there was a second by councilwoman poras that motion failed 32 so let me say mayor that um I know we're dealing with a charter provision here um I don't think the charter provision is necessarily the deciding factor here I do think the charter provision frankly is a little vague because it says no less than seven days um that might preclude consideration for the morning meeting but from what you submitted it would not necessarily preclude consideration for the afternoon meeting however not withstanding I I think the charter provision frankly is a little vague not withstanding that where there was an actual motion and a vote taken to add the item and the motion to add it was voted on and failed I think that controls so I would have to say based on the fact that there was uh had it been presented without that I do think there is some that the charter provision ought to be clarified and is a little vague but I'd have to rule that since a vote was taken and the vote failed that the item is not appropriate for consideration at this time okay all three it would be item D and item M that's okay I will I will work with it on on the on the next me I should point out that you know that is contrary to what I understand the precedent is because I've always since the time I've been here I'm told agenda prints Wednesday and that's considered seven that seems to be seven days it doesn't say full days um so for I don't want the ruling to necessarily bind future consideration but here there was a vote taken and I think that the vote that was taken does control because the council voted on it and it failed I appreciate your ruling and I I will just say to the respect that um it's important that we follow our Charter um and all rules and that's what we have all agreed to do um and just because something has been done before doesn't mean it's right to keep doing it therefore if I look at this and I did consider it very very heavily it says no less than seven days therefore Wednesday the Wednesday before right uh the council meeting is Wednesday the full day Wednesday so you have Wednesday Thursday Friday Saturday Sunday Monday Tuesday Wednesday is the full is the day of the council meeting therefore you need the full day on the Wednesday before to have published um and that's not been happening but that is what the charter States that's seven full days I seven days no less than seven days anything after that would be less than it would be six days so and that's counting the Wednesday of the meeting you can't count the end of the day Wednesday because you have the full day Wednesday so I would look at it but um I think that that is very uh it's it's pretty clear as to what was just a few hours he wasum made at 2:00 and not before 10 o' so that's okay it's just a few hours anyway that's not going to stop me to be bringing it back and and being able to have this vote absolutely not I have a question to the mayor yes uh to the clerk how do you evaluate I'm going to how do I evaluate you know when when we submit or anybody submits what what you take question um as I I will be asking for clarification from our City attorney as to exactly what is the deadline for everybody for all of you to be able to meet that Charter and I will let you on all via email by this day at this time will be the last possible time that I need an agenda thank you so much I I just want to add also um when you do make that evaluation and I do agree that we have to be strict with the charter um for me me it's 7 days is 7 Days 24 hours in a day so council meeting starts at 10: I think as long as you submit it by uh 959 you have met it um obviously this could have been pushed to like the evening but again that's just another story so I agree we we should be very strict I just have a question on the m m is not part of those that were submitted after right but it is part of if you what I was going to say next so section 4.10 has uh section A through e and if you look at section c of the charter it states the city council member shall submit supporting documentation related to the specific agenda item that is sufficient for the city council to have notice of the specific agenda item request and to be able to evaluate the agenda item at the regular city council meeting the supporting documentation shall be submitted to the clerk no less than 4 days prior to the regular city council meeting till today we have no backup for item 9M and the memo States proposed adjustments to the public affairs Department budget for the current fiscal year 2023 2024 so there was nothing backed up and therefore May for the record we've had a lot of these where it's just a memo when with the discussion and it's really just for us to open it up for discussion um and in fact we can bring back examples from the previous meetings but by the way I think it's it's it's fine and even then we would still have to take a vote on whether we think it's sufficient but given that you know it is an important topic um perhaps we can add councilen if you don't mind adding some information just as a backup but I just want to make a statement that items like these have been discussed before exactly as is um and so we either need to EST Lish you know instead of cherry-picking which ones we need to establish whether it's acceptable otherwise we're going to be seeing ourselves removing a lot of these from the agenda because there's been a lot and I've never complained but at the end of the day I think it's a matter of a vote whether we want to continue to discuss it or not but you know to satisfy everyone here and you know just to be respectful of what everyone uh wants to see I think it's I if you don't mind bringing it back to me with just some you know backup I'm going to be I'm going to be bringing it anyway I have some backup here the backup I mean everybody went through the uh the revision of the budget at the time that was presented so everybody has a copy of it but if you don't have a copy of the budget that we actually uh that was really passed even though I voted against it I can surely I can give you get you a copy and I can add that within uh the memo but I I didn't see that it was necessary because everybody all the offices have receive it a copy of the budget if I may it's not about a copy of the budget it says proposed changes we need to see what those proposed changes are so I was going to have a discussion an open discussion with the council I I understand but the respectful thing but I'm not going to be talking more about this because this is coming back and I don't want to have any any any issue later on of what is it that I'm going to be ringing then okay the respectful thing to do for all agenda items moving forward and always especially when it has to do with budgeting items is to provide a the what the proposals will be so we all have time to ask questions and be able if you want us to make a decision up here that we all have time to see what and evaluate what that decision's effects will be that is what the charter provision is called for that's why it was put in so that there was respect amongst not just us but the public and that's why I am enforcing the charter okay we can move on to item 9e item 9e a resolution of the mayor and the city council of city of D Florida repealing res olution number 23 to establishing a zoning meeting schedule providing for implementation and providing for an effective date okay vice mayor P this is yours as you all know I requested the U in the last meeting um that we U evaluate or and move the uh meeting to one time per month instead of two twice per month and uh this item was suggested by the city clerk that we have to remove the dates that we already had accepted for the zone zoning meetings uh in a prior meeting so they can reschedule them into the uh new one time a month schedule that we're going to have thank you okay any comments questions yes uh councilwoman poras okay thank you vice mayor for bringing this I am in full agreement um and I I really do think to be a lot just to be efficient um and I think after serving the some of the staff and just getting also opinions this is something that is favored um and so I'm going to be supportive I think that what you're proposing is to combine the the zoning meeting with the evening portion of the regular evening session right correct okay um I'm full I'm fully in support of that thank you yes councilman Pino thank you uh my my only concern with moving forward on this is that and based on the report that the city manager provided as well is that sometimes we don't since we don't control the time and we don't control how many items we can have potentially on the evening agenda is that yes so far has been like the one for this evening hopefully we're not going to spend more than one hour depending on you guys but um but the the my main concern will be that what happened with the soning meeting agenda as well we don't we don't control that in the sense of the timing based on the report that was provided by the city manager some of the meetings were from 27 minutes to almost two hours a soning meeting so if you on top of that you had how many minutes or hours we can spend in the evening agenda what we might try to avoid is to see what we used to or what used to happen before back in 2012 2014 well the mayor was here back then that that sometimes we had Council meetings until 12:00 1:00 in the morning so again how you control the agenda the evening agenda plus the sunning agenda especially in the evening so that will be my my main concern okay any other comments there is a mayor may I yes I I'm pretty sure the charter says we can't go past 11: p.m. yeah but you can vote to extend it the time right okay so that just to clarify we we don't have to be here trust me it happened a lot in 2014 yeah I also to your comment uh councilman Pino um from 2014 to now there's there's there's been uh there's been a a big change in the we don't have as many applications and we don't have many as much land we used as we used to have and and and ever since I've been here maybe maybe 3% of the meetings have prolonged more than 30 minutes or an hour so that's where I base my yeah I got it wa if I may I yes counc recognized I'm the city manager to get and also to Frank that has been here uh for a long time I was asking and I asked at the time to give us all those numbers to see how long has it taken the past two years so it will give us an idea I also asked them to ask the different directors and also to our city clerk what will be the input on having everything within one day and the um at least the answer to me was that it was a good idea to be able to have it there and also our City attorney also addressed that if by any chance it will take a longer a meeting then we can actually then decide another day to continue with the uh uh with the discussion okay um I I my only concern everybody spoke and had there okay my only concern is that the the items that we discuss at zoning meetings are sensitive in nature and specific in nature and so such a critical component to our community that I'm afraid that we're not allowing for True transparency and participation from our public um I know our meetings run quickly and smoothly and effectively right now um because we've had we because we have two meetings uh separated to be able to operate through additionally um I was the one that came and proposed having our meetings separated between 10: a.m. and 6: PM back when the our meetings were take were taking till 2 o'clock in the morning and I think former councilwoman Sandra reiz is in the audience and can attest to that because she sat up here with me when those uh meetings would go into to 2 o'clock in the morning sometimes and we have to extend them uh I think zoning is such a particular uh such a particular item that we need to discuss and there should be opportunity for residents to know there's a zoning meeting and coming to speak on the zoning items because they heavily impact the community it's the way that it's been done for purposes of transparency and also participation and therefore I just don't see um the need for having to put everything and just completely you know drown our agendas um and make them so heavy in one seating uh it's clear that there's a lot going on in this city you know I think that we're compensated very well I know that there's a charter amendment to raise salaries for uh council members but you know I think we're paid very well that we can come here twice a month um and and sit in these Council meetings that's my opinion I will not be supportive of it because I think zoning meetings need to stay about zoning so that members of the public when they come they know they're coming to speak about growth and development in should participate in in or go ahead should staff a table which has informational materials um about the city at City at council members events correct right okay um I'm not going to be supportive of that because I