municipality are complete after approval tonight they will be sent to the state and uh just to let you know there are our is a possible score of 46 A2 we received 42 A2 which is 92% and uh you need a minimum of 35 so that guarantees us 100% uh funding by the state next year which is really good uh and so all reports pension reports benefits reports chapter 159 resolutions everything has been forwarded to the state along with the 23 audit and uh now we're working on budget transfers that will happen in November and uh we've already had two meetings for the 25 budget uh on a different note uh I've been working with Governor Murphy's office and NJ doot for uh we actually have a meeting tomorrow morning at 10: here and uh what they're doing is dedicating the new overpass off of 42 uh for anden John Elliott who was uh killed by a head- on drunken driver through the hero campaign and uh he was on the way just after graduating Naval Academy so uh November 7th they expecting around 75 people uh and it'll be held uh at the Belmar little leg because that's where the new overpasses during it putting it his name so uh again it'll be about 75 people Governor Murphy should be here all of the TV channels uh NJ doot as well as multiple assembly Senate to honor this gentleman uh that's all I have ch thank you Ray did you mention a time on that the uh ceremon tentatively is at 11: a.m. 11 Avenue and Warren Avenue roadway Rehabilitation project has been completed uh leafing season has begun so we're going to start um from from B road to barington now next week will be from B road to job tomorrow evening uh Trunk or Treat will be held between 6:00 and 8 at the rec center if you would still like to participate and have not signed up yet the gates will open at 3 :3 to 5:30 you can still bring a car in um that does benefit Belmar believes as Billy said uh for the underprivileged kids in um belmare the police department always does a great job with that also so if you're able to come please do rband will be sold for $5 um a person if they want to uh go around and get their treats and again that will benefit belmare believes uh Christmas parade will be held December 1st at 6 mayor I have the statistics for the police department fire and Ems for the month of September for the police department uh they handled 1157 calls for service they conducted 74 investigations there were 69 arrests made in the month of September and they investigated 28 motor vehicle crashes for the fire department for September uh responded to 80 calls year to date they're at 823 calls uh Ems for the month of September 262 calls and to date 2584 calls uh the U Bureau of fire safety conducted fire inspections 17 of them in the month of September there were life Hazard inspections and eight non-life Hazard inspections I just want to thank both departments Chief Pera and dorenzo for uh all their hard work and uh keep up the the work thank you thank you Craig under my report I Echo what Joanne mentioned about the Fall Festival uh what a great crowd we had so many people and it went off perfect with the police fire um and we'd all like to give special thanks again to uh all the guys excuse me my name is Blake sheski 456 Dy Road Belmore New Jersey um I'm here today in regards to a uh conversation that I had earlier in the month with Mr Howard long um I myself and Shane Merz have brought a lot of the residents here of belmare to basically if you can explain to us um and to them about exactly what the situation is with the property say the address please I'll explain why in a second it's actually for your benefit I understand but the the the property that everyone's here for if you could explain the situation and what you told me what I what I can I can certainly tell them what I told you first of all I also spoke to Mr Merz so on ph phone and I want to appre thank you both um for being concerned for being polite for being courteous means a lot and it makes me want to help you thank you um and I appreciate that not a problem is that what I think it is behind you it is how are you it's good to see you she's a special guest of mine there you go very very nice lady um so got two issues going on and I'm going to talk generally now one is with respect to sober living facilities okay so the state created um a law relating to the placement of individuals who have drug or alcohol problems into what's called sober living facilities corre and when they did that they said like most most of the regulations the zoning regulations or the the land use regulations it's the municipality that has to say as to what uses can go there we have a lot of input on what can be done correct in the sober living situation uh the state said we're going to make all the decisions we're going to we're going to license it we're going to oversee it we're going to monitor it and inspect it we're going to make sure it's in compliance with the law um there's certain requirements in it for example it there can be 10 individuals in per unit um there has to be a full-time individual who's living there um these these that's the the general rules of if they're going to make any changes or get any construction permits that require inspections it's got to be done by the Department of Community Affairs not our construction official we don't issue a zoning permit it's all controlled by the state and and and if there's complaints about what might be going on and I can tell you I complained and I sent uh in conjunction and speaking with the chief who I've been working very closely with um a letter on August 6th where uh that was fairly lengthy setting forth a number