comment on glad to um thanks for letting me speak I'm Judy orcut I live in Pebble Bay 4665 Pebble Bay South and I'm the president of the Clean Water Coalition of Indian River County so I'm here to actually applaud you guys for your plan uh let's see it's agenda item 8C ordinance 570 I'm here to applaud your plan to connect all the septic systems in Indian River Shores to Municipal s sewer the alternative to connecting to sewer is to allow nitrogen reducing septic systems and those only remove 60% of the waste water entering the Lagoon which in the current condition the Lagoon is not enough so connecting them to sewer is definitely the way to go I applaud you for that um it stops the pollution at the source and of course as everyone knows our lifestyle and our property values depend on a clean Lagoon so if I have a time allows I want to also thank you for supporting another initiative that the Clean Water Coalition has advocated for and gotten moving in the county and that's the anchoring limitation Zone I know that that's being shuffled back to the town at this point um because of the cost of installation of The Moorings and the signage and so forth so I appreciate you're working with us and with the um enforcement of it down the road because we have a real problem with derc vessels and abandoned vessels and as everyone knows those end up polluting the Goon too and are hazards to navigation and and finally I hope that you will also support the fertilizer band period which is part of your ordinances from June 1st to September 30 that's our rainy season if people put fertilizer down at that point in time it just washes right into the water so we have a band period for that purpose and also I think most of Indian River Shores uses reuse water for irrigation so they really shouldn't be adding any fertilizer because the reused water is got plenty um if you are interested the Clean Water Coalition has produced some signage you may see it around town at the various parks in county and City administrative buildings and it's just a you know one of those signs that sticks out and it would help notify your residents of the band period And I'd be glad to be sure to stick one in front if you're interested um so you can let me know thank you very much that's all unless anybody has questions thank you um just one comment for me the I don't remember the exact percentage but as you know we get our uh water service from the city of EO Beach and the City of EO Beach does not provide all reuse water some of it is actually portable water that's provided into the town of Indian River Shores so um and hopefully with the new project pulling the canal water and pumping it up here that will hopefully even I've not heard anything heard any good news on that and you know oh I know they just got a new Grant yeah well grants are one thing but um I think I I don't think we had any movement from the city of Vero Beach to replace the portable water um for the ReUse lines that we have throughout it's not been a topic so we're currently in discussions with them we're it's not it's not what it's not been a topic of discussion that they're willing to discuss so we we always bring it up and we're always hopeful but always disappointed so so just just would like you to know and I know you're on the Utilities Commission but not anymore yes I know we'll we'll work with them is there anything else from Mrs orcut okay thank you very much thank you for your comments appreciate it all right item five the uh I'm sorry are there any other comments from the moving to the mayor's report I have a very short report uh today um the the County Commission will have a an an interesting Forum on moving the urban service boundary lines so does it directly affect the town of Indian River Shores it doesn't but it certainly affects our area um my recollection is it's at the intergenerational center over by Alo Road uh the date is now escaping me and I didn't bring the 22nd so it will also be streamed is my understanding uh so for those who have an interest in the area and those watching the live streaming we have um our County Commissioners that will be addressing um an important step for really what the county looks like you know over the next decades to come um so urban service boundaries basically artificial lines that are drawn uh to determine whether or not the county is going to provide um Municipal services such as sewer water and um those those types of things that um assist in development of areas um Mrs orcot mentioned the anchoring limitation areas that's a topic that uh the town and the uh uh County Commissioner O'Brien when he was in office were working on um very steadfastly and it's nice to see it finally coming to some type of fruition uh Mr harping will be addressing that so I won't take the time to uh to go into that in any detail um I was thanked by a uh Town resident the 7-Eleven which is the nerve center for all Communications from residents in the town U for the wonderful job the council did in addressing the traffic concerns uh so on our behalf I thank the gentleman but also told them that uh this was really a seasonal fluctuation and really uh didn't have much to do with us so uh that's it if there are any question questions for me I'm happy to take them if not we can move on to council member items if there are any members of council that have to uh bring up an item or wish to bring up an item councilman noworder uh Mr Mayor in a followup about the urban uh service area and urban service uh boundary there has been one meeting already occurred up at the North County Library Sebastian uh which I attended there was a fair number of uh people there and uh well it doesn't impact Us in terms of being right next to the town of Indian Riv Shores it impacts us from the perspective of really uh a tool to in my opinion to uh bring about some quote affordable housing or lower cost housing for all the people the Ser you know the service people that take care of us uh old people here on the in the council and uh the urban the urban service area which is the area where the uh County provides Utility Services primarily uh water and sewer is mostly to the east of I95 but there's two what I call doughnut holes there and they were asking for suggestions one suggestion that I had which I know will uh throw some that let's keep buo Vero people in a tizzy is the idea that you expand that area some degree but require that any Builders going in build affordable housing and maybe God forbid go up a couple stories of what we have so we can try to get some lower cost housing so people in their 20s and 30s can actually uh afford to to live here so I I uh put that out there as a as a suggestion so but it was it was a good meeting I I would definitely suggest uh you you attend the other thing that I had was U last week again this doesn't impact us directly but it would in a hurricane situation fot had a meeting at the intergenerational uh Center about they want to widen the Florida turn Pare from north of State Route 70 to yeul Junction State Route UH 60 it's pretty straightforward they want to add a lane and each Direction my wife and I attended uh we were the only people from the public there so believe it or not there were actually some people in other parts of government were happy to see me and uh they one thing they did talk about which I thought was good about improving The Interchange at ye-ho Junction uh I remember one time we evacuated from Hurricane Matthew and there was a huge bottleneck there they have improved that to some degree but they want to make other improvements that help the flow of traffic so I'm going to write them an email suggesting that they go to this alternate B so be a good thing for us if you know God forbid we have to chase out here it gives an alternative trying to get up I95 when everybody and his brother and sister are trying to make it up there to go north so just want to bring those to so Bob are you saying they're going to put in the new entrance onto it or it's going to be the old entrance but improved uh it's going to