thank May so this is presented for second reading it adjusts the um entry feature height on single and two story homes we had a thorough discussion last meeting the reason that we moved this ahead of the quas judicial it is because one of the applications includes an entry feature height that would be permitted after the ordinance is passed right we discussed this at the last last hearing um Rene would you read ordinance an ordinance of the Town Commission of the town of Gulfstream Palm Beach County Florida amending the town code of ordinances at Chapter 70 Gulf Stream design manual Article 5 areawide standards Division 1 General architectural standards section 7100 roof and Eve Heights to adjust criteria applicable to entry feature Heights for one and two story homes providing 555 L Mr Murphy thank you mayor Mr Mayor um members of the commission Mr Naro Mr cler Chief good morning I'm here with the representative from environmental Land Design which is the which is the Landscaping contractor for Susanna Brown St arms at 555 Pelin L if there are any questions with respect to the landscape plan um we'd be happy to answer those questions but the landscape plan is not before the commission today since it's previously been uh accepted what happened historically with respect to this this application is that during the course of the repair and replacement of a sea wall that had been in existence for 73 years um there were significant problems in that the Army Corps of Engineers now requires that seaw walls which are restoring or replacing seaw walls have to be seed of the existing seaw wall and so for the seawalk contractor this presents a problem sometimes and in this instance um here's what happened in 1951 this very modest Cottage on the extreme Southeast corner of Gulf Stream the last point of land in our community um Mr Christensen Mr Christian sorry who built that home and had built the home at one drip of Landing which was purchased by Sally Brown and W Brant Lions Brown in 1945 putting a concrete D there are Twi concrete docks in that extreme Southeastern corner of our community one owned by the late and great Lee Brown who died on June 24th of this year as some of you might know a distinguished man in every respect among other things the former ambassador to Austria the former CEO of brown foran and on more boards than I could possibly remember um Sally Brown and her husband WL Lions Brown senior bought their modest home in 1945 and wound up also owning the home that was built in 1951 in fact Sally and Lian Brown bought all of landan Landing for those who don't know about it which is all the way down south is a community originally of 8 Lots now expanded to membership of I think 11 or 12 so turning back to our present history Susanna Brown Scott Barnes purchased that home 555 pelican from the estate of a la late father Martin Brown who was a resident in the winter of this town from the time he was born and who died 5 years ago in fact all of his children are owners of residen is in driwood landing Martin Brown Jr Eliza Brown Nina Brown um suzan the Browns seem to have an affinity for this town arguably now the longest continuous family residing in this community 79 years um a cousin Austin muscleman whom the commission has heard of because he he and his wife happily purchased Lemon Hill um forms the eastern boundary of The Canal at drifford Landing that Canal is south of the bir Sanctuary so Susanna Brown put up a modest addition to her small home and a landscape plan in the seaw wall restoration when the seaw wall uh Construction Company approached the concrete dock it had to take off a piece of it in order to be able to pour the continuous seaw wall when that happened the the contractor realized that the northern part of the dock was dangerous and had to be replaced which he did a similar situation occurred in 2020 when Lee Brown restored his wall with the same seaw wall contractor and his do was restored as well understand Commissioners and Mr Mayor that this is not an application for a new build this is just an application to restore what has existed there since 1951 which is an identical dock quazi perpendicular to the seaw wall and concrete pilings in concrete deck it is the twin of the brown dog immediately to the north it is a dock along with its twin that cannot be seen by any Resident of this community which I think is important in that we have over the years had a number of instances before the arpd and this commission concerning things like my neighbors landscape plan will my sideline to the north or south and I need relief this is really not a variance for relief in order to therefore do something new but rather a variance to preserve what is old and at the risk of being verose this morning what is old in ghering is good well thank you and uh the historical background is important uh because this town um normally does not Grant variances uh and we are becoming stricter in holding to to that that approach to variances however this is a historic property and historic um Dock and I believe as you were speaking uh I was going through the eight requirements for a variance checking them off um according to your description of the property and and what uh the contractor countered and what you're proposing to do um questions from the Commissioners relative to the eight requirements for AAR just one one question it's the drawing of the 2729 Fe the 37 was to that's it's the the shorter one it's shorter the two it's 29t 6 in what's the length of the uh seaw wall area there with the stone you know where they had they had to put the dock parallel to the seaw wall is that the same distance as 27 or is it 296 or is it a little longer good morning Design Group for the record I'm not sure if any question clarify this here what is that you might approach look sure pointing to rock here oh what is that distance yeah you may not have it if that's even a final distance not no it's about 15 ft plus or minus yeah so it's shorter than the do yes sir Rob did you have a question Mike was did you did you ask okay um I guess my only question would be the wood composite versus the wood not my one is there a particular reason I know our application states that wood was acceptable but that's a question I had as well that's more a question that staff has for the Mission uh we've seen more and more applications for composite and I've had Dina um steer them in the direction of using a traditional wood so the question I have to the commission is whether or not as a general matter wood composite is acceptable I did talk to Mr Murphy and he said that they would be happy to use a traditional wood that's not part of the variance that they're seeking so we're just asking for direction should we continue to require wood as required in the code doc shall be made of wood or with the changing technology and and materials whether it's acceptable to have a wood composite that is made partially of wood and and has that similar aesthetic but maybe has some other properties that would be beneficial for long term um you know staff is happy to continue to require wood um you know traditionally me there are certainly some high quality Woods that you know are appropriate for do and for well if you have that it probably will last a few decades but if you have pressure treated it's going to go away a few years on the salt on the salt qu I saw water in the Sal here and but the I you probably all all have some knowledge of the composits including um ceramic it's remarkable stuff looks just like wood and it's it's imper the weather yeah I think we should be moving in that direction it's not before us today we need to see see the uh the composite being recommended but just as a general rule my opion there are some good very good products up but also yeah there some we in yesterday Roes about ago last long splinters buckles but that's not before us today uh any other questions on the request for a variance which is before us okay um Mr vice mayor a motion uh Tre we need to go through the uh the findings or can we just go to the short form motion go the short form motion that's acceptable if it's a motion for uh approval then you don't need to reference any of the criteria if it's a denial you need to reference a specific criteria okay I make a motion in the affirmative motion to approve a variance to permit the restoration of the original concrete Dock and the dimension proposed on the application materials proposed and the application material subject to the W comp we at staff level or commission level again so we can we can do it at the staff level if You' like however it is required that the Aesthetics of docs be approved by the arpd so moving forward we can certainly have any composits go to them this part of that review have to be we need