lonard with lonard Consulting Service uh uh I'm working in conjunction with uh McLure uh engineering uh for the uh design and the pering for the the uh Forge pond dam for which you receive some grant money from uh our fine state of Massachusetts so anyway uh I wanted to bring you up to date actually CHR invited me to bring you up to date uh I I unfortunately up until uh right now I've been pretty well pretty well uh uh confined to to the to the house I've had foot surgery on on the right foot and also knee surgery on the right foot so it hurts yeah the the doctor the doctor finally gave me a permission uh last week that I could I could drive short distances so I I consider this short distance I'm only in chicke so anyway but you for coming we've we got off to a rough start mainly because of my my issues with my my feet and and I was hospitalized in the process uh uh so things were were not moving as quick quickly as they couldn't but as it turns out the the state originally had a a requirement of of having the work done by June 30th of 2024 uh and they were given the the grant monies that were were distributed late in in 23 and uh project of this size didn't you know just couldn't be done in that short shorter period of time they they were what they did is a uh with a request going into them was to to extend the period of time to to June 20 uh June 30th of 20 2025 so so it's given us a better uh shot and and the dry weather has been very helpful in things like the survey I've given you a set of the uh I guess you want to call it the Draft plans for the project uh the uh basically just to go through quickly go through the P Pages um the first couple that mean heck of a lot first first one is to show you where it is I'm sure you know where where it is the second one uh is uh the existing conditions and then all the black dots that are on there are the uh for the uh Wetland delineation which is required under the chapter 31 of the Massachusetts general laws for the wetlands uh the uh the third page uh is identifies staging areas and and uh places for for storing materials uh for the contract the key page is Page four uh right now in all the uh am I getting the paper oh the paper I'm sorry background noise the uh the the current situation there is the dam is is judged as poor condition by the office of dam safety and they've said either either fix it or tear it down uh and uh uh I guess this this is in the direction of fixing it the the biggest problem is the uh excuse me the uh uh uh embankment and wall on the north side of the dam uh where there's a somebody built a rubber tire retaining wall at some point and and uh uh the dam is kind of a hodge podge of of construction there's a a small part that's stone masonry another part that's concrete and then another part that's uh basically on Bedrock uh the uh uh the the intent here is to uh stabilize that uh north wall so that the house doesn't fall in and the garage and uh make improvements on the project in different areas where there's uh deficiencies in the uh in the in the concrete and other things the The Proposal that's here calls for a concrete wall along the property owners uh uh where the house and the garage is and then using rip wrap for the slopes beyond that on the south a a short section of concrete wall and then uh uh basically rip wrap uh down to the uh the street culs uh the dam the dam is currently 82 82 ft in length this that D length is going to stay in place uh the hydraulic analysis indicates that that uh uh it will be okay but there will be a requirement where where if there is going to be a major storm that the the lowlevel outlet which is called the Dyke uh is activated and and water is is passed uh now the the the I guess the there are options for the wall by the property owners uh uh facilities uh either going with rip wrappers or that but uh concrete was chosen as being the uh I guess the uh the best solution and more permanent solution and the dam the dam will be rebuilt completely across of all of concrete complete as opposed to a the hodge podge that it currently is uh meeting the uh the state of Massachusetts office of dam safety uh uh requirements uh these these plans are preliminary uh they're full review uh if there's any comments by uh you know any parties involved in the in the uh I guess the effort to uh more than welcome to you know look at them and and and act you know respond to them the uh the next page is say uh five five and uh and six uh basically are dimensions and and details on the concrete for the uh structure the the idea is to use Mass concrete walls uh as opposed to reinforced concrete which would probably be a lot more more expensive and then and then rip wrap and uh uh crust stone for the the slope uh conditions uh that are there uh one thing that uh came out of the uh uh survey that was done is if you look at page C2 uh right at the right at the water line there's a property line the proper that property owner that uh is on the North side owns down to the down to the water line on the uh uh the project uh uh so that at some point a either a taking would have to be made or a uh en easement taken for the for the purpose of construction and maintenance of the of it I'm surprised the uh the officer Dam safety didn't issue notices of deficiencies uh to two parties as opposed to you guys uh but I guess they they said ah he t t gry's they're they're the ones although I've run into many uh many situations where there are multiple property owners that that the the state doesn't know about and they uh they uh uh the state will will do research on own for property if it's not identified uh one other one thing that uh I brought the curse at one point is there there's you know some buildings there that are uh abandoned and uh the thought is that that whole area that you see on page C2 uh the buildings be demolished and and removed and graded uh there's there's a shed and then there's a looks like it used to be a Horse bar of sorts uh and uh uh that would uh that that those buildings would be taken out the idea too is all is is to clear and Grub the whole area uh to get rid of all the root systems and have a a uh a maintainable area that can be done with like a farm you know farm tractor with uh you know a mower mower deck either under under it or behind it uh as far as the Dyke goes um the uh I I kind of like a lot of history and and that operator for the low level outlet for the water drains out is kind of nice uh so my thought is the contractor rehabit so it gets gets into a working condition and then be be used I mean it's a very very reliable thing a rack and pinion type of situation uh uh levers and GE gears are the are the uh the way of operation and uh it's in good shape uh so why spend you know a lot of money putting a a fancy gate valve in there and modifying the structure when when you can make use of what's there and and the structures that are below grade uh I guess were replaced or repaired not too long ago I mean mean you know in the last 20 years or so uh and they're in pretty good shape so very little will be done for the for the uh uh Dyke area except on the downstream end get rid of that hodge podge of of channels and and stone work that's there and make one channel going to the Culvert U as an improvement that's it's kind of the uh the situation where where if the concrete uh proposal is is okay we we can move ahead with developing the specifications and uh doing the uh the permitting which would is is part of the process uh that the uh the state is is funding so uh I guess we're at at kind of a a transition Point uh we could we could move ahead with it as concrete walls uh but if there's you know some other ideas other changes that somebody would want uh we need to do that and then get the uh get the permitting underway but uh uh the the uh I guess all the permitting needs to be done by the uh the 30th of June of of 20125 uh which is is is doable and uh uh we're far enough ahead there there's not not a lot of high high tech things in here other than you know the guess uh let kind of summarize it thank you um can I just ask you a few questions so when you say the um north side that is going to be near the 265 260 on C2 so that's where the tire retaining wall is that's the one you're talking about yeah yeah okay yeah and then um when you said the shed needs to be taken down are you talking about the woodframe house behind that or that's