thank you all right let's get started everybody Welcome to the meeting first on the agenda is a vote to approve the meeting minutes we're going to skip the June 3rd but we're going to go back to May 13th for the meeting minutes would someone like to make a motion to approve the meeting minutes of May 13th I'll make that someone like to second that motion all in favor uh the next one is the June 10th meeting Duncan you weren't there all right would someone like to make a motion to approve the meeting minutes of June 10th I'll make the motion someone like to second that motion second all in favor I thank you next on the agenda are hearings first one is the noise fent Garden the Conservation Commission will hold a joint public hearing under mgl chapter 131 section 40 in the Wetland protection act in the city of D wetland protection ordinance notice of intent filed by gr engineering on behalf of Roy is it cin cop I don't know for the construction of a single family home at 68 Acadia Road someone here to represent yeah your name is Troy come on up Troy add some extra copies of I got five is exra all right good evening my name is c um on half of GRA engineering on behalf of Roy copin um so we are proposing a single family house within the 60t uh Gardener no build Zone um the slw has existed there was a previous mobile home here um it wasn't there at the time of the survey but based on are seem to be there back in 2023 um so we're proposing it a little bit further away from the existing Wetlands back here at the back of the site um it seem they've already been Disturbed up to almost the wetlands um I'm assuming from the last house mobile home that was there um it's kind of a tight obviously the front set back here so we're going to need uh variant for the front set back as well we try to kind of Meet the middle between both of them um but it is within the 60t no build Zone um kind of the houses the abing houses kind of within the within the zone as well um so yeah it's a 24x 36 single family uh two-bedroom house I think one store um so yeah it's kind of what we get the W back here proposes some Sil F between the two so I don't I don't know I'm looking at the same thing like trailer home that's there the image date I see is October 2022 but I mean it's in the 60t Noe build it's been PR previously Disturbed I don't know what the disturbance has been sense so it's kind of a a little odd for us to come you know and look at this type of lot cuz you're going to be Escavating in a no build yeah yeah slightly well how many square fet are in the 60 no build um I don't have that information with [Music] me so you're going to come propose to us that you want to build the no in the No No build Zone but you don't know how much it's going to be in the no build normally they tell us hey it's you know 200 ft or go ahead D well I just going to the one thing I was going to say is that you know casion these house designs have a little tiny Corner in the 60 which we then have them move out of that this is almost half the house and I recognized there was a trailer there was built before the other regulations were there but it's really challenging us to do that cuz we we move stuff even like a corner of a building at least a third of the house not more than that is there any way to adjust it out of there well the yeah the issue was the front setbacks you're trying to kind of Meet the middle I mean you have to be more encroaching more into the front almost too much into front you got Glen Road the front your Glen Road comes up at an angle there um yeah it's really tough to kind of try to tweak it without being way too close to the front of a caveo can't you can't move sideway I mean forget the proposed driveway I mean can you I know there's still Frontage probably issues but looks like you could move it sideways a little bit more you could go a little bit more it's still keep it into the 60 quite a bitless he moves even closer than the side up back yeah the property is very tight right there yeah it's tight I just don't I mean when it says no build it just means no build I don't know everyone comes to us and says hey can I put a house up and it says no build the only that makes this a little different is that it's been dist start like you're going to be digging into it not just putting you know it is just a slab on grade there's no down but you're putting footings right there going to be a 4 foot probably wall no Perman Basement foundation any I think is it f the frontage limitation was Frontage and like if you if you ignored the proposed driveway for example m i mean and it looks like it like I don't know what where the regulation is you can't go any further close but look like it's still moving sideways I don't know well can you oh yeah there you go that's what it looks like right now yeah yeah you could try to twist it then you're going get that front set back there going to come into question a lot more too so who took the health down that was there um I'm not sure um was it always Jacob you since you've been there yeah we surveyed it in March and it was vacant uh March of this year now is this the owner of the land they have they owned that lot for um I think just last year if I remember correctly so he bought the lot and was vacant already I'm not positive I think [Music] um it just seems like someone took down you know it was already an issue with them working in the W one yeah see has a sign far yeah also slopes down right water yeah yeah right where it was kind of already Disturbed it drops down it's kind of flat to there and then yeah it does slope down into the into where the weapons are I think you should just try to rework the the footprint a little bit and get it out of that 60 yeah yeah I'm not sure it's going to be possible to completely get it out of the 60 well 60 no build is no build I mean it's that's pretty much a precedent we've set for the 15th plus years I've been here yeah since even if there's an existing well there that's kind of what a build where we were going with it it's kind of like there already a building there we're improving it well it really wasn't a building was it was already somebody cut trees way back before we had an ordinance right right and then they put a trailer on it so they didn't have any foundation and then we probably had an ordinance they just I I can't tell you know what the timeline was but now I knew the trailer was there it was 1985 was a FL went done but I don't know