a quorum we'll call the meeting to order we'll start with invocation we have pastor Dean Williamson sir you're recognized thank you I'm sorry from First Baptist Church of Coco yes sir thank you uh thank you for the honor of being here our County Commissioners citizens of rard County it's an honor to begin this meeting with prayer let's pray dear father we ask for guidance from you and we thank you that you are the god of the universe Lord we just celebrated Thanksgiving Lord I pray that we would continue that Spirit of Thanksgiving into every day of every week of every month of the entire year Lord we have so much to be thankful for we thank you for this representative form of government that we the people are able to uh elect representatives Lord I pray that our uh County Commissioners Lord that you would guide them and I pray that you would help them to U make decisions that would be best for the people of bravard County that would lead to our flourishing and God we also ask that uh you would help this entire County to flourish Lord I pray that we would all understand who we are before you that we are sinners that we are separated from you because of our sins but through Jesus Christ through his sacrificial death on the cross we have peace with you and that you Rose again on the third day and Lord as we go into the Christmas season we thank you for the gift of your son Jesus Christ and God we ask that you would guide this meeting by the power of your holy spirit that you'd help us all to think rationally and come to the truth we pray this in Jesus name amen uh during the swearing in I spoke just briefly about uh how we're going to conduct the meetings I'll I'll say a few words about that and we'll get started um we will first introduce the item we will and Nico have been skating for 3 years and skated or started skating together two years ago under coaches Ryan and Jeremy Hilman and whereas Julianne thei is 12 years old and a native of rockage she is a seventh grader at West Shore Junior Senior High School and is on the cheerleading squad Julianne is the social chair for the Space Coast icex Junior board and is part of the Space Coast hurricanes theater on Ice team and whereas niik Vargas is 14 years old and a native of Meritt Island he is a homeschooled freshman and he is a founding member of the Space Coast icex Junior board when he is not skating he is in the gym and whereas this year the skating pair entered the national qualifying series and qualified to comp compete at the Juvenile level in the 20125 US figure skating pairs finals in Boston Massachusetts and they placed silver securing a place in the National development team and whereas Ryan and Jeremy Hilman have been coaching together for 15 years years and have been coaching in rockage for four years Julianne and Nico and their third are their third third pair team to compete at a national level now therefore be it resolved that the board of County commissioners of Bard County Florida does hereby recognize the achievements and outstanding accomplishments of Julianne DOI and Nico Vargas and offers them congratulations on their significant achievement and sincere wishes for continued success in their endeavors done order and adopted in regular session this third day of December 2024 Commissioners this is my item is there a motion to Commissioners um the agenda item is very simple uh the money is uh a carry forward request from our prior fiscal year uh this is money that was not spent due to Savings of having a single party presidential preference primary election um that saves significant cost we had to budget for it as I stated in my last year's uh budget presentation uh but we wanted to make sure that we earmarked that money and had it set aside our voting equipment is 11 years old I don't think anybody has any piece of technology that they used today that's 11 years old so it's time so this budget request would allow us to purchase half of the machines that we uh need to purchase this year and then I will be adding about the same amount into the next fiscal Year's budget uh so that we can complete that purchase and that's the agend item all right very good are there questions for the supervisor chair yes all I'd like to comment about I spent two months on the canvasing board it was about as much fun as a butt kick okay but I must admit some of us need to go back for penmanship or either a vote in person with a driver's license because you know when you vote it's very important that your vote counts but when you have to go through and send it back and say hey we don't think this is you and you have multiple years we kind of track your signature he did his staff and him did an excellent job the only thing I can say there is no cookies no candy and nothing like that he ran a great ship you know you you couldn't have missed a vote there was one election one vote one vote did it so that's not important don't ever say your vote's not important you know but one vote counted in West Melbourne but thank you for your service thank you for thank you for your service on the canvasing board and we look forward to working with the you know the most important thing about a campusing board I'm G to tell you if you guys get a chance to get on it you don't have to endorse and you can't give money that's a good way to get out of that think about that but my wife deleted the bank account all right commissioner Delan you have a light thank you um I just want to put this out there for the public and we had talked about this is um that these machines are required because of a software update your our current machines aren't compatible is that cor the current machines that we use for early voting uh won't even run the current version of the software where loan machines with a higher higher uh model number so this would you know take care of that problem right so this is this is of people who might like to speak about this in the audience is that okay that's fine I have a couple cards on it so if you want to go to the to the cards so okay having explained the item where um let's let's go to the cards and then we'll do questions okay so uh Blair witherington don't worry Vince you're next so don't get comfortable thank you and good evening I'm Blair witherington I live in florid Ana Beach a few miles north of the Barrier Island Center uh and I'd like to thank uh commissioner Atkinson for uh sponsoring the motion to name the uh what I hope will be uh the doc aart Sanctuary uh at the Barrier Island Center uh doc aart was my teacher back in the early 1980s uh and I remained his student until he passed in 2022 I know that sounds a little bit like I was a bad student uh but the truth is I had so much to learn from him I just never wanted to stop uh he was a great guy so a lot of his students have a similar story to tell he kept in contact uh with his students uh throughout the years uh and he was very well-loved but normally just being well-loved isn't sufficient justification for an eponym uh however he was a historical figure uh and a historical figure is normally described as someone who makes an impact to the community and the landscape and that was Doc he certainly did to witness his impact uh you need to do nothing more than just travel South from Melbourne Beach uh either on the bike path or on the beach or on A1A and you'll see that the traffic thins uh there's more native Green Space uh Scenic Vistas even uh and uh Wildlife uh and a lot of people worked very hard for that protection but doc aart was a key person uh he was a key person that took part in a key activity and that was the very first sea turtle nesting surveys that were detailed on the South Beaches uh he found extraordinary sea turtle nesting uh there on the South Beaches uh and he let out the information in the normal ways that a scientist would through Publications and through scientific meetings uh but he also told everyone he could he and he told people by taking them out on the beach and showing them a nesting sea turtle he took out County Commissioners he took out Representatives I believe commissioner Alman uh went out on on an episode with Doc aart to see a turtle uh and he showed people Turtles as they walked out of the the sea and laid their eggs U at the foot of a natural Dune underneath Starry skies and Doc told stories about the biological significance of it uh and about how rare the circumstance was and it soaked in uh a lot of those people who went out on the beach with him were movers and shakers uh they got things done and long story short uh they cobbled together a refuge from private foundations the county the state the federal government and now we have a mosaic uh Wildlife Refuge uh and it's it's a beautiful place uh doc aart became very interested in all the wildlife and the natural history in The Refuge and uh he was also interested in the human history the the old naturalists that visited that stretcher Beach back in the late 1800s and so he was cut of the same cloth of those oldtime naturalists uh and I'm sure he would be very pleased if his name were part of uh a wildlife refuge in a sanctuary uh there in the South Beaches um thank you very much for the board uh considering this oh and by the way if you're interested yourselves in going out on the beach and seeing a nesting Turtle I would be happy to guide you uh I would relish the opportunity to recall some of Doc's stories uh and to convey some of his wisdom so thank you very much thank you sir uh Vince good evening very excited to face this new board happy you're here I I served for about 15 years as a as a sea turtle volunteer uh taking people out on these walks and uh and a lot of involvement with Doc airheart over that period uh I developed just the absolute greatest highest magnitude of respect for his accomplishments now I I actually got to go to the National Conservation training academy and uh in West Virginia once and I was that's run by us fish and wildlife I looked around to see or I kept asking is there any other Refuge of the 550 something in the system that owe their their Origins to a university professor and I couldn't find one so uh but that Refuge wouldn't be here without his data but even more than that uh he actually led the effort to have it named for Archie Carr who was his mentor he was you know uh but he uh you know he he basically LED that effort because US fishing Wildlife didn't like naming uh refugees for people after sun Bono but so there was some resistance for a while but we we got there with with uh but the uh I'm here in part because I'm a board member of the friends of the car Refuge that's the uh nonprofit organization that's associated with us fish and wildlife and the Archie car refuge and we do the turtle w we do some volunteer services for them we raise some money and uh our board absolutely voted enthusiastically unanimously to support this measure so uh in addition we're prepared to help organize a uh a public event when the science is unveiled we'd like to have a public event at the Barry Island Center so that we can invite uh Doc's followers to come out and participate in that so uh I hope this is the easiest yes vote that you will have for the rest of this year thank you thank you okay Vince we appreciate that are there any question we don't have any other cards do we no no are there are there questions of the sponsor no is there any discussion on the item commissioner Alman I I just wanted to say I I knew doc aart I've been on was numerous walks and hearing his his uh talks and what a wonderful man couldn't name it after a better person and he was a larger than life figure and I can hear his voice he had that distinctive voice and just a way about him so sad that he's gone I'm happy that we can remember him okay any other comments commissioner Atkinson you're recognized thank you so I grew up down that way and never knew doc um but I am glad that I have the privilege and the honor of requesting this renaming Doc's 30-year Legacy as a UCF marine biology Professor uh includes his extensive work with his students in conservation and research and in establishing the Archie car National Wildlife Refuge The Refuge is over 20 mi of Beach and shoreline between Melbourne Beach and weasa Beach The Refuge was designated to protect habitat at the most significant area for loggerhead sea turtle nesting in the world and is the most significant area for Green Turtle nesting in North America thanks to Doc The Refuge is now internationally recognized as one of the most important sea turtle nesting sites his career as a professor professor um as was said allowed him to mentor and teach and impact the lives of hundreds of people who still live here his research and active collaboration with legislators and officials uh was instrumental in the establishment of the Archie car National Wildlife Refuge my goal and continued vision is for our Barrier Island as we support and move forward with the Barrier Island area of critical concern is to carry on conservation efforts for the future of our families and children therefore Mr chairman I'd like to make a motion to approve the renaming of the Barrier Island Sanctuary to the doc aart Sanctuary all right very good we have a motion by commissioner ainson is there a second second there's a second by commissioner Alman clerk will call the role commissioner that Dana blickling and Lisa Cullen you're recognized good evening last fiscal year we started looking at our budgets very um closely so I wanted to continue with that process as we finish that physical year and part of that process is when each of our offices have unused fees we return those to the taxing authorities in the Equitable amounts that you paid if you're above the line you want to that's that's what started this that's the Nexus of it I just want to say a couple of comments about the exit fees from the Property Appraiser's office so this check is higher than you normally see and I will tell you that that is because of the same problem that many of us are experienc and with human capital so we averaged about 11 vacant funded positions all throughout the meaning that our staff of a 100 um worked that much harder to make sure that those gaps were filled um the tax roll calendar is cyclical it's unforgiving in the deadline so um without an executive order from the governor we don't get an opportunity to take a little bit longer to do each uh function of our job in order for us to um facilitate this process so kudos to our staff that works extra hard so yay for you the check is bigger um wo for us us we we had to look a little work a little bit harder a little bit more efficiently with less folks to do the job so we're hoping we don't go into fiscal 25 with the same issue but human capital is it's a challenge now so that's kind of where we're at are there are there my office I'm sorry we still have time sorry about that sorry about that uh my office has taken on uh many different roles uh concealed weapons licensing being large part of that even with the changes in the legislation we still issue uh quite a bit of those also we have partnered with Department of Health with birth certificates and of course we've taken over driver's license from the Florida Department of Highway Safety and Motor Vehicles so for each service that we perform we are um allowed to charge a fee and it is a statutory fee and that's where my check come from so it is um quite a nice size check 5.6 million a little more so I just wanted to bring that process to the Forefront with the public because that is the end of our fiscal year and this money has already been transferred to you through AC now if you take the five off the the front you'll get the property appraisers check and while you're not going to be able to fund $5.6 million with it I know there's some funds here for some cookies that maybe you can allocate for the supervisor of elections that would take