business uh case number cc- 24- 195 it's Julianne and Karen Marcy over at 2425 South oan Boulevard bird Beach is what it's called and the um the code sections that the alleged V violations here are multiple unregistered inoperable Vehicles improperly parked on the property that's one then there's open storage of trash debris vegetation and waste then there's an exterior gate wall in disrepair with exposed electrical wiring for light and lastly a dirty unmaintained pool oh dirty unmaintained pool and broken roof tiles this roof and disrepair and hurricane panels covering the windows um yeah that sounds like yeah there's like a half a dozen uh at least five different violations here I don't know why hurricane panels though would be a problem covering the windows isn't that what they're supposed to do no can I can make this really simple and easy chairman yeah take them off when it's not hurricane right right right the owners actually have come into compliance they've done everything it's just to taken them time so the town's actually uh pulling this from the oh okay I was trying to wait for a breath so I didn't interrupt but they literally came into compliance this morning F no expires every six months so I'm assuming he had one and it expired and he didn't renew it it's for a tub remodel uh tub remodel is that like a whirl poool uh hot tub is this one on you found this is one no um I'll explain that yeah let's just get through here of uh I'm going to open the violation hearing turn it over to this Adam mazowski hey my name is Adam owski town of Highland Beach code compliance officer and I had been previously sworn in this is case number CC d24 d172 the respondent is Michael Michael Quinlan the property address is 3420 South Ocean Boulevard 8y I inspected the building records on May 10th 2024 the violations that require that remain as cited on today's agenda are 30-1 122b expiration of two building permits permit p23 d199 tub Remodel and br23 d0230 building remodeling both expir due to missing inspections and unpaid permit fees last month the board heard code Cas cc- 24-16 for an expired electrical permit on the same property but today's case is not being heard as a repeat because both cases were originally opened within a week of each other and due to scheduling both cases unfortunately had to have two different hearing dates the notice of violation was served by posting on May 31st 2024 after certified mail was sent on May 10th 2024 the respondent was originally given 24 days to come into compliance permit br23 d0230 was submitted on August 28th 2023 it expired on April 28th 2024 permit p23 d199 was submitted on August 29th 2023 it expired on April 28th 2024 I have had no contact with anyone regarding this case um I've even reached out to the building manager and HOA regarding it the notice of hearing was served by posting and certified mail sent on July 29th 2024 prior to today's hearing I reinspected the building records on August 9th 2024 and the viol ations continue to exist I have submitted the following evidence which includes proof of service supporting documents and photographs the town recommends that the respondent being in found in violation of the town code AS alleged in the notice of violation and be $250 per day for each day the violation remains after the date set for compliance the town is asking to assess prosecution costs in the amount of $250 payable by the date set for compliance this is a multiple correct it's a multiple but we're only counting this one wait it's m there's multiple permits that were expired but it's the same code section so it's only one section was code section was cited is there another one that you have to reschedule different no there was one we heard it last month yeah that was for an electrical permit okay but this is not a repeat last month the board gave the respondent 30 days to come into compliance or $250 a day fine thereafter and he hasn't come he hasn't come into compliance yet all right that's a different case though okay so different Cas correct that was correct yes do you get confirmation that the uh the homeowner property owner received the complaint in other words I know you sent it certified mail do we have anything that shows that they actually received it assigned receed that you have to sign for that certified mail is the preferred method of service by Florida statute the fact that when they don't sign for the green card that's when we post okay so the notice was posted at the property and at Town Hall okay and then this particular resident maybe he's not in Florida now possibly did you ask the he should have forwarding mail right is mail should be forward certified it's not going to be forwarded I don't think Adam's doing his job correct I I follow State Statute 162 yeah well there's nobody here to uh answer answer which means they automatically lose right because they're not here and what are you asking for 250 just the cost of prosecution and prosecution 20 $250 and then $250 a day fine after the date set for compliance when is that we set a date well probably 30 days I try again right what do you want to do to I think this person's out of 10 probably yeah I I mean the buildings aware they're supposed to reach out to him I did that as a courtesy yeah they should yeah all righty who wants to make the motion I move that respondents be found in violation of the town code AS alleged noce violation and that he she they it be ordered to comply within 30 days or be fined $250 per day per violation for each day violations remain after the DAT set the compliance and assess prosecution cost in the amount of $250 a by the date set for compliance can I have clarification that the 30 days would be to September 13th it would be if there's 30 days between now and September 13 today is August 13th 1 yeah that days September 13th there's how many days in no 31 so it might be September 12th
