elevator boat lift for the property Lo located at 102 Grand Court do any members of the board have any expar Communications no hearing none Miss Allen I think it's ball is in your court hey good morning for the record in GD Allen Town planner uh so as indicated this is a request for a the installation of a 27,000 lb capacity elevator Boat Lift um let's go ahead at the uh take a look at the Aerials they do start on page 14 of your packets okay um so here we have the aerial of the property this is from January of 2024 I just wanted to show you that um they did get a boat lift or there was a boat lift previously here think the Dot's working not working oh well um you'll see the two uh remnants of a boat lift pilings this is again the property how it currently looks and um I also provided you a I also provided you an aial from January of 2023 and here I put a little blue arrow you can see the previous Boat Lift again what's remaining of that previous Boat Lift is those two lift pilings um the applicant has provided uh an authorization from the Florida Department of Environmental Protection um I've gone ahead and provided that file number in your staff report on page 10 and on the fgp approval or authorization letter it does indicate that a separate permit from army Corp of Engineers is not required now uh this property is zoned residential multif family uh so as the board may recall if you're in a multif family zoning District you do not have a marine site setback so that is the case for this particular property um let's go ahead and look at the 11 by 17 plan sheets that's why really gota do this yeah there we go okay so this is the existing site plan again you could see those two little B pilings and here you have the proposed plan um the structure itself yeah you could see is from the property line encroaching into the uh Canal 11t 9 in and here you have an overall plan view again these are the 11 by 17 sheets that are in your packet and um here you have the top of the lift which is the top of that mechanical equipment um it's at 6 feet 6 in and then the top of the super structure of the boat when lifted is at 10 feet um so the applicant or I should say the request is consistent with the definition of boat lift and that the lift is not higher than the superstructure of the boat when lifted I've provided you that definition of boat lift on page 10 of your packets now um in the code uh for moing facilities which includes a boat lift there are certain Provisions that apply and again I've provided them on page 10 the moing facility will not create a hazardous interference with navigation endanger life or property or deny the adjacent Property Owners or public reasonable visual access to the public Waterway and installation of such moing facil shall not infringe upon standard navigational practices that are or may be used by the abing property owners so given the location of this particular lift you know sort of a tight area of the canal uh staff went ahead and brought in our marine expert uh the town does have a Professional Services agreement with ATM for marine consulting services and um Dr Michael Jenkins of ATM he did provide a report which is on page 16 of your packets and Dr Jenkins is also here today if you have any specific questions um I'll just add one more thing we do have a regulation in our code um that states that when you Mo uh boat now keep in mind the code uh describes accessory mean facilities Boat Lifts docks as moing facilities so it says when you moreour a boat you can extend beyond the property line as extended waterw so you could see on the plans they extend the property line into the water and that boat when lifted is within the parameters of their lot um I'll be glad to address any questions we also have the authorized agent for the project here so again glad to answer any questions uh for the setback ingred Melle yes um on the it shows that it's just at the property line but because it's multif family then that the the setback doesn't apply at all well keep in mind the setback is from the structure right it's not from where the boat right so if you look at the proposed sheet the proposed site plan yeah you'll see that um the the structure itself is set back from the north property line at 11 feet 2 inches and then from the south 19 feet 5 inches but right when the boat is lifted the the width or the length of the boat is within the property line yeah okay and the other question I have is any other uh were there any comments from any of the other people in in their community community I did not receive any public comment from any residents I don't believe the town clerk has either yeah uh and the other thing I I'd like to request is I'd like to have Dr Jenkins come up for a moment good morning good were you sworn in I I was not sworn in would you please raise your right handk by the authority vested in me as a notary of the State of Florida do you swear or affirm that the testimony that you're about to give is the truth the whole truth and nothing but the truth uh yes I do and for the record is Dr Mike Jenkins uh senior principal of Applied technology and management thank you dror for being here the the question I have being an ex booer and there are a few of us here uh the turning radius for this boat in this canal what is your concerns about that or are there none um there are concerns but they are inherent to the fact that this is the end the a dead end of a canal um and um so there the turning radius you need to use is out in the canal so you have to either you have to go in straight or back out you can't there really is no turning radius in the immediate area of the lift um that is really defined by the width of the the canal however if you just go to the corner of the canal there is the turning radius so it does require you know um some some Captain Skill but that's inherent to the width of the canal uh for any forgetting any boat into that area thank you do any other members have any questions of the staff um just when I David I guess when I look at the uh the uh the illustration of of the proposed boote it appears that it just barely fits within the the lot lines is correct it's it's this is the functional limit of what would be allowed under under town code correct okay and and I think to you know to Eric's Point um so it's approximately a 40 with 44 45 foot boat with the engines corre yeah it's it is at the limit of what you could and I'm seeing here 86 feet from seaw wall to sea wall is the width of the canal right right and and it it obviously the structure that it sits on extends 12 feet plus 5 feet 17 feet I don't know what the what the boats on the other side do and so it's just I I guess it's a concern um that you know it's it's very tight it it is tight but it is also been historically tight I would note there was a previously approved lift in this exact area Okay um the old lift was a more traditional lift with piles that already stuck out and those piles were in the Water Way farther out uh they're putting in an elevator lift which is you know carries that you know more landward as opposed to what was there uh as part of their placing of this lift they are going they were going to if they haven't already remove those piles so yes it is a tight fit yes that you know it does