public comment we'll close the public comment portion we'll move into our caucus work session first we have elected officials risk management seminar training yes mayor um so so you might recall I believe we discussed at the March 19th meeting um the need for everybody to be trained and um solicitor long was gracious enough to be able to uh arrange to conduct it uh as one so that everybody didn't have to log in individually at home and spend you know at least I think it's about an hour or so um solicitor long checked with um the GIF to make sure that he was able to administer the training and then everybody will sign a um group signin sheet and we've arranged for that I did circulate an email to everyone and didn't hear anything back uh with regard to May 21st at 6:15 so we would just it wouldn't be the meeting the meeting will start at 7 pm however you all will gather and uh solicitor long will administer the training okay so just want to make sure everybody puts that on their calendars I'll certainly send something out as a reminder um but I think we're good right Howard yes um be ready to go it's a stellar presentation but must say so myself um it has to do with government ethics some of you should pay closer attention than others um thankfully Regina will be back by that point in time she'll critique your work heavily I'm sure I'm sure she will and but she's um the other thing I wanted to mention that's not on the agenda is um I know everybody received the email from me regarding the uh annual filing of your financial disclosure statement just want to remind everybody about that um it is needs to be filed by uh April 30th so if you filed before which most of you if not all councilwoman Haren did it today um everybody it's easy enough to file because you've filed in years past so um you got that email from me I don't know couple weeks ago or last week um so that's it thank you there is I think it's a PIN number you got to find yeah all right uh next on caucus uh work session we have the tree removal replacement ordinance councilman oison all the municipalities [Music] ENT session commiss and I had a session outline doing that we need to Fashion General and then we have to implement a missile full permit process if we want to we have to have an application for for the requirements if we decide that we want to collect payment from the resid plan then we have to decide how we want the ordinance formulating an inspection process and setting viations there's a lot to this yeah we U as part of those storm water ordinances that we've been working on we were required by the state to do two additional ordinances one we're moving forward with and one we're not one we're moving forward with is private salt storage so that doesn't run off I mean municipals already regulated but the private places um so we have that ordinance on for consideration you may recall we also they've also sent around a template for a tree removal and replacement ordinance because of the benefits the trees has have to sucking up the groundwater and and taking that down so when I looked at the ordinance that they presented versus the ordinance that we already have we actually because of the formation of our shade tree commission have a pretty strenuous ordinance say protection right so it's do to say we can't change it to this because I just did what you're talking about because they have probably one of the more stringent tree replacement ordinances in South Jersey or maybe anywhere state so I'm familiar with what you're talking about Council um I did pull the model one that came from the state because it was really less restricted than our present so um I wrote in reading the regulations the reason behind why the state was mandating to do that they said that if you had this type of ordinance like we do and you have a shade tree commission that reviews these things you don't have to pass State mandated or so I sent them our certification of the of the um active nature of our shry commission which is recognized by the division of Forestry or whatever that is um the ordinance that we have presently and the ordinance that they wanted us to and um as I'm saying I believe we fit the exemption that don't have to do the one that the state has been circulating I guess this becomes a question of um you can do this yeah it becomes a question of how how much you want to encourage people to replace trees and then if they don't do it you want to have you have to set up a permit process for removeal you have to have application for do it then you have to have a system of enforcement and collecting fines for having repl the tree and then you have violations at this time it's a big process at this time don't we have the the ordinance currently has I thought like fees we don't enforce can I just get some clarification are we talking about just the street trees are we talking about any tree anywhere on anybody's property yes it's very very strenuous and what they did in Cherry Hill was they don't charge the homeowner you get like one one a year if it's dead it doesn't count otherwise you get one a year free you're filling an application describe what you're doing you do it creates work for somebody either expection sh if if you're a developer they would charge you like usually um in Li of plantings if it's not feasible $300 a tree and they establish tree replacement fund um there's not a lot of development that you see here um you're but you're going to be seeing some Redevelopment which could impact it um maybe but it you know it's up to you I can pull Cherry Hills and circulate it so you can get a handle on what's free what cost you know what it what the issues are what the permitting process is because we did exactly this and I mean I don't know if encompassed in your correspondence with but my understanding is shade our shade tree commission onlys to tree not trees that are on this this dis ordinance andin other towns passing is for all trees and most of municipalities set it around like the fact that kind we have but you have to have you know rules enfor to discourage people from just clear cutting the trees which are a benefit the storm would to run off plus you know water do what I mean I think the best thing can we circulate the additional information that you have like the presentation to the rest of council and then I think obviously we have to do something in regards to storm water management I don't think we do because of because of our I would respectfully disagree with councilman aison to one extent we have a shade tree commission that enforces thees the trees uh along the right rights most towns do not have that you're free to do whatever you want however you want take it down if it's raising your sidewalk take it down replace it don't ask anybody tell anybody you can just do it um the thing that came down from the state if we have a shade tree commission exempts us from doing this modest ordinance at the state saying you at least have to do this when I read that compared to ours I thought ours was a had a little bit more teeth to it frankly um what Tom is talking about is a good idea but it applies to every tree in your town whether it on private property public property everything is that the state mandating this the state is not mandating what Tom has it man it's mandating some sort of tree replacement idea um but it does not go as far as what we already have so I think headen Heights is because of the existence of a shade tree commission is slightly ahead of the game so I think think we're exempt from doing not that one but the one the one that I think we're Exempted from is a May 1 deadline this is something we would do it would be wider spread I mean there's an application process the idea here is put this in motion you have to