item number 2-1 regular meeting of January 23rd 2024 what are the wishes of the uh council members motion to approve that's the the agenda that's for theend agenda for the a motion to approve the agenda yeah second it okay we have a motion on the floor by councilwoman call mayor before you before you get there just on item 5 A1 which is a guaranteed maximum price proposal for the um the project at the uh at the water uh at the plant that's a 10 million um project uh it's on consent I just wanted to note to you that that is a significant uh dollar amount and so uh staff doesn't have any objections if you want to move that at to a discussion item again just simply because of the size of it being on consent the amount of it okay okay and uh action item and that'll that'll give uh Mr Walsh an opportunity to tell the public what that item is City business yes sir okay move that one to City business item number 51a okay we have motion on the floor by Council woman cson a second by councilman G now uh I have a question um I need some point of clarification and it's pertaining to item number 7-3 provide direction to staff for funding new policies if necessary for the Indian River septic to se conver and here's my reason why I have some concerns uh representative Thad Alman who's the chairman of Appropriations we had that meeting we were all in attendance with the exception of councilman Beringer um I specifically made that motion that we table that item until we receive funding to show that we have the proper allocation for this and and and representative that Alman did give us his commitment and Mr city manager have you heard anything from representative fed Alman no sir I don't have any uh recent updates I know he has or is making the Appropriations request yes sir uh Mr Walsh have you heard from Representative fman no sir okay and and and and uh Esquire Anthony gargan have you heard anything thank you have you heard anything from representative fed Alman okay so that is the reason why I'm asking that we table this item to give representative fat Alman he was sitting right out there in the audience and he gave us his word because it this was prior to session and the next whatever 10 days we will be 9 to 10 days we will be at um Tallahasse and we will get accurate information from him at that time there's no time urgency or time sensitivity for this um even even um understand that the the February final report in August is due October the 24th for the deadline given by commissioner for the city to apply for Grants for additional $545,000 for the jnk so that is the reason why I'm asking you to at least give representative district 32 uh F Alman the opportunity to provide this fund or at least get some information from him I did call Representative fad Alman and I call an additional representative in l of Representative F Alman so I'm just asking that we consider just giving him the opportunity for this now I have two lights on and that's and and I will hear from them but then I'm going come back and ask for us to table this item okay Council woman cost and then Deputy Mayor hear yeah and what has changed is law on July 1st the governor signed into law House Bill 1379 that says that everyone in those projects in an impaired water body will have to have will have to either go septic to sewer or we'll have to have an upgraded um septic now the number two reason is that we went to the County Commissioners and asked for additional dollars they responded saying that we would have to apply for dollars they give us a deadline that we would have to apply for dollars before October 24 so um so the issue of Appropriations the Florida League of cities the workshop that I attended in November by the Florida League of cities on Appropriations stressed having skin in the game Palm Bay is a good example of that they've passed an ordinance that requires mandatory hooking up so that they can aggressively go after these grants and make Appropriations to to catch up um because we've got a deadline it's 2030 we have um and and of course our comp plan supports that ordinance as well but in order for us to apply for the grants we have to be ready to apply in the spring and there's another one in the fall not taking action not moving forward not preparing for that is going to put us in a backward position we're we're we're going to be behind um when we have you know when we have a moment of opportunity 100 million was allocated when the IRL protection plan was created the dollars are out there now the deadlines are out there now 2030 that's seven years I mean this project could very well take most of that um so further delay and this is something I've talked with the city manager about for the last couple of months since I came back from that conference the whole idea that we have skin in the game that means that we're actually going after the grants that means that we're actually willing to to pass the ordinance now there's a motion on the table right now and it was seconded that's for discussion ma'am and we're okay but there's still a motion on the table the um the item that we'll be discussing that's that's been moved to City business is a big Grant it's a Wastewater Grant um um and we're also in consent items we're receiving a grant that project $1 million we're receiving I think it's 3.6 or something like that as we're voting in the consent agenda and certainly we're going to look for every opportunity to get more dollars but it's not an either or it's a yes and yes um because the dollars are available now and even being able to moving the soral dollars or not taking the soral dollars will not give us any advantage to getting any dollars for the other project and I can show that to you with charts and I I have evidence to back that up but it's not an either or it's a yes and yes now is the time and we have to show some skin in the game the other municipalities are moving forward and aggressively going for these dollars we don't want to be behind we want to do what's in the best interest of our citizens and that's why I think that we should discuss giving staff direction to move forward okay my concern is that it states that we have until October 2024 and yes um to get the money ma'am did I interrupt you when you were talking thank you please the same CL five no ma'am may I have the same courtesy please thank you Mr Walsh sir do you based on your own professionalism um what is your take on this especially with the funding that's uh in reference of upgrading the plant itself also uh in reference of the nutrients too as well sir because there again we still have not yet given the man that set right there in the audience and your word is your B and he made it vividly clear matter of fact crystal clear that he would acquire These funds for us stated it right there pull it from the minutes you know he asked us we table this item until we get some information from representative fed Alman am I correct in reference of that Mr city manager uh Mr uh utilities director Mr Walsh yeah um when when we talked about this item last year um representative Alman did promise that he would um make all efforts to go and get the additional funding that's uh needed for um for the project again the session started uh late I think they they they alternate every every uh odd every even year I think they start in January so the session has just started um um and so again um there's an Appropriations request that he is making he is sponsoring um and then the the the additional dollars remember the county commitment was for additional dollars added to the project and that uh that uh decision was uh the caveat on that is uh to secure funding by October of this year if if we don't secure funding then we don't get those additional dollars there but but again U that's an October um of this year deadline and then Mr wal can actually uh he can talk about and again we've moved that item so we can talk about um the significance of the uh the project at the plant as you know um the complimentary item is uh 52 which is the grant that uh complement that but that that also uh has a bearing on on uh nutrients um um in the lagoon there and so um sort of related um but certainly can talk about that when we get to that item yes yes sir um I think there was a question or two in there uh I'll just clarify the um the item that was in discussion to move move was for the award and it's kind of part two because we had already been to council for part one for the improvements at the Wastewater Plant and that was to engage the contractor or semar and to order the long lead items so that that's been in place for six or seven months I think six months and those items have been ordered and we allocated a portion of that project total which was about 1.5 million okay so that's already in place this agenda and if you want to pull it off and have more discussion no no issue there certainly you're you're more than welcome to to take that off and I can talk as much as youall want me to talk about it um but the the part two of it that we're presenting tonight is simply when we have a semar they develop a guaranteed Max price to complete the project after working with the plans and the engineer to the nth degree we have that number secured this is our second or third go around with the Sears they work really really well gives us some assurances some caps on our on our spending some um some engagement with the contractor on you know answered questions before they have to bid it kinds of things this all really works very well uh and that portion of that project is the 10 a half million that's on the agenda for tonight uh it is budgeted as required uh because otherwise we cannot put things out to bid as we've talked before the project was fully fully um funded because it's a required project and as councilwoman C mentioned $379 and other requirements we have to meet certain criteria dis charge to the river for our plant I you know there's other things about septic and Sewer in the Indian River Lagoon but our plants wet weather discharge permit by July of 2025 has to meet the advanced chemical requirements as outlined in that bmap that go to the Indian River Lagoon this project fixes that problem and and it fixes it for everybody within the city because everybody's waist goes to one location okay and it's in the order of potentially we get credit for something like 6,000 lb of nitrogen and I think it's 2,000 or so pounds of of phosphorus it's big numbers and that and that is calculated based on the 91 days that we're allowed to discharge during wet weather during hurricanes and in the Summers when people aren't taking the flow but we have too much coming into the plant we have to get rid of it somewhere and we have a number of Alternatives but are absolute last alternative is the river and now that the new laws and the new things that are in place that's that's a requirement so I have to do this project so that project was designed almost two years ago you know through that process through the sear selection process underway to get to you today and about four or five six months ago that additional 100 million got identified as a water quality grant for Indian River Lagoon there's components of that project that meet that re criteria so not all 12 million or the total project meet it but $3.6 million definitely meet that criteria we made that submitt in hopes of getting the Grant and that Grant was was identified for Coco for that 36 and that's the second item that's on there and that's a reimbursement Grant so we still have to have the money spend it up front and then eventually get reimbursed from uh from D yes cuz my other concern is if there's a a cost that superseded the actual completion of the project who pays for it we we pay for it yeah I mean the grant is the grant you can't go back and get more like I've I think I've stated that before it's why these things get can get tricky a bigger project like what we're doing we have a pretty good idea but if if it comes out at $3.8 million well then the city has to pay for it but we've already budgeted those dollars to put towards that project and again it's a it's not a nice to have project it's a required project so whether we had the grant or not we had the requirement to do that and we're trying to get that done it's going to be about a 14 project and that'll leave us about three or four months we hope of testing to ensure that the implementation and all the engineering is correct and that the plant is tweaked in such a way so that come July of next year that we're actually compliant and our discharges will meet those those criteria thank you very much and that's my greatest concern the if the cost supersedes the actual allocation of funding who pays for and there will be other individuals who do not have a direct impact will be subsidizing someone else's uh concerns uh uh Improvement and I understand I I do like the project but the greatest concern I have is a representative th Alman who I do believe in respect to the fullest gave us his word and we all heard it and that was the motion the table that I made and we seconded and we mooved forward on this councilman Deputy Mayor Hearn then councilman go then Council women okay I'm just trying to follow up so I understand the project that we have uh that was in the consent agenda the must have approval of the Mandate of the uh mandatory hookup what bearing does that have on that project is I mean they're related in that the mandatory hookup is addressing indirect discharge to the in River Lagoon through the use of septic systems that are existing this particular project is a direct pipe that goes from the Wastewater Plant and discharges to the river which is what all of the Wastewater plants done over the last 100 years that's how they used to dispose of it now we've gotten smart and recognize that there are some detrimental effects and the new law that was passed has specific Advanced water treatment requirements chemical requirements for phosphorus nitrogen and other constituents that we have to comply with and so this project that the plant addresses those specific concerns and remember that's the collective so we have 19 or so ,000 people 7,000 sewer accounts in the city uh and that Collective Wastewater effluent once it gets through treatment at the plant that effluent if it were to go to the river because we don't always go to the river some years