some standards on that can't just be bringing you m mayor all right let's move on to the next application water code morning good morning my name is l re I'm from Affinity Architects and today we're presenting lot this one is inac with a water view one story Georgia style and uh the main thing we wanted to do with this residence was uh make sure that it had a different look from the rest of the uh homes that we built in that street um as mrar commented we have entry feature that uh based on the new code is approved um we're also under the allowable square footage for the home um and if you have any questions sty uh yes uh couple of things on this s obviously it's great that it's one story um I just want to have you go through the uh I think this one has pretty significant impact on the neighbors um especially since I received some comments that some of the neighbors thought they were going to be looking at a the rest of lives from the East side so you can go over the East Elevation and the we don't need to do the Landscaping just yet but you know the appearance of the seaw wall the seaw wall cap and then the Windows window featur of glass the we always Focus elevation amount of glass railings that sort of thing even though I know it's a long story home we're talking about the rear elevation yes uh yeah uh we wanted to make sure that the uh this being on the water side the uh elevation was appealing as much as the front elevation is everybody that uh travels on a boat or from the other side is looking that elevation uh now uh in terms of uh window and and glass coverage we're at I believe at 36% and the allowable is 40 so in terms of that we're complying with the calculations and those uh I mean again it's got a pretty pleasing one one story feature it's hard to pick on are those sliding glass doors underneath that for going out to pool Oria uh yeah how deep is the ptico that's what I was looking at because a lot of glass there with those slid doors sure I know why you have them obviously but they seem to be fairly well is is about 16t from probably a little more with the the portical F okay so 16t to the main area of the and then that part that PES out it's another five looks like ass it's a bedroom sliding last um I believe the rear um the bedrooms have other questions just have one quick question on the um a lot of hardcap in front of the house relative to the driveway question sir just it just seems like it could be more Greenery in the front of of the property relative to the am driveway that appears show I know it's a corner lot there so end the yeah my name is Louis Vos um Majestic use Landscape Architects um it was a challenge in two ways number one it's on the Colac lot so the whole frage is is minimized you know but there's some positives on this uh number one the garage and garage Motor Court is set on the Southside so it's something that's not visible from the street and the other item that that we uh were challenged and did is we reduced the drive driveway to a minimum of 12 ft um all the way around or no I'm sorry 14 ft um and the majority of foundation Landscaping uh Etc is up against the building so there is the the grass areas that are required by by the city um in this situation um there's no way to provide access to the front of the house like we did in the other uh lots and not include a driveway yeah the front drive I mean other than obviously we have blendo glass which we've reviewed in the back of the home Facing East which is the west elevation we I know we don't have our our 3D Dimensions up today but we sometimes we have trouble assessing to commissioner Green's point where how the heck these driveways configure the street every house we approve they're always different and then sometimes you walk by 2 years L you're like well there's nothing but Stone up to the edge of the house with like a twoot plane area exagger detail but there's not enough um greeny the pictures on page one which I know probably aren't quite representative which commission green I think is looking at looks like it's close to not having enough uh landscaping and Greenery and I know You' got the island there which break break it up it's probably larger than what we have in the core but then you know when you go to the plan you know it looks fun the actual you know site looks like you got plenty of room so I don't correct to comment any comments on that go ahead to to respond to that um basically yes it does you do have the difference in uh the visuals but one of the reasons is on on the elevation and the graphic we're also trying to show the building so you can see it within context I I think once everything like the the tree in the island the lar by customer specimen is going to be 18 to 20 ft it will be almost twice the size um the same as everything else the jaes and then also there's the two large Oaks which are part of the streetcape um that that's in the front there that are not indicated on the elevation had you done that you really wouldn't be able to see the the house itself I think if you look at the landscape elevations um there's a the west elevation which is the front I think you you can get a better idea of what it looks basically um from a landscape point of view uh like the large tree in the front we want to walk out the front door and be able to look out into the street okay so so that's that's hidden the Japanese blueberries are complimenting the architecture to the North and South uh the two large uh date palms on either side of the entry you know and of course um again we have the Palms in the middle of of the windows between the ja I think if you look at the west elevation which is the front elevation indicated on the um landscape elevations I think you would see it it's a little bit more detailed INRI I think it's attract I think limited visibility on the West Side our main concern the is View from the East think by maintaining a single story home a large Portico for the setback of your glass doors um I I think you you ter addressing our uh last question for the staff is there a dock permit coming with this separately yeah so there's a do I know we're not approving it today so is that coming all the way back through to us again just no the do would just be seen byp like a pretty big was it the doc approved like a year ago I don't think so then we went back and forth with the original Public Access and then they came back I think we have a we have our common section in the code that a lot of people forget is if you have a vacant lot unless you leave your do there when you raise your house if you take it out it can't go back in without a house Mr was attempting to okay well that'll come back before I'm comments that any other questions comments um okay motion to approve a level three architectural site plan based on a finding at the construction of a 6,343 square fo George and one story single family dwelling with a three car garage and swimming pool including new landscape and parkc meets the minimum intive design manual and applicable review standards with the following condition any minor modifications to approve Landscaping shall be submitted to the town manager for review and approval and any major modification shall be brought back to the arpb for review and approval prior commenc of landscaping second commissioner green yes commissioner Canfield yes vice mayor Stanley yes mayor Morgan yes thank you very much move on Town manager report CIP up okay so thank you mayor so you know the work that's under under construction right now is located at RightWay and old school and also some degree over here on G Stream Road um what's happened is as the contractor was doing the work um you can read here uh there are many Shadow uh Utilities in the neighborhood in the area that they're working right now and uh pretty much confirmed by our by Anthony that the same kinds of conflicts that they're having with the existing utilities will be occurring uh through the rest of the core area U and so the the engineers did have a $775,000 allance to uh to address this but uh contractors have said that's not uh they would have to change their means and methods of building the roadway because of these conflicts and that $75,000 would not come close to a meeting the expense of changing the means and methods of doing the roadway because of these conf uh what did you say Anthony on old school and and right way there was something like 30 yes sir 30 conflicts that that's what that is is this Utilities in a conflict with where the pipe is going well wherever the the tilling they were going to do to the road was going to meet below 16 in where they need to be able to to place their machine and till it up so it's a conflict where it drops the machine itself and has to reuse the asphalt to do the density and