thank you Mr chair so this is a request for a home occupation uh a crane service business uh this property is approximately 8 Acres it's located in Elwood Township on the east side of uh County 11 there is the land use is residential and Industrial there's a residence a detached garage to approximately 6500t pole buildings and a 12,600 gon above ground fuel tank on the property the zone is egg General and then also has a resource protection Wellhead protection overlay that would be the pink there so just some background on this um in 2019 uh the applicant did receive an a after Thea conditional use permit for commercial cold storage and at that time basically that's what the planning staff was recommending uh however that's not a permitted use it wasn't at the time in the resource protection Wellhead overlay zoning District um and really what this business is is a uh home occupation basically a homebased business um where you have the business owner and operator living on the premise as well and that is allowed in this zoning District by an interim use so the request would be to continue the operation of this crane service business what the business does is they provide Crane Rental Machinery moving and Hauling Services they employ 9 outside employees their operating hours are from 7:00 a.m. to 5:00 p.m. Monday through Friday uh they're currently based out of two existing buildings so here's the residence and then just to the to the north you've got a heated building and a cold storage building and they like to construct an additional building as well um really to move equipment stored outside indoors and then their accesses off of of County 11 here uh kind of going backwards a little bit than how we usually or how I usually present this and um kind of giving you the um the report on the on the application and and the proposal and looking at how that might relate to our comprehensive plan goals and objectives so we do have a general goal in Clay County to maximize the potential of Clay County as a thriving Center for agriculture business and Recreation while maintaining its and enhancing its Li livability and so kind of how this would relate to that goal is that home occupations follow regulations of Klay County provide unique opportunities for residents to live and work in the county home occupations have potential to Hance both the economy and livability of Clay County we do have a land use goal to establish a comprehensive growth management strategy that promotes orderly and efficient growth of residential commercial Industrial Development while preserving the County's rural character and home occupations they might not necessarily fit into that orderly growth management strategy they do provide for flexible living and working arrangements and can also really um make for more efficient use of larger residential tracks of land um and they shouldn't detract from the from the rurual character of the county if they're in harmony with the Royal character and they don't create nuisance conditions then we also have a goal to plan land uses and Implement standards to minimize land use conflicts and home occupations if they meet all the regulations which this one does um then they shouldn't contribute to land use conflicts for the resource protection Wellhead overlay zoning District we do have a goal related to that to protect groundwater resources in Clay County to ensure safe and clean drinking water as well as an adequate supply for people in agriculture during times of drought so this is um this use is right on the Buffalo aquafer which does provide a uh it's kind of the primary source of water for Western Clay County secondary drinking water source for City Morehead Dorth um primary drinking water source for Sabin and so this home occupation doesn't require the bulk storage of any ha hazardous chemicals or fuel um doesn't require any groundwater withdrawals beyond what would be normally um expected of a residence uh equipment and vehicles should be primarily stored indoors on impervious surface uh commercial outdoor storage is not permitted in this zoning District uh and then there is a 12,600 gallon fueling tank on the property I it it does meet all the regulatory requirements um just needs to be registered with the pollution control agency and in addition any storm water management with any impervious surface or with the gravel lay down area would might require a storm water uh management plan as well any questions for me so the the cold storage is that for clarification is that that's not a cooler that's just unheated unheated unheated okay it's not okay it's probably hot storage in the summer last week yeah yeah thank you anybody else have any questions for Matt at this first condition would be to operate within the provisions of the Clay County Land Development ordinance must provide proof of npds SDS storm water management air quality permits as required to the planning office shall be in compliance with any and all state local Federal regulating agencies terminate if the applicants close the facility for period of 12 or more consecutive months or when the property is transferred to a new owner uh um hours of operation would be 247 365 days per year no noise producing activities permitted between the hours of 10 p.m. and 7 a.m. it's basically what the state defines as your nighttime hours and then outdoor storage of commercial equipment is not permitted Beyond temporary staging of equipment so I have one question with four sometimes those cranes have to be at the wherever they're going to be set up by daylight hours sure I'm I'm thinking five or six said CU how much noise backing up noise from if they're backed in they back out the beep and then they're gone there can't be that much noise to these there wouldn't likely be anything that would rise to like a nuisance level so if that's if that's the case you could i' maybe recommend striking that from as a condition just this just a 10 to seven yeah what does everybody think on that I would strike that man it would essentially be covered as a standard in your um as a home occupation you couldn't create any nuisance conditions anyway so yeah it's kind of redundant but I would I would strike that uh with there being no negative comments from anybody and the county included on that with as long as they're following weight restrictions I move that move to approve this permit with conditions one through five I'll second that motion made by Joel Second by Kurt stet LLC request for conditional use permit the applicant is Seeking a conditional use permit for a 5mw community solar garden on parcel 07.32 in the Northwest quarter of Section 3 Felton township do I conditional use permit request for a 1 megawatt Community solar garden this uh parcel is located right on the clay Norman County Line on the east side of Highway 9 if you hang on one second there Matt you put that in the wrong order so this start that page oh my apologies so this is be on page 62 page 62 the one MW Mega is the first group of it there oh we're doing the five yeah well I am so yeah would starts page 62 okay they're on the same parcel yeah um so this would this would be for uh to develop approximately 28.8 Acres of a uh 160 acre parcel uh land use is currently agricultural zoning is egg General so the request is to establish a 5 megawatt Community solar garden uh the way this community Sol we've done several of these now in glay County the way that they essentially work is to allow for residents businesses other entities like churches and schools to subscribe to solar power and receive Bill credits so if you don't have a good spot for solar on your property you'd want but you still want to um access solar energy this is a way for you to do that and get a bill credit um it's accessible to excel energy customers in Minnesota excuse me just some background so site selection criteria for this specific site um looking for just level terrain amount of sunlight the proximity to electrical infrastructure which would be um on that Highway 9 quor uh a landowner participation as well and then the ability to um interconnect to the grid through Excel Energy this project uh they're looking to begin Construction in Spring 2025 uh looking at potentially about three months um for a construction window like to have it complete before winter of 2025 um would include solar arrays an inverter that would convert your DC power that's created by the sun and the solar Sy solar energy system to your AC power um which is shipped off to to the grid essentially um an equipment pad 15t Access Road uh 6ft chain link Security Fence that's basically what this project would be um underneath the the um solar project there would be uh they would establish beneficial habitats or pollinator vegetation which is um recommended by the Minnesota border of water and soil resources and it's something that's actually required in our renewable energy ordinance so the access to this would be so this is the there's two projects there's a one megawatt project right here then there's the um the 5 megawatt project here uh typically in Klay County we we have only heard one megawatt projects uh changes to the community solar garden laws in Minnesota have have increased um the um capacity of community so Community solar project from one megawatt to 5 megawatts so this is this would be the first 5 megawatt project in Clay County and so um it's a very passive use essentially once it's once it's constructed there it's REM monitored remotely um 247 365 days a year uh they'd come out to do um twice yearly equipment equipment inspections and then vegitation management as well um two times a year their project lifespan is 35 years this could be extended by a new landowner agreement could also be extended just by equipment upgrades as well so as part of uh the management plan for this site they would have a vegetation management plan that has been submitted to to the county uh as well as a storm water management plan um a fire prevention plan would basically include um providing uh Dorth fire access to the site with a key keyed access to the site um then putting all the relevant uh emergency contact numbers on um right at the gate as well and then a a decommissioning plan um basically so if if the the eventual ended the lifespan of this project whether it's not upgraded or not renewed um um there's a decommissioning plan for that some considerations with this uh project is it would take about 28.8 Acres of prime Farmland out of production that's both Prime farmland and then Prime Farmland if drained um and the acreage just to put this 28 acre project in context with the entire County the estimated uh acreage for of prime farmland and Prime Farmland if it's drained in Clay County is uh just about a little over 450,000 Acres uh which translates roughly to 67% of the county um one thing I should mention too with this project is um this the project could be developed the developer could keep the project the project could be sold as well um because it's a conditional use permit that runs with the land the uh new owner would be basically um of the project would have to adhere to the conditions of the permit so relative to comprehensive plan goals and objectives um and if you agree or disagree with any of these please um feel free to to speak out but we have a goal to support the long-term protection of the County's strong and diverse agricultural economy uh Community solar Gardens do add diversity to our egg economy in Clay County as they allow for producers to diversify their operations and revenue streams uh in a manner that doesn't have to be at odds with with agricultural production uh we have an objective under this goal to ensure that all new development is comp compatible with the character and quality of the County's agricultural areas um jur is a little bit out on this one some people view solar as kind of detracting visually from a rural landscape um some people see it the opposite way in Clay County most of ours are going up along major transportation corridors and hubs anyway things that are generally a little more busy and a little less idilic so to speak um we have a goal to recognize and protect the agricultural character of Clay County and under that protect Prime egg soils from commercial industrial and residential development so this would take about 28.8 Acres out of egg production for at least 30 35 years um again I mentioned that there's um there's about 297,000 Acres of prime Farmland um if drained in 154 240,000 Acres of prime Farmland in Clay County uh one thing about this project is it could be restored to Farmland as soil loss is not going to occur um and ideally we would want to site Solar Development on marginal agricultural land but this is a pretty small scale project relative to the total acreage um and it wouldn't take it out of permanent production if it is decommissioned or if the land owner decides to go back to farming it once the the terms of their lease agreement is up we have a goal um to encourage commercial and Industrial Development that is in harmony with the Agricultural and Rural character of Clay County and then again this isn't one of those where some some may view the uh solar as detracting from just the rural aesthetic of the landscape but they can also be rece like more recently being perceived as part of uh emerging part of that agricultural landscape uh we have objective under this goal to avoid or mitigate against commercial and indust Industrial Development in or near environmentally sensitive areas this is not in or near an environmentally sensitive area and to avoid or mitigate against commercial Industrial Development that increases the potential for land use conflicts with rural residential or agricultural uses so once this thing is built it's pretty passive it wouldn't generate any excess excess traffic noise vibrations or dust um would generate power for Minnesota businesses residents and institutions uh we do also have a plan a goal under our natural resources in the environment prairies and Woodlands goal category and that's to grow and restore Prairie and Woodland areas in Clay County for the benefit and enjoyment of Clay County