thank you so much would you bow your heads in prayer please Heavenly Father we welcome you into this meeting tonight we are grateful for the privilege of being in the induction ceremony we thank you Lord for those that have been chosen we ask that your blessings be upon them Father we just thank you for our city and our community and we declare that you are the Lord over our community and Lord we just thank you that tonight as we carry on in business that thy kingdom come and thy will be done is our prayer and now the blessing is this may the Lord bless you and keep you may his face shine upon you and be gracious toward you may he give you his peace and his favor amen thank you again all right the Pledge by councilwoman abar all right right so we're going to do the appreciation to the outgoing city council memb so with that be right yeah Ally if you would councilman Stevens in just one year you have shown that the measure of impact is not in the length of time served but in the passion the dedication and the commitment you have brought to each task and we appreciate that you have made an unforgettable contribution to our city and to each of us personally and professionally as part of the staff and family of Team Destin throughout your time here we have witnessed your wholehearted dedication to every issue every meeting and every decision always Mark with sincerity that inspires us all you reminded us of what it means to serve with true purpose your ability to listen deeply empathize and to act in the best interest of our community has created a positive influence that will continue to benefit the city for years to come your sense of responsibility toward the safety of our city has been evident in your every effort you've undertaken from championing initiatives to improve voting and harbor safety to advocating for sustainable infrastructure structure you have tirelessly worked to ensure the security and well-being of our residents as you transition from this role the vision and standards you have set remain with us all you've shown how much it can how be how much can be accomplished with determination and a deep commitment to the people of this city we are better because of you and the time you spent here with us on behalf of the city council the city staff and our community we thank you councilman Stevens and Miss Ally for sharing him with us for challenge every opportunity you acted thoughtfully and with Integrity always prioritizing the well-being and interest of the community you offered balanced and insightful perspective on a range of critical issues such as Public Safety traffic management and short-term rental policies bringing depth through each discussion your support for underground utility projects and advocacy for sustainable infrastructure have laid a solid groundwork for the resilient and reliable future of our community through your compassion wisdom and dedication you have not only strengthened the council but but also contributed significantly to shaping a Brier future for the entire city as you step down from this office in your official role we know that your influence will continue to be felt across um for everything I've learned from all you guys and gals um people who come you know we served with before um and then and then the city staff I mean it's a like I said this a couple meetings ago you know it's like a family up here um and and a lot of times it feels like we're all we each other have you know so it was a it's a great honor um I am it kind of hit me saying the Pledge for the last time up here you know like I don't have to be gone forever but I'm going you know take a little time you know um but but anyways from the bottom of my heart thank you for trusting me and and the rest of these folks up here it's been a great honor to serve the city of Des and you know I will say real quick and I'm gon maybe I will be along I don't know I got one more time um you know there was a there's a great philosopher who I've been waiting to tell this story is a gentleman by the name of of Dennis early he's my two doors down neighbor he was doing some brick work for me and we were sitting there he was doing some we were sitting there on a bucket and he was saying uh he said you know I was he was griping and complaining about the Destin city council and I'm like Dennis I'm sitting right here he said he said what's that mean I said I'm on the city council he said well then you're corrupt and I said I don't I don't think so well well if you're not now you will be and so you know I'm not going to say I've had any kind of opportunities to be corrupt but I can tell you that I've kept kept my word been honest every step of the way and so I just wanted to tell that story because now I get to go tell Mr Dennis that that uh that that is not the case so anyways from the bottom of my heart thank you all very much uh this has been a great privilege and great honor uh to comprised of nine and 10 year olds who have played in the Panhandle Youth Football Association this season the junior Dolphins had an undefeated regular season and finished with a record of 11 and one that's awesome really good guys and with that they are pyfa Super Bowl runner up we would like to turn it over to the head coach Joe to introduce the team and have any remarks hey well done man mayor counsil uh and I just want to say congratulations and welcome back to the city councilors um what's what's the saying what was old is new again um it's I've worked with all of you so it's good and good to see you back and also I want to pay a big compliment to Lisa fth and the recreation staff over at the community center they hosted us for Dustin forward last week for Arts culture nonprofit day um and as usual Lisa comes through the room's set up the coffee was warm and hot um and uh we just appreciate the partnership and as you all know I try to get the class in different facilities in the city throughout the year so next month for small business and economic development day will be at the library so um working with when on that so thank you very much right thank you so much anyone else here from public comments who would like to speak all right seeing none or close the public comments and I will entertain a motion for the consent agenda make a motion to approve manager report ler take it away thank you Mr Mayor uh first item is 4 a is an update from our undergrounding uh utility Consultants regarding the uh undergrounding project there were some questions from Council and we asked them to come tonight to address those questions so um here we go good evening mayor and council members uh thanks for having me here tonight to do a brief inter um kind of update on the project status is there a remote that I can use for that or do I need to not but I'll get you just give me a perfect okay so we can start with the first slide um next one so just a real brief background on how we got here most of you guys know but for those of you that don't we had the FPL design um we identified the critical equipment locations and that was key in some of the easements that had to be um acquired the carers involvement is similar including some of the recent agreements that you guys um had approved and then procurement because of the uniqueness for this project we re recommended early on kind of a qualification base versus just a bid um out because we knew that you know just having any contractor here wouldn't probably be the best benefit to the city so if you remember some of the um many reasons was to kind of ensure that the contractor had specific experience working with FPL projects but not only that but within the beach communities working around residents and businesses we know this Corridor is especially tight with a lot of uh businesses that rely on being able to get Ingress egress operations without much effect um also working in a very um complex and tight Corridor as well as familiarity with things like seasonality but one of the biggest um things that we had in that procurement package was working around existing utilities and their background on other projects and showed similar um success for that so that's kind of how we got there and now we're happily to say that we're actually in construction we started last week so I'll give a little bit more update and a f a future slide for that so the next slide we just have the map that most of you guys have seen we're working in the area in red there on us98 of course it has some legs and some extension points that go slightly beyond that but uh that's the primary corridor from airport road to the West End Bridge as you guys are aware um easts are required for all the FPL um equipment locations there's there's two forms there's ones for residential and then one for the business so that's kind of been an ongoing effort it'll continue including some survey as we um collect that during the construction once we kind of get into some areas there's couple of them that have kind of floating locations where they're not specific on a corner of a property so some of those that were fixed Corners we're able to kind of capture those early on the other ones we'll have to capture them as we go through the project and the equipment is physically set we can get those coordinates the next slide is the uh street light and Landscaping so for street lights you guys have already um been aware of this but just for any any new faces or um anyone that's not familiar with the street lights that were picked that's the option obviously the existing street lights there that are on the polls now will come down we'll be installing these new um street lights throughout the coridor and then Landscaping we've had some discussions about potential wraps potential Landscaping so I think as the project evolves we get a little bit closer uh we'll be excited to kind of bring in and hear what the feedback is and what everybody thinks might be the um best rout going forward for that the next slide so um as some of you may know we did start construction last week um in that one week we're able to complete approximately 1,800 ft of us98 on the North side from Beach Drive to Benning drive so we got a pretty good amount of um work in in the first week um as we progress the contract will continue to locate the existing utilities and place the new FPL and carrier infrastructure in the ground we currently have a schedule of about 18 months we hope and based on past projects that we will achieve that and hopefully get it done a lot sooner than that but um I guess the first week is not a true indicator of the overall project but it should be a good um starting point to kind of give you an idea of how quick and the impact being minimal um on the next slide so as we progress through the project we'll keep daily reports identify things with pictures update the schedule we'll come here as often as you guys would like us to kind of perform updates and uh give you a status on anything with the project the contractor I should mention too is here tonight as well and he kind of offered during his procurement process that he would be available to come in periodically as well and do some updates so we can do those together or separately but um he wanted to be here tonight as well the next slide um is really just to kind of give you a snapshot these are the these next two slides are actually pictures of the section that we're working in now from Beach Drive um to the to the west and you'll you'll see the FPL design I just showed a random slide it just shows you can see they're basically on the North side South Side we have number of crossings that are identified and then you can see on there too there's um quite a bit of existing utilities um I know that there were some concerns expressed at last meeting with identifying and protecting those existing utilities so I just wanted to you know kind of highlight that we you know we've got them all outlined and as part of the design um I just want to emphasize on that too FPL designs this project we're not allowed to design it we are able to kind of in and make some changes of modifications we've done a number of them easements um changes in the field that we have to redline movements that we make because of existing utilities uh we'll continue to do that but the um the permit the design is that of fpls for the carries it's that of centry Link Cox Communication we don't we don't control the design nor does the city want to be in that role of responsibility if we if we do that we own the errors and emissions and things like that so as part of the procurement process the familiarity with that process and working with those drawings the contractor is familiar with that um I know on typical projects you you have considerations to existing utilities because there's fixed locations there's structures things like that these type projects are very different in the fact that you have to period avoid existing utilities we have to go up down side to side whatever we need to do but we have to avoid them they were there first by State statue they're in place um so the design that you see from FPL doesn't mean that it's going to go horizontally exactly the way you see it nor vertical we have to make those adjustments in the field so really day one was the start of finding those utilities we can we can look at the data on the drawings but as most of you guys know when you get out there in construction things are never where they're exactly shown in the drawings you have to physically find them so we um you know as I mentioned before we picked a contractor that had a successful track record with that I'd also Point um out that the neighboring project over in GF Breeze is very similar it's a very tight Corridor it has a ton of existing utilities got gas water sewer a lot of sewer laterals and um that's an extremely successful project all the infrastructure is in incomplete we had one hit and it was a service lateral that wasn't even in the RightWay so in the RightWay nothing was hit u a lot of things were not marked or you know we had to do a lot of work to try to find those things but I just wanted to give some assurances that that's really an important thing my background's in utility so I take a lot of lot of pride in trying to make sure that those things are addressed and they're identified and that we we capture them during the project it's also true of all the other projects that we're doing in the state we have a similar track record on those so um lastly we do have a bi-weekly meeting uh moving forward we've had them with the city with moving forward we'll have them with the contractor as well um we will invite all the utility companies they've been invited to participate we'll continue that there could be some additional ones that that get invited but as we move forward they'll be at the bi-weekly calls as as as they um see fit or need to be there we'll continue to address any concerns at those meetings but you know in addition to that throughout the project um I don't think you'll find another team that's as as dedicated as we are to not have the problems that you'd expect we've been in a lot of beach communities and we know the expectations are high we know your constituents are concerned and that we want to make sure that we give you the confidence that those things are addressed and they'll continue to get addressed I'm always a phone call away um our PM's available our inspector is available we want you know people to feel extremely comfortable calling us anytime I don't work Monday through Friday 8: to 5:00 I'm available weekends nights so if there's any questions or