[Music] good evening um I'm going to call the helax Conservation Commission Tuesday July 23rd 20124 meeting to order uh at 7:02 um this meeting is an open meeting um I'm going to announce that this meeting is going to be take by area 58 and can be viewed on YouTube um I also want to make an adjustment on the agenda that uh got mistakenly left off and that's going to be 347 Helm Street which will add to the end to be signed you conditions first order of business 8 Hill the lane D number SE 17105 74 that hearing is continued till August 13th 8 Hill map 120 2T the EP number 171579 that hearing has been continued to August 13 8 Hill L map 120 y4t D number SC 17158 that hearing has been continued until August 13th next item on our agenda is Haywood Street and we are going to be signing the order of conditions there was a question on whether the peer review would been paid that has been paid so at this point Street it's special next item on our agenda is 265 Street I am going to take PRI I'm going to take another matter you don't one out of War but I thinker quick um if you don't want we're going to go to 105 col Road DP number SE 17105 P1 that's an noi continued hearing let Mr Webby if I could um there's a little confusion as to the review portion of this um we or I have not found the initial review on the weapon I do recall seeing some sort of plan to vegetate that particular section but I do not have it unless you have it with you a restoration plan I have a restoration plan yes okay but there was a review by ecosystems we gave the ecosystem two weeks ago okay did you get a copy of that review you didn't you didn't get the review I did not get a okay Tim she was there yeah there's no question she was out there there was a question as to where that inspection form was and I know there's some phone calls to the office today regarding the review and fees um so I think for tonight I think what the commission needs to do is to just go over what you you want to do and then we'll kind of decide what kind of action the board wants to take as far as that line attorney originally [Music] weent 105 we 100 Engineers went out there had g into the vation so then we located areas and this is live at 105 and we a is enforcement order and we brought you a restoration plan two weeks ago and since that what Tim has shown me today brought what that probably this should have G the office but it's okay but uh but basically uh yeah what what like to do B is he wants to get going bu the house he's a house Builder and he knows that he went obviously into the 54 area right here and he's more than willing to restore it back and guess something else going what we' like to do is proceed to H conditions whatever it's going to take to to do BS or whatever to do okay so I think what the commission needs to decide we can't make decisions tonight because we don't have any of the red okay um but I think what the commission has got to decide is whether we're going to allow them to go back into the the 50 or do we want them to I don't know where the structure is in relationship to the 50 to the 100 uh we want to okay that's a better that right now we're talking about this propos structure we have not filed anything bigger but he does know what he has to and this would be lot s okay so what's the what's the encroachment 17 between the 50 apprach isim no that's the the restoration area well that is the the the structure in the 50 between the 50 and 100 the next one between 50 and yeah that would be this are you know what that distance is between the red line and the house you got so I guess 2 24 so I guess with the commission's going to one of the things I got to consider is where there is an encroachment in the uh wetlands area um do you want them to continue to use the 50 as a no touch um or do you want to expand that area that's one question sure sign postage F something just defeat the proposed new buy away from thata problem so I guess one of the things that we're going to consider is is are we going to keep the 50 that's the way it is or to make that encroachment that that 50 make it 70 ft they can't work within 70 ft or the the other alternative majority was as far as post if you P gentlemen gentlemen okay um my conversation is is what we're going to do about the 50 there's been some some some discussion about putting a post and ra fence at the 50 put some something as simple as that the whole thing and I think we are going to require a bond for the restoration push so um I don't you want to come to the mic I'm sorry you want to come to you want to speak just come to the right just okay no for the record we have we we need we need it for the record we have remote people taking it so you got one right there just name the address name's Tim fosi landowner I'm saying is you could do the split rail fence and stuff like that's fine but any work into the 50ft buffer the 50t buffer is to keep anything going into the wet LS correct look at the photos if I do anything in that 50 I'm going to be disturbing the natural organic vegetation you follow me the vegetation is gone it's the picture what was there before exactly that and if you take letter so the previous owner comes out and hey and she's like that's exactly what's been the entire life she lived there for her whole life since a baby and you can also look at the loom pile the loom pile which where the house is going to be built the LOM pile is growing the exact same vegetation which tells you it's the same organic plants that have been there since we before we were born I'm just saying you want me to go in there I'll go and hyro seated I'll go for whatever but I think you're going to be digging into natural organic plants cuz we never d it the roots are still there we went in there to clean it we have a letter right from the home we took tractors and Lawns and wheels we cleaned it all right but if you want the split real fence I that's fine put it up with the post saying you're entering into a buffer zone uh you can't say Wetlands because wetlands are another 50 ft in so you can put the sign at the W but you're not going to put the sign at The Bu usually yes oh you're getting close yeah well it's a no touch it's a 50 foot no touch yeah people to know I was just saying I just don't want to you to think that it's baren and I'm going to go in there and stop replicating