would like to join us for a moment of silence and the Pledge of Allegiance led by commissioner Hawkins please stand with us amen commissioner Hawkins please join me at the pledge I pledge Al to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with libery and Justice thank you all before I call the meeting to order real quick um we had elections on Tuesday um I want to thank everybody that ran for our city commission seat but I would like to congratulate our vice mayor for being reelected to another four-year term here at the city of eust to say anything yes um I can you I'm really grateful and um every time I get ready to say something about this I kind of get emotional about it but I'm so grateful that the people of this city really appreciates the work that I've done and that they've supported me wholeheartedly I really appreciate that so much um it makes you feel humbled when you see people voting for you and saying all the kind things that they've said to me and also the support that I've gotten from my treasur be um I've had um over here I know Ellis has helped me so much and my Commissioners have supported me I've had um the sheriff and and um our new Senator and I've just had all these people supporting me it makes you feel really good it makes you feel that it's worthwhile to do this and it gives me just all of the enthusiasm to go forth the next four years and make and work so hard and make all the difference that I possibly can and I thank you all so much thank you Vice reelected in this round uh without oppositions commissioner Hawkins so he's going to be around with us for four more years sorry anything else know I um uh I I wish I could say that that I get emotional like uh uh the vice mayor uh but I didn't have any competition uh I I didn't have to do that work and what that said to me was I was on the right track uh and and I appreciate everyone that thought about running against me and decid decided not to so um we're here for the next four years and our plan is to work our behinds all for you guys so thank you yes sir just one more thing I wanted to say Mr Blake Griswald back there was my opponent but I appreciate him he's helped me grow as a commissioner we had a really clean and comfortable um you know race and there was not all the ugliness and and the bad stuff that could have gone on WE respected each other and I appreciate him and I I applaud what we've done together thank you Blake agree with and we had one more open seat and that seat went to commissioner elect George as bodybody George do you want to come up and say anything uh Tom can you start the clock everybody as the Comedia uh thank you um it has been a interesting eight months to say the least and um it has strengthened uh strengthened me my family who uh endures the process as well um I've made a general comment on my Facebook um and appreciation um and uh to the to some people who played a key role but I also have to say that the support that I have gotten um from the Comm from every one of the Commissioners um to keep a positive um Campaign which we did um we ran the best most positive with one thing being at the Forefront and that's the city's future the city's reputation and the honor and integrity of what this city and this commission has been able to maintain and and I'm proud to have gone through that test so I think I'm ready to continue um with that um thank you to to each of you for um ensuring that that uh that we maintain maintain that integrity to two of my opponents so ncy Parks John pots um they ran a excellent proud honorable and they're both beautiful people and we as a city are lucky that those kinds of people came forward and uh I called NY um and I expressed that to her I've left a message message for John and uh having been able to connect with him but I am excited about our city we have a city on the waterfront that's a million dooll Sunset that I've talked about for almost 10 years that I have been coming to meetings and uh I'm excited about the future I'm excited to to come in for four years and leave this place better than what I found it so my commitment is to that I might not agree with many of you at times and that's okay because that's healthy and I will Express what I think is best for the community first um and uh again thank you for this beautiful city and thank you for uh if any of you voted for me and trusting in me and uh I I hope to make you all proud and everybody who did vote for me uh which was overwhelming and we won by a great great margin that we're very proud of and a Clean Campaign thank you congratulations I'm gonna officially call the meeting to order um Christine is there Corum president proper notice been given yes mayor thank you Tom an agenda update sir uh yes uh we would like to remove item 5.3 which is resolution 2492 related to lightning detection uh we're looking at procurement and additional vendors related to that process and then the other change is removal of item 5.11 which is resolution 24100 for theou for SWAT uh there are multiple parties to that agreement including some of our partner municipalities and we're kind of coordinating with all of them on that so uh want to remove those two items from the agenda thank you sir thank you next we have approval of minutes we have the approval of minutes our July 5th 2024 City commission workshop on utilities October the 3rd 2024 City Commission meeting and October 17th 2024 City commission Cruz I mayor Holland I coming down now to presentations and I'm ask to pleas come up and join me how are you Bella The Carter family has been a big part of our family our our eustus family for a long time the family owns Ace Hardware here locally um Bella has got quite an accomplishment that she has uh come forward with and it's uh With Honor that the city of Eustace recognizes you Bella Carter is the 2024 junior girls Division World wakeboard and Champion [Applause] so and if y want to come up we're get a picture of all of us together okay [Laughter] [Applause] and all of Bella's training was done right here beautiful Lake we got beautiful for thank you guys for joining us thank you so much they've got a t-ball uh game to head to so they're heading out on us if I could get Sam Bron to show uh come up Sam Sam is the director of Parks and Recreation for the city of Eustace and it is always an honor that we get to rec recognize folks that have done a great job for us um Sam has hit the the the ground running since he's been with us I love when you're up here by me I feel small Sam and his team put together a trunk Retreat and it was one of the first that we've had out at Carver Park and I'm going to tell you the whole city staff really every division showed up with a trunk Retreat booth and it was a fun event Parks and Recreation did a beautiful job putting together a haunted house and all kinds of things for the community the outpouring of the community was outstanding so it's with honor that we honor Sam tonight and Sam I'm also on behalf of the city commission going to hand you these and let you honor your staff if that's okay so if you'd like to call them up and we're going to get everybody to come up and we'll have a group picture taken afterwards okay um first I want to thank my team like you said this is our first Trunk or Treat for the city and it was a great turnout and they'll tell you I was a little bit nervous about turnout so and it was a great turnout so um I'm going to call names up here everybody couldn't make it so but I'm going to call but once your name is calls please come on up uh Jerry fiser Rachel Ammon Sarah Alvarez tor [Applause] Anna VES do have another event coming up called Winterfest and we'll get that information out about that event as well this organization Parks and Recreation team has direct contact with the children of our community pretty much on a daily basis we need to really support them as a community and be out trying to help them as much as we can please give them another round of applause up a little bit we're going to take a group picture if that's okay we're probably have to squeeze you want to come on the other side of him I might block out everybody I'm sorry okay guys thank you [Applause] all Tom I'm going to turn it over to you for just a minute so we have our annual uh organizational grants process uh and we have uh awarded grants to a number of organizations uh so tonight we want to recognize pause therapy dogs so I don't know if a representative would like to come up and say a few words and then we will uh present the ceremonial check and take some pictures they sending the wrong one up here thank you Michael I'm Robin richer and I'm involved with pause um I don't personally have a therapy dog right now because mine passed but I am on the board as the secretary and we really appreciate the support of the city we could not do all the things we do for the community if we didn't have the support of the city it's really important to us specifically for our Christmas senior gift bags that we give out with toiletries and other things that try to lighten their load a little bit for uh nursing homes and you know assisted living facilities these places where people don't get a lot of visits and they don't get a lot of gifts so it's really important us to have that program going in the city is totally responsible for helping us with that so we really appreciate it a lot thank you on behalf of the city commission res of the city of e I'm going to present you this check for $1750 [Applause] wo I guess we just sit down stay R back time to make the donut mayor may put wow look at that one how survive the or the the summer here I was say was wear stroller where is over there they be quiet did you did you kiss that I didn't kiss the one in the stroller yet I got everybody else Katie's confusion earlier when she oh yeah Christine's got get and tell it thank you all so [Applause] muching okay okay but be ease Kevin I don't know how long he's going to talk next presentation is is going to be going to um open door I'm going to switch spots with one of our commissioners it's actually on the board for open door so he can make the presentation so Tom you want to kind of give a little bit of intro so again uh as part of organizational grants uh this year we've supported uh open door uh and live stream and so I'd like to ask them to come up and say a few words as [Applause] well well thank you again for inviting us up here um for those that don't know um open door is a program through live stream that serves the homeless we're a drop in day Center so we provide meals for the homeless showers laundry we love them and give them resources into the community and we really appreciate the city of eustus embracing us and that really is that means a lot to us thank you for your professional support your personal support and and having our back so thank you so much you're welcome that you all do on behalf of the city commission we like to give you a check for $4,300 thank you [Applause] congratulations thank you all so much thank you for coming we have one more presentation tonight and that's for America in bloom and I'm going to turn it over to the vice mayor I told her she gets two minutes of course I'm going to observe those two minutes I want to tell everybody about American Bloom it's been a wonderful experience and it promotes Nationwide beautification through education and Community involvement by encouraging the use of flowers plants trees and other environmental and lifestyle enhancements but I'd like to also emphasize that it's more than the beautiful flowers and plants and trees it's about partnering with our city and American Bloom to promote Community involvement we'll provide education for our children and adults we're looking to increase pollinators improving hisor IAL sites enhancing entrances and creating a beautiful city for our enjoyment and attracting more visitors the American Bloom committee meets once a month to plan and Implement Lake beautiful and American Bloom objectives my committee and I call them my committee because I have a lot of ownership in what they do and they have caught the vision I'm so proud of them and they work diligently to implement projects that we have coming up coming coming up with those that we've already done and those we're planning for the future in uh 2023 representative Nan Cobb and I attended the first conference in North Carolina but we observed something we saw other cities bringing their entire team and they all could comment and share different things about it um what they were doing about their different projects and all that was there was being then but we decided when we went back we would have our team and and we did um we won um the year that n and I went we won two Awards and this last one we were up for three we got one out of those but next year we're going to come back with lots of Hardware all the things that we're planning on doing so our team committee and I'll U let them introduce themselves and tell you about what they're doing because I think they saw they went they saw and now they're ready to share so our aib Comm um committee would you please come up and share with everybody thank [Music] you you should you should have been in there did you know that why didn't you wear that she's surprised she don't know what to say they're creative they CAU the vision so for those of you that don't know Rick erck wore that costume on Halloween where's Rick tonight uh Rick is out of the office right now all right so you guys got it good evening I'm Michelle Saxman I work for the engineering department and we asked her give a presentation what is an American Bloom so these are just the first couple slides that what is American Bloom it's a national award program as commissioner Lee St that it's within communities it was founded in 2001 and it's a modeled after a program successfully that was started over in Europe so it's just been brought o it's been brought over here and then um what does it provide it provides a framework that it improves the overall quality of where we live work and play connects people with plants Wildlife local history cultural Community Pride working together for a common goal promotes Nationwide beautification through education and Community involvement encouraging environmental initiative of flowers plants trees wildlife and lifestyle enhancements provides on they provide onsite and one-on-one mentoring and coaching for our team they also um have an annual event Symposium symposium and offer Awards to um properties but one of the things that they provide is quality of life goals for US cities um know that flowers trees shrubs and Turf and ground cover provides visual impact and welcome folks to spend time in our community the success requires the Synergy that comes from our overall engagement and activity combining the efforts of our municipalities and businesses because it's not just us that we want to do this it is a community um program so once people get on board it will grow within us some of the benefits of participation is bringing um residents together that might not normally work together the message is spreading is is it is slowly slowly spreading in our community and our great work it increases civic pride which we do have great civic pride in our community the study shows that it decreases vandalism and crime by having more people provide empowerment into their Community it provides Economic Development benefits improves property values in um increases volunteerism increases tourism information and cultural engagement and Neighborhood National um national awareness and international communities and then then the next one is just a list of the various awards that the Comm um program does so you can look through those but examples of our existing participation this is the part that I really love about the program so our library an our librarian an has doing a wonderful job promoting programs in our community just in the last couple months throughout the whole year this is just a small example they had a program on butterfly gardening Florida friendly plants a weird one which was fun because I attended on creepy scary poisonous plants um they had a program on bats and snakes so an is doing a great job yes on on our programs her Pro her programs aren't just about plants they're about um um painting with Scott art Sparks uh wonder of the rain Forest um her promotion on the postcards thing that's just a small sample of how this program fits into American and Bloom the next one we have is um how many murals we have in our community we just did the one mural on the racket ball courts the mural that's at the new mural that's at the Clifford house the next one next to it is just a uh business with a great mural in the community these are a couple of my favorites that are around the U Mexican restaurant in that little Alleyway but these are just a small sampling of what our residents are doing to beautify our community one of the great things that our community is doing is cleanups I know several of the Commissioners do cleanups and so I I went out and found some great samples of our cleanups that we've done the Community has done and done and we need to continue to or um promote theirs um we also had a recent cleanup of Mont Olive Cemetery it was definitely run down and those are all part of providing community service to our organization it is also about um Heritage we have a um AF um African-American Heritage program in the city and that they do great um or um programs they have prayed I know in December they have a Gala I heard that they're doing but there's a lot of promotion in that that they are promoting their culture and we need to encourage them with that and of course our most famous event George Fest that so many people from around the country come to that event for it so that is something that people really like and we are continuing to promote another one that is driven by business owners is rehabbing buildings a lot of businesses don't down in downtown areas don't have apartments downtown we do and one of them in the in the mullus alley has um parking in the back that they added PLS through so it makes it more inviting just those little things that helps our community just have that Added Touch to provote promote businesses the next one is an apartment building in the midst of a rehab there's a before photo and this one is current the building is not finished but it is a dramatic difference of the community members are putting into our community to make it look better and then one of our projects with Public Works that we're doing is Park improvements some of our benches have been replaced that's our before and this is our beautiful um community center on the lake people are going there eating their lunch um walking the path it is a great program and I mean we do the parks and wrecks and events there's so many things concerning the lake um we have our our trees we do a lot of um tree growth for that you know growth Awards and Barbor day you recently passed an ordinance to encourage or discourage develop developers from clearing trees from having a $50 fine per tree to $2,000 which trees are important for our environment so encouraging them them that is great so you know we just had our recent Arbor Day event last week at the Clifford house is there it's a photo of our planting over at the Clifford house house and then we also do Community Tree giveaways so um and then we also participate in the tree City annual growth Awards but we just had a and then we also the city also participates in supporting organizations in in the community this is a small list of examples of how the city is helping to improve our community in a small way but having great impact with our St John rway Waterway recycled water program um providing funds to lake trout Nature Center the 4 The Garden Club