yeah when it was lived in or was it has it been vacing for a while I'm not sure um I'm not sure if you bought it trailer um we talking about this a bull in the face and we're going to get anywhere tonight uh you know if you want to go going you know see if you can it around so you're out of the no bill Zone and come back in in two [Music] weeks I had somebody in the audience had a hand up too so I'm not I'm waiting for that but I think do your best you can to kind of reposition the thing and maybe talk about the ordinance you know call the zoning and see what they have to say too see yeah I mean to get it out of the 60 completely it's probably going to be very close to the to the property line itself I would assume trying to fit it kind of up in that corner be your best option um cuz right now the frontage there off that that angle corner there is about 17 1/2 ft yeah um 20 ft along the front of the Cadia but the angle kind of messes with it more yeah dou um what what's the ruling typically when it's already been obviously they've already done work out there over the years and it's pred Disturbed what how is that come to play here or do you not know um I mean you know definitely it's taken into consideration of course like it's uh built upon lot you know it's already been there are utility scubs out there from what I saw yeah there's existing water SE out there and the current lot is sanded you know just looks like that either dug up or spread prepare for construction um I mean or may have been the you know sat like 6 in underneath the trailer home I don't know yeah um I it's definitely taken into consideration of course but it you know it does kind of precariously back up to a uh significant Wetland stream and Wetland and it is a pretty uh significant kind of building set what the setback is off off off the thing I don't see it is this proposed be one correct yeah building yeah goes here it goes here and then it goes here yeah can you explain that set back line there just so we're all clear yeah um so it comes down here so the side is a 15t off the property line uh the front of J 15t it's 15 ft yeah and then it's 30 off the front which would be aadia road so yeah it comes it's kind of like that darker um hidden line there kind of runs through the front third house almost half of it already yeah I think he you know give a couple of options of moving it as much as you can out of the W lands or the 60 no build okay um I understand it's been previously Disturbed and like Doug said you know we take that in consideration but could give us some options to go with and then they'll you know we'll take it from there okay yeah cuz the neighbor houses I know those are probably put in before too but those up to the the notice their Zone themselves so y that kind of I mean this one's not but the one to the north is almost into the no disturb Zone yeah and they have that shed start on to the wedings yeah like to think something could be done with it just twe there if not there's going to be pipes you know electric P just kind of sitting in the pole you know has a wire that wants to go to the lot too so isn't going to make it anyway well I mean let just see what he comes up with okay yeah we can try to and talk to the zoning as well and try to get get some feedback to say hey we're willing to work with you a little bit but we need some zoning as well to where that proposed driveways and kind of get it more out of that as much as possible I mean like David said or Mr orward said that you know we've had people come with like 10 ft in the no build no build no build so we're trying to be flexible here on this yeah anybody in the audience anything to add take your name please Steve Rockwood 310 C Street thank you uh the trailer has been vacant since 2019 and at that time it looked like it had been vacant for about 15 years before that okay okay that makes sense cuz I'm looking at 2020 and it looks like it's yeah was it on the just no it's okay yeah yes so um just um we'll continue it to the uh July 8th okay and then give us what you can a few days you know before I mean we know what we're looking at now so if you can get it you know a couple days before the meeting give us time to review it be great give us ABCD whatever options you can come we'll come up we'll try to get a couple variations again Taco zoning and kind of see what's what's possible out there yeah we'll do what we can to work with in our side because it's thing but that's a significant drop off to a sizeable you know Wetland with the Stream So we' got a a lot to work with on our side too okay would someone like to make a motion to continue to July 8th I'll make that motion someone like to second that second all in favor thank you thank you next is the continue from the March 25th meeting um this is regarding 12210 Road it's D pile 16668 you have an update on that one yeah um so i' spoken with the consultant that we had hired as well as the applicant um in the middle of final report there's one particular point where they're off art the me hard is he's out like 10 ft from where they put a point um so he thinks his farther out yeah that would have then bump the boundaries out like another like a you 30 plus 10 whatever Fe um and from the latest I've heard they are just kind of hatching it back and forth and discussing the merits of each kind of uh Point um which is just kind of what you do you know we saw walk the uhal trail it's kind of just what you do when you have a you know disputing line kind of go over the various merits of each um they're in the middle of that um they just kind of you know they both have to be there and kind of the schedule of that it's kind of led to this taking a little bit longer um they had some questions about whether isolated wetlands are regulated under the bylaw The Gardener city ordinance yes to which I said yes [Music] um there we're just questions about that um I guess apparently other municipalities specifically outline or state you know isolated weapons are regulated um which is fine for them but I I don't think uh I don't think not specifying that would preclude that from being um included is the word Wetland and isolated so I this L has got a beautiful spot on the water we've all been there times over the that second lot there is just there's a couple of just tight areas out there we're trying to do what we can to work with them but it's very tight yeah um so and that's just kind of what I've said pretty much