businesses residents and Vis visitors and this would result in over 28 Acres of pollinator and wildlife habitat um in the county and we have an objective under that to encourage Egg commercial industrial residential development to establish Prairie and or Woodland areas on properties to provide ecosystem services such as erosion and flood control through a assessment permitting this would be a permitting example um and that is a requirement of our renewable energy Ordinance one thing I will say too just to stop here um if it is okay with you Mr chair um we're going to be hearing two more of very similar requests so I do not have to go through this three times unless someone needs clarification or wants clarification on on any of these does anybody need clarification on any of those that we just went over all I would say you're good next two any other questions for me at all not a question but a comment for you said Dorth fire department that would actually be Felton sorry so just a comment on that yep applicant you're correct I have a question you had said that there would be contact numbers posted at the gate is are there any special fire fighting training that is this if something would happen where the undergrowth would catch on fire is there any special training that the volunteer fireman would need to undergo to fight a fire on this site I mean I don't know what's in I know it's not glass there's just wondering about toxicity there I would Mr chair and I would say that there would be if there was any battery storage associated with this but there is not any battery storage associated with with this um project so um I my understanding is that they would treat it as they're fighting any other type of fire and if the applicant when it's his turn to speak um wants to correct me on that he can certainly clarify that thank you but the lack of battery storage is the key there thank you Mr chair my understanding is uh sites that are uh the one megawatt or below producing or exempt from the the energy tax and so now this would bump it into a different classification is that I me since this is the first one that we've been dealing with that have we communicated that to the app yep that is correct and the applicant understands that yep anybody have any else have questions for Matt would the applicant like to come up and speak state your name for the record please Dan Gorman senior developer at Enterprise energy so first I'm happy to answer any questions to get to your point there should be no uh additional training for the local fire department this would be the same as firing any other type of fire at uh an energy heavy use like a uh substation for example for electrical power outlet the same sort of conditions apply there's no additional toxicity from the solar panels themselves and there will be no battery um to these projects in general we've designed some really good projects um they meet all the county setback requirements the landowners is very enthusiastic um and these would be the first five megawatt projects in the county and um as an advocate generally for energy production um I'm excited at that Prospect um in addition um I just had a couple real quick clarifications um this project is not in the flood plane the map that was submitted maybe was a bit ambiguous um this is south of the flood plane area so we will not have those considerations uh to take into account that being said even if there is a risk of a flood that's above the 100-year flood risk Community solar Gardens are designed in such a way where you know marginal flooding of even a foot or two will not adversely affect their operation so um regardless of how you view it um I don't think that will be an issue all right and then oh and then just one other real quick point I noticed how they were listed on the agenda it all says Enterprise energy e solar 38 um 38 is for this one that we're on um the one megawatt is 39 and I believe the other five megawatt is 40 I'm not entirely sure if that was uh on my end or or not but I just wanted to clarify that for the purposes of this meeting if you have any questions I'm certainly happy to answer them or I could continue on with details does anybody have any questions for the applicant uh I have a couple questions so you you're separating the one megawatt Garden from the 5 megawatt and is that simply because you can't build bigger than a five is that the purpose there yep so there's a couple of things with that um under Minnesota law a single project can be up to five megawatts if you put more than one project on a single parcel they're called collocated projects which are permissible but they do need a separate ownership separate permitting separate financing um and those considerations to take into account so that's why we split off the one megawatt so that we could meet those criteria for the state selection process sure um and then also so the five megawatt are you going to be assessed the solar production tax which would go back into the yes for both of the five megawatt projects we're anticipating the production tax um in fact I would not surprise me at all if Minnesota changes the production tax rule to include projects that are one megawatt and smaller in the future anyway so we've accounted for that in all of our models sure um I have a couple question sorry just bear with me here but um 12,500 megawatts of solar energy was an estimate for for this project like that it could produce yep so is that specific to Minnesota or is that uh overarching United States no that is specific to Minnesota that generally speaking if you have a one megawatt of capacity solar garden it will produce um um 12,000 produces 5 megawatt hours per day uh so that'd be right 12,500 megawatt hours per year um in Minnesota it's interesting because Community solar you would think like the super sunny places like Florida or New Mexico would be the best but uh solar production decreases as temperature increases they lose efficiency so actually the most Prime areas in the country for Community solar is Northern Illinois Iowa southern Minnesota um getting a little further than that we get a couple less days of sunshine year so production does come down but we actually have very good uh solar land up here for the production um and then I just had a question on current federal and state tax credits and incentives that um you're able to use to install these um solar Gardens um how much does that play a role and how much the subscribers will pay for energy if those because I I do believe the federal 30% does um deak or stop actually in 2034 so I'm just wondering is the subscribers rate going to go up after you know a certain time period is this going to get more or less cost effective for them and I can very much appreciate that question on the finance and tax credit side um our CEO would know better than I would um he's not here what I can tell you is that all the subscriber models that I'm aware of allow people to drop out whenever they want to so it's not like they'd be hooked in to subscribing for 35 years the final pricing to the customer um would be negotiated with the customer and then they wanted to stop they'd be free to stop but I we're not projecting it to be more expensive than what uh Excel can provide energy for at any point in time sure thank you anybody else have any questions I have one comment Matt so if they don't do anything within a year they have to come back and get another permit in these past we've given them a three-year window to get start construction yeah Mr chair we can a lot of that was related to some the supply chain issues I know a lot of that is eased but if you if you as a as a commission would like to add that as a condition that they would have three years that's definitely an option all right the planning office uh project owner operator must provide a decommissioning shity bond cash deposit with Clay County or letter of credit for $50,000 per megawatt of the project and the project owner operator must provide a shy Bond cash deposit with Clay County or a letter of credit for 125% of the cost of establishing native plant cover on the project site and I would put number five they have a three-year window to finish the project just in case they run into yeah we've done that in the past with all these because before we did this we had them come back almost every year until they actually started the project we gave them a three-year window and then they seem to get it done in three years so with those five conditions do I have a motion to approve motion made by Brad second this is roughly where it is compared to the five megawatt project uh construction everything is is is the same um in terms of the project details as well as the operations and site plan everything would be the same there um the only difference just being the locate the size and the location would be the the two differences again take 6 and a half acres of prime Farmland out of production um any am um we open this Floodgate and it's you know they're they're put everywhere and then pretty soon we're decommissioning a bunch of these and where does the I mean we can recycle some things we maybe be able to you know recoup some costs um but I'm assuming a lot of this is going to be ending up in in in the in the garbage you know um so I'm just I'm a little hesitant here I I think there's a way Matt thank you Mr chair this is a request for a 5 megawatt Community solar garden uh again this parcel is directly to the east of the uh parcel on which the pre previous two hearings uh were heard uh this would be on approximately 32 Acres of a 80 acre parcel the land use on this parcel is agricultural the zoning is agricultural General again um the request is the same is that first hearing um for a 5 megawatt community garden solar garden site selection uh is is the same here as well uh the construction um details are the same as well as the operations in the site plan um one thing worth noting on this is there is a natural gas pipeline that runs through this parcel and so the site plans did change I think you did get the updated revised site plans um in in your packets so essentially the the the proposed project became a little taller and skinnier um we do have a provision in our code uh that any development would need to be a minimum of 60 feet set back from uh any pipeline rights of way and so um this project would be able to meet that setback as well as the um the the property line setbacks and the road right of way setback as well that's a natural gas pipeline that's operated by bking and this would take this would take um 32 Acres of prime Farmland outo production um goals and objectives uh are the same as well any questions for me anybody have any questions for Matt would the applicant like to come up state your name for the record please Daniel Gorman senior developer Enterprise energy does anybody have any questions for him I have one question I don't know if it's necessarily directed towards him but wasn't there not a state mandate a year or two ago that all utilities should try to be going more green by year X so would this be more of a push towards that for Excel for our area then yeah correct it's um basically 100% carbon neutral neutral energy by 2040 oh that's all I couldn't remember the exact date and time so yep so this would be selling this would be selling credits to someone like me to become carbon neutral is that basically what these are being put up for well there's a mandate for excel themselves to become uh carbon neutral carbon neutral in their energy generation so that ultimately they're buying the electricity from us yeah and then in exchange we get a bill credit which is just the right for another party to withdraw the same amount of electricity at no cost so it would likely be Excel receiving the environmental carbon neutral benefit yeah so essentially would give them their credit much like Morehead does so like wild rice has to do it and all the utilities in the state have to be neutral so okay cuz Mr chair if correct me if I'm wrong with the city Morehead is currently basically carbon neutral correct we have been for a few years credits we buy like this and most of ours is hydro from Red Rock and all that yeah anybody else have any questions for the applicant thank you for coming in the only thing I may want to mention um with regard to Prime farm land use I understand that it is a concern uh with some members of the board this is a ultimately a temporary problem project we have every intention of decommissioning it at 35 years in fact that's written into the contract now of course the board um with approval from the board and the landowner is potential it could be extended too but much like a CRP program this is just a temporary cation of farming activities on the parcel the Farmland itself will actually be improved due to lying at phow for that 35 years so it'll be better Farmland at the end of it then it will um at the start of it and um you know it's just in that regard not a permanent sort of development um also I noticed that you mentioned about decommissioning their decommissioning plan uh was submitted to for the permit we do account for uh not so much the recycling but the resale of some uh the panels at the time of decommissioning because ultimately the way panels get older is they don't just break down there's still a substantial amount of life left in them it's just at that point if we did get County approval and Landover approval it makes economic sense to replace them but the used panels actually have a fairly substantial resale value because there's a lot of uses for panels that are used and still producing electricity especially when we account for selling them at about 15 cents on the dollar um for resale and in addition to that we are covering bonding that's likely to be eight times what the Gap in between um the recycle value is and what the actual cost for construction are so the county will definitely be covered in any thank you thank you anybody in the audience want to speak on this matter anybody in the audience want to the Northeast quarter Northwest quarter section 22 humble township do I have a motion to open the