andice all right we have item 1C um we had an election and it's not not the one that everybody was thinking about but uh we had an election too here in town so we are going to administer the oath of office through our town clerk um and the newly elected newly elected council member is Mr William Dayne who's in the audience and we had the re-election of Jim Al Terry and uh councilman Bob aard so uh if you would like to administer the oth of office I would ask if Mr aater and Mr Altier could come down to front of the DI I will raise your right hand I state your name do solemnly swear SAR that you will support protect and defend the constitution of the government of the United States and the State of Florida and that you will Faithfully perform the duties of council member of the town of Indian River Shores for which you were about to enter so help you God congratulations take some pictures there he is [Applause] yep all right thank you thank you councilman eler just told me it was a hardfought campaign and you'll be happy to know that none of their campaigns are 20 Milli million dollar in debt so uh so we have a uh we have a terrific thing and um before we get to the roll call uh we're lucky once again to have a new member with such great outstanding credentials um Mr DNE we're we're delighted to have you on the day and uh looking forward to working with you Mr alter of course we know your work and Mr alwat we know your work as well um and it's indeed a fortunate town to have the talent that we have uh willing to serve all right with that can we do the roll call please organizational aspect of the meeting which is the election of Mayor is there a nomination for mayor I nominate Brian Foley for mayor I I would second that uh thank you very much I greatly appreciate the confidence that uh that you're showing in me and um I look forward to uh giving it all all my best for uh the next two years um thank you do we have to have a roll call vote on that or Madam M I was looking at our CLI uh normally we would close the nominations and then just have a all right are there any other nominations nominate Sam Carol for vice May we're we're any other nominations for mayor all right if there are none we will close the nominations and we'll take a vote all in favor I I all right thank you very much uh we will move to um the election of vice mayor is there a nomination for vice mayor I nominate Bob arder for vice mayor I nominate Sam Sam vice mayor all right so we have two nominations the vice mayor has nominated uh a successor Bob alwat and Mr elry has nominated um uh vice mayor Carol um vice mayor Carol by you're nominating Mr aler I'm I'm presuming that you are happy to pass the gavel the gavelin waiting over to Mr aler I'd be delighted too all right I appreciate Mr alter's vote of confidence but um with having served for vice mayor for two years has been a terrific experience um I think that uh councilman alwat uh has shown has demonstrated U over the I think four years we've worked together a remarkable ability uh to make uh uh substantial contributions uh to the town uh to this to this Council and um I think that uh for the next two years um I would prefer to step aside and let Mr howat serve as vice mayor thank you sir Mr alter in light of the current Vice mayor's comments um do you wish to withdraw the nomination withdraw okay thank you um I will say this first um uh it's it's terrific to have such a such a great choice on my left between vice mayor Carol current vice mayor Carol and uh former vice mayor alwat and councilman alwat uh and I appreciate your your time and effort over the years Sam and U the graciousness in in which you were passing passing the T council member alwat so uh with that uh we will close nominations there any other nominations if there are none all in favor of Bob orderer as vice mayor uh say I I I any any Nays all right it is unanimous and we did not need a roll call vote on these correct yeah I didn't think so all right well we have a uh uh we have a newly organized council with many of the same faces and uh we look forward to working on your behalf uh for the next two years uh we will move on to item three which is the agenda reordering deletions or emergency additions are there any requests from Council to reorder delete or add items to the agenda if there are none may I have a motion to approve second all in favor I I I any opposed all right we are uh moving on to item number four which are presentations and proclamations we have no presentations and proclamations uh today other than the general Proclamation I'm going to make to all of our committee members which we will get to later in our our um agenda items uh for having serve the town so well uh you do it as volunteers everything from Finance to Planning and Zoning um we even have a bicycle advisory committee and the the work that you folks do make the council's job much much easier and is essential to the functioning of the town so for those of you that are signing up again we thank you and for those of you that are leaving uh we thank you for your past service and maybe after a vacation or two you can think about coming back so thank you very much um item number five are there any comments from the public regarding the agenda items any comments regarding specific agenda items okay if there are none we will move to the consent agenda is there a motion to approve the consent agenda so move second uh we have resolutions so we will need to take a roll call vote mayor Foley I vice mayor Carol vice mayor aler I council member Carol I council member Altieri hi council member Dane hi terrific thank you very much uh we'll move to the mayor's report uh typically at this meeting is where we do the the annual review uh we give ourselves a report card last meeting we pretty much covered it U when we went around the deis and thanked former council member uh Smith for her service um but just to recap it I think I think the highlights are uh We've we've continued to push our staff and the leadership including the town manager of course to be the Paradigm of great leadership uh be the Paradigm of customer service we don't want our citizens feeling like they're interacting with