anything about The Thrill Hill annexations nor will it be discussed at a joint meeting on the 24th as the county has canel that meeting and uh that's all I have thank you next we have approval of own behalf and on behalf of the Lake County County Conservation Council which was founded in 1987 to protect Lake County's natural resources and one of our major goals is protecting our rural protection areas from Urban spraw um I have given each of you a copy of the letter which I sent to you on June 13th setting forth 15 reasons why this commission should reject the proposed annexation uh of about 233 Acres uh for a develop ER to build 535 dwelling units it's near The Thrill Hill area so I refer to this land as The Thrill Hill properties shown on the map which is on the last page of your handout please note that most of the Thrill Hill properties are located within the Waka Okala rural protection area a couple of years ago you may recall the county hosted a meeting of all the Mayors in Lake County to discuss how we can Preserve of our Open Spaces then the county invited strong towns to conduct several workshops and their message was urban sprawl hurts cities financially trying to balance a city budget through high density development away from the city core is a Ponzi scheme then the county asked East Central Florida Regional planning Council in cooperation with Stetson University to do a conservation study and make recommendations their report was presented to the County Commissioners 2 months ago their report listed four conservation priorities for Lake County surface water aquafer recharge rare species habitat and Wildlife Corridor it also listed six conservation tools one tool is protecting our rural protection areas and the other tool is for the county to work with municipalities to protect our rural protection areas so lccc urges the city of Eustace to decline to enter into an interlocal service boundary agreement to Annex The Thrill Hill properties rather we hope the city of Eustace will do its part to protect our rural protection areas from Urban spraw which has tremendous economic and environmental cost thank you thank you J John the city would consider an ordinance to limit parking to customer parking only for restaurants and businesses um Mount door has I think a 2hour limit I don't know if it would work if we could do something like a 11 a.m. to 700 p.m. customer parking uh to help everybody currently I can only speak for the west side of Magnolia we have 18 spots in between five and seven are filled daily open to close with either a business owner an employee or a tenant of a unit so that's taking 30% of the parking away from potential customers so uh just asking the city to possibly come up with the city ordinance to help local businesses restaurants that are currently downtown thank you thank you sir uh I have a card uh for Mr Marcus Savage did you want to speak on the um The Grove at Pine Meadows negative things that's free publicity so count it all joy thank you thank you Pastor mayor I just got a card from Kathy Graham Miss Kathy thank you I'm speaking on the annexation of The Thrill Hill property my name is Kathy Graham I've owned a home in usess for 15 years my home is on 7 Acres with 240 ft on Lake Eustace I maintain a natural wooded environment on five of those acres and um for raccoons and all the critters possums and um rabbits and armadillos the occasional Fox birds and there owls Two Eagles have a nest that they return to each year and there's also reptiles on my property such as snakes lizards and turtles one of which is the endangered gopher tortoise the gopher tortoise is an endangered species which creates Burrows that can be 40t long and 10 ft deep they live in their burrows for up to 40% of their lives and sometimes don't come out for days these Burrows provide an ecosystem and protection for up to 300 other species species like the near-threatened Florida Mouse gopher frog pine snake and Eastern indigo snake are dependent on these burrows for survival so who cares if we cover these Burrows with concrete and trapped tortoises in their homes anyone the gopher tortoise is an endangered species in Florida and protected by state law and must be relocated before development or land clearing developers must relocate go for tortoises to licensed recipient sites the recipient site owner sets the cost of moving the tortoises some places are now now charging developers up to $6,000 per tortoise besides being against the law it is inhumane to bury this ecosystem under concrete this is just an example how development can diminish an ecosystem I hope our elected officials will listen to their constituents who are concerned about the environment and how habitat loss has a major effect on animals and their ability to survive thank you m thank you mayor I just received a card from Maria DOD Maria M good afternoon everyone um I'm sorry I am not good to speak English but um I um I came to complain about the water bills I moved to Florida um May last year and um I got this property on ending February and um it used to be a daycare I thought I can come and do business here but I couldn't so I told okay I'm going to do my family home anyway uh I I need um I need please to I need help because since I came the water bills are extremely high even though I didn't use and I moov in May here but they made me pay from January from last year even though if I got this home at this property in uh ending February and anyway I complained many times I don't know what happened but at the end I paid everything now I got bills late then I have to pay with um penalty now I got bills zero I consumed zero but they charged me almost $70 I call called and I said what what is going on now and they said no you have to pay because that's what we said and I said but my bill is zero I didn't consume any in is they are two units and the other unit I don't use for anything because it's close I'm fixing this property I don't use any but they charge me uh like I consume 4,000 gallons which can't be and the other one I didn't I didn't use anything was Zero but um they are charging me 67 I think close to $70 I don't think that's fair and all uh every month I um I complain about my bills and probably um I don't speak I I don't explain well um my situation but uh there is a lady that she got mad I think is the supervisor they get mad so I feel so tired in this situation and uh I don't know what to do but please if I can have help so um is the address you put on the card the address where the water service is located I'm sorry you put you put an address on here is that the address for the Water Service yes sir okay um if Holland hi madam attorney thank you Mr Mayor we first have resolution number 24-40 a resolution of the city Commission of the City of eustus Lake County Florida adopting a user fee for public electric vehicle charging stations within the city and providing for an effective date Tom would you like to speak on this item sure I can take that one um we for a while we had gotten direction from City commission to start uh start to Institute a user fee for electric vehicle charging stations uh to recoup our costs related to those stations um we now have new equipment um we have a new agreement um with that new equipment and in starting that new equipment it was time to uh Institute a user fee uh we have to come to you to add it to or add a new fee to our schedule of fees and that's why it's before you uh we're proposing $2.50 an hour um that would uh the way it's proposed is it would um you would get charged $2.50 per hour of charging once your vehicle is fully charged you get a 30 minute grace period at no charge to relocate the vehicle and then if you don't relocate the vehicle then you you start incurring the two $2.50 an hour after that uh the reason that we're proposing that is we want to encourage vehicles to uh cycle and to uh relocate once they're charged and so that's what we're proposing Tom how many stations are we going to have downtown uh we have three three uh how many do we have now two no we have the the three are we we I'm sorry go ahead they're they're usually four right and we're doing 250 an hour and $2 an hour and 250 they're late I think that's that's not enough it's no no it's it's 250 mhm at all times with the 30 minute grace period uh but if you're saying the 250 isn't enough the 250 isn't enough if they're elate that's my concern gotcha uh I don't think that's I mean we have uh businesses saying that parking is kind of you know at a premium down there so you're saying if they don't move it after the 30 minutes it should be more than $1 an hour that's an incentive that's an incentive that's an incentive 250 I'm like why not yeah if that is the will of the commission we we I don't know if can we approve that tonight Sasha or does it need to come back the uh title of the resolution is uh specific enough we can approve it with the modification to indicate that so would it be after 30 minutes or would you like to change the time frame for the 30 minutes are you okay with the free 30 minute grace period 30 minutes yeah what is 30 minutes I mean to move it so what it so if you're charging your vehicle you pay 250 an hour to charge your vehicle once you're fully charged you should get a notification saying you're fully charged we then give you 30 minutes to get there once you get the notification that you're fully charged the goal is to keep vehicles moving along that's right they don't necessarily sit in their car fact correct it may be I mean we have city employees who have electric vehicles they will plug it in uh and then once they get notification that it's charged they'll go relocate it right yeah yeah I think with you know with as many electric vehicles that we're starting to see now it just makes sense to be fair to everyone Gary um yeah I kind of agree with Willie I think 250 is a little low but I'm not sure what the uu right right amount is yeah my thing is if you if you're going to be late you're going to decide to