it's it's right now if you look at the photos my son's in that photo is 3 ft high in another 2 weeks it's going to be 5T High I'm going to go in there and plant the ceing see what I'm saying just I just don't want to create any more damage we just went there's no intent to try to you know anyone wants to come out and take a look feel free come on out I'll show you restoration restoration we we put on here is all conservation mix of seeds so it's not not a native lawn mix we are not proposing any shr trees in the C we're just putting conservation mix down and that will be wereing to get r two weeks ago we again we don't have the response I think the the board's inclined for those three conditions the special conditions um I did send um ecosystems an email around 5:00 trying to verify because I got so many emails I didn't hear back from him so if you want to continue this to the next meeting um that's that's your call yeah I'm sorry my name is John represent is part of this plan one question we have is if we're if we're going to do a bond what would it be based on I think right now we're still determining what the best replication is for the area and a bond should be based relatively on you know it's to ensure that what the plan is gets done so it should be roughly one or one and a half times the cost of of what it is to do um so just have question is to what the basis is for the F and then what the terms are for yeah the the bond would be to ensure that the area that's back from whatever it was and that whatever they determin once our review looks at it they determine that that's what's going on here for plants bushes and the bond is for that and and you're going to have a 2-year period that's going to be monitored for two years doesn't the order of condition itself um you know either through ongoing conditions or not releasing the order through a certificate of compliance doesn't that give the board the shity and needs to make sure that these not necessarily I've got 16 open orders and petitions right now I think we you know we're happy to continue this for the next year um want to go to a v just looking for a motion to continue 105 Comm Road August 13th I make a motion that we continue Comm V to August 13th second all in favor I'm sorry 265 on um so since we were uh here last on uh on the 9th I think the only uh really new information that has come into the commission has been the uh draft conditions from uh ecosystems that arrived I think yesterday um so at this point um you know we're looking for uh action from the commission on kind of the three things that are in front of them Pres um uh one as you'll recall there's an existing certificate existing order of conditions for the site from 2015 so we discussed simultaneous with uh issuing any new order of conditions certificate of compliance will be issued for the old one with the understanding that the work was not completed but the New Order of conditions would cover as inter that's on our agenda to be signed ler is it yes I see okay oh isum of uh yeah on the old project okay that's on the agenda I haven't seen it but we'll be signing that afterwards excellent so so basically we want to go into the order conditions and the special order of conditions um they were drafted by ecosystems the board has not reviewed them so I think the board has might have some different ideas on the special order conditions sure we we've had the chance to review them we have no objections um I sent an email there was they listed in the kind of the Preamble that there were five members of the commission and four so that that was really my only comment on them otherwise were perfectly amenable to all the conditions as as drafted Miss Evans did have some questions on the plan I had um one question was on the garage just and the corner of it is 3 and2 ft from the yes it just seems a little too close I don't know how can do any work behind it I would think it want to be a little bit more space building and not um so we discussed that at the at the last hearing because the previous plan was actually even closer so We Shrunk the width of the garages to get it we actually Shrunk the garages by 7 ft but since it's at the angle it increases it by a few feet off there but everything can be built from the high side on that the retainer wall can be the the um concrete foundation wall so I mean it it's a line it's close we know we have to stay out of it and we also agreed that we would put up um the orange snow fence as an additional marker um so that uh you know contract it would be crystal clear as opposed to just the you know the sils that can kind of blend into the woods in terms of its appearance um so we're amenable to that but I mean we're we're out of the 50t we plan to stay outside of the 50 Foot and we know how to do that construction yeah I know you're out of the 50 Foot just as far as ingraving or anything are you going to have to do any of that no because the walls in the foundation Cod straight down to the existing gr that's why we're doing and as far as EAS are getting around that building people are going to be able to do that uh there's no need to it to get around there that you can get access for the only area that the moow you would actually get access via around the pool building so it's not we're not planning on maintaining the area behind the garage and behind the retaining wall it's going to grow up natural and end up looking like the adjacent Woods eventually so again we we understand it's close and you know we certainly flagging with our you know our site contractors and as part of the preconstruction meeting they will be present you know representatives from this commission will be present I have no problem standing right there and saying do not cross um but uh that's that's that's would you be amenable um that that's her concern 3 and 1/2 ft sounds like a lot it's not because you're going to over the date for the foundation um would you be meable putting a permanent type fence whether it be poting ra probably in that particular area M uh so that you know snow fence can be moved no fence can be um I would I would recommend a um you know a chain fence with drill them into the ground you know so it's 6 ft High very visible um and again not not movable um I think that would be again one of the clearest barriers that you can you