ask to have rules so actually I think too there's some value here right out of the gate if if you require and I know other towns that do this because actually I think we had I had somebody call me about it and ask me do we have you have to pull a permanent Heights to cut down a tree in your own yard um this is an issue there's some H very honest tree work guys like Shoot actually is really good where a resident approaches him about shade tree he Flags it right away says do you even have permission for this right where you have others that you know these these smaller outfits that'll just they come on to the property and they say yeah no problem and they'll cut down the shade tree and they don't unless they get caught you knowe people yeah and they call them they call them R them out right but I think like if you put a basic you know if you put something in and you don't have to charge an exuberant fee I think permits we could set it whatever we want the idea not being to but really just to be able to track anyway yeah to track the fact that trees are being cut down in town and then my understanding what you're saying Tom the ordinance would also say is it something where you could do in L of the fee or whatever that and then the fee yeah I was gonna say and then it goes to am the max can do Under the LA is $300 yeah I think it's a good ide certain percentage can be used for administrative most has to go I can I can I can circulate this whole package and a presentation um that we did I didn't Cherry ho about a year ago um you take a look it's the same kind of thing Tom's talking about let's yeah I was say I have we can shift this around yeah if you want how about we circulate this Howard circulates he has and then everybody can Che on that and we'll let's revisit it at the uh the May meeting and then um and we'll uh we'll come back and kind of come up with a see where everybody stands on it what we do supposed to be well we're talking about two different things here so Howards Howards has to be done by the May meeting because that or or or be Exempted we'll be Exempted so that that's that's a whole separate issue which is what we wrote about today to say you I wrote and then you sent it to someone else so we'll see that in motion but then regardless of that regardless of that exactly Tom will circulate his presentation that he got and Howard will circulate his information that he passed with similar ordinances in the area we'll review that this is pertaining to all trees not shade trees all trees it has nothing to do necessarily with the storm water management plan have S we'll review that talking Howard is not that thatty that that was not there are the stre protection or we already have there are some protections that occur off off the off the line where the is overlap with I think both is what it's this is coming down to what what we're saying is legally the the legal end will be handled by Howard based on what the state says about our exemption yes right and then even if we are exempt there's there's an idea that there's a notion that I think there's a need to put something we would adopt another ordinance that or build on our current ordinances it was really popular in Cherry Hill because everybody was concerned a little concerned about they found out we were not charging the resident for on their private property that you were allowed to do one a year or a dead one obviously sense yeah there some situations we didn't charge the residents and that's what made it big but you had you have development going there where on if you saw on Crescent Road there you know exactly what I mean right I mean they just took a beautiful right just level everything they dealt with that man this app in Hill I know it applies to like the headquarters Firehouse had to we were only limited we actually they were like well that doesn't count it's dead to I added that in just to annoy you yeah thank you I appreciate do make your job a little harder um all right so we'll Tom's gonna circulate that information how will keep us updated to whether we're exempt from the legal end and the deadline of May 1 and either way we will still plan to explore all of this and discuss it further and now give us time to that all right Wonder uh moving on we got uh fountain at the railroad councilman I got aain hisory men's clothing business and when he passed away the business back in the mid I remember most recently brain but there have been times in the last couple years where the has failed toiz um used to be has it's constructed on 4 Bri with the PPS and tubs one of the problems is there's tree right overhead so drops organic Bean filter and maintain nobody seems to want to take responsibility so some ideas were thrown out there right now the P burn out last year P so the pump not operating so we can put a lower volume P we can make it run again then constant maintenance during the summer months has to be accommodated an so DPW they time to do it if they kind want to do it anymore so I guess we have to decide we talked about potentially they have self-contained FS it doesn't have waterr it what you do f up it just runsun back into and if you did that you could fill the uh the curent tub with oranic materi plant flowers in there too um it all depends on what you want the look to be I mean a lot of people like water you know some people wouldn't mind having in there do the water have that somebody that commit M right now now what I did is um we had all folks there and then I just recently reached out to to see if they had any interest in presenting some ideas I thought may they help create and then Kyle was to look at other pumps the next days but it should be able to get the pp off and running from now decide what we keep it running Council Tom I thank you for doing all this research and meeting with all the parties I know that is a that it's been a continued concern that it's a lot of work um not necessarily in a fountain that's not necessarily in the ideal location given that it's it's kind of in that tree covered region um there's no C I think the plan IDE but I know a lot of people might what the self-contained fountain that you're talking about what what would that that's I think what happens is water flows and then it flows back into a bowl like a smaller volume where it's not like right now when you look at it it's a pool you know up there so it's six foot diameter in the center is a two-tier fountain it's laid up on stack two two 4 in brakes so the pumps underneath and what happened before blew the water it blew out and drain now they're put a small triple down at the same time everything all the organic free get sucked into you Gotan right somebody's got be in there anybody to do that if we put a self-contained pump in the center surrounded by potentially planners then it would you know be probably couple so we're exploring those ideas so I thre it out to Heights Ros to see they actually have 8000 yeah let us know what they cuil all right um so I think we we'll waiting to hear we'll hear back from Heights grows and we're gonna open the fountain up this year we'll see we can maybe navigate this problem in the next few months as The Fountains open um as for care and maintenance um and then we'll explore our options to uh if we need to turn this into a a flower bed some type of contain that work you El it's definitely a different yeah right um that our officers and all the local retired officers usually go to John's grave site at 6 in the morning on the day just a little something that we do as the AL server show at 6 a.m due to shift changes where we try to get all the shifts that can make it get but we're not having anything as far as the Bike Tour usually comes through in May so we'll definitely let you know when that comes up
