Thursday January 30th it is 6 pm and we will do the Pledge of Allegiance and tonight it is led by Mrs biller I pledge aliance to flag of the United States of America and to the stands na indivisible liy and justice for all person to the New Jersey open public meetings act adquate and electronic notice of this meeting has been provided by posting on the bulletin board in the Beach Haven municipal building on the burrow website and mailing the same to the beach Haven times the Asbury Park Press and the Press of Atlantic City Miss Anderson here Mrs B Miller here Mr mcaffrey here miss Snider here mayor Lambert here I have uh January 2nd 2025 reorganization meeting minutes for your approval without formal reading I make a motion to approve the minutes from January 2nd [Music] okay all in favor thank you uh all matters listed under item consent agenda are considered to be routine by the municipal Council and will be enacted by one Motion in the form listed any items requiring expenditure supported by a certification of availability of funds and any item requiring discussion will be removed from the consent agenda and discussed separately all consent agenda items will be reflected in full in the minutes resolution 41 authorizing the execution of a shared service agreement with the county of ocean for participation in the prosecutors program the fatal accident support team resolution 43 awarding a contract to GC Contra concrete LLC for the 2022 and 2024 Community Development block grant projects which include handicap accessibility improvements at various locations 44 authorizing participation of the burough Beach Haven in the state development and Redevelopment plan cross acceptance process resolution 45 authorizing the execution of an agreement between the county of Ocean and the burough of Beach Haven for the cdbg Community Development block grant 2024 that should say 2024 project um handicap accessibility equipment and improvements various locations 46 six is authorizing to advertise for bids for the 2025 Water and Sewer Department Parts 47 awarding a contract to Mid-Atlantic Waste Systems for the 2025 garbage truck refurbishment project and finally 48 is reappointing our Emergency Management officers William trom and Beverly trom is there anything that anybody would like to remove or discuss on the resolution list not no all right seeing none is there a motion to approve the resolution I'll make the motion a second Miss Anderson yes Miss B Miller yes Mr mcaffrey yes Miss Snider yes mayor Lambert yes we have approval of bills this evening in the amount of 3,172 58032 35 cents I'm sorry everybody have a chance to look over the bills yeah yeah a lot okay well yeah it's funny that the trash truck one the refurbishment I looked at that it's a lot of money but then I remember two years ago when I asked about the cost of a new trash truck which is like two years ago was 350,000 yeah you know so of course that adds up yes is there a motion to approve the resolu I'm sorry the bills so moved I'll second Miss Anderson yes Mrs B Miller yes Mr mcaffrey yes Miss Snider yes mayor Lambert yes okay we have three three proposed ordinances the first one has come from our land use board solicitor Eric reso um he has sent us a draft [Music] um ordinance requesting that in chapter 120 under licenses that an appeal uh to a denial for a mertile license instead of being heard by the land use board would be heard by the governing body um he's saying that uh section 12-5 of the burough code which indicates that appeals from denials of mertile licenses goes to the Joint land use board and that in his opinion that needed to be changed that the land use board does not have jurisdiction to hear this type of appeal under the municipal land use law the only appeals a land use board can consider are from a zoning officer's denial of an application for a zoning permit which is something the zoning board deals with Mercantile license appeals should go to the Govern body and our solicitor Bruce um also agreed that the governing body would be the more appropriate body to make this determination so I have this draft all right so that'll be um yeah presented to you for introduction at the next meeting um the next one is a proposed ordinance on zoning definitions unfortunately even though we've went through it with a fine tooth comb multiple times uh we did find an error in the definition of an accessory bill building or structure residential um that these buildings inst structors shall be calculated in building coverage and floor area ratio the end floor area ratio should be struck from that paragraph it should be um calculated in building coverage period so we would like to make that change and also in the meantime we've uh realized another need we need a definition for retaining walls um so Phil Reed our zoning officer has provided us with this definition he would like us to add a structure that is constructed between lands of different elevations to stabilize the surfaces prevent erosion Andor prevent protect structures retaining walls in the stormwater Management Area shall be designed by a licensed design professional to prevent flotation all retaining walls must be constructed on the same lot as the Improvement requiring the retaining wall and are counted towards lot coverage and impervious coverage for definition purposes bulkheads along the body of along a body of water are not retaining walls Jamie have you had a chance to review that definition yes I have you feel it's appropriate yes I I feel it's appropriate Phil is a master at at wording and he he really knows his stuff and again like fully editing the zoning chapter is always a work in progress we're always trying to kind of you know know Clos loopholes building codes change this changes that changes so we're constantly trying to get you know a final draft and it's always going to be always going to be a work in progress