with the open public meetings act adequate notice of this meeting has been posted on the township website and sent to the newspaper of record the agenda has also been posted on the township website and Bulletin board at the municipal building at least 48 hours prior to the meeting the agenda items will not necessarily be heard in the order listed and the meeting sh will not continue application review application number n-14 all sh the shot 64 646 yes Mr chairman and members of the board this is a a slightly different application than we typically see before the board uh this was a um application for a lot line adjustment and it was presented to the technical Review Committee at the end of November and the technical Review Committee met and agreed that this fit the definition of a minor subdivision um and if in the U buroughs Land Development ordinances the technical Review Committee can make a recommendation to the planning board uh to determine uh this application to be a minor subdivision and if it's a minor subdivision the municipal land use law does not require that there be a public notice a public hearing or notice to the surrounding Property Owners so there was a recommendation from the from the TRC uh that that be the case um the the requirement uh for minor subdivision is basically that it's less than uh three lot subdivision in this case it really is just a lot line adjustment there's a joining property and in the applicant is here with their engineer and the the owner of the property but uh the they're looking to uh take a piece of one of the Lots add it to the adjoining lot to reduce the lot area in one lot and increase the area in the the other lot uh it does not create any new variances it meets all of the bulk standards for the R20 Zone and so what will be presented to the to the to to the board by the application is a a a summary of what's involved a discussion about what they're proposing to do and if the board uh is takes action tonight would be number one to make a determination as to whether or not uh uh you are agreeable to a waving the notice of public hearing requirement and then secondarily uh a finding granting the minor subdivision approval subject to really just uh conditions that the sketch plats being reviewed and approved uh by the board's engineer and Town's engineer the uh the or the board and the town attorney uh review the a minor subdivision uh deeds and that they're filed within the time required they pay all escros and taxes and obtain any and all necessary outside approval so and there was a uh proposed uh resolution uh if the board so finds it's there if the bo wishes to adopt it tonight can do so as well so with with that the applicants here and andless anybody else on the board has any questions that's good evening Mr chairman members of the board my name is Jordan fredman I'm an attorney with the law firm of vasta and Sullivan we represent tonight's applicant um talah shake and his wife Fatima shik who is not here um they are the owners of the premises located at four Treetop Court uh for the record that is lot uh 6.04 in Block 3201 um as Mr Robertson uh introduced the application before you is for a minor subdivision approval uh the uh the bones of the uh application are uh the shakes would like to subdivide a 10,300 square foot portion from 646 Mountain Avenue which is an adjoining property to theirs uh that property is Lot 8 in Block 3201 and they'd like to merge it into their own property uh a brief description about the properties um for Treetop is in a regular shaped lot runting on a culdesac and it currently consists of 20, 611 square feet it is used as a single family residence 646 Mountain Avenue is a rectangular shaped lot consisting of 45,7 35 square ft uh it is improved by a single family uh dwelling which is under construction that property is owned by fras F AI G Construction LLC uh that company has consented to this application uh both properties are located in the R20 uh District um at the risk of some repetition um the 10,300 foot subdivision uh would result in the shakes property having a new uh area of 35,43 square ft um the 646 Mountain Avenue property would be reduced in square feet to 30,000 91 uh we intend to present uh the shakes expert witness uh with us tonight is Andres Romero uh professional engineer of Mana design LLC and the application is based on a plan which you have in your packet that is the minor subdivision lot line adjustment plan dated September 10th 202 four and that is by Giovani manilo manilo PE also of Mana design LLC and jeffre S grun PLS of Lakeland surveying um with your permission I'd like to have Mr Romero did you flipflop the lot areas is the excuse me gger of the two lots and at 646 m 646 is the larger lot at 35,000 and 604 is 30,000 uh currently 646 has 45735 square feet upon reduction it will go down to [Music] uh correct okay so I believe you're correct we we're good to go okay um before your board how would you like uh the engineer to be set up where would you like me to be when he is testifying you can take a seat if you want to ask questions you can stand up whatever how about we share the microphone make sure theer so you can come to the can you state your name and your experience please yes my name is Andreas Romero I'm a r o m e r o that's my last name um I'm a professional engineer in the state of New Jersey uh with an active and valid license to uh um to practice the profession in the state I have over 15 years of experience in practicing the profession in the private sector with uh projects ranging from minor to Major developments um that's my experience and I had a fiveyear uh bachelor degree in civil engineering can you raise your right hand I should do do you promise to tell the truth and the truth yes I do okay I have no problem accepting him as a Mr Romero uh your firm uh prepared the plans for this application correct yes correct and are you familiar with them yes I am okay um uh regarding the proposal uh could you give the board a description of uh what the plan intends to achieve yes correct um so basically you know we have the two properties uh located in mon Avenue and three top Cur uh they have been identified as another four three to Cur in the block 3201 604 and the mon Avenue the 646 which is in the county road County Road 622 the two uh properties um are located in the R20 res residential single family District as per the uh Township Sony M so the two properties are surrendered by single family homes in all the directions the current the property uh 646 Mountain Avenue is currently under construction and Renovations uh the two Property Owners agreed to adjust the property line the common property line to reallocate 10,300 square ft area from Lot number a to 604 for the record I'm using the submitted plan as an exhibit I just color the lines so for easy understanding know how the transaction is going to be I don't know we're going to mark it as an exhibit but I think I think we should Mark it as A1 only because it's been uh colored from the documents that that were submitted with the plans so I think it's best to mark it as A1 okay yes but I mean like the only change is the colors in the Pro understand so the proposal division will create two fully conforming Lots Elimina eliminating two existing variances for maximum building coverage and maximum coverage on lot 604 which is the number four top three C this is an existing non-conforming condition that now that we are we are in the 10,300 square feet is going to delute that that that uh that variance at this point no side improvements are osed on this application no changes in building Dimensions no changes ining coverage and any future Improvement will comply with the township and Zoning permits any questions very very makes a lot of sense so basically lot e which has the house under construction it was a fully conforming lot previously yes correct and it remains a fully conforming law correct in 64 which had two two Varian two non-conforming condition nonconforming now it becomes correct okay sh about 10,000 square feet right yes anybody have any questions is good okay very good all right want to do a brief closing I promise it's going to be brief um based upon the testimony that the board has heard tonight will be respectfully request that the application be granted um as you have heard this is a subdivision with a merger between joining properties um there are no variances that are required and there are no other changes uh which would render this anything other than a minor subdivision uh that all being said uh again I request that the application be granted and uh we uh appreciate your time and your