somebody's house right there's there's a long there's a long building in between the the Dyke and the uh uh this the actual stream which might have been a horsse bar or something and then there's a there's a shed up above uh the the doors and windows are are gone just the concrete structures are sitting there and that's not on the map though right ex those two structures aren't on the map they're they're vacon yes yeah right but they're not pictured here on the map yeah well you're on on the on page C2 you see that long building there okay cuz this is the entire routine and then there's a shed up on on the Hills kind you see how we also this one right this one right but we also do have another tire retaining wall over here I don't know if anything there is of of significance with a historical uh uh folks but uh um you know I I I would imagine those buildings are not are not of any any uh use or concern just here no no that's that's just that's uh the uh the property owner on the North side this and then there's a shed here oh yeah yeah in between I'm sorry so I was in the right spot or no no you said door right here and here okay okay which means it's this one everyone see the conrete W yeah okay it's a major project when it comes to construction that's another another phase uh uh the state has their their uh Grant Loan program uh above probably the first of of each year they they accept uh uh applications for for uh you know either the pering and design together or or the actual construction they they they usually put out an announcement as to you know that they're available and and uh but anyway that that's that's that's the next thing Beyond and you don't and and you don't it isn't just a one-time deal they they do it every year they come out with the money every year so it's not a dead drop dead situation to to get it you know get it in the first of this year um if if things aren't quite ready if if they are you can but uh uh every every year it rolls along unless unless the new government changes the whole program we never know with politics so as of right now um you guys have this draft plan and then the pering has to be done by 6:30 2025 so the grant we have is for the planning phase sure so the grant we we currently have is for the the gr the grant you currently have covers the design and the permitting but but there is a 25% uh uh cost sharing that the town would have to do or has to do for the for the uh uh the program okay that's for this current Grant and the next grant that we want to do is 25% to and I remember last year when we were looking at this we had three options right Chris and so the concrete wall was one of them and then I don't recall the other two options because I think one was demolish yep one was repair and one was replace so we chose the replace option which is what Dave has been talking about take all the various retaining walls the tire R WRA all that and turn it all into solid concrete I'm not sure what you want to do with the property whether you want to turn it into like a park or or something but the idea is to again like I say clean it all up get all the the the root systems of the of the you know the the weeds that are there and the brush and and then make it mowable so that whether it be public or what would be a decision you could make I I don't think there's any restrictions uh uh from the state and and what the use is uh uh just uh maintain the dam and operate it accordingly if there's any kind of imminent storm do you have any question to think no I think I think concr the way to go it's yeah it's permanent uh it it'll uh it'll it'll keep it keep the slops in place uh uh and uh you know if we get hit with one of these uh uh I guess unique rainstorms uh it'll hold hold up uh r now they you know I I've for as long as I've been in grany and around I a couple of I lived in grany for a while uh that I've never seen a a major overflow at that at that Dam at all it's all the Watershed apparently is it buffers the the storm enough so that it doesn't create a big problem but uh uh you never know with with today's uh uh you know weather conditions that we seeing that you know we could get we get 40 in of rain in a half an hour which that would change things quite a bit and I think the biggest concern for the people living around there too is that they had shallow Wells so they were concerned if it got taken down what that meant for their Wells so I think it's definitely important to uh replace it thank you very much for coming in and giving us their um thank you very much for coming in and letting us know where it stand I apologize my my hearing is uh is also been affected by my for some reason or so I uh I have to ask to repeat it than that's fine me all do it's a bummer getting old too though okay if I you know I can come again at at another time that we'll move ahead with the concrete uh uh you know proposal and and uh get get the permitting under underway and I guess get to the next phase I'm not sure You' you get you'd have to put the the article for the you know the project to to town meeting at some point and again we we have to find out from the state I know I know they they offer certain things um you know part loan and part Grant or or all Grant or something but at the time we you'd have to you know find that out so you know what the financing would be thank Commissioner hello we take a seat do you have the figes yes we do we do what I have uh tell me if you don't have it I have an Excel sheet with the compar since I have proposed schedules there should be three yep building Plumbing um I'm sorry building Gas and Electric and then I have the current schedule so we have the building y yes yes we have all of them good so you want me to jump into a quick rundown or you yeah a few question please yeah we're just trying to understand um the difference in cost that's all sure so um you know when I when I stepped into the office I had a number of sheets and wasn't really sure um if I had the most updated ones but the best I could find is 2014 and 2019 so 2014 for building electric and 19 for gas so about 10 years since the building was was looked at and with the flat rate you know everything goes up the cost if it's a flat rate it probably ought to go up every 10 years or even every five years instead of you know a huge increase in 20 years so it's just taking a look at it the comparisons are of all the communities around there's quite a few of them um some of these are going are proposed to go down and some to go up and it's really just an evaluation of the cost of service so uh for example tents is probably one that's it's a it's part of a temporary structure $150 that's that's a lot for um a single inspection and that sort of probably discourages people you rent a tent for $600 and the firm $150 doesn't really make a lot of sense so we want to encourage people to get the permit get it on time um so lesser amount would make more sense to me um so what's the old one and it's also about streamlining it so if you notice you know the old the old fee schedule is lengthy and broken down by a lot of categories a little bit Antiquated and the new the new one is just probably only 2/3 of information um another change would be just wrapping up no change to the building permit fees the basic ones uh they would charge for certificate of occupancy I don't feel like that doesn't make sense you just is charge for the Bild perit fee at the end of the project they don't have to come back in and pay more money per certificate it's just it's wrapped up in the building permit fee again to encourage people to close out their their permits get the certificate uh Tempco is a proposal that's a difference um and that's that's at the end of a project where people don't have everything put together commonly nowadays of paperwork so there's nothing unsafe about occupying your home 30-day certificate but an incentive so that they don't sit on it or never come back it's $50 every 30 days uh for residential that one's not on this paper I noticed it today uh 150 for commercial but for residential I would propose 50 that's the one thing that's not written in the paperwork you have so it says 50 to 100 you're on number seven right of the letter that you sent us where it says increase certificate of inspection that's different certificate of inspection is not the certificate of OCCC okay so the C I was looking at the letter sorry okay um yeah this