name is yet but uh he's going to lead us in the pledge thank you sir don't know his name IED Al to United States of America the nation God indivisible with andice for all all right and I've asked uh Pastor Tony Hammond if he would uh please lead us in prayer tonight thank you Tony well it's an honor to be here and to be here with Julian and uh the crew so let's bow together and just thank the Lord for this father thank you so much for tonight thank you for the council we pray your blessing over this evening we thank you for Deputy Garcia we pray that he'll be honored and recognized tonight and we just thank you so much for this community and all that it does in your precious name amen amen all right well I'm going to turn this uh over to to vice mayor Sharon Mahoney but I just want to say her the sheriff everybody that participated all the volunteers everybody that participated in this for Julian was it's spectacular this was a really a huge multi Community you know it was it was just a a great thing so Sharon thank you mayor you're welcome um well we'll get into the thank yous and everything I think what I'd first like to do is hand the microphone to our Sheriff Rick Ramsey if you want to come up and get it and I'm going to let Rick do a few things and then we'll proceed thank you vice mayor [Applause] family friends thank you for being here this is a special time we're going to talk about an amazing young man who I talk to every week and is just a the model police officer representative for the city of alam marada to me a true hero he's very humble when I talk about his accomplishments and being a hero he just says I'm just doing my job which is what you expect from someone like Julian who throughout a very difficult challenging time has been the most upbeat positive person always focused on others how's everybody else how's the team how's the gang how's the office putting himself a second worried always about MCSO and the citizens he's out there protecting each and every day we make no bones about this is one of the most difficult challenging jobs ever just by what we see here to today Julian's out one night April 9th patrolling the streets keeping Alam safe and secure trying to arrest an individual on the side of the road on outstanding warrant by walking the person back to his patrol car was going to walk between the patrol car and the suspect's car in front of them when most of us know by now what happened a drunk driver a female 26 years of age four times the legal limits never slowed down to the emergency lights never moved over as required by law never hit the brakes last second left her lane of travel was getting ready to strike Julian's car while he's escorting The Prisoner to his car as he saw the car coming in last second what a hero would do pushed the rusty out of the way to try to protect him from the impounding car his efforts were successful the individual did not get injured that he was in care custy control of unfortunately he got trapped between his car and the car in front of him based on the drunk driver our officers were unseen almost right away trying to get the cars separated to get Julian out between the car where he was pinned we talk about Partnerships how important they are our friends in fire rescue were there like right away our friends in FHP fellow Squad members team members we saw the severity of injuries we immediately put the Sheriff's Office trauma star on standby we launched it pretty quickly landed right here at the park picked up Julian flew him up to Miami to a Trauma Center to deal with his injuries obviously entire agency at that point in time is just devastated every everybody's worried about Julian and there's not much information going on well Julian was in a difficult time and over a period of time went through at least 10 surgeries imagine that 10 surgeries as they worked so hard to try to save him save his leg do the best they could for him uh blood transfusions it was a challenging difficult time for anybody I made a Time point to come up and see drooling up there it was difficult same time I was visiting him I was visiting another officer who had been injured just a short time thereafter and had to also be flown up on trauma Star as he was uh riding a motorcycle police motorcycle car pulled out in front of him the Collision caused the gas tank to explode catching the other officer on fire so it was so hard to come to a trauma center to see two of my amazing men both uh in there for variety of injuries but it just goes to show you how difficult challenging this job is every day to protect and serve our citizens we do a very difficult challenging job for a minimum wage crazy hours nights holiday weekends away from our family and friends dealing with difficult challenging people people who spitting on you cussing you threaten you it's a difficult job but it's so rewarding though when we get a chance to see our citizens help you make your lives better focus on quality of life put bad people in jail make our streets safe Community for everybody spre of core team work working with our fellow team members this is one of the best jobs ever but one of these difficult jobs that I think sometimes is underappreciated but the whole time we've been four months now this young man has never lost Spirit never lost the drill Drive the will the desire remain positive just such an inspiration for others to go by Sheriff's Office we uh give out various ribbons for service and different related stuff we have a ribbon called The Purple Heart which is just like military vets would know same Theory a ribbon that was given out to somebody who sustained a serious substantial injury in the line of duty this isn't you got a couple stitches or you stubb your toe when we give these out SE them for a few you've been seriously injured and there's only a few people in this agency who have that ribbon I think there's four people that I'm aware that have that ribbon thank God but I had to give out one just last month to the officer who got burned in the crash tonight we're going to give one out to my friend Julian for his serious injuries in the line of duty we have a citation that we drew up for Julian I'm not going to read it because it pretty much goes through a lot of the stuff we talked about about his heroic acts to try to risk his life to save that of a defendant put his life and safety out there each and every night to protect you our citizens and Friends you're like family to us I always talk about the Sheriff's Office relationship when it comes to community policing communication cooperation partnership teamwork how important it is that we be out there with you each and every day that you see us as your friends and we see you as our friends and that's our mission and goal I think we're very successful but Julian is an inspiration to others he's a model employee for MCSO and a representative for the city of alamada and our Police Services back to our citizens it's so amazing to see this group of people here co-workers citizens clapping supporting Julian I know we've had so many people calling email texting almost every day checking asking wondering about him and uh you see this young man here today proud to be here proud to wear this uniform so today I'm going to present with you the Purple Heart ribbon this is off my uniform I have 30 years ago when I was seriously injured on line of duty myself and I'm going to pass this ribbon from me to you hope it has some uh memories coming from me to you as my friend but also this is welld deserved for you to wear on your ribbon on your uniform here's your Ribbon sir [Applause] you have a few words sir I'll try my I'll try my best to look at everyone but um just looking up um would make me want to cry first I wouldn't be here without obviously God being there for me having too many people who were there on scene to to help me possibly save my life as well um Deputy Richard Rodriguez and Deputy Landon Garner no question they started as soon as they saw the accident with Landon move in the car and then Richard pling the tourniquet that I joke that I rather the leg didn't hurt at all obviously but that touret was the worst pain I've ever felt who's whoever had has had one you'll probably know cuz it was terrible but like as the sheriff said without the community without my family everyone constant support the month and a half that I was in the hospital um it it was tough but with all the support seeing that I seen and they would keep telling me it definitely help me to stay positive um as you can see I'm still standing it's not easy but I'm here trying um my goal is obviously to come back and continue to serve this is I wouldn't regret it it's what the career I chose and it's just what I went to school for and all of that even while work coming to the academy so it's I can't thank everyone enough from the whole is Mara Community to as um Mr bu said volunteers and everyone that I I haven't thanked obviously I just want to thank them um my family of course and my girlfriend who were there every day when I was in the hospital every night to to sleep with me every night no matter what time I needed help just friends as well texting me and I was just um staying there with me but just thank you everyone for being here I really appreciate it you know remember talking to Julian after the accident and he pulled me aside and he said to me you know Sheriff you always talk about Community pleasing you remember this he said you always say that we have to be there for Citizens and we're working with them and we build these relationships and the time ever comes we need them that they'll be there for us I said yes that's true he said well this experience has proven enough to me that when I needed the agency the citizens the community to give me strength they were here right and they were and they always are and that's so important to this agency again these relationships we work hard every day to make you safe and secure to be there in your time of need and every now and then we do need our community and every time this community is there for this agency his members to show that we love you and you love us this place is special a relationship that has with our community and the police agency other areas could dream about the relationship we have with our citizens and how important it is that we work together so again I want to personally thank you I know Julian this did my team members again we do this for you with pride integrity and this is the inspiration for all of us to look up to vice mayor very rarely do I have a loss of words I'm over here crying so I apologize um before we start with everybody who helped me so greatly I want you to know Julian I didn't know you but it was my honor to do this I love doing events I do quite a few in the keys and when Terry AEL and I spoke wasn't a second thought in my mind but to help and I'm so glad I did so before we let's have some happy news I'd like to give this to your Sheriff to hand to you inside there are some thank you notes and it's a list of everybody who donated and a check for $ [Music] 6,519 thank you again this was a labor love and I love this community I'm born and raised here I'm a conch I'm from here and through this event I made a lot of good new friends too I didn't know Sheriff Ramsey that well Charlene uh just people that really been over backwards for you it was the easiest event I think I've ever run people were throwing things at me for you everybody was what can I do what can I do so I would like to call up some people to get some pictures with you and the sheriff and just to tell tell everybody in this community how important us being the way we are is what continues in this place and we love you we can't wait to see you back on duty and uh so Terry Abel Judy Hall without these two Judy took care of the car show Terry was up early in the morning barbecuing so come on up here skipping Lisa brine uh skip Lisa skipped did all the radio shows for me and Lisa sold out of t-shirts in record time an hour um my family who always helps me my casting for cats family carol Albury Alden Albury and Victor who represents the Masons who do all my computer stuff because I'm second grade [Applause] level Dennis Ward the best thing I got from you I got to meet Parker so come on up Parker she did a great job Mary Beth Harris Tai's wife who took care of everything in the parking lot where i' never even had to come out so thank you the food trucks that came alamada the Italian food company I know we have a family member here tonight they had pizza out in all that heat lovely nextdoor neighbor who represents the joy Club they were a great help Tony Hammond you are always there for everybody in this community we love you and we are a community because of people like you uh anybody I forgot who came was there Charlene come on up here oh well oh that's right Leslie and Tom Gallagher who left stuff on my doorstep repeatedly Cheryl Culbertson who worked at oh that you know what I was going to ask Carol where's my jail people where are they they were great they come on up everybody come up you guys were you guys worked all day long and you were funny and entertaining so if I forgot anybody I greatly Darren and Alex okay Derek and Alex I apologize I am I am trying so hard I'm writing this down uh Robbie's Michael rorth gave me alcohol not for me personally but I might need some Michael tricks I might need it theater the sea brought birds I mean it was truly a community effort and if anybody else I left out just come on up because without this community this town would be nothing and we I love each and every one of you you all wonderful and Julian it was my honor thank you [Applause] do you want to say anything else Julian oh here here pass I know there was a lot of vendors and there I didn't know it was this many people really but no I truly appreciate you guys I know my family is beyond grateful for everyone who part participated and volunteered obviously on a Sunday I appreciate you guys praying it never happens again but I'll obviously be there to help if it does which I hope it never happen so thank you guys for everything I want to say I want to say one last thing I was probably the last one to leave The Islander with Carol who helps me all the time and we left at 7:30 I walk outside the door of The Islander and there is Julian and his his he were in the wheelchair facing the ocean holding his girlfriend's hand and I thought I wish I had a camera for this and I said you're still here and he says I don't ever want to leave he said I had the best day and that meant the world to me so thank you thank you everybody if you want to get a picture with Julian I'm sure he'd be thrilled we're going to take a little break I think you have a couple things that you would like to say before we go to public comment yeah just uh before we get to um requests for deletions and additions I wanted to uh remind everybody that you have to submit a speaker card um and get it into the clerk before the item is called um uh in order to be able to speak on that item I also wanted to uh advise everyone uh and make sure that they're aware tabs 1 through four are Council discussion items those do not have public comment attached to them so if you would like to speak on any of those items it should be done during general public comment so please make sure to get in your comment cards to to the clerk who is up here and it must be in before the item is called to speak okay Council anybody have anything where we get rolling is this I wanted to pull an item from the consent agenda do you want me to do that now or down at the at the deletions request for deletions yeah yeah no no he was just before public comment okay Council anybody else have anything okay all right so we will move on then uh with that being said to uh public comment this is general public comment Marne do we have anybody Mr Cole do you did you want to say something I do okay Henry go ahead why Mr Cole okay it's been discussed that the only public comment it'll be allowed to talk about the Eagles you will also be allowed to talk about the Eagles at the tab uh Mr Quick just said they have to talk about it at public comment no and you can Al about either way you get two bites over the Apple that's what explained to me so I'm relaying the message no the items under citizen advisory committee reports reports presentations announcements mayor council communication Village attorney manager Communications are discussion items that don't have public comment so that was why I wanted to make sure everybody was aware of that as a reminder so that if they want to speak on any of those items they need to do it during the general public comment there's not specific public comment for tabs one through four I understand that that's a normal rule but I was in the manager I had some you go ahead go ahead Mr Cole uh no I think uh councilman Rosenthal what was discussed was that the tabs didn't have any meaning in the context of when the people need to comment it was during regular public comment and only the mayor could decide to vary whether or not he would accept public comment at another time okay I I'll go corrected you said to me you have two bites of the Apple that's that's all I had to remember so I'll conceed and and we'll move on Mr let me let me tell you what happened today in the meeting today uh I brought it up that if we don't let people speak that we go all the way down to uh to uh delions and and uh or additions that in in general public comment goes and then they can't speak on the on the mayor uh Council communication or the manager communication and attorney communication then but if we let if we let them speak at public comment general public comment then they can speak but we did that I brought that up to Mr Cole and to Mr Quick today that we they we that we say this so that they have an opportunity to speak at public comment okay so are they speaking in public comment and the tab as well no no no no only in general public comment because those tabs Mr Quick reminded me and Mr Cole reminded me today that those tabs do not there's no public comment those are discussion items well I strongly disagree with you okay all right Mr Mayor given the the the outpouring of public interest on that one item for the Eagles would it be permissible for us to wave it on that one item only to respect Henry's concerns I have the same concerns okay uh you know Mark if we keep changing when Brian was here we passed that thing that you have to fill out a card you have to speak before and Mr Cole brought this up to me today and I said let's figure this out right now that we let's follow our guidelines what we're supposed to do and if we keep changing it for one thing or another then we're changing it I I think the guidelines provide for a waiver don't they sure yes I mean they do um the guidelines are no public comment on those um if the uh um under the Parliamentary rules uh the mayor can um Can wave that um or a majority of council can wave that but the the Baseline your rules are there's no public comment for discussion items okay so Mr Quick or Mr Cole should we just take a consensus here real quick of of what the let's it's got to be the whole Council I'm not going to do it unless there's a consensus with Council that greater consensus all right wants to do it so let me start with talk okay so about what they're saying about waving this for the the eagle thing that they get to on on the discussion items for mayor council Communications and the attorney uh manager Communications that uh they'll be allowed to speak they can speak at general public comment but we we I want to vote on this we all have to take a part in this I I want a consensus if you're Henry wants to let him speak two times Mr Greg wants to let him speak two times now so I want to consensus I don't care I just I just would like to respect the three minutes and and you know move okay but okay so I'm fine with it totally my my suggestion would be if you're going to allow for public comment on an uh on an item on a tab that doesn't normally have it that that comment take place during it so not that you get not that there's two times not cuz like with everything else if somebody wanted to speak on Tab I'll just pick a number 18 okay they wouldn't get to speak on Tab 18 at general public comment and then again get to do it on tab so it should be one whether it's a general public comment or we're talking about the Eagles Nest item or at tab three so that would be my suggestion okay so do are we going to have consensus to let him talk on the tab and not at general public comment that would be great I'll that's what we're going to do we the eagle this time okay so just to so the public stands if you want to speak on anything related to the Eagles Nest which is tab three uh you're wait until tab three is called I would get in comment cards um submit them to Marney to the clerk now so that your comment cards are in um because that will be the time for you to speak on it on that item not during general public comment they don't have a a request to speak card in with Marne before the tab they cannot speak you can't raise your hand and speak because we just keep getting this on Communications first time in my 25 years thank you now this is simple taxation defined by the French is the art of extracting the maximum amount of down from the goose the minimum amount of hiss and the hiss is going to start okay everyone has a boss even Henry Ford had a boss was the Ford family and the board of directors as well as the T the stockholders we're in a period of determining the taxation of the citizens of Isam marada let's look at the sources of revenue in the village let me remind you that there are 48 units across the road here that are taxed as modular homes or mobile homes I have no idea see if you can hook up a Ford F650 to one of those guys and to it out of there if you