concerns throughout the project I hope that nobody has any hesitation with reaching out to us we want this thing to be one of the most successful projects that the city has encountered and I think we can deliver on that so with that um I'll just show a couple extra the the slides right here that just kind of shows you that during the permitting process when we're looking at that we have to kind of ADD address all the crossings cuz when you're crossing the street there's a dynamic of existing utilities that are kind of opposite to the ones that are going parallel within the corridor so that's just kind of a snapshot of of how we go that and kind of how things have been looked at and sequential you know during that design process how we'll approach it and then other than that I'd like to turn it over and see if you guys had any questions or concerns that we can address all right now I've appreciate you being here thank you guys so much for all your time and dedication to this councilwoman abar thank you mayor um thank you for being here tonight giving us the progress you know I've been up here for four years so I've seen you guys make quite quite a pro a jump I mean it's been very rewarding I just want to address something that was brought up in the public comments at our last meeting that the water utilities des and War users was wondering if they were going to be included and from what I understand they've been included that you just weren't getting answers back from email can you clarify if they're being part of this because they are huge in they are they are everybody is um you know if if we lose fiber every the businesses will completely come to a stop right so we understand the sensitivity so it's important for us to um you know have those relationships I don't want to I would never want to throw any utility company under the bus you know that's important for us as relationships so I think what we've done is hopefully those slides kind of show you that the drawing we' we've have those things that they've been captured we've known about them for a long time now the utility companies whether it's the cable it's the Destin water user whoever the utility company is they'll all tell you there's stuff out there they don't really know where it's at exactly anyway so we can look at as builts but when we get out there the way that you're going to have to build the job is we have to physically find it in the field and you know we we have that data from them from the survey I don't know if yall remember but early on we had to go out there and get survey of all the existing utilities so outside of those as builts we we rely more heavily in this type of construction in the field because that's what's going to be critical elevations aren't showed in as built a lot of times and if they are they're they're not the most accurate so we never go data dependent on that um we go data dependent on what we find in the field it I know you guys have probably had experiences where a lot of things get hit that's why I was saying we take take a lot of pride in avoiding that you can't can't avoid everything it'll just be a a role now where the contractor's been engaged he'll continue to be engaged throughout the project with those utility owners and uh we'll we'll do everything I think what you're going to find is the contractor goes a little above and Beyond what you normally see with a contractor that's kind of one of the big things where I personally kind of graded them high on that side too is that's so important to have someone that kind of goes the EXT popping off a manhole finding that gravity you know you know it's there but where is it at exactly elevation wise because that's what we have to do we have to meet our separations going under them around them so I think for the utility companies the the message is that we we want them to be included as much as possible we also know they got a ton on their plate they got jobs all over the place we we have a role to find them and protect them and do our part in the field to try to make it as easy on them as possible so that's that's kind of how we see it and moving forward we'll we'll do everything we can if whatever whatever it takes so well that's my only concern is is that you like email keep up with them let them know what you're doing even if they're busy if you don't get a reply back you know after about five or six maybe you know call them don't wait for email but I want to make sure that you know they're crucial that they're included so that they know they're included that you guys reach out to them maybe when you do meetings with the city verify that you know somebody from DW you can be there okay since they are local they matter to everything that we do here okay agreed agreed and going forward like I said we've got bi-weekly that had been just with us in the city now that we're in construction now it's switched the gear so we've invited all of them they've been really good and responsive they've been in the meetings the last couple of weeks so we'll continue that effort and outside of that like I said the meetings were here all the time my email I have my phone numbered everything on anybody can call me at any time if there's any issues or concerns all right councilman Bagby so describe for me the y'all's involvement in the design process that FPL went through please so the design is solely that of FPL so what we do is we look at where the Design's going and kind of how that looks as far as the existing um you know like I said it it it's kind of hard to explain without going into it detail but you know if you have a storm system structure it's a very specific grade El you know I know you already know all that with this stuff it's avoidance so if they show it in the design whether it's two foot off the side the edge of the RightWay in the sidewalk or four or five it doesn't matter we're going to we're going to adjust that and then Redline it as we go so when we work through the design process with them it's mostly to try to figure out like hey we need to move the equipment switch gears things like that we we move them but we know getting point A to point B doesn't really change it's just where is a and b going to be getting to it it we have a lot of ability to go up around and turn we have obviously separation that we have to meet and we can't turn a a pipe on a you know too much of a bend in degree radiuses things like that so we take that in consideration but um we we've known of the you know you got a major gas line you've got tons of existing carrier Communications we've known where they're at um a proximity but the design is that of fpls like I could go to them and just say hey we've we've got a water main right here they it's shown on the drawing is it is it here or is it over here we have to find that out in the field we know that it's there we just have to pinpoint it in so that design you don't go we couldn't go back to LPL and say hey you need to move your facility to accommodate that they're doing that by saying you have to avoid them they're there first so by State statue there everybody else is in underground and in there they have the right who did the survey of the existing facilities so we had a um a company called it was Bullseye survey that came in initially what they did is kind of that so they pop the manholes find a lot of the existing utilities so that in a combination of some as built records and things um do has as builts available we just requested from them they give us what is supposed to be the most current the point I'm getting to is you were our representative in those meetings so the surveyor gave you those documents right correct and then you gave them to fpl correct okay so when you did you talk to the other utilities when you got got the surveys to get them to confirm those surveys um the the no not necessarily what we did was we we did make communication out to the the utility companies prior to the construction um throughout the the process we that they've all been provided with the FPL design in fact if you I had a pocket slide but if you go to the FPL permit package again remember that that designs there's a permit they're required by permit to issue the notific ation and the draws to each utility companies that was done back in June I believe for FPL so there's still nothing that the utility company would do if let's just say that we get the gas company out here they're aware the project coming but at the end of the day they you have to you have to find it and verify it in the field so we don't we don't want to rely on that information nor give it to the contractor say hey base your you know construction on this we wanted to find it in the field so when FPL finished their design did somebody in your office go back and check that against the survey you actually gave to them to make sure is that what you're saying is we do that yes so we're taking the existing over so basically they're overlaying their facilities on ours again like I said they're going to show a lot of things that go right over top of utilities that's that's normal in this process because you're going under it around it so there's you know it it's just not like you're you know everybody's probably used to a standard construction that's you know if you're designing something if you're the city and you've got a roadway project those utility companies have to move to a comp their in by permit however you do try to avoid them and your designed when you can ours is completely different in the fact that you're you're just avoiding them from the get-go so you you show them and you try to capture that existing information from the survey but again the survey is just picking up a horizontal he doesn't know for sure we have to go down there and and find it so that's kind of what I wanted to kind of assure everybody is that we we know that responsibility we know it's a big one um but we know that it comes down to the boots on the ground now is that time so but to answer your question yes we did look at that we saw that coming in um we knew the you know we knew some of the major critical um facilities that that are out there in the corridor they were identified whether each exact in everyone you know relying on the survey data um I think even the utility companies have told us in this past week we don't even know where some of our stuff is so that that's why I'm saying it's it's not that we wouldn't want to base too much on those as builts because even they don't know where some of their stuff is I'm not asking about asil I'm asking about the survey cu the survey told you where everything was correct at least on one plane absolutely on one plane corre possibly on the other plane but right okay so at the end when the and I think you answer this question I just want to make sure I understand FPL came up with a design somebody you or somebody in your team took that design and took the survey that you gave them initially to make sure they didn't make a mistake or they didn't put a line that was too close to one of the existing lines right right that that's that's kind of not a straightforward question because they're going to show their line right over top of a water line in some instances because we're just going below it so you we can look at we don't you don't get vertical information with the survey you get some vertical data but not a lot you know where you can get the manholes aess but the water mains that are under so they're just showing really what you're looking at is horizontal information you're not getting any vertical information are very limited you should get uh uh vertical information from FPL though right no that that drawing that we had kind of shows you the the typical section so what they're doing is they're showing like for instance um a water M typically will be 48 in in depth but it's not going to be 48 in in everywhere they're they're going to have to you know deflect with ours it because it's power it's complet it can go 7t 8T 3T you know as long as it meets the minimum 36 or whatever the crossing depth is for the do 72 in you know whatever as long as they're meeting that criteria you can go as deep as you need to you just have to miss everybody else so you'll see the elevation on ours which will get as builted at the end um but that just that FPL owns that as built whether they you know they decide to give it to other people or not that's that's the utility company themselves but we do have access so our planning department won't get a copy of that as built we will provide them with whatever yeah whatever the utility companies will release fpl's I wouldn't say it's proprietary but they do have like they don't just give out anybody's you know their ass builds to their existing infrastructure but we'll ask for them and I don't have any reason to believe that they wouldn't give them to the you know to the city yeah it's not their dirt right it's right away dirt it's our dirt oh I I agree with know what's on my dirt I agree with you so we will we have as builts that we collect so if we're asked we'll provide you with what we have okay well let's ask and get FPL to give us the as builts please all right councilman Dustin thank you mayor and I know you're not in charge the eans FPL is I take it about it's been about a year since they came by on my property on the Harbor and said okay we want to put the line here and we're going to put some boxes here and I guess we all shook hands and I've yet to see anything in writing what how do you design a project when you don't know what your easements are and I guess you can go back and I was told four or five people were not giving easements but they designed their project with kind of a yeah we're going to have an easement here maybe not we so we do move them throughout the construction project it's not uncommon that we have a Transformer at the beginning of the project and that's why I was I mentioned I think on the slide I didn't go through it verbatim but it does have where we have to redline things we'll move that equipment all day long to you know in order to accommodate it its design is where it needs to be so before we go moving it we have to get that approval process so we work back and forth with FPL there are a couple of people that you know if we if we have the consense kind of was saying what we don't do is you don't want to go out prematurely and get that easement because it's specifically saying where the coordinates is is so we have to wait till the C because let's say the um let's say that the Des and water users has a water facility so we have to say hey probably we have to move it over two two feet over from where we originally told you that's what we're waiting for so that's when I said during constructions we progress we'll start getting that that's when we'll go back to the owner and say all right we've got the documentation ready and prepped for you now that we know the four coordinates of that box so if we if we were to do it early we would be kind of premature and that you'd spend that money for the survey have to go back out and Survey it again so um we've had projects where we don't get the easements until the construction's about 80% done 70% not we ideally don't want to be in those situations but we have to work with whatever the homeowners or the business owners will will allow for it and you always you always have a few that will um you know maybe deny that request so we're constantly looking to see where we can shift and and move things to accommodate that and I was just curious about when we were actually going to get around to