is you know I don't have any plans or finalized Millen or report to go off of yet you so I mean it's just hard for me to say you know looks good or not but just kind of film you and that's the latest as far as that goes all right someone like to make a motion to continue to July 8th I'm a motion second all in favor next is another one for the continuance from March 25th this is regarding um oil Land production ordinance of No 10 allpurpose storage LLC represented by Christopher bua buil Stone land consultant for work on parcel x22 1316 then A14 uh and then 9 through 18 located at 143 Colony Road Project entails extension of existing storage facility including seven storage containers four of which are located within the buffer zones of a bordering vegetated Wetland this is also pertaining to the violation in enforcement order and it's D 16664 you again it's nice to see if for a bi-weekly get together make you a member of this commission first I'd like to say thank you for working with us and spending the time you did the other night with us and and putting your efforts in on your side we're trying to do a weekend um but I just want to kind of talk about what what you're proposing um with to make the corrections Duncan if you want to read this while he's talking I know you don't get emailed but he's doing everything literally we ask to do um almost to the word but go ahead this is based upon our discussions two weeks ago um I guess I can illustrate on the plan here this green line is the edge of the originally delineated jurisdictional Wetlands the pink line is the 30 non-disturbance buffer the purple line is the 60t no build and the blue line is the 100 foot buffer um so what we proposed here is um I mean we can go through the whole restoration sequence if you that makes sense yeah please just really briefly we all kind of yeah so proposing immediately setting up erosion control around the entire area um and then um stabilizing areas as needed especially with that ongoing erosion and scouring ramp um I actually stopped there today in the past storms over the weekend haven't done too much it's not significantly different than it was good um so in addition to that proposing is to remove all the material that placed in this Wetland area here um based on how thick it is I think some mechanized equipment could be used but ultimately it's going to have to be finished with hand tools so to not disturb the um Organics that have developed there um and then we're proposing to seed that area with a wetland mix from New England wet plants um as far as the buffer areas we're proposing to have all of that um asphalt fill that was brought in removed down until L of materials exposed to then go back and fill that with LOM and seed that with Upland plants um we designated a conservation and Wildlife mix um it's kind of has some pollinator as well as Fring material for birds and other um Wildlife um and then in addition to that we also proposed at least as a stabilization measure now for putting a wire reinforced Sil fence across the top of that ramp and supplementing that with a mulch BM in the front to redirect storm Waters towards the existing storm water infrastructure the catch basins that are on site um and to prevent water from entering that area until everything has been stabilized what what's sequence would you do on this would you put the sil fence up above and then surround down below and then start peeling out or how would you do that so going through it I don't know if it makes sense to put the sil fence at the top of the ramp I just I'm just trying to worry about it keep going down and Wasing out right so I think the first thing that needs to happen is this Sil fence needs to be put around the entire perimeter so if anything does come out it's not entering even the uh non- disturb area that 30t buff yeah um and I think that would provide a balance between access for equipment to get the work done well as also um protecting the resource area as it is today um and I think the priority should be to restore that Wetlands um and to get that seat down as fast as possible especially if you've had a couple rainy weeks so take advantage of that yeah we're get into the hot dry season so when you propose starting this if we said go this looks good we all agree to it here as a commission how fast do you mobilize to start um we're prepared to tell them to take action upon the decision for so I would imagine it' be within a week or two we should be able to report at the next meeting the status and I should have an update now who's doing the work they have several contractors they work with um so probably they'll put it out to bid um now would you facilitate the bid for they handle a lot of that um because you you can't just be a civil guy and go out there and clean up a Wetlands it's kind of a specialized right and that's something we could definitely coordinate to have um Wetland specialist from our office there to oversee the activities and obviously the commission's welcome at all times to come observe the the operations so what you going to say yeah I just I think that's important to add I mean I've gone to a number of sites both you know my capacity as a conservation AG both s superintendent you know doing a w replication you go it's like you get like landscapers to do it looks like Commercial Landscaping with like red mulch and it's like yeah you yeah I mean got any questions anybody yeah just one so you're also talking about other Wetland or buffer Canyon right so this that area too this area and so anything that's hat that's this yellow this hatch here with the yellow highlight we're proposing to excavate yeah um and I think that that would be valuable just to get that material away from the wetlands and I guess just relate to that so there were Vehicles right up to that edge of that are they going to be so that's the first step I guess I skipped over just trying to go by memory here but once the erosion controls in place have all the material removed the stock piles the vehicles um and also hand removing the debris that's in the forested areas okay A B job yeah yeah you're right it's not small there's a lot to be done there it is a big job yeah you know I mean I'm thinking of just moving the the the top the asphalt down there just to you know just that's a that's a big job yeah and you're going to what I'm getting at is going to be open you know what you start you know want you start you know you can