of complaints that the burrow had okay and a lot of the information that you repeated when we met a week ago correct um and I had advised the state of art the the governing body's concerns and the residents concerns in general they were going to do an undercover investigation I can tell you that now because it's over because uh Monday I sent another email to Mr Bernard Raywood correct and I have his information here Chief could I give you this and if anybody's interested because this is the guy and I think I gave you and chain the information for this gentleman but it's right there if you want to have it um I emailed him and said you were going to go through this process you're going to get back to me and set up a meeting what happened so today around 11 or 12 I think I sent it to you right away or you were included on it mayor um they said give us some dates we completed our investigation we're willing to meet with you I don't know that Chief just got up by email and I was in Atlantic City at um a seminar all day so I just got back into town recently so I was going to get together tonight um with council president willhelm the mayor and the chief to get some dates to be able to email them tomorrow so I can find out what's going on from their investigation okay and then Express to them what my concerns are so that's that's what sober living that's what sober living is all about now I'm going to talk to you independently about a separate issue which is Megan's Law and Megan's Law notices correct so um Megan's Law as you know was created for Megan canka who who was abducted and killed by a sex offender correct and um there's a strict guideline and she I have those guidelines for anybody that may want them it's very helpful document by the way thank you and and so what happens is when a when someone who's a a been charged with a crime that's determined to be uh a sex offender crime they have to voluntarily report to the town that they move into once they move into the chief of police and then the chief of Poli police takes their information and he sends it to the prosecutor's office and they're and I'm going from the Lesser to the more severe you're either going to be the prosecutor's office will look at your background what you were charged with what you did fact that the court said you're going to be subject to Megan's Law notices and there's tier one tier two and tier three correct tier one is the lowest level tier three are not good people for the most part um when we get when they they then advise the chief whether it's a tier two or tier three then the chief and only the chief or his direct design based upon whether it's a tier one tier two or tier three has certain responsibilities under the law to notify youth groups notify schools notify neighbors within so many feet of a dwelling so if there's a property that has um sex offenders living there there's no one here that can give a peep and I'm going to read you one piece of the guidance that is really helpful that you'll see and the information it says if someone moves into my neighborhood will I be informed and how will I be informed and it says you will get personal notification for highrisk tier three offenders that you are likely to encounter in your neighborhood a law enforcement officer such as uh police officer state trooper an investigator from the County prosecutor's office will come to your door and deliver a notice to an adult member of your household if you're within that area again this all happens through the law enforcement component of it not the government side of it um many years ago a number of towns passed ordinances that restrict and limited these types of facilities and it was blown out all those all those ordinances were tossed it was determined to be illegal the state L took precedent okay the next question is perhaps the most important may I share this information with my friends now this is the the Attorney General of the state of New Jersey in conjunction with the 21 County prosecutor's offices giving advice but what you can and can't do so this one says may I share the information with friends it says you may share and discuss the information you have received with those residing in your household and with anyone caring for your children at your residence in your absence you may not share this information with anyone outside your household and not in your care you may not copy or post a notice law enforcement will notify all appropriate Community member schools organization residents in businesses so the reason I stopped you mids sentence is because if you would have went through with that technically not that anybody the chief's going to come over and put you in cuffs but technically you would have violated the law and I didn't want you to do that I appreciate that I don't want my client to do that and I don't want to certainly do that which Miss Stewart certainly knows you know we have a certain obligation to conform with the law that's what we're doing here so I'm talking about those things independently so there's a question of whether or not in my mind and and and this is really a question from the state are Megan laws offenders permitted to be in sober living facilities that are licensed I don't think so it talks about people with drinking problems and drug problems so if there is a meeting it might be a question that I would ask and isn't what isn't that a problem yes and what can we and what can we do about that problem but I can only get that relief as you can see from the way the state's basically taken away all local control we love local control we love to