we have the Hurricanes we have some years we've had those really crazy storms that drop 20 inches of rain on us in a week and have wet wet wet wet wet and nobody's using reclaim we run into some problems but when we do we have to meet that criteria going going forward from July of 2025 so I I completely follow in that aspect um I just was making sure it wasn't any confusion as this was a either or um situation here see they're they're different projects yes and two two different requirements here and I Jack I just passed this now and so this is this is a a a sort of cheat sheet on on the house bill that uh councilwoman cost referenced and if you you'll see so Jack has a requirement for his plant for the wastewater treatment plant to be advanced water treatment water treatment plant by sometime next year July 2025 and you'll see on this side of this uh of the summary that if you are uh a resident out there and you're on a septic system you have until 2030 to connect to a sewer system if it's available um are to to upgrade to the advanced septic so that's that's that's the 2030 for the residents out there it's a 2030 uh deadline uh that was in this bill that said if if um if a sewer is available you have to connect to that or you have to go to Advan septic by 2030 Jack make sure I didn't miss that's correct 2030 right okay so if we were to move forward with a mandate of the hookup uh no one would be penalized they would have until 2030 2030 to actually hook up to the J&K line correct again I think Jack the key word is if it's available available right if sewer is available if Council to move forward on the jnk item if they would have choose to go to the and fully fund or fund that project so that we build a gravity system out there then this requirement then over overshadows everything and says hey you have until 2030 to connect to a line that's in front of you or go to advaned septic if it's not in front of you so if the project did not go forward everybody would be required to be on advaned septic by 2030 if you put the pipe in and spent the money those people if they didn't connect and our I think our requirement would be what we would want them to connect because we're going to have skin in the game from the county because they're going to want their money back for everybody who doesn't connect and that was part of the multiple agendas you know that we brought to you in this you know in the same vein of J and K about hey we've got to have mandatory participation because it's a prata reimbursement from Savar Indian River Lagoon they give us money because everybody's going to connect if everybody doesn't connect we give them back that money and so then it comes out of our pocket and it's not a small amount so it's I think it's over $70,000 a connection so and I and in the previous agendas I had tables and if you all remember it but it's it's scary because if you just have 5 or 10% you know that could be half a million dollars in reimbursement that we would pay back to the county that they would use towards another project in in the Basin I would imagine but the Mandate would would basically secure that everybody's going to hook up yeah I mean I think the mandate's there I I think you know for local governments I think we all have to decide how we want to approach this and it's still back to the fundamental agenda item that has been been you know looked at several times about are we going to create a mandatory connection ordinance and and force people in J andk to connect and try to get 100% participation and if we do that if they don't connect what are we going to do because the city certainly has significant skin in the game to the county because the countyy is holding the strings for just the sural money and then there's additional Grant monies that we were also looking at from D to try to get that 50/50 match and then of course there's the risks and all the other things associated with the construction project so I don't know if that helps or not okay so forgive me for being long winded but I'm just trying to check all boxes here um a question for gargan um this for my personal uh reasons um has there ever been a history within our government where there was a mandate issued um things didn't go as planned or the results wasn't as favorable as they wanted it to be and that mandate was resend it is that has there ever been any history of that not not that I recall I mean in terms of in the context of sewer I mean the council's changed laws from time to time you know they've gone one way and then another but I'm not sure that's Apples to Apples to Apples with respect to what you know the Mandate on a on a on the sewer connection okay because of because of the way the project is um styled and then the jnk right and the Mandate for participation in order to get funding right right it's it still comes down to funding that that's really the basis that that's kind of what's driving decisions here it's we've got this overarching requirement now that's going to require something to happen by 2030 whether that's a hard pipe or whether that's an advancement to an old septic system to make it Advanced treatment either way the council has to decide somehow between now and say five years from now that which way you want to go and how we want to fund that and who's responsible to pay certain things are we going to roll out any programs are we going to try to go all in on J andk and get as much funding and still take on the risks that we talked about associated with that um and and of course this also opens up up because we haven't really been talking about the greater area of the Bap we've been primarily talking about everything east of US1 but we've got a lot of folks on the other side of US1 that are in the bmap zone and that are going to have this requirement I think it's something like 470 plus or minus connections that would be affected by the bmap mandatory requirement to connect by 2030 so what are those folks going to do so it has to either be an advanced septic or we'd have to look at possibly trying to fund a piping but probably impractical in those areas they're very spread out and there's onesies and two's all over highest concentration of course is east of us one along Indian River Drive and in between Indian River Drive and and us one those areas you talk about in the B Maps which I'm familiar with a few of those areas Coco play Grove Street um few areas we have over the city is that something that could be addressed through a plan where we have over the years we you know we achieve those uh it it could be but I I think we'd also have to look at the practicality of whether or not spending millions of dollars for a few hundred connections and again it's not going to necessarily be the most bank for the buck because they're spread out there's certain little concentrations in Pockets where that might make some sense uh but overall remember you know we've got to run gravity and we've got to be able to connect it to existing so I have a restriction between where grade is where the where the lowest sewer is and whether I have enough cover and how far I can travel with the minimum slope in the gravity pipe in order to make sure that the flow gets to the to the existing point which is a fixed point in space so that would all have to be looked at gotcha my biggest concern I just don't want to miss out on this funding um I understand Mr uh uh uh Thad Alman you know he had made his promises to us um but that's just one portion of the funding and uh I think I think fundamentally the question that I heard that I heard the mayor state was simply we don't know because the the item was tabled last I may we were I think we were at we were here and because Dad came and and made some commitments we knew that they weren't be able to address that until the January session which is essentially now but as of today as of this council meeting we don't know whether we're going to get any additional funding and it'd be nice to know so that we maybe you could make a maybe a different decision or a decision based on whether that comes up with something or something partial something full or something in between so I think and what I'm seeing is is simply we don't not today and that was really the primary reason why it was tabled at least when I reviewed the uh you know certainly what we did previously on when I wrote the when had to bring the agenda back this week when I was asked to bring it back okay so if we give Mr Alman uh the time to give us further information on this subject uh I would be in favor of tabling it only if we can put this agenda item on the next at the next council meeting and then you know do we know when he's no we don't know because when session is over March in the month of March I want to say March 4th okay give or take a few days so we still have all the month of February right and January and here's the other thing I mean it look at it again it says October 2024 so we have ample time that's the 10 month of the year but we're talking about funding process I don't that takes longer than just a couple months as far as going for the grants correct no no there are certain grants that we're guaranteed automatically even if we I'm just saying I'm just saying if you went to the advanced septic connection the advanc one that still supersedes part of the requirement of nutrients falling back into the Indian River and that's the reason why I was asking uh Mr Walsh sir with the upgrading of his facility of the plant we are ahead of the ball game and and and that's what we're saying by the year 2030 pretty much everyone is required to either advance to a septic or hook up to a SE by 2030 everyone is that correct that's correct everyone everyone in that Basin yes right so so what I'm saying there's no rush I mean yes time is up Essence but there's no rush we haven't given this man the opportunity where we voted say sir we're going to give you the opportunity to provide us some additional Revenue because if we fall short who's going to pay for it and people already told me that live in the Coco North Area already and over by me they want to pay for someone else's um subsidizing because it's not fair and Equitable to them because they won't do it in even in district one cuz I know uh the conditions and situations they went through for district one as well so that's the reason why I'm saying just give representative F Alman opportunity to see what he can do during legislation we're on a starting week four so I understand what you're saying but so if everyone is mandated by 2030 to hook up what are they going to hook up to in 2030 if there is no sewer line they don't have sewer they have they have to go to advantics so so and and again two two requirements Jack as a Wastewater uh uh treatment plan operator has a requirement to go to Advanced wastewater treatment that's the 2025 yes um that's the project that's on your agenda tonight right so that's that's sort of plantbased and then in the community those properties that are in the Bap area are required to be either on a sewer system or have advanced septic by uh 2030 so so so the sewer system the wastewater treatment plant will be taken care of and then you have from now until 2030 for residents to actually be on a on a on a on a um sewer system again if available or go to uh the advanced septic okay sir thank you sir councilman goens sir after councilman go one minute please after councilman go will be councilwoman calls then after councilwoman calls will be councilman be Matt be uh F first I'd like to apologize for this long discussion on the item we haven't even started the council meeting yet um but it's a very important item and and we we don't have any other opportunity to have this discussion legally except for this moment so that's why you see sometimes a long uh winded um conversation so if involving the the Palm Bay um and I don't know if you can answer this or not but and maybe Council woman C can answer the question far as pal Bay what were those majority of those lines that uh once they made the Mandate were they already available in the city of Palm Bay I think they had they're going for both now I think they had and have been applying for the quick connect requirements which is if you already have a sewer nearby or right in front of your property but you've got septic for whatever reason reasons they're getting grants to make that connection to pay for the plumbing get the connection get the cleanout in pay for the impact fee whatever and get you connected those are some some dollars that have been available they recently I think just passed an internal ordinance because they didn't have a mandatory connection they're in the same boat kind of that we have that they weren't able to qualify for other grants like the D stuff not going to get it can't take the sural money either because they want mandatory connections for the for the septic to sewer stuff so I think they they did that back in November or December of this year they made they basically took the Florida statute and Incorporated that into an ordinance for the city to make uh to make it mandatory uh our our ordinance has that same language but it has an extra paragraph that basically says that but if your septic system is working you're not required to connect and that's the reason why we don't actually have anything in effect right now gotcha um so so I do know this NE next weekend um or next week uh three council members will be going to Tallahassee um and and I know each one of you are probably gonna have some reust conversation uh with um um representative Alman as well so um I don't NE I don't mind I didn't mind that's why I second it I didn't mind having a discussion um but I'm also just based on the conversation because I know um councilman Binger is quiet on the at the moment so I don't know he is um with this conversation I'm also worried about the U item uh dying on the diets as well today so I don't mind tabling at all um based on Council Members being able to have that one-on-one dialogue cuz I know councilwoman cost will be in his office for sure uh to have this conversation so have making a decision today um I don't don't believe would be detrimental today um next month or possibly like like uh the mayor said in March I don't think it will it will do us any harm right now but I have confidence in my council members that they're going to go