can't it ain't a mobile home all right they're on Wheels when they came but they're permanently attached to the Terra Firma Sun Communities is an annual revenue of $3 billion if you didn't know that you ought to respect it that's almost 20 they have almost 200 communities like that across the country and the USA and their headquartered in Southfield Michigan where I used to live Sun Communities has an annual revenue of $3 billion the village of islands has a v revenue of 51 million wow jump change Sun Communities is over 60 times larger than we are why isn't Sun Community just across us one not paying their fair share I pay my fair share why aren't they sounds like their attorneys were shter than ours great please Mr Cole fix this an equity in taxation finally please use the five y's in the analysis of your upcoming budget and Sir if you don't know what the five y's are they're run by that's how Toyota runs their company if you can't answer five wise in your bu budget request you haven't done a good job of preparing so I ask you to look at the five yse if you don't know what it is I'll bring you a book on five wise of Taxation from Toyota okay so with be with Toyota and others doing all these things the managing budget I'm asking you to quit extracting all the down from the goose do what's necessary and let's review The Art of Taxation and look at the five y's and all the taxation we're doing thank you much thank you Marne who's next banking head good evening Council I'm van Caden H head um first off I'd like to thank the rotary for this beautiful first place blue ribbon for the Patriotic people's parade on the 4th of July and that was the first time I ever won anything you know it's first place blue Ribbit I love it thank you rotary and uh I'd also like to uh point out that I'm going to read to you from the the action minutes of the Alam Mara Village meeting of January 12th 2006 a presentation for the Village Council for Hurricane Katrina relief Mr Bill Kelly steering committee member for the hurricane relief for Katrina thanked all sponsors and especially John sudor director of Parks and Recreation for all his efforts he advised the gross amount collected was approximately $95,000 he also advised the sister city Ocean Springs Mississippi had thanked everyone for the warm welcome that the residents gave them and then Mayor Johnson read a statement from the Chamber of Commerce of Ocean Springs Mississippi our sister city and this is the proclamation from Ocean Springs Mississippi whereas the citizens of alam marada have rallied to the aid of our sister city of Ocean Springs Mississippi whereas Alam marada Village of island is recognized Ocean Springs Mississippi as a sister city and whereas we share the pleasures and dangers as Ocean Front communities whereas Ocean Springs Mississippi suffered catastrophic damage due to Hurricane Katrina and whereas on Sunday April 8th 2006 the citizens of Alamar Monro County will be holding the Florida Keys for Katrina relief at Founders Park to collect funds to help support the communities involved in Hurricane Katrina disaster um therefore I Robert Johnson the mayor and the residents of Isa Mar would like to extend a heartfelt recognition of the the losses due to Hurricane Katrina and we declared Sunday January 8 2006 is Hurricane Relief day in honor of the residence of our sister city Ocean Springs Mississippi so we have a sister city and we have it for a reason that we have uh U dangers from hurricanes uh that are are uh consistent with both of these cities so uh any other talking about needing another sister city I just wonder if we're going to get get more sister cities and and then we get up to seven then we can call ourselves the pleades I don't know how many we need um but but uh I I really hope and I'd like to bring up one one more thing before I sit down when we were going to have a tab one discussion on the Sunset Beach problem that was going on hey hey time time's up man oh I'm sure it is thank you sir Mar anybody else yes Diane Harbaugh is next good evening Council Diane Harbaugh um resident Isa Mara I am the chairperson for the Nearshore water committee as well and I just want to make it abundantly clear that what I'm about to say is about Sunset drop and it is my opinion and has nothing to do with the Nearshore water committee so I don't want any confusion there um we had our meeting which we you will not get our information until your next meeting because it was too close to get on the agenda for Nearshore water just a few days ago and I want to tell you about a motion that was made and um the motion was to recommend that the council not pursue any new vessel exclusion zones and in instead conduct long-term planning for management of Nearshore areas in Isa marada that motion was passed 6 to1 and you won't hear about it until next month unless I come up here and tell you about it so um I read something today and I've talked to Sue about it and we're we're buds we're friends we're cool um we're not talking a swim Zone we're talking vessel exclusion Zone those are two toal totally different things we like to call it a swim Zone when we talk about it at White Marlin that's not what it is so I want to make sure that everybody is aware of that and one of the members said it best if you squeeze a balloon what happens to the air it just pops out over here and that's what we're doing we're squeezing the balloon and now we have a problem over here and we need to come up with a solution and I don't have it but we need to find it and someone mentioned that maybe we already have an idle only Zone within 3 feet 300 feet of improved Shoreline maybe we make it a idle only and no anchor Zone within 300 ft of improved Shoreline and that might help solve the problem we need the D we need the FWC we need everybody here we need some meetings and we need to come up with a solution because if we don't we're going to keep squeezing the balloon and pretty soon we're going to have a freaking poodle so we got to find a way to fix it rather than squeezing the balloon so that's my personal opinion I just wanted to say that and then um real quickly it's still green I see um the B pass meeting was that same night so I wasn't able to attend and um I just there was one question I wanted to ask and and I still really don't know the answer but we have 212 buildable Lots my neighbor just sold his house house on Woods Avenue and he had two lots and one had a house one didn't and they were combined I was told by our building department that those two lots had been separated and that there was a TDR that was being transferred over which I did get notification of the TDR transfer you need to wrap it up okay and and so I'm good with that but that gives you 213 buildable Lots so if you're going to look at it you should look at all those combined Lots that's my point Thank you thank you next Marne next up is Sue Miller Sue Miller lower matumbi it's nice to see all of you participating in a wonderful beginning to our council meeting I really really was so overwhelmed with emotion to see our Deputy who was so badly injured here walking here and I I thank everybody that was involved and um I I just think that this is a demonstration of what our community is all about and it was wonderful to see how many people came to a council meeting where we actually had to have numbers so that we didn't exceed the capacity of the room and now important decisions are going to be made tonight night and look how many people are left and at the last B pass um meeting our planning director took a question from one of the tables that said you know how can we uh make these important decisions without so much as a Vibrant Community participation and her answer was what can we do about it and oh she said that wasn't what she said anyway there's a problem with with robust public participation the discussion that you just had to talk about when can we talk about this and when can't we talk about this is because of your your um rules for public participation when you can talk you look at an agenda and you see boy we go the whole way down how many pages of agenda till we get the first opportunity besides this for public comment people give up we might not get there for hours and I think that you need to really consider why we don't have as much public participation as we really need when we make critical critical decisions about our community everybody loves Alam marada but we we want to participate in the decision making and I feel like we're not doing much to encourage once again I question who is responsible for setting the agenda putting important items where the public has no say should be unacceptable the attempt by mayor Pinder to put public comment before additions and deletions where we all know that the council a majority of the council can vote to make these items available for public comment is unacceptable also adding over 1,000 pages to an agenda August 7th 796 Pages August 8th 278 Pages for us to read research and understand in just five days is intolerable I wonder how many of you had time to research and understand these agenda items with the due diligence that they deserve I don't know why you are so against public getting involved but remember you were elected as public servants and you should have us ahead of anything else I would also like to thank the village manager again for his weekly reports it is a breath of fresh air to have someone who cares about informing the public about what is happening I wish that that would be more with the council as well thank you thank you Marne anybody else nope okay public comment is now closed okay so about the citizens advisory Barbara tab one I mean okay it is it's historic preservation under citizens advisory committee reports okay Barbara Edgar the historic preservation commission our last meeting was held on July 10th and the HPC discussed a photo calendar with old photographs showing historic sites in Isa marada several local banks used to do the calendars um they would put them out each year but to my knowledge they no longer do that these could be given out to locals or visitors free of charge we're working on prices from local companies we discussed sponsorship for funds to have the calendars printed or if the village would have any funding for such a project we'd like to do this on an annual basis the HPC felt it was important to meet more frequently to accomplish other things that we'd like to do we would like to meet every two months the update on the hurricane map the map was delivered to the Village a few days before our last meeting as chair I asked that it be installed right before the Labor Day service and covered with a tarp the mumi historical trust would like to unveil the map at our annual labor date Labor Day service the map has the names and ages of those who perished it shows where the bodies were found where they were intered or if they were um cremated after the 1935 hurricane this year the anniversary falls on September 2nd which is the anniversary of the hurricane Anita was going to ask Public Works to contact me to arrange the placement of the map at the monument this needs to be placed on Keystone to match the rest of the monument so we would like to have it in place soon we discussed the historic designation markers Corey AEL was working on this but has resigned from the HPC Tammy gilo volunteered to take over and try to find someone that can make the port hole design out of something which will withstand the elements the design has been finished for several years one of the members of the HPC asked for the guidelines the of our commission I told him the village used to give out notebooks outlining what they were but they no longer do that so I'm going to bring a copy to the next meeting and share it with all of the members our next meeting will be held on August 14th any questions any questions for Barbara sure so are you saying that there is going to be a celebration at the monument on September 2nd we hold um a service there every year uh in memory of the people that died in the 1935 hurricane of September 2nd okay and then you're going to work with Rob for the placement on the monument right um I have a feeling that if it's not if it's is that that's like a Rob issue right not a public works issue before it gets too out of control um we'll talk with public works and identify the proper staff resources to get that thing uh that Monument placed where it needs to be and we'll coordinate with the historic preservation committee to make sure it's in the location where Terry AEL said that he is going to get the Keystone to have it the other and if we could get it placed there before we have the event and put a tarp over it and do an unveiling during the service okay anybody else have any questions for Barbara thank you thank you Barb all right uh so next tab two is going to be the uh land acquisition citizens advisory committee report and Greg can't be here so Peter is going to do that thank you Peter okay uh good evening Council yes Greg doly the chair of this committee uh emailed me today he becomes sick so asked me if I were here if I could present this report so this is the land acquisition advisor committee report The Village Village's land acquisition acquisition advisory committee met on July 24th and is eager to work with the Village Council at the meeting our new members were brought up to speed on recent activity of this committee and staff also briefed the committee on land acquisition actions by The Village over the past year the committee reviewed a list that was presented by staff of 35 vacant private Parcels within the village that the staff have identified as priority properties to be added to the Florida forever list so yes we are looking to make some additions to that Florida forever list the committee will continue to work with the staff to refine the list which will eventually be sent to the DP as an amendment or as additions to the Florida forever boundary the committee also discussed the updates being made to the committee's action plan to retire development rights and the committee will continue to work with staff on finalizing this action plan and staff hopes to have that completed within the next few months the committee does understand the importance of preserving our environment in the village by working with the Monroe County Land Authority and with the Florida forever program and other agencies to identify and acquire unique and ecologically important properties that still exist so while the village can obtain land through various methods purchasing some parcels may be the best way to acquire and protect these parcels and our environment to that end we know that there has been discussions about the village creating a land acquisition fund and this committee highly encourages The Village Council to create a budget line item for land Acquisitions we have some smart folks on the committee ready to work and to provide Solutions the advice of the of the of the advisory committee is yes please move forward with creating a land acquisition fund for the village thanks thank you Peter uh Peter hold on a second Council anybody have any questions for Peter yes please um Peter I've already asked you these questions so don't worry I'm not going to surprise you these are old ones but you mentioned the action plan the land acquisition advisory committee action plan and I think in the tab there's a copy but I believe that that's a I'm not sure if it's a proposed one or a draft of one but is there an official adopted one no so as we found no that's why we're moving to now complete that action plan we we may have it done within the month okay I'm working on that along with Rebecca Jaton our land use consultant so we will bring that back to the committee this advisory committee and for their approval once they approve it we will refine it and bring it back to the council for adoption as a final final version I was very uh pleased to learn that you're adding new properties to the list for acquisition so good good progress there um you're probably aware that our comp plan requires that the village prepare a capital investment plan for land acquisition and purchase of development rights and other uh development retirement um efforts and I was wondering if your committee had been asked to participate in that as far as I know they have not okay um I think that's the end of my questions thank you I have some questions just to follow up if is that a you know um since we are we're having these budget meetings coming up in actually I think it's next week or in two weeks um and I know this is a topic that will be that will be discussed is there any way that we can look at this receive this action plan you know sooner than later um I mean I I I mean isn't this kind of been in the works it's just we've never really brought it to the surface um because I think that would help in the ation about how how or if we want to budget for land acquisition if we see your plan could we would anyone care to request that well there's a draft of the plan in our tab weird I don't see that you mean under this it should be Yes actually I think that's in Rob's actually it's in Rob's I apologize his presentation it's actually the next the book it's in the book got it so so that's good enough for our purposes something to work with okay thank none on the agenda so does anybody have anything I got something I want to say okay go ahead Henry as you know the water quality has been in my back pocket for number of years I I was successful and negotiation with Publix to buy bags a th000 bags which they gave away to try to save the uh plastic bags I'm back in negotiation for them to do it again but to my surprise there is a business here that beat me to it and I knew nothing about it and I think that business should be recognized this business in desperate need of saving plastic bags that are floating out there in the back country have been using these bags that are are dig biod biogradable for a number of years and I just found it out and I think you should know this business and they've been doing it for a long time and the bag looks like this and there's a lady to thanks and her name is Betsy at the trading post and these bags have been given she on her own has bought these and she gives them out and has been doing it for years I just found out about it I believe she deserves the recognition she's one of the people that are I remember from years ago that did things for us and the community and never asked for any recognition newspaper pictures or anything she just did it I that was the one thing the other thing is and I I have to ask questions of uh the council I know you're scheduled to Clos the property uh from the church sometime this month on Monday actually yes on Monday actually and you know as well as I hope the rest of you that I'm very much opposed to the acquisition and spending $4 million but I'll have to ask you a question that contract is a con con consent contingent contingent on anything other than just the purchase price etc etc excuse me can I just make a point of order here sure um thank you I I totally appreciate this conversation but I know that the process that we have here is is that we bring these things to put on the agenda so that we all are prepared to discuss them and and we don't remember we made a rule about this I'm just going to yeah so I just wonder if we wanted to follow that process or if we wanted to just wave the wave the process to have the conversation either way it's okay I just wanted to acknowledge that we are waving a process well we've already voted for it we we already had the majority vote to to vote for this uh happened a long time ago and we're at the closing if we want to reopen it tonight then just let I'm not reopening anything I'm asking a question it's just not the process that we follow I just want to make that point let see with are you okay with him asking this question I want to hear the question okay Mark you okay with him sure okay all right so my question pertains to the closing statement is there anything in there that is needed to close either the seller or the buyer there are title requirements um I don't have the contract conf front of me I was wasn't prepared for this but the as with any closing there are um you have to convey uh good and clean title so there are title requirements that go into that there is a post occupancy agreement um that we have been working on with the um uh with the seller uh because they're going to stay in there after we purchase it for a period of time uh there so yes there are some contingencies in there that have to be met in addition to to just uh just paying the uh the fee yes and the zoning is one of them I assume um no they're withdrawing their request for rezoning they're they're withdrawing it yes that that's one of the the um uh requirements of the letter of intent and the agreement was for them to uh withdraw that yes so when closing uh takes place that that will be withdrawn I guess I'm going to make a statement if you'll allow me that purchase price is contingent on the resoning and we're supplying the resoning and because of that we're paying more money for the building does that make sense to anybody here I don't care care who you are my recollection of the appraisals because the appraisals came back for both the current zoning as well as the proposed zoning that they had applied for my recollection of the appraisals were that both were actually above the purchase price so the the current zoning as it stands was also above the amount that the village is paying okay I'll let rest I can't agree to it I just can't do it it's the Public's money and if we want to spend it 4 million for whatever so be it I cannot approve it never have never will and that's that's that's where I am I just see that we're actually approving the up zoning so they can get a larger purchase price it is