can use it on home like daily well sing is that one I'm sorry it's registered for your license plate in so if you have four vehicles and you drive all four of those to the beach then you would have to pay for each vehicle and register each license plate in the system so there's no restriction like you could if you want to register all your vehicles so it does have a negative impact since the parking is domain and got a lot of people so this really then hinders someone who has so is there any way that know just looking at it instead of saying [Music] it's or four vehicles up at their home in p pania that are all registered under Park Mobile um and then maybe they have one or two cars down here so that's six cars that that individual may have registered in the system obviously they're not driving all six cars to the beach every day right so they're going to getting get in one car and drive it to the beach so having the the the uh but it's no different if somebody had four cars and they wanted to go by go into the beach fee office in previous years and buy a sticker for every from from 6 pm to 8: am you do not have to pay however from 6 pm to 6: am you cannot have a vehicle parked in those lots for more than four hours of time that that would be the police department would their enforcement for par so they go in I'll let the police sheet com about after hours once eight in the morning hits they have to then so Jim Jim is the same as always there's no get their parking permits online now that's all this is doing nothing nothing changing the restrictions you're you're discussing have always been in the ordinance this is nothing new the only thing that's Chang is instead of having a sticker that's going to go in your window it's not be parked mobile everything else there's there's uh forms that the veterans have to fill out when there's disabilities involved they have those forms filled out whatever percentage of St State regul and you have to be 100% disabled was basically for the exterior of the Tower and all so what's happened now with the leak inside and all that that wasn't included on and what we were paying for less than 20% right so so Jim the the 20% is based on this current project the bonds it's irrelevant of the 20% has nothing to do with the total money bonded for the complete what we expect to to use this is strictly for this Tower and this scope of work that is currently being done right so you know they tell us this is what we're going to do this is how much it costs and then when they get in there they go okay there's some additional work that needs to be done as long as we stay under 20% % of the current scope of what they're working on then we don't have to go out to rebid it and we can keep it and which which was the after the meaning up was approached by several volunteers that said we need to be able to communicate before the reck ball comes to it maybe could go over there and I remember years ago when was somebody on B she welcomed everybody to come with the shovel and um he did our my co-chair did enourage the people and Al came down Avenue it's a police W let us know watch big trees and the plants go we could I mean there's bed tenders that are brand new that are asking for plants and and plenty of sites that could use it could use it so is there a way that we could have somebody work with us to let us know such and such a place is coming down uh Alice HS came down last summer and she had a back front side yard for flowers that would just give us a give us a heads up and maybe talk to the owner to the person that's selling and dig them up we come we'll dig them up we're not asking them to dig it up for us also comes down to person that's selling the property person that's buying the property person selling the property buying the property say well I'm BR so I think we have figure Old owner says they take insurance liabili I assume so much can I make a suggestion and I don't know if this comes into play so when I was the fire chief we created a form that we put down in the Construction office and when somebody would come in for a demo permit the the uh staff and the Construction office would hand them the this form and basically it said hey you know it was a whole harmless uh can we use your this property for training so we go on the roof cut holes bust down walls bust down doors the whole bit um and usually we would go in a day or two before the wreck ball shows up and cause all kinds of havoc and it didn't matter because they were just taking it all out of there so I I don't know if yeah what about a way John aren't is Garden Club covered by the city because of when they're on the street so they may be covered yeah yeah I mean that's no problem my suggestion that would be something we'd have to look into so we we can find out if in fact you would be covered because I know you are covered when you're on the streets right um under the city's Insurance my recommendation would be maybe make up a form that we could put in the Construction office and you know explain what you would like to do and have a point of contact or somebody alls we can do is ask the girls down there to hand hand that out with with the demo permit and if they call you great and I mean if we we can you know uh save some you know flowers and shrubs or whatever that can go somewhere else but that would be my recommendation maybe generate a form get it to me and then I I will check the insurance part of it to make sure you're covered if you were to go onto that property because it is private property um and then maybe we