good morning thank you all for joining us we're just going to give a few moments to clear the waiting room uh and ensure that folks have connected to audio as a reminder when you are entering from the hearing before the licensing board for the city of Boston today is Tuesday April 23rd 2024 today's hearing is being held pursuant to Temporary amendments to the open meeting law that is what allows us to meet virtually today's hearing is being recorded and will be posted to the city of Boston's website before I review procedural matters I will introduce chairwoman of the board Kathleen Joyce good morning thank you Denny my name is Kathleen Joyce I'm chair of the Boston licensing board and today I'm joined by commissioner Kiana Saxon and commissioner Liam Karin thank you please ensure that your audio and visuals are working properly I will call each item in the order that it appears on this morning's agenda I will then ask who is present on behalf of the ly who is present on behalf of the Boston Police Department and whether there are any other individuals with firsthand knowledge of the alleged incident who wish to testify I will then swear in all parties after which the police report will be read into the record and the leny or their representative will have the opportunity to make a brief statement followed by questions by the chair and Commissioners all testimony will be limited only to those individuals with firsthand personal knowledge of the alleged incident we'll begin with the first item on this morning's agenda calling item number one 253 Food and Spirit LLC doing business as Nashville Bill Grill and Stage located at 255 to 257 Tremont Street date of the incident October 14th 2023 robbery outside of buting premise in violation of Mass General Law chapter 138 section 64 who is present on behalf of the leny general manager Jessica Iola great thank you Miss Iola for being with us uh who is present on behalf of the Boston Police Department detective Walsh thank you are there any other individuals with firsthand knowledge of the alleged incident who wish to testify hey can you both please uh raise your right hand do you sir to tell the truth the whole truth and nothing but the truth yes yes I do thank you detective Walsh if you could please proceed with reading the police report and the record for us thank you about 7 pm on Saturday no October 14 2023 officer Santa for was approached at the front desk of District A1 for a report of an armed robbery that occurred in the area of 253 tremon Street located in the Theater District of Boston the officer was informed by the victim that between 2: a.m. and 2:30 a.m. he was robbed of his cell phone and was threatened with a knife while attempting to retrieve it After exiting the above location with a group of friends he was approached by a group of Black Or Hispanic males in their mid to late 20s when one of them snatched his cell phone and walked away Mr seed along with this group of friends followed the mails and was told to back up or else by one of the males who was about 5'6 in height same male then pulled out a squish blade and they continued to follow and R towards them with it Mr seedle and his friends ran back to the above address where their Uber was waiting for them Mr cedel also informed the officer that another group of of his friends attempted to retrieve the phone and was threatened by one of the males the other males one of the other males brandished a firearm that was in his waistband the victim stated that his phone was locked at the time and it was stolen and all of all of his information could be accessed from the phone Mr cedel informed the officer that his mother was tracking the movement on the phone from the Life 360 app which was able to screenshot all their movements an attempt to transfer of $1,500 from his bank account was made but unsuccessful a venmo transaction was successfully made to a bill with the account Creator being a Zemo Nowitzki transfers were also accepted from his cash chap account and was locked out of his iCloud account which has his banking information credit card information and personal notes on October 31st 2023 A1 detectives wal and Canal conducted a licensed premise inspection at 253 Tremont Street Boston nashar and stage in relation to a cell phone robbery directly outside the establishment on the sidewalk detex has met with general manager jessar Rola who signed and accepted notice 17304 should be noted that this incident happened on October 14th detective Walsh visited the bar on the 24th and spoke with head of security manager Sylvie patani who assured detective Walsh said the video would be saved and he would contact GM Jessica arola immediately for the video detective Walsh left his card with Mr patani and with his contact information on 10:25 detective Walsh emailed general manager missa hi Jessica there was a cell phone robbery outside the bar on 10:14 between 2: and 2:30 a.m. if I could collect some video footage it would be helpful and greatly appreciated feel free to call me to discuss if necessary thank you on 10:26 detective Walsh called the bar and spoke with Mr patani who stated missa iraola was busy with an event but assured detective Walsh beinging him would get right on it after not hearing back detective Walsh called again on 10:30 and spoke with Mr batani and stated urgency and it was starting to get concerned because often times video was written over after several weeks and the video was lost Mr patani assured me that it would be saved and downloaded on October 31st detective Walsh received an email from desar ol good afternoon detective wall I just left the voicemail regarding the requested footage from the evening of 10:14 2023 from 2 to 2:30 a.m. please give me a call my personal cell phone number on 10:31 detectives w Canal sorry on 10:31 detectives walson Canal went to nashbar and met with Jessica ol who again assured detectives that she had had it