the government we want them to feel like they're uh their valued customers because at the end of the day they are at the end of the day the money we spend is your money and at the end of the day the services provided are paid for by you so we are committed to that as a council um I can say that confidently knowing the people on this day is um we had you know great vigilence on uh ensuring that we are continuing to push for uh you know our beach to be replenished and protected U we are um continually working at our disaster preparedness it came a little too close little too close to home this last time and what I mean by close to home 30 yards you know we had 30 yards before an ef3 was going to enter you know our town um contrary to popular belief we we don't have the power to keep a tornado out of the town we were lucky and we thank God for that um but our neighbors were not not as lucky so we had we had a couple of things that we learned out of that and that is that um our our intergovernmental relationships are extremely important we were on the giving side this time our Public Safety department assisted in the city of Euro Beach's response to that because they had enormous um calls for activity and so we were proud to lend a hand to our to our neighbors uh the other the other thing it pointed out was that um when we were looking at Reserves and thinking well you know gez maybe you know maybe we should um give i'llbe at a modest refund and refund to the taxpayers instead of building our reserves up for potential disasters it looks like it's a pretty good idea that we did um we did make the decision to increase the reserves because again we were we were hundreds of meters away from um wondering whether we would have had enough to to cover those costs um I think generally this is a hard one to articulate but because it's not terribly flashy but it is it is probably the most effective way of delivering a quality product to our taxpayers day after day and that is that we've all worked hard as a council to make sure we have the right people in the right place in the right systems in place in the town and I will speak for myself and if anybody wants to add to it please do but uh I've never felt this confident that we have the right people running departments and the right people with the focus of moving the town forward and and keeping this the special place that it is so again these are not flashy things because you don't see them happening every day but trying to figure out where Talent exists and we have a number of examples of you know late in talent in the town that uh I'll give credit to Mr harpring for you know finding the people that you know would be uh capable of taking on additional responsibilities uh for for the town and here's the best part um without having to BR bring another person in uh no more added expense so uh we will continue to work effortlessly on your behalf to do that and to make U make for a more effective uh town uh is anything else anybody would like to add to that yeah all right um okay um item number two uh we had uh we had an election as everybody knows and I alluded to earlier and um one of the items on on the on the ballot which did not pass was uh the recreational marijuana use which caused me to take a look and see whether or not we have a smoking ordinance because the feedback I was receiving from members of the community were uh questions along the lines of if if the Constitutional Amendment passes do we have something in place to prevent you know public smoking and uh you know I I don't I don't I don't want to uh tip my hand on how I voted on the issue but you know are we really going to have people smoking joints walking down the street to the sidewalk and is there nothing we could do with it so on a rather expedited basis uh a town attorney was asked to look into an ordinance to U uh take care of this contingency and the event that had happened uh for two reasons you know first of all to do what we could to address an issue that would be u considered a nuisance by a number of people in the town and the second reason is that the legislature in Florida has a tendency to uh enact overarching preemptive regulations but do carv outs for um ordinances that were already in place at the time of enacting the legislation otherwise known as grandfathering so while the pressure is off um because we don't have to worry about this happening in 90 days I'm going to ask for consensus among Council to have our uh Town attorney continue to uh work at a more leisurely Pace but uh you know with all due speed anyway on an ordinance that would uh take care of this capability should it happen now I will note under the under the current ordinance excuse me under the current statute we are able to regulate smoking in public places except for cigars so we wonder who in the legislature has a cigar Factory but um so you know I don't think the definition of a cigar would uh um prevent us from doing what we want to do in the event that this issue comes up again and or that the legislature which it could decides to legalize recreational use of marijuana so um it's fine if that becomes the law we'll abide by it but we want to do what what we can to make sure that it's not a public nuisance so uh Mr aler Vice May aler sorry the only thing that I would disagree with you on is using the term leisurely only because the legislature meets early next year and unfortunately we have seen so many times times where they have preempted us the one that always bugs me is the tree uh the tree ordinance I won't won't go into the detail behind that but I I think the sooner we get it on the books if if if we decide to go in that direction I I think we should consider sooner rather than than later A Point well taken um it's it's um my apologies Pete and I have a vernacular leisurely means by next month um so I hope to have a draft ordinance by next month as opposed to having it for this meeting um which was what our attention was uh had the Constitutional Amendment passed so uh you know thank you for requiring the clarification but yeah if we can get something next month for first reading I would appreciate it so any objections no okay terrific thank