the food pantry Bay City um Street Theater our annual food drives and I believe we're doing a new to Holiday toy drive I think that's new I hadn't don't remember that from last year so these this is just a small list cuz we even had some that I didn't even know about that we support so I just went through and got got a few and then we have a video for volunteering that worse is going to play for us if it's going to play hey there are you ready to make a real difference in your community today I'm inviting you to join the America in bloom program right here in Eustace this is your chance to transform our city into a vibrant blooming Paradise let's talk about what you can do we need volunteers from all walks of life kids teens adults and seniors our first project creating motivational painted rocks for Citizens and visitors imagine the joy of finding a beautifully painted rock with an uplifting message on it now let's get our high schoolers involved assigning a high school representative to help recruit students is a game changer they'll act as a liaison ensuring our youth are fully engaged and feeling a sense of ownership and pride we're also partnering with Liv stream and open door to provide care packages to those in need remember helping the homeless doesn't attract more homelessness as Mother Teresa said if you can't feed 100 people then just feed one compassion is key we're calling on local schools to join us in various projects the modern school is already on board imagine students painting storm drains to add color and creativity to our city art teachers we need your expertise let's make this a community effort and we can't forget about our local groups 4 Junior leaders Scout Troops and even coach Johnny who's been contributing for years you all play a crucial role in this initiative but wait there's more we need citizens to plant pollinators in their Gardens in recent years we have been losing bees and other pollinators at an alarming rate this decline threatens our food supply and the health of our ecosystems by planting more pollinators you can help reverse this trend and support a thriving environment the city has a budget but it won't be enough this is where you come in take ownership and pride in our city remember no sweat no gain let's meet over iced coffee or bubble tea to discuss ideas and share your voice your input matters we need funding from local businesses grants and donations we'll also have a plant sale day to raise funds our community garden is the perfect place to start with a simple seed welders painters and sculptors we need your skills to impress visitors and keep them coming back let's partner with the events Department Parks and Recreation Department and the media to showcase our inspiring projects and neighboring cities we're in this together Tavaris and Eustace are already on board we have so many opportunities from a monthly Bingo night to Holiday themed fundraisers how about a dog and cat costume contest let's educate our citizens on keeping their plants alive and build butterfly Parks all over volunteers we need you retirees self-employed individuals artists grant writers your expertise is invaluable you'll make a difference and feel a sense of pride in our blooming community so are you in let's start a bloom Revolution remember it all begins with a simple yes together we can make Eustace a vibrant inspiring City for all to see thank you for your time and let's get blooming remember America in bloom is not just about pretty flowers it's about uniting our community to make our city better more livable and developing skills to help others in need helping others generates a sense of Pride and boosts your mental health the best way to find yourself is to lose yourself in the service of others mahat Gandhi and a special thanks to our vice mayor Emily Lee for bringing this to our attention great thank you and my name is Ellis foran I'm the volunteer um committee so we want to say thank you to commissioner Ashcraft because he actually already connected us with the the community to get volunteers we have here Alex and Benjamin which are her sons they're already working in the Clifford house so we want to recognize you and we have a a gift for you guys so thank you very much thank you all great job if anyone here wants to really see what America Bloom is already starting to do please go down and visit the Clifford house uh the house is not open to the public yet but the grounds are and the grounds have really changed over the last few months so I encourage you to go down and take a look at what's going on there you'll be very excited yeah also um Georgia's um mega place they have a butterfly garden going and you if you drive by there you'll see all the beautiful plants and how many butterfly um lves what it was it that you had seemed like it was 150 and so that added to the butterfly population right here in usas and so the more we have the better it will be for all of us so if you drive by you notice all the plants you'll see have an idea what we're talking about all right thank you great job one more this is our latest award from America in blue all right which I'd like to present to you thank you so much beautiful American believe growing vibrant communities um in recognition of your community Vitality oh wow that's beautiful that this is our second year in row second year in a row thank you all right amazing thank you all for all you du vice mayor thank you for leading up this project we appreciate you and we would appreciate people volunteering coming forth helping us in any way you can um also we have a two Community Gardens one for the Youth and one for the adults and I think we could use a lot of help in that and getting those started again uh now that it's fall and um it's a lot of work but it's fun work and our city will benefit from it and all of our citizens because it's going to make a better place for us to breathe be healthier and volunteering always works so please contact UM Ellis and any suggestions y'all Lee hi commissioner Ashcraft hi commissioner Cruz hi mayor Holland hi madam attorney thank you Mr Mayor we have resolution number 24- 90 a resolution of the city Commission of the city of Eustace Florida approving a final subdivision plot for s's Reserve subdivision an 18 lot single family residential subdivision on approximately 4.70 Acres located north of es Road lincol Road l sorry Lincoln Lane Lake Lincoln Lane on the the west side of es Road alternate key number 386 2867 tongue twister there Mr Lane good evening Commissioners for the record Mike Lane development services director you have before you the um final the final plat for Estus Reserve subdivision it is actually owned by Bergin investment Inc and um it is an 18 lot subdivision that as Sasha was poting out is located just north of May May Hill subdivision or on the west side of Estus north of Beats Avenue and and eses the just just a quick uh property history the property was annexed in 2021 uh it actually uh received the preliminary plat approval in 203 two years later after it was annexed and um we reviewed the the final engineering uh and construction plans by the DRC in 23 early this year uh we actually came forward with the U um preliminary Subdivision plat and uh we we subsequently then held the preconstruction conference and they began construction on the subdivision they have completed it now and um we actually have the maintenance bond in hand uh for the next twoyear period uh you know to basically um cover any issues that may arise over the next couple of years before the city actually accepts the infrastructure and the the roads in there um the property is actually in Suburban residential and it's also in the Suburban neighborhood area again it's 4.7 Acres 18 Lots basically 3.8 units an acre uh for density and and um this is generally what it looks like rectangular uh and um again um it is um 18 lines so at this point it does meet the the um the goals objectives of Our Land Development regulations and our comprehensive plan and we do recommend approval for this do staff really recommend approval at this point we haven't talked about setbacks and we've not talked about you know they can't vary the lot widths like we discussed earlier but you know it would be nice if if they could Meander some of the front setbacks but we haven't talked to them about that but yes at this point it does me Our Land Development regulations so we recommend approval any further questions from are they here with us tonight yes I believe I I did see Jason I was going to ask if I see that it's very close to another subdivision is there any separation between the con Construction in this new subdivision there is a buffer uh that that actually was um I think there was some buffering that was shown uh on particularly on the North side is what they're preserving uh a number of the trees that are there uh on the south side I think there's already a fence in play on the Mayhill Side Oh north side of M that's what I was looking for is a there's a fairly decent fence it's already separating the construction site in the existing residential subdivision I think May Hill is probably 3 years old at this point so the fence is relatively new there so anything further would anyone in the audience like to speak on this resolution I do have a card from Cindy new good evening Cindy Newton Cindy I'm at unincorporated Eustace and I live very close to this uh I'd like you to take a look at those Retention Ponds those are counted as open space the 5:1 ratio which is up near the top is is over the limit for what is considered open space and should be fenced it looks like they're counting down further it's looks like where they're putting uh grass but if you look real close there the um descension starts like one foot off of the property line of the houses next to it and you only have a 5-ft setback the foot footprint at the bottom of these a lot of times uh the city mentions that they can be used as open space because the kids can go down there and play toss the ball around that footprint at the bottom is very small you've got a high slope so I don't see that happening what I'd like uh to happen is for you to table this until you can go out and take a look at what your Count's open space and take a good look at how much they've built this lot up that is a 75 ft drop from that lot to the lake that the water will be leaving those Retention Ponds down to my house is in between we're at about uh the level of the water on Lake Spa is 72 ft before a flood space flood stage we're at about 125 we're not worried worried about flooding although uh the gentleman that lives to the north is a little worried about it because the Overflow is towards his property as well but if that water does start coming down there we're going to look at you know a lot of water flow coming down looking at erosion and water flowing when it comes from that direction it goes right down my driveway so I'd really like you to have take a look at that and realize that this is uh on map 19 and the comp plan should have been developed at 2.5 houses per acre so you went outside the the comp plan uh to get this density so I'd like that on the record as well so thank you for your time thank Youk you there anyone else in the audience that would like to speak on this item okay I'm seeing none would commissioner like to hear from the applicant yeah I'd like to I'd like to hear from the applicant Jason Lee berglin LH SD's Reserve LLC 14934 old US Highway 441 thank you for joining us Jason yes sir um the the the top uh retention PO is it in fact uh um a foot off the um def fence line I'd have to look at the survey he doesn't have a picture oh exra I don't think Cindy handed that toe you have extras down here good and uh during the I'm sorry you had a chance to get yeah I'm looking at it yep okay during the last uh rainstorm MH uh did you have any issues or were you added to property none actually I I take Drone footage twice a week and I was there and we we didn't even have water in the bottom of the ponds it all perked and historically I wanted to say too the the property that's to the north as the last person was speaking of historically it's actually above elevation so their property drains historically to us we don't drain to them so it would their property in the flow would actually come down to us mhm so there's one that's to the north of you but there's a property to the north of us to the south of us is a subdivision MH and as it happens I believe this actually shows it uh the Topo and and you can actually see that and it looks like if you look at the solid black line on the south Pond it appears that you have natural Topo there and then it appears to me that that line that black line is where we began and you can see below that there's actually it shows the buffer there is a buffer on the south side where you see the8 do you see the8 on the it's technically the southern side it's sheet of the paper depending on how you're looking at it okay so that's actually a part of the buffer okay all right so could you address her concerns uh it sounded to me like the concern was water flow and as I said on the north side of the property that property is higher in elevation so it wouldn't be us draining to them it' actually be them draining to us so that that would actually answer that we we kind of can't drain to them because of the to of the property and I can tell you as I said I've got plenty of of Drone footage of of the ponds even after the hurricanes and we had absolutely no water retention no no water it all recovered within a day there was nothing in the bottom of the ponds it and and there'll be as builts when we file and and all of that will come with it show how the as builts so it's we have the plans and we say that the property is going to be built to a certain back and the as builts are going to show you what it was built to and there's a a very small amount of variation but it's it's usually to you know to the plan okay what um the the retention Pond to the the north MH uh we 145 um that area if I'm not mistaken uh did you all include the as play area for the kids is that so this particular project and it doesn't show in here if you're looking at that North Pond do you see the the larger strip on the North side mhm so that strip there's a Meandering walking trail through there and we did some tree prevention on the North and the South side of the property so so there's actually going to be a um there's going to be a walking path through there and there was tree prevention done in lie of call it a Tot Lot if you will so it's it's more of a uh recreational walk in area open space okay you said where one where you see where you mentioned north of the pond I don't know I can point but it's right right here if you look on the bottom yeah you can see that there's a strip across the top 155 right and it goes across the entire Northern boundary all the way to the es Road okay yeah and I don't know if the commission remembers this that initially was a narrower strip but I think the neighbor asked for uh tree preservation and buffering and so the strip expands think it was between the in the neighbor yes yes but I didn't hear an answer for the one foot unless I'm looking at the construction plans it's hard for me to answer that it would be hard for me to believe that that it would be one foot from the property boundary I wouldn't doubt if the ground has been Disturbed close to one foot of the boundary I wouldn't doubt that you know it's a construction site okay yeah and one other thing that came up uh or that uh Cindy Newton mentioned was the uh the slope the level of the slope mhm and uh so I think our code requires uh 4 to1 4 to1 Max otherwise you have to put a fence around and you can't utilize it for open space and I just want to I want to point out 5: one is actually less slope than four: one a 3: one would be steeper and so you do see on here some four to ones and some 5 to ones that means the 5:1 is less severe slope um because you are traveling five all right uh next we have resolution number 24101 a resolution of the city Commission of the city of eus Florida providing a reduction for outstanding code enforcement fines and a release of Code Enforcement leans recorded against 309 East Woodward Avenue upon satisfaction of conditions and full payment of reduced fine Mr Martin good evening Eric Martin code enforcement supervisor so resolution number 24101 uh approves a code enforcement board order reducing five outstanding code enforcement leans uh totaling 220,000 well $ 22,400,000 to $1,250 and releases the leans the leans against 309 East Woodward Avenue upon payment and upon completion of all conditions listed in the resolution so so the conditions are for transfer of ownership to SOS Property Solutions LLC they're the applicant payment of the reduced fine clearing of all the overgrown conditions uh and accumulations removal of a hazardous uh tree that's in the backyard uh removal or replacement of a dilapidated fence that's facing Woodward Avenue and for obtaining permits and completing all work necessary to repair and renovate the s family dwelling that is currently unsafe and unfit for human occupancy so basically this action shall become NL and void if payment is not received uh if the reduced payment is not received by January 6th 2025 or if the applicant sells the property before completion of the conditions so that was the code enforcement board wanted that verbage in there uh so with that being said staff recommends approval of resolution number 24-11 it is up to code now correct cor no no sir no mayor uh this is this is the best path that the chief and I have discussed that can bring it to a path for compliance okay the buyer is going to do everything that's needed to be done to get it in compliance now this this house uh and this has been before uh before um and we had a problem finding the owner correct no this this is that's the next uh resolution coming forward so this is a that's on Ward Avenue this is on wood okay that's right okay well I have a question yes what process did you use to um bring it down from um the what is it 22,400 to 11,250 okay so the there's a sales contract the the uh purchasers paying $75,000 for the property the um the property owner selling it he's agreed to pay 15% of the sell proceeds so that's where the 11,250 comes from so the market value of the property itself currently is only 885 so and the 11,000 would more than cover the city cost oh absolutely okay okay I have a couple questions for you the three case violations that they had in 2004 do you happen to remember offand what months those were in there was case 53 54 and 762 that was the $31,500 I am not sure if I brought that information with me no I didn't the the one for 53 was the no building permit for interior and exterior repairs alterations and construction that was $31,500 there thereabouts do you think it was before or after August when that one was issued when the violation was issued mhm like I said I didn't really bring any dates I didn't break a I didn't put a timeline on the cases um if I had to so if you look at so that was this property yeah I can tell you cra police chief this property is a menace was a menace a headache a dent of inequity uh and it's going away if you guys prove this and I met with the new owners they've been they had the talk from the chief and they and I think these guys are really good and it's going to be an asset to our community and it's going to spruce up it's going to change the whole dynamic of that neighborhood uh like I said the goal is compliance not fines once we gain compliance which we've got that that's the the main function of the code Code Enforcement is to gain compliance it's not to hammer people it's not to worry what people making money off the sales of the property that's none