signing documents so it's toward the end of the construction you think I think and I I I hate to put you on the spot I think we have 40 something that are already recorded or in the process of it or survey let me have let me have my PM come up for a second and just kind of she give you more specific numbers I hate that good evening um so we have 17 that are recorded at this time and these are the easements that are butting up to the corners of properties where you have an easement where the equipment is set back from the RightWay with the conduit line and we're not sure what's underground those will not be recorded prior to installation so in the instance of the one on um the Dustin property the Dewey dustins that one is a floating easement it runs all the way back and then the transform yes so that one we need the contractor to look at it to see if there's anything conflicting with that placement before we can go ahead and draft that sketch so we will get there eventually yes sir we will okay thanks all right that was the last one um that was a awesome presentation I have more confidence now in you guys than and ever before even though I was at 100% before I I I just wanted to commit tonight and be here personally just say we I truly want this to be like one of your award-winning projects and and we want this thing to be extremely successful we take a lot of Pride if we don't do good on this one we probably won't get another one so we're going to take a lot of Pride we'll do we can't guarantee anything but I can promise you we'll we'll do everything we can to make sure that these citizens and businesses and Council and and the city deserves a good project we'll deliver on that so we'll do our part I think after our explaining PTSD I think the community is very afraid of a 5year long drawout of another 98 so I'm really excited for you guys to rewrite our history forward with a better construction uh process it worked out good with the timing of this meeting because we did get in week one the contractor got about 1,800 feet in so he got um from Beach Road to Ben Ben so that's a pretty good progress in in a week's time so uh we knew that the progress would be pretty quick but we knew that the concerns are early on we like Hey we're going to have Lane blockages and so those businesses in that Corridor hopefully they got a good s You Know sample of you know getting through there not really impacting them so you know we we got him sitting here tonight too so if you want to ask any questions of him but I think we've got a good one and we'll work hard to to make sure that counselors next item is four 4 B is regarding our state appropriation request if you recall at the last meeting we brought a couple for your consideration you asked us to add some more significant projects to that so we are presenting you with a A list tonight um that includes um M Kelly outfall construction uh The Clement Taylor Park Renovations the cross town connector stallman intersection improvements the Morgan Sports Center safety net and the pickle ball phase one construction um so those are presented to you in your packets for the dollars that we would uh anticipate moving forward um however uh as you consider these please keep in mind that later in tonight's meeting we're going to consider bringing on a state lobbyist to help with these Appropriations and that we would uh want to vet these through that lobbyist make sure we're not moving bad projects forward and spend a lot of time and energy trying to seek some funding that we're probably not going to get and then to have a broader uh conversation with them assuming we get there with the lobbyist to make sure we are moving U the um highest priority and the most likely to be funded projects through the system so if you uh look favorably on these you know uh we appreciate that in your motion that you would allow us to vent them through the lobbyist to be sure we're moving in the in most favorable direction right do I have any discussions it's a big topic all right councilman BBY yeah I just uh had suggested a couple more uh in my meeting with the staff uh today but I assume those and and others that the lobbyists come up with or the staff come up with will come back to us for a prioritization process before they start trying to get that's correct sir okay and and and we would ask for if we get to the lobbyist we would ask for that input and help uh prioritize them based on what their understanding of is moving going to move to the legislature and have the highest priority of getting funded okay yeah and I think the two that I I mentioned with the staff for both resiliency uh type projects but there any thing that we can do because I and mention that because I know there's resiliency money out there but one of them was the undergrounding project because again that's not just an aesthetic I know some people think we're just getting rid of all the wires but to a lot of folks in this community it's a resiliency storm prevention damage prevention whatever uh project so I would just ask that that be put on there I'm not saying we're going to fund the entire undergrounding project what I'm saying is we can get some State money and some federal money uh to help us do that project which frees up money to do other things I'm to throw in the record uh councilman Bren got the motion that we did I was looking for the recommended motion we haven't had any training on how to use [Laughter] this you find it turn you got to turn on your oh I'm sorry I move for staff to prepare and submit appropriation request for the recommended projects and submit those to the House and Senate offices when requested second a second okay and I would ask that we add the undergrounding project and the other uh U project all right councilman d uh councilman Bren you are you asking to speak as well yeah okay all right councilman Dustin thank you mayor I was looking at the uh request for stalman and it has design in parentheses now we're paying back forville and Donan already for design so my question is um I would like to see money to actually do something and I putting design in there are we primping ourselves design there you go I hope the motion maker in the second will allow that it's good all right thanks and then on that well since we're talking stallman um if you guys wish I think that would be very suitable talking to Jason ay for uh the ctax dollars there's about 60 plus million dollars sitting in their bank and of course they have uh rotating uh projects coming up but that that seems to be another place at the local level that we might be able to do an interlocal with yeah and I mentioned that last time we do a or at one meeting we do a really great job with tdd making sure we get that money to help us out but we historically have not done a very good job in fact we've done a very poor job on getting uh the half cent money and you know last year being the exception where we got 1.1 million we haven't done a really great job of getting those State dollars over here either so we we probably need to include that when we do our strategic plan planning and say here's our priority and you know Mel well Mel won't be there Drew we expect you to bring home some bacon to a good part of your District just we are actually uh some conversation we had with uh County Administration and staff um we got some good ideas of how we can move some of those project forwards and Public Works just taking a look at them and having those conversations as we speak so working great all right any anything else get to the order on this not seeing any call the vote all right I have at 60 so moved item 4 C is regarding our trash can enforcement update and uh misstina from Community Development is going to share some good information with you yeah yes good evening mayor and council members you all I see have your trash cans in front of you so the first part of this item is just a quick update on our proactive code enforcement procedures that we're putting in place for the short-term rental trash cans um you all have examples of the sticker there in front of you um we've tried to work quickly to come up with a procedure to make it more efficient in the field for code enforcement officers to be able to um when they see these be able to issue the citations as quickly as possible so we work with the city attorney to come up with the language on the sticker uh to make sure it meets the statutory requirements for a warning and so now the Code Compliance officers will be able to go out and when they see a trash Canon violation they will be able to put the sticker on it will make it very easy to see if a warning has already been issued so that they'll be able to issue a citation the next time they see that the same properties in violation uh the second part of the agenda item is current currently under the code the regulations for the time that the bins can be at the curb only apply to short-term rentals and staff has requesting authorization to move forward with a code of ordinances Amendment so that we can apply those same time limitations to all Residential Properties um there seems to be a a lot of desire for this from citizens um we frequently get complaints from people that are complaining about trash bins and currently we can only enforce the short-term rental so we'd like authorization to move forward with that and we would request a legislative sponsor if get one I would like to be that legislative sponsor thank you all right with that question on the longterm versus short term are we allowed as a city to have different warning systems for two different categories sure okay all right Council meston I speak the inclusion of a regular residential into this enforcement great majority of our problems have been with short-term rentals uh I've been asking around town I can't find a single person who thinks it's appropriate that we sck code enforcement on all the residents who may or may not leave their can out too long too short wrong day um we've got code enforcement is pretty strapped to do what they're doing to start writing tickets to everyone who's not in a homeowners association because homeowners associations and subdivisions they have the ability to regulate it themselves just just not something that's going to be real popular in my opinion and I couldn't support that all right councilman I'd like to expand on uh Bobby's question just so that I can I can make sure I understand he said there can be a different set of rules can there also be a different set of fines can you do short-term rental at a higher rate than you do homesteaded individual if we have a justification like a reason that they would cost more if it costs more for staff's time or something but we'd have to think about that have to analyze that councilwoman abar this legislation that I was going to be like you know the sponsor for is set up for we have a lot of renters in the city of dtin and a lot of the renters don't pay ATT attention to the rules and guidance um about 70% of those that are still out are in like a lot of the rental like apartments that you know like off of cyber and there's some off of Kelly and I've had renters that I've spoke to they're like well I didn't even know there was rules so it may be that they've never gotten anything because they're a renter not the owner so thoughts on that Mr dtin yep ctin I just going to make a comment in the past we had service to people's houses and I think it's still available for old people and people who are in firm are we going to be able to incorporate something into the OR into the enforcement that old folks or other folks who have an exemption and who actually under the franchise are allowed to pay extra and have the people the garbage people come and get their garbage are we going to be able to make sure that they don't get ritten up for not having their cans out or in or in a timely fashion councilman Bagby we going to answer de's question I think that was a real question yeah okay I don't know if that was hypothetical and was it rhetorical rhetorical it's directed toward staff or the City attorney or whoever may have the expertise answer question me there's Provisions in our Waste Management franchise contract where you can actually if you have a legitimate Ada issue or a handicap issue you can get exemptions uh I don't know that there's one just on age but let us um there was may may not be but there was so we'll take all your comments and see what we can come back with that satisfies the concerns so go ahead and keep telling them to us cman for taking notes yeah I would uh suggest a uh compromise here that we go non-homesteaded properties as opposed to just shortterm rentals because in that way that solves the issue on Main Street or over in Teresa's part of town where uh people are leaving their trash cans out and that solves the short-term rental issue and then the people so I would uh I would ask the motion maker to or the legislative um lead to maybe consider that yeah councilwoman I that's exactly what I agree totally with that this isn't meant for those that are homestead because 99% of the time it's an accident if they have it pulled it in but those that are renting and not homesteaded maybe apply this to them like we do with the short term that would be something I think that even those that are the taxpayers in the city would have an agreement with so can we work that into it yes question yeah yeah um because I think GIS would have the ability to Overlay for for code the homesteaded properties so that they could be driving down the street and they see a trash can they go oh Homestead of property and just go to the I mean you can do anything with maps these days so I would that would just make it easier as opposed to some of the other things we've discussed all right councilman bradden that was my question is we didn't want to put more work on Code Compliance but how are they going to determine which which home is Homestead and which one is not do we have that techy we have that information we can pull it from the Property Appraiser's website so how hard is it going to be I mean do we have that ability to Overlay something I mean the co- compliant have a computer in their truck where they can overlay it and they're riding around town and yes is that quick and easy yes okay all right Council a anything I'm read that all right I move the council direct city manager to proceed with bringing forward amendments to the code of ordinance addressing allowed time periods for non-homesteaded properties to have trash bins at the curb all right I have a motion do I hear a second oh a second by counc Bagby all right I don't see any further discussions thank you we'll call the vote don't thank us yet oh yeah me too I think that was a good compromise all right I just have it so moved thank you yeah that was good all right thank you Mr Mayor item 4D is regarding our pickle ball courts um we had a lot of interest to our request for proposal or request for bid uh however we only got two proposers or biders uh and they were signif both significantly higher than our budgeted dollars for that project uh one by doubled and the other one would have been doubled if it had included the restroom so there was some communication um error between the time questions were answered asked and the time they were answered that one of the biders left out the whole restroom facility so we would recommend that you um Deni each of these and that's not the word I was looking for but uh for reject there we go uh each of these proposals and let us rebid this uh with some scaled down