you um all right so um that concludes the mayor's report are there any questions for me or comments uh council member items are there any items council members wish to bring up okay item nine uh discussion with possible or probable action so item 9A is council member appointments uh council member appointments are the uh various committees that occur on an intergovernmental basis so for those of you in the audience for reading the minutes um an important part of our function is not just our our monthly meetings here and the things we do in between them but uh there are uh intergovernmental organizations through which the town uh is represented by a council member and an alternate if the primary member can't make it uh to weigh in on some fairly important issues so uh Metropolitan planning Organization for example um has an awful lot of authority over you know when Bridges roads um you know growth issues um relating to infrastructure are going to occur how and when um it's heavily influenced by uh Florida Department of Transportation who's usually the major player at those meetings I served on that committee um a couple of years ago um and as we go through the aordable housing advisory committee uh Economic Development Council Beach Insurance preservation we alluded to that earlier pretty important uh pretty important um um item for us elected officials oversight committee Treasure Coast Council of local governments Treasure Coast Council Regional League of cities planning Council intergovernmental relations and they go on so um I'm I'm reminded of you know somebody said what was the biggest untruth ever told to you when you ran that you found out after you were on the council and I said the biggest untruth was that it's one meeting a month you know to get people to to run it's like what's only one meeting a month and just have to prepare for it so to do job effectively this is what we do um so with each organizational meetings we either keep people on the same committees or we we add and subtract from other committees so we are going to go through um each one of these line by line and appoint council members um my preference would be to do it as a slate uh so long as the town attorney doesn't object we'll just go through it we'll put the names in and then we'll approve the Slate of all these various committees um I will say this that the tradition has been if there's a you know a uh more than one Council persons that want to be on one of these one of these committees you know the seniority the rank has its privileges has has attained to it so um and the the theory of that is that you know eventually down the road the the junior council person will will um obtain the ability to get on that that committee at some point so we're going to start with met let me again say what the process was to make this a little bit more efficient for everyone we asked everyone to express uh through the town manager uh what committees they would like to serve on um those preferences were expressed to Mr Harring and then they were uh presented in a summary format of uh How It All Shook out in terms of Who Wants to be on what so there's Metropolitan planning organization uh Bob aater has uh requested to be the primary uh I'm happy to serve as the alternate unless anybody else wants to be the alternate I'm not going to be greedy on this if you'd like to be exposed to Mo which I would say this this organization meets rather frequently uh is it 10 times a year yeah um so anybody interested uh in throwing their hat in the ring for alternate and are we okay with Bob being the primary all right thanks so we'll move on now to affordable housing advisory committee uh Sam Carol is the primary uh on that and we're looking for an alternate on that is anybody willing to be an alternate on ahck you will okay thank you Mr DNE Economic Development Council Sam Carol as the primary and Jim alter as the AL it everybody okay with that all right Beach insures preservation advisory committee uh I I I would like to be our member I've attended almost every single meeting from 2015 and uh as I mentioned in the last council meeting my wife and I attended the Florida Shore and Beach preservation Association it's it's been sort of a passion of mind to try to get sector 4 designated as critically eroded to help us get further uh funding okay and Mr alter you're interested in being the the alternate on that I will do that okay um and you know just to remind everyone um simply because we have a primary an alternate you know the alternate can attend every meeting uh these are publicly noticed meetings there's no sunsha issue sunsh Sunshine issue um and likewise any council member can attend and um and make comments that the primary of course of in attendance is is is the voting member um all right elected oversight elected officials oversight committee Sam Carrol is the primary uh would anybody like to be uh the alternate on that Mr DNE Mr Dame will be the alternate on that thank you uh Treasure Coast Council of local governments um I am happy to stay on that as the primary and Mr Carol are you okay as the alternate all right uh Treasure Coast Regional League of cities um Mr danne you expressed an interest in being the primary to replace me and I'm I'm happy to happy to pass the torch to you and Bob alwat will be the uh will be the alternate on that I'm fine with that are you okay I'm happy to be the alternate if you feel you're going to be overstressed so no no okay that's fine all right Treasure Coast Regional planning Council uh Mr Carol yes is the primary and I'll be the alternate well the reality is we're not going to be there for 2025 well we don't have a vote but well okay all right we we rotate on yeah so uh just so folks know that we we alternate with The Town of work it in terms of who has a vote on the Treasure Treasure Coast Regional planning Council and um uh this this cycle we do not have a vote but that doesn't mean that we cannot go and advocate for our position so uh uh we'll we'll be happy to do that again that that one used to meet more frequently it doesn't doesn't seem to have the same frequency that it used to have uh quite frankly I think it's very informational but um