night okay and Mr Mayor if if I could indulge the council just a very brief I want to make a with a statutorily required statement for an ex itive session during uh the uh Village attorney Village to talk about come up and give us a presentation Sheriff Rick Ramsey all right hey thank you Mr Mayor vice mayor council sorry about that all right better all right here we go again Mr Mayor vice mayor council member staff and citizens hey it's always a good time to come here and see you and spend time with you but especially this time of year when I bring the annual check back to you as our citizens know and our Council for sure we provide Municipal Police Services to the city of alam marada we provided our direct cost so whatever it cost us it cost you and we're always proud to be fiscally responsible I always tout fiscal responsibility in all budgets whether it be counties or cities when we work this way we always treat every penny like it's our personal money and make sure that we're doing right by the taxpayers if we don't need it we don't buy it we don't need to spend it we don't spend it we try to provide a great level of service we hope you're proud of we try to uh provide the service that you expect you demand you deserve our citizens U as well focus on our community policing projects but this uh year as well our past years we've been very responsive not having to come back to the well but yet coming forward to return money excess fees this year we're returning excess fees of $83,000 so I know the city is going to do some really good stuff with that thank you all right this is really important to me uh this year we're returning 70 something, a marathon last year we returned 2.7 million to the county of Monroe that's been one of the biggest foundations my my regime is is U be responsible be fiscally responsible but still get the job done so we hope you're happy with our service we try hard we try to have the good community relations and our citizens and police cies and our rotary and Chambers and our experiences and be good partners to you in the city so again I want to thank you for your friendship your partnership and I'm glad to give this money back to the mayor I guess who's going to receive this sir all right thank you to give [Laughter] fin thank you council members app thank youch [Laughter] checks okay so okay Peter so uh I guess we are going to show a little video that it has now of uh the Glenn property is Peter here yes okay okay all right Frank can are you ready yes sir okay my name is Mark Greg I'm an is Mara Village councilman and I'm coming to you today from a very special place in Isam marada we're here on Plantation key on what's called The Glenn property which was just acquired by The Village it's a very special environmentally sensitive property just a little bit to the north of the the Venetian Shores neighborhood on the Bayside and the reason that it's special is because it's an undeveloped parcel it's about 90 acres and there's about seven of those Acres that are a very sensitive habitat it's a high quality uh most of it is a highquality hardwood hammock and that's becoming increasingly rare environmental area in the village because of development pressure but I'm delighted to be here to tell you about this acquisition we just closed on the property last Friday which was uh March the 29th we own it now it was special because it was under some pressure for development and it actually contains a subdivision here there is a paper subdivision of about 190 lots and paper streets all ready set to go for development but we've acquired that now the village owns it it's preserved in perpetuity and will not be built on it's also special because of some of the features it has it's got uh not only hardwood hand but it has transitional areas of Mangrove and Buttonwood area it goes from the highway all the way to the Bay it has some interesting Critters here we know that there are American crocodiles it's a breeding habitat for the protected White Crown pigeon it's in the Florida migratory bird Flyway where birds migrate in the fall and again North in the spring back and forth to Central and South America in the Caribbean and it's a stopover where they can rest and feed the protect Eastern indigo snake there may be some sock island tree snails that are here all of these are protected animals and they are here could even be habitat for the protected sha butterfly the swell Tail Butterfly so for me it's a trophy acquisition for the village for the environment and for the folks to have this in perpetuity I hope you get a chance to visit it we may open this up a little bit for some recreational or or um passive Trails I I did want to mention a very special thank you to the Glenn family that sold the property to the Village Mr Glenn his uncle uh purchased the property and recorded the subdivision I believe in the early 1960s and uh had some health issues and was unable to develop the property The Glenn family inherited it when he passed and uh they didn't rush in and want to bulldoze it or anything and so when they approached us about some kind of development it was to you know of course get some income from the property but we worked with the Glenn family and Mr Glenn in particular they were very in tune with our needs and wants and with the environmental sensitivity of the property they are conservationists themselves and so when we met to talk about this we were all on the same page and so we owe the Glenn family a debt of gratitude for their cooperation in making this transaction happen there may even be a ceremony where we name the property in honor