scratch I don't know that everybody's gotten a chance to look at this um basic oops basically um this permit gives them the okay to do the work within um the confines of the property uh there's some language in here there is no wet ones but the use of fertilizers um attached to this order of conditions is going to be a plan that requires a it references a traffic management plan um also it's going to reference a planting plan that Thorndike development has developed for this site um they have agreed to file with the registered Deeds the storm water permit in the operation and and maintenance uh reports i b a little mistake there um they've pretty much complied with everything we're looking for there was some back and forth on the language and it was basically um some issues relative to there was some language in the original report that gave the the commission the authority to to make changes in the permit at any time which didn't make a lot of sense so we did remove all of that um so if everybody has had the opportunity to review this then I'd be looking for a motion unfortunately I don't have the attachments this is the package here if you anybody wants to look at this the packages are extensive um and I think in one of the emails we did include all of the the planting plan and the street plan and there was some information regarding the siltation sock did everybody receive that yep is everybody comfortable with that we don't so attached to this is going to be oh right right here attached to this order is going to be all of the information that they provided us and just give me a minute uh there are some emails that are attached that I don't believe need to be recorded so we'll sit down I'll sit down get into the office to make sure that none of that's recorded um if everybody's comfortable with the process then I would be be looking for a motion to approve the storm water management permit with special conditions I would like to put a motion Anki counsel for the applicant um so our review engineer received the comments from the commission's review engineer made revisions to the plan discuss them with your review engineer unfortunately we weren't able to get those plans complet printed last week so we dropped those off yesterday and it's my understanding from the chair that because the plans were delivered after the agenda was published that this wouldn't be discussed substantively but I will note that the commission's review engineer has reviewed the plans and did submit his response indicating that his um concerns were addressed and concluding that the proposed storm water system will result in less run up into Home Street than what was flowing to home street prior to the building addition and the clearing of the rear vaw um so we made this presentation um submitted these plans and attempt to address the drainage problems that people were complaining about at home straight um we've engineered the system and now that we have responded to the review engineer we'd like to proceed with a hearing for this okay you're requesting a continu it yes okay um based on the information which I think we received Friday or Monday I did respond attorney sisy that um those should have been here prior to the posting of the agenda I think the engineers review report just came in today so we need the ability to look at that adjust it and go from there so I'd be looking for a motion to continue this matter until October 22nd I make a motion that we continue 285 Home Street minor storm water management permit to um under a stone water management regulations um this is the first step of the process once we determine and this commission will determine that we have a completed application then we'll have you notifi the abuts and we'll hold a hearing just so that's clear so I understand you you mentioned that at the last hearing okay so when you come in on the 22nd um we will need all of the boards and committees that are involved in this process we will need you know their appr approvals so in the event you don't have them I would suggest that Thursday prior please request to continue so that we can plan our agenda but you do need everything approved everything has to be vetted correct well we we are before the planing board and we provided them with the updated plans as well we're scheduled to be on the agenda for their next hearing okay okay I I just wanted just so that you're away so that you don't come in on the 22nd expect a hearing um but that's process okay thank you okay next item on the agenda is the stump for cleanup um we we got an email back from the gentleman that's handling this and he's in agreement that um he will notify the office when they plan on starting this process um Kathy just just so that you know we're not going to be looking for any boots on this uh this stump broke cleanup um gentleman from um Fisheries came in made a presentation and they're going to attempt to clean the brook from Elm Street back to the dam in Halifax all by hand putting all the material off to the side um they don't require our permission and the board discussed it we don't have a problem with it um and they just followed up saying that they would notify us when they're going to begin okay thank you okay next item on the agenda is 21 Rich viw Avenue we're just going to go over this quickly we we got um some communication from a developer that wants to do some work at 21 Richview and we've determined that the work that he's proposing which is going to be Excavating underneath the foundation and taking that material off site is probably going to require a notice of intent um I've looked at the site I'm familiar with the site anyways um and that's the conclusion that we've come up with so hopefully he'll follow notice of intent if they want to continue on with the project this whole site is [Music] within whole structure I believe is all within 100 ft of the um one puncher plant so that's why and the fact that there's going to be moving Earth and I think the commission needs some control yeah especially it's so except like so much work being done on it all right um hope for Halifax um we heard their presentation uh I have not had the the time to to write a letter um I will um and what I'm hoping that the board and I'll share that with the board before we send it is that based on the open space concept I think the board is is in kind of agreement that the community preservation act you know for uses as far as conservation are going to be okay and I will have that letter in um by our next meeting uh virtual hybrid meeting requirements we've met all those um next item on the agenda is ensal plumouth Water Commission uh I did receive a letter uh a few weeks ago I think you've got a copy of that in file it was addressed to me as the chair uh it had some language relative to the city of Brockton not allowing some runoff towards the Jones River that was their concern that was addressed to um the city of Brockton uh I ask Peggy to share that with all the board members and all the Departments next item is uh board training and updates um I'm going to hopefully with our new agent sit down and see if we can get copies of the wetlands protection act and some relevant documentation and some materials that board members will be able to to review so we have a better understanding on on what we're doing okay um lot 11 P Road uh the board had indicated that they want me to to uh seek the use of town counil on this matter um I did reach out to Cody um and I had some ideas that would hopefully kind of resolve this without a lot of leny litigation I presented them to Cody today and he was supposed to have Council get back to us by the meeting obviously that didn't happen um we had a couple of options we had the the feasibility or the possibility of utilizing 21d of fines for non-compliance um the other option is try to get injunct of relief to stop any work I personally didn't think those two options would be beneficial to the town it's going to cost money and I think just create more problems so what I've asked is that we place this enforcement order in the channel title and when they're ready to respond we'll deal with it at that point any questions okay any questions and once we get this back from Council then we proceed from there okay 34 40 Plymouth Street um just to follow up on that the process has started on Plymouth Street I believe the paving is sometime in a week or two um the areas that are in front of Mrs Al's property have been mocked there's paint marks on the on the on the street I don't know if you saw them and those paint MKS indicate the directional flow that they want the water to go to we know that the water is not going in the right direction so I think it's a step in the right direction um they know which way we need the water to go so let's keep our fingers crossed that the people running that equipment get the water to go away from Mrs zeld just driveway I must ask this last thorm was it any better or any worse about the same about the same okay all I really did with this process is heat up the pain um just so they didn't have to remove it so so hopefully at the next early November meeting that will be resolved okay any any other questions okay okay we're going to and they were looking for a release so uh we we investigated it and we pulled all the records and we found that there is an open noi on that um it actually did not cover the lots that the attorney question is on but it's on the entire APLE so what I would like to do is is have the agent work with the administrative assistant from the planning board and see if we can go through that file and see if we can find out why the noi has never been completed at least not the process uh one of the things uh that Caitlyn is doing is going back um into our records of nois to see which ones have been completed and which ones are still out there uh cuz if you go on the website I'm going to say there's 15 to 20 that appear to still be open but we don't know so that that's going to be a project um so I just wanted to bring that to the board's attention the next item is meeting minutes I have any looks like we're going to carry them over to next meeting Peggy is still working on them oh I'm sorry I
