afternoon van Caden head here from Alam marada um the Florida Health Department is monitoring the eoli bacteria in the waters of 10 different beaches in Monroe County the worst one it seems is uh the most frequent flyer on the on the closed list is the Lagoon Saloon Lagoon and uh I just have to remind you that 25 years ago when they wanted to put the dog park 12 feet above the swimming beach I said it was not a good idea so for a little turn down memory lane you've got a do do do do diligence at puppy poopy Park it's uphill from the playground don't go there after dark you could step on a floater on its way down to the Sea sailing down to the swimming beach like a little brown submarine you got a do do do do diligence at puppy poopy Park they got a giant fire hydrant for puppies on a LK used to be a lighthouse the land shark bit the center from the people's promised land and left them do do diligence to seep into the sand you got to do do do do diligence I said that this was going to happen 20 years ago and but what do I know but now suddenly you can't bring the kids in the summer programs into that Lagoon because it's contaminated it's polluted and what's it polluted with it's polluted with puppy poop it's polluted with not only that but but human waste also but we're on the Bay Side here that was a really bad idea 20 years ago and I think you should really radically consider moving that to where it should have been in the first place where it was first advertised as a 1 acre Park up by the Admin Building that's how they got it approved in the beginning with the First Council and then suddenly it it expanded into three acres of of property that cost a million dollars an acre so we've got $3 million worth of dog park sitting there on the highest piece of property the best property that used to be parking used to be trees used to be a place for people to be and now it's all closed off fenced in treed in and just for the people that own dogs who are less than 10% of the people in Isa marada and even fewer of them will bring their dogs in there for fear of disease so every time it rains um once again you get sheet flow you get saturation you get everything that goes down to the water level and every time the tide changes the water level goes up and down and sucks that stuff right back into the into the Lagoon so if you want to head this problem off seriously think about relocating the dog park thank you very much man Marty anybody else no sir that's it no public comment all right go ahead if you want public comment Deb but you we need to make sure you fill out a card before I do I didn't know he was is going to talk about the park Deb Gillis um I believe if you dig back in your records a year or two ago we did a study uh Isa marada did a study I don't even think I was on council at the time on on what was causing it and they determined that it was not the dog park that was causing the problem I don't think they determined you okay all right all righty so we're on the tab one y uh tab one is a preliminary rate resolution of Island Mar Village of violence Florida relating to the collection and disposable solid weight Solid Waste within the village for fiscal year 2024 to 2025 establishing the estimated assessment rate for Solid Waste Service against assessed property located within Isam Mara Village violence for the fiscal year beginning October 1 2024 through September 30th 2025 directing the preparation of an assessment role providing for public hearing and notice thereof and providing for an effective date Lisa good evening okay okay um good evening um we are here tonight to discuss the solid waste assessment which is an annual assessment that goes on the tax bill in November and um what we're here to do tonight is to discuss just a preliminary rate uh we will have the final at the August 7th meeting which is just a week away but we want to go ahead and talk to you a little bit about um you know what's going on behind the scenes we do have um ajs here from Public Works to answer any questions you might have and also we have our Island disposal Representatives uh Jim Wheatley and Brian lindback are here to answer any questions you may have um I'll begin with um the background on the assessment um well on the solid waste collection we did have last year from October to December we had uh a different company as you recall it was waste management so we had them from October to December and then it was voted on to change to Island disposal as of January 1 so we we've had Island disposable disposal from January through now and um they're doing a great job I think in our community been very easy to work with on my part so um Jude his wife's she's a really nice a very a hospitable person that you know I talked to her about the billing and that kind of thing um so anyway that's been the the transition where we are so what we've done we've spoken with our um with Island disposal about the rate increase for next year um and it's proposed for January 1st of 2025 so what I wanted to do is bring that up on the screen for you will bring that up okay can y'all see that so what we've got here is the rates that were that we had for last year and that's under the well that's for the current rate it's under the First Column column number three under current so those are the total rates that we paid 4101 for residential service um this this year and the proposal on that um they are allowed by their contract to charge us the CPI and that's the Miami d uh CPI rate um they're allowed to charge that which is 3 and a half% as of June of 2024 so that's uh what's there and so the