be sort of a com combination they're going to keep the old entrance primarily for for southbound and they're going to create a new entrance in the same location for uh Northbound and based on the drawings I see will definitely improve the the flow of of traffic so I you know I I think it's a real good thing so that's it for me great thank you Mr alard all all good points if if um you can leave the the handout I i' for one would love to take a look at it um and we could probably make copies for the rest of council and uh having tried to evacuate I believe it was during Matthew um I was stuck for two or three miles for a good 2 and 1 half hours so that's it's that bad a bottleneck um I don't I don't know if it came up at that meeting thank you for attending but it's also I think the only exit between south on the Florida Turnpike and here for what 20 miles 25 miles so uh it it's quite a bottleneck so thank you very much for bringing those items to our provil thank you that's quite a mouthful um as uh as it is a second reading are there any comments from the public on the second reading of uh proposed ordinance number 571 uh there being none are uh this is an opportunity for the public to comment are there any public comments uh there being none are there any comments or questions from Council uh just a housekeeping Mr Sweeney um in section one where we're referring to 312b and then subsection five emergency purchase um the last sentence reads as used in this section the term emergency means a sudden unexpected turn of events that causes there's a colon there were five causes a through D they should probably be recounted here in the [Music] ordinance the clerk and and I think in the end there's uh because there's no changes in that section uh we just left the remainder out uh for um really convenience because that that causes piece under five the only change in that section is the 10,000 of 35 so we left the remainder of that section out because there were no changes that were affected the a the subsections you're talking about if they're not modified typically they wouldn't be reprinted in a provision of an ordinance like this the reason you see the subsection as Mr har was saying B5 there the the number is a strike through on the 10,000 yes right so we modify any of those subsections they would be fine not have been reprinted here okay but noted and that'll be part of the record to make sure it's actually clear for everybody in the public yes sir okay so where does that leave us uh we don't have any substantive changes um if it's a scrivener's issue do we need to make an amendment to it or we no there's no need for an amendment the council wanted to certainly but but as explain those aren't actually changing this is providing the so that when it's when it supplies to M code and red in the change you will see is that specific change the other changing so we don't by by just by way of comparison um for explanation if we look at U section one you see 31 02 you have a one two and three then you have B you'll note that we don't have one two three and four we just have five and six because those are the only sections at all that are changed it just allows for convenience not to print um the ordinance or the sections in their entirety when there are no changes in those sections in the entirety but I'm very happy to we we can include them we can I'll forward them to you after this meeting uh but we can include those in the future at at at your you know at the council's uh Direction it's just that when there's no changes we tend to leave the bulk out but but does this does this go into the code of ordinances as it is this piece of paper no I mean the the ordinances itself will be amended uh Shores Florida providing Amendment uh of article 3 to chapter 101 storm water erosion and sedimentation control providing for permit required for site inspections for storm water erosion and sedimentation control as required by the national pollutant discharge elimination system NP Dees program providing for a permit fee providing for enforcement of the ordinance providing for penalties for violation of the ordinance providing for conflict and severability providing for scrier errors and providing for an effective date this is the first gr thank you thank you very much um we as with the other uh previous ordinance we had some public comment any other public comment on this proposed ordinance any comments from councel basically wecking up uh yes we're changing the fees to be consistent with um what the standard is um in other words uh but in brief answer yes in other words the the state fees sech charges can change but we've established what our particular fee is and uh and the violation uh as well there's a small modification relative to the um uh delegation under uh 131 I'm sorry 101. 38 uh and the other change is the the nomenclature because in um uh as you'll note previously these were under 10.21 uh but we wanted cons internal consistency within the code so we changed um the actual section numbers in substance though it is the it is the fees and um uh and the delegation of responsibility 101 change yes yes thank you all good comments um for what it's worth if we're going to have one of our town people out there enforcing this I think we ought to make it worth our while um kind of reminds me of the $10 fine for illegal parking that was on the books forever that we changed a few years back so uh uh Jake we're going to make it worth your while to go out and have a look at these all right um any other comments from Council just uh just a question of section 10123 101.39 penalties says violation of any provision of this ordinance shall be subject to the following penalties what what provision other than the filing of a permit would lead to a a violation I'm sorry could you repeat that Count Council says violation of any provision of this ordinance shall be subject to the following penalties and the only provision the only compliance provision is is a permit filing for perit is there any other potential violations of this provision I don't see it well disruption discharge without first obtaining the permit well there yeah I mean there there are illegal discharge pieces associated with it in terms of penalties um and I I will say that uh using the broad language is certainly much better uh than using narrow language in terms of uh of encompassment and I say that because uh many times uh there are as I said in this there's uh fines or penalties for elicit discharge or failing to follow uh you know a notice from our enforcement officer or building official to get a permit if they haven't U so that's why the language is is Broad I guess my understanding a certain amount rain right yes we and we do both uh just for appication purposes we have a a certified ms4 uh inspector on staff with our public works department uh when there certain amount of rain goes out we we go out affirmatively and do that but then we have just regularly scheduled uh calendar baffle box inspections and things like that right so is it fair to say um and I'm asking this rhetorically that this is just the enforcement provision for a number of State mandates in addition to local laws that require certain things to be done within the Ambit of um of storm order control so this is the penalty provision um much like a sentence guideline after a crime is committed then this would be the uh the consequence if you don't get the permit or you what the day holds right great thank you very much appreciate it item 9B Town treasurer miss Christmas good morning um I will be sending you my forecast report as soon as I've completed it I've been in the middle of we're still in the middle of closeout right now so I usually try to get done by the 15th and then get the report out after that so as soon as I'm done I'll have Jim forward it on to you um other than that um I will have a budget amendment next month because I want to tie up any loose ense because that will be the budget that will be in our budget Workshop so that'll be tied into my final budget and then speaking