to approve the agenda and out of the land use and legislation meeting this uh this afternoon we have one item that will be uh moved to tonight's meeting um with the um okay of the council so the addition would be number nine Northfield Oil Incorporated for a new license at 100 Memorial Drive it'll be a cigarette license a restaurant license gasoline pump license and an off sale license is that correct yes but you have two additions oh what was the other one snow PL license oh I'm sorry I missed that one and we also have a snow plow license for Zachary Schmidt uh for 607 4th Avenue and that's a snowplow license so items number nine and 10 with the council's permission chair would entertain a motion to add those and approve the agenda so move we have a motion by councelor Buller opportunity later in the meeting go to opening bids and quotes uh we'll start with uh the property at 8017 Street um City administrator you want to give us a little update on that situation well I can try mayor council um we did originally have quotes for this property to um be taken down um it's been placarded um city of attorney gave him an update last um Council and then in the meantime um just this past weekend there was a fire at the property so that changes the aspect of um the the demolition um uh bids that we received so the fire marshal fire chief the City attorney and uh County members spoke this morning they have reached out to the individuals who had bid and asked if they would like to Reid according to what is what the structure is now and they have and so those are the bids that I will be opening for you is the rebid after this weekend's um happenings okay why don't we open those up and then uh from there hopefully the City attorney come because I have some questions I'd like to ask her and I think a lot of the council members might have questions as well so if you want to open those up yep I sure can so I will be opening them in in order in which they were received today so the first one is from Travis Thompson and the bid amount excuse me for 8017 Street house and garage is $ 7,849 the second one one is from Steve boyam construction that bid for 8017 house and garage is $12,100 and the third bid is from J&J Contracting and that is for 8017 house and garage and that is $9,500 okay so the the L bid is $7,850 and if uh if I remember correctly the county has uh given the okay to um wave The Tipping fees is that correct that is my understanding but I would defer to the fire marshal or the fire chief for additional clarification on that okay um and and so this is this is the the hangup that I have and we had a long lengthy conversation about this at the land use and legislation um I just and I'm kind of almost wanting to push this later to see if the City attorney comes on because the question I have is there's something different now than when we originally bid this um there is uh potential that the the property it's tax forfeited it it's state owned property at this point it's being managed by the county um there is conversation about potential insurance that uh for the neighbor who had damage to their house in the fire we're just questioning it my question is is there a different process that we need to follow now that it is a burned down house historically if there was a a a fire the city has in our property maintenance code that we provide the homeowner which the homeowner is the state of Minnesota at this point um that there's been a fire it needs to be vacated and it goes on them to remove that whether it's through insurance through whatever means what I don't want to do is put this through to the tax to put the tax roles because we all know that the likelihood of it being picked up when when the property sells is is non-existent so I would like to see a process that we can have with just keep checking to see if she gets on what the correct process is we don't want to have a burnt out building sitting on a corner in our community I want to make sure that it goes away but I also want to make sure that we're being fiscally responsible with with how we move forward um does anyone else have any thoughts on that and like I said I'm more than willing to push this later to the agenda as well well I think we need to uh mayor I think we need to listen to the City attorney on it I really do because it's a whole different ball game I'd like to see move to commit the whole that we can discuss it thoroughly okay not make any hasty decisions and see what what options we have because it seems like we've got quite a few more options right now than we had before okay um and now the one of the things that did come up earlier today uh and could you just come up and and really quick and I'm not trying to put you on the spot but um there is a uh something is happening at that property tomorrow someone's coming up to look at it and I think that that's when we want to try to get it done sooner than later but please uh explain what you explained earlier at the meeting um so we've been in contact with the county um since the night of the fire the morning of the fire um and uh they've reached out to the mcit which is the municipal County Insurance trust from my understanding um and they have someone coming up tomorrow to take a look at the the fire um and the neighboring property um if youve drove by there today um the county insurance company did give them the okay to knock the structure down into a pile because they're worried about collapse so the insurance company um Ed that so the county had a contractor there today to um push the walls in so they didn't worry Bo collapse so he's uh the investigator is going to be here tomorrow from our understanding the big thing is we're under the gun with is weather Y and the basement's got over 6 feet of water in it right now so if we don't