to Tallahassee and do their job for the citizens of Coco so um so I don't mind tbling that I did second it I didn't second it it for um that particular item per se but I was willing to have that conversation today about it if we needed to um but as we can see there no really no new information um so um so I resend my second uh on on um and so that's that's where I am with it so you were sending your second yes on the approval of the agenda sir yes sir okay I just want to make sure I already know the answer to that question is that permissible esquad garanes well there was a sec there was a second so it does belong does belong does belong to the council at this stage so without objection certainly um you know you can withdraw if there is an objection then you would have to vote the motion down and then make another motion okay that's fine thank you and or I can make a motion to table and if I get second then call the that's different yes and then ask that this item on my table I'm Excuse me on my request for this item to be tabled and then that will eliminate just item number 7-3 is that correct so but everything else will stand as stated yes you can you could table one of the items right and then the uh that would modif well yes yes sir modify the main motion yes sir yes sir okay uh but I believe in doing things decent and in order I'm going be biblical okay uh councilwoman calls then councilman baringer sir okay so um Jack you mentioned that there are 470 uh connections out there there are 470 homes that do not have sewer or yeah okay and you also said that everyone is served by the wastewater treatment plant so those 470 people are not served by the waste water treatment plant right and five years from now do you anticipate this project being less expensive I have no idea ma'am okay I can't predict construction costs next week let alone five years from now the project was approved in 2019 um there's probably you know we've seen quite a a cost increase in in that amount of time um as far as representative uh Alman goes um he's not the one I would be talking with I would be talking with other Representatives right because he is in support and that's where it starts to get dicey because we're competing against other Appropriations including Palm Bay who has been aggressive aggressively going after um upgrades to the wastewater treatment plant as well as sewage overall to for the purpose of having a you know 21st century ready to go strong infrastructure City we're looking at a lot of growth a boom in growth and fortifying our infrastructure is certainly in the best interest of our citizens do you have I was going to ask um Mr Whitten do you have a copy of the letter from the county the exact wording because I believe the wording on the dollars from the county required us to have the funding in hand we haven't applied there's a grant in the spring that we apply for and a grant in the fall if we don't apply for those how do we have that in hand would be my question and then in terms of our talking about this this being the only opportunity for us um councilman gos I mean what we really need is a workshop to really look at these infrastructure needs right that would that would be the ideal I've been talking about this with the city manager since November it kind of got seemed like a surprise on the agenda I didn't realize it was going to be such a surprise and lastly how appropriate is it for us to have this amount of discussion on something as important as this is to I see several people in the audience who are facing probably 30 to $50,000 expenses as a result of you know they could be as a result of our decision how appropriate is it for us to have this amount of discussion and not have any public comment since numerous ones of those have turned in cards the public would have an opportunity to speak on the public input I mean the this discussion is about whether or not this item should remain on the agenda for discussion and Direction so this is just a procedural you're at a procedural posture of approving the agenda for the the night now granted this is a very important issue that you've taken up numerous times so you've had approximately 35 minutes of discussion on the substantive matter even though what's really before you is whether or not you want to leave it on the agenda for discussion so I would I would recommend that you decide whether you want to leave it on the agenda for discussion yeah and then vote on the agenda for the evening and regardless of your vote the citizens have an ability a comment on the public input on this issue if they want to okay and then the last thing I would just ask is well I would say is we don't know but we don't know there are many things in this agenda that we don't know exact expenses on we did a pretty good job of Shoring up what grants were available now you know we may be off some and prices go up but we're not that far off um so the we don't know is not going to change um that we don't know even if we get the appropriation you know we can't be positive that's going to cover every penny of it so um anyway so I think uh well that's all I'll say about it for now and hopefully we'll have an opportunity to discuss this it would have been better to do it in a workshop I yield the floor to councilman Beringer councilman Beringer sir thank you uh short and sweet uh I think we're about at a point in order at this point uh uh and to Echo uh council's uh sentiment so if the vote is are we doing it or we not I think that that is the vote uh is and essence or substance to the actual issue should be done under the issue or so and so on so I I would just ask us and point made uh additionally I I do recognize that there uh is a concern question or information that is I think as council members were receiving that may Foster more questions I in in the interest of the public I know that we have it on the agenda and there are there are people who came here tonight uh I think because of that that would be do only extra piece uh that I would throw out there so thank you thank you very much sir people live by integrity and and and I believe in representative fed Alman because he gave us his word and that and I want to give him the opportunity to um fulfill his obligation that he publicly stated even in the presence of his father-in-law he made this statement and my concern is we still have time um the the house excuse me the legislators do not conclude until the month of March and we have ample time to apply all the way up until October the 24th so I mean there's no need to hit the panic button because I believe in our representative he's been again faithful and trustworthy so on that note I would like to table item number 7-3 for tonight and I'm looking for a second we don't have to vote on my motion because I guess that's a table second was withdrawn no I think it's the the main motion I guess is is to approve the agenda and now he's the mayor is making a motion to table one of the specific items okay so I'm looking for a second the second was rescinded and that Council well as I pointed out procedurally the second has not been resented unless it there's unanimous consent of the council because a second a second was the second was made once it's made then it the motion belongs to the council so and we procedurally the council's always taking a position you can withdraw your motion if there's unanimous consensus of the of the of the council if not then the motion needs to be acted upon alternatively now in this particular case the motion main motion as I understanded to approve the agenda is still on the floor the mayor has made a motion to table just one of the items yes seeking a second if he gets a second then the table issue and under Robert's Rules I believe takes precedent has to be dispensed with and then you see where it goes so the first motion is not voted on it's not voted on if there's a second for a motion to table then the the the manager of Indian Harbor Beach and I'm here tonight as I serve on the Florida City County manager association Communications committee on behalf of fccma we are privileged to present the city of Coco a certificate celebrating 2024 as your 65th year as a council manager former government as recognized by the international City count management association on behalf of President gatso officers and board of directors and membership of fccma we offer our sincere congratulations on your 65th anniversary as you know the council manager form of government was created to help separate Administration from direct political influence and establish merit-based practices within local government it's modeled after a corporations framework where voters I.E the stockholders select a council I.E board of directors who in turn appoint a manager I.E a professional executive to advise the council and Implement its actions through ordinances and policies in Florida nearly 70% of the 411 cities town town K all right uh we are an electric ride sharing micr Mobility device company in Bard County I do have a Bard County City license and I'm here today to request that the city council please issue my business tax receipt that I applied for and September 15th of 2023 I was told that it was going to be on hold indefinitely until the city council could come up with some kind of ordinance for lowspeed vehicles uh I submitted a package in there um about our company and what we do I'm a local I was born right here in woff in rockage uh Gary's also local Don is also local the reason why I started a scooter company in Bard county is because I travel and I Ride Scooters all over the United States and I do not want our city to look like Orlando where it just looks like Pickup Sticks on the sidewalk on Sunday morning like trash in our company we go around in the city every morning before the city wakes up and straighten up our scooters if someone leaves it on a sidewalk somewhere no one knows because it's already lined up pretty by the time the stores open at 8:00 a.m. I've already been in Coco Beach for over a year I brought my scooters into the village because I had Jackie at the Pirates Museum requests me to bring them here I never brought them into the village I would have never even thought to bring them into the village but after I was with her I was at George and dragons and I was at bugnutty I was told that I did not have a city of Coco license and I couldn't be here there's information about how my scooters are safer than all the other scooters in in the US in Tampa and Orlando they're twice as big they're twice as wide they charge your phone they have blinkers on the handlebars they have blinkers on the back they are heavy duty not the tiny ones you see everywhere else that are you can pick up and throw mine weigh 120 pounds good luck picking that up all right um after we were here we were told we didn't have a City license and we had to move them after I moved them here we have numerous businesses that want them here cuz you know you're not making parking any bigger there is no more parking what parking there is is what parking there is people who come here visitors residents people who come back year after year always looking for something new to do and a way to get around people already have their private ones riding around the city airbnbs are providing private ones for people to use why they're there and just because they're not labeled with a company nobody stops them I just want my license issued or denied not just to be on hold indefinitely in September you had a meeting okay ma'am minutes 31 seconds in September you had a meeting uh direction to staff on oper ation of low speed vehicles and golf carts if you see on page two the state chapter uh 320 under state Florida statue says lowp speed vehicle meanss any four-wheel vehicle under chapter 316 we are a micr device a motorized Transportation device made available by private use through the reservation of an online application during that meeting I understand the fdot or FDLE was requested to be here but I was not please wrap it up ma'am I've been I just requesting that our license be issued because we would love to have the scooters in the city of Coco okay esad councilman go um have you have you you haven't not met with our city manager about this at all correct no but I applied for a business tax receip in September so um I I think that would be a good first step so talk to who uh our city manager okay um so if I know your your numers on this hefflefinger I live in 2000 Juniper Drive I am an unincorporated resident in District One your Windward preserve development is just down the street the citizens have some concerns and we think that we may be able to get along with you guys but we have it we have some traffic issues um there was an there was an stipulated settlement agreement way back when I mean this is an ongoing thing that blocked you from having access to the Friday road to your development right now your PUD currently shows a two access points off a James Road which you're asking the county to allow you to turn into a private road you're kind of in violation of your own PUD ordinance that you're supposed to have two access points and they should be highly desirable to be on separate roads the stipulated agreement took Friday away from you I understand that that puts you in a hard spot it also puts us in a hard spot in the unincorporated you will all be coming down the same road one Central exit point we think I think that I have and I propos this to the county I think I have a solution for you but it will require you to relook at your current plan you can give yourself a secondary access point by cutting a road on your own property along a frontage road of 528 you'll stay within the city you'll control that road and you will give your your citizens in there and there's quite a few homes you'll give them highspeed access to Services fire emergency and you will also take a little the burden off of of Bard County residents that you're driving through a rural residential one house po per acre typically and and we're looking for a little relief and we think you you have a problem with your your access and that that creates a problem for us so I'm asking you to consider modifying your PUD so that you're more in alignment with what the intent is give yourself the second access on a second Road cut yourself a road in the city you can control that road there