rate that that rate increase that they've proposed is $446 as you'll see so it's not a real big increase there um so that's that's what they've proposed there and and the other rates at the bottom are going to be for uh commercial rates but the commercial rates are uh build directly by Island disposal we don't do any of that billing um and all that we get from that they just give us our franchise fee on a quarterly basis so um we get that from them and that's been about probably a be about 600 $600,000 this year so um that does go into the general fund so it's not uh part of the solid waste but we do get that in addition to and as I understand it last year I don't think it was build that way I think we had to uh there was some other kind of agreement worked out but we just get the franchise fee they do all the billing so that's a big help okay so now those are the rates there so what we'll show is let me just read this to you on the coun communication um so this the proposed we also have answer uh that used to be GSG Government Services Group I don't know if y'all are familiar you're probably familiar with them they do our they do the rate um calculations for us as far as what they think the number of um they do it for the water the Wastewater and the solid waste and what they've come up with this year was uh proposed rate of 490 per residential uh dwelling unit um it was the same rate that was a adopted in the final assessment resolution last year and uh that does establish August 7th as the date for the final hearing um and then you'll be asked to approve the and adopt the final annual rate resolution articulate the rate of the assessments and approve the assessment role and direct and authorize the method of collection so um the budget impact for that will be uh it'll be 490 times the number of well pull up the next slide if you would Vince so uh can you make that a little bit bigger it's a little hard to see no not any bigger um anyway so what they've established answer gave us the uh estimated number of residential units in that far right column that's highlighted in yellow uh that is 4418 and so we take that times the 490 and that will give us our gross revenue of 2.16 4820 and then what we do is we estimate the early paid discount so if if for instance you're paying early on your uh tax bill then the first month you get a 4% discount the second month is 3% so we go with the three because I think you know most of the people will probably be in the second month there that shows our R our net revenue of 2.99 875 uh so then we take that if you go right below that that will give us our revenues for the year and that's um and then interest Revenue which is it's really hard to estimate interest Revenue because with interest rates fluctuating right now we're we're getting quite a bit on our interest but um so you add the 10,000 to that so you come up with 2.10 9875 for our Revenue then we will have the expenditures at the bottom and that totals 2.4 million if you'll see at the very bottom there that's got the double underlines under the operating line and then so the the excess we have over there we actually have a shortfall there um so that's the what was voted on last year I believe is my understanding is that 490 was the rate that you decided on and um the the rest of the money the shortfall would come from the general fund which is the collections of the assessment for the commercial the franchise fees so that's um that is what again we are proposing this year and so um it's up to council to decide how they want to do that the maximum rate we can go with we can go with 490 as the minimum and the maximum we can go with is 550 so um it's just depending on you know what you want to show there um whether or not you want to have um have to transfer from the general fund or not and that's basically what you're doing buddy okay um just wanted to add a little bit of of background as well um what happened back when we transferred to Island dispa was that waste management was about to increase residential disposal rates very sharply so part of the conversation and setting the waste rate for single family homes revolved around that concept waste management is going to increase wait the rate sharply our DPW team uh was very good at finding an alternative to waste management we brought in Island disposal and while the rates did go up and some of our residents weren't quite happy with the fact that they went up um the rate increase they would have otherwise experienced had we stuck with waste management was significantly blunted so in other words the rates did go up but they did not go up as much as they would have had we stayed with Waste Management so Kudos everyone involved in finding that alternative that's one part but as part of that con discussion and the rates going up that was what we as staff have been advised underg guarded some of the decision to go with 490 and then keep it at 490 again for this year just to help people adjust to the increase in this in the waste rates themselves but after this year we'd have to again look at whether we should be increasing the solid waste rates for residential because of course if we're subsidizing ing as as Lisa had shown um the solid waste contract fee with revenues from the franchise fees there will come a point where as that amount of subsidy continues to increase we will eat severely into the franchise fees and be upside down financially so at some point we have to budge off of keeping it the same at 490 and starting to increase it just to keep up with cost of weight waste disposal because as we've seen there's