think that there's enough work for the city staff that they have and to be forced to go to the endless amount of events that we have I think it's going to be an undue burden on them and um Mr attorney if you could please also um comment on the uh on going through I mean there's one part of it that it will be on that I would like to exclude within the revision that it will be the second so I wanted to keep um the revised portion on one on Three four five and six after as as I understand it councilwoman the only thing you're removing is the part that relates to um businesses whether there's a business involved with it nonprofits yeah right and otherwise a nonprofit entity but otherwise the ordinance not the ordance The Proposal the policy is intact except for that one removal and that's perfectly fine for you to do correct which number is removal a number two I want to send extension to the business and nonprofit so I think it is critical for us to make sure that um instead of the only part of the number one it will be only the time the five years and uh and number three that we will be implementing the background check and then the number four that the clarification the scope of exclusion provide clear guidance regarding the type of conviction that result or in ible for anybody and to be transparent and fair for everybody on the application process and number five that it will be first come first serve because I know that sometimes there applications that come in together at the same day so the first one that comes in should be the one that will have priority uh to be reviewed and then uh to communicate changes clearly I know that um before there was the policy was not really clear on how many times they have to clean up and all that so and I also know that right now we have a new process that will be electronically so they will keep up on the um the time that that the uh The Entity would do their duties to keep up the the other sign and as I understood it councilwoman you said that the the change was because when you're dealing with the nonprofit itself there may be different people in different positions one might be even just an employee and then you're talking about there's not really a principle when you're talking about a nonprofit there's a board and it could be somebody that's just fulfilling some role so my understanding is you wanted to delete that so if there's an individual that's involved that's one thing but and then the clarification it's now you're looking at the standard being felonies or crimes involving moral turpitude which you know is a little bit in the eye of the beholder but there are definitions of it so if it's if it's fraud or something that's one thing but if it's um you know like some kind of a reckless driving that normally would not be considered moral interpretive correct unless it was like drunk driving or something correct Madame mayor may I point of clarification um just want to make sure so when we have an entity come in is that the owner the CEO who is that this applies to just St I believe number two comes out entirely en correct yes so I think but but even we even number one you have well we still have the existing provision we're just not making the change that was going to be made in number two that doesn't negate what we have on the books currently thank you motion motion to approve okay I have a question on the moot on a motion there's no policy attached there's an agreement attached but I think the policy needs to come forward with the changes the policy was not attached here we can write something that once if you pass this we'll put it we I don't want to say codify because it's not actually code but the the written policy reflecting what you voted will follow okay because last time we made the changes it had the we had the policy con for so it's just easier to read the full policy with the changes um I thought we were just discussing potential policy changes but there's there is applications for streets right now which we're going to get into next so therefore the policy effect won't be till after it comes before us again or technically it could be immediately I'm asking if there is some clear violation um because we're not really changing the standard here with removing number two so if there's a violation that's existing in an application then that would still have to be verified but we're not changing the eligibility so the existing policy is you know with some the changes made here is what would govern it for instance if there's um if you pass this and it develops that somebody is had a problem and it was more than five years ago because this removes the five years if it was somebody who had a problem six years ago and you passed this then they would still be subject to not being qualified because it the existing policy is being modified but not as to who is eligible except for for instance for the the 5-year period That's being removed but it it does change the who eligibility it is a change to that only but only to the extent the the the major policy change has been removed they just what's I'm I'm with it I'm just saying because we have applications currently in front of us that's why I'm asking okay mayor all right so do you do you need a mo I'm sorry you have a question councilman councilman I I just have a question I know we're holding applications based on on this decision are those I know the mayor already asked but are we holding those application based on I think that's the clarification the city manager wants right we have on this agenda five applications and we have six more that are scheduled to come for May um so certainly for the six that are scheduled to come in may we can apply this new standard my question is for the five that are on the agenda do we want to approve them subject to them meeting this new standard do we want to approve them under the analysis of it I don't think any of the applications would be affected with the changes that were made by councilwoman cabal today so you know just if that helps clarify some of what you guys said security 101 utilizing tip Technology Solutions products and services contract 23105 and security systems products and services contract 23022 in the event that negotiations with ADT Technologies are not successful authorizing the state man to expend budgeted funds and providing for an effective date this was pulled by mayor Fraga okay thank you very much Madam clerk Madam city manager would you like an opportunity to speak on this item since it had been deferred twice yes madame mayor um this was deferred as you said from um the February meeting and again in March to give us the opportunity to go out and get a best and final offer from all of the the um entities there were four entities that had the necessary licenses for Access Control and close certificate TV systems for Dural Central Park um ADT did come in with the lowest proposal at 588,000 4436 um we are seeking authority to negotiate with them and execute um an agreement as part of that negotiation we we are accessing a Cooperative agreement we do need to confirm the prices on that Cooperative agreement and we're still working through that and we also want to make sure we tie down timelines associated with that to make sure we meet the timelines for dur Central Park however in the event we are in unsuccessfully negotiations given that again the timeliness for Dural Central Park we wanted to have the ability to immediately move to the second vendor negotiate with them and then bring you back um an agreement at your next meeting okay is there any comments or questions regarding this item all right I have expressed to the city manager already in our agenda briefing um I would feel more comfortable I think that ADT is a nationally recognized company uh and reputable that we move forward there's a big dis there's a big difference in the sum between 500 and and I'm paraphrasing because I don't have it I can pull it 588,000 588,000 versus 7 22,000 22,000 287 uh between the two vendors therefore I would feel more comfortable that you uh negotiate and enter into agreement with ADT and if for any reason there is uh a lack of negotiating and being able to which I I I doubt will be the case then it come back to us so we can re uh we can look at how we're going to proceed but um that would be my recommendation what I would feel most comfortable doing at this time second may I go ahead councilwoman yes I know uh if it's not my mistake uh and somebody can clarify we had issue before we the with the uh with the scope of work when when they were doing it here in the uh culture art center isn't it that that is my understanding I'm looking for it there's Evelyn Fernandez director because she can um give you some perspective on that good morning M mayor um Council of the members um City maner City attorney deputy chief um alien Fernandez interim IT director um in the case of cultural arts um ad was in charge of the access control security 101 was in charge of the cameras um scope of work there was a Miss um Communication in terms of Access Control with ad um they did complete the work successfully we had um a little Gap in terms of communication like um there was um a time that they were not responsive as we wish they were it took us a little extra time to get them back on track but they were able to complete the work have was after I mean you guys have to contact them and and be able to make them understand I mean and enforce the contract in order for them to uh comply correct so because of that I I don't feel comfortable then um I mean I understand that sometimes things are less costly but then it will be a burden to our uh Team so for me that I take that also in account to make a decision because sometimes things are might be cheaper and they're being uh more difficult to our staff so thank you for confirming that U where one of the thing that is spending is the City attorney will have to do an agreement with the company that we that get selected they should provide a schedule that they must buide by the schedule so that would be part of the negotiation that's what we when you when you mention a little time gap of lack of communication how long is little I was not in charge of that project remember at a time but I remember probably I would say a couple of weeks okay all right but I I think that's something that the attorney can put on the agreement and they will have to abide by provide a schedule ahead of time to to clarify what you're proposing is to what what the city manager has proposed but a little different which is to have um allow the city manager to enter into a contract with ADT and if that falls through to enter into a contract with security 101 and then bring the contract back to us for review correct the same way that we did with the with the speed zone stuff right is that your proposal mayor no my proposal is just to move forward with ADT and if if the if they cannot meet the the scope of work then she would have to come back and we'd have to reevaluate there's a really big difference in the pricing and therefore I think she should go and negotiate she has to go and confirm all the the um the the pricing and and and go into a negotiation and start the work uh if if they can't come to an agreement between now and the next meeting then it'll come back and we'll have to make an a decision but we're talking about quite a large gap in the figures and therefore I think that we should just move forward it's been deferred twice move forward with ADT and if if there's no negotiation on the contract then in that case it'll come back right now what they're asking for is negotiate with ADT and if they can't negotiate with that then go on to security 101 um but I have serious concerns with that and therefore I think that we should move forward with the ranking that was best and final offer the best and final offer came from ADT let's move forward with that and if for whatever reason I I have no doubt that they're going to be able to come to an agreement if they can't come to an agreement then she comes and tells us and we'll have to evaluate at that time the next bids but I I have no I I think that ADT is her very reputable company and should be able to uh provide the service just fine so that was the that was what we did we went back for f best in final we deferred it twice for that we got our best in final let's move forward with the best in final um um through the mayor yes vice mayor can I get the rest of the numbers I just here this is security 101 and the other two that's it the only two only two the first one there three what's the third one The Third One Source tips right no Source no Source Wells conver conver your mic apologies the third one was convergent and their quote was their proposal was 82,000 822 823 and 45 cents these were the two lowest best thank you so much so those two are close together to each other um except for ADT I I support the way that's written right now I