will be no speed bumps you can get in and out fast and the people that want to buy into that development will appreciate your decision and you're you're you're looking to the Future to make sure they remain safe because right now there's the stipulated agreement and hamstrung you guys it did and that was the intent because we were mad about it then you got com traffic cing devices that you're going to push all the traffic down Friday my backyard is Friday that you've got a lot of density in there that's it's a lot less houses than it was back in 2004 when it was talking about a thousand but we'd still think it's a lot of traffic in our area it doesn't match our area we'd love to have Coco grow we would you got that property you also have the attaching property along 528 you can cut a road and you can keep us all happy so we're asking you to do that I pitched this to the uh County Commission they said you should go down there and talk to Koko because ultimately they're they're they're allowing you to have access to our road we're a little upset with them and we think you you do have a problem with your with your access point so like you to consider doing that and uh I think we can all get along I mean change is going to happen you're going to build there we know that we're just trying to make so you're happy we're happy and we're good because it's going to create a major traffic nightmare for us so I think I do have a solution thank you very much thank you very much Mr Richard sir do we have any questions for him well Mr Richard come back to the podium please go they don't do this at the county please ask me a question it's not really so much for you as I'm trying to understand where is the opportunity to do that to consider that because we've already we've already we already passed I actually submitted a document to the county and I presented or generated a map you have the the reason that you were able to to Annex is you can you can you you state that you had the continuity along 528 that get you to the big development there at the corner so you do own that property runs along 5 28 okay I think you have enough easement to cut a road there a frontage road and that'll stay on your property you won't have to speed bump it the services fire stations right down here where it would come out near the the CVS Pharmacy on to 524 those people that want to get to the cape they would love to have that road that would be a selling factor for that development I don't think it's something we're going to consider now because what's in front of us tonight is a CDD right we're voting correct okay City council's already approved the the uh final engineering and site plan for the project this is just creating a uh CDD to manage the uh infrastructure that's going to be constructed in conjunction with the project I've heard from lots of folks and I'm very sympathetic about what's going to happen there so well it's yeah we still got per we have to vote on the CDD I was hoping we could just kind of come with a compromise to make us both happy but we we'll keep we'll keep working on it and hope you guys continue to work with us too thank you absolutely sir thank you very much sir Miss Tammy Hoisington good evening my name is Tammy Hoisington I live out um on Pinto Circle which is right next to the drainage ditch across from extension James Road Extension um it is my understanding speaking with the fish and wildlife and also with St John's Water Management that no um permits have been issued for some of that stuff yet um my question tonight is if anybody can answer it is how come there's an excavator already out there doing work on the property how come there was another piece of equipment that I couldn't identify and I've been around a lot of equipment out there last week also working on the property if nothing is permitt if none of that stuff is permitted yet they're already out there plowing and digging why why is that being permitted I did call fish and water life and turned that in I did call St John's Water Management today and turned that in so I'm just wondering what's going on if we have to be above board with what we're doing in life why doesn't that company have to be above board and what they're doing because this is already showing us that they're just a pack of liars and that they want what they want because they're greedy people and that's all there is to it that's all I have to say thank you maror um Miss liever and after Miss Liber will be um wow what does that say is that Jerry oh I know who it is yeah come on up with uh Rick in um my concern for the safety of the residents who will eventually live in Winward um the two- Road access onto a onto a private road meeting up on James Road with five other small rural roads coming in and a major one Friday road if there is some type of Emergency on the James Road Extension and people from Windward have no way out no way out I just don't know how you can justify establishing a district when you are already compromising the safety of the residents that will be there I that just blows my mind until there's a new plan which is there's many faults with it when it comes to egress once you're in there I think you guys need to go back to the drawing board with the developer and saying we want to make our residents safe and God help that there's an emergency at the front entrance there's no way out there's a canal on one side and there's private property on the other that's fenced in there is no way out so I just want to present that that I think you're Gravely you're you're you're not taking this seriously that you are jeopardizing the safety of the people in Winward and you're not looking for you're not looking to an emergency that could very well happen so that's all I have to say and I hope it works out that you're more considerate of your citizens that will eventually live there but until then wiw should not be established Susan Rollins and I live at 2770 Pine Lily Lane which is right off of James Road you know I have similar concerns but I would like to um I don't know how far you are on developing this Council I don't if that's the appropriate name for the Winward District the council but I would like to request that um somebody in unincorporated Coco be a member of that Council I think that is the fair and um and um conscientious thing to do is let us have a seat at the table and let us help in that discussion and uh so I wanted to put that out there obviously I have similar uh questions that everybody else has but I I would like to recommend that is if at all possible let us have one seat at the table that's all I had thank you ma'am Mr Allen coward and then after Allen will be you Jeremy good evening Council apparently I'm a little late I didn't realize it already been approved the site plan has already been approved for that whole project yes sir okay because I I was at another meeting a while back when all it started and we were talking about being a in order with what's around you okay everything around there's acres and you know single family acreage and bigger and this was going to small houses per acre and it's not what's around us we're not being uh good to the neighborhoods around it and I was told at that time that's because they're not in the city and that's not the way we should look at things I mean if somebody wanted to put a condo next to your house even though you had 40 acres that would necessarily be the greatest thing to see and be you know living with the neighborhood and trying to make it work um the other big thing on that as has been mentioned already I'm not going to beat a dead horse but the traffic control out there getting house vehicles to and from that they're going to go down James Road even though Friday Road even though they say they're not going they're not supposed to you know there's only two roads in uh three if you go away into Coco North that's not going to happen and people going be shooting up and down there at a multi amount of you know people um so I don't know what exactly is turned out on all that I like to see the site plan on what's being done being a site developer seeing what's happening with that I know y'all have done the best you can with what you have as far as getting people to and from but maybe it's too many people to and from and I guess I'm missing the mark on on say much about that at this point but it just need something keep in mind you know if we can to help help the people that are out there I'm not in that area I would volunteer to be on that board if they're if they're taking people for that um I'm into politics a lot more than I probably should be but I'm more than happy to be uh so you know people that don't want to be can't complain you know and so if uh if you need another name on there give me a call and I'll be glad toh work with you best I can thank you for your time Hey sir good evening my name is jar early wi I'm with qac rock here on behalf of Taylor Morrison and my handwriting has not improved since last time so I apologize for that um just in response to the the good questions we've gotten the project as you all mentioned was approved back in December so you know we went through traffic studies and worked with the city and that that plan is basically in place and it's already been approved today as youall mentioned what we're talking about is the CDD um as the operations and maintenance um entity for the project it's a much more Superior robust uh entity for taking care of the storm water uh taking care of the the James Road Extension all those things you all are talking about the CD is a much more capable entity for all the reasons we talked about last time in terms of sight clearing or anything like that that's not going on um there there is um there has been some geotechnical testing so they had a site visit last week had their contractors out there looking at the site doing some soil samples and things like that but there's no no construction going on so I'm happy to answer any other questions y'all may have okay we have a question from councilman go and councilman Beringer my question was um at any point did have y'all had any conversation with the county as far as their roads as far as Jan's Road um a Friday any any any robust conversation about widening or of those particular roles any conversation I'm not as privy to the um project details I'm not their land use attorney but they require permits from all the different applicable entities and I'm sure that's happened I got you yes esad sir yes I mean there there are requirements in the stipulated settlement agreement regarding James Road and traffic calming and so forth so the developer has been working with the county to meet the County's concerns regarding the project gotcha I I guess that that would CU we've been going through this for a while and a lot of a lot of times um citizens that live in unincorporated Incorporated areas um and I don't mind it they jump down our throat but at the same time the county is the one who um has approval a part of this approval process and so I always thought they should F those dishes in and pipe them that's what I thought for a long time but but we know what that means that means money right and so last time I gave phone numbers out to representatives and it didn't go well uh they got mad at me too but but I I I would always say call your county Representatives cuz a lot of times um they have they have the funds for certain things things right now when they're go going to get ready to go into their budget season that they might be able to do more on the roads in that unincorporated area I just say that so I mean only like I said I just in my personal opinion I just always felt that they should pipe those ditches and and widen those roads I always thought that for a long time but but that just that just me I always get myself in trouble by speaking my mind but um that's just how I feel about it sir okay is that it sir yes sir thank you sir uh uh represent represent come on brother councilman baringer sir thank you uh and so that is my million-dollar question is I understand the framework and structural means of which a CD is created uh and also uh the the legality of the authority that is designated to that entity uh and yet here we have a citizen willing to be supportive I think to the idea of the CDD through direct involvement so so as ordinance written I understand the five supervisors under Section six my question is how can or is there a willingness to to appoint a another individual to the board a representative to the board board or is there opportunity for a local representative not listed in this board or citizen to be able to attend vocal vocalize concerns meaning in their annual meeting you know semi anual whatever that might be is there a place where that citizen can be involved with that if they are not directly appointed Andor is they willing to make a number six instead of five so councilman that's excellent question we get that question from time to time consider if we just had an HOA project this would simply be run by the developer it turns over at 90 95% build out by putting a CDD in place though you know a CDD is basically a homeowners association that can do more things they get FEMA funding they've got sovereign immunity protection their insurance is better they can take out um uh tax EMP loans to finance and take care of their infrastructure better they can collect on the tax roll which means if there's a a problem with roads or something like that they're much better uh more robust maintenance entities so that's really what we're talking about is as a CDD now you talk about involvement from the public the CDD does turn over typically earlier than an HOA because the CDD doesn't turn over when you've got 90 95% buildout the CDD turns over after 50% of the um uh property is sold and whatnot they can start to have elections and and put people on that board but in the early years of the project just like with any other project the developer is going to control that so they can uh oversee the project they're familiar with that they're more involved in the construction now the other advantage of the CDD is it's a public entity so our our meetings are not closed to um you know just the HOA members they're open to the the entire public just like you guys so if we have uh citizens who want to attend our meetings um we've got public available