be it's called home rule in New Jersey and we love it we love to be able to control the things that happen in our town right having grown up here I love the fact that they these folks do wonderful things to make sure things get done for the town in these two incidences the state has said no way and the reason is cuz you'd never do it are we in favor of this I can tell you raise your hand if you're in favor of living next door to someone who's got a Megan's Law conviction there's nobody's going to raise their hand nobody up here is going to raise their hand but they do take an oath and they raise their hand at reorg and they swear that they're going to follow the Constitution and the laws of the state of New Jersey so when I tell them that they they can't speak about this they listen because they abide by the law it's not to say that I'm dropping anything I'm not taking this seriously I'm pound in the state the chief has given me a lot of more information to supplement before we meet which I intend to do and I appreciate all his hard work that he's done from in helping me um be able to make my case to the state so what'll happen from here is once I get some mutual convenient dates we'll set up a zoom call with uh Mr Raywood and his department and his staff okay and we'll have a discussion as to what happened with the investigation real quick um because I since police chief per is here I want to ask him um you said that the investigation ended on Monday was there any notice they said recently recently excuse me I apologize no problem I said that they I wrote them Monday saying what's the status and today I was noticed that their investigation recently concluded whatever that means so from public information that is available uh the tier 2 is what we're working with where people were notifi where the people in stuff notified about that so anytime a notification is done it comes directly from the Cy County prosecutor's office okay they prepare the packets okay our packets are never delayed more than 48 hours of being picked up they're delivered that week we never we never wait um we document every single notification that's made um understand there's always a delay okay I will not deny that there is delay coming from the court but it's not with my department okay docent chief chief um you speaking abstractly hypothetically if someone you get information that someone's moved into town and not report hasn't reported to you or or the department take action correct so so fast I can tell 27-2 and you Char and you charge them right Chief let's assume hypothetically if someone did that you would charge them and they could be presently hypothetically pending criminal charges against some folks correct that could that could be a thing correct okay because the reason I ask is because we have some guests here that are from the mosque and they had they had told us that they weren't notified about it that's why so that could be but it could be because of the tiering like a tier 2 and I don't know what the specific rules are cuz I never see it we never get involved in it the chief gets it from the County prosecutor's office and says this is where we plac them on the tier guide and these are the notices that have to go out I know sometimes in in tier one and tier two they or tier two they may or may not get some people may or may not get notied it might be 200 feet it might be 1,000 feet you know of of a particular residence where other residents are notified it might be just schools and you know uh Civic organizations that are notified so it it's all We're the Chief only is advised who he should notice the chief law enforcement officer in this county is the camon County prosecutor who's your boss uh on all things and they're the ones that tell you how to who to notify and in what method correct so the okay yeah because so in this so in this situation it was a County prosecutor that gave you everything as far as so anytime since I've been here 26 years we pick up a packet it's in an envelope with with the sheet on the front who you're delivering it to we have you sign off on that we then scan them back and send them back aof of what's delivered per their you know per their order um we don't decide who we deliver or not deliver too okay well I'll just say this I got a lot of questions to ask to that County prosecutor because um according to what I have here and what I've read before about tier 2 and tier three um offenders uh schools and Community groups are um should should have been notified about it and the MOs clearly is a community group and they weren't notified about it so if you're saying it's coming from the County prosecutor then that's something we'll take up with the County prosecutor but I just want to make that aware because you know they're very upset about this and they had no clue about it so um but thank you for taking my question we completely understand unfortunately we're really handcuffed all right on what on what we can do weird we cannot I cannot sit here right now and say there are and I'll just give the address I grew up at 1116 Troy Avenue okay okay I can't say there's someone of this nature at that address okay um and I only picked that address because I used to live there um I I'm not permitted to say that the chief's not permitted to say that I understand the mayor's not permitted this so we just unfortunately we can't or we've broken the law that's fine I just wanted I just wanted again to on it yeah I just want you wanted you to relate everyone here exactly what you told me and to try to figure out because I hadn't talked to you Mr Perna exactly