of their family and their commitment to the environment and to the benefit of the folks of is Mara so thank you again Glenn family for working with us on this transaction hi I'm Pete frza the environmental resources manager here with the village of Isam marada and the acquisition of the Glenn property is certainly a significant one for the village it's by far the largest single land acquisition that the village has ever completed uh it's it's mostly Mangrove Wetland there are some Mangrove uh transitional areas with Buttonwood tropical hardwood hammock as well about 7 Acres of hammock some of which is high quality hammock and it does also have about 2,000 linear feet of Frontage on Florida Bay so this Glenn property is currently completely undeveloped it will remain undeveloped and be managed as conservation land by The Village so certainly it's an important acquisition for the protection of native habitats and natural resource [Applause] protection hey uh Mark I I do believe that they it was 1955 is when they plotted that subdivision I'm probably you're probably correct it was a long time ago yeah and also uh if I remember right the rosette spoon bills it has been a breeding nesting ground for Rosie at spoon bills you'll see him in there occasionally in the salt marshes but anyways it was a very good catch for the village and in very good price yes and and I just want to say thanks to Peter and to uh Frank in the we all lost about a half a gallon of blood from the mosquitoes when we were out filming that it was unbelievable and John I'm sorry thank you mayor um like Councilman Greg I'd like to give some credit to Frank mberg for his work on the video and I want the ID La Mar Community to recognize that we have a YouTube presence if you go to YouTube and do Village of Isam Mara or Isam marada Village of islands you'll pull up our YouTube page and Frank is building a library of video shorts that will cover all kinds of topics uh for the community and he's he's doing a really excellent job so uh kudos to Frank and and the rest of the team that are working on these and our drone pilot Robert Mather as well and also thank Mr Quick he's worked very hard on this with the Mr Quick's firm his firm did an outstanding job of managing this from the point of a claim to the point of a closing and uh that doesn't happen very often and it certainly doesn't happen this well with this kind of an outcome come so my hats off to his firm for getting us to the Finish Line Henry you got something you want to say uh what was the purchase price uh my Rec closure is 650,000 650 and the original price was 2 million yeah well their original demand was higher than 2 million 3 million yeah but it originally came back to the council um for potential acquisition at 2 million and Council um successfully were able to negotiate down to 650 thank you thank you Henry okay so let's move on here then uh alrighty so Ryan Matthews are you on board I mean Ryan from Gray Robinson good evening mayor how are you good you're on board man you're you got it perfect well mayor vice mayor council good to be with you as always this evening from Tallahassee I was asked to give uh really a brief update in terms of what happened during the 2024 legislative session we'll talk a little bit about from a policy and a budget perspective what occurred and then really what are our what are our next steps uh as it relates to planning for the 2025 legislative session um so so I'm going to go through this slide deck obviously happy to answer any questions afterwards um should you have any um again we're looking at uh basically a 2024 legislative session whereby um there wasn't a lot left to accomplish from the governor's priorities the Speaker of The house's priorities as well as the Senate president's priorities to 2023 was robust um when it comes to the number of policies that presiding officers and the governor want Governor wanted to achieve and quite frankly um they had a very very high success rate on those policies um so with the governor spending most of his time in the presidential primary in Iowa um in other places his message to the legislature during the opening day of session was stay the course keep doing what you're doing um Florida is a a success uh and you have my blessing to move forward effectively so who are those presiding officers um and and those who are playing the biggest role obviously we have no changes in the governor Andor the cabinet um James James uthm is the governor's chief of staff he took a brief leave of absence to run the presidential campaign he is now back in Tallahassee the only change to this uh slide here is Chris Spencer uh who recently was appointed the executive director of the State Board of administration so the governor will have a new OP B director who plays a pretty vital role um during the legislative session again there there is a Changing of the Guard um after this legislative session as it relates to presiding officers a number of these folks uh on this slide are termed out um and will'll be leaving office as we have an election Primary in August and a general election in November um most importantly here um other than the current presiding Speaker of the House Paul rener um is the speaker designate Danny Perez speaker designate Perez is from Miami Dade County very familiar um with South Florida Regional issues quite frankly and that includes um key specific issues as he spent a majority of his life in Miami Dade in the Florida senate senate president pasido again um she is not actually terming out U but her her time her two session term as Senate President will