of budget I am presenting a working draft to the finance committee next Tuesday for the budget with them for their review and comment and then we will send we will get the numbers from the property appraiser in June July and then I will send it back to them for further comment so at that point that is the update for finance do you expect to have a quorum to have a meeting with the finance committee to talk about the this point we do have a quorum excellent thank you very much um as it's a short month you didn't have a lot to update us on but we'll look forward to uh um the report in June where I'm sure you're going to have a bit more for us so anything else soon as possible anything else for Heather no okay thank you um Public Safety Department chief Stone good morning everybody excuse me kind of uh past three or four weeks of uh few disasters have hit us we had a pipe break over at in the main building um above on the second floor of course we ended up with some mold inside the building it collapsed some dry wallet there we've got our insurance company involved in it and they've taken over the the repair that needs to be T done to it um we also in the process of tear out we found some other suspect Plumbing that we need were getting taken Tak care of as well as an air conditioning issue that we ran into is when we started tearing walls out and fixing them what had happened um the vehicles that the town purchased uh the the two uh um ones that you gave us approval for uh two months ago I believe uh you'll see those on the road starting at the end of this week at First the next week um we've been very successful once again the past month of uh processing uh additional pum and full-time employees so we're getting very close to being up to full Staffing as a matter of fact I had one of the shift sergeants uh comment the other day it's the first time and he can't remember how long did he that everybody showed up for work he had a full shift and we didn't have any PMS coming in to actually work so um we continue to see an increase in fraud cases through the town and our detectives division has been doing a phenomenal job of staying on top of those working with the uh working with the citizens of town also outside law enforcement agencies in the State's Attorney's office um um we attended hurricane Expo this past Saturday over at Dodger field um along with number of other emergency service providers throughout the county and a number of private vendors it was a su success for them they I understand they push between five and 700 people through the through the facility over there um the uh we held a preconstruction meeting for the station Remodel and I'll let the Public Works director address when that's going to kick off and our ladder is out of service um and is out for uh for a maintenance issue and hopefully I'll have it back first next week that's all I have I'll be happy to answer any questions great anything for chief Stone just one question on the problems you had over there will that all that be addressed when we when we uh do the work on the building the problems you said you had with the plumbing no there're separate issues separate yes ma'am um we had to because because we weren't doing a re a specific remodel in that section of the building B burst and of course it burst on second floor and flooded everything on the first floor um so thank goodness it was in a storage area where we keep bunker gear and some other stuff on the ground floor um so that was it'll be outside of of what the was entailed um for the remodel of the building well should we look into including it I'm sorry should we look into including that area in the remodel since it sounds like it's going to be suspect or not no I had I had to get all that stuff finished that I needed to get repaired with the additional plumbing and air conditioning before they can button up the walls and on where we had the leak I think I'm misunderstanding your question for some reason you said that we had a problem with a pipe on the second floor over in your buildings right so my question is when we start the construction on that building will that area be addressed and you said no it's a separate area that's correct okay so I said should we be looking at that area if it's going to be suspect to further problems while we're doing the construction hopefully we'll have everything finished up before they even get in there and start the start the new construction in the building okay so it'll all be solved yeah we we should be solid before before they even get into the building okay thank you council members if I just Mr Mayor if I may um the the repairs of things we're doing now they're exent they they've got to get done now uh as opposed to wait for the process of the larger um you know the larger reconstruction Rehabilitation so it's just it's it's got to get done now uh and of course that was not part of the original scope of services that's just my then that was my question was why wasn't it a part if you've had this it wasn't ENT it wasn't identified as an issue the pipe just burst I mean it just burst that that was not something that through the review of the public safety building having the engineers come in and everybody it just it wasn't an issue it was just something that that happened uh and that has to be repared uh now it wasn't as if it was identified as an issue or problem before but if I may as I understand council member Smith's question um does this prompt us to take a harder look at you know that area to make sure while we're U undertaking the U renovation of the other part of the building make sure that we're not just putting a Band-Aid up on the top um you know if we're going to be inconvenienced and budget hit once why why not include this in the scope is that that's exactly what I meant yeah um and again the two pie I'll defer to the chief but um uh as part of the remodel review again it it wasn't identified as an issue problem or concern no I think I think we both understand that what we're saying is let's you know maybe we should have a relook you know just make sure that you know we're not going to go through this Remodeling and there's something Suspect with the pipes on the second floor and other are is you know have a full is that a fair assessment I'll prefer to the chief but I think that's part of the I think that was part of the evaluation of the problem the identification of the fix um as to as to what it was that that is correct when they when they got in there and did the tear out to see how far the water had actually spread when the bip burst and the Damage that had done they of course removed drywall and other things where the plumbing could come through I I am having additional Plumbing work that's over and above the the break that actually took place in the pipe because it became suspect so while we're in there we're going we're going to go ahead and get it fixed before we button everything back up and replace everything that's suspect in the build in that section of the building okay I think we're saying the same thing I think I think you're addressing it you're addressing it now okay we've probably had similar situations in places that we've owned where we've done some renovation we need to find out that you know we should have been you know Penny wise and not pound foolish and right would or should have could I gu right exactly exactly is that that's okay thank you anybody else you have anything Chief um I know you you may not know about every single vehicular accident that happens in Indian River Shores but I understand that there was a significant accident on A1A in the vicinity of um the 7-Eleven like last week or the week before that I will go back and check for you and let you know but I don't I don't recall anything sign significant that caused us to you know do job I only raise it because that's a hot button issue for all of us and and my understanding that it was a fairly significant one so I kind of like to know what the circumstances were and what led to it because it kind of feeds into our