s inspection that's that's a uh those those are timec consuming there's a lot of paperwork involved um preparation before and then going and actually doing the inspection in no way is it a fast thing um so that that should be increased and you know to think on the extreme end flat rate is never perfect some some places are very small but then you have like the MCU McDuffy School that's a half a day of walking around you know for you know for one one inspection but the C is what I was referring to before that is temporary stiffing the lockum see so so we would be adding that to the sheet that's the only one that's not written you know where it says residential one to two family it's just something that again offers somebody the ability to get often it's because they got a mortgage or a they have something hanging over their head that they need a certificate of occupancy for and we can give them that while they do their last things it kind of helps them out but then it doesn't have them dragging on and for the commercial end if if there's say site plan r view conditions from the planning board and they can't do something at the end but they want to get occupied a lot of it's weather dependent they could have a temporary Co but as an incentive to get it done and come back um from the town's uh you know restrictions or or uh conditions then they could be they could pay for every 30 days if they want to continue it on probably the only other one that's new that's is a letter of verification and determination that's something that um I've done for years it's it's a request from somebody I shy away from it most times um I don't give people any advice or legal advice but if they want an official on letterhead uh something sometimes just it's zoning questions then I will do it in the proper way but they're going to pay for it it's not a public information it's not giv me a copy of documents that's that's just free just give the documents but if they're looking for some kind of determination uh and it's usually as an example it's going to be people big commercial buildings either going up for sale uh MC actually was a recent one that this mortgage company wanted a full determination of all the lots of land and the zoning on letterhead for free is here's a copy of the zoning you figure it out with your own attorney you know but if they want it actually put together that's time consuming it's careful language so can we um I don't know how you guys are feeling that this there's a lot of fees on different pages so do you want to go through the first and go through what he's proposing sure all right so we have number one increase from 50 to 60 for a flat rate fee for Windows Roofing wood stove Etc reference sheet so that reference sheet is the proposed one that you're showing us here the Excel sheet okay this one yes that's just a table you can read it yeah and then that this one also has the comparison to the other towns as well that's right okay so if we look at it's the fourth column for Windows insiding on the Excel sheet very tiny but um it looks like we are still cheaper than the other towns besides Southampton right hady and what does it mean by 10 by 1,000 10 it's a valuation it's the $ per 1,000 square feet of um market value of the work okay so the project is 30,000 it's 30 times 10 okay but you're just proposing a $10 increase for a flat rate yeah these it's grouping them together because just again for Simplicity all these things would just be under you know a roof of 60 siding a 60 insulation 60 it goes on below that solid fuel appliance which is wood stoves pellet stoves demolition just 60 and now this inspection is going to vary based on the size of the house and so forth right so we're just doing a flat rate of 60 instead of going based off the size of the project right I me it's not perfect you know somebody could put in 100 windows but you know it's it's still just one stop at the house right okay I'm okay with number one you guys yep with then number two is decrease in temporary structures from $150 flat rate to $75 per 30 days most of these are permits for tents that are only in use for a few days they are a single inspection um so I think one of the things that we were a little confused on is the 150 flat rate they can leave up unlimited time y or do they have a certain amount of time for that structure to come down once inspected I don't know by the zoning if that comes up the building code restricts temporary structures uh because it's not temporary after Soo right there's a test of reasonableness and often people are given a lot more than what's allowed so okay yeah so we are decreasing it but we're putting a 30-day limit on it because anything more than that would not would not be temporary it forces people to also say hey I'm going to put this 10 up and it's going to be there for X number of days right so you know so that they knowled that it can't be there for 6 months 9 months okay I don't know people that keep them up that long or they shouldn't anyway is it normally 90 days for temporary situations though it varies you know the other you know the other thing here is and I and it is anything over 90 days I would just use the the um say a temporary trailer when somebody has a fire at their home and they bring in these things in R them off they're allowed to have that for a year it's still the temporary structure but it's a year I would not use that by definition it's temporary it would be more of a permanent but you know and we go by the other fee schedule which is just what's the value of that minimum fee whatever okay do you have any questions on that one p are you suggesting this be Lou than 30 days for Te gr well that's what I'm wondering right I mean there are there are some things that say temporary is 90 days on in code if I'm not mistaken is that correct so rather than 30 days should it be 90 days just the question I mean you're suggesting just because it could be either way there's some other things that I haven't come across it here but some people do um I mean like a tent could go to 90 days but most people wouldn't rent a tent for and leave it sit down for days obviously right so um like temporary wiring is like usually 90 days right for like a festival or something like that if people are running so I don't know if 30 days really covers that aspect of it and see any of the other towns doing 90 days I see them doing 30 or not putting a time frame which at some of those just be going by building a lot of the towns don't have restrictions well they don't they don't have a fe schedule that covers certain things so they just default to the full value they're not getting anyone a discount sort of thing right okay they're not considering them separate um but it could either way it's just a matter of this is my my opinion what I think works best is is just for anyone it wants a temporary thing it it makes them it holds them on you know to it and keeps them honest so whether it's a big Conex box for moving you know or you know there's there's other examples where you plop something down on the yard or property that maybe the neighbors don't want to look at forever okay that they have to put in I give me the description of work and tell me what you're going to do when it's going to be installed and when it's going to be removed there is restrictions on some others there's not but even for zoning building goodwi I'm talking about good is there be50 someone puts up a tent is there an inspection right you oh yeah absolutely supposed to be yeah so every 30 days you do an inspection it's a t up longer I would be at 30 days but at 90 I probably wouldn't because those are not intended to be well asking because if if the limit is 30 days then why we charge another $75 we what we be doing another inspection for safety reasons if they say it's up a 30 we would make sure it's down but if they say it's up no there wouldn't be another inspection for 60 days it's here's the fee for the for the food on it's monitoring it it's not you it's not another inspection again currently it's 150 for whatever whatever restrictions put on it okay so when you go and inspect it currently right now it's 150 as a flat rate and the Restriction is put on it based on that tent and based on what they're using it for yeah okay I'm not aware of I was going to say I'm the only one who hears that ring right it was for a while I was here for a while but I was hearing