version maybe eliminating the lights and looking at any other means that we may be able to uh save some money and try to come bring it within budget uh and we also added uh the possibility of some State funds to uh this that may be available uh thirdly we are looking at a neighboring community that is in the process of contractor for some pickle ball courts that we may be able to look at their contract and see if there's something there we can take advantage of so um ideally we would ask you to reject these two bids and let us uh restart the uh bidding process with a scaled back our U document for submissions for bids and look at any other alternative means of funding all right uh customman bradden sure I I moveed to reject all bids on the pickle ball court right I have a motion in a second um I'll just add in there I did not uh push for anyone to jump in there so I'm fairly confident um uh Tracy who is part of the USA pickle ball and who she's been up here with with the paddles and all that um I believe with with her help and I haven't reached out to her yet uh I think she might be able to give us some local talent who who has done this either for the pickle ball or the tennis courts um you know I just I feel optimistic with if we get her involved we might be able to pull a couple more biders to the the table uh anything else for the record Motion in for the record motion includes rebid right correct okay just confirm councilman Bren are you okay with that I don't I mean when the city manager asked us go go to the state try to get some funding that would be one Avenue we certainly wouldn't want we think it' be prudent to rebid and take a look at those in the process while we're looking looking it there's other funding to be made available as well and then it take advantage of what comes um shows itself first we're changing what we're putting out for bid yes sir we will reduce the scope probably eliminate some lights look at any other potential opportunities to save so we could get it closer to our budget number motion stands okay all right so I have that amended all right seeing no further discussion we'll call the vote all right eyes have it so moved 60 thank you Mr uh Mr Mayor and council members our next item is the discussion for the building fee update and our consulted is here and he will share presentation with you good evening mayor and councel and my name is Alan Steinbeck for those of you who are doer and Council Bren good to see you again after many years of not been of you um I'm here to present this item uh next slide please we've taken several steps to um cover the issue of of this project and we've evaluated fee Revenue across various categories we presented a um Revenue neutral fee structure in September and at that time Council adopted the fee structure but not the fees that went in it and requested that we come back at this time this month to talk to you about the actual fee recommendations we did create a revenue model as a as a part of this project to really estimate how the proposed fees would generate Revenue to match up with the needs of the division and we've um adjusted levels across fee categories but in different ways based on actual estimates of person hours required to conduct each of the types of inspections or administrative functions and on average 48% of the above uh of the what is recommended in the packet is on average Topline 4 % increase above current um feed structure next uh why this decisions now uh the building fund balance is forecasted to go negative by the end of fiscal year 2025 or calendar year 2025 uh potentially if changes are not made the fees were updated in 2022 with a 10% increase at that time we were anticipating that the fund would go negative in calendar year 2016 um and and this time around in this recent study it's actually Advanced on us and it's it's it's anticipated to go negative earlier um the cost of doing business has gone up in particular and that's one of the things that was driving that advancement cost of insurance Staffing cost and operating cost um everyone is suffering through the inflationary times and that's no different for your building division next we had uh through this process we looked at historical Revenue the actual uals going back to 2021 and including the 2024 budget where you see the revenue is under a million dollar in the actuals uh the budget calls for a million dollars in Revenue we we don't have the final numbers for fiscal year 2024 yet next uh we forecasted um Revenue based on um the trend and we looked at the uh 2024 budget your Finance director does keep forecast about 5e out for all of your funds including the building fund and these U Revenue forecasts were taken from the department and unedited um we they were backed off from the last time we did this in 2022 they were very aggressive before and they were kind of dialed down to some of the recent conditions that we saw over the past few years so the forecasted revenue is different this round than that last update that we did in 2022 uh but this shows um how it works in terms of the money coming in the fun expenditures um and the net operating um costs that go in there there's also a transfer out of the fund that pays for technology it goes back into the general fund out of the building fund and you see that change in fund balance um uh Pro projected to go down um by the end of of the Year here and um going over a million dollars over the next several years so uh meaning over a million dollars is going to have to come from somewhere else um unless some other course of action is taken to to to adjust next please um so the forecast based on the updated fee structure that we had so we took the um Revenue model that we created we plugged it in and we generated an amount of Revenue we did not do any adjustments to the forecasted cost of the department so it was cost neutral in terms of my analysis but the revenue U model showed that we would be still be slightly negative over the next um year but then the the fund would eventually go up to over 10% creating a fund balance reserve of 15% by 2028 if all goes well I would say um uh that's about two months worth of Revenue and I guess that's a any any business person out there who doesn't have two funds of Revenue in in the checking account is um is struggling so this is just a insurance policy that by 2028 you have a little bit of a fund a reserve Fund in there based on our forecasts next so our recommendation um is to raise review permit and inspection fees according to the proposed schedule um to build that fund balance up uh that fund balance can be used for Capital expenditures on building equipment and vehicles there was a $116,000 dedication to equipment uh in this year's budget so that was one of the things that we needed to roll into this calculation and that was spread out over 10 years within the fee calculation that we did but there are other things that the building department needs to spend money on and that Reserve can sort of be built up a little bit and spin in that way when you need a new truck or what have you otherwise the revenue model is just to cover the cost of Staff operations and what happens inside the building so that Reserve is important for that that that purpose as well next that's it Endo okay so we had um the the fees themselves um uh are in the packet there was uh we included the femo memo that we produced before we changed the date on it but it is exactly the same as what you all saw in September there were no alterations to that so the same information is before you I included that full report for everyone's benefit to have in the packet and um there are several attachments in there that show the fees and the structure that's being proposed in order to adopt this there would need to be a a resolution a scheduled um hearing and just like you would adopt anything we're not asking you to adopt but we're we are trying to get this finalized and scheduled for a a hearing and adoption in January is the proposed time frame should Council feel um obliged to move forward with this at at this time and and lend its support to what's being recommended okay with that does anyone have a motion that wants to start this off or a discussion uh councilman BR Bren thank you mayor I'll start it um as a said in our meeting um people don't want to get permits it's easier to just get caught and just come up here and fill out a simple permit pay a fee um instead of spending 6 months trying to get a permit um I mean i' I've actually witnessed it multiple times um you know you you skin a re re reskin a a 5, 5500t metal building you reskin three sides of it you put 20ft rollup doors on it you change those out you put a new fence new gate up on the road right on the sidewalk and you get caught pouring some concrete so you go get a concrete permit and that's it so why why would I pull a permit why would anybody want to P pull a permit cuz anybody you want to ask they they tell you it's it's it's easier just go out and do it and get caught and it is try to go through the process and do it right um so I mean there's I can't support it at all because of that I mean what there's no even when you tell Cod compliance about it they they don't want to do anything about it um so I mean until we can come up with something something different you know where you know there there's an IND Village right now I know it's had a a structure that's 90% complete it's been there for almost 3 years now he got caught but it's still still there no permit no nothing don't have to tear it down nothing um so there's there's really no consequences whatsoever you know it's it's kind of like getting caught you know going to Louisiana and fishing it's cheaper just pay the fine if you get caught than it is to buy you know $200 fishing license for three days um I mean this to me this is not the answer just just to keep increasing fees increasing the fees CU more you increase it the less people want to get permit less fees we going to get that's just my two cents on that though since we're spending so much in the technology what's what's that going towards this is that more of a staff question on what we're hoping to get from that technology investment that was in the slide you said we over 100,000 is that any anything specific 10% of our budget goes towards the technology fund so what do we know our permit turnaround right now I'm sorry do we know like what what our permit turnaround is for I know that's been something that we've all been wanting do we know where we're at as far as what it takes to get a a typical permit time of submission to issuance I mean obviously that depends it varies depending on Project I mean you know um but typically if if everything submitted like like it's supposed to be uhuh then I mean it can be turned around within 20 days days so okay but most of the time there's back and forth comments between staff and the submitter and that's what delays a project gotcha okay good to know right one inter one interation it's baked you know two is not uncommon even so but yeah councilman dtin thank you mayor I understand there need for more Revenue but I understand the people that are buying the permits need to simplify and make the process faster that right there would probably generate quite a bit more Revenue uh I can't support a 48% across the board when we just did 10% two years ago um and I and I noticed there's some big discrepancies Sumer 15 I think a permit for a new pool is 250% increase so I can support a reasonable increase but I want to see us not always our first cut reaction when we need money is increase fees increase taxes how can what can we do to to uh to make cost more efficient where can we save money so like I say I can I can understand that they need more money and I'm willing to go down that road of ways but not a 48% increase after a 10% increase two years ago too much and I want to see some improvement on how quickly you can get a permit it's really that simple I'd get a lot more enthusiastic about supporting when it became simple and quick to get these simple permits I'm not talking about a big development order complex of but fence to get go get a permit to fix my roof or to put up a fence or to do some minor repairs that needs to be something that can be turned around in a couple of days a week at the most so councilman gal are you done Mr okay I'm sorry I wasn't sure I'm a building contractor roofing contractor um I pull permits and Destin every day roofing permits turn turn arounds 24 hours as long as I fill out the permit application properly I don't typically build houses in Destin but I would anticipate that that would take a month because of the environmental plan and everything else that has to be included the Wastewater the environmental and uh any any of the other evaluations that are are required if I do a remodel permit as long as I fill out the paperwork properly less than three days um I don't see the issues unless I see where people aren't filling them out properly from my end um and if if they need help um when I needed help because we changed into that system all I did was call and somebody was right there ready to answer my questions and guide me through the software um I'm all for a permit fee increase if because it's it's it's what benefits the city overall so I I'm here to support it and I'm the one that's the the user I I use it probably more than anybody else on this Das right custom Bagby so a couple questions what what is the cost of uh doing it and asking for forgiveness double your permit fee okay so so there is a um builtin you hope you don't get caught type thing where you don't see I'm I'm kind of in between Mr Dustin and Mr gu uh I'll support an increase because we're going to have to pay the for the building department anyway so we can either pay for it for the people that use it you know who who put the cost on the city or we're gonna have to put it on the general taxpayers so I'm maybe not a 48% although the the pool thing jumped out at me too but I was like well if anybody can afford to put a private pool in their backyard they can afford to pay the $250 or $400 can I can I make a comment regarding the pool permit and the Fe pool sure yeah in your p in your packet there's um an attachment called permit fee examples and I don't know if you had a look at that so I plugged in all the numbers for this particular new pool which was an expensive pool by the way $126,000 pool and the the cost of the permit the actual cost of the actual permit for them only went up by 28% because it's just the building fees that are going up not the planning fees and not the engineering fees that that are also assessed on this permit so just the pool full permit fee went up out of of its totality what the customer had to pay by 28% yes you're you're walking in and out of the door experience is not affected by 48% when your to look at your total costs this is only just a portion of what a normal applicant who has a complicated development project would need to pay how much would that permit be at $120 Something th000 pool that that pool permit originally was uh [Music] $514 because the building division only charges $66 and a $55 admin fee and a $33 review fee that was all the building division got off that permit the rest went to planning and Engineering planning got $105 engineering got [Music] $137 so planning engineering made more than the building division did on that permit and the building division had to go out there four times doing an inspection that money did not cover our cost okay I'm going to reclaim my time I think