of you know it's just about getting compliance and I can tell the community has called me on this and are absolutely elated uh with the problems uh let me say something chap I I I think it's important that we realize that that the house was a blight yes um and for them to come in and take care of that one hopefully it spreads to every other house on the street I got to tell you commissioner this house and I got to give credit to M Mr Sean here that for the past year the house has been pretty much vacant and in compliance it's just been an eyesore prior to that it was every hoodlum crackhead methhead uh that you could imagine and it was it was it was an eyore and a problem but the new owners are going to rehabit uh we had an issue with the house across street we got that guy on board the block looks 100% better the property values are going to Sky rocket there and we're going to he's going to get a family in there he's going to rent the place and get a family in there at affordable housing so and I'm sure that the neighbor to the north is very happy that the neighbors all around are happy and and and the good he's got the the new people got to dump about 150,000 maybe more in that house to get it where it needs to be in this house oh yeah absolutely absolutely is that where that first violation came from from not having the building permits and doing the repairs well first of all it was we went in we declared it unsafe unfit for human occupancy uh there were electrical hazards there were unsafe uh railings and deckings and just uh a multitude of minimum housing violations oh it was terrifying looking at that list watch the Texas Chainsaw Massac you geter owner went in and he started doing those Works he he applied for a permit but it wasn't approved through our building department then he started the work anyway so then that's where the violation for working without permits confir yeah I think that's what my concern was was cuz I saw that the property was sold in August but then after August it looked like he was continuing it hasn't it hasn't been sold we thought it was yet oh I saw the recent executed contract within the paperwork for August no there's a um there's a purchase contract yeah there's a sales contract may have been a closing on that there's an addendum attached to it it hasn't been able to close because of the link because of the links so if we get this resolution approved tonight the title company should allow it to close the city will receive the check for $1,200 $50 and then they can go in because once they have once they have assurances that the city's going to release these fines then they will begin to invest in it they can have a landscaping crew go in there and mow it they can have dump trucks go in there and remove all the trash they can get contractors in there and start giving them estimates on the uh what it's going to cost them to repair and rehabilitate it but right now they haven't wanted to do any of that because we're sitting on over $200,000 worth and I talked to my good friend Kareem and his partner and I have I am very confident about judging people and what they're going to do I have a good feeling this is the start of something in the city where you'll see other properties being bought the rehabit it they do an amazing job I vetted them and it's a win-win winwin win win win for the city well you know the likes you thank you we don't tolerate thank you drug houses in our neighborhoods and we'll take them down no not off the records um before I go to was no it's unusual but I do want to commend the chief and um Eric because they have been doing such a great job with code enforcement they have been going above and beyond trying to find contact information for the prior owners or family and they have been able to reach people with emails from like four years ago and it's been uh a savings to the city and on on you know legal fees and and it just gets results quicker so I really want to commend you guys I uh I had a conversation with Eric before the meeting about how amazing code enforcement is doing right now so I mean not just this particular but throughout the whole city right now I mean they they've made some real changes so thanks ER yeah thank you resolution 24-12 uh approves a code enforcement board order reducing an outstanding code enforcement lean totaling $12,300 to $2,000 and releases the lean against 124 East Ward Avenue upon payment and upon completion of all conditions listed in the resolution so the conditions are transfer of ownership to Kathleen Jensen and Patricia Jensen they're the applicants uh Patricia Jensen actually lives next door uh payment of the reduced fine and upon demolition of the unsafe structure which has been declared unsafe and unfit for human occupancy and demolition of the dilapitated detach garage so this is the one where the city commission approved foreclosure but they asked us to before that to try to find if we could find some ears so we we did attempt that we we were not successful uh but a um for the L better terms a uh a probate company came in uh on June 25th of 2024 they this company I talked to one of the representatives they have genealogists they have uh attorneys and that's all they do is go through and find airs for dist for distressed um properties for you know that are in Estates so in June of this year they filed a petition for summary judgment uh in the Lake County Clerk uh for the distribution of Philip Met's estate uh so and an order was approved on July 29th once that was approved the on August 2nd the uh a quick claim deed was recorded in public records transferring ownership of the property to estate Co LLC they are the trustee of the4 East Ward Avenue Land Trust so um when they came in they they had landscaper come in they did a lot of work around the grounds um and the intention was to put it on the market so there there was the city knew there was some issues with the building so the representative agreed to come and meet with us we did a walkthr around the outside the allowed us inside we determined that the building was unsafe it's got severe Foundation issues severe structural issues uh so there was a gentleman uh Mr Lou Ron he's here tonight that was going to buy it but his inspector got maybe a 25% through and he says no we're not going to do this so that's where TR Jensen stepped in she's been interested in the property as well she lives at 114 East Ward Avenue she actually was mowing the grass just so that it wouldn't be overgrown so she's done well for um making sure the you know homeless and vagrant stay out of the house we had to go in there and board it up at one time we put some no tressing p no trespassing signs up so has been an issue but you know it has been resolved well it hasn't been resolved but this is the best path forward uh to approve the resolution and let Miss Jensen tear the house down and build her a retirement home for her mother any questions how um sorry when how long does she have to to to take care of that to to demolish those so um basically all she had to do is pay the ACT pay the reduced fine by February 5th but there is not a deadline on the demolition we didn't word that into okay um the resolution but we have uh ways of persuading okay outside of you know uh full disclosure u i I've had a couple of conversations uh with Miss Jensen and uh and you know her house next door she's done an amazing job on it uh Mr roona he remodeled that yeah and it was a real eyesore beforehand and it it's it's beautiful now yeah and um and it it just makes sense that we they wanted to do the same thing with this one but it's too it's too far gone it would cost too much yeah it's a shame cuz it's a pretty house from outside it really is right anything else from the commission no District assignment associated with a annexation um annexation under ordinance number 2435 future Landes under 2436 these were heard at the last commission meeting um due to an error in the ordinance title that was included in your packet um and my response to M Garcia um the we tabled this one and we are rehearing it tonight under its first reading um the ordinance actually was advertised appropriately I was not able to accurately respond to miss Garcia um so the error was only in the ordinance that was in the package not in what was advertised or what was notified um anyway we are hearing that tonight I just wanted to completely clarify that um this is a request for Suburban Corridor for again a annexing property um the assigned land use uh classification is requested to be um on uh March uh earlier in March of this year the mayor pulled together a group of representativ is from the chamber the city and uh try to pontoon boats uh Fred Cunningham is here representing uh the company today um at that meeting we discussed options for beginning tour board operations on uh Lake Eustace uh subsequent to the meeting um s uh City staff did research did our due diligence to learn everything we could about to aboard operations how much it would cost safety issues vessels uh you know uh infrastructure all that sort of stuff um we also looked at other communities that had to abroad operations uh among them uh Mount Dora and taries um we actually toured uh the Trident uh um boat manufacturing facility uh we also uh talked to Lake Ventures uh an existing watercraft operation that we have here um he indicated that uh he and Fred Cunningham and Trident boats have a great relationship and uh the operation of uh tour booat operators uh on the water where he's selling water crafts uh would be an um a great complement to one another and not competition um we um later in the uh discussions we talked about um franchise agreements and uh possible uh franchise uh terms and Provisions and also um the complete needs uh tool operator would need to operate successfully uh at the um uh at the lakefront and relative to the infrastructure uh Rick uh gr who is not here uh put together some numbers for us uh and those are in front of you uh I won't go over them item by item unless you'd like me to uh but the cost to put a finger off of the um boat dock closest to the chamber uh including uh 80 uh 80 excuse me 8ot by 80 ft um fixed the dock uh that would be the modification include modification of uh some of the peers uh it would be water supply and shed and uh that total cost would be $24,000 204 204,000 table he's referring was in the email email P it's not front front okay and you said Al that was near the where the chamber is now correct that's correct okay yes uh now did we take into account or have we even thought that far is that where we want it to be permanently based on what we do with our downtown or should we wait until we get that figured out um that um that discussion took place um uh during some of the committee meetings stakeholder meting that's some of the input that we got from uh the community and it is represented in the recommendations of the master plan which we're going to hear from that those consultants in just a couple of weeks right and and I will say that um staff and Fred did sit down and talk about alternate locations temporarily and permanently are there any alternate locations and I think why not uh this would be their preferred location okay um they temporarily during construction we might be able to do something um a little bit north of here but I think a permanent location their preference would be at this location okay and I think the dock that's there that's outside of the chamber I think that was originally designed for something similar to this but this kind of an operation needs a fixed Dock and something a little bit different yeah okay uh oh sorry one one how far out from the original dock is this one going the reason I'm asking is the boat races um so it's going to run it's going to run perpendicular to the current dock if that makes sense it's not going it's not extending any further it'll be not a maybe not a t it'll be an L if that makes sense so fixed dock comes off into l hustus and then this would uh be an L to the north okay so um I don't think it would necessarily impact okay uh well um if if there is a 50 foot pontoon boat docked at that dock the the boat races might have to shift a little bit Yeah okay all right uh a little bit about the boat information it's 50t long um pontoons are 42 uh inches in diameter uh and the passenger limits 49 um we have um uh considered names for it but we'll share those with you later um yeah Al originally put the SS Tom Corino in the staff report I removed that so as you look at uh or as you consider uh the idea of a u of fully taking advantage of of our Lakefront uh and uh allowing people to tour the natural setting um take advantage of the sunset um Dock and take advantage of some of the concerts that we we have in the um um in the van sh you know I I I mean I know you keep saying tour vote but I think it's more than that okay party vot yeah I think it's it's it's it's going to be like where you can actually hold events on the boat because it hold that many people more party you know or more or even um or even or team te team building exercises and then and the mo and you know what and and every other Lake out there's got something unique you know this is this is a chance for us to have something unique absolutely and have this kind of this kind of um option for people to bring or 49 people on and and do something so I'm excited about it I really am right we we I'm sorry go ahead have like food and available and yes ma'am okay so like if someone wanted to do a wedding or something they could absolutely the whole boat and all that that's cool yes and and and also um uh Fred is going to partner with the landside restaurants that's what I was going to ask if there's buyin from our downtown restaurants and you know how heavily we pursued them right yeah that that's a campaign that's will be developed yes okay now are we able to provide any sort of Educational Tours maybe do a partnership with trout lake Nature Center or some of the schools to maybe do some tours around the lake shore yeah uh Trident and Fred have said they're open to all of those ideas that'd be fantastic I'd love to see that I'd love to see the kids be able to go out there and get a little bit that extra education on those boats also and our seniors I'm sorry our seniors right right okay okay uh let me proceed before Sasha gives me the hook um you don't have to worry about her you got to worry about me [Laughter] geten yes sir um so as you look at uh projections what they might be um we just did some very conservative numbers of 3,000 per year that's not counting special event tours um that just public that um you know uh they go online uh and make reservations for for trips uh very conservative 3, uh 200 um and you know that's four week uh 25 four cruises a week 25 passengers um um a trip and um for a eight-month season uh the season could extend longer uh depending on the weather uh but again just to give you a very very conservative figure you can expect about 3,500 um boat Riders a year um and um the other I put some examples of um other operations that we took a look at that's Rusty Anchor in Mount Dora which is doing well um primary boat tours in Mount Dora um Cat Boats which are actually smaller boats in um Claremont uh but but the idea there um is that there are other boats um succeeding in their tour operations in other cities on other lakes and and actually can I thanks for reminding me about that so you guys remember when I went to um Houston to see uh Jim's daughter get that scholarship from NASA soon as we get to the hotel I see a boat that looks the same size as this one took a picture sent it to him and he says Gary that's my boat they they made that boat for this for this area and it was packed we were there three days it was packed every night for a dinner for dinner cruises so um yeah how big is it the boat yeah 50 ft yeah Happ be moreale that's it I don't want to get ahead of you but I'm going to um the uh advertising yes um I know that Mount Dora taries I know they have them um how do we set ours apart from theirs now I like the million dollar sunset uh but how do we set our aside do we advertise does Fred advertise do we jointly advertise um CU I I don't want it to come and it sit because no one knows it's here right the best advertising is going to come from pulling a team together um and that includes uh events in the random Mir our new assistant city manager Miranda burls who's got tremendous experience uh getting the chamber involved the local businesses involved Fred giving us examples of what has been successful in other cities um so you know putting a lot of heads together is the way we come up with the best advertising strategy now we're looking at was it two about $24,000 yes sir okay I want to make sure that and that's City output yes okay if we put $24,000 into anything I want to make sure that it's going to be around for a while so I want to make sure that if this is what we decide to do and we decide to do it for the long haul which means that the first couple of months everyone it's the new thing everyone wants to do it m what happens after that right that's that's my concern sorry I mean could we Fred do you have any um idea of some of those other cities have done how long they've had their boats abely yeah come on thanks for your time Fred Cunningham uh all the cities around here Mount Dora uh taries we partnered with those operators and help them build their boats and obviously they typically start kind of small and organically grow you they start with one little 30- foot boat 18 to 20 passengers make money and and they grow in they scale I'll tell you that all across the US I have operators that become friends that now you know the goal is typically not to even maximize volume on your one boat entirely but get to a point to where you can scale and have multiple boats so you can offer to those different you know groups and kind of work consecutively or work at the same time where during like a George Fest you may maybe have two or three different boats that might even be different sizes or styles to kind of accommodate those different different groups and compliment each other so I a handful of examples and even you know pnls to pull from when we started this because it's a huge Endeavor for us as well I mean the boat's over half a million dollar investment for us so we definitely have ton of skin in the game and and we want to be able to you know really plug in everywhere so every every different facet of the community every different event and um it to your point you know the idea of starting something and then just kind of falling dead isn't an option for us we have a lot invested and we want want to have be really creative with marketing and how we engage in the community not even locally but even you know right outside of our our normal band because the goal was not only just to give people around here something to do but bringing people to Eustace and part of my experience prior to Trident is in that corporate space where we'd go out and hey we're going to spend 50 Grand at top golf at a night as whatever Corporation right so this is kind of that other Niche uh activity that we can bring people in that may haven't seen uh usess Waterfront or even this area in general and even those more north of here that's constantly expanding to where you could really easily let's say Charter a bus of 45 to 50 people on a very regular basis at a very fixed cost where it's an activity that they can talk about and it's almost an unlimited Supply people if that makes any sense and I think dialing that in with what works is part of that learning process like you said for the first couple months where it's the hot thing and you really dial in what's what's working okay does Orlando have one I know Sanford so we we we built boats for operators