you all right back on April 9th 2024 we had uh a meeting and uh are there any corrections to the minutes of the April 9th 24 hearing none may have a second to approve the minutes of April 9th 2024 chains and cones in the public right of way first of all do the board members have any expart Communications to disclose on this okay at this time I open the violation hearing turn it over to Adam mazowski our code enforcement officer good afternoon my name is Adam owski town of Highland Beach code compliance officer and I've have been previously sworn in this is case number cc- 2464 the property address is 23 395 South Ocean Boulevard I inspected the property on March 4th 2024 after receiving a complaint from both fot and Public Works the notice of violation was served by certified mail that was sent on March 4th 2024 the respondent was given 30 days to come into compliance the notice of hearing was served by certified mail that was sent on April 24th 2024 prior to today's hearing I reinspected the property on May 10th 2024 and the violation has been corrected I have submitted the following evidence which includes proof of service supporting documents and photographs the town recommends that the respondent be found in violation of the town code AS alleged in the notice of violation the town is also waving prosecution cost in this case Okay so um are there any questions for Mr xowski from the board okay so would that be a violation number two because you're going to wait we don't have nothing yet because we still have the uh resident who's gonna she's here she wants to speak about this right um correct where's the pictures do you have the pictur yeah I have the pictures but they're they're really kind of yeah you'll see little cones a little con cones a CH I guess there's a some some other little thing sitting on the right away it looks like a chain or something okay but nothing ma'am would you like to come up and say anything come come up here so we can hear you speaking the mic just say your name and and uh my name is some side and I would like to know if I can put the cone more inside with the chain because cars are hitting the cameras all the time all right uh that that would be a question for code enforcement and uh they could you can keep the con where they are now they just need to be closer to your property not the street fot is going uh town is fre to wave the cost of prosecution but we still need to find that a uh an offense was committed so it's a number two but waving of the prosecution that means it was corrected it was Michael and Sarah G WTS from 3912 South Ocean Boulevard number 701 that's the regeny Highland Club um the violation alleged is hermit changing all existing Outlets to afci GFI and kitchen only expired so only the one in the kitchen expired uh change all existing Outlets but the one in the kitchen expired there's other ones that aren't expired uh do the board members have any expar Communications to disclose no at this time I'll open it up our code enforcement officer my name is Adam osowski and I've been previously sworn in um this is case number cc24 d78 the property address is is 3912 South Ocean Boulevard Unit 701 I inspected the property on March 6 2024 the violations that remain as cited on today's agenda are 30-1 122b expiration of electrical permit e23 D 0012 the notice of violation was served by hand delivery on April 5th 2024 after certified mail was sent on March 6 24 the respondent was given 30 days to come into compliance the permit was issued on January 30th 2023 the permit still needs to pass the final inspection which has yet to be scheduled the notice of hearing was served by certified mail sent on April 24th 2024 um the property owners are here and they'll speak on the scheduling for that um permit prior to today's hearing I reinspected the building records on May 14 2024 and the violation still exists I have submitted the following evidence which includes proof of service supporting documents and photographs the town recommends the respondent be found in violation of the town code AS alleged in the notice of violation and be fined $250 per day for each day the violation remains after the date set for compliance the town is asking to assess prosecution cost in the amount of $250 payable by the date set for compliance okay um board have any questions for Mr sski on this I mean I my question is just that you know underneath the code section is 3122 expiration building permit then you have e23 0012 changing all existing Outlets to afci and kitchen only expired I'm a little confused about that uh so all the other ones are fine and just the one in the kitchen expired no they did the remodel of the kitchen so the way that the electrician pulled the sub permit that's the project description that we copy from the expired permit to the notice violation so they only did the outlets in the kitchen that's why it's on the project as only only the kitchen correct not the rest of the house correct so they need a separate permit for each room in the house if they're doing a remodel yes they only they only they the only work they did was only in the kitchen oh there's nothing in the rest of the house for this per related to this permit okay so they probably I'm I'm not going to assume anything but I'm thinking you know while they had them there they said why don't you fix this in the other room too or something and you'd have to get a separate permit all if work for work like that would require a second permit in general correct yeah that's what I figured I'm confused uh so the work was not done uh in the six months no the work was done the contractor never called in the final inspection ah so the permit expired we're just here for the expired permit not for the work yeah it's not because of a delay was it a delay on the town's part or was it a delay on contractor never called in the final inspection contractor never called so have they reapplied for a permit it is reinstated oh it's um but it hasn't been scheduled for that final inspection with the licensed electrical inspector okay any other questions before we let the uh offender speak offender I know I hate calling you the offender the alleged offender I I'm just going off the script i' I've I don't like that either like alleged no alleged is okay um okay thanks Mr zi uh bring up okay my name is Jeffrey gortz I'm here on behalf of my parents right there Michael and Sarah gor and we went to Lowe's to had to have a kitchen renovation I don't know if anyone has ever redone their kitchen but don't go to Lowe's okay they did an okay job but the electrician did not do a good job he got in a fight with my mother and he was rude to her and he left and we had to get a replacement electrician to come in and finish the job H so that is what happened but uh everything is done and they never did a final inspection and um we have tried to get them to come