be ending she will be coming back uh to the senate for the the remaining two years of her term uh Senator Ben albrittain here is Senate President designate he is from watula uh in South Central Florida uh and is a citrus farmer by trade we'll look quickly at Future Leaders um both the house and the Senate have a mechanism to ordain or determine Future Leaders uh presiding offices ERS up to eight six years excuse me before uh those terms will actually commence um we have Senators Jim Boyd and Jay Trumble who are the next two officers of the Senate and then Representatives Garrison and canedy who will be leading the house um I briefly mentioned speaker rener Senate President pasido um I I'll talk about one of their priorities each pres uh house speaker rener was very focused on minor social media usage uh there was a piece of legislation that was filed that was his priority House Bill one um that would have prohibited children under the age of 16's youths of social media that bill was actually vetoed by the governor during week seven of that nine week legislative session um the governor's uh umbrage with that bill was that it didn't allow for a parental opin for 14 and 15 years old 15 year olds um so the legislature very quickly pivoted and amended uh a piece of legislation that was still alive to have that uh parental consent uh stipulation in there and that bill ultimately passed Senate PR president prido very focused on education and affordable housing uh we had a a glitch Bill if you will to the live local act which was her priority piece of legislation last year and then this year she also spent significant time and money um on the live healthy Act act uh which is increasing Access Medical access to Floridians um more opportunities for future doctors in this state Etc but this is a very sort of broad look at what occurred in 2024 we had about 1900 bills filed only 325 of those 1900 ultimately passed um as of yesterday 66 have been signed by the governor and two have been vetoed our state budget came in at $17.4 billion um Florida is the 13th largest economy in the world uh this is uh one of the if not the highest budgets we've had in our state history just to give you a little bit of color uh our our budget 10 years ago hovered somewhere around that 7780 billion dollar range so not only has our population skyrocketed uh but our state's budget has incre increased tremendously as well you can still uh compare that $ 117 billion budget to that of the state of New York who's got about a$ 225 billion budget um California I believe is over a quarter billion dollars um all the way to States like Montana who have a six billion dollar budget some of the highlights of that budget again just by um Silo not surprisingly education and Healthcare are the two biggest costs um found within the state budget um roughly about 46% of our budget uh comes from federal dollars uh the rest is General Revenue uh that is brought in I mentioned the live healthy act which was a priority of Senate President pasido that cost over 700 million dollar uh the state spent significant dollars in education um increasing the amount of per pupil spending they were doing giving raises to teachers Etc um the governor ALS Al in the transportation space uh was was moving a a moving Florida Florida Florida forward excuse me Priority uh appropriated $7 billion doar for transportation projects in last year's budget that was carried through to this year's budget we had a significant uh funding of uh not only Florida forever as a whole but environmental land Acquisitions um much like the Glen property the video that preceded me um the the administration continues to spend significantly uh in the environmental Arena and that's really not just um focused on the Everglades but as it relates to water quality um alternative water supply Etc which is a very promising thing in addition to the significant amount of dollars they have placed on on land conservation our annual tax package uh is a yearly legislative Trad tradition we have granted about $2 billion in the 2020 24 legislative session in tax rebates to Floridians here's just a a small sample or subset um of some of those sales tax holidays that were included in that tax package again when you are faced with um what was deemed as a successful 2023 legislative session it left a lot of questions about what the priorities of 2024 would be from a local government perspective um you know there has been tense relationship between state and local government in Tallahassee really for the past decade um that has waxed and waned over time we have seen um a a a somewhat uh beneficial Andor a closer relationship uh less adversarial I guess uh in 2023 and 2024 couple bills that I'm going to mention um you'll recall uh that in last year we had a bill that requires business impact statement for every ordinance that is passed by the village and similarly other municipalities and counties effectively stating whether or not that ordinance would have a quote unquote Financial impact on local businesses um there was a cause of action that was created if an ordinance was arbitrary um for the attorneys uh it was mirrored under you know arbitrary and compre standard and administrative law um although it doesn't rise to that level effectively it just created a new cause of action um for someone to sue a local government who would have infringe upon negatively um on businesses uh that original legislation did not include uh growth management ordinances or Land Development regulation so the legislature came back this year uh and now has included those type of Municipal actions