morning morning I just want to first of all thank you for your service before I start the invocation and God bless you in your private and your public life so uh just a quick thought today is the last day the seventh day of the biblical Festival of sukot sukot is the Festival of the huts and one of the um interesting and very fundamental lessons that we can glean from from it is the idea that everybody goes into this little Hut and everybody observes the festival by being in this little booth and this little home and everybody is there equally meaning from head to toe You observe this observance this Festival by being inside and it tells us something about equality about everybody being equal and unified and togetherness now make no mistake it doesn't mean that in order to be equal you have a city of 80,000 not residents but 80,000 Mayors or 80,000 Council people you can have run a city like that it' be chaos of course there's a hierarchy of course there are various levels in society but with that and not withstanding that we're all equal we're all together we're all God's people so I pray today that God always give us the wisdom and the reminders the pleasant reminders to remember that at the end of the day of course we all have our positions and we have to hold our offices and serve the people in accordance with that but at the same time that we always remember that at the fundamental root of it we're all equal we're all the same we're all God's people and we all need to be unified serve each other and respect each other and appreciate each other amen amen thank habit uhuh discussion item 7A a resolution of the mayor and the city council of city of D Florida urging the Florida state legislature to amend Florida Statutes 316 2128 and 31620 65 in order to amend safety year requirements and enforcement as they relate to the operation of micromobility devices providing the city's lobbies with instruction providing for incorporation of recital and providing for an effective date all right this is Council M P's item Council M Pino you thank you mayor the reason of bringing forward this resolution as you know we have been uh actually going to recognize vice mayor pck cor before starting a conversation when we were discussing the issues and the concerns when when we talk about the scooters and in our in our city so I think it's appropriate for us to keep mov moving uh being being proactive and this and in this occasion is orgin the Florida state legislature to amend the Flor Statute 316 2128 and 316.2065 as uh that address the micr mobility devices micro micr Mobility devices include as you know not only the scooters and bicycles that can reach speeds that exceed 25 miles per hour and currently the Florida law allows persons under the age of 16 years of age to operate micr Mobility devices and allows persons to operate these devices without the use of a protective helmet for example uh the recommendation is certainly for uh my colleagues to approve this resolution origin the Florida legislature to require a floa driver license in order to operate a micromobility device and in order to require the use of a helmet for all individuals 18 years of age and younger who operate a micromobility device I think that we all pretty much aware of everything that is going on with this issue not only uh Citywide but countywide and Statewide so I thought that is a it's a it's a good moment to uh talk to our state representative and hopefully we have uh there's something be being done at the state level when it comes to uh micromobility devices uh Statewide thank you Council thank you councilman any comments okay need a motion yeah I think I I'd like to make a comment um you know in the city of theal more and more we see um youngsters high schoolers riding especially the uh electri mobit or battery operated and and uh some do it in a safety way and others you know do it with u a lot of danger uh one passed by me last yesterday actually in the morning and and he was not being very careful no no helmet but I as I understand we have to and correct me if I'm wrong Mr attorney we have to abide by the laws of the state first and we can amend some things um I think like you mentioned talking about it and putting it on the table and adjust it as we move forward it's it's important for the safety of our residents and especially those that are under the age of 16 uh I know a lot of parents do it for necessity and a lot of kids do it for necessity which is important as well because you know parents got to go to work and that's the only Mobility affordable Mobility that they have uh to and means other than walking of course to uh to get uh from long distances to to school sometimes it's more than two miles that they have to move so um I'm in favor of this um I'll support it uh I'll make the motion and and uh so we can move this forward okay motion to approve by Vice May P Corbit second by councilman Pino if there's no other comments let me just may just a quick comment I want to thanks our City attorney for helping drafting this resolution my pleasure thank you councilman thank you uh councilman I just want to make a brief comment I think this is excellent just this morning I got a text from a parent who was very startled because someone went right in front of them and they almost hit them so I think that there there absolutely has to be some more reinforcement so I think that this is um this is a a great resolution to extend to the state and through our lobbyist to hopefully see uh some improvements to the councilman poras mayor frag yes motion passes great move on to Item B item 7 B discussion update by the City attorney and support and moving forward in assessing and improving Lake Drive Street Council M Pino this is also your item thank you mayor as we all recall after the council discussion on that took place this year in February 2024 um I had the chance to meet with the city attorney and city manager in effort to determine the city's ability to present a legal re resource to the to the constituents in Lake Drive Street