about about a 20 what is it at least a 24 27% increase in some of those charges and in speaking with the county the reason for that has been cited as the increased cost waste management is experiencing and finding landfill space H right as landfills continue to fill they become more scarce scarcity in the marketplace results in higher prices and waste management is having to drive farther to be able to get rid of the waste than they did before and driving waste any distance and finding new sources to put it is very expensive so that's the explanation for the very large percentage increases on the disposal side of the equation I've learned they're trying to come up with a rail solution which should help long-term uh decrease Transportation costs which are a big part of why the rates go up but that's not a near-term solution so in summary 490 last year 490 this year future years following this budget cycle will have to really focus in on how much and how to continue to escalate those fees to keep up with these costs that uh that we would be incurring on the expense side so I wanted to add that additional detail buddy thank you rob go ahead Henry couldn't have said it better myself um I'm going to make it short I'm in agreement keeping it at 490 I'm also in agreement to using the source of the franchise fee which is part of the general fund it is separate but it's still part of the general fund to uh cover the expense that probably it's at 27% I think it's 27% is the overage right so I'm going to make a motion to we need to have public comment Oh I thought we had it oh that was for the other I'm sorry okay I agree with you but let me let's have public comment okay thank you okay I will we have anybody wants to speak public comment yes van that I would question uh the commercial and I understand rate increases because I have a business of my own everything increases but this doesn't stop the rate increase to your commercial businesses and on this piece of paper it talks about what the rate increase will be to your commercial businesses um I just wanted to point that out because the what you're voting on tonight has nothing to do council support of the enforcement uh of a No Parking Zone on L key providing for an effective dat AJ all right good evening um so hopefully this will be pretty short and easy for you guys um and for us to establish no parking zones it is written in our code that we must come to you guys uh to determine those locations and uh get approval through resolution but these locations is um along the old highway on windley key uh on both sides of the road is what we're establishing uh FKA is as you can see now they're out there doing their water main replacement um and we need that kind of area to be open and free for um as a work Zone area it is a highly used area and with a lot of storage of of vessels vehicles and um trailers and and other things of that nature um but we are looking to to add this area as a No Parking Zone and establish the the proper signage and everything required uh for the with the help of monora County Sheriff's Office to help enforce it anybody have any questions for AJ I have a question please go ahead Mark thank you Mr Mayor a AJ I've read the resolution that's proposed for us to vote on here and it's not Crystal Clear it's pretty clear about the exact area that will be impacted here uh and could you give us maybe a little bit more detail as far as some landmarks in other words does it start say for example at Hog Heaven and go all the way down to um almost to um the PA Bates Motel down there I can't remember the little there's a little break in there before we get to the affordable housing project but could you just kind of tell us where we can visualize the extent of the area imp impacted please no problem so the area that we've included is as you spoke of uh from Hog Heaven at the intersection there um where it comes from the old highway to US1 heading south and we've included all the way down to where you uh Old Highway merges back on to um to US1 down by postcard n um there's already some established no parking zones there but we didn't want to leave any gaps in there and everybody just moved from one location to the next and just kind of move those issues on so to establish that whole area um whether it's you know completely uh signage and necessary but it would would be established as as us having the authority to to put that no parking signs up and to make those uh adjustments as needed I understand that was great answer thank you rob thank you mayor uh I'd just like to add one other bit of information then that is this area that's designated as no parking is also going to have a landscape restoration project to help with the corridor Aesthetics and and having that no parking there will help to protect our investment when it comes to the longevity of those plantings and and their ability to survive and thrive so uh that's also an important part of this of this uh particular request before Council okay so that will come after the aqueduck moves through there correct correct okay yes yes all right AJ anything else anybody got any other questions for AJ all right all right uh public comment Marne we have any public comment yes van Cadenhead and deep goas okay van Cadenhead uh I'm very much behind this project I think it's long overdue and uh the it's been used for storage by people with their trailers and obviously it's not overnight because there's like fourt of grass growing up through the trailers so my only uh admonition here at this point is that it becomes a resolution with teeth and not just