e [Music] for for yeah going you good right um with the absence of a chairman I'll get things rolling um I'm going to call to order this meeting of the Dion Board of Health scheduled Tuesday June 18th 16:30 at Old Town Hall um it's also a zoom meeting um the zoom link is at the top of the agenda um call to order a motion call order Patrick McGovern present present please stand for the Pledge of Allegiance Pledge Allegiance to United States of America for it stands one nation indivisible liy and justice for all all right um seeing as though the agenda is pretty lengthy Barbara um with a lot of kind of internal things we need to talk about I want to make a motion to take a couple things out of order um and allow the residents to to go in order of what we have on the agenda for residential issues but let them go first so I make a motion to go out of order from the agenda I second it um I'm I I'll vote I good all right um so we'll start under old business with a review discuss and act potential health concerns regarding farming activities at 2651 Pleasant Street excuse me Pat I think we have to reorganize first we should okay you have a call no reorganizing I make a I make a motion to reorganize the board of help at this time okay I'll second that at this time I make a motion to nominate Patrick mcgaven as chairman of dayon Board of Health um I'll second for discussion um I I'd like to keep the reorganization the Board of Health the way we are until we have another person on the board since technically our terms are up at the end of June um and we're starting over again in July with a new person on the board I'd like to hold off on that okay if you would like to I agree so we'll table that until next month um so we'll continue with the um old Business Review act discuss potential health concerns regarding the farming activity of 2651 Pleasant Street anybody here that would like to speak on that yeah yeah this is just a a brief summary of um things that have been filed with you okay um on March 1st of 2017 excuse me could we have your name and address please drove 209 Beach Street um on March 1st 2017 it was um animal mov sleep deprivation because of the animals removal of property boundaries stench from the property worried about bacterial waste runoff um uh this person was um believe that the conversation was it was environmentally sense of area and the killing of trees on the property line on March 20th a complaint animals walking around the neighborhood nothing was done both of these times on March 8th 2017 um someone had asked the town to step in and protect the neighborhood from this individual nothing was done on March 9th 2017 a letter from Nancy Gula said that she was concerned and wouldn't want something similar to develop in her neighborhood because the houses are close together and public health would be an issue and a major concern um and she would wouldn't have waited as long as we did to complain nothing was ever done with that on 2017 um of March concerns animal feces rodents decreas of property value uh loose animals walk through the neighborhood negative impact on neighborhood excessive lights I I guess the lights were addressed but the other stuff was not dressed on um September of 18 a complaint stench from the property two three foot tall grass and burning of trash and debris and that they had a child that had health issues and the doctor said it was environmental and depreciation depreciation of property values nothing was ever done with that either um of on February 22 ducks on the property making a mess of the property and starting to see Rats on the property nothing was done with that on March 25th the 24 the same thing the the Ducks all over the property making a mess of the driveway stench and the animals were pinned up after that this has been a concern for a lot of years and the the Board of Health is here to protect the neighbors the the the residents of this count um there is a um environmental well is it environmental um protection oh environmental justice program and it states that everyone has a right to live in a clean and healthy envir and that is the state of Massachusetts and I believe that if nothing's done I believe that's our next step so we're asking you we're giving you time to to fix things we'd like to see some results that's all I have thank you um is there anybody else that needs to would like to speak on behalf Alexander 168 Washington Street I understand D is a nice country community and I'm all for farming when the farm interrupts the neighborhood wrong why you have to have what I think is three roosters I get up at 5:30 in the morning to go to work I'm up at 4:30 and when I wake up to go to the bathroom at 2:30 every night exactly I can hear the roosters crowing and crowing and crowing so my main concern is the health of these animals and the noise interrupting the neighborhood I've only smelted it a couple of times when the wind comes towards my house it's awful so I can imagine these folks a lot closer than I do that's all I have to say why do you need roosters if you don't have a Hatcher not raising little chicks um my neighbors have chickens you the Allens have chickens you never know I never know they're there they got to look through the fence to see if they got rid them rid of them or not they don't make a peep the roost come on I I know the um agricultural committee was working on that Y and um I will check them out and see if how far they've gotten on the rooster problem okay it's almost the same as the pig problem and the rest I mean those animals living in the swamp the area just doesn't look good for raising healthy animals to me thank you thank you anyone else hi hi Tom Rose 2635 Park Avenue my main concern is that yard is flooded eight months out of the year and those birds are captive there there's got to be 30 geese constantly there's feces in there and that's got to be a health concern they can't have all those birds in there 247 water is stagnant for months at a time so that's my main concern that's definitely a help risk have uh has anybody I didn't see anything in there has anybody contacted mosquito control I know that the storm water committee had contacted Bristol and the owners stopped them from proceeding they were going to do some mitigations as was the town was going to put a drain basein in there and the owner stopped that also so there's been things in progress but the owners don't seem to want to cooperate so that's all I have to say thank you anyone else would you like to speak okay I would I'm a farmer I've been a farmer for over 55 years and when this law came in I said well you know I wonder if it's really going to help us at all commercial fs and I'd like to read this to you word Farm shall include any posle or continuous parles of land or water bodies used for the primary purpose of commercial farming the benefits and protections of this bylaw are intended to apply exclusively to those commercial Agriculture and farming operations and activities conducted in accordance with generally accepted agricultural products could you please come up here so I can ask you a couple of questions thank you 2651 Pleasant Street how many file do you have on the property total yes right now probably aund okay and do you sell them no you don't don't currently sell so you're not commercial not you don't put anything on the taxes no it's 100% for us um anybody here could do that too sure could and I don't you know as a farmer I had 100 acres 22 fields and four towns and every morning if I went in there spraying or at night when I'd be going home I'd not got theate at this door and they say I'm coming in tomorrow morning do you mind would I be bothering you I was very very concerned about the neighborhood and this was way back before this item came up way back people have the wrong wrong idea it's commercial commercial doesn't mean filling your belly commercial means making money putting it on your tax return and claiming it so we'll be looking into this thank you for your time anyone else would like to speak you know you all have to get up and say what your complaints are unless it's not taken into advisement thank you we're not going to get on anybody's throat believe me