would be pleasing to you that we would put away any and all selfish motives seek the welfare of our community and our people which I know they will do so this we thank you in jesus' name and now the blessing is this may the Lord bless you and keep you may his face shine upon you and be gracious to you may he give you his favor and his peace amen all right we need a motion to approve the agenda I'll make that motion to approve I'll second Mr Mayor Mr Mayor I oh uh I I sent you an email this morning uh uh Kevin Council memb Smith is the uh uh he's the uh uh sponsor for the uh item 4A the RFB for Morgan lights and he's asking if we could uh delay that to next next counil meeting and did uh Mr Jones talk with council member Schmidt or somebody yeah we did and I think we are okay to proceed talking about it and um we'll get into that more when we get to it sorry Ray There was an update since then okay cuz I asked that that same question but I would make a motion that we pull I believe uh the legislative sponsor for the Livery vessels which would be 5A uh John ask that that be pulled and so I would ask that that be pulled from the uh agenda and scheduled for the next meeting when he will be here City attorney you have an opinion on that the only uh issue that I think we were discussing was whether there were members of the public that want to speak there were a couple that came up uh prior to the meeting and I think they wanted about six minutes and they're already here so that is in the discretion of the council yeah I would say let them speak at the uh public you know give them their 3 minutes like they would have had anyway they can speak at the beginning we're just I just don't want to make a decision when the legislative sponsor is not here the difference between him and council member Schmidt is we're just approving to send an RFB out this we're actually looking at legislative language so if if you're okay with it I would read the title when we get to it and just let the couple of members of the public speak that are here I don't think there's um too many but there's a few and then um and then you all can continue it if you'd like yeah we can make a motion to continue to the next meeting at that time yeah I I would say why why wait till that just do it in the public and uh public comments here in about two minutes but okay whatever y'all want to do can we just move it up into the front to make Jim happy and public comment happy just move the whole item up there's one problem with that it's scheduled at a certain time during the meeting and if someone is trying to plan to be here to testify when you move it around that makes it a little more questionable the simplest way is let them talk and then we'll move to continue it and then one other item that the council uh had asked me about was to pull the sheriff's agreement from consent did you still want to do that okay so then it sounds like we don't have to move anything any so we're just going proclamations or recognition but we're going to go to the public comments and these are comments on things that are not at the uh for public hearing tonight anybody from the public that wants a comment please state your name and address Carrie harborer Mountain Drive so I wanted to say this because we are going to hear a couple people and I understand that it will be put and yanked off the agenda but I have something to say because I want to remind some of the people that might not have been on the counsil of returned to to the council and I want to take you back about 11 years when we were coming out of a downturn and we were kind of fussing with the TDC if anybody remembers that how they were soliciting to people in the in the uh gross income of like 50 to 60 70,000 they were trying to get people heads and beds and we were all fussing about that and then we had decided that coming out of the downturn we wanted them to do better and we wanted us to do better we wanted us to bring more things to the table for these people to come here and do so when we talk about these Livery vessels I want everybody to remember one thing these people bring other clients to the table I understand the fishing Community sometimes gets a little out of whack because if it's not all about them but here's the thing the people that come for those Livery vessels spend money in all the communities with all the businesses businesses like mine depend on these people that actually have gross profit incomes that can actually come spend here and why is that important is because if we only cater to one sector of the harbor than what is it doing for everybody so we all need the business so my thing to say to you tonight is to keep in mind that when we do address this if people have their boat slips and they have their ample parking who are we to tell them what they can do are we really going to talk about clouding up the harbor we are not talking about clouding up the harbor when they add three charter boats to the fleet we're not standing up here having that conversation if people have their ample parking and their ample licenses I'm not sure why we're even having the conversation when they're bringing clientele like NFL players and such to the community to spend money with my business and some other people's businesses that was something I want you to ponder until we take this up the next time thank you thank you uh anyone else hi Max Driftwood Lane um uh in 2020 I kind of started a journey about becoming a business owner in this town and uh you know the the talk with the Livery vessels and the bear boats you know it it we've all been you know kind of stuck in this limbo for so long and um you know I was I was trying to get everything started and you know there there was never a clear path you know I talked to the people here um at the annex I've talked to people at City Hall um I've talked with council members since then and um nobody could really tell me am I a bearboat am I a livery vessel I have a captain you you may be treated differently if you follow these rules or those rules and you know through all the the fog and all that stuff you know I kind of missed the deadline for the moratorium um once again I was told that you know by certain people don't apply because the moratorium is already in effect and there's going to be another one going into effect hurry up and apply before the other one goes into effect and I was caught in limbo because you know I'm also being told at the same time to apply for a livery permit but you need a BTR in order to get a livery permit and you know my history is a fisherman I I understand what these guys are going through like I respect it to no end i' I've came up through the hos pipe with a lot of these other kids not in this town I've Charter fished all over the world I understand the Integrity it brings to every community that I fished in um and I think it's a necessary part of this community to keep it the way it is and I think we can work together and I'd love love to work together um however I I I did not get in before that time and I I understand that there may be a grandfathering in thing that might be happening and I would just like to be you know put myself at the mercy of you guys to hopefully be considered I know that that's not a free pass to just go do whatever I want I know that I'm still going to have to apply for things um you know and do it the right way and that that's what I'm here to do you know uh the people in the council that I have met with I appreciate all the time they were giving me they they all know that I'm I'm trying to do it the right way I I want to be a positive addition to this you know where you guys where certain people see doors closing I see other opportunities for it to be done the right way um which is I think what we all want I think we all want to make this community better I think we all want um the money to keep coming in and and tourists to to have a great time but we want it to be done safely and to a standard that we can all be proud of and and I I would love to strive to do that and to be one of the guys that's that's able to do that um I apologize public speaking is not my forte so um but I I did just want to like leave you guys with the fact that I I'd love to I'm really just trying to be a positive member of the community I I've moved here I've lived here for eight years now I own a home here I'm raising a family here I would love to stay here and work here um as a captain you know I I I traveled the world my whole life fishing on boats and spending months and months away isn't an option anymore because I have a little girl to raise and uh I I I watched how captains are accepted in this community and I want to be part of it that being said I don't want to come in because I know how hard it is I know the financial obligations I know the licensing I know you know guys like Allen started when he was 9 years old to to to build a business that he's built you know I I don't want to come in and step on their toes but if if I could see you know with what I'm doing uh not stepping on their toes and bringing everything up I I would love the the opportunity to do that so that that's all I'd like to say thank you for your time thank you okay do we have anybody else that wants to speak under the public comment I'll quick you're he exact same thing about two weeks it seems Ryan hallway 5:30 Beach Drive um our business operates out of 314 Harbor Boulevard and some other places um you know good call on the selfish motives thing because that's all the D dcba is right now on this um but the points were when you take this into consideration uh expansion so we want more people spending more money that matters here not $25 per person on pontoon boat my people are spending on these trips upwards of $110,000 a day that means they're going to your restaurant uh which my daughter works at uh while in grad school and and they're spending money where it should be buying the nicer houses renting the nicer homes um I'm in real estate down here too on the side I see the values and pricing um and and where it changes where it's going and it's going for the better but we need to have the better client base here to make Destin better um so when it comes to expansion you know it needs to be considered that we can expand our business businesses because I have people approaching me all the time because we're the top company at this to to run yachts and and run them for them but if we but it's like hey the city don't want you so we can't do anything about you but hey we're going to take you down to Sandestin and go use all their all their waterways sounds stupid um so what about Kim Perry what uh or mergler or or Claud they um use that t do and we're one of the people now you're going tell them well you tell them go kick rocks because they do pickups out of those spots you got to consider that you're not considering it um most of the captains of dcba don't even know what this is about they just got a letter from Jim green saying and maryan saying hey come here hey y'all come fight the charter Yachts because they're ruining your business no we're not my people