care of commissioner Goodson and his need to for to keep his tummy full I'm sure Frank's already SP okay so there you go and since I accidentally stepped on you I'm sorry uh we'll remind uh uh Property Owners if they pay their taxes I'll I'll let you do the rest in December in January and February they get a discount in December your discount is 3% January is two February is one and in March the full amount is due taxes go delinquent April 1 and so the people paid in November got 4% yes sir there all right got a question commission and with that being said we have collected 74% of the role and we are at 888 million at this point very good uh commissioner Goodson question can you pay property taxes quarterly like you can pay IRS taxes yes you can all we request is that you sign up for the installment plan you'll receive four equal installments the first two installments are based on the previous year yeah once I get the roll we do a true up and those last two payments will be based on the actual role and you do receive your 4% in that installment plan the 4% discount thank you I didn't know that unless I do a midyear assessment on your property commissioner and I'm thinking about doing that this year did you get that Rachel um you you got to understand it would be easier for me to fight for a quarter of it from my wife than wait to December to get it all so let's don't monkey with a cart all right well thank you for your time thank you thank you okay uh commissioner Delan oh sorry go yes yes ma' I just had a question about the um these fees that were given back to the county and is there I I guess for the staff is more where where does that money go where where is it um you know I yeah I guess that's my first question Frank that goes into Cash forward you and you have a midyear supplement that um the board uh comes before the board in agenda request and those funds are allocated at that point and so does it go into the um general fund or does some of the money go into the general fund the dollars yeah the ADV the adval dollars are general fund dollars and so is can there be more discussion as to where those dollars go since it wasn't something that was necessarily budgeted for for that well actually some of it is budgeted it's projected in budgeting not all of it this year because of the amount uh there's a large part of it that it had not been uh budgeted and you will have that opportunity as we move forward like I said the midyear supplement doesn't doesn't happen until around March okay so the board will be able to do you know make adjustments at that point I just wanted to bring it up because we have a lot of things um you know like our our firefighters um that we really need to keep the focus on making sure that we get to a better place um so I just want to put that out there for everybody that that's I would like to discuss that okay we'll go with the rest of the public comments Chuck Sheridan I'd like to welcome the new Commissioners to the board and and wish you good luck with it and and remaining Commissioners you've done a good job uh what I would like to see though uh coming to the meetings is is the monthly reports that each of you do a lot of times uh we don't get a report and I know when I've set on reports they they they're eye opening for the other Commissioners and the community on what's brought to your office what the concerns are and you know what staff might have that you don't know about so I just ask that you give a little bit more Force thought and attention to doing a nice presentation or you know I don't need to know that when butter was first churned in Florida I'd rather know what was the community came to and called your office about thank you thank you sir John Dogo down okay yes sir you recognized sir thank you hello my name is John dco U tonight I'd like to address the significant issues facing fire rescue um and explain why these problems signal a failing Fire Department fire rescue currently has a condemned fire station because of this they have two other fire stations housing two to three extra personnel which makes a total of 7 to eight Personnel in a firehouse that only designed to hold five fire rescue has currently between 10 to 15 people that are mandatory overtime every shift fire rescue has between 10 to 20 that are on regular time overtime every shift almost every shift we're seeing 30 to 40 people that are on overtime if you extrapolate this out 365 days the overtime budget will equate to over $7 million per year this dollar amount would pay for the contract that the units prevented presented to the county negotiators this would allow fire rescue to compete with the comparable wage package that the county presented the union these monies would allow fire rescue to compete with seminal County indan River County and the municipalities here in Bard County fire rescue has people in this department that are continually failing at their jobs that are being promoted fire rescue has people that are successful and Excel in their jobs who should be promoted that have been blackballed and that have now left the fire department and have become Chiefs of other surrounding fire departments because of these promotions and the loss of respective Chiefs morale is at an all-time low this is a sign of a sick and failing fire department they are not alone as these other as there are other departments that are failing as well bcso parks and Rex as well as rad and Bridge much of the dysfunction can be attributed to Frank Abate his Le his leadership has dismantled County departments and blocked necessary pay raises to retain and attract skilled Personnel years ago during a negotiation session he made a statement that perfectly illustrates his perspective fire rescue Personnel are no different than office secretaries here in Fiera this statement devalues the unique and emotionally taxing nature of fire rescue work fire rescue Personnel like dispatchers Animal Control off officers and bcso deputies face the worst of humanity daily they are not just employees they are FR Frontline responders their roles demand resilience sacrifice and a strength that cannot be equated to office work I do not have all the answers but I know it will take substantial pay raises and systemic changes to rebuild these departments if you want to stop the mass exitus of talent and restore the health of these critical service it starts with you the board of County Commissioners thank you for your time I urge you to look deep in deeper into these issues and act for the benefit of our community thank you thank you sir Marie Luke did I say that right very good I'm short good evening thank you for the opportunity to speak I've never been to one of these meetings before but I felt compelled to come tonight as I heard that there was going to be discussion and perhaps voting regarding making Bard a sanctuary County although I understand you have removed it off the agenda I am not sure why this was removed from the agenda or or why this is even being discussed in Florida much less Bard County we are a law abiding citizens but you are considering this radical and unconstitutional action which allows criminals and illegals to be protected from consequences of their illegal acts and therefore protecting the criminals as if they are the victims and the citizens as if they are the criminals there are many examples of this currently playing out throughout the country perhaps none of you have walked the streets of New York Chicago Texas Arizona California to see and to see and smell the impact I came because I've seen and hear many sad stories about what such disastrous Sanctuary cities have cause the citizens of the communities the communities financially to the police departments to those that have had their properties destroyed taken over by criminals to those children and women who have been raped and murdered with no consequences we do not ever want to have a sanctuary anything here all we ask is that you please follow the Constitution and the laws that you swore to uphold and protect your lawful citizenry thank you thank you no Christina Fleming you're recognized thank you hi guys good evening welcome new Commissioners and welcome back old Commissioners I am Christina Fleming District 3 resident retired County Firefighter as of today you have lost 105 fire rescue Personnel 94 of the field which I want to add to the meeting minutes after I speak we lost Eric Bing Kyle pishdad and Shan Burns to be added to this list also Al there's shocking news that a 20-year Lieutenant medic who is battling occupational cancer while still working here he has had to take on three jobs total to pay for his cancer co-pays and everything but according to the state statute um Bard County should be paying that we are also in a current pay freeze which is being used as cheap negotiation tactics the county manager has been approached three times about anou for a raise immediately and has said no so the money is sitting there in payroll right now serving no purpose so I stand before you today not only as a concerned citizen but also as someone who is deeply troubled by the ongoing mismanagement of our fire department it is with frustration and disappointment that I address this issue one that directly impacts the safety and well-being of our community for months now we've heard repeated claims from the county manager public safety director and others within the administration that they are unaware of the internal problems facing the fire department yet the signs of mismanagement are undeniable from Staffing shortages to inadequate salaries from outdated equipment to inefficient operations the signs of neglect are all too clear to say that they are unaware is frankly a disservice to the hardworking men and women who risk their lives every day and to the residents who depend on their surface service how can we accept the claim of ignorance when the evidence of dysfunction is so glaring this issue isn't about passing blame it's about accountability the county manager is charged with overseeing and ensuring the effective operation of every Department in this County for the past several months really years we've been hearing excuses and evasions but we need to be clear leadership means taking responsibility especially when things go wrong our fire department deserves a leader who is not only aware of the challenges but is actively working to solve them they deserve better than vague reassurances that things will improve please trust us and Roll Tide while the problems continue to grow the public deserves transparency and the firefighters and First Responders deserve the resources and support they need to do their job safely and effectively I ask the commission to take immediate action we need real answers not more evasions and we need a commitment to fixing the problems that are putting both our community and our First Responders at risk and that includes removing people from their positions thank you for your time and this is the list thank you Christina okay commissioners that's the end of the middle section of the public comment cards we'll go to uh H1 and I think Mark you're recogn Commissioners Mark bth Public Works director uh with Rachel Jena engineering manager uh H1 is an approval for of an amendment to chapter 62 of bard county code of ordinances to allow uh high performance polypropylene pipe in County rights away as well as provide administrative waivers for inverted siphons often uh referred to as Bubble Up structures uh we are here to answer any questions the board may have okay are questions for Mark uh I think uh commissioner delini beat you to it go go ahead commissioner thank you um I have some major concerns about this um uh this item because it's not so much the polypropylene pipes it's more the inverted siphons um all the research that I've done these things fail regularly and um require a lot of Maintenance and so I I don't know why we're making our code um weaker I I don't understand why we're weakening our code with this um even the EPA they say um these structures can present problems and communties look for ways to avoid siphons in their Wastewater collection systems when possible um there's there's a flood risk if these things aren't maintained properly properly and while I understand that they will be required to keep the flood waters on their own property we all know how that sometimes goes um so I is there a question in there for Mark and then we'll okay I think I think he was waiting to answer you sorry so I'm I'm concerned about that thank you okay um Mark do you want to do you want to address that real quick yeah commissioner um right now the board uh has in the past reviewed these uh what this is doing at the request of the development Community is uh simply shifting it from a Board responsibility to a staff administrative approval process that doesn't mean that we're going to uh start approving them uh anymore than uh in the past it but it would allow us to expedite it in the cases where it makes the most sense uh to your point about uh maintenance we do agree which is why we made it very specific that it was only for commercial applications and there are a number of other uh requirements in here um so for example uh residential HOAs in our right away all excluded because of the maintenance concern that being said uh it is a substantial uh benefit to developers and so trying to be responsive uh to them uh we wanted to offer this uh alternative path but again uh making sure that all of the concerns that you had enumerated are addressed thank you commissioner Goodson does this follow state code as far as I know I do not believe there's a state restriction on inverted siphons there none that I've come across does the state agree that you can use the polyure thinge pipe oh you're talking about the pipe I'm sorry all all of it either one you answer the first yes fdot has approved polypropylene pipe um they approved it in 2014 there's been extensive research on it um we talked to both this state as well as other municipalities as well as visiting some sites that had already utilized it to come to the conclusion that we were do they use it only in green areas in other words like through a covert easement it is actually approved for all ations driveways Road Crossings everything the cost to an owner would it be from concrete to that would it be 50% I don't know you tell me it's not a significant cost difference material-wise um there is uh cost savings installation wise if you get a contractor that's used to installing it um it's really kind of Hit or Miss depending on who's doing it okay thank you ma'am any other questions for Mark any other questions okay we don't have any cards on this so we'll move into discussion uh commissioner delini thank you um the other thing that I just wanted to put on the record is while I'm not going to die on the hill of the polypropylene pipes one thing that we need to consider with that is that when we have um entities like um cable or Internet those type of places or those type of uh businesses um if they're drilling into the ground there's not really a whole lot of room for error with these pipes because with concrete at least you know you hit concrete before you drill through with these pipes you go straight through it and it's you're now you have a much bigger problem to deal with um and then uh but the thing that I'm I'm really passionate about is these inverted siphons I think this is a poor practice I I am really worried about what this is going to do and I worry for not the person putting it in but I worry for the person that buys the property that may or may not know that they have one of these siphons and um then it goes unmaintained and then now this property owner um has this major issue that they have to deal with commissioner Goodson thank you if you commissioner if you know anything about Florida and dilling