in Sanford Mount Dora um tares obviously in Orlando uh we also have one an operator in lesburg in Orlando we have a couple smaller op operators um but there's not really anything like on Butler or any anything that area but we have them all along the coast and they're actually successful in a lot of places outside of the coast as well I mean we have them all throughout Florida I was down yesterday um in an operation in like a really really small town south of Tampa and you know candidly they were telling me their their financials and this is sah doesn't have the visual you know the Aesthetics of usess let me put it that way and uh the big thing is being the first one there and having the space to accommodate that's really the barrier to entry um the the initial investment of the boat and having a beautiful place to put it where you're not going out of business as soon as you start so this partnership with the city is essential to us um you know when we started this business we didn't have usess locked in but it just was the perfect fit as soon as soon as it starts so was like we both have a lot to win here so we're excited about it okay great thank you for that that's good I'd like an explanation how does the city benefit and how and how do this partnership work sure so um we the the city benefits in terms of Economic Development getting people um um choosing uh eustus as a destination it serves as an attraction for the communities all around from The Villages uh anybody who's um coming through on 441 um It's kind it can be kind of an entertainment stop before you head south to Orlando um for additional entertainment it starts to get people bonded to the eustus community they come they like it you know then you know they've um I can't tell you how many times for example I've been on the uh Winter Park um uh Chain of Lakes tour uh because every time I get a new visitor that comes down we we go do that it would be the same here for the um city of Eustace you know um one individual goes and the next thing you know he's bringing you know friends and family and it just continues to grow like that becomes a custom uh e it's another destination or another attraction for Eustace um and you know when they come uh they part with some of their money uh and we like that I think that I'm sorry I know you're ready to go home quickly I want to um also related to your question a a more a more uh direct benefit would be we would negotiate a percentage as part of the franchise agreement yeah you know I uh we I'm I'm not sure if Emily did you here I'm sorry as part of the franchise agreement we would also negotiate that the city gets a percentage of sales um now I'm not I mean we're not private sector we don't need to make money it's going to take a long time to regroup $200,000 but that's I mean Al's Economic Development benefits uh more than make up for that so I'd be lying if I told you we're going to recoup the 200,000 uh but there is a direct uh benefit to the city financially as part of the franchise agreement you know it it just sounds great so many things that that especially what we have downtown and I think will be great to partner with with FR you know you have the crews and you know Bass Street uh you know of play so I I think it's the opportunity for us to kind of you know do some things downtown to it's a good positive expansion yeah yeah so I think it's a good idea so Al I have two questions for you one is where is the shed going um it would be at the end of the dock closer to the um public restrooms that are there MH on on the chamber end of the on of the park of fa park so kind of above where that seaw wall is or like more on the on the ground towards the shoreline kind of in that area Okay um and the follow-up question of that is if we're going to have a structure a shed is it possible for us to get any kind of marine gas going in that same area uh that's an idea that has been discussed um and uh that's one that Fred has said he help us to explore further do you have any additional information on marine gas on what that would take by chance I've done some uh preliminary uh discussions with other marinas that offer gas uh locally and throughout the state and there was a couple different options that we could explore as uh you know as a group I think that as a city decides to expand uh what you do with the property that's alongside um the Waterway there would likely dictate you know us doing something and you know making it permanent uh the easiest solution would be to a large fixed external tank that could have a remote pump and that was my idea what I explored that' be the most cost effective and the added benefit to that is once installed it could obviously be moved because another structure would be buried or or be permanent and that's something that you know as an organization we'd love to partner with the city in whatever way it would be mutually beneficial whether that's the initial buildout or the operation long term and super open to that we think that it's just going to coincide and work with everyone our partnership and you know the Synergy we have with Lake Adventures you know that's something where they're having to go down the street bring back cans to all that I mean just the opportunity locally is immense um for us to bring Revenue into the City and not only that but just be synonymous with a good stopping place you know people don't stop if they don't have the necessary Essentials so we've done some of the preliminary numbers they're very rough and you know I I think just with anything we'd have to go in and really dig into the details but it's not a huge investment compared to what could bring uh the initial so roughly is it like 10 or the initial numbers for tank install delivery and everything kind of built out would be uh sub 350,000 for everything all in okay but that would be a way that we could get our money back for the dock build and also bring additional traffic into the city additional marine traffic in and that's kind of worst case scenario numers so I mean it could obviously be done more effectively bitting it up I see Swanson back there and I don't know how our fire department gets their marine gas but I know that we we need Marine gas and I don't know where to get it around here gas station you have to go to a gas station put it on a trailer and bring it out take the boat it lives on a trailer yeah it lives on a trailer boat mayor what do you think um I've met with Fred how many months ago Fred it's been a and I got very excited about this um I it's it's using our Lakefront the way that we've intended to use it for many years um I love the fact that Fred has a local business um the business is into varies that boat's being built into varies um he's already got a structure set up for the business side of running this boat um and I think it's um it's well worth the investment that the city will have to make in this so with that said um do I have um full Comm U approval of the commission to move forward yes yes all right Fred we look forward to working with you and we want that boat here soon thank you for the opportunity I look forward to as well it's going to be a lot of fun thank you very much it's exciting do you um we're going to need to bring something back to you this is unbudgeted yes um at that time we can discuss options um but I see really just a couple of options one um CRA um would be an option or uh taking uh money from um fund balance or reserves can you do a combination of both we could Tom we had money in the sell of the spray field that we had done out east of town can any of that money be used I think that was 1.6 or 1.7 million that money basically went into reserves okay um all right or again I'm not sure if I'm using the ter the correct terms uh but it it it is in reserves and so um we don't have that kind of money elsewhere in the budget to just move uh so we would have to come back to you with the budget our reserves are very healthy at this point yes okay all right let's move forward and see what we need to do okay how long do how long do you think that it'll take Fred from from this point to as soon as the do done I'll be there okay that okay so I will in talking to Rick um there's permitting involved there's engineering involved then there's construction um so it will take some time and part of our discussion with Fred was is there somewhere we could go temporarily and there are challenges with all of our temporary sites so we'll we'll work through it we'll figure something out um but uh I think the the engineering the permitting and the construction are going to take some time especially for Fred's purposes a fixed dock is best we could do a floating dock more quickly but I don't don't think it's safe uh nor does it really serve Fred's purpose so if it's got to be fixed that means again engineering permitting somebody's got to drive piles uh it's just going to take more time thank you now go ahead with the next one okay thank you sir um so mayor uh you got us in trouble again I know uh you invited us to a meeting uh octob um excuse me at the chamber or at the last commission meeting you asked us to um have a meeting with the Chamber of Commerce to talk about uh ideas uh that could support the the strengthening of the businesses business traffic uh downtown and so we uh reached out to the chamber um and uh um up uh we had some conversation with them but prior to our uh meeting with them I researched uh uh grants uh for other cities other Ras uh and put a put put together a list of those ideas to present to you for consideration tonight so um the ideas uh Grand ideas that was were discussed with the chamber and um uh fall into two two categories number one is to increase putot traffic and number two is to uh DEA some of the cost of um build outs uh or um improving the buildings so so the very first one is uh entertainment grants uh this involves um providing uh a recommended $500 to businesses um who want to have a u live entertainment at their place of business um or uh outside and near their place of business uh those grants would serve to catalyze uh traffic in an area and um you know provide foot traffic for uh business is in a general area um the more businesses that uh apply in the various um um um let's say uh um directions or not directions the various locations in the downtown area Northeast South and West uh the more that traffic moves around and um um and um provides patronage to uh a broader base of businesses in the downtown area um with the recommendations we're recommending limits on all of them uh so in the entertainment category we recommending a limit of 10 um and um so the total um for that would be no more than $5,000 uh next concerts in pocket park um pocket park is um very very underutilized and one of the uh ways that uh uh it can be uh given some life uh and used as a tool to help businesses is to offer um grants for uh or to um institutions like uh public scho uh middle schools high schools uh colleges um to come and to play in that pocket park uh bring their families with them uh some of those could be from the outside the area bringing people across town um you know discovering eustus for the first time um and um you know creating a u you know favorable impression so hopefully they'll come back again uh we're recommending doing uh a maximum of uh two of those a year uh but that number could change um next um Merchant uh matching um marketing match uh Patron tour a program in the past the city has um um paid for um tour buses to go to The Villages and bring folks from The Villages into hustes to shop uh that proved to be a very successful um Arrangement uh and so this essentially would bring it back uh we're recommending two tours be done a year for cost of 2400 bucks um Sidewalk Cafe or al fresco dining uh right now we don't have a lot of restaurants that are using the sidewalk uh outside their shop to um provide food um lots of folks like to eat outside especially in the um uh when the weather is is Pleasant um and uh this grant would provide um a $5 $1500 Awards to businesses to um make fixed arrangements to support um a sidewalk uh Cafe fixed meaning that we don't want anything that anybody can walk away with and um just two more um customized business training for struggling uh shop owners um currently we have a a number of programs uh that are in group settings and that businesses don't tend to want to um publicize the fact that they aren't doing well in front of an entire group um perhaps more individualized or um you know small group um training uh could be provided uh over by UCF at the incubator by The Kaufman Foundation by lead uh by a number of organizations but again we you know this is a compliment to everything else we're doing um so that uh if there's inventory uh problems controlling inventory problems if there are pricing um issues um if there are marketing strategies um you know if there are refinancing uh issues uh this is a way we can bring them some professional expertise um in a way that they would receive it um and be open to it um in in in a more customized private way that uh we're capping that at um $99,000 for three Awards and the last one is um commercial interior uh building a renovation grant this would provide funding for businesses to do a buildout um you know uh shrink a space expand a space put up uh dry wall um you know to uh um make the space accommodate um the size of patronage they think they're going to um they're going to attract and then make it appealing um to that group that they are most trying to pull in uh Commissioners uh those are the six um um um six Grant um uh ideas that we have um brought before you uh if you implement all of them it would cost you $52,900 um you um you know we our ask tonight is that you tell us which of those you'd like us to implement if any Now where's the money coming from if you need 52,000 to do it all where does it come from we actually have it uh in the um you were gracious enough to set up a a $50,000 line item in the uh Economic Development budget so it could come from there but we also could use some funds from the CRA since um you know it would be supporting businesses in within the CRA so the money is in the budget the reason I brought this up at the last meeting and asked you all to start working on this is I have a great fear for our businesses downtown and the economic problems that are going on I think that the city needs to to be a catalyst in making sure that our businesses are successful not for make for picking winners and losers that's up to those business owners but we need to give the infrastructure um I'm in full favor of trying all six we're at a point where we've got people struggling downtown so my my vote would be to go ahead with the 52,000 let's put it all out there let's see what sticks and let's see what works that's my opinion rest of the commission no I go ahead no you go ahead oh F I'll let you go first perfect so why why just 52 I mean do we have a expectation on on what the businesses are going to want and you say why the 52 why why just 52 why not more how' you come up with 52 I'm just curious I know we've got 50,000 okay that makes sense yeah that's you know if we start with this no that makes sense finding something works we could come back and do a budget adjustment to it okay that's and and have we thought about the parameters on the locations of the businesses that are going to be allowed to do this and are they allowed to apply for all of these or just some of them or is there a limit per year yeah there there is a limit per year and the details uh will be worked out I mean you give us the okay and then we set up the parameters for eligibility requirements uh for each one anyone else will oh I'm done oh okay um you know I'm looking at the um uh the entertainment grants yeah our downtown is what two square um uh two two square blocks it's not very big yeah it's not very big and you know we have the uh um uh you know we're talking about uh entertainment grants at restaurants but then we have concerts in pocket park uh pocket park to me it just sounds like it's it's a better because you got the traffic going by um um we have and and it seems to me like the concerts would be more more or the entertainment would be more for the restaurants if I'm not mistaken right I I think one I'm sorry I think go ahead I think the the ENT the entertainment is for like specific businesses to have in their businesses where the concerts and the are are different Am I Wrong the yeah the concerts are for a broader audience uh at the um the uh uh entertainment is going to be specific to the style of a particular business okay yeah so it could be a little bit of country it could be a comedy act it could be okay you now um the outside Sidewalk Cafe MH I know that there are at least three or four Chris's Place Romas they're doing outside cafes without City money right how come everybody else can't do it I mean I I know what we're trying to do and I appreciate what we're trying to do but I just want to make it fair right they've gone out and they did it on their own right and I think that they've been pretty successful mhm um the the the idea is to encourage more people to or more companies to uh get on board with um our Fresco dining um it is not something that we're going to do you know it's not a program that I can anticipate will be offered you know year after year after year um you know maybe in the second year Alfresco dining is so pervasive uh over downtown we won't need this anymore but this is you know will engage you know um you know getting more and more activity outside uh and allowing uh Patron excuse me patrons to have uh that outdoor you know good weather experience kind of leads into if a business currently has al fresco dining could they apply for it to kind of upgrade any of their outdoor seating or replace them yes they could and and I you know Al talked a little bit about um about furniture walking away and that I mean that's more than just a theft issue the CRA can only pay for stuff that stays in the CRA and so if a business buys a a table and then they pick up that table and move it to another location outside the CRA we violated state law and so what our vision for that is it's for infrastructure it's for electrical receptacles it's for uh integral planter boxes it's for building the infrastructure to support that outdoor dining and and so if there are existing businesses that have outdoor dining but they want to Spruce it up or they want to make it more permanent or they want to do more uh they would certainly be eligible to do that so um the monies for the entertainment is you know can we use the um the money that we set aside for park at Park that if everyone needs anyone needs it it can be supplemented from that so are you if entertainment grads are wildly successful can we pull from the money we've set aside for concerts in the pocket park is that what you're asking no the it just makes it it sounds good on paper and in front of us but how would that I don't know if it'll be used that much which one uh the entertainment I I I I love the pocket park I I love that but well part of this you know part of these ideas is you know to see what what is you know what the um business owners latch on to what they feel is um you know useful tools in helping them to generate uh uh patronage uh and um so we'll have some um some um empirical information next year when we talked to you about refunding the program okay commercial interior building renovation grant who does that go to does that go to the building owner or does that go to the business owner okay and we honestly have not developed the program yet I mean that would be the next step is develop the program and the details okay it might depend on the lease arrangement I mean is the property owner doing all the buildout in which