this proposal is prompted by the persistent issues of floating in that area even during minor rainfall which further compounds challenges on 79th Street uh furthermore the current state of late Drive street is is really really deteriorated throughout the years and it has been like that for the past 20 plus years so as you all know for an extended interior no efforts have been made to enhance the road conditions on this street and we all aware that despite the legal challenges of that is a private road uh we had this conversation not only we hosted a workshop before too and I just want to first of all say thanks to the administration to the City attorney and to our public works department because I know they have been working on these matters since we had this conversation as Council and after the work shop that was hosted so at this point I'm going to let our City attorney to take it from from here but I thought that was going to be a good idea to bring it back so that we can get an update not only as Council but also to provide to the residents about what are the options that might be available and hopefully to host another Workshop that we can have the residents participation as well thanks certainly um through the mayor uh I'll answer the uh question so um one of the things that we've studied and through uh discussions with with the manager's office and uh with yourself uh councilman is the possibility of perhaps creating some kind of a special assessment District but that would take the uh that that would take several steps one of the first steps that we've done is done a estimate of uh cost of what it would take to actually uh build the infrastructure what are we talking about building some drainage on the road uh repaving the road and raising it uh and creating some street lights in order to bring it up to uh City standards uh in order to do that uh We've estimated that there could be a cost of as maybe a million maybe more the reason why it could be more is that in order to determine whether uh those improvements can be made at that cost uh we would have to do certain borings to see what's under the road and see if there's any remediation that needs to take place but once we know that and we've we've been able to do those studies then we can fix a cost then what happens is basically the city in partnership with uh the res residents would take responsibility of that road would then make those improvements to that road and then through a taxing process the way that you receive a bill the residents that live in that area would receive a non-ad valorum uh tax uh bill every single year and that would pay for you know 30 40 years as long as it takes so it would be a proportional share of all the residents so the first step would be I think really meeting with the residents the residents have to uh be in favor of making these improvements uh and then having those initial studies and then fixing those and figuring what those costs are going to be I'm open to any questions you may have I have a question um the um my understanding this is a private Road H that's my understanding yes it's a private road and I know that the the last Workshop that we had that we have a discussion that government should not be it's illegal mean know what it was told to us uh for us to intervene on any private road I just wanted to have clarification when it comes to that because it's not just this road that have issues the street but there are other areas too in the in in the in our city but my understanding on the last Workshop by the building department it said that it's not it's illegal to interfere when it comes to uh private roads if there's no agreement between the municipality and that in uh private you know institution at HOA uh then yes it's completely illegal uh in some instances you have cases where an HOA has become defunct in other words it no longer exists and so in order to be able to get access to that private road you would need the agreement of everybody that lives along those roads uh this process is more of a of a dedication of the road to the city and then passing that assessment on to the the homeowners and my understanding is that there is an active HOA in that area so that would facilitate that process okay I would like to to explore a little bit more about that because I know that there are other entities that are also private roads that they're through the city that they're going through a very hard uh time when there's rain or hurricane or any natural um and I would like then for them also to know about this and they will have the option too to be able to have this opportunity trly Council woman okay so we will meet later on thank you the mayor yes for us so I know we've had a lot of discussions on this um we've had workshops I know Public Works has done a a really great job in explaining how some of these different things work um and so what would be right now the next steps according to this now that we have sort of an update from what it sounds like we were considering speaking with the residents in that area to see if they would be willing to take on essentially something that looks like a taxing district right and and then we obviously if they if they're in agreement then bring it back to us and then we can sort of figure out what how we can do this right that's correct the the residents would have to be in favor and a majority of them if they're not then that's something that we we can't do we can't impose this on them uh but if they are then the next step would really be um and this is under direction of Carlos Aro he's been wonderful in getting us that cost Testament uh and and studying that area uh would be doing the uh borings to make sure that there's no significant remediation needs to be done on the road uh and then passing and and seeing if the residents want to take that burden on okay oh I'm sorry no just to finish I so it sounds like the next step is to reach out to the HOA and get in touch with them right is that what's going to happen right now one of the ideas that uh