don't even want to fish and to be honest I own a fishing company I think we've done 175 fishing charers on one boat this year so maybe it's not us cuz we're still getting it um this ruling was made for pontoons it was made for the overrunning of the harborth pontoons it was never intended for yachts and they should be excluded and I understand I might be the one that gets grandfathered in and I still think it's wrong so that that's where I stand and that would actually get rid of all my competition to let me Skyrocket my prices and I still think it's wrong um and we want like I said we want better people in Des and spending more money and that's what we need we want better clients we want better uh visitors and not better but you know more affluent visitors that are spending more money and if we are the people that are doing it why try to stop us why would you why wouldn't you Embrace that because even even if this girl spending $4,000 on a bachette charter out with us well her boyfriend might be spending 1,000 1500 on a fishing trip so well I guess fiance but uh it know just brings it back to selfish motives and there's nothing in this other than being a selfish mode of trying to get rid of Yachts because just like they thought the dolphin cruises were stupid they thought this was stupid and and they're just trying to push you out and I appreciate your time thank you for your comment anybody else hi my name is Matthew Davis 412 Spring Lane Destin Florida I'm actually one of the captains that's involved in all of this uh first off I'm an advocate for the fishing business uh my family is one of the founding families here I am a fourth generation Destin my grandfather was William Frank Davis so I mean yeah the fishing business has been a big deal for us uh what I think Ryan was trying to expand on is that we do bring a different kind of clientele to Destin uh I'm taking out personal personally I'm taking out athletes I'm taking out people that that are on TV and stuff I know some of the fishing guys get that but I mean it's maybe once or twice a year I'm doing it every day so I mean I'm getting guys that are spending thousands and thousands of dollars and then afterwards I'm telling them to go fishing so if they're going to spend thousands of dollars with me just watching Dolphins cruising around eating dinner and stuff if you're crazy to think they're not going to to leave me and go spend the same amount fishing if they've got enough money to do that with me they got enough money to do it with them uh we don't fish I'm not in competition with any of the guys that are fishing I don't even allow a fishing rod on the boat and I've been fishing my whole life I was deand on the Anastasia before I did this and I can tell you that we don't allow it I'm not going to compete with Jim green who's one of my cousins I'm not going to compete with any of the other guys trying to do this so whenever I'm out there I'm strictly watching Dolphins cruising around chasing Wildlife not trying to kill it so that's another thing and I think if you're going to force us to have a medallion you need to regulate the amount of medallions and then on top of that you need to watch the new charter boats that are coming in there's no regulation of new charter boats like if we're going to have to have a medallion what's stopping yall for giving them a medallion for every every year we have like 20 new charter boats that come in so that's just my opinion thank you thanks for your comments oh boy so deey gave me permission to read mine my husbands and Matt condens um so Patty Brown 86 shyra Street uh dtin Florida Florida BT Charters LLC and 46 Cruiser yacht misbehaving since most of the guys who own the Yachts are out of town tonight I decided that I might have a battle we had a shark here last week we got a viking this week thanks for for joining me in a little humor because Lord knows we need some humor in today's world um all of you up here have seen me with short-term rentals the airport the beach and now the harbor I've worked on many committees and taxk force in the city in the past I'm very passionate about this town and I really try to make things better for everyone it is all in the compromise I've come to learn through all of these things I'm sure you guys all remember the Red Wave of the Destin Airport pilots and thanks to the city council at the time and especially to Kim Cobb it all worked out with a negotiated deal with Destin water users but it was a battle we started operating our day Charter 3 years ago and we've got all five star reviews our choice to do this was to bring another level of experience to our tourists we have tourists that um they have higher end tastes and they want 100% to be pampered and that's what the Yachts do um um the two longest operating Yachts are Ryan holloways um 72t princess I'm sure you've seen her out there she's a beauty and misbehaving both of us have been in business for um three or more years with btrs we're still waiting for our 2024 BTR um it's been held up but we've had btrs our entire time operating um the next time you're in the Far East and I had the pleasure of showing it to Teresa uh of the harbor dock um where Haron Harbor is please come down and see how beautiful that is now we have a bordo we have a coffee shop we've got two great restaurants and thanks to Jean uh IDL Eisenman um we had donations made so that we put in picnic tables and umbrellas and we have a ton of tourists down there now just having a drink enjoying them elves so um we're doing more than just providing a service we're part of this community um we don't compete with the fishing fleet we're a whole another level than the pontoons we require expensive Insurance a marine Merchant credit Captain we have to have commercial dock with parking and bathrooms the amount of fuel that we use is significant and it's all purchased off the docks of that uh we use um services and supplies from local mechanics on our boats and the upkeep is significant with a yacht what I'm trying to say is we contribute extensively to the uh economy through all these services that are necessary to do a charter operation when we started down this road I work really closely with Rocky I'm sure those of you who are in the boat business know he's a US Naval retiree to make sure we had every Consortium and every certificate that was required um I also worked closely with the harbor Legend I'm not going to name their name to keep us between the buoys after up and running I considered uh getting on one of the Waterway Harbor boards but being new to boats being new to a harbor I didn't think I had much to offer uh and there are people with extensive experience working on those boards I regret it now because we had no one to to represent us and so um we were like a bunch of sitting ducks um there were a few that took offense to us uh conducting business um and they went to the Coast Guard and tried to get Federal rules changed it didn't happen they came to you guys and they wanted you to change the rules and so that's where we are today um let's see with Yachts being so expensive to buy use maintain repair and fuel among other things we cannot stay in business if we cannot do bearboat it's just too expensive um it will force us out or close down or move to a dock outside of dtin no more btrs no Revenue to fuel docks captain first mates from outside the city along with other items in closing to the person at the last meeting who suggested that we just buy a $25,000 Medallion and join their side I've run a successful business and have never engaged in extortion and I won't now either medallions registration should have no value once you cease operation they should be returned to the city for use by the longest running businesses first that are offer operating legally and according to the city of Dustin rules thank you Gary troop I've asked my wife Patricia Brown to read this since I'm out of town on business my name is Gary troop I reside at 86 Sher Street Dustin Florida and I co-own the misbehaving with my wife we started business in December of 21 first and foremost I'm an entrepreneur that believes in less government regulation and free enterprise we did everything we could to abide by the rules since December 21 whether that was complying with city ordinances state laws or coast guard regulations we've worked very hard to do that things like commercial dock space with parkings and bathrooms is approximately 2,000 a month appropriate Commercial Insurance is 13,000 per year and only allowing Coast Guard licensed captains to operate the boat we want to continue doing business in the city of dtin we provide a service that's unique and I do not think we compete with either fishing or pontoon boats except maybe on the very Fringe in the pontoon boat Market of course we both offer bachelorette parties but we offer a different experience at a different price point so I really appeal to you folks to find a way to let us do business and please don't force us to pay somebody an exorbitant amount for a medallion that they paid nothing for again we're done and have been have been doing business for almost 3 years all the stuff they did to get a medallion we have done too and let me say that people try to equate those medallions to commercial fishing license that get bought and sold to justify the intrinsic value of a medallion I've done a little research in many commercial fishing license have to remain active for people to keep them because otherwise companies could buy them up and then not use them to manipulate the price of fish and the same thing could happen in Destin pontoon Market businesses could decide they're going to hold on to those and reduce the number of pontoons just to keep jacking the rental price up so you need to consider things like that I totally understand me medallions need to follow a business with with boats when a boat or business is being sold but allowing Medallion ownership to remain when they go inactive is a completely different situation whatever you try whatever you decide will try I emphasize try to adapt But please understand and we are running a small business and the margins are already very thin please consider that thank you Gary troop and the final is from Matt Condon who owns United Yachts hi Patty I don't have an official statement however if given the opportunity my sentiment would be the following as it appears the city will implement the Livery band to include you lot Yachts this will negatively affect my management company and the four Yachts we represent this will have a detrimental effect on our business business and essentially Force us to either close completely or move out of Destin since the original implementation of this Livery ordinance allowed existing businesses to file for the liery permit I'm requesting that we follow the same precedent and allowed existing yach owners to file for meetings ago we brought a recommendation to you to use a bid from sourcewell and we were directed at that time to bring you back a RFP for your consideration that's what we have before you tonight as it was mentioned earlier councilman Smith is