downloaded and just needed to send it or load it to a USB missa stated she would contact detective Walsh when it was ready or could be emailed over if not too large of a file on 111 Mr patani called detective Walsh to confirm the dates and times and stated he was downloading the video a few minutes later Mr batani called detective Walsh and stated the video had expired and was no longer available that is all I have at this point thank you very much detective uh Miss aola would you like to address the alleged incident yes so um everything did happen we were we had a change of management so we were trying to get into the account that was able to download the um video footage um by the time we did get that video footage on 1031 it was to be downloaded that day but we at that point we found out that the footage was only saved for 14 days so by the time we had got into the system the video was no longer available to send over thank you anything further you would like to add before we move to questions from the board um no at this time we have we are able to get into the system now properly for the security footage moving forward um we have utilized it since then so moving forward we have rectified the situation so this won't happen again thank you we will see if there are any questions starting with chairwoman Joyce yes can you explain to me how you rectify the situation who's aware of the video and how to save it and why I I personally now am so we did contact the security company to be able to get a new password to log in to save the information so moving forward I personally have all the information as well as the owners now so this wouldn't happen again how many days does the video say for now 14 days still 14 days what is your policy about saving video um the policy on saving the video as far as if we're allowed to or when when you're aware that there police or anyone or a potential um incident has occurred on your premise or near your premise or you've been requested by police to cooperate what is your internal policy about saving video so moving forward yes it will be happen within 24 hours of somebody notifying us uh police that notifying us that they need footage from that or as well as any incident that happens on the premise as well okay and in your own words what happened here what was the breakdown of communication in this incident so the breakdown of commun I don't I believe on our part the breakdown of communication it was on our part letting them know that we weren't able to get into the system right away and by the time we were able to get into the system right away um the video was not available anymore okay and um just going back how many days into the incident were you made aware by the police that they wanted you to save the video it was 10 days so 10 days in okay okay I don't have any other questions at this time commissioner Karin or commissioner Saxon uh I have nothing to add this morning calling item number three big night venues Boston 2 LLC doing business as Empire located at one Marina Park Drive date of the incident February 16th 2023 alleged bouncer assault on Patron and violation of Mass general laws chapter 138 section 64 and chapter 265 section 13A who's present on behalf of the lcy good morning Madam chair members of the board Kristen scanland for the lensey and with us this morning is Charlie Kane who is director of security thank you who is present on behalf of the Boston Police Department good morning officer Co for the Boston Police Department thank you very much are there any other individuals with firsthand knowledge of the alleged incident who wish to testify can you both please raise your right hand do you swear to tell the truth the whole truth and nothing but the truth I do I do thank you very much officer Co if you could please um read the police report to the record for us about 106 on Thursday February 16th 2023 officers Co and McCarthy in the fox 102 Alpha unit responded to a radio call for an assault and battery in progress at one Marina Park Drive Empire Restaurant um the cad notes were as followed caller states he got dragged out at above by bouncers caller states there was a fight inside the restaurant about 5 minutes ago caller States a female was knocked to the ground during the altercation and she's bleeding from the lip there's the second second 911 call caller States the two males were fighting with security outside um one male white male 5'11 thin bills about mid 20s wearing a gray long sleeve shirt with dark blue jeans and tan boots no weapons female assaulted facial injury male two Middle Eastern male brown skin 51 heavy set mid to 8 20s upon arrival officers located a white female later identified as Abigail killer crying on the sidewalk at the AED location Miss Kaylor stated she along with her boyfriend were tackled To The Ground by four unidentified men then miss Kaylor reported she was dragged out by the bar by Empire employees Miss Kaylor pointed to a bouncer later identified as Malik cam kept pushing her and would not allow her to walk on her own Miss kale stated during the altercation she in injured her lip and could taste blood in her mouth officers obser the observe Miss Kaylor holding gauze pad to her lip in her mouth area Mr Dillan reported that a group of unknown men pushed him and his girlfriend to the ground then the bouncers physically picked them up and dragged them out of the bar Mr Dillan stated he injured his right KN during the confrontation EMS arrived on scene evaluated the victims who deny being transported to the hospital at this time Mr George the manager of the Empire reported that they were in the process of escorting a patron later identified as Christian Perez from the bar when Mr Lynch started interfering with the removal during the physical struggle Miss Kylie was knocked to the ground Mr George reported that Miss Kylie was not dragged out of the bar but walked out officers spoke