the public wishing to make a public comment would you like to make a public comment thank you very much name and address please uh good evening my name is Michael J Ash I'm an attorney I represent Franklin at Middletown LLC the owner of record of the uh the properties 1045 23 and 4 subject of this ordinance I'm with the firm Carlin Ward Ashen H and Flor Park I believe uh moving forward with this ordinance to acquire the properties or to get the authority to acquire the properties as premature the uh due diligence that the township is engaging in in fact continues tomorrow morning where your Consultants Princeton Hydra will continue their investigation of the property for the alleged acquisition for open space purposes now my client uh the owner of the property knows conclusively that there are minimal Wetlands on the property we have an Loi from D it's not R Loi it's actually dp's Loi they field verified the wetlands they are of limited resource value and the property can be developed with multif family housing in satisfaction of the affordable housing obligations that Middletown is not currently compliant with allegedly the floor is mine sir my client has a proposal to build 408 Apartments I see the next ordinance on the agenda is to borrow 1.8 million dollar for property acquisition if that's for the acquisition of these properties you're going to have to raise that that limit because our appraisal is $15.5 million $45,000 per market rate unit so again moving forward with this acquisition tonight is premature and in light of the pending Builder remedy suit and docket Mammoth L 12423 this Council should table the ordinance all together thank you on the advice of council I will not respond to any of those uh statements any other member of the public all right committee M Clark mayor typically I'm uh I pass on comments but uh I just want to go on the record saying that I'm damn proud that I voted yes on those two uh Bond ordinances regardless of the intimidation that just attempted to happen that's all I got thank you you Seno nothing at this time mayor thank you all right committee woman Katz nothing mayor thank you Deputy Mayor I'm G to pass please thank you all right uh just got back from the Jersey Shore partnership which is a unbelievable organization quickly went there had to leave early but a great organization I'm proud to serve as a board member on uh advocating for the replenishment of our beaches um uh here in Middletown and and all up and down our Jersey Shore so proud to congratulations to them they had some excellent honores on tonight um uh Lauren goldar and company that was on there um and well certain definitely members that are are certainly well-deserving and uh I'm sure all of them are committed to preserving our open space in Middletown and preventing overdevelopment uh and protecting our Shores so um we'll see if they uh if they uh abide by that logic so um all right with that being said any member of the public wish to make a public comment we ask that you state your name and address for the record we ask that you keep your comments to five minutes at four minutes I'll let you know that you have one minute remaining any member of the public wishing to make a public comment Melanie come on down W this is fast um hi Melanie eler uh 43 Green Tree Terrace in Lincroft um I'm here tonight because of the um situ situation with this microphone okay com I'm sure so um the situation on 520 um we've had three crashes in the last month today was a very severe crash I was hoping Chief Weber was here he sometimes comes and um I would like to hear his input and um thank you for um offering to get the police crash reports um we are very very concerned um people are very upset um I think it's the speeding the weaving the In-N-Out and of course this is a County Road and we have spoken to the county freeholders we'll speak again on Thursday at their meeting at 1 um you know so it's really in their Court to do an analysis do uh the crash studies and um just try to figure out what's actually happening um it's very dangerous the left turns are getting harder to make um you know I don't know what the pattern is it it doesn't make sense why it's it's happening um worse now maybe there's more just more traffic more cars uh it's so it's really warrants an analysis from so many different um government bodies and and people so that is why I am asking you and I've asked before and I've asked the county before to um make a resolution to reinstate the 520 taskforce in um 2000 this government body led by Joan Smith the the township committee um made they made made a resolution to bring together business owners residents County um Township Police uh to meet on a monthly basis to analyze you know what's happening um on that corridor from Brookdale all the way down to the parkway um there's just been a lot of growth uh there's been a lot of development um you know tonight you um you know move forward with the um housing with Avalon uh so you know we're just it's not just looking to the Future it this is a 25y year problem I know with the two-way Acme road that that should help in you know the center of town but but this speeding on 520 um is just out of control and I I think we just need to get together and try to stay ahead of this before we have more um density more more traffic um so I'm I'm looking for the township to talk to um Joe Ator um Mr Arnon see if uh there's any way that we can reform this group that was um just so instrumental in looking at some of the past studies some of the crash reports and coming up with um you know what our concerns are and how they can be resolved or moved towards you know a safer environment so what are your thoughts on that I will be happy to speak to director arnone um I was just with him U but happy to talk to him and if he would like to do some type of joint committee between the two agencies to and and governing bodies um you know I I don't see a problem with well we're looking for something broader than that with lvga members business owners residents you know maybe whether it's an open Forum you know people can make comments or if it's are you looking for a committee a working committee a working committee for that Corridor as it was done in the past in 2000 it was um active for several years and made a lot of changes in the downtown what why did it dissolve that's a really good question I think because some of the plans that were presented by the county kind of got dropped um you know with we wanted roundabouts um you know maybe you know I'm not really sure it was It was kind of predated my time on the on the board so it really doesn't need to be created it's already been created I don't know I have the resolution here you could look it up and see if it somehow was dissolved I don't think it was I think it just kind of people weren't able maybe maybe it just kind of went by the way side know fizzled fizzled that's probably the right word yeah let me let me talk Tom okay all right do you want my resolution sure you can give it to Laura we'll take it okay good all right um and um and also I just want to thank you for um uh I think it was Amy srono uh set up a meeting between the lvga and bfj the um master plan um uh professional planners uh Mark frer was wonderful uh very knowledgeable very helpful answered all our questions and you know gave us feedback back um so you know we're very appreciative of that and um we'll miss the meeting Wednesday because that's our board meeting but um yeah we do have a master plan meeting it's Wednesday yeah but what time is it at s at senior center yeah yeah so um so thank you I appreciate it no problem thanks Melanie any other member of the public wish to make a public comment okay seeing no other member of the public stepping forward move to close the public portion and we are going to be adjourning to Executive session um do I have to give a time frame or I can just for 10 15 minutes tops okay um so we are adjourning into executive session I'll just read a uh resolution one moment okay this let me load it up here all right at this time I'll read a resolution enter executive sessions whereas the open public meetings act provides that the town committee may go into executive session discuss matters that may be confidential or listed persuading to njsa 10 call 4-12 word is recommended by the township attorney and administrator at the committee going to Executive session to