we've gotten down Rabbit Hole here the the point I want to make is the same point Mr dtin wanted to make and I and I understand Mr G and and he does he's probably he probably pulls has pulled more permits than all of us up here combined but we have to stream you know technology it has to be quicker faster cheaper so that I'm I'm glad he can get would you say a roof within 24 hours or a 24 yeah so that ought to be you know anything it shouldn't take over a week unless it's a really complicated and I understand review I'm just talking about the permitting okay the which is the review is part of but trying to get I go in and a month later I might get my permits well actually I could get some permits I just might not get the overall if it's a complicated project right so do we wait let me ask this question because I don't know as much about this as you know Mr guile or or M Mr Braden or probably anybody up here if you have a project detailed type project where you get multiple permits right can you have that I mean you can I mean a new single family home could have up to uh five six permits right because you got one for the new home itself from the contractor then you got your trades right so so do we wait till all the permits are approved or the roof got approved in 24 hours and the plumbing got approved in2 hours typ they're typically all submitted separately by each contractor trade contractor so typically it's the new home that comes in first and that we kind of serve that as the master and then the trades come in behind it but once the the the trades we don't even review cuz you've already got a master house permit per se so we know the trades are going to come in and pull the permits to do the plumbing the electrical those don't even go through review those just get issued okay so what what takes the longest other than a commercial I don't even want to get into the commercial realm I mean it just depends on the project to be quite honest with you uh Mr Bagby um anything that has to go through all divisions for review being planning and engineering and building take the longest so that would be your fences that would be a pool that would be a new home that would be so but simple changing out doors and windows that's just the building division review okay changing out you know putting on a new roof yeah that's that's a day or two okay so um changing sighting on your house that's just building that's just a couple days those are very easy reviews all right so if I do a remodel and trade permits changing out at hbag system remodeling the interior of a home those are all very easy but when you get into aspects of the whole site where you have to have it reviewed for storm water and you have to review it for Land Development code requirements then that gets a little bit more in depth okay I I guess my my thing is how do we get it faster or more efficient or easier for the contractors education education okay yeah but yeah I'm not opposed to raising the fees I just want us to be as efficient as we can be and you know I've got one side telling me we're we're pretty efficient I've got one side saying no we're not as you know it took me 3 months okay and I'm not going to say well that's because you filled it out wrong four times you know which may be the case but I don't know that in my experience working in other communities the number one way to save yourself time is to come in with the right package of materials that the municipality requires you to submit to get what you want to get out of them and a lot of times that doesn't happen so right out of the gate it's so start off with a bad experience where you you have to get that call saying you didn't give us what we needed and yeah so the education part is key um we did try to make some improvements and simplify the process and make it less complicated which helps your staff which sometimes come and go and need to learn these things they're going to be more effective at helping people and your customers are going to be more effective at understanding what they need to do in the system through some of these simplifications so that'll help some in that situation um otherwise it it is a it can be a very difficult experience if the team of Engineers and developers are not are not working in in good faith to get what's needed and submitted and that sort of thing so hey I got one more question do we because I deal in metrics a lot in my business can you tell me how long it took for the average permit or various types of permits four years ago versus today how much we've improved the system we should have we should be able to pull that data from our system we well we I know we brought it up during the um um vision visioning and when was that April February um so I I could pull that from there but that's yeah I'd I'd like to see because if we're improving and we've made good improvements okay uh I'm the more we've improved the more I'm willing to raise the fees cuz we it's got to be paid for that's the bottom line we're now we're just talking about how we're going to pay for it and I really don't want to use money that we're going to use for storm water or dredging the harbor or doing other things to pay for the building department no no offense but I want the dredging money used for the dredging not the building department all right councilwoman abar thanks mayor I kind of agree with Jim and I kind of with Dewey I know that the incurred fee sounds like like a lot but I'm glad you clarified with the swimming pool one we put a pool in it was $55 okay so I personally know that putting in getting a permit four or five years ago was almost like a two three week process and in the last couple of months I've talked to people that have done the same thing we did and within three days they had their permits so I do know the system is working and I do know that we need to charge more money because we have to pay for our building department I mean the role over and turnover of staff is very hard but now that we're getting the system down to where people are coming in it's easier to train them on what to do because it's not as tedious and I think didn't we thin out some of the like the way they were all spelled out no well didn't we break it down and like combine some of the permitting requirements you talk to that yeah you said we we reduced in this proposal some of in this proposal what we did is condensed the permit fee the permit stru not the fee structure in other words we eliminated you know just the HVAC chain out is this this much it just was too cumbersome the trades in particular have been significantly um streamlined which when you're out there running and Swinging Hammers and doing stuff that's when you need a permit quickly when you need to go out there and do your thing so you can get out the people way and that so I think the trades will actually benefit significantly from this once that project gets going well I I just wanted on the record that I'm going to support this because we've got to charge more we are so if you look across the cities that we're compared with it's like we people are paying a nickel here and they're paying $20 there so it's we are not charging enough for for a decade now so we've got to do something different it's what's working is not working for the city or for our department right Council m g um I just want to clarify just a couple little things first if we can compare what it takes to get a permit now to what it did 20 years ago it's going to take longer because they're holding people's feet to the fire back when I first came to Destin in '93 when we used to pull a permit it was more of a hey we're going to be pulling the permit go ahead and start the work before we actually do the permit and the permit would be in process while we're actually doing the work now that was illegal that was against Florida statute but it was it was allowed um now thankfully they don't allow it anymore and or they enforce it more now than they did 20 years ago but um now they make sure that they verify your insurance your ler your workers comp your gen Li um and your capabilities before they actually issue the permit back then it was kind of a I hate to use this term but a good old boy system so um they've eliminated that which means it does take a little bit longer now than it did 15 20 years ago to pull a permit because you have to go through the process um there was another point I was going to make and I completely forgot what it was it's going to hit me at 2 a.m. I'm going to wake up in the middle of night and I'm going to remember exactly what it was but if we do base it off that Matrix the metrics of where we were 15 years ago versus now we have different different leadership I love Larry Boward great guy but he was pretty LAX on a lot of things in progress versus what it is now um and I'm I'm just GNA I forgot the other one I thought maybe making that last comment would spark it but nope I can't remember what it is to save my life you guys locked out and I I'm to say I can't wait for us to get to the visioning session because I know this council is different than uh last last meeting's Council but the previous one at the visioning session we were all very much in four finding the Specialties and letting them pay their way so that we're not subsidizing development cuz that's what this comes down to when you see that number go negative that's our taxpayers quite literally subsidizing development and Destin and I think you can ask almost anyone I don't think most people care that their their hard-earned tax dollars are going to offset someone else's uh project and us doing our due diligence so I I just I would hope that we we can move forward and again just for clarification tonight we're not we're not setting fees we're just trying to set a date councilman Bagby yeah I'm I'm close to making the recommended motion with some um changes and here's the ones the the ones that are over 100% okay I really want you to relook because as I went through besides and I I'll just say the pool ones but the ground signs you know 191% increase the pools can you say the not the per attachment C okay attachment C so I'm saying the percentage of increase in the I mean I can read the whole thing but I don't want to do that can you say the the number of dollar and amount so follow along okay so the on the pools the new commercial pool going from 165 to $330 pool Renovations residential or commercial $55 to $165 new residential pool 66 to 240 so that's 100% a 200% a 26 64% increase which gets pushes that 48% you know I think you can get down to 28 or 30% if you relook some of these kind of and I understand we probably have to pay somebody to come inspect pools cuz we or pay them to go to school one of our person one of our people but I I want you to look at the triple digit increases and just see like a temporary tent I get that weddings or whatever or I think you've had a couple of events where you put up temporary tents um next door to the place on the Harbor you know temporary tent is going from 2750 to 60 so that's 118% increase um flood plane from 55 to 150 that's 173% increase New Pools again for the electrical the pools the Spas Etc 4 $44 to $120 for 173% increase so I would look at some of these but really the other place that gets us on these increases is the reinspection fees and I really don't have a problem with that yeah you know because we're saying the first reinspection is going to go from $ 3850 to $80 108% increase yeah because you shouldn't have called us out there if you weren't ready yeah I agree with that and the building second reinspection goes from 77 to 320 that might be a little Lous but again you shouldn't have called us out a second time when you weren't ready um so now I got to go back up to the page with the motion hang on what does it cost for a tent in another city I don't know do you that's a what's a tent cost and I don't I what's the temporary cost I'll tell you what it is it's $100 down in South Walton to put a tent up temporarily we're like N9 10 years behind on making changes to these numbers I hate that it's 110% or 300% but when you don't raise fees for 10 years you're going to look like crazy numbers because we're so cheap it's ridiculous and that and that 110 or 120 or two 200% is one line item fee in the whole fee for the that permit it's one line item that's it there's other line items in that in the total fee for that permit so that's what I'm saying for that new pool that that jump to $240 the overall cost of that permit only went up 28% not 240% and I'm going make a motion uh that city city council direct staff to bring this back at the next meeting with or the meeting where you can get the metrics of how much we've improved over the last since we raised them last time 10% so we raised them we've improved the process we've combined them condensed them whatever and then relook the numbers uh where there is me personally I'm not going to put this in the motion but anything over 200% is going to jump out at me it reinspection fees I don't care but some of this other stuff I probably will care so that's my motion to have you come back with both the process Improvement metrics that you have and a relook of these numbers based on everything you've heard from up here future okay gotcha and do I have a second okay all right I will second that push the button you got to have the button down for you before you second I'll seconding it C that made it all better yeah yes you are you're up next come some G okay I remember what I wanted to talk about I blame Waste Management they filled these things with candy and I've been sitting here using candy so I'm on a sugar rush so I'm pretty sure that's why I forgot my train of thought but one thing I did want to talk about um I was getting quite a bit of since I I am building contract I was getting quite a bit of emails calls and texts about uh building departments issues I did a bunch of Investigations I even investigated through next door some of those were they were trying to bring contractors from out of state that weren't licensed in Florida one of them I believe was a swimming pool uh somebody was trying to put in their yard brought a LIC unlicensed contractor in and then they were complaining that we weren't issuing permits but they had the wrong contractors I did several other investig ation where they had invalid surveys they were out of date they were trying to implement uh dos with significant changes so I've done several investigations on a lot of these complaints and almost every one of them was the uh users or the the applicants errors um I didn't find anything that stood out as to where there was a significant delay on the uh building department side but I did want to bring that to to your attention that I this isn't something that I just idly accepted I I actually followed through with quite an extensive investigation all right c d thank you I hope uh tor's experience is what's really happening but I can tell you that I've gotten a lot of complaints that would be contrary to that people who had trouble getting permits and it may very well be that they don't know how to fill it out and you do unfortunately that's something we need to fix too that is not so complicated to F fill out and and in support of Mr bagby's motion I would feel comfortable with a 20% increase that would put us in Black for a couple of years probably during which time we can work on alternative to constantly having to raise fees to fix these problems and we can see how we improve the permitting process so you know that's my advice to the uh the city