everything else they so so one of the Alternatives is have the utilties come and move all their all their utilities where there are conflicts correct and I think you did you reach out to some of those utilities I personally did reach out to com so can you lay this out of course the I'm not looking at a map or chart or anything uh so we take Old School Road for example right is already torn up so we're trenching let's say Lan term somewhere off center of the road just where you've got the cuts for the pipe right um I'm seeing we had to reroute power to the house from a Transformer and so are these utilities are all over the place or they just supposed to be on like the east side of the road they're designated to be on certain sides that where a water M isn't running Yeah by usually they try to keep power and and sewer and everything away from water right just to be able to isolate it um but that's not the case with everything there are some that are just crossing in certain areas that shouldn't be so we Dig Down new pipe right and we're just stuff is just crossing it's snaking yes so uh and then there were two solutions go ahead an expensive one and I know we're redoing this but y'all have been looking at this for a week we we have I I did try to get a any so there yeah to make this short sweet I think we're really looking at two different ways to address it and and one is by uh going block by block and on the agenda today I do have a change order that it would be a prime example of what we would be doing uh moving forward if we were to do it this way going two blocks or you know from Polo up to Lake View and a little bit of Bion so we would have small seven or eight small uh sections that every time uh you know that they began to work on those and begin to invoices then we would have to come uh back to you to get that approved and so uh so that's doing it block by block and anybody feel free to jump in if I'm if I'm not explaining this right or to have a global uh sum of money that uh would be available uh that they could you know continue to draw down on doesn't uh it wouldn't ensure them I think the amount we're looking at is around $700,000 it wouldn't insure ensure them that they're going to get $700,000 it would be based on on each section that they're working on and uh and we wouldn't then need to come back to the commission every time to get that approved uh obviously we only meet once a month and that you know by doing it section by section might come slot it down if we had to get everything approved by the commission like I'm bringing to you today uh so those are uh basically two ways that we have I guess we have no choice uh to to continue to do it the way it was designed we have to change the means and Method done is that right Rick yes talk address two points number one you know why is this just being uncovered now why was it not part of the original design to then did out and number two putting that water under the bridge what is your recommendation for how we address it now in terms of changing the design from an engineering standpoint and the best way to to address right jocky s back So like um Greg mentioned you know we did anticipate in projects like this there you know obviously existing utilities throughout um throughout a project that needs to be dealt with during construction uh we utilize a Surveying Company who do that performs subsurface utility engineering work um we utilize GPR um scanning to find the locations of the utilities um based on the level of the water table levels it's brackish has salt in it it makes it very difficult and inaccurate to um identify the depths but typically utilities of um Power Compass things like that going across roadways are 2 feet or greater below um pavement uh that is a typical um design standard that uh we've always CED on other projects once they get into the properties your cable um and telephone cables are a little bit more shallow but again it's not going across a public right away where there's road traffic and possibility of damaging of the pipes so um you know we have we do know the locations of majority of the utilities based on the scanning based on um on uh as built drawing provided you know by the utility companies that provide us that information we have as buils of the towns or not the towns but the neighborhoods U low pressure Force main system The Depths that the force main was prop or should be constructed at so we utilize all this information in the design of our project um and again like I mentioned that we did always have the anticipation that utilities will need to be a adjusted during a project to the extent that we're at no we did not we did not expect it to be at the extent that work and how are you proposing that the contractor now address the problem so in order so the main issue here is the process of taking the existing uh base and the sub rate and mixing the tilling action so that tilling action obviously will destroy any utilities and uh any utilities that encounter so in order to avoid that we would substitute that subgrade material for rock so that base rock that goes above the subra would be um add an additional 5 in 5 and a half in which is an equivalent to what that structural um strength of the subgrade would have been so uh Rock Construction does not require the tilling so the contractor will come through excavate down and um install that rock that 5 and a half inches of rock on top so the utilities will not get damaged and the majority of this work is you know at your intersections where you have multiple utilities going across you know it makes it much more difficult for the contractor to have that tilling machine to get into fine little areas so you would have that extra um you know thickness of AAS Rock and then you know we're anticipating as we go further north that the utility crings become much more spread apart so then the amount of additional Base Rock should be less as we move uh to the South as the elevations increase and you have longer Str you have longer distances between um intersections where the majority of those utilities are pring have you known about the location of the uh elevated location of the utilities prior to designing this project is this how you would have recommended addressing it yes we would have done the same design uh utilizing the rock the existing pavement the cracks you know you can't just resurface it uh if you just resurface those cracks will um come through into your new pavement so you have to reconstruct the base and the subgrade as well um for a new new roadway and plus all the grading that we um added to the project in order to facilitate the surface water getting to the new inlets that are designed the contractors estimating over $700,000 to change this this approach to the work um have you worked with them to verify whether those numbers are legitimate got work those numbers down we we did work with them and work looked at their numbers uh because we already have a bid for you know the bid of schedule that contractor bid on so we have their unit prices for the the amount of the cost per you know L feet square footage of the subgrade so we looked at the substitution of what they had put in for the subgrade and the cost of what it would be to do the rock um so yes we we compared the cost of everything and that's assuming that what you confronted on Old School is what you're going to find elsewhere correct that number is for the entire neighborhood which we do not anticipate it being for the entire neighborhood it would be just that's the contractor's number for the entire neighborhood we feel that if we have the pot it you know as Greg mentioned it would make it faster so that we do not hold them up having to wait every month in order to get an approval from the board um so you know we do not anti anticipate the entire amount being used when we when we met on this some time ago we we spoke about going step by step through the core just verify that we actually needed to do this correct as the the contractor installing the water main first and that's typically you know the single trench and that is when they're um identifying the locations of these utilities and the debts of these utilities so by the time it comes to uh when they need to do the actual Road restoration project will know where all the utilities are and the extent of the work that we anticipate that would need be done by the contractor so the roads are going to be higher right correct the roads themselves I'm no no overall we're just changing out the material they're going to be what they're designed to be they're not going to be any higher than the current design correct correct yes other questions so my understanding is that this is is almost like be drawing down Al right sounds like what we're going