digging or drilling you better call for locations because the cost that you will occur in hitting a fiber optic is astronomical so therefore don't buy the idea of that you know drilling is going to affect anything because if you don't call you suffer but uh I understand your concern on the siphons commissioner Delany my um concern wasn't so much for drilling into say fiber optic my concern was that I'm sure you all get lots of phone calls like I do about certain companies they do their digging and they hit um sewer pipes and things like that so that is um you know it's it just it it's it's a lesser of a product like I said this that's not really the hill I'm willing to die on but the again the in in the siphons are are a problem in my opinion commissioner Goodson U I hear you but also you can't govern stupid okay um not on the stupid question mark but uh could could you could you speak uh to the other concern raised about digging May um interference with uh with these kind of pipes thank you did that one I'll take that um so in regards to directional drilling through pipes we do experience directional drilling through the concrete pipes that we have in the right of way uh can the these types of pipes be drilled through absolutely um the problem is less that they can't feel it the problem is is that they don't notify us when they do it so regardless of whether they've drilled through a concrete pipe and no they did it the likelihood that they call us is very unlikely um we did actually uh address the drilling with the um one of the major companies that carries this type of pipe and the corrective fix for fixing an application like that is actually a lot easier for this type of pipe so I mean the problem's going to happen eventually somewhere somehow we do a pretty good job of trying to make sure that those pipes are located on plans Etc so that they don't but the fiber companies it's a w wow West so there's a lot of it out there commissioner Goodson question the pipe um concrete pipe comes in 8ot lengths correct correct yes sir okay this pipe can come in 20 or 40 foot lengths correct uh yeah typically it's 20 or 24 yeah so therefore the installation would be uh greater for the contractor and cheaper for the developers that probably a good statement generally yes yes I thought so okay thank you very much and of course if you know anything about getting concrete pipe today it's extremely expensive and on and you wait for a concrete pipes sometimes yes because the demand is so high all right commissioner delini if there's no other um discussion I'd be uh ready to make a motion if possible okay let's just check on is anyone if commissioner if I could just circle back real quick to commissioner delane's uh concern over maintenance one of the stipulations in here is that a maintenance agreement uh shall be provided by the proper owner that includes maintenance frequency of the inverted siphon The increased maintenance needs uh for the inverted siphon and potential increased cost associated with such a system so we believe that we've addressed the concern although the concern is is a real concern thank you okay any other discussion on the item no okay uh we'll entertain a motion okay um so I've never done this before so please bear with me are we able to amend um amend what's here currently yes okay I would like to motion to pass this with the amendment that the inverted siphon stay with the board of County Commissioners are there questions on the amendment what is okay sir tell explain your Amendment again please just explain it to us one more time sure I would like to have the waiver um through the board of County Commissioners that way there's some kind of public record so that future owners are protected if a contractor would like to do that route question mark wouldn't that show up on the plans it would so therefore the developer and the owner buying a lot would have a set of plans showing it correct correct and as I mentioned it is before we would approve it we would have to have the property owner with their maintenance plan so they would need to acknowledge that as part of that process thank you okay uh does does that cause you to want to change your your Amendment or that's your motion okay we we everyone understands her motion okay is there a second on the motion a second okay so we have a motion by commissioner Del and for the purpose of the record will you just say say that one more time for the clerk to the board I would like to make a motion to pass H1 with the amendment to make the waiver still have to go through the board of County Commissioners and if I may just for clarity as I understand it that would accept the proposed amendment to 4.6 D adding the term polypropylene pipe but it would reject all of the proposed amendments to 4.6 J is that correct yes discussion on the motion right okay yes yes sir may I okay yes sir Mark if that was if this motion passes tell me how much uh it will affect your staff and affect the county and cost we don't get that many of the types of requests so it would not be uh that great of a uh you know administrative burden it it's really a request that the development Community has long requested it be moved from the board to uh our staff as an administrative process and so trying to be responsive we've worked over the last year or more uh putting this together uh but if someone came in we would endorse it if it fits this type of criteria IA and then we'd put it on the board agenda question if that was if this motion passes could you guarantee this board that you will catch every one of those or will they fall by the wayside obviously if if it's something that the uh developer or contractor did without us knowing I I couldn't say that we would catch everything but if they came through our office looking for an approval we would not approve it unless it met the requirements here and if there was any uncertainty we always have the option to come back to the board and say we have some concerns and put it on the board to approve okay thank you Mark okay Commissioners we have uh commissioner delany's satisfy the community rating system as part of the national flood insurance uh Protection Program uh for the county to Main maintain the current CRS rating uh that we enjoy of a seven um and it requires all manufactured homes newly installed or replaced in a special flood Hazard area to be elevated to at least 1 foot above the base flood elevation this is also in alignment with other parts of the code which require one foot of uh above base flood elevation uh but is specific for structures so this aligns that part of the code but also Keeps Us compliant within the nfip Community rating system to ensure that homeowners uh can get the uh best possible premium discounts on flood insurance standing by for any questions you may have all right commissioner R questions questions for Mark commissioner delini I just want to um this is for the public sake this is so that people can keep their discount correct that is correct the uh Florida Department of Emergency Management noted that we needed to make this update and so this is really just an administrative uh request so that we can stay within the program at our current rate thank you other other questions for staff okay uh we don't okay it's all right okay everyone we're going to go to item H1 so James road traffic calming and i1 I won I'm sorry okay I I promise we'll tighten this up Mark recognize Commissioners i1 is Jame roads uh traffic cming it was presented at the last board and uh continued until uh this one um there is a requirement in the stipulated settlement agreement of 2007 after years of litigation requiring um the traffic coming to be considered and for input uh from James Road residents uh a public involvement meeting uh was previously held as well as input solicited directly from owners uh of properties that uh Traverse James Road and then as recently as last night in the D1 Commission office we met with all residents that wanted to attend um to get into some more specifics um a traffic uh engineering consultant um which works for Taylor Morrison and confirmed by staff is proposing implementing traffic calming due to the Limit right away uh as there are no other cost feasible Alternatives in order to reduce uh vehicle speed and improve the safety of the roadway uh for users along James Road with the addition of um traffic um by the Taylor Morrison um development uh so the board may consider approving the recommended traffic uh all of the traffic coming measures approving one or a combination of uh rejecting all or other options as the board may wish to direct staff to pursue standing by for any questions the board may have all right Commissioners uh we do have a lot of cards on this item but we'll do questions first questions commissioner Delany um Mark if you could answer these couple questions for me um there were a lot of concerns about the narrowing of James Road and um from The Briefing that we had if I'm understanding correctly the road isn't actually getting smaller the lines are just coming in so the amount of pavement that's there is still going to be there that it's not going to be um no pavement is going to go away that's correct commissioner um so when we say Lane uh narrowing in in this particular case uh James Road actually varies from 10 to 11 ft so we would be standardizing it to 10 ft uh but the reason for doing that and again it's leaving the existing pavement it's moving the lines in by one foot is that we need a standoff separation for um from where the speed tables are uh and the guard rails and um that allows us to do that so it's really a bundle if we want to do speed tables we need that one foot of Separation to do the guard rails because of uh the roadside drop off Hazard that we are uh presenting by introducing a new condition which is in this case speed tables and um you kind of just answered my next question but if if you don't mind um um if I'll say it in a little bit more layman's terms just um so basically the guard rails were put in place so that when people go up and over the speed tables that there's less of a risk of somebody you know driving re recklessly and going off into the ditch right whether it's Reckless or carelessness or maybe uh blinded uh you know during night conditions or whatever the case may be uh we uh reviewed our concerns with the traffic consultant for Taylor Morrison and uh Taylor Morrison agreed to um in in the cases where we have speed tables to accompany those with guard rails because of our concern for safety and then my last question was about um there was some paint markings that were on the road and those were not put by the county or the developer correct that to the best of our knowledge uh that is correct uh certainly for the county and I believe for the developer uh we believe that uh some uh Goodwill individual took our map and tried to see where uh the speed tables would be uh but they have it slightly wrong and that uh made it so that some people thought that their driveways would be blocked uh we've worked with the consultant uh we've been out there on site and we will not be blocking any uh driveways thank you okay other questions for Mark are there any other questions I just for clarity sake here if if the board didn't do anything tonight what would be the consequence of that on this item so a as the stipulated settlement agreement currently uh requires in order for the developer to uh finish uh or complete uh their work um we would basically be seating um allowing them to move forward and then they can uh not have to bear the expenses of this I know there's some um and that's where option four comes in there's been some discussion potentially bonding it uh I don't want to get too far ahead on that uh but right now as the stipulated settlement agreement uh requires they can't finish the work until they do the traffic Hing any other questions for Mark before we go to the cards commissioner ainson um what would a bonding situation look like I'm going to ask uh the County Attorney first to weigh in on that one commissioner theoretically it would um look like the developer posting a bond or some other kind of cash security uh in the amount of the estimated cost of Performing the improvements in this case because the developer's cost is based on an actual contractor's bid rather than construction cost it would probably be that amount rather than that amount plus some contingency um but then that money would be available for the county to use within a a reasonable period of time potentially tied to something like issuance of certificates of occupancy within the new development or something like that and the county could decide to use that money either for the um improvements that are advised based on the study or some other combination of traffic calming improvements or not use it at all and then return any unused funds at the end of of the period back to developer of course then the county is at risk if there are cost overruns or if the county decides to do something you know different and and more costly than anything that exceeded whatever is posted would be County obligation not developer obligation and that also involves County Performing the work which means either self-performing or more likely Contracting to do the work as opposed to having the developer use their forces to perform the work now I'll ask a followup question what's um year-over-year construction inflation uh situation today so if we took the money and we put it we escro it and we didn't spend that for say three years on the traffic coming what what would be the INF inflationary effect of that just uh I won't so uh without uh quoting actual CPI I could say that we have seen some bids at 15 to 20% year over year since covid uh you know 2020 time frame okay so construction cost dollars uh are devalued 20% as potentially year over year fair and in some cases we've seen more okay thank you are there any other questions for staff before we go to the cards nope okay um Margaret basset James Road and today I saw a car go by doing at least 60 M an hour now we have that deep wide ditch if we don't get the traffic coming somebody is going to get killed out there thank you yes ma'am thank you uh Robin Hunter hi my name is Robin Hunter and I live at 2754 offshor Lane which is right off of James Road and um I just hope that you would approve traffic calming design that was put together by the by the county and um the windward preserved developer thank you thank you um Tom Sullivan thank you Mr chair Commissioners uh Tom Sullivan with the great Robinson Law Firm on behalf of Taylor Morrison appreciate everyone's time tonight um I'll just be brief uh appreciate uh Mark's comments and Morris's comments and the questions regarding the bond so um really uh Taylor Morrison is in a position to either construct the improvements that we have presented to you which we're willing to do to fulfill our obligations under the settlement agreement or we would consider the bond option as Mr Richardson laid out um the only additional wrinkle that I would add to that um and this is based upon a conversation I had with commissioner Delaney is uh in the event that we posted the bond and there were some uh improvements that were call them non uh James Road improvements that the county decided to use those funds for we would have no objection to that and therefore uh would not be requesting a refund of of those dollars if they were not used towards uh the James Road Improvement so I just wanted to clarify that um and then additionally Mr chair I know you have the speaker cards but I do have um Gil Ramirez uh who's our our uh traffic expert here as well as Fred Miller with Taylor Morrison so we're happy to answer questions that you may have if there's any follow-ups from from the last meeting so uh with that said happy to answer any additional