the legislative sponsor for this item and is was unable to be here tonight um but I believe we would represent to you that um moving it on to the bid process with this RFP would meet with his approval um so if you're inclined to do that we would ask you to staff would make that recommendation to you that we do go out to bid and that we bring that back to to you in as soon as we possibly can and at that time if the the earlier proposal was more attractive you can still have that option but we would recommend we go to bid and did you approve the representative from Baskerville Donovan here tonight to offer you a brief presentation at the conclusion of their presentation you have options uh if you like what they present to you your recommended motion would be to move ask them to bring back 30% plan based on what you've seen tonight if there are things you would like to see different or changed to make those recommendations to them and ask them to bring those back for your further consideration at a later date Jason frick I'm a engineer at basal Donovan I'm here to give you a presentation about our PDN and Boardwalk Under the Bridge Project a status update I think they're trying to pull up the uh PowerPoint presentation I'll get started as soon as I see it okay may I ask a question beforeand this will save us some time uh you're not going to show us all the slides for all the traffic intersection improvements that go down all the way to airport I just have one slide that kind of summarizes that thank you very much and those uh by the way those are recommendation from dot it's not something we you know spent a bunch of time investing um you know efforts into but that was in the feasibility study that dot did as part of their PD sorry guys here we go it's on the screen okay okay so introduct uh introduction Boardwalk under the bridge PD and study Jason frck basker Donovan um okay somebody's scrolling there so just as a summary I've got the scope here listed for the we broke it up into two divisions one being the board walk under the bridge which is a design uh project also a study that looks at congestion Management on us98 we call division 2 and we kind of had a focus on stalman intersection U uh trying to take into account the cross town connector project and so uh for the for the boardwalk under the bridge uh we had an update to our survey a pre-design meeting with staff here to kind of get some Concepts laid out currently we're at the 30% stage I believe in your backup you have a copy of our plans and we're you know we're basically looking for approval to proceed to a permitting with do and with the state um next slide for the pd&e uh basically we were looking at all the different studies that have been done at stalman on 98 uh from from the stalman intersection to Airport Road that was our task uh we summarized those uh we came up with a lot of Alternatives work with staff worked with Okaloosa County worked with um mayor Bobby um and kind of came up with the some big Ideas basically currently we're at the third task here where we're preparing our draft report giving you a presentation on it next slide uh just to talk about the boardwalk under the bridge um our limits were from the Zerby street parking lot and connecting underneath the maror bridge to the boardwalk there uh we were tasked with coming up with a safe secure ADA Compliant uh walkway that would connect the North and the South uh and and also use General guidelines for the Florida suntrail uh design guidance which would be the 12T wide walkways and the ada8 compliance we got a a sketch here so we're starting uh just uh west of the Zerby parking lot with a 12T wide section uh we'll have an improved crosswalk that crosses over over Zerby um as we're coming down cyber we've kind of kicked the walkway to the back of the RightWay line there's quite a bit of RightWay there uh for a few reasons we're trying to give some more green space between the pedestrians and the the traffic uh there's also some we understand there's some storm water issues in that area for this project we're going to put in a a fairly large retention swail uh just to kind of alleviate some of those issues there there might be a followon project that the city wants to look at that does an overall you know drainage Improvement but that's that's the reason we have it kicked out there uh coming down cyber uh We've improved All The Pedestrian crosswalks to be perpendicular to the road uh so you know that's the safest method to cross uh we'll cross over Calhoun they'll enter the one Harbor parcel and you can kind of see we've jogged around some trees there uh that'll transition from concrete to an asphalt section uh as we proceed down to the water's edge and then making that turn along the water that'll be a concrete uh walkway with railing uh that will be incorporated with a pile cap and the the new seaw wall there and then from that point we'll transition to an elevated section uh that was kind of a discussion we have with do early on they wanted something that they could take and you know remove if they had to do maintenance uh so that's you know that's where that section will start and that's basically the concept for The Pedestrian path like I said currently we're on uh task three we're looking for we're looking for approval to with this draft concept to proceed with the permitting our 60% um tasks uh next steps would be you know permitting uh vertical design of the uh the the the the walkway or our seaw wall design uh layouts for the security and lighting and then our drainage drainage design would be the next steps for this this project or this portion of the project moving into the PDN study our our limits were from the abutment of marter Bridge to Airport Road um we were asked to develop some comprehensive plans for congestion management for vehicles and pedestrians along that Corridor with an emphasis of at uh stalman uh anticipating the cross town connector traffic that'll be you know loaded into that intersection I've got a sketch here I apologize for the scale of this but working from the west side we'll work East um basically we are adding an additional left turn lane uh heading north onto stalman at that intersection we're going to we're proposing to close down the median at dtin I'm I'm sorry at Maguire's and extend that those two turn Lanes about about 450 ft that'll give you two very large stack lanes that will make left turns North on the stalman there is a right turn in uh uh Lane proposed for the Harbor View uh I guess their next phase of development so we've got that shown here there's there's space for that uh We've shown a pedestrian barrier um along that median and in the report that I have in your backup there's an example of what one could look like we're not giving you a you know not saying you have to have this particular one or that one but we're trying to prevent pedestrians from making illegal uh midblock Crossings there and sending them to the to the u u walkway underneath Marlo Bridge uh to the west or to the east there's a mid block crossing a few hundred feet from that intersection um traveling north on the stalman we're proposing a one-way North on stalman uh that'll give you two left turns North and then white one right turn only North um that'll proceed up to the intersection of uh stalman aelia and Palmetto uh we're proposing a roundabout um at that intersection based off the the weird configuration the geometry of all the inter the intersections coming together it's a much safer alternative it doesn't have to be a roundabout but we're proposing that based on our judgment um there'd be a byass lane that would then head south uh onto Palmetto that would be a oneway South and we're proposing to close that median at Palmetto and make that a right out only there'd be two lanes of right out only with additional pedestrian barriers hopefully that makes sense I know I just said a whole bunch of things there but there's a lot going on it's a big idea for this intersection but we believe it will promote a huge amount of flow and increase the capacity tremendously here uh these two slides are basically just what I've said if you want to roll past these two I've already kind of covered both of those uh additionally in our report we've included some information from do like I said they did a feasibility study and they proposed uh a number of median closings to meet Florida Administrative Code um currently the city has median every 300 ft on 98 the standard is 660 ft so at some point I'm not saying the city has to do this but dot will probably implement this plan at some point in the future and then also three additional signals here one at maror uh Melvin and then one at Palm Street uh and they're also proposing at at at marlor and Melvin uh to uh incorporate the midblock crossings that are near both of those roads at those new signalized intersections currently we're on task three of this this concept we're asking for approval or comment on our you know proposed concept you go to the next slide and then the next steps after approval would be to complete the the draft report we have a third party traffic consultant we'd also like to look at our concept here make sure we haven't missed anything and also help us incorporate any any comments that the council might have and with that I'll take questions if you have them Council we have questions well I do have some questions I'll make the motion but I may come back and change it but I move the city council direct staff to move forward with the boardwalk under the bridge concept as presented and to have staff work with the consultant toward 30% plans I'll second that okay so H having said that 60% you got three tasks right because I only understood we gave y'all two tasks so did we give you three tasks or did we give you two tasks well you gave us two major overarching tasks one being the boardwalk one being the PDN but within each one of those there's several you know steps that we we going but the PDN we gave you was not all the way down to airport was it it was it was at the foot of the barer bridge to Airport Road no I thought it was the look at the stallman intersection so I I will look to the staff and maybe the minutes will prove me wrong yet again but I thought our concern was the the stallman intersection not in front of the you know surf shop or the airport or all these cut throughs so can somebody help us out here that appears to be my recollection of what our task order was also it was Sol alond intersection yeah so that that's why I ask you before we even started you're not going to go through all those cuts and all those stop signals and all that because that's not at least that's not my understanding of what we gave you so I just want somebody to pop up and say no that's what we gave them so that would be engineering or that would be Community Development or that' be the city manager or the attorney it was for stalman intersection is my recollection but I'm looking at Burgess because I think he's pulling it up the only thing I can think of is if that if the changes to stallman have an effect that trickles to everywhere