things all right so um as you were saying Glenn if he's if he's not going to go back and inspect it until 90 days then it should have a 90day limit that's that's what I'm thinking yes I mean if if not if we're saying that we want it to be up for 30 days and then it's for safety reasons we'll go back and inspect inspect it make sure make sure it's okay then i' say just go the 90 days if every 30 days yeah that makes sense do way so do $75 per 90 days for that one that simplifies it sure good all right and the next one is um number three to increase $100 to $120 for inground pools all inground pools require two inspections that makes sense you're going back twice for that one B that yeah are you okay with see yes okay okay all right number four to combine multif family residential fees with commercial there are one and the same for administration of the code and then what fee would that be that would be a residential right here so all of these if it's a multif family would just default for the commercial is what you're saying right and the building C they're no different it's all the same um there probably was a period of time when when three unit homes and four unit homes were were built and and in previous versions of the building code they they had different requirements so they were more I guess they they weren't as decentivize but nowadays you put in a three family home you get out a suppression system um they're completely commercial so because of square footage just the just the third unit and know and above and and so it's you know I don't see the minimum fees were the same anyway so I don't know how yeah I think it was just the value of the um where it's on the factor list yeah it was just that instead of $7 it's 10 that's true Renovations were 150 as opposed to 100 okay and you've got another unit to inspect so that makes sense yeah at least yeah I don't I don't I haven't seen anyone build a three family home in 10 years you guys okay with number four too I am right all right so number five remove $50 additional fee for certificate of occupancy and that like you were saying was because it confuses people it's part of the building permit process correct that that's not an uncommon thing a lot of towns have done that at the end you pay more money for the co I I don't really see the purpose people already paying for the billing perment they're paying a few thousand dollar in Fr home sometimes it's just you want to incentivize them to close the project out get the CO get it to the tax collector you know and not give them another reason not to come back any questions on five no right number six increase inspection reinspection fee from 50 to 75 and was there a reason behind that one that's just the cost I mean really it's got the direct cost of service if you're paying me to go back um there's probably no inspection that doesn't take at least 30 minutes I mean somebody drives to the other end of town from here anyway is is a a 15-minute drive to the far end where they they happen to be building some homes um and I don't ever I don't know if ever charged anybody a the inspection fee on the first failure it's really just like the people that are continually just not getting something right or in their laxity days schol or they don't show up so it's like the reinspection didn't show up well now you can pay the fee come down here and pay it when you do then we'll go back home I'm okay with that see a point there U what if you did like a a first second third would you said you know we like you don't do anything the first time pretty much it's the second third time which just people are feeling the same inspection over and over again right what if we if if you're trying to put some I guess teeth into it why would we we change the weight a little bit for first and second third inspection you can go 50 75 and 100 I hope not to get up to 100 no but but but to your point it it it um it makes the awareness that more important for the person to get let's let's get it fixed let's get it fixed right because if we have do another inspection it's going to cost us more money yeah I can see both ways um i' I've dealt with that with with a lot of you know leveled ticketing kind of thing First Defense second defense it just in some ways if it makes it more complicated it's harder to follow everybody that's the only reason why it's not that has lots of Merit and there's lots of people out there there's one property I've been to four times now for the same thing and the contractor only showed up the first time and hasn't showed up since and you know that's that gets obnoxious um but I still you know I'm the side of all right let's just get this done you know get to the goal line but to charge them the one time is I think enough you know to give them a reason to go you know enough the second time you mean 50 and the 75 okay so you would be referencing like um if somebody had insulation done in their house or something like that not like a building inspection because you go through those standard inspections anyway correct right wa in this case it's a garage Shing a new one right and they got to the installation stage and cannot find a way to do it right so okay you know it's like all right you got to do this specific thing lay it all out and you go up and they it's like they don't they don't do it and they didn't sell okay okay okay so it wouldn't be so much as house inspections for new homes because you're already doing that based on the B so save it for every second in additional inspections after that so and pay 75 for that second inspection and then if you have to go back a third time do they pay another 75 they could they could be asked too yeah so again I feel like the one is enough incentive for some okay want to kill anybody you yeah right but my concern is that we're consistent yeah that we don't have someone coming in and say well he didn't charge him for the second time he came up but he charged me right so I think if we there something set that consistent you charge and charge regardless of what it may be only not charged I'm consistent but if you want to make it in wrting consistent you just put the first failures free right but that that's how that's how going back see there's everyone gets the free pass you know for whatever reason but you know free second failure to show up is a good reason to and additional so you got go back to third or fourth or a fifth it should be additional so we'll say the first is 50 um for the inspection and then if he has to go back the first failure is free right so if they failed the first time that first the second time you had to come back is free and then after that any additional $75 that's fair okay point someone comes out and the building the build doesn't come out but they have to be in charge for it so right yeah let's see first offense not free don't charge yeah I mean to my knowledge you know any inspector pass they come back the one time out of courtesy right so I think we put in writing that's it don't can say anything different yeah firsts is no charge not free right okay all right number seven increase certificate of inspection fee from $ 50 to $100 these are each an hour of office time and 30 minutes of inspection time at the very least they can take four hours for one inspection and that's what you were talking about at first when you were talking about um some houses being bigger than others right and the jobs depending on what you're doing yeah the CIS are complex they they require a lot of paperwork and a very thorough you know the the checklist has I think about 80 items on it okay everyone okay with seven oh okay was seven yes okay then number eight reduce trench permit fee from $1 to $75 these are not common and mostly paperwork filing any time you reduce it fee that's a good thing right as obviously there it's not you know cost there probably five I I've I've been looking at the past records and there's probably an average of five of those a year they might be being um filed with the DPW if they're on public land and that's a separate thing but these are the ones on private land or or a uh hybrid of both um but again something you want people to encourage people to do it follow the law but um that's a $100 is a lot for if you just think of running a 10 10 foot trench to put a pipe in seems kind of already get a permit for plumbing or something else the reason they're digging the trench yeah I'm okay