having been on it for two years or so I still scratch my head and wonder to do um in terms of binding capabilities but I I can say that because I'm term limited you figure it out you let me know I I I would love to let you know but I don't I I always look to my right and left and say you know do we ever vote on anything that um has any Mr Mary could you just repeat who how how's the lineup going to be on that then yeah Sam Carol's the primary on Regional planning and I'll be the alternate okay um okay Florida FLC Florida leag cities intergovernmental relations Sam MH primary I'm happy to be the alternate and the Utilities Commission my understanding is Mr alter um wishes to be the primary on that and Mr DNE um Mr alter has seniority so Mr DNE will be the alternate are we okay with that all right good so do you have all that I wrote it all down in case you need it and uh with that do we have a motion to to approve the uh committee appointments of counil is there a second a second all in favor I all right that was easy mayor FY um are you going to uh reappoint the um committee liaison for the town which would be on the bicycle advisory n would be frank blazedale and Nancy um aater as alternate we were going to do those in December I'm sorry those were uh subcommittee appointments um we're going to take care of those in December in in in December yes just at the December meeting yeah all right yes um I'm it's not on my sheet so I can't no I'm kidding um my understanding is that the town manager is correct we're going to take those up in December as the subcommittee okay terrific all right we are now going to uh planning zoning and variance board appointments uh we had two expressions of interest um in alphabetical order um Terry Bowman has submitted an application as has David chus uh are either are both of you here I see I see Miss Bowman okay um is there any discussion from Council and does is there a rep a nomination from Council for this opening many one I nominate Terry all right are there any other nominations okay are we able to close nominations no no other nominations um we have Miss Bowman um all in favor I I okay so we have uh congratulations uh his Bowman Mr Mayor yes just Clarity the other three remaining members are hold over members and appropriately be reappointed if it were the council's I'm getting it right to yes sir okay so we have a vacancy appointed uh and now we have the existing members of the planning zoning and variance board um and that is Mr carbin Mr Crawford Mr hutmaker and that would round out the four so do we have any um uh any objection to renominating Mr carbin Mr Crawford and Mr hutmaker Ju Just A a question information so the PCV board has only four members Mr Mayor I me yeah uh vice mayor M the uh has five uh one member's term expires in uh 2026 so there is no need for action on that uh on that fifth seat right okay so excellent point so we may um we may be well served if you could let Mr Christus know that there'll be another opening coming up in 2026 so right all right so with that is there a nomination to reappoint those three members so move second is there a second second all right all in favor I okay all right so we've got Planning and Zoning done mkey are not here I don't think um and I want to personally thank Mike and Peter for the for the outstanding work they do I know that uh you always bring up issues that uh if I thought of them you you you put a different perspective on it that makes me rethink it uh and you oftentimes bring up issues that I that I haven't thought of so your work is invaluable and thank you very much for your nothing further to update since last time um any questions are there any questions for Mr mikr vice mayor maybe more of a comment item six two election signs from the Sandy Kennedy for congress campaign were removed I assume they haven't been picked up no sir not yet I'd probably bet my house is not going to be picked up probably not okay thank you I know tough tough job people putting signs up all over the place so thank you very much for for that and um and the other work that you do anything else for inspector Mike r no all right um public works department Mr Bryant morning Council you've received my report if you have anything questions about it or I have nothing additional to add to it anything from Mr Brian vice mayor Outwater uh since you and I had a discussion on the phone yesterday could you talk a little bit about the the mess at the corner uh of Fred Turk drive and A1A caused by the city of ver Beach's contractor and what's going on um just just a brief update we did have it was a lot worse than what it is now um I did make contact with the uh project manager for the city of Vera Beach and they they sent somebody back out to clean up to where it is now um at this point there hasn't been any other actions going forward but I do know that they are going to have a a trench going across a Fred Turk explain is why the reason theot is still in place um other than that that's pretty much the brief update I can give on that okay well I I have a suggestion for a town manager U I don't know and be interested what the council feels is maybe to contact Monty falls directly would they tolerate this mess if we cause that in front of their City Hall you know particular as we're going into uh the season I think I you know you know L Larry's you know going up the the the chain of command but I I think it's worthwhile and and an Outreach I mean it's been sitting there for a while it's not like it's been two or three days plus they damaged our anchor in the front so just a thought on my part and other counil how other Council people feel uh any comments um I I agree with you on the issue and um I I would ask that uh uh I know Mr Bryant's doing everything he can but maybe maybe it's time for you to Mr Haring to reach out to Mr Falls and see if they have uh and I know you have but you know say the council you know Council has requested that you know we get at least some uh some time frame on on when that's going to happen and and perhaps if he knew that the cost to repair the anchor is going to go up every day it remains uh it remains untouched uh it may motivate it but I I I