really have some problems on if we get some rain like we've been getting I yeah I agree so what I guess where are you're going is what's the plan if you're halfway through from stripping this stuff and we get torrential rain like we've been getting almost weekly it seems yeah how would they how would the owner react to that call you guys to come or how would that work so that's that's a good point on similar sites we do um uh Swip inspections and so I think that that's something that could kind of tie in it may not fit that we may not have an actual EPA report that goes with it yeah but something to try but we can have a weekly inspection report logged and we can submit that to you guys for documentation and that'll be fine we you know you're going to put this out the bit and you know I'm a great bully but you don't take the low bit but that's my opinion you know and you you guys do that but I see a lot of these jobs going around here and the guy gets the job and he's got a mini excavator and a and a and a six wheel dump truck you know if you're going to do it you got to have something big some big equipment in there to strip it get it out there how deep do you think you have to go what's the deepest do you think can I I think you're looking at probably 3 ft just B material just based upon the where the native material is in the forested areas there and you believe the owner is committed to do this work absolutely he's um he's at a standstill right now so and what's his plan once we move forward and clean this up after that what's his plan with that that area so at that point I the intention was to continue the permitting process with the commission here and continue to receive feedback and incorporate that okay so Doug do we need to vote on this do we just say because it's an enforcement order yeah I believe I like his plan I mean we all know Ken's been committed he me go ahead what are you going to do with all the material when they remove it so as a not on the plan I've said it cannot be stored anywhere within the 100 foot buffer anywhere on site to me that makes most sense it's going to have to go off site at some point so to St pil doesn't yeah it's save anything yeah it's not fill or gravel or anything it's such a mix yeah your name it's yeah so if they I mean if they do have me that kind of be up to whoever the winning contractor is how to handle it whether it's like live loading it versus stockpiling and then removing it and if it's going to be stockpiled on site then we're going to have to establish a secured Basin with storm water protections all around that as well okay so that's kind of um I me you could if this is what you want to go forward with right now you could vote um it should be a restoration order of conditions anybody have any I want to get it fixed as soon as you can the with inspections that could be well Ken has invited us anytime anytime you want okay yeah and I I mean obviously he's let us out there a couple times already so just a matter of the commission getting out there at you know as um you know I like what he told us tonight but there the storage and there's a lot of material there you you don't have the room to store for one thing no I'm just saying in terms of a practical operation it may not make sense to have a triaxle going down there to collect it versus bringing it up and stock until you have a few truckloads worth yeah sometimes it's short term and they put it up there for 3 weeks 2 weeks and then once they're done pulling it the machine will come and then they load it so it's more getting it out of there quickly cuz I'm really worried when's the growing season almost it's almost gone right we're getting into July now so for the Wetland plantings um you can actually plant them on frosted ground and they'll come back um but obviously we like to see some development and in my experience what you've seen is the existing Wetland plants there once you have better conditions for them they'll expand in self seed as well to supplement that okay and then guys going to be watering this thing throughout the summer is that something you can put into a plan um for us I mean how just somebody's going to have to maintain this right so it's pretty hot out there and it's wide open so it's so it's part of the um revegetation there is um documentation um oversight maintenance done um yeah definitely if we just planted it's a difficult especially the Upland areas would be difficult [Music] now I ha to be but in in the past I can think of one right off the bat God that you know they were supposed to do these plannings and and nothing got done you weren't involved I me this is something you know maybe we put a timeline in well I mean you know if for instance you all you all what are you going to put down in and somebody said oh you can't have it cuz we don't have it so you going to go to plan B so I I want to know this commission wants to know what plan B is so typically um we'll specify a plan or equal substitute that's why I've listed all the species that are in that seed mix if it's not provided by them if there's some shortage or something we can get a comparable equal yeah seed mix um yeah I pretty much want that whel lands mix because we've had the or equals and it's still not growing yeah right and I think we even if it's short term you put something down to get it to bite and come back in the ball but what do you think is a fair timeline from us approving this um order conditions and starting and finishing is it if it's need needs to be done within 45 days is that fair is that not enough time I'm asking I don't want to Pigeon hold you because you're trying to do the right thing yeah um so what I'm just on my end thinking is obviously the fines come due in October so they have to have it done before then or otherwise and we're going to not have the opportunity to grow anything probably once we get to Middle later part of August um do you think 90 days is fair I think well I mean obviously communicate with us if you're saying hey we're partway through we're moving along it's a little deeper and taking us more time then we can extend that accordingly you communicate all I have no problem I don't think commission has any problem with that we just want to be notified about it oh absolutely I've been trying to make an effort to include you and problem about the planning that it didn't get planted the way they had said it was going to plan now you would you know yeah yeah