can meet in the middle and come up with some maybe save something and Louise I think it's a wonderful idea and also what I I I would post a question since mayor Sarah's not here Mike who is the Str Str official overseeing this regulation that we imposed effect of January 1 of this year so we we had advertised position and had to pause it it currently I just today I instructed our Personnel director to repace it internally we're going to advertise again for a week as we're supposed to do and then if we don't get any qualified candidates we'll adlies outside I expect in the next couple weeks probably the next three weeks we should have some and I apologize that there's been a delay but unfortunately there was an issues that arose that we could not hire we are moving in right can you give a hint us what the issue was actually not so we're a we're in April and now we're coming into may we have no supervisor overseeing this Havoc that's about to unleash on our residential neighborhoods the rules are in place who's enforcing them police if we call the police there's an situation you know we we'll handle the situation if there if there's a problem we'll take care of it now you can still call because if no one hired right now doesn't mean that the rules aren't going to be enforced that wasn't that wasn't the process we enforced the rules we implemented the rules and we're going to enforce the rules now okay so what what the the undertoe is and I'm just a talking C like I said I'm representing everybody who sends me the emails texts me you know calls me in the ucket which I sent you that because someone sent me that from up there they they've tackled this where someone who purchases a property of a single family residents they cannot use it most of the year for purposes of St Str use like a commercial mini hotel if you will and I went I've did some research I haven't really pulled it all all my tricks out of my hat yet but you have a copy of a deed a page I I redacted information that might lead you back to who whose deed it might have been from but every property between 31st and 15th Street inclusive Between the Ocean and the bay all have that Covenant in it and on it that restricts that the use of that parcel of land to single family dwelling for a single family home to be occupied by a single family not 18 unrelated individuals coming in for a UA weekend okay so let me ask you are you you want to revisit the the ordinance I want I want I want the the ordinance I want that these things enforced these things enforced where the city's allowing violations of the covenants that run with the land Rick would know that it runs with the land they're not revocable unless you take it to court these are being used in violation of the covenants on all these Deeds so this is something you're saying because it's listed as a single family residence that it's not allowed to be used as an Airbnb or you don't want it to be it's not a single family 18 unrelated guys coming in for a weekend is not a family like this I worry about the next round gotcha uh there is something called The Fair Housing Act you cannot Cann not Define a family as a single unit could be a number of unrelated individuals I represent several towns that have colleges in them they use houses asms that or stop it you're going to end up in court you're going to pay the attorney's fees and probably trouble them I I understand because I follow that to in gler they had one from Rowan where they were like a fraternity SAR they they rented a house for the semester and come on up to my town ofing where we have the College of New Jersey and show you lawsuit after lawsuit we have lost in this kind of ARG but in that instance they are functioning they live together they sleep together they they have refrigerated goods hope they all sleep yeah well they don't sleep together the same you get my trip they sleep in the same under the same roof like a fraternity and sorority house that I that's understandable but people coming from Here There and Everywhere from All Points just for the weekend like the gentleman before said to raise hell like on 15 Street North on 20th Street sou they're not a family well just remember I have been living this for a while now thanks to this good City uh regulations that I help to write uh and we researched this matter thoroughly and I have some towns where we totally but you've got to do that townwide and has Chen not to do that regulations put for by judge judge so far matters Ono so far has our favor because have regulations that laws and the Poli power regul laws we have here in the city of britin so if we go any further at this point further regulation we'd end up back in court and I can't guarantee that we okay but I know covenants are pretty binding you cannot those covenants don't apply here in far as what you're trying to that LE on that deed that Covenant in that deed is not not not enforceable it applies to certain situations but does not apply to sdrs so single family homes yes a single how do I identify single family home as an Str Str what is what where where's the uh still a single family home occupied by unrelated individuals again ma'am I I really ask that we don't go there because this transcript gonna be in front of to allow them they've been doing some work there and more papers are going down and it and it's actually the water is completely covered the street the crest of street it's up to Bob's driveway at 2000 Ocean Avenue I think something that's got to be done when if they can send somebody around to look at these properties