manager I'm I'm going to support some increases because I know they need the money and I think that uh we're not out to try to defund inspectors in the building we want them to be able to function by the same token we can't always fix our problems by just raising fees so I think I've said enough all right and I think the Slate is clean so we have a motion in a second so we will call the vote all right 51 eyes have it he I wanted to do something tonight are you're running the show for us all right next item thank you while Mr Alan's still here we will talk about the uh Mobility fees study and the recommendations thank you Mr city manager I um last time we came before you we had a what I would call a preview of the fees we were in draft status in terms of the fee study and at this time we have completed the fee study the fee study is the legal document that must be prepared in order to have a compliant Mobility fee or impact fee they all require this kind of study that study was included in your packet and is the technical findings of the analysis to update the fee table which in includes uh different types of fees and different types of land uses as well as a new fee schedule to um set the fees so that they can pay for that $30 million of projects the phase one of the Mobility plan um we as we've discussed in the past the Mobility plan um there's no mandate to um implement it but the mobility fee is the way that most local governments do this and um that $30 million is estimated over 15 years in the calculations so in theory uh you would be raising 30 million or $22 million per year but before I even get into the slides I want to remind you that uh you probably looked at the table in the packet and thought holy smoke these numbers are High um and um it doesn't mean that every applicant is going to pay those fees in fact most of the the vast majority of people who come in will not have to pay those those same exact fees because you are credited based on the existing development that's on your property so if you have a property in destined with a building on it and most people do then you're going to walk in the door and get credited for that building when you go calculate your Mobility fee for example the brand new publ out there paid $0 in Impact fees because of the credits that were available from the movie theater and the shopping center now phase two of that project will probably not pay zero mobilities but it's a good example of the size of a project that can be built and still get down to zero and not pay anything so um that if everyone paid the full fee it would be about $2 million a year that would go to implementation of Transportation but but the fact of the matter is you're going to be somewhere around 50% and generating a million dollars a year and whether you think the fees are good or not at the levels that they are I think we also have to ask ourselves is a million dollars a year enough money to fund the expansion of our transportation system to meet the new demands of people who come in this development um the city has been for a while um using capacity that's already around in the system that's here to support new growth and strains start to develop when that happens so um this fee is intended to deal with those issues it's not intended to deal with maintenance you're not allowed to spend the funds on maintenance but it is the capacity improvements in the projects and the plan if if a applicant comes in and they're making improvements that are either part of that plan or something that's required in Your Land Development code then they're entitled to um that discount off that fee as well so if I'm out there building a turn lanane or some kind of sidewalk extended beyond my property for example I'm going to get a discount on that fee as well so um those are some of the essentials of how this works and I'll get into to the presentation now to go through some of the details and go so next slide we can just keep going next slide uh the legal framework uh we've talked about the four statutes um in the past basically uh they encourage multimodal funding strategies and Mobility plans the Mobility plan and Mobility fee structure is a preferred way that the state wants people to do this kind of thing and they also encourage um other types of of policy um initiatives that local governments are enabled to make including um having um incentives and write Downs of cost of these fees when they want to do things like a specific Economic Development incentive incentivizing development in a specific area or um how even housing incentives can be built into the fee structure next um the mobility fees study and Associated fees must be adopted within 12 months of the beginning of the fee study so we've now created a fee study for you we've been working on it for uh since right before the Mobility plan was adopted um I could probably make up a date if I had to about when we started but but we can't have what we've produced on your behalf sit around for more than 12 months and have it still be out it would need to be done again so that's the time frame that you have to adopt this um we need to provide 90 days notice before the fee increase becomes Ive and there are two publicly noticed workshops that must be held um assuming that some um forward movement is is on we would need we would desire to schedule these at the beginning of the year at least the first one um to get the conversation going about this topic next slide please U the fee must be approved by a 2third majority vote from city council and that's a statutory requirement the mobility fee and study must meet all the requirements um in the statutes which um also have um uh some information about um the extend extraordinary circumstances under which you can increase fees Beyond 50% and we have documented those extraordinary circumstances in the study those the way that was documented and described was approved by a very serious legal department in a previous study that I did so I feel like we've got a good legal sound basis for um doing that although I highly recommend a legal review of that language before you all adopt to make sure that your Council has approved what's in there next uh we took the um uh there's this this is the the the fee study itself is um has some really technical jargon in it um and that is to substantiate how we made some of these assumptions when you look at uh the trip generation manual that doesn't match exactly all the uses on our table so we had to do some interpolation and number crunching that's all in there to be documented um but the first step was to calculate um a standard Service Unit and that is the equivalent dwelling unit you see that in there as the basis so a a typical house would have one house worth of impact on the transportation system a restaurant might have five houses worth of impact we've just normalized the impact by that that common currency if you will regarding the transportation so each land use has a number of trips associated with it which is turned into an equivalent dwelling unit which has that dollar sign associated with it so the amount of dollars per that dwelling unit is the basis for calculating the rest of the fees um so that $114,000 number is the the base um information that's used for the whole fees um we looked at how much development is anticipated out to 2040 and we divided the $30 million by the number of equivalent dwelling units that represent that change in growth over from today to 2040 15 years of growth the $30 million is divided by the amount of that 15 years of growth so that each individual component part of that 15 years of growth pays its proportionate fair share of the money and that's how the fees get calculated next um we uh let's see the the I just described what happened on the slide next slide um so again that total cost $30 million is the phase one of the Mobility plan for those of you who and I've been watching closely as we developed it Council recommended and and and directed us to only use the first phase of the Mobility plan as the basis for these calculations and we determine that 40 that basically the equivalent of 2,000 houses worth of traffic impact and transportation impact will come to the city over that 15year period meaning that each one of those is that $14,000 number next uh these are the projects that are listed you are you are not bound to implement the projects as listed in this you can change your priorities you can move projects around you can add projects to the Mobility plan as this Council and future councils determined to um Implement projects you can decide how you want to use this money you just need to go through the official channels of updating your list and making it a affirmed policy statement that you want to implement this project and the fee can flexibly be applied as you all determine that is in the best interest of the city next uh the the residential you see there's um a variable rate option we can either have a single family residential unit have a fee associated with it in this slide you see the current fee of $1,172 and the calculated Fe had that 14,000 we've already had some discussion and suggestion that that you all would want to Discount that fee and that is an inherent part of my recommendation back to you as we move forward that's not included in this presentation but some where between $0 or the current fee or some other amount could be established uh so that your um your residents who own their own properties and want to rebuild aren't coming in paying thousands and thousands of dollars I can appreciate this having had worked on my own house it's very painful to go in and pay thousands of dollars worth the fees on top of your contractor bill when you're when you're a resident building commercial development is different it's a business model people anticipate it it's just a just a way different experience for people so um we are going to work to to pencil out something specific for the um single family detached number um and we can discuss that further on if you would like to but we also have calculated the options of charging homes based on square footage um to accelerate the schedule as you move up to a bigger sized house next slide please um we also came up with a short-term um rental residential fee which is significantly greater than the um long-term residential fee the uh these types of units as you know are very intensely used and so the amount of people in there was used to calculate uh that higher burden of cost and that difference could be up to $330,000 per unit or more depending on how big it is and if we adopt this kind of schedule I would note again for your for your knowledge that if you convert an existing um long-term occupied house into a short-term and you come in and get registered as such you will have to pay this fee so the difference between the house whatever is determined for the regular house and what's on here so you might have a $30,000 bill when you come in the door to establish a short-term rental um and that is actually if you get caught with one that becomes your penalty having to come register so that is a big number but I think it um technically it's supportable in terms of the actual impact and everything I've heard is that you all want to capture the the real impact of those projects and be able to respond to them with the funding that comes out of this kind of fee structure next slide please we went through the commercial um I I have um these numbers at this point once you generate that value per house number the rest of it just becomes looking at the it trip table in multiplying that number by the number of trips that the engineers say a typical type development gets has in it so there is a the it is a National Standard it is the industry standard and we are using those direct rates in here um and so um we we have um come up with some numbers for this study that are significantly different from what you have on the books and much higher again those apply to um different uses across the board next please um and again this is the comparison to uh the current fee and the other fees that exist let's keep going please next slide um so there are several options for fee structuring um you know just adopt the fees as is which uh which would generate that um $1 to2 million a year depending on how things happen with Redevelopment um adopting recommended fees as a percentage for example 50% of the max recommended fee where you set that equivalent dwelling unit at $7,000 and then everything gets adjusted accordingly uh to that number um apply fee discounts to encourage specific land uses or by type of people there are some uh fair housing and equal protection considerations that are that that lie at the edges of policy that we have to be cognizant of and careful about otherwise having work for housing as a basis for any sort of housing incentives is a legitimate purpose to do so um and then uh you know some combination of options or going deeper dive um if these commercial fees are a little seem a little outlandish there is the opportunity for us to go back and investigate any line item of these and make an adjustment to the it trip table based on some professional judgment and additional analysis that might get that fee back to a place where everybody things that make sense but I'm going to do that based on guidance rather than me suggesting what that might be so just a question while I SP along with that slide on right now it's about we can we can cut it back if they cooperate with things that we're looking for them to do in the development that could then be the way to Discount that top price because this would be as high as we go whatever these fees are set that's the top anyone would ever pay and then we have ways to walk it back if they go come in line with B basically our comp plan and our vision of what we're hoping development becomes that's a good point mayor once you set the fees themselves you can't you without revisiting the study you can't raise them to create a penalty or be punitive to something you can only discount them so setting them higher and then taking discounts as your policy priorities suggest is is the path is the way forward yes all right well with that uh do I have have a motion you don't have can I Mr talk about that yeah let's talk about the schedule so that you all know like what the the the next steps um the the fee study is complete and um you know it's basically a final draft ready to um be accepted by you all it does need to be adopted in order to become the substantiated legal document at some point um the the study is those raw numbers it is it is un encumbered by any of my own bias or perspective or any adjustments to the numbers it's just the raw it trip generation rates that come out of it so it's it's it's it's um unadjusted at this point um the the the fee schedule will need to be adopted put in your Land Development code there will need to be LDC um language that's created there is very very little language about in the Land Development code about how to administer impact fees but things like how you apply discounts how you apply your policy priorities and that sort of thing really warrants some language so that your staff and the um developers that come in here aren't arguing without any guidelines about what to pay and so um we've talked about putting the code in place and trying to have the code language um find its way through the the policymaking process at the same time as the fee itself is being reviewed like any LDC update you need two public hearings so there may be some opportunities