questions and Commissioners um my name is Susan Rollins and I live on 2770 Pine Lily Lane which is right in the middle of James Road and uh I am recommending that you pass this and not put it to B um not is it called bonding the money and uh it kind of made me nervous what the gentleman prior was saying that maybe the money could be used for other things but I again I live off a James Road and uh I walk that road daily I used to walk with my dogs but um um they're unable to walk make that walk anymore but when I'm walking the road most people um um either will slow down or you'll see them pull over so that you can pass I mean it's only a 35 mph Road they'll pull over and they're real nice where other people I've even just the current traffic now um I've seen people where it's like they either mathematically know exactly how much space they need to pass me or um or they don't care because at some sometimes I could have reached out and I could have touched the car and at some point sometimes I feel like throwing my water bottle just to kind of get a reaction so but um I can't imagine how much uh worse it's going to be with the additional traffic of the development but I will say um it it kind of feels like right now we're in um this situation where um you you asked us what we wanted we told you what we wanted then you said are you sure and now you put it to a vote and and now we had this vote and 85% of the people that return the ballot said we do want you we do have concerns about future traffic and right now we have con 71% said they had concerns about the current traffic I I don't know how much desperate more desperate that could be is that people are begging you to help them I mean if 85% of the population of Bard County asked you for something you would probably give it to them and um and now 7 76% of the people said that voted said they would want these speed tables put in so we are asking for your help we're begging you to help us and um you know and uh pass this amendment and uh you know let us return to a very quiet community that we um that um we all live moved out there to to live in so anyway thank you you got 18 seconds left thank thank you appreciate you yelding back your time uh Jennifer theen did I say that right good evening welcome new Commissioners hey I have been working on this uh on the James room traffic calming for 20 years and 5 months tonight so it's really been a long road you can see by the the um previous uh um comments that uh it is something that's highly desired I have provided you with a map showing you the uh the overwhelming support for the um the traffic calming particularly the speed tables those are noted in green on the table um the TR our current traffic study that we had showed that there was uh average speed of 46 and 48 M an hour on a 35 mph on two spots on the road so obviously already we have a problem before we talk about adding additional traffic um we looked to the county uh to provide residents of James Road safe access to our mailboxes and area residence to walk pets or walk or ride a bike without the fear of being run over or someone ending up in the ditch I can tell you for a fact that I've nearly been hit three times while walking my dog I H uh I I have seen residents of nearby streets uh probably going in excess of 60 M an hour I cannot tell you how frightening it is when two cars are passing and you at the mailbox and there's a foot or foot and a half between you and a car doing near nearly 60 there isn't even a word for it I have asked the county to and worked with and visited board meetings and visited uh the rod and Bridge I know that you there has been hard work done between the county and the uh and the developer to come up with a Fine Design I plead with you I ask you to to put that into into effect we have a stipulated agreement that we worked exceedingly hard to put together we we know that the development is coming we're just asking for you to to to put the uh the traffic coming in to provide a safe environment for the residents not only of James Road but other uh but other residents within the area um I ask that you uh um that you would move forward with this and not delay it because if it's not imple now just as was mentioned by Mark over there that cost will likely increase so I uh I know that uh there has been considerable consideration and I ask for you to please press forward with the implementation of the traffic calming before the uh building phase starts on Windward preserve thank you for your time thank you ma'am Rick hefflefinger Rick he finger 2000 Juniper Drive I live off Friday Road um Dale Hurst ranches I don't think there's any question we're going to get traffic coming so I but I'm on Friday Road right and Friday Road ain't James Road so we're not talking about Friday Road right the problem is we're going to get a lot of traffic we already have speeding so I just wonder you know there was supposedly a survey done and there was a plan and you know we had a meeting the meeting was Miss addressed somebody doesn't know how that happened this whole thing has been a botch it really has I'm I'm seriously disappointed that I think the contractor's guy was let too much in charge and the county wasn't watching what was going on so now we've got a plan that includes guard rail and I realize everybody who lives on that road you're you're going to get traffic common I just want to make sure that everybody knows they're getting guardrail because guardrail looks like crap it does it looks like you live on a freeway I hope that the people that voted and they voted without guardrail that was not included so does there have to be guard rail I asked I asked you mark the other is there any room to you know can vote for all of it some of it now all of a sudden the guard rail has to be there because it's safety we have G no guard rail on Friday road we put more cars in the ditch than James Road has nobody's asked us about man we need to get you some guard rail well look if you're speeding and you fly over the speed hump you deserve to be in the ditch I mean you you can't protect it you know idiots you can't I don't know I I hope that everybody that lives over there is going to look at that guard rail and not be sorry later now why can't we go back out with another survey and say hey there's guardrail now do you want the guardrail 50% of those people said they didn't want the road narrowed where are those 50% now they already did the survey right met the legal requirement you notified them but you notified them with the wrong stuff you've changed the plan I I just I'd love to get guardrail I'd like to get you know my pipes buried and culs wide four lane you know Friday Road that's not going to happen Friday Road was completely ignored we're going to get a lot of the traffic and I realized that and you know we're 45 M hour and they talked about making the whole development 35 we can't do that because people would whine that they can't get out fast enough you know I I'd like to see a little bit of concern for the people on Cox and Friday is there something we can do how about those speed limit signs oh they're expensive I know that but we're not paying and where's that guy he's paying can we get a couple those signs throw them in for a while at maximum capacity just to remind everybody hey this is we're residential out here we're Horse Country we used to be you're going to kill some go you're going to kill some golf cart people on Friday Road you are because I won't ride my bike on it right now you don't mow the side enough for me even pull over how about a little concern for that stuff I know you're going to get trapped coming but I don't know that everybody knows exactly what you're getting that's all I wanted to make sure everybody had Fair opportunity and the right people got the vote that's all I got to say thank you sir Lee wi Schlitz shle uh shidel did I say that that's good try I answer okay sir I'm sorry good evening my name is Lee win shidle I live at 4137 James Road with my wife we've lived there almost 25 years we have seen an increase in the speeding on James Road in those 25 years the uh Walmart Distribution Center on 524 got a stop light a lot of the speeding is to get around two of those three stop lights there's one at Friday Road in 524 one at the Walmart Distribution Center and one at 524 in Cox so you got people speeding down James Road to beat two of those three stop lights the whether they're going west or east it's significantly increased the speeding on James Road FPL came in and put in large concrete power poles those block your view of people coming down the road now they are on the south side of the road we live on the south side of the road so when we pull up to the edge of our driveway in James Road we're having to try to see is anything coming because of those power poles we got to be very careful somebody speeding doesn't run into us or we don't hit them if we're pulling out and of course we're adding what 250 Homes at least at the end of James Road so we know that the speeding is going to increase absolutely as a minimum we need the speed tables bare minimum slow them down as much as possible there's still going to people still be people that are going to speed over them what happens to them well that's you know oh well but please please please vote yes please vote Yes and give us at least the speed tables on James road we've got to do something somebody's going to get killed somebody walking their dog somebody pushing their kids in a stroller somebody riding a horse I haven't seen anybody on a horse in years they just don't ride them anymore down there we have lots of horses in the area they just don't write them on James Road because of the speeding so again please I ask again that you please vote Yes as a minimum for the speed tables thank you thank you sir Ed dwire good evening thank you guys uh my name is Ed dwire I live on 4440 James Road halfway down been there for 24 years and I've observed the speeding I walk I actually made the traffic caling survey that everybody's seen that you guys had had had presented to you um we are the people that walk our dogs every morning between 7 and 9:00 I get to observe everybody going down the road and the people on James Road that live on James Road very rarely speed but the people that use James Road as AC Crossroads speed a lot and we deal with a a specific bus driver daily that I have to even wave down daily that that that that speeds down James Road that's going 50 m hour with a bus now it's it's it's unsafe for people right now if you add they say 250 maybe 400 homes maybe 800 cars 500 cars that road the study showed that that when they did this study of the 3-day period that there was 680 cars on average that's people using their cars three or four times a day going back forth to Walmart going back and forth to work that's how many is going down now so you're going to add another 8800 cars to that there's going to be a lot of traffic and the bottom line here is what we're looking for is that we all know the James Road and to bring up the man on Friday Road James Road is way different than Cox Road and Friday Road James Road has a 24t wide ditch it averages 12 feet deep it's 3 ft from the edge of the road on average from the edge of the pavement on the on the southide on the North side and then the concrete poles are 5 feet on the South Side so there's a pinch point there so if you're between the pole and the and the ditch you have it 3 feet on one side and 5T on the other side to get out of the way whether you be in a golf cart a horse walking your dogs your kids riding a bicycle you're pushing your kid down away in a carriage and everybody on Friday Road and Cox Road they all use James Road I see them every weekend they're all there on their golf carts they're bringing their kids down there they can go up and down on bicycles people walk on James Road and with all this traffic if we don't do that there's going to be fatalities there's going to be people getting injured and again if I'm wrong the Builder is agreed to put these speed tables in and we none of us have a problem with having the guard rails you definitely have to have a guard rail on this side of this ditch just because of the depth of it you don't want to have a speed table without a guard rail nobody's going to about what it looks like so guys I just want to say that what I'm what I'm really concerned about here is people getting hurt somebody getting killed I assisted in three recoveries in in my 24 years two of the cars were upside down in the ditch their tires were only showing one of the cars we didn't even know was there till the next day and a motorcyclist died so just so you know it's all about safety guys please look at this and vote Yes on this thank you thank you sir uh Roger Helms hello there I'm Roger Helms I'm a lawyer from over in the Orlando area nice to appear in front of you tonight uh commissioner Goodson good to see you I remember we elected you to the Port Authority back about a quarter a quarter century ago in the in the port uh actually I'm just glad to see somebody my age that's still working uh if I were Publix I'd be a BOGO buy one get one free um I had a career in law enforcement I was an accident investigator and a Reconstructionist uh went off in the military got shot in the Army went to law school and I sort of parlayed that into cases against Dot and planning agencies with regard to Road uh construction I had a case similar to what we're dealing with with this safety plan it was a u it was a sharp curve on Fort Benning Georgia um two young soldiers were decapitated by guywire on a telephone pole because there was no there was three or four feet from the side of the road I as a young investigator brought it up I said why don't they put guard rails or do something to protect it and cause it a big Scandal it's similar to what we have here you have a vetted engineered verified study by traffic professionals the Laster traffic group who have said that it's appropriate given the speed circumstances here to put these speed tables out here I can't tell you the names of the people whose lives you will save by doing the right thing and approving the plan all you have to do is say I vote safety I can't tell you the names of someone you prevent from being paralyzed but I will tell you as a trial lawyer that that costs $ 25 to $50 million in a jury verdict these days your county attorney can tell you the liability picture one thing for certain is with respect to Road design it's muddy and what smart lawyers do is get around things I had one in Orlando it was it's always planning versus operational they said you can't sue us for planning the stop sign out there but they didn't inspect it and see that the sun was bleaching it out where nobody saw it and somebody was killed at the intersection so in closing I can't tell you what'll happen I will tell you that it is my opinion as an investigator in the past and as a trial lawyer that specializes in this sort of thing somebody's going to get killed somebody's going to get paralyzed and somebody's going to be ask the following question so wait a minute you had a plan which was done by engineers and traffic studies to slow the traffic down to save lives you had a trial lawyer come to you and incidentally my fees have been set at $1,000 an hour in this circuit I'm doing this for free because it's the right thing to do and somebody will ask someday you had all this in front of you and you did nothing it's wrong thank you thank you sir uh now we're at the end of the cards is there anyone else who wanted to speak on this item and maybe we didn't get your card I know there there were a lot tonight no all right thought yeah no okay sorry but anyway that's my concern that they would have to be replaced at the expense of the County versus the Builder who was putting them in now so I just