datab basis on you know what's going on down there yeah the the only one that I can remember of any significance over the past 30 days or so was actually to north of north of town hall um past the uh the main gate into uh um John's Island that's the only one I remember that was significant so I'll double check though make sure thanks yes uh with with regard to these financial fraud cases is there any pattern that's developing on on this yes and that's as far as I'm going to go there is um and uh it's uh it has to do with inter internet um they're hacking their personal uh PCS and getting into their bank accounts and that's where the fraud is taking place um so we've when we become aware of that we work through that with not only the FDLE but the local State's Attorney's office and we had a big case um this past um Friday Friday evening okay would it be worthwhile I I know we send out the new newsletter that the town clerk does I'm just trying to think outside the box it be worthwhile sending a mail publication to people you know just reminding them of the different ways this can be because you know having sat up here for a while I know what an enormous time sync these cases are for your staff and frankly of course the taxpayers a hell of a lot of money right to uh follow up on these things and you know we be wor worthwhile you know unfortunately I think the people that have this type of fraud don't don't use the internet that well to begin with may maybe that's just something to think about maybe sending a mailing out to everybody we we have out there and just say look this is really happening and not give specific uh cases but just describe this a little bit more because I'm a little tired of spending all this money right on this I mean I think one of the one of the cases uh probably cost us over easily over $100,000 to uh go through the one that ended up in the paper uh so it might be something to think about we'll see if we can come to come to some put something together to get to our homeowners associations and all the management companies to see if they can include that into their newsletters too and see if we can get the word out yeah I I think councilman aler has a good idea the more you know and these I get a few of them I mean they slip through any um any of even the best filters and uh they're getting more and more sophisticated you know the correct you know you've been charged for your Microsoft 360 account um if this is an error you know please respond back so that we can refund your account well once you know um once once you provide that information then guess what your PayPal account's going to be charged or all they need is the information for the proper email address to syn it so I think it's a it's a good idea to we'll put something together terrific thank you yes sir thank you anything else okay thank you good morning Council um just a quick update our Pebble Bay Estates storm water outfall repairs we had the pre-construction meeting last week with Joe bear um that will be underway within I think it was by the end of July um in the Indian and simol Lane baffle box repairs are completed I did see that this morning it looks really good uh Public Safety renovation project starting this month so we're in process of cleaning up the areas of the first phase just to get allow the construction guys to come in and put their equipment down um Cemetery irrigation renovation project is in the planning process there's any questions anything for Mr ryant no thank you very much keep up the good work thank you sir um I I'm going to wait till my uh uh committee report but there are some additional grant opportunities that came up regarding these kinds of projects so um we can certainly look into them all right uh next up we have uh code enforcement Sergeant Mike Rand good morning it's been a busy past couple weeks um but other than what's on the report for it I have nothing to update any questions I can answer with regard to the real estate science you you state that you give them a copy of the ordinance yes sir and I'll be honest I don't remember what the ordinance looks like uh frankly can the people can the people you give it to you think they can understand from reading that ordinance or should we try to give them a page with some bullet points on I I get this question to ask the people in the real estate well you know why are you guys so tough on this and frankly I I don't understand it which may be my issue that but you know do we have sort of a a onepage flyer that just boils it down the simple terms we do not but I I can make something up I I I think that that would be helpful I I certainly like to get a copy so when I get calls from people saying you know why you guys being so tough on the real realter I can just say hey here it is or I'll I'll scan it in email to you or something like that just seems to be like an ongoing issue that I it is Mr Mayor I me so if I may first um you know I'd just like to respond to that so the two issues are do they understand it and then the other one is why are we being too tough on them or why are we being tough well I'm just saying they they're being tough I'm not saying I agree with I understand the ordinance is pretty simple it's got Dimensions it tells you what's what's permitted and what's not um all the reputable Realtors I know have those signs they have them with that Dimension um my personal opinion is when the when the market is no longer sizzling hot interest rates are high people want to move things they want to they want to put signs up everywhere which brings us to the second question and why do we have the ordinance because we're different you know we want different Aesthetics in this community um we don't want you know a floppy man sign saying open house here and open house there um and you know I think I think the Realtors know all too well um what's required of them uh there there's an education program that goes on I think you know that's part of the reason why we have our own code enforcement fellow um Sergeant Mike rans and I know your first your first what is it the three e educate encourage and enforce so I'm sure you see a fair number of repeat offenders uh people who you know are aware of this but they're just they try to push the envelope they want to make a sale so you know it's kind of like saying to me it's kind of like saying I know the speed limit's 35 through there but I'm really late I'm really late getting my appointment so I'm going to go 45 and if you catch me okay if you don't I make I make it to my appointment so that's my two cents on it I you know I I get these comments to councilman Al and I just say that's our ordinance that's the community we have that's the community that we want so um sorry you're not going to be able to put a wooden steak with an 8 by you know 8x4 foot sign there that says open house today and keep it up for a week look I'm I'm totally agreeing with you so I don't want to okay thank you no I I understand I'm I'm just trying to communicate with folks and frankly get them off my back Jake have you have you ever find anyone I mean I always see how many reals do we have you give out there's quite a few but I mean you have you actually find anyone um so between myself um Max and Larry um they pull the signs I take the information on the sign and actually have a folder for each real estate company and there's multiple from each company so you've never find anyone never find anyone but I do contact them let them know we do have the signs I give them a written warning just so it's documented and a copy of the ordinance stating the regulations and requirements from the town so how come we've never find anyone for repeat violators we do oh you do okay that's what I'm asking yes there's there's probably two or three that have been repeat um and they haven't done it since they paid the fine so it's working thank you right and that's why we had U our Our Town manager um made the excellent suggestion that we have a special magistrate set up so that we have a mechanis ISM to deal with this as opposed to