Shutesbury Select Board Reviews Accessory Dwelling Units Amid New State Law Changes
- Meeting Overview:
In the most recent meeting, the Shutesbury Select Board addressed updates to accessory dwelling unit (ADU) regulations prompted by changes in state law. The discussion focused on the compliance and requirements for ADUs, the implications of state law adjustments on local bylaws, and the treatment of special permits for residential developments. The meeting also included deliberations on a special permit request for a nonhabitable shed and the procedural requirements involved.
A considerable portion of the meeting was dedicated to understanding the new state law’s impact on ADUs. The law now stipulates that the maximum allowable size for an ADU is 900 square feet, a change from the previous 800 square feet limit. This adjustment prompted board members to seek clarity on how these measurements should be calculated, particularly when considering elements such as knee wall attics. A state regulation, 760 CMR 71, was referenced, which outlines the calculation of gross floor area, excluding certain non-habitable features. The complexities of these calculations were acknowledged, leading to assurances that the building inspector would verify the final measurements for compliance.
The board further discussed the relationship of the ADU proposal to existing zoning regulations, specifically its proximity to property lines and the lack of visibility from neighboring properties. There was a consensus that the natural barriers surrounding the property would minimize any potential visual impact on neighbors. The need for a survey to finalize the permit was emphasized, and an extension was granted until August 29th for this purpose. The board agreed to draft a permit, with a review scheduled for a subsequent meeting.
In addition to the ADU discussion, the board considered a special permit request from resident Huckle May for a nonhabitable shed within the front setback of his property. The board had received three supportive emails from neighbors, and members conducted site visits to assess the proposal. May argued that the proposed location for the shed would clean up an existing embankment, avoid interference with his septic system, and remain less visible from the road. He also noted that much of his property is restricted by a stream flowing into Lake Wyola, limiting placement options.
The board acknowledged that the application largely met the special permit criteria, focusing on whether the structure was detrimental to the neighborhood. A member raised a concern about the absence of a scaled plan detailing the property lines and the proposed shed’s location. In response, May offered a hand-drawn sketch and the original property survey. The board decided to leave the hearing open until a scaled diagram could be submitted, allowing further review without prematurely closing the application process.
The meeting also included procedural matters, such as the election of officers, with Jeff being unanimously elected as chair and Michael Pill as clerk. Additionally, the board processed the approval of minutes from previous meetings and set the next meeting date for August 21st at 4 PM, where further discussions on both the ADU and shed proposals are anticipated.