wondered if they can had a similar situation there we have a ditch on one side Trees close to the other uh by the time I ended High School I've pulled three people out of the ditch Dead uh where there an turn there and you know cars would go by our house 80 90 100 mph sometimes and these type of and when they just put the speed bumps down Chrisley Road I went to visit my mother and I said bumpity bump you know and she said isn't it wonderful the cars have slowed down I don't have as much traffic now I'm not as concerned as driving down the road and it does save lives so that's all I have to say thank you and everything we plan to build eventually I have a 8-year-old a 7-year-old and a 4-year-old and growing up like as kids you go out to the road my dad would tell me to take the trash out or whatever my kids can't do that we're cars fly down the street I'm working on the property bring tables or bring like Fallen trees down with a tractor whatever and these cars like you where we take our brush pile is across the street like if trees branches anything are down I'd take the tractor I dump it and the car goes whipping by like I still have to back up to go back into my driveway and it we need speed tables I hate speed tables with a passion I do landscaping and every trailer trailer it sucks but we need them I'm asking that you guys please pass it thank you thank you sir okay is there anyone else um with the people from this community and I just want to thank Mr bernath and um Karina for coming and she even came on a day that was on her leave so I just really really appreciate that and um I it means a lot and it means a lot to the people in district one that you that you did that so I just wanted to give you recognition for um for being willing to do that so thank you and um we've been this has been a long very long drawn out uh fight and um the thing that I have to stay focused on is what part of this development are we talking about today and um where I understand that uh what this will look like for district one and for the people of this community because I myself I'm dealing with the same thing right over 528 because I live in canaval groves so I I personally know what you guys are all dealing with um and so I just wanted to make sure that I let everybody know that if this if this get goes forward today as um as the engineers have designed um that doesn't mean that I'm not going to fight for Friday Road and I'm going to call on our partners in the state and our new Congressman to help us with our infrastructure issues here in Bard County and um that Friday Road will be on the front of my mind to make sure that we're keeping that part of the community safe as well because it's not just safety issues because this is psychology once all this traffic cing goes onto James Road regardless of what everybody's going to say there's going to be increased traffic on Friday Road there's going there's going to be issues and so I am making a commitment to you guys that I'm not going to stop pushing for improvements on Friday Road as well because we have got to make sure that everybody is safe in the whole Community um the thing that this we have a unique um opportunity here to have our developer friends um help us with paying for this Improvement on James Road and so it would be in my opinion silly for us to not move forward with um with what this plan is and um but like I said I I hope that my fellow Commissioners will partner with me on making sure that we Monitor and um keep an eye on what's going on on Friday Road as well because this is it's side of uh North Courtney Parkway um it is providing fair market value of $6,700 for parcel 110 235,000 for parcel 112 and uh for the other Associated RightWay uh because it's right away uh the county wouldn't get any uh costs associated with it um or fees Associated but this would allow FD to move forward with its planning of potential widening for State Road 528 okay questions for Mark are there any questions commissioner Delaney this is just for the Public's sake um is it correct that this is going to be widening coming off and onto 528 onto Courtney and then going east um onto 528 based on uh the parcels that they are looking to take uh that is what I believe but I have not fully seen their uh proposal at this point they've identified that they need the additional RightWay for what they have projected but it would make sense based on where they're looking for uh what I would call slivers of of our property thank you so hopefully this will be a good thing any other questions for Mark one off okay sorry Frank we've been working with uh space Florida for a uh last several years and preliminary discussions relative to uh needs that they have have and and the partners they have relative to water wastewater treatment um in on the barrier islands and recently we received a letter that we shared with the board that was signed by uh four of the secretaries of the the State of Florida from the uh Florida commerce Florida Department of Transportation Florida Department of Education and Florida of uh Department of Environmental Protection you know expressing their uh strong interest as well as that of the governor's office to uh sure that we are working in a unified manner to uh provide well water Waste Water treatment um where possible and uh we as staff uh have been in that in those discussions we've laid out in the letters that you see there were two letters that were attached on the agenda item uh that spoke to that issue and set certain parameters of what we would be looking for primarily it was to assure due diligence which is to make sure we're doing all the right things in terms of uh protecting safety in terms of uh assuring uh the the capacity that is at the Sykes Creek facility is uh is maintained for the rate paays that put it together and that any future uh utilization uh would be in manner that uh uh was fair for those that were coming into the system as well as for the Rays who built the system that's there now as part of that effort there is a also um uh what's called A Mir Grant which is a military installation resilience grant that we've been working with uh EDC on and the Department of Defense which speaks to a a longer term solution uh where we would have a regional facility somewhere on the mainland looking uh perhaps at in the Port St John areas what is is being looked at and and with that dialogue we are going to have upcoming uh discussions with uh with the state and the state agencies I mentioned and we having a new board uh thought this was an opportune time to make sure the board is aware of what's going on and to get your input as a as as the meetings are being scheduled as we speak uh Eddie fonton and our utilities director is here and he can uh discuss the item in Greater detail and uh we'll do our best to answer any questions the board may have and uh get the input so we know that we are U moving forward in an aligned and unified manner okay qu Eddie do you want to say something before we start with questions um we we can expand a little bit on that or we can do a question and answer um it's your choice I think commissioner Goodson's ready with a question yep go ahead sir if the Air Force station's been there 70 something years right and NASA's been there 65 years roughly correct why are we here today wanting us to take their sewage why didn't they plan for the future now if you take their sewage you're going to put your plant at risk of being overc capacity therefore you're not going to be able to sell this deal about septic to sewer for the Lagoon so help me understand why the federal government hadn't done anything well I can speak on behalf of the federal govern uh government commissioner but what I do understand is um the Air Force Base who has the wastewater treatment plant has made a notification about a concern that the blows at the plant are getting to a level where they're starting to put a limit on what space Florida can do in the future okay stop there then I hear you then why don't they increase their plant that would be what's the problem with that that's that's a question that has so basically you're telling me that seems to be no concern of theirs it all falls on us now at the same time didn't they recently ship some stuff South to Coco Beach that put the Coco Beach plan in Jeopardy of violating their D perent I am not aware of the dynamic with the Coco Beach I'll get you the report okay well now are we going to allow this to H here's my comment I don't I'm one of five I am never going to agree to this not unless you tell me that you're going to charge them enough that's going to allow you to increase your plant for the citizens that pay for it then you come back and charge the citizens in my district to do that no but I'm one of five but go ahead this is going to get excited I'm sure so well I I I'll say this commissioner we are in its infancy with regard to this and as um Frank attested we are we have presented some parameters to space Florida as at a preliminary level of what we want to accomplish from due diligence so when we're getting into um it is our full intention and if you read one of the correspond that we replied to one of the letters that were received that's a common theme we just want to be fair and fair is associated with cost as we continue through this due diligence we'll understand more of the parameters because as we're talking about potential industrial pre-treatment and whatnot it's identifying what it is and identifying the the strength and the magnitude and what that is and when you go through that process then you can then you can actually um identify the Investments needed to and I don't want to say Protect um Bard County but assure that us as Bard County are able to maintain the environmental laws that are in effect today would you not agree that you have slim or no chance to to but the federal government wouldn't you agree to that be honest let's all I'll be honest I've never seen the federal government roll over and play dead so I don't expect this to happen this is not going to be pretty this is going to be a nightmare and your taxpayers on marit island would go absolutely ape crazy so Frank yeah jump in I'm sorry that no no that's fine commissioner that's why we're here and that's why we're here to discuss it um staff has made it very clear we've had dialogue with EDC we've had dialogue with others and we've made it very clear that uh our expectation is that costs all costs that are associated with uh taking uh this uh waste water uh needs to be borne by those who are coming into the system that includes any kind of pre-treatment that might be needed offsite or any technological improvements or expansion that might be needed onsite to assure that we handle it appropriately in addition to that you know whatever capacity would be utilized our expectation is that's not only a short-term solution but on the long term that uh the whatever capacity they utilize at Sykes Creek that when we get to the regional facility they are paying the proportionate share of the new costs at the regional facility that protects the rate payers Who currently paid for the Sykes Creek facility at the rates that they paid when they invested in this some uh you know 20 to 30 years ago and so those are all parameters that we have put forth and we plan on moving forward with based on of course the board's input consideration um and the dialogue we plan to have with the state um when as soon as that meeting is scheduled which uh looks like it might be as early as December 9th right would you agree M May yes sir would you agree that North Mary has suffered you know extensive flooding piling of water and we have asked NASA for seven months or a year can we put it in their ditch and you know what they've told us hell no you can't even put water in the ditch now also would you agree Frank that you're going to have a you talk this Regional plant you're going to have to cross two rivers banana the sanctuary in Mar then the Indie River three and you're going to have to get permits from uh Guess Who Army Corps Engineers so that could be well one thing about it I'll be retired and dead good luck with your sewage but if you know anything about Army Core Engineers Frank it'll take 30 years probably to get that permit well that's part of the dialogue obviously Commissioners you know the the partners that space Florida has okay um they're not looking for you know uh uh that kind of delay I think if if you you know if you've been following what's happening with that they move rather uh quickly and so we are uh you know that expectation in terms of what it's going to take to move forward I can tell you that it's staff's concern that we not only look at a short-term solution but we have viable Partners who understand and are willing to participate in the long-term solution that long-term solution is one that I think the Department of Defense uh shares and wanting to assure that there's resiliency that we are you know protecting the environment and that's what the regional facility would do if in fact the study that is conducted uh that the board has supported uh provides that that's a plausible course of action of course we can't speak to that issue today we have to conduct a study that study um should be completed you know within the parameters of what the grant that was approved our Target is no later than May of 26 so that's really what we're looking at and uh we know the state's very interested based on the letter that you've read uh in and working to see how they can provide support in terms of uh moving this forward in terms of grant funding and uh providing the water quality improvements to the Lagoon how we can work together with them and and that's what they've told us and that's what we plan to be discussing with them based on board appr I appreciate your honesty and I'm sure you'll protect bard County uh and then we'll move forward all you're asking for today is to consider a study correct um actually we're just considering the parameters that we're talking about something the board is comfortable with oh yeah of course we're not going to make any firm commitments we're going to bring it back to the board um this is just the opening dialogue that forward federal government state I feel so comfortable I feel this kind of easing up behind me and kissing me but yeah but I'm comfortable with it Frank that's why we brought it Forward commissioner to get your input okay questions uh commissioner delania question I guess I don't really have questions I have more discussion so I can wait if that's better we do have cards so um we'll do a discussion after cards commissioner Alman you you have a question no no sir okay okay all right let's let's go to the cards uh St Bailey St Bailey poor St John I have testified at the White House before ceq about pollution from the space industry and how it affects the quality of life I have worked with Congress the EPA and several National groups on issues like posos chemicals and the dangers faced by military families and firefighters my dedication to improving water quality and health of impact to communities has has gained International recognition it is concerning that the wealthiest people in the world who stand to gain from this Spaceport expect the residents of Florida to shoulder the financial burden of crucial infrastructure enhancements tied to the space sector in the Department of Defense upgrades they were aware of that were necessary at least a decade ago if this industry can create rockets that can travel to Mars we should certainly be able to prioritize creating sustainable living condition here on Earth to ensure our species Thrive yet they now anticipate that our County will bear the weight of our Wastewater issues I find it deeply troubling that the space industry and our federal government are neglecting their responsibility