a code enforcement uh board and you know I'm I'm not being tough on Realtors either I mean everybody's got to make a living my my mother was a realtor helped put me through school uh doing that that stuff too but um had of curiosity I went back and I looked like are we are we really that tough and I think I think we'll find that we're not all that tough compared to other communities of similar stature some have much much stricter um guidelines than we do you know you're only allowed one sign on the property so if we take a look at different different communities of um a similar scale to us um we're actually pretty good we're probably in the middle of the pack when it comes to that so anything else on this so thank you keep up a good work thanks thank you um town clerk Janice ran good morning I just wanted a very short short um report that we did host um the clerk's Association for Indian River County all of the municipalities were represented along with supervisor of elections Leslie Swan I was a Bittersweet meeting because it was tamy uh BK's last meeting she retires on June 28th so we presented her with a plant from the town of Indian River Shores for all of her assistance over the years and for your professional working relationship so she did send a thank you to all of of us um for hosting the luncheon and for acknowledging her retirement thank you thank you anything for Janice no we talk to you on a daily basis anyway so you're all good thank you Janice uh Town attorney report Mr Sweeney thank you Mr Mayor today I do not have any updates Happ to answer any questions if you have anything for the town attorney one general question yes sir very odd session of the legislature um I don't remember this many bills still hanging out there um and I lost track but there were over a hundred a couple of weeks ago probably about 70 or 60 or 70 any Rhyme or Reason how we can figure out what's what's still going to be presented to the governor or is it just the the best advice I can tell you is that there is no time limit on when it's presented so if they passed both houses of the AFF A legislature there is no legal time limit on when they have to be presented to the governor there is a it once they're presented for him to either sign or to veto or to ignore and S back I have been told that um he is receiving them in batches and he's receiving them um maybe weekly or bi-weekly when he would be around different parts of the state to make presentations I think we saw a couple two or three weeks ago and a batch of four or five the only one I know for a fact that has to be attended to is the budget but other than that I've been told that we could expect to see these all the way up until until November of this year potentially be presented right so it has to be done before the next session starts correct so still hanging out there we've got vacation rentals vacation rentals we have uh uh homeowners association um which doesn't cover condo associations it covers homeowners associations um which you know I'm sure is of great concern to a number of homeowners associations because it essentially strips the HOAs of um substantial ability to regulate their own their own communities um there are so many out there I have a mental block on it now but we'll we'll just have to keep track of it and I would just ask that as you see these things come up please please send a memo to us in counsel yes sir absolutely you know we can uh uh we we have usually a limited time frame to uh contact the governor's office and for what it's worth say please don't sign this sir or please sign this there are a couple out there that we we would you know certainly like to see enacted so thank you very much yes sir anything else from Mr Sweeney no um Town manager Mr Haring thank you Mr Mayor Mr vice mayor councel um a couple of items before I give a brief presentation on the status of the anchoring uh limitation area um regarding uh Solid Waste uh town the board of County Commissioners has a meeting on the 21st uh in that regard um we received best and final offers uh in their totality uh from uh FCC and waste management uh on the best and final offers waste management came in better uh than FCC I say that generally I say better I'm putting together some uh comparisons for you uh outside of all of the sort of voluminous spreadsheet documents that we have in that regard uh and we'll try to put together um uh after the May 21st uh bccc meeting uh I don't want to get ahead of ourselves on the decision we'll put together a rate comparison sheet to distribute to council and for the community to see exactly uh where uh the rates will be there will be a lot of transition obviously since we're going to be leaving from Republic one way or the other and we'll sort of have an itinerary and outline for that uh keep in mind that the um uh the the term date of the agreements is October of 2025 uh so the good thing is is we'll have more than a year to prepare for a lot of those uh changes and modifications we've had a a very brief higher level discussion with the property appraisers office um as a contingent discussion operating under the hope my hope uh that the board of County Commissioners decides to go with universal as opposed to subscription so uh at that point in time what we'll see uh is if that is the case and they go with universal uh then Mr Sweeney will be preparing some ordinances and so on and we'll have to have don't want to get too deep into it we'll have a public hearing because it's technically a tax that will go on the um uh on on your your tax bill as opposed to a subscription Bill uh from the provider so um I'm happy to talk uh at at length at any other time uh on this but again the uh bccc meetings on the 21st of the of of may just because it's a um convenient stopping point on this uh does it make sense for Council to um encourage the County Commissioners to up for Universal given the you know what I perceive to be the great benefits of that or are you comfortable the negotiating team can persuade the County Commissioners that um you know our council is supportive of that approach um yes uh I I I do think that I actually yes to both I do think that that uh I just just recount that that reminds me of uh when I when I asked a friend if he was walking to school and he said no I packed my lunch so thank you um I do think it's important uh I was at the last bccc meeting on this topic uh I spoke and uh and supported the idea of universal for a variety of reasons uh staff is recommending that in other words bccc staff is recommending that I've recommended that on behalf of the town uh I think that there are uh some council members that are uh not convinced of that others have or excuse me bccc members uh other bccc members have said listen we need to you know rely on staff it's their recommendation and I will hasten to add that as it stands right now 70% um of eligible people home owners are subscription in Indian River County so in a way I think the way to think about that is that they've 70% of the people in IND River County have voted with their pocketbook to say that they want um Universal garbage service because they already subscribed to it very small percentage do not again roughly 30% so I do think on the one hand it is important to to to reach out if at your discretion to bccc members and I'm happy to talk to you later about this as well um because I did note to them that we essentially have Universal service because we have an ordinance that requires you to subscribe and I talked a lot about what that would mean for the county um overall uh and then to the second part I do think that um uh County staff and myself have made it pretty clear that we support uh Universal all along the way of this entire process so um yes and yes all right well let's make this simple I I think uh absent any uh discussion or objection from Council if you feel um submitting a a formal written um statement to the county commissioner saying that you know the Town Council uh supports you know Universal subscription and uh you know see below why uh which