case it maybe it should be the property owner that gets it versus is it a tenant buildout and then the tenant should get it um so we we need to work through the details we hav't is it a 5050 is it is it like we do the um you know Gateway Grant again we haven't developed the program yet okay but I mean if we wanted to model it after Gateway Grant then yes it would be a 50/50 match up to a certain amount MH and then again I the CRA concerns if we use CRA money I wouldn't want to fund anything that the owner can then take to another location it's got to stay in the CRA yeah yeah yeah and and for for live entertainment you know does it benefit all the businesses downtown I mean how does how does um the seamstress you know what kind of is it fair for everyone so you know that kind of stuff concerns me whereas pocket part everyone has the ability to use it and it still draws people I've given you my two cents worth anyone else I do when we when I think about p pocket park and having a concert there where are people going going to go where they are they they can't be seated so they're just going to stand around I think they have little chairs and we can put chairs in we put chairs chairs areil chairs yeah there's some work that'll have to be done to pocket park to really make it work out of all of these um I liked the idea with pocket park um but we also had some ideas with with American Bloom right we wanted to be more artsy with it and the things that we wanted to do and like the butterfly putting that there were people it would have tried people to come and stand in front of it to take photos I was thinking of it as more artsy which we I guess we could combine the two but um that one appealed to me the most uh I don't particularly like the idea of the buildout because I feel like if somebody's going to do a business they are going to be prepared and they have to they should that should be what they do that's how I feel about that one um Patron tours not crazy about that idea that can I say something while you you're on that you know I think that's a great idea if we can do it in conjunction with something like it at at the theater yes but yeah the theater dinner and when we did when we did those before they were hugely successful but we had more to offer them right than we do right now when is this going to start we got to have to develop the whole program some of these tours are amazing and the amount of money it but it literally buses money into the towns yeah so uh like the Red Hat Society those ladies they rent buses and they go out to different towns and a lot of these smaller towns really depend on that funding so that's actually probably one of my favorite line items here is several times a year literally busing people into to our downtown I love that idea I think you could turn something like that into the other one I was thinking about when we and and I I like that thought that when you're um paying for entertainment in a specific building there are not as many people taking advantage of it I would like to see more done in pocket park and the and the um and the big the the theater outside Outdoor Theater um I think would be something that would great I could see more focusing on that I'd like to see more uh concerts there um so those are the ones that I I guess I favored the most um I'm convinced what you guys said about the tours that's because I wasn't aware I've never heard of even that so that that um I could go along with and um I said I'm not that comfortable with the with the entertainment grants and with the build outs um because I feel like what if it doesn't succeed you know do we ever recoup our money are we because I to me if you're going to start a business then you're coming prepared you're going to get a building if you're going to rent it or buy it or whatever that's your issue to to to repair or renovate however you want to do it so that when I'm not as comfortable with um so those are the ones that I would you can we because I I'd love to hear from like Chris hoop I don't know if we can i' I'd rather Al kind of take a tour downtown with the plan and then bring it back to us one more time once it's really kind of faked a little bit more but let him go visit with the different business owners have you done that yet not with regard to this no no yeah and and and you you kind of see some of the issues that would have how does does Nyla or you know the dog how they think that Al has heard some of our concerns I think that we need to have a Merchants meeting downtown and make sure that every business down there is invited yeah and if they don't come that's on them um and then we can see what we can do to move forward and guess some ideas about what their meet needs might be maybe they have something different suggestions than what we have here that they might want have inut on does that sound good to everybody yeah I like you think I like it that you're thinking outside the box and it's this to is this to attract more businesses or more to help the ones we currently have both yes both but but let me just say generally downtowns are struggling all over the country um you know what's important is that we do something and so that's what that you know that's why this is is important you know uh that's why the mayor called the you know our little economic Summit um so we can think about um you know um those assets that we do have we're in a better position than a lot of downtowns because we've got assets you know we've got uh fair and park you know um we've got walkable streets you know um there there a lot of we got the lake um we've got a lot of advantages that other cities don't have um so um we we can leverage those to our benefit are the local businesses attending the um the meetings at George's Place uh are they trying to get information and yes we we're and is that available to them do they know that that's available to them yes you mean the community meeting no I'm talking about the uh small business small business small business group and the the business incubator oh yes yes yes yes yes cuz if they don't know that you know that may be something else that you yes and actually uh just so you know um the county um and uh myself meet on a regular basis to talk about what we're doing in terms of marketing the incubator um because that's one of the requirements of our contract with them one of the main things that that that we're getting ready to do this master planning and hopefully get building started on the Waterman property if we don't have a vibrant healthy downtown now and we don't start building it no one's going to want to invest and be in our downtown Corridor so we've got to get the ball rolling now so I that's why some of these ideas are important so I would encourage Al if it's okay with you all to go ahead and start Miss meeting with our business owners present this list of things and get their ideas and then come back to us one more time and we can go ahead and and put this together you know I agree with you I would like to see this sooner than later we're coming into a holiday season and some of our businesses are struggling and I think any help that they can get especially if we're trying to do tours you know trying to pull in a tour from the villages to come down come downtown I think is going to be huge for a lot of our our businesses and I think this is needed sooner than later so and I think you've done a really good job buing this together thank you thank you and and I want to Pig back on what both you said um you know sooner than later but again it comes back to we start something and it takes us forever to get anything done you know and and and and I'm not talking about you but you know what we're trying to do with Fred I mean come on people let's let's get some urgency to get our City built m and and that's the thing where's the fire you know I uh I you know our master plan and this is going to be my closing but let me have it and I won't say much later um but the the master plan you got to go no well I do but go ahead we talked about our master plan in the spring of 2023 and we still don't have it what the heck are we doing we got to get our City built this is taking too long everything that we do in the city takes long yeah sorry oh thank you and that wasn't again directed at you but it's just since since we mentioned all that you can go and have a seat Al I mean Al's already got it budgeted and it seems like we're mostly in agreement they just got to flush it out a little bit so hopefully it go a little quicker hey I got a little bit more Gary hold on well you can't hold on go Terry you to start P to these meetings the Lake eust Area Chamber of Commerce has really put together a neat program also um they're doing a small business season uh that is a bilocal and it started November 1st and some of the neat things about that and Marie pointed out some stuff out of every $100 spent in our local downtown businesses $68 of that stays right downtown and it helps employee emplo employers it helps bring people in so we need to encourage our folks and the chamber's putting out press releases and everything right now to encourage people especially during our holiday season to buy local and to shop downtown instead of going to Amazon going to the big box stores let's try to keep everything downtown if we can you know we we have light up uses is most of downtown going to be open for that that's the other thing we need to encourage I've gone down there at 4:00 to closing locking up and we've got when we have events downtown that they could just stay open a little bit later those are kinds of things that attract people so hopefully before we go on to the closing Miranda U Mir will you come up and and kind of give us a preview of what's going to happen this weekend downtown if you don't mind I know I've caught you off guard it's easier for you to do it than me though because my mind is spent tonight all right sounds good Miranda Mir Director of Events and communication um this weekend is our salute to Veterans um celebration it's kind of K kicks off tomorrow uh with the Tomb of the Unknown Soldier there is a replica Tomb of the Unknown Soldier in faen park right now um big thanks to Public Works it was quite a task getting it here and getting it unloaded um it looks beautiful um we have some signage up there that kind of tells you the history of the the tomb and um its significance and um it will be on display um officially starting in the morning um all through all day on Sunday um so please stop by and take take pictures and enjoy that um then Saturday we will have our official celebration which will start in the Park oh actually I think parks and Rex starts at 8: a.m. um with a two mile dash so if you haven't signed up for the two mile dash make sure that you do so um then in the park we'll start at 10:00 a.m. um with vendors food um some entertainment on the stage uh in the park uh just how we normally do is it 2 mile or one mile it's a two mile dash did you sign up for it I did not sign up for it it's two miles signed up for a one mile the mayor signed up you push me in a sh at 2 pm we will have the salute to veterans parade which will go down eusta street and it is changing directions this year um um due to some parking challenges um and just safety reasons we have flip-flopped the parade route um so we will be starting down at we will the parade will meet up at Bates and Eustace so if you're going to be a part of the parade that's where we're going to start lining up um and then it will head up Eustace or head south on Eustace all the way back up to um the police station basically sorry I'm forgetting my street names at this point but um so we will just be going backwards um just different than last year um and then at 3 p.m. or immediately after we all get back over to the um Park we will have the um ceremony of Honor um where we honor all of our veterans and we have a special guest speaker um Representative Keith trunau um Senator elect Keith trunau um so uh we will be joined by him as our uh keynote speaker and we will have a nice little celebration of veterans at that time thank you so much thank you for all your team has done Joby thank you to you and your team for getting that uh tomb uncrated to today I was down there watching y'all that was a big chore but the thing is absolutely beautiful so I think people will love it so thank you we're going to go down to closing remarks now Gary since you've had a break you want start us sure why not thanks for that you know three after three hours I so um the the the only thing that I really have on on my list is I've gotten a lot of calls this week from residents about debris C clean up so oh yeah can we Tom can we just get a just a very quick very quick update on that and maybe a possible date that it I mean I I know it was a major storm and it was a lot of clean there's a lot of clean up but that is something they're asking about yeah so um our um our in-house crws uh plus Waste Management plus we've gotten some extra help from tiptop our arborous contractor are working on it uh we hit the ground running the Monday after the storm so that was October 14th um since then we've picked up 997 truckloads of debris wow uh 5,000 tons of yard waste uh 3,740 piles have been picked up and so what what we've been telling people is about four to six weeks from October 14th and so we're about 3 weeks into it and if you drive through other communities I think comparatively we're doing pretty well uh and our folks are working hard so I would ask folks to uh be patient um and uh we're trying to get through things as efficiently as and effectively as we can but uh again I I I want to thank uh Joby and all of our crews who are out there working hard and um it's um not only picking it up but uh getting it delivered to the uh the incinerator site and getting it burned and um so anyway a lot of work going into can we put those figures on a PSA on our website at social media yeah we can uh and that may alleviate some of the phone calls that we get cuz it's not like you know they're standing there kind of twiddling their thumbs you know maybe a press release maybe a Facebook post or something that we can share kind of get the word out kind of like a halfway way mark update go ahead that's all for me m that's all that's all Christine already head sister I want to say congratulations to the Eustace High School Panther marching band because they got straight Superior ratings at the district competition in The Villages absolutely so we have a fantastic marching band um and I know Christmas is coming and I'd like to see Public Works maybe do a sweep in downtown eust see if there's any kind of loose bricks kind of holes in any of the bricks any little areas that we can kind of patch up and kind of Tighten Up Downtown a little bit um and I'd like one committee made if possible what's that I would like a fact finding committee for sister cities created just a fact finding not an advisory committee but I'd like to get that started as soon as we can all right sounds good anything else ma' no sir thank you thank you Wily Wily well you said you going to be quick I'm going to be quick okay on the 13th the 13th of December we're going to have a special needs Christmas party oh so um uh and it's going to be at the uh the Women's Club did you said the 13th the 13th uh you know they wanted I ran into you know uh there some of our residents and and they wanted the Halloween and and it wasn't enough time so so we put together a u you know with the help of uh parks and Rick and PD and Darius we we're putting together a dance for so perfect um come on out and Shake A Leg got it what do you need do you need anything for it any help Women's Club you Women's Club nope don't need anything anything else Willie uh nope that's it was qu that was it thank you vice mayor I was wondering when are we having a CRA meeting keep when we were supposed to discuss everything or all I don't think we've come up with a date no okay I um I I was told but so Horus is trying to coordinate with his board uh because they want to be part of the meeting um and he's working on uh he said he would get me a letter uh outlining when they'd like to meet and uh some of their their requests I don't have that letter yet uh but that I think that's the next step well the only other thing I would have to say is that I love the trees the way that they're decorated this year really really pretty and I and I'm and the big tree and then the ones that just goes up the trunk and stop very nice good job thank you for that I'm done done for vice mayor I just own American Bloom you know we're talking about uh wings and things like that uh the skate park is there any way we can incorporate something like that into it yes I think that by all means I'll put that down um yes definitely okay uh thank you ma'am Tom yeah uh already gave a storm update um and then the only other thing I have is um master plan community meeting uh 5:30 p.m. on Thursday November 14th at the Women's Club uh I've not talked to uh Al or the consultant but my vision for that is probably start off informally at 5:30 uh the consultant will be there we'll have boards and easel maybe give folks an opportunity to talk to the Consultants one-on-one kind of Mill about a little bit uh and then do a formal presentation maybe at like six o'clock so that's my vision for the meeting and I know uh commissioner Ashcraft uh is hoping to be there by 6 o' yeah I'll be I'll be there by 6 but it's it won't be at 5:30 yeah so I think I think what we can do and again I haven't talked to Al or the consultant yet but I think we start off informally give folks a chance to talk to the Consultants uh and then have a formal presentation a little later at like six o'clock so that's my vision what's what's the final outcome of this meeting going to be I think we want to present what the consultant has worked on and then I would say we want to get some input and feedback from the public but uh I don't think we're looking to make wholesale changes I think it's more about presenting what the consultant's been working on um and talk a little bit about what the um the development partner has been involved in the process so talk a little bit about the three blocks um and get some feedback you know how many missions to outter space have there been since the spring of 2023 how many babies have been born since spring of 20 how many brain Sur it this isn't brain surgery let's get this done you know there you know easel you know coming in and meetings and all that stuff let's get it done if they would come to town more than once or twice a year maybe this thing would be done but this is taking too long it's about time for them to come with a plan yes it's just one one meeting after another and then we never get anything solid and purposeful so we know where we're going we'll be another well my turn will be over and it still won't be done oh no I'm no she's right you know this is taking too long when they came before us I asked them how long it would be and they said oh about nine months no I think they said a year and and I said nine months we can do it bull M you know this needs to be done we need to be a priority at this point and I don't think we're a priority to them but this is taking too long okay now I'm done anything else that's it all right and I want everybody to I want everybody to be aware we're going to have Planters outside of all the the businesses and nice flowers in it so we're evening everyone welcome to eustus City Hall this is a city Commission workshop on Land Development regulations it's 4:30 p.m. Thursday November the 7th 2024 is there a corn president proper Don has been given yes mayor thank you so much Mike I'm gonna turn it over to you sir yes sir thank you thank you for the record Mike Lane development services