websites we announce all the meetings they're welcome to attend we would encourage their participation so I take that as a no I think that's sir you elaborate you know if I if I may once the board that the board will turn over then only those persons that meet the definition of qualified elector are allowed to uh run for election and serve on the board and that includes a residency requirement within the district so it's it's limited to Residence like an HOA right you own you own a home there you'll you'll be uh if you meet the other requirements uh qualified as a candidate to run for the board okay than all right thank you but it does turn over typically earlier it's it's much more transparent sure it's fair thank you is that it okay do we have amending the fiscal year 24 budget Mr Walsh yes yes sir sir there there's a lot going on there yes sir it is my friend try to get it all one you know one item so obviously spoke about this one you know when we started the meeting but just a quick summary would simply be this project has already been seen by Council in the form of part one it was awarded to Wharton Smith as the construction manager at risk and Council authorized somewhere around 1.5 million for the long lead items and for the for the award to Wharton Smith this is amendment to that first contract if you will or change order whatever you'd like to call it but because we're using the cmart risk we're doing it as a change and that's to add this 10 some 10.5 million to the project for the whole completion of the project this is also related to the second item on the consent which stayed on the consent which is we're going to get $3.6 million back because we're get we got that that water quality Grant from um from D thank you CH like to make a motion to approve look for a second second second uh uh Mr otario U Mr Greenwood and also Mr Mr Sullivan I have your cards here I will listen to you all once we get me get elected there uh good evening I just um since you you tabled uh since you guys tabled the the motion I I guess there's really not much for me to say when when do you guys uh think you might bring it up again well let me say it this way sir disc to be honest in all fairness to me let the session conclude in March oh okay to be to be fair and Equitable across the board because I call our representative fat Alman today and I call another state representative as well in conjunction so my thing is it's on their radar for sure okay they know it and I trust representative Alman he's fair and Equitable across the board and I support him I've always been a supporter of his so all right you get this um all that's pretty much it thank you guys thank you you want to speak now yeah no I just wanted to say the um actually it's March is when the session ends but nothing becomes signed in until I mean we don't really get a a confirmation till July in July correct um Alec Greenwood thank you Council and uh thank you for allowing me to put a a couple of ideas um uh to discuss uh I noticed that there hasn't been too much discussion about the actual drainage the pipes that are not involving sewer that go into the river and I've been told that there were uh quite a few and I couldn't get it verified there bottom line there is a lot more questions about this subject and I think it's important that it would include other um uh uh methods that the city is using to relieve some of the uh the Water that's ending up in the river and one of them is this drainage pipes I've heard there was as many as uh 80 or 90 I don't know if Mr Walsh knows that off the top of your head but uh I was just curious is there an abundance or is this something we should I think the pipes that you're talking about are storm water discharge pipes so that would fall under Public Works we only have one discharge for the plant oh there is one one good but the rest of discharge is typically surface water and that falls under storm water okay that that answers it thank you very much Mr Frank Sullivan he's not okay well that's all we have so at this time I'm going to close this session from the public and open it back up to the council any staff reports yes sir um Mr Walsh Chief lamb and um M singer am I up yes sir you go first yeah I just wanted to mention to the council and anyone listening uh and I think I'd mentioned it a month or so ago that we had a a um a regulatory violation for our our testing of our water I mentioned it a council about five or six weeks ago but it took about five or six weeks to get bids and get the notifications and now they're cycling through the the bills so some of the citizens are now starting to get them over the last two weeks so in case you get questions uh it was for diethyl hexal phalates yes it's a synthetic organic compound that we have to test for every once in a while every every couple of years we test for it and the the bottom line is the water was safe we never were not compliant what happened was was we exceeded a regulatory a state regulatory detection limit but we never exceeded the maximum contamination as determined by EPA so the state put an extra requirement on certain organic compounds and says hey if this comes up at this level you need to start monitoring it a little bit more and we missed one of those monitoring sessions it was like four quarters and we did the first one and the second one got missed because it's we had a little internal problem um but the water's safe everything's fine and and somebody brought up to me I forget where I was and where when they mentioned it to me but they said they were just so scared from reading the the flyer and I I agree 100% And I just wanted to make sure that everybody understands that the flyer is 99% D controlled and there's like two sentences in there when we can tell them what happened basically that we missed the monitoring and all the other language in there is pretty much dictated by De and has to be in there and I don't have any control over that so it's difficult to read it can be scary but this particular item was we missed a test and the item that we were testing for never exceeded the contamination level where it would have gotten to a level of concern it only exceeded a regulatory State requirement to create additional monitoring that's it that's my report no Samantha's GNA go you go okay um just a few things um just wanted to reiterate that we are having the Coco or the celebration for our Coco High football team this Saturday um beginning at 1:00 so come out to Riverfront Park and help us celebrate our state champion football team um then we have on next Wednesday January 31st we have our annual economic development business Showcase Event where we'll be highlighting our Coco businesses um and giving just a a year in revieww uh to our attendees for economic development um and then on February 6th we will be doing a groundbreaking ceremony um to kick off the start of the Fisk Boulevard drainage project um that will um that's a much anticipated project along Fisk Boulevard and uh the Broadmore Acres Corridor there um and so we'll be doing a a short uh groundbreaking ceremony uh to kick off that event and that's all all I have would you reiterate that date again please ma'am councilwoman call I apologize February 6th and it's at 9:00 a you're welcome they saved the long- winded one for last so much to their demise uh I I will attempt to not be long-winded uh but I think what I'm going of reports very important to council uh it's with great um Pride that I announc to you that both of our uh High School uh recruits who came into the recruit program have have both graduated school and they have gotten their State of Florida EMT certifications so um you know it's hard not to get uh really uh emotional when you talk about this program especially these two young men and what they've accomplished and they have gone through phase one which is getting their National EMT and state of Florida certification but it's been through that partnership through the city of Coco that's helped them get that much of that has been through our HR department with Lauren stanet and certainly Tammy jamat helping them get through that first phase through EMT school but the other portion of that was our finance director helping get their uh their programs paid for so they are moving forward into phase 2 Fire school starting in February um and I say that because really you should sit down and listen to these two young men's stories uh the impact that the city is having on those two young graduates from right here in Coco and the lifechanging events that we're making on them is Monumental people don't see that on the street our citizens really don't understand that or see that and what's going on behind the doors to help them be successful and it will ever be lifechanging um not to to get in the Weeds on stuff we talk about roads we talk about impacts of communities that are coming in taxes and all that but the impact this Council and our staff has had on these two young men will forever be impactful in their lives and we're continuing to do that with that partnership with our school here at CoCo so I'm very proud of these two young men I'll cut it off as the city manager always says don't unsell the car but it's hard not to unsell the pride that we have in these two young men and what they've accomplished so thank you yeah and Mr Mayor I I I let the chief go on last on on our purpose because it's a you know it it is uh there are a lot of things that you can do in a 30-year career this is one of the things that I'll remember most um and and chief we we we have to give a special shout out to the gentleman you told me about that uh provided some assistance yeah and I was really trying to cut it short cuz I wanted to say this but so so Chief Hennessy as you know she came in with a very strong background and very strong connections throughout the fire service and that's what has helped connect her and I together is our relationship with our connections and she actually had a connection with a private Institute uh in Orlando that teaches fireing EMT school and one of our uh recruits were struggling with the state test she reached out to her connection and said can you help him and he said absolutely we sent him up uh several times four or five times within a week uh for remediation extra study extra help uh this gentleman makes money off of doing that as a favor to us in our organization he didn't charge us a dime thank you his last session was on Friday with the this young man and I'm trying not to embarrass him but this young man and then he tested Saturday and passed with flying colors so that was huge for us man when you invest in human mankind that's a win-win situation sir yeah man the impact that you all thank you sir yeah thank you and imp life it's just really a a great story and and uh I mean you don't have any better stories than that and and and uh the the two uh gentlemen from uh Coco high are as committed as any recruits that you probably ever had Chief and and the and the irony and the beauty of this all is is that they if the timing is right they'll get through fire school and hopefully they're testing and we'll be able to bring them to the Coco high high school graduation this year as uh full-fledged uh Coco firefighters and so so that that would be just a one ful thing and so we pray that the timing works out for that um and so that's the end of our reports let me suggest that on next week when you're up in Tallahassee that um there are a lot of issues a lot of big issues up there but with regards to um um uh representative Alman that that that be one of your stops um because representative Alman Alman among his assignments are uh a and natural resour sources he is the appropriation subcommittee chair and so you you need to pay a visit to him to ask him what the strategy is with regards to who you see to get them um I'm I'm singing from the same sheet of music with regards to our Appropriations request because he's going to give you direction as to who he thinks he needs to have in his Corner as we uh as we go out of subcommittee two committees there so so so please go by and see uh start off with odds this evening uh councilman goings district one and okay uhu good evening [Laughter] um uh so so um is that politics so I some sometimes you uh we we we tend to help so we help so many people sometime you forget about your own uh so my my daughter she uh committed to the University of Memphis uh this week and uh the great thing so yeah and full scholarships I don't have to spend no more money that's [Laughter] what but I'm very very proud of her um and all her accomplishments um she's also will be graduating from Eastern Florida State College before she graduate from Rock Les high school so she is uh much smarter than me um and I'm very very very proud of her um so we this Sunday right before the Martin Luther King march um a group of young people um from the Jack and Jill organization um came in so so imagine uh you 13 12 uh 10 year old and your your parents ask you to go anywhere on Sunday right and especially City Hall on Sunday you know but these these young people were were very excited um to learn about local government um a lot of questions um that I know I didn't have at their age I believe my first time really coming to city hall or was in my 30s I probably was 3031 every every time I came in I really didn't know or even know why city government was so important to my life so for them to be interested and wonder why we all take this charge at their age was absolutely amazing um I'd like to send shout outs to uh Tiffany bonadio uh Sam Samantha Singer and also our city manager also for um helping with our Swag Bags um I think I think Miss Tiffany put put those together with with your with your assistance as well the Swag Bags was great I see the kids walking to McNair Middle School this week and all of them had their glasses on um and so little things to us is is is means a lot to a lot of the kids in our community um so that all of them got an opportunity to take pictures in all of our chairs again it shows um what we do means something in the community um I would have never thought at 13 I would be sitting here at all um with the life I was headed in and so for for them to have the opportunity to sit in you guys seat uh from the end to end um it it meant something to these young people um this was our um uh the Martin