mean I think it's it's a process that already took place um it's transparent it's it's gone through our process the one we we normally have and that's fine with me just just as a comment yeah I'm not arguing the process we should absolutely move forward with ADT they came down they came to the lowest price I just don't feel comfortable authorizing uh you know an open you know an open opportunity I think that we should just just move forward with ADT and if that process doesn't go through then come back but I think we should I think we can move forward at this point with ADT I think uh oh you want to say something go no that um like I said I mean we already have an experience with them and they have failed so for me I don't I don't feel comfortable of pursuing having them doing the work with them when already we have um another company that also has been giving services and we haven't had any issues in the past I think um through the mayor yes absolutely so I think um happy medium would be to for move forward with the way that it's presented but come back with the contract whichever one if the first one falls through the second one for us to review which is the same thing that we just did with the speed zone cameras I agree with that so I'll make a motion for that second motion to approve by Council boras second with by vice mayor cor it's I think there the motion is the way it's stated the way it's presented except for bringing the bring back yeah it's gonna to us to come back yes go ahead sorry I have a a fiscal year 2024 cycle Community Based organization grants in the amount of 3,200 to a betterday therapy learning center Inc 4250 to Dural temporary Art Museum 450 to theal Symphony Orchestra Inc 4500 to Miami Dynasty 2900 to Pat latam foundation and 2,850 to toys for kids Miami and providing for an effective date this was pulled by mayor FR okay um I pulled this item only because um we just approved today in consent agenda for deral orchestra to have a Mother's Day concert um they've been practicing and looking for space in the city and they really do an amazing job and they had asked if they could get the full 5,000 because they're going to put it towards the Mother's Day concert that will be taking place at the park and so they were awarded $4,050 and so I'm just asking for the 950 to be completed so so that it can all go towards their concert we also approved the use of the logo in that consent item um earlier today and so that's my only request everybody else is great and I'm happy to support those organizations um but I I've been following dout Orchestra and they've been really struggling to find Space and do the incredible job that they do there's so many residents participating in the in the um in The Ensemble and I'm looking forward to you know their concert on Mother's Day here in our Park um they've done everything themselves but they asked if the city would complete that funding for them so I make a I'll make a motion or someone can make a motion for me motion to motion to approve by councilman Bal second by vice mayor P Cory sorry go ahead very quickly sorry sorry no no no through the mayor thank you and yes I'm fully of course supportive of it something I wanted to mention just very briefly uh and something for us to think about I know that these These are CBO grants right yes um you know maybe re-evaluating the process of when we provide the funding I think that you know right now we have to wait or the the organizations have to wait to have an event and you know show receipts only because um you know through our own Council offices we have a sponsorship item that doesn't really require that so I feel like the process may not be so fair in that sense something for us to think about in the future because I have um spoken to a lot of organizations that have received this Grant and their biggest complaint not complaint sorry their biggest um concern is that they need the money UPF front and so if we can do something to help that happen um you know at some point maybe we can bring it back but just something for you guys to consider since the you know counil and that aspect um you know previously historically it was like that and it changed back I think in 2017 and I actually was opposed the change because of that exact reason even for our schools the ptas have to go out and get the money first spend it and then it's reimbursable I was told at that time that most grants are reimbursable anyway and they should understand that however I agree with you 100% I think that if we're going to provide these grants to these organizations then they should be exactly that grants and then they have to provide documentation for what they used it for if it wasn't appropriately used then it's not given again in the future but I'm fully supportive of that idea I think it's great and that's the what I supported the first time around too so um you can bring that forward we it's a policy we can bring It Forward you can work on that okay so we have a motion and a second to approve yeah you want to go ahead and so I just wanted to uh remind everyone we're having an HOA um event this Saturday at the cultureal Arts facility where we'll have the dbpr Miami dat County economics crime bureau South Florida property owners Consulting uh State Attorney's office our rep state representative um a David borero as well as um Juan Carlos por state representative is coming to speak about condo and HOA law we'll have a video from um house representative Vicky Lopez um Brian aila's office um my office will obviously be there we're also going to have seven different specialized attorney in HOA and condo law that will be giving free legal advice and services so um I'm just want to remind the community come out you're all welcome to be there uh we've gotten great response on that I also wanted to um congratulate Parks and Recreation for the extravagan event but with that being said I also wanted to just bring something to the attention of the administration I noticed at this event and I know that soon our D Central Park will be open and we'll be moving some of those bigger events back to Dural Central Park and hopefully parking won't be so much of an issue I know that in um Dural Meadow it is an issue but if we continue to have events there I noticed that a lot of parkings are ConEd off for uh vendors that are never utilized they always end up remaining empty and then you have residents walking so my recommendation would be to have vendors come drop off their stuff and then maybe cone off for them at the school where they can move their vehicles and leave those parkings open for residents I really really noticed it this time around I heard residents complaining about it like look at all these you know ConEd off um spots that were had vendor names on them but then they were empty they never got filled so that would be my only recommendation and and uh something that I noticed and heard residents talking about but other than that as always uh Parks and Recreation did a great job the sunset Jazz was an incredible event thank you to our ICM for being there um uh our inam city manager for being there and enjoying that with us we'd love to see that more often I know we talked about it briefly and the organization that provided the musicians is willing to do it for their you know it's young musicians that just want to practice and so it's such a great opportunity to do it now when the weather is still nice in the evenings and so I'd love to see that take place more often and I know our residents absolutely uh loved it and enjoyed it um that's pretty much it for mine uh I also just want to mention yesterday was councilman I mean vice mayor Oscar PG cor's birthday happy birthday we wish you a happy birthday yes uh and um that's pretty much it for me thank you Council comments yes we'll move on to council comments anybody have any coun I'll I'll make some um I want to thank everyone for all their hard work um again pushing us through yet another morning session thank you all it was a packed agenda and I'm glad that we got through it um I just want to make a a comment on um you know the tragedy that happened at martini bar and especially since I'm not going to be part of the workshop um obviously it's a truly truly heartbreaking and tragic incident that absolutely warrants an immediate conv Sation you know regarding our code and and what we should do um as a city to protect our community um and prevent as much as possible um some of these things from happening in our city and so I'm absolutely you know supportive in in making sure that we have that conversation I was hoping to have that conversation during this morning session um I obviously won't be there um at at 3 um but I just want to mention that when we do have a conversation where there will be decisions being made um which will not happen at 3 but hopefully when we come back and do discuss it there's still a lot that's happening um there's a lot of facts that are being uh released there's just so much right now the investigation is really ongoing um and just from my you know previous and very quickly review of of our ordinances of our code and just everything that's been happening I think there's a lot of questions um including on you know what we can do as a city to ensure that these establishments are following the rules are following the code um also to see if you know we can force them to strengthen the quality of their security um there's just so many things that we have to consider I don't think that we need to um necessarily um rush into any decision we need to ensure that we look at everything that we have as things develop and as things come up so I'm hoping that um I I don't know at some point we can find a resolution to come together and have an actual discussion where we can talk about all these different things and involve the proper uh parties and be able to make a decision on how to move forward since that can't happen today thank you okay anyone else coun comments yes go ahead um I actually I mean for the castano family uh you know very sad that this had happened like I said uh someone that Al my son knew and his girlfriend too and having to lost a life and in life I mean it is important uh to our police officer Ricky uh uh and to the other ones that were hurt we wish them you know fully recovery uh and for them to to be able to be with the uh with the loved ones um I hope I know that I brought this item uh as a discussion item to be lay this morning so we can make a decision here as an elected uh official body I going to try to bring it back at six o'clock I think that is important for us to have the discussion make decisions because even though we will have a workshop in a workshop yes we hear comments we can hear from different entities from the businesses from the residents but that's not where we make the decisions the policies are made and decided here in the days so this is the reason why I I brought it because I think that if we have two meetings we could take the opportunity and understanding now that we all I mean we all understand the policies we all have all the information uh that was presented and was sent by the city manager and I think that this was the proper time so let's see what happens later on after the workshop that we will be able then to make decisions that will help and strengthen our policies so our police officers uh will be able to implement those ones and those businesses as well for the things that we might ask um I'm also have another point that I am very concerning I got an information this morning uh someone sent me this information and I really don't want that our city get to the point uh of having issues like unfortunately other cities have had with business owners or people that presenting their business business where where we think that uh we're being attacked or any personal issue is going on we're making decisions based on that uh I don't want anything to happen the way that it had happened with um ball and chain that is presented here in our city and I don't know if this have got to you but I want to share this audio that really is really concerning [Music] counil woman you can't put an audio in Spanish can for res of the person for [Music] for [Music] when for in City [Music] Place for [Music] m oh no keep please keep playing it oh don't you guys want to hear the end I'm going I'm the one this is my time to speak translate that's fine I can translate this is this is this is this is my time to speak because this is my Cel comments so my concern with come when it comes to this videos or this audios is that first of all we were going to be talking about and making decisions on someone that was going to be and have presented and have bring bringing all the paperwork and has going through a process basing information on that someone has been giving favorites to anybody here so far I haven't received any favorites I don't know what is it that you want to imply when