and we're doing it and we're going to pay the pay the extra money for that if we said no we're not going to give you the zoning where would the price be the appraisal came back at a at a higher than the village the amount the village is purchasing so even if we said no the appraised value was higher than the purchase price okay so the public is listening that's the answer and I'll will not continue to beat to death but I just have to do that that just have that's just me I negotiate things a lot differently than the two of you so it's Edgar and Deb Gillis hello again Council money talks and Alam marada walks is where we are this uh paralo Island I used to cut the palm trees used to be over 100 palm trees on that island and along with Jeff e Bloom and his company we maintain that Island it's a beautiful place and a beautiful uh addition to the E ecology and the environment of alam marada someone bought it with dollars in their eyes and someone who's well connected uh apparently the next door neighbor to Rick Scott in Naples has bought it and is trying to have the uh Island subdivided into $1 million home sites of scarified land and wants another scarified plot uh which it would be available if they just eliminated the eagle nest now apparently uh the Florida Wildlife Commission and the Department of Environmental Protection and anybody else that has anything to do with trying to save a tree in the State of Florida has turned a blind eye to this because this man apparently has such deep pockets and such good connections that no matter what we say no matter what the people of Adam marada want it's not going to do a damn bit of good so I might as well just sit down and shut up right no I'm not going to sit down and shut up I'm sick of it I'm sick of the fact that that money can walk in here and buy whatever it wants whenever it wants and and there there's always finding someone here that will bend to that and and find a way around the ldrs and the comp plan and everything else so that they can get what they want and this is just disgusting this whole process of of of desecrating that island and and making those Eagles who are the national symbol of our country making them uh declaring those nests abandoned that's bull crap and you know it those nests aren't abandoned they come back may not come back every year but but somebody uses those Nest Ospreys use the same trees and the the eagles use the same trees and and it's just ridiculous that you would allow someone to bamboozle you for the sake of a dollar bill so that's my comment and I not that it'll make a damn bit of difference but I hope you take it into consideration thank you next next up is Joan sches good evening Council Joan sches is [Music] marata I ran the the Florida Keys W Bird Center for over three years we had a juvenile eagle fall into the bird center the caption read on the front page of the press juvenile eag checks himself into rehab we couldn't keep that eagle why because they are an endangered species we needed to have an enclosed area protected for those Eagles for any Eagle us fish and wildlife FWC we care about the Eagles I don't know why the developers don't I don't understand why the the landscaping company that pulled the permit wasn't the landscaping company that destroyed the nest I don't understand how that happens with our code I just ask we are in a critical state of concern we should be protecting our Wildlife we should be protecting our ecosystem an extremely fragile environment and I ask all of you to take part in that and stand firm thank you sue Miller Sue Miller lower mumbi I can't tell you how excited I was the first time I saw an eagle on low manakum it was like the most exciting thing that had happened to me since I had moved to the Island and I think lots of people share that emotion when they see this dramatic bird floating over our Island it's just really special and I think that we as a community should do everything imaginable to protect that family of eagles that has been here for decades and and I keep hearing that the village has done everything right um I I don't believe that I I saw a permit issued by the village that said that before you're done with this tree clearing every invasive exotic must be removed those eagles live in an invasive exotic that the permit for the village said must be removed that nearly broke my heart and like a previous person said the permit issued to clear trees from that property was issued to one contractor that contractor is not the one that's cutting the trees I know that when when I get a permit I have to name the contractors that are going to be on the property and I have to name the right contractors I just don't understand the this eagle nest is in our comprehensive plan as a protected area it's in the plat map that was approved by our Council as a community area on the plat map it is not something that should be buildable unless you're going to build a community center on it it's not a buildable lot for development purposes that can be sold to an individual it's a community area that needs needs you you can't you can't issue a permit to build on a community area sell it to a private property owner and build a home on it it's a community area and plat maps have to be changed to do that I don't know how this community could possibly have given the developer a letter saying that it is a buildable lot it it's just unbelievable to me and I hope that you tonight understand and correct the mistakes that you've made and protect those precious eagles and their home thank you here here who's next next up is Deb Gillis Deb Gillis H marada I sat on Council when the first time that palaly came forward and um there was no doubt in our mind that we were protecting the eagle Eagles The Nest um a lot of water has gone over the dam since then there's been storms there's been new owners there's been all sorts of stuff the the original uh owner um during that time period is no longer there the promises that were made I don't know where they they were for sure in writing but uh I remember very distinctly we uh we were following the federal guidelines and putting it in our ordinance to make sure that the eagle was protected um since then we had a storm it knocked the one nest out but they came back and built another Nest um I'm anxious to hear uh the manager's report on it all uh but there there was high discussion back then actually it wasn't the center of the discussion on that property but there was high discussion in protection for those Eagles um and I I remember it's many years ago so I may have some of this wrong I remember us pushing to make that corner lot larger so that it they could protect the Eagles and yet use the the lot and there was a promise that okay you know the Eagles will be on that half of the lot and we'll build on this half of the lot or whatever um since then we've got different different owners and all sorts of things so um I just wanted to remind everybody that the prior Council it was a priority for us to protect the Eagles Nest that we had here thank you than anybody else yes um Barbara Edgar and then we have Mr wishme on Zoom my dad first saw the first Eagle come in 2004 and we we were excited because it was the first time we'd ever seen an eagle here in the keys the Eagles first one came a few days later a pair of them came they came for the bird bath because they were looking for water and we used to try to figure out where they were going and we'd watch we live right across from parmales Island on the ocean and we'd watch and they'd go all the way back and when they got to parmales they would land and you could see them go down we couldn't see the nest but you could see them go down and they have come many times throughout that time for 20 years on and off we've seen the eagles they have brought babies we've seen babies that have flown by with the parents and at one point they brought uh babies for the water and um I just have to believe that there's a way without stepping on somebody's property rights because I think sometimes government steps on property rights way too much but there's got to be a way to let the property owner um utilize his property and yet that protect the Eagles I really think that the nest should remain the Eagles are still here I saw one of them um four weeks ago and they're still here they've been gone at times they always come back that's it thank you's next we have Mr wishm give me just a second to get up anybody no Mr richm left okay go ahead Mr okay can you hear me yes Joe wishm Plantation key you know I would like to talk about the tab three uh I'm so glad that you brought it up so that more people have a chance to discuss it you know since it uh it is one thing when you vote to overdevelop our Village affecting our quality of life but now you want to mess around with the national bird of the United States of America a bald eagle and the reason for this to create even more development when are we going to say enough is enough a report by Eco wild which was hired by the developer stated that dest was reported loss due to Hurricane Irma so Federal Regulation should not apply but in that same report it says that during the 20 2021 breeding season a nest was active according to Federal bgea since a nest has been active within the last five breeding Seasons regulations do apply the developer has proposed building a platform that would work for the Eagles to build another Nest our national bird deserves a natural nesting area of their choice not some man-made platform this is not the first time that this Council and planning departments have been asked to ignore some rules and regulations in favor of developers this practice has got to stop those of you who claim to care about the environment need to start showing it this would be a great place to start thank you very much that's correct public comment is now public comment is now closed you know I have to I have to agree with Barbara i' I've seen Eagles on Laura mumi for a long time but what I don't like is people coming in here accusing this Council when we didn't even vote on this that's what I don't and people need to have their facts in order I grew up here I I've been working with the Florida Wildlife Corridor very involved went to o2o up at Camp Blanding I am about protecting animals okay I feed them in Alaska I see hundreds of eagles when I go fishing up there but to come and blame us we this is this thing just came up so I want people to have their facts right okay I highly Clear care about animals and to come say that I'm trying to tear a nest down or something that we're not this just came to us two weeks ago so I would appreciate people to have their facts in order okay I love this community I was raised in this community barbar I know exactly I know ply Island extremely well and I personally I get offended when somebody's going to come in here right now I'm sitting here and going to let everybody talk but man make sure you have your facts in order okay because there's a lot of documentation with with this thing right here and the federal people are involved because vice mayor Mahoney is going to talk in a few minutes about that she this lady that she talked to knows everything about the Eagles nests that are there the number how many Twigs were on the nest after Hurricane Irma left okay every all the facts let's just make sure that we have the facts okay and and I think every one of us okay Mark has now since got involved with the wildlife quarter okay it's a great thing we're we're spending hundreds of millions of dollars the state is making more home for Habitat we have 230 or 24 something underpasses for animals to go under the freeways to go under 75 for Turtles for alligators for crocodiles for you name it protecting I just came from a place marine land Florida where I'm watching bucks out there I'm watching Osprey nine Ospreys at one time eating a fish every day I drove through Vera by Wickham Road it's just north of of uh Melbourne and I'm watching an osprey up on one of the light poles on 95 eating a fish then I look over here to the left there's another one okay it is it's it's so I want people just to make sure that you have your facts I've seen Eagles many times on the concrete poles that they just removed eating a fish eating a eagle okay I see him on the stretch and some people confuse ospre is for Eagles there's there's a difference between the Osprey and the eagle the eagle is much bigger than an osprey but I I'll tell you what please do me a favor I I I take this seriously at heart I really do because I care about the animals the whales up in Alaska the Eagles the the all the animals here I grew up with them the federal keyer preserve we we protect the keyer okay but you know what man okay I spent a lot of time with the with the wildlife Corridor and I plan to continue I'm one of the first Council people that has got involved with that Mark Mark tried to get in too it wasn't easy to get in okay but I got in and I'll tell you something it is a solid organization and they are doing great things for Florida to protect the Everglades the the Brian Farmland okay so make sure you're educated and you understand and I want people to know that are watching on TV or the the public we did not we were not on Council I first found out about this two weeks ago all right so I don't know who's coming up with this that we're tearing eagle nest down okay we have staff but vice mayor I don't know if you want to talk now or Mark I'd rather some other Council speak about this because this gets me very very fired up over this because let me tell you something that's not right to come in here and accuse us you you you people get up there and say stuff at that mic and say we've done this and we've done that I happen to be an animal lover and I don't appreciate it I protect animals everywhere I go I just came from walking and took stopped and took a gopher turtle out of the road on A1A okay I mean my goodness I'm telling you this is a serious thing so make sure your facts are right thank you Mr Mayor at some point I can also chime in on the legal analysis and what it means and doesn't mean to okay who who wants to go I would prefer to speak after John presents some facts and data and information I think it would be helpful to everyone educationally to understand how we got to this conversation John before you do that I'd like for vice mayor because she talked to this person I'd like for her to give her what she found out because her her brother-in-law is a vet has his daughter's a vet they're very well connected so I would like for vice mayor to to say what she found out thank you Sharon um um I think the smartest way to approach us right now is clearly there is misinformation clearly people have been saying stuff that is not true and I think what would be most helpful right now is maybe we should have a workshop or something uh the woman who oversees the Eagles for the state of Florida I have spoken to several times she is willing to come down um The Nest has not been taken down I don't know what Nest anybody's talking about um Ospreys and Eagles don't use the same nest Eagles like to be hidden Ospreys like to be out in the sun so that's not true so there's all kinds of things that I think instead of going on and on and on and nobody agreeing we have to accept the fact that the keys are changing and that people have the rights to sell their proper and they do have the right to develop it and somehow that seems to not be important enough when it comes to the animals and you're not going to find anybody stronger than me when it comes to the animals but I think the best way to do this right now is maybe we should everybody take a breath have a gathering with maybe I can get her to come down here uh the developers who are not going to build a house right there right now I know that for a fact and they're they can't and so instead of everybody going off in a 100 directions let's get some facts let's get a professional down here and let's do the right thing instead of everybody's coming in from Left Field we're ripping down this we're you know Chicken Little the sky is falling that's what this is like so I don't really want to get into everything she told me she is willing to come down here I think that might be helpful and we also should talk to the people who bought the property and before saying you know they're out there ripping the feathers off the Eagles and stuff so I think that's might be the best way to handle it I don't know how everybody else feels but so thank you Sharon all right so Council we okay if we let John speak and then Mark would like to speak too yeah I just wanted to to kind of give a little discussion about you know the the legal analysis of it and and I do think it's important to point out I know there was you know at least one of the public commenters talked about ignoring rules and regulations that's absolutely not is not what's going on here at least from from what has currently been presented to we are bound by the code we are bound by state law and and we have to to to address it on in in with with those lenses on so for what was presented to the Village was a request from the owner is this area a develop a buildable lot what does that mean what does that mean Under The Village code there is a definition of buildable lot which just means a lot that's duly recorded and complies with every requirement of the code and then there's a definition of lot Under The Village code to be a lot it does not have to be platted it talks about it as a platted parcel of land and then it so or an acreage tract that has some other conditions tied to it intended to be occupied uh you know for occupancy purposes so this is not a platted lot there are other platted Lots on on the plat obviously but that does not mean that it is not a buildable lot so from there we have to look are there any restrictions on the plat and we have to look at the face of the plat and I and I know that there are uh there's discussion uh about the eagle area in the comprehensive plan there absolutely is although I will I did point out in my memo it references a different area it references it in the southwest corner according to the plat the Eagle Area here is in the Southeast corner and so I did make a recommendation I think we need to update our comp plan to accurately reflect where this Eagle area is so that the comp plan is covering it so the C comp plan is stands on its own and the plat language stands on its own when we're looking at does a plat Amendment need to come forward in order for there to be a buildable uh to be considered a buildable lot on the face of the plat there is no dedication language that restricts that area like you would have if you have a dedication of a roadway to the public it would it would have language that says the roads are hereby dedicated to the use and enjoyment of the public or something something along those lines there is no dedication language in this plat it is just a notation that says Eagle area and there's a point on it that says Eagle's Nest and then there are two radi that go around that say 330 ft and 660 ft and from the face of the plat it doesn't doesn't even say what those are we know what those are based because of the analysis that's done by the the feds and their regulations but again on the face of the plat which is what I have to go on those are not restrictions in terms of the use of the property for a replat purpose they may be restrictions as to what the owner can use if they come in for an actual development application and that's the other thing that's what I was going to get to is that being a being a buildable lot does not mean in reality that it's buildable I can't say one way or another without any plans in front of us whether this is actually buildable they would need to comply with the federal fish and wildlife regulations they need to comply with state law they need to comply with with local law I mean is for example I mean without a wetland survey I mean I just jotted a couple things down I can't confirm whether the building area would comply with a wetland requirements if they don't they wouldn't be able to build or I shouldn't say wouldn't they I'd have to look at the the circumstances they likely wouldn't be able to build if without civil plans I can't confirm whether they they're complying with Frontage access or utility connections without an overall development plan I can't say whether it's in compliance with the ldrs these are all things that a owner would need to do and actually to actually build upon the land to to actually develop so the term buildable lot is a term of art but it doesn't necessarily mean that you're you can just run out there and you can build on you have to comply with each and every other thing that is every other law that is out there um the the there are certain things that we cannot control we do not have jurisdiction over what the feds have jurisdiction of that is within the federal fish and wildlife guidelines we have you know they are the ones who enforce those guidelines um we have adopted them and we referenced them in our our comp plan and as part of that we will rely upon the uh Federal fish and wildlife requirements but for any development they need to comply with our comp plan they have to meet zoning they have to meet all the other requirements of our code that we have jurisdiction over um I've also heard um not just today but but for the last couple days about this being a an environmental area or a community area again that's not on the face of the plat and for purpose of whether a replat is required I have to look at the dedic dations on the plat if it if there were dedications on there that restricted that and said this is a community area we would likely be having a different discussion if there are restrictions like that through like an HOA document through a uh restrictive covenants or anything like that