else maybe that becomes part of it that way but Michael we know you're looking it up okay well while he's looking at up I don't have any problem with the boardwalk you know I'm we we'll break it into two yeah okay any more discussion on the under the bridge designed to I had a quick question uh when you're talking about closing in so as you come off the bridge you would close off where there's a left turn there on Calhoun and close off the left turn into the Maguire would close the left turn onto Calhoun there' just be the one in front of Maguire's so that way it would maintain a straightaway after they turn left on Calhoun there would not be an additional break to go left well there would be a left they would be a protected left turret at stalman to turn back around got it okay that's what I was going say to get people back to get into Maguire you would have that that would be part of it or they could make a left turn onto stalman and then Zerby directly you know that that routes you right there as well got it okay I just wanted to clarify thank you all right I have the uh the notice to proceed uh in front of me that was issued on May 21st 2024 and it's for uh the boardwalk under the bridge and the PDN study and the agreement as well was separated into these two sections um with different uh subtasks under each division I have the the contract right here in front of me okay that's notice to proceed that's not the motion though that the Council made and approved and I'm looking through the the two primary divisions to see uh where the uh stalman 98 intersection was included well in any event I think I agree with Mr Bagby that we certainly won't be approving all of the uh bdna changes we're happy to take all of that out of there and just focus on stallman if that's if that's the wish of the council yep and I think that's what the motion is at the moment right yes yes any other discussion on that motion all right Tori go well I have a a question so if we're we're altering the mo or the uh the agreement that means there's going to be a price alter as well right because if he thought the original scope was for from the harbor all the way or from the boardwalk all the way down to airport and their price was based off that and we're reducing it to just stalman that means there's going to be a price decrease is that is that correct scope of Works Chang drastically understanding the scope included all of that entire stretch and I'm not Mr dtin I found the scope of work attached to the agenda item for that may 20th meeting and under division 2 tasks task number two will evaluate Transportation Alternatives along us98 from stalman Avenue to Airport Road it says the analysis will focus on impacts from the cross town connector internal and field review of adjacent routes evaluations of driveways left turns signals and congestion points we'll have to do a little more research into the Motions made if I if I recall call it started out with stallman and then I think the city engineer I remember Ryan that's exactly right yeah Ryan had concerns where it went from the boardwalk to airport and then we added the boardwalk and that additional area I think it was a three-part we combine two contracts into one to try to make it you know yeah however I mean so it's up to council how you want to proceed it's amazing how off course we can become isn't it um so the so the price that you have here is for all of it it can't be broken down into the the boardwalk under the bridge and then the second part of it depending on what that second part may be this is Mike Langston our civil Market director yeah Mike Mike Langston Bas Don you know this we have been working on this for multiple years and it's been put on the shelf and came back and we've done a lot of work to try to combine research pull up get get all the options pulled together that uh that you'd ask us or Ryan Scott had asked us to pull together the scope that was in that's in the that's in our contract was developed by Ryan he asked us to add a bunch of things in there was multiple iterations and negotiations back and forth what we can do is we can go back and look at where we're at today if you want us to reduce our scope we could be more than happy to go back and take a look at that and see if we can give you some savings back um this has been going on for a while so we'd like to get to the end of it you tell us what you want we'll tell you how much how much it's going to cost and and we'll move on with it the biggest portion we have right now of course is the access from the parking lot under the bridge if if you're if you're happy with that one we can move forward with that and get that into this design stage pretty quick design and permitting the one with the study though that we were basically directed to consider all the way to airport because the do the all do Road they had recommendations all the way down to airport and that's where we were directed to go yeah and I understand now you got there it's just that a whole lot of that stuff that's in those that study is going to be very controversial yes and at tonight I'm certainly not interested in considering that no but we are interested in going forward with the part under the bridge to connect the parking lot oh any more discussion no so the motion is to go forward with that part and you're going to be able to give us a different task order and price on that part alone we we have it we have it priced already for two different divisions the portion that that we have now is for the the the pd&e portion of it which was evaluating what it ought to be done we have a certain value to do that work and so what we'll do is we'll go back and look at and come back to you and said for us to just study stallman this is the price and this is how much we have allocated for it there'll be a reduction in the feed to you that's what I think is what we're looking for right now is getting us to stallman and getting us a little bit of savings back because we don't need to be controversial carrying on down 98 all the way to airport at this time understand do I am I in agreement yes I think we all agree on that so we're going to approve it tonight and on the contention that you bring us a price fact that we feel is acceptable sure everybody understand okay Tori Tori yes yes yes I'll V yes yes TK two I thought task two we agreed to right I I do have a couple of compliment or comments on task two and that is the round out where you have two lanes coming into another Lane three lanes going into one lane going out if you want to head south okay if you want to head east that that's okay but that those intersections are too close either one of y'all ever been to Southern Pines or Pinehurst they love roundabouts in North Carolina they absolutely love them you might reach out to them because usually I mean they have them where you have the inner you know you're just zooming and then you can do this so if you're in the right hand lane you're automatically doing the the U-turn to go out which I'm not sure why you would do but when you have those two lanes coming in and you have that one lane coming and they're trying to head out South back on that you're that will be the most accident prone intersection you have ever designed in your life yes sir seriously understood and that and and and we base the design off of Aerials not actual survey data so we're just trying to constrain it to what we think is there it would require some some really good geometry and study to ensure that it is safe it's just showing a a big idea concept basically okay okay just so we're clear we have approved going forward with the boardwalk under the bridge and connecting to parking lot the other stuff which pass to I'm not sure what what we're referring to with task two is that task two is the PDN or division be the PDN one will be not approving that tonight right all right that's right thank you thank you Council the uh next item is 4C is the TDC monthly report that you have information before you if there's any questions we would do our best to try to answer them or any comments I do have uh yeah what Happ we pick B I guess it was up there yeah so I ask um and I'm trying to pull up the TVC slide so I can get get you the exact numbers hang on here 4 H I'm too far on a yes I am okay budget 4 e two more 4 C is what I'm looking for so I ask the staff to pull up the number of units uh in the taxing district and so on the tax in District what we're talking about is the the old District the Destin uh for Walton Beach I think it was Mary eser was in the old ta taxing district come on and so here here are the differences because 4 C okay oh I know what I why boom I'm in the wrong thing here okay yeah I was in the wrong I was in the minutes of the May 20th meeting I was trying to figure out what the heck we had approved okay I apologize but we're almost there now okay so if you look at the TDC slide for just the current District which is where we are FY 24 the taxes collected 4,553 n76 in the last 12 months the previous year same time period 40, 580,000 53 so yeah can you blow that up so everybody can see that so what that tells you is the tax rate stayed the same and we actually collected less or the county collected Less in TDC taxes this past year than it did in the previous year oh by the way the number of units in this taxing district went up from 13, 284 in FY 23 to [Music] 13,632 in FY by 24 so what that tells you is the yield has gone down per unit okay so people are making less and I got mixed up hopefully these will be the right numbers but the taxes that they paid in that the units average unit paid in the old taxing district which is the one we are and 23 paid tdt taxes of 2781 that's the taxes this past year $2,626 so it's kind of heading trending in the wrong direction now we we still you know we're close on what what we're bringing in but it appears that we have stalled so this this Golden Goose that everybody you know loves to milk in this city and in this County uh might need a little help the other thing that I found interesting was the taxes and I I will go back and double check these numbers because I may have used a wrong numerator but the taxes that I'm I'm sorry not the taxes the money that the homeowners made or the vrb owners or the rental owners made in 23 uh came out to about $ 43,96471 in 24 uh it came out less and I have to go back and correct that number but all I'm saying is we we keep thinking that tourism taxes and we had this conversation which I I don't believe we have to get the right people here that's that's the wrong narrative we ought to make it fair for both the luxury yachts and for the fishing fleet and for everybody but if we once once you stabilize you usually start dropping because then people can't afford to keep those rental units up or recruit the people and then the tax revenue Falls and then we're going to be in a world of hurt when we start trying to collect it so I would just say maybe it's just a one-year blip but I don't think so thank you next item is the capital project uh status update in your package any questions comments just want to