public King so moved ocean made by Ashley second by Kurt shervin all in favor single by saying I I all opposed public hearing is now open Matt inform us please yes this is a IEP request for an asphalt batch plant uh this is on a 1073 137 acre parcel just Northeast of Barnesville uh the current land use is agriculture and uh industrial there's an existing Gravel Pit on the site uh the zoning is agricultural General and resource protection aggregate overlay surrounding zoning is the same although there is uh resource protection Wellhead protection uh to the west of this property so just some property permit history for you uh in 2001 there was a c a conditional use permit request for a 10 acre gravel pit and an asphalt batch plant that was denied by the Planning Commission Miss at the time reasons mainly for the denial um uh related to the hall rad um just the number of residences along the hall route uh proximity of the residences to the road and lack of um uh any sort of barrier between those residences in the road in terms of trees or vegetation uh to protect from dust noise vibrations all all that sort of thing uh as well as safety um just there was uh children on the road as well or who lived along the road as well uh that decision was overturned on appeal uh in 2001 it now currently appeals go to the Board of Commissioners uh this one went to the board of adjustment they overturned it on appeal in 2021 they were approved for 39 acre gravel mine as well and they were amended it was amended in 2022 to change that hall route from 150th Avenue to 210th Street just due to the condition of 150th Avenue so the request is for the placement of a temp asphalt batch plant the request is through the end of 2024 uh the purpose of the B batch plant would be to prod produce material for road projects in Richland County North Dakota uh they they plan on utilizing 5 to 10 acres within the existing pit all materials that would be the recycled asphalt the Aggregates needed as well would be imported on the site they don't plan on using any Aggregates from that pit uh they're estimating about two to four weeks of operation uh the site prep would be any top soil stripping stripping and leveling that likely be minimal just because uh it would be in the existing pit site we plan on constructing a burm on the to the west to block noise and visual sight lines and then using existing pit burms to provide additional screening directing any runoff into the pit and then if any if needed um uh best management practices uh as well the requested hours of operation are 7:00 a.m. to 7:00 p.m. Monday through Friday and 7:00 a.m. to 2 p.m. on Saturday they would like to go south on 210th Street to trunk Highway 34 they would do dust control um have a water truck and truck speeds at or below 20 mil per hour to manage dust noise and vibrations uh Each truck would be anticipated make four to six round trips daily and during Peak hauling they're estimating about one truck leaving the site every 2 to 3 minutes so this is kind of the plan this is the red is the basically the the setbacks the 300 foot property line setback and then there's an 1,000 foot setback from a a residences as well they'd be looking at putting the batch plant right in the pit uh right here the axis road is two go west here and then 210th is right here you can see some of the area land uses within the hall route um just showing that 2 Mile hall route on there 150th down to county 25 5 as well just for reference that would be the township preferred route just because they want to limit impacts to residences uh there's just more residences on this um road than over here um some considerations so this this proposed location could meet all the the setbacks 300 ft from property lines 500 feet from Road or highway right away and 1,000 ft from residents church school or public establishment establishment closest residents would be about 1100 ft west of the plant there are four residences along that that hall route uh there is one residence that's very close to the road that is kind of disproportionately impacted by noise dust and vibrations of trucks um there are some nuisance concerns with a batched plant including air emissions noise odor and dust this plant has had one permit violation uh from the pollution control agency that has been resolved and they do have a air quality per or they do have an permit from the pollution control agency as well um other than that I think in our in my staff report I may have mentioned as well that um with the gravel pit and Hauling there have been some issues with the the operator out of there in terms of hauling dust control and speeds um those have both been been issues not related to this applicant but just to falling out out of that pit uh relevant comprehensive plan goals and objectives um so we have an objective to encourage commercial and Industrial Development that is in harmony with the agricultur and Rural character of Clay County U batch plants are really not really in harmony with the Agricultural and Rural character of Clay County but they are essential for the Improvement in maintenance of paved roadways within the county uh this is I just added added this went out after your packet so I highlighted here that this plant would not serve or improve serve to improve maintain any Clay County roadways or would use any local aggregate resources to my knowledge um but they are temporary and Project based in this op operation of this project is anticipated to be less than four weeks uh another objective is to avoid or mitigate against commercial industrial development in or near environmentally sensitive areas would be cited in an existing Gravel Pit the hall routes are adjacent to Prime wildlife habitat and land that's zoned resource protection while at protection over lay um so any sort of dust control uh preferably using water for dust control when necessary minimal calcium chloride uh keeping your truck speeds down um would would be key there we also have an objective to avoid or mitigate against commercial and Industrial Development that increases the P potential for land use conflicts with rural residential or agricultural uses uh batch plants are associated with noise and odors um the applicant states that they'll maintain and muffle their equipment and use Earth and BMS um the prevailing winds for this location are from the southeast and the the Northwest at this time of year roughly um there wouldn't be any residences directly downwind at least a quarter mile unless you get like a straight North Wind essentially um from this plant there are four residences along the proposed hall route and as I mentioned one is very close and there's been past issues with truck speeds and dust impacting this residence a humble Township would not like this um hall route to be used um so we recommended that hall route as well but uh in talking with the or corresponding with the applicant it sounds like 150th Avenue is just not in any shape to handle any truck traffic so just some images of the pit looking Northeast this is from 210th Street this would be south on the proposed Hall Road this is the actual entrance to the pit it's very narrow road probably could not support two-way truck traffic at all um yeah it's a very narrow long access road and this is looking from that axis South 210th and then West on 150th and this is just kind of showing you the condition of 150th this would be these are from today um this is at the intersection with County 25 any questions for me at all so is that where you're if you're going to use 50th that's where you would go south to Casa 34 right to trunk Highway 34 Highway 3 anybody have any questions for matth at this time would the applicant like to come up and speak state your name for the record please good evening my name is Jason first egg I'm a civil engineer with d Incorporated also have two other gentlemen with me more on the operations end uh Mike Ruther and Jared Fleming as well might be able to answer operational questions as well um originally this was uh um I I had a colleague who put together the the application materials for this he's no longer with with the company and so um his name was Lucas so I had one one uh just comment or I guess um request um and maybe I should start in the in the way of a question as far as the the hours of operation that um are are stated is is it your County's um ordinance requirement that that stay within 7 a.m. to 7 p.m. or uh is there would there be flexibility or possibility of flexibility um hours being granted earlier than seven there there is there is an option for time on that yes it's not it's not uh it's not written in code that it has to be seven to seven what would what if if you could if you could what would you choose we would prefer that those hours be uh that an extra hour be granted at the beginning so six to seven six to S would be um better and the reason is this uh the the projects that we're using for um this site U are of some distance and we would like to be Paving uh at on the road by uh roughly 7 o'clock and so that uh that 6 or 6:30 would will allow us that time to get to the project um so if there is some consideration for that other than that um yeah the the hall ra road is an issue so going south on I believe was 210th is the preferred route we if we go West on 150th um that road would get beat up pretty bad and so just would not handle the um the traffic that we anticipate putting putting on that road for that short period of time um so the preferred option from our perspective from a road maintenance perspective I would be that going south 34 I have one I have one question for you why Clay County um well why why permit this in Clay County when the work is in Richland and this is this is the yeah I guess the the the closest uh site that was available to to us as a um as a on this project so you we we try to we try to secure plant sites and materials as as close as we can to the projects that just seems like a ways to go for yeah for whatever reason this was um what was what we came up with on this project so Jenny you have a question thank you Mr chair that um kind of I was going to ask the elephant in the room question as to why they're you're utilizing or planning to utilize the Clay County site for North Dakota Richland County so um I appreciate your answer there my my question is in regards to the material that's coming in where do you anticipate that coming from um that is coming from um again I have to refer to my notes because I didn't put this information together but um it's coming from uh near role from an Aggregate Industries um site there so from M Clay County pit yep right so so part of you know when we talk roads and road maintenance and you heard the comments from the township is um material that's generated from Klay County generates a revenue stream for the townships and the county as well to help mitigate the road deterioration and and I will say that is one thing that I'm a little concerned about is the huge amount of um Road time that loaded trucks will be on Clay County Roads I mean I think that's that's fair our Engineers here too you could probably tested that too so you know hearing that there's a material coming from a Clay County pit is um a little more helpful um for me personally but I have I have another question so is this is this an over overlay project the grind and over as far as I yeah my understanding is so are you going to bring over all the grindings into that pit we will and we'll use them back into the the asphalt and what percentage are you using back in 20 to 30% I believe 20 so if this if this project in this permit is for three months or four months what's your plans with that product after any any excess materials will be left at the at the site use I do have one more question sorry as I look at your hall route out are you planning on so once you get South to 34 headed west are you anticipating taking two all the way to 29 are you are I mean you it really would maybe make more sense to bump down at Barnesville on mine and go south what is the hall plan if you could come up if you could come up and state your name for the record please I believe they are taking to West over 29 uh Mike Ruther oh I'm sorry Mike Ruther um I'm the portal plant superintendent right and so um I'm a little bit detached from the road but I have a general idea what's going on and to the best of my knowledge they are plan on taking to West over to 29 into Richmond County um it's it's a relatively straight and direct route where's can I ask where where the I I saw the bed sheet from richon County I looked it up where exactly is that located my understanding it's it's it's a number of projects number of locations County I believe it's four locations here in the county and it's it's basically what they refer to as a Mill and fill they'll Mill a certain amount of asphalt off thees of the road all it in the plant site and then yeah it uh the way the calculations work is that all that all those Milling should be used back if it does difference um so then my my only follow-up question is you know I I personally would prefer if this were granted that two or nine be used to go south and the reason is I'm not sure if you're familiar with the farore head diversion project but there's going to be a substantial amount of project or digging that is starting um along to to the Red River this summer any day really um and I just I'm not quite sure if that amount of truck traffic um on top of what the core is doing would be a conflict or not I wouldn't I wouldn't anticipate it being a problem with the there but yeah is County two this is a question for Matt or is number two is that a County Road or a state road it's a County Road County Road so the sooner we could get them on state roads the better and I'm you notice why I did 34 to9 and I'm not overly yeah I having this virtual event we really appreciate being able to attend when we can't be there in person um the first thing I just wanted to uh express my concerns uh and my thanks to Matt for really addressing some of the concerns that Cameron and I both have already we are the property that is really close to the road and is