those are things that the owner would have to deal with and if the owner doesn't deal with them the in certain instances we as a village might be able to enforce them in other instances like HOA docs a private individual might be able to enforce them so just by saying this is a buildable lot that is honestly like the the very very first step that a um property owner has to to potentially move forward but there are many many other hurdles before somebody can come in and develop and I we haven't seen any plans so I can't say planning can't say is this something that they can even do I I mean there are other things that might come up if they want to subdivide this area into five or six different Lots then yeah they would probably need to come in for a replat I believe under the code that they would have to if they want to subdivide it into multiple different uh areas so there are instances depending on what they want to do that a replat might be required and it would have to come back before Council if they wanted to do that because I something like that would would I think would but to to say that the the the village is allowing them to tear down an eagle's nest just based upon the the simple first question of is this a buildable lot we're not there yet and we're not the only ones who would have any sort of say in that that that the the environmental agencies would you know they would really come in and have something to say about that so I just wanted to make sure that we understood where we are and really what the question of is it a buildable lot or not what that actually means in terms of of of where we stand today so I hope that I cleared up any confusion um and hopefully I didn't make it any more confusing okay Mark would you like to speak now yes yes just first a couple of questions for John um I don't know if it matters whether or not the lot is platted but I would like to clarify something that you said um it appears to me from the documents in our tab that the eagle area is within the bounds of the land that was approved for the plat of the paraly estate and if that is the case it is a platted lot under my interpretation and under the interpretation of the platting section of our code but I don't know that that makes any difference U you know we also have another term in our code called parcel of land and a lot is a parcel of land so it's names and games and all kinds of funny things but um to me what really matters most is what was the intention of both the owner and the council at the time that this was approved as a plat and I believe it was in uh 2016 and so what I have asked the manager to look into for me I asked that we include it in tonight's materials but it's not here and I'm not complaining but we can look at it later what I would like to see is the complete plat I believe it contains five pages not just just the one that you have I also understand that there is a set of um homeowners regulations a declaration of restrictions whatever its title is it is a contractual um imposition of ownership again restriction of some kind of ownership and I'd like to see if that is addressed you may have already looked into it and then second or thirdly um I would like to see uh whatever uh Council Communications or the equivalent was produced by our staff and and given to the council for their review and consideration at the time that they approved this plat and and similar background someone had to file an application for the plat and somewhere in there I believe there is a clue to that because there is a clue in this letter and when I say this letter this is the letter from our staff that declares that it is a buildable lot and I know I respect your your distinction about a term of Art in our code as a buildable lot versus your ready and approved for a permit that's not what we're saying in this letter that the way I read it but on page two of the letter it says and and for purposes of public education if you uh make an application to the village for a pre-application conference you get to come in ask questions submit them in writing have a meeting and then after that meeting they will prepare a letter that answers all of that and that's what this letter is that I'm going to read from it's a short paragraph um it says after the meeting the pre-application meeting it was discovered by staff that this lot was not originally assessed Wastewater fees as it was not anticipated at the time of the plat approval it was going to be developed so I don't know what that means if it was not going to be developed does that mean it was going to be conservation it was not intended to have a house on it they were going to leave the Eagles alone was it going to be a state park or a village Conservation Area those are the questions I want to know what was the intent at the time that this was done because that to me has some pretty important implications we're required by state law and out in our comp plant to respect property rights but if the person that owns the property knew all about this when they bought it I don't think that's our problem I think that's his problem and if it was pretty clear to him and I think the nest itself and the the curved line the semicircle of the lot line that kind of tells you right there buddy you got a an eagle's nest if you're going to develop you've got an environmental problem to deal with and you may not be able to use the property the way you want to so going forward with this I would like to have these questions answered and I would like to have a presentation to the council or we can have a workshop as the mayor suggested an informal thing where everybody can come and participate like they we opened up the meeting tonight I think that was a good thing that we did we made it as an exception we may not want to do it on everything but certainly you know we're talking about an animal that represents America and it and the whole world know what knows what that bird means and it's us and so there's a lot of Pride with it and there's two of them because there's a nest there and there may be more um I had a farm in North Florida and I had an eagle's nest on my farm and the the Eagles we had cattle and the Eagles would eat the placenta from baby calves and dead calves and I saw them all the time they were gone sometimes they were back sometimes I'm not an eagle expert but I know that they're not always visible and uh they come and they go and so I think that's something important to to think about we need to learn about eagles our community is founded on protecting the environment in some cases I've been a complainer that we're not doing a good job of it but this is as Mr wishme said this is a time for us to step up and show that we want to protect the environment protect the animals that live here protect the the the creatures that that Define our community it's part of our natural National Heritage you know a bald eagle I mean what more is American than that so I would like to get the background information on it let's all take a clean Fair calm look at it if there's if the developer has a right to build on it he's got the right but you know there are federal laws and state laws and all sorts of regulatory laws but to my knowledge John and here's a question for you if it is the will of the council and the and the folks of the village that they want to impose additional restriction and additional protections to keep those Eagles here isn't it within the purview of our power uh to do so I mean we're not limited by the federal government if we want to put more protection on there can't we do that yes you can uh just I'm the only caveat I rais with that is depending on what it is we'd obviously have to analyze it for uh for takings issues exactly that's why I brought up if the if the owner of the property was aware of these restrictions and and the issues with the eagle I I don't know that we're going to make it any worse but certainly we can clarify what's there that would be my goal we have to be fair to the owner we have to respect the property rights but this is something that touches it's an emotional thing I'm emotional about it maybe you couldn't tell but I think there's a lot of people in this community that feel that wildlife in in general and an American bald eagle oh my God you know and then who wants the black eye and our reputation that we're cutting down a tree where they nest I mean if we're going to do that it's going to be kicking and screaming that's all I can say on my part and you know I can get you what you what you would ask for because all of those things are things that I looked at when when analyzing this I mean I went through everything all of the old Council Communications the old agendas the old discussions um there are five uh uh pages to the plat the first page has the dedication language that um for things that were dedicated like it the road it talks about I I have a copy of the first page with me it says that the the roadway is um uh is not dedicated to the public but is reserved for the people so there is dedication language in there not related to the eagle area so I can get you I have copies of of everything that I can get and I'll for to all of council obviously I'm not saying that you'd ignore those or you did a f I know you you I'm just letting you know you didn't leave a leaf unturned I I know or a feather unturned uh so I I know that that's how you operate but I think if we shared that common information with the community where we all had a common understanding we would all feel a lot better about going forward it's it is in my view unfortunate that someone can cut down a tree where an eagle is made a nest that that's I I'm trying to think of more offensive things uh but if that's what the federal law allows that's what the the law allows but if we have an opportunity to uh increase that protection in another way uh that respects the property rights I'm all on board with that so I I think it's a it's a matter that's of enough importance that we've all become concerned about that we can make it a community issue and and do a and review it that way instead of and this is the thing I spoke to the manager about when it first came came up you know people are saying that you know it's getting shuffled along it's being done behind the scenes it's it's not coming in front of the council I mean it was kind of like we were just letting it go because the developers going to make 10 or 12 million doar from selling it I don't know there's something on a website I didn't see but I heard about that so if we get it all out in the public where everybody sees total transparency about what's going on here and our decision is based on that I think that's the fair thing to do fair to the community fair to the leg and fair to the owner I agree so let's do that please okay anybody else with Council want to speak we just need to have the right facts you want to speak you know what uh thanks Mark because I'm so irritated about this and and this issue I I I mean I feel like I have to be a lawyer to to come up here and say hey let's make this a community conversation and talk about uh talk about this issue so thank you for bringing your lawyer skills because it shouldn't be this difficult it should not I I mean and we have this conversation over and over we're going to have it again in the next two days about what we're doing with our property to in at the expense of our natural environment and and again like you know let me go get a law degree before tomorrow night so so we can get some so we don't have to have this defensiveness I mean it it's yeah Okay g stop Henry you got any anything you want to add or I can appreciate what's been said to me I don't see the argument truthfully I I think we'll come to a conclusion or any has been said to prohibit any building in that area period I can't imagine anything but that happening and the longer we put it off and go through all the motion I predict the end result will be the same as you like it and you like it and hopefully you like it and Mark and I do I don't see any area where that can not change we're we're going against against the federal government and people of the United States I don't just see any compromise I mean it's a dumb deal why are we beating it to death because there's an application from Miss Anna Richards to ask for it to be removed that's why and it's kind become a flasho sorry to interrupt I'm sorry I mean it due respect Miss Richards I mean she has a position it's and I can't criticize her position because well I don't want to get into person alties but that's I don't see any change I really don't but if you want to beat it together and have workshops and all that have at it the end result I predict will be the same I'm sure it will but we should and the Eagles Will Survive and we're going to go on about our own business that's me thank you okay thanks Henry okay so Mr Cole what you just informed me we don't need to you want to I don't think that it would be of value for me to add anything to the conversation at this point I think we have a pretty good direction from Council on next steps and we can prepare accordingly and and return okay and uh I want to thank uh councilwoman Mahoney for reaching out to her experts and uh perhaps we'll talk offline about potentially getting them to participate in that next conversation okay thank you so on the agenda it said if we could take a short break after this but uh Council are we ready to move on okay all right wait till 8 okay so now it's going to be Tab four uh Mr Cole the land acquisition fund brief update thank you mayor just as a little bit of background uh this item came up in a discussion of our landscape mitigation fund at our last meeting we were talking about uh what constitutes an appropriate use of those funds what doesn't constitute an appropriate use uh we heard from some of our environmental planning team about uh the criteria they use in determining how they spend those uh and one of the questions arising in that context was whether those funds could be used for land acquisition as it turns out they can uh as we see in today's agenda we also have a draft copy of the land acquisition advisory committee's report which had a preliminary list of higher priority Parcels that would potentially be targets for U either restoration Andor preservation of hammock within the community so with that backdrop I was requested to at least look into the feasibility of establishing a land acquisition fund and what that might look like and and timing for it so what I did was you know I I reflected back on many of the conversations we've had that are related to this uh we have existing land Holdings that we really need to identify a path forward for what are we going to do with them when are we going to do it what's the process that we use to disposition those uh have been very aggressive in in my view in terms of buying land uh acquiring it for conservation purposes but not yet for restoration purposes we spent a a number of millions as discussed in our last meeting in comparison with how much money the the landscape mitigation fund actually uh generates uh it was brought to my attention and this is not in my report so I'll draw everyone's attention to it now there's some language in the comp plan that says we need to have an account for land acquisition and there needs to be a consideration of that uh in each and every budget cycle that the village has uh I don't think that historically we've done that in a way that's uh very clear and focused on a line item allocation for that purpose but there is in the capital fund money that comes from the discretionary uh sales tax uh that is used for land acquisition so there's an account there and we do make purchases and and use a variety of different resources to to make those happen but the general uh finding in my memo here is is yeah let's let's get some of that strategic framework in place let's identify all the purposes that we want to have land acquisition for prioritize those needs and then begin to use not only a land acquisition fund that's you know identified in the budget but also some of the other sources of revenue that we currently have whether the landscape mitigation fund um unassigned fund balance um let's see I listed impact fee fund Capital project fund and others um and interestingly enough I highlighted in my memorandum that um you know we have some pretty major studies underway now that could influence our land acquisition priorities we have our our uh we have our rogo study the bass study that uh our village planner is working on that may help to inform options for potentially mitigating our exposure to takings litigation uh we have our our comprehensive plan that clearly is going to help establish land acquisition priorities within that context and it will involve a broad group of stakeholders so that's very important and then of course we have the budget and and I had mentioned the budget is an ideal opportunity to discuss uh establishing a fund or adding additional funding or being a little more explicit in terms of how we want to use that line item and so it wasn't surprising to me when Councilman Greg pointed out that the that the comprehensive plan actually says we're supposed to do that in the budget because you know according to my memorandum not having read that I'm suggesting that's an ideal opportunity to have this convers and just as an initial figure we came up with about $630,000 on a tenth of a point on the uh military so if we think about allocating additional funding that doesn't come through one of these other existing sources if we wanted to you know add additional cash money into that account heading into budget keep that number in Mind 630,000 one10 of a mill so every 6:30 we want to put into land acquisition we're pushing the millage up a tenth of a point irrespective of what other demands are in the budget and that's why uh to councilman Greg's point the the uh the comprehensive plans point and what I was trying to emphasize in the memo this is best discussed and dovetailed into the budget conversation because you really need a a good view of that entire Financial landscape to make good decisions on this rather than trying to get it started right away which is important but we do have other mechanisms for funding in the in the short term if we find U particular properties that we want to acquire so that's my report and I'm open to questions as Council deems appropriate cbody you have any questions for Mr Cole I I don't he did a great job and we had a conversation and there's some some I guess I surprised Mr Cole with some things in the comp plan that uh I thought we all knew about but it's it talks about um environmental infrastructure you know we we don't normally think of our environment as infrastructure but you know wooded lands swamps and things they provide storm water runoff storm protection they produce oxygen they absorb carbon I mean they're essential for human uh life so if we invest in that and at the same time improve our community's appearance with uh beautiful open Land open space you know it's a more pleasant place to live so there's another item coming up and I'll have some more comments about that in detail so I'll save my comments for later the Glenn property that we acquired last year has all it has saltwater Marsh it's got hammock it's got you know there saltwater crocs that are nesting out there I've seen white pelicans there I Through The Years there's been lots of Ro uh rosette spoon bills actually nesting there there's just there's a lot that that has to be in my nearly eight years of service on the Village Council the the the most thing I'm most proud of that I did is we worked together and we we passed that and we got that bought I I I think I was proud of doing the comp plan too but but that was a big deal and uh I think that's an example of what we can do going going forward and it's it's within our power and it's certainly within our our plans to do that so I I hope we do more of it anybody else have any questions for Mr Cole Council all right uh okay so we're going to move on then to the consent agenda uh Mr Cole or Mr Quick summarize yep uh we're into the consent portion of the agenda these items are routine nature and council members have reviewed these items in advance and sought the advice of Staff as they felt necessary there'll be one vote on the consent items which today are tabs 5 7- 11 and 13 if anyone would like to pull an item from consent he or she he or she should state so now eight it was my understanding that council member Rosenthal wanted to keep eight on consent agenda but just have a discussion about it afterwards correct yeah and I think uh Mark wants to have a uh we wanted to he he wants to have a discussion on six and then Elizabeth we we pulled tab 12 yes the one that are on consent are tabs 5 7 through 11 and tab 13 okay okay Council any discussion on anything all right uh Marne do we have any public comments signed up yes thank you sue Miller okay Su or lower mumi pretty soon you're going to think I'm van Caden have talking so much yeah I wanted to just make a comment every single time there is a Wastewater expenditure in the consent agenda I have I come a little bit closer to have a nervous breakdown and um and it just drives me crazy that in June we were told that we would be discussing in July um convers ations with the kyaro Wastewater system and it seems that we have had that mentioned dozens of times that we are having a real serious issue with maintaining and servicing a 200 million infrastructure and I I looked at the KE Aro Wastewater Board website they have 33 employees that are maintaining and servicing their system and we have a couple employees that work for Public Works that also work for Wastewater and and I really think that we need to address Wastewater and every time it comes into the consent agenda more money spent uh over