we just want 2017 this has been going on and the last time I was on this board it was going on it's about time done and no we're gonna I am anyway going to get together with all the different departments and find out what's going on here we understand you love raising animals but I feel as a farmer I would have so much compassion for people adjac to us because our Machinery makes big noise and there are times we have to spray by 9 in the morning so we don't kill the beets and we have to spray while the the leaves are still wet so it would absorb um and I would always always have compassion for my neighbors and that was 22 fields in four towns never got a problem I'm sorry that's okay Park out um my concern is the Taunton water shed the river has been cleaned up really really well it had gotten very healthy um unfortunately when we have these endless rains the field does flood there is a fair amount of feal matter in that field um it does then flow down the road and I've also seen it flowing through the beach into the river so my concern is the taunt water shed which is a very important protective piece of water IND D do you know if anyone has taken a sample of this water flowing across the street I do believe we discussed it and I can't document the year with um Mrs Gula I did not test it her response was there is no feal matter flowing down your road how did she know that I don't know and that was my assump it to the also she didn't send it to massachus it floating down the road I'm assuming it must be some type of didn't look like hopefully not human I didn't think it was human nor dog but um so my concern is protection of the Watershed and the bylaws and regulations I.E for the distance from cutting trees trees require Roots Roots absorb water trees are very protective for our marshes and the Waterfront so that's my concern to protect this Watershed thank thank you anyone else M 2641 pav I'm a newbie in there we the one right near the beach um we're also the same thing we're it's the water that we're projecting I go fishing there right on my Dock and basically this winter it was atrocious we were basically surrounded on an island by water coming in clean water not really it was going it was pouring 24 hours a day seven days a week into T River like I said they've done a lot of work to clean up the river and you know I think stuff like that needs to be done to address that thousand Gall okay we got the de Department of Environmental Protection in there too um but if it in the meantime if it does go over the street currently dry right now oh I sawry yeah yeah I've been by a number of times um I'm not sure as an official I could go out there and take a sample of the water and send it to the University of Massachusetts for testing um I took my soils analysis classes at UMass and am but um there are methods to to get it cleaned up uh we're working on it I I I I am really apologizing to all you people that this has been going on since 2017 um they have they want their animals fine fine think about the neighbors think about the area um my daughter looked at a house in that area and she saw the water and the feal matter and she said no I'm I'm not even looking at the house she wouldn't get out and um I'm sorry to say but it does devalue um the area and I have proof of that um Town proof so we feel for you and we don't want you all going into devaluing your property because then we lose tax money but um no it's true it's true so that's why we want to to do something um for all of you including you you know we we really aim to try to get together with to have at the last meeting that was discussed the chairman well the last chairman was going to have Tom Ferry look at it as well on a highway department end of things as well I don't know to amend complaint from Tony Roger an ongoing thing Quality quality of water and dat and it doesn't seem like they're doing anything I do about receive two letters read them and iust what they're telling should be drinking this water can't CLA I don't know why this board hasn't done something about it before now uh sometimes the water is not even fit to flush a toilet because the water sits in the bowl it turns brown and stains and you want people to bathe in this water I went to a meeting last night and I was surprised no one from the Board of Health was there they asked questions which meeting about the regionalization of the F water district with the town they had a consultant there and gave a report of uh things that they said that could be done but the water department doesn't want to do it it was it was evident last night that they don't want to buy water from Somerset ton or Aquarius were they there last night the water department water one commissioner and super that's [Music] all no concerned about this is this is a health issue and I believe the to we have you know monthly reports you know available to to the people Elizabeth do we have I thought we had gotten reports from the water department no notice this was talking about was when there was a Pard you notice is when there was an increase in a certain um chemical no it's something that happens with the sediment when it loosens yeah it reaches a certain level they sent it out townwide um I'm not the only one complaining about this numerous people yeah and I apolog the emails that you referenced um when I got them was the first time I'd ever seen them so I know you had reached out to um a couple of people in March I Believe by email i' never seen those emails so I apologize for that I uh I've been on this for now probably eight months and uh all I get is a handshake and I'm going to take care of it and nothing's done the quickest fix here is for them to buy water from Somerset it was it was evident cost wise and everything last night uh it was a very informative meeting but they also said the only reason reason why they have a moratorium on water is to C the growth you better be careful because discrimination the right contractor gets a hold of that and this sounds in trouble I want to tell you they have a problem all they do is dump water on the ground they flush flush flush flush I've seen them flush sometimes 24 hours declare a why have moratorium that only shows me one thing they're not using enough water second of all they just put in a 40 foot well a 40 foot well to serve the public this is a waste of money they've had 40 foot wells in this town for day one they've had a Filtration plant that was obsolete the day they turned it on I don't understand why the Board of Health isn't stepping in and doing something for the people well I'd have to look into it but I I can't imagine that if the water isn't outside of Health quality standards I don't think we can't tell them to not drill Wells we can't order them to get water from the next town over it's a Water Commission so they answer to themselves or the forest lechman I think I don't I I'd have to look more into it but I don't unless it's unless it's a like a tested health issue I don't think the the Board of Health can in the letters they're sending out told you right in it right but they also had a remediation plan already in place they notified the town as they were supposed to do and it was supposed to be fixed so I it besides a test I can't I can't think that the Board of Health can tell them what to do and how to operate unless it's a true Health Emergency you don't believe so but I can look at like I said your email that you sent was the first time I saw it and I'm not trying to say I'm giving you a handshake and saying I'll look into it but it it's the first I'm aware of it and I will gladly look into it because I drink the tap water myself and my wife laughs at me and says take the water from the refrigerator it's filtered and I said I could drink from the to I did it from as a kid from a hose like what's the difference so I I drank the same water so I 100% see your complaints and it also tells you that it could be cancer causing anything can be cancer cause and let's face it I drink the water all the time too and all my horses and all my dogs and nobody has cancer at my Place fortunate well you know y you can't we take an ADV so in the letter they sent you I'm sorry they're telling