why the mosque wasn't notified about this situation but I appreciate your time and I appreciate answering question and that answer would would be best place if there were a situation where they should have been noticed that would have come from the County prosecutor directly without the chief's you gave tonight uh you eliminate a lot of my questions there's absolutely nothing the people can do you can so for sober living facilities if you have a complaint you can call this guy okay over and over and over again you have considered a sober fac sober facility if there's not a sober person I mean a person with an app there they're they're tested right but they weren't that was they weren't alcoholics they weren't druggies these are convicts like murder whatever it might well I'm not going to I'm not going to connect the two but it's not something that I'm not well aware of and it might be the lead question out of the box wouldn't you think yeah and the other problem that I have is like a lot of people are coming to be like oh you just need to be a parent you just need to teach your kids to look after these people they actually say that in that in the citizens guide the Megan's Law they said talk to your talk to your kids and have them stay away from the I literally printed out all the seven sexual offenders the very first week I found found out about it yeah the next week line the next week they're not the same people they changed so how can I protect my child if they don't know who's going to be in there dayto day I mean this is a halfway house this is this isn't a permanent facility it's a halfway house where in my opinion might give them more of an opportunity to do damage because they're going to be out and gone and that's 100% fact I can show you uh screenshots of who the 10 or seven offenders were and the very next week three of them are gone and three more people are in there like that's scary it is and if that's the case it is and and I appreciate Mr Merz being a member of the real neighbors of Belmar to you saying this is not attacking Our Town Council or mayor it's about us and protecting the residents you're trer words were never spoken and I appreciate you framing it in that method some people tried to make it political this is about us coming together as a group it's not and all of you know me I get well with all you Democrats don't say that open don't say that in front of M Stewart Z what about the town meeting you uh town meeting I know you said Poss don't yet I don't I got to have that meeting with the state and see if I can fix it I don't want to go to a meeting where it's broken if I can fix something okay trying to fix for face it as we can't direct people no you can't tell put on their door knob or not we can give them that opportunity to participate but we can't force that participate in that their it's their property it's their First Amendment right to put on their door whatever they want to put on their door okay it's a good idea from the point of you would expect that those that are welcoming are going to be lit up and have decorations anyway the it does legally can can turning it we're not taking it like we can't enforce it in any way no probably all right another question do we have I'm going back to one of the things you said do we have anything in place you're you're saying that7 districts got shot down on having restrictions on how close a sexual offender could live with within school district school district oh there there's um because everything I read said in 2006 I think it was 107 or 117 districts put in and it's current today anywhere from 1,500 to 2500 ft from a school um a a daycare or them New Jersey but but it's it's there it's clear as day that somebody bought it for 325,000 off of John bami God Rest his soul okay bought off of his daughter one month later sold for $55,000 so nobody else could buy it and to pocket $130,000 so these are things we all need to look at and what can we do to prevent this from happening again that's the biggest question you can not going to like of council so at the end of this summer I had an opportunity to speak here on behalf of Hall AV and what's occurring with the tractor trailers um unfortunately nothing has changed the truck drivers are continuously driving reckless and in an illegal fashion more specifically using hallab as a commercial Trucking route using our only sidewalk as a commercial ramp infinitely idling their trucks and per usual the speeding at your convenience uh please see the photos I have provided to to understand simply what's going on back here our streets sidewalks and houses are being destroyed uh by these trucks as the rest of the township peacefully sleeps imagine waking up at 3:00 a.m. to a tractor trailer going down your street at 40 mil an hour and jumping the sidewalk shaking your entire house with your kids inside it's terrifying one of the photos even depicts tractor trailer tire marks from their property onto my driveway ramp they are on our properties at this point before you know it these truckers will be inside our houses um I'm not raising awareness because I don't like the tractor trailers or the trailers are an ey sore uh has nothing to do with that um what is going on Hall AV is dangerous and illegal at bare minimum we have recreationally zoned land being used for commercial industrial purposes with Reckless individual ual causing Havoc towards the residents this doesn't include all the traffic and EPA laws that are violated every single day what an when an entity is breaking the law there shouldn't be any negotiation period corporations need to