think it's worth a you know administrative to administrative uh response before um you know before we at um just uh Mr Mayor and uh Council um I continue to have those Communications and conversations regularly and um uh we will continue to have those Communications regularly we do anticipate as uh Public Works director noted that there's uh going to be that uh additional uh piece down here but there's also going to be another excavation which is why they're still um standing by we do monitored every day and I would have noted during my report that um uh I thank our our building official our Public Works director uh who at a moment's notice uh either on their own initiative or or at my call are with you know the City personnel and others to to work on this just as an aside um I've also reached out to um uh both uh Flagler College and Indian River State College to uh come out and actually try to get somebody down here uh to do an evaluation of the anchor uh we have very little background on actually what it is where it came from uh thank our town clerk for looking up the information that we do have uh but all this is um not going uh unnoticed or unattended thank you really appreciate it and you know no no I just I I wasn't suggesting that it just uh I I all suggest is got to keep the pressure on given our relationship with the city of ir Beach on other things they tend to be very unres unresponsive and not transparent as when I go through uh my my remarks on committee reports will just reinforce that point so um just to add to that what I'll do is I'll make contact again um being with the holidays coming up and get a timeline of when they're going to more continued Works going to happen here out front um maybe they could just at least spruce up our front lawn enough to to get it ready for the holidays thank you that that would be appreciated no and I I agree with you know Vice May alwat um you know I'm sure we're going to hear we've got other things to attend to given you know given the the damage in central Beach but you know there's there's an awful lot of activity um being devoted to to other areas and not us so I I think it's a point well taken we we have a short fuse before our next meeting it's mid December because of the because of the holidays and um we don't need to wait that long if Mr harping can give an update to council you know in the form of a communication and remember don't hit reply all you know we're going to get one of those disclaimers um so if we you know if we're at least kept a breast of what's Happening um you know perhaps it can avoid it escalating to the political level uh and nobody wants that um so okay thank you very much I think we have a Way Forward on that is there anything else for Mr Bryant thank you very much thank you Council uh Town Treasurer item 10d miss Christmas good morning sorry I can't really speak much but um I don't I'm still in the middle of closing out the fiscal year end and because of the early report I wasn't able to get a October report to you I should have something for you in November um we are scheduled to do our audit in December 8th or December 9th and 10th of next month um other items of note for financials as followup from last month change Health Care has gone back and build out all the old um ambulance Billings so we should start seeing that money coming in that we had been delayed so I just want to follow up and give you a and in it news we have a new employee that has started with us I introduced you earlier Mike latinsky from he's formerly from compath has joined as our chief technology officer and is helping the town further and I'm available for any questions any questions for miss Christmas from Council no okay and W welcome Mike uh you know we you know we we pay attention to these things and there's been um since I was first on this Council a huge uptick in everything from ransomware to making sure that your systems are secure and functioning properly and uh we're we're in we're well beyond the digital age so we we uh we trust We Trust an important part of our town to you and we look forward to working with you anything else from anybody else no thank you all right um item 10e Public Safety Department chief good morning um just an update on uh a number of projects that we've got got got working um the uh construction on the facility is going well um the vast majority of the construction right now is taking place upstairs directly above my head um and uh so with uh jackhammers and impact wrenches and all those kind of things going on I've had to relocate once or twice because I just couldn't hear myself think but it is going well the contractor is very responsive very happy with the product that he's producing and uh uh very easy to work with as well as our architect that's helping us manage it um our ladder truck is finally back uh for the hopefully the lart the final large safety repairs that we had to get done we got the vast majority of them done last year uh last budget year this year we were uh we finished up fixing the comp systems between the the plat form where the operator sits in in the the head of the the ladder truck so they can communicate back and forth and taking care of some uh some sensor problems that we were having with the truck so that is back in service and with that when it came back in service we put all the new extrication equipment that the that we purchased at the end of last fiscal year that all that equipment has gone back onto the ladder truck because it's the first out unit um in this year's budget we had uh uh two speed trailers um that actually it has a built-in radar displays the speed for people as are driving by those should be delivered within the next 3 weeks and uh they'll actually be delivered over at the emergency Operation Center they have a loading dock over there um we'll offload them there and then we'll grab a hole of them and bring them back over and hopefully get those in service soon um hats off to uh to to the folks that work in my department uh the traffic enforcement along A1A continues to be going well um the vast majority of the the stops have been for just to issue warnings um because of because of the minor speed change