just kind of you know I'm I'm plugged in and you know I'm going to walk around downtown for the next 5 hours that's going to be $50 it's going to be added to your walk we have some people that plug in and stay there all day ex yeah they do at this point we we will do whatever the will of the commission is well we need to turn it back to Sasha since um anything else you wanted to Eustace Florida approving a preliminary subdivision plot for the Grove at Pine Meadow subdivision a 60 lot single family residential subdivision on approximately 24.9 Acres of property located on the north side of Pine Meadows Golf Course Road South of the intersection of Orange Avenue and Beach Drive alternate key numbers 39- 7758 2831 1634 and 158 8243 Mr Richardson for the record Jeff Richardson deputy director for development services um again this is a request for a preliminary plat approval for The Grove at Pine Meadows uh the property owners are um Colin and Jessica cden and Shelton Savage as shown on the property appraiser for owners of record Chris germano with Jana engineering is the uh applicant for this project again it's an approval for a preliminary PL for a 60 lot single family residential subdivision on approximately 2496 Acres um the application was filed for the preliminary plat in November of 2023 um on June 4th the DRC found the application technically sufficient and has brought it forward to youall for your approval um here is the layout um again 60 Lots with the bulk of it uh being on the Upland side of the property uh the Wetland area is kind of on the south and the left side of the screen um that is being pretty much not touched at all saying pretty much is they're thinning some trees down to the line actually any trees that are on the property that are within that area are generally being left alone though um just so you can kind of see the typical lot layouts uh giving a typical 45 foot X 75t pad all of the lots are meet the minimum house size for the um for the district did you say beneath no they meet sorry I'll annunciate better now um again 24.9 6 Acres 20.8 Acres of that is Upland area uh house lot size at 55 by 120s 60 units comes out to approximately 2.88 dwelling units per acre they are providing 27 plus minus per open space um they have provided and set aside area for um meeting the minimum Park requirements uh landscape buffers will be both on um Pine Meadows and um orang jav uh actually fairly substantial buffers before you even uh get to the house Lots yeah actually let me back up and point to that so on the leftand or right hand side of the screen the two smaller rectangles are actually open track open space buffers that are on Orange Avenue uh with North being to your right right side of the screen and then on the South Side there's actually a fairly substantial because there is enough room to even put a lot there but that will be basically the right of way and open space tract you're saying landscape landscape slop space tract the two the first two yeah the first two on Orange um and the big long strip which is uh it actually has a name a road name on it but I don't think it's actually designated e either a county or a local road so it's a private road oh I'm sorry I know going to exit on the orang you'll get a chance in a little bit hold on one second for us those can be questions that the the applicant can also answer um just an over view aial of what is out there future land use back to that one sure the three is not included in there is that correct uh the three is actually the parcel to the South the number just for whatever reason shaded in pink is included okay so the one of is not shaded in right there is an out parcel there that is actually still unincorporated I believe um Beach land use uh rural residential uh Suburban residential and a rural neighbor Neighborhood Land or Design District uh this is the preliminary subdivision plan phase as we're kind of going through these are the basically the steps in platting and uh technically it meets all the requirements uh of the current Land Development regulations staff is recommending approval can you go back to the uh keep going keep going one right there y okay anything questions oh okay uh Orange Avenue is the entrance exit both uhuh Pine Meadows Golf Course and orange it goes all the way through for two um two exits okay so when when I went out there and I when I went out there and I drove Pine Metals we had one of our signs there correct yes okay and there was a sign on orange when so what we're looking at is all of these houses will exit or let's say half of pine Ms adding to the traffic uh potentially both ends um I believe they did give us a TIA I don't a traffic impact analysis I don't remember what the split is well if did they do a traffic now doesn't 73 trigger that or is it how I believe they did one mhm um I think they got an exemption if I remember incorrectly because they didn't m whatever thresholds to say yeah you've got some stuff to do but generally in those they also say that give kind of directional traffic so which end going out um I don't I I don't remember what that split was the applicant is here so they may be able to address that question for you okay the um the roads are going to have to handle all of this traffic so we checked into that correct yes okay um constructions going to have to go up and down the road we checked in there y um 535 houses being built sou South correct east and south yes I say east and south um what's the lock size of these houses I mean the the the home sizes do we know uh we do not have that information staff did not have that information okay sewer safety do we know actually I do not know right off the top of my head developers here no public works this year okay um I take it that uh the owners and the developers had meetings with the neighbors GOA that I am not aware of hold on hold on everybody hold on hold on we'll get to you okay we we did not hold an official community meeting if the developer did something outside of that staff is not aware of it we have a developer that wants to go in and up in the lives of everyone that's been there for years and they don't have the decency to go and have a meeting with the neighbors no F fol please I have a problem with that one of the things that we as Commissioners say when these projects come before us is be good neighbors this is not being a good neighbor this room isn't filled with that with people that want to talk about uh uh electric Chargers downtown these are people that uh this is going to affect their lives um I'll I'll talk to the developer once they get out anything further from the commissioner for I have something to say I drove out there and I even took pictures of it and I don't see how it's possible to get that many houses on that little stretch of land and it seems like it's overcrowded I it's almost um I guess someone is more thinking about what they want to do not what affects the environment or the people around there that's just too many is on that low stretch of property and I believe believe prior to that when it was um um looked at it it was what seven or was more fewer homes there than than what they're proposing now this just seems something that someone's doing to make the most out of what they can get out of it I I don't see how that can possibly be in that little stretch of land you know and I agree with the vice may you know with me it looks like you know you have orange Avenue that's being affected not their large Street either the exactly and the residents on on Pine Meadows being affected we have two established neighborhoods that are being affected and I don't think that anyone is taking their neighbors into consideration um Jeff when when was this property annexed I'm not sure on the date I think it was probably either just before or about the time as Mr Zari so 2 20 2020 maybe okay and and it was annexed for the purposes of do we know don't know would the commission like to hear from the developer or developers represent all right I'm going to give you has an opportunity to speak first to address the commission we'll hear from the public and I'll give you an opportunity to come back up again so if we could have a representative for the developer and Folks by by the developer or somebody's coming up do me a favor this is an old theater this room is everything you do is Amplified when it comes up any talking you're doing or applauding we can't hear anybody else so it I will promise you I'll give you your time to speak just kind of hold it until they're done okay recording fix it yeah and we are recording everything and it's going out live feed it as well so it affects everything that we do so help us hear everybody and then we can make a great decision for you folks please come up and state your name for the record good evening my name is Christopher germon I'm the engineer record with germon engineering and Associates so I want to answer any technical questions that may be had but um a few things I want to point out which Jeff mentioned that the the open space we exceeded the density we are below the maximum density the park space we provided is in excess the land use and Zoning designation supports the what we're doing here and staff has recommended approval we didn't want to go through any variances or waivers so if there's anything technically I can answer to you know with some of the questions I'd be happy to walk through that with you well unfortunately I have questions other than technical questions so I don't know if you can answer or the the owner okay I could I could try if You' like but be the the traffic can you explain the uh the traffic for I'm the traffic report so I'm not the traffic engineer but I know that a traffic traffic memorandum was submitted that I believe has identified that it was di Minimus so that Traffic Engineers submitted that as part of the review process which which is should be part of the package I believe okay um are you going to be running uh you have swamp out there correct there there