so adversely impacted by dust by noise um by the trucks that constantly drive by um so to the applicants we really appreciate your um intended diligence but we do definitely have concern with just the impact on our our lifestyle um it's difficult for us to be outside in the morning um it's difficult to be outside in the evening because of the Dust even when you're driving 20 miles per hour you mentioned that at peak times you will have trucks leaving the pit every two to three minutes which essentially takes out any potential opportunity for us to enjoy the home that we live in um it also is an impact Wildlife we enjoy our Birds our Fox our deer that live here we won't see those things anymore and so I want to strongly express my disagreement with having a North Dakota project being run in Minnesota there's lots of Wide Open Spaces in North Dakota and I feel strongly that our area shouldn't be impacted by your use permit because of its availability and I appreciate bringing in other materials from rollog um that's awesome we support Minnesota economy we love that Prosperity um but it's going to damage our road further it's going to damage our lifestyle further and it's going to be an impediment for us and so I wanted to strongly object to this um as a person that lives here so thank you so much for your time I'm open to any questions comments or feedback that you have thank you so much for calling in is there anybody else online Matt uh no there's not Mr Jer all right I have one question Matt so the hall route they prefer is 210th Street South that's one mile correct correct and the one that the count the township wants them to use is a mile West and a mile south to hit trunk Highway 34 same distance essentially but yeah less paved roads is that is that all you've heard from the township is that so I mean they could they could fix that road so it could be used with the mill the mill stuff and put that on the road and build it up so they can use it I mean they are a road Building Company they could fix that mile a road to use that on 150th if they have permission from the township I would assume there's a lot of product that's coming back into that pit that could be used on that road but that's just an idea is there anybody else that have has any comment or question I just wanted to add I did speak to another res president um today about this project who is also not overly thrilled um about it going to North Dakota and being on um on their on their main road um worried about the impaction and how that road is actually widened because of all of the the truck traffic um and it's just it's low land over there it really is so I don't know I don't know what the best option would be but I I do agree with Ezra I mean I thought of that too like in the back of my mind you know they have the option to build it up but um again then you're just going by another residence that I do know is out walking her dog doing stuff in the evening so um and mornings so um but just wanted to share that with you guys any one more I got a question didn't we just approve uh like how to use a pit this is this is a pit same pit yeah to use 210th Street okay y first they had a permit for 150th and they then they came back and asked us to use 210th correct correct and I would say too that that the use intensity is drastic between um the the amount of truck traffic that would that would be driving importing all this material into the pit and then coming out compared to um the hauling that we've seen just from from mining at this site I would and um um the guas can maybe speak to this but because they live right there but I it's pretty intermittent my understanding um hauling current hauling from this from this pit that's correct this is kren yes I guess my question or comment was would be they're going to be greater than 200 trucks a day um I don't really see a huge benefit to Clay County for having this granted some of the materials are going to come from the roll log area but that's a lot of traffic and it's not benefiting Clay County any other comment questions just have a question is this this seems unique to me in my time on the board that this has been brought up that it's a North Dakota project and using a plant I don't recall this happening before Matt in your tenure in my tenure here every asalt badge plant that's been approved they've already had um they've either approved it and they've either were bidding on a Clay County project or they um had once secured a a Clay County project that's what I thought it's yeah it's yeah just with the the external costs and of running a batch plan and the impacts um typically I think the Planning Commission has in the past weigh that against the benefit of improving and maintaining Clay County roadways I have a question for the engineer or do you have a comment no I do have a comment on that question so I would say there are batch plants that do carry product to North Dakota Northern Improvement would be a prime example of that I don't I can't remember the last Clay County project that north northern Improvement had and that plant runs pretty much every day and so so I have a question has D Nick have they bid on any County work not that I'm aware of they have pulled plans on pretty much every ping project we have but since I've been the engineer they've not actually bid on because Northern Improvement has bid on at least working Klay County correct all right it's just it's just an odd odd odd one tonight so anybody else have any comment or and anybody I believe I've done this anybody in the audience want to speak anymore all right do you have a motion to close a public hearing all moved second motion made by Joel Second by Brad all in favor single by saying I I opposed effective use in granting an interm use a Planning Commission shall consider the effect of the proposed use upon the health safety morals General Welfare of occupants of surrounding lands existing and anticipated land use traffic conditions including parking facilities on adjacent streets and land and the effect on agricultural usage and values of property and Scenic views in the surrounding areas and the effect of a proposed use on existing comprehensive plans and staff came up with the use has the potential to have temporary effect on the health safety morals General Welfare of surrounding lands primarily due to the increased frequency of levels of traffic traffic originating from the importing of material and Hauling of asphalt from the batch plant some of these effects May made be may be mitigated by dust control limited speeds regular road maintenance and Limited hours of operation the batch plant is temporary but could have an impact on hauling of Agriculture Commodities in the area if the projects were to occur during beet Harvest number two the use and enjoyment of other property the interterm use will not be injurious to the use and enjoyment to other property in the immediate vicinity of the purpose already permitted and not sustainably diminish or impair property values within immediate vicinity noise and Emissions emitting from the bat plan could temporarily impact the use and enjoyment of other properties in the immediate vicinity the air emissions permit setbacks and hours of operation should mitigate these concerns the frequency of truck traffic from the import of material in the batch plant and the hauling asphalt could be injurious to the use and enjoyment of rural residents and properties in the immediate vicinity dust to control speed limits and regular maintenance and hours of oper oper op operation can reduce impacts number three development and surrounding properties the establishment of the interm use will not impede the normal or ordinary development and Improvement of surrounding vacant properties for use predominant in the area it is only two to four weeks utilities roads access okay number four utilities access roads drainage off street parking and loading spaces adequate measures have been or will be taken to provide utilities access roads drainage off street parking and loading spaces the access roads to be appears to be less than 10 ft wide and will not support two-way traffic con considering the anticipated frequently levels of traffic traffic traffic management must ensure that trucks are staged within the prop property and are not staged along any public roads number five nuisance conditions adequate measures have been or will be taken to prevent or control offense of odor streams dust noise vibrations water pollution and soil erosion so that none of these will constitute a nuisance and to control lighted signs other lights in such manner that no disturbance to neighboring properties will result number six burden on public services the use will not create an access burden on Parks schools streets Water Supplies sanitary sewers storm sewers other public facilities or utilities which serve or propos to serve the area truck traffic associated with the importing of asphalt batch plant raw materials and exporting asphalt would have a sustain substantial impact on public roads used for hauling dust control or regular maintenance must be required a surity bond should be required to ensure that road is returned to preul condition number seven compatibility the use will be sufficiently compatible or separated by distance or screening from adjacent agricultural zoned or used land so existing homes will not be depreciated in value and there will be no deterrence to agricultural use of said lands the use is temporary and estimated to last two to four weeks eight appearance and structure in sight the structure in site shall have an appearance that will not have an adverse effect upon adjacent Residential Properties number nine relationship to overall needs the use is in the opinion of the Planning Commission reasonably related to the overall needs of the district and to the existing land use in the case of flood plane areas the proof that the location is necessary for facility operation and alternative sites not sustainable to flooding are not available 10 consistency with ordinance of the use this is one where I had drafted that you might want to now that we know that the aggregate resource is coming from rollog just striking this stri that hole well just just this um highlighted portion right here okay strike nor does it utilize any Clay County resources beyond the site I'll read it the proposed use does not serve to maintain or proove any public roads in Clay County because the project serves richond County North Dakota Clay County would Bear all the external cost burdens and Bash plant project and none of the benefit EG local roads improvements can consumtion of local resources proba scratch the consumption of local 10 consistency with the ordinance the use is inconsistent with purpose of this Con ordinance and the purpose of the zoning District in which the applicant intends to locate the proposed use asphalt bat plants are allowed to use use in the resource protection aggregate overlay zoning District the use appears to meet all required setbacks 11 conflict with Comprehensive plan the use is not in conflict with the comprehensive plan if any of the township or city or county see Clay County goals and objectives as referred in the staff report humble Township does not want the Hall Road to follow 210th Street South and instead would prefer the Hall Road to follow 150th Avenue South to County 25 and then to trunk Highway 34 12 traffic hazards congestion in flood plane areas the use will not cause traffic hazards or congestion and in flood plane areas has access access during flooding or ordinary and emergency vehicles the use has potential to cause traffic hazards and congestion to the frequency of trucks hauling estimated one truck leaving the site every two to three minute minutes during Peak hauling times the project would likely concede with beat Harvest and depending on the hall route would create sustainably congestion on the city of Barnesville trucks should be staged within the property and spaced adequately to avoid congestion trucks should yield to local traffic 13 existing businesses existing businesses nearby will not be adversely affected because of a curtailment of customer trade brought about by intrusion of noise glare and general unsightliness you want to go through the seven conditions you have on here yes Mr chair so first condition uh permit shall terminate on December 31st 2024 two operate within the provisions of the Clay County Land Development ordinance three operator shall control dust provide necessary maintenance on any and all gravel Hall Roads trucks truck speeds must not exceed 20 mph on Township roads I just I meant to say here shall provide proof of mpds SDS storm water management air quality permits as required to the planning office and shall be in compliance with any and all local state federal regulating agencies prior to commencing operations uh hours of operation 7:00 a.m. to 700 p.m. Monday through Friday and 7:00 a.m. to to 2 p.m. Saturday an operator shall provide parking screening lighting drainage portable sewer facilities consistent with County regulations as determined by the planning department and County Health Department and then operator must provide a $50,000 shity Bond cash deposit or letter of credit to be used to address any damages to public roadways incurred by the use do we want to put a condition for what Hall Road if we want Tony N9 used Jenny or well I or if we want to the township I've been trying trying to find a Richland County map just to see exactly where the there's several different projects to see what makes the most sense it's kind of tricky to find so I I mean if it requires someone to do like a 40 mile backtrack that doesn't make sense I'm not really sure if it's the North or east or whatever part of the Cy and Mr chair I don't know if there's any of these that you feel or anyone needs further discussion or clarification or rev for number seven what goes longer than four weeks that's what I mean yeah so their permit would be good till December so if it does go longer they have but no county is going to let you put the asphalt down by the middle of November so that's