with Mr Shan Lynch who reported that he witnessed his friend Mr Christian p as being dragged out by several bouncers Mr Lynch reported that he jumped into the group to help his friend when he was physically dragged from the premise by several bouncers Mr Lynch stated that he was uninjured during the incident Mr Perez reported to officer Saul that several bouncers dragged him out by his arms and his legs Mr Perez did not report any injuries or need for medical attention Mr Lynch and Mr Perez left the bar on foot without incident Mr George stated the incident was captured on security cameras but cannot access a footage at this time Patrol supervisor Sergeant poelo Fox 910 did a license premise check and issued a violation 08904 the fox 102 Alpha provided a currency R to Mr Dillan and Miss kylo to 70 Causeway Street thank you very much attorney scandin would you like to address the alleged incident yes thank you just a few brief questions for the officer first um officer Co to your knowledge was staff Cooperative um from start to finish with this incident yes ma'am they were and to your knowledge were any charges filed regarding this matter ma'am I believe the case is uh still open uh the detectives have the case now okay thank you so much if I could detective Moria I'm sorry I didn't answer up I didn't realize I was on this one as well I was never able to contact to get a hold of the victims in this case alleged victims thank you detective uh you have not been sworn in yet at this time correct no sorry I have another identify yourself one one more time detective morti m o r i a r t y thank you detective morti uh you're already raising your right hand do you s to tell the truth the whole truth and nothing about the truth I do and I'll just reiterate I reached out to the victims and then I never got never spoke to them and they never got back to me thank you detective U Madam chair members of the board and we'll share the the video surveillance with the board but what you'll see in the video is a male Patron um initially backs up into a female Patron at the main bar the female Patron pushes him with her back and then a female friend pushes him as well what it appears to be is kind of some body shifting going back and forth to occupy space um at the main bar the male Patron then backs into the female again and she Taps him to get his attention they appear to exchange word and then the male pushes the female which is then returned with a smack in the face um the female bartender or a female bartender Witnesses this and extends her arm out for them to stop which they do the initial um uh incident deescalate here and then the bartender immediately tells another bartender to her right to get security um what you'll then observe on the video is within 1 minute a bartender's flashing a light to Signal security to the location of um these two initial patrons and thereafter within 30 seconds a female security officer approaches the group to talk before escorting the female out of the venue you'll see when this happened that the situation is totally deescalate nevertheless and knowing an altercation has already occurred and to prevent any future altercation from occurring security proceeds uh with further deescalation of the matter and removal procedure following um removal of the first female Patron um about a minute later you'll observe a female and male security officer this time approach the male Patron who becomes combative with security and is refusing to leave the bar this all occurs within approximately 40 seconds of security approaching him and asking him to leave uh security attempts to restrain the aggressive male who is slamming into patrons around him and male security the male security officer bare hugs the male Patron to escort him from the area a female Patron who is identified as Miss Kyler um in the police report who is not involved up till this point is observed trying to pull who we believe is her boyfriend away from the situation the boyfriend also was not involved up to this point and can be observed interfering with security as they are trying to remove the initial and problematic male uh Patron from The Establishment thereafter and as the police report States um Miss Kyler is incidentally bumped causing her to fall uh the mail Patron alongside M Kyler's boyfriend are escorted out of the venue and important to note you will see Miss Kyler walk out on her own accord followed by a security officer she is not dragged as she claimed to police she was told she needed to leave after she got in the middle of the altercation while an incident did occur there's simply no evidence of um assault and bad employee on Patron and to the contrary the lensed staff handled the incident uh per board and their own internal policy they called police they de-escalated further and already naturally de-escalated situation utilizing proper methods in deescalation uh when the patron did not want to leave the male Patron following their approach to him he was the aggressor towards security which you will see they held him by the arms and escorted him out not in any threatening manner of violating any use the force policy and of note um for the board's record these patrons aren't otherwise known to The Establishment and nothing happened earlier in the night that would have caused the staff to believe this incident was foreseeable um Mr Cain can testify also to his internal investigation and his follow-up Communications with the Boston police uh good morning attorney green and members of the board um just to reiterate um based on our policy immediately when we get a licensed permise violation we create a file um and save all video statements and create a file for the Boston police and for the board for these hearings um the video was saved I subsequently reached out to Boston a few days later and left a message at the detective Bureau that we had the video if it was needed would be