could have there and we could you know we can put a length of um I would take it from kind of the garage corner to the uh the the Cor can be specific uh basically this area right here so in terms of you say 75t a fence it's it's tight for about 50 ft so go 75t do mind picking some Wetland flags and let's go for wetland flag number cuz those those flags still up there so yes but we next not the wet themselves correct you got to put 75 ft but where is it's w flag they numbered are WFC or something so if you're going to go flag B4 and B6 so we could go from let's say kind of B6 to B2 that would be from kind of here and here so that would like is there any concern with any activity going anywhere else property is this you know again because you know we are working close to the 50t and in order to avoid we're getting into it we're building so this the back of this is a retaining wall so this will have exposed concrete going down to existing grade this is also a retaining wall so there's no grading that's occurring on the low side anywhere along here really anywhere along here either so it's it's a pretty you know we're not creating a 2 to one slope or 3 to one slope that you know yeah that that slopes towards it so there's no new or steeper land that's going towards foot um uh again that's usually where it's most vulnerable as you get into this area this is an existing potention Bas that will keeping so there's really little Earth that's occurring you in there so the uh the main the main thing is um the uh uh discussion about regarding the variance um was the uh there's a drain that kind of goes out uh let just this make any questions no I'm not said we talked about the last meeting I like the idea of a permanent fence we clarifi to the record there's going to be a 75 ft chain Li fence approximately from B6 to B B6 is it yeah B2 B2 that's the best job you okay with that um one other question you have within the 50 The Spill I'm going to call it a Spillway it wasn't wasn't marked on the plane can you bring that up sure so right there right here so there there's an existing Spillway that's there okay is that a Spillway uh yes it is okay it's just not delated on the plan as a Spillway the one before it is that shows as a Spillway that one okay so this shows SP like you're talking about over top for emergeny and then this is the ri R area out at the disu so at well you know and what we did is we on the previous plan we had this pipe that basically serves as an outlet for well today and it was going uh a little bit farther uh about 25 ft from the wet LS itself so we cut that back and we basically have this one discharge area area that serves these three pipes so we kind of to mind it and that discharge is there now serving the two pipes we're just going to have it serve three pipes now um just for the board to know I'm reviewing the plan and notice that that is within the 50 um and I've requested and they submitted varing from our local regulations to work area um the next section I believe is going to be the replication area so this is the proposed uh replication area and as you recall this replication area used to be located here sorry right here that was part of the original order conditions and as part of peev comments uh it was suggested that we look for an area that would be less disruptive I think both our consultants and ecosystems agree that this is a good spot and they uh I know within special conditions they added language about the process that was very specific in here in terms of uh youate you expect the bottom of it to make sure you're at the right elevation relative to groundw that gets blessed move forward with your soil and your plantings etc etc and we understand that you have to go through two Gren Seasons um for that to be uh considered complet established and if there are deficiencies along those two years they need to be supplemented additional plan or whatever to you know to accomplish so that work is also within the 50 the original work was within the 50 ft but but honestly I prefer having the variance to uh to address this this issue even if it was kind of a um uh in part approved as part of the previous uh order condition any questions from the board uh I don't there's no test pits in there so you're going to probably supplement that gravel soil with some hydric soils that'll be part of the restoration y okay yeah there's a cross-section that has the appropriate soil the only other question that I had asked on site is I know you said that with the math that I looked at it looks like you got about a 6t depression MH um and I know you got some trees in that area I just want to make sure that that's protected so that we don't get anybody from the facility next to Door traversing over there yep so I mean that's a field adjustment you can make I know this in trees is the lot line that was the only other concern that I had yeah this there's a not from says replication 1550 Field located to avoid uh mat maple trees plan in terms of the go you're minimal to make us some adjustment so that nobody can travel over okay any questions are there any questions from the audience on the notice of intent for 265 um mon sh I I think they've addressed all the issues that we had it's a big project and there'll be a lot of oversight so if there's nothing else I'd be looking for a motion o hi uh Amy tro to Hill Side Al have you received the full documentation from ecosystems on this on this project okay and um have have you gotten any any comments on the fact that their turtle um barriers went up before their required and allowed date they went up they went up before May 15th which is not not okay we're here discussing in a l the turtle program they provided us with the turtle plan um I believe that they're complying with that that's got nothing to do with the NY okay so you do have have that in hand though and you you're aware that that they've been working within this with before all of this has been decided and you just heard them say that they were working in the 50ft buffer zone and that's okay but it's not okay for your previous applicant it's true I think you're getting off Pace I'm asking don't know anybody that's working in any 50 foot Zone he just said it corre well I don't know that he cut a pipe he cut a pipe but we're not this has to do with the notice of int okay