with that abely all right so sheet metal remove fee from residential it is considered part of the building permit otherwise it creat confusion that makes sense and then remove fee for number two from a flat rate of $150 to $10 per thousand by value with a minimum of $100 150 is high for small changes and not sufficient to cover a new large building requiring a lengthy plan review in multiple inspections okay and I mean you explain it on the smaller end and you explain it on the larger end so it makes sense yeah it's again to encourage people to get permits it's just $150 a lot if somebody just puts like a hood in in a kitchen you know just that's a one single inspection or they they a lot of examples of commercial work that require permits but it's just one unit they shouldn't have to pay the higher but then if somebody puts in a HVAC system in I don't know a giant building that's a lot more so that's where you're asking to go $10 on a th000 according to the project $100 minimum Y for the smaller jobs and then for the larger jobs would be based on based on how much how many units and stuff they're putting in right yeah based on cost yeah yeah Bas like the building permit um any questions on that I I guess I like the flat fee $150 I guess sticking with something up to this certain amount is this cost anything above that is additional because this is I me talking about building homes and things like that too so and you putting it on the value of the not the size of the home right this is the this is the schedule for the town is going by value it's already in place I'm not particularly a fan of the value system as opposed to square footage but I'm working with what is already here and understand that's what's bother of me because as values keep on increasing so is this right and that's something I could definitely hammer out in the future you guys want me to because I agree if somebody puts in a high-end boiler why they charge more for the one that pays for the cheap one that's $1,000 at the hardware store right so if they put in the 15,000 they should be paying more incentivized to have a better piece of equipment because the inspection is always one inspection so I I agree with you 100% but this is for some reason the most common Fe system in the in the uh State nowadays it simplifies it but if it's a new construction home though isn't all of this covered under the building permit or would they have to get separate permits for it sheet metal well say they're putting in the HVAC system like it so that's there's no additional permitting that that's that was a mistake in here so that would be an existing house if they're putting in an HVAC system or something they' get a Golding permit they wouldn't get a sheet metal permit so they would fall under the um the building permit schedule it's already there and chances are there'll just be the minimum fee you know they're not going to they're not going to get to an amount that that goes past the minimum in most cases what would you consider an an average cost if someone had to do that to do an average system not a expensive you know an HVAC system depends on what they're doing if it's if it's a metal work anywhere between 10 or 20,000 if it's a full brand new house it depends on the of uh the typee of equipment that putting at so still kind be the 15 range right $10,000 project yeah 25 so right so you would have if you're doing renovations that it would fall in a renovation $7 on ,000 so $7 time1 is $70 and if it's double that for $20,000 pay 140 if they got the most popn system so you're still R but like I said most things would be probably just you'd hit the $100 minimum you know they put in that $122,000 worth of work and they would have to pump it up to 100 bucks yeah and those are usually two inspections thanks all right electrical and gas is to increase to reinspection fee from $50 to $60 so right now the new construction motivations is 80 any work that requires only one inspection is 60 so if you go back a second time is what you're saying increasing from 50 to 60 they're different as a as they're contracted they're in their own world um they're chargeing re inspections immediately at reinspection because that's how the town is p more directly so this would be you know again everything's increasing um these these guys here there's four of them in total uh they're doing this on the lower end of the cost scale and that's good B last um but I don't think it'd be tough to find people to work at these rates okay so just staying a little bit closer to really people who are going into inspect they're they're getting a cut of this yes I'm right followed what we've done this is the third time since I've been on the committee that we had to have a member appointed I didn't know about posting we've followed the same process where we've mentioned it at um a number of our meetings we've talked to people I mentioned it at the opening of school this year at convocation I've hit up people on the sidelines of every sports game that I've attended um talked people I uh you know I think Mr try just walked in and I asked him if he knew anybody at different events so we really and I know my members have been doing the same our previous superintendent was doing it I know that our interim superintendent was doing it so it's been out there I mean this position has been vacant since last March hi um would you like to tell us a little bit about yourself to it um it's my least favorite thing to do but I'll give it a try so I have recently moved to grany um moved in in August with my daughter my son-in-law they're two boys um we're near completion on a new home here so we're current living on Pleasant Street um I sered I lived in Hatfield for 30 years I served almost 10 years on the school committee there my original um and when I say almost it's because I was appointed originally to fill a vacancy um my term ended the last term that I served ended in' 09 um and I'm kind of a school committee geek um I actually work for the Massachusetts Association of school committees as a field director and what that entails is uh sort of my territory is hampen Hampshire Franklin birkshire counties um and I work with school committees on any number of areas of concern uh training Consulting assisting supporting um I worked for 35 years almost 35 years I got the almost in there a lot with the directly with the hoolio school committee um until of course receivership uh came into Julio and then it was a whole another world um I retired do I thought I could make it through receivership like I was determined because um I wasn't going to let that sway me but at the end of the day man oh man did it sway me and I retired I was retired for less than a week when the Massachusetts Association of school committees reached out to me and asked me if I'd be interested in filling um what they anticipated was an upcoming vacancy um so I have a ton of school committee experience one two um I think that if you're going to live in a community a small community especially where folks depend on others to come forward um I'm sure there's no pay for this position although I never asked right um no so I'm sure I was sure of that all right because there was none in half field either um you need folks to come forward and step up and sort of do good things in the community where you can I know I have an awful lot to learn about Grandy um but I know an a a lot about school committees and the work that they do why they do it and how they do it um I'm hoping to actually retire here um in the not too distant future and I think this be a great opportunity for me to stay connected to folks in the community meet more people um and as far as I'm concerned and again I did say I'm the school committee geek um I think it's some of the most important work you can do in a community because it affects the lives of all the young people who live here right your schools are a reflection of your community and what you value um and so even though I new to Grandy I've heard about it a lot of times um and I figured I'd throw my name in um anything you else you'd like to know about me no I think you did a great job introducing says my name is Alex Frank I live at One Jennifer Drive um so when the wieh housee is playing music the windows of my house ran I can hear the thumping base sound rattling the walls of my house and objects inside for example some of the furniture vibrates and this