they're anticipating that it would be two to four weeks but they requesting that it would go through the end of the year I guess if Mother Nature wants a rain for another week it'll be five weeks or six weeks yeah does anybody else have any other conditions they want I believe uh the hours are operation they requested that we instead of 7 to 7 six to 7 to change that how does everybody feel that everybody okay with that or yeah my only my my comment was that uh the applicant wants to use 210th the township wants 150th Ed there is no mandated hall route on the conditions we just let them no I think I think we should decide what I mean the township wants 210th I mean 150th I mean they're in a gravel pit they can fix 150th so it can be used I mean they can work with the township on how to fix that road so it can be used for 200 trucks a day I mean who makes that judgment call does the County engineer go out and check it out and see if it's I mean if they blow out the road they got to fix it that would what condition that's what the bond is for yeah and condition number three is maintain the road yep can the applicant chime in at this point Matt if you yeah Mr chair you're free to ask the applicant any clarifying questions or anything like that yeah I guess my my comment to that is that would add a a ton of time and expense to to the project uh neither of which was anticipated you know through this and so I our goal is to get in and out of there as quickly as possible to have a least impact on on on theun neighborhood right and so that's why um we've got a good road in 210th uh that has just one mile of gravel and that I know we have um potential impacts or conflicts with with residents but that is why uh we have um offered to uh limit speeds to 20 M hour and uh apply calcium chloride over the entire hall route which will will you know eliminate the dust um and also just beyond that just maintaining the road while we're there and and once we're done um we think it's going to be much much less uh impactful to the neighborhood if if flar tent is ative result are are you going to have a motor grader there working that road too I would imagine so is that would yeah yeah if if yeah C all all depends on you know if start getting washboard and and uh and that type of thing but yeah we that would be a much less impactful than uh you know having to rebuild an entire two miles of of bravel road which which would probably push us you know into next year and all that type of stuff it'd be one it'd be one mile because you're coming on the county road after that sure yeah I'm not super familiar but still that's that would be pretty impactful y take into consideration when it comes to that maintenance that Hall Road it's in our best interest too because we want to get the products in and out at the same time so it doesn't pay for us to just let it fall apart uh with our Trucks R on at to it costs us money as well as an inconvenience for every so so at that this portion of it our interests are are pretty well aligned all right thank you for clearing that up Mr chair yep go ahead Jenny can I go back to the hour toour conversation um you know we have pits in Northern Clay County that um have a 50-minute hall route to projects in the faram Morhead area so you know this spard has been really careful about trying to have consistent regulations on times and you know I I do struggle with us deviating too much from that that I I think what we've had is maybe special exemptions in regards to that Saturday piece if you're you're pouring and I think there's a 2 o'clock or somewhere there and they call the planning and zoning department to see if they could have a little bit of an extension there I think we've been more apt to approve something like that than going any earlier just is the is HS pit right now operation 7 to7 yeah my understanding is it is that was my question too she kind of me to it cuz I think since I've been on the committee it's always been 7 to seven 7 to seven and then the 7 to two on Saturday yeah and if they want they can call the planning office to correct so I I would switch that back to 7 to seven mat any other discussion Dave far as the Hall Road apparently there's two theories on what they would like are the returning trucks going to be coming meeting the loaded trucks on like you know if it's every two to three minutes as a truck leave and you're on that stretch of Mile you're going to be meeting two to three know one to two to three trucks heavy trucks going to have to sneak over is there a way to have incoming split up the incoming and that's probably there have them have them used both I don't know I mean uh I mean it just seem like when you're concentrated on a short little distance you're meeting that many trucks you see you figure 200 trucks a day yeah I mean there's going to be a lot of meeting trucks not that they're going to crash but there a lot of heavy trucks going to be pulling off to the side just a something for I mean if we you know the heavy the the hot mix that's leaving could use 20 10th but everything else coming in use 150th and just split that difference then the I mean they would have to calcium chloride and keep track like they said they don't it's two extra miles that they have to I don't know if the trucks coming from the rollog is going to be meeting or not it might be on the I mean I suppose you could put the lighter trucks on the on the worst Road first roads or if they're coming back heavy I suppose you have to stay on they're all about I assume all of them are about the same coming in or going as fully loaded most of them be coming back loaded yeah probably not always but yeah I mean far as uh doing something in Clay County for North Dakota I mean that's kind of their thing but it's it's our thing when the roads get destroyed and we have to deal with that I was thinking I'm sure they have it all thought out but if you're hauling x to the plant and Y from there on it just seems like why can't you just make that somewhere just get it over there and set up a plant but I mean I don't understand what they have thought I mean they obviously have thought through it I I think that's everybody's idea here why is it why is it here not sitting in melin if you're hauling x to the plant why does it matter where X is the plant is it's already on a truck my bigger Focus was the uh if you could split up the truck somehow at least if they're both heavy they wouldn't be pounding the same road yeah all day long yeah I know we I mean just Clay County is in general I mean I mean we're hauling gravel to to North Dakota every day many many loads so it's nothing new as far as North Dakota uh Becker County runs right through our County to get to North Dakota uh so that part of it I guess doesn't really concern me it's just uh one business doing business somewhere else yeah so my question to the group here again do we have a a condition eight on what Hall Road they should use uses are permitted by zoning District that's kind of been drafted and and revamped um as well as um kind of some um standards for specific land uses as well and so be and then also our administrative and enforcement um uh or Administration and procedures chapter which basically kind of details the the roles of the County Commission um the the planning staff the board of adjustment the Planning Commission uh and then procedures for different permitting um uh rezoning text amendments uh things like that and then enforcement as well so that has been drafted as well and the study Review Committee will have the opportunity to um review those any questions for me at all I know that we had anticipated kind of being a little closer to finishing this project or further along but it's kind Sheriff's Office K9 program um this stemmed from a raffle that uh they had done and assisted us with and uh raffle was very successful the funds will be used towards um just anything related to the program whether it would be any type of equipment um uh any type of training that they they need to do any type of um sometimes there's some technology that we have to buy for that stuff or maybe even a replacement dog as well so there's several things that that's going to be used for and uh we couldn't be happier of the uh of the partnership that we had with the American Legion thanks Sheriff the the legion has always been generous and with the K9 programs for years and and other needs and they're a good partner for law enforcement in our community so we're grateful for that thank you thank budget good morning commissioners before you this morning is just a a brief update on page two uh you can see the the culmination of the actions that this this board has taken if you recall last year the legislature legislature provided $300 million in public safety funds uh Clay County received $942,000 $19 uh there is a Public Safety Committee uh that uh that met and heard recommendations from our departments and then brought them forward to to this board and so before you this morning is just an update of reminder of what those things were uh the projected costs and the and the dollars that were actually spent uh for those uh for each of those projects uh uh a couple of the different positions a couple of different uh things that were provided were two positions in the sheriff's uh department and one position in the restorative justice uh so obviously there's still funding available with those positions through the remainder of this year uh there's also uh three uh three hiring bonuses totally $9,000 uh that uh that should those deputies remain here they would be eligible for th those funding dollars uh here in in September and then in March of next year uh when uh we when our committee got together again and reviewed all this information uh and projected what that spending would be in those in those three positions and and the uh bonuses uh we we projected that we'd have $ 32,45 uh remaining again depending on uh overtime uh but the request before the commission would be to take any remaining dollars whatever that dollar amount would be uh and to apply that towards the sheriff's department uh budget uh in for 2025 to offset offset any potential Levy increases with that I'd yield for any questions questions for Steve Mr Campbell yeah the excuse me the Public Safety Committee did meet and um Steve just expressed what our wishes were and recommendation were was to use that for that purpose so I would uh I would move to approve the request I'll second the motion M commissioner M thank you I um one I want to First applaud the staff and the department department heads and the Commissioners that took part in this conversation I think it um really was an opportunity to get creative and look at what the local need was for these funds so one I'm grateful for the legislative appropriation um certainly um the team work to figure out where the best fit was is important but I will say in the last week I've had conversations with um residents um applauding us for utilizing these funds in such a way and if you look through how we've um delegated this from the attorney's office and the restorative justice um component to the Sheriff's Office and the K9 there's so many different areas where the citizens have recognized that need and particularly um you know when you hear about departments in struggling times you I think we're trying to do our best to make sure that we give our employees the tools they need to be the most successful in the community and um really grateful for the opportunity to have the um funds particularly so um thanks for the work that you all did to make sure it was allocated in this way and certainly support the request commissioner Campbell and I worked with staff and the sheriff on this and um again staff came up with great recommendations to where we can not only impact the needs of Public Safety here in the in the county but we can also address some issues with our Levy to bring down down some of the some of the cost on taxpayers so it was a pleasure to work with commissioner Campbell and the the staff on this and the sheriff uh we have motion oh go ahead yeah I I I don't I don't think we should I don't think you meant to intentionally but uh Brian Melton was also a key component to this and and when it comes to the aid that also went to um the law office or the you know the county attorney's office as well well as restorative justice I think those were key components that Brian also U felt strongly about so sorry Brian indeed and and I'm I've got restorative justice in my portfolio if they ever need a commissioner but uh that's an essential program and we get feedback on that singing the Praises of the the guy we've got in in that spot so another good expenditure of these funds very much so I mean I think we've said it many times before but I will say it again it is very much appreciated and it is very much a a a terrific program and and that money is I think gone you know it it's its purposes has really reached a great deal by by funding that and keeping that going go back to a previous item here uh when we um when we went when Brian asked us to fill the assistant County position County attorney position um were we looking at backfill I didn't ask for backfill I don't expect it'll be any it okay the work that he's doing we've kind of already absorbed and we're going to look to fill really just inter okay I justas just wanted to make sure that we thank you all right thank you okay next up Darren Brooks our HR Director uh um we've got the discussion and recommendation on implementation of the market study findings all right big day the Blazers out I think everybody's been waiting for this um and I'll be glad when it's over um thanks for having me today this is a a briefing on the uh findings of the compensation study I think you have the a copy of the slides in your packets as well and then we have it up on the boards for the public and the employees to see as well um first off just a little bit of of history on this um as you you know in 2019 and 2020 we did a market study as well uh with David drown Associates and at that time they recommended a 5.42% increase on top of the 2% Cola that had already