in the bill so it's something to be mindful of particularly another theme for the 2024 uh legislature was uh building regulations there were several bills that were filed uh that dealt directly with local government U building permits uh and a lot of those focused on the streamlining of the timing of the release or granting or denial of those permits um one of those bills uh that you all should look at is House Bill 267 uh which again is cutting almost in half the time by which a local government um shall uh respond uh to a permite for a building permit I believe the the old timelines for uh buildings over 7500 square feet was about 60 days it has been uh streamlined to 30 under 7500 I believe was 30 streamlined 15 so again multiple bills were actually filed not all of which passed as it relates to building regulation but 267 is one of those um to pay attention to one of the more controversial bills uh in the 2024 legislative session that you may have seen some media uh centered around um was the the permitting of the homeless camps Etc so what this bill does is prohibits local governments from allowing individuals to Camp or sleep on public property the only way that you could do so is a county would set up an area with the consent of the municipalities therein uh that would provide facilities uh in resources to create effectively a public camping or public sleeping area um and again one of the issues to be aware of here is because there is now a Prohibition of public sleeping there is a cause of action that can be brought against a local government um if there is public sleeping Andor camping found in uh local areas that have not been established as I mentioned previously by the county a couple other bills that we have tracked and talked to you about over the last couple of years sovereign immunity has been a uh a yearly uh piece of legislation that is filed in Tallahassee to increase those those torque caps against local governments uh the current caps are 200 300 uh the initial this bill this year um the standards were were to be increased to $400 and $600,000 respectively we've seen proposals across the board over the years um all the way from abolishing sovereign immunity Al together to having the cap set at a million dollars per person and per incident um so that bill will likely be back again in 2025 couple of environmental bills to bring to your attention we have the safe waterways act um that passed this year year uh this was a continuation of the clean waterways Act of 2020 which required uh the department to do a host of rul makings on a wide variety of water quality and water quantity issues effectively this bill is creating a digital mess messaging communication system for when you have water quality impairments of a bacterial nature um what this bill aims to prevent is for unknowing recreation in water bodies where there is a bacterial or parasitic type of water quality issue uh one of the really major wins uh in 2024 uh deals with environmental resource funding uh the speaker and Senate President with the governor's blessing had had began to talk about late in session a way to uh fund environmental programs uh both now and in the future and what they came away with was was taking revenues from the seminal gaming compact that the state receives um and putting those towards again conservation easements land acquisition water quality Etc the exciting thing about this uh that this bill that has been approved and signed by the governor already um is that this could upward be upwards of $1.2 billion per year uh utilized from that seminal gaming compact revenue for Environmental Resource Management typee projects D had a a substantive uh agency bill this year that did a whole host of things including creating a new aquatic preserve it further discussed the the use of reclaimed water in various instances in this state and has continued to fund resources uh in the resilient Florida grant program we've seen about $1.5 billion dollar put into that program over the course of the last three years um so again just highlighting the fact that this Administration has spent significant dollars um on uh on environmental projects that last slide dealt with the taking of Bears um which really is a Florida Panhandle specific problem so I won't get into it let's talk about next steps because we had a a bill that I have not discussed yet um one of the highlights or I guess I should say surprises of the 2024 legislative session occurred when the Department of Commerce released a report that would have significantly changed hurricane evacuation timelines um we worked with the Department of Commerce representative Mooney Senator Rodriguez Etc to educate um why rash decision-making uh is not in the best interest um of anyone as it relates to those hurricane evacuation times um and the future of building permitting in in in the Keys um so House Bill 1297 was filed by representative Mooney um this made a couple clarifications uh to the evacuation models as it relates to the citizens of of the city of Key West as well as mobile homeowners within the keys um that bill also had uh a couple of uh affordable housing Provisions as it relates to the current tourist development tax dollars uh that are available that can be utilized for affordable housing in the keys um so I will say a couple things I'm I'm grateful for those that came to Keys day in Tallahassee this year um I think it was a successful trip in terms of an education of of how Tallahassee operates and how um how important a plan is uh to be successful uh we also had and I know discussions continue around the $300,000 