you should probably give us more of our planting plan that's a little bit more detailed as you go mhm so we can kind of watch that I understand the stripping part but while you're doing that give us something for you know for review and guidance on on a planting so oh yeah well I can definitely do that um we've done we just finished a project in uh Bernardston um we did two years of monitoring monthly for vegetative growth growth and documentation so what grow there um so we did a one for one um replication area and I don't have the plant list in front of me here but it was how was grew well um so we actually had some red Maples established which was cool but but uh we had Joe pie weed um and couple of grasses and sedges um we had 100% coverage within 2 years wow it's pretty good Jesus yeah that's good yeah all right waiting for Doug to come back so um I guess we kind of can take your email and put that into our order conditions what your you know your short plan is bull tized um and then we're talking about um giving him conditions for restoration only yeah um and needs to be completed within 90 days um and then within that 90 days if he's you know getting into it and it takes a little bit more time can communicates with us at like another you know 30-day extension but what our concerns and Duncan brought this up was never doing it or starting it and never finishing it so that's kind of what we're thinking your thoughts on that that would be September 24th yeah um yeah I mean like OB I still want to do the original submitted project which they have an an live for I mean this would be conditional completion of this would be conditional to even moving forward on that now yeah and then like like K said that you know October will be right after that if he's not done then the find roll so yeah yeah yeah if you get done sooner all the better but you know you kind of get back into the growing season towards the end of the which is probably when you be planting right so and we we'd also be able to evaluate at that point if it needs to be overseed again yeah all right would someone anybody have anything else you know the only thing I I you know everybody's busy yeah trying to get somebody to do that trying to get somebody to do it um what do you think I mean so that is one perk of how large L this businesses they have guys on sites right now that they can roll and they're and if they're not going to do the work for them they're going to get pushed off the the list so yeah okay yeah right anybody in the audience have any questions no no okay would someone like to make a motion to approve a a restoration order of conditions U the work needs do of start and be completed within 90 days which brings us to I just want to make sure exactly we could just say 90 days from yeah from 90 days of signature um and with Ken updating us uh on progress and you know project award and uh we can basically use some of these bullets St to make it easy in the we conditions he kind of summarized it and then know his plans um and his planting he's going to give us a a little better of a planting program for review uh and guidance really an approval type thing but we don't want to tell him where to plant what uh he's got the expertise to do that that should actually work out pretty conveniently because the second meeting of September the 23rd and 90 days is September 22nd okay for today yeah yes someone like to make that motion I'll make that motion which [Music] one exact someone like to Second it I'll second it all in favor thank you I've also brought two hard copies yeah please yeah thank youate thanks for working with us we're doing what we can yeah and um make sure they stay committed to get this done to sign that now yeah thank you thank you for your time thanks for hanging in [Music] there let's wait for that to go around before we jump into the next [Music] one actually while you're signing I just do this is a new business this is for the uh Mac C Massachusetts soltion of conservation commissions um we added Karin on there and uh Sophie was still listed so remove Sophie um the invoice amount is for $311 K you got the E handbook subscription too um not yet did you want that or did you already order that I did not order already order it um but I attended two of the sessions yeah they're good right I've done a bunch of them yeah yeah and and I'll I'll be able to finish all five by the end of the year it seems for the basic certification that they have yeah they're interesting yeah oh yeah they're very good this last one was uh conducted by the person who's the head of the conservation department of the town of Lincoln yeah they put in a lot and um yeah they've got their act together yeah they have a lot of good resources and a lot of good public programs that they do like garlic p and garlic mustard you know all that kind of stuff so it's interesting to see what everybody else does in their own [Music] neighborhoods so um I'm going to say that we add one just we'll do the one e handbook for K see if it works and if anybody else wants it after that we can get it for $20 more so um the the total bill would be three 31 $331 it's something like to make a motion to approve expenditure I I'll make that motion out of our Wetlands fund of 331 for MCC I'll make that motion second all in favor thank you [Music] [Music] all right the next one under the new business um was 827 Green Street this is the proposed track um this is just kind of letting us letting the commission know that you know there's some there's some discussion in the city of this of the proposed horse track it's not on our docket we have no application this is a discussion open to the public is more of just understanding that it's moving through city council there's been some um meetings um that are planned later on this week there was already a meeting crany head said there's already one meeting um last night is that was that open to the public yes y so just um you know keep your eyes and ears out it's a tight site out there um there's some uh conditions already going on on site that we've been discussing with the current owner and uh Doug had tried to call them a few times to get back on site and take a look and see if they moved that pile of maneuver out of the way they were in the process of trying to do so so um if you do hear anything you know just you know keep keep your eyes on the ears out there there was a question of salwer too yeah I don't know anything