out and do the final inspection in fact on April 5th when we found out about this permit issue I text messaged our contractor and I have the evidence of my text messages if anyone would like to see may I approach yes sure so we were communicating with the the contractor and he continued to ignore us and I had to actually threaten him uh to sue him few days in and we called a different contractor to come in and reopen the permit and finalize the permit for us and we hired that uh separate substitute contractor to come in and do that and she actually went to the permit office like last week and she what she said to me this morning is that they can't do it because the original contractor received my threats and decided to reopen the permit on May 5th so my threats worked the original permit the original contractor came back and has now reopened the uh permit but he hasn't scheduled an inspection yet oh boy and we have until I understand we have until June 5th for him to schedule that inspection before we're totally out of compliance and as soon as this meeting is over I'm going to contact him and have him schedule it I understand though that if he doesn't do it we will have to get a replacement general contractor oh God to then focus on the sub Contracting situation that needs to then be fixed you ever hear the expression too many cooks in the kitchen it's uh reminds me of a this is what I'm thinking you know there so many people nobody knows what anyone else is doing you you have you're on your third contractor and you have subcontractors and just a hassle yes so the original contractor who was rude to your mother is back doing finishing whatever well he's the general contractor who I've been in contact with it was the sub subcontractor electrician who is not very nice to so he sent somebody else we don't know yet who he has sent because hasn't sent anyone to do the final inspection yet but he still has I think about three more weeks to do that oh boy uncomfortable with then um has any leverage over him paid have you paid him uh we did pay him uh the I think maybe the reason why he reopened the permit is because I threatened to tell Lowe's on him file suit against him and Lowe's um but it hasn't happened yet so ah so he was a vendor of love and that's why you can go after both of why don't you go Home Depot did you think of that for the next project for the next project yeah um okay does anyone have any more questions for uh Mr G gartz gartz gartz gartz yesz it's one syllable sort of ss uh if not um no more questions for him so I would ask if we could get some more time for we have a $250 fine every day is um that would be our request board you have a couple options on this one okay when I let you know so you can treat this as because this was for an expired permit they have reinstated the permit already so you could consider that complied at this time but complied past the date if they don't get it closed out this time and it rexpirnspelled [Music] we give them some more time what do you say I think they need a little more time but if not then it's going to be a repeat violation yeah the next time so we don't want that so what is the time what if you time what are we looking at we make it the July 5th what was the date they gave you uh June 5th for the uh inspection the final inspection to occur um and I've also asked Mr oaski if uh for recommendations and I know that the city or the town cannot give recommendations for a substitute general contractor but I understand there's a list of potentials out there we're going to go and get that list and if my pressure campaign against the general contractor doesn't work in the next 10 days or so then we will hire a new general contractor and do a substitute of the general contractor who will then fix the subcontractors issued I think we need about 64 cont ch give them another but that's only a week past what they've got if you're finding them in compliance then you do not need to give additional time oh so they are but they want time it may happen that the June 5th comes and and then it's a repeat you know that's again that's up to you all how whichever way you want to um find it you guys think I I I'm I'm I'm going to say to give them till June 14th I'd even give them longer if to the end of June but you know need to give them past our next scheduled meeting yes which is June whatever what is it it is June 14 June uh let's see our next meeting is all I have on here is May 14 says June 11th we give till June 15th May 14th then it'll be they into the next cycle yes yes yeah they wouldn't be for the next meeting they would be for the cycle after which would be good that give them time in us you know all right someone want to make a motion on it oh so what does that one become no violation no we we say no violation but an extension we're giving the the inspection must be held prior to no I think it's a violation but corrected prior to hearing isn't it no yeah but it because we still have a this is like pulling there was a violation at one time when they didn't have the cont but they got it renewed so it was corrected prior to the hearing we can do a violation hear how do we put in the extension of time how do we do that another number mo may but the uh violation respondant be given until June 15th until uh to finalize the inspection uh so it is a number two then violation not a no violation the attorney was saying and and they still have to get the uh F the uh prosecution cost no no we don't have to do that good okay well I'll do move that the respondent be found in violation of the town code is alleged in the notice of violation that is now in compliance and that a do not repeat order be issued uh also that uh the uh electrical inspection required under the town code be conducted prior to June 15 uh 2024 second roll call roll call sorry did you get did you get all that do you want to include a a fine if the inspection isn't well that that would then be another or prosecution cost recommend the F he recommended $250 a day okay well uh I would amend that uh uh um motion to include a fine of $250 per day for each day uh the violation remains after this date set for compliance which is June 15 and assess prosecution cost if the uh uh inspection is not completed by June 15 in the amount of $250 payable by the date set for comines correct can I just have the record reflect that we have HED a subcontracting company for like $350 just to go and check on the original general contractor and and tell us how we can fix this situation so it's not like we are letting things go we are being very diligent we make sure they stay in contact with that guy back there and let him know each step of the way what's what's going on I think he will tell you that I've been telling communicating unfortunately Florida is filled with these type of contractors yeah this is not a new a new story for us we