you so in the letter they're sending I don't remember getting one either it came out twice they've given us two letters it was like I think it was like recommend at least recommend to the water department to get a report of what they're doing I believe we do get a report if it's over a certain level yeah only if there's something wrong yeah well the p is is over what are they doing about it I believe it's down now isn't it what's that it's down now isn't it no they stay last night doesn't pass doesn't pass the test the only ones that's passing the test is taon Aquarius and and Somerset Somerset I believe is the lowest swansey just negotiated with them to buy water from them from Somerset because of the PS well that's something I think we can take into consideration yeah I mean I'm glad to look into what our abilities is and and request a water test if we can um and see what the levels are and see what we can do from there and you know like I said I don't want to give you the answer that you said that you've been getting but is the first time I've I've been involved in it so you get from I don't know I I'd have to see what we can and can do any other board of help well we the board of he but it's over a certain limit and that's been right along I no we will look into it Tony we really will I'm not going to just say hello and goodbye you know if you want call stop in whatever thank you Tony Mr Hull Leonard Hall 760 Main Street night I attended that meeting last evening during my tenure on the border of selectman I was the lerson The Water District there are a number of issues and they really come down to money if the town and the water district has somewhere between four to6 million we can readily fix those problems on the issue of the moratory I was the one last evening my capacity as a citizen who made the comment about the moratorium and what I said was that in effect the moratorium as is controlling growth in the town and there a a segment of the community two members have been very vocal with selectman meetings that the and planning board meetings that they are against growth um but that's not the real reason for the moror we have Ceda one that they're working on it's still not quite online yet but CA 2 and CA 3 are regarding the meth the TM H problem the water district is working very closely with the state on this matter the reason why they've been running water is they've been flushing to remove the contaminants they already spent money to take a look at the Elm Street tank and they found that fortunately the it's not going to necessitate a complete overhaul of the tank it's going to some painting and some weak cleaning and pain relatively inexpensive as far as the posos that is a huge issue for the Commonwealth Massachusetts never mind D EPA on their own lower the PS level from 20 to 4 I attended those meetings at the State House when cities and towns all across the Commonwealth as the healing Administration what Financial relief they were going to give for the communities for p us alone the cost of the town of dayon is $4 million dollar for the cost to bonable county1 billion many of the communities I mean many of the states are in serious negotiations with the EPA at the federal level to see if they can work out a compromise or they slide down gradually get to four is there a need yes there is why it's taken EPA this long to do anything about it doesn't speak well for the federal government and I might add that's both parties um as far as Massachusetts at the last MMA conference we talked about it and the heing administration doesn't have a and most cities and towns like dyon don't have the money to do it so it's kind of on holding patent because the state understands they can't mandate it if they don't have any money to help out the cities and towns and it really comes down to money you know those Commissioners they have families they have kids grandkids they don't want anything bad to happen either but unless somebody's got $4 million they want to give a d water district they're going have to Grant it up the meeting last night connecting to Somerset is probably the best plan however there's still connections that would need to be done there's also some concerns about filtration that would need to be done again it gets back to that same old thing money one of the things that was discussed last night especially Pat had that because over the past two years started with Governor Baker and mor H's Administration has [Music] continued um regionalization of water it's the goal of both administrations to do away with the like North dyon and the water district they are not part of the tong of D they are a separate legislative body they were created by the Massachusetts legislature they can only be dissolved by the Massachusetts legislature it would take a whole rule petition to do that and right now with Senator Pico retiring that Hadad as the contact person and to see what financial assistance the state can give on all three of those issues so that's kind of a summation of the meeting um the water district you know keeping it inhouse has some serious infrastructure issues even that alone if they keep it in house the upgrades are going to be in the millions probably that Alone 4 to six million so it it really comes down to money no one is doing it purposely to hurt the developers it's really a money issue thank you Lenard do you think um there's any hope for the federals coming up with grants for this J Goan Clash has been a huge help to the to losing Mike Mullen in that regard that hurt huge last year thanks to Mike Mar and and a few other people now J Goan class was persuaded to get 2.75 million for the Pleasant Street bridge and what he accomplished most people don't aware there was a trillion dollars across this country and Senator M wanted a piece of it for two big bridges down the cake and got the money and and Mikey was told to wait another year s so what he was able to accomplish I mean you take a look at the whole country in a town of 8200 people and for Jak to convince Congress to support that was huge can we go back to him and ask yes but at some point and he did last time he was actually in Somerset we asked about that and he is concerned about peos but the P issue isn't just a Massachusetts issue it's all across the country and I have I mean if you hear in bville County say it's a billion dollars what what is the cost to the whole nation you know especially in the Coast where the communities are a lot older you know the the more modern the city the newer the city the less of a problem you're going to have it's the communities that have been around for a long time they said I think n Tucket or Martha's Vineyard sits on the largest fast area in the country I don't know which one it is it's either Martha's Vineyard or n Tucket really one of them is the largest dep positive P fast in the country real bad and they don't have a plan and they don't have the money so um sure that's [Music] J was Rel thanks to Dr offers he was when we served on the board we developed a good relationship so um once we get Town Administrator that'll help too it will thank you lonard you're welcome all right uh the last one uh review act discuss 2371 County Street um email status update from Dave Phillips how we all doing hey Phils 1261 Main Street hi um just looking for a status update on the email that I sent on I believe it was April 3rd or 4th now I mean obviously what's fight in the last week or two with Board of Health you know you guys you guys probably haven't seen it I honestly again I'm not not trying to to say the same thing but literally this is the first time I've seen this email um so it's it's definitely a concern um but yeah obiously with everything going on it's the first time that I've reached out and I just didn't get no response so I was wondering you know what the process is Right know um I know I had been on a site visit my last I mean it that trailer could may not even be there now you know and I don't know if it was a problem but there was a safety concern when I was out there where the trailer was in the embankment down to the down to the railroad bed it's like a 22 foot drop and that trailer was honestly 15 20 feet