what we veted I'm going to be here talking to you about it and I think that um it's unusual to have a municipal consent agenda for a a government as small as ours that has in today's consent agenda alone almost $3 million spent without discussion just put it in the consent agenda and spend three million do again thank you thank you uh Martin anybody else no one else has signed up okay with that being said public comment is now closed all right Council any further discussion or do I hear a motion on what the ones Mr Quick said that are here I have a question sure uh Mr manager where are we talking to kargo in reference to Wastewater councilman Rosenthal we're in the middle of uh negotiating some improvements that need to be made to our waste water line in terms of the technical aspects of that it's been taking a little while there's been some questions from kargo Wastewater District some that our engineering firm has had to go back and forth on and we're I think nearing completion of those conversations so before we can really start talking about a broader picture of potentially even having a something like ke Largo Wastewater District take take over our system we have to first uh get past these technical hurdles that we have and I think I just saw a copy of a report a draft report last week late on this very topic so it is making progress it doesn't go as fast as what anyone would like um but first of all coming to agreement on the infrastructure Improvement specifics is an important and necessary thing it does take analysis takes work takes Engineers talking to one another getting past that it's going to be another conversation about the state of our infrastructure and what might take for something like hearo Wastewater District to take that on financially and operationally and then um as that conversation continues to mature maybe we do end up in a place where we transition it away I would not call that a near-term solution so if there's an expectation for that amongst anybody and I'm not sensing that I want to be sure to set a clear expectation we're heading in that direction uh it's been an issue that we've had for a long time it's going to take a little bit of time to to get through it um and it it's going to require some Technical Resources but it's not sitting idle I can assure you of that well I just want to thank you because I talked about that before your arrival by the way and I was met with uh not the support that I need to move it along you have and I'll thank you for doing that thank you hry I hear a motion on the table oh go ahead I just wanted to add I also thank key Laro Wastewater district for their collaboration and cooperation and our DPW Personnel that are working really to help Advance this conversation by making sure that the technical specs are fleshed out uh between the the people who talk that same wanted to move that one up since it's not a we're not taking a vote on it but or we can go in sequential order whichever one you all prefer okay all right go ahead Mark so we talking about six now six yeah well we're going to do six and let me um let me read the um okay the title to it uh tab six is a resolution The Village Council V Mar Village violence Florida approving work authorization number five with Tim Matthews tree and Landscaping Inc for completion of a planting project on when Le key authorized and Village manager to expend budgeted funds authorized and Village manager to execute work authorization number five and providing for an effective date okay thank you Joe so I I fully uh support this project uh what they want want to do my complaint my problem is with the source of the money that we're going to spend to pay for it this is in my view a larger version of the one I complained about I think in the July meeting where they were going to do a landscaping project literally right out our door here with cocoa plums and other things um and the reason that I'm complaining is because the source of the funds comes from mitigation fees that were paid by people who cleared hammocks and cut down trees under a program in our comp plan that requires us to restore or replace hammocks and protected trees uh in a habitat and this is going to be a beautiful project creating I haven't seen the plans but obviously trees in the area between the old road and the highway it may be in a line it may have understory but I don't believe it's going to be habitat habitat is a much more complex and complicated uh environmental um feature so unless this is going to be some kind of protected habitat with a conservation easement on it I would like us to use some other source of funds and if we can identify those tonight I'd be happy to vote to move it forward uh otherwise I'm not going to support it okay anybody else have anything they want to say about it I mean I I I appreciate your the the Nuance of this argument um and um are you also asking for um more information about the plan for using the $758,000 in the landscape mitigation fund well let me let me back up and and say something um to clarify I've heard I think it was the manager Mr Cole used the term landscape mitigation fund you just used it um I don't believe it exists anywhere in our code uh certainly not as it's certainly not a fund that is to be uh funded with money from mitigation of cutting down hammocks that money is earmarked for two specific purposes to recreate habitat and to acquire land that is to be used to create more hammock in other words there is a mandate in our code that we have no net loss of hammock so if someone cuts down a half an acre of hammock and they pay whatever it costs to do that probably a couple hundred thousand dollar it is our our mandate in our code to spend that money on either uh creating or or restoring a hammock somewhere else or purchasing land where that can take place it is not Landscaping so you're saying that that what we're that this presentation that we're reading and and taking as facts is there is no such thing as a landscape mitigation well I I don't know if there is or isn't but if there is it should not be funded with mitigation fees well so help this is a staff thing because this is confusing what I'd like to do is invite Pete frza up to the microphone to talk a little bit about this particular agenda item and I think in the use before he as he's walking up the landscape mitigation fund is not a label that says use it for landscaping it's a label that was been used to say that it came from cutting down things that constitute landscape so it's the mitigation of those activities which isn't necessarily saying it could do things like you know we covered in July with planters out here but I maybe I'm going to find out the hard way that I'm wrong but I could I looked through the code I could not find anywhere in the code or the comp plan where we would be justified in destroying a habitat and mitigating that with a aesthetic landscape project if it's there I'll listen and then I'll shut up oh let's let Pete talk I think we did a a staff presentation on the same topic so some of the commentary we're hearing this evening I think we may have had last time as well so let's let Pete step up to the microphone talk a little bit about um the project and and what why we believe that it qualifies for use of funding from that account where uh the developers pay fees to whatever the proper label is for it and we can clarify that as well and then if you've identified alternative sources of funding uh to to respond to council concerns of using the the mitigation fund for it I I welcome that conversation as well thank you okay sure and I know Daniel Daniel is still here too if he has any like specific questions about how that funding comes in you can ask Daniel as well but so the staff have reviewed this in the code extensively I've spoken with Daniel a number of times we've talked to Rob about it certainly there's ambiguity in our code it's all over it's open to interpretation the way we interpret this and me personally I think this is an appropriate use of this fund it's for the restoration of public lands and it's for restoration now this absolutely would be a restoration project the habitat had been lost or is lost in that area we would be restoring native plants native habitat it's also going to enhance open space and create green areas Green Space and also enhance the community appearance all of those things are within our comprehensive plan uh this would be for planting about 850 plants that would be a minimum we would likely do this project in phases as the pro as the water main project moves North anticipating three or possibly four pH so we would be able to adjust the project if necessary to change the plant species or create more habitat CU 850 plants is definitely a minimum in this area we would definitely have room to expand so understood about your questioning of the code um I personally don't agree I think it's an appropriate appropriate uh source of funding uh but we could identify other sources I did talk to Lisa Lynch today I me the really only other appropriate source of funding would be through the general fund uh we think that within the public works department is most appropriate and uh within the repair and maintenance fund so we could budget budget for next year for 2425 for this project uh and for any other additional projects uh the these planting projects would not be appropriate for use of the of that um discretionary sales s tax uh we wouldn't build use it for that so really the only other option uh is is the general fund yeah ask some question questions nobody said no so I guess I will so you you mentioned that this is going to create habitat absolutely what kind of habitat trees are habitat one tree is habitat in an area where there are lacking trees anything you plan is habitat it could be habitat for a moth but it's absolutely habitat by by using these funds are we going to obey the comp plan mandate that we shall have no net loss of hammocks are you creating a ham hammock habitat so good point so that is another topic I believe that's another topic of discussion are we creating a hammock likely not but even that is questionable on in terms of the definition of a hammock which can vary um so we are looking into that other point of no net loss of hammock we are restoring properties with hammock we're doing it now we have three projects in the works right now that we'll be bringing back to you for the restoration of hammock we just need need space too that's that's the limiting factor is space I I I don't uh I don't uh hold you uh in contempt or anything for doing those other projects that's exactly what the money was intended for and I sympathize with your dilemma that there's just not enough projects to to spend the money on which gives me uh concern that the decision to use these funds is is driven by the fact that they're there they're just sitting there because we can't it's hard to use them so that might be something influencing our decision on what we can use them for I I think that we are robbing that mitigation fund for a purpose that it was not intended for and the ultimate Guiding Light principle that I read in our code is no net loss of hammocks and a thin strip of trees and bushes down between two roads is not a habitat in my view I don't think a lot of birds nest in there if they do they're subject to being killed by a car same with the other animals in there butterflies whatever it is we want to protect I don't think a bald eagle's going to nest in there I'm making a joke but I appreciate you know you guys are trained educated biologists I'm a Old redneck that likes to walk in the woods but I see these things and I know a hammock when I see one and that line of trees across the street is not a hammock and if it's going to be anything like that I think we're breaking the law so I would much rather and it's a difficult thing but I'd much rather us go find another pot of money to pull pull from rather than Rob uh a hammock project in the future when we've expended the monies on a pretty landscape project and in fact there is a criteria in the code and it it says that talks about receiver sites where we can if you have to put uh trees in somewhere else because you can't do it on site one of the U criteria that makes a site ineligible is designation for landscaping that serves an architectural or aesthetic purpose and to me I haven't Senor plans but that's what this sounds like to me so okay that's my complaint but Mark I have a I have a a question because you are really confusing me like crazy because you talk about hammock we bought 600 we bought the Glen for 650 there is so much High hammock across the street from the weight station it was all clearcut but it's all grown back today it's amazing hammock there you said yourself that's one of the best High hammocks okay and we didn't use we didn't use money I believe Rob from I think that Peter help me where that money came from because we spent 650,000 last year so I don't what I'm we spent the money to buy a hammock but we haven't spent the money to recreate one that has been destroyed and that's what people don't seem to understand but you're trying to you are giving the impression to people that we're letting hammock be torn down I called Barbara pow in in Tallahassee because people are saying things and she said you know you have more green space in alamada now by the properties that you've acquired what you've replanted than anywhere else in Monroe County the only other place I know that they did it when the state bought worlds Beyond Marina cuz I worked up there for a month drilling I don't know how many thousand holes they were planning Island after Island after Island it was totally vacant okay okay so that that's we don't where do we have 100 acres of land that we can go into drill holes and plant mahoganies dogwoods pigeon plums mastic okay I don't know where all the lands are but there is a portion of the Glenn property that is degraded hammock that we talked about that could be restored and there are other properties around if we wanted to do that I mean I I just asked Lisa a month ago in a meeting I asked her in my agenda briefing to show me how much money property that we've bought and Acquired and I forget what the number was I think it was around $8 million that we'd spent in purchasing property and and we have come on I know you're just saying those trees in between the road but he's planted native trees man and I understand you're not they're a knockout I fully support that I just don't think the money that we are spending should come from a fee that's supposed to mitigate something that was destroyed by replacing it somewhere else it's very much like like a mitigation bank that you might know about in North Florida where developers pay a huge fee to wipe out a swamp and go restore one somewhere else it's the same principle so it's not about buying a hammock that already exists this is the fallacy that everybody keeps reminding me of when I talk about this it's about wiping one out and building a new one somewhere else so as the comp plan says there is no net loss and if you ask our staff if you ask people that study us Barbara Powell do have we had a net loss of hammock since the village started absolutely absolutely have we restored any maybe some and we've bought and protected a lot that I'm very proud of as well but we we the comp plan requires us to have a program to do this and it should be on the developer to go and identify a property where we have degraded hammock or no hammock and either buy the land or or somehow get it to where permission to plant on that and restore it somewhere else so what do you say are you saying that like for instance the Machado property that we should go plant trees all over that we should make every bit of that hammock we shouldn't build housing we could but so it's already cleared it's already degraded I don't know that that's a good idea to do that but I I would not necessarily promote that because I like affordable housing and that's already wiped out but there are other places that like I said by by Monty Green's place there's a 5 acre piece back there of degraded hammock that we could could improve and there's others uh that that both Peter and Daniel know about around town we've talked about a few of them and there may be some new ones we we might want to go buy some from someone so so if I can ask a question yeah so in the interest of moving this um really fabulous conversation forward because I love where it's going um perhaps a way to move it forward is to say sure I mean I think we all want trees in the in the medium um so let's find another place another pocket of money but but you're touching on some very um important issues that I know we all agree on which is we don't have a good mechanism to move forward with spending that money which we're collecting from developers and are you asking for us to give direction to staff to come back with a very clear method and plan for how to use this money or the C plan already requires it but we've 're so is the question Pete tell us how to do it so that we can methodically move forward I don't think we have right all we ask developers now to do is put some money into a fun listen if if you just want to get through this I would move that we approve this as long as the money that pays for the project does not come from Mitigation Of hammock destruction I have one more thing to say no I don't want to get through it I want this money to be spent to I want money to buy land and then put important trees on it but we're not doing it so how can we ask for that to be done we're not we're not saying don't build affordable housing but why aren't we doing this that this is a great conversation it's I don't want to say it on TV because I'll get in a fight or I'll get trouble people threats and stuff like I've already had so I don't want to do that like this this is like the the highlight of my night right here Mark what I don't understand our comp plan's 20 years old you were on Council in 2004 man what you had four years how come what why haven't we been we had to pass a a morat on development in hammocks before we could put this in place we did that my last year on the council because they were getting mowed down like crazy so we we put this in here it's a program that's in there but it's not popular because people want to build on hammocks they're worth a lot of money nobody wants to do the hard work but it's in there I'm not going to be here much longer so I'm going to make a a statement about it and I'm going to do my best in the time I have left to see that you all know about it and if you don't want to do anything about it that's on you you can explain that to people that are going to votee for you I don't have to do that we do and we all do because we all just talked about eagles well you know we're all in this but but I think what you're getting at and I and I know that you have this request I'm just not sure how to say it um is what are we asking to have happen like now in order to move this hammock conversation forward because it's not happening even if it's in our comp plan it's a little off topic to Define where the money should go but I I I think I expressed what you were looking for which is a way to move forward I will approve I would vote to move to approve this provided that the source of the funds does not come from Hammond mitigation fees and I'll leave it to the staff to determine where that is to but that's not the bigger the bigger this this question begs the bigger more important question like I'm sure we can find the money to go put those trees in I'm sure we can all agree with your motion but but that is not what's more important which is how do you move the bigger conversation forward since we are not following our comp plan to buy land and then put hammock on it or I I think the answer to that is first we don't have it on the agenda so it's not appropriate to do that tonight but if you want to put it on there I'd be love to sponsor that that conversation for for September how about that I'm on board okay you guys hold Mr Cole would you like to add that then I want it Daniel needs time too that's exactly what I was going to call out was that Daniel is waiting to speak and add something and perhaps Pete could speak or Daniel could speak to the projects uh that you already have in Q that will help to restore some of the hammock using that funding that is the subject of this conversation here right just uh to help clear kind of some of this stuff up so the landscape mitigation fund it internally we've had a lot of discussions uh with staff and we're in consensus that the funds for the landscape mitigation fund it its appropriate use is to supplement uh hammock plant plants like this project where we're planting in areas that currently are scarified and projects like that we we all agree that that's uh the way that code reads it's an acceptable use of the funds um but what's really important to understand about the landscape mitigation fund and it's a separate conversation that I that I think is a good conversation to have is that the landscape mitigation fund is not a mitigation Bank like a wetland bank or anything else it is based on a treeby tree basis it is not based on square footage of hammock destroyed or taken or developed that would be a completely different funding mechanism so although the funds can be used to purchase conservation property and restore hammock the funds aren't as equal as if you were going to mitigate a square foot of hammock the fund is not sufficient enough to actually mitigate square footage of hammock loss to where there's zero net loss the code and comp plan tells us we're supposed to have no net loss but the funding isn't there through the landscape tree mitigation fund to achieve that goal I am familiar with the mitigation hammock and what you're talking about with square footage is