it comes to receive any favorites I personally I don't know anybody else here if he has or not the other thing is that if it is something so important that we have to discuss when it comes to policies having only a uh a workshop like I said again it's not going to make the difference the difference is going to be made here I was able and I brought it as a lay down item majority of the council also supported because they also consider that this is the time to make the changes on those policies so you would have the opportunity to be able to talk about that and to bring it here so we can make the decisions I don't want to end at one point that any business is going to be hurt in our city or the decisions are made only because somebody's making reference that certain people or certain entity is giving or doing any favors to anybody at least that's not the way that I conduct myself myself I conduct myself in a very transparent way and I when I make decisions here everybody knows in the past five years I make my decisions based on what it is the right thing to do and based on what it is more convenient to our residents of the city draw so I wanted to address that there are many things this is just one of those because I'm not going to be bringing all the other videos and all the other audios saying I mean your team and I consider my team the people that are sitting that are here because the people that are sitting here in the days are the ones that are we have to work together to be able to make the decisions that are a large convenience to everybody not to a group not to who is is supporting me it's not who is giving me money for my campaign no everybody body knows that when I have made my decisions when it comes to developers when it comes to any entity it is based on facts it is based on what is the best for my community and I think that it has been reflected in the way that I have the support of my residents uh living here for the past 17 years it is really a shame that these and there's many others that I'm not going to be bringing right now that things are based on trying to do things as a populism and not having the opportunity to make the policies and make the changes and and have a fair discussion here where we can make the decisions so those are my my Council comments I really I I I'm tired of this situation when the truth wanted to be manipulated out there in many in many ways and I just want to let you know that I'm on a an open book you can ask questions you can ask in cont me at any time why you have made the decisions the way that you have made them okay any other Council comments May here yes Council M Pino thank you uh I just want to announce tomorrow my office is hosting a drug uh awareness conference at D Legacy Park starting at 5:30 in the afternoon alone with our school board commissioner Dani spino uh you're more than welcome it's this is Happ in thanks to uh the organization called drug free award uh we're going to have Dr Marty Carman Rodriguez uh from the Iman light Foundation presenting also from the office of mental health and student services and we have from Miami day County uh School Police Executive Officer jandro Suarez uh this is a free uh conference happening tomorrow 5:30 at Don Legacy Park I also W to uh thanks the Police Department once again for the great uh work that they have been doing since this occurred at City Place and um and please know that um certainly it's hard to see when something like this happen in our city uh which is doesn't happen thanksfully very often so and I also had the opportunity to speak to Mr uh Jorge castan know the dad of the young guy that unfortunately the security the guy that passed away on Saturday and again I think we're all United on this and and we have to work together on making sure that something like this doesn't happen again in our city so that's all there thank you councilman any other Council comments at this time okay we move on to the city manager's report good afternoon I only have one item I just need to put on the record that on April 24th staff will be bringing forward the first of two public hearing resolutions required for brownfields designation for the Lithia Motors green rescue area and that will require two public hearings that designation allows them then to get the funding for the cleanup of the site or some of the funding for the cleanup okay thank you very much um Mr City attorney attorney just very briefly following up uh something from before we've held executive sessions on the cost attractor versus builtmore matter and on the Cabrera versus city of Dural matter um I'm again announcing that it's possible in the future we will need further executive sessions on those matters in addition I flagged some other matters previously we're trying to work through this backlog of cases we want to get it reduced so we have less litigation going on here period uh to that end yester uh having previously attended uh a mediation um in the um Gomez matter uh yesterday I sat in on about five and a half hours of mediation on the Dural 10 matter uh we did not come to a final conclusion but we are working hard to get that reduced but in the future we will need additional executive sessions I'm not going to be scheduling them in Mass because I think it's just too much for the Council to take in so I'll be limiting him to two at a time um but again we might do again acost the tractor we might do again Cabrera versus city of dur in addition and I think I read these into the record last time but just in case um Gomez versus city of Dural Dural 10 uh versus city of Dural sapoa versus city of Durell and per uh Pereira Diaz versus also the defense yeah city of Dural so I'm we'll have executive sessions upcoming presumably on all of those I'm working with the clerk to get a date for the next one uh which ones we have immediately upcoming depend in some part on when the attorneys who are handling them for us are available but expect two executive sessions certainly before the end of this month and definitely at least one additional set and and maybe two depending on some of the ones we've covered so um that's all at this point that includes my report unless there are questions thank you Mr City attorney Madam city clerk nothing to rep I have a petition to the uh to the City attorney you have a question for the City attorney okay you're recognized thank you um Mr C um Inter City attorney I would like to ask you to please if you could I don't know if it is to you or to the city manager that I have to instruct but I would like to ask uh to please if you can submit the paperwork that is a pending on the state that it was never filed and I say this without having uh without making any changes to the previous action that the council took is only just to submit the paperwork that was missing uh so they can we can move we can move forward with all the different cases without like I said again without making any changes to the pre actions that the uh that the Council made if that's the the will of the council we could uh direct the pension attorney to do that I would feel more comfortable if this came before us as an item if we're going to take action as per the charter this is not something we should be discussing unless there's an item placed on the agenda so if that is the councilwoman's will then put it on an agenda item and bring It Forward is there something that prud me to be able to request that just to send that documentation can't do it alone um you can certainly ask that that be done um the question of whether as an action item it does require some action by the council to instruct the uh the attorney representing the city because it it has to be done as a body so I would be happy to work with you to put um something together to be considered on an agenda I think I understand your intent um but it does it it can't be acted on by the council except through the council's processes but I'd be happy to work with you to if I understand your intent correctly you can present that issue to the council and we can assist you and do with that perfect yeah I would like I would like to see um after we have all those meetings I'll get with you about that absolutely couns thank you all right city clerk's report I have nothing to report mayor okay perfect I should I'm sorry I should add one thing quickly if we move uh subsequent to the workshop um as I've indicated I think to each of you if we are moving forward with actual uh some kind of legislation relating to the alcohol regulation issues it's come to my attention that one of my partners is involved with some of those clubs to whether it's an actual conflict it might be it's certainly at least an appearance of conflict so I want to disclose that on the record and if we we're going to be moving forward Beyond workshop at that point um we're going to recuse ourselves and I'm going to bring in outside counsil so there's no hint of any impropriety and I've spoken with Gary Carmen at the grey Robinson firm and he's agreed to do it at a very reduced rate they have substantial alcohol experience and we'd bring him in as special counsel um and we would remove ourselves from anything to do with it thank you okay with that being said uh Mr G hold on Mr G um there's been discussion about trying to bring the discussion again forward this evening the purpose of the what was originally supposed to be a meeting and I had to change to a workshop because there was refusal for a quorum then um the idea was to discuss at that meeting not only get a full report like I asked of all the incidents noise reports everything so that we can amend the code but that'll have to be publicly noticed the right way anyway therefore I'm proposing and that was what I would what I was going to discuss today proposing to bring that forward forward at the zoning meeting with the with the changes and then at that point it'll give you enough time to engage Robinson uh's firm to be present and and represent us in that absolutely mayor um I will be in attendance at the workshop because no action's going to be taken I'll be attending at the workshop and that will enable me to give him a full briefing and whenever the council uh however and whenever the council is prepared to move forward it's not necessarily for the meeting we want somebody engaged to assist whatever it is that you guys want to do in advance so that you have the opportunity to prepare so that would take place right away as soon as the indication is that there's any moving forward and I've heard this morning yes various members want to move forward on it we'll accomplish that and that way the not just the council but the citizens can have full confidence that there won't be any appearance of impropriety or any conflict thank and clarify some points um I was your neighbor for quite a while actually I was chief of police for Sweetwater for eight years before I came to the corporate world which is a little different but I know the needs of your community I've worked with your police departments before many department heads you have an incredible Police Department incredible Personnel that work here and uh it's a pleasure to have the opportunity to work with them again ver stands as the largest public private partnership globally uniting the strength of both sectors and offer P parel expertise and capability and deployment serving Partners in any location or region in Florida our partnership with the city of dado is a testament to our commitment to life-saving initiatives through proactive enforcement programs although the Dural program was phased out after achieving its goal behavioral change the infrastructure and channels established offer seamless integration of schools own speed enforcement projects ver recognition as top contender in the initial phase of the vetting process and second in subsequent phase underscores are comprehensive qualifications the initial phase and comments are documented by the panel clearly stood out amongst all all competitors are just 11 point shot of a perfect score and over 60 points above the closest competitor our numerous contracts in Florida demonstrate a tailored risk-free approach to compliance for agents and only competitors with limited scope One camera based in Florida that's but that's the touting of the program itself in Florida that that the one of the competitors has unlike competitors with limited scope's commitment to scalability impactful programs is evidenced by our existence operational Network across the US US reinforcing our status as a distinguished provider and the largest in the nation initial thoughts on this and I'm I'm not going to go into the sub details I provided you all the documentation that we presented at the initial RFP presentation uh and subsequently we added an additional one at the orals but one differentiation I want to make orals are not meant to supplant or substitute the RFP process they are meant to augment them that's been my experience