that the villages set to receive um at the beginning of the new fiscal year for a marine Vessel I know again that that conversation continues amongst the county from a timing perspective the state budget begins July 1 that new fiscal year for the state begins July one um so there is still time to have a continued conversation uh between the council uh on on that specific Appropriations project so what does that mean for 2025 and Beyond uh I mentioned early on there is an election in November every member of the Florida house is up for election you'll see you've got qualifying dates there in April um November 5th is that General Session our next legislative session does not begin until uh March of 2025 uh so I I was very uh appreciative of the time that I've had to speak to Rob to date the multiple conversations we've had about uh Alle legislative planning process you're looking at legislative committees beginning their work in Tallahassee probably just after the new year so you know in terms of having a legislative platform um or a priority list uh established for 2025 that's really going to be something that's a late summer to Fall exercise early Fall exercise um and in addition to this again what was supposed to be a brief legislative wrapup I'll be working with Rob to have the members of gray Robinson come down and meet individually uh with the council and Rob to further expand on that so that with mayor I'm I'm happy to answer any questions Council any questions for Ryan I have one hi briyan this is Mark Greg I did want to say hello again from uh seeing you last time in Tallahassee for Keys days you were our jungle guide to Tallahassee and you helped us find our way through the Labyrinth of offices and halls and and uh different department so thank you for that I noted in your materials that there is a change to the vacation rental law of course our ordinance is grandfathered in but it seemed to be uh to me that there may have been some Provisions especially for advertising platforms that may be uh may affect us it looks like some of that's preempted to the state could you walk us through those changes if there are any that affect us please councilman I would be happy to um yes there is a standardization in terms of uh the advertisements uh for vacation rentals you'll recall again since the 20 um 11 session or so I think we have had a bill dealing with vacation rentals filed every year in Tallahassee um again I think this was an the outcome effectively is that uh the short-term rental platforms are not happy and local governments probably are not happy um so there is a a registration program uh that is effectively created and and what Senate President pasido did because it was really her baby uh was look at the majority of vacation rental ordinances that were in the books uh were on the books from a municipal code perspective and then I think took probably the seven most common factors found in those ordinances um some of those factors you know establish a registration program uh the bill would actually cap a registration cost uh for those local uh registration programs so I would need to know a little bit more about the specifics how much you charge Etc um to let you know that but we do have additional material Ava available as it relates to the vacation rental bill that I would be happy to send to to Rob and John okay send it on if you would thank you sir anybody else have any questions for Ryan I do Henry pretty much the same question I've asked for the last almost four years and my question is what did you do this year for us and us alonely what did you do to have something passed for our benefit you not the not the session that you attended councilman I I would say the $300,000 for the marine Vessel is one thing that we did for the village just like the year prior uh when we had $500,000 in Appropriations for the generator facility and for the improvements to the council chambers we have been very focused on appropriation specifics for the village of Al marada and it's the discussion that we have had for the past four years um because there has been a lack of an establishment of a village specific specific legislative priority list was that so I am always willing to work on behalf of someone who tells me what to do was that in Jeopardy of not passing it hasn't passed yet so it's still open the marine Vessel the 300,000 or 300 the 300 allocations the governor has not yet signed the budget that is correct budget has legislature but you're you're right let the governor could certainly still veto that $300,000 okay so you want the bat for us on that I take it yes sir okay is there anything else you want to bat for us that was part of the agenda for the legislature from a policy perspective we've had an ongoing conversation about bass rogo Etc because the education in Tallahassee um is a lengthy one quite frankly uh because of the unique nature um of the keys so that's something we also spent significant time on and can I can I um just um intervene here for a minute you're you're asking a very important question for the community and um and it's a good one and I think that what we found when we were in Tallahassee and maybe Mark you might support me in this is that um as a as a body we actually what we learned um is that we have not been very faithful um and deliberate about providing um legislative priorities for him to work on so without that you know that's that's on us and and we have um asked for uh a meeting date and and I I'm hoping we can have that conversation here um about when we would set that meeting remember we codified it we said that