been uh negotiated with the the unions which was given us a 7.42% increase um as you also probably recall the market study was implemented about 3 months before covid hit and so there was a much different Workforce uh prior to covid than there is right now and so the board had uh said that we were going to do these Market studies every four or five years and I think that is a wise decision especially in this atmosphere um back in 2020 we had 22 positions that were deemed below market value and those grades were increased accordingly and as you know the union contracts that we have recently signed they go from 2023 to 2025 so we still have one more year on the union contracts and that's uh all of all nine of them um but during those negotiations we decided that uh or you you promised that market study would be done during that time and this is the result of that uh a little bit of uh background on David drown um well first off the colas that we've had for the last three years is 4% 3% and 3% uh for next year um a little bit of background on David drown we had Tessa Melvin did our Market study she did our last one as well so she was very familiar with our organization and our um positions um she's worked for DDA for quite a few years and and worked for nearly 13 years um in County government and city government um she has a classification and compensation uh service area and her earned her doctorate in public administration at Hamlin University with the emphasis on City development and planning so um she's very versed in doing these uh Market studies as well and let me get to the next slide so as of this date we've had numerous phone calls with David drown uh Associates and Tessa regarding the study um before the study started we had all of the department heads update their pdq's which they did which was very helpful as well and since the start of the market study we've had three closed sessions to discuss the results and also to receive board guidance on on where you wanted to go with this uh the market analysis for 2024 shows that our current grid was calibrated at 5% under Market average minimum rates and 2% under Market average maximum rates and 5% under Market actual uh actual rates um I will show in the a later slide that there have been several comparable counties that are doing Market studies this year and so the results of this Market study are a snapshot in time and I can't stress that enough because the market is is very flexible and and um moving a lot right now and I'll show you on a a slide going forward uh how many counties and cities are doing Market studies this year so um some of the things that we have to consider are other counties pay philosophies uh where they are in the market difficult positions to fill um retention issues tax base all of that goes into how a county determines what their Market study is going to be and and how much they're going to give um also taking into effect their counties and how they decide their Market studies um some some Implement them all at once uh some Implement them over the course of a year and if uh some counties are way below market then they may they may take a couple years to get back up to Market so um and I and I put that out there because there's a lot of ways to do a market study and a lot of things to look at um so from our 2020 Market study as you can see the board has pretty much done what it wanted to do and keep up and kept up with with the market as we were going forward based on the colas that uh you were given out for the past couple years so with any Market study we have benchmarks um Benchmark counties um some of them are cities that are uh location wise close to us and so this is a list of the benchmarks that we used uh for our study the list contains 19 counties and cities and these are uh the same cities and counties that we used last time uh this time we did add Sterns County which is a a bigger County than ours but we fought that that um it more closely represents where we are in relation to Fargo as well so it kind of takes that into consideration as well um some of these counties are bigger than Clay County some are smaller um but everything with the double asteris as you can see on there which is uh there's 10 of them those counties are actually doing Market studies this year as well so like I said this is a shot in time uh for when our Market study uh data came back um some of the things that we looked at are uh the entities that surround us what are they giving for colas and everything where they Market study is um indicators include tax capacity pop population revenues expenditures all of that goes into determining what kind of a a benchmark County and city that we we are going to um compare ourselves to these were the uh Benchmark positions that we looked at there's 48 of them in in total um and we picked those because these are the positions that are very closely resembles other counties so for instance a deputy in Clay County is very much resembles a deputy in otter taale or or some of the other counties these are positions that most other Counties have so we want to get the best data from as many other counties and cities as possible so these these uh positions were determined and approved by the board when we first started the market study that these would be our Benchmark uh positions there are a few positions that um not All Counties have uh for instance our detox positions and our out detention positions County not All Counties have those two organizations and so uh they had to go outside to um private sector to look at some of those uh positions as well and and they did do that uh when David drown does their comparisons they have they like to have at least five comparables to make a good representation of where the market is for those each each of those positions um not every position is looked at in the county we have over 163 positions uh job titles in the county and so I think um the the public and the employees have to know that not all 163 were were compared to all County positions in all Benchmark counties um so that's why we had the 48 that most closely resembles all the other counties um and please stop me if you have any questions um at all um this is just a a representation of our 2024 grid this is where everybody is right now um this includes the 3% Cola that was given uh this year uh from from last year's grid um just as a as a note for this Market study we did have uh 11 position that were graded uh differently and those were dealt with a couple weeks ago uh with the board to move those positions right away um for those that did move most likely they moved up and then back a step and so a lot of people um when that happens whether we have a market study or a grade increase or position increase or whatever um their years of service is not always going to line up after that so I just just kind of want to throw that out there just so if people say well I've been here six years but now I'm on grade 11 Step five or four it's because when you change positions and you go to a different grade your years of service is probably not going to line up exactly so I just wanted to put that out there for every Everybody also in our um Personnel policy um it does say that if you go up one grade that you would get at least a 1% increase in two grades 2% so we applied that that logic as well according to the Personnel policy right now we have uh 687 employees we have a lot of employees we've grown tremendously in the last uh couple several years um and 96 of those employees are already at step 12 or Step 13 uh just as a reminder Step 13 is for the deputies the deputy first class pay that we give uh that was negotiated several contracts back um we also have 122 of those employees currently at step one um like I said before we're five% under Market minimum rate at this point and 2% under Market ma maximum rate by um making those switch for those 11 positions we helped out the grid so we weren't quite as low low is what we were had we not done that um adjustment as well um let's see here those ones that uh those positions that were increased they were increased as of August 3rd so they'll see that increase on this coming Friday's um pay pay stuff um as we were going through this uh Market study we also realized um that we had two other positions that were below 93% and that would be the correctional sergeants and the HR coordinator and so I'd also like to have a motion to move those two positions uh one grade as at the end of this as well um and they would be moved according to the the grid and the Personnel policy and then uh make that effective August 3rd as well so that we can do that at the at the end uh as part of a motion um so getting to the actual two options that were given to us uh option one is very similar to what we did last time um option one was to add 3% to the cola which would make it 6% total and that would be applied to the entire grid um the cost of that is approximately 1,747 it would give all the employees the same increase um the negative is it is a a big tab to pay all all all at once starting on January 1 and uh but it does immediately impact the grid and and and assist with uh new people coming in and and attracting new talent to Clay County um if we were to do this as we did the last 2020 um Market study we would be at the Benchmark average and we would be 3% above the market Benchmark Benchmark maximum average so if you go back and remember we have 10 other counties and cities that are doing Market studies I think that's would certainly help us keep ahead of ahead of that to some extent um we did have a uh this was the option one we did have an other option too um but during some of the the meetings that we had we kind of deemed that option two was not going to be beneficial for the um employees what that was is to add 3% per step and uh as we go forward just making it standard 3% after we did the calculations and everything actually some of the employees would be losing money and so we kind of threw that option out at this point um our third option was to add one step uh to the end of the grid and then um uh or cut One Step At the beginning of the grid and add one step to step 12 so our our step one would become our or step two would become our step one um there's an immediate cost to this but it's not all equal this mostly impacts the new employees at step one and the long-term employees at step 12 um the implementation to the grid for this option would be 46 approximately $465,500 came up with and so all of this would kick in the first pay period of um 2025 which is like the last week in in December um let me see if I missed anything here I don't think so so um questions and discussion yeah thank you um thank you Darren for that uh I I want to start off going back to the uh benchmarks and the locations that we used and I uh I know that commissioner Mojo was the one who suggested we should include Sterns County not necessarily because it it matches up with Fargo but it gets us to looking towards the metro area correct because when we start looking at uh wanting to have you know save our employees and have retention here we need to pay attention to what's going on to the east of us so including that would I think that was that was kind of a a goal of having Sterns in there and I'm sure that probably brought numbers up a bit yep and I and I re I remember that conversation with uh commissioner Mojo that you know that's along that 94 Corridor where you know where we draw our people from could certainly be in the Sterns County uh area as well and then I have a couple more things then um just on going to the employees when you say 687 does that include our variable hour room yes it does and how many of those do we have um I don't have an exact count but we usually run about 150 and a lot of those it's in our Juvenile Detention and yep most of them are in juvenile detention a large portion of them are in juvenile detention uh I think Corrections might have some detox uses them those are those are the three departments that use the variable hours the most and then going to U getting into to um the couple of options that are here and I said it I said it earlier in some of our meetings uh between option one and option three I think I think option three would be putting a bandaid on something that um um probably would not work in the long term um I think option one is is um the way to go I when you know when we talk about um we made a commitment to the whole team the all all employees of the county that we would do this Wade study and for us to do that wage study and then just to put a banding on it would not be right and you know so I think option one is certainly the way we should go I do have a I just have a question on your presentation so that you know because because we have a 3% Cola already planned for 2025 right correct and then and then this one would be the the wage study action would be to add 3% to the to across the board to the grid correct but they would be two separate actions it wouldn't be one six% it'd be a 3% for um The Wade study adjustment right and then the 3% coal which which order does that go in um well I don't know I don't know if it makes I I don't know if it really makes Mr chair commissioner Campbell in this case because they're both 3% it wouldn't it wouldn't matter yeah okay all right so I I didn't know if we had to specify in any what motion we would make because it's not six it's three and three right it's three and three can be slightly different and from what I've been seeing uh through my HR channels 3% is becoming pretty common that other counties are given uh both for this year and next year so I think we're still going to be in line with what other counties are given I mean I'm not seeing fives and six and sevens out there at least the the input that I'm getting from other HRS um but 3% and then the 3% Market study so when you see a county that says they gave 8% but they had a market study that might not be 8% as part of the market study it could be like we are 3% and then no three but the action we would do today or what presumably that we we would be doing would be to deal with the market study 