add and the staff agreed they'll have it in next month's report for prong Lake for which we already have a million dooll uh check waiting from the state to be cashed will be on the uh Pro be on the list of the capital Improvement projects and along those lines I believe we'll have the appropriate agreement before you on the next meeting that cor so to uh take that million dollar uh quarterly investment report is item four um e you have any questions and for f is the quarterly attendance report of the volunteer committees and boards and that's for information only however in next uh believe the first meeting in December we will be making new appointments so take that into consideration uh again we've reached out um through media sources to ask for volunteers to get that volunteer pool larger so that we can perhaps do a better job of getting quorums at our committee meetings um next item is draft minutes for the standing committee and board meetings again for information only and then um as far as announcements uh from your staff you asked us at the last meeting to reach out to the U fire uh District regarding the boat slip and the lease as it was proposed and the possibility of them considering adding language that would allow for any Municipal purpose as opposed to Simply um code enforcement purposes or um that they did not look favorably on that but we don't have that in your package tonight because we didn't get that information until after we went after your agenda was published so we will have that on the next agenda for your consideration whether you want to move forward with the lease as presented or whether you don't so that'll be your decision at that point um and then we were asked to meet with the school district regarding the um uh property that they recently purchased next next to the de Destin Elementary School about potentially partnering with the Destin High School the city and the school district to utilize some of that space for High School athletic fields uh we did meet with Mr Smith from the school district and they have plans to use some of that property but they don't know the extent of that total use and we've agreed that we would stay in touch with one another when they get that formalized and know exactly what they're going to use we will look to see what's available and see if there are any opportunity to work together on behalf the high school to utilize some of those fields and that's all I have Dr Young anything from you ma'am yes thank you we uh early voting began today for the general election and that started at 7:00 a.m. but we had people lining up like an hour or so early so it was definitely a hit and we'll have that through November 2nd and please notice that's at the community center we are apologetic for the people that showed up at City Hall today we know there was some problems with the County website and where things were directed and that website was down so we are sorry but um definitely it's at the community center through November 2nd and that does include a Sunday so we would love people to go out for early voting we also have our open house this Wednesday from 11:30 a.m. to 100 p.m. so we encourage people to stop by we have a fish fry that's free to you all live music some giveaways and just a nice chance to meet with council members and staff to talk about different projects that have gone on this last year is that at the community center and that's at the community center thank you yes and councilman Schmidt had asked staff to look into making the bidding process a bit having more clarity to it on the city's website and so it has done a nice job with that we all as senior leaders worked on that to make sure that the verbiage and um all of that for the bidding process is a little bit more clear so it it looks good and is sharper on the website valorum revenues budgeted appropriated and deposited as provided herein providing for the rights Securities and remedies for the owner of the note authorizing certain officials and employees of the city to take all actions required in connection with the sale issuance and delivery of such note making certain covenants and agreements in connection therewith and providing an effective date thank you any comments Council I believe to recommend approval of ordinance 24-19 19- CN upon first reading and I do have some comments second uh met with or talked with uh Crystal and our bond attor or Bond manager I guess is what he what is his title uh Dwayne Draper is our bond councel Bond Bond counsil this afternoon a couple of concerns because I thought this was going to be treated like a construction draw so we would probably immediately draw half down because we need to reimburse the uh general fund for the $9 million for the parcel and then there's a certain amount of equipment that is sitting on the ground that should be we should reimburse for for the undergrounding and then we have spent money on some of the on these projects uh that we need to reimburse ourselves as calculated in 25 million after a long discussion uh that's not allowed in the document as it sits before us so I reached out to John sumerall and I haven't heard back from him who's the head of the trust Mark Bank in this area uh but uh Crystal and and John I guess came up with a an idea that what we might be able to do and the pending attorney review and approval would be to take the money pay out the 12 or 13 million that we either owe ourself or ow owe somebody that's has equipment sitting on the ground and take the rest and open up a Florida Prime account which if you go back to the investment uh portion of this they they continually uh outperform our performance and part of that may be us but part of it probably not us and see if we could open up a Florida Prime account and invest the difference because our and I understand why the Merill Lynch guys uh for multiple reasons don't want to touch that money because it's obligated uh and it's for a loan or it's receipts from a loan and they don't want to get into the Arbitrage business so I would like the council uh to empower the city manager and the City attorney to review that and see if it would be uh proper for us to invest the additional 12 or 13 million so that the money is not sitting there since we can and I will continue to try to reach out to John to see if we can't do the other 13 million like a construction draw so that when we start digging up the old trailer park and start installing the tubes or whatever you know we would pay as we go but that's not allowed uh in the agreement that we have so after this motion after we vote on this motion I will make a subsequent motion to authorize the uh City attorney the city manager and our finance director to look into at least making a little bit of money off that $13 million that we are forced to accept on or about November 7th I think I mean we can talk about it a little bit I think Crystal can convey what we discussed today but I did discuss it with our uh special counsel you know Dwayne Draper and we don't have legal concerns about it but Crystal do you want to explain the Arbitrage yeah no um so it um to to Kim cop's Point uh Bond Council has confirmed along with his tax lawyer that works in his firm that were allowed to invest these uh excess funds that we won't be needing for a little bit uh the rates at the SBA have been uh they're still trending around 5% uh which is much higher than the 3.48% that we on the hook for this loan uh we will be doing Arbitrage reports annually to the IRS uh and if we expend all of the construction funds within 24 months um then we're done if it takes us longer than 24 months to expend all of the construction funds then there will be a a sizable chunk that will have to give back to the IRS in a payment towards the end of the as we come to a close in our construction oh and I also did I did reach out to um after discussion with our city manager um I did reach out to Florida uh Prime and they should be sending me the documentation to open account specifically for this purpose um this week just question so we are allowed to to have it in the account for 24 months before we would run a foul of any Arbitrage well I think there are certain percentages at certain dates for example uh there's a a six-month percentage uh 12month percentage a an 18-month percentage but I feel confident given the loan the the construction schedules that we have uh that we will meet those obligations I would think we would if we don't then we're behind we don't need paying back that's right this language is to move all of the building code issues to the code of ordinances and out of the LDC and so this is part of the steps in doing that comments I don't see any from the public at all this is first reading again counc I move the city council approve ordinance 24-1 14- LC on first reading second okay I do have a little discussion after reading through the next ordinance that we're considering which I believe is 48 pages long we didn't take out 48 pages out of the Land Development code did we no no they are not they that is not the same thing as the building abatement that when we get to that one it's the property maintenance code that's next and we will explain that one it has some Provisions that are related to building abatement go but it goes Way Beyond um but that's not this ordinance it does and I understand what we're doing this one is taking it out of Land Development code yeah because we're taking all of the building Provisions out of the LDC and moving it to the code there's already some building in the code but when we combine them with this ordinance we're about to consider it is far far more far-reaching and more complicated and after reading through that 48 pages just in a very quick manner there are a lot of things in there that concern me um that are not things that we have ever done you know I know we sent this to the community LPA and I would have hoped that they did a workshop on it I'm not sure we gave them that instruction and they just voted to approve it I'm not sure they understood how comprehensive this second one that we're going to adopt is and so when we get to that one of course my problem this is first reading so we take it out of the Land Development code and if we if we uh send the second one back to the LPA for a workshop I don't want to put the Land Development code in a position where they don't have anything so we could just put off the second reading couldn't we we could all right and uh so we will vote vote on the first one and then we can discuss the second one any other discussion go first yes I vvo yes yes yes Tori yes also to remove those sections from the Land Development code and we will not advertise 2414 LC for second reading until we deal with the other ordinance so just want to make sure Ray hears that we will pull it from the ad we we already send it to the papers but we will pull it okay okay so um moving on to 5f it's first reading of ordinance 2414 oh sorry 2417 CC an ordinance of the city of dtin Florida amending chapter six of the code of ordinances to create a new article 5 property maintenance code providing for