away from the edge and if some it looked like somebody was living in it you know I mean you there's no railing you know you walk out of that trailer in the dock you know just being being a trailer RV type of person right it was like this is not need railing up there or or turn the trailer around so it's facing way I know right I did see the email when Elizabeth sent out the packet um so it's it's in the process of being looked at um and I'm sorry that you didn't get a followup it's all good that's why I'm here thank you David thank you all right thank you um I had asked Lisa calonia to be here tonight but she had other things she just couldn't I was out with her twice today really doing site visits in and ran in do we have she was heading the way I asked the health agent for an update thank you Dave she said that Jim was looking into it but he was on vacation so okay chance to get an answer from him do we have I know we have I know this might sound stupid but we have everybody's email address list on our website but do we have like the ability to create like a Board of Health at Town of dayon so it goes to like everyone instead of if somebody from the town is looking for someone or it should be able to to go to like dyon Board of Health at dton mass. whatever you know so that way because I I've been seeing a lot of these emails come up that my name isn't on and and I don't want to say like I I I feel stupid but now I'm looking at these emails like I never knew about them you know so um maybe once we settle down on three board members and move forward we can have one in inbox that goes to everyone well on fairness to the board you know when I sent this email out I should have sent it right to the channel no I sent it to at the time was the director but I I mean even when in my personal World in my private business I tell people you know email me and C see my boss I I say it to anyone that's reaching out to me and that way it keeps me honest and it keeps me onest and I I don't I don't mind if my boss sees stuff that gets sent to me it doesn't you know it's work um but I mean it it could go to the Chim and but if something happens and that one person's out or you know I just I think it should go to the whole board three supposed to be the vacant if you want to [Laughter] apply um all right um we good to resume normal agenda items in the order that they are they are in I second that that motion I think so does it need a motion I'm still learning a few things let's try it okay so I make motion to resume normal agenda activities I second it I I okay passes um so move on to the inspector reports um of which kind of coincide with a few other things I would say um Town nurse obviously we don't have a report from the town nurse we didn't get anything right before since the last meeting so we have no nurse report I reached out to the animal inspector she didn't have anything to report okay uh anything from Jim on the building end of things we have nothing from the health agent I'd like to mention some did the any of them send you letters stating that or emails I emailed [Music] Stacy okay I I I I firmly believe we can't do our job unless we hear from them about what's going on in their job pertaining to the Board of Health it's very important they at least come and and I just feel that way I like them to come if they have nothing or send an email pertaining we have nothing they have nothing that would change the board of health which they are part of we'll have to talk about that in a workshop or whatever sure because um I really feel something should be done to let them know how important it is to come in and discuss something also if we have something we'd like to discuss with them if they were here and such as Pleasant Street we may have needed to ask one or two of them Animal Control we may have had to ask her about some things um the same with um building inspector Health agent um I know there are times they can't be here and I totally understand that but I mean for us to do our job here in the Board of Health I really feel they should come and be in the audience ready and available because I believe they're all paying jobs am I right Elizabeth yeah okay they're all paying jobs so I believe at least this one night um how long have we been on here 45 minutes and we are here everything's done not everything we've got more to do but I mean we did the bulk of it and I really feel if they should come they could be here and they may be out in 45 minutes but really I I they really should be here to help us do our job I don't know how the board can work on a lot of these questions there may have been somebody that just came and wanted to do public input and we don't have some we don't have a lot of the answers our job is to get everybody together make them all happy get things we'll try to make them all happy get things done in this town and if these people that are on the payroll don't show up how can we do that yeah we'll have to do a workshop and figure out how best to go about it yeah yeah I mean I totally understand that everybody's busy but they do get paid and it's part of the requirement I don't know if it's a requirement yeah I'd have to yeah this is is another thing we have to discuss well you can discuss it with Elizabeth or I can discuss it with Elizabeth and or we can have a workshop on it and um I think they all have to know how important it is to be here even if it's just for an hour just so they can touch base yeah definitely something we can work on all right um moving on to Old business um review act discuss overdue trash bag vendor balances we have the um same call for it yeah any more progress on that did we did I confused my emails did that email was that with the letter that we sent in January was that just to inform the board that it was sent or did it get sent again again okay um I don't know this may be approaching something that when the temporary Town Administrator comes in um that we sit down and figure out the next steps um I mean I I'll admit I was hopeful that maybe following the process I understand the sold and the company changed hands and you know they still have responsibilities it's a big it's a big Corporation um and for a while they were making they were making payments and you know we had asked Elizabeth to follow the the recommendations of the new company and go through their portal and we did everything that they had asked so it might be time to kind of little push yeah you push it up to the Town Administrator and see what the next step is is a this I'm looking at and it's hard to believe that they're owing from 728 2022 right as a total of $ 34,42 that are in their coffers and not the town of dayon coffers but I'm sorry they are doing a service for us and we are appreciative of it but in the same token they have people going in there and saying let me get a trash bag and oh I'll pick up some milk or I'll pick up some bread um people I'm running out of trash bags well let me go right now I won't wait until the end of the week and you know once you go into a market you're going to pick up something um and as I said we're appreciative of them doing it I think this problem coincides with we were supposed to update the vendor agreement so it's a legal binding contract that they have to sign and buy by the agreement and the one we have currently is from 1996 really yeah we need a workshop on that too well it was supposed to be done right Solid Waste recommendation on it yeah we've we went through a workshop we rewrote it we did everything and we're just waiting on Solid Waste yeah CU that was one that was one of the big steps we discussed was the create updating the bag agreements to say y you have X Y and Z amount of time and I honestly can't remember off the top like 90 days to pay old Ines or whatever um we also had Elizabeth ran a new issue with this this company is all the older invoices never had invoice numbers on them so to track them saying did we pay it did we not pay it did we this the first thing they said to Elizabeth was well do you have an invoice number and invo you're never you're never going to chase Corporate America unless you have an invoice number so definitely this is why and when I we