e e e e e e e e e evening everyone welcome to ustus City Hall our first meeting tonight is the local planning agency meeting it is 5:30 Thursday February 15 2024 a quum present proper notice been given yes thank you so much first we have approval of minutes the approval of minutes from January the 18 2024 LPA meeting sove thank you second have first and second any discussion not hearing any roll call please Miss Cobb I Vice chair Lee I Mr Ashcraft hi chairman Holland I next we have considerations and discussions Jeff all right good evening uh for the record Jeff Richardson deputy director for development services uh your first item is a future land use assignment associated with annexation um this is 2023 CPL us-9 this is for consideration of assignment of future land use for a property at 2596 e Spates Avenue um the property is approximately 1.8 acres in size uh and the owner of the property is Habitat for Humanity of lake and Sumpter the property is contiguous to the city limits on the east side and on the South Side would be contiguous on the west side except there's a little bit of a Hiatus property about I don't even think it's 50 feet wide that belongs to the Oaks at summerglen subdivision we are going to go back and do a little research because obviously Oaks of Summer Glenn is in the city this is part of the HOA I'm just wondering if a legal description didn't get run right so it's a little bit of go back and look it doesn't really pertain to whether this property is contiguous or not um but just to let you know that there is a little bit of a Hiatus in there that's why you're going to see kind of a spacing of different color as we go through overall this is actually part of that uh doughnut hole type Enclave that we have le left in the eastern part of the city um again 1.88 Acres it's directly above existing subdivision as well as the other subdivisions to the East and to the uh East South and West uh with unincorporated Lake County being on the north side of Bates Avenue uh advertisements have been done pursuant to uh Florida statutes for the comprehens for the small scale comprehensive plan Amendment ads were run on February 6th as well as February 12th as well as all the other notice per Land Development regulations for signed posting uh and mailings uh the request for future land use was reviewed based on Florida Statutes our own comprehensive plan and Land Development regulations which all that information is included within the staff report this request will take the proposed Annex property from Lake County Urban low to uh city of Eustace Suburban residential um change of four dwelling units per acre to five dwelling units per acre with both of the land use categories really being a residential land use category um and being consistent with the surrounding area um well that answers that question for that slide uh the environmental evaluations um public facilities are available um there's a slide later on that actually shows the water and and uh sewer locations in proximity of the property um this property is not subject to flood plane or Wetland it is within the Waka study or Waka Basin study area um however at 1.8 acres in size it's not going to be a big development if anything goes beyond one dwelling unit or you know one house on the property um the only kind of caveat on this on the other hand it is developed all around the property is that it is in an area that is designated as high recharge um but it will be the pro any development of the property will still be subject to maximum perious for the Suburban residential at 40% as well as any open space requirements as development occurs in the future uh utilities are available um in the area U basically along Bates Avenue as well as other routing if they needed to take that to get display the property um there again there is no impact on flood for FL from flood plane or from Wetland um the property was cleared at some point in the past and on 1.8 Acres there's minimal tree cover it's basically on the west side and the south side of the property again uh recharge is at the TW in the 12 to 20 range uh which is the moderate to high range um soils are well percolated very deep very Sandy soils so it does drain very well um again the project is or the property is um directly contiguous to City Limits directly on the E or on the west and directly on the south um staff is recommending transmitt of 2023 C+ 09 to the city commission for consideration as part of the uh annexation package any questions of Jeff anyone in the public like to speak to this not seeing looking for a motion to move this to the city commission for consideration second first and second any further discussion roll call please Miss Cobb I Vice chair Lee I Mr Ashcraft I chairman Holland I Jeff uh we have our second item which is uh future land use assignment for 2023 c plus-11 um this is a property located on uh getford Road just east of kulage and just west of gatw um RC lake is the owner Tom Zan is the applicant to the property I don't believe he's here tonight but I think he said he was going to send a representative uh future land use assignment will be on approximately 13. 