well we were just talking about is working in a 50ft Zone we were on the site last week I didn't see an activity you SE any activity okay that they have a turtle plan in place um they brought that to our attention they explain that process as far as the turtle that Turtle plan goes along with a no of intent but we're here just to discuss allowing them to work with I'm just asking you to look into it please don't interrupt so let me finish and then if you get something else to say go ahead I said I'm just making sure that you're aware of it because it's a very big deal so I would be extremely careful about allowing this to move forward where you they just stated that they changed an overflow thing and changed all different piping and all that before there was actually an order or conditions within all of those areas and I think that the previous applicant was in trouble for that 2 seconds ago for taking lawn mes out of the Wetland because he has oil in them and things like that but now we're okay with it I'm just showing you there's a major difference thank you any other comments from the public okay I would be if the board soed i' be looking for a motion to approve the notice of intent but the AP number se1 71 0578 with a order of conditions and special order of conditions which will be drafted we're going to use the special order conditions that we had but we're going to make some some addend to that so if you want it's easier I'll make a motion okay I'm agenda items just going to clean up a few things and then we'll get to 265 um we do have an 8:00 285 Home Street um our next item is 285 home streets an update I've reached out to the Town Administrator on this particular one for the use of Town Council regarding stor Water Management I'm waiting then backwards 340 P Street have nothing to update on that other than we're in the process I will be following that up with Highway um when they get ready to pay so something's really chap um next item is the lingam Street beach on 4th Avenue um I got a call from the Recreation Commission last week and they needed to cleare some trees or some brush uh at an entrance way um and I felt as though that it was just preventive maintenance and I gave them the okay and they quick question on that what type of trees in size or anything or no they weren't cutting anything trees they were trimming there's a pathway that go Tri it yeah there was a pathway that goes to the water they just needed to trim some trees trim the branches and we're going to have an IUS do it I don't believe it was done but they s it commiss next order of business 2651 Pon Street that's the Stone Warner management plan David do you want to speak to this so um so essentially we're looking uh for the commission to acknowledge that the application is complete so we still need to go through the formal notification process upon the commission and of uh uh again agreeing that the application is complete so now that we have um what I would call a clean letter from from t thre regarding the storm water and uh we've gone through the notice content process for that same parcel um I think we've uh addressed uh you know any of the let's say potential issues that might come uh come up this part A as part of the St permit so we're seeking for um uh acknowledgement that the application is complete so that will allow us to move forward with the formal notification process in the newspaper notification for letters and unedu future okay I just want to update the board part of the stone water management process the um the applicant is is required to perform certain functions which they have um we've notified all of our departments we've gotten comments back from some of them we haven't received any comments on our last email went out but I'm comfortable that we we have received enough comence so that we can go to the next step which is going to be to advertise this okay and then we'll have a public hearing um to go over the S process um just one thing Dave I want to confirm these notifications for regular First Class M correct yes that's what your ask yep we we will as as an extra belt of suspens suspenders we'll get the green cards as well so we'll we'll do it certified even though it just says first class so that's kind what's that certificates I I would suggest certificate of mail okay certificate of mailing would be sufficient I mean they're only requiring first class if you get a certificate then I think that's going to be fine um So based on that um I'm going to be looking for a motion to um allow the process to continue um they're going to contact the office and they'll set up um a public hearing which is probably going to be in September so might be easier if I make a motion um I'm going to make a motion on 265 mon street that the storm water management print application is deemed complete and we're going to schedule it for a public hearing I second the motion all any discussion all in favor David you're tuning again development so 266 it's really basically the same uh situation where we have uh um where pgb Engineers has reviewed the stor water issue letter saying that is M plans um in addition believe since this commission uh and its last hearing the the planning board has issued our site plan approval uh for that lot as well so uh that's really that's really the update so we are again looking for the commission to deem that the application is complete so we can go for with the public notification process just a couple of things on that um on 266 um we did have there was a few comments we did last year we had some comments from the fire department we had comments from Highway and were those adjustments made what were the comments and so the specific comments from from the fire department they were concerned about um access around the building and there were two components of that one was the width of the uh exit um from uh the rear of 266 and the chief required that uh we widen it from 16 ft to 20 ft so that's reflected in the plans he also was concerned not really a would say not this is not something that would show up in any site plan modifications um but he he was uh wanted to get a better understanding as to how the ladder truck would have access to the building so um additionally we supplied them with a uh a graphic basically a cross-section um showing that the uh the latter