and I believe that's what should happen here so I also handed you the phase one uh ratings which you did not have as part of your core package I went ahead and raided them based on the process and like the Pastor said Justice and fairness in his opening statement and that's what we're looking for justice and fairness so if you look at the ratings once you take both into account ultimum rates at 459 red speed at 413 safer speed at 435.214 let me go back to the orals just for a minute because a lot is lo is Lost in Translation when they mentioned the Prov providing of a handheld well they provided an addition product yes where we asked if we did or we did not the question is we did and it was included as part of the package we include 10 decoy cameras in order to help you avert and subdue crime so that is part of the original RFP that cannot be ignored so that was not brought up in orals that that really goes to show that you have to take and we both processes and come up with one final solution in number by far globally uh regionwise Statewide and actually internationally we have teams that support every every single region and are ready and willing and able to respond within the quickest time frame as opposed to any other vendor that presented here or is going to present here we stand by it uh talk speaking from a technology perspective your city's already surrounded with aprs you have done an amazing job by geofencing your city our our technology is probably the best on the market we make a recommendation based on what we believe to be the best product for this particular solution I can tell you most a lot of you will hear about lar and radar well radar actually performs better under increment weather and that's a fact so in South Florida unbeknownst to well knowns to all of us increment weather is not an when that is why we chose a solution we may provide lar but we recommend radar as a solution um you know interestingly enough we have over 10,000 systems in North America over 80 speed camera programs in North America and in Florida we've executed already three and in the process of executing two more contracts for schools own speed that's not because we are the smaller one or we profer something other than the best and provide the best service around like I said we serviced your program our back office is in place for your program and we are ready and willing and able to partner with Dalal to succeed and curving behavior and providing safety for our children so at this point I'll I'll open the floor for any questions you may have of me uh we're going to do questions at the end very good is that the end of your presentation sir yes ma'am okay great we will now hear from the next which I believe is red speed uh good morning uh I'm Greg parks with red speed appreciate the opportunity to be here uh you definitely have gone through a process and I commend the council in taking ownership of this this is your program it's very high-profile you're s haven't had a photo enforcement for over a decade you understand that probably an understatement right so I thank you all for having us in today to go through what we can offer compared to other good companies and certainly be prepared to answer the questions at the end how do I Advance the slides Connie green for go okay um so I'm going to talk about today very quickly in under the five minutes experience and Leadership our best technology I believe we have the strongest local presence something that I haven't heard many people talk about about this morning is the public education awareness it's a big new high-profile program you're going to want to get ahead of it I believe some of the failures real or perceived of the red light camber program is where the vendors didn't own the message for the cities everybody concurs that it's dangerous to run red lights but they got perceived as a money grab and everybody should uh be in favor of reducing speed in school zones but we need to help you have your citizens with a message nobody talked a lot about legal either um I believe I'm the only person in the room that physically worked on the law in Tallahasse in for three years one of our very good competitors participated in that process since the person that did that for them has left so I think knowledge of the law and our local legal team which I'll talk about I think will be valuable to you experience and Leadership we've had a lot of people talk about what they offer um we've had the same management team for 15 years our five senior managers have over 100 years with red speed um I will never badmouth anybody I've heard us mentioned by name a couple times but um we're the only vendor presenting today that has had the same name continuously every other vendor presenting has changed your names in the fairly recent future there's probably different reasons for that but I believe stability is the key thing that we can bring for you all our CEO resides in South Florida we have a fully staff technical office in Miami date County in in Aventura and and we have support and parts in halia gardens the most recent law to pass prior to the 2023 House Bill 657 was in Georgia we have approximately 70% of the market share there and it's the same almost virtually the same laws here so it's a lot more relevant experience we think that a program in New York uh that operates under complete different parameters and I want to talk a little bit at the end about the legal aspect it's very likely this be challenged um we've retained white soda who is the preeminent other than Joe preeminent local Municipal firm in the state they let I'll talk a little bit more of them but we just had oral presentations at another city it was my understanding that no one else would commit to paying your legal fees or V said we're unambiguous that we're there for you if challenged with the preeminent local off firm we recently had the honor of being uh selected by the fora police Chiefs Association as their preferred vendor and partner that's a very well respected agency probably the most respected of the 50 states of police agencies and they did a lot of vetting and have actually notified all their members the Chiefs that they believe we have the best solution and our other partners so we're really proud of that as I mentioned we have 350 systems in Georgia Georgia we have 600 systems going through the process in Florida we do have a fully live fted fot permitted system in warnings in a small town called LTI we actually have received Pine Crest permits and will begin construction here so I do believe we are the first mover and understand this process better some of the results we've had it's all about safety that's why you're considering this uh in some very similar communities in Georg guette County speeding is reduced 95% and probably the most notable stat to me because traffic patterns vary but 93% of the people with our system in the biggest school system in the state that got a ticket do not receive another one so it's absolutely modifying behavior and we're very confident you'll see those results here as well A lot's been talked about technology it's a little granular for policy makers but it's important we prefer lar but we also have hundreds of radar systems uh two two vendors offer each now what we like about lar and we found many many members of the J Judiciary prefer it it is commonly known to have much better Target ID you don't you don't want to site the wrong vehicle that's a toxic for the program and our solution with laser actual Circle will be drawn around the target the alleged violator and that gives them a better feel that uh it is an up and up program and you're uh I believe in Mii D County Court which we've spoken with they will prefer that as well public education awareness we really think this is important as I mentioned you need to own the program we've got a local team PR we understand it we've done it we have by far the most recent wins in this space we'll do handouts for the flyers for the kids to take home email we'll do posters FAQ all kinds of other things and we provide I believe the most robust stats that there are on how the program is working quarterly or biannually to the to the council for distribution to your constituents and I have not seen any professional PSAs produced for any program other than ours I know you guys had a very successful red light program for a decade I don't recall seeing a professionally produced PSA maybe it was and overlooked it but here's some examples of what we've done in Pine Crest because there's no audio well we interview uh teachers parents uh police and uh this is available for their social media for their website many of our customers in Georgia actually send these PSAs out when their citizen inquiries because they also talk about the aspects of the law no point points no insurance you have to be 10 miles over Etc so we think we do that best and to start to put a bow on this there is a likelihood of a challenge to this and we are unambiguous we will defend you with white soda who was the lead Law Firm at the Supreme Court for defending the red light programs they also have helped us interpret the law that we worked closely on and here's the here's the statute that states you can use alpr and and other video for purposes of determining Cal or similar liability for incidents captured by the speed detection system incidental to permissible use why seroa believes it's unambiguous the sponsors one of them a formal council member here sees it that way as well too and so we think it's a big value ad that we provide in technology and understanding the law from the context of the institutional history of working on it so to wrap this up We Are The Local Company we are stability we've already been working with Mii D County engineering with had a call with FPL yesterday we worked with fot and dhsmv to Define and set the standards we have the south Florida presence which I've talked about and lastly we think we have the best technology we I believe we know we have the best technology also no flash radar laser options integrated or Standalone alpr our thought in that as a policy maker what a great tool for your police Nova wanted vehicles in the school zone during the school day self serve oned video against stability we've not changed our names we've not been replaced um one of the presenters here uh that mentioned us we've replaced them five times recently one as recently as last week and we've never been replaced when we're in a program we have offered a very fair no risk no termination penalty contract as a couple of the other proposers have in fact we've proposed the exact same terms to you that Mii Dade County contract with us for for 206 schools um established leadership has said we we're contracted already with Miami day Pine Crest Miami Gardens Manatee County we have four Miami day municipalities agendas coming up so our local presence from information sharing for your police to just the knowledge and the the uh bandwidth of working with the people dat at mind day Public Works and transportation Etc so that's with five minutes overview why we think we're the best choice for you all thank you thanks okay our final presenter is safer speeds morning good morning my name is Jim McLure I'm the managing director at uh safer speeds and thank you thank you very much for allowing us to come down we we weren't your first choice but your process has been by far uh the most thorough that we've seen across the state so we applaud you for that um I've got with me John hickon um we are your current uh supplier through one of our partner companies for all of your alpr and you've heard a lot of similarities between all of the companies the systems all basically look the same um we did uh forward down to you a updated presentation that highlighted some of the um discrepancies if you will from what the committee had reported and so I'm hopeful that you will take time to review all of that uh in the packages that we forwarded to your procurement section so as we look at this here today down here locally vetted Security Solutions which is a partner of safer speeds is a local service support company that already does the alpr for the city of Dural and with that being said alpr has been mentioned multiple times in the solution and how we would provide that right so when it comes to merging these products together Al is very important in this and we believe that the City attorney as multiple people have noticed either says that they can read LPR through our the program or you can add cameras to it we will provide both no matter what so you can read it through there if the City attorney allows it and we will provide Standalone cameras wherever you want in the city you guys were a Pioneer when it comes to LPR and you're a Pioneer when it comes to this so as it goes to City Safety Dural is always at the Forefront of this um sure so uh this is uh again presentations that you all this button John