to be talking about the next item the agenda but the engineers will be monitoring this step by step and then revie the contractor's recommendation for how much Rock and corre what to be done and you make a recommendation cor correct and this is based on just square square yards or yeah it's on a unit basis of by square yardage so question and I had yesterday was we had known this and you ask him that question then it would have been designed differently and right right it would have already been included in the cost it would have been I you would have known the cost then versus does the cost of stone I'm not familiar with does it very weekly monthly or is it a usually quartering but not by month okay um all right so you looking for us if I right now at the moment they started down on polo and that's much higher elevation it's dry they hit one empty case and didn't have anything in it but we're talking 3 and2 ft down there's conduit just below that that they're digging up and they're visibly seeing so that section down there is not Tom if you may um I'm not sure if that's going to impede where they need to place whatever I I haven't been looking at the drawings lately you so I don't know um that's why I'm hoping he'll be able to answer more than what I'm giving you right now there are structures that are in place that need to be in certain locations and we ran into that problem this morning with a su don't know if we have to shift the Box forward or meaning up or down North or South because they're going to be on the laterals to the road so the crossings are are impeding where the Box needs to go now I had instructed run for back wood to assess the situation and do a field decision change out in the field but um those are those are things that we're running into even up where it's up and high and it's dry where they're able to work and we're still running into conflicts so that conflict is not what we're talking about now in terms of wellity line some some of them are because they're at that same depth where they're hitting them now and it's even where up higher in the areas up there now yeah it was less than 24 in under the ground so it's it's still applying all the way is probably less two two feet correct but they are still like on on this worth Street where they came in and board new AT&T line yesterday and I wasn't even know where they were coming in they put in the line Lo for but they put it in at 16 in in depth I called him this morning and told him to have to come and take it out and red do it I have to go below 24 in it can't be even at that depth a code sort of code or regulation requirements for the depth of sewer line the D has a requirement for their roadways we're not in a do right away um you know typ FPL has their own requirements on what debts they want to protect their utilities so it's uh it's you know utility owner to utility owner typically a Pinel runs four feet typically but when they go into residentials and they don't have the room to directional boore at four feet they compensate municip so stand right all right so here's here's where we are so uh I do have two two change orders that I need to bring to you uh that one is related to this this would be U four RightWay in U old school uh so they they can put the road in and with these with this new means and methods and that one would be that one is estimated at 95,9 to finish so this this would this would have been an example of what we would have to do with come back to you uh randomly to get approval for do sections of roadways but this is one that uh they're to to the point now when they can begin to to do the road to do the roadway so I think you said next week sometime yes sir you could start doing the roadway okay uh so this is so this is uh one one of the change orders that uh uh asking you to approve now uh Rick you would you actually would do the uh the paperwork for a change order to the contract correct so what we need to do is you know depending on which way we go here you know in any case actually we have to write a change order to Construction contract so once we have Council approved do something we can write that change order and assume when we have Council approval then you be able to sign the chamber so even for this small section that's $95,000 we have to write a change to conser contract the the uh the uh quickest and easiest way to go forward for the big picture however is to entertain that larger amount which is over $700,000 to approve the funding for that and then each time the contractor gets done with a couple streets an area a block whatever we feel is that uh is appropriate um and they've demonstrated uh and located all the utilities and they submit a log and say Here's all the utilities and here's all the elevations for the utilities then we'll make a recommendation going forward to even stay with the existing design in that area or move forward with this alternate design and then we would issue at that point since we've already got Council approval for the funding we would issue a work directive to do a certain area using the alternate design and then they can draw against the funds for that so anyway around if we have to write a change order to the Construction contract to get it going and then and follow up with individual work directives to allocate okay so I would ask the attorney I think uh what you we would be asking the commission to do for these two change orders today these two individual change orders is to authorize me to sign them once you correct do the pay correct well let's look at the change so we know that the price of rock is relatively stable so they would have looks like a removed pavement but they'd have to do that anyways to sel it right oh yes so we're adding additional Rock in replacement of the tilling to firm up the the sub we know how much that is what they're doing um I'm just wonder where the 95,000 comes from how much is rock and how much is labor and how much TR right well what they're doing is using existing bid items and then giving us a credit for this the existing bid items that they will not need to do because of the change I mean maybe you guys can shed some light on yeah um so basically instead of just identify yourself refering to you have to do this anyways additional right uh Thomas week's roadway construction um so basically what we did was in instead of providing a new price with a higher cost of lime rock due to at the time when when we did to what it is now we have an existing pay we said a we're willing to work with the same unit price that we have we're not going to charge any more for that unit price of lrock so what is we calculated what that square yardage would be based on 52 in in Li of the original 8 and a half which we have as base in our in our contract and then give a credit for not tilling the existing subr so what you see there is that 3431 per square yard that is essentially the price that we have in our contract for 8 and2 inch Lime Rock base that we're providing in the town and then the uh REM and dispose of existing pavement section that is the additional 52 in of material that has to be haul off due to not leaving it in place if you tell it you leave it in place correct correct okay and then um the the subgrade item which is a grading compacting intensity if you add that 850 plus the credit of 2142 on the bottom that is our unit price that we have in our contract for Tilly and doing all the work associated with that so essentially we're giving you know a credit of I think it's comes out to like 60 64% 64% of the original pay items because there still is scope associated with cutting down compacting denting that type of of work work so we gave 64% of that credit back for not having to till and then um the new unit pricing for for the line which is what we have in the CR shs so we we haven't given any new pricing whatsoever for anything I'm just trying to find out how you'll review each of these well the same fashion what they'll be come to us and and they'll say this particular area here's a log of utilities this is what we think we need to do in this area and then they'll give us a sheet similar to what you have in front of you using the same things the reason why I stumbled when you first asked the question because I I was looking at item number two and you said is that not in the original bid and the thing is it's just the working of the bid item the fact of the matter is that since we're adding 5 1/2 in of rock they have to remove 5 1/2 in of Earth there in order to get that rock in and and that's why what that line item is a significant increase in excavation hauling off material yeah you have to haul it off and everything else and I think to answer your question so as we find utilities obviously we share the the log with Rich