Luther King march um the speaker was Pastor Sean Ferguson um I really I got this picture because it was raining um but we had a situation we had a concert the night before and just so happened the um event people didn't come pick up the tent right and so sometime that's how God works when a missed Opportunity by them to come pick it up we all were blessed and all of our seniors was blessed to be up on it this tent while uh it was raining uh thank you for the council members for that tent that showed up um so not a lot of people in the chairs now because it was raining but there's a lot of people standing around um yeah that's yeah that's those are the glasses um shout out to uh coko High School um they a lot of times the football team get all the praise um but they have a lot more Sports where that they're being successful in they got second place yesterday um at the K Coast Conference um basketball tournament uh they played against a very very good a top 20 uh basketball team in the nation with Palm Bay High School um so they was really to be honest with you really outmatched um but they are so young they have a lot of upstart to them so shout out to them for the second place finish and they play my daughter Friday so we'll see how that go you know uh this was the March um Marther King March a lot lot of photos I I think you know just talking to a lot of the leaders we as a community we just got to do it better getting the information out um a lot of lot of the events have changed a lot some of them have gone to parades now some of them have changed so our crowd wasn't as big as what it normally is um but I think as a whole we can um you know get our young people out and and more of a drove up so I another know the young man to the right he is our fleet manager uh Mr Jones U he's always in attendance um you know I really appreciate him I just wanted to get him and I told him I would he told me not to but uh but I had to do it anyway um but but that was it um I I really appreciate um the citizens for coming out I know that the J andk conversation was really a hot um item um I believe it's going it's definitely going to come back around uh my stance um has always has been where it is and have not changed thus far but I'm I'm I'm really really interested in making sure um that all of our ciens do have do do not have to uh pay for anything and also I really don't want our city to to have to come out their pockets either for for anything as well so that's my goal if it happen to change then it changes and then we we'll go from there but um we'll see but I I again I really think that um our accounts that's going up there are very aggressive people and I believe yall going to have a great conversation with whoever that may be and um and we'll get it done so thank youer sure you're have to help me maybe uh thank you so uh and before I get going uh on on some of those things uh um at first I'd like to apologize for staff because you're here late and I'm I'm going down some so let me apologize ahead time uh so just a couple things and I would welcome discussion at an appropriate time so if that time is at after or during or whatever I would welcome that uh but I also would welcome that at a later time if it was uh appropriate to do so or if you say no we don't need to talk about it well that's democracy so uh uh the the just just a couple things a little bit housekeeping um the just first I think internal as a council uh I think it is important for us uh to and this is not an admonishment I think it's the idea is just to make sure that we are uh being good stewards of our our great reputation uh if if if we need to communicate ideas uh the the the person to use is the city manager to that and so if there are things that we would like to see direct to the city My Hope Is as a council we are using our city manager as that city manager point of contact but also we definitely are not communicating with each other about things that could be on the agenda I I I I really think that that is a very important it's law uh and I I even if we're doing something that is okay uh my hope is from a perception standpoint we are above board so just as a you know courtesy between us all I I I would hope we continue to do that um uh we we with the tabling of uh this evening um I I I I am while I am the affirmative to the vote I am disappointed and I'm just sharing I'm sharing for the purpose of so so we know where I am at uh I am disappointed that we came back earlier than what had been agreed upon or moved previously but equally I respect that as a council member when we feel that there's a priority that needs to be assessed I I'm I I will be the first to say push please uh and the reason for that and this would be my question of where I am totally feel that we are underprepared to make a decision and as a coun member I can only speak to myself but the reality is that the legislation that came out is inclusive of the entirety of the Bap and our calculation up to this point I think is representative of 1/4 of the bmap and if I have my an individual who lives in Palm Bay who helps us out with our kiddos who just got the understanding that she now owes 30 grand to hi to to hook up her septic that's her take and she makes 25 a year and so now she is totally lost on what does it mean how do I do it who pays for it what just happened and I I I hope that at a minimum at a minimum if we're going to have a discussion about our area specific in our Bap that we are inclusive of an entirety of a plan that meets the legislation that now is inacted which is you will connect or you will go to a 65% reduction which I think is the advanced septic I think that's the the the E idea but until until we have a number of what that cost is I have trouble spending millions of dollars to impact not for them not for the addition of sewer but for the addition of sewer for the reduction of the the nitrogen and what's going into the Lagoon so that's all I would ask is that in moving forward if we're bringing that to council My Hope Is that can somebody please provide a number for what it will take to do the entirey of the Bap not specific to the incremental you know receipt of funds that that that can help us in that calculation but the legislation says everybody within the area which is 400 you know around it to 450 and because that is a really big number and we're talking about one big number for one4 we have another whammy you know for three years down the r that's a $10 million upgrade that we're moving forward on tonight that you know you got three and a half for so now we're at 7 for one we're at an undetermined amount for just the 100 we've identified and we've left 300 people hanging to the equivalent of what my babysitter is the same question who how what when and I haven't heard one piece of legislative clawback at all for enforcement because it doesn't exist the legislators didn't even figure that out so are we as a utility going to be responsible for a potential claw back is it going to be to the homeowner for the clawback is it going to be what's the enforcement mechanism and the these are all questions that if we are talking comprehensively to the area specifically designated in the B map to reduce nitrogen loads to the Lagoon I think my hope is as Council we may look at that as an entirety although I'm very willing to if we are looking at that as an entirety and we have a plan to address that to break it in parts so on once we have that number I I'm I'm more than open to moving forward on getting a chunk but I'm not okay with getting a chunk and going I don't know about the rest and and and that that that would be my hope is as we are working on waiting for legislative session to to finish up and that's a lot that's a lot of information I don't think that's something you whip up overnight so maybe maybe if council is is open to something like that maybe maybe while we're waiting for that funding we could also be working on can anybody give us a number on what it's going to take to meet the legislation and not asking for that number tonight but I just would would would would anybody ask oh with that I'll give you a couple clues well and depends on how many grants we get well yeah well because there's money out there now I and I would say independent cost of Grants so what What's the total and in agreement it I got you What's the total amount and I think Point yeah I think Point made so that that would be one and again I I I would appreciate that scope of information in in decision-making but again not tonight and I don't know if Council uh would find that useful uh so that was one uh the this the the other part is as education to the law I don't believe there are out of our population of the city of Coco that there is a significant I think that there is a lot of work to do for people understanding that this law was passed by our state legislature because immediately the answer is city of Coco you're making me connect you're making me no this result is a result of State Legislature step one so no matter what the case and I hope that I hope that citizens understand and I'm not saying right wrong and different but I'm saying our state legislators have compelled this to happen so if you're in this area no matter what Coco does it's one or the other and I I hope that they understand and I hope that they are planning now for a potential $30,000 connection because there's nothing that says who has to do what so I I I hope that we might need to I I hope maybe as Representatives we can help people understand that that law exists and the gravity of the amount of money there's a lot of our tax base you look at our homes if you break down the let's say The 100 on the J&K and let's just put it I'm going to grossly overstate it I'm gr I am grossly overstating but let's say it was 13 million take it to 10 you're at 150 Grand a house to connect 100 how many of us in our districts have homes that don't equal 150,000 so we are buying a house for a single property I'm not Nei no so there's more to that I I I I don't disagree and I'm not saying about the city of coko I'm saying total amount dollars to to do this so what does that look like for the other 300 in the be M what does and I'm just saying it's a lot of money I think there's a lot of consideration I I would appreciate the additional information at a time that sooner than later so I could help but educating people about the law I I think that we as a council that would be to a benefit and more Community engagement on what the take is on that law and how to move forward I would welcome that uh thank you for the for the latitude sir yes uh the uh the the other is just as we are coming up on Spring break uh uh Chief I I know that you youve got it out but I'm just as a friendly reminder those kids don't have anything to do for a week uh and so whatever we can do to keep them occupied when they are not in school uh I man I because I know that if they are busy doing good we're not making poor choices so I just I would share that I had a couple of citizens who were concerned a little bit about that just is how we going to handle that so anyway the good news uh this is all District 3 yes sir uh and so so if you go out towards our industrial area if you haven't been out there for a little while it's they're turning a lot of dirt this a great RV storage boat storage uh and so folks can you know maybe get out of the yard if they don't need it put it in place it looks great and uh there's a lot going on out there uh and I thought that that was just great to see on Solid Ground uh uh everybody knows this or or I hope it you know if you haven't seen it for 6 months or a year uh it's it's moving that's right uh the other is just for clarity for citizens that may be concerned about you know when is this getting done or when is this starting uh it is definitely there are phases okay so it's not build the whole thing stop and then wait for a while and rent so uh they're going to get that going uh and I actually I think we're on the right side of the timeline from a development agreement standpoint they are in line with the development agreement uh city manager if there's anything you want to add to that but thank you thank you thank you thank you th this the they the serus apartments which is what this project is uh was issued 15 building permits on December 3rd 2021 and uh fast forward we we are here uh January of 2024 and so uh remember 2021 2022 we were on the heels of a a pandemic we had supply chain issues um we had labor issues um and so uh they are uh weeks away from going and seeking cosos on on uh several of their buildings um the representative told me they are they're currently leasing um the uh uh those uh those uh Apartments these are high-end uh luxury apartments and so for the for the citizens that were concerned concerned about the development agreements they always have timelines in them you know they they always have timelines in them um and and and to be concerned um about whether or not this project was progressing in accordance with their uh the clock in their head is a is a just kind of funny to me because this project is replacing uh a dilapidated uh uh uh Plaza that sat vacant for 15 years and so I thank you for the opportunity to to uh to address that because this is going to be a a very very uh big Improvement to that site and uh they are ahead of the time frames that are uh outlined in the development agreement in District 3 yes yes sir in District thank you hey and and speaking of District 3 I just want also want to remind that uh you know within our city we we do have that balance of that you know that our environment where right with the city uh and I just as you know you see the duck Crossings whatnot but they're they are alive and well over in District 3 uh and abundant and it is just a wonderful thing uh to remind us that we live in a place that has rural components to it or at least some uh Wildlife they just all over the place uh the the other part and uh so this is our our good friends over at the old Flying Jay uh and so that's a 100 trucks on a Sun Sunday night and it stays packed and it's not the same truck every night so I I just share from a from a marketing standpoint I'm not a marketing guy uh but I do understand that there is a lot of traffic going through there uh and then I saw that sign that said Coco on it I said man that that's probably