about this until until we get applications technically there's not really much to talk about yeah um go ahead clarification order conditions I can't remember where we stood on that what were the were there some so when they did house um 2021 they got an order of conditions for it um and and I just happened to kind of notice it was expired down around February 3 years um and I've been working with them at the time to try and get that resolved and still open and it's still open so so there's going to be no proceeding on a827 green until that's resolved yeah not so it didn't show up I guess it was never properly recorded but it's still valid that doesn't necessarily change it being valid um we have a copy of it open and so does mass DP has it been sold I don't know I don't know well I can't sell until they close that technically so all right anybody have anything else on the commission on the 27 [Music] green oh okay moving on to Old business uh 170 Mill Street Doug you said you might have a little bit of an update yeah so I managed to get a hold of the engineering firm that um Mark pris has used mcari um just kind of I wanted to see to whom and where and what I should send any type of letter to before I send the letter I finally got a um call back today and so what I have been told was that they are in the process of attempting to kind of redesignate the dam as like not a dam anymore um whatever that means or entails um due to it no longer being active or live um but the Massachusetts Dam commission still yeah I mean so that is who they would be working with to do that um so if it's not a dam that means what happens to it so I mean it's still obviously near the water but I that's kind of where it you know becomes a bit over my head okay that's just very technical and kind of you know with dams obviously just it's you know it takes 10 years to do it again at least do we hear anything bad from the core Engineers M Dam safety oh uh Dam safety cor Engineers supposed to We were supposed to keep them informed I don't know I think that was on their the mass side that mass safety was working with them but not us no well they have a final say yeah I don't don't remember us I know I remember some of the the emails we sent we sent a copy to the cor Engineers yeah you should ask them if there anything if if you can call a dam not call a dam I mean that that's I I I don't even know what that means I guess so I that's why I'm kind of like I don't really know how to proceed from here um for Mardi say what the address was of the applicant no they you going through either them or a lawyer it was it was I guess what's the what's the address on the application uh just for [Music] curiosity the project address is just 170 M Street yeah but what's the appli address is it Mardi I assume they would be handling all the permitting and just kind of there they still involved well he's that's who he's paid to so the actual applicate no not not in this one um so I guess I just kind of wanted to bring that that piece of information before you guys um because a little petty and weedy um just to the extent that might change the angle of approach that you guys might want to take on this [Music] um I don't know if that's possible or if I I really don't know that's obviously very uh it's like a very specific thing it's a very technical what's the address you can send in a mail to the certified letters is that 128 South Main Street yeah that's what so it's owned by 1289 what it was that's the applicant 1288 South Main Street Corporation um and that's where you been sing8 me to be and what's the the uh tax note say for that that address who the owner is uh do it say there yeah so right now it's we're sending it to the owner applicant markas 120 South name and it's coming back that they just not accepting it or you come back is that wrong address [Music] I'm no I'm no um investigator here but if he's got his name as owner applicant on the on the John what he said 128 that's 129 on the reg stre 129 the 129 sou Main Street oh maybe that's legit it's going up this one says 128 okay that's the old factory right yeah is that address for the old Factor that's the address he put on his application so maybe he's not getting it cuz it's going to 129 I think that's where he shows all his equipment you other building there building [Music] with a to the 129 South Main Street Corp in Massachusetts Corporation with the usual office at 129 South Main Street Gardener Mass that's the old Denny manufacturing building Denny just huh yes yeah should we send a letter 128 I being serious [Music] um so any um so I guess along that vein what I have been looking to do was I'm going to create a large email you know cced gation DP um off Dam safety um Mardi and saying you know just kind of like as for our conversation you know requesting an update I asked him if he has even like a vague the vaguest notion of kind of like a date like get something submitted um you know I told them the sooner the better I mean if you can get anything that would be construed as kind of a intention to move forward please go ahead and do that it would be um very much appreciated I reiterated the October commission day um definitely said you know weing to have something by the end of the year um but I you know again reiterated the October um 22 date of original submission so [Music] yeah he's looking to it's a mailbox there but it doesn't say the number on it okay that says 129 yeah um why don't we send 11 128 sure I asked what the intention you recognize that in place yeah going forward and stated um want to touch the dam but he wishes to convert it into a more usable property and the way to do that I guess would be to re categorize the dam is kind of a no longer a structure structure and almost like part of the embankment physically to the extent that is possible um it's just going around and round uh on purpose yeah I so I I don't want it where I'm coming from is I frankly am kind of hesitant to tell anyone to touch anything over there because with it being so sensitive I don't want to say oh move that or don't touch that I don't want touch anything over there because I think frankly that would be the greatest liability for the contribution Commission because you know if it is structurally so poor right I say oh you know you put that fill in move that you know I I don't want to be the one to say that nor would I advise anyone here to be the one to say that frankly yeah the