something on a piece of paper I'd like to see it that it's enforceable and then it's Rumer to the Village the the sheriff's department is going to be administering the tickets from the no parking Zone and I would I would hope that they would include on the sign that says says no parking no parking Tollway Zone and then have uh uh someone that the Sheriff's Department's going to contact to tow them away to a yard and not let uh 48 Hours go by or a week go by before we get it towed it should be towed quickly and it should be put on this yard a storage yard where the the towing and the the storage for those pieces of equipment be they trailers boats cars RVs whatever it is that's there does not need to be there and it needs to be gone in a timely fashion so I would hope that that would be reflected in the signage and I would hope that the sheriff's apartment would uh give special uh attention to this area which has long been an isore and a problem uh you know people going back and forth across the road to their vehicles uh you know it's a health hazard it's a traffic hazard haard and it's our property basically and we've received nothing for it and the village owns that property so people have been essentially storing their trailers and boats on Village property for free for years so this I commend uh Mr Cole for taking the bull by the horns here and let's get this done and let's make sure that whatever resolution that you put here uh the Mr uh quick assures that this is going to be a resolution with teeth that can be enforced that will be Rumer to the village and not cost us money thank you very much I appreciate it Deb Gillis Alam marada so um it has this this area has been used for years for parking and it was always said that they could use it for parking um now that we want to change the rules I I don't have a problem with but I might suggest that that we figure out a lot up that way that we transform into a parking lot that's not for free but a place that they could store some of that stuff um I don't know whether there's anything available up that way or or what but that's it's just a thought because um those people have for years you know they yeah it's boats and trailers because it doesn't fit inside their property we all know that there's parking issues in Isa marada all over the place we've we've always had and we probably always will have parking issues um I think there's restrictions on it but the the the uh lot across from postcard in that um that the do actually has I don't know it's a might be a possibility of using as a paid parking lot I'm not suggesting free but a paid parking lot but I think there's other restrictions on that I just don't remember for sure thank you thank you Deb all right anybody else Marney nope sir that's it public commment is now closed AJ don't we we have a lease or we had a lease or do we have a lease on that property that Deb just described the what F where Michaels is right now so that that property is fdot right away and we do currently lease it at um I think a zero expense or maybe it's a dollar but part of that is yeah we cannot collect any money or make any money right okay on any of the use of that property all right thank you anybody got any questions I have a question please mayor um this is really directed to the manager and uh the village attorney uh I'm just reading the uh the proposed resolution and section two describes the area where the working will be effective and I I I the lawyer in me feels a little uncomfortable with the word approximately it says approximately mile marker 85.4 to Mile Marker 8 84.3 I'm wondering if if if you tell me you're comfortable that that will not pose a difficulty when it comes to enforcement where someone says for example it's not specific enough uh as a possible to fence if you're comfortable that that's okay and we can work with that I'm fine with it I just wanted to ask that before we passed on it and that's the end of my comment thank you uh you know one thing I can suggest I just mentioned it to Rob and and I think that we could do to maybe to ease council member Greg's concerns is as part of a motion uh direct staff to attach a uh photograph uh depicting the exact locations of the no parking Zone and we can attach it as exhibit a to the resolution okay all right and so if you just if there's a motion to approve it would be a motion to approve and including directing staff to attach um uh a map depicting the specific areas okay all right so do I hear a motion you have I have a comment okay um you know um this this is I'm I'm happy we're having this conversation and and I would applaud this Council for um taking some action in addressing the fact that we are um that this this body whoever sits here is now in a position to respond to the fact that that we are um our our town is now full and um we've spent lots of years sort of not realizing I think in the haze of I don't know the sun and the salt or something that um and not responding to the fact that we're getting that we're maxed out and so while yes people have always parked in this area it's been one or two trailers and you know 10 years ago and 15 years ago but now it's different and and so just like we're addressing the um the the swim Zone issue I mean this is this is what this group does so um I I would say you know great let's move forward on this and um and I think other and more difficult decisions will be in front of this group or should be in front of this group I hope we you know we initiate those conversations because they're not uh it doesn't make everybody happy but it who else is going to do this