Wetlands yes adjacent to us yes Wetland swamp I'm from North Carolina swamp sewer what's the sewer so we're going to have Municipal sewer we're not going to have septic are you running it through the uh the wetlands no okay where you running it we're running it to Orange Avenue and then we're running it along Orange Avenue to a gravity manhole so we're going to have an on-site lift station and that lift station would go to Orange Avenue and then East with a force m uh how many acres is that 24 right yes 24.9 okay do you have any ideas the size of the homes I don't think I don't think a builder has been selected yet at this point so the time terms of the homes that has not been determined yet do you have any idea what size the homes are surrounding it I do yes okay same above below I would say they vary but yeah you have some that are smaller and some that are bigger there's yes okay have we talked to the neighbors no the neighbors have not been reached out to as part of the application process we okay we have not when did you decide you wanted to start working on this project how long have you been working on this project for a few months for a few months I think November was when Jeff said said that uh it was sent to the city that's correct yes so you had 8 months to talk to the neighbors not you specifically but someone on this project sure and to get by in from the neighbors and that wasn't done correct it was not done okay anything are you all concerned about what the neighbors think and how the neighbors feel of course yes yes and and and I'd like to take some notes when they when they come up and and voice their concern and we'd like to take that in consideration and see what we can do to be a good neighbor on that okay it would be a lot easier for us if those meetings were had before this got to us U because I think there's some concern out there okay sure this is a big project this is a big project for what I consider to be a small area uh I think again it upends the lives of people on Orange and the people on uh Pine mels because of traffic and I and I just want to point out that the land use does allow for this and I understand it is a big project and but the the designation actually allows for this type of development so that is is part of the same and I need to point out that just because the land use allows it doesn't mean I have to like it sure I understood I just want to at least point that out we're not asking anything above and beyond the code you know we um we go we go through something like this every development yeah and if we want them to do this then we need to change our code and make make it a requirement I mean we we go through this every site appr what we do there's things that we like but there's nothing in the code saying they have to do it so I agree he should have he should they should have had a meeting but there's nothing in our code saying they have to same thing right so we we should be addressing that while we're going through these developments I agree that's that's that's not me you know I'm not uh here to represent him I'm here to repres I'm not either and those are questions I think that need to be asked I I agree I would like to know in your experience um what size house do you think would fit on this little lot have any information I I really can't speculate I mean we have because almost estimate well a home builder hasn't been decided so they have different products but when you have a certain siiz lot and it has setbacks on the side the rear and the front that we can kind of approximate but each like I said each Builder has their own so I'm sorry I can't give you a direct answer on that because I honestly don't know at this point I just know the size of the lot and that you know home product would have to meet the setbacks that are that are part of the lot which is also part of Land Development code so what made you decide that this is the number that would fit on to that you would want to apply to that I do I do think that you probably could estimate it would be a 1500t house or 2,000 or what can approximate sure think you can do that but my question is what made you decide to put this many homes on that lot what your purpose for doing that I I think it's a little bit of the market just the developers here and just some other projects the the market is going towards this size of of lots and units and that's that's where the current demand is and the trend so that's that's basically what uh a home builder would want to actually purchase so that I think that's what migrated towards that versus 7 5 foot Lots you know 80 foot Lots I think the the smaller lot which is within the what was allowed here by the code I think that is where the trend is uh in the current market that you're seeing some other subdivisions that had come in as well that kind of have these size Lots well I hope that you build a good product because I've seen these kind of crowded communities and then very inexpensive materials used and then before you know it you've got this wicked looking subdivision so I hope you put some thought into to that sure and uh I do agree with you about the code that we are going to have to make some changes um so we don't have to face this anymore and we can fix it and we want good quality we want something that's going to enhance our communities and and how it looks and not cookie cutter kind of things so that's my little thank you man any other representative for the developer wanting to address the commission right now please my name is Nick Burton with the epic development group I work with the developer and help him put this community together um Emily vice mayor with regards to your questions there's been an approximation homes probably 18100 to 2100 Square F feet uh probably a nicer higher end product actually is what they're putting in there so you're going to see well like he said the Builder hasn't been chosen but that's what been been estimated and the type of product that will go there can we go online and see their high-end product well like I said the Builder hasn't been chosen but as a developer they're choosing a builder to match that criteria because that's how you actually maximize the value of land the more of the expense of the home actually the more you can get for the land it's actually economics on that too okay uh if you put less homes on there could you build bigger homes and get just as much money that's not my expertise but I know right now they originally came in in November with more Lots they actually through staff and the staff was diligent and working on the project they made them uh increase the lot size they used to be smaller well and being in line with being the good neighbor maybe you guys could re look at this and kind of compare and see if you could make fewer homes there or do something different that is is so crowded and so overloaded with vehicles and disturbing your neighbor so think I know with what regards to the traffic study after doing that analysis looking at schools some of those things and actually trying they've already taken that analysis and looked I think there was 79 LS actually plan for this at one time and then working with staff going over capacity issues sewer water traffic coming to find out 60 was kind of almost like their minimum number to really get this thing going from what I understand they did do traffic study they did do full traffic study they did just so you know too that they did an environmental study too Chief just wanted to lay that too they did an environmental study that that little Wetland area you call Wetland it's actually a lake I think it's called lake so it's actually a nice it's going to be more of an amenity out there I think there's like a 30 foot 25 30 foot buffer all the way around it there going to be a little park on the lake um multiple Parks throughout the community playgrounds Lots I don't know if we had the map I could probably Point some of it out to you but can you put the the land M back up please go to the more of the um the natural one it's a little bit further in there you go that helps I don't know if you could zoom in a little bit on that possibly it might be easier on the site plan too for me to kind of point out where that Lake see that's actually a lake if you kind of the dark area yeah that dark area that Circle right there that's actually a lake they call Lake Catherine you'd be surprised if you actually go on site it's actually a nice little nice little light there they're going to be saving all the trees all around I mean by any standard you can't touch those trees there's going to be a buffer can't touch any of those trees around the lake have we addressed any run off possible run off uh are we far enough away Well yeah if you want that's more of a technical question yes so we actually have submitted to the St John's River Water Management District and filed for a permit we we do have a storm water management um on site and we will meet the criteria of not adversely impacting adjacent properties and also providing the water quality requirements of the district can you zoom out just a little bit just a little bit more well not that much come just a little bit if you can okay look at that neighborhood uh look at the streets around it look at the property next to it now imagine 60 rooftops there I'm done well not only that the street is very is you know can can I just say something yeah this we should have had all these concerns during annexation I wasn't on yeah none of us I I know I'm just saying if so this is this is a problem that we've now have have to but that's one of the challenges we've asked about the whole time we inex property and we have no clue of what people are looking at when we when they're bringing it into City and that's one of the changes that we need to take a look at as a commission that's always my question is what's going in yeah because anybody that's buying it knows what they're going to put we're not we're not privileged to at the time but even though it's