tax the tax card says the 129 South Main Street corporation owns 170 Mill Street okay [Music] um so D I asked you this before but what time they have a 2year time frame for it's really up to the discretion of the Conservation Commission but generally it is advised that a 2year from from the daid application y pending any showing of good faith so sometime that can be the last time someone showed up to a meeting on behalf of them whatever that was 2 years is from then um but it's 2 years is a strong cut off gener at the discretion of the Conservation Commission Now will this October be two years two from when it was received yes yes okay the date of filing is October we've gone through this with him before he's got a pile of degree that's been there probably 10 years that he's supposed to remove he's never touched it yet so yeah like I said he's moved without going on the property you can see that he's moved a lot of equipment so there there's an open area Bel of the dam yeah I don't want to no I can see I didn't I don't want to stop or to go ahead on anything with the D just like let someone if someone's problem D with the boards out it's extremely leaking 10:03 222 fin so at that point they can't really proceed anyway right well they're going to yeah they shouldn't do it they should right now shouldn't be doing anything right because mean unless they're rectifying an issue so we got to only wait four more months that's what I'm saying so let's just keep it on four more months but the problem is what are we going to do in four months send him notice that he's not going to live except plus there was that Schedule D safety came back that's over a year ago yeah and and that was you know they they never did any of it we take the last estimate that I have I have the two copies the last estimate was 1.4 million to fix it right yeah I mean take him off the agenda then if he actually does want to do something on we would not be able to obviously um but we should leave it on the agenda right that's what you're saying for four more months yeah not even I mean three mon in week it's October 3D all right we're going to keep it on I just don't know what we're going to do when time's up the time's been up on everything on this and nothing's happened well but they can't proceed with anything well he says they out there doing stuff well somebody has moved all the equipment was push below there and they moved the equipment out I don't know I don't know if they've taken any equipment out of there or not but there moved it out and there's an if you can down you can you can look from Miler you can go up where the uh where the um the um the cabinet cabinet places you look from there you can see it they moved it so there's an open area there and it's you whatever well I mean on this damn report it does say remove debris from primary Spillway outworks and approach and discharge a remove trees Woody vegetation so maybe he's doing some of that on on I I don't know I I don't know there's a lot of trees in there now and everything like that um the old the spillway that wasn't being used that's still filled with brick and he's and he's put a piece of Steel across it so you can walk out there I didn't walk out there you can say okay so we'll keep it on there I just don't want to be the last person or anyone here to be the last person who told anyone to move an ounce ofial on that property okay just sa the D's going to collapse yeah and if and you know both of those reports the the the last paragraph of those two reports they talk about uh loss of life yeah cuz if that goes it's get some real problems down stream it's out of our hands though yeah this point it's m m Dam safety is it's on them I can't I want to let like a damn engineer say what to do I don't want anyone to get in any kind of hot water issue God forbid you know lost of life you know and someone looks all right who told this guy to move this I if you ask me I DM safety just dropped it they haven't done anything they dropped the ball yeah I mean take you know 10 years to do anything with a damn frankly unfortun maybe I can't see where they where they say they can we won't call it a dam anymore so we don't have to do anything yeah I don't it's got a national ID numberal yeah I got it right here M says ramale pond dam national ID number Ma 01720 so this isn't just Massachusetts it's a national ID no that's that's Federal yeah that's what I'm saying they can't just say it's not so why don't we why don't we send an email to to to Army cor Engineers this goes this goes to um miss Emily Caruso Mass Commonwealth Department of Conservation Recreation Office of dam safety yeah that's I've been well we not get any away with them they probably they probably have out they need anyways no well you know what's funny is this meeting I should say funny but this report is dated June 6 2023 or June 24th so they've been and their deadlines have passed so I guess we just I'll reach out to her why don't you you got the national number of that Reg D reach out to the cor cuz they they the ultimate cuz this is all in their Wetlands you know this goes to the a river a river goes into the into the Birch Dam and so on and so forth and then you know eventually ends up to Connecticut just send meil all right I got two more things so what doug what is what are you hearing is the plan now that your last day is Friday right what's the plan when you're are gone who's taking over our email who's answering the phones your cell phone's being issued to who um who can I say who do I tell to go do this cuz I have another job to do that I paid for so yeah I the short is Trevor I kind of had the idea of in just like a personal recommendation as well as just kind of like you know it doesn't even have to be now but if you can get it kind of put in you know a month around I think it we should be good like just having like a conservation at Gard email you guys about that style email a lot of Tal cities municipalities are going that way just makes things easier it allows the email to serve as its own record um you know you don't have to tell people how to spell your last name and stuff like that and um you can just kind of T it up on the website and people can submit stuff I have that for the Paxton and I have you know emails back almost 10 years and it allows me to look back not just like paperwork but I can see like what was said and just kind of like you know jumping in here right catching up on certain