be held liable just as individual people are I'm sure this entire panel would concur uh the purpose of this dialogue today is to inquire on the status of the revision of the ordinance restricting the trucks on Hall AV also um just a question I guess to get the combos started does the township have an action plan based off what the joint land use board decides next month um for example if it decides uh noticed that they were coming in because I've been wondering why they haven't no I I've been in close contact with um I'm blanking out on her name I've been emailing her Tina Tina yeah Tina Johnson right um she said says they're in the process of like developing an application but they haven't filed I think they're just buying time they're just milking this thing so I I I agree with you and I've told him as much within the past week that this is nonsense we met with you guys on this a long time ago and I got nothing right so the direction given by me and taken by our code enforcement and our zoning officer who is away and is in the back of the room can hear me S them s them s them they are parking trucks on recreational property they own that property right but it's Zone Recreation right so um there's a couple of plans that have been floated around one is dedicate most of that property to the town and then we can use it for parking at the rec center right and for like over crowding events when when we're really going to pack it in which is in reality what's going on basically exactly right and then and if you are going to set up a very limited capacity with fencing with buffering with trees with a curb cut with certain hours of operation with a ramp they get with a ramp exactly they get before our board then you say they can't negotiate but if I get I can site them or I can get them before the board and maybe solve your problem to a significant degree can't make it go away understand but to a significant degree I can solve it because they will have to put buffering they will have to put land Landscaping it we'll have to put a fence up so you don't have to look at it we can restrict the hours of operation that they're they're moving trucks in and out of there so when that goes to make the turn and the light shine right in your kitchen or living room I you know I'm sure it's awful I had to put up a fence around all 8,000 square ft of my property just to get a little bit of enclosure I have two small kids one in the oven you know and I can't I can't have my boys just free roaming you know and and those trucks are literally feet away the other thing we have we're introducing an ordinance tonight that um restricts any truck traffic of 8,000 lbs which is would be a tractor trailer except for the and some some bigger trucks that do make deliveries except for a delivery it goes from uh the industrial park up Hall to Walmart and that's it so the only trucks that should be coming up there are not trucks that are trying to go all the way through Hall once we get this La next month we'll adopt this and it'll be in effect then we'll put up signs no truck traffic we made it so that it's not a truck route we specifically called it out as not being a truck route there's a sign there anyway I mean they ignore it every time they drive past it but then when I put the ordinance on the on the books the chief can have someone sit there and if someone blows through that he can he now has an ordinance to site him under right so that's being introduced tonight and we'll be adop the next month okay and um councilman willham was a big help to me with his background knowledge on the police force helping me put that together yeah I greatly agree had one thing to that I'm sorry goe so the on the police department side um they did Issue an enormous amount of tickets out there when they came to court the tickets were dismissed by the Municipal Court uh because of lack of verbage in the current ordinance and that's changes that we're making tonight will should remedy that problem so exactly I appreciate the the transparency so Ju Just so I can uh it's been a long day at work if I can just cram it in my brain it's basically um currently there's an ordinance being proposed that perhaps would take go into effects next month that would provide clarification um regarding the verbiage of the trucks being allowed to go up and down on Hall F in addition to that that at some point they're supposed to like build some sort of uh barricade or some sort of fencing or something to enclose that something that actually looks nice it's Kentucky Derby the the the dirt from the side of the sidewalks have mixed with the gravel it's just like mud I know the area very well it it's it's absolutely hideous and they'll have to either pave it put Stone down do some whatever the engineer would recomend men would be the best surface to put down so that dust and dirt's not KCK you know how much money they probably make I mean they don't care they're just cheap cheap cheap you know whatever they can they don't want to spend money back there they they have what they have and that they're not going to invest anything they're going to milk this for what you know something funny sure they as if they could expand their use with the holidays coming up yeah you know what answer they got no no yeah expand their use not good because they get so busy around the holidays they got do a lot of truck shifting around and they right now we got them agreed to two stacks in the back right that's what they agreed to do before they would come in so we tried to get some interim relief they triple stack them yeah they're not supposed to I