is with the windows closed there are many weeks that I'm on call for my job and I need to sleep during the day some of those days The Wine House is playing music during the daytime and I'm unable to sleep this is live band music and also DJ Style music music is also being played on days when there are no scheduled events there are times I have heard the a crowd of people yelling and screaming l at night thank you for your time it's from Alex um I'd like to read my saf now yeah so I've come here tonight to speak about how The Wine House is affecting us um my family moved here in 1997 we wanted to live in a residential neighborhood where we could enjoy a quiet country setting we settled on Grammy for this reason it was that way until the Wine housee opened you could sit outside you could read a book you can open a window without feeling like you just entered a nightclub I don't want music pounding through my house for hours there are live bands and DJs playing most Fridays Saturdays and Sundays this is not how I want to spend my weekends I don't want to call the police on a neighbor but we have and the response we get is that he will be wrapping it up soon only to have it continue for hours during a select board discussion for wine housee permits a member of the select board said keep in mind Neighbors in noise another member said that knowing Mr trumpy it shouldn't be a problem well I'm here tonight to tell you this is a problem and it has only gotten worse it seems unfair to his neighbors that this can continue this is a residentially zoned piece of property with a stop order cease and assist issued June 25th of 24 the stop order states that conditions were found that amounts to violations of the town of grany bylaws the RS property Zone does not permit this type of use I thought this would get resolved quickly once the stop order ceas assist was issued it turns out a stop order doesn't accomplish much if there's no way to enforce it we have been told by the police they can't en force a stop order ceasing assist we have been told by the building commission that he can't enforce it either as a taxpaying citizen where do we turn who is looking out for the average person just looking to enjoy some peace and quiet after a long work week I hope the select board listens to all of the neighbors who have spoken before or have signed a petition we strongly urge you to enforce the stop over ceasing assist and to not issue any of these permits to The Wine House moving forward thank you was opposed to that right off but that building was first design just for storage so he got that at one point Mr Trump he came over to discuss his intentions for the winery uh the impression he gave was that he was going to do a maybe a food player or a violin player uh possibly there was no mention of live entertainment or rock bands or food trucks all these things are disturbing to our neighborhood's quality of life is what's going on here um I have the same problem I I think I spoke the last time I'm not well and I have a hard time with all that going on too so just so you realize Town Grandy I sit outside waiting for my daughter off the bus and have been recently noticing an established New Road off of Morgan Street now uh that is accessing The Wine House that would be my first concern the second concern was I was verbally attacked yesterday on audio and video by somebody using that roow that's a small synapse and maybe someone would say that's first rights but that was an aggressive attacking statement that was made to me which we know falls under a different leek the music has not stopped I cannot speak directly but I can tell you a family member met with an officer which was at 702 he was supposed to have been wrapped up as a former person said today around 8 I actually sang lyrics to two officers the clarity of the music and the disturbance there has been a complete breakdown of respect between everybody here in Grandy in this location above and beyond a second trailer has appeared a construction similar that people build tiny homes has now appeared on the property in additional to more fencing I couldn't tell you how far out I would say double of what was existing there are three different Vehicles accessing this road which are directly cross from my daughter's room and we know there's no gate or a public uh uh G rail in place uh uh one of them is from New York uh the plates of course are recorded because the person verbally a direct attack verbally on me yesterday and now we have a second trailer on there and the food truck I have personally already contacted them uh to let them know this isn't matter in Grandy WWLP is now notified of what's going on here in Grandy we have a very black and white ceas and assist and everything's been disrespected from your level down to my level as a new person here in Grandy and I am not here to agitate I am here for respect of everybody in grany from everybody's base value of Peace Quiet safety are their licenses are their handicap accessibility are are there special permits and it has become draining on our environment here and that is sad it is sincerely sad I the the whole idea of uh asking for extended permits or new permits I couldn't even understand that if the first permit was never respected and I feel more activated would be my word not aggravated to further this outside of this Township of Grandy we have to have an answer month after month we have so many other things to address not even just the grand gravel pit or D frin or a school system or lighting but this whole section is being devastated religiously people who are moving in and out of this properties people that want to come to Grandy I'm begging the town of branding put these rights into place to see an assist in whatever parties need to push for it and have it recognized and upheld I me an opportunity to speak I am in I am here in regard to the wine housee Winery my husband Keith and I live directly across the street from the winery and have maintained a residence at 11 East Street for 34 years my husband was not able to come tonight he is not well at this time and he sends his regrets but stated that I may speak on his behalf as well we have been seeing and hearing a lot of discourse regarding Winery and felt that the select board should hear a different perspective I would like to state that the rary is a clean well made welln establishment and we appreciate the entrepreneurial Spirit of this relatively new Endeavor we think it's great that people can come to a very lowkey chill environment and enjoy a glass of wine while enjoying our Town's Beauty along with some occasional live entertainment I'd like to mention that when Jim trony first opened the winery he came to us and told us on numerous occasions that if we had any problems whatsoever to come directly to him and we would take care of any issues or problems we had he has stated this repeatedly over the tenure that the wiary has been open I did not know we did not know Jim trony prior to this to date we have had no issues I know that Jim would be just as open to nearby neighbors if they had given him half a chance Jim trony is very conscientious about traffic noise levels and he strives to be respectful of the neighboring homes he brings his he brings in live music excuse me oh goodness I'm sticking B in live music that ends well before his 8800 p.m. in time in that regard I would like to state that we cannot even hear the music when we are inside our own home I have an 1800 year old home with old windows um you know with the storms I have never heard my windows rattle once and all the time that he has played his entertainment we literally have to go to the outside to the front of our home to hear it the idea that the is too much noise is really a Le issue for us as far as the traffic is concerned East stream is a threeway from area towns and cities to the greater hway iners area in gry 2 there's always been a lot of traffic and if anything why slows the traffic down and short we believe that Jim is a good considerate neighor who just wants to run his business to which he is entitled to do I have one more statement just for some background when we moved to Brandy the business of a e Street aka the winery now was once Maplewood kennels the kennel business was active for at least 20 years if not more there was heavy traffic even back then with people parking on our front lawn with their RVs to drop off and