um Tower one within town was um more than long enough had a ladder more than long enough to reach the roof of our three-core buildings um in addition he wanted a hydron near our sub of entrance which we added to the plants so those were the fire department's comments and as they were um addressing and Highway Department yes the highway department uh their primary concern was drainage at the uh two uh entrance points so there's been um uh it was communicated to me that there's been issues in town where water flows from um mostly commercial developments into the street causing flooding in the street so he was very concerned that there was appropriate drainage at both uh uh entrances to our site that would capture really as much water as possible um and send it to uh the storm water management system within the site before it went into the road so we made um a couple of modifications to our plans um and we uh we discussed a few different options his preferred option was to provide basically a um so if you have a driveway that's descending like this you put your drainage here and then you have a little hump Downstream it before it goes into the street so that it would kind of puddle behind that hump before it went into the street so that was that was the modifications that we that we did and um uh at the at the planning board hearings so not in front of this commission there was a discussion about that specifically where um Pan actually presented our changes to the to the planning board and um uh again was um uh approved of our um means of addressing the highway Department's coms one quick question about that on the um the the changes with the runoff water and the highway department that's involved in the storm water management part of it also uh does it change it yeah so the um uh there's there's an overlay so the in front of the planning board they also are focused on storm wi and then you're focused on St your stor dep so it kind of falls under both of those um umbrellas so P kind of did the same review so he did view yes okay they did make some changes I change obviously to Still Water they spent some time with with the highway department because the the original proposed plan would have created the same problem we're having on plumet stre okay so they made the necessary adjustments uh I think originally he wanted to Crown the road but um I saw that you did create an area for that water to go in both bases and the St water receptacle would be on the nor side can handle all yeah it was I would describe it as a good better best situation we had originally had a good design and now I believe we have the best design we don't want any water on okay anything else no those were okay responses to your questions okay this right now not going to bring to the public only because we are going to have a public format um I believe they've met the burden um they've completed everything as far as the application process the next step will be to hold a public hearing and all the public will commend and address the situation so so based on that I'll make a motion that the stone water prit application for 266 uh P Street can I ask a question yeah okay so just so uh just to be clear um the only change to the water waroff is in the front of the building there's no change to the side of the building where uh 58 is it 58 or okay basically what we doing here tonight is under the under the regulations okay very Qui to take their plan have it reviewed we send it to all of our departments they review it and they have comments once that's complete now we go to a public hearing process which at that point you get up and say okay I'm concerned that you know the water from on the North side is going into the liquor store or there's there's an issue with the water at the rear of the property that might affect uh some increased runoff onto uh some back land that potentially could affect yours so the process is the public hearing process this is kind of this is the way yeah it's the way the St management regulation okay so we going to make a motion that we um 266 on poner Street they met the burden and then we're going to go to a public on this particular for second all secondly motion all in favor okay the next item on the agenda and we going to get to an appointment uh there 111 River Street uxo survey it just show members of the board um we have an application an Noti of intent that was filed um it hasn't been um you don't have a d num so it has been scheduled the an engineering company wants to go in and clean up 111 River Street or how many acres it is with ammunition that's been out there since the 40s and the 50s um I've asked them to provide a narrative the the application is in 96 pages long and I thought that was a little long for us for everybody to read um they did send me a narrative and I had some questions and answers and then include them in the narrative so once we get a DP number we'll get that together and we'll discuss that uh quick question was there any ammunition or anything found on the property there in the notice of intent I know it used to be a there there is ammunition there in the notice of intent they showed pictures of so and I think there's enough people around to know that there is spent ammunition here the pictures showed 20 mm and 40 mm and they have a plan a company that's going to commit but we'll we'll vet that once we get the application he's going to name a clock but we can maybe pay bills we don't have any bills but we got some meeting minutes from June 11th oh I'm sorry yes front I didn't miss anything I'm sorry okay come on first one 129 Circle Street on the previous thing on 11 Riv stre does that cover any of chemicals they might disturb too if they'll release it all into the streams and um I what I have is an informational package and it was very lengthy it's a plan um basically what they want to do is go in locate any ammunition that's within 3 ft of the surface remove it there's some language in there if they have to go into the wetlands and it's safe then they will go in want to go in if it's not safe or it's going to create more a hazard than they want that's about all I can really tell you they provided some pitures um but there's a lot of questions what do you do with the ammunition where is it going to be exp a I know under a separate number in the same