Anthony verifies obviously um we'll look at a section and then it's measured you know jocky can verify the measurements you know per plan in the field and then that quantity will be provided per section which you guys would have to say either yes go the 5 and a half inches of rock or no you don't have to we can til yeah and for instance you know on our design our design capabilities we can just go on the computer and say and designate a particular area and and the cat program will tell us exactly what the square yard is so it's always a a field a few verified square square yards even after the computer tells us what it is so there's a possibility that we'll be able to tilt certain portions of this project we're hoping we're hoping for that we're not going to encounter this whole thing that's why the big number is a worst case scenario at least it gives us the the funding in place that we can move forward efficiently otherwise if if we got to come back here each time there's there's a Time domain the contractor wants to get start we we can't move forward until the contractor gets all his trenching in place because the trenching in place is what discovers all these these utilities and conflict but once he's done he needs to go right into the road building process so if we're going to stop every time and come to the council for approval individually that's going to put a significant yeah no no that makes sense and Thomas is explain if we have to do most of this work with the the extra uh subgrade how much longer you think this will take we got to do this for like 80% of the project it seems not looking really at time the time delay I mean the time delay is locating all the utilities from scratch every time you dig and that's not going to change the rest of you got know you need to do and the process of the toing is the time it takes the T originally is kind of exchanged for the time it takes to put additional BAS got uh any other questions with the engineer of the contract yeah just one question so it seems to me we're just swapping out building materials you're not adding any additional profit margin no no no we're all using bid item unit prices all right so before us is the change order for what has already been done right or it's going no it's going to be going to be well has been discovered between right and old schol those two streets how far up does that come so it's all the way at the end of right way yeah it's basically to the point of curve yeah but then all of old school corre this is Right Way old school up to PO no up to Gold I do want to interfere again they have to do a Crossing in front of the little from one box to the next that's still pin we still have two services that still has to go in and we also have a 50 foot section of uh CMP corated pipe that needs to be replaced that's on the north side of the street that will be on that will be sent to us today because he spoke to me this morning he said he's going to get it together and send it to us today so we'll have a new figure since he Incorporated all the other figures into it from the bid line items that made it a little bit using for us to know but he's going to resend it today by the end of the day so that we we know what the cost of is to do the 50ft section of pipe that needs to be replaced that's at uh 345 old school in that driveway section so that would be the ending of that section where they'll stop once those other items get replaced or installed the question is are they going to be able to well if they start at the end the right way and start working and then they're able to do what they need to do to put the pipes in at low tide time and finish installing what it needs to be installed and they should have plent of time to be able to get to that point at the end of Polo and old school no problem but the question is I mean I asked if they felt like they could start on the road on the road yeah yeah we can do all right right away next week starting next week I have a question about the roads again so what's the how are we supposed to explain you know as we're digging up and and we're laying down the fight look at you utilities they got either till or not till put the new base in we've got the trench just half build in we got some temporary asphalt coverings you've got the the metal grates and whatnot I stuff like how big of you are jumping around with between right and old school but so how big of a swap of of road do we need done before we're going to come in and actually put down the final black top I mean we going very good question and we've yeah I know you all been I said the residents are kind of asking well how big of a section do we need so if everything looks shiny new from Old School to in front of school around up to B then around how much up I think is methods and yeah I mean I would I would tell you can I can I so we've haven't been having a lot of discussion about that I was tell someone said that uh that not until all of the pipe and and base material had been put in would there be any kind of even a first lift of basball and I said well no that can't happen I mean you can't leave Rock and dirt open on a street for 16 18 months until it's all ready for the first LIF Bas now I've been told that uh that's not going to it's not going to move forward that way way rather as you I don't know when you would be putting that first lift B down are you going to do like the phase one and then put the first lift of asphalt down or no you'll put the lift of asphalt on on old school and right way whenever you're done that's correct okay yeah I won't wait until the end of phase one to put down the first layer that we've just seen enough area to be able to bring in the Cru to productively put down that so I mean right is a little short but obviously you know old school we finish old school top of Base we'll come in we P first LIF so I'm not sure if that's what you were asking that's what you been having a lot of conversation where are we on our um so everything's moving around different spots we're digging on gol VI we're digging here we're digging there so where are we on our chart I'll have I have a comment for that we are we don't we don't want them to be not coming into work and not having so originally this started out in phase one and a phase two well right because we have no dewatering permit and there are some opportunities to do some work in areas where we don't believe that they're going to run into water uh we have authorized them to to go yes we have a lot small we have a lot smaller sections yeah so so we're going to have to do I know we have a lot of people that are out of town so we're GNA have to do a lot of information uh providing information I mean Mr Lions they're over there in front of his house and when he comes back he going to go oh I didn't know they were working up here already so we're going to have those kinds of situations but we we would rather them be working uh and doing what they can without that dewatering permit if that's good if you're if the commission is good with that another opportunity that we might have is this yeah I just want to make sure these sections are somewhat organized so that's what I'm worried about what what was the comment I made I didn't want I didn't want Construction on five different locations going on at the same time here in the core because it you lose consistency and and opportunities for people to drive places and not be guessing how you know where they have to go well the first completed section or phase one completed section would be what we just talked about when do you expect that first left to be on time um well I expect probably right way to take us probably about two weeks to get completed and then but I think what he's asking is yeah I'm trying to just think about it my head you to it but your best estimate I would probably say two months two months a long time that seems like an awful long time how much more needs to be done well right obviously just the roadway um like Anthony mentioned there's a couple things on on um old school um I mean it could be a month and a half you know I just don't want to tell you you know a month and then we're here next meeting let me just say say this for St one this it's happening every day I mean I'm getting I'm getting a signal that old school and right way are ready to go we're ready to put that first you know to to to raade and put the first F basketball and I believe doesn't that include the curve yeah and we're going to start that next week so I when I hear that it's like I'm thinking okay that's the next step and however long it takes them to do those two roadways is the length of time you know that we're looking at but I keep mind what I'm hearing is that no old school was not ready for it yet right but they're going