preserved um never heard back as detective morati said um there were no victims that came forward with this reviewing the video the woman who alleged that she was assaulted was in fact not assaulted and never dragged out um if you read paragraph four uh my security manager Kevin George's statement is right in line with the video which I have a the video and I have a very detailed timeline if you need that explains and walks you through the entire six- minute incident um as attorney scandin said there was no factors that showed this ring into a situation security was there within seconds of the Bender advising them I believe that they followed all the training and policies on the use of force and deescalation in getting the patrons safely out of the establishment um and also believe that um they did not assault anybody or drag anybody in any of the fashions that the people made statements Uh Kevin George the security manager did call 91 one so I believe that we followed all the license premise policies were followed by the staff thank you Mr Kane thank you attorney scandin anything further before we move make sure it is shared with the Commissioners absolutely yes that was send it today sir thank you calling item number four big night venues Boston 4 LLC doing business as scorpion bar and restaurant the grand located at 25 Northern Avenue date of the incident July 21st 2023 assault and battery employee on Patron in violation of Mass General Law chapter 138 section 64 and chapter 265 section 13A who is present on behalf of the ly Kristen scanland again for the lense e and Charlie Kane director of security for the lcy thank you and who is present on behalf of the Boston Police Department a detective Sandra Swain thank you detective Swain are there any other individuals with firsthand knowledge of the alleged incident who wish to testify can you please raise your right hand do you s to uh sorry thetive oh there we go are do you s to tell the truth the whole truth and nothing but the truth I do I do thank you detective Swain if you could please proceed with the police report for us okay good morning uh at about 11:39 p.m. on Friday 7:21 123 Sergeant Denio and officer kopinsky responded to a fight at the Scorpion bar located at 58 seport boulevad upon arrival officer spoke to the victim alleged victim uh Thomas Levesque who stated that when he was attempting to enter the bar he was grabbed by the suspect Gary Dixon causing him to fall backwards making him grab onto Mr Dixon to brace his ball after grabbing a of Mr Dixon Mr lest stated that Mr Dixon then punched him in the face officers then spoke to Mr Dixon about what had happened to which he responded that Mr Levesque grabbed him by the back of his shirt and attempt to get into the bar so he punched Mr Levesque in the face officers also spoke to another scorpion by our employee Isaac M melli which he stated that Mr Dix and punched Mr Levesque after Mr Levesque had grabbed him by the back of the shirt officers also spoke with Mr lees's friend Jacob Paris HS who stated that Mr Dixon had grabbed Mr lves and then punched him in the face after M Mr lest had grabbed a hold of Mr Dixon uh at that point Sergeant Daniel issued a citation for license permise violation number 058 905 um shortly after this incident uh the following day I reached out to Charlie Kane uh I obtained I was given the video um with with within a day or two I made several calls to Thomas lavesque who was the alleged V victim there's been no response from him at all I also received a um a a written statement by Gary Dixon about the events that happened um and from watching the video uh his statements are exactly what happened it appeared that uh Thomas Lees was intoxicated he seemed unsteady on his feet in the video I saw him step over the St and those ropes and when he was approached by security he W he wasn't going anywhere uh I did see him grab the back of uh Gary Dixon's jacket as almost like he was gonna pull it over his head and that's when Gary Dixon punched him and stepped away from as as if defending himself thank you detective Swain uh attorney scandin would you like to address the alleg in in it yes please and thank you detective Swain um were just to clarify were any charges brought in this matter no thank you very much um Madam chair members of the board attorney green similar to uh the detectives testimony and what you'll see from the video which is still preserved and what was shared with uh the Boston police the alleged suspect Mr Dixon is actually the victim here he is assaulted and defends himself which is what you will see on the video this particular Patron in question Mr L is uh was initially denied entry and was never in the building that evening he's not known to The Establishment and initially other than being uh frustrating uh would be Patron trying to avoid the entry process there wasn't any aggression initially from him that would lead them to believe he was about to be violent with the staff um Mr Kan will testify that upon reviewing the incident with staff and similar to what the detective shared with us with regarding Mr Dixon statement the patron kept trying to rush the door stepping over the entry stanions ignoring security and not following the entry process um he was initially escorted back to the stanions and he again tried to rush past them um including rushing past Mr Dixon who initially uh stood in his path you'll then um observe on the video that the patron grabs Mr Dixon by both uh the shoulders of his suit coat and pulls his jacket over his head quickly so he's Mr Dixon can no longer see so Mr Dixon throws instinctively a defensive punch with his face covered by his jacket the punch appears on the video to graze the patron and Mr Dixon thereafter walks away immediately does not continue to engage with the patron another security officer is out there who takes over and uh de-escalates the situation or attempts to but you'll