do something within the next couple days you're going to have an ice cube there and it's most likely going to have to stay until Springtime so um this has been a know un problem property in our community for years and uh I know there's a lot of moving parts to it but uh um we've tied up a lot of resources in this property on multiple occasions and we had the county sheriff there today in our city police department um while they were there just pushing the walls in there was an altercation um verbally um they're hanging out in the garage the house is gone so now they're in the garage so which the garage has Al also had a fire correct so um I I understand that we have to do what's best but the longer it lingers more resources we're going to tie up and more involvement we're going to have from City staff what really bothers me Jared is a possib possibility of a city employee getting either killed or hurt in the process that's what really bothers me the most it it worries me I mean I had to go placard that house last week and there was an altercation then um with the homeowner um not the homeowner they don't own the home well the previous homeowner yes um and you know the cops are there I mean there's we have quite a few of these properties in our community right now that you don't go to unless you bring law enforcement and if we at this point we have the ability to clean this up and move on from it and if we don't we could be dealing with it for another 6 months at minimum till it's warm enough to do something with understood mayor the City attorney has a okay perfect uh Chelsea I know you're we're we're just jumping right into this but we are having a discussion right now on uh 801 7th Street and after the fire and we're we're just looking for some uh legal advice or some recommendation on how we should move forward so I got the email this morning um and I heard about the fire over the weekend um so my understanding is the people that did um submit quotes um were contacted before tonight's meeting so they could alter their quotes after the fire um and I know we've Jared specifically has already been in communication with the county as well they're still willing to wave The Tipping fees even though their fees will go up um because it's not demo property anymore it just has to go to the general landfill and everything um so as long as we contacted the people that had put in quotes um and we didn't receive you know any new quotes um that didn't have the opportunity to go relook at the property that sort of thing um the city can still take the low bid or whatever one they pick really um or low quote and move forward with tearing it down it was placard um to give them the opportunity to remove everything by the 6th which is this Friday um the house would obviously not be a concern anymore the garage I don't know I guess I would defer to Jared um on how much is in there um if they need time to remove that but from you know from a legal standpoint we can go forward with tearing down the the concern that I have um and I I I just I need to understand better from your perspective the the um our building maintenance code gives us uh 30 days to um and this is a a different situation because it's a fire we already have the the teone is this a property that the we could contact the state of Minnesota since they're the homeowner on the property because it's tax forfeited and have their them or their insurance pick up the cost for the removal of of the building given the set of circumstances that we're in sure so originally when it was brought before Council um there was that question there's that case out there Tyler V hennipin which kind of prohibits counties um as actors for the state on forfeit property from themselves tearing property down um in the fear that they could be sued um they could have to pay fair market value of the property this property has changed slightly since that last discussion considering it burned down um I'm not aware that the county you know I know they have some form of insurance on it um I don't I don't know the parameters of that if they are able to cover it or not cover it um so I can't answer that question now but I do know um you know certainly our cost would go down from it being destroyed with a fire it's not going to cost the city as much to tear down um mainly because it's torn down the other concern being Insurance may come in and um you know remove the house but we'd have the continuing issue of the garage um where we've started the process on both structures um it's possible that the insurance would say nope we clean up the house but not the garage and then we still have to tear down the garage so I don't have a clear answer um right now but I do know you know our fees would go have gone down and the counties have only gone up um with their tipping fees and I just would hate to have to readdress this again I I understand it's been a long time please Kaylor I would move to go ahead with the bids and take down the structures for the multiple reasons that were talked about here cuz we were going to do it anyhow it just so happened that a fire happened in between the time and like Jared said we've been dealing I don't want to get too deep but yes with the building for a long time and okay I'm going to accept your motion to move forward with the low bid for Travis Thompson do we have a second second we have a second by councelor Holden discussion please Contin and that just I'm sorry I kept going but uh just for those reasons the public health safety Factor the a year it is and you know it's just not regular wood now we got to get rid of it and we were already going to do it so I said we go ahead I think that's in the best interest of everybody for the cost okay any please I I have a little issue with that only because of