area that this one covers they also identified Asic and other chemicals and they dump sludge where we can see everywhere in New England now where they did that everything's polluted with P chemicals so I didn't know if they go in there doing the ammunition if they'll upset things and they'll be run off into rivers or what is think you're talking about the sludge is the uh materials they came out of u r and the septic waste yes okay I believe I think it was all the same area where the ammunition is too so um probably going to disagree this area here if I if I'm correct where it is is pretty much wet it's a wet Meadow where they put that material was farther up north uh near the middle of our line and they plowed on I remember seeing that stuff there the problem is that there is regulations that allow them to put so much of that per acre there no question that it wasn't followed but um to my knowledge this L is not part of that parle okay they broke this parel out um a year or so ago with planning Ward and they might have broken it out just so they could treat it but please come to the hearing and we'll have get all the questions answer I'm should be issued to 265 even though it was work um by uh Halifax Trails because we're requesting it I I believe that's the process on that process is she to be in the old person's name well that's my that was that's my thoughts so the origin so they're requesting it so what they're doing they're looking for question which is correct and then it's got Alan cim back here as the property owner okay and it could very well be okay um I'm going to be okay with it if it's wrong they're going to kick it back the name is on here yeah they're going to kick it back so we're going to have has been reviews to rotate them mhm okay this is in regards to yeah looks good just the name Mr Clemens uh Jo Clemens from Hansen um I just want to take a minute we in the past we we had to go to a peer review Consultants because we haven't had an agent um and we discussed prior that we need to have a couple of different peer reviews um who sisters were busy um and I thought it's kind of important to have someone local um I am committ with Mr per he's a resident for prob I'm not going to say um all my all his life okay um yes um I know him orally well I know his background Mr comment well thank you for having me here for the record Clemens and 46 Main Street Hansen all my other residences have been in Hansen since 1951 so um spent a great deal of my life uh in the outdoors of Hans and the region and around here so I'm very familiar from personal experience but uh academically I got a Bachelor's and master's degree in biological Fields went to college in Connecticut and then Southeast Mass University which is kind a un start with and had a lot experience in the private World wherever I had been from 1976 to 2010 U I always seem to be the one that put in charge of Environmental Compliance as well as many other forms of compliance environmental audits environmental site assessments and things like that pretty much all around North America but a lot of it is in New England and here and both in my spare time during those years and in the years since I retired doing Wetland delineations I've worked with u i sister who Sharon report who for a period of time was agent here at HX and uh she also was doing consulting on the side and uh I basically inherited her business I changed the name from L the woods to Tonk Associates Tonk having a local historical interest to for those of us who are think interested in those things but I have been involved in the Hansen Conservation Commission actually starting back uh 43 years ago I was on the Commission in the early 1980s then took uh 25 years off to take care of family and career and then was an associate for about 10 years and uh nine years ago was appointed to the commission and for eight of those nine years I was chair of the hon Conservation Commission um just the end of this past June I asked to be not to reappointed I felt my dues have been paid I believe you might call it train limits I just call it common sense and I do feel that I have quite a lot to offer I've done Consulting in Halifax both into delineation and reviewing the delineations of others I've done the same for the town of pouth and the town of penri and would look forward to doing more I spent a great deal of my life walking around Smalls and things and hope to continue that for quite a while to come and as a member of the caner commission and as a private citizen I availed myself of as much education as I can get my hands on I'm a member of the Society of wetland scientists and I've been almost all the Massachusetts Association of Conservation Commission meetings in the last 10 plus years and numerous workshops in between uh went through all of the fundamental that Commissioners are encouraged to take and try to remember everything and have papers to look it up if I don't uh so I would look forward to be a resource to the town of HS or anything along those lines that people make your mind okay thank you um I just want to take a minute I'm know for it so I think our fathers were friends maybe first grade yeah first grade um he's been on the commission I've been in front of the commission many worked on a few small projects um I once we started looking at peer reviews um I think ecosystems a great job I was inclined to try to get um people that are familiar in the area um I remember when Chon was the agent in town um and I know he's very heavily involved Hansen with the not so much with barage sm's B in that trail uh is it the Bay Circuit Trail yes the Bay Circuit Trail is something you can look up our website bc.org but it's a an almost 100y old idea that in the last 30 years has become a reality especially the last 20 it's a 230 M on trail but not a back country what they call a front country trail it goes through cities and towns and Parks as well as uh fields and forests and um natural areas and it's not just a trail it's also a Greenway the bay arec the trail and Greenway and I've been working for the last 25 years with my people who um advocated for and done a huge of my work to make it a real thing um I actually was had quite a lot to do with the bar Pond Wildlife Management Area coming into existence I pointed out the area to Department of Fish gang when