to start on right way and bother you know finishing up a few little things there on old school but keep in mind it's quite it's quite a process not only are you digging down there and Excavating all that material removing all that material rolling compacting bringing in road base putting that in lifts there geotechnic geogrid that has to be installed when you get up to a certain level then you're building curves and understand is quite a process I'm confused at is whether it's ready for that to start and apparently it's not I mean there's still pipe that needs to be put in and and so I just need to get something that's accurate so when I get calls from residents I can more accurately tell them what's going on timing on so if we got six to eight weeks on old school and right we six is to October 1 part the the worst area other than whatever you get into around those B for sou um is technically traffic wise and this where the cheap comes into really going to be around from banion down to town hall of course you all are using the construction lot and then old school RightWay and back up Polo that whole square is there a way to like I mean are we targeting trying to get all changing all our schedul getting we were we were going to try to get all this work done in front of the school before school started but we talk about December so we targeting once we get everything once we get everything the de waterings in we get everything switched I guess the per is in but once we get everything switched around just cing that getting that through a first on B Stream Road about the other residents and I care that they're going to have problems getting to their homes on that's why the work's been done and and the other issue was also the main reason why I wanted them and I suggested this from the very beginning to start on the lower area because of right the king tide and the High Tides when they start coming in um they're okay with moving to the South End to start doing what they're doing but in our meeting that we had yesterday our monthly meeting I reiterated that the whole situation with the king tide and the and the tides coming in and that ground in that area becomes very saturated they still have a large project that they have to do in between the tiing and the comes yeah at 3400 to put in a 40 inch pipe and once they get ready to start doing that if they don't do it when they get approved for the dewatering that area is going to be so saturated with water whether they do it now or towards the end of the project if they shift it's not going to change that area is going to be underwater no matter how you look at it because it's the lowest area so I made the suggestion to come back to that and revisit it now once they have the opportunity when they get their BW per approved to move forward to start doing that now and get it out of the way so that way they don't run into any issues later saying well you know I have a delay because of the water you're going to have it because it's the lowest but right now you have physical means with dewatering to be able to keep up with what you need to do and still disperse that water and do your job where it won't be an issue so that's on that side you're recommending we stay on on the schedule from old scho back to go yes I mean as just that se school have their school year with what they have now work on the other roads on their defense they did come back and put in Asphalt to resurface as a patch temporarily so that way it's not open but the water lines are in but the services not so I don't know what is yeah so what before we wrap up here you know we can't plan the whole project today but replan it I should say so where do we have a decision on on uml or Golf Stream Road in front of the school or not I don't think there's any way that they can work on that this year this year okay so we back original that's what I'm getting we don't need the pest as a chief about bringing all the cars off of A1A November December January we're okay all right I got it okay thanks so so we're going to be moving back to the original plan right po up yes Southside letting the school keep it Road through the school year I mean I made that suggestion like I said yesterday but he's the representative of their company he needs to make that decision on their own I just I put it out there for him so I don't know if they want to adhere to my warning or not but I did tell them and I I gave them notice that this is what's going to happen because I've been here for 5 years now oober I know what happens I see it on a regular when we left the meeting yesterday the it was left that will correct so okay well yall can like I mean that's the biggest number of cars we know that I mean so if y'all can like try to figure that out in the next we I want to are we're we this holdy watering is just totally yeah I got it we know know we got redoing the okay so are you guys good with the first yeah so we'll need a motion on Morgan yes okay so this one is change order number two uh if you recall several months ago the staff came to town commission and uh we uh recommended that some of the design of the roads had been reduced to 18 ft and we prefer to have them consistently at 20 ft this includes on Bion on light view on all of old school uh uh sections of I think Gulf Stream and uh so we came to you and said we're recommending to them to to move that to to 20 ft so this is a result this is the result of those changes and we we just believe that we we prefer not to have a road going from 18 to 20 ft to 18 ft so be consistently 20 feet on banion Leg view all of our roads we we discussed this before and the commission agreed these uniform they need to be but I have a question uh because of this new method means and Method so I'm addressing you Rick this is $177,000 is that estimate based on the original construction design or Does it include this new method that we would be using because you did say well we're going to have to add 80,000 to that well I'm not going to pay for an original design thead wiing the price for the road widening was just for the the road widening not not anything underneath it it's based on the original design in uh design but with additional material to widen the roads 100,000 considered every road would that's being widened correct right that's being widened right that's being widened okay so we not going to be getting an increase to the to the Rock base no those are uh unit prices based on the original original original design but that's based on have some extra square foot okay this supp right that's based off of yes the original design original so if we had to do the the alternate road design there would be additional cost is that in the 700 number that would be in the 700 number actually the 700 number was based on the original design as well 700 number high enough no I think what he's saying with with with with the with the added road that 700 number becomes 780 but you're already doing the 95,000 for right in yeah so we're back down at 7 you're estimating another 75,000 doar of Bas no I mean as jocky just said we're getting ready to do pay for old school and right right the 95 so the 700 would be exclusive of RightWay and old school because it's already in the 95 that so we need to redo this now we're not consider it's not taking into account what we just approved nor you to seem to be in disagreement as to whether the subbase that we've been talking about for the last hour is included in it so this number is not accurate I don't know how we can vote on it but what number do you have anybody 177 386 that's that's the widen the road as it was originally designed when we get to that point if we encounter the same issue with utilities then there will be additional cost to address those utilities using what you today so a 700 give or take whether or not it's supposed to be used on every road or not whether we're tilling or putting in new subbase do you think you have enough in that there's enough in that number I would I would re 74,000 whatever that right so then the so if we get to the very end and it's off a little bit and we would have to come back and increase that number but not and and my guess is we're not going to use all that okay credit on this number for what we just approved for RightWay in Old School well this so it would have been 795,000 if we did not do old school right way on its own but since we are doing old school and right weight on its own only 700 separate change order we just approved is not part of the 700 correct correct you already did no I got that did approve almost 00 and because we don't know what we're going to run into when we get to the road widening the change order for the road widening is based on the original design intent now all I was trying to get was