started tackling this this was probably about 15,000 more so we've not we Elizabeth has chipped an amazing amount away at this but there's a huge there was a huge gap in what they owed like in the red versus what is new and she was chasing the old stuff and they just continuously said like you know well give us an invoice and then there was like well we found a check for and I don't know exact so I apologize but like there was a check for like 5,000 or whatever was like well what invoices do those cover because none of those add up to what that that check equals but the check was deposited by the town so technically it's on us to say well we accepted payment but we never marked what was it was paid for so and that's where my said that check wasn't even supposed to for you well we already deposited it and it was made out to us really so now we've been trying to go with that and that's why and I've been I'll admit been a huge kind of middle of the road with this issue because I'll agree my wife will come home from work and say I need trash bags and I'll go in there and I'll get trash bags and I'll get milk and I'll get a bag of chips and I'll get you know what I mean like so it's convenient for me and I'm not saying that that is my driving Factor but they do sell a lot of bags because of that you know and we should have it cleared up but like a lot of it I say to Elizabeth and I've said it in the meetings in the past is what part of this and I'm not saying it's not owed to us but what part of this is our fault for our improper bookkeeping at one point yes um so I had pushed for actually probably at least six or eight months to to send them a letter to follow the and I feel bad for Elizabeth having to go through it but she did go through a lot of Hoops to do it every single you didn't know she was Supergirl so it's we've been we've and we were making progress for a long time actually I want to say up until like four months ago um and then the past chairman sent the letter in January yep and and it kind of stopped so now I'm kind of thinking that maybe it it needs to go to the next level like it should go to the Town Administrator to see if we should get legal council involved to see what our next step is um I don't want to say we've been slow playing it but I kind of wanted to say well you know we weren't doing things the right way and they weren't either and I'm not agreeing with it it's Corporate America the business changed hands two or three times in the past five years so exactly but now it's time to kind of yeah you you have to look at the vendor agreement because that is what they signed could you could you pull me out that for tomorrow yeah that old vendor agement was older than me I think no it was pretty bad um the new one is pretty good it stipulates time frames it stipulates you know cut off times it stipulates everything um but we're just waiting for final approval on it um other than that the other remaining businesses always want to ch this until next meeting um yeah let's you want to see the the agreement so let's yeah yeah we'll table this until next month because we've we've been it's been on our department for always making me feel a part of the team um so uh we have to make a motion make a motion to accept the resignation of Nicole Melo as public health nurse I I second that and I sorry trouble with eyes um review act discuss Health director resignation James agu which dated June 13th um as you are all aware this week's town meeting eliminated the position of the health director um this change affects the town and the health department much more than I um has chosen to regress which is very unfortunate um that said when I arrived at the office this morning I returned all my related folders to the health department side of the office will no longer be assisting the department in any way um I will be emailing others to make them aware to contact the office manager from this day forth you can adjust my health director stien for this week accordingly I will instead focus on my core employment as a Building Commissioner uh Miss Brady has supplied me a copy of my job description to be sure that hi and my department stay within our box um so I'll make a motion to accept the resignation of Jim agar as the health director position and I second it I I'll vote an i i um next is oh yeah sorry I crossed out the wrong one my fault um resignation of Paul Pico from his um chairmanship of the Board of Health um Board of selectman due to circumstances Beyond My Control job description um so I know that with um Nicole's stepping down we need to fill that role um a vital role to the town um like the um trash bag agreement I looked at it when it got vacated um and the job description was pretty pretty old and out of date I totally agree so I spoke with um Karen and Mike before Mike had left Mike said that they were in the process of updating the um job description to kind of bring it up to today's standards and requirements um there are a couple other things that looking at the town of dayon I think could could help us more in the long run um I I hate to to hold off on this but personally I I would like to do a workshop on this and try to revamp the job description and maybe see other areas of the town that we might be able to utilize I maybe instead of a public health nurse I'm not against nurses my wife is a nurse um however I think that there's other ways to benefit the town that doesn't necessarily need a nurse um I think there's better ways I think a workshop would kind of bring that out I totally agree um so I'd like to vote to table this again like I said I don't want to I don't want to wait on this too long but I do want to get a workshop going to kind of see it from all different angles um so we make sure we get what we need you want to make a motion I'll make a motion to table this and we'll create a workshop make a motion to create a workshop um second that I um so the next one is review act discuss Board of Health member vacancy um so obviously we have a vacancy with the Board of Health um so the question is are we going to move forward with more interviews and more um lost my I was advised we should do the interviews with a uh 14-day uh I'm sorry applications 14 days and the interviews and I really like the way we did it when I had my interview with the Selectmen and the Board of Health because it seemed it was it saved a lot of time it wasn't we we approved of we suggested one person or two people whichever they'd want and then we have to wait for the Selectmen to meet again I think and then this way everybody can ask their questions of the um oh God the applicants and I just feel it's a much better way a lot better than as just the Board of Health interviewing sending recommendation then the Selectmen picking someone I believe this joint interview and um selection work out great sure I'm all for it okay um so I'll make a motion to post the job description for a Board of Health member um reach out to K reach out to Karen and let her handle the the twoe time frame and schedule a um a joint interview and I second that I I motion is approved I look the right one Health number it was the job description oh is there a new oh there's a posting in there okay posted gotcha if you want to change that posting before we no I think this is probably the same one we use for the most recent one right yeah it's just oh yeah April 25th we can just leave it yeah that's fine she can we can use something so yeah I know there was the whole discussion on the last meeting that I went to on it but it was supposed to go for think I just table it till you get something okay I know Jim had reached out to him for it and he said he'll take care of it and then I reached out to him today get anything so I don't I know what it was but right we need something official whoops all right um so on review act discuss Solid Waste committee bag price increase um as Elizabeth said I'll make a motion to table that until we have um an official document from the solid waste Commission on it I second that I'll vote I and passes unanimously um review act discuss board member appointment to Solid Waste committee that something you want to do that able to do that yeah