I was still on by Northland cranber Northland was in the process of almost failing we all know what happened to the price of berries about 30 years ago and it's been very satisfying to see that come to fruition I worked uh personally with uh Secretary of environmental Affairs Bob Durant as they were deciding whether or not to advocate for that and worked with Town officials in Hansen and others and actually was part of a small team we get in a short period of time we got about 1,500 signatures of registered voters from the eastern part of the state primarily around here supporting that acquisition so it happened and a lot of people are happy about that we think it's a great resource quality of life has been significantly enlarged I think in this region but above and beyond the human quality of life I think the Environmental Quality has gone up too because uh the burage is a resource for everything that you can think of the as we all know the advantage of mon Pon Pond flows through stun Brook and which flows through Robins Pond and the Herring are run their way back up hopefully some year they'll be here but there's a many many things are related to uh water and Wetland resources and we all know that the regulatory uh home of those things is right here at this commission and other commissions and it's I think good to be in communication with and practice with as many other people and agencies and organizations as possible and I've been building those Partnerships for some decades now and it's been very successful we have in this region this Northern pth County we've been unol as suburban sprawl has come this way it's not done yet in fact it's sprawling around us and uh what we're trying to do is protect the resources that we need for our water and a wild life and again quality life Recreation Etc uh while that spra continues so that uh so that as much as possible everybody wins but we still have water drink air bre things like that and trails so as I was saying I'm known f um I feel very comfortable he's got the ability he's looked at more plans than I have um and he's had the expertise so questions from the um yeah seems very qualified be great uset to help with the pay reviews and he's familiar with the area and the soils and everything else soon because it's next time over so and you just want to point out what we have yeah what I wanted to point out is when when the commission decided to go out the peer review because of the lck of an agent um we are basically looking for individuals that will look at that plan for us um and advise the commission on which direction it should go look at any specific issues in the plans that we might not recognize um do site visits uh and prepare um special order conditions of order conditions until till such time it's sounds like um a little bit above and beyond what uh some peer reviewers are asked to do in many cases they simply asked to look at delineation and to comment on that and um collaborate with the original applicant and so on to to uh make sure that uh things are correctly uh but certainly uh the um the range of tasks that are associated with reviewing any project it's a wide range and the bigger the project The Wider the range and uh sounds like that's some very interesting ones coming along here um I personally have tried to be involved in uh many many projects both inside and beyond hansome for example we have been tracking closely with great interest the uh project that's best known as the fireworks project in Hanover since Hansen is shares the water shed the drink water the IND head River we've been in contact with our praties for a number of years now tracking that and that's not done that's project is Le I would say an interesting point of perhaps being handed off from DP Mass DP to the EPA uh I hope we all live long enough to see that completed in in a good way but uh as far as other projects go uh one ought to look at everything just the way you said in in many many different ways and make sure now your eyes dotted and te's crossed but nothing's been practically overlooked and information is presented uh get that information to the extent possible and basically give your commission the best advice possible question I would be looking for a vote um that the commission app point Clum TK TK Associates um as a review consultant for the I'll second that motion all in favor well thank you very much looking forward to working with you um I'm going to you can just me for one second I'm going to ask the board um based on on Phil's interaction a little bit with the handle the fireworks this Munitions issue that we have on 111 River Street that's the source of this um there was many many years ago that's where they developed all the ammunition that went from Atlantic Research and then it went to H hen uh fire my memory is correct right uh I wasn't alive then but some of some of my siblings were one my siblings were and as an anecdote uh one of my older brothers was now the town historian as a young lad was fascinated during World War II when periodically a half track would come down or come up High Street where he lived on his way from the hanova manufacturing site to to its Halifax early in the morning with a large plate of Steel in the back and that machine you could hear miles away so late in the day they' hear the noise the the machine was coming back with a plate of Steel that now had a very large cold in it so the speculation we have is that it it was being tested or the munition was being tested for their ability against armor and to the extent it was a whole it was successful uh but it sounds like you're looking at where those tests took place which is a wise thing to do I have some familiarity with that area uh in that it been an open space resource to many people for many many years for decades really and the streams that go through it and the swamps that are or used to be in and around it uh fascinating area worthy of protection tremendous Wildlife Resource uh not that the edges of on streets don't have development potential because they probably do uh but again many things to consider and uh they collectively everyone do a good job on that what I'm going to ask the Bo and and we did give we left that up to the administrative assistant to sign these and if the board has no problem where he's got a little bit of experience