director you may recall Commissioners that um this time last year we had a workshop and we were primarily concerned about the cookie cutter subdivisions that we seem to to be getting here and during the workshop we talked about Suburban uh residential districts and we talked about lot widths the frontage uh setbacks uh we talked about landscaping and we also talked about design guidelines uh and at that time we talked about uh pursuing uh assistance from uh planning Consultants to help us uh subsequently uh we did reach out to kimley Horn who was on our uh continuing Services contract and uh for the last nine months we have been having discussions with them about our Land Development code uh and about your concerns with that particular uh cookie cutter look here in the city and uh uh tonight uh I would think this is probably part two with a lot more um information and meat to it than our last Workshop uh our our I guess our kimy horn representatives are Brian Kanan and Katie McGruder and uh I'm going to basically turn it over to them and let them share with you some of their first drafts beautiful thank you welcome good afternoon commissioner mayor um I'm Brian Kanan my teammate is Katie over here and we've been partnering on this thing together from the day one and partnering with your staff in a in a beautiful way um we've developed a lot of design guidelines um over the years but we've never had a city that actually has asked us to do develop design guidelines to make the builders do better work and the streetscapes get better so we congratulate you on that it's it's a wonderful thing and we're so excited to be part of that um so what you're doing is a little special and you should be proud of that um we've been working with closely with staff and and you know we've had the pleasure of meeting most of you face to face and that was very helpful to us to get you know the feeling from the lead leadership of what's important to you it's nice to be back so we received excellent direct direction from Mike um and Tom and um and just to put it back on on our Focus we were told to evaluate Your Land Development code and uh and how we could improve the quality of what gets built in your city and what we found uh when we you know Katie and I took a field trip after talking to all of you and talking to Mike at length I think we went to place called Mayhill maybe some other places too and what we found is the single family streets are quite dull if you will they've not very inspiring so there's a big opportunity for better and um we found they're very repetitive the homes are just endlessly the same you know uh little variation they're all uniform lot of what we saw is one story and that that's just part of the repetition of everything we saw uh the garages are very prominent in most cases and most noticeable of All To Us was there were no Street trees so you know the architecture is important but if you've got Street trees that grow up the architecture almost disappears so that's a really big deal which we can fix uh and is in the guidelines so early on we shared some ideas together and um some of the things we were considering you know as a team were let's vary the lot widths let's vary the building setbacks um let's add porches or patios there's a difference porches are raised patios are nice Open Spaces covered but they flat and we like both we'll show you some examples of that um let's assess the impact of smaller lot so there's a lot of discussion about lot sizes which also got into density a little bit and um you know and the discussion was well if we make the Lots bigger is that a good idea and we said not really because in terms of the effect on the quality of the street you just get bigger lots and bigger houses but we want more diversity and variety and not everybody wants a big house we want a whole range of opportunities prices and sizes you know based on family typ Michael turn off your phone I'm glad it's not my phone and uh and we really want to see some variety in building huts so it's not all just you know one level play so I think we've done that in the package that you're now beginning to look at and uh I think we've got much more diverse menu of things that are options for people and right about in the middle session no uh we've got this sort of wake up call which is the state changed the comp plan chapter and said you got to be careful regulating architecture and to be honest with you we never were going to regulate the architecture ever because you can't actually do that so we've got in this package a nice division between things we can regulate that we call mandat and things that are advisory and the power of advisory is Big by the way you know when a developer comes in and they look at this and they see um that that they're not required to do that back part of what's in the design guidelines but the city likes it the city sees Merit in it the city sees things that are good in it that has a big effect so don't under estimate that um we can talk later about density it came up and we battled with it a little bit I'm fully prepared to talk about density but I think after we maybe go through what we've got and then um we talked to Tom and there's some interest in discussing Self Storage so we have a lot of information to share with you on that as well Katie does and I have as well um so I think maybe at this time let's just sort of take a quick run through the document itself and you know I'd like to keep this informal so if you have questions or anything's not 100% clear let's just stop in the middle and chat a little bit about it uh because we thank goodness we're not in the rash tonight so let's see if I can make this work over there okay I can read it okay so um okay um so there two parts to this there's development standards and we want those to be requirements and then there's um the opportunity to get waivers from those if you play bowl and join us with accepting these guidelines so that's a a strategic idea that came up in our deliberations we had to go back and forth a lot before we got to that point but we think it's very workable and and so the second part which says architectural style guidelines that's advisory and that's you know just suggestions it's more than suggestions because what that is it gives um a builder or developer an idea of what's really good that's out there that they could benefit from they could learn something about proportions and scale and materials they could learn something about details and most importantly they can understand what the city thinks is good and that'll bring up their hopefully bring their expectations up a little bit so that's that's how we've structured it um this map's interesting it's this where we started we said let's look at all the SR Parcels that are undeveloped that are vacant and they're scattered all over the place and they're different sizes and there's one really big one as you all know so that informed us about scale and trying to make sure we could uh calibrate density and and standards to these different parcel sizes so these are what we call the mandatory requirements for anybody that's coming in um to develop or Annex in if you will and uh we think that they're fully covered by the state statute they're not in Conflict if if you will so I I can't read that you probably can't read it but what it does is it takes lot sizes because we wanted different lot sizes so it starts all the way from 100 and goes all the way down to 30 and by the way in the city today there are some 35- ft wide uh Lots which are interesting some are built and some are still vacant and so we'll talk a little bit more about that and then uh you don't have a lot of rear loaded garages but that is state-of-the-art for some developers especially on a big project so we've got those criteria which is um typically small lots to maybe 60 foot wide sometimes they can be re loaded and we we want to make sure that we all know that's a developer option we're not forcing them to do that it's nice when they do do it the street looks better the garage is hidden so that's on that page and then these diagrams uh take the smallest Lots I think that's a 30 and they go up in like five five foot increments and and uh you can see that it shows the relationship of the lot the building the garage the street the sidewalk and the street trees and all the dimensions that are important to get all that done so I put this one in because this is what's actually Inus today that one on the left is on a 35 ft lot unusual and we we took some time on our own behalf to say if if they build more of those on vacant Lots let's see if they can do it like the one on the right which is just adding a simple little porch and extending the porch in front of the garage and the whole thing transforms and becomes much nicer that's easy fix for a builder so I wanted to throw that in at for you to consider and then these are houses that we have designed and had built in the city city of Orlando uh in the Redevelopment district and these are um really nice and you'll notice that onecar garages so when the Lots real small and the garages in front on the street one car actually works pretty well you can see what it looks like so those are 40ft wide lots and all of these were built in the CRA area in Orlando and they're quite nice you can study them in detail they were very affordable because that's the purpose of these and um they meet the needs of young couples uh older couples that don't need a lot of space and firsttime you know buyers so they they're very useful and then and they look great so um that's more of the same 40 foot wide Lots I think they're 80 foot deep so they're actually quite shallow in this case and then these are what a lot of Builders want to do which is 50 foot wide lots and what we're saying is they are when they're on the street the maximum number of garage spaces is two and you can see the street trees and all the other things I described so I threw these pictures in to give you an idea of what a 50ft lot can look like so I built these with my wife in College Park very successful and they're on 50 foot Lots five foot size of yards and they're gorgeous and they sold very very well so that's a more contemporary one and this one's a little more traditional with a Spanish tile but again 50 foot Lots so I throw and the garage is there it's a two-car garage and it and it's set back and just go back one so both of these plans have what we call patios so they're they're they're like a porch but they flat and people like that so there's nothing wrong with that and they're covered and you can sit there and enjoy your your coffee in the morning all that um so both of those have what we call patios flat spaces but they're beautiful they're eight feet deep and they're nice and wide you can furnish them and and you can really engage with the street nicely and um so that's what we did with the 50s and the 55s uh and you know it gets easier when they get bigger so we just went all the way up to to I think a 100 so what is important um that we have to make sure is boldly stated in these guidelines that's not quite in there yet is you could you cannot do two cars if the lot width is under 50 ft wide you got to go one car so that it's it's in the drawings but we want to put into the text that's one of the things we'll we'll add and then uh [Applause] whoops I think I better to go the other way so of course there's rear loaded so rear loaded you know um you can get more cars parked you could actually get almost double that the number if you got deep locked you can have cars in front of the garage and in the garage and that's great because it has no impact visually on the street at all so we've got a couple of those for you to look at and so that was all that first part is what we say is required and mandatory the next part is the uh part where we trying to inspire people give them ideas see if they can pick up on it see if we can uh get better results from them but but but we can't force it on them we can't tell them what to design we can't tell them what colors to use we can't tell them what materials to use U but we suggest so we picked three Styles if you will as you know it could have been other styles we picked Coastal because there's a lot of lakes in this community and so we thought Dam makes sense you know it's not on the beach but it's Coastal and um the other one was Craftsman which is very traditional so a lot of what you've got in town that historic is craftsman style and the last one we put in there was um traditional Farmhouse which is sort of a new emerging style that's quite nice it's clean simple and and it's quite elegant so we put those in there and then we show these preceden we're not saying you got to copy this we're saying saying get some ideas of what this stuff and you know what's amazing to me is we could build these beautiful houses way back in the day and we can't do anything as good today that's just weird so I think to your credit you're trying to fix that and I I'm 100% behind that idea uh and then I can't read this from here you've got it in front of you but it talks about the Essential Elements you know which way the roof should go uh what are the proportions um and so we answer there for the three Styles and any questions at this point might be might be a good time if there are any do you have do you know uh a lot of developers how how do they feel about uh uh the rear rear Lots MH um the more sophisticated ones build them all the time so um you know names David Weekley good Builder they do that a lot they Oakland Park for examp go see it um but you can't do that easily on a small lot so that's usually when you can control the whole block and um and you really have to be controlling both sides because nobody wants to build a single loaded alley it's expensive um so they work really well on bigger projects like that big parcel of land that's up was in the blue that would I could see a lot of that in there but on small Parcels probably not so much would that add substantial uh uh amount of money to what they would put out if we if it was rear loaded I don't so a little there's a I don't have the exact metric I can get it but a little bit but it doesn't break the bank any other questions okay so moving on um the density question came up a lot and we circled around it a lot and I'm going to get my own so the first reflex when things aren't going really well is let's change the density and make everything bigger and that doesn't do anything it does not change quality at all to change the density density is also very complicated because it's how do you measure it you know there's net density and net net net and then there's gross density and you know do you count the streets do you count the sidewalks do you count the rear uh yards do you count the open space do you count the leg so it's a very complicated discussion sometimes so we're dealing with net density for this discussion today let me flip to this so I can actually read what I'm showing you there so in our firm um going we're experimenting with small homes so these are interesting these are these are these will be wonderful small homes starter homes they're on 50x 50t lots and uh the one story as you can see they've got beautiful porches they've got beautiful facad s and um the parking is usually on the street so I just thought I'd throw that out there I'm not asking you to do anything about it in communities like this where parking is usually on the street are those smaller like smaller developments yeah they could be so here's the here's the here are the diagrams I did to illustrate this and this one is seven Okay so okay so this one's interesting so on the right side of your screen those are basically 50ft wide Lots by I think 120 deep and the density comes in at about 4 and A2 net and then on the other side we've and we've got 24 units and on the other side we got 40 units and they come in on a gross density of 7.6 but you get two parks you know and you can do it oops there's there's one other diagram I think somewhere okay well it's probably coming later that one okay so that one I was trying to shuffle these but I didn't get around to that one's sort of interesting because it's got five to five basically I could find it I just go up and read it so this one is interesting because it's got 26 units on the right that's five units an acre and on the left it's got 28 units it's 5.3 units so it's more the same density but there's 1.6 acre Park in there so you can play these variables uh when you're doing planning and um can get some good results so density we got to be careful just changing density is not an automatic fix for anything and that's really the only point you can stay at that Podium if you're comfortable there okay yeah that way you can see the screen better does help I thought I had good glasses but I gu they're not that good okay so this is where I want to hand this over oh thank you uh I think this is where I want to hand this over to Katie so she's been working on the policy side that duve tails with what we're being talking about thank you actually can I ask a question yes sir um do you have any um any experience with with people purchasing if they'd rather have a garage or not based on some of these densities there's no garages are there yeah um they they would like to have a garage okay and the garage is interesting in today's world the garage often is not a garage and sometimes it's an office sometimes it's a gym sometimes it's just storage which is the other discussion we may have tonight MH um but so they'd like to have a garage um but if the price points are available by eliminating the garage then they'll live with that too which is some of the goings yeah that's the reason why I brought it up what's the square footage of these homes bigger part the square footage of these homes small homes um I'm going to think about that I think I think the smallest was 700 and ,300 would be the range now when we I'm sorry when we talked about uh mixed uh you know mixed sizes uh do you picture the sizes ranging from what you and your wife built to something down to like this or just totally different communities that's a really good question um in the older neighborhoods when you go in and they're really beautiful they were built one builder at a time over years and so they sometimes you know built a house in different lots and planted a different lot but in today's world they typically plat and engineer and get approved at least one block face with the same lot sizes but given that there can be tremendous variety um on that but but but we don't believe in mixing the actual lot sizes on one street phase of a block does that answer question okay and one more if can we go back one slide so in this green space is 1.6 acres and just to clarify I think later on we're talking about how storm water Retention Ponds can also be in there and some of those Retention Ponds might require some kind of fencing would that still fulfill the requirement for green space in here okay so and I can and I can I can wait till later I got to start this way um you raised a whole lot of questions in one stance actually so this is really explaining that we could get park now it's just explaining that you know you could get a park and still meet the same density which is kind of interesting with totally different house types and small Lots so park put that idea aside the park could potentially handle storm order and to Katie's point if it does we want it as an amenity so it's very well landscaped and there's a walkway all the way around it we can come we can come back in and out on we love questions because it just helps round out the whole discussion thank you so um as Brian stated I my role here was really to take Brian's vision and put it into your code um and so one of the things that we had