and these little things are are really important it keeps the work in the office flu more fluid too with all the building that's going on so okay fine all right thank you yeah thanks again because you spent your whole summer on this and many months since so thank you um the last proposed ordinance that we're we would like to present to you is an ordinance amending um the police section it's section Chapter 30 uh it dictates what the roster of the police department will look like we do have a retirement coming up um Captain meow will be retiring in December of this year and we do have a current exam list sitting um and Lisa Fay is at the top of that list list unfortunately for us that list is going to expire in um April May of this year and we would like to make an appointment before her list expires so in order to do that path of least resistance is to temporarily amend the ordinance to allow for two captains um and then this change that we're going to propose has a sunset provision and at the end of the year it will revert automatically back to one captain this will allow us to point her into this position before her list expires um Jim did you want to come up and just touch on anything I may have [Music] missed and and um Lisa correct me if I'm wrong she's agreed to take this appointment while Tom is still captain at no increase in salary right y okay does anybody have questions for the chief about this can you just clarify what it means when a list expires I don't so they take a test that it's good for a three-year period and then at the end of that three-year period you have to take another test got it she I understand she would have to take the next test which then um she it be it would be it would be quite a while before um the results of that test would come out so okay we'd have a we'd have an open Period of time where we wouldn't be able to fill that I understand so and then this period of time s um Sergeant Fay to uh come up to the responsibilities of what the captain is doing right now so and then I'm sure he he'll be taking off and doing stuff you don't want to sign him with stuff right before he retires either so kind of yeah we're a civil service community so um all of our promotions and um open hires have to go through a competitive examination process or a promotion examination um and we hire by the rule of three there's a lot of rules and regs for a civil service Community like ours I have no problem with I think it's thank you good idea thanks Jim so if we don't have any concerns about those we'll present them for introduction at the next meeting thank you that's all I have okay um moving right along we will now open the meeting to public comment we always start with people in the room nothing for us have much to say it's you know we're deep in uh winter really just not much happening in town except last weekend was the Beach Haven Elementary Schools production of the wizard of vase which was amazing and it's always wonderful to see how all the different community members come out to support the school it was a packed both both night Friday night and Saturday during the day and it was an amazing performance thank you for the surf light for allowing them to use the facility for free of charge just a great way to have the community uh together like that thank you Mr mcaffrey yes we've got some uh good news in reference to the wind turbines um apparently shell one of the big backers of the wind turbines might be backing out of the project we don't know for sure but we still have to be diligent in our uh opposition to any of these projects thank you Mrs Snyder thank you for coming um and thank you those on Zoom um there's not much to say you know we're happy that we're going to be turning the calendar page to February that much closer to the turkey dinner which s sort of kicks off the spring I think um just everyone stay warm and be safe and we'll see you next time thank you Miss Anderson a couple of things Wizard of Oz was great if they ever do it again you have to go everybody anybody it was awesome it was in the sand paper but um Jamie mentioned it at the last our last meeting yeah they do it every year at the end of January there's always um a production by the elementary school there was parts for every age from the little preschoolers on up it was awesome okay but I did notice in the Sandpaper in last week's sandpaper there's a little article that Jetty Foundation is doing some fun fundraising for the California fire victims so um whether or not you personally had anybody affected um it could be worthy cause to help spread the word and help these people in California I know there's a lot of people hurting everywhere but that's just one thing Jetty is Grassroots and they do a good job then um I wanted to just mention I don't know if people know that we have artwork in the hallways at the burrow from Pine Shores and it's on this way from January to April and it's always uh refreshing to come on in and check out you know the artwork you might see some people's names up there that you know and um stop in and say hi to your bur officials that work hard for you every day and pick up your calendar that wasn't mailed this year come on in that's it from me thank you um really nothing else to say um just to piggyback a little bit on Mike's comment when I first got the email today about the turbines I was over the moon and then I reached out mayor manini had sent it to me and I'm like does this mean but well you know it's a good sign and then I reached out to Dr Stern and he said hold your horses it is a good sign but we can't let up so I mean I was hoping we could stop spending money on lawsuits but apparently that is still necessary to keep the pedal of the medal and force all these federal and state agencies to do their due diligence which they haven't done to this point and that is going to be our best shot at finally putting