findings of fact providing for incorporation into the code of ordinance providing for conflicting Provisions providing for severability and providing an effective date so this now is a national code that was developed and the building official um and everyone on staff has kind of tweaked it to address issues um more appropriately for Des but to your point the LPA or the city council may want to tweak it further but it it goes well beyond unsafe buildings it's intended to get nuisances and lesser offenses um because the city has been struggling in certain areas to deal with yards that are not up to par we've gotten a lot of complaints and so this would help the city deal with that but um if you have specific concerns we can Workshop It generally but if you also have anything specific you want us to look at um we're happy to well I will let the council discuss first will this address things like when a neighbor encroaches on a neighbor's yard or will that still be something that would be more civil uh like trespassing type issues and encroachments will always be civil but this would address like you know trash and nuisances and the the current unsafe building code is really about life safety issues and if a building is not in immediate danger of falling or there's other severe issues going on we don't have authority to abate those lesser nuisances now but this code would allow lesser abatement yeah we need a motion to go forward and then we'll have a little more discussion I move that the city council approve ordinance 24-1 17- CC on first reading I'll second it okay any other comment besides mine well as I read through it there were a couple of things that jumped out of me besides the 48 page length um in one section I saw that well it it starts out that that the rules shall apply to the date that the structure was built I believe which is I guess a uh an ability to to leave grandfather in other words you can't just make people bring their buildings up to the current code for no reason however we seem to have a terrible time figuring out who has a BTR do we have records available that tells us when the buildings were built so then when we go forward we can determine what standard the particular building should be held to yeah um a lot of times when we to find out if a when a building was built we use the property praisers which a website that says building effective built date yada y y because a lot of buildings as we know preempted the city of Dustin um Corporation so um we typic and so we don't have records of things built from 1980 so we use the County's website to uh affirm what year the effective date structure was built this this ordinance is for existing structures and M maintaining those existing structures and premises you know so yep that's what intended to uh yeah and I know I know the intent is well mean but I read another section that said in the event that there were no code violations it was up to the discretion of the code officer to determine whether the building was safe or unsafe what bothers me about that is that we kind of like the rule of law here and then to leave it up to the discretion of a code enforcement officer under me yeah under um section 103.1 it defines who the code official is in this in this code so under 101.3 The Code official the city of B the city building official and the city building the city building officials doesn't need is also referred to as the code official it is intended that the code official and Code Compliance division Department staff work together for comp compliance with the property maintenance code and it further also goes on to say under 105 that the code official which is me is hereby authorized and directed to enforce the provisions of this code or design does it say that design would typically be one of my inspectors that know more about structure stuff and and as I say it it concerns me a little after reading through the 48 pages so uh I'll make a substitute motion I think I can still do that as a coun can I add one more comment if you don't mind under the existing unsta building regulations there was a section in there um that defined unsafe building and part of that um section was item 12 um which say stated any violations of chapter 2 and three of the state standard housing code so a lot of the standard housing code which was a 1994 Edition was not spelled out in it was just referenced in that unsafe building abatement code but a lot of that standard housing code stuff was relevant to um minimum um um lighting requirements and electrical requirements and all that stuff that wasn't spelled out in here it was just reference to that code so a lot of this property maintenance code contains that same language I would say the only main difference between what we had in this property maintenance code is it didn't really extend to the exterior of the properties it was more just building related stuff and I I got that part it's just you know that gives me a little pause too it's just taking another big arm around I understand that we need to make sure things are safe and that the Public's not put it at risk I'm just not sure 48 pages I feel comfortable with goes but it has things that are like the height of vegetation and grass we did not have that before there would now be a certain height of grass and if you do not mow your lawn that is a code violation so it it does go beyond just safety so just I want Council to know what they're approving it's it is much more than the unsafe building Cod not saying it's a bad thing there's provisions on garbage and grass height and all these things that we did not have before so yeah that's part of the thing that bothered me we'll now have the lawn police the grass police um just you know more more regulation that I'm not sure I'm comfortable with it's it's nine in right now so it's not like you know if your grass is four or five inches high you're going to get a code violation but if you have 9 in high lawn you would and I if I can speak mayor protm some of the things that are in this 48 pages make a lot of sense there's a lot of areas in Destin that have HOAs and the reason why they have them is because people take pride in their home and they want their home not to lose value by a neighbor that may rent their property to somebody else and they don't care about cutting the grass they don't care that their paint's chipping in that their door leans off the hinges and so it's it's not like it's the yard police or the you know property police it's more of take pride in your home because your neighbors take pride in their home and it's not like she said the the grass it's got to be significantly high that it's not like everything is just so you know exact it's like it gives them plenty of time it's almost a month before it's too long in the summer type of grass length so I think it just helps our city maintain a cleanliness and a pridefulness you can drive around now in certain areas of old Destin and there's a lot of rental properties and they don't take care of their property and they allow the grass to grow and there's garbage cans that sit at the street they never roll them back to their house because it's inconvenient they'll just take their trash in their car put it in the garbage and it sits there all week until the garbage comes back to pick up so it's some of the Common Sense kind of things that a lot of neighborhoods already have in place but have never really been put in any kind of writing to help our code enforce people taking care of their rental property basically that's really where a lot of the problems are so I think it's a good thing I think it'll benefit those that are already spending lots of money to take care of their homes and keep them nice and I understand exactly where you're coming from Teresa it's just said it at some point how much is too much we're going to turn Destin into one giant homeowners association and it's just a it's just a philosophy and I would like to uh examine it a little closer and I would like the LPA to examine it a little closer so I'll make a motion that we send it LPA for a workshop as a substitute motion do you all do you all also want the LPA to look at like the occupancy information and the things about the room sizes or or is it just the exterior things that uh look at all of it okay I just okay we didn't discuss that part that's why I asked thanks okay just real quick no so my question is Staff didn't come up with this list right where did they get it from I think it's a national standard that they had found somewhere but it is they are the legislative sponsor for this all right I just want to make it clear this is something that's nationally recognized not just something we came up with so it's modeled from the International Code Council Property Maintenance codee B it's really common for cities throughout the country to adopt portions of it that are right for their city and not everybody very few adopt the whole thing and we didn't either it was tailored for Dustin by staff but um you know lots of cities adopt various portions of it and it's whatever makes sense for the city council which is exactly why I would prefer LPA to a workshop on it go ahead Mr Bagby so just help me out here Nicole because one of the things that popped in my mind and I got yep we're going to get the date from the Property Appraiser's website but say a storm came through in 1996 and damaged more than half of the structure they rebuilt they obviously made some improvements some things that they wanted to do differently would the property appraisers website pick up that 51% of that home was actually constructed in 1997 as opposed to the 1980 this is more of a processed question of the property appraiser because my experience is once they put it in it's Fir and forget Al though if they get permits it would be on the property appraisers if they do work without a permit it wouldn't pick it up but if they get their proper permits it would I think what Noel was saying she can correct me if I'm wrong is we have permits here we have our records but when things are very old and predat us before the 80s and it was either permitted by the county or not at all then she goes to the property appraiser am I correct yeah yeah and and I understand if if they follow the rules and they do it right the problem is is a lot of PE we got people today doing more than 50% Improvement on their home that are not pulling the permits and staff has another trick for that because I've seen them they go on Google Earth and they compare and they compare how it looked in each year and they can figure out right am I yep yes okay and then what what is do it an action of the council that would Abate this say we get hit with a storm 5 years down the road obviously I don't want any you know I'm not worried about 9 in worth of grass I mean I'm I'm glad we have a standard for it that we can enforce but would it just require an action by the council to say we're not going to enforce this until we can get all the debris cleared out you know for 90 days or six months or whatever yeah I mean there would be uh you know if after a storm I this is