heard from you all when we met with you individually was a desire to increase the lot width requirement and so how we have we we're saying mandatory um what we've done is we've adjusted the lot types that would be allowed in Sr and we'll get to that in a second but um so for the general procedures for development approval this is your section 102-1 we've adjusted the number of lots within a subdivision that are exceptions to preapplication meeetings basically we want developers who are doing these types of projects to schedule a meeting with staff so that they can go over these new guidelines and and try and get a feel of whether or not they're going to conform and then um included a new provision to require Community meetings because this was also um an issue that was expressed to us for residential developments of six units or six Lots or more um so that will be um you know advertised to property owners in the surrounding area so that they can be a part of that discussion this is one of the things I'd like to see the language clarified from six to three instead of developments of six or more so possible to make that three because most of the areas that you're about to go through we talk about three lots are greater so I'd like to see Community meetings for three more not just six sure so and that was part of the the discussion we did initially start at 3 but we felt that three was just too small a number to really three three homes just doesn't have an impact on the neighborhood that six or more does and so there it was a conscious decision to go from three to six on this because again we the purpose of the community meeting is what impact are you having on your neighbors in the neighborhood and we felt that through and there are people um I I use Nester Diaz as an example uh he will do two three even four homes uh in um the neighborhood east of downtown um and that we just didn't see that as triggering a community meeting whereas six or more you're you're getting to the point where you are impacting the neighborhood so that that was the rationale be behind going with six here uh but initially we did we we we considered three and decided to uh go with six because of the dominous impact that three has okay so um getting back to what we were talking about with um widening the lot sizes within the Suburban residential future land use designation I'm sorry uh can you go back um you know we're we're talking about uh noticing and uh the meetings and all that uh that is going to be the developers responsibility correct I believe so as written so we currently we have a process where a developer uh the community meetings are not required uh for residential subdivisions I think there are some projects that do trigger a community meeting uh right now there is no standardized process for Community meetings in other words if a developer wants to hold a community meeting they can go and hold the community meeting they can determine the location they can determine the notification method they can determine how to get the word out about that community meeting we also have a process that the developer can pay a minimal fee which is actually too low and we need to consider raising that I believe the fee is $150 right now in that case for $150 we handle notifications and we will host physically host the meeting um for $150 for $150 we change that so we're changing that one so we can add that to our list of recommendations at the end of this document so um if the developer chooses to to pay that fee there is a process for Community meetings but again a developer can decide to go their own route and they can they can do whatever they want as part of organizing that community meeting now one thing that we may want to look at is if we are going to require these Community meetings maybe we need a more standardized process absolutely and that doesn't necessarily mean we have to do notifications but it might mean that developer here are the notification requirements now we did try doing that related to community mailing Pro mailings and in the end there were just too many questions about did the developer do it properly and we switched back to staff handling those notifications now in that process did we provide a checklist that had to be turned back into us we provided I think we provided like a sheet of paper saying here's the process for your not project notifications but again and they were supposed to submit to us the mailing list with all of the proof of mail mailings um but it it there were there were the problem is on the fly at a commission meeting it was difficult to pull up those list of mailers to see you know we had a member of the public say I didn't get a notification and then we on the fly at a commission meeting would try to pull up the developers mailing list and um there's just more certainty if the city is handling that but there is Staff time and cost involved in handling that but I think I think it is reasonable to say if we want to require Community meetings for everything more than five units that we should standardize the process in some way absolutely okay the question is does that mean the city's going to handle it or do we put the burden on the developer and then they have to show us proof that they did it properly that's just I'm in favor of a standardized system personally standardized system and a standardized fee for Community meetings for projects of a certain size I know you haven't gotten to section two yet but I think it speaks to what Tom was saying we have a list of requirements for these Community meetings and one of those requirements is Staff prepares a report and I don't think that we have in that list that staff is required to be at that meeting so I'd like to see that included in there too okay okay so moving on to the lot type so we we heard a lot from each of you Commissioners and the mayor about increasing the lot size in the SR area and I'm not sure what that sound is either it's actually kind of pleasant but the bells the Chimes is somebody's phone if somebody's phones ringing if you could check them please it sounds it's probably an alarm sounds like an alarm you again oh no he L all right so right now there are several different lot types that are allowed in the SR future land use district and it's all based on the different design districts that fall within that future land use designation so we've gone through and addressed the tables where each of these lot sizes are listed and that's um the urban performance standards the Suburban performance standards and the rural performance standards and basically removed those lot types from being allowed and required that all of them are 100t wide so your by right development is going to have 100 foot wide Lots now if you want to go through the waiver process which we hear is a fairly common process and that does end up coming back before City commission you can ask for a waiver to go to smaller lot sizes of all of the lot sizes that we've just mentioned and so that'll bring that project before the board in a waiver process to be able to access all of these different lot sizes within the mandatory guidelines now again that does not uh require them to do the architectural guidelines that are in the back but it holds them to the mandatory development standards that are in section one do we require any additional fees for waivers uh there is a fee is there no fee for waivers I know there's a fee for conditional uses that seems like an awful lot of Staff time once we get process you're doing you're lot sizes otherwise you carry them all the way to the develop process they come flat waivers well now they've gone through the entire design engineering exercise so I guess if they're going to come in with something like a variable lot size they come first with a concept to show you all and you we have to work some process out to make that thank you so you're not putting horse I think that would be appropriate and after the horse and I don't know if we had talked about this yes yet but you could also change the waiver process to not be associated with just a PSP you could associate it with some sort of concept plan application so we could talk about that if that's the direction that you want to go associate with a PSP um I believe right now it's associated with a PSP and so what I was saying is that you could assign it to an application that would come before that so that you're not waiting that long to see what is going to be the layout of the lots and the sizes and Brian can speak to you know when when is the appropriate time within that process because obviously you know you don't want to require that upon annexation they're not quite ready to have that information ready um so we can talk about what timeline Works um so here is the new single detached lot and this is a new lot type that we've created it and it'll basically replace the house or estate or Homestead lot size that was previously allowed in any of these Sr flu designation areas um and so you'd be required to have the minimum lot width of 100 and minim minimum lot depth of 100 as well um and then you can waiver from these to access the mandatory development standards um so this is a a new section of code section uh 115 3.4 and this is residential subdivision standards for all design districts within the SR future land use designation so this you know mandates the 100 foot wide lot but allows you to go through the waiver process and then IT addresses a couple of the different streets that you have in your Land Development code so it limits the types of streets that you could use within a one of these residential subdivisions two residential Road residential street or rear alley as we've amended them which you'll all show in our subsequent slides we've also written in that culde saacs are discouraged and if a residential street does not provide connectivity outside of direct access from the residences to the surrounding Street Network it should be a private Street and should be maintained by their HOA um and that's a pretty aggressive um stipulation so you know we're of course here to talk about that and if we need to remove that language we can but uh it is it is something to encourage a developer to have connections to the surrounding Street Network so that your only entrance and exit is so you're not limited to one entrance and exit AR you have something I do thank you um does does this um increase the street widths it will not increase the street widths it may increase it will increase the landscape strip that's required next to the street so not the pavement width so one of the one of the biggest feedbacks I get from the developments is on street parking we have made that an option for both the residential Road and residential street ranging from 8 to 10 ft wide unmarked okay but even that's that's an interesting question well can I finish um just the the thought so if you have cars parked on parked on both side of the street on street parking I mean it it is really hard to get garbage trucks or even buses or even a larger vehicle between between all those cars so I mean so I'm assuming we're still going to allow on street parking but how do we address that oh you have to have an add an on street parking Lane okay so you keep the two vehicular Lanes as vehicular Lanes do not allow on street parking unless dedicated on street parking Lane is provided okay yeah you know I I happen to live in Winter Park so it's I 20,000 people it's quite a big city very 140 years old um now the lots are fairly big in Winter Park but the streets are just average streets and people park anywhere on the street both sides so that works well when the lots are big now to your point or your developers point when the Lots get smaller and the density goes up it's a different ball game so there's a balancing shift somewhere between large Lots where you can just park on the regular Street and um when the density goes up do what Katie's suggesting which is is actually a yeah but most um I mean and I'm assuming you guys have toured the the city most of the newer developments they have really small garage parking pads and you can only get two cars there but most households have more than two cars nowadays and they're short the so they all Park on they all they all park on the street yeah yeah so I think I think we need to dive into that with some of your um engineering technical staff and Mike and come to an it's a good question okay thank you we also got some comments from staff related to open space and how some of the developments that are coming in have um open space that's not necessarily meaningful and and is counting like buffer areas or storm water ponds without creating any real passive or active Recreation spaces for these um Suburban residential areas and so we've required that there is a centrally located open space in multif family or mixed use developments um acceptable justifications include like sight constraints due to natural features um or for example if you have a cluster of protected Champion trees that you want to locate the open space around to save those trees you should be able to you know move it from a relatively central location and then here is where the storm water provision is and it and it can count towards open space but it must be amenitized um Incorporated like pedestrian Pathways or benches or other recreational features sometimes a fountain would also be a desired amenity and that helps drown out some of the noise of traffic nearby and also is just a pleasing sound to the community so this is going over the street type changes so so on street parking Lanes may be provided um within 8 to 10 ft um and the parking spaces would not be required to be marked or striped in any way um and then for the residential street standards we increase the planter widths from six to 8 feet to better support a large you know Live Oak Tree preferably um and one tree would be required to be planted every 40 ft Within These subdivision so that you end up with you know a sidewalk system that you know shade for us Florida folks um who otherwise probably would not walk in in the direct sunlight so this is just helping that heat island effect and over time as these trees mature and grow as Brian mentioned it really does help to kind of screen from view the front of these houses that we cannot regulate so in a live oak would be my preference as well but do we have a list of trees that are not acceptable canopy trees that are not acceptable so some trees are a little bit more susceptible to to weather damage like your Laurel Oaks and stuff which are big favor with developers not recommend those I I don't either yes but do we have some kind of a list that we could include Within These guidelines of trees that are susceptible to to WEA we don't currently but happy to provide that that'd be great sure I noticed the trees lining the streets in our development and um it's really prominent in Country Club where they are the sidewalks are all popping up up you know uneven a lot so what could we do to prevent that and that's mainly from the root system from the trees yeah so I'm I mean not familiar with your neighborhood but I did consult with our landscape architect in office and that's why we're requiring The increased width from 6 to 8 feet because 8 feet is really the recommended minimum for any type of these large trees root systems to grow and Thrive um over its maturity I think my arborist had mentioned something about there's some sort of plating that you can put in the ground between the dirt and the concrete areas we have root barriers there's something like that maybe we can take a look at including so we can certainly to protect all the they are expensive so the the if you're going to require them you're you're adding thousands of dollars per planted tree it's also really expensive to replace sidewalks every 20 years very true which is also part of the reason we've added that provision to connect to other streets or pay for your own private roadway um so if that is something that you would like us to add we can certainly do it and and maybe it's if for any reason it goes less than 8 ft that that would be a requirement right so I have some experience in writing Land Development code for the city of Orlando and for oo related to personal storage facilities and I brought some language to to share with you about that um Brian also has some unique experience with personal storage facilities so I was going to actually let him go first because his son works in the industry and provided um some numbers and data for the city of Eustace with regard to Self Storage thanks um yeah by happen stance my son is a national builder of Self Storage so the good news I got a lot of free information um so there's there's lots of different variations there's what we call the Mom and Pop which are some of the older ones sometimes they're not climate controlled sometimes they are one story and they have space for campers and uh cars and so forth and then there's the more Urban Storage which is you know can go to three stories and um doesn't have that and it's climate control so there's a big variation um this group that my son is a partner in they've built storage at Celebration looks really good obviously was expensive and they built storage up and down the coast to New York Pennsylvania Philadelphia all over the place and Orlando so I'm just throwing out some free data for you guys so they have formulas that very obviously but generally the formula is 10 Square ft per person to make storage work from a feasibility point of view it can go to to different numbers and um you know he pointed out in Atlanta for example it's much lower because they will have basement so they storing stuff in the basement but if but if it's high density a lot of Apartments the need goes up so you know all these things are inbalance if you will the projects they build just to give you scale are 1 and 1/2 to 2 Acres uh they're three stories mostly it's 100,000 Square ft the construction's $10 million and when they finished it's costed them 15 million so these are Big projects They Don't Really generate traffic though they have seven parking spaces so that's a good thing um it's kind of a retail use you know the way he described it to me is when we're looking at a project if we can send our wife or or our daughter down there at night we won't go there that's interesting um they they have a three mile radius of service and um okay then he did a little study on eustus and it turned out they're 19 apparently in the city right now who knew and there two one two new ones either have come or are coming I don't know he knew that somehow but his overall take is the mark Market in hust for storage is at is that at equilibrium it's not like you're dying for more storage I'm glad you said that because because I was thinking why are we even talking about this um I'm happy with everyone to take their storage to mount dor to be honest with you does does storage units do they do they bring anything to the city other than I should say can I raise my hand here um um I I actually provided you guys with a little analysis that we did several weeks ago you know we've we we seem to be bombarded with these these structures and I wanted you guys to know that right now uh just by our analysis we've got at least 90 structures in the city with four that that could come online anytime soon and we're talking about 631 th000 square feet of space today now when if we add the the two that are considering David Walker we're looking at that time there's one that's that's going to be two stories that's 100,000 square feet that comes online there will be 745,000 square feet in this community that equates to 30 square feet per individual per individual now if you look at at our our numbers for families the the the 2023 numbers um I'm thinking that