all accurate but I I mentioned a mitigation Bank uh because that's the same principle if you destroy something here you restore it or replace it over there and you know it might not be one square foot for one square foot but I again and I object to the not not to you but not personally but the we're confusing this by calling it a landscape mitigation fund that that landscape should be for something else a landscape fund should come from some other source what we're doing is destroying something that we're trying to protect and we're obligated to try to restore it uh uh we somewhere else so put it you know if we wreck it here we build it back there we don't go make a pretty Lane down the middle of the road that's not what that's about one is aesthetic and one is environmental the way I see it so we should stop my opinion stop using landscape mitigation fund as long as you're going to be taking the money from cutting down hammocks to put into it if you want to call it that and get the money somewhere else I'm fine with it but this is it blurs it so that people just kind oh yeah you know you cut a tree down here you plant one there that's not what the code says it's a it's a habitat analysis it's not a tree by tree analysis so we're supposed to replace the habitat that is lost and you're right you know we can't get enough money maybe we should raise our fees but we can't get enough money on each one to do that but it doesn't mean we can't try so that's my point and you're right you guys are doing great work I'm not here to you know put you under the microscope and torture you I'm here to fight for something that I helped to put in the code 20 years ago that has largely been ignored and you know we we've done so many had so many other priorities that we chased then and did I think are ridiculous but I'll save that for another time this is something that's been there I think we should address it and I I don't think we should ignore it anymore because it's very clear we have a mandate to do it so end of speech okay so you w so we want to bring something back in September but in the meantime find some different know this one great let's find some we put enough trees in there and I would give you the example of the South Winds Park we took away a a beautiful Royal Point Siana tree and a beautiful sapadilla tree which were habitat for Birds we destroyed that habitat and we replaced it with a bunch of other native uh things you know out of our our landscape funds well I think this is a perfect use of that and I understand what Mark is saying but by the same token we are creating habitat we might not be creating a hammock per se but we're going to have trees were going to have habitat from from Abel's tackle shop all the way to Hog Heaven which I think would be a definite plus well there's not habitat now I mean there's some trees in there but we're not uh you know this project that they're talking about doing would enhance that Habitat to the point where it could be more useful after three or four years of of growing and and uh expanding and rooting in that median strip could be a beautiful habitat for all kinds of birds and squirrels and various insundry other Wildlife so it's it's a it's a habitat and we're creating a habitat out of a place that there's not a habitat it's you know it's very limited and it's been uh basically taken up with the storage for the people that live on windley key but we'd like to have that change and I think this project is a really good idea to do it and I think we could we could use the funds for for uh mitigating uh destruction of habitat and and uh and create some habitat on windley key and the median thank you very much all right thanks van all right Sue S Miller lower mumi I'll keep it shorter I think that that the confusion is the fund and how we're funding it and I agree that if we're cutting down a hammock we're removing a hammock that we need to the mitigation money needs to go to restoring a hammock according to our code unless you want to change the code but there's also a lot of money that goes into that same fund that isn't cutting down a hammock I had to pay into that fund on a lot that I own because I cut down a native tree and I paid a mitigation fee it wasn't a hammock that I removed it from it was a single family lot and and so I think that it probably is a pretty easy job to go and see where all the funds have come from and say okay this portion of the money we've collected is because someone destroyed hammock property as opposed to this the agreement authorizing Village maner to expend budgeted funds and providing for an effective date okay so do we have anybody that uh for public comment for this item signed up Marney I'm not here let me double check Zoom no we do not okay so public comment is now closed AJ oh I mean it's I'm sure we all read it I don't know do I mean do you want me to just tell you what my issue is with it or do we want to go through the presentation it's I mean I'm sure we already read a it's just a new bathroom Okay well we've already we've already agreed that we're pulling it yeah but I mean it's do you need it's pretty straightforward the request is to build a bathroom at library Beach but I do you want me to just tell you why I pulled it okay or do you want to hear AJ go ahead go ahead Elizabeth go ahead just to make it brief so um I want to bring together a couple different issues here on this bathroom it's I mean the bathroom it it you know it's not lovely no one wants to spend a ton of time in there but it works but we're also facing this issue with the pool having um a shortage of sta and we're closing the pool on Sunday which is pretty alarming to me and I don't know and so when I when I see that we want to spend like about $100,000 on a revenue on a non Revenue Source over here I wonder if that we can like look at that money to look at salaries because we don't I I'm distressed at the idea of the pool being closed on Sunday when not only is it a revenue Center but it's a space it's a it's a day when kids and families are want to go swimming so you know the bathroom nice idea but is this is you know is does money solve another problem that's more important right now which is the pool closing on Sundays but is that so Mr Cole can I ask a question isn't that Elizabeth though a because we can't find anybody not about we don't know but could we could we if money solves a problem and it often does um this might be a time to pause on this and you know look at that problem go ahead Mr Cole um I believe that the issues that we're having finding lifeguards uh could be partially salaries it it may not be there's that's a continuing conversation uh certainly paying people more money can maybe attract more candidates but I think that's really a separate question from the the bathroom and if the bathroom is is in a condition to where it's falling apart um and that's what I'm hearing from our Public Works professionals I think we're confronted with that decision irrespective of where we had with you know Library I mean with the the pool lifeguard question uh what precipitated this most recently was we lost one of our lifeguards uh and we had students that were transitioning back to college back to school and so it created a little bit of a drain and and we have closed the pool in the past on certain days this is a little bit more protracted until we find a candidate to make the replacement but I I'm not sure or the two are wet at the the hip okay so I'm relating them because um I'm I'm just making the connection there and I I know we don't pay our lifeguards a living wage and and I'm alarmed that we are closing on Sundays when we have a multi-million dollar facility that so I you know there's urgency around solving that problem in my world and in my world of families and kids and you know active people um and I'm making that connection so you know is the bathroom falling apart because Elizabeth says no it's not that it's I mean it's usable is it like is it as nice as these bathrooms no is it air conditioned no I mean I you know what and I may be wrong in putting these two together I I mean I don't know AJ go ahead and yes it is it is falling apart um the the doors don't open very well um they're they're rusted Beyond repair they need to be completely replaced um those are part of the issues the uh the the dividers themselves um the partitions uh need to be replaced um I don't think the the facility has ever been renovated and I'm I'm not even sure how old it is but it was way before we became the Village um but yeah go ahead it definitely has it has been renovated before I mean in my time been and I've spent a lot of time at that park there I mean it's not beautiful but it's definitely been some renovation it it's NE here or there I I know we've put a roof on it that's the only thing that we've ever done to it hold up one second Henry go ahead with your question what are we talking about to fix this thing money how much the the um the agreement here is for 95,000 95,000 to fix the facility at the park behind the LI Li Library yes and we just spent a half million dollar for equipment this is the last phase of it yeah right we just spent a half a million dollars for that but we need another 100,000 to complete that facility right well I can't object to it quite frankly I usually object to a lot of expenditures but I guess this one is appropriate I don't like the 100,000 but it is what it is I wasn't too crazy if I spending half a million but it is what it is is I can't relate the expenditure as to the lifeguards at the pool but I have talked to staff about that as well I'll let you know what I said in a moment so if it if we spent so that much money for that area and the facility will detect from the area and whatever I guess we need to do it truthfully I think it's just something we obligated to do so that's my feeling okay so all right anybody else want to hear any more from AJ are we done so if this has been pulled John I don't know that we can you you can vote on it you just need a motion second and and you can vote on it all right prove for approval okay um do I hear a second yeah I'll make a second but I want to put it out for bid if you don't mind can we do that it was put out for bid only one bidder came back I guarantee you Henry if you go look at that bathroom you're not going to vote Yes on this but that's okay okay we can still go for this and we can still keep our pool closed on Sunday because we don't pay our lifeguards a living wage and that I'm not going to end my conversation on that it's going to be hard but I'm going to stop talking Has Come to Me by those guys over there I talked to them about it and I have want one more recommendation that you were not aware of so anyway so so so I I'll make this second to the most I like everything to go out for a bid be honest with you it it did God forbid it did it did yes and it came back uh 90,000 or whatever by one person only one B only one bidder okay I have to be satisfied with that I okay I would like to ask a question of Elizabeth go ahead I saw your eyebrows go up when I made a motion to approve and I I sensed that that was not positive on my part so I I would like to explain that you know we spent a half a million dollars upgrading the facility there and if we have a no pun intended crappy bathroom the two don't match up it kind of seems like in for a penny in for a pound to keep up with the standard that we established so I don't use that Park myself not that I have a problem with it at all I go by water it's beautiful but um you know considering the fact that we just spent a ton of money there doesn't it kind of imply we should continue with keeping it nice I appreciate that you asked a question because then I feel like I can answer it even though I said I would stop talking about this issue I want to know the answer yeah thank you and and this is with all due respect from how you know I I I know government works in a certain way and I and I I try to respect that but but occasionally you know philosophically when I look at our Parks and Recreation um if you look at that as a whole um and and I'd like to do that and I know it's not often how we work right we we we work in Pockets which again no offense and I I know I often offend people but in this case the bigger issue where money I think solves a problem is on this very expensive facility that we have right here which costs money every day to run it and and I would suggest that that we look at solving this problem and um immediately and um and if there's and I and I have heard that you know it's hard to pay lifeguards more like you know and so here's money that um that uh that we should be looking at this holistically that's a crisis this bathroom if I mean it's not an airconditioned living space it's just a bathroom it works it's super clean too I mean it's amazing I don't even know who cleans it and they're doing a great job it works I just say this I think what you're talking about is not on the agenda but I totally agree with you that it's ridiculous to close a multi-million dollar facility for one day a week we all paid taxes to use it it's crazy to do that so to solve the problem I don't know how to do it we put the manager to work he's very creative go ahead i' just like to say I've spoken with the parks director Maria batti on this question we've Advanced a number of different strategies for her to try to identify lifeguards that could be hired everything from Boy Scouts and Girl Scouts to Monroe County Sheriff's officers looking to Moonlight I've also asked her to prepare a salary schedule that she believes is commensurate with the marketplace in terms of making us a preferred employer of lifeguards as opposed to you know we we get who we can get and so I think we are heading in that direction and um I'm going to continue to work with Maria and and get her salary schedule fleshed out and see what it looks like we have to not only look at new hires but we have to look at the ones we have and make sure that those salaries are competitive as part of that uh We've also said it with our budget uh coming up U maybe we want to look at our parks and wreck fees to see if there's opportunity to increase some of them so that we can pay our employees at the parks and recre Department more money without necessarily having to put that into the levy so that it hits our millage rate and things like that uh one person advised me on that point that uh kargo charges I think it was $10 to get into their pool and ours is three I'm not saying I want to charge $10 so anyone who's concerned about me raising pool fees that's not it that would be part of a budget discussion but certainly a consideration when we look for ways to improve U salaries and the uh ability to retain people over not only the short term but the medium and long term and and so uh councilwoman jolen has a very good point about living wage and uh I think that's part of what Maria's looking at live in the moment well I need to ask in the past for example on the fills we paid overtime can we bribe somebody with overtime pay to or is there restrictions on how many hours they can be a lifeguard every day we've talked about overtime and being able to get them they have to have certain qualifications we've talked about training existing staff that could uh have dual roles and fill in for lifeguard uh providing incentives even to encourage people to get lifegard status uh and yeah there could be opportunities for people to uh get overtime and and that could be an incentive so we've talked about that as well okay all right vice mayor Mahoney um I think we have two totally different subjects here we need it's not like that's the only money we have is to fix the bathroom so the bathroom should get fixed but why can't they redo the schedule and get somebody to work Sunday if you got a close close like on a Monday or Wednesday I mean to me that would make a little more sense if we have to do it and again I don't know if this is not really our problem it belongs to the manager but I agree that we shouldn't be closing our pool but I don't see why the schedule can't be revamp that maybe everybody draws a short straw and every Sunday somebody else gets a Sunday cuz that is Saturday and Sunday are the prime days I think we're getting a little bit into the weeds with this conversation for tonight but I will say this that we did talk about scheduling and in fact when originally brought to me as an issue when this last lifeguard uh left the organization um it was a proposal to close on both Sunday and Monday and we have programs on Mondays and we have other things going on on Sundays the way the uh Parks Direct analyzed it was that um based on her uh view of the pool it was primarily non-residents there on Sundays and primarily residents on Mondays so she cons consciously chose Sundays because it was mainly a non-resident crowd rather than Mondays and then my question to her was okay if that's a non-resident crowd that we're seeing on Sundays taking for truth what she had reported to me as a professional responsible for that uh facility how much revenue are we losing because I also wanted to get the revenue equation it averages out to about $100 over the course of a Sunday right so if we're serving non-residents on Sunday and we're only losing $100 and she was believing it more important to make sure that we're open on Mondays when we have various programs that we're contractually obligated to provide and and and uh coaches and what have you have collected money to provide those programs her viewpoint of it was that it was more important to be open on Monday than Sunday so we did do the whole rescheduling thing and Shuffle things around to go from two days of closure down to one and now we're focused on the Lifeguard issue which I still um am uh of the belief that that's likely going to be a salary question and so we need to move forward it's it's overtime it's getting people trained what are those costs and hiring others can we get back we we do have a motion here and this was not on the agenda so I have a uh I know uh councilman Rosal wants to talk again too but let's go ahead and get this done with because we already have a motion in a second and Henry you what are you going to are you going to speak about this or the pool or what yeah I want to speak about the pool okay all right okay so let's go let's do the motion let's do the bathroom let do the bathrooms yeah yes let's do the bathroom so Mar we have a the pool I mean since it wasn't on J I think we're all concerned we don't want the pool closed on Sunday we don't want the pool closed on any day if we can help it so uh and we can find some money to for this part we we got so can you all work on that please yes councilman rosenfall you got the floor the dock is the one thing that produces positive income the docks Marina Marina number one why don't we spend some of that money to address this problem with the pool and how how do we do that well very simple we just pay people to get the job done I've done it all my life up the up the numbers you'll find somebody I want to present one more I present to you the Boy Scouts Girl Scouts and the police department I got one more how about the organization of joy you already said that well then I'll compliment you that you already said that be because I just it just came to me today when I got a haircut the first and and they said that so it was new to me me uh Denise had left I was going to suggest it to her she's probably watching it but I don't know she's got five or six members 100 members and there has to be somebody in there at one time was was a lifeguard so I'll was make that suggestion to you as well thank you all right thank you Henry okay so John we're going to move on to tab 14 correct yes tab 14 is a resolution solution of the Village Council of alam Village of violence Florida establishing authorization for the reservation of building permit allocation system affordable dwelling unit allocations for award to the proposed Woods Avenue development and providing for an effective date uh this is the agenda item that Council majority of council had asked to be brought back at the last council meeting um and so that that's what this is okay Jennifer thank you um I don't really have any additional information to Prov by the council from the last time this was heard um I was not at the July meeting when Council voted um in favor of waving the procedures and bringing the item back for red discussion so I'm happy to be here to answer any additional questions or or I'm happy to reread the council communication if you want um in our briefing with councilwoman jolen um it was brought up that this could be um the council could look at this as not specific for Woods ab and the council could um look at this is reserving allocations for Village use instead right now these allocations are back in the the pool for affordable housing allocations for any anybody to take advantage of and apply for uh if the council were interested in apply uh reserving those for Village use on any Village property they could reserve those um we would just have to change the resolution and take care of that so that is an also an option for the council as well so um here to answer any questions I I I have a question mhm so this got approved by Gorman they were all approved okay correct yes so the the RFQ was issued Gorman received the award um there was a agreement that if Gorman did not act or take due diligence that that would then transfer to Habitat for Humanity at the time that the RFQ was uh awarded the village reserved the units for Gorman um that res res ation had has lapsed so in we in the the staff had determined that we should bring that reservation back to you to reserve them again if we were going to move forward with the gour with the habitat proposal now okay but but you you just answer the question that I asked today was that the