that has occurred by by the state of Florida um but that continues to go well um the uh uh and all in all I think that uh We've we've been able to deal with that not only the speed issue but with the traffic issue at the at the gates of ji where we had the problems in the morning um with the contractors trying to get in we've eliminated that problem now and it's stays clear for the morning um so we're I'm very happy with what the what the team has done been been able to take care of all those problems as they've been popping up I'd be happy to answer any questions that you may have anything for the chief vice mayor with regard to the change in the speed from 45 to 35 miles an hour uh one thing that I've seen on on two of my cars when you have a map up is that it still shows the speed limit as 45 miles an hour and the reality is a lot of people look at that and don't pay attention to this the speed limit sign is there anyone that you can potentially reach out to F I realize it's their Road where maybe they could you know go to Google and Apple Maps and other things to try to get that data point drop from 45 to 35 I think that might help you in terms of enforcement and just keeping people doing the right thing yes sir I think Mark has already reached out markw has already reached out through through do to try to take care of that problem and I'm quite sure that it's going to take a little bit of time to to be able to do that but I know he has done to reach out to them that that's an excellent point and um I was you know going to ask our our new IT person you know if uh you know there was a a magic trick to it because one of my vehicles already has it down at 35 miles hour the other one has it at 45 which servic um the manufacturer the manufacturer has something called PIV Pro which is their own U and that's that's already down to 35 um but Google is still showing it um when I have apple carplay it's still showing it at 45 miles per hour okay so I I know that there's a self-reporting thing but you know if you do we have anybody who's like 16 years old because they'll probably be able to fix this out you know I can I can call my grandson he's uh he's 16 and get him over here yeah terrific uh uh he's not old enough to buy a beer but tell him we'll we'll get him a die of Coke or something whatever you want he'll be fine yeah all right it's a good it's a good point though because people do they're reflexively looking at it and I'm I'm getting a lot of comments like well my car tells me this is the speed limit but you know it's posted and it changes quickly and um I'm sure I'm sure it'll go away but if we you know if we uh if we add this piece to it it probably will be helpful to your guys so they don't have to you know continually pull people over yes sir all right got it great thank you anything else for the chief no thank you again for all you do for us yes sir um Town attorney Mr Sweeny Mr Mayor uh you covered it earlier with the uh amendments proposed amendments so I have nothing else to you bet one thing yes sir sorry I'm slowing the meeting down but uh NOP no problem um have you heard any anything in the state legislature I realized it's it's early they're starting to do some committee reports anything that's a concern in terms of infringement on the town's ability to uh operate you know we know we talk talk about the uh the pr the preemption sorry I had a brain stall there about the the preemptions that we have to deal with every single year with those state legislators who ironically complain about Washington interfering ING with the state but is is there anything that's sort of popped up even at the rumor mill at this point that we should be have on our radar yes sir um at this point the legislative session actually will be a later session this year it actually won't start until March and end until virtually May 1 um so at this point and every member of course of the house at the state level was reelected they all serve to your terms so at this point they're starting to jockey for committee positions appointments such as we just went through and the pre-filing of bills will happen shortly uh all the way through the beginning of the year there's nothing but I would say that we should expect to continue to hear no special session has been called on the condo Surf Side surf Edge uh live litigation and collapse tragedy nothing has happened and that of course has a December 30th timeline I expect there'll be that um there continues to be discussion about insurance regulation I expect we will continue to hear that and as follow on on implementation of some of these things such as the no sleeping in public parks um those things are beginning to be implemented so those are some of the items that I expect will come back up but um representative for all uh senator for all uh now I expect we'll be providing some update as representative of some of the things that they expect to introduce but there's nothing hot button that I've heard yet that's a good question my my understanding is the majorities in both Chambers have been expanded um and the what I've what I've heard through the uh through the inofficial rumor mill is a special session is still very seriously being considered to and remember in Florida you can only address one item in a special session so um if there is a special session it's likely going to be if and whether there should be uh some relief from the uh uh condo legislation The Sur study um the uh further information I've received is that there's no appetite to change the guts of the uh legislation right now um if anything it would be an extension for compliance uh for reserves not for the studies those have to be in at the end of December and an unfunded mandate which is another thing the legislature likes to do has our building official being required to uh accumulate those and be the repository for them we don't have to do anything else with them we just have to collect them and make sure that they are filed so um we'll wait and see on that uh the other thing that's sure to come up is um uh short-term vacation rentals uh that I'm told will definitely come up again um and you know we see it every year and it gets beaten back