thereafter see that the patron comes back for more after pulling the jacket move on Mr Dixon uh security continues thereafter to deescalate um the situation calls uh 911 pursuant to policy and procedure um and again in this case it it was a defensive throw but our security staff was uh the victim in this matter um at this point I'll turn it over to Mr Cain if he has anything additional to add U regarding his intern report uh good morning again um just basically the same that um upon review it was apparent that um Gary Dixon uh was grabbed uh by both shoulders of his suit coat and his head pulled down um losing his vision uh he stated he was in fear that he was going to be assaulted and threw a defensive punch to get himself away from the individual which you can see on the video it's almost like a compared to a hockey fight move where they pull the hockey shirt over the person they're engaging in he backs out of the jacket and immediately steps away and deescalate and goes to a manager and other security handle the situation with the patron still being unruly so I feel they followed all the deescalation and he was actually a victim uh Jason Nichols the Vice President of Operations immediately called 911 for the incident and everybody cooperated and followed the license premise policies with the incident on followup I did speak with Detective Swain and sent her the video within a day and Sh had with her Gary Dixon's uh statement relative to the incident thank you Mr Kane thank you attorney scandin anything further not at this time thank you thank you any questions from the board cherman Joyce just like to request um the internal statement to be sent to the board as well as a 302 Center Street in Jamaica plane date of the incident October 23rd 2023 assault and battery with a dangerous weapon in violation of Mass general laws chapter 138 section 64 and chapter 265 section 15a who is present on behalf of the lcy good morning attorney Green attorney John P conell from Upton conell and deblin good morning chairwoman Joyce and board members I should have here with me the LC Raphael varis thank you we do see Mr varis uh who is present on behalf of the Boston Police Department good morning detective Matthew Becker officer Francisco Rodriguez thank you uh detective is it am on Monday October 23rd 2023 P Rodriguez and P Jackson while in the Jake 101a unit and Department issued body warant cameras activated responded to 302 Center Street Latino restaurant for m stab upon arrival officers observed dmts a SEO Hollowman from ambulance 13 working on a male on a male victim later identified as Miguel kayaso restaurant owner Mr Rafael veras confirmed victim to be a patron in his establishment Mr vys further stated he noticed Mr kayaso arguing with an unknown male outside but was not able to give a description of suspect or suspects officers observed Mr kayaso to have three apparent stabs to his left side abdomen with small bleeding EMTs rushed Mr kayaso the Boston Medical Center emergency room where he was being treated by the trauma team headed by Dr Andre mipi at the at the emergency room it was determined by Hospital Personnel that victim was in stable condition P Rodriguez attempted speak to attempted to ask Mr Cayu what happened on today's day to no avail EMTs also attempted to ask Mr kayaso for description of suspect to no avail the Jake 1018 unit while in the ER Department were able to take custody of victim's clothing items which included a black T-shirt blue jeans and pair of black sneakers officers were not able to were not a were not allowed by Boston Medical Center nurse technician Kayla Maynard to take victim's Wallace cell phone keys and cash through the hospital policy involving seizure of personal items belonging to a victim officers observed the cash to be the officers observed the cash to be multiple bills of $100 bills inside of a clear hospital bag m M explained to officers that his personal belongings including the cash would stay at the hospital in the secure safe officers while recovering clothing items at the hospital were approached by nurse technician Kayla Maynard who found four quarter siiz plastic bags containing an off-white uh powder believed to be heroin officers along with clo clothing items took possession of the above described drugs officers turned over to the Boston police evidence bag with containing with containing clothing items to Sergeant detective Brown Jake 983 and detective sise Jake 803 drugs were logged on book number 13-2 page number 179 and deposited into e13 drug safe in a Boston police evidence manila envelope along with drug depository form and copy and copy of incident report Mr kayaso to be summonsed into roxber district court for possession of Class A with intent to distribute units also on also on scene with the patrol supervisor Sergeant de Jake Tango 5 5 a officer o Conor Jake 421a unit p p Costa and detective s Jake 803 thank you very much attorney conell would you like to address the alleged incident thank you attorney green I have no questions for the officer uh Mr Varys is here to answer any questions but let me provide a summary uh this victim was inside the premise and left and after he had left he was outside not in front of the premise but outside to the left in front of Freddy's Market which is right next door Mr Baris who is the lensy manager of record heard yelling went out uh and saw the victim stabbed and applied assistance to the victim in the form of gauze to the abdomen to stem the bleeding while somebody called the police and ambulance EMT arrives shortly thereafter and that's the extent of Mr varys's participation in this matter there was no forese foreseeability here and it had nothing to do with the license premise and I would add that uh Mr Varys has operated this restaurant for 28 years since 1995 with no prior violations and he runs a pretty good store and uh as I said Mr varis is here if you have any