require safe navigation and and all those things but it is slightly better than the existing conditions prelift um sure again you know if I were to Pro if I were to design a marina I would have more more Fairways but this is a pre-existing condition and therefore um it is it is a concern but it's a tight fit for for for all the vessels it's just the end of the canal and it's just very tight are there any other questions from the board uh one question to us in The Illustrated purpose it said vat may change now what happens if he decides he wants to get a 60 fo vat um town code requires that any boat stay Dimensions be within the lot lines okay so if he's outside of the lot lines then then there's an issue but he can go to because this um on the lift the setbacks there are no setbacks because it's multif family there are no setbacks on a boat more next to but the boat cannot extend beyond your property line for any for any property so if he got a 100f footer he would be in existing building as provided in section 30-39 the town code of ordinances including but not limited to additional square footage and changes to the exterior facade and the roof line for the property located at 3515 South Ocean Boulevard do any members of this board have any exper Communications hearing none let's move on at this time is Zen again the stage is yours hey all right we'll start off with the Aerials these are on page 66 of your packets um here we have the front of the existing home and this is the rear of the existing home um according to the Palm Beach County Property Appraiser this house was built in 1996 and the request is for a major modification to an existing family home um on page 62 of your packets I provided you the description of a major modification per section 30-39 of the code and um I've also provided you a list of the major modification that is before you today which includes an additional square footage under air conditioning totaling 347 sare fet there's also a new covered entry there are exterior facade changes including but not limited to the AL to alterations to the Windows Doors balconies railings and columns and they're also alterating um Al there's an alteration to the roof line uh the applicant has indicated that all the existing Landscaping currently on the property as well as any Landscaping on fds right away will remain the same um so uh there's no landscape plan nothing is being changed when it comes to the Landscaping um and I also indicate in your staff report that this uh major modification the changes that are happening they're all west of the Coastal Construction Control line uh so there is some correspondence in your packet starting on page 69 the applicant did reach out to fdp just to you know verify that they wouldn't trigger a permit and again because that major mod construction is um west of the line they don't trigger the permit um so this uh request um basically if the applicant or the the board uh does provide an approval uh the applicant uh will be required to uh commence construction um within two years of the date of approval of the planning board uh we do have the applicant here in case you have any specific questions for him and I'm glad to answer any questions that you might have let's just go through the plan sheets real quick here's the survey of the property um again here you have the site plan I've highlighted right here at the bottom but um the bottom I put a little yellow circle which shows where the addition is taking place right at the bottom there towards a middle left in the front of the house and here you could see a little bit better I've highlighted in yellow this is the first floor this is the additional square footage on the first floor High highlighted in yellow as well as that new entryway and then here you have the second floor again the area highlighted is new Under AC and here you have the roof plan um here you have the elevations so the top left is the proposed elevation how we will how it will look and to the right is the existing condition and then the bottom is the rear elevation as proposed and then you have the existing condition in the rear and then of course you have the right side and left side elevation as well again I'll be happy to address any questions again miss alen you've done commendable work on this do any members of the the board have any questions at the staff I this I have one question I'm just curious in the garage area in the front have you had any problems with drainage going into that's what I was GNA that's what I thought I hate must have been my question yes Earth shaking oh no do we have an earthquake down here in and and obviously they've handled all the drainage issues as been brought up um this particular request did not uh trigger a drainage because they're not adding they're removing a planter so there's not um additional drainage that is triggered okay yeah this was reviewed by our flood plane administrator which is also our building official yet any members of this board have any other questions of Miss thank you Miss Allen uh at this time do the applicants have any comments to make please identify yourself good morning uh my name is Carlos lades with the Randle stoft Architects We're The Architects of the project uh we did uh submit a a the same PowerPoint that Miss alen uh also provided uh we also wanted to illustrate a rendering that that we've um we wanted to uh show you guys uh just to answer any questions as far as what we are trying to do uh you know uh Miss alen obviously described the the addition that we're uh doing towards the front uh the um roof line that that is being introduced so we're introducing a a pitch roof with flat flat roof tile obviously the all these things have enhanced the architecture of of the uh property um the roof line is being introduced on the front and as well as the uh the rear of the home uh there is some existing flat roof that will remain in the center uh which does not is not visible either from the from the front or from uh the rear uh of the home so we've decided to keep all of that as as as is uh window proportions have been uh looked into um because of there are some interior modifications there are some windows that have changed on the side of the home as well um the rear of the home basically is just uh being up updated uh window proportions muttons a little bit more traditional um architecture uh the base is going to have a stone base um which is all existing uh stairway that we're not touching that at all uh garage is not be in touch we're going to replace the garage door obviously um in order for it to um complement the rest of the home um uh like I said um Miss ingred uh pretty much mention everything everything that we're doing and we're here to answer any questions on the design any members of the board have questions uh I have one on lighting for the beach side uh you're aware that of of the need because of the turtle season to keep the lights we talked about that a while back about lighting and they're nodding as they are they understand what the need is yes so our drawings uh indicate that the liting will remain all right any other questions any members of the community have anything any comment and at this time the public hearing is now closed I'm going to call for a vote