are the reasons we don't need to discuss here yes sir is there any objection to that or okay all right so feel free to do that I I think it'd probably be a good idea to do it just because you know things said in negotiating committee meetings kind of get lost on the record but yes sir I'll take care of that thank and I'll make sure Council just copy that Sor already interrupt than no no no sir uh Jim a quick question which um service providers are still seriously Waste Management FCC um initially and I'll get these numbers out to you I'm sorry FCC F FCC yes um I'll get those numbers out to you um FCC was the lower uh uh total number overall in the initial round in the best and and final offer um uh waste management is now below FCC uh and I'll get all those I'll get all those details to you I just want to pull them out from our we just had a meeting on this on on Friday so I want to get it all together for you in a coherent sense Jim is that the only thing that I'm sorry go Ahad is Republic out of the running they are because they withdrew or didn't make a bid or no they did they just did not in in the initial rankings uh they did not make it accumulatively uh to one or two and then the boc bo County Commissioners decided go back get best and final offer from one and two which were FCC and waste management thanks do they only make their decision on on rates I mean I hope not like the lowest rate won't automatically get the no not automatically um and what happened was there were a variety of different um categories under which each uh uh vendor who submitted a bid uh were were were judged uh Heather Christmas was on the uh the pre preliminary scoring uh group of people that did that and then from that uh we ranked individuals and then as a result of that we came with the top two which was initially FCC in waste management cumulatively and then uh now after the and final it's Waste Management FCC and G geographically what's the closest FCC service territory Port St Lucy I believe I don't think it's were they the ones that had all the problems down there okay they were the ones that came in after all the problems yeah um would like to follow up uh very briefly on uh the council's determination uh to go with the change in our domain name uh we've had some preliminary meetings internally we've also met with uh Indian River County IT personnel who have already gone through this process that was very very useful for us and uh we've done some again some internal research and we've determined that the staff recommendation uh for us to attempt to uh secure this name our new domain name would be Indian Rivers shores. goov um that's available and we believe we can secure an exception without going into details to to get that in the alternative we would be looking at Indian rivershores fl.gov um no you know caps irrelevant but those would be the domain names that we're we're looking at right now I'll keep you up to date as this process goes on yes sir just to clarify there's no spaces dashes or any other punctuation just yes okay just want to state that and that's how we would be submitting our request it's fine okay uh then at this point in time I'd like to just go over uh the anchoring limitation area uh presentation briefly with you uh I'd like to thank the County Personnel uh apparently Heather's trusting me with electronics see what we can do um so I want to thank County Personnel for putting this uh presentation together I took information from their most recent presentation put it together for us left out a number of uh items that were not necessarily relevant um to the shores so just as we go through it uh a lot of this will be familiar so uh it'll be helpful for people that are looking at this later on on the tape or looking at it live so the anchoring limitation areas uh were uh authorized by state statute and uh they limit the amount of time that a vessel can uh be in a particular ala uh 45 consecutive days in six-month period uh there are citations uh potential for empowerment uh or the Declaration of uh the vessels as as being derel keep in mind that the derel vessel process is a exists now now in a separate and distinct if it's just derel and it's not an ala violation so the county passed an ordinance uh consistent with Florida statute and uh looked at what um ala may be established there are acreage uh limitations uh in other words it may not exceed 10% of the counties delineated navigable in fact waterways which is kind of a term of art doesn't include moing fields or marinas uh and has to be less than 100 acres uh it also has to be clearly marked with signs and buoys and and and so on uh again you have copies of these but we'll move along I want to show you just a couple of other things this is a really broader version of the of of a you know you can see the orange area where the town is uh not particularly easy to see here but uh the three jurisdictions that are uh that have passed uh resolutions to have the county establish the AR Sebastian uh ourtown and Vero Beach uh we have three areas within the town jurisdiction that um uh that we are contemplating for uh Alas and the future in the other Maps you'll be able to see them broken down a little better I want to look at the financial estimates right now just for the the signage uh what it required to establish Thea alas are pilings and signs as well as buoys uh associated with all this are obviously the the Marine surveys and and things that have to to be done um so we would you know roughly be looking at this $43 to $50,000 uh cost based on a you know an initial comparison again these are these are County um estimates the signs themselves are required to be placed at the entrance of the Ala area uh and then you have to have uh buoy markers which uh if you'll just allow me to go back that's the buoy and you can see just the schematic for the pilings uh and in this particular ala that you can see uh it's roughly 100 Acre area and um this runs along if you're looking uh in land it's obviously um you know east of the of the inter Coastal uh the second ala area that we have uh and the third ala area that we have you can see uh those are within um town jurisdictions and you can see the what are identified as the entrance uh areas to those by the anchors and then the black dots are the uh the buoy markers uh of importance right now and relevance where we are the county staff has provided two options to uh the board of County Commissioners for proceeding uh the first is option one where in the county serves as the permit for FWC the municipalities are responsible for permits through Army Corps of Engineers Coast Guard and d uh we would also be responsible for the installations of piling signs and buoys within our Alas and we would be responsible for monitoring maintaining the piling signs buoys within the Ala additionally uh we would be the primary uh enforcement agency that's the same in option one or two we're going to be the primary enforcement agency in our town regardless uh in this option the county would reimburse the municipalities 50% of the cost associated with the installation of the piling signs and buoys the municipalities would bear the responsibility for the maintenance and in the event we were to fail to you know monitor maintain or enforce the Ala the county could uh exclude us uh from their ala now uh some of those considerations and and again County staff is recommending option one to the bccc uh is that you know the county work with the municipalities and FWC and um look at some potential um you know look at some potential grants and otherwise uh option two is the option that uh all of the municipalities favor um which uh there's some uh analogous uh bullet points for both with some uh very notable differences uh first the county would serve as the permittee for FWC but also they would be responsible for permitting through Army Corps Coast Guard and d uh for sign and buoy deployment uh the county would simply invoice the municipalities at 100% cost uh for uh for those for those items uh same thing for the installation of the