questions thank you attorney Corell we will see if there are any questions uh chairman Joyce any questions um it doesn't say who called the police um could someone tell me who called the police I can I can provide you uh choman Joyce what what I know which is that while Mr varis tended to the victim he asked somebody to call the police and somebody else called the police okay ask another uh there was another bystander there okay all right thank you I don't have any other questions number six Tremont 958 restaurant corporation doing business as slades Bar and Grill located at 958 Tremont Street in Roxbury date of the incident November 11th 2023 assault and battery Patron on Patron in violation of MTH general laws chapter 138 section 64 and chapter 265 section 13A and a robbery on premise and violation of Mass General Law chapter 138 section 64 who's present on behalf of the ly uh Britney pil thank you Mr pel who is president on behalf of the Boston Police Department uh officer Dy is now present or detective Sol uh Lieutenant detective Troy thank you lieutenant the whole truth and nothing but the truth do I do thank you lieutenant detective Troy if you could please read the police report into the record for us uh reading from a report written on um Saturday November 11th 2023 By An Officer James dority it reads as follows about 2:10 a.m. on Saturday November 11 202 officer D while assigned to the uh Delta 415 responded to a radio call for an assault and battery at 958 tremon Street officer Williams and Jacobs also assisted on arrival of the officer was met by victim uh kareim ball who stated that inside of a blue Jeep Wrangler with New Hampshire registration in front of uh 108 Hammond Street the victims was holding a jacket covering her face throughout the incident the victim uh ball stated she was drinking in slates Bar and Grill at uh 958 tremon Street for about an hour prior to the officer's arrival when she was assaulted and robbed by a group of eight people the victim stated she met the suspects that evening and the victim stated that they had been very friendly to her earlier in the in the evening victim stated that she got into an argument with some of the suspects in the bathroom where where the suspects made numerous comments about her being a male to female transgender the suspect uh the victim stated that she uh then sat down at a table in the restaurant with the suspects victim stated that not uh not long one of the suspects punched her in in the head um victim stated that the rest of the group then began to beat her by punching and kicking her the victim stated she was struck numerous times in the head and torso victim stated that the assault continued as she attempted to leave the restaurant and during the struggle the victim stated that one of the suspects stole her purse which contained her wallet credit cards ID cards and car keys the victim was unsure if there was Cash inside the wallet the victim stated she was able to break away from the group and fled down Hammond Street towards shamad of victim stated it was like a tornado and stated that she could not remember uh when the assault stopped when the group stopped giving her Chase or how she found her way back to her vehicle EMTs were requested to evaluate the victim officer was unable to observe any victim injuries due to the victim holding a blanket over her face the victim stated during the assault the suspect made numerous comments about the victim's transgender identity the victim stated the group uh consisted of seven black males one white male ranging in age from their 20s to 30s the victim was unsure of any further description of suspects uh ambulance arrived on scene and evaluate the victim the victim adire bruising and a cut in her head EMTs transported the victim bet isra further investigation body War cameras were activated in addition there's a supplementary report here uh and it reads as follows since it's written by detective Christopher fencer and it reads on 1111 1223 uh 2023 detective fencer along with Detective nuci responded to slates Barn Grill at 958 Tramon Street ised license premise inspection notice um and that's the extent of the incident reports there some the matter was assigned to uh the Civil Rights and matters still under investigation um by detectives the Civil Rights unit thank you L detective Troy Miss pel would you like to address the alleged incident yes so uh as the story goes um I spoke to one of the victims that was involved in the fight she called the following day I also viewed the camera and then I later spoke to Carmen myself um on that Sunday of the 12th and then two weeks later so um Carman inside the bar notices a woman that is well known from the transgender um from a transgender program she speaks to this woman I believe her name is Shere Chenise and introduces herself speaks about her situation um it's been observed in and around that time that Carmen is living out of her car and parking it around the bar in other places in the South End and so I believe that she speaks to this woman sh shenise and asks her for um housing which they you know be become friendly over that conversation later that evening for some reason um Carmen then approaches that group you know I I don't know it's it's very likely that somebody said something to her at the bathroom or something like that but she goes back to the group of women that has uh shenise in that group starts a fight with them and then fights with the women security breaks up that fight Carmen is able to get away from the group runs through Slade's back door holds the fire alarm as she runs out that right before she runs out the back door so there is no scuffle with security and then she just um goes to the fence area and goes to her car parked on Hammond Street and then waits for the police um then later on Sunday that following week she comes in the morning around 11: she's wrapped up in such a way um but