all about if a building's damaged Beyond that's Hab able that's no one's doing anything about right I mean if it goes on and on then yeah we're going to probably slap you with an unsa you know part of this un an unsafe portion of this to the building and say you either got toate it Abate it and you have X amount of time to Abate that if not then we'll send you a notice first a notice of violation then a notice of hearing it would go before the magistrate we can put in a provision that provides in in cases of storm events or other similar types of activities that this can be abated or put in abeyance for the council time period whether it's 90 days I guess it depends on the Storm could be a 30-day storm it could be 120 Day post storm I just want to make sure we have some common sense yeah that I mean I I like this you know I like where we're trying to go and have standards I'm all about standards but sometimes you know you need to apply a little common sense to some of the things we do up here a lot of this is you know complaint base driven too where you know someone lives next to a old dilapitated home that's hasn't been kept up and they finally sick of seeing it and they're like then they call say can you check this house is it even safe and then we go investigate but I was going to ask you was it in reference suit because I know there's a couple of houses that you can barely see them the amount of growth that has taken over the home and we found out that the person that was living there pasted and the kids that own the house live in another state and don't even realize how bad it's gotten is that in one of these cases we've we've had some that similar scenario yes Mr Bagby if I can add something to if we do have a storm come through we are required to perform substantial damage inspections post event so uh very few of those would ever slip through our fingers you know being having work done without a permit um we're required to do a CommunityWide sweep and then individualized substantial damage inspections and I would point out after Hurricane opal the governor did a blanket waiver of permits to put all kinds of stuff back and that can happen also so the won't be any permits so there there are two shards to that coin okay and this substitute motion I think got a second yes and that is to send it to the LPA for a workshop all right Tori Tori yes yes yes V yes yes that one passes 5 John uh uh I do I do have something I'd like to say this is councilman Johnny King's last council meeting and I wanted to tell him it was a pleasure serving up here with you I appreciate you I learned quite a bit about you I have a lot of respect for you and uh I will M you up here sir thanks man he's referring I'm not going to be here at the next meeting so be there is one there is one other meeting but I won't be here so you would be here on the 18th for the and over yeah just not on the fourth right thanks to well then I'd take all that back if you're going to be but there there won't be any more you know time for sweet sentimental you know compliments at the next one at that one so you know no pressure to the rest of y'all and and I want to say thank you Johnny I mean and I would encourage you I I I understand why you decide not to run for reelection and you know when you have a young family it's stuff and you got to have your priorities you know that's why we historically have had just a bunch of elderly retired people and I think you actually you and the the younger folks bring something to the council that's been missing but you can't do it for eight years and then take two years off and then come back for eight more years 14 times like Mr Dusen or whatever but the uh 12 12 yeah but but thank you and I would encourage you when the kids get a little older maybe when they go to college to come back and uh give the city some more of your time I think it's valuable the uh I have my numbers which I won't go through but I will ask you are you going through this or am I going through this you're going through it okay uh uh we postponed the pro potential proactive Code Compliance strategy last meeting so once the slides get oh well I don't know good evening um you can go to the next slide than there just a quick intr introduction this just a brief presentation um we've been listening to the council's concerns regarding wanting the city to take a more proactive approach to C- compliance and um we believe that based on the prior Council discussions that what that means is proactively looking for violations instead of just focusing on looking at only complaints and then also when a complaint is received proactively looking at the entire area you jump forward can you go back right there yep um proactively looking at the whole entire area to see if there are other violations that exist that should also be cited so um we've developed a strategy um that we' like the council to take a look at we want to get your feedback on it and basically it involves breaking the city up into zones and then having the council set proactive priorities for each Zone and then by priorities what we would mean by that is that complaints would always be investigated consistently across the city through all zones but then proactive compliance would be focused on uh the specific proactive priorities that the uh Council has put in place for each Zone and because we also have two seasons here in the city we can go to the if it's working go to the next slide thank you um because we have two seasons here in the city the council could also set proactive priorities for each season in each Zone and we propose that we have these zones set up based on the city's adopted planning areas because those are already um identified as having individual characters and we want the priorities that the council sets to be appropriate for the character of the area and Steve is going to go through the proposed zones based on the planning areas and we've come up with some potential priorities just based on the most common complaints that we've received in each area and he's going to go through those and then we want to get the council's feedback and talk about going forward with a formal proactive Code Compliance policy where the council would set the priorities Steve good evening Council appreciate your time um if you go to the next slide thank you so what you'll see up there on the map right there is the uh breakdown all those individual dots are code cases um that were created from October of last year through October of this year so one full year um it's also the Coler coded by planning area that Council adopted two and a half years ago three years almost three years ago almost um and so when you look at that you kind of get a little bit of a picture of what's going on um particular to areas um you can see the the higher density of of cocases in Crystal Beach and and Holiday Isle um not so much North and 98 um that kind of spreads out a little bit more so um so what we've done is we've just kind of taken a look at one the intent of the planning areas that was established um and then two the Cod cases that that occurred within within each one of those planning areas next slide so starting with the village obviously right away um infringement uh trash um plants overgrowth um other things parking the right away is an issue um sorry I can't read we were just talking about that Renovations and without permits um so that's OB obviously an issue um and then um the last one is conservation of uh the neighborhoods you that's kind of very all-encompassing um when it comes to um you know we can use the 222 cybert lot that we currently have an issue with right um tons of debris tons of garbage um spilling out into the rideway so there's again another rideway issue that we can focus on in the Village area those are kind of the three priorities that that we see as staff um and again we'd like to get some feedback from from Council if those three are are good priorities for the Village um you know we can move forward with those are there others that Council might see or or heard from from their constituents if anyone I'll I'll start sure and I appreciate what y'all did y'all are trying to strike a balance from you know enforcing everything proactively which some people in this city w't you know I I would tell you Ive walked through my neighborhood this weekend you would not make it through my neighborhood you could assign two Code Enforcement Officers nothing but coming to my neighborhood and spending three days out of their lives riding tickets taking pictures sending it back in so so I wanted the intent here was to to NE neck it down so when you say right away infringements okay that's signs that's cars that's bushes that's shrubs that's grass growing over the sidewalk or something and you you don't narrow it down enough to where because remember it's not just the Code Enforcement Officers it's we're we're not going to get rid of the complaint model that the complaint model is universal throughout this country so complaint gets called in it gets addressed a code person goes out there and they see yep it was and here's your warning or here's your ticket if this is your the second time they've had to come out I'm trying to keep it simple so yall did a great job because you went through each one of the zones or districts and said okay here's probably the three problems here and this time of the year you know maybe I just want to I wanted it simple and maybe I wanted it too simple but I wanted it in a way where the citizens understood we're not going to have trash cans we're not going to have signs and we're not going to have uh cars in the right away period when they're not allowed of course the legislature complicated that because last year they said if you're an HOA we can't write you a ticket you know the day before your trash day or the day after your trash day and so when you have two trash pickups a week that leaves one day that we can write tickets for trash cans in the RightWay in an HOA plus some of our guys probably don't know they think well this is an HOA or that's an HOA but I'm not sure about this one it might not be an HOA maybe it is an HOA I just wanted like three or four things to say and M mine was parking in the right away and signs you know I just wanted to get if we can just clean that up if we can just clean up a few the things that are repetitive and then we can start to work the complaints will take care of the rest of them sure yeah and and as we go through these slides if you want to go any further we can stop here if you'd like um the top three most common are exactly those and I and I think I've said this in Prior conversations with other staff if you can figure out your signs your parking in your garbage yes that eliminates a vast majority of of code stuff so if that's the direction that that Council wants to go is just though Hammer those three you know that that certainly does simplify a whole lot you know I I will make that motion that we uh direct code enforcement to proactively enforced that means you drive by and you see a trash can out there and it's not trash pickup day and I