the possibility of getting reimbursed and not putting the burden on the taxpayers um if there's possibility to get reimbursed for it it' be nice that if the Mi mcit is coming tomorrow one more week isn't going to make any difference and we can didn't have clearance to tear it down until Friday this week anyway well and and maybe that's a possibility that that yeah I don't need it tear down today but the sooner the better but we can wait till all that stff the sooner the better but I still think that if there's a possibility be reimbursed we need to re we need to research that well and and if if we were to accept the the low bid we have a motion and second on on the floor right now if we were to accept the low bid is this something that we could still submit to the insurance company to to move on and if it if it gets declined it gets declined but we're in the same boat regardless yeah would that be something that we could do I don't know City administrator City attorney um I am not sure I mean certainly with them coming up tomorrow um I think we could get an answer pretty quickly if it's something that maybe they would reimburse I don't okay I don't know okay and I know uh councelor Wagner is online councelor Wagner do you have any thoughts or concerns on this I'm leaning towards he doesn't all right um so I guess I guess then if we move forward with this uh we will tear it down but I think the the concern with the um with the council is just making sure that we we do our due diligence to try to get it to insurance or have the conversation tomorrow on how we what we can do with this bill if this is something that the city has to eat for Public Safety or if this is something that we can uh turn in just we want to make sure that we're doing our due diligence on this so as soon as we get that answer well if it'll be Friday would be the earliest we can tear it down regardless we get that son of a again tear it down tore down yeah I mean we could I mean we could tear it down as possibly as early as Wednesday okay as long as they give us the okay you know or give you guys the okay tomorrow like I said we just want to get it done before it turns into a ice cube you know and that with them in the garage now it's just there's going to be a lot more issues than just the building being there and us being out some money that's what I believe I got I got five calls today from the neighbors five different neighbors all concerned and what the process was going to be now because they're very concerned yeah and uh I told him I was going to do what I can to help push this through because like I said we've every resource in the city every department has had involvement in this property over the last couple years and it uh my feelings it's time just to put it to bed City administrator just a question on the placard gave them till Friday to clear their contents so we would be doing anything before that date is that correct well there's there's no contents left in the house but the garage has contents yeah we our intentions would be to get the house cleaned up as soon as possible if that could be before Friday um and then as of Friday we would tear the house or the garage down Friday thank you I think that's where my Friday push was but yeah um I just I just want to make sure that we're doing the due diligence and and this is a different process than we've ever had to deal with usually if there's a fire there's a property owner and we can go through a property owner this is just a unique situation yeah and you know Nathan hiel has been great to work with at the county he's willing to help us any way he can myself um the building official and the City attorney met with um Nathan and the County Attorney a few weeks ago regarding this property before it was brought to you initially and they explained to us where they were at with the process where the Tyler vers hopin and how it's hamstrung them on how they proceed with these properties so um that's where it's at okay Mr Mayor please yes I agree with it the same thing and also with uh pursuing uh reimbursement if we can I've also received at least three calls about the same property and when what we're going to do with it and when we're going to get rid of it perfect all right Julie yes I just have a question are you sure he has insurance we we we don't know because it's a county owned prop or a state-owned property oh okay so yeah that's my concern if you had Insurance yeah no this is a a tax forfeited property that's where that's where all of this uh six which is Adopt a resolution for a municipal state aid funds advance for project 1346 106 002 and project number 13410 18-1 it's Second Avenue East and the e8th street projects Ted broa sorry do I have to stand I would love that or you can battle the microphone it's up to it's up to you thank you mayor and Council so as far as the Second Avenue in 7th Street we had talked about encumbering 5 years um we're not going to have to encumber as much as 5 years so as part of that with the next resolution you'll see that if we do Ninth Street I kind of slid that one in so that if we do Ninth Street we're able to encumber an extra 309,000 um so that will Square us up with Second Avenue and 7th Street um which we're in the process of closing out um if we do 9th Street we'll be able to use some Municipal state aid money for that as well um in the event we don't we're not we just don't submit for re repayment but my recommendation is when we when we originally talked about Second Avenue in sth street is that we do not encumber longer than 5 years which we will not and then we do not encumber any more MSA money until 2029 when mot does 1171 from basically Menard's 26 Avenue because we're going to have a sizable cost shared there um so that's the reasoning behind the two resolutions