a definitive statement from both the contractor and the engineer that the 704 this number we were talking about would include any additional rock that might go into these widenings as well the the 704 is not it's based on the original design right then you mentioned 780 which would be an addition to the 95 that we approved just trying just trying to get the numbers the 780 would have included the additional of the subgrade that needs to go into that widening section okay now with the 95 out this is going to cover the 704 is going to cover any condition that you meet completing this project in the cor with the widened Road right correct if you some comforting News mayor from Lake View to G view on G Stream Road the only utilities that I am aware of that are on that road because everything is in the alley from that stretch would be gas and sewer and I just don't want to have a surprise right so I I would recommend that we go ahead and you're recommending based on what we heard today that we approve the second CH one of the roads that's going to be widened is old school and that's they're working on that right now so I don't want to hold them up on so now that I think we are satisfied that it doesn't that 8 is in here right I'm satisfied because it's on the record from both the engineer and the contract so I would recommend that we approve this one also okay all right is there a motion uh motion to approve change order number two as presented uh in the amount of 1773 8628 second commissioner green yes commissioner Canfield vice mayor Stanley yes mayor Morgan yes all right so okay so the third item is uh if we want to do the 700,000 for dollar as a change that that would be a change over correct to change order it's not we're not approving it to be totally St exactly right but I don't know well a change it's not necessarily A change order because the change order got to be signed by Greg we're giving him we don't have we have to do that motion we haven't done it yet now we're on the third item so we're approve the council's approving the uh to spend up to 700,000 for the I think you all did it in reverse order construction 30 30% of the day the uh so we're approving we're approving the number and then you have to sign the change order as it comes we have to do a motion to for you to approve the change order as it comes but then try we're doing a a tenative budget increase to the contract 74,000 the only way to do it exactly it's not a change order to the contract okay run out and spend that we're not approving a CH other added to the budget 74277 okay the first motion is a motion to uh set the procedure for the town manager the town engineer uh to approve change orders uh periodic change orders uh as needed for the designed Bild to add uh additional subv as presented today the uh change order supposed to be once uh provided and reviewed and approved by the engineers to be signed by the town manager and one member of the commission as they come through second commissioner green yes commissioner Canfield yes vice mayor Stanley yes mayor Morgan yes uh second motion is to approve a tenative budget increase um which the town the town attorney will add to the contract as needed or with a separate statement of $ 74,2 2772 so the project uh subject to the change orders and Order to provide additional funding uh for the alternative uh Road installation with additional subgrade as need second matal commissioner green yes commissioner Canfield vice mayor Stanley mayor Morgan yes thank you very much okay uh moving on just passed out a chart provided by the police chief uh this was the budget discussion I was going to come back my my recomendation based on this request and what I would point out to you this is this page this this budget request is doing two things the first thing is actually the first page was to raise our starting salary from 66 to 70,000 you can see where that would put us I'm sorry mayor that's on the first page yeah no yeah uh and uh then uh a a $4,000 across the board increase on for our uh police officers uh would put us at the levels that have been uh shown to you on this spreadsheet by the by the blue is where we're at where we we where we're at now and with that $4,000 across the board increase would be in the red that's correct that is correct so that kind of puts us cheap with these different positions uh right now kind of the median range for the county yes sir so what I did was obviously a comparison of the salaries meeting the same organizations that we used previously in last year's budget and then kind of came up with a median number that was relevant to those agencies and that's how we came up with the numbers that we presented as part of our request uh so that's um um that's the that's the recommendation how do we avoid doing this every year so we we are uh addressing that we we are going to I I I I'll put a qualifier to your recommend to your motion that NE that in next year's budget that we come to you with a um we are going to start currently working on a step plan that will address these Financial issues that we're we've been dealing with on a yearly basis and try to put this into a three to five year plan where it's kind of a defined number that's built into a pre-plan agreement that we have in place in essence as a step plan that then creates a budget tool that we get to use for a longer period of time and we don't have to go through this process annually to compare we're having to do this every year it's like all these towns that we use are are in this this competition and uh I mean if we keep going like this I mean a 5ye police officers going be making $200,000 I mean hopefully we'll see some wage station I think we're starting to see it already to be completely honest with you um but you're right the last five years that's kind of been the competitive market in not just Palm Beach County but the southern you know Southern portion of the state everybody's competing because everybody's having trouble hiring and retaining so they're they're throwing money at it instead of you know having other alternative ways to address it and to be completely honest with you I don't think there's really a true alternative way to address it so we're in kind of the same position that they were in um we made a huge Improvement last year and stabilized things very well from my perspective I think this is something that needs to be done one more time and then I think a step plan will create that stability for us and Define a plan for officers help you recruit as well so they yeah they know what they know what their future are they know what the future is absolutely not at the wi of the commission each year correct and next year we have one more year left in our uh contract this is the last year of the uh PBA negotiation or contractual agreement at the town house so we feel like this is something that we can bring to the table got our collective bargaining agreement yeah um okay all right so what are we what um we're recommending yeah across the this is in the budget that we the tenative budget we looked at or no yeah I mean we could we can totally handle yeah and it would be updated for the the budget pass that you have to pass the initial one next this did not include the one that was passed last month it creates about just to give you a number it's about $48,000 Plus benefits so you're you're technically looking at probably about $65,000 for the year making total right okay yeah certain um the 4% portion was already included not and I don't believe we do no not the man want guidance are we in agreement with doing this I think they on annual summary of am so yes let's include that in the budget uh so uh the next item is a long discussion I can uh say that the town has reached out to uh uh Banks uh and we received one proposal that we're still reviewing and assessing and we we believe that we'll be getting at least another one uh and so we are making progress we uh uh we uh I was impressed I think our staff was impressed at the proposal that we that we receive um and I just wanted to let everybody know that we are uh you know moving forward with that so you'll understand that we are uh you know looking at a along or financing for some of this CIP uh Mark has done some some uh analysis on it mayor do you want just briefly yeah I think so um Mark if you can just touch on the numbers come up and you recall last month we talked about a um I believe we talked about this so number oh yes I mean so right so we we've always used even Back when Mark was you know making his uh comparisons on how to approach the CIP we were always we always use the number seven million and uh but I think this further uh defines what we perhaps might be looking for in some kind of while maintaining $4 million correct yeah