can I can tell you right now that that we have in the in the background been working with Kim on on a sticker system that if your can's out there on a day it's not supposed to be it gets slapped with sticker and that's your warning the next one citation next one and then it goes through the process and so we've actually developed that draft sticker already and we're working through the the legal with that so I mean that was already going to be priority number one um so yeah no that's that's perfectly within the motion I want to make uh I I want you I want code enforcement to proactively enforce right of way signs trash cans and parking okay okay that's all I want them to you know if we can clean that up yeah thank you yes if we can just get that cleaned up 90% of our problems will go away and our our citizens will be like and we're going to tick off some of our citizens because again people parking in the rideway people in my neighborhood parking on the sidewalk I'm like are you flipping kidding me but they're renters so I don't mind them getting tickets [Laughter] but I just have one thing that I wanted to add to that um under the current city code the regulations about trash cans being out on certain days only applies to the short-term rentals so when we talk about proactive compliance for that it will be um only for the short-term rentals yeah that was something that I actually did learn is that that yeah that that it only apply to short-term it doesn't apply to if you're Homestead or long-term rental if your trash can's out for too long I I didn't realize that until I I actually had the pleasure of going out on a couple of ride alongs last week and this week with code um to learn their processes and everything so that was something that I did learn so that is that is definitely something that that we will bring forward as a as a potential Amendment we we've got to fix that but right now let's fix the alligator in the boat and that is to get some proactive code enforcement going on in this town so if you know I would say short-term rentals that might be the extent of our trash enforcement till we can come back and change but that I still want the trash trash cans gone I personally think that if we educated our residents in the village the destined proper area that the yellow lid that's Tuesday morning only M and then Friday morning is the Green in other words you'll get a green and a yellow on a Tuesday and Friday morning because the amount of people that when I'm running and I drag their can back up they're like oh I didn't know they won't pick the yellow up on Friday morning yeah it's not the day for that so and I truly believe if we had some way of doing like a flyer and put it in their mailbox I don't think we're allowed to do that but if we had a sticker that we could even put on the trash cans Tuesdays only on the yellow lid I did that on mine because when I moved here from Colorado you get one trash day this whole the recycle day two trash days and then a bulk day it's really confusing for some of us but yeah the the sticker thing and then education is also going to be um uh awareness really is is going to be the the big ticket item that's going to drive this and we can work with Tamara on on sending out some of that awareness too anything else I've got something I'll say that I I really enjoy this uh quite a bit actually and although I'll go ahead and go along with it I I do sort of disagree with a little bit of it because I remember when I first got here one of Kevin's G biggest complaints were certain areas were being attack more than other areas and and based off what we're seeing here it's because certain areas have more of a certain violation than other areas so how do we combat that certain areas are being looked that more thoroughly than other areas without looking at it in in this context but to start off with with baby steps I'll support the pick the three go with the three but I think this is phenomenal I think this works in the direction that was from from day one whenever I got here the argument that was kept being brought up so I I think you attacked it appropriately I think we're just baby stepping your yeah your appro yeah and this this was this was this was uh several steps forward as well as you're kind of alluding to um there there are other steps that that staff is still flushing out um on how to further implement this and just taking this you know a little bit further a little bit further a little bit further um uh that we haven't quite fully uh brought to a a coherent thought just yet we have our ideas um and we'll we'll bring that back as soon as we as soon as we got that but I think moving forward with the three now and then getting that that trash B applicable to the entire city rather than Str strr is is is a good U step forward well I think the strr should be in there because that's still a revenue so the Str I think we still need to be proactive that yeah absolutely they will be quick question um I know Waste Management did the whole address number stickers and got those to every resident can we re-engage with Doug and find out could they do a sticker that says you know every Tuesday and Friday we'll pick up the green can and only on Tuesday we'll pick up the yellow can there's a sticker that that could then also be sent to the residents I mean how did they get the stickers out I can't remember did they come in an envelope to us hold them to everybody so if we could have them mail out like that sticker that tells every resident that's being that's paying Waste Management this is the day your Tuesday this is picked up and Friday this is picked up yeah Kim cop is correct that that was sent to everybody and then also about six months ago we sent it to all new residents as of the time in the last year and a half those stickers went out to everybody from us I just have one comment on the parking in the rideway in uh in residential areas it's pretty simple you're not supposed to be doing it in some of our commercial areas it's not so simple we have working in the rideway all over the place that has actually been allowed by action of the council so you may have to check back to figure out which is which you know one example is there's it's not a commercial area but the parking in front of the death Elementary it's all halfway on the rway we specifically allow that parking along with the back porches on all of those rideways both along and to the road specifically out Allowed by Council action so it it'll get a little more complex to figure out yeah and there's plenty of developments that happened prior to the establishment of the city that it all happened as well so yeah we we obviously will we'll we'll work to um figure those unique situations out and and apply it appropriately thank you just one point of clarity so we want those three enforced throughout the city okay yeah okay just want to be clear don't park outside my house and wait for me to park in the yes I vote Yes yes yes Tori yes thank you all right uh Miss AAR thank you mayor protim I just wanted to piggyback on what Tamar was saying that you know of course today early voting um at lunchtime I heard on one of the news channels that the State of Florida had over a 100,000 early voters the first morning of early voting and the Democratic party only had 50,000 voting um members show up in the early morning so it is early voting it starts all week long all next week so get out and get your vote in don't wait till the day of because you never know if an emergency will happen so go out and vote and please reelect if I'll get the opportunity to say this at my last meeting but really really appreciate the staff and all that you know everybody here has done and just I don't know just really made really feels like a family here in a lot of ways um you know and and so I just I'm very very grateful uh for the time that I've had here with all of y'all all of y'all in previous Council and mayor so that's all I've got thanks thank you Mr King and I have enjoyed having a young brain near us too so um enjoyed the entire time you've been here and appreciated your perspectives I've got one issue tonight that I will direct to the city manager I've had a number of younger teenage folks who fish on the docks in the harbor who have called me and said they are being uh consistently banned from being on docks and fishing in the harbor and I I understand the property owners dilemma people are doing things that are associated with vandalism down there and and it and it's a risk they don't want to take but I know these kids are are uh some of them are associated with the fishing club at the D high school and they're running out of places to go fish and so I'm going to have them contact you and I'll let you be the liaison to see if we can get some of the property owners if we can put in some kind of a system where we register those kids so that they'll be less worried about them being involved and things they ought not to be involved in perhaps they'll let them fish on their docks I know that we let them fish on our docks the ones we have but it's getting pretty restricted and I know that they've had a number of no trespass notices put on them so the area they can fish on is getting smaller and smaller so I want to tell them to give you a call and see if there's anything we can work out we be glad to have that conversation sir all right just to add Main Street I've noticed there's been a lot of young Fisher folks out there um between 4 and dusk so there is some great fishing right there off of the pier in the Main Street Park area so if there some high schoolers that didn't know that that's a great area for fishing both on the sidewalk you can fish there as well as on the pier that's at the Main Street park and then I think we've also got opportunities at the mty Kelly Pier we am I right Lisa a that a great area for the fishing as well down there by Joe's Bayou so okay fishing's better in the harbor it is the trout like getting under the lights the uh but if there's some kind of system we could put where they would register with the city so at least the vandalism problem may be not quite such a concern can can I can I piggy back on that Abol as well you know we we saw this when the Emerald Grand came around uh we used to when I was a kid we used to ride our bikes from where ever in dtin with a five gallon bucket with a cast on it Tackle Box on in your backpack and a fishing pole in the other hand and it was like man when they shut that stuff down so quick I mean it was like it got smaller and that was 25 years ago 20 years ago or whatever but I have seen an influx of kids it just gives me incredible Joy the amount of kids that are riding around their bicycles fishing poles and it's just is like it's so nostalgic uh to me and I I'm really grateful I think it maybe has something to do with YouTube man there's so many like Urban Fishing people I love it I think it's great so I would support that yeah they do have to have somewhere to fish and that's becoming more and more of a problem that's all I have thank you I don't have anything we'll miss you Johnny don't