in our code um as a procedure we're going to set up a meeting and I think it's in June now we don't have a date set for that it's coming Upon Us quite quickly but but but we have to take we have to take responsibility for that because what the heck does he know what we want but it's a great question I understand what you're saying I haven't gotten to that yet but I appreciate the the uh input [Music] um the county for example on the topic presents to the legislature every year something about that thick as long as I've been sitting in this seat we've never presented anything with any thickness and you're absolutely right you know why because we haven't demanded it it's it's like you're absolutely you been doing this whole time just kidding I'm agreeing with can I say our task you two guys is that first of all Ro used to handle all this this this has happened recently and I will say that Ryan called me and said he was told by some of our staff that we have no uh infrastructure projects so I mean that that he called and I said Ryan man you know let's get with you know whoever we need to get with but we he was told that we didn't have just what you just said okay so it is our fault we we are the ones that dro the ball on that and so uh Ryan if we don't give him an assignment he has nothing to do but in spite of that I would like to add that even though it may not have been specific to ISA marada it was very some of the work that his firm has done has been very beneficial to the keys because we share the status of an area of critical State concern with Marathon Monroe County uh Key West has a similar one to ours and fortunately his firm represents I think all of those entities and we have common interests and needs in in mind and he's been to the legislature and they've appropriated funds and and passed things that benefit us all under the that kind of County Banner so uh he even though we did not give him specific Direction he did wind up bringing home the bacon for us under that scenario and we should thank him for it well Henry also uh Ryan was very instrumental in helping get the aqueduct uh they got a resiliency Grant I believe Ryan corre correct me if I'm wrong but wasn't it about 17 million because of the way the grant was written The Village had to ply for it towards the $42 million water main yes sir okay all right thank you and the stewardship funds that was a huge chunk and we got a a nice piece of that too for the fourth year in a a row we've had $20 million in stewardship funds and and and councilman rosenal what I would say is quite frankly we're we're in a good position now from a timing perspective uh because there are several hundreds of millions of dollars available at the Department of Environmental Protection um for water quality projects and others um and and so so I I think the The Next Step again is having the council establish their priorities both from an appropriation standpoint and from a policy standpoint adopting a legislative platform and then executing that platform I understand what you're saying where I'm where I'm going is in essence we're picky backing everything the county work wants I can't identify anything that we want that you provided for us and I get questions of how we spend our money and for you we're spending $108,000 and all I want you to say is this is what what the $108,000 went for us not the county because it would in all probability if we didn't hire you we be get the same thing the Count's asking for anyway now I know it's a pro probably a reach on my part when I say those kind of things but I'm just trying to justify you and your company to substantiate the $108,000 that's all I'm trying to do I appreciate that and So my answer to that would be in 2023 we brought back half a million dollars uh for a facility to house generate specific for the village of a marada um also in that half million dollars were dollars that were going to improvements uh for the council chamber in 2024 there was $300,000 um that as you pointed out has not yet been signed by the governor but placed in the budget for the purchase of a marina vessel so I know again that those are ongoing conversations but is marata specific that would be $800,000 in the last two sessions okay you answer answer the question for a lot of our citizens and I'll say thank you very much and Mr one more thing Ryan I think it's important you know that we've talked about the the money that you've brought into the village but I think it's equally important if not more so to tell the citizens about how you play defense for us where there's funds that come our way and sometimes there are things that uh that may be taken away from us and your firm is on uh the tip of the spear to see about uh preventing that from happening maybe you could share a little bit with us about that so we can know some specifics absolutely um councilman and I mentioned earlier that there has been a bit of a contentious relationship between state and local government um our firm does in fact represent numerous local governments both County and cities as well as the Florida League of cities the Florida Association of counties um and so from a preemption Andor unfunded mandate aspect um I I I talked about the 1900 or so bills that are filed there's generally upwards of about a hundred bills every session that directly impact the operations of local government um we work on almost all of those in a defensive type posture um and whether that is you know private property uh rights uh policies that would potentially impact um the liability of not only the village but all you know key specific