and knowledge with the fireworks I'm going to ask that one of his first tasks be this uh X uxo Sur yeah have no problem with that yeah whatever comes forward with that yeah good um I don't I'm going to have to check with really I don't think there's anything feel what you need to do with the town um but I'm going to have to check with the administrative assistant um we get paid out of the 52 G fund not all familiar with that but that's something we can work on with with K right I think it's the type of project that calls for uh very clear settings of expectations Ries what what are the necessary steps to be done uh by by when Etc um again it's somewhat unique among projects that probably come before your board you probably been to many exactly like this before uh if any and so I know I would have question if I were involved with that and uh I guess through Peggy uh and Alan we would pursue answers to those to make sure that uh I if I were doing it uh I knew exactly what was expected what was needed and why and therefore be better prepared to meet those expectations not not pertaining to this project things but famili SE with very well knowledge about many different things like um if you ever read about or anything about removal of ammunition and anything else near Wetlands or anything like that have they come across anything like that to the extent that the Handover project involveed that and uh it still involves that uh it's not just a Conservation Commission concern there's definitely Public Health involved Public Safety and uh shall we say a team of of in example uh not just local but State officials have been involved and the contractors hugely involved in a great deal of communication uh because when Munitions are found you don't just throw in the back of a truck and take them away they need to be uh deactivated as they say I know in Handover for a number of years now they have fallen into a pattern whereby uh whatever they find during a period of time a week they would schedule detonations by I think literally by the state police fire uh great job uh denate on Friday afternoons with notice several days ahead to the public through a wellestablished uh email and other systems um who knows Among Us probably nobody yet what would be found how much and so on but I can't imagine that the uh authorities at any level uh certainly the town or state level would have anything other than a a well thought out and proven protocol for how you handle these things how you keep the site secure in between uh well throughout the process and uh I think that part of the protocol would be um how you do the looking if you need to enter a resource area to look uh how you do that uh certainly Public Safety uh including the safety of anything living in the resource area would would be better off with the uh anything explosive removed uh but there would need to be a very clear and approved plan to be followed and uh You' want eyes and ears observing to make sure that plan was followed and and the part of it that involves the natural resources I'd be very satisfied to or shall we say confident having an involvement there the parts that involve other things such as the actal chemistry of the explosives the uh procedures for qualifications of people doing at security um that probably is a little bit outside that definitely be a little bit outside My Lan um but I feel that this board right here certainly has a lot of core responsibility because the work would be in or near places over which you have jurisdiction yeah I know this point that invol of it but Public Safety really huge out there because we all know kids right dirt Bank squads everything around that are it's it's a an area that's somewhat different Handover is almost what you call wide open hanov has an advantage if you will being surrounded by uh some Sid by the water barrier and the barriers of uh that you'd find for security in the industrial park which they have and develop homes which everybody protects their own property this area is um show we say less surrounded by anything resembling a barrier other than maybe swamp it can't walk through so it would remain to be seen how the various protocols and precautions would be developed uh and be happy to be part of that to make that possible just to answer this question I'm not involved in it I just got some knowledge they they had unexpended ammunitions that went at the factory pwn Factory pwn has been tested and I think it's got heavy concentrations of Arsenic and some other this Mercury as well Mercury that you know what a ski shop is Winter Street and Hansen okay it's in that general area Winter Street and Hansen ski shops on the lot um Factory Pond is it's an impoundment of the drink water river been there for a long time and they used to fire things across it and maybe even dispose of a few things in so that's what they're looking for and so they have they're in the water and then they're looking at areas um around it they've been they've been there for a year too Downstream as well uh there have been sediments transported uh some confined by the dam and some that very likely originated there but went downstream during periods of high flow sampling has been done at about half a dozen sites uh including empowerments on the Hansen handle line on State Street in Hansen and further Downstream um near and below the U West Elm Street bridge and the dam there between Hanson Hanover and Pembrook and the whole the north north south watered Association is tracking this carefully to but when you have a sizable stream like the Indian head and drink water rivo complex uh and that much activity um you got to look now or else future Generations will not think well of us uh as far as this other side goes there are streams there but it's not the same situation to me it seems like uh there's a relationship yet to determined between where um ordinance might have been exploded or fired or whatever and the stream bed themselves there may be much less potential for transport of chemicals whether it's Mercury and Expos to the Mercury fade or or any AR or anything they weren't things weren't manufactured there they were simply fired or hopefully fired and not left behind in unfired condition uh this shall we say uh work to do and I look forward to catching up on the paper if you so choose and we do so