always using the4 million qualifier yeah what what what this is shown is just an estimated of what what we believe the reserves are going to be at 9:30 2024 and then seeing what what we're estimating what the what the new costs are of the of the core project uh the 10 other 10year plan projects and the uh the Boon Beach connection and this is kind of a snapshot as if we had all those expenses being incurred by 9:30 2024 and where the town would be left and how much they would need to borrow to uh cover to to to cover that and keep a $4 million reserve for the town and a as as of that point it's around5 million dollars that that were estimating the town would have to finance to to keep that $4 million Reserve uh this doesn't there's obviously there there'll be changes in cost in the you know moving forward past 930 2024 the town would probably increase the reserves from the day-to-day operations during the 25 year so so those those things could adjust this number up or down uh in the future but that's just kind of a snapshot of where we're at at 9:30 2024 what are we thinking about additional changes to the current project over and above what we did today we still barely started the thing for future year uh projects Beyond this one oh this one that's a moving Target yeah I don't believe there's any known any changes but unknown yeah the unknown is I mean just consider this is this is very good I like this sheet and we can actually see what's going on and get down brass tax based on a date certain but you know we always get every time we get into this we like we use the term reserve for projects well we are hoping that what we worked on today is whether it moves it up or down but as far as moving that that that loan figure we've been working on 7 million as the borrowing number um draw downs and whatnot and with pretty favorable terms uh we negotiated with the with our banks EOS met with them several times brought in both Del field and Bob dockerty to review them and give their uh input and their assistance on whether the numbers being presented by SE coast and another bank we're looking at we good so having done all that and impressed with what we've got so far from C Coast um the question is with with with these numbers do we reduce that R I'm not so sure we do uh for the reasons you just mentioned who who knows what's going to happen it's not it's not a loan amount that we have to borrow it's almost like the 700,000 we're talking about right withraw on it pay interest on it uh and based on these numbers it looks like we wouldn't need to borrow at all we' be able to pay it back Mr Mayor is there a ticking fee on the undrawn portion sorry is there a ticking fee on the undrawn portion because that's the only cost you would have with having a larger number than than what we need I mean I assume I assume there would be if we reduce the reduce the amount of it I don't know I believe that the terms were when during the draw period you're just paying interest only on it and and then and once you find finalize what what the final borrowing amount is going to be it just converts into into the into the ongoing loan and and where you're paying the principal and interest on it so I it's up to I'm referring to about an annual fee zero balance it's in a different context where there's anywhere between 25 and 50 basis points charged against the undrawn amount because the bank has to reserve I just no that no then there's no the only noost yeah I think you're right the only big point is the is the fiveyear yeah but I didn't hear anything about no I didn't see anything in in the term sheet of of I understand what you're talking about now and I don't think that there is any are any no I think think would jumped all and in fact I I think Bob did say I think he that was a highlight to him was that there were no fees that you're Fe yeah it's just this balloon number which had us concern because it's a it's based on 15year anization but a fiveyear payment pay pay back which you which you B with these numbers that that sounds more reasonable to me we may not have to go beyond that some discussion of of making that a tenure and we may still look at that but that raise the interest rate yeah so I mean is the commission comfortable with where we're at right now and can move forward perhaps to to to maybe tighten up uh you know the proposal yeah it yes uh what's we're going to have some more meetings try to finalize these numbers a little better before we come back to you sure um I so I think we're in no rush absolutely we have plenty of money to keep this project going and we did discuss uh the rush versus uh you know if we were in any kind of a b to do this and and then the banker wanted to know that also he wanted to know if we needed to have this buttoned up by uh 9:31 or 9:30 yeah for the new budget year and I don't think we feel like that we need to do that any I I just thought we should keep you informed what sure because the numbers us okay I I just did want to report to you that Del Beach did approve our fiveyear extension for fire services and so uh so that's that's a done deal that's great uh and then we did receive our new FEMA flood maps um let's see where is that there there there is going to be okay yeah let me just read this to you uh FEMA has issued new flood zone maps adding thousands more pal Beach County residents into highrisk uh flood zones as a result Property Owners with federally backed mortgages and rs are mandated by FEMA to to obtain flood insurance uh the new maps are affected December 20th of 24 uh requiring County Property Owners IM mediate attention Palm Beach County will be conducting public Outreach meetings that will include representatives from FR FEMA and uh and the your town uh uh to uh to discuss these new flood Ms uh with residents and so uh the one that's scheduled for South County that were that we would be included in is on Wednesday September 11th 2024 from 5: to 8 it's at the Pointon Beach Police Department community room so we'll be sending we'll send a notice out to all our residents regarding these F Mas I mean that the the minimum the the the maximum or minimum uh finish floor elevation now is eight yeah PR much all of Street okay um going back to budget didn't we have a couple salary items to uh yes uh um I am going to uh uh our our town clerk is the is the president of this Florida Municipal Courts Association she has taken on more responsibilities in terms of she payroll now she's a human R Source director so those are two tless operations St to recomend amending a bump in in her salary of about $5,000 and I'm also recommending the the same amount for our U for Mr Anthony uh if he wasn't working here right now I we'd be having to hire somebody to be out in contract I I have contractors walk up to him and ask them how do I do this our owner rep right now yeah so I'm recing assume we're here okay thanks um all right um arpb meeting for anyone who wants to attend it's going to be in September because there's no Finance report done uh yes I there was nothing spectacular out no any questions no very good um that's F and water Chief so I do a report submitted and I'd ask that you accept the report as uh as it's shown if you have any questions I'd be more than happy to answer them in addition to that I would like to ask the commission uh to individually visit the police department if you have a desire to do so we've done a lot of changes internally within the police department lately and if you haven't seen it uh in the last year or so uh it would probably be a shocking surprise to you to see what's going on inside and um apart from that um are residents stopping by all the time or is it still how we normally do it where we catch everybody on the street corner throughout we still pretty much catch everybody on the street corner throughout the day but we do have some visitors from time to time okay um so okay got it it's just always amazing to me to come in in the morning hear some of the things that they have been involved in the previous day it's very interesting some is ring to the arrest number seems like it's up traffic contacts from last year the answer is that that is a it is not related to Crime that is occurring within the town it is related to proactive policing efforts to prevent crime from occurring thank goodness for our our cameras it's asked by someone in ocean ridge to provide the difference in because they noticed all the stops between last year this year I sent them a copy of your report where stops of 133 last year in July are now 973 ju this year there are some I'll just say this there are some officers I kind of get up on that are totally on board right now uh and I will say that there was the gentleman that was in the audience this afternoon or this morning that a