I've got pictures so probably have to report it come in up is that right tiger feel that someone so it's actually been report the construction official has been down there they're not putting any additional favers they were doing work to flower boxes they do have uh they weren't required any permanent because of what they were doing but our construction official has been down there in the past within the last 30 days well the Expos there was exposed wiring and irrigation uh tubing after they ripped out those beds that had to be I guess rerouted or repurposed or recircuit it I I would imagine permits had to be pulled for that work uh from what I was told the work they were doing did not require permits but I can check tomorrow with the construction official I I was not aware of rerouting wiring I I the only thing I was aware of was the beds that being I have pictures so I think a council militaria had called him and he came out and he witnessed it as well okay and um well there was concern to I guess I could just get a yes or no oil tank removal that's a buried oil tank underground is there a special permit required to extract an oil tank from underground when a demo site yes is there a special contractor that's approved this or a certain list of contractors that approve this and they have to go with an approved contractor to remove that tank right does anybody know the procedure off the top of their head is it like a crane that hoists it or can they break it up one site got to pull the tank you got to test ground make sure that contamination got a board down make sure the water's clean that was like you know you're aware of it 1904 into what is a Comm commercial Enterprise residential C and fact that this is not we've accomplished something that we've been waiting for at least you brought out the open beted I don't know if everybody on Council has read it or not but it is part of our zoning code so I just happen to have it that day that's the only otherwise would so let me ask you a question um okay can you uh tell us the particular Resort house or more that you're talking about you're saying there are Resort houses on the island is that correct yes okay can you tell give us an address or if you don't want to give us the address now give us an address you know whenever you get it and and then we'll look into definition I don't think we have any Sarah has addressed several times if I um I have been able to discuss this with the city administrator and we looked at the at the definition definition throughout the state state of New Jersey there are Resort houses here in BR Team that I Define definition hours and these are not being it says styled structure which they are' what court were you what case was thisor court the Str Str Association versus the city of and how was this case disposed of it was on an order show details of this Resort house defition yes we we've talked about all these so Mrs Phillips if I may okay if you address of a particular you feel is acting as a resort house you can call me direct you can get with any one of us and we will get right on it with tiger and our Council and look into it as soon as possible and if it's a resort house operating in a residential area I Street or Resort houses yes and I believe I have one on my block here's the problem I you go ahead have CED as found by judge it is not a resort not able so it just be in action without any consequence but what was the purpose of the case how was it decided in terms of the result what happens as a result of the judge's decision the judge the judge made a decision that there is not F going on right now those who are operating Dr City rest of the case is still ongoing well I you know very interested in knowing what has happened so far and there's been no publicity on this at all so Mrs Phillips if I may know's house is on 20th Street or the one on your street at this moment is is advertised in special events but not limited to weddings Retreats family reunions parties or meetings or they just advertising for rent no they're advertising they have these events they put this can you have a copy of the events that they you have a copy of a pamphlet that was distributed by Andrea last year uh detailing the advertising that goes with this these are clearly adver we agreed it was issues at one time that people were advertising for uses that were illegal and that has stopped you saying currently currently I don't believe there are any any of those houses on 20th Street or advertising for weddings Retreats get togethers am I correct me if I'm wrong so in other words you're saying that there's no advertising at all that has anything to do with these events that are held on over weekend principally I feel pretty confident that if any house on 20th Street at this moment was advertised weddings retreats family get togethers Bachelor boies b mitford or anything else that anybody in that second row right there would be right up here with paperwork and this will not occur this year is that what you're saying this advertising will not occur this year it occurred before but it's not going to occur if the advertising occurs this year it'll be illegal and we'll enforce the rules well that gets back to the lawyers comments as to these are not Resort houses they don't and if they rules we're going to we're going to break down on on uh rule Breakers listen we we're we're on your side I get exactly where you're coming from that but it's already been brought before our lawyers and the courts and they're not agreeing with this well I get with you're