in my discussions with councilman Pino was having a workshop or hosting a workshop here where we could have all the different disciplines that would be involved uh with the residents and for all of you to have a discussion with the residents and see if this is something that the council and the residents want to Mo for yeah that sounds good all right who the mayor yes one of the things I want to be clear on is is not the residents per se it's the owners of the property right A lot of these residents are tenants right and unfortunately the ones that need to make the decision here property are the owners uh that's that's we we got to get their buying is it is it the majority or is it like is there a number I think it's plus one 50 plus one okay yeah so anyone else okay so I actually um and I want to thank councilman Pino for being on top of this and bringing it up again um I've we've been there quite a bit and have talked to I've talked to many of the residents there and that same issue was expressed um that it's not just the people who live there but rather the property owners so um there is a process for for making sure we get to them but I think that for a long time this area has been a huge concern and while there may be other areas in the city that may have similar problems I don't think any is as exacerbated as this one so I think it's time for us to move forward and even look at this maybe as a pilot to see if there's other areas of the city that would also take on similar um you know a similar um tool to be able to fix like there's some commercial areas the Finger Lakes is one of them for example um so I think that this is a great opportunity to study and look at how we move forward if there is the acceptance of the property owners to create the special taxing district if that's what it's going to be to be able to fix the roads I can tell you most of the ones that I've talked to that are owners are 100% in they want to do it um there is a lot of uh tenants but it's I don't think it's over the 50% um it's still it's still a good number of property owners that are living there so I'm in favor of moving this forward um you know expeditiously I think it's it's been many many years of this area being told that we're going to do something and never it never gets done so um whatever we need to do from my end as far as making sure we have the workshop we get people involved we reach out to the property owners even if we send letters directly to the current properties that are there and tell them if you're a tenant make sure the landlord receives this information um I think that's going to be the best way to get everybody um in the same room and and and making a discussion I will personally go out and knock on all the doors and make sure they're here so do you need a to move this forward or I think through consensus I think I have your consensus through the manager's office we'll work on with all of you and your schedules and and organize a workshop yeah okay perfect thank you all right we go back we'll now go back to the items that were pulled from consent yes item six I a resolution of the mayor and the city council of the city D Florida approving an extended hours perimet for baru group Dalal LLC located at 11402 Northwest 41st Street Unit 00 pursuant to chapter 34 alcoholic beverages of the city of court of ordinances and providing for an effective V this was pulled by mayor frog yeah I have a concern with this um just I I know that when the original ordinance that was discussed a couple months ago was passed there was like some confusion on the hours um and I want to know if that was clarified on the on the ordinance was did we go back and look at the m so right now it's last call 2:30 but they can stay open till 3330 till 3:30 okay um I have my reservations about this so my question to Lorenzo can we take up the items all together or should we take them all one by one I just wanted to clarify that and and I want to yeah you can have a general discussion on all the items yeah so I don't have any and just vote and we can vote on all of them together or do you want us take them up individually you should take them up individual okay all right um I'll just make my comments for all of them I I I personally have a an issue with this I think the way the ordinance was passed and the way it was passed has to be fixed um and so I won't be supportive of the extended hours at this time but if there's a motion theal enhancing the quality of life for all residents the original request for submitting highlights the ongoing commitment of Oscar P to our city has been his contribution including are not limited to Leading the incorporation effort in 2003 providing continued support for City development projects participating in various Community initiatives and events offering guidance and expertise to city leaders and residents so I hope that you all will in support um on my recommendation um giving our um cman and uh Mr osar pu corve the the key of the city that is well deserved motion to approve voting is taking place now um I want to congratulate the new police officers from theout Police Department who were sworn in recently and I was able to attend their graduation was very very nice uh congratulations to the parks and uh parks recreation department for the how loween event it was really cute we had a lot of fun um I want to also encourage people to come to the event by our status of women Advisory Board this Saturday at 9:00 a.m. at I believe it's Legacy Park yes um and I also want to um wish everybody a happy Veterans Day since we won't be having a meeting before Veterans Day again I also want to remind everyone that the dif the D International Art Festival starts November 7th and we hope to see you all here it's going to be a great event I also want to wish Council Marin poras a happy birthday um and and of course last but not least we have a a little um it was supposed to be a plaque but they didn't get it on time so you'll have a key and a plaque but I wanted to do a recognition for vice mayor P