pick up their pets not to mention the incessant barking we never complained about his business and as far as I know no at that time no one else did either apparently I stand corrected my point is that there have been previous businesses at 16 East Street and I assume it is Zone business indoor agriculture frankly I much prefer a winery to a dog kennel with given the choice with no disre disrespect to the dogs we love dogs and had another buyer come in and opened another kennel we would respect that because that is their ative to do so Live and Let Live I want to state that we have no stake in the laryy we are just neighbors we just believe that the owners of this property have the right to use the property and whatever re they choose within the confines of the laws and ordinances that pretty much sums up our stance on the winery as the closest a butter and I thank you for your time thank you all right so to be respectful of um abutters complaints and that you are seeking Town counsel special Town counsel for advice and I believe I should have some sort of rebuttal on what's the information that you've been given and um to see where you stand with with Town Council and my permits um at this time we can't tell you where we stand we can just tell you that we've sought Town count special Town Council in regards to this um so we cannot give any decision okay at this time do you have any questions for me I don't well I think yeah go ahead Chris all these allegations have been made to correct okay and I call them allegations that just point you did call and ask people in to do a reu and I think before we would ask any questions we would like to hear your responses so that they can have an idea of where you're coming from and then maybe ask for clarification of Mee okay so um my neighbor spoke very well my behalf so thank you um so let's let's go with ceas and assist to start with um with regards to that I confirmed with my legal councel that the that this was issued without Authority the select board was the ones that issued the entertainment license and all the other licenses um so with that being said the the select board was not aware of the letter nor was nor were the uh Town Council or the town manager until after the fact that the the letter was sent to us um ceasing assist like two or three others that were issued in town recently or issued by code enforcement to seek relief from Z and asking applicants to seek relief from zba Town Council showed up at those hearings as well as I did um and Town Council advised the zba not to act on them it was out of their jurisdiction which I take the same stance we're a farming Community a right to farm and that's what we're doing there we're growing grapes as well as hops we have approximately uh one acre of grapes with three different varial those familiar with the industry would know that there's no lne before it's time as the saying goes we have we have a b of EST State wine picked from last year and to be bottled next month we also we also have the field of for the we also hate the field for a local uh Dairy and beef Farm um the farmers hate about four or five times a year so I'm I'm I'm saying this because I was accused of we're not farming every acre of that property is farmed other than what's what's being used for parking um Noise We periodically have music I've I've heard people say the music's too loud there's bylaws stating how how the uh how loud the the music can be based on deciel points I went out I haven't heard anybody tell me what the deciple readings are I've when we've had music I've gone up to um is that Jennifer Jennifer Drive and and walk the street several times the deciple reading at the property line is between 40 and 45 it jumps to 9095 when a vehicle Drives By and depending on the type of vehicle the the traffic drowns out everything um I want to touch uh I want to go back to that cease and desist there in a minut after I finish the rest of this um the Mass General lot exempts Farms from local zoning therefore the entertainment permit is not needed I've consulted uh my attorney but I don't have a problem paying the fee and Reno the license annually I pay a lot in taxes too by the way um I would also like to remind everyone that this Farm operation business has been in existence prior to the bylaws going into place so it's exempt um since we've opened I can't tell you how many we've we've um donated the the facility to the Lions Club a couple times South hary Chamber of Commerce several other organizations we've we've donated a lot of money to American Diabetes breast cancer the Shriners Randy Veterans Memorial so the the the establishment is giving back to the community and and brought as the hours of operation I was I was g i was I requested a license from 12 12: noon to 9:00 p.m. we close at 8 and music ceases at 6 well well within the bylaws and well within the decel ratings um and as far as the cease and Tois going back to that um I would recommend due to the lack of knowledge from the zoning code enforcement officer that he refrains from issuing any types of documentations that are related to zoning unless it's cleared through planning the planning board Town Council zba or the town manager to be able to review the situations it's putting the town at at a liability there's two or three of them out there that that have been uh dealt with through zda down Council dismissed them if you will again you know what do what does a right to farm mean in town through the whole Commonwealth you have you have wineries breweries popping up and they're in residential SL agricultural zones and they all play music they all have some sort of entertainment you can go to MC ways and look what they're doing over there it's a it's a new way of farming to bring people to you to to sell your product we this town needs to step it up a little bit to the 21st century here and start uh get with the program if you go to so I I mentioned the um Mass General law I think it's uh chapter 40 48 Section 3 it's spells it out farming is exempt from local local um bylaws and zoning and National national uh agricultural Law Center elaborates on it and extends it to even ancillary uses of the property that will promotee your product we've been open for just over a year we're learning we're learning different things about how to run the business um we're learning that um entertainment isn't probably going to be um a main thing that we're going to be doing there as far as bands we're we're we still plan on doing it the last big session for bands was um our anniversary colus day weekend there's so many people that come in from this community and other communities that appreciate what we have here I can't tell you how many positive how much positive feedback I've had that gry finally has something so I think that's about all I have to say but I I'd like to hear from the board um the licensing is due here in a few weeks by the end of the year most of the licensing other than is is um is is regulated by the federal government and the state abcc as a matter of fact one of the neighbors I'm assuming called the abcc uh several months ago and they investigated what the claim was and they dismissed it I'm well within the rights of what I'm supposed to be doing there not to mention I employ about 12 people part-time you know so there there's there's a lot going on there and it if you look at the abutters list of about 35 residents there's only a few that have signed a petition out of all the abuts and I know they went from door to door to door all around the area trying to get others to sign it and they won't or they haven't but as the my neighbor stated I went over to them several times that if there's any other issues let me know about it I also did that with uh another neighbor I haven't heard anything from them but yet they're here complaining tonight without without talking to me first about it I bought that I bought the property from the fitzgeralds by the way um who were who ran the uh the kennel and there was two other contractors that were looking to purchase the property they were going to develop it and because I told her what my intentions were I couldn't promise that it would stay that way my intentions were to open a winery and farm the property and if all else fails I'll probably go back to doing what the other two thought they were going to do with a with development so protecting trying to protect some open