perfect I make I would love to make a motion to appoint Barbara kabia to the solid wayte committee I don't think you can vote for yourself can you I stepped down a second I don't know we're sharing we're sharing the chairmanship here I'll vote I learning process I don't know how right it is but it's a learning process we're getting it done let's put it that way Patrick they can fire me it's okay we're getting it done all right um the next one as well was um was that the one when we were trying to put them all on the same cycle or something was that something different I'm thinking something different so so people receive a temporary food permit and it was good for six months the problem we're seeing is when vendors come back multiple times you're sending the health agent back multiple times so somebody who comes once it's fine but for somebody who comes to three four events we're losing money because they only pay that first initial fee of $75 and then this instance we had one vendor come back three three times and the health agent had to go inspect three times so it's not and like I said for the most part I don't come back more than once right I um had a food trailer for quite a while and I firmly believe that if you're going to be here all year fine let's do all year um they just have one in two inspections on that and I I firmly believe that every time a vendor a food vendor comes here they should get inspected is that what we had what did we have before I know that Chang did we have every time they came yeah they had to pull a temporary food $35 and then we increased it to we increased it to 75 and extended it for six months yeah I mean I I don't know I think there should be better language on that I mean if you come here and there's three back-to-back events I mean I don't see the need to get a f food permit three times if you're here for three different events in April but you're three different events throughout the year but then my concern is to where it was earlier like if a food truck comes and we give them a temporary permit and then they up and leave and they come back technically their conditions have changed since they've up and left right you know the refrigerator may break right uh the the it's different than a restaurant that's established in Brick and morar in town you know I don't think either that they should go every day in a three-day period right just so and it's good for three days or five days or whatever we should have that stipulation and it it's more reasonable than a whole year a whole year is uh 175 list 125 125 um and what is it every time they go out the inspect is a 35 there is no there is no suspicious well we could have um one fee to get the um six month but then $30 or $20 each time they have to go out and reinspect yeah I mean or something like the inspection shouldn't take longer than 10 minutes it really shouldn't um if if they know what they're doing and what to look for it shouldn't take longer right and then of course if somebody complains and they notice something is wrong with one of the food trailers they can always call the B of help and we will go out if we think that something's wrong that we have to correct because we don't want that happening yeah I definitely think it's something we should look at I mean maybe even yeah you know there if if they're you know over 30 days or something that we have a reduced fee or they have to pay the inspection cost if they come back like it's the 125 is okay it can be good for whatever but if they have multiple events greater than 30 days they have to pay like an inspection fee like the permit can be good but they have to pay like a $25 inspection fee or something would you think a workshop sure you investigate a little bit more yeah I mean it's up I've said in past meetings with everything that we've been looking at there's a lot of stuff with the Board of Health that needs to change and there's a lot of stuff with the Board of Health that needs to come up to this day and age and we're not going to realize what needs to be fixed until we put something into effect and then have it come back and realize and say okay well that probably wasn't the best decision but at the time in the first Workshop it made sense but once we operationalize it we realize that it's not the best plan so definitely definitely I think we have to because there are a lot of different ways we can do this but we want to do something that's really specifically looking for things that may go wrong because it's concerning food right and um I know when I went from town to town they all had different different cods different times they came in um Westport $500 to inspect the grill above of the frol 500 yeah and that's after I was in and there was a trailer behind me a trailer in front of me and I couldn't go anywhere I said I've never heard of this the other thing is a lot of towns they require the fire department for the trailer to go over to the fire department and have the fire department clear the gas lines and I think that's I don't know if the fire department would charge or not some did some didn't um the first one I got was North did that and I said that's a good idea they we do they do require a permit a yearly permit where uh a special person comes in and checks everything and writes it out and everything but you never know that we've got to change tanks probably every event if it's on correctly if it's leaking if something's wrong with it so we're only taking care of our town and people if that should blow up or if it has a gas leak so I think maybe we should contact the fire department also and ask if that's something they could do yeah I think they do I mean every fire department I've worked for has done it um they go and inspect the I know that the chief was out here walking through um for the cow chip Festival but I think you know if we had um fire department end things and the other thing too is maybe we could have um a sticker saying it has been inspected only because that would alleviate I mean after I get my food trail and new rules and regulations and then I went up to the fairs in Maine wow it's like I'm not eating at this R Trail but uh Massachusetts is is right up to p on inspections they really are a little bit more than necessary but that's okay yeah I would Shake I would shake before um I I'd go to a new town and I be there and scrubbing and cleaning and scrubbing and cleaning and didn't know what they were going to pick on next and you don't ever want to have a bad inspection ever ever um all right so I'll make a motion to table this and build a workshop to review the fee structure for the temporary food permits and I second that and I'll vote I I passes unanimous um so review act discuss vehicle usage and tracking um this is something quite a few of the towns have um only to keep track of the mileage the other the other thing is there may be another department that conservation could use one of our vehicles when it's as last last week the um building inspector was on vacation and the agent wasn't available and it just sat here and conservation is constantly going she doesn't have a vehicle but it is a town vehicle and so we could have offered that to her but she had no clue about it she didn't know about it that it would was available and I just think keeping track of the Mage and the places they inspect so if something does happen they said no I inspected it on this day here is my mileage is the day I signed out do we know if there's a process in town for well first off do we know if that like was that vehicle bought for the town or was it bought for departments I don't know it was bought I'm trying to remember I would excuse me could you come up and speak CU either one of you probably remember remember this I was there but I can't remember I thought it was basically the health building department or what do you think it was the health building however that doesn't mean that it couldn't be shared with conservation when it's not being used no y there's a need for more te yes bonding yes and a lot of times they actually go together with conservation the building inspector or the health inspector so it's not as if we're getting the accountant it's someone