corvy this is his last official council meeting and so I think it's appropriate and absolutely necessary to always recognize those who serve in our city regardless of any differences and opinions um it it's not an easy task and so um I served for eight years and didn't get a recognition from this ccil and I would never do that to someone else so I wanted to make sure that you did get recognition from us I'm glad that we are getting the key to the city for you and also there will be a plaque coming it wasn't ready in time but I did want to have something for you today so if we can just all go down and take a picture um and commemorate the four years of service and I don't know if you have anything you wanted to say you're going to wait till your to your time to do it um no I just I I do want to say thank you first of all of you for voting uh unanimous ly uh for the recognition of the key and and the plaque that's coming um I do want to say that uh this for years of service have been enlightening to me uh I learned a lot it's uh it's been great to um to get to know some of the uh uh staff employees of the city um I already knew some other ones but uh it was great to be able to work with them which was a lot different I believe we have uh great Professionals in the city uh very dedicated hardworking employees and U it shows because um every so often another City steals an employee from us so um that says a lot about what we do and how we do it uh at the administration level to the administrators uh thank you for for your support and what you have done and um and for your hard work of course and and uh and to the residents uh I'm leaving the deas but I'm still going to be an involved resident so thank you all of you for everything appreciate it it's been a pleasure thank [Applause] you for ch I just want to say because I haven't had the opportunity that I'm going to miss you so much I mean it's been four wonderful years even though I know that there's sometimes that we have not agreed in certain things but we have been able to sit down have a conversation and have a open discussion here in the de and for everything that you have done because I know you from before even though not as close as has been this last four years even though I have a a closer relationship before with dat your wife and just want to wish you the best and that I feel honored that having the opportunity to serve with you for all this for past four years thank you so much like you said hopefully I mean we are serving our community in so many different ways not just in this capacity but like you said I hope that you keeping um active and close to us and keep guiding uh with your knowledge and your wonderful advice to all of us thank you so much you know during this moment think of so many things that you also forget some and and I I need to make sure that I say that I thank my family for putting up for all the time that we miss together because we're serving and of course uh my right hand Claudia has been uh tremendously um uh great and and a big supporter and uh someone that I think uh made this job easier and better so thank you Claudia for support right we'll move on now to council comments yep you started already but it's okay well I just want to um congratulate uh vice mayor P corve again for his service thank you for your dedication your commitment and I'm sure we're going to be seeing you around and you're going to stay very active and you know this is the beginning of a new chapter of life for you and you know many blessings to you and your family and thank you for um your service and it was an honor to serve with you and also thank you to everybody that's wished me a happy birthday 25 looks good right councilman Pino thank you mayor well the Mr saying happy birthday Council woman for us uh vice mayor well we had a conversation about a couple of weeks ago about this state and and I promised you something I'm going to keep it in mind for next year I promised vice mayor Oscar pck that he will be on my VIP list on the Four of July event so all right yes I want to keep that promise but it has been a pleasure to serve next to you for the last two years and uh as I always said despite any political difference uh you always kept it like that just politics and um never personal and I appreciate that thank you and that speak a lot about you you your your family and and you have served this community as as everybody that voted for you four years ago were was was we're expecting so I say thank you for for serving our our city thank you so much and since this this the last meeting of the year and certainly I'm not GNA uh I I'll be seeing you guys again uh soon I just want to say thanks to to the staff he has been a great year uh I think that we have accomplished a lot and we while we had encountered challenges along the way uh I believe that we had we have continually be inspired by the unity and resilience of our community and and you guys demonstrate that as well and I want to thanks the administration as well everybody that is part of the the administration and certainly I look forward towards the future and I'm confident that our Collective efforts will lead to continue growth and prosperity for theale uh I know we have couple events coming up before the end of the year and I look forward to celebrating those events and and be next to not only the residents but next to you guys as well everybody that is part of the city and I also want to thanks my colleagues because again he has been uh uh despite as I said before all challenges and and differences it has been a good year for the city and I look forward to not only serving next to you but continue serving our residents of the ra thank you councilman anybody else yes um as we currently in the early voting period I just want to remind everybody that from October 21st to November 3rd I radar uh just so you know that this is going on uh that uh don't be surprised if if uh the clerk calls you and asks you for possible dates and please uh I I know that it's it's this is a difficult