regarding Wastewater management and the lack of comprehensive plan for sustainable growth it is astonishing that they would have the audacity to send certified letters to the county implying the county could face serious consequences if it fails to meet the demands of the IND industry the industry is set for a significant growth and it is eyeing the funds the community members spent years fighting to save the Indian River Lagoon to support their growth the investments in water restoration were never intended to benefit the Industries or developers in fact Ness has spent decades dumping waste into the Lagoon and has not done nearly enough to help mitigate that marid island is currently grappling with serious flooding challenges and now the federal government is looking to add to the strain to this community by by temporarily hooking their Wastewater to Sykes facility this facility is expected to hit capacity within 10 years and is already notorious for frequent spills we should be operating at 50% capacity and prepare to prepare for storm surges flooding and other environmental challenges unfortunately most of our wastewater treatment plant in bouard County are not in addition there are plans to build a new facility in Port St John where the industry aims to divert their waste from six existing plants while space Florida has pledged to invest in infrastructure taxpayers will still bear the cost by being forced to pay to 10 to $20,000 a front to connect to sewer system although there are grants people pay those costs first and have to wait for a reimbursement perhaps space Florida could ask their billionaire Partners to cover the connection costs instead of trying to use funds meant for water quality to cover the industry's failure to be proactive and manage its waste and growth properly I urge this commission to ask imperative questions like how the waste will be brought across an entire Lagoon consider our options and ensure taxpayers are not exploited explore Solutions like a Spaceport fee an embankment fee also approach our state legislator to address the Impractical to impractical 2030 septic to sewer mandate and find a more effective option for the soral other than a reimbursement I believe a new CL plant could benefit us but I feel you are putting a lot of pressure on our communities by not considering the cost that space Florida and the documents that that the documents provide have overlooked thank you thank you still sander Sullivan good evening Sandra Sullivan so when we talk about space Florida we're talking about the biggest controversies and corruption that's gone on in Bard County um that I'll leave for another day but I want to talk about a couple things that were brought up here um so first of all um in September the end of September there was a meeting um I was printing out the agenda and parts of it I got dressed and I was ready to come and I get here and there's an item added to the agenda between the time I left home and the time I got here which is $1.71 million to put to this second study for alternative three to put a regional sewage plant I have a lot of issues with that um and just how that went down EDC represents private interest they did the first study I did a records quest for the black and velic study and uh they didn't even consider putting a sewage treatment plant in space Florida for their Industrial Waste so one thing not really talked about much sort of going around the bush is this is Industrial Waste and you can't put Industrial Waste to a region to a sewage plant that is for residential sewage which works on activated sewage bacteria to break it down soon as you put Industrial Waste in that that plant doesn't work okay so this idea oh let them clean up the Industrial Waste well if they're going to do that they might as well build a plant a package plant to handle their sewage waste this problem started because space force doesn't want their sewage private sector so let's talk about about merid Island a little bit merid Island County spent half a million dollars on a hydrology study it's on the 10-year flood plane and why the corruption to take space Florida and have the permitting done by the city of Titusville in 2010 was I think to avoid the requirements of the county not to bring fill in to elevate their lands which clearly if you look at the U Google Earth Pro you can see that they did the other major concern that I have is this we just got a president for America First what we have going on in Bard county is we're selling off Bard to foreign interests I believe based on um the documents that this whole thing is about a piece of property that bright line purchase bright line which is owned by Fortress which is majority owned by a Ab boo to buy which is Dubai come into the port you see the big Exploration Tower welcome to the Dubai of the Americans that's what we have here our Port cargo space hundreds of billions of dollars and now what they want a regional sewage plant so they can do our sewage infrastructure as well one last thing about space Florida you guys passed in legislation this past year on Senate Bill 102 putting in affordable housing there this isn't just about space Commerce this is also about residential housing thank you and there's a lot more stink about this thank you uh Jack rman I don't know I'm Jack rman North mer Island 568 East Hall Road I represent the North maritt Island HOA which represents all the homes from the Barge Canal to the NASA gate I'm also on the North Mar Island indp special district board which represents uh the interest of the north Mar Island community and we're elected board and we represent according to our map here from the middle of the Barge Canal to the middle of NASA Causeway and these folks over here have never at all asked us to look at any plans they have about putting anything on the property that we're supposed to regulate so the due diligence I I I beg to differ with them uh I'd like to remind the board that the one that I'm on is also elected like you are I'd also like to ask who's going to pay for this new system what's the present uh percentage of the capacity of the merid island uh facility I think it's 85% now understand that it'll be Industrial Waste who's going to regulate whether it's Industrial Waste or residential North Mar island has many concerns because we've not been dealt with we've been dealing with flooding and other issues and this will just be one more we're asking that this be put off in a public meeting and additional public information be given I would like to know how much is going to be the increase of liquid that's going to be pumped down the how many foot deep well anybody know no are you're not going to 2,000 foot well below the aaer and anything that they have extra that's what they pump down so that would also increase that please don't do this without the consent and uh input of North Merit Island I'm asking you this I'm just just a humble eighth grade American history teacher but uh I think I have a good nose to smell and this smells like a a rotten fish thank you thank you sir uh Rick he finger Rick he finger 2000 Juniper Drive district one um I was going to come up here and just congratulate Frank on a wonderfully Written Letter about due diligence and the whatnots and then I heard the other speakers and it's h it's a hard night Frank um a lot a lot of this is water we we don't have enough we're building a bunch of developments and we're not even sure where our sewage goes and yet now we got the space port guys want to dump their stuff in with I mean I don't live on Meritt Island but I feel for you guys and and I thank commissioner Goodson for standing up for those people but hey if they want to do that there's there's a great answer you know what it is you pay for our stuff as well as your stuff and don't charge the taxpayers anything they we've got something they want it pay for it that's that's the bottom line right so the due diligence is make sure that doesn't fall on the taxpayers cuz we all love the Spaceport right rockets and all that's great but you got to pay your way that's that's all I have thanks thank you sir Milo zanka this is going get good now it's it's full circle Milo well this will be fun first uh first time caller no not really um list I want to make very clear I am an employee of SpaceX I'm not representing SpaceX tonight I'm representing myself I'm actually representing the guy who stood here in 2006 when we celebrated the fact that you know after after Decades of only being a launch property that uh we actually brought the first manufacturing uh for space to Bard County and that was the crew exploration vehicle from Lockheed Martin back in 2006 and the county went we loved it and from there we've seen what's the other things that have happened so many programs so much growth so many new opportunities and with that come the consequences and that's now what we're talking about we we like it when the companies come and they build and they hire contractors to do their building we like it when they hire people who buy houses and do shopping and do all those things but those people when they go to work they poop that's that's what we're dealing with and when they're manufacturing these next Generation space vehicles that are going to go to the moon and the Mars and carry America's flag and put it on the moon when they do that manufacturing it uses water and it creates Wastewater so those are the downsides of the glory of having the jobs and the investment and and to be able to say that we are the home to Intergalactic space right here in Bard County all that said I want to reset the conversation just a little bit because I don't think the space industry has asked for this to be free I don't speak for the space industry I don't speak for my employer I'm just asking a few questions that I think are worthy of being answered I don't think anybody has asked for it to be free I don't think as anybody has asked for it to come at the expense of The Bard County rate payer and and I think if we can just take the conversation down a notch and not be in a contra in in a controversial phase and in an argumentative phase and and get back to the information phase and and that's the only reason I came here tonight was because the entire body of information that you're being asked to make a policy decision on tonight was four letters and I think there's more information that you need to see that we need to see I heard the gentleman ask for the uh the capacity study for Sykes Creek I that could be public record I think we could all benefit from having that information to understand what those issues are what's the cost to expand syes Creek that would good information to put out there again I don't think anything anybody's asked for anything free and I've spoken with Eddie spoken with Frank and you know just just from out of those Curiosities but you know I just want the information to be out there and and for you all to be more fully informed uh these are very serious issues there are serious issues with lots of Awesomeness and and Rockets that are going to go to the moon and Mars and employ people and you know and those people are now are you know Staples in our communities uh in our schools and all of those things I I work with the most amazing people at every company you can imagine up there and and they are deeply vested in this question so I would just say as you're looking for policy Direction on this there's more information that needs to come to come to the record I really appreciate the diligence and all the work that you all do and thank you very much for your service thank you yes sir a got a question for you if all this is just so wonderful and so special right I mean it's not asphalt but it is pretty cool well I know but you know of course on asphalt asphalt I can go to the woods you're locked up there and you can't poop right I can I know where to I go to the woods right yeah but if all this is so wonderful why is it taken 70 years for you decide that you need somewhere to relieve yourself well by you you're not talking to me cuz I'm not that old but you said you were up there I I I work up and I go to the bathro there wonderful so I here's the problem if you if I have a m an extra moment I would tell you what I know of the system the Cape Canaveral system was was built to accommodate a certain level of activity that's on the Air Force Station NASA doesn't have a water a wastewater treatment facility they shce everybody uses the Air Force and that Capac that plant right now is at I think it's about last I saw from the studies that were done was at about a half capacity and then they've got allocated the rest or they're worried about storm water intrusion you know you flooding the plant so they they hold back some of the capacity so that's that's the current challenge now I don't think anybody lack of vision whatever you want to call it I don't know if anybody envisioned the level of success that Kennedy Space Center and and and and the Space Coast we're going to have because you now have millions of square feet of new facilities that are up there and thousands upon thousands of people working there should they have been more aggressive in their assumptions yes but now the question is do you want to double down on a plant if you've ever been to the plant at Cape canaval I've I've been I've drove driven past it it's at elevation like 3 in it's not the place where you want to put another dollar to build a plant you to expand a plant and I can see why the Port St John is to try to get everybody's treatment off of you know resilience issues that kind of stuff now would it not be true to say NASA doesn't build a rocket I NASA contracts with people NASA doesn't build a rocket correct correct that's very correct but yet we have a just buil a brand new complex Office Center for them up there your tax dollars mine yeah so if everything's so wonderful with SpaceX it sounds like we could cut NASA and have 20 more years on the poop plant what do you think of that I'm not party to that conversation but I appreciate the thought well president Trump has got Two Fellas that's going to be part of that conversation I'd imagine but hey I'm all for it as long as you don't hurt merid Island I think it's wonderful and again I don't as long as you don't ship bad stuff down there I want premium stuff coming to our plant the good stuff yes intelligence stuff I'll need Italian and I'll I'll pay you a visit okay okay thank you very much can I say something sure you can yeah I think that the tone that you're that you're getting is is I don't know if you read these letters that we got I did yes but they're pretty pointed and how dare the state and how dare the state do this and try to withhold funding from the people of this County and handcuff us so that is the tone that you're getting and I say this with all due respect it's not my that that is not my argument my my and and that's where I my point to that exactly is I think those four letters should not be the the the breadth of all the information if you're being asked to make a policy decision that's all I'm saying I I didn't write the letter I think that's what we're talking about tonight no I understand I do I I I get it and and it's just trying to take the the the temperature down just a little bit because at the end of the day there there does have to be an answer and so if if if the first answer is don't send us another letter like that you buttheads that's that's that's a perfectly valid position but then we still got to get to a solution AB that's all thank you I didn't say that Governor you said it I did say it I did not call the governor buad thanks Milo uh okay Commissioners uh we're done with the cards based on and and let me just clarify real quick is there anyone else who wanted to speak on this issue I had a lot of cards tonight no okay uh are there any follow-up