Annex and it has land use designation and Zoning designation that kind of speaks of what the property can be so the answer is there of what is currently designated now even though so let's say if you have a property that's Zone C1 commercial you can do X Y and Z on a commercial property C1 so that's kind of I agree with what you're saying my point is that previous Commissioners have now handtied us because of an annexation that I don't want to speak for everybody that we probably would not have approved oh you you you spoke for me well I'm sorry let's go all right let's open it up to yeah let's if you could take notes as to what their questions are so you can address them thank you who's next on uh Eric gisler did I get that right yes Council um I moved up here a couple years ago from Palm Beach County to get away from the rampant population explosion and a couple months after I moved here I found out about the 600 houses you're putting right out in my house um I picked my neighborhood and Don a Vista there I looked all around and and through the cities here and I picked that place because of the lack of good roads the not zero lot lines because of the the lack of planned communities and the density you're talking about here so I was you know but love having seing this this this development will completely disrupt that neighborhood it's it's not used for that you mentioned the um the density in the surrounding neighborhoods it's absolutely not made for that and on the orange side those roads are tight they're not just roads they're very tight and I don't want them improve I want them tight I want it dark I want it tight I don't want these neighborhoods here at all if you could please reject that proposal because they're not taken into consideration even on the Pine Meadow side it's the same the lot the lot sizes everybody that that lives there wants what's there they don't they don't want this kind of City plopped and shoor right in the middle of our neighborhood thank you uh Rita Mada hello I'm R manada um I live on Myrtle Drive off of orange if you able to see it in the red it's that skinny strip and that's a private road and we have and I have two other neighbors and you know we're over there cuz we're more private and that's going to disrupt our privacy and that's a private road um years ago when I went to build my house over there I try to get city of Eustace to fix it because it's a dirt road it's a dead end and they want to do it because they said it's a private road so that's our private road and if they want to make that an entrance and an exit that road is not big big enough for that it's not made for that and on the other side of my road there's gas lines and stuff so that that's really going to I don't know how that would even be possible for them to make that entrance in an exit um and then there's the wildlife not only that we do have Wildlife you're going to tear more trees down and they don't have anywhere to go and people want to complain about that they're they're going to be coming out more and people are going to see them out more you know um I think that's all I have to say is that that's not a good the roads yeah yes we don't need another 240 cars and that's a minimum 60 houses two people in and out two times a day minimum of 240 cars on that road at least once a day I stop for the San Hill cranes that are crossing the roads there's turkeys out there yeah you've seen them out there matter of fact we feed the baby you know they come out of the house but that's another story but uh we just simply cannot I don't believe handle that traffic and you good thing about the the dump trucks and all that how's that equipment going to come in there and us get back and forth I just don't understand how we're going to do this and I I asked for information when I saw the sign and did you did you see the sign your your that you gave it's tucked up against the fence under the weeds had I not actually seen it I would not have saw it I would not have known this was going to happen and I I reached out to the planning department and I was told if I live within 500 ft where it was going to happen I would have receiv received something I don't live front within 500 feet but I live at the corner down there there was no we we never knew anything about this we were not talked about thank you thank you Brenda Rogers drive down a bunch of not I'm all over the place but I've lived in there for 25 years um I was at the same meeting five six seven eight years ago when that property was trying to be annexed into the City and it was agreed upon that they were going to have ranchets the smallest being one acre I don't remember the largest and I don't remember the total number but it was only like 15 it wasn't a lot of ranchetts I don't know what happened between then and today but um somebody mentioned the Pine Meadows exit that doesn't exist right now so the only way in and out is down orange AB um we were told at that meeting that any variances or that particular variance people could not come in and rezone any of this it was locked in to ranchets I think this is the second time I've been here talking about this same particular property trying to get rezoned for something else um M Graham I think she left already she talked about the wildlife it's all over there we have Gophers we have the sandill cranes we have skinks we have Birds we have them all now as what I know there's four people that bought in there two built according to the specs by the city and nobody else is built in there um I believe the people that do own it I could be speaking return but they both have been trying to sell their property this entire time um the engineer he couldn't answer a lot of questions so really in my opinion this needs to be kicked to the curve Judy Eisner you can come up you can come up together you still get the three minutes hi my name is Judy Eisner I live on orange a I've been there for 20 years I live directly across the street from this property and the last thing I want to see is all these homes built the sign that was put up for this hearing tonight was tucked into Pomo leaves you could barely see it had I not lived across the street I probably would have driven by it a hundred times and not even seen it the fact that there's 60 homes that's going to be 120 cars and I know the gentleman just brought that up but because of that there's no way that road is I know a couple of you guys have gone down on that road there's no way that Road's going to handle that traffic it's ridiculous it's just not going to happen um the they've already the city of Eustace has already come in and dug some of that road up and repaved it the center of the road is starting to crumble um and then you've got dump trucks coming in it's not just affecting my neighborhood it's also affecting Pine Meadows and it's also affecting me Henley because there's a little road where the the um the animal place is and that's affecting that road because there's going to be an exit there also so please please please reject this can I ask you if you received a letter from the city about this I did I have it here F I just wanted to know I did I absolutely did thank you so much all right thank you yes ma'am Chris Herod oh I live on the corner of orange and Wy right at the front of the subdivision and I've uh was a foreman for your uh wastewater treatment expansion plant in usedas when they try to tear up Orange Avenue that's the only access for Three Lakes Community residents you can't put underground sewer down that road unless you're going air left all of us out of the community there is no other way in or out they've also redone the highway on 19 so it's now a uturn road so to take the traffic out of Orange Avenue and wait for a U-turn with four lanes of traffic is going to be impossible uh we also have the wildlife we have Bobcats we have Bears we have all the animals that live in our community in 2006 they did a study to to Zone 74 acres for this type of Housing Development this Lake County refused it they said that we were lowland we had in uh gopher turtle infrastructure built there they refused it and the the investment company had to let the property go back to the bank okay so to allow these homes is going to open up lawsuit from that investment company because now you're going to allow somebody else to do what they wanted to do and they lost their property you also had uh stand dollar Investment Company come in reone all of it to get it into bigger lots for ranchetts to keep from having the impact like what this is going to cause on our community so these have already been rezoned twice so to rezone them again to suit somebody else is going to be impossible and again once you tear up Orange Avenue we've got no way to come and go from our homes so I mean it's not just uh how many cars go down the road in order to put underground sewer lines in that road you have to shut that road down to do it and you won't be able to do that thank you Amanda Hall minutes I'm sorry I saw you sneak back to the seat back there so I um am the administrator of the Three Lakes Facebook page um I have been in Three Lakes for seven years I spoke with you in regards to the 549 homes because we talked about the wildlife we talked about how we don't want congestion so at that meeting we talked about 70 extra cars we talk have we discussed the new sub that you guys were talking about over by the damn smoker the little barbecue place right there at 19a it's too much and then these guys want to come in this guy he can't answer any questions do you live here no no no no no just us R what I'm saying where do they live they don't live here these guys this development Florida is coming into the biggest Lake county is the biggest growing County we have I'm born and raised here remember blackford's IG and taries I told you about this this is my County I moved from taries to get away from deud River Road what is deud River Road in tarus we all know how congested this county is getting you're a cop you drive these