someplace we could figure out you know say you know come live here come explore here come be great here we love you truckers please find your family here uh and I don't know if that is but you know if if there's an opportunity there I tried to talk to the folks and that got complicated I don't think it's as complicated as I made it so anyway uh I would love to see something uh from a tourism standpoint and whether that's the the tourism Council can buy us to sign and the City of Coco can buy us a sign uh but anyway I I thought that would be a great way to welcome some folks and maybe some new families and show them our new homes uh equally we've heard a lot about Friday Road uh and so just for for clarity uh if you haven't been out to Friday Lo Road in a while uh that's right at the intersection where previously you know I think folks had mentioned the potholes and how bad the intersection was so that's the freshly paved uh road that has the turn lane uh my hope would have been that the the turn lane would have come back a little bit further bit to to accommodate more and maybe that's a redo uh depending on what we see there but you know I'm not a traffic study guy either so uh I'll let those who do but just so you know that's that intersection across the street from all those trucks that I just saw and ultimately that would be the exit where people would be coming out of probably primarily for all the development but it is nice and paved and that's all I got thank you right thank you here you go ma' so you want me to go yes okay um well I'm not sure how to unpack all of that I really feel like we need a workshop because there are a lot of things that were said that are incorrect one being that this is just about 88 homes there are there's 470 As We Know um homes that do not have sewage a number of those and did we get a number jack on the number of potential quick connects 60 it's 60 plus or minus okay so out of that 100 million that was signed into law um bravard County got dollars for quick connects now there's an education effort because we have um 60 residents that can get their quick connects virtually paid for well it's 12,000 for each Quick Connect um but that money is available to everyone in the county and it's on a first come first serve so um there's 60 of those 470 of course we have the 88 Direct on Indian River Drive in J and K then you have another at least 200 homes behind them in Carlton Terrace where Janice and Russell live uh who are determining what are they going to do now these houses are very close together they have non-uniform lots so they've we've had all sorts of problems with uh people even being able to put up sheds just because it's a very it's a dense developed area and septics really limit you doing the uh main down Indian River Drive will provide us offers us the opportunity to later expand that and offer it to those other 250 folks so you see how we kind of Whittle it down okay um but there are in terms of it I'm sorry you're disappointed I have and I do meet with the city manager every week every week and I research and we talk about ideas this we've been talking about for a long time um the value of it um but uh at any rate I did have one thing I wanted to share because these septic projects are very expensive um and sitting on the you know I've been sitting on the save our Indian River Lagoon a citizen oversight committee since the beginning so a lot of times it's hard for me to explain because I have so much history and having worked in this industry it's kind of hard for me to know where to start with with folks but one thing that always comes up is well we're spending so much money here it doesn't make sense we should spend it over here we should and more often than not people would like to spend it on the wastewater treatment plant because it's a very visible when you know when there is a problem is very visible and it's the front page headlines and it just makes everybody sick to their stomach but the plan is based on the data and the science that shows that we have multiple sources we have the muuk that is the Legacy pollution we have to prevent pollution that's the septic to sewer that's the storm water um and we do support the waste water now if I just do this is this going to come up for me or do I need to I just pulled these two slides and the the the plan by the way is there for anyone to look at online um we just met last Friday um and approved the uh this is not the right one uh we approved the recommendations for this year they will go to the County Commission the County Commission um will have the opportunity to vote on those in March so every year there's additional monies and the citizen oversight committee looks at the applications and determines you know where that money will be spent so I just put this up here because I wanted to show you in terms of Coco um and in terms of our uh opportunities to uh say go after grants for the sellers plant we actually relatively speaking the sellers plant is doing pretty darn well and that's why we're below the black line so that it's uh competitive and it's not likely at least if the data based on these 2016 is correct that we would be eligible um but we should still try and it's again it's never an either or for these grants it's not it's it's good man the the data that you're showing this is from the tetr report yes that black line indicates that those you're you're correct the black line and the places and the and the communities that are identified below that are not applicable because they were deemed that they were not major contributors in the in the analysis that tetr completed and therefore they're not eligible for dollars from Savar Indian River Lagoon right so they didn't so we were not eligible we never were eligible but we were eligible because quite honestly the Bap information that they've released is not consistent with what's in the tetratech report the distance right they're saying you know basically the Bap is now opening up and saying we'll give you $122,000 for a quick connect whatever but the tetratech report has everything based on distance for septic and so only the people who are within 55 yards 150 fet or whatever are going to get the full funding and depending on whether you're sewer or Advanced septic and then as you before you get half way to US1 you get nothing because they've deemed by by that distance that the the penetration of the nutrients into the soil doesn't necessarily get fully back or if it does get back there the soil does do some cleaning because of the nutrients and the and the rock formations and the carbons that are in there actually act as a natural as a natural cleaner so the half sense sales tax by referendum is based on paying per pound of nitant or phosphorus so obviously those closest to the Lagoon are going to have the biggest impact but we know overall that septics and having 60,000 septics in Bard county is contributing to our impaired water body which is not just impaired water but it's health risk um you know some of these alg's they're still studying but um you know there are potential health risks and then so just as Jack was explaining so um this is where the funding for in terms of wastewater treatment is going so I just wanted to clear that up with you and also uh I did bring the annual report since it was coming up and again forar County voted by referendum in 2016 to have some skin in the game so that we could go to the state and match grants and that's what they've done you know we got a big chunk of the 100 million and of course we're 75% of the Lagoon but um this gives you an idea some of the projects I'm sorry it's not let me just thank pass this yeah I got you yeah uh the dispersement of funds you know is based on cleaning up Legacy pollution preventing pollution and then restoring Lagoon Shores so those are the projects that you see on the [Applause] back and again I you know I don't know how to how to um unpack everything that was said other than to say I would really like to see us have a workshop where we look at the whole issue the North Indian River Lagoon B map which is eligible for a lot of funds now um and you know identify exactly the costs and the opportunities for funding and that's what PM Bay has done because they have they're aggressively pursuing these grants um I listened to the city manager give a talk at a lagoon meeting a couple weeks ago and um you know she said they had to show skin in the game they had to pass that um you know pass the ordinance and to really be able to go to the state and say you know we're ready we want to catch up we want to be a First Rate City with First Rate infrastructure so that's end of my report everybody get one all right old District Two you got something you want to say I wait I'll wait okay um so for district 2 um first off I want to say uh I also want to harp on Chief lamb that is a big deal me myself going through the EMT program I don't know how I made it through without gray hair or pulling my hair out it's extremely tough especially you know being a student at the same time and doing it is so that's a tremendous accomplishment um so good job on that um also well I don't want to forget I wanted to talk about uh and I know this may be tough but I think it's necessary that you know if the council agrees uh I would like to host a city sponsored Community um community meeting off the fist Boulevard uh location um there's some issues starting to arise I spoke to Chief about about it um he's been doing his part you know trying trying to uh minimize those incidents but I think it's real necessary for the citizens over there to see us uh you know have a presence and let the people know that we see what's going on and uh we're working on it so uh I don't know I can communicate with the city manager tomorrow and maybe work out some dates Chief I would love to have you there um I was thinking the location the entrance to the braco pond off of fist between all the apartment complexes I think that would be a good spot for us to be visible uh to everyone and um just go talk about some of the things that you know we plan on doing to uh assist the citizens that are having issues over there um I think code enforcement be another good partner to join us um so if you all are in agreeance with that um I can work with the city manager on setting something up yeah so I appreciate you guys backing that um I'm also excited about the groundbreaking for the fist uh Boulevard and uh Broadmore Acres uh project that's been in the works for some time now uh that's probably one of the biggest questions I got asked over the years when is it going to take place so I'm excited for that um I know part of that is in district one as well but it's Grand father than District 2 so um and also in regards to the MLK parade I I had a special detail I had to attend the MLK parade over in Tampa and I can tell you I was it was I was mind blown at the amount of uh participation from all levels of government over there uh you had everyone from your school board Representatives your County Commissioners all your city council members from all the ities over there and um I'm going to do my part to try to make sure next year's uh MLK parade we have a we well representative well represented as far as uh government and um I'm not forgetting anything that's it go ahead let um I know uh councilman um Binger um um Mr Walsh he made made some statements about the cost right and we talked about this in the past where putting the project out for bid just to get numbers right that's the issue as well so can can you can you explain to him what what that looks like as well yeah there there's two big problems with that concept one is that it would violate our internal Financial policies that we've already established that all are funded before we place them out to bid and it would also create a huge problem perception problem in the construction industry if if contractors start to figure out or get when that we put something out frivolously just to get numbers on but we had no intention of or had the funding to back it up we would have a big problem getting accurate bids and or accurate people even bid or do our work in the future and I would never want to go down that road ever okay um so my my next question so we talk about um getting an engineer cost the engineer cost doesn't necessarily uh equal out to actual construction cost or from the contractor's cost yeah quite often it varies yes um I'm not sure if he understand that I just I'm just trying to clear it so he because he had some very specific questions yeah because I've seen on projects where you know we get the um the print out of a certain bid engineer cost is at $700,000 right but our bids most of the bids are coming in at 2.1 million right or or less some sometimes the engineers cost a little bit more so I I think that's an issue for us too as far as trying to find out what that number is do we ever come to a real number without it being bid that's the I think it's extremely difficult and I've said this before and and just not to go on too long here but the biggest problem with that particular project is the risk associated with undertaking that type of construction it's underground we already know that there's layers of coina in certain locations that we've tried to analyze by taking borings and and and trying to compensate for that in the in the in the construction bid by having a range mean a cost to dig it and a cost to bore it and or and or some kind of combination so so a good scenario and I think it was councilman dial who brought it up a few meetings ago about how it it certainly is is not unheard of that if we start to do a boore and the bore can't Advance or it collapses when we try to install the pipe that then we have to go back and then dig it and guess what in in any construction estimate that we would put together it's not going to take that into account we're going to throw a contingency a standard 10% or something on there and that's kind of what we have like a b cost and a boore cost but if I have to pay you to late to to do to do the boore and you get halfway through and it fails and you have to pull it out now I've got to pay you for that work that you just attempted and I got to pay you the Dig and that is not in it is not never going to be captured in anything that we can do in this particular type of project let me let