she's very tall like six something so the the the bar is not very um busy so a bar Ender notices her I come out from the back go to the bathroom she stands taller than the stall you can't miss her and and um I just you know called her name she didn't really answer so I waited for her to exit I called the police just because you know there was an issue and I was trying to get her to leave gracefully the police come she's on her way out the door as the police come I express to them you know like the current issue and then the police proceed to I guess go address her down the street um at some point a week later I speak to the Civil Rights uh detective he and I have a a conversation about the matter I explained to him that I have um Carmen's purse and that I'm keeping it like any customer in our um office but obviously I don't know how to reach her because of this issue he says that he's going away and that I should go to like District Four or something and drop the purse off or something like that um in a matter of days before I get to drop the purse off Carmen comes back to the establishment I see her on the camera the Security's trying to tell her that she's banned from slades I run out the door with the purse tell the security to get out of the way and I go walk down the street with her by myself and I just explain to her like I appeal you know to her and like I'm a part of the LGBT community as well Carmen the police you have an ongoing issue you need to stop patronizing this bar it's not going to be a good situation for you I saved your purse here it is I wish you well just please don't come back you know we we we kind of Converse back and forth and then she takes her purse and um is upset that she's barred and that that's the end of that thank you Miss pil uh we will see if there are questions at this time chairman Joyce uh thank you so miss pap when the first incident was happening um we were staff security or security security was scattered throughout the bar like in their zoned areas uh how many security um staff do you have on or did you have on that night um I would say four to five is that typical number on on bizer nights or if we have events then we will add security but typically on a Friday or Saturday night we we will have like four to five security staff okay so it sounds like the fight occurred Security started to break it up and then it escalated it it what escalated was Carmen running out the back door and pulling the fire alarm as she as she went out okay um do you have video at slades yes we have video at slades did you preserve video from this night H I'm not sure if if we preserved it the police came typically when the police come on these matters I um I give them access to our video and numerous police officers it kind of came to slates due to this matter okay were they given access to the video they yes always access the detective didn't I had a lengthy conversation with the um civil rights detective and we we didn't really talk about a video we talked about um just the safety of the bar and at that moment I was really concerned about our safety because you know she was coming during the day okay um just to note for the record that should an incident like this occur again and there is a police response you should preserve the video for yourself and for the board in case something like this comes up okay part of your policy I don't have 20th 2023 assault and battery with a dangerous weapon serious bodily injury in violation of Mass general laws chapter 138 section 64 and chapter 265 section 15a who is present on behalf of the lcy truth and nothing but the truth I do thank you I who will be reading the police report into the record I I have a copy of the police report right here thank you if you could please proceed about 12:55 on Monday 11223 officers Kelly and choyce in the fox 102 Alpha responded to a radio call for an assault in progress at Lincoln Tavern 425 West Broadway South Boston multiple C6 units responded including Fox alpha 1 cholo Fox 422 Alpha malor and fox 431 Alpha Russell prior to arrival officers were made aware via Channel 6 dispatch that the suspect later identified as Rebecca Dylan a white female with black hair where an all black was leaving the scene in an unknown Direction upon arrival officers witnessed a large commotion in front of 425 West Broadway and were waved down by multiple Witnesses including witness one yelling to officers this is her while pointing to a female officers observed a female matching the description of the suspect officer stopped the suspect and radio for Boston EMS officer Joyce stayed with the suspect the suspect stated to officer Joyce some random girl is being really rude she tried to hit me in the face so I hit her with my glass I mean I threw my drink at her and the glass broke officer Kelly proceeded into Lincoln Tavern and was observ and observed the victim Shannon Lynch being tended to by a staff member of the bar G G Guerrero Guerrero was applying pressure to El laceration on the victim forehead officer Kelly observed a large Elation in the center of the victim's forehead officer Kelly continued to apply pressure along with Guerrera until Boston EMS arrived on scene Boston EMS A6 arrived on scene and transported the victim to Boston Medical Center for further evaluation officer Kelly spoke with witness one who stated he had witnessed the suspect and the victim appeared to be engaging in an argument witness one stated that as a suspect and the victim were arguing the suspect's boyfriend stepped in between and was trying to get the suspect to leave he stated the suspect then picked up a glass off the bar and threw the glass into the victim's face from a close distance the witness stated the suspect began to leave and himself and other people in the bar attended to stop her from leaving the scene officer Kelly spoke with witness to G G Guerrero who stated he saw a large commotion at the end