roads my game is water you'll be a third world country without Plumbing that's protecting the health of the nation right now I can tell you about the water their septic the space they're going to have the zoning the EPA regulations for how close they're going to have to get to water there's no more space for it this is Lake County this is the most lakes in one County down here I studied this I didn't move to Texas I didn't move to North Carolina I didn't move to South Carolina I wanted to slow down so I came down here for that reason I want a small town Vibe this is this isn't oh it's a beautiful Lake we're going to make it beautiful it is beautiful and I know the people on it I know my neighbors they're here with me I know the other one he's in the middle of the Atlantic right now on a boat wishing he could be here Dale he's a big biller beautiful houses on there and the wildlife I I make a joke it's Jurassic Park my backyard I mean did she just show you the pictures do you see what's on our backyard the Bears are gone we don't see them anymore you started that on the one side the Gators are gone the the wildlife's gone my 30 turkeys are gone the the the turtles the 35 turtles in my backyard are gone it's it's not the same and you're just you're devel this develop develop develop I can help you guys with how to stop if you want interpretation of the code I'll work with you I mean there's things that just get pushed through but this is ridiculous I mean since I've moved here I've gotten three four letters we're putting a monopine tower 500 feet from your house we're putting 700 Christine Cruz hi Christine good evening Christine Cruz 8813 East lemon mayor Madame vice mayor Commissioners thanks for listening hopefully I'll be super quick I've got two technical questions about the traffic study the first one is there's a a 70120 split leaving this neighborhood and all of them go to the exact same road I do not see any emergency Provisions if anything happened 219 where anybody in this neighborhood or the existing neighborhoods what happens in any kind of an emergency there is no Provisions for that the roads that are currently there are too small to handle that amount of traffic in the event of any emergency or emergency vehicles trying to get into that neighborhood they cannot handle that secondary part of the traffic study I'd like to question to y'all of course is hold on just a second so as we're looking at this traffic study that they had submitted it is the after effect of the neighborhood I don't see a traffic study about the construction itself so I might have missed that missed that somewhere in the packet but the construction itself almost closes down the existing neighborhood and I think some of the people have already address some of that with you and that's a big concern and that's a big giant hole in this packet that was submitted that I would like the commission to consider asking them to go back and relook at some of these drawings and see what these actual impacts are for this neighborhood thank you for your time that is it for cards okay is there anyone else in the audience that hasn't spoken that would like to speak to try and answer these questions here first of all I just want to mention actually a comment was made about us being here I've been in Lake County since 1997 so I get what's going on here I am an engineer I I do most of my work in Lake County so I understand the the constraints that the county is dealing with in many fronts um runoff was mentioned we are going to have a storm water Pond the runoff will go to the storm water Pond be treated and then discharge not exceeding the predevelopment runoff so this will be permitted through St John's where the runoff will be handled appropriately including any water quality issues sewer on Orange Avenue was discussed and also I guess um the the gentleman the plumber that mentioned about septic we're we're not doing septic I think I think one of the stop sir we can't have you talking about that yeah and I I can help out yeah so I think the question was that um one of the Commissioners mentioned septic as a question I came and clarified Municipal sewer with lift station so that's the pump station that actually pump it as a force Main and as I as I continue about the sewer on Orange Avenue so all the work will be done within the rideway there's grass area in the RightWay and there's pavement area in the RightWay so we're going to be in that grass area we're either going to dig it in or we're going to do directional boards where we can't actually you know let's say we're going underneath driveways we have directional board so that is going to keep things in operation along Orange Avenue we just don't have a choice because the sewer is not nearby and we're going a long distance to provide M Municipal sewer versus doing septic so this is a choice that developers made and the cost that goes along with it to go all the way to the manhole on Orange Avenue um Wildlife is mentioned an environmental assessment report was done and there are um some some Wildlife uh go for tortoises those will be relocated through the FWC process properly uh and go through the permitting process through the state I cannot really talk about traffic other than what the traffic report States um so you know if there's any traffic questions that you know we need a traffic engineer to attend but right right now the traffic report you know stating you know 47 Peak a trips and 61 Peak PM trips so so um so those those were some of the questions that I wrote down and if there's anything else I can assist with I'm good anything further from the commission all right then we'll go back to you Mr Mayor commissioners before us we have resolution 24- 57 what's the will of our commission anybody want to make a motion to discuss to discuss uh yeah if you make a motion we can discuss it and then vote we can vote up or down uh I make a motion okay anybody want to second that motion I'll I'll second it for the sake of um for going ahead and have a discussion okay so I'm sorry was there a motion um I'm I think what we're going to do is have a have a conversation our yeah I wanted to First in a second so um I will tell you my main concern is is the condition of Roads lived here all my life Orange has been a problem for many many years um and coming in and out of that neighborhood at Three Lakes is going to be horrible um we also need to make a look take a look at what we're doing to the south of that neighborhood as well I mean we agreed on the one development that we've already given approvals on um we are overloading 19 and it is and the work that the state just did on 19 did nobody any favors the way they constructed pleas don't um just my opinion we're goingon to have to be very careful with what we do I told I asked this commission two months ago that we asked you to really consider hitting the breaks on some of what we were doing planning moving forward until we get our hands and heads wrapped around a new comp plan Grand use regulations and things like that that's my concerns as we move forward um we sat through a utilities workshop on on Monday night um and that's still a concern of mine uh we're losing $800,000 on one plant it's to the east of us I don't want to overload the plants that we have to right right now so that's just my thinking that that I'm that's going through my head anybody else want to speak you're welcome to yes when I draw through there you have no choice I I I was kind of confused about where it was and all of that and so you go down this down any road and you end up back on orange avenet so you are going to only have one exit then you get to the end of it and you have to turn right to be able to get to the uh a a part of the curve where you could do a u-turn and in traffic I had to wait for the traffic to go by I find that street to be in poor District pair um I'm thinking about what if when they're doing this if there's an emergency and an ambulance comes through you know how's that going to what's going to happen there so um and I looked at the size of it and it's it's probably very beautiful with the lake and all but I have some real concerns about the uh amount of housing um that's going to be placed there the roads and condition of that road and that they only have one way out and one way in and that's very difficult when you have things going on that prevent you from getting in or out in an emergency or even on a daily basis just to leave in the morning and come back in the evening okay you know I uh you know I I agree with what you both said U the the the roads terrible um uh Pine Metals a little bit better uh because initially that's the road I went down trying to to find it um Christine brought up a good point you know what if something happens and they have to get down can the roads handle it construction if they start to build you know they can say that it's not going to be bad but me going down the road by myself I agree you know the roads were bad and and it's tight um I I just think that it affects Orange Avenue and time and and 19 well I uh I think we got to put a hold on annexations until we get some of these things figured figured out I I mean really I don't think any of us would approv this annexation when it first came came to us so I know I wouldn't have absolutely well you heard the lady speak earlier about what was sold to us at that time I know was the ranchetts and that's a little bit more it's a little bit more plausible for for 14 or 15 ramp style homes out there than 60 homes right so I I think that was one of the things that was told to us when the an I'd have to go back and pull minutes from that meeting to be able to remember because unfortunately so many things come through here but um you know so um anybody have anything else really can Mr Mayor can we do that well um we're all familiar with our the policy as far as a vote so um we can consider if the commission would like tbling this item to give the applicant opportunity to revisit this or not but