every year but I'm just you know um waiting one of these years it's going to be eroded to the point enough where you know we are going to see what protection we have now taken away and centralized um but I think the good news is the state figured out last year in the legislative session that in order to implement what they wanted to implement they would have to hire a whole host of state employees which means that they would have to increase the budget not something they had the appetite to do so we'll keep fingers across um as as we get further and further into this peep if you could just yes sir as a standard item just update us on you know what you hear in terms of potential legislation that will affect us absolutely yes sir great thank you very much anything else for the town attorney no uh Town manager report Mr Haring thank you Mr mayor council um just to note again the Doom project is ongoing uh we have determined that we're not going to close uh Beach comr Lane until the work is approximate to that location as a public beach access it's possible that the uh work may not actually be going down uh Beach comr uh in terms of mobilization it be more efficient I think the contractor and our site uh meetings had indicated that that is their goal but that doesn't mean it it's not necessarily uh going to happen um we recently uh had to replenish uh on a Dun context uh we recently had to replenish a little bit of our uh sand at our access uh some of the storms and the wind had chopped away a little bit at that but uh we do have some uh reserves here that we keep for uh those particular uh eventuality so we're able to keep that open um other than that I don't have anything else if there's any other questions I'm happy to address them anything for the town manager no okay thank you um item 13 Council committee reports um we'll start from right to left as we usually do Mr danne you don't have anything to report but you will but you will next month there you go Mr alter nothing to report uh I had Treasure Coast Council of local governments it was the day after election day that was an interesting meeting um the only item I I'll leave the the packet as I usually do for anyone who's interested interested um generally the state of the Treasure Coast area covered by local governments is doing well uh in terms of employment um a lot of discussion was had about the recovery efforts for the for the tornadoes which uh really impacted some areas uh throughout the Treasure Coast much much more um severely than others um there was no Quorum so we couldn't do anything other than meet um but we did you know the practice of this committee is even if there's no Quorum uh we still go through the agenda we just can't vote on items so um it's not a waste of time having everybody go and turn around and drive back um there was a comment um on the updates of relevant news to the Treasure Coast U commissioner Moss Indian River County Commissioner Moss um said that uh the urban service boundary is likely not going to be changed due to quote public overwhelming concern quote over quote overdevelopment quote so there you have it um so the urban service boundaries to the extent anybody was worried about that uh one of the County Commissioners opined that not likely to happen um with that that's it I had no other committees that met and U pass it along to vice mayor okay there was a city of ver Beach utility commission meeting I did not attend personally because I had to go out of town on short not notice for family reasons but I did watch the uh video so there was an update on the John's uh Island pipeline that the uh City uh city of Vera Beach is constructing to uh send uh Reclamation reclaim water irrigation water to John's Island uh separately as opposed to the town system that they also Supply now they're talking in March to April 2025 completion date uh update on the Water Reclamation uh plant a new uh plant uh that's supposed to have a capacity of 5 million gallons uh per day uh they said on a normal day they process 3 and a half million uh gallons uh during the storm the the the hurricane and the associated the outer bands associated with that for four hours they process 9 million gallons now so just shows you how things can surge for a period of time and in terms of the construction process uh drawings are 100% done they are subject to revision they're going to be sent to the construction manager at risk which is the title for the private manager who is uh overseeing the construction of the of the plant uh bids that go out to subcontractors or supposedly out or going to be out on the on the street um U they're they're hoping to get back uh responses and this was somewhat confusing they may not have this completely right right around uh Christmas they're talking about a deadline which seems ridiculous to many people just you know as you approach the end of the month they're not going to work on things so you're pushing back to uh early uh January and then they and then there's going to they're going to look those over and so forth and Rob Bolton and the uh utilities Director City of Viro Beach said that pricing to city council which I ultimately city council will have to approve this will go to them approximately in March 2025 or or possibly uh April now you know this was talked about 2022 2023 uh if they get it by June I would be surprised that just might got uh they supposedly will might have some rough price estimate after the end of the year a little bit more on that uh the problem that the Utilities Commission where the town has one rep representative and realize this is solely an advisory committee it has no power at all and frankly as we talked about before the city counil over there generally ignores it uh to my knowledge they never receive any comments from that Utility Commission informed of a memo or so forth unless it's done uh uh privately so it's unfortunately it's turning more into a storm water committee well we've had trouble getting quarms for meetings the chairman at that meeting I think in response to the letter was put together uh by by Jim by the town manager and signed by the mayor they're going to look at trying to make sure the people actually