for encumberment all right and when when was the last time that we encumbered it was was it for the 53 project no we encumbered a little bit for Street Lighting on Highway 53 and we encumbered a little bit on Second Avenue and 7th Street at the beginning but we're in the proc process of closing that out now so that's what the additional encumberment is for okay perfect please these two projects run together no Second Avenue and sth Street there are two there are two different MSA segments so that's why it's listed as two separate numbers but it was the same MSA project but for mind do you know they two yeah understand all right so the first one that we have is for the two projects uh ending in in 10 16-002 and the second project ending in 108-01 chair would entertain a motion to approve so move we have a motion by councelor Buller do we have a second second second by councelor talking about here um at the committee of the whole um we're looking at doing a public meeting with the residents of Ninth Street in January um and what I'm doing is doing the paperwork for the encumberment now if we don't do 9th Street then um it's a mute point um part of 9th Street is is the plan where we paid cash basically for 15th street from 3rd Avenue East going east to 3 32 um we did not use any MSA dollars for that project because we had went back and closed out all of our previous MSA projects and ended up with a balance so we're not we don't owe so if if you redo and you do an MSA project if you try and lift that mileage within 20 years you have to pay a penalty okay by us paying cash for 15th Street we're going to pull that mileage that Municipal state aid mileage off of 15th Street and apply it to 9th Street because it would meet the criteria so we can get help with the funding and the reason we want to do that is because Ninth Street is going to be one of the most expensive streets that we've done in a long time as we were kind of talking about earlier it would be the most expensive project we've ever done hands down and why is that uh because everything needs to be replaced um it's a Concrete Street with a binous overlay so it's very expensive to remove the water shot the sewer shot the storm sewer shot the street lighting shot um plus the intention is is to make it a two-way street widen it out widen it out and yes and that's why we want to have the conversation with uh with residents correct yes yep so so Ted have fers gone out to the residents already no we're in the process of doing that and that's why we want to have we're we just had a meeting on it last week and we're going to set a public meeting in January for those residents because I was just just kind of interested in how much you know how much input we've had back from them if the Flyers have been out already but no not yet but that's it's on the calendar I don't know the carries next uh Ted broa upgrade the current charging system and installation of a DC fast charging equipment uh by Minnesota Power I want to go back to February of 2022 I believe we sent a letter of support to the mpca on on an RFP um in support of getting a fast charger in International Falls part of their goal was was to put enough fast chargers for electric cars where they could drive from rodchester and make a loop all the way up through International Falls back down through buiji and back to Rochester um we sent a letter of support it was approved in March of 2023 I got contacted by Minnesota Power that they received that RFP and they wanted to put upgrade our level two Chargers which they gave us in 202 20 which are like a three-hour charger don't quote me on them I'm not a big expert on electric Chargers but it's been a long drawn out process um but what they would like to do is put a fast charger there with two slots right now we have two parking spots that are taken up by the level two Chargers they'd like to do two additional Chargers um or two two additional spots one fast charger um and then replace the level two Chargers that are there and they're looking for an easement and an agreement with the city and they will be responsible for 100% of it all all the financial all the financial all the maintenance all the headaches that we've been dealing with on level two chargers right um one other thing that I would like to do is get permission to give them back their two level two Chargers that we have there we have no business being in the electrical car charger business so we received two by donation from Minnesota power but they were going to up up keep them up and keep them running and keep everything good and um yeah we we we've had some issues so we want to give them back we want them to be able to utilize our space and it's at their cost they deal with the billing they deal with the charging they deal with the everything and I I think it sounds like a great idea i' I've shared the agreement with the easement and the contract with Minnesota Power with Chelsea and she sees no issue with it okay so at this time the chair would entertain the um Christmas tree lighting ceremony and I'll tell you all seven or eight people that were braving the cold just to see those lights turned on they were excited so it was a a wonderful event uh the llamas the the parade one of the best parades we've had in years I El pacas elpac what did I say llamas yeah it wasn't it was elpac I don't want you to you know the it out that you're offending the you know Ela is not giving them their do all right so uh wonderful event and uh the next uh big event that we have coming up is is uh chamber chamber commas and ice box days so uh we have another big one coming I want to say thank you to the fire department and for the fireworks this last weekend um just all around great event go to audience is there anyone in the audience that has anything to