of the bar and then noticed the victim bleeding profusely from her forehead Guerrero came around the bar and grabbed towels to apply pressure to the victim's wound officer Kelly spoke with witness three Cameron Decoto the bar manager who stated he observed two females arguing and attempted to intervene dto stated a male stepped in and then he witnessed the suspect throw a glass into the victim's face due to bothal multiple witness statements and the severity of the victim's injuries the suspect was placed under arrest and transported to District C6 and booked in the normal manner officer Joyce read the suspect Her Miranda rights from a Boston Police Issue Miranda card before being transported officers went to Boston Medical Center to speak with the victim victim stated she was out at a bar with friends and was an acquaintance of the suspect the victim say that the suspect accused her of trying to speak to the suspect's boyfriend Jonas Rosel the victim St an argument ensued and then Rosell walked over to the suspect and said it's time to leave the victim stated the suspect then threw a large pint class which struck her in the face officer spoke with Dr Brown of Boston Medical Center who stated the victim would need multiple stitches to fix the laceration and the laceration would likely result in The prominent Scar the fox Alpha One issued Lincoln Tavern of licensed premise violation 07743 the suspect will be F charged in South Boston District Court with the following 2655a A and B with a dangerous weapon Serious botle injury to with pine class body One camera is AC thank you officer Kelly attorney Hawkins would you like to address the alleged incident H thank you yes if I may I just two questions for the officer uh officer Kelly was the ly Cooperative with you that evening yes and the the incident report indicates that uh least recall were you aware that it was actually the manager on duty who made that call uh no I wasn't sure thank you very much no no further questions uh if I can I have some questions for Cameron who was the manager on duty that evening yes Cameron could you please State your full name and title for the record it's Cameron deotto and I'm the manager at Lincoln Tavern you and what were the Staffing levels that evening um it was a Sunday night we had uh two security two bartenders a barback and myself as a manager on duty and can you explain to the Bo in your own words what happened that evening that you witnessed um at approximately 12:20 um a group of people came in and uh it was those two girls um Rebecca and Shannon um approximately 30 minutes went by um I was at the end of the bar and I noticed them arguing um I proceeded to step in and um I believe it was Rebecca's boyfriend was trying to pull her off the bar stool to kind of separate them as well um she tried to then swing at uh Shannon and that's when I stepped even more in between them and that's when she picked up the Pint glass and uh threw it at Shannon's face um after that I immediately called 911 um and then I stepped outside to see where the uh Rebecca and her boyfriend were heading just to alert the Police to let them know what uh where they were going and prior to the incident becoming violent how long would you estimate that the two patrons were arguing um probably about 30 seconds when I noticed it because I was standing right by and it wasn't loud or anything but I as soon as I walked over I could tell it was hostile thank you uh and was there anything that occurred before that that incident that would have suggested there would be any sort of conflict between the patrons no and did the patrons appear to know each other yes they um they both arrived together thank you very much Madame chair members of the board we will submit the uh surveillance uh video this morning showing what the testimony just detailed uh we respectfully submit that this was not foreseeable it was obviously an unfortunate incident but that staffed everything they should in accordance with their policies and procedures by attempting to deescalate at the start of the argument calling police and cooperating fully and we're happy to answer any questions or provide additional information thank you very much chairman if I could just uh if I could just add something um so I I was assigned the case although it was unrest uh I went to the B I think the next day I was able to get the video immediately as what we see from the video um Cameron you know started to intervene and this could not have been stopped uh the action of the suspect is so quick it literally it comes out of nowhere she swings her hand grabs the glass and throws it all in one motion uh and they were very Cooperative in and um and assisting me in getting the video and having cooperate throughout thank you very much we'll now move to sa if the already questions from the board chairman Joyce I have no questions thank you commissioner Kar n for me thank you commissioner Saxon any possession of alcohol on premise in violation of Mass general laws chapter 138 section 34A 34 C and 6464 a who's present on behalf of the lcy uh do we have anybody with us on behalf of top mix we will attempt to contact them and take a second call as well calling item number 10 Boston restaurant bar and grills LLC located at 1263 River Street in Hyde Park date of the incident February 25th 2024 premise operating after posted 12:00 a.m. close in violation of Mass General Law chapter 138 section 64 who's present on behalf of the licy hey uh all three of these lenses were hand served uh we do have that chairman Joyce how would you like to proceed would you like these right into the record and proceed would you like us to reschedule and work with the lies let's reschedule them so that's items seven n and 10 uh yeah items s nine and 10 uh will be res will will be rescheduled to the next available hearing dates those are all the items before the board this morning the board will vote