know they're not they're not supposed to when they come in we'll be able to control things like that as far as the ordinance goes you when the Well when the when when they come into the planning board which is something different the land use for and I would encourage if you're within 200 ft you'll get notice I strongly encourage you to go here or even leave your name with Tina and say when this application comes in would you be kind enough to let me know absolutely and I'm sure she would do that she's very courteous that way okay um before I because you should be here go to the planning board and speak your mind all right most of my neighbors back there are like senior citizens and they're not up to date on technology they don't keep up with like the burrow and things happening every month and I'm a senior citizen be so are my parents you know but some some people are as old as your dad thinks Mount Trashmore mhm what are they doing with that is that under going to be developed it's going to be developed as uh warehousing but we have to put in a bypass road as a condition of being able to develop it which takes all the traffic coming out of there either mostly to the right if they're heading there's going to be direct access to 42 and if they come to the if they go out and make a left it'll go up the creek road but like up near the curve a little closer which is right where I'm at on Booth Drive so yeah no no you're far away from it not not you're going to say it we we have told them from day one we like the fact that you're going to clean up the land and they have clean up the landfill get us release from liability from the um EP to clean it up give us a $25 million insurance policy in case anybody ever sues us the Barrow is protected so we don't ever have to raise your taxes because of that dump that we're getting sued and got to pay um they're building and I got to tell you there was disagreement among Council on this on the plan they're paying um they're making a a um a tax payment for the next 30 Years to the burrow which is nearly $30 million once they get occupied so we're taking a space that was contaminated a decade ago and I know it seems like it takes forever and it has taken forever I haven't been here 10 years but it started before me well this is about the third time we're close to Finish Line we are the third time I've heard it was going to you know at one point it was a Disney project another time it Wass yeah okay that was the your hard work on it I'm in real estate I get serber living homes I understand it I have an 11-year-old who is anxious about driving by the property walking by the property you know on his bike take use that with the state maybe they'll listen and as a realtor you know that if you're selling a house you can't tell that person you're selling a house to who might be living next door corre in fact you're legally prohibited from saying that aren't you 100% yeah so there are ways to potentially uh you know through our ordinances um try to protect against it I mean when you're dealing with sober living you know they give the license to the owner and then they go find a property and then they go go occupied basically so um I did a lot of work people yeah I did a lot of work in Philadelphia they used to restrict they wouldn't enforce it many times but they had an ordinance in a certain area with three unrelated parties no more than three unrelated parties are able to lease a property okay so to to guard against rooming houses in in Philadelphia things like that I don't know if we can do that here I don't know if it would protect against uh Megan's Law you can't really protect against Megan's law but from a sober living standpoint this is something maybe to to try to dig into with the state that you know if we can put ordinances in place to protect against 10 people living in a house that are unrelated parties yeah I mean it's in Philadelphia so it's it does right so so you know as we've driven by this week they're digging erress access's 11 in one because they gave them a waiver for the person State gave them a waiver for the person who's supposed to be there full time yeah 100% And and you know you go by this week and they're digging egress access in the basement which is means adding more liveable space Construction in the basement because right now they're living in the living room to to live on the right and the left of the house and all that is is putting eest access so you can have a bedroom in the basement right that's what it is it's exactly what they're doing yeah times two you as a fact that's what they're doing you put two people in a bedroom down there right that that's what's going on so you know they're they're totally abusing that in my opinion but you know I understand you're you guys are tied with with the state it's a it's a tough spot to be in but you know if we can try to do things locally with ordinances to try to protect protect against it I mean how would we treat a property that isn't a serber living house or a a uh uh uh you know Megan's Law you know will we allow 11 people to live in it that are you know I mean well there's been many houses in bmar where the husband and wife have had nine children well that's different they're related I can God bless them you know what I mean but but the state says you can't make that rule apply here well not not in Megan's law but from a on the a so living standpoint specifically says 10 yeah and if it's happens to say hypothetically be a duplex that's different 10 and 10 yeah it's 10 and 10 right exactly um yeah so just keep fighting the fight I mean thank you