me contrast that with with uh something that's more definable like a pump station or a um or or like an advanced septic we know those are going for 30 or $40,000 plus or minus right it's going to vary right in those numbers because it's very definable there's there's a hole in the ground you got Plumbing from the house to that and you got the plumbing from you know uh you know to the to the drain field what and that's going to be definable and things that'll vary be you know what are you disturbing on top is it pavers is it asphalt is it just grass you know it's so many dollar or so many cents per square foot for beho and so on and so those become a lot more definable within within a reasonable range where you can predict them and so I I think we're what I heard from councilman baringer and I'm just going to you know try to summarize is I think that you know there's a lot of concern or or certainly there's certainly my concern is is related to it which is simply we have a lot of risk in pursuing that project regardless of how many grants we think we can capture and and how much funding we can get from save our Indian River Lagoon and those are all great things and they would only make that project even close to feasible because we didn't have any of that we would never I would never recommend even going close to those projects because spending 13 or $4 million on 88 88 converted systems is not worth it it just it just isn't and in the grand scheme of expense and that's the Hat I wear as the Director I'm trying to look at Capital dollars that we generate on on the sewer side and proportionally spend that in those increments each year to try to come up with the best plans and although the that plant project that you just was a kind of a compliance have to do kind of a thing it's a big chunk of money we don't you know we generally don't have $10 million laying around to do a particular project that project was contemplated almost three and a half years ago and we've been trying to get it designed and by designing it then getting better idea on the costs and then putting it out to bid and getting the Seymour's number now we have a g now we have a guaranteed Max price unless we dig a major change to the scope or have a major deviation that it wouldn't be covered by a contingency that's built into that 10 million number we should come in under you know within that number contractor makes some money we get what we need and we become compliant so so you know and I kind of get what councilman was was saying which was hey you know we've got 400 people to consider if you multiply that by 30 or $40,000 yeah you're looking at 10 or15 million for everybody in that Basin to become compliant or we're looking at a combination of 10 or 12 million and another 10 or1 million for the other 88 people to become compliant so I think it still comes down in my mind only to some discussions and some deep understanding of where Council might want to go with respect to how it's funded there is a risk by putting that project in motion that somebody has you can't we can't go and accept these grants and not have a plan to deal with it if we come up short that that's the that's what that agenda item says that's what it's been saying for the last four or five times it's come it that's what's in there that's the fundamental what do we do if if we get the grants and that covers everything and expenses coming lower then that's a good thing but if it doesn't what do we do and who should pay for it and for me as the Director I get very uneasy in my chair when I look at the costs of that kind of a septic expense or that kind of sewer expense even though the you know the the reasons are right the Lagoon is important those are all great reasons but I'm also I'm I'm I'm I'm collecting about 92% of the total revenues of 65 operational million dollars each year 92% of that is collected from the water side so I spend about 105 $18 million a year in capital on Water I spent about one to two million dollar a year on sewer on average that's Vehicles Capital at the plant sewer improvements and other little lift station stuff that we do anything that's capital it runs around that proportion So to overspend that or not overs spend but spend well beyond that Norm I think has is going to be looked at closely and it needs to be justified so when you ask me to sit here and and you know kind of give you the input I try to give you all the sides of it that part of it is the part is a concerning part if we can again if we can offset that with grants then great it works but if it doesn't offset with grants we again have another unknown it could be a small amount or it could be a big amount and then even with the compliance even if we make it mandatory to connect and to try to grab as much of the save our Indian River Lagoon dollars as is there's still people who may not connect I just don't want to connect so what do we do because we're GNA have to pay somebody back I appreciate you thank you yes sir sorry that was that was way I wanted I want to give you the opportunity just to express that side because he had some very very direct and I'm pretty sure he gonna have some more for you directly but I just wanted that it's a tough issue no no question but it takes some tough decisions and like councilwoman C and others were you know alluding to which is there probably needs to be a a little bit more discussion but it's there are some fundamentals that read the agenda there are some fundamental decisions that are in those those those U areas are highlighted in the agendas I say if you're going to go this way there's some implications about about your ordinance and about how we're going to go forward and who's going to pay for it and and that has some rub amongst your own citizens as well as yourself as as as the leaders of the community and if we go to the septic there are certain things that have to happen because we're tying up sewer money for the for for the hard sewer so that has to be dealt with and and then we have to deal with now the larger map because now that has become the law uh but we have six years to decide are we going to do an advanced septic system and and how is that going to be funded I'm I'm sure there's other grants that are going to be coming available that can offset certain costs with associated with that is that the way to go and if if that comes up because we're going to get caught in the middle because I think we're still on the hook to be the applicant because I don't think save our in allows individual home owners to apply I'd have to check with Anthony Gubler again but um but definitely if it's a d Grant they're not individual citizens cannot comply and cannot apply for that we have to apply for them so we're going to be in the middle of this thing managing the the improvements on on personal property on private property uh with contractors and other things that are going on so yeah there is an approach that needs to be sort of laid out uh but but a fundamentally we need to kind of decide what what that's going to look like as a council gives direction to us as to how to proceed one or the other hybrid whatever it's going to be uh and then from there then we can come back and and bring more detail as to how we might accomplish that can I ask a quick question because we have in the audience we have people from Carlton Terrace Carlton Terrace of course the neighborhood of what 300 all together other 250 this has big implications for them do you see them never going to I mean so they would just be all on septic I I I don't see I mean right now the only place where we have the only place where we're getting hard sewer pipe funding is for J andk that's it and and according to the tetratech study and you you you affirmed it and it's in there they do everything based on distance and impact of phosphorus and nitrogen so the people in Carlton Terrace and anywhere from Carlton Terrace all the way up to the edge of us one they're getting almost nothing or most of them are getting nothing or nothing significant that's going to offset the cost of doing POS potentially a major extension if J and K were to go in place okay so it's just that there are people that are going to move as a result of this conversation I mean you I can only tell you what I see in front of me what I see in front of me is the save our in Lagoon the committee that you are a part of has only allowed the dispersement of funds proportional to distance like, 1500 ft away you're getting nothing and that's septic or the hard pipe you're getting by way I hav't did I did not do the plan we only vote on additional monies and applications okay right I'm sorry so it's you know from from the technical report as part of the save AR Lagoon that's how that's I mean they had to come up with a metric clearly they had to do something right yet getting all that tax money had they had to come up with some kind of metric to distribute the F thank you Jack I get it thank you Jack yes sir thank you see the manager I'll confess to the plan I was actually the county manager when they did the plan now can I go cuz I I waited so patiently let everyone give their report did Pano give his report P you gave report mayor thank you sir I have the floor goly man okay thank you first of all all right we were at Jolie Smith Park here um we were having the community event there at Jolie Smith councilman GES thank you for helping the kids get their uniforms they were very proud of that sir um thank you Chris web another Red Raider and also the rotarians um you mentioned this councilman G's about the clean up U by Emma Jewel district one um the for the young kids getting them civically active in the community they will be picking up trash that is the reason why I was asking y'all about the buckets so it's imperative I know we may have to just go back through KBB I don't know I guess the buckets grew legs and they walked away but that's where it's at um this is a community event that was held at Jolie Smith Park this past Saturday where everyone spoke and have great participation for our Police Department as well well for the pals Miss Dolores mlin and her husband andar Brown and the new member is Devon I'm trying to think of his last name forgive me sir but he's the newest member for the recreational leader there um we had literacy week this past week at coko high school Saturn Elementary participated and deor participated Emma Jew participated um as you can see one of our former School Board member Mrs Janice kirkshaw also bred to the kids I had a great time you see that uh South Carolina state board old Jack of there hell wild cats um these are the various principal principal um um Mrs uh Stewart participated misss mcloney um also participated we had a great time Come Rain SLE the snow everyone attended the parents was there man and it was positive and the kids that book that I just showed you the kids took their book home as they venture to each room to be read but in the Next Room over they had activities that are applicable to what was shared in the room when we were doing literacy week is that it brother Green Eggs and Ham well okay I'll save it for another rainy day one other thing let me end on this VI kudos to VA we've taken a tour of their facility they had a test firing of their um excuse me rocket engine and they did a phenomenal job they used recycle plastic to knite the engine as we all are aware of so Shan Mery provided this venue for us along with um Martin maretta and a host of space industry professionals it was very very limited seating uh but the thing that was most important it was a successful launch multiple testing and the beautiful thing about all this is that um hey man everybody was actively involved also in the literacy we had an organization from Jamaica the international literacy group uh Mrs Smith lets Walker and Miss Rodriguez participated in this um I'm sorry we didn't get all the pictures there and I'll just say before next council meeting about where where we are legislatively speaking House Bill 7777 that will have a direct impact us economically speaking from changing the homestead exemption from 50,000 to 75,000 and how do we make up for that loss and we have 400 plus homes that don't even qualify at the dog on 50,000 so we have to be creative we have to be uh thinking outside of the box so how we going to make up for that law revenue and also they're trying to limit the funds that we can take from our utilities and place in that general fund back at it yes sir back at it again so that's why it's imperative that we participate in this in um form six form six is a hot conversation five individuals throughout bavar county has resigned from their post because of form six the impact and it's not just only in Bard County but it is Statewide and our president Greg Ross is in a vicarious scenario right now because his City voted to to be a part of this lawsuit and he was against it but he's the president um Mr Beringer sir I see your light is on thank you uh sir uh member go I I just want to say thank you for uh you know helping as a colleague thank you for that um just for clarity I under that understanding uh and I think director Walsh sir I appreciate because I think that you uh uh spoke the sentiment of my intent uh during that so just to share with you not so much specific to a single project but like what's the whole plan for the whole area so I just I I share that with you uh and sir and I appreciate that member cost you had mentioned uh you know a workshop to that to that effect effect of or so on so on I as a council I would be very open to be it a special meeting and when we say Workshop that can take different forms so I I would be very open to be at special meeting SL presentation slash priority something to that effect uh outside the the scope of a regular meeting uh and or if there was a workshop sure absolutely if that if that fits the name then I would be very open to that uh and if there's a if if if that would require a motion or or manage opportunity yes sir thank you I appreciate that not to step ahead but I'm open to that for sure it's it's thank you a special meeting Workshop is already on the calendar for February okay so so so in conclusion you notice I share the floor respectfully thank you sir so yes sir we count it all joy again city manager all 44 plus staff members employees with our directors I thank you very