presentations that you all have seen and again there's a lot of similarities so we won't uh consume a lot of your time with your full agenda today but we do hope that you'll review some of the the detailed discrepancies that we did forward down in that for your consideration and we wish you all the best uh like everyone represented here truly and especially for me after 30 years of law enforcement in Florida um we're we're all encouraged by the number of cities that are taking the student and crossing guard safety seriously so uh regardless of your choice we're hopeful it'll be an effective program for the city of Drell thank you thank you thank you okay we'll now open it up for discussion amongst my colleagues and we can call up those that you have questions for kind of just have a casual conversation yes I want to ask the city manager you mentioned that uh one of the applicants uh did not submit a paper work one sheet and at the meeting you mentioned that they did turn it in and one package the digital or the printed what is it can you please explain yes I can clarify so um it what happened was um red speed specifically um all proposals were asked to submit a digital form and a printed copy a hard copy and there was a page that was missing from the electronic copy that was actually available in the printed copy however the evaluation committee was given the electronic copy so they did not have that one page so when that was discovered that was the real impetus to reconvene the evaluation committee does that satisfy your question yeah okay counc and this is to uh Vera I saw in your application that there is a section or a note that you there's a cost to remove some of the insulation equipment I think it's based on whether you know the contracts terminated early for for whatever reason is that something that is negotiable is that something absolutely to not not an an argument whatsoever not an issue whatsoever uh one one point I'd like to make uh commissioner Council M I'm sorry is uh you know even in the recommendation that was made by your staff clearly in the second page it says that they feel we are qualified as well very qualified um can you please speak into the microphone I apologize that even that I'm addressing page two of the comment or memo put out by your staff the conclusion says that we are just as qualified as ultimate and I would argue that that would be take it into account as well as the tabulation of the scores as I mentioned before I think uh like I said like the Pastor said Judiciary and fair the fair process is to combine them both the missing of one page and one document to reevaluate and rescore is just not enough to just take and literally throw the baby out with bath water if you will okay yeah that was my question I'll I'll make comments after everyone asks questions thank you I have another one yes can you tell us the points per total points per company for the first phase I have it I actually tabulated it yeah you do you have it or I I do have it um so um for the first evaluation committee scoring ultimate scored 424 red speed scored 371 safer speed scored 420 and Vera Mobility scored 489 489 yes thank you that's turn now yeah go ahead go ahead yeah yeah I have another one it's open discussion during the first phase um did the applicants had an opportunity to present presentations no they did not and that was a decis ision when we were decided that we needed to have reconvene the committee we decided at that stage to allow for oral presentations okay thank you any other questions yes please go ahead councilman thank you mayor uh well first of all I just want to thanks all the all the applicants all the companies that are here here I think that as um as it was mentioned I mean is everything is very similar especially for us up here for me especially you know but I'm I'm sure we're going to be in good hands regardless what the decision is uh and certainly I I'm glad that we're you know we're moving forward on this uh thank you councilwoman coros for for starting this discussion one of the things that I um that got my attention is when we speak about I mean I know Vera for example is very well known uh when we speak about red light cameras I mean it's not a secret uh they have done a great job Nationwide on this matter uh but at the same time when we look at Red speed uh they're well known for or they focus on speed Z safety so um I was reading here on red speit they're endorsed by the Florida chief police chief Association uh which I found very interesting and at the same time the fact that uh they're from Florida I mean that's that's also something that caught my attention uh with Vera again I I commend you because I I can see the the history behind so again I don't have any technical questions about how you guys matter handle this uh the the whole school some uh some speed system but I just wanted to say thank you for uh for bringing this forward to our city and and again I know that regardless of the decision that we make is going to be uh something good and I look forward to working with with any of you in the future so m i mayor have another push yes so um to the manager um so the the the first phase did not have the opportunity or did not you guys did not request correct the uh presentation and the second one you did correct and that's why you called it so if I want to understand so we're not disregarding phase one no the scores in the second round reflect the committee's complete evaluation including what they had reviewed in phase one so it's not two sets of scoring that com combine the second set of scoring replaces the first set of scoring by the evaluation commit when I add phase one and I add phase two Vera comes in first with 963 and ultimate 918 second that's uh 40 right but it understood Council me B mayor but it wasn't it wasn't uh combined scoring because they with those oral presentations they re-evaluated everything with the oral presentations and the missing information from that one proposer they re-evaluated everything and the the yeah okay they yeah they so it flect that full reevaluation that's it okay any other questions I just have a comment that yes Council cover I actually um have met with the city manager and asked many other the questions that I had and sure my decision is going to be based on part of the scoring and also the experience and the uh quality of service and the technical approach uh to be able to um be applied within our city needs so I went through everyone and at this point I don't have any question all my questions have been answered within the the information that I gather for the city manager okay I have a couple questions all right um so for me looking at this first of all I'm I'm I'm going to be honest I'm a little bit uncomfortable with some of the discrepancy IES in the um scoring process and the two phases and when you look at the two different scorings they do uh vary quite significantly but when looking at this process um there's a couple things that I look at specifically and it's hard to dissect all four of these proposals um and I I and we received this packages maybe Monday it was Monday there was a p there were packages with what went out with the agenda but they were reacted right so the full packages I'm not sure I think they were bring brought to us Monday or was it Friday sorry sorry I'm looking to Jackie because she was the one who Jackie our procurement director I saw him on my desk on Monday so they may have been dropped off Friday but so they were dropped off individually to each um council member and mayor and vice mayor um but they were it it was as available so um each individual received a different time because it was whenever they were available here to receive them got it so I I got mine about Monday and it's pretty extensive to go through and these are the things that I'm looking at when I'm looking at these at at this procurement and when I am given um a recommendation by staff I go back and look at the scoring based on several things one contract price what is the cost to the city if there's no cost to the city what is the uh the revenue for the city two legality contract terms uh closets for consolation fees to the city for contct for for contract cancellation I look at um service what is the service that's providing to the public and how does that how is that evaluated in performance um I look at experience depending on what the contract is or what the the services um and then I'll look at past performances should it be a a veteran company in this case it was a little bit different to look at because it's such a new law and such a new process for us so it's really something that we are going to almost pilot um and I think most cities and most jurisdictions are piloting right now as it was said by one of the presenters there may be challenges faced look it's no secret we took off red light cameras in our city because there was just a public uh distaste for them the public did not necessarily like the way the the the ticketing process happened they felt that it was not a very fair process there was no contact so customer service who's administering these tickets that's what we're kind of looking at and so I don't feel like those questions were answered for me neither in the presentations nor in what I researched and what I looked at in these packages again it was very had a very short limited amount of time to actually go through everything between Monday and Tuesday um besides the heavy agenda we already had um to be able to really dissect each of these companies so I Rely heavily on what staff's recommendation is in these cases because the committee is the expert that goes through the process of looking at these individually and I trust that the committee does that work then I go and just verify right trust but verify I don't feel like I can do that here so I'm very uncomfortable with this process I have to say I'm very uncomfortable with the way this process has gone um because I want to go with the recommendation of Staff because that's normally my just my my my my my policy I feel it's the best public policy is to go with staff's recommendation um and in this case it seems to be a great company but to my understanding they don't service much in Miami Dade County or in uh the State of Florida so and correct me if I'm wrong and if the company wants to come up and and and and um and give us that the that information but to my understanding um they are not servicing many contracts here locally and there has been uh I guess Replacements in in other jurisdictions and then I'll just also say when I look at the written evaluations from phase one your company did not score the highest so can you tell me a little bit more about your experience here in state of Florida sure for for one I've been in this industry for almost 20 years longer than anybody you'll probably speak to certainly today um we do have hiia Gardens contract we have elportal the gentleman sitting in your attorney spot uh negotiated that contract and approved it as well as the ordinance we do have the first and only operational program in Florida we have several others since then and we have our alpr program already launched we're in8 different states we have almost 200 employees and we've been around for almost 15 years so we do have the experience of launching this program and experience here in Florida can you tell me a little bit about your customer service experience sure well you met the greatest differentiator among them is uh Anna Perez your local uh representative so they're right she's right here so if you have a problem she's four blocks from the police station she's going to I'm not talking about customer service to me I'm talking about customer service to the public so when and again this is a new system so I'm not sure how the administration of it is going to take place but for example for the red light cameras the way it used to be was the person got the ticket and a lot of times they had no contact with the company or reviewing there was very little appeals process sure sure so one of the things we pride ourselves on is being an American company and having our own employees so if a violator calls into the call center again it's our employe they're in our building they're right down the hall from Tom if if the people are processing the violations we don't Outsource that we certainly don't offshore it like some people do to another country it's all in our building our employees again right down the hall from Tom so we have that contact with our employees who have direct review over everybody on that so that's Paramount to us so if someone gets a ticket in this case what's the process so they can do a multiple multitude of anything they can pay the ticket they can go for an judication hearing just like you did with the red light cameras and that's you know that's for any vendor I'm not distinguishing between us anybody would have that and that's on you a