I just wanted to point that out because it'll be a 9month delay for them to come back and if I can comment on that if that's okay um already closed thank you I'm ready to vote to V okay yes you ready to vote we'll have the next item on the agenda resolution number 24-58 a resolution of the City Commission of the city of usus Florida approving a preliminary site plan approval with waivers for a 2904 ft restaurant with drive-thru on approximately 2.14 Acres south of US 441 between Kurt Street and Dillard Road alternate key numbers 1 163 2501 377 7837 38670 and 38677 Mr Richardson we have a request for for site plan approval for a Zach restaurant along 441 um the applicant is Charles Hyatt be on behalf to half engineering uh the property owners are MGA used this property uh LLC um the waivers that are being requested are a setback greater than the maximum of 75 feet from US 441 um they are requesting a setback of greater than 75 but no more than 90 um a waiver from the minimum building Frontage build out requirement um it is less than 50% they are requesting approximately 32% it may actually be a little bit more than that because we don't have a definitive on the building width and they have some other perces that are going on that could make the building be a little bit bigger so but it's still below the 50% um allow for the use of faux Windows along 441 to meet the 40% fenestration requirements window fenestration requirements um and to allow drive-thru Lanes in front of the building uh versus to the side or to the rear um these are the properties in question on 441 so this is in between uh the Golden Corral and not sure what the building is now I think it's vacant right now I think it used to be a credit union it still is it still is okay um the future land use is General commercial it is in the Suburban Corridor um here is the site plan um as you can see uh I believe that's the joint access that would be to the credit union and onto this property um that is in the on your left on in the upper corner of the site plan uh here is a copy of the landscape plan a little bit about layout on what the site is going to look like too uh that is the southern portions of the property there is the big retention pond on one property and then the other property will be the through with drive and then an out parcel proposed elevations um has actually taken some work with the applicant and they have worked with us very well um this the on the upper is actually the side that will be facing 441 um so the two faux shutters U appearing uh windows in the back those and I think even the third window will kind of be beh behind the order boards so you really won't see them anyway but it does give a nice appearance to what is presenting to 441 uh just below that on the left is the the actual front elevation which will actually be fronted fronting to the internal through road that will go between DAV and 441 and then obviously on the bottom is the um is the drive-through side or the the back side of the property um the applicant did provide us with an elevation of potentially what it would look like with the Landscaping in and what you would see from 441 um this is their exhibit so we did have a little bit of discussion about relocating that Magnolia so you can really kind of see the zby sign a little bit better um from 441 once it's actually in there and mature um so with the waivers uh building setback they are at uh just about 90 feet so we got an 897 and a 90 that allows them to provide the U diagonal parking one through Lane of TR for traffic and the two drive-thru stacking Lanes um as you can see on the on the site plan itself um so that is what the applicant's request is um the property is approximately 230 ft wide the building is at about 73 to 75 feet so that comes right out at about that 32% um it is a large it is an existing parcel and there really isn't a lot of options to make that parcel parcel smaller and based on the model that zby has or the whatever prototype I guess is what they call them um they don't really have a bigger building to put on there without building a bigger restaurant which I don't think the applicant wants to do can you go back J sure sorry entrance from the back is looking at this the let me go back actually to the site plan then so you can maybe see a little bit see better so the entrance is actually The Joint one that is now there you kind of pull off 441 and that splits to the um to the credit union or whatever the office building is there and then there's kind of a a cut that comes through that will come onto this prop okay all right okay yeah okay and then it would circulate through so this is the north side and this being the south side with the road going down through through just adjacent to the to the storm water pond that's back there um and again the faux Windows the the area with the just past the entrance so to the to the right of the entrance I'm kind of looking at it hopefully I'm looking at it the same way you're looking at your screen so to the right of the entrance that's basically like the bathroom areas the counter area areas so using true Windows doesn't really function well for the for the floor PL layout um the the faux windows and the shuttered windows are what the applicant is proposing to try to meet those requirements um the two red ovals are the location of the drive-through board so kind of showing that you got your two lanes traffic with the drive-through boards up front there but again there is that that landscape buffer on 441 with the trees as well as the shrubs and it does sit down a little bit lower as well so um there will be screening provided uh legal line ad was run on June 8th um mailings went out on June 8th and the notices were posted on June 8th June 9th I think I W up doing them Tuesday Morning versus Monday morning Jeff when when they exit after they go through the drivethru will they exit to the east hop back to this plan so you can see yeah so they would drive in it's one way through so they're pulling in either driving straight through and into a customer parking space or into the drive-thru Lanes around the building and they can either go out to Dora Avenue go down and actually hit the light or go back out and take a light right to the light there yeah all right it makes sense okay you know I thought as I was putting this together I would do the same type of thing that I did with the tommies and actually put the arrows but I'm like well the site plants have the arrows but I oh I'll remember that I'm with you when you're right I know um the waivers that are being requested are they the applicant was trying to meet the intent at least in the opinion of Staff all of the other requirements for the site plan and for the development of the site have were met per the code um staff is recommending approval any questions from the commission for Jeff would anyone in the city Commission of the city of eustus Florida approving a final Subdivision plat for Phase 1 18 of Pine Meadows Reserve subdivision for 209 Lots on approximately 24043 Acres of property located on the north and south side of Pine Meadows Golf Course road with Frontage on County Road 44 alternate key numbers 106 1725 171 18881 383 9388 383 9391 383 9392 1 121 3916 1 121 396 3901 1694 and 14841 Mr Richardson Jeff they're making you do all the work tonight what's up Mike's over there this is why I'm tired uh this is the request for approval of the final plaid and acceptance of the performance bond for Pine Meadows Reserve phase 1A um TLC Pine Meadows LLC is the owner uh this is for the first 209 lots of the 548 unit residential subdivision on 24 1.41 Acres um little bit of background uh the original Community meetings began back in 2021 um PUD was approved in March of 22 um the original um preliminary plat was reviewed in April of 22 um was approved under resolution 2236 in June of 22 um vital engineering construction plans were approved last June they have been under construction shortly thereafter I can't remember when the exact start date was on that um that they have moved through the final plat was submitted in December it has been through several rounds with both the surveyors and the attorneys making sure that it meets the minimum requirements of um of Florida Statutes um what is before you today is the again the first phase with 209 residential lots and two of the tracks making up the balance of the 241.55 P so the blue area is basically the area for phase 1A with um the pink and the peach color um being the later phases oops did I just go back or go forward oh the performance bond uh the uh performance bond was submitted with the engineer of Records cost estimates for the site development work um Rick did take a look at those and they agree and Public Works did agree with those numbers so the bond is being posted at a total of 204 uh 2,486 7718 um just the background and kind of summary of where we are with this so 241 Acres um the whole development is approximately 3.69 Acres um and so on just kind of an aerial tried to outline as best as possible and yellow the the area that would Encompass phase one um future land use is Suburban residential with a rural neighborhood Design District um I left that in from pre previous so again the phasing plan and again we're at the final plat um their next stage will be moving to building permits if you so approve and uh they can set to record um staff is recommending approval of the F of the final plat for the Pine Meadows Reserve phase onea as well as acceptance of the performance bond in the total of 2024867121 in the audience like to speak on this item seeing none we'll close public authorizing adjustment to the city of E rates for water Wastewater and reclaimed water to provide for the annual adjustment per ordinance number 16-10 to be effective July 1st 2024 uh do we have someone presenting on this item tonight anybody uh Lori oh Lor's coming up Miss okay missed you there hi Lori Carr Finance director uh this is uh I present sent you an ordinance to um increase