questions for staff based on uh the cards that you heard tonight commissioner do is there any way you can get for us the um capacity for Sykes Creek and um like where we're at with that not tonight obviously but will you get that for us I mean right yes I can get that now what does Frank need a motion just to proceed on is that what he need I Commissioners I think we the the what's requested of us here is to give direction to staff on on how to proceed so I think uh as a board um we need to we need to get something um well let me let me pause here for a second here I'm I'm sorry commissioner rman I think uh this is an incredibly exciting opportunity for bouard County to really be a part of something is much bigger than we are we are the community that put the only humans on the moon we are the community that's leading the way to making our society interplanetary which we know ultimately we will have to do if if we're to survive as a species we uh we really have a can do attitude this allows us to be a part of fixing a serious problem that the space centers facing now but it's a good problem because no one anticipated that we would be soon facing 600 launches a year that we would be U having U having colonies on on the moon and on Mars that we would have this incredibly talented individual who's able to launch rockets and literally catch them in the air when they come back no one could predict the rate of of growth and the rate of scientific breakthroughs the that have been achieved and they've been achieved through American Ingenuity they've been achieved because of this wonderful wonderful entrepreneurial private sector system that we have and what's happened is we're in a space race too where China now has returned samples from the Moon they've landed on the polar region of the Moon they're leading the way of getting back to the moon and they are no friends so we are embarked again on a space race that really is uh our national security is depended on winning I was there when we built uh the sces creek plant and if if somebody would have told us that we had an opportunity of providing needed sewage capacity to a guy that's launching rockets that can hold hundreds of people that were going back to Mars going back to the moon and going to Mars that we have an entity called space force that is at at at Cape canav Air Force Station space force station and at Patrick that is leading the way in the world to keep our national security that we have two launch providers uh uh that are two of the most Innovative wealthy entrepreneurs in the history of the world that need help I think we would all be excited about that opportunity that the investment that we made 30 years ago 35 years ago that can be a very significant part of achiev achieving this National goal this goal for mankind the greatest the most exciting and The Greatest Adventure of our human existence this is something much bigger than us and I hope we can I think Bard county has the ability to step up to the challenge and be a part of that I um so I hope we we take a can do attitude and we work with our private uh partners and um we can we can rise to occasion that that do some of the most basic things things that County government does provide infrastructure this has happened so fast that NASA couldn't foresee it and even a lot of the private sector could foresee it but you know what Bard County foresaw it we built the site que plant that still has 10 years of capacity left we can fill this void it has to be done quickly and in the long run I'm convinced that the people in North maritt Island the people in bouard and the people of this country will prosper because of our actions here tonight commissioner Delany you're next thank you and thank you commissioner Alman for for all that and I I definitely agree with you with with um how important the space industry is to Bard County um for the Public's sake I I really would like to speak into the record of these letters of what of which we're talking about um because I think it's important to this convers ation um on August 13th we got a letter from space Florida from the CEO of Rob long and that was a very pointed um letter the tone of it um was unacceptable in my opinion and especially with the next email that's on our um or the next letter that's on our agenda from our utilities department basically saying that these conversations had have gone on for the last six years and space Florida is the one who has not done their due diligence they did not do their part in the deal and so accusing Bard County of not being good partners right off the bat out of nowhere is is a problem to me and then when our director sent that letter to be for on October 28th the Florida commerce space Florida the Department of Transportation the Department of Education the Florida Department of Environmental Protection to send us this letter basically threatening all of our projects here in Bard County and I'm looking at everybody in the room and I hope you guys hear this loud and loud and clear and at home our government entities at the state are threatening Bard County and thankfully our County Manager sent back a very pointed letter at them to bring them back to reality and um I hope and I would like to preface this because I I we need a we need a solution to this problem so this is not me saying um that we don't want to work with you or we're not happy to have this partnership or any of that but if we're going to be partners I'm asking these entities who sent this letter to actually be our partners and not threaten the people of Bard County with that being said um I have some concerns um and I'm I'm glad that we're having this conversation because um I'm very concerned about the Industrial Waste I'm very concerned about who is going to be paying for this um this should not be on the backs of the people of merid Island um is it even possible to expand our our plant in in the way that's needed to handle the Industrial Waste um there's just so many things and then looking forward to the future what does that look like for um because this is just a short-term fix what is the future going to look like with this Regional plant that we keep hearing about but there's really not that much information about um how is that waste going to go across the river how are we going to ensure that we're not going to you know pollute our River and that our people are going to be um safe because we don't know what kind of toxic chemicals are going to be put down these pipes and if that leeches into our River if there's a pipe that bursts and gets into our groundwater there's all sorts of things that can go along with this and so um whatever path we take forward we need to ensure that our people aren't being taken advantage of because I think that we equally need each other um there's only so many places in the world that can um you know allow Rockets to go into space and in my opinion I think we're one of the best places in the world to do that and uh or the best place to do that and uh so I would like to expand on that partnership and be good you know come up with a good deal for everybody thank you um sorry keep commissioner Goodson I uh let me apologize for before I start for my rudess okay now commissioner uh Alman tell me you've worked 20s something years for the Florida Memorial astronaut Foundation correct or how long I've worked there um 11 years you know and I was thinking about 11 years experence I'm answering your question this was the question but now you have a vested interest in this I'm going to answer that question no I don't I have a vested interest and this country leading the world in space Explorations you know um I was thinking about the type of programs we have there we have educational programs so one of the biggest programs we have is called the International Space settlement design competition kids from all over the country come and they design the things that we need to have to have space Explorations one of the first things they start Water Resources sewer treatment we are part we have a duty we are a part of that great Mission that's that's bigger than all of us uh in that space and that's who we are that's why we're here and I'm I'm excited about that I'm really excited about the opportunity to work at the Space Center and to be a part of that thank you I I I grew up in construction like you y and I uh I my family moved here for the space program and I think we have an opportunity we have a a great opportunity and a mission and a role and a purpose to support it and to be a part of it I don't think there's a better Community to launch U as the commissioner said and it's important we have a a sacred duty to meet the challenges and this is one of them huh this is one of them okay that being said though would you agree that at the turn down of the atlas program NASA left here and at night and left you okay all that being said I'm not mad at anybody but if you're going to sell the barn you might want to know who's pulling the wagon because it might be going tomorrow because if Elon if um musket something happens in Texas is better you think he's going to just say who I'm staying here because of the poop plant so I I don't I hear everybody's great thing great vision and all that and I hope you all get to Mars before I die but God Bless you that's all I can say because we got to protect the citizens and we got to protect Bard County that's all I'm asking for okay uh I'm over commissioner ainson I just wanted to expand something on uh that commissioner Delaney said the response that Mr Abate sent was strongly worded and I thought um a good representation of how generally the people of Bard County feel um I would like to see you and your team continue to advocate for the residents of Bard County based on the wording of the letter that you wrote I have um a lot of belief in the team that we have working for Bard County residents that's all uh commissioner Delaney is that new light I think it is yep no okay um anyone else in debate okay uh Frank maybe you give us just some guidance on what you're looking for from the board here in terms of Direction what is it that you need to go to go forward I think the staff and I have very clearly heard what the board has had to say I think it's very consistent with uh what we put in both letters um we have a um an absolute expectation that due diligence will be performed that due diligence will help us with the issues of capacity will help us with the issue of the type of waste it is and make sure it's properly handled looking at the shortterm and long-term solution and very importantly that uh none of the additional cost that's going to be associated with this will be borne by rate payers I think you know if the board gives us a motion to follow uh relative to those themes uh you know we have a plan to move forward and of course anything we would have would only be dialogue that we would then bring back to the board for any action you know as we move forward so we make sure we explain it to the board uh explain it to everyone and then uh move forward only when we get you a thumbs up on it any questions on that nope any any more discussion on that I'll entertain a motion uh I'll make this glorious motion say it in the mic oh say it the mic for the for the C yes I will make the motion now you turned it off there come back and report that part is clear I want to make sure I understand what what does that do relative to the meetings that we have that are now being scheduled by the various state agencies with space Florida is that uh is that part of what we're going to be doing or is that something we need to pull back from I mentioned that we you would go over all the content of the letters and and the letter had content with all the state agencies and I think okay I've read all four of the letters I think all four of them were written very well I don't agree with all of them but but I um but I think it it gave us a good platform by which we could have a really good discussion and there's been a lot of concern about those so we can vet those and clarify those and maybe correct those May good to come out of it thank thank you commissioner okay we're g okay we're going to go on to a public comment Darlene hiters and we'll have Janice Maran after that hi good evening I know this is not on the agenda it was removed it was concerning uh making Bard County a sanctuary for the Bill of Rights and I wasn't able to go to the presentation right before Thanksgiving um put on by the organizations that are pushing for this to be passed and I did a little bit of research of my own online just to try and understand what it's all about and to me it just sounds like they're wanting to be able to refuse if the federal government authoriz izes some mandates um and I think a lot of those we already have those rights so basically my question is who would make the decision whether or not what they are opposing is unconstitutional and I know you folks are probably be reviewing all of this and it might come up for discussion later on down the line but that is my question who would make the decision that whether or not we follow a mandate by the federal government whether it's unconstitution and we don't have to abide by it in my opinion also I think it would create a lot of lawsuits which would be a great expense to us you know to fight for those so that's all I wanted to say thank you for your time and have a good evening appreciate your input thank you ma'am sure jice letting me speak and uh I just wanted to Simply ask you to vote no for provard becoming a sanctuary County uh my father was in the military uh he was in in Germany at the end of World War II he was a uh witness at the nberg trials came back and told us kids do not ever let that happen here in this country and I believe in our country I'm a good American and I think that the our checks and balances between the government really work well and I do not think that we should be thinking of ourselves as somebody that can determine what is constitutional and what is not I think it's almost seditious to try to even do that um so as an American citizen I ask you to please do not even consider doing this is just not the American way thank you thank you ma'am St Bailey St Bailey poor St John Florida um first I want to welcome everybody and the new chairs and then some people that have been here for a very long time welcome back and welcome to the County Commission I didn't get a chance to say that um I want to put out a challenge to this commission and the first challenge is to commit to doing a ride along with our firefighters and then coming back and reporting to the public about that ride along um and what you experience and the Second Challenge is to meet with a minimum of at least 10 firefighter families and talk to them face to face about what they're experiencing in this County and what it is that they need and and lastly I want to remind you that you represent we the people we are your bosses not the lobbyist not the out ofate developers we the people are your bosses you represent us and I want to remind you that please uphold your oath and make sure that you uphold the Constitution thank you thank you uh Mr hefflefinger Rick he finger 2000 Jun for Drive District 1 um wanted to kind of uh by the way I like what's going on up here we're talking about stuff we're going to get some we could do like round taes and stuff like that and information sessions for the public because a lot of people are scared to death when you start talking about building new water processing plants and they're all going well I saw my water bill already went up what's going on with that so this this thing about informing the the community is a good thing so I appreciate all you guys and I like the direction that's going um I did want to thank uh Frank for a letter I I got some information that all of a sudden