that really has to go out and inspect quite a bit there are you know as you said there are times you know was mentioned tonight were a couple issues they were asking conservation and board Health right as to whose area really is yeah so sometimes we have to all work together to get things done that's why when site inspections had to be done um the heal stormwater agent uh would call me and for example uh we need to go to this site um I've looked at plans I've looked at whatever uh what they're doing needs to be changed uh I don't like what's in the plan um but I want you to go out there with me all right so more than once I'd come here we'd go out in that uh the car go to the site we'd ride around the site and he'd show me the areas that needed uh attention and that way uh sometimes we' meet with the engineer on site from the solar farm or he'd go back and say you know we did this inspection uh the chairman of the committee was out here um we've looked at all of this and she said this new needs to be changed so he would take me and explain to me the I'll call it the technical end of what it was and it usually dealt with anything from slopes to this would be when the after the land had been cleared but before they started actually installing or um uh a bad rainstorm and you have runoff and the proposed solution isn't really going to work so but yeah we absolutely did use it and now I can also remember um when I was a selectman going to Joint meetings that might have involved either uh Solid Waste or health issues or but there would be several of us in the car because the topics at that meeting were important to the various committees so um an easy way to do it is to put a log book in the vehicle whoever takes the vehicle signs in with the date what committee they're representing uh beginning mileage ending mileage reason for the trip you know inspection of piic aite okay uh but that way you always have proof and if there was questions about when was that inspection done you got a log book that's what I mean yeah just to cover um Elizabeth how does the procedure go if two people want to use it at the same time has there been any cause for that would you like to have a w workshop on this well I mean I'd like to get more information on it yes I mean I'd like to it's it's not a Board of Health vehicle so I don't want to come up with a policy and say that this is what we're we're saying we want to do with it um I I don't want to put it on a temporary Town administrator's plate because it's kind of menial to the day-to-day operations of the town it's just a a procedure um may he may have had some um have some input in on it right he may have gone through something like this that would help Keys need to be stored at one department and there needs to be a person that is in charge of the book I mean the book can stay in the car the book can stay at a desk the book can stay anywhere but um I mean it's a town vehicle it could be used for anything that town Town wants I just what I don't want is you know gim to be going out for an inspection and Lisa walking down and saying I called Elizabeth this morning and I said I was taking the car and I don't want to cause fights over it we we'll we'll have to get so I think that it needs to regiment maybe you know draft an email to the Town Administrator saying what are your thoughts and this is a town vehicle it's not our vehicle and I don't want to own a process that for people that don't report to us you know what I mean like Lisa doesn't report to us and I know she does an awesome job but she report to us so I don't want to say this is our policy if you want to take our car that doesn't belong to us right yes it was uh it's shared vehicle the town vehicle okay um unlike the veterans vehicle that's definitely when that was purchased it was related to the veteran services but I can also tell you uh when we had to go to a meeting somewhere and there were quite a few of us we were allowed to take that vehicle because the agent didn't me it that day we knew about the meeting ahead of time and we needed we didn't have the this the Toyota at the time we had the the white car and he would allow us to take it um the thing was if you knew there was a meeting coming up let's say you had to go to the Department of Health over in Lakeville um you made it note ahead of time that you had to go so that the vehicle was booked in advance MH um when I would get the call to go to a site with the health agent um the vehicle was available if it wasn't available uh it would be meet me at Town Hall we take his vehicle or uh another town vehicle I've gone in which isn't which truly isn't for use by the town was Tommy's truck because it's a that's definitely highway but that that black car was uh has been a Shar vehicle yeah I and I I think can continue to be shared I just I I don't want to just take ownership as the Board of Health and say this is how we're going to run it when it's not our vehicle it's the to so I think the Town Administrator should have some input on and if he says I want the Board of Health to run it then sure we can you know but I also don't want to add another thing to Elizabeth's workload to say and I I know it's a very small task but I don't want to just say right you're in charge of this and this is your daily operations because it's they book meeting rooms so is there a way we can book they could create a calendar for the car and it's a it's just like a meeting room that has it yeah and I'm I'm all four different ways of doing it but like my thing is is if it's a town I I don't want to make a decision for the entire town so maybe it's an email to the Town Administrator and I am meeting with him next week so I can bring it up talk about say what are your thoughts and see if he has any input on it or sure and um I I could also contact a couple of different towns that use this and see how they go about it also uh what because they've been through it they've probably had the problems and we don't want to have the problems we want to have it go nice and smooth yeah so I yeah and I think we'll get more use out of the vehicle too it's just sitting there when someone else could use it's I'm all for it I think it should be shared it's a town vehicle and and if Jim and Heather are out and Lisa needs it I'm all for it it needs to be used it's it's going to break if it's its Idol and I think it's more professional showing up someplace in the town vehicle not just coming in your own private vehicle it was grant money involved too which also makes it a if you will the town vehicle I'm all for it like I said I just don't want to claim ownership over something that without getting the town administrator's in on it I totally agree totally agree so um so you're going to talk to him so I'll make a motion that you're going to follow up with the Town Administrator yes um when you meet with him next and report back at next month's meeting you want to wait that long I mean if we have a can we do a workshop on it along with one of the other workshops and then we'd be if we had any questions we wouldn't have to be doing this at a meeting we'd all what would you're describing as a workshop if two of you were present we get rid of it it takes so long because the stuff that's public I can just put in recycling but the stuff that's executive session I have to shred it so it takes a long time but uh in the course of cleaning out um I'm going to give you copies of this this is a job description that was prepared August 2019 It's a combination health inspector Health agent but it has a storm water component and when we had the combination job um this is some of the work that the storm water agent um did why is high ated in dark colors I don't really remember but I just wanted to ask today when you're when you get a full board and you're able to look at the duties of the health agent I'm requesting and I will put a request in writing from the St committee um that you consider reinstating the part-time St water um we have have the engineers to do the plan reviews and those are paid for by solar companies but there are times that we did inspected right now like get a big rainstorm or something and not having somebody immediately on site