it's like 2.3 house or 2.3 individuals per household that equates to 95 square feet per family in this community and and that's that's why I I wanted to have this discussion because we seem to be extremely inundated and we we do not want to become or or the question is do we want to become the storage facility of Central Florida I'm glad you brought this up Mike uh to me and you know we've all driven past what they're doing in Mount Dora and it gives the appearance of a transient Community to me uh and if we're looking to make this a community where people come with their families and they want to stay and they I don't want a storage unit two blocks from my from my house um again and people may not like it but I'm fine with them taking all the storage from Outdoors you know it's only a FIV minute drive also would that not be a lot of competition it's huge one in M door toar has a big one and then when ours end up being a lot of them empty because of the competition I I just don't see we need all that much storage Our concern is you know at what point do we reach saturation exactly I would say we I think we we already reached it I mean these are just our numbers I didn't look in other communities we know that there are are just as many in other communities I think just that we're just being besieged with these things because they're easy and cheap to build ex exactly you know I um you know what would our community look like if we have two or three of those things that Mount Dora has sitting empty or half full you know so then they get dilapidated and then have yeah yeah I'm I'm yeah well so I have prepared you know to talk about these two different Land Development code changes that we had made in in Orlando to make them look better but I mean you can just prohibit it as a use and it sounds like you have enough of them this is not a protected use by the state you could just say we're done we've discussed having an overlay for mixed use and I'm not sure where we're at with that process well that was certainly an option that that we' batted around but but we could easily go into the table of uses and make it a conditional use uh and basically everyone that comes to staff we bring it to you uh for for review yeah but but the real question is I I've noticed that the challenge particularly in in some of the previous discussions it's hard for us or hard for you to make a decision when you you you throw concerns out about traffic and and and you throw things out about the the visibility triangle and and they can quickly turn around the their their drawings to prove to you that there isn't a traffic issue issue and that the the visibility triangle is not a problem the the real question is is okay what do we if I guess with the previous project uh that is out uh at the public shopping center for me I thought the easiest route for you guys to to deny it was that it looked cheap it looked fo it looked false the faux Windows uh and and the metallic structures even though it was behind picketed or a an iron RW iron looking fence and and heavy landscaping it still didn't betray what should be on that out parcel at a public shopping center that basically has over 980,000 trips a year to that shopping center that is one of our biggest shopping centers and do we really want another storage facility that's a two-story across the street I don't know at the present time that we can prohibit that because they have already submitted their their their plans but it's just it's those sorts of things that alarm us at staff level and and trying to understand H how do we control it it seems like it's a uh a have we sorry Mike I didn't mean to cut you off um but I mean have have we looked at it from a different way and tried to understand why it's so attractive for storage unit companies to come here it's easy money well there got to be more than that I I I do think that that our the value is a lot cheaper here than it would be close to the Villages and if it's within 30 miles of of them to be able to to to store their stuff and come to then then you know this is a value to them well you know what I also I would like to have had you say what you said tonight earlier um it was would mean a lot to us when you have that let us know I you know and then we can make better decisions because I had no clue how many we had until we see this you know and it would help us if if you kind of get a little warning you guys may want to watch this because it's it's just like the auto part stores you know dollar stores just all of them coming in at one time and I think we could do this better but we need more information and that would have been a good one for us please I encourage you to do that you know one of the things that one of the reasons why we're having this this Workshop is because we want to be different uh and I don't think being the same and doing what everybody else is doing makes us different uh and I think we need to keep our focus on being different than everyone else around us um we have an opportunity to really stand out uh and I think that what what you all are putting together I think that gives us a chance to do that uh so I just hope we just keep our focus on what we want so yeah and I think to that um I'm showing you these examples not to say copy them but as examples of what other M municipalities are doing in response to this growing not very desirable use and so I think that there's levels here so you could flat out prohibited in your city you could require a distant separation between those uses like we do for like assisted living facilities or whatever um you could would make it a conditional use permit which I would highly recommend doing if you're going to continue to allow them's City Miami I think it's radius one exist and that's because they had an influx of them and if you drive down the highway in Miami they are everywhere um and and so that was their response is to create that distance separation so that's an option for you as well so city of Orlando did make it a conditional use permit in every single zoning District um outside storage is prohibited so this is only enclosed storage would be allowed if there's outdoor storage it needs to be in an industrial Zone um they also increased the minimum building site to 3 acres and that was to keep them from being in their core they wanted them to be pushed out to the more Suburban areas of the city requiring more land um there is an F requirement and that applies just to the ground floor because they require that you have a second use in that building so they'll require that your ground floor is actually a restaurant or retail and it's built as a multi-story building and that the upper floors are designed so that you don't know that it's storage there's actual Windows not faux windows that have transparency that meet the requirements of a normal building within that area and then um you can see basically like a hallway behind that behind that window and then there's the doors entering each one of those units um so in mixed use districts 10% of the ground floor and no less than 75% of the primary Street Frontage has to be functional space for an additional principal use and it has to be restaurant retail or personal service so it has to be it can't just be like a Lobby or or uh something that is not going to bring other users to the site and then in industrial districts at least one additional principal use may be required for properties if they're on a major Corridor if they're back in an industrial district they don't care as much um so that is what um Orlando has done and then as far as design requirements it's limited to 50 feet adjacent to single family I think that's a little bit less applicable here um building facades visible from the RightWay or lakes must have the appearance of of an office or retail building through the use of doors windows awnings and appropriate building elements exterior materials are regulated to stuck o brick stone or a combination of those so you don't end up with like a corrugated metal um buildings that can accommodate two or more stories must be designed to have the appearance of a multi-story building and um 15% transparency on each of those floors and then they have through this conditional use process they're actually able to condition the elevations that are provided as part of that application so you see them when it's going through that public hearing process so this is one that was recently constructed and this is one of the ones I think that one of the first ones going through this process and this is pretty close to the downtown um this is on Magnolia which runs adjacent to Orange which is the main road in in Orlando but you can see on the ground floor they have retail and then they have two floors of storage and you can only really tell by the sign that they have in the window that says that it's for storage here's another one and then the city of Ido did not go as far um but they did require a special exception it's their version of a conditional use permit um again building facades have to look like they are not a public storage facility and you have to provide elevations at at the time of your public hearing and and they actually regulate that the first floor has to be entirely a second use so not just a portion of it um and that is all I have for you perfect anybody got questions so just to rund down some of the comments that I heard back from you with regards to what we've written up and that we need to go back and address and that would be a list of suggested or required Street trees uh commissioner Cruz yes are you um suggesting that they're required or should they be a list of suggestions I think it should be a list of suggested trees and and I think the reason for that is because some trees are more susceptible to to storm damage okay over time and we're looking for trees that can last a long time yeah understood and one one thing I'd like to add related to that um we probably need to talk to our utility folks certain Street trees really get into the underground infrastructure and so we'll probably want to avoid trees that are going to really damage our underground infrastructure yeah and so but I I we I like the idea of Street trees uh and you know when they mature it really improves the neighborhood yeah and just to to that point Brian added something into the the the guidelines here and this is really to encourage a developer to bury those utilities within the first 12T of the actual property that it's serving um and we've labeled it as a utility easement now it's written into here that that is really informational and could be required by the city engineer but is not a a mandatory um development standard but by doing that and getting your city engineer on board with that you're keeping it out of the planting strip where these Street trees are supposed to be planted yeah and I just I I think when we rid the downtown we did Cathedral folks their root system goes straight down instead of spread so we haven't had trouble since we put those in downtown I'm a little concerned with the health of some of those as well because if you I I think we keep them all bound up all the time I think that's one of the health problems with them so yeah definitely be one of the ones you put on I've got one followup question how are these codes going to relate to lots already inside the city that are buildable so what this really applies to all of this what it really applies to is unplatted lots that are in Suburban residential fluture land use so um any of the lots that are already platted even if they're not built on if they're already platted they're pretty much locked in to the development standards that you have right now okay that's what I wanted but this should definitely apply to any new annexation areas the the huge piece that you have up in the the North Corner um as well as any other pieces that are not added yet okay thank you and then real quickly going back to Street trees we should not have problems with power lines because power lines in all new subdivisions are required to be underground so we should not have a problem with because clearly all around the city we have issues with trees getting into power lines that would not be the case with a new subdivisions and as long as that coordination happens with engineering you'll keep those buried in in the lot and not in the street tree park strip um in section 10221 2 and F we're talking about the wildlife studies so that's going to be I don't know if we've listed it on here oh yeah it might actually be in the beginning under the note sections 10221 might be close to it 10221 yeah 10221 so it should be the very first okay but I don't think it's in the it's in the note section it's in the actual bed right there so under under Section F number four it's all good we we are giving a grant to a dog Related Group and that is a dog's tail I was just very confused about the sound that I was hearing she's excited the dog's like yes let's talk about the environment yes please so you've got protective species survey to include direct single indirect uh but I would like to see the FWC part of that conversation if there's species specific for the street trees no this is no I think it's just general I mean that that is not part of their scope I think you just have yeah they're they're not suggesting any changes to any of this changes this is just the one that I gave you this earlier I think this I mean I'm happy to update it though that'd be great so it's Section 102 so one2 21 21 two 2 f f or and I did I talked to Mike Lane earlier about that today and there are other areas of the code that reference FWC so maybe we just have to coordinate language yeah specifically I think your question actually applies to if You' got your small book I can I can tell you what page to actually go to I don't got in my car okay well well it's 274 okay and and it it talks about the wildlife habitat it's actually it's section 10 21-26 it actually gets specific about the the different agencies right that down in that particular area there so the the area in the front is somewhat generic just for the guys or or the developers to know hey we expect to see these things but then in the in the back it gets more specific just to kind of explain to them that okay here's how we're going to review some of those analyses and reports that sort of thing and pardon me because I don't have that provision right in front of me but could you give me a little bit better summary of of what change you're looking for in that basically what it states is that we're requiring them to do site surveys for that are looking specifically for certain species okay and those are kind of protected species not necessarily just the endangered ones you know but they would be protected or other species of concerned to WC and that could be plant life or animal life certainly um and at that point if things are encountered at that point I would like to see FWC have a greater part of the conversation with the city when those things occur so if any of these pieces are required coordination with fdwc is required yep and I think so a development is required to do a survey if they identify a species they're required by state law to work with FWC I think what commissioner Cruz is saying she wants something in our code that clarifies they need to work with FWC okay certainly thank you Don yeah I have anything else um at like to make sure and you going down your list of yes and I just wanted some clarification on if we if you all were wanting to see root barriers and soil cells applied to all of them or just in the case that maybe they ask for a waiver for a lesser planter strip anything less than 8T would require that okay I think it's probably going to depend on the tree isn't it I I don't think imposing more costly things yeah that's going to be thousands of dollars yeah and imposing more costly things makes it worse I think it requires probably looking into a little further and seeing if a live oak how much of a root system a live oak would take and how much of a root system a canopy Oak would need some of the other ones we've got downtown yeah right so I did um consult with our landscape architect to get that 8 foot number for a live o so that that's what he's saying is the minimum that would support a mature Live Oak okay um so I'm sure there are trees that would do fine in seven and six and five feet but it's not going to be a lot so if they wanted to change it from 8 to six I think it's reasonable to require them to put in the curbing there because they could still put a live oak but you just have to prevent the root system from getting in The Hardscape and and to prevent the root system you'd have to come up with the the barrier correct M and that adds thousands and hundreds of thousands to a project and if they how many trees and how many homes trees and they I'd like them to leave it at 8ot if they left it at 8ot they wouldn't have to put in a barrier but if they want to shrink it down to 6 feet yeah if constraints I mean not every property is perfect right so somebody's going to come to you and say we have a slope that blah blah blah blah blah our our planting strip can only be six feet wide on the new project we would as your planners we would recommend letting you go for live to we wouldn't recommend that right and and but eight we work everywhere so are we saying that we might not even consider a waiver to go L you know if if we're looking to be different and we're looking to have the canopies the trees why do we go down yeah why why don't we just leave it at B yeah and they and they are going to select better and they have suggestions of better trees to plant and so I think all of that working together we should be okay it would it would what it it would take four feet down off of the the whole sidewalk street so no I'd say we just leave it at 8T I say we leave it at and if for any reason there is a development that comes before you with a waiver for that width you could add that as a condition of approval okay yeah I like that all right anything else on your list no besides the 102 D21 D2 I only have one more thing I just want to make sure because we kind of glossed over it when it comes to our um uh notification process I want to make sure we F tune how we do it whether we do it with them whether we do it with us whether we do it jointly I think we need to fine-tune How We Do It um I think that's very important I'm very I do have it on my list that we need to standardize that process if if we are going to do it inhouse we certainly need to review the fee um and we need to look at uh Staffing and and what they can handle definitely I will add that is a bit out of our scope so I think as written we would ask you guys to take it from sure yeah that makes sense anything else from the commission that's it that was very interesting thank you great start with yes thanks mayor and commissioner we really enjoy what we're doing with you and uh we salute you thank thank you so much Mike anything else from your side sir Tom anything from you yes um I mean the basic question is where do we go from here if you like what you're seeing we need to start codifying this and bring ordinances back to you um if that's again if you like what you see we need to start preparing ordinances that is um it is outside uh kimly horn scope to actually draft the order ordinances and so we our internal staff and Sasha will have to work on drafting the ordinances so yes let's move forward I really like it so okay um I want to point out to the commission also Tom had left us uh a letter from Mr keading make sure you look over that if you've got concerns about that letter please get with Tom and Mike and Sasha uh to answer any questions that you may have on that all right anything else from the commission where's the L no sir that