3% yes effective January one correct because the the um because Cola isn't decided until Cola is correct Cola would be decided at the final meeting that which is already in some contracts correct and and that those all the contracts have 3% for next year um that is correct so thank you that's any other comments commissioner CR well just briefly I uh totally Echo commissioner Campbell's comments uh especially in that that piece about the option one and being the right way to go and the other again I strongly agree it's just a Band-Aid and a bad road to go down so right fully support that yeah option one was what was initiated last time and that basically put us in a good position this time around to to meet the the promises we made our employees and still responsibly uh bring the salaries up to where we were competitive in the market too so I think option one is a wise choice commissioner moso thank you I just want to Echo the comments of the board is had this certainly has been a process and Darren and the team thanks for the work uh the long work it's taken to get here um to fulfill a promises that was made during negotiations certainly um you know I it's been an interesting few years in the HR World in regards to hiring and advertising for employment employees and and I think we avoided the the quick knee-jerk reaction by not doing a market study a year after the pandemic to wait it out a little bit to kind of have some of those hiccups work out and and there certainly still are challenges in regards to what the private sector can offer versus what um the public sector does but I'm hoping that this closes that Gap I'm certainly hopeful that because we did in include Sterns County some of the Metro counties now that are um 100% virtual to where people don't necessarily have to live in a highly populated area they can work from anywhere in an area um helped us align a little bit with with maybe that market pool um uh and agreed I you know budgets are tricky and it's a tricky year certainly there is a lot of challenges in regards to the economy and how much it costs um a family to go get um one meal at a grocery store certainly has gone up and so while we recognize that our employees are facing those challenges as well it's it's also important for us in the position to be cognizant of what the taxpayer burden is as well so I don't want to um um leverage and make that that equal on the backs of our employees which is why I support option one but as we move into uh the next month to cognizantly look at um the budget I think is important as well so um thanks for your work to get us to this point and um hopeful that this will be help and I think some of the things that the board has done has truly helped you know with with the public safety funds was helpful with the the uh remote work we have a lot of people that come in now and say do you offer remote work so that's a selling point as well um for for our recruiting efforts um the the recruitment bonuses and stuff I mean that all of that added all together has really helped in Recruitment and retaining employees Mr Campbell were you so um the two positions that we that we had 11 and there were two more that we found that needed some adjustment what were those two position uh it was Correctional sergeants and HR coordinator Mr chair Mr chair I I would move that we um and what what we what are we moving them to Darren to um the HR coordinator is goes to 19 and the correctional sergeants go to 17 I'll I think it's 17 I'll double check that okay but so they they I guess what I want to do is I want to do the same for we want to do the same for those two what we did for the other 11 and make that effective August 1st whatever that you know so my motion would be whatever that reflect the action you know whatever that uh where it goes on the grid yep it matches um yeah we would we we would apply the same mentality of so so I guess my first motion would be to do that one uh those two positions to move them up effective August ones similar to the other 11 positions we did earlier it it would be August 3rd that would be the part of okay whatever August 3rd August third okay that's my motion that you're going to have keep it separate from the yep okay I'll second on that motion have motion to Second any further discussion on the movement of the correctional sergeants and HR coordinator if not all in favor say I I oppose same sign motion passes then Mr chair based on the um weight study that we've done um I would move that we move forward with the option one proposal which would give an additional uh 3% Market adjustment effective January 1 um but it's easier to say the first payroll of 20 okay first payroll of 2025 thank you a second that have motion a second further discussion if not all in favor say I I oppose same sign motion passes thank you Darren Steve thank you we have Dale Arnold District supervisor with probation and he has his budget presentation welcome Dale thank you I'd seen some other departments put together a presentation they had a PowerPoint with their so I figured I would step up my game a little bit and put something together for you guys um I wanted to start out um today talking a little bit about the state funding formula which is something that is new uh to the state of Minnesota um in the last year or two uh I don't want to get too much in the Weeds on this but I wanted to give just a brief overview of kind of how it works um so that we can kind of make it make sense so to speak so the purpose of the community supervision funding formula is to reimburse expenditures tied to Community Supervision and community- based programming and services for persons involved in the justice system so what that means um is that for the purpose of uh refunding the counties um they had to put it together a formula um so that it was done equitably and so the way that they have done this is they take the number of clients that are on supervision um in each County uh times this capitated rate and this capitated rate um is put together it is the average salary of all of uh the corrections employees um in the state times the number of uh probationers on Supervision in the state and then times three then times 365 and they get like this average number um and then and then they take and then plugging that back into the state funding formula you take that times 365 and then the county is responsible essentially for 50% of that number um and this state funding formula is put together by annually and so they they come up with this capitated rate every two years and then they update the numbers um for each each County and so in 2022 uh we had 202 misdemeanor cases and 76 juvenile cases um for a total of 278 in the county uh the numbers today reflect a little bit higher numbers for both misdemeanor and juvenile cases um so you you could probably anticipate U that in 2024 when they redo the state funding formula that the number uh would slightly increase um and so the return funding for each one of the counties is now done in monthly installments um and when you plug in the numbers specifically from Clay County um you'll find that uh the total ends up being like 520,000 and then so the county is build back those or paid back in monthly installments to equate that 261,000 costs that are not included in that formula as well uh and you can see I kind of put together some data there for felony supervision as well which is um not associated with the county um and so in 2022 uh there were 537 on felony supervision and then 117 on supervised release or parole um so 654 and so that's our Revenue we get the 261 348 based on that funding formula and then we also on average generate about 6,000 in supervision fees which I'll I'll I'll discuss kind of where those supervision fees go here on the next slide uh so there were some changes in the department um in 2023 and 2024 um we had one agent in the Department uh retire uh and that um resulted in some changes and we also had uh one juvenile agent uh move over to a state funded position and that has uh really adjusted some of the numbers here uh that I'll talk about and so the salaries uh from for the budget for 2025 proposing a 5.6% increase um that's mostly due to Cola and the Insurance increases um the STS program hasn't changed uh and that's contracted with the do at 75% as well health insurance uh there's a significant decrease and that's due to one of two of the employees one being moved over to the state uh funding source and then one employee retiring and you'll see that kind of aligned with perah Social Security and then for some reason which I cannot explain that Medicare has increased uh slightly um even though those two employees have moved rent uh for the contracted employees and the building is included on there and then there's the juvenile offender restitution program jorp and that's where this the 6,000 in supervision fees that we receive in Revenue um has been rolled up and kind of given back and what that allows us to do is if there's a juvenile who's placed on probation and and owes any amount of restitution to a victim um we use some of those some of that Revenue uh so that the juvenile May complete uh community service and then we use that Revenue to pay back the restitution to the victims and so that's been a a very big benefit so 600 for drug testing um travel Auto Repair conference registration and training has slightly increased uh to $200 telephone translator uh decreas increase I think technology is kind of driving the decrease for the need for a translator and then obviously the telephone system office supply small large equipment repair um you'll see a small decrease there um and then this is that last part of the state funding formula the administration uh OAS senior support staff and the management for administration uh and there's a 10 and a 10 and a quarter increase there uh in The Proposal in the reason for that is because the cost of living uh increase for 2024 uh was not added uh as well as uh Insurance increases for 2024 and so we're including both 2024 and 2025 uh cost of living increase and um Insurance increase as well any questions about that commissioner karanov yeah just one uh just hear us on the two employees you talked about um so one going the state the other retired are you looking to replace those not at the moment um the one the the one employee that moved over to the state was supervising a small juvenile case load he had uh picked up some overflow the juvenile numbers are creeping up on supervision um you know we're probably in like that yellow stage you know kind of preparing if it ever crosses into the point where we can't manage it and maybe we'll have to try to figure something out but at the current moment um there has been no discussion about that thank you any other questions Dale and when we went through your through the through the budget one of the areas that we touched on was the decrease in health insurance um pretty significant there your your family contribution your individual contributions are significantly different is that is that where attribute or is it just the two positions that I haven't been read I believe it's the two positions um and then you know any degree I don't really know exactly what theyed um in terms of what their coverage was off hand but I would assume you're probably right any other questions they we appreciate the presentation oh I still got some more oh okay you'll see the total revenue for 2024 sorry apologize no problem um and then the total budget expenses from 2024 uh 1.27 uh so you subtract the revenue from budget expenses we got 760 2025 uh requesting a 4 and a half% decrease um and that's kind of because of those positions moving and whatnot um I do want to talk a little bit about what's upcoming this year um there's a we have applied for a DWI Court position uh to be implemented in the county uh that'll be no cost at the moment to the county I don't anticipate there being a cost because it's a grant funded position uh and so that that is exciting um and then we are also going to potentially continue to work on moving uh the felony office uh into into do the county building here which I think as well uh would be a benefit to the county as well if we if we can make that work the state funding formula is relatively new and uh I think over the course of the next five to 10 years you're going to see this number the state funding formula kind of go up and down and then eventually balance out uh there's also some potential legislative stuff going through is my understanding anyway that will uh also affect uh how certain counties are maybe potentially doing supervision and then overall kind of affecting how that that'll play out and so I I Envision that in the years to come um hopefully uh we'll see we'll see some increase in the state funding formula that is it well decrease is always nice uh certainly I know that the legislature uh or legislative work on this is about four years into it we're finally getting a little motion uh I I hope I'm not hearing that there's going to be surprises coming up in next couple legislative sessions but that's always a possibility with this fairly um novel process we have here in Minnesota soda it can be redefined with stroke of a pen so wish us all luck thank you for your presentation oh commissioner Mojo thank you Mr chair uh Dale I just want to speak a little bit to the DWI specialty Court I know that that is something that judge Rosenfeld has been really um wanting to Champion here and I know that there's been a lot of work with your office and others and just want to thank you for um whatever component of help you've provided to that uh this board really sees a high value with the specialty courts um the the transformative changes that can happen to the individuals that um that it works with so we're hopeful that that can become a model for the state so thank you for your work thank you anything else well thank you appreciate the presentation let's see on to committee reports and we're going to start with commissioner kraban off thank you Mr chair so we're going back to the last Tuesday afternoon we had our board work group uh in the afternoon