buoys and uh the pilings and the signs uh um and uh the county would be responsible for uh monitoring and maintaining uh the piling signs and booze within the Ala um I have noted off off of this not off the Record but just simply off of this that uh given that we would be primary enforcement we're happy to do the monitoring as well uh if that would um allay any concerns uh that the county might have uh again we're as with option one we're the primary uh enforcement agency uh in this option the count the municip alties would cover 100% of the cost um and then if we failed to reimburse then you we would have the same thing the county could exclude us U as I noted not withstanding the cost difference I.E in in option one uh we're getting reimbursed 50% from the county but in option two we're uh being invoiced by the county and paying 100% of the costs um not with stating that cost cost differential I believe from a a management uh permitting standpoint I think it's better for the county to do it I represented that to the BCC when I spoke with them last at their last meeting on this topic uh but we're not uh There Yet the bccc directed uh their staff to get back with the municipalities uh to see if we could come up with um as one of the Commissioners noted option 1.5 or somewhere in between to try to make this happen uh on the one hand we believe that it would be more expeditious if the county did it in its entirety um but again everybody has their own uh interests in regard to it though I will say the collective interest is certainly the Lagoon in the waterways and and being able to make this happen so that's what I have on the Ala are there any questions yes it sounds like a nightmare the uh it's really it's really not the the permitting piece uh yes and no I'll say the permitting piece is is going to be where there are going to be a lot of hurdles a lot of Staff time uh however some of the items associated with that can uh can be used for all of the permitting pieces for example there's going to be need to be a marine survey to identify the exact locations of the pilings and the buoys that's going to happen you know one way or another it's not going to happen separate and individually so we have not heard back from the county yet because this meeting was just very recently so once we hear back from them we're going to continue to negotiate how we can how we can make this happen um in the end I think all the the administrative work The Upfront work and the permitting and the installation after that uh we have a boat on the water regularly we can uh definitely handle the uh monitoring and the enforcement uh 100% that's that's not the issue but we'll we'll get there one way or the other okay but the at the beach and Shores me the derc vessel issue is huge and it takes forever to get rid of them so this does not address someone leaving a derel vessel in this Ila area it will they still have to look at it for three years it it does can you get them out quickly it does to this to this point if we can regardless of whether it's a derel vessel or not if we determine that it's in an ala okay and it hasn't been moved within 45 days then we can proceed with the actual enforcement of of gathering the fines and and having those types of enforcement actions uh a little quicker than on the derelict vessel which is looked at in a completely different regulatory sense under state law yeah it doesn't say that here it says that the deric vessel has like 12 months to get something like that but and that that's why it's that that's why the deric vessel process is completely separate than the anchoring limitation process well I I don't understand then why if you can just put a vessel in the anchoring limitation area and say it's derel and it doesn't get removed just quickly as the other vessels I think the difference is is in in the ability to move the vessel in other words um the Ala is intended to address those vehicle or those vessels rather um that have the ability to move in some way okay whereas by definition the derelict vessel is unable to move under its own power and I'm paraphrasing the term of art terminology within the statue I say this ala is a is another tool it's not the be all or the end all to the derel vessel piece it's just another tool that that allows us as an enforcement agency to move people out of an ala if they're simply sitting there indefinitely so it doesn't do anything for derli vessels really you could just put your derli vessel in one of these nice areas that's been all buied off and nobody will come by and you can leave it there forever to paraphrase my early response to council bradwater yes and no okay I just wanted to say it really doesn't help deric vessels you might be able to move them a little quicker was PR press a little yeah so okay but but only if they're in that ala yeah right okay it also allows for more direct enforcement of tracking down the owner as opposed to just a derel vessel you can slap finds and leans on it um it it's another tool it's not a Panacea but the thing here is um derc vessel is just one issue that alas are intended to address um there's a safety issue and the safety issue is that um typically people who have been anchoring in um an area for an extended period of time um tend to correlate with Mischief people coming ashore um hitting places that are um vacant um uh there's a huge amount of discharge that goes into the Lagoon they're not terribly responsible Boat Owners but probably the most persuasive thing is do we we really want to be the only municipality that doesn't have an anchoring limitation area because guess what's going to happen if somebody gets sighted in one of the other communities that are all going to come into our area now the fortunate news for us is you know unlike the other municipalities we have a fairly limited um area that our ala will cover there aren't going to be that many places for these for these um vessels to um to more long term beyond the 30 days so uh I don't think we want to be the odd man out here otherwise we're going to see a substantial number of boats being moved from other Alas and other municipalities and coming into the shores yeah no I don't mean that we shouldn't do this I just wish it had covered darc vessels better that if there is a vessel in there after 45 days they just remove it they don't have to find the person I mean they've dealing with a vessel now where the person's dead and then they've left it to the person in jail I mean it just goes on forever and it doesn't address that in this I couldn't agree with you more I I think I think we're going to need legislation that's going to have to deal with that because this goes back to a it's amazing the stuff you learn up here that you never thought you'd learn about but this goes back to a policy forever in Florida that the waterways are to be the home for people it was a policy that was designed to uh encourage people to live to live on vessels and you know times change and statutes don't um you know I I went out with our Public Safety people three years ago and um best way you can describe it was it was a deric tugboat that also had you know probably a quarter of a tank of diesel fuel no signs of life um fish and wildlife who had jurisdiction over it said they couldn't move it because there's still a functioning radio in there so uh you know we really we really need I think to get a of our local legislators and I'm I'm committed to working on that hopefully we'll all work together on this this year to see if we can't get it because um I mean who isn't sick of driving over the barber bridge and seeing the same boat on the right and the same boat on the left that's been there since um I want to say Matthew for you know exaggeration purposes and impact but I I think it was Ian I think it's been at least since Ian so that's what two years2 yes sir so couldn't agree with you more but um I I think the deric the deric boat issue is something that we need really focused smart legislation on as opposed to you know just just giving an enforcement mechanism that