utility rates at uh 2.5% as of July 1st going on to our August bills and our ordinance requires us at that every five years that we do a study and the last study was done in 21 it would not end until um 2025 sorry Jeff wore it out guess it's easier to go this way so we did the study in 2016 and they gave us an increase of 1.7 for four years in a row and then the last study was conducted in 21 and as I said it ends June 30th of 2025 calling for an annual two and a half% increase which is what I we're requesting tonight that was that was late but we'll we'll let you present more often okay oops I don't know sorry about this okay let's get it right this time so with recent inflation and receive of the arpa funds it's uh necess necessitated necessitated a new study which you all have approved that's been by rafis and I'm really not going to go into too much of the study you had a very extensive workshop on it Monday night so uh you do understand the need for the two and a half% and to continue on with our plan uh planned increases and I really have not presented what the other cities are doing because it's almost a moot point depending on where RAF Tellis comes in with everything that that we have to take into account for our rates and and that those results will be presented at another time and and as we all know and the average bill or the water bill water and seral Bill will go up a189 a month and irrigation will go up about 41 cents a month and the reclaimed will go up 20 cents a month so it's a very minor increase that our residents will actually experience uh much lower than current inflation and that is it any questions yeah any questions for Miss Carr from the commission no would anyone in the audience like to speak on this item well actually I do have a question based on what we decide on the Eastern plan would this affect that at all so we I mean we need to do the 2.5% at a minimum I don't think anything changes with that all right and so we're not um we're not doing anything uh that isn't appropriate at this time uh we may come back to you once we collect the data that you've asked for related to the various options um we may need to do a mid-year adjustment and so we may have to take it further uh but I think everyone agrees that the 2.5 is a minimum and needs to be done in in either in any case thank you um we will um we will be gathering information for you uh to bring back to you related to the utility discussion uh the fact that the joint meeting is cancelled um does kind of change I think our path forward a little bit uh we do need to have a discussion with the county about their intentions for development around the Eastern plant uh but regardless uh we need to bring information back to you about um what we discussed on Monday and we'll we'll have more information about things like estimated legal costs estimated permitting fees um for the various options so uh but again we all I think we all agree we need to do County Florida adopting a standard annexation agreement form for contiguous and non-contiguous Property Owners Desiring to utilize City Utility Services authorizing the city manager to execute set agreements providing for conflicts and providing for an effective date uh Miss Garcia that's me all right um Commissioners um so we have had uh I've been working uh with um development services and we actually had a meeting uh with commissioner Hawkins there have been a number of increased requests from uh not residents but there wouldn't be City residents but um from property owners that are contiguous and non-contiguous requesting to use uh Utility Services with for for different reasons um now we've had a standing um agreement or policy I should say that annexation is a condition U of the property owners in order to have utilities services from the city um we have a process for it for developers in the code but we don't have it for Standalone property owners that already have residences um established and um this would really just apply to those where we have available water or sewer in the area and or sewer um they may want both um this condition is um not only our policy but it's also completely reasonable according to the Supreme Court um in order for that requirement to to be made for them to execute an annexation agreement prior to utilities uh being afforded to them the annexation agreements uh would be executed it could be for either contiguous or non-contiguous properties if you are contiguous we do require annexation but it will allow you to get Services ahead of time so that you can you know get your water or your sewer set up while the annexation process uh goes through we know that can take anywhere from 30 to 60 days on average so it'll get them set up quicker and we would be able to then record the annexation agreement and those property owners that are contiguous would immediately execute um a petition so that they can go through the process this does not put any condition on the commission to accept the annexation it's simply a requirement of the property owner uh by the city if the commission decides not to have the property annexed into the city then we still continue to provide services to the property owner the idea is that all they have to do is be on board and so you know follow through with the process for annexation but the decision is not binding on the Commission in any way and for those that are not contiguous then once the property becomes contiguous or there's another form of Legally annexing the property such as an isba or some other legal Avenue then the city would provide notice to the property owner and they would be required to then again go through the process um we have these agreements set up just to make it a bit more streamlined for um the property owners and it's intended to run with the land so we would record it so it there's public notice and it's um um it will tie Future Property Owners as well and we'll have that recorded in public records and after the agreement is executed and recorded in public records then the process would start for the utilities to um kind of be set up the work order process would start then um the agreement is very clear as to what the conditions are uh for the property owners and for the city so um there questions on the agreement I'm happy to yes answer those so so for the properties that are non-contiguous who is paying the cost to run the lines to those properties the property owner would be required to pay for establishing connection from the home to um the main that the city has already in the area Okay so they would pay for that and there's also I mean the process itself I think there are um impact fees and other fees that are collected for that if I'm not correct incorrect on that yeah uh so the generally what this the reason for this is if we already have Utilities in the area and they have a septic system fail or a well fail then the Regulatory Agencies will force someone to come to us for service if they're in a very rural area without Services they're going to get permission to work on their septic system or their well and so what this is is really it's it's for properties where we have service available and now it's time for them to connect um and we have a process we're trying to streamline the process to get them Water and Sewer quickly uh as opposed to having to wait months to get it done well what about what about residents already in the city that would like to do that they they can do that without an annexation agreement because they're already in the city he a someone the city who already has access to service and that has a septic system or a whale fail uh they just come in to customer service and to development services and they get it done okay right so this is just an extra step for those who are outside the city basically non City residents they sign a contract to Green that they will Annex they'll get the services and then they are signning a contract that they'll Annex later what if they default on it um that's provided for in the agreement if they default that we can in as far as payment or if they do not follow through and with the annexation yeah uh well they actually um are signing that we can proceed with the annexation even if they do not submit the um the petition uh this is considered actually a petition for annexation for for those circumstances and um of course we do have um the right to to sue for specific performance and things like that if um if that were to happen so what um but we're only trying to do this to facilitate it to those property owners that have access well would like would have access um to City Utilities because they're in the area this does not mean that we are required to extend Municipal Services anywhere this is it has to already be in place so I do want to be clear on that okay okay any other questions okay um uh first reading we have ordinance number 24-29 an ordinance of the city Commission of the City of eustus Lake County Florida amending Chapter 70 pensions and retirement article 3 Municipal firefighters pension and retirement system section 70- 61.5 D Board of Trustees of the code of ordinances of the city of eustus and providing for an effective date that'll be me again um and this this uh for hanging in Jeff you're welcome um this applies uh for for both this ordinance and the and the subsequent one so uh we were I received a contact from Council for the police penion board and the firefighters pension board they've had some concerns about some Trends related to vacancies on the board and they wanted to um essentially set out some terms for those serving as trustees that would hopefully reduce the turnover um so the concerns would essentially be addressed by modif ing our code to allow for staggered terms having numbered seats and setting election dates for each seat and clarifying that the new trustees that would fill a vacancy would serve out the remaining term of that particular seat um both the boards have voted on it in favor of the amendment and they've provided um no