reason why it had to come back to council was but it was all approved all approved on the same piece of property they had the eight units reserved the only reason is because the allocations lapsed correct because of time okay I just wanted the general public to understand this was already approved yes okay Gorman could have came in picked up the permits and did what they want to do and build eight units there same thing that habitat is looking to do they weren't looking to do it we made them the default contractor well just for a little and what one second and I believe Mr Greg voted for Gorman I was on councel Mr web Pete and Mark voted for it just a little bit of clarity there were no permits approved or issued they had to come in and and go through that permit process um but the the award was approved and the allocations had been reserved they would have still needed to come in and apply for permits okay but and Henry I think you voted for it as well we all did if I if I believe I mean I voted for it I I I believe we all Pete all of us Dave web we all vot for it when this came to us so I mean we could definitely go back and check Mr Mayor we we I had a discussion with uh Mr Cole and it was a phone call but and I think I heard Jennifer's voice but I couldn't see her and I believe also um uh John quick and so I was questioning you're going to like the outcome so just relax for a second so I I was I I didn't I just want to get to the punchline I was questioning whether or not this property could be built on for affordable housing because in our code not only in our definition section but in the uh bass section it says that um if the property is in a certain Zone uh you cannot clear hammock to put in affordable housing now you can in certain zones but in this particular one you couldn't but what we discovered was a completely different loophole and I'm going to call it a loophole bass does not apply to a not for-profit Corporation in other words we don't even have to do a reservation if I'm not mistaken maybe Jennifer would agree or not agree but they're exempt from bass so they can build and they don't have to worry about my arguments about the hammock although I still argue about it but I think that's what we discussed this afternoon and it was near time to get ready for for the meeting so they may have come up with a more refined approach to that or something to refute what I just said but take it away Jennifer um no that is what we talked about I I believe that I concur with that I don't want to speak for John from a legal standpoint but um in the room at that time I think we all agreed with that our our bass section does um list types of residential development not affected or by the bass and one is um residential development activity by federal League tax exempt not for-profit educational scientific religious social cultural and recreational organizations so um we believe that habitat would qualify under that um I don't know that they're here this evening but um they may be on Zoom I'm not sure but we could confirm that they meet that qualification go ahead El you know um can we just can you refresh me Mark I think you were the one who had uh the reason that we we we had voted this down and then it came back and we were voting it down I thought that the question was to ask staff to look at whether there was another property another place that had less hammock on it where we could build or another place where we could add on additional units affordable out units in order to make these um more um more useful and and then we we we were giving them time to do that and we didn't get that that that um analysis before we decided to bring it back so I just wonder if you you know it sounds like you changed your mind or did we no longer want that analysis which is perfect I didn't changeth is the one that requested it come back we did it at our last meeting I thought Mark I didn't change our mind on it what I was trying to do was two two good things in one shot which was to allow Habitat to build more units than they had asked for and to do so on a property that didn't have any hammock while while giving us an opportunity to preserve the one by the high school which I also thought was an inappropriate location because of its uh going to generate more traffic I and on that topic I did ask Jennifer earlier how many um trips traffic trips does a single family home generate and I couldn't pinpoint it in the code but I remember reading it somewhere code or data and Analysis but I think it's 9.57 so if there's there's eight units there time 9 do the math about 76 trips a day at that location combined with the ones around the corner that's a lot of trips there so I I I don't know I'm not trying to reinvent the my argument here I'm going to lose I get that but I think it's we at least we can talk about what would be a better choice from the bigger picture but if you want to go forward this way that's your choice I'm not going to win but that that's what we were trying to do habitat is exempt from bass they can build as many as they want they don't I mean they don't have as far as I can tell maybe Rebecca jutan is listening and she can pipe in and say Mark you're wrong and crazy and and so but the way the code seems to read a not for-profit that qualifies can build as many as the zoning will allow them to without having to get any kind of an allocation it's exempt completely it's amazing code but not in a good way so we can talk about that when it's time to redo the code you can Mark uh Henry go ahead yeah I'll brought it back because I met with uh habitat and uh I voted against it and I said give me something that I can argue to make it work for you I had two meetings one actually in the office and one out of the office they gave me no reason to adjust what they wanted to do none whatsoever I was willing to discuss it that's why that's why we're doing it so go ahead I mean there are a couple of questions we could have asked them which is you know would you prefer to build eight or would you prefer to build 28 and did you ask that question because that's that I mean this this whole conversation happened five years ago I mean when and and the whole entire town has changed in five years so that I think is why we were saying is there a better place with more opportunity for the for the result of the town and and habitat's an amazing Builder who would love to take advantage of that but we're not giving ourselves the space to have that conversation I don't think anyone is disregarding this is not about habitat it's like great we have this awesome partner but what if we could even do more with what they're willing to bring to the table and what we already have I think that was why we paused and then we asked for the staff to like see what else we could do that that's what right well we did but this new thing kind of blows a hole in everything because habitat can do pretty much what they want without having to deal with bass and you know our our card in this game is the fact that we own the land that they want to build on yeah they're not in the business of buying land right so so they they I mean and again they're not here but they are on Zoom the executive directors on Zoom go ahead John I just wanted to say just one thing in terms of um habitat being able to do whatever they want we are the owners of the land so as the owners of the land regardless of what our code says if we tell them we own the land but we only want you to do eight or whatever it is as as the property owner we still retain our rights to to tell them what the whether the code would allow it or not and and the approval just as a reminder I I know I mentioned it last time when this up but it's been a couple of of months the the this is a reservation the approval for what was then Gorman and then habitat as the backup still required the the negotiation of a land lease for the property and for the development too so that hasn't been done yet either so I just want to make sure to remind everybody when I said they can do what they want I mean obviously they have to own the land or have control of it I'm sorry I didn't make that clear I thought it was kind of obvious but I don't think like everybody else nevertheless once they have our approval to do something on a parcel of land they do not need an allocation there's no State review you know do not pass or Go pass go or whatever you can this this conversation is mot because they don't need approval so we don't need to vote tonight is what I'm getting to no reservation but wait there's more right around the corner they did another project with I think nine units they did go through bass so we got n extra unit do we you know there inquiring minds want to know happen in the first a lease on that property Mark well so so if we made them use a bass allocation that was not required do can we get that can we call it back claw it back whatever the state and then put it back in the pool so it can be used by a for-profit group and then what about the ones they built across from the Marlin store and and this one and that one you want to talk about infrastructure now you're adding how many more building permits by doing I'm just talking about reality well I'm just listen to me I don't know what when you say let's find a place they can put more eight one-bedroom apartments why wouldn't we let them do that and then look at other stuff this is ready to go to me it seems like you guys are just trying ready to go I know I this makes no sense to me I'm sorry it do because this because because this was done five years ago so so let's think about that four years ago cuz we were on Council the three of us were on Council we were so land was bought about 6 years ago so what do you guys suggest because for example when we were in um in the meeting the other night with the with we were the it was the bass meeting we were talking about wow how do you deal with affordable housing someone said and she's in the audience she was saying what we need is mult multi-unit like we need apartment buildings now I know this is a rogue I mean like don't don't get all freaked out but when you think about how how to accommodate a lot of people there might be a reason to pause and and think through well I mean maybe this same lot would hold or a different lot would hold I I don't know 25 or like an apartment building rather than eight units I mean you've seen the but the eight units are ready to go and we need one better one bath but but but I mean just you know but we need I mean do we need one bed one bath I don't know do we also need two bed two bath we need a lot of different huge demand for one bill we're not basing that on any kind of analysis we're just saying we have oh I think we are we we need to open public comment Marne do you have any public comment but we're not even going to vote on this are we yeah we are well are they getting it they don't need it we're going to vote well here hold on John I mean uh I'm sorry John no I say you know what you can do I mean cuz that this was raised and honestly there were a number of things I think we had talked about we just did didn't have the time in the short time before the meeting to look through because one of the things I raised was it might have been a requirement of the RFQ or or the RFP that that it used that so because you know Gorman obviously was not a KN for profit so there might have been reasons why and and we don't have that answer um but what the council could do if it would like is it could reserve these just generally for use by The Village not allocate them to Woods Avenue not allocate them to Habitat but just generally reserve them to the Village and then that will will allow staff to to if the council wants to use it for Village purposes will allow staff the time to analyze it and then they could either be used or not used depending on on on how it falls if if the council doesn't want to do that they will just go back into the um into the the pool of available affordable housing reservations and people in the queue you know once they're ready could have access to them so um if there is an option if the council wanted to to have a vote on it again this still the woods Avenue still requires a land lease still requires a number of things um so this does not necessarily mean that we're going forward with the woods Avenue uh project whether they need be pass allegations or not the The Village doesn't have to go forward with it um so I did want to mention that there's an option if they want to reserve that um for Village use but but the motion or the resolution in our materials is to reserve them for habitat yeah it would have to be a motion to modify so yes since they don't need them we would have to have a different resolution which would be to reserve them for the village so okay Marty we have anybody signed up for this yes we do van Cadenhead followed by Sue Miller okay come on van at the meeting where you paused I was absolutely incredulous that you did because Lind l ly fast was here in the audience from Habitat for Humanity with the money and you already had reserved eight units and she said that she that habitat would build one ones now that was not done five years ago that was done on that night she said one ones and that's what I've been pushing for from from you know almost time in Memorial and listen listen to what Sharon Mahoney just said we were ready to go with eight units they had the money they had the land they had the permits and yet we had uh well let's discuss philosophically what might happen up the road at another time with more units and obfuscated you know keep your mind on the job that you're trying to do one job we could have done that that night there could be eight units under construction in the permit process now on Woods Avenue if you just had stopped and paused for discussion and and and kicked the can down the road it's totally useless totally useless we could have eight units of one ones under construction now except you had uh uh second thoughts well you know you make a decision stick with the decision plan the move and move the plan we could have eight units under construction now and I would urge you to move forward and not dither with some something in the future hypothesizing and philosophizing and analyzing two paralysis thank you very much thank you van Sue come on S Miller lower matumbi I think that it's important to pass the resolution reserving the eight units for the village for administrative relief and proceeded with doing an analysis it is shocking to me to see you sitting here questioning whether or not um a not for-profit can can build an unlimited number of dwellings we have evacuation issue there's so many issues I mean this is shocking that you you are even in this position 25 years later that you're you're all of a sudden realizing the museum was built without going through bass may I say Museum Conference Center was built without bass allocation and um and so everybody knew at one time that that we have a problem I mean and not for profit that can build unlimited dwelling units without thank you very much thank you Su Marty anybody else we do have Lindsay fast um okay all right get her up here um do you want Mr wishm to speak before Lindsay would you prefer if he's go ahead whoever with if both of them we'll let Mr wishme go first okay go ahead yes thank you very much you know with all the discussion that we always have about affordable housing and with the permits that you give and most of what is built really is not what I would consider affordable housing for the Working Class People how many times do you see people willing to build an actual apartment building I can't remember of any in the in the last who knows how many years so for this to be a one bedroom one bath where people could actually afford some of our bartenders or School teachers I I don't understand why you would even have any second thoughts about improving this so I would hope that you would go ahead and make affordable housing in the Upper Keys and specifically Isa marada where here to do whatever is Task is that we can do within our constraints of course um I will second what I said previously at the June meeting that we are ready to go with these One bedom units um I will also say that anecdotally currently the main reason that we are denying renters is because of occupancy because they are single renters so I do think the need is there and we're we're happy to fill that need and we're ready to roll um and I do think that we would continue to be interested in any other opportunities that come along and um you know just based on what the village needs are we're we're here to work with you guys so thank you Lindsay okay anybody else Marne nope okay public comment is now closed um do I Florida adopting the Alam Mar watershed management plan providing for an effective date okay thank you Megan hi yes I'm Megan RBA the flood plane CRS coordinator here at the Village um I'm here to introduce Aon Dei who is here in the building and also Lori Lear who's on zoom and they're going to give you a short presentation to tell you what the watershed management is and why we did one so I'll let them take the floor now thank you thank you sure Lori Le is going to take over the first um part of this presentation and she is a known Statewide expert in the community rating system program and just briefly if you're not familiar with the community rating system it's one of the best programs that a local government can engage in because the better you do in the program the higher reductions you get in flood insurance premiums for people within your community so it's a program where you invest in program you work the program your your um constituents really get back um and we know in an area where we have high flood insurance premiums every discount that we can get in in those policies is really important so I'm going to go ahead and stop there I don't know if I have a clicker for the presentation [Music] okay okay so Lori go ahead and take it away all right thank you very much um I just want to say that uh we have been really excited to work on this project we we feel like we were the forerunners um taking this project to the state using the the state grant money um to be able to produce this uh this watershed management plan it was one of the first if not the first out the gate to be reviewed uh By fdem and By ISO and it with a really very favorable outcome so kudos to the community and being the Forerunner and showing everybody else how it's done so it's been a really exciting project for us to work on so I'm really excited to present it so as as Aaron said um I've been involved with the community rating system for I'd like to say 25 years but it's probably been more um and I have always been excited about this program it is a quantifiable program uh you as a community can actually hand a dollar figure to um those folks who have flood insurance policies by the good work that you're doing in your community under this community rating system it is a voluntary program so you all did volunteer to uh become involved in 2015 and it does not only encourage to um exceed minimum standards for flood plane management now the way the program has evolved it actually requires higher regulatory standards things like one foot of uh free board over based flight elevation and things like that just for participation in the in the program at anything more than an entry level and of course for all the good things that you're doing what you hand over to your community are those uh flood discount on their premiums on an annual basis so the goals of the community rating system while the the flood insurance is the incentive the flood insurance discount is the incentive um really what what the goal of the whole program is is to try to minimize uh some of the flooding damage that happens and that's by all of the different activities that you participate in um also we know that the the the national flood insurance program can't um can't keep going like it's going we need to build uh safer more resilient type of structure so we so we're not paying out on those structures all the time after every kind of event and the CRS program encourages those and credits those kinds of act and fostering um comprehensive flood plane management that that that CRS could do that we've seen it in the keys we've seen it everywhere and I I am now a believer that when you get involved in the in the CRS program it's an all Hands-On debt kind of a program and it does Foster flow plate management throughout all of your department or the aware the awareness of it so the community rating system um has about 1, 155 this changes two times a year these numbers of participating communities across the United States um and on the next slide you will see that 244 of those um are located in the State of Florida so we have working the program from the federal side we have three different folks who work Florida um and in the rest of the nation um a specialist or an auditor will be working several States so we we're densely populated with CRS communities and we are the highest participating State as far as highest classes and biggest discounts so uh we really have not only Isa Mor has a lot uh of good things to a show off in this program so it is the whole state so we're pretty proud of that um so how does it work it works on a point Sy Loosely on a point system there is a point system and there are lots of prerequisites but um 10 is out of the program you're not in the program at all and nine is entry level and you need 500 points to do that and and many other things and that gets you a five the um 5% discount for each one of those classes that you move down the scale so one is the best class uh 10 means you're not in the program at all uh and how do we earn those points so this is this is a very very uh High flyover of where the how the points are broken up we