to have combined public hearings for the code and for any fee adjustments that are made at the same time at the same schedule so that any stakeholder who wants to review them has a full scope of what's Happening um in terms of your future approval of some solution here so right counc that concludes what I wanted to say thank you so much question a second counc dtin mayor I had a number of questions but my first one would be do we have a legislated sponsor of this I take it we do since we had a a motion in a second yep so those are sponsors is correct um if you want to call them that I guess well either they are or they aren't if if there's no sponsor for this it shouldn't be on our agenda and shouldn't go forward we've been working on this for over a year what do you mean I'm sorry I'm not I'm not tracking okay trying clear that up and then I have a we're getting back to the rules here Goa yeah and and another question do I understand this correctly when we adopt this our transportation fees that we have in place now those go away are they in addition to this they go away the impact fee transportation fees are replaced by the mobility fees construct and and it appears to me that this is way more complicated and I'm a little bit uh apprehensive about that the calculations are complicated Mr Dustin the the the fee table will look exactly like the one you have now and in the end you'll look up your use there'll be the fee and on the user end it'll be a and that's not the part I'm talking about okay the uh where we give discounts we that's quite quite complex and complicated that's not present in our in our present impact fees and so how we worked that out Devil's in the details that's very important um and it and it appears of course that fees are outlandishly more expensive than what we have in place now and I've heard it argued that well that doesn't really matter because we're going to going to have these discounts but we don't know what these discounts are at this point and I'm not even sure how they can be put in place in a fair manner so I've got some real reservations about going forward with this Council Bagby I don't even know where to begin but I I'll just start and I'll see where we go the unlike the previous fees that we were discussing we we own this whole puzzle okay if we don't want to do these fees we can take some of these projects off the the table you know that these fees are our funding so if we say well I want to cut it by you know 30% all we got to do is say we're not going to spend any money on the power line easement multi use path we're not going to have one of those you we'll just have sand you can walk through the sand and and are you telling Pat that or am I well I'm not telling Pat that I I'm voting for The multi-use Path because he got me the money for the uh four-prong lake so I I understand how this works okay uh but all I'm saying is the point I'm making is uh if if the fees are too high and I and I do think there is the uh ability to misunderstand what these fees are because of discounts and all this other stuff so I'm going to ask you a series of questions to try to help clarify that how many vac Parcels in the city of desen anybody have any idea anybody on staff okay so at the next when we bring this back if if it passes and we have our first public hearing I want to know that number and the reason I want to know that number is because pretty much those are the people that pay 100% okay if I have a house and my house gets totally I decide to tear it down and build another house a single family residence because that's all I can build on my lot I don't owe anything I haven't unless I you know make it four stories tall but oh I can't do that cuz I can't go above 35 ft so which I think I could add a story but I still wouldn't have that much more space because my lot is is f it just won't support that so that's what I want to know why how many vacant Lots because those are the people and I'd like to know if we can how their Zone you know what their uses are potential uses are because that would determine you know what they're going to pay so they're they want that's a big enough enough lot it's a commercial you can put a hotel on that lot which is my second point I want to Jack the rate on the hotels and the car washes and the other things that we have enough of in this town through the roof because I want to disincentivize that type of development and that's what this this process allows us to do is say we we have enough and know by the way staff that means you'll have to go talk to the county and we'll have to go talk to the county because that little strip out there that's not in the city I don't want to just push hotels out to the county land out by off common drive because then it'll just be hotel hotel hotel oh wait that's what it already looks like so it's getting there uh yes but I I want to we have enough of those so I want to stop those and I don't care if you make it $100,000 for a hotel because I I looked at it and I think the hotel was like 20 something th000 or 40 something, I have to get down here shoot hotel hotel motel is it your room is that how you guys what's that is the hotel motel 310 is that per room yeah the room is U so it's 12,000 per room room if I'm reading that right see I would make it 15,000 20,000 per room I'm with you on that you know and on a car wash if you got you know 28 vacuum slots or however you however you guys compute it yeah yeah I I can appreciate the sentiment from a from an economic de development point of view and like a community building point of view yeah uh the there's no fair housing issues on hotels and there are not but car washes that's what I'm trying to prevent and mattress stores it gets back to the issue of you of the the punitive mindset right is misaligned with of the ability technically to to punish people I'm not punishing anybody this is what I want my community to look no I know I know but I mean if but given the given the base assumptions that we've made about it there's only so much dark Elven Magic that I can throw at this under the black box to to generate the numbers you're talking about without possibly running a foul of some of the assumptions I'll have to go think creatively about this on your behalf think think creatively about that and then there's a lot of discussion on the single family residences and I think that's where most of our pain is going to be uh both from our residents and probably from us the the question I have is uh you say well you can can change it VAR make it a variable based on square footage okay that makes complete sense to me right youve got a 4,000 foot house you ought to pay a lot more than if you have a 2,000 foot house I also want to know if you can layer location into that and the either based on how we divide the city up in the seven Villages or whatever you know we're going however we're going to divide it up because no offense if you're Waterfront particularly if you're Gul front you know it ought to kind of resemble the and I don't know how to do this but you can creatively think about this the cost of the lot I understand you know if I have a lot in Crystal Beach uh a similar size lot off Third Avenue it is not going to be near as expensive but I'm I want to buy I want to be close to the beach and I'm willing to pay more for transportation fees on a undeveloped lot you know I wouldn't pay that much more because I already have a house there but what I'm saying is if it's a undeveloped lot and it's Waterfront or it's out in Crystal Beach or on holiday aisle dude I you know you can also apply that bonus location cost or whatever I don't know because we have problems with transportation in Crystal Beach and holiday we have problems throughout the city but particularly during the summer out there so I don't know if you can do that but if you can creatively think about that not just say we're going to make the variable just square footage but where that square footage is and then to Mr des's point if you could bring us back some uh examples kind like what we did on the building fees uh you know she said well this is what the new pool and it's $126,000 pool and here's what the fees would be today and here's what the fees would be whenever we approve whatever we approve yeah you too guys I mean I don't care if y'all get jacked up that's a that's why I don't have a pool but no no no I'm saying just give us some examples because I think a pict picture that picture will help people understand no yeah you're going to pay $20,000 if it's a blank lot and you use it for what it's you know allowed there today uh but because you have a house there and because you already have a garage and a driveway that accommodates eight cars you're not going to pay anything right if you completely tear it down and rebuild it so that there's we need to minimize the oh my God I'm going to have to pay no you're not no here's what you would actually owe yes okay yes um and again I your your comments are well received Mr babby I would I would remind you that we can we can do this but we it's harder to do this to somebody it's easier to do this to the people that you like than it is to do this to the people that are the uses you feel may have been overbuilt in the not impossible but I'm saying there's a limit to the dark arts that I can employ to do that for you from a technical basis there may be some the policy part of it uh has to be coming from you all and directive as such and we what we come back to you with has to be meaningful for you all and really feel right so um and the reason why I didn't bring you a bunch of ideas tonight is because I'm because it is complicated it it does open up cans of worms to to start talking well these people benefit and those people don't you know that makes it messy technically it makes it messy politically but I think there are some sound principles that I'm hearing from you about supporting Community uses about making sure that existing residents don't get um thorted when they come down to pay their fees say you you you know this community you've been around here long enough so the one one of the ones that really jumped out at me was the church synagogue so the 2005 fee was $794 the current fee is $883 the 2,24 max fee from the feast study for a church synagogue $1,577 I I I want more churches I want fewer car washes fewer hotels and fewer mattress stores Okay so how we came up with 11,577 for churches and synagogues just blew my mind the same thing with schools you know we're either going to have to expand the heck out of our school not our job I understand it's school board or we're going to have to build another one because we're just bursting at the seams and so the elementary school was nothing in 2015 is currently $354 and we want to jack it up to 3,778 I don't want do that I want to incentivize or not disincentivize schools being built so I I get this and it came out of the book and everything but go back and apply some common sense before you bring this or it it will be a blood bath and then we'll just we won't get any of those $30 million worth of projects because we won't have a fee and that in that process you're describing it was anticipated by me I did we're like I said we're bringing you the raw numbers at this point and we need to react the the daycare stuck out to me like who does what community has too many dayc carees zero right so why are we why are we making it difficult so um yeah so we can look at the community uses and that's how I would describe it Community serving uses rather than visitation oriented uses um and or what other whatever words don't cause a Ruckus um and sort differentiate between those two things as much as we can and go to back to Discount would be my recommendation those Community orent uses down below that's the that's the policy incentive and um if there's someplace that feels right right where it's at as presented tonight then we leave it there if you think it's low too low we can try to figure out how to make it higher but but since they're all seemingly very high I would recommend taking those uses that are desirable and giving them a a policy oriented yeah and my my last thing is you know this screams for a council public Council Workshop it really does two of them right we did but we have new council members or returning council members or whatever who really yes they could have come to the public workshops and you know voice and say that's too high but now we have numbers now we have hard numbers that people can put their fingers on and say oh because conceptually here's the projects we want and we got to get the money to pay for them and here's how we're going to pay for them through the thing but when you put those numbers through the process the little meat grind you ever made sausage I've made sausage so when you put it through that little sausage maker and all of a sudden it comes out the other end and it's like oh my God $1,577 for a church no it's it jumps off the page at you I I realize that it does for me too when I see so I I would even so just for a point of clarification the motion has in there two publicly notice workshops required for the mobility fee adoption so it's we have to when we were discussing it at the staff level this afternoon we we were we were talking about having that first public hearing be an open Forum where it's well but to have a have a little W Workshop of these specific ideas brought back to you where you can consider these policy options for adjusting these fees and it's done in a public forum so that anybody who wants to hear what's going on at that first official public hearing can hear your your deliberations over those those things and and weigh in on them if they I hear that we get one CH you get one chance to make your first impression because people haven't been following this for the last three years or whatever and when we put these numbers out there we'll have 80 people in this room all screaming at the top of their lungs that you're attacking their church or you're attacking their daycare or you're attacking as opposed to if we have a non-confrontational hey here's here's our numbers you know where we can just kind of discuss it not necessarily make decision I don't know that that's just me I'm not going to make a substitute motion I'm not trying to dissuade you from having a workshop but Our intention was to have a an airing out and I and I think us coming back as a staff and team with specific proposals that you all can consider next would get us a step in the right direction um before whe and however that gets vetted either in a workshop or more formal environment um I agree there's risks in you know starting a brush fire uh over over something on this topic so we should be well all right well he's gonna have it on the streets tomorrow councilman D is going to be having postcards sent out the public hearing is open uh all right okay Jim's mic's off all right Council M so I have a question about when we start talking about the uh Mobility plan with the short-term rental obviously but um so if somebody tries to to build a home and they they say that their plan is just a single residential family and then they convert later is there a way to back charge them for that uh Mobility fee that they they avoided there is not and that is the Dirty Little Secret of this if you had a if you had a user who just somehow didn't pay their fee and I I can assure you there's some cases like that in this town um and there's no record of the paying doesn't matter at all what fee you paid previously it only matters what