72 Acres of property uh again this is directly uh um along gford Avenue with Gat being to the East and um coolage being to the West City boundary this becomes contiguous or this property became contiguous with the annexation of the completely lost what I was going to say I apologize um with one of our previous extion so it is contiguous on the southwest side of the property um but again this is another one of these properties that is in that doughnut hole type Enclave where we have kind of the city surrounding but quite a bit of um the County's Urban low um also in that area it was uh I'm sorry Jeff First Assembly of God that's what I was looking in my mind wouldn't Gras on I apologize I was think it was Scott Johnson the uh the property was annexed or annexed it was advertised uh in the newspaper on February 6th February 12th as well as all of our Land Development regulation requirements for site posting as well as for the mealing to AB budding Property Owners um the request has been reviewed based on Florida Statutes our our own land our own comprehensive plan and our own Land Development regulations um the request is taking the proposed Annex property from Lake County Urban low to City of Eustace Suburban residential again a difference of urban low at four dwelling units per acre to city um Suburban residential at five dwelling breaker with both land use classifications basically being for residential development um the surrounding area is consistent with what the requested um action or assignment of land uses um in this particular case um utilities are available to the site um this property will have some constraints there is a wetland on the property which is both onsite and offsite as well as 100-year flood plane effect that is both onsite and offsite site specific studies will need to be done as it moves to development to indicate whether those lines are there or maybe moved a little bit um those will be again site specific studies um because the gis layers that we do use are generalized layers especially on the Wetland is from the national Wetlands inventory which is based pretty much on soil type more than it is on um a definitive Wetlands jurisdictional line um utilities are available in the area uh along gat road as well as coming from the coolage area from on the west um to potentially serve the property uh again the uh property is relatively heavy treed it seems to be mostly covered uh mostly canopied at this point in time it is subject to 100-year flood and um also to Wetlands um the property itself is within the W St area um out of the 13 was it 78 Acres 72 Acres approximately 7.2 Acres remain as Uplands with approximately 65 6.5 Acres affected by the flood plane in the Wetland area on the property so the property on the west side as well as on the North side does have high and dry to the south east corner um is gets a little bit wetter both in soil type as well as the mapping indications uh the property is located in moderate recharge in the 8 to 12 range uh soils tar types are the Mya Placid Maya as well as swamp type soils that are indicated on in the Wetland areas um we already discussed the contiguousness to the or contiguity to the um Municipal boundary um again City Limits are on that West Southwestern corner of the property um in this particular case uh although there do do does seem to be some um environmental factors involved in this property it makes sense to bring the city into bring the property into the city the Suburban residential and the Suburban neighborhood classifications um that are being requested um are the most appropriate staff is recommending transmitt to the city commission for 2023 C+ dasel up thank you Jeff any questions continuous with all these properties to the South um while I recognize that the area up next to get getford road is high and dry um there's not an appreciation for just how wet it is back in the back um that swamp um I was looking at the maps associated with this um that area to the West I mean two weeks or a month ago that had standing water on it um you it it doesn't make sense to continue to develop weapons that are flood prone uh when the the city of eustus has already done how many flood control projects back in that area uh the County's done plenty of flood control projects back in that area um but whether it's developed or not I would like to kind of go on record and kind of bring it to everyone's attention that I do on the swamp to the South um probably you don't hear this much but I like my swamp I want my swamp to stay wet um and my concern is if they drain this property enough to be able to build on it that they're going to start affecting my groundwater levels um I've got a pond on it my Pond's going to go dry if they drop the water levels uh the swamp's going to dry out that's going to increase fire danger um I just don't see a lot of good coming out of this um if they do build I would and I realize this is probably not the right place to bring this up but I'm going throw on the record anyway I would like a fence I would like their property fenced um I've had fits with you know the children coming back to get in my pond I don't want the liability or the respons posibility of trying to keep them out and it shouldn't be on me to have to build a fence um you know that should be their cost of doing business and that's all I had to say Thank you Mr appreciate it sir anyone else not seeing anyone looking for a motion from the commission to uh transmit