there was a little musical chairs which I I called it musical chairs for um parks and wreck and I was wondering how you guys you know make those position choices and Frank wrote me a nice letter back that the parks and wreck is going to be Ian golden and I guess that comes between in front of the board for you guys to confirm I didn't know how that worked um I was I was interested to find out that you guys have a secession plan and I was wondering well why don't you just post a job posting and take resumés and hire the most qualified person I don't understand sucession plan that almost sounds like you everybody's pre-programmed to move up through the government and nobody leaves this big bureaucracy like we've got in the federal government that worries me a little bit I mean I hope I don't know who Ian golden is but parks and wreck was uh pretty hot a little while ago about a park somebody trying to take our park so um I hope you guys just pay attention to that I'm concerned because I think it was stated you guys all work for us and everybody over there does and everybody over there does and we'd like to have the best qualified person in a job and I think the way to do that is to post a job and the most qualified person gets selected so you know you have that option I it's all I wanted to but hey Frank responded to my my inquiry about that and I was glad to hear that you know he responded so but I do like what's going on and I and I hope the transparency thing is something that you guys all want to do and we can be you know we can be nice if we have to be even Tom could be nice so I I like the fact that we've you know got the opportunity to come up here and exchange information and I'd like to thank Katie for going to bat about our traffic caling you know all this growth and stuff we have a lot of issues and the only way to can solve them is to talk about them and make sure we're not getting getting the short end of the stick and uh we're always concerned as taxpayers that we don't get that thank you very much thank you sir I appreciate that uh Pam castellana good evening and before I start I'd like to say thank you commissioner felner for not only meeting with me but but initiating that conversation yourself to make sure that I felt heard by your office last week I appreciate that thank you um Eis Unum out of many one our differences are what make our country great and our for fathers crafted a clear explanation of roles for our three-pronged government with a strong Federal presence the County Commission is not a Judicial body it is not the role of our County Commission to interpret the Constitution it is the role of the Sher it's not the role of the sheriff to do so it is the role of the judicial branch as outlined by article three of the Constitution sh prob thank you for attempting to bring the sanctuary City for the Bill of Rights to our County at this time with president-elect Trump announcing many blatantly unconstitutional programs it would be great to have the ability to require our Sheriff to refuse any calls for the use of US military to enact Mass deportation if they came to our County it would be great to have the ability to acquire our County Commission to ignore any demands that may come to establish religion in our government Spaces by requiring any particular religion's text to be posted on our hallways like the Ten Commandments but why stop with the federal government we and Florida have already experienced the reality not the imagination of tyranny and authoritarian overreach if the governor were to try to remove an elected official in our County for political reasons rather than malfin it would be be great to have legal teeth to force our elected officials to ignore that order but that's not how it works out of many one this proposal that is now shelled but I think it might come back um would create distrust of the United States government and indeed distrust of the Constitution itself our Bill of Rights was ratified on December 15th 1791 it has withstood cries of tyranny and states rights leading to out out Civil War it has withstood the ending of slavery the Civil Rights Act desegregation of schools over the objection of many lawmakers right here in our in our County uh and desegregation of our military it has withstood the expansion of legal rights and protections to formerly enslaved persons all black people and women it has withstood the expansion of legal marital status through interracial marriage to samesex marriage I dare say it will withstand any and all assaults and does not need vard County's sanctuary and frankly with all due respect I was in this room two years ago when my mic was shut off with a minute left to speak when I was addressing our government I'm not sure I trust everybody in Bard County with our first amendment much less the rest thank you for shelving this for now I hope it doesn't come back thank you thank you very much Sandra Sullivan Sandra Sullivan so first I want to just talk about our firefighters given that uh we're headed towards a public safety crisis and maybe you could take the nearly mil about $9 million that you got as a unexpected windfall and put that to Public Safety that would be a Band-Aid it wouldn't be a fix but at least it's a step in the right direction also I want to mention that I was here for the County Commission meeting when the discussion was about extending uh the county manager's contract and it was until the new commission came on that was the vote that was taken and in fact it was chair feltner that made that suggestion I think it's time for him to resign and to rebuild trust in the county now I want to go back to a bigger issue of merid island in the six plus years I've been coming here what has filled this room more than any other issue citizen driven has been mered Island flooding and the reason is is because it's a 10-year flood plane developing that with a lot of extensive plans that are underway right now including affordable housing um it's when the change that was made in 2024 is very deeply concerning to me um I want to talk about the NASA condemnation uh this is uh process in taking public land that is the history of that land and it must be used for public use public use only okay and that's clearly not what we have what is interesting when you look at tax records they are not paying in space Florida they are not paying taxes now on Federal Land you expect that they're not paying taxes on the land but the buildings that they add when you review the end beds meeting and end beds is another controversy a very deep one very troubling one because end beds was created because of the legal issues with space Florida but there's no taxes on here for the the additions of buildings and whatnot this is space Florida uh this is blue origin the only tax that they are paying is garbage pickup that's the only thing in here there's no storm water don't pay for St John's River Water Management District they don't pay anything maybe they should be paying some tax to provard this is the Crux of the issue of space Florida and the controversy this is the North merid Island special district jusa space Florida is an independent district North merid Island special district is its own special district that has a jurisdiction over that area north Neds was created Creed to circumvent that by intent and one of you as a staff member who is involved with the district then involved with that thank you Bob White thank you Mr chairman members of the commission congratulations to the new faces that are up here uh this evening and to the uh Old Guard as well no reflection on your age commissioner Goodson um listen I just wanted to speak very quickly on behalf of the Republican Liberty caucus of Florida which I chair we have come alongside the Constitutional Sheriff's and Peace Officers Association cspoa in advocating for counties around the State of Florida to become a Bill of Rights Sanctuary uh we have no less than four of our chapters that are currently at work within their counties to advocate for this if Bard County was to pass it it would not be the first County to have to to declare itself as a Bill of Rights Sanctuary it would be the sixth County to have declared itself as a Bill of Right Sanctuary uh there's been some suggestions made uh in public comments that this would open up the county to lawsuits on behalf of citizens is actually exactly the opposite it was a great discussion that we had earlier congratulations to the members of the of the public as well as to the Commissioners that were so eloquently speaking on on behalf of the citizens of Bard County as it relates to the potential Financial fleecing that they would experience at the hands of the federal and the state government the only thing that a that a bill of declaring the county a Bill of Rights sanctuary and passing an ordinance would simply empower the county to more easily and reasonably defend the citizens of the county in the face of a federal overreach uh that is abusive of their constitutional rights of the Bill of Rights that's all this is and if you think that that the that the federal government is has has complied and is operating within the bounds of the Constitution then you've got a then then you're just completely out of touch with reality uh Madison himself declared that the powers of the federal government are few few specific and well- defined while the powers of the states and the people thereof are virtually Unlimited okay and open to great discussion and great debate over exactly where that goes Thomas Jefferson said that whenever the federal government overstepped its bounds and stepped out of the box that the Bill of Rights was created and the enumerated powers were created to keep them in that the states were in fact Duty bound Duty bound not only did they have the right they were Duty bound to nullify those actions of that out ofcontrol federal government so that's where we find ourselves today we find ourselves at the mercy really of a federal government that is completely out of control and gets more and more dangerous and more and more abusive of our rights with every single day that passes it seems and now the State of Florida is coming right alongside the federal government we've got issues that are coming at us not just not just domestically not just here in this country we've got issues that are coming at us internationally there are international organizations that are working to try to create International agreements that would literally literally wipe out many of the constitutional rights that we experience here in this country all right sir thank you very much for your time thank thank you okay Commissioners we're going to move into uh board report Mr County Manager I do have an item that I want the board to start considering we are going to be coming back to the board very soon uh to get input on uh moving forward with our legislative delegation um we've already uh spoken to Ron book's office who'd like to meet with us next week to start setting priorities uh for moving forward I can tell you I had the opportunity very recently to meet with Congressman elect heropoulos who's very interested in supporting the county and moving things on a a federal level and wants to make sure that uh you you know we give him good information on on things that are most important to the board obviously with the new board staff is going to be seeking your direction I have already spoken to directors and anticipate having their input to bring back to the board very soon I just wanted to uh plant the seed that you start thinking about what your priorities are so we can have that discussion uh hopefully maybe even at the next board meeting thank you sir uh uh Morris I have no report Mr chair okay uh commissioner Altman I have no report commissioner Atkinson no real report but I just wanted to say thank you to all the county staff who has made my transition into this position so much easier thank you very much thank you uh commissioner Delaney um there's there is something that I wanted to bring up um uh we all got if I am understanding this correctly the fire assessment study um sent to us and I would really love the idea of possibly having a workshop um to where we could talk about our options um and this is this is such a um big topic that I feel like we we really need to brainstorm how how we need to proceed proed forward with this and um uh I was also wondering about uh possibly next meeting um having this presented to the public um in some kind of fashion maybe a slideshow or or something like that um and at the workshop uh some of the things that I I would like to talk about is all of our future needs um so that is fire stations fire trucks personel Staffing um rescues and anything in the next 5 years and also I would like the cost out of doing 24 72s for our scheduling um for our firefighters because that is quickly across the state becoming the new standard and so I just really feel like we need to focus on this um to get to a better place with our firefighters I I think go ahead commissioner Morris would that be an executive meeting that she's requesting I think what we're talking about um it would be if we were talking about direct labor negotiations but I think what she's talking about is the um fire assessment report that was tendered to the board that just contains the steps that the board would have to take if wanted to consider increasing or adjusting the fire assessment fee going forward okay yeah I know that I just wanted to know if it was executive or not right that would be an open meeting is my understanding that she's requesting a workshop meeting the the reason why I'm asking for a workshop is because I really feel like we need to engage the public on this because at the end of the day they're the ones that pay for this and so we need clear direction from the public and um I really feel like we need to dedicate time to this commissioner I think you have two things in there uh first of all the the issue of the workshop and then presentation of the fire assessment right yes that's fair okay I think you could put on the next agenda uh a presentation okay so I know staff would work with you on that and and you can put that on as a as a D1 item and then just like we voted today for the TDC uh Workshop um maybe you could come up with talking with staff and and and Fire Chief and what have you you could come up with some dates and and we could consider that kind of in the same fashion of what we had today for TDC does that sound fair that's great thank you that's okay there is one other thing that I was going to um mention um in my and this is just for us to to give you guys um insight and for board reports in the future for me I would like to give a report on the board that I sit on so that the public can hear you know what we're doing what we've got going on you're welcome you're welcome to do that and I didn't want to catch you guys off guard so that's what I plan on doing I think that's I think that's great commissioner Goodson I've done enough damage I'm I don't have any report I'll turn your mic off okay okay all right can't do any more damage uh let me thank everyone uh long journey uh for all of us to get here and for me to end up in this place too uh I appreciate all the support of staff and everybody's uh forbearance and uh so I'm not perfect either we'll we'll all work together uh to make the meetings better um I think we had a great meeting tonight thank you to the clerk to the board uh for roll call voting um I I I know that's that that that took us a while to get there but uh I I appreciate you uh very much uh just as a last reminder uh there are uh uh appointments uh to various boards that we have that that we gave you tonight now we'll we'll put that on consent um if there aren't any changes if there's changes or other concerns that you have then we'll we'll take