there's not much we can do and you know the the enforcers really are are in a tough position you know they can't you know they can't and not comply with the statute so anyway just my two cents on it so in listening to the the board of county commissioner meeting on this uh former uh commissioner O'Brien got up and pointed out something that we all should be aware of the the slide deck says the alas allow for anchoring vehicle for no more than 45 consecutive days in the six-month period he walked through different ways that you can gain this to make it a lot less the legislation has been drafted pretty poorly and it was my understanding that the county can't change those rules that has to be done in tasse is that correct okay so so this is the first step here this is typical a lot of bills that come out of Tallassee where somebody doesn't think through the things I I have a question about cost so a couple of these Pages show that the uh Shores estimate that for County that somebody over County staff came up was 43 to 50,000 do we have any sense as to whether that is accurate at all or even in the ballpark we have we have embedded those numbers specifically however uh my understanding from speaking with folks over there is they were uh simply based on a uh you know a determination of what other what the cost was right now as we stood to order the signs what were the buoys you know how much were the pilings right so this doesn't include surveys no so we have any sense of what survey is it going to run uh no and the reason we don't right now uh is because if if the county decides with option uh one then uh my plan would be to get with Sebastian and Vero to um for uh really based on economy of scale and collectively get the surveys done uh under one umbrella as opposed to each of us doing separately same thing with the contractor for the installation of the pilings uh the signs themselves are they're all standard purchase online you okay they're di Minimus in terms of the the the signs and the buoys um it's really not that no idea what the um what the actual Marine survey piece uh would cost at this point in time okay and then under option one there is a discussion about funding the estimated amount of 106500 127,000 will be made available via budget amendment would it be fair to say regardless whether option option two are uh done that we as the town could go to the Florida boting fund and try to get some of this money back directly uh yes we have't either either reimbursement or looking affirmatively for Grants um uh and we'll do that uh subject to what the county decides I don't want to expend any um no but I'm just saying if we get stuck doing the whole shebang or organizing ourselves separately outside of the county with and Sebastian that we could try to go get some of that money yeah we'll either try to get a grant money up front or reimbursement okay okay and just one last thing to know for people who are watching that there are no alas for UNC corporated County and it was interesting that Peter O'Brien said uh he he said without saying I I I think you're wrong you're going to need need some of these you know I think about down in the moing area uh that big development down there I could just see people setting up down there so that was a bit of a head scratcher to me when when they when they walk through this so but that's all for me yes sir uh Mr Mayor that's all I have on my report you know we do have to recognize this is AOL the first step I think order the Public Works director of that number ofy of funds toing that for that take at it's all right a com I'm Jenny Jenny housted and I live in the Estuary at 135 River Mist Way and I think maybe one or two of you have heard from me but we are having a real problem with use water um and when I was directed to call Steve uter from the city of virau beach I was told by him that we should have adequate pressure for irrigation any day of the week be um between midnight and 700 a.m. and that for contractor irrigation workers that we should have it from 7 a.m. to noon on Wednesdays and Thursdays and this is not working for us there um is not water at midnight if you look at there's a recording of our pressure um on the main line and if you look at it we rarely achieve 50 psi which is what all the irrigation companies say we need at least to be able to run our sprinklers when we do get it if you look at that graph it's usually less than an hour and that's not enough for for most of us who have zoned irrigation um and then we've had irrigation workers come out to work on our system in that Wednesday and Thursday time slot we get there we you know pay to have them come out and there's no water pressure for them to assess the systems so I'm asking if we can somehow address this with the city of Viro beach I was told by St that we should within our community try and rotate who Waters when so that with like within the Estuary everybody isn't set to water at midnight but currently you know what we were told is that we should all water at midnight and we should set our sprinklers for seven days a week um hoping that one or two of those days we'd have water pressure so I'm just asking for some help in this issue because most of us are seeing our plantings and things dry up we we'll do what we can it sounds like you're getting the answer that when you go to the doctor you say my arm hurts when I do this and they're saying well then don't do that um and I don't mean to make light of it you know it's a very dry season and without proper irrigation we're all we're all seeing some issues with our plantings so um Mr harpring can you um follow up on on this issue um I I'll be honest with you we have a long list of issues with the city of Vero Beach it comes to issues but these these operational these operational issues should be should be addressed um so we'll we'll do our best to follow up on it and we'll get somebody back in touch with you and let you either know the good the bad or the indifferent so we' appreciate it I actually suggested that in that Friday news blast that you put a a recommendation there for when the different communities water because otherwise we may all be drawing at the same time and that may be part of the issue so anyway well thank you we we appreciate your comments we'll you know we'll certainly um we're not just saying we'll look into it we'll look into it and we'll get back to you and see see if there's um if there's validity to what's being said but uh they they their pressure should be sufficient U for a community particularly at midnight so it doesn't doesn't seem to make sense to me well I'll just say that the uh their utilities director Rob Bolton I I I'm I'm the town's representative on the Utilities Commission which means a lot less than you think it does because it's totally advisory that uh two or three weeks back he was actually on TV saying they were having uh pressure issues uh in portable water because people were using portable water to try to IR irrigate now why they have a bigger problem than other water utilities up and down the coast I don't know I had planned to bring it up at the Utilities Commission meeting for this month and lo and behold it was cancelled so uh you know we we'll try to do our best they are extremely unresponsive particularly utilities uh directory you you tell him there's a problem you know that the sky is red and he'll he'll he'll tell you it's uh it's blue it's they're just very difficult to to work with so I you know unfortunately that is the reality of the situation uh W with that organization so well there's graphic documentation on the little recording wheel of what the pressure is well you know yeah that actually if if you could maybe if there's a way to download that or print that off and give that to the town manager to give to give him some numbers in the discussion with the utilities director it certainly can't hurt appreciate it okay thank you very much for your comments we appreciate it anybody else going once going twice all right we are adjourned until our June meeting uh thank you