show up it's very frustrating I go over there you wait and then then not nothing happen so that's going to work okay so the city is going to have to do a bond financing to pay for that plan and uh you know unlike you or I when we buy a house and we put 10% down or 20% down what the city of ver beach has done over the years is they've drawn cash out of that utilities fund to supplement their general fund and to uh keep their property taxes down so they're going to build this plant it's going to be completely debt Finance zero Equity even though there's been money uh that they could have put aside just egregious what's going on so they had a meeting of an Investment Services uh committee which was supposedly a public meeting which I never saw any notice on their website and I asked the Town Clerk and she couldn't find anything as well but there were three members of that uh committee and they were trying to decide who was going to be the bond underwriter on the on the deal and they had three factors that they uh were going going to uh look at the the ability of the bond dealer underwriter to distribute the bonds when uh when they're issue how they were going to structure the deal and how what kind of of essentially commission that's not the term it's used in the bond market I worked in the bond market for 33 years but it's effectively it's a a commission they only gave 5% weight to that commission which I which I complained about so they picked a uh an underwriter using this flawed process but lucky for I think the ray payers they picked the firm that I would have chosen which was Raymond James Raymond James had almost the lowest commission for the the bonds and in addition uh Rayman James has a big they're a very large well-known Municipal firm but they have a big distribution that Network in the in the state of of Florida a lot of smaller uh clients what we' called in the bond market mom and pop uh investors as opposed to institutional invest like mutual funds that that I ran the advantage of that is usually you can get a lower interest rate by selling it to sorry to say less sophisticated investors which would help the the rars so the process was flawed but they came to the to the right conclusion now they should have brought this in front of Utilities Commission because Utilities Commission is supposed to look at budgets and rates and clearly this is going to impact rates over the next 25 or or or 30 years but they they blew us off like they do they had a finance commission uh uh meeting that I watched a video on uh this morning and it was a very brief meeting where they talked about picking the uh un underwriter and so forth but an interesting thing came out that there's not there's not a final price as I mentioned but the finance director for the city of ver Beach uh Steve Deon is I believe how you pronounce his name but I can be wrong and I'll I'll give you a direct quote from him that I wrote down he said we are anticipating a160 million in bond financing now initially when there was a discussion about about this plan years ago we were talking 56 million roughly or so then it went up to 82 million then then then it went higher and then the mayor katno from virau Beach let's slip out 130 million so I don't know where the final number is going to be but that's pretty troubling it's going to go an additional up an additional 30 million and I can tell you that the cost to build this plant and in my opinion I'm not an engineer and I don't play one on TV but I want I had a uh a trip down to uh Fort Pierce facilitated by our town attorney where I took a tour to plant that their uh building and the City of ver Beach excuse me sorry the city of for Pierce utilities directors came out and walked Walked with me and the construction manager we spent an hour walking through the plant as it being built I asked them a lot of questions about you know cost ability to get skill labor and so forth and they didn't indicate any obstacles this is very troubling and we're all going to pay for this for years and years to come so we'll have to see what the actual number would be but this is an example of the total lack of transparency that comes out of the uh city of ver beach at the highest lever levels of the mayor the city manager and the uh City Utilities director you get a pride of stuff loose you I had Jenice Routan our town clerk hit them with multiple record public record requests to try to figure out what was going on and uh it was so so we'll have to see where this goes but was was rather troubling uh these two meetings and at the end of the day Utilities Commission is not going to have a chance to give any opinions on it so that that's uh that's my report thank you um that $160 million figure does does that include or exclude what they hope be to be $30 million of I I I have no idea to be to be perfectly honest with you I've I've asked the question before and I can't get answer okay so it could be if it's not included it could be $190 million that they're anticipating the build cost is and um you know and this still doesn't include you know remediation of the site it just it just includes I asked that question uh probably a year or two ago and uh I was assured by the U director that there's no re remediation of the three corners uh site will be necessary okay well there you go um I I I would just offer one thing I was discussing this with the town manager the town attorney earlier and um in preparation for a prior meeting with the city of Vero Beach that council at the time attended um I I didn't have to use it but I I do have a timeline of cost it actually starts at 40 million um 40 million then went to 51 then 58 and then um so you know there's a there's a steep progression of this and in fact some of the candidates for city council even put it on their website you know in terms of we got to get this going because look at the costs and how the delays increase it so but thank you um i' I'd like to say um maybe we can expect better things but um I'm reluctant to even take that leave the faith but we'll watch it vigilantly so thank you very much is there anything else no okay um we're up to the call to the audience is there anything members of