the size of your project is and you compare that project to the new project so fee payment history has nothing to do in the settlement of discounting and all that it's the building itself all right and that brings up a question where are we on our short-term rental registration fees I mean is that coming back to the table anytime soon I thought is that something that's I thought that's something we we kind of said we wanted to have on one of the agendas future the condo Fe we are working on it yeah that is on our list of things to return to you that we haven't got to you yet but they are coming all right and one other thing that councilman Bagby said earlier about the churches I love God Jesus Christ my Lord and Savior but you can't swing a dead cat in this town without hitting a church there's a new church that pops up every single day and these churches don't pay taxes but they can pay a Mobility fee so I have no issues with the churches being on there at that elevated rate because that's a one-time fee and then after that they've kind of got a buy moving forward I'm done comment was separation of church and state may be an interesting point in this whole game as Tori said thank you good all right counil woman neighbor um something that Tori just said I'm just okay so somebody has like a single home with two bedrooms and then they decide they want to update it and change it out and they put in six bedrooms there's no other there's no fees there's nothing extra that we can charge somebody that's going to put six bedrooms into a two-bedroom home like by extending out into their backyard well in expansion of this of a place you have to play you have to pay the the increment of new stuff that fee would be applied to that increment per bedroom um in this case we have a size range but the we have some per bedroom calculations that can be used in that case if if that scenario needs to be articulated in that way then we can do that that's a good point all right I see no other discusss unless I'm looking at all right seeing none we will call the vote the question this is just to bring it back this is just this is for the two public hearing yes this is going to move to the preed the two public noticed workshops got all right eyes have it so moved noticed workshops required for the mobility fee adoption is that the correct terminology hearings would be the state statutory appropriate statutory language all right so for the sake of legality shall we make another motion with the correct verbiage yes you technically yes you can we knew what you needed to do but this does not preclude you all from having a workshop prior to scheduling the now okay thank you um next item is the TDC monthly report that you found in your packet Mr Bagby made a interesting observation that I believe he said it was the lowest it had been in four years um so it's something we probably need to keep an eye on and see if we got a trend going on if this is an anomaly but I suspect we're going to see there's a trend that we're going to have to pay attention to all right uh councilman Bagby that's I was just going to point out that uh this is the lowest one in four years so four four okay okay 2020 right next item uh you have minutes from your standing boards and committees for your information there and then we have a number of announcements from Dr Young a few council meeting ago Mr Dustin had asked us to look into the possibility of having more fishing opportunities for teenagers at the Docks at the harbor and we've now met with a number of individuals right now we're looking into whether a training some type of educational component where we talked about rights and responsibilities could be incorporated as part of the process of receiving a permit to fish so we've started conversations with some folks at Dustin high school with the Okaloosa County Sheriff's Office and and FWC and we've asked the harbor Waterway board to take the lead on this project at the last council meeting Mr Bagby had requested more data on the intersection of Highway 98 near Whole Foods and whether that intersection is among the city's top 10 most dangerous it does not fall into the top 10 however it is number 11 in in addition Captain Fon helped me understand the if you compare that intersection which does not have a traffic light with other intersections in our city that also don't have traffic lights it falls in at number three for most crashes do you have the total crash number no Captain fum I had done a sorry I had looked at three years of data um I think you had a fiveyear data thing and for um for that intersection for three years the data was 32 man what the number one was Pro I got it pushed the number one nontraffic light was probably down by the bridge right uh no number one without a traffic light would have been actually Palm Street 98 with 62 okay where's Calhoun on that calhon fell in at number two okay um but also Calhoun has been redesigned to where it's a right turn on only in the middle of those dates so I think you're probably going to see that number drop there since it's a right turn only now but I don't have enough data to support that okay thank you thanks our mural at Captain Royal Melvin Heritage Park is nearly complete our artist Kelly Pier is in New Orleans this week working on another mural but he'll be back next week to finish just a little bit of details um on on it Tamara I had I had two different emails asking what is the cost to the city for his work $7,000 we had budgeted for $8,000 I think that's fantastic because I've seen other things that he's done triple that price for half of what he's doing he he was he was working very kindly with us for the last year um to to get here yeah he's done a very beautiful job and then uh once he finishes his details next week we will be putting on a clear coating that lasts for about a decade and the idea behind it is not just for you know any slime or Grime that gets on there but um should and you know someone do something with paint on there that shouldn't be on there it's very easily for uh easy for us to clean it off so it's a little bit more expensive but worth it and it's all encompassed in that $7,000 the Town Center CRA advisory committee currently only has one active member the other four members whose terms have expired are not considering reapplying for various reasons so um anyone listening in we encourage you to talk to the clerk's office if you have questions about that or would be interested in becoming involved lots of Christmas activities coming up I know we have to get through Thanksgiving first but we did want to mention a couple of dates to people we will have our City's Christmas tree lighting at the community center on Thursday December 5th at 5:00 p.m we'll have a brunch with Santa uh at the library on Saturday December 7th and please note the library will be closed that day other than the brunch our city parade will take place on Saturday December 14th at 10:00 a.m. and then on Sunday December 15th will be holiday on the Harbor lighted boat parade at 6:00 p.m. and uh in honor of Dustin's 40th birthday both the regular City parade and the boat parade are having themes throwing it back to the 1980s so it should be a lot of fun before the boat parade we're doing something ne new this year we'll be doing a Holly Jolly Harbor from 3: to 5:00 p.m. at Captain Royal Melvin Heritage Park and the Fort Walton Beach High School will be providing music and we'll have cookie decorating and hot cocoa and children's crafts and don't expect anyone to have written all that down that fast so please remember in order to get this information all you have to do is pay attention to the city's website and our homepage list all of this as well as our official Facebook page we're constantly updating that with different events we've reached out to CBA about expanding their services as directed by Council and they are researching the feasibility of that and getting back to us we'll have a council meeting on December 2nd the Land Development code workshop on December 3rd and a meet and greet with the underground utilities folks for the public on December I guess we don't have anything um in place to maintain those medians um and what I mean by that is when a vehicle destroys the trees or I don't know what what has happened to all the grass and stuff that was on Airport Road but once it's run over then it's gone I'm just curious why we don't maintain that or if the tree is destroyed why don't we plant a new one so is there something that the city manager staff needs from the council to address that because I hate to spend the money we spend on the meetings in 98 and just let it deteriorate and get run over and destroyed and nothing's ever replaced I don't know why why we don't do that but I mean it's I guess you need some kind of direction from Council on that or I believe we're clear that those things need to be handled I know we have uh just opened bids for a new contractor to provide um landscaping services we may to look need may need to look at expanding that to cover more as you say getting ran over and trees plow down how we were replacing those and we can certainly look into that okay so we're when is that bid coming back for the maintenance and maintaining of those meetings know we've opened them they have been opened the bid committee has not uh officially met to review them and once we do we'll bring that back to council for their uh review and approval probably second meeting in December the the contract the current contract is through the end of the year so this would be the replacement contract for that so I guess is it sounds like it's too late it's already went out it's too late to add that to the contractor to the bid packet it's too late to add it to that one but we can certainly expand their scope of services if we deem that necessary yes sir Mr city manager if I can add there's also a time and materials section under exhibit a of that bid for labor and materials plus a markup so if we need to replace trees or uh utilize their staff to install those that that would be kind of included in that exhibit thank you is that something that has been in the packet in the past I has been in play before we're just not using it I'll have to defer to Michael C because I'm not sure what was in it previously there I believe I'd have to go back and look at it but there I would I would feel 95% sure there is a time and materials clause in that one as well so cman on from what you're saying we probably need to do a better job of taking advantage of that and using it when we see it's necessary and I I think we can commit to that yes sir okay thank you and that's all I have all right one person on the council that supports some of the things that come to us other words we're like the emperor who's going thumbs up or thumbs down and things are constantly being brought to us so you know I thought that we had voted earlier that there should be sponsors for these policy and legislation uh do we need to put it in ordinance form or can we just remind the city manager and the staff to try to get a sponsor when you put things in front of us otherwise we will have to pass an ordinance thanks all right councilman Bagby just want to welcome all the new old members to the council uh about in the meeting Larry so it's on the record yes ma'am thank you and thank you Council for considering the this item and uh councilman member a for sponsoring uh this I think it's a a huge opportunity for the city to take advantage of some expertise um to procure funding uh to identify funding sources and to make sure we're moving down the right path to attain those funding sources um we have the opportunity to partner with a lobbying firm from Tallahassee uh heing Associates particularly Kelly Horton uh who is there's only two members of The Firm Kelly Horton and Rich hefley both very very well respected in in the lobbying realm in Tallahassee well known uh very well healed and understands the process uh and tell Kelly is a local gal born and raised in PHX Springs in Walton County knows the area very well I've Had The Good Fortune of working her for many years and uh has procured millions of dollars for our neighbor to the East and is very excited about the opportunity of moving forward with the city of dtin council member a bear had opportunity to visit her for a period of time the other day and I know she he also visited with u councilman Schmidt and uh so uh we look forward to that opportunity if You' see so inclined to support that initiative uh we believe there's dollars out there that working with heing Associates that we can figure out the best way to attain those if we would you know as we mentioned earlier in the meeting utilizing their services to vet the projects that we have presented tonight as long with other projects we have you know that may have opportunities of funding out there um so if you were inclined to to move forward with it the motion would need to include setting aside your uh purchasing uh or your procurement policies because of the urgency of getting this done if we want to utilize them for the coming legislative session their proposal that's in your packet is for a six-month engagement for $30,000 uh we would utilize the funding for that is currently in the budget for the assistant city manager position which will not be spent for the first quarter and that's about a quarter of that funding uh to utilize it so it'll have no impact on the budget uh we will certainly uh review it in third in 60 in six months to determine what the value was and there may be a appetite to move forward at that time but at least we will know through a good leg legislative session how it works and what the opportunities are there so we try to entertain any questions you may have So based on that do do I just make a motion that we um incorporate the option of having a state lobbyist for the six months January to the end of June of 2025 see what we can do as far as a city and getting funds that are there that we have somebody that's an expert at finding what we need helping us and and setting aside the uh procurement policies in order to get to that and the urgency being the timeliness of putting someone in place that we do not have the time to go through the procurement uh process to have someone in place to begin the legislative session yeah you just to read it so it's verbiage all right I'm going to budget amendment for $330,000 take it from the city assistant city manager line budget line and put it into a state lobbying line and then the only other thing I would say is I I discussed with staff today uh Jeff if you can do a little Matrix here's what we got in 2024 we got 1.1 million from the state and then out because at the end of the legislative session I want to see either she brought us Triumph money or state money or something so we know what we got for our $30,000 that 1.4 with our Benchmark all right I like it good Benchmark yeah that was a good Benchmark too that was a hard one all right I got a motion in a second by councilwoman treml any other discussions seeing none call the vote oh councilwoman a bear second in that was the first one all right so moved 60 we got some backup and the only other thing I want to say is uh thank you to the citizens that reelected me I hope to continue to do what we as a team up here have been doing and that is taking care of our residents our businesses and our tourists to make Destin the place that we're proud to live and work at and uh be safe for H the Thanksgiving holiday and if anyone's traveling travel safe and we'll