projects the only source of the story you know I like to link up with you guys but like say if I need to just give someone a call and find out quick it was the applicant instead of going back and say all right we kind of where they going at here and being able to read firsthand like the only primary source readily available to catch up was Word of Mouth from the applicant after the fact um which can have problems I'm sure we're all away um so that's kind of something I've been trying to get the ball roll on I send an email to it CC Greg on that and basically said that's being afforded to Trevor yeah you got that as well so for the time being as well as that may be the case I mean I would recommend you know not to drop drop it I just think it's really valuable and just it's like a super easy thing that is not hard to do and is just so much so much more helpful um more about your cell phone that I don't know I mean usually they just have you turn that into it I mean I could uh I don't have I think it needs to go some to you because your number's out there then what's going to happen is they're going to get a new agent and we're going have to hunt down a phone yeah start all over again I can you know put a note on that and then what about your your your um your phone your desk phone is that being forwarded to somebody how's that working are you leaving a password which you don't need you know go over here yeah um so I've just been getting calls I've been verbally I've reached out to pretty much everyone that we have something open with or kind of are waiting on and I've been telling them informing them like I'm not going to be there to redirect any um things to Trevor or if they have specifically conservation related questions to you know you guys grg getting your email a couple times not you know I know you obviously play you're own so I'm keeping that in mind too not not posting your email on the city website um what I mean if you want me to tell Trevor anything just kind of like more than happy to just what you think well I mean as he had stated the position reports to him so I'm assuming he's taking over your duties cuz I can't anybody else on the board that's time right so I'm sure tror doesn't have the time either that's that's my concern so a Friday that next Monday next business day we don't know what the plan is no one's told us the plan yeah I haven't heard anything like either frankly everything everything I've said or done has been of my own yeah I know I know you can try I do I think everybody likes the idea of the email yeah yeah that's nice and that's normal if you have any other ideas you know you want me to get done out the door I'm you mentioned the website I tried to get that kind of straightened out as well I don't know if you saw that there's a um there's part of it on there yeah yeah that's okay fly been flying a mile a minute the past couple weeks um I just get worried that your phone's going to go unanswered and then something's going to happen and someone's going to go and say you guys didn't answer me within the L business days like we have to for our ordinance yeah I mean I've been trying to keep all that in mind as well I mean I can put it on the desk and you can dve really whatever is appropriate I have no quals whatsoever about doing anything any which way I guess okay um do you want me to ask see if I can do that just kind of yeah you can send an email just copy on it just I mean we can't just throw it on the desk and go well nobody has time for it yeah just falls on us again so okay yeah this is there any other I guess kind of tips or anything I've been trying to think of stuff kind of to you know make things a bit all no I think the only thing I would say is last time sopie left us a list of stuff yeah I want to do that too yeah and I know it was a little hard and she was a was a little confusing for her to do that um but she had a lot going on but it was hard for us to kind of pick up the pieces for the couple months um so if you could do that yeah I appreciate that and then um and I mean everybody you know stop in City Hall while you're out and see if there's any notes on the table for us just to kind of keep things going but I honestly don't know who's going to even publish the agenda for the next meeting I was going to try to get one out on the way out July 8th I mean I should all the deadlines should be clear for that what what Friday is Thursday Friday I don't think they publish it 27th or 28th yeah I was going to see if I post one Advanced you know might be like 11 days rather than 10 well it says yeah yeah maybe it'll be you can usually they're pretty good if you already have it posted just need to edit like one thing just kind of okay doing that so I'm going to try to get one more posted on the way out appreciate it um probably help out with that yeah um let's see what tror has to say how it's going to roll that that needs to be discussed of this so it doesn't happen again I oh well I was the firm which is with not not to reopen all that but the firm with 170 Mill Mardi they're also the mea storage as that of them them today too and they're you know kind of next month looking to have something kind of submitted to that y um M's they do a good job yeah no they did the they did the golf course pipe yeah that was good yes I visited that site the other day too took pictures of that you know have rip wrap down down to almost the uh Crystal Lake Shore [Music] um the trail they released the hold on that the other day obviously I haven't been super involved in that recently but just kind of letting you know they're moving forward on that because with that um I've notified everyone involved with that that I will not be the contact of that going forward um they you know time Bond will take a more forward role in that going forward um what else well thank you for everything you've done for us I mean short but I know Duncan's tough and he's pushing you off the door keep it good touch yeah yes absolutely thank you anybody you have anything else no I'm trying to think I mean I'm sure I'll have something else kind of in an email maybe later this week but off the top of my head that's it it's just about it right now okay anybody in the audience have anything hello goodby what's up it was me on the phone oh okay yeah all right someone like to make a motion to end tonight's hearing I'll make that motion so like to second that motion I'll second it all in favor all right