um we were fortunate that when we had the really big rainstorms and like the verm blew out on Treemont Street and we had all that going on um we had somebody here Plus Lisa went out with him and Tom Ferry was around so today uh Tom of course is is away uh so there was a site inspection at uh the solam uh Treemont and middle streets so I met Lisa out there and we did a complete site visit I mean from one end to the other um and the engineer from the company was there rich richio and then the general manager the construction manager was there so we did walk the entire site uh and I took some pictures I'll be sending them out I can copy you guys on it just so you see what to say because it's looking good but um while we were out there I remembered that I had this so um it's just something to look at but as I said you get organized and you get a third member and you're looking at all of this uh if it could be consideration for that uh part-time storm water agent because it's Fallen to Lisa or Tom and I don't mind going out too but um needless to say when we had a storm waterer person who was also a PE he had the professional knowhow that we were looking at the construction site and he could do the math and say that isn't going to work so just something down the road um just so for follow this I've seen this job description this is what we spent multiple days months weeks hours reviewing um when we redid the job description for the current health agent um the hours that were taken out of this to create the health director position um equal about $20,000 of which the town's people said they have a vision for the Board of Health without coming to a meeting or telling us about their Vision or telling us anything and took that $20,000 away put it back into the general fund so I can tell you right now that the health agent currently Works 25 hours a week um within that job description within our budget we have no money to dedicate to storm water so I I'll tell you right now that once we get this third board member I'm a no for this so I appreciate your input but unless the board of Selectmen want to come and give us the money back that they stepped down and took from us at town meeting then I'm a no on this job description no no disrespect n thing is um when you get a full Board of Health um by the time by the time I think we have a fall town meeting uh we may have a full-time Town Administrator on board because it's the in is to October 1st all I'm saying to you is uh it's something that needs to be looked at for the future yeah it was looked at for the future with Jim as the health director fact of which was stripped of us by a residence discussion at town meeting and was not supported by the bard of slman they didn't say anything so I spoke against it myself because number one the duties that were being performed relative to storm water were zero and he's not qualified to do the work that a storm water agent would have done I'm only comparing Apples to Apples but the um focus was on the Board of Health and the reason that that storm water portion I was the reason that was created way back when is because we had three Sola farms in the early early stages and as I said at the town meeting we have no one on staff currently qualified to do that job we were just lucky the person that was the health agent was a PE and could do it all right but um I don't know uh if we'll be having more solop funds coming down the pike uh we're all the ones we've got right now are in various stages um of completion uh whether or not there will be something with battery storage that may be the next thing because we've heard about battery storage coming down but when you disturb that amount of land uh you need to know what they're doing and you really need to have qualified people to be able to look at the area of disturbance and to be able to do the math because when I hear Weston and Samson talking uh they do the math it's like going back and checking to see if in fact the volume and everything else works out I mean but those are engineering tasks so so again when I when I saw this it was just a matter of if down the road there's a chance uh please just keep it in mind the town the town needs to hire an engineer if they want somebody to engineer so have a town engineer that's conservation planning zoning storm water Tom fery because when Tom is doing something we have to hire an engineer whether it putting in a sidewalk or a whatever and maybe down the road we can afford to do that uh the other request I have is right now the stal water committee has been operating with six members and when you get a full Board of Health I request that a member of the Board of Health be appointed to represent the Board of Health on the storm water committee uh the uh when the committee was formed way back when uh the chairman of the board of health at that time was willing to do it doesn't have to but it's that important the other thing is down the road when the select have a chance to look at this the STW water committee might be an independent committee like the Conservation Commission but right now my main concern is I have a six member committee and at times it's difficult to have a quum so just something to keep in mind but but certainly input from the board of health is important you served at one time with us so interesting loved it you served when we were looking at the big project bigest Sol th we got behind a Ros yes that was the first one that you were on so Nancy when's the next meeting right now tentatively July except the June meeting got cancelled because when I looked at it I don't want to have an engineer come in and say we have nothing to add right because that's part of what they get paid to do yeah um the I'm going to post a special meeting of the stor water committee the same night as the planning board meeting because planning board cons continued the Brook Street solar hearing so they're supposed to be getting plans whatever up to date so they can send it to Weston and Samson so uh I believe it's July 7th whenever the whenever that hearing is continued that's when the stor water committee will meet again but it's only to act on that if plan says they're all set and they don't have to continue it again and planning approves what they present stat will vote that night to accept this uh change in design but we won't act without planning boards saying it's okay so ours is just kind of a uh if you will carryover so the third Wednesday in uh July will will be the monthly regular meeting of stor water okay so you're figuring the n9th the 7th meeting third Wednesday okay you just said something about the seventh is the planning board hearing it's a continuation of the planning board so it's a planning board meeting we will just post and be present so that if we have to take a vote we can one of the concerns from the developer was can we get all these boards together and whoever has to vote will be there all at the same time and be posted and can vote so that at a planning board meeting they do their thing if they approve it storm water can approve it as opposed to say well okay planning uh approved it tonight so two weeks from now you got to come to a stor water meeting they would like to get everything approved so they can move ahead to get that Basin constructed based on the new plan so that's why we're doing this uh to move it along okay um is when's our next meeting Elizabeth is there a date on it yet Tuesday in July is July 16 is the 17th or Wednesday the third Wednesday all right the third Wednesday that July 17th would be at one o'clock would be the storm water meeting if we had okay so we still have time have if all I got a minutes to approve approve we might have a quick meeting but I'm not going to ask Engineers to come in and right not have anything to say and they're on somebody's time clock okay thank you Nance okay I did get a set of asilt today for uh Tremont and Middle Street really so they had been waiting for those and uh the engineer rich richio said he would email those plans to Weston and Samson because they're waiting to do their final review up there uh so that's that's moving along thank you dear thank you all right any more public input