judication hearings they can call in they can transfer liability um if they get a ticket and through your company yes yeah we handle that and they can transfer liability if it was you know if it's my son and the great thing about this there's no points there's no insurance so if you have a kid that does this and you want to teach him a lesson you can transfer liability all right son you go pay this ticket it's $100 but learn your lesson right so we handle all that for you okay I don't know if that any other company wants to come up and give their their yeah sorry if any other company wants to come up and give us their um description on customer service as how it's handled for the uh Vera and then red speed wants to come up too so I includer as part of your package is the the process that we follow uh and we U touching a little bit on on a couple of other matters we have a very robust uh campaign for social awareness and we've partnered in the past with Dural to make sure that it is a successful program to aware make a public aware of what is coming down um as far as the the process itself it mirror is similar to what Jason has has pretty much proferred we uh we pride ourselves in customer service it's all uh based within our company uh by our own staff a based in the United States we don't Outsource to Nigeria or any other country uh we do everything local US made us born and US driven and we pride ourselves in that we have local support here in the form of myself our staff here readily available at all times to perform and react to any possible issues you may have um again we all we all provide the best service around we have proven that in the past with Dural working directly with your Pi uh who's Amazing by the way and we'd be working hand inand with them in making sure that any features that are not inclusive of what we provide now we make them happen for you as far as making it easier for the client to navigate so that's where we stand we stand to adapt to the mun the municipality or the agency based on your needs that's the unique uh uh perspective that ver ver brings to the table and that's what I bring to the table I look at it from me being the client that I was I was the client for vera for many years running the biggest program in the probably the state 155 units in the city of Miami and then I ran the program in Sweetwater so when they ask me my perspective I act like a I'm sitting in the on the Das or in the chief's Sheriff saying hey this is what I want this is what I need and this is what the community wants so we know your community I know your community and we know we can adapt to whatever needs you have based on your input and um and our partnership okay I can can he answer the question about the tickets how people get the ticket yes I think he did at the beginning but uh the vice mayor has a little bit more spe specific question on how you handle if someone needs to call for a transfer of ticket or maybe obtain video all uh web Bas driven uh it's very user friendly uh there is uh like like Jason mentioned we all have the same statutory boundaries that we have to follow the same guard rails as far as transfer of liability and like so pretty much it's all statutory driven but we go that step further and allow for you to tailor to your needs and your community's wants okay I don't know if uh red speed or I think um safer speeds would like to come up and address that point I I have just a couple other questions if we can go around again though if you guys need yes uh thank you Greg Parks red speed um as as a couple of other good companies have mentioned is statutory on the appeals process the alleged violator has a right to request a local hearing which will be held here or to have a UTC and it would go to County court and that's statutory the law that again we worked on um I really appreciate your questions on customer service something I believe unique that we do is the city will have a dedicated 800 number and it'll be answered by Red speed but answer Dr schools down safety program and that rep that answers that call will be specifically trained in your rules how you want to do it are you enforcing a 10 over or 12 over how you like to handle specific things emergency vehicles funeral flag men so we think that's unique in that and I very very want to be careful to we're not badmouthing anybody but this is a chance to State our case and I think our case is strong as that we virtually everything uh we're fortunate to do that that we've been involved in and um I think one of the testimonials to our customer service we have we have not been replaced and again this is not bad anybody but the two people that spoke before us we have multiple replacements of them and I do believe service plays some point to that so I think customer service is a big strength of ours and one of the reasons that great governing bodies like you all have chosen to place their trusted us we are the leader in school zone safety okay thank you Mr Parks and to give an opportunity to safer speeds so yes ma'am you're probably hearing the theme now that there's statutory requirements that all of us have to adhere to including uh a viable Affidavit of Defense which was referred to as transferring liability so our response to the public is carbon copy to the others we we have uh customer service Outreach we have public awareness campaign uh and responding to the um folks that would want to contest a citation up or a notice of violation up to the traffic citation um which then runs through your court clerk's system that's already in place so I we're basically similar to everyone else's uh processes when it comes to that do you have a customer service though um location so we have an online and phone number just like the other companies have where the violators can go on they can look at the video they have a PIN number so they can only look at their violation it can be paid online with a credit card we also built the flexibility into our system there are some cities that we're working with who they would like to have a place where someone someone can come in and pay in person at the small municipality so in our software we even have roles for that we don't dictate what the needs are of the agencies so we've been responsive to that as well okay um I have a question for you guys specifically do you all have any current contracts with school speed zones um anywh we do not we are similar to the other companies were close uh waiting on ordinances and processes to get through City commissions uh we we have test systems if you will or demonstrative systems in some cities in uh Broward and in North Florida but we're just waiting on the council to pass ordinances I appreciate it thank you so much for being here anybody have any other questions if not I'll continue yes go ahead I'll I have comments later but after Okay um I have questions about fees for installation and initial costs is there any to the city from any of the companies I did not see that particular no and what are the shared percentage of of profits to the city um for each individual company did any score higher or less based on percentage of fees to the city or are they all the same no they're not the same um and not based on percentage but I'll give you the numbers that they each proposed so um the fees that what and what they proposed was the fee they would charge to the city so ultimate um propos that per ticket fee of $20 per ticket per ticket red speed 21 safe speeds 18 and Vera Mobility $19.20 um so that means much $19 20 very very very very specific apologies no $19 um the the um red speed and ver Mobility um in addition to that um and this was brought out a little bit in ultimate's presentation red speed um also would charge us um $4.5 per certified M piece and ver Mobility would charge us um $2 um certified mailing fee which is a $4.5 plus plus $2 per page per citation so that's how so I'm sorry to save R Mobility again it's $2 for the certified mailing fee of $415 plus Vera vera for plus $2 per page for citation so then it's really four five6 615 $65 that's Vera red speed on what was was just a certified mile fee the $450 cents and um altimate and safer speeds had no charges in other words that's built into their feel ready okay and then I have a question on technology and flexibility so if you go out to some of our schools which I know some of us have done and looked um and looked at that um there's areas like for ex for example D academy uh Elementary which I go by a lot because I live on right next to 97th Avenue um and you'll see the office because he's out there trying to guide traffic speed up cars that are actually going to it's happened to me where I'm like is he really telling me to speed through but he's trying to get cars moving to be able to because the backup on 97th is so bad it happens also um academir the 41st academ year so the system will now capture these cars speeding but they're not really speeding you've got the officer out there um moving traffic along so my question is about technology flexibility and who's reviewing these videos because that came to my attention when I was out out a school visiting and actually the principal came and talked to me about it I was talking to her about the system and she's like you know our concern is that we are out there monitoring and and actually um you know uh we're guiding traffic your officers do such a good job of because the traffic gets so bad that they speed people along and now it's potentially that that person can get a ticket and it's really our officers telling them then move on so I'd like to understand a little bit about the system and how there's flexibility if there is any in you know can can it be turned off through at a certain time depending on the school how how does that work again this is all very new to us so I think verah wants to come up first and then we can hear from anybody else I actually have a comment on that okay so again let's we're going to clarify this is just to select a vendor we are going to have an additional meeting where we're going to disc deide all of those things so we're going to look at all the schools we're going to look at the report and in fact I did speak to some of those schools too and they you know we have to take into consideration that that happens and so for us if we do want to make sure that doesn't happen then we're going to have to decide not to put a camera there eventually and correct me if I'm wrong we're going to come back and uh sort of sort out the program and how it's going to work or it's going to be placed so I don't I mean I don't you guys may be wasting your time answering right now because we're going to be the ones to decide that if correct right a quick answer on this that might might address it and because you have flexibility to understand first of all let me address the UTC or yeah can you please oh I'm sorry I apologize it's been a while since I stood in front of a Podium about a year so so let me address first one thing the the UTC the certified mailings are UTC related and when you take into account the process in the court the city is made whole by virtue of the payment to the court so even though that number is there the city doesn't suffer a financial loss as a result of the UTC certified mailing that's number one number two as far as you're concerned with Dural by the way my kids graduated from Dural Academy great school so uh the way that you would address that the easiest way is to your business rules you make the rules as to how you're going to enforce the program and we work closely with your department your agency and your staff to see what your needs are to best meet the needs of that particular area so yes it's a conversation to be had later but you do have the flexibility in your business rules and I I probably speak for everybody here and all the other companies it's not to waste their time or waste yours it's all business world based so the question is that yes you will make that decision and all the parameters and and the guard rails are on you and based on your decision okay all right thank you do you have a comment I do have yes that was my understanding when I spoke with the city manager that all that information was going to be disclosed later on ask to the depends on who will be the company that was going to be chosen by us with our vote and I just uh also wanted to mention again uh Council woman pars thank you so much for bringing being the leader for the camera something that is really needed thank you question yes vice mayor corvey how many of the tickets have to go out in certified mail percentage wise I guess so and D for your red light camera you the last full year that you were operational you send out a little over 30% Statewide average over the nine years for the entire States about 28% so you're right on what's the average in your experience of uh schools of you know similar to to the ra maybe you use that into your calculations