have public information we have mapping and regulation we have flood damage reduction and flood uh preparedness but under each one of these categories there are subcategories and elements which is how you actually get the credit and and there are about 105 or so ways that you can get credit um under this this program and then under those there are some subredit elements where you could get partial credit so there's many many ways that um a community can participate they don't have to participate in everything but obviously Isam Rada is participating in a lot of these different activities because of uh they're very notable class five it's a very very uh prestigious place to land in the program uh so so like I mentioned we came in the program in 2015 as a CRS Class 7 with a 15% reduction in nfip premiums um had a modification in 2016 I was I was around for all of this and saw it happen and in 2016 they improved from a seven to a six uh hung around there a little while we had Irma to deal with and so none of us did did much uh much other than deal with um post disaster recovery for a while there and then in 2020 um the verification uh said that you all could that that is Mara would be eligible for a CRS class 5 so um that's quite a quite a great run through the program and now the goal of the watershed management plan there like I said there's lots of prerequisites but to move any further in the program um the the prerequisite that that we needed to hit would be to have a scoring that scoring in the CRS program waterers shed management plan adopted and effective in uh Isa marada in order to qualify to uh apply to be a CRS class 4 so not only does this plan uh help you plan for the future and and and and all the things that Aaron's going to talk to you about that's in the plan but it also checks the box for having a watershed management plan that meets the criteria for CRS so and you all scored very well on this the average score for these plans is a 120 points uh because you have dedicated funding for Capital programs uh you were able to capitalize on a few more points and got to that 145 points so that's a really great scoring plan uh for Florida and certainly met all the goals of the fdm grant process and for CRS uh movement in the program so um and here is where we're gonna uh let Aaron take take and get to the more technical issues that are included in the watershed management plan and the process we went through to get there thanks Lori so about two years ago the Florida Department of Emergency Management created a granting program through some Hazard and disaster relief funding and the whole goal of the program was kind of like Lori said was to help local governments improve in the CRS program give them money give them money to do what's known as this watershed management plan because it's a prerequisite to break that ceiling and get to a four um so the state put out 7 75% cost share grants and they were amenable to using the uh the ISA marada cost share coming from the vulnerability assessment that we just finished up in June so there was no money out of pocket for the village to do this watershed management plan um all five municipalities and Monroe County are completing a watershed management plan right now uh the county is currently at a three um so they've they've made some great strides but have to update their um watershed management plan I know of no other jurisdiction in the State of Florida where a county and all of the municipalities are equally participating in the CRS program um so what are the differences we just completed the vulnerability assessment in June and the key difference between that and a watershed management plan is the vulnerability assessment has certain criteria spelled out in State Statute we have to look at all of your assets including but not limited to your storm water management system it includes electric utilities um it includes uh hospitals any other assets that you have within your community a water shed management plan is very focused on your storm water management system it runs a higher level um more intricate model um called icpr and that model was run and basically what it does is it looks at the functionality of your storm water system under different rain events but you also have to factor in the 2100 sea level rise projection into that um this is a federal program and they they want to see that um recently you all have launched a storm water master plan as well and that that just launched I believe in May of this year that storm water master plan is going to take the work from the watershed management plan and get even more granular that's going to give you precise projects precise cost estimates it can help support when you go and revisit your storm water utility rates next year or a subsequent year you will actually have costs operations projects um so these these plans all kind of have similar information but they're different plans different purposes and different criteria here we go um so we have to look at the 10-year 25y year and 100-year rainfall storm events we have to look at 2040 2070 2100 and we have to adjust that for sea level rise the out comes of the watershed management plan were to Define five basic project areas where we think that there are improvements that can help with this these different rainfall events at this point very conceptual projects have been developed but those will have to go through further engineering and design to get to a a really accurate um level of cost but we do believe pursuit of these projects can be translated over to the storm water master plan and can help that that effort as well and it's the same model that's going to be run in both um projects so what we were able to find is establish a threshold that if a road was getting more than 4 Ines of flooding that was not going to be acceptable for our level of service for flood risk and so we were able to find in Project areas one and two if the projects were implemented the model says you're going to be okay for project areas 3 four and five by 2025 accounting for the king tide scenario which are the highest high tides that we get in October you would be okay implementing those projects this kind of breaks down those five project areas um the more detailed information and the cost information is in your backup in the actual document but essentially what you're doing is adding um detention areas improving your swales um we looking at adding a a storm water Pond pipes inlets to capture runoff these are the types of you know they call pipe and pump type projects that you're going to need in terms of um storm water management in the future there we go um so more refinement is going to need to happen in that storm water master plan adopting the watershed management plan through the resolution that you have in front of you tonight is a requirement of the CRS program to get points um we have already done a preliminary review uh with the people that review and approve the watershed management plans and they have told us that we're going to get credit in three places 145 points and 145 points is really pretty good for a watershed management plan especially when you're already around 2600 the goal is to try to get to 3,000 you know this puts you at like 2750 so Megan and Lori have to find those additional 250 points to get you to that next um class certification but that's how the program want Works uh this is being closed out right now the grant is being closed out it's been accepted by the people that review it for the CRS program and by the state of Florida so we feel very confident that we will be able to get those points awarded for the program and that's it um again this is one of the few programs that you can participate in that gives direct benefit back to your constituents with reduced flood insurance premium so the more you participate the better outcomes in the program the more your people are going to save that's important does anybody have any questions for I think so um we have had a couple of ordinances this is a I know a resolution we're going to adopt in the past that deal with flood insurance regulations and I think Megan and our planning building official were involved in that and so some of them have an impact on homeowners as far as their costs and I wanted to know if you could address that in comparison to say the savings the 5% or whatever so uh for example you know we had an ordinance one I complained about where we have downstairs enclosures and uh we were prohibited from Air Conditioning those because it encourages people to live in them but other people use them for storage cars and other sensitive things so I made a complaint about that uh and I I think we did okay with it but I don't even remember but nevertheless for every benefit there seems to be a cost so can you help to just guide us through some of the things I mean I tried to read this quickly I didn't get a chance to study it carefully like I would but could you help us to how an average homeowner might be affected by this or someone building or re rebuilding their house could be affected well I mean the first thing obviously is the reduction in the flood insurance premiums but you're a pretty active participant in the program already right now you're a class five so that means you have adopted higher regulatory standards and other ordinances and Provisions that you have on the books Megan can probably give you an overview of the other elements of the program that you might be referring to um but that downstairs enclosure um issue is why it's been so hard for communities in the keys to participate in the program and what kind of got you kicked out of the program to begin with not you but that's that's the issue that you couldn't participate so it was resolving that issue and I can tell you the person that's probably most responsible for helping get that issue resolved and getting communities in the keys back in the CRS program is Lori lir I just want to state that we received a grant to execute this and our um we were matched we had to match 25% so I I just wanted to mention that explain thatch came from the mitigation Hazard M um Hazard vulnerability study fund so it really didn't cost us anything is what right exactly I just wanted to point that out cost wise well done yes so I don't have a full report on all of your participation within all the activities of the CRS program but to tell you at that class rating of five you're going to have to do better than the average Joe in terms of those types of regulations with um elevation and rebuilding and substantial Improvement and that type of thing so the things that you have in the place right now are helping you maintain that class rating of five and where you're going to need to go is find additional points within the program to get you to that that 3,000 and we already got you about 150 of that with the watershed management plan so it's it's coming I mean just this year uh the state passed a heightened real estate disclosure um provision that requires people to disclose if they've had any federal assistance or made any federal claims on property so it's coming at the state level it's coming from the nfip level um you know so you can't really sit on your laurels in this program you have to be constantly looking for ways to improve okay I I didn't have any other questions but I did want to say I've attended a couple of seminars that you've presented to uh League of cities and some other things and you're an outstanding professional in what you do and we're lucky to have you and we sorry we made you wait so long tonight to oh that's that's okay um so yeah oh something just flew in my shirt there that was weird sorry um you know it's the keys you're used to it you take it from everywhere yeah exactly he's over here now you okay great perfect my friend um anyway so your next steps after adopting the watershed management plan you've got a class certification coming up or a class visit two years in two years you have one just one last okay so that gives you time to go find those other 250 points because the goal really is to get you um to that class 4 and those 30% reductions question so justly you're creating a list of these projects that have to happen so that's a great question I mean so what we did here is we identified conceptual projects that could happen in some key hotspot areas you have launched that storm water master plan and I'm assuming I I'm on that project it's a year I think that that project is going to take place and that will give you a higher level of design a higher level of confidence in those cost estimates and then you will be able to fold that into your Capital planning I mean you'll have two elements of that you'll have capital projects and then you'll have additional operations and maintenance of your system and usually the next step is to look at that in the context of your storm water utility fee and see if you need to make any adjustments in that so you got a while until that's coming but it's coming you know instead of going from broad conceptual plans to actual projects what do we have to do when do we have to do it and how much is it going to cost great thank you sure thank you we public comment have anybody speaking on this speak yes man Cadenhead I turn the mic on I'm van Caden head and I'm real old and I've got CRS myself that's can't remember stuff but one of the things I do remember is uh our dog park has elevation of 12T above the the swimming beach and i' just like to know what the uh chances of improving our situation uh with this program would be uh if we leave the dog park where it is and continue to pollute the swimming beach and my other thought is tea table we have gone we have gone from uh uh on tea table a vzone which prohibits filling and building in it because it's a coastal zone that's prone to flood and somehow or other uh a request was made by the developer to FEMA to have it changed to an azone well I'm not aware that this ever came before the council or was discussed or was publicized or anything else but I'm under the impression now that uh tea table has an azone which can fill which can be built on now to me it seems like uh we're creating a problem because sea levels are rising and every time we have 5 Ines of rain in an hour which happens not infrequently in this location um we're creating a problem for ourselves by doing this so I would question the the I think we should revisit the change of the flood zone designation on tea table and I think we should revisit the opportunity that we have to relocate the dog park to a higher place that's not directly above the swimming beach thank you very much thank you again I I don't know how to interpret this I mean there's a lot of material here a lot of imagery there's a lot of like you know charts and things like that but I don't feel honest about voting to approve it when I don't fully understand it I I can't articulate this to someone else other than to say it's going to make your flood rates go down that's the good news I get that and I'm in support of that but I mean is it going to make it more expensive for somebody to repair their home or um will it cause them to have to make um changes to their house if they have a flood and they uh and they need to you know like with FEMA or something with she's Notting no so that's a good sign so I I I just don't know what impact it's going to have on someone other than uh the obvious benefit of the flood insurance reduction on the individual property owner the answer is no I mean this is about your storm water system your operations and the whole goal of the watershed management plan is to identify those areas that are going to be impacted by rainfall or rain fall in combination with sea level rise account for them and improve them and so what we have in there is a list of conceptual projects about how we can improve drainage and improve storm water management under conditions that we know are problematic today and in the future if if someone were to come into the building department and planning department tomorrow let's say we adopt it tonight and they wanted to do an addition on their home or do some remodeling or even put a new house in um would these regulations would the some of the things in here be this is not this is not a regulation well I that's the another question what is it because normally a regulation would be done by an ordinance and this is a resolution this is a this is a plan U the resolution is to adopt the plan right there's nothing that says that you have to implement every project in that plan there's nothing in there that has a regulatory Trigger or changes your code at this time this is for further deliberation how you want to implement the plan going forward is entirely up to you what resources you want to put into that you may want to wait until you have your full picture with your storm water master plan and have better cost estimates and then figure that out Through Your Storm water utility and your rates and and how you cue your projects but there's nothing that commits you to anything from a budgetary or a regulatory standpoint in that plan the recommend if I could re repackage what you said in my way of thinking about things if we were to adopt this tonight um and then someone were to come in and speak to the planning department or to the building department this wouldn't have any effect on that just yet would there until corre formally adopted so there's more work to be done at this table before this thing becomes either a benefit or a problem for someone correct this is a blueprint okay okay I'm I'm um we had an evaluation committee made up of five members who reviewed those proposals and ranked them in accordance with the um ranking in your package um we have made a recommendation to um approve the ranking of inspire placemaking Collective Inc as the top ranked proposer um and to move forward with them as the consultant to update the comprehensive plan I'm here to answer any questions if you have any hey Council anybody have any questions for Jennifer I don't have any questions because I haven't had a good chance to study this and part of that is is my problem because I was in North Florida in the hurricane and didn't get back till uh last night so I don't know if you guys would be interested in looking at this one more day and voting on it tomorrow night um I might have some questions by then but if you want to vote tonight I understand that that's just I I I you know we've I would say that U before Elizabeth and um Sharon joined us here we had some done some work I think buddy you'll remember with Calvin gardano and Associates as well as the cordino group great so I know they're familiar with us so it's U it's a little bit surprising that they didn't do better here I don't know if the cost Factor was part of the decision there but I I just wanted to look at this a little bit more and and process it some I I I I'm not saying the staff didn't do a good job or that they're so much cheaper that concerns me is is it a total comprehensive coverage or they just picking things out to fix because to me that's a big Financial difference and I I would almost like to see the first in second place uh uh applications myself I think you were provided with all the proposals oh really see I didn't look at them all either but all the proposal well not all um there all but two were uh complete uh updates of the comprehensive plan two were just updates of the E which we've already done we did um last year so we're in we're in compliance with the E update so um those I think ranked a little bit lower that's why Corey Dino I believe was on the lower end of the scale because they were only proposing an e update um can I ask a question um would it be possible to because the point spread here is very um close is there any way that we could hear from these this group would that help anyone here these various groups this is this is a big decision I think we should would would that help anyone in this table go ahead Henry my conversation is this is this is probably the most important I agree what we'll do for the next 10 years it's huge yeah that's and so far the staff had not been able to handle it I question their recommendation one of the things I was at the meeting one of the things that they spoke of very lightly and and denied the privilege of having these proposals and the people involved to address anybody that I would have hired with this impact I want to see them in person I want to talk to them I don't pick them over an application come on now common sense is better than that I shouldn't have to even talk to this am I do you agree with me absolutely this is a really really big decision this is yes it's major major I agree and you Den not the opportunity for the PE people involved with their proposals to come we pick managers they stand over there and they talk to us this is bigger than the manager that's ridiculous okay so if I can just speak to that um there was some discussion about um having the top two um proposers ranked proposers come in for an interview amongst the committee but um we heard loud and clear from the council that this was to be an expedited process um at several Council meetings the council did ask for an expedited process I I specifically think in the July meeting it was asked for an expedited process so we were looking at it as an interview process would take longer and so not to defend our choice but that was where we were coming from in that process we are happy to do whatever the council wants to do recognizing that this is your decision but to defend our choice it was to give you a decision sooner rather than later you did what we asked yep yeah so would there be a way to to bring these people in like Tom for tomorrow's meeting I mean you know wh why they're not all available on how do you know I mean they're they're interviewing for they're going to have to prepare