impact letters from each of their actuaries so this is not going to affect the policies or the plans in any way so um that's uh what they've asked for and uh before you today any questions on you Sasha coming down down to Future agenda items and comments um if you have anything we'd like to hear it Willie let's start off with you uh before I start rting on off I I'd like to we had someone come earlier today and they they made a complaint on the Water Department and since Nicole is here I'd like for her to come up and I I would I would remind that myself so and I think that's one of the main reasons Nicole she came tonight because she came with paperwork so she has to stay through it all yeah and it's 8 o00 so can you give us a reur so um part of the problem is as she said uh the building used to be a daycare so the building um was plumbed and has two meters one serves the daycare part and one serves the home partk while I understand her concern and we have made many adjustments for her um can you explain what kind of ajustments so because they're two separate units and the daycare is so small that they were considered a residential um daycare so they had garbage at both units I've canceled garbage at one unit because one person owns both now um for a year to help Miss Dodd we did cancel availability on one meter what what's the cost of that how much is that um so the availability for the water the sewer and the garbage from one of the accounts for a year was $725 128 so you helped her out with that and she didn't have to pay it she did not have to pay it I waved it for year that year is ending in August um this has been explained to her many times she brought her son in twice and I've spent over six hours with them trying to make them understand that they could replum the property and then we can take one of the meters away and that was Sol is his English as bad as hers no it is better than hers it is better does she but does she understand that even though you don't use any water there's still the availability the sewer charg is the garbage I've explained it every way that I know how to explain it okay um what what I would love to do um is maybe have a face tace sit down with an interpreter with oh sorry no I'm sorry no no no you were thinking you I've had my employees um I have two employees who are very fluent in Spanish they have both talked to MD but it's still it's it's not getting getting through and I I fear that part of that maybe she just wants it to go away so if somebody above my office was able to sit in on a meeting and explain to her we just simply can't make an availability charge permanently go away from for her without doing that for the whole city I've certainly never seen a bill with zero usage well her meter head broke for three months that's why she kept saying it was zero on that one when we you know discovered through Quality quality control that it was broken we went out and fixed it did we charge her for those 3 months she was charge availability only and no consumption okay but she's now getting consumption because we fixed it and that's why her bill has gone up and she's upset about it that's correct thank you ni you I think though if if you would if you want to arrange that meeting and see if Ellis could sit in and maybe even Tom as city manager sit in with that and sure you know sorry Tom no that's fine thank you thanks for all you to over there appreciate it go ahead Willie I'm sorry with the uh uh the the summer coming to an end U you know we're getting a lot of calls for backpack uh giveaways and all that and and I noticed that on several of the backpack giveaways there's the police department and the fire department uh that are involved U I just want to thank them for that um you know uh the resource center is doing one as well uh and we've got uh Public Works coming out and they're doing the touch of truck and some of the churches are too yeah and um uh we have Parks and Rec that's participating so the city is involved in our community and I think yes that's a big thing uh the other day um the cheerleaders from um hustus High I don't know if commissioner Ashcraft knows why they had to go out actually I don't oh um that never said anything well I guess at the U one of the training sessions they were using the uh the cafeteria and they left it a mess so the U I received a call from the the cheer coach and she wanted to uh expose them to community service she got they got it uh so they ended up uh cleaning up an area and they did a great job uh so I want to thank the cheer coach for that and and I think the girls may be coming out again I I heard I'm not sure well if they do they should maybe concentrate a little more on paletto yeah yeah well well they uh they and I'm not saying they didn't do a good job on the other part it's just that they they did but I think that night the rain lightning started so they had to stop but uh I think as a city we're doing good Community involvement I think is great so that's it for me thank you sir Gary um I just want to talk about the hometown celebration yeah and how great that was so many people there um Talent was good people were excited um Fireworks was really nice so I just want to take a time and take a shout out to Public Works and events and PD and fire everybody that came together to make that event because I don't think as long as I can remember and I think Miranda shared the numbers that we've had that many people in the park 10,000 yeah so um thanks everyone for have not instituted a moratorium and so we have an obligation to commit continue accepting applications that said uh kimley horn is working on what we've asked to do they're working through the code R right right now um so what we'd like for you to do um is potentially uh take a look at this uh see if you have any questions any issues uh we can get those back to kimley Horn uh and they have more to do but they are working on it and um I think we all know that uh we want high quality projects that we can all be proud of and uh they're working to put together the framework for us to do that so is is there landscaping part of this uh well I think uh they do talk a little bit about Landscaping in here but we probably have to we've talked about do we want to make changes to like our our our tree preservation ordinances and that would be that would be part of the code rewrite that would not be in this design guidelines but I think they do rep they do reference uh uh sing Landscaping in subdivisions okay thank you may we could kind of incorporate aib into this we we could Tom I have a question on this for you I don't know if this came up um with the discussion with the county there there has been legislation that preempts uh certain design standards for uh developments and I don't believe that there is an exception so I'm not sure that this is actually something the commission will be able to consider unless you're aware of something I'm not this this is consistent with other other projects that Kim Le horn has worked on uh we can talk to them about preemptions that might stop this um but I think this is consistent with other other projects that they've worked on um yeah there may be an exemption that would apply to those particular projects I just want to make sure we're covered because uh the statute right now prohibits us from doing that we'll talk to them about it okay anything try to put you on the spot anything else sir no sir Sasha anything else um just wanted to ask if it's all right to do the presentation um just on the restrictions for the special events next commission meeting it's it'll be brief um but I have some information for the commission um also got a a a text message today from our lady from eustus high school that does future Business Leaders of America um we had a young lady that from eustus high school that won number one in the state a couple months back um and it was in accounting the young lady competed today uh down in Orlando at their competition and came in number three in the nation from hust High School name is Kelly um so we're very proud of her so we want to send a shout out for that so um we got good things going on I love that this city commission is involved in our school systems um and we're trying to make things better for our kids here in eustus we want to encourage them to stay here so you know after college we want them to come home and be a productive part of our community couple things I want you to put in the back of your mind and we need to discuss at our next commission meeting after our um um utilities workshop on Monday um you know we have a part of that was an appraisal for $35,000 of the property to the east I want you I don't need an answer tonight don't even want to open that door just consider let's go in ahead and moving ahead with that 35,000 whatever we decide we're going to need to know really the value of that property as we move forward so just putting that out there for right now um another thing that I really want to uh to consider and it just went out of my mind but it it'll come back and that's okay it's getting late and I'm old so but um I I want to thank the the this commission and the members of our community for uh standing up with me supporting me and supporting this commission we do a lot of great work and we're not going to let any anything or anybody stop the work that we're doing we're going to move forward um we'll let the people to trct if they want to but we're going to continue marching forward so now it just came back to me I'm getting better um uh the next commission meeting um we will need to really talk about whether we need to fill our other seat by then we will really kind of know if people have filed to run um so that's a conversation that we probably need to tack on to the back of our next commission meeting as well okay um if we had the desire to move forward or what our plans may be okay and Sasha you'll probably need to check our Charter to make sure exactly where we stand with that absolutely okay thank you all