of the number of tickets that we be given in a day so your own testing your own testing results that you already conducted dat right so you and and keep in mind when you did that testing it's only in the morning and the afternoon you did not test in the middle you did not calculate those so for one day you had 5,500 violations wow one day just those 15 schools not including during the day but you're not you're ironically not the largest okay any other comments and then I'll I'll make my final comments I know Council fores you had some comments too yes um I just want to thank everyone for sorry oh I'm Sor second Mr Parks you had a comment thank you mayor um I wanted to comment on the UTC issue as far as the volume I believe the revite is not an Apples to Apples there was acrimony and that uh it was a much higher fine uh it it it was a different animal you operated it for years so I don't think it's it's a fair comparison what I do think is the fairest and there will be some that go there um the the Georgia law is the most similar in the country it's it's identical in many many ways um and we operate the vast vast majority of those systems there are very successfully based on the stats I showed you we believe so we're seeing less than 2% request adjudication at all in Georgia so in my theory on this and it's it's it's partly empirical and part intuitive but it is way different than a red light a red light was a nanc into the red 247 uh 365 this is only in the any anywhere in the city these are only in the school zone only during the school day at least 10 miles are grer over there's almost I believe a level of Shame of coming out in front of God and everybody that was blowing through the school Zone again not saying you won't have any contested but it it's not going to be the number I believe that you experience with red light based from our our relevant experience how long have you been operating in Georgia now uh since 2018 so their law was implemented in 2018 yes and we took that very successful law concept to Tallahassee along with Vera spearheaded only two that I believe even fully understand the law again not knocking anybody but okay yes yes Mr Parker Greg Perks Mr Perks since you're here yes quick question sure uh I read that you you guys have been selected by Miami day County correct yes how is that going um it's going very well uh County permitting can be its own Beast of time we've had very good we had a great meeting with Frank Ira yesterday it's been expedited we believe we'll be live by the beginning of the school year and I'm glad you brought that up councilman that sorry a I think the election by the county who ran a very thorough process uh is validation for us along with all the most of the other municipalities in the county and there's some great information sharing possibilities uh best practices User Group you know there're a few miles down the road and have a lot of commonality with your Police Department so it's going well appreciate you bringing it up and we think again says a lot about it validates our excellence in the market and it's some great ability to share information practices many things public education thank you okay all right Council fores thank you mayor and I want to thank everyone that's here and all the um vendors that have made their proposals and you know for taking the time to be with us and really showing us um your product and what you can do you know Al baade I think it's probably going to be one of the smaller contracts around but um that just shows the The Pride that you take in your work by being here and presenting to us um with that said I do um you know I I was a little surprised by some of the scoring considering that I think you know we have um a vendor here that is with the county has you know uh most of the contracts here in the in the at least in South Florida um but with that I think that our uh City and our Comm committee members which included you know very important people including the assistant IT director Finance transportation and police have made a selection the first one being on March 15th which was the first um set of scoring which had Vera being the top scorer and then we saw the the determination by the city manager to reconvene to ensure that there was a fair process because red speed um red speed application or electronic application didn't make it completely and so I think there that was a thank you for doing that that was a good step and making sure that um the committee had a full electronic version to be evaluated and I mean even with that though you would have thought that there would be you know maybe different results because it was an entire page that was missing um and so with the recommendation that we have now and based on everything that I'm seeing you know where you would have applied that redetermination to um benefit the the P the the vendor that wasn't properly evaluated it really didn't move that much other than moving Vera out of first place where again everything was the same so I would like to honor that first scoring and award the uh the the contract to Vera based on again the fact that they came came in first in the first selection um and then during the redetermination the there was a fairer process a where you would have anticipated for the only thing to have changed would have been the uh vendor that didn't receive the full consideration based on their application and as such I'm going to place a motion to accept Vera considering that you are ad meable to eliminating the cost to remove the equipment if that's correct okay I'm going to place a motion um to move forward with that second second I have a question real quick before we take a vote um can we have the terms of the contracts sorry the terms of the contract I'm Sor we haven't drafted so there's no proposed terms included in their proposals no okay other than it was only the cancellation Clause correct that was part of the that was part of the proposal so that's what we're saying that they will eliminate correct yeah that was part of their proposal and if they're willing to negotiate that out you know obviously you have to go back and back and negotiate if contract I'm I think if you all want to do sort of like what we're doing with the the cameras where you know if the first contract falls through you want to choose a second you know I'm happy to do that as well if you guys are open to that but y here um I'll say what I'm going to what what what what I would feel comfortable with um there's a motion on the table in a second I'm going to I'll just make a quick comment I I'm very uncomfortable with some of the way this was done I would have actually preferred sitting here thinking about it that we would have had our own score sheets and been able to score as the presenters were presenting I feel like that would have been a much more adequate way of tallying the the the um you know the competitive process of scoring based on qualifications fees and all these things I really feel was a little bit hodg podged so I personally am just not going to be supportive I just don't feel that this process was as closure as I would have liked for it to be um and at the end of the day I think that um we're not going with the recommendation of staff there was two different evaluations I just don't feel comfortable that's really my my perspective on it and so therefore I was actually going to recommend that we maybe as much as I want it to be done quicker um that we would reconvene again with an opportunity for us to score you know they present and we go scoring and kind of like we do in our committee for City attorney and so on we score and then based on that scoring make a decision Rank and then go into maybe negotiations with the top two firms right now I feel like we're just cherry-picking oh let's go negotiate with Vera and red speed or let's go uh you know let's go negotiate with Vera and alien um alumen so I'm not very comfortable with that therefore I won't be supportive that's my comments on the record I'm very supportive of the program I will be supportive of how the program comes forward I'll have comments on that I'm just not supportive of the process that we went through I just it's not the way we usually do things and while it may have been uh you know a very thorough process for us to be involved I'm not comfortable with it so there's a motion on the table in a second um I hope that we do have a contract that has no fees for getting out of the contract in case that there has to be changes um but that's just the position that I feel I need to take for for transparency purposes and purposes of the public uh public interest mayor yeah Council P yeah I just want to follow up on that I mean it's it's um mean we have two different evaluation so uh it's like pick and choose and different scores and and again it's I commend all the companies that are here as well uh I just want to add in case that uh as as I can see we're going to move forward with uh with negot start entering into negotiations with era uh is there a way that we can add a second company in case negotiations fall through as part of the that's what I suggested if you guys wanted to that I suggested that yeah okay if you can if you want to choose a again are you comfortable with that city manager absolutely okay got to make a suggest yes in that case I will suggest uh red speed to be the second option I your mic is okay I I just said that you need to either amend the motion to include a second or the maker of the motion can accept that if there's no objection but the original motion does need to be even though the maker suggested it you do need to change the form of the motion if you're going to put in a number two and then say who the number two that you want to negotiate with may may I may I suggest also I don't think that it will be fair to put the person that is on third I mean if we're going to do a negotiation we should go with the top two because they actually have the one that have the most comprehensive uh information and that it's really uh covering the needs of the community so I mean if we going then to choose two it should be the top two if we want going to go into negotiation at the second I mean the third and fourth because they actually have the lowest scoring so if we're going to go into into it it should be the two top ones that's my recommendation I agree with that too do different evaluations we're making decisions based on the final evaluation I mean the the final scoring if we're going by that that's we're not using that one so okay I need I need to there's an amended motion that's why I'm basing mine on supporting Vera so right so just to confirm okay the councilman made a mo made a recommendation that there be a moving there would be a amended motion to include negotiations with verom mobility and red speed as the top two and then the city manager will have discretion to negotiate and get the best deal um as Vero first and then second red speed that's the amended recommendation from councilman P NATO you're the maker of the motion and my amended recommendation will be then if we're going to negotiate with anyone it will be then with a top two so the one that have the the highest scoring that it was Ultimate that has 100 and then a Vera if we're going to do that okay something yeah I so I I'm I'm fine with having um Vera and then red speed but for the city manager to come back to us if negotiations fall through just to approve it yes does that work for everybody I want to be clear so you're you're saying that Vera will be the one selected right and then if negotiations with Vera fall through then red speed as is's recommending then they'll she'll bring it back the will bring it back for us to I would negotiate well the contract first with Vera if that doesn't work then with red speed and at that point once it's negotiated bring the contract back to exactly okay yeah I'm okay with that so you're okay with that yeah we're all right so the charter 4.10 section B and I quote and I said this at the beginning of the meeting and I quote if the city council member desires to have an item on the city council regular meeting agenda for consideration the city council member shall submit the request for the agenda item to be included on the city council regular meeting to the city clerk no less than 7 days prior to the city council regular meeting this item was submitted April 3rd at 3m. that is not 7 days prior additionally section e of our Charter States the city council shall not consider items that are presented to the city council members at a regular meeting that are not submitted pursuant to this section there shall be an exemption for City Council items that are found to be emergency by an effective affirmative vote of no less than four members of the city council therefore this morning during that time when I pulled the items off the agenda I said we can lay it down she asked to lay both of them down it did not