we all attended that um having a discussion with uh HRA in their housing uh program um I thought they gave a good review I I was happy to see them kind of give a breakdown to their certain projects and knowing where their challenges lie and certainly as being a Lon to that group I I um see what they're trying to build on and the fact that how the time of the P pandemic affected them so much when there was a rental moratorium and they just had a large uh group of people that weren't paying rent and then when it came back on continued to not pay rent so there are higher evictions than normal and um and they're recovering from that as well as unfortunately when people leave places sometimes and many times uh they uh somewhat uh destroy the property as they leave so there's been a lot of work U done to rehab those as they get re rented but uh again they're um those things are all taken shape so I uh fully expect that their revenues will continue to increase over the next year or two uh they came forward with a potential request to of Levy uh to be approved by us of around 350,000 000 um I'm going to just Segway so I don't have to talk about it twice then two days later uh I had I was uh the lay is on then at their board meeting there was deeper discussion about um what was presented that day and Steve I think you may have received it maybe not but they passed the resolution um okay uh it'll be uh be coming then um that Levy amount that they were talking about uh finding uh funds um that were on a state grant that came through first part of April and looking at other savings um or other ways of reallocating and working with their projects so that re uh that budget ly request and that was 350 dropped to 300 so um I think and that was passed huh oh okay all right very good so that that handles that that group uh the next morning I went to the wild rice Watershed District they did their budget lby and um there's a slight increase there but uh not too bad I don't have the exact percentage but it was um so again they'll be doing a levy up in that direction and Clay County is about uh 16% yeah 16% of their uh of their L um of our of our drainage that goes into the wildo Watershed also they uh made approvals on 17 projects uh uh 11 which were drain tile as uh the wheat is uh harvested and the ground gets open they get ready to start putting their drain TI and so that was significant and then the rest was structures uh the after um that afternoon I had a um historical and Cultural Society Retreat uh the main purpose of that Retreat we had brought in a facilitator um Marine Johnson who's been there for many many years is going to be reti in July of 2025 and so the uh the whole purpose of that um uh uh event which was about 5 hours long um uh was about transition planning looking at their successes and maybe a little um rep repositioning of some positions and then and and in particular Marines job you know uh discussion around um her uh that uh executive um director position how that might vary a little bit with the next tire so that at this point moves on to our transition group uh which I'm not part of but our executive committee and a couple others are on that and we uh will then start uh looking to get the new uh hire in placey so that when um Marine um retires in July of next year that W uh up and running um on the 15th Thursday uh I as a a visitor I or a guest I should say I listened in on the metrocog meeting U commissioner Mojo is at that uh I'll let her give more detail Insight on that and then uh also on Thursday um I had a um the suicide and substance prevention monthly meeting uh excellent uh meeting I was very happy to be part of that or listening in on that we had uh presentation by our new uh community resource Navigator hired by the mo PD her name is Megan Lundberg I think she's been working now maybe four months right that ballart anyway the uh and her purpose as a job is when uh calls come in uh dispatch they're triaged over to her when it involves um uh uh assistance for mental health um and it just takes a little um uh White Off the uh PD for handling those type of calls uh she's documented um uh 18 calls uh of service that she's attended to and since her working with these uh people in their distress uh six of those 18 have not called again and four others have only called a couple other times so much fewer than before that so that job is um doing what was intended to do for the mor PD she ALS also helped uh supervision and and um uh involvement with the summer youth program that the PD had uh later in the U meeting um uh through uh with the county uh Roy Beal Jason McCoy and kren leard there was mention of a grant that is in place now for resources and um it's a four-year Grant uh that came in from uh Department of Health uh 500 Grand and and it's working with 14 Youth groups outside schools through sources of strength and other programs um uh to empower kids and and keep them hopefully away from making bad choices and then and more importantly uh in a way of life that can potentially lead toward um greater mental health distress leading to Suicide so anyway uh commissioner eer was part of that so that's my report thank you Comm commissioner Mojo thank you last week I also attended the HR meeting that was well covered thus far I attended the board canvasing um election canvany rather with commissioner Campbell as to certify the election results in this room I attended the um metrocog uh meeting as identified by commissioner karabanov we approved a GIS specialist employment offer a attorney engagement letter and talked about the North Dakota Mo um for the AAC approval but also approved the um BNSF study which has been a long time coming to get that to where it is and then yesterday sorry commissioner Campbell and I attended the withdrawal management detox facility openhouse planning um meeting we did talk about a ribbon cutting for our both the DMV and the detox facility we're anticipating that being October 1st um so you can all Mark that on your calendars at 1:00 we'll be hosting tours for the chamber and the Morehead Business Association after but also providing the public uh the ability to see the new facilities so a lot of work and coordination between all of the different departments um that were at that meeting certainly grateful for their help to lift that but even more grateful for the opportunity um to have those facilities up and running for the public um there'll be you know a a lot of Public Communication that will come from Jackie on on coordinating when the DMV at the center mall is no longer and when that move will happen um but that's what we covered at that meeting and that concludes my reports thank you commissioner Campbell thank you on August 13th uh I attended a a diversion Highway tracking coordination meeting regarding uh issues related to reach four um in on the Minnesota side for the diversion project several issues are still outstanding there and reach for um that that part of the project has been awarded by the Corp of Engineers uh to be constructed but with that there are still a couple components in there that are kind of a critical timeline and and one is um a small closure of a road in Holy Cross Township uh that needs to be done and and there hasn't been an agreement on that yet and um ultimately you know Klay County may be asked to um step in and assist with with those needs because that there's a very small section that will be permanently closed and that's the area that we're we're talking about here that needs to be resolved uh rather quickly um I know um Brian Milton was able to be at that meeting and and I think he's going to be reaching out on behalf of the county too um with with Holy Cross or their representatives to have that that discussion uh then on the 15th we had the Public Safety Committee meeting uh commissioner eing ey and basically the review as to what do we do with the unallocated Public Safety dollars and we acted on that this morning based on that committee's recommendation and then yesterday I also attended the uh open house openhouse planning for the withdrawal management and the dmbb facility and commissioner moo will also report on that and I just want to um go back to today a little bit for the actions that we took um I just want to comment to you know we've been for the last few months now we've been looking at every Department's budget requests and um you know I I I think the action that we took today in regards to the Wade study and our intentions on Cola is this you know that's going to be a significant uh cost to the to the county and I that can't go unrecognized in addition to what we're anticipating is the based on our third year of agreement with blue cross a 9% increase in health insurance so you know so when you look at those two numbers it's significant uh but I I just want to point that out that over and above this there are still a lot of uh demands that are coming before the county and um I think what we did today is we prioritized uh where the money has to go first and that's taking care of the people who are providing these services for the residents of Klay County and it that's where we need to start uh I'm not so sure that all of the other um proposals that we've had are uh going to be um probably as as U able to to do I know we can't be looking at 10 and 12% increases is being sustainable uh to our the taxpayers of Clay County so uh I'm just pointing that out that I I think we took a step in the right direction to take care of the most important part of this and that's our employees and with that I'm finished thank you on uh Tuesday the 13th I attended the county the um meeting with our County HRA which has already been covered um on the 15th Thursday uh I attended uh remotely the suicide substance abuse committee meeting which has been reported on by commissioner kravinoff uh one one thing I want to point out Annabelle uh gave a a uh presentation on a four-year grant for subance abuse and suicidal uh issues from the Minnesota Department of Health that is being worked on I don't believe it's been the grants come through yet but she gave an update on the report on that um later no I'm sorry on the 17th I attended uh the uh the Agy Regional Library uh executive committee meeting and finance committee meeting we reviewed a salary survey that's been done and we set up negotiations with asme the attor the uh uh Labor uh unit uh for the library out there and I will be serving on the the negotiation committee for that um one of the things the study did show is that the lake agasse employees are way under rate and we're going to have to look at uh at trying to close that Gap so that that is issues to deal with here in the future uh Friday I went to Detroit Lakes we had our uh partnership for Community Health board meeting quarterly meeting there uh agreed on food pool and lodging program fees uh for the most part the the big issues there are with Ottertail County it has a huge number of vacation home rentals that they have that's where some very big fees are attached and we are just kind of following the the identified needs of them in setting the the costs on that um had a couple of presentations and update on finance and Staffing and nothing really just kind of General business after that and that completes my report Steve thank you Mr chair uh last week participated in the HRA uh that's been well covered with the comments of commissioner kravinoff and receiving the special benefit tax that their their Board of Commissioners signed I believe they're under the same timeline from a budget standpoint so we can look to have them come in here and coming weeks uh on the 14th we had Clay County management again uh we T talked about the 2025 budget of the market study that was addressed here this morning uh strive 2025 and what an intergovernmental Retreat may look like uh next year um the 14th I met on commissioner Campbell commissioner Mojo and the solid waste budget uh the 14th also met with representatives from the diversion Authority that has been addressed uh the 15th participated in the public safety funding uh also MCC jpa prep meeting uh we have a meeting this coming Thursday uh there's a number of items uh that uh will be addressed uh there from uh rips uh rimp excuse me um also some additional uh addition water excuse me purchases of property uh that will be addressed uh and also some leases um we uh on the 15th met in the afternoon with representatives from the Minnesota DNR Greg strowman strowman uh from the Clay County Trail Alliance uh we were fortunate enough to be selected as with as a fiscal review uh with the DNR as their sponsor uh and so uh the the Greg and and the trail Alliance has have done a great job with the documentation working with the county uh and so just a few minor different things that that that were mentioned but overall it was a it was a good meeting uh again along with uh six other or five other staff right now had various no leadership academy uh meetings throughout last week met with sheriff empting on talked about some hiring uh challenges and also or hiring I guess not challenges being full staff and also then uh vehicle issues that he's continuing to have uh both with existing and then also I'm trying to acquire some of his 2025 Vehicles yesterday participated or planned some department head evaluation prep we have a meeting scheduled this afternoon with representative Keeler and Senator kupek uh in regards to the ptrf uh plan moving forward uh so we had some prep there uh participated in the open house meetings for the DMV and the the withdrawal management if you see up at the site now there already are some signs uh hanging on the on the fences about the opening date uh and then yesterday afternoon I met with Lori Johnson audit Treasurer in additional discussions about the budget and with that that concludes my report thank you m Milton anything for us no thank you eron Jackie everybody's quiet Kevin Mr I just I just follow up from Darren regarding the question I asked regarding variable hour we have Juvenile Detention and secure and non-secure as 77 of the 150 uh Corrections has seven and detox has 23 and then the rest