space here a little cooperation from the neighbors would help Gooding question I don't have any questions you're pretty pretty clear on anything you have to say I don't have any questions but uh you I do appreciate Mr TR coming in and if you will voicing his side of what some of the concerns were from the residents as well as what the business has been doing over the past year so I do I do appreciate that you know to be honest it's been quiet from that side so it was it was nice to hear uh from from the other side what what was taking place so thank you so we we heard from many times from a lot of the Neighbors which was going on um these things come up and you we talk I speak for the board um we look at all concerns everybody's views uh you know and some things with that go outside our expertise we reach out for additional assistance and that's where we come here to getting a special Town Council we're we're a part-time board really know so much um and as of now Mr Martin is is part time as well so we uh we reach out to you know for guidance uh to make to make sure that we are as as a board are acting in a in a proper way so sometimes those things take time um and you know for the board to get together and and meet and discuss things like that so I mean like I said we do appreciate anybody that comes out um and provides their thoughts on um we have been discussing now for the past probably 45 50 minutes that we've heard so uh just some today so I want you know people rest assured that we we take everybody's comments um like seriously and I and everybody speaks and when they speak on their part we we know that that's important to them and and they're speaking from uh from what concerns they have that so um I don't want people think that those um do not go unnoticed because we do understand that thank you okay thank you than you all right next is Rich taraki excuse me is it possible to still speak to that form we are currently still on citizen participation so you just have to fill out the form that's right at that table right there sir yeah Richi 428 Bater Street I just wanted to say that number one I like dogs and I like wine so that's good that's good but I'm 100% against issuing licenses and permits for the wine house number one it doesn't matter how contributions you make to other businesses or communities doesn't matter how many employees you have what it matters is whether you're following the bylaws they are not following the bylaws that wine housee is located in a residential area okay he has not done one thing to stem the music the loudness of the noise the people have documented they could hear music a half a mile away from The Wine House they've complained to the owner he hasn't done one thing not one thing to to stop the music or the loudness of the music he hasn't had the courtesy to go to the when the ceas assist order was issued the building inspector told Mr Chun that he would like him to come in and and at least discuss the issue he didn't even give the building inspector the courtesy of coming in and discussing it that's what the building inspector told us so which I'm not going up it but I want to make sure that we're being clear I mean the building insector can um speak for himself and I don't want to put words in um a town official or a town employee um words out there I mean he can Comm in to speak to that no disrespect to you and I know you're speaking of maybe a conversation with them but you know when it comes down to a town employee or town official I'd like them to come in and and speak to something like that okay but again I he's making it look like he is helping out the the residents in different ways they come with a problem and he helps solve it I mean that's what should happen anyone who has a business they should get along with their neighbors it's a residential area it says right in his deed that the building cannot be used for commercial use I went to the registry online I got a copy of who he bought the property from I got a copy of their deed I got a copy of his deed it says right on it it cannot be used for commercial uses and it is it's a violation so there are violation after violation he does not help the residents who live in the area there's a ponderance of elderly people they have a lot of medical problems it seems from the committee I been on and right right across the street Ray spoke him and his wife both have serious medical problems and they needs rest and they can't get rest now it's it was said that the music is in the desperate levels of the Town bylaws now does it make sense that you Windows should Ladle and and your dishes and and uh plates and stuff Rumble a little bit I mean obviously the music is too loud and the owner will not do one thing to help out the neighbors so I'm against that thank you very much thank you Brian good evening uh Brian trony I actually live on The Farmhouse property at 16 East Street um one thing I do want to say to start this off is I feel kind of a shame to live in a town where the neighbors who have concerns would rather spam call our Emergency Services on a Saturday or Sunday instead of just coming over and speaking directly to James trony who is my father or even myself he's always been receptive to concern or complaints and um it's just kind of a shame that they would rather do that than come and speak to us directly but the main thing I want to say is I live at 16 Street with my wife my three-year-old daughter and my 5-year-old son uh I don't remember exactly when my house was built it was before the uh 1900 my windows are old they do not rattle nothing in my house shakes my furniture does not move around the floors and I have a a hard time believing that a properties that are over a almost a mile away would have this issue I do also want to say while there is music almost always enjoyable and kept at a low deciel level one of the main concerns on E Street I see in terms of noise and sound is when me and my wife are watching TV whether it's 10:30 11:00 the winery is closed my kids are asleep and we have cars racing up and down East Street Extremely Loud but I don't hear any complaints about that and um it just kind of saddens me that there's aary it's not a bar it's not a biker bar it's not a club it's a winery that closes that's open three four days a week closes at 8:00 it's usually died down around 7 that people have such malice for something that it it's beneficial I think to a small town community especially when planning they're the more more active committees I believe this point kind of defeats the purpose of all working together we have to do it a couple time I guess but at least we can at least hear from through June of 2026 now um Chris how are we going to know if they're going to be in the range of a like if another if they're being competitive with another business we're not we're not doing this right now what we're doing we buying us time okay to put together an RFP okay for services okay because we don't have enough time the town does not have enough time uh to put together an RP properly advertise uh review the responses and to award a bid prior to June 30th of 2025 it's a good year process from beginning to end okay so I am advising the board that we should make it a priority in the spring to start the process good and it should remain on here until you've at least got an RP done and is should so on December 2nd hopefully we'll have a number by then yes another all right so comes up so we'll have to be on the lookout for it then and then meeting with other committees and Boards we just talked about and then Park and wreck department which we discussed a little bit last that is that something that you want to invite them to a regular board meeting or do you want to have a separate meeting to discuss that I think we do a regular board meeting got sched so appointment final one down at the police station and then hopefully for next year we will be able to start conducting it at the but some more and we don't purchase a tree for that right don't they have that tree right out front what police station yeah yeah planted they specifically for the tree yes hasn't grown much but it was planted there specifically for events and then the tree lighting at the police department um they usually we usually have hot chocolate and afterwards at we need Santa at across the street at the M har and Mary Church and know last year we got rained out it was like three