specific governments um as it relates to takings cases um we have dealt with that vacation rental piece of legislation for the past um dozen years or so I mentioned sovereign immunity um I I think that the legislature has started to look at local government revenues as a whole and something that you all need to be mindful of um there was a bill this year that would have um first abolished the local business tax and then slowly um phased out the local business tax there was a bill filed that died um that started to look at the Merit of property taxes we have a wave of legislators particularly in the house who are very focused on local government revenues now I think there's a reason for that I think that a majority of legislators have heard um an outcry from constituents as it relates to property insurance I know the keys are no different um and probably you know uh patient zero when comes to the property insurance crisis the legislature acted a couple years ago to make changes to property insurance um I I think those uh Solutions are are slowly coming on board um but I don't think the relief is being seen by the voting populace um quickly enough and so I think the legislature may be looking at what kind of revenues do they have more control over and those would potentially be local government revenues so that that's something that although we're ways away from the 20225 legislative session something to be mindful of because it's likely we'll be paying quote unquote defense there Henry go ahead uh what you just brought to mind one question I had for some time do you represent Coler County as well no sir you do not no sir okay thank you questions fory question just to followup but not not a question for Ryan okay go ahead followup as well not a question for Ryan okay I can go ahead and present that now if you wish sure if you want all right absolutely um I just want to respond to councilman rosenthal's concern about the absence of a booklet uh one of the things that Ryan and I have been talking about over the past couple of weeks is not only timing for developing a local legislative process but also uh the the content of it and what has uh proven effective up until alasse I think that once we really take advantage of our relationship with them it is good to have a voice uh in the state capital uh and yeah they do need to be held accountable and Ryan would agree with that I'm sure uh but a lot of this is relationship building and making sure that uh we have a pathway to our legislators and a uh Intelligence on the ground to give us early notice of potential Grant and other funding opportunities that we can pursue um and get ready for as those announcements are getting ready to be made instead of catching them on an email distribution list some week or weeks after those announcements have been made and we're already behind the eightball so um the lobbyist can have value but it does require active management and Ryan and I are committed to uh helping us get on track with that and doing the best we can and then we can revisit that later on and say Here's the results of it um you know these are the metrics by which we assess whether that relationship is is returning value uh along the lines of what Ryan has already quoted but hopefully even better with a A Defined legislative agenda right right all right anybody else okay hey Ryan thank you but it was just a followup I don't I don't think I need to Ryan but um it was just a followup to what councilwoman jolen pointed out which is's correct we did adopt in our policies a um legislative priority Workshop which I think uh at least in part was a direct result of the trip up for Keys day this past year um I've wor I've spoken with with Rob he's aware of it and I just thought it would be a good opportunity to make sure that everybody's aware of what to expect as well as the public the the way that we have laid it out is it's a it's a workshop to occur no later than uh June 30th so Rob will present you all with a list of topics or areas uh that uh that he believes should be priorities um you all as Council will um consider them give direction give your input and then um from that Workshop there won't be a decision that will made from that Workshop Rob will then put together the packet that he's talking about which will ultimately be approved by the council so that will be a formal council position uh for the state legislature and and Mr Mayor you were correct in the past historically uh this had been done through the village attorney's office the The Village actually had a separate um uh lobbying or legislative agreement with with the village attorney's office above and beyond his Employment contract now it's a more it's a more Council driven process um and then you know that's what we're doing we're doing now and and we will uh work with it and and obviously I'll be working with Rob to to assist in any way he needs okay go ahead and just one quick followup uh as Ryan had mentioned the target for that approved legislative agenda not the beginning of the process but really the culmination of it is late summer to early fall so the June date in terms of that Workshop is good timing and would allow us to have that document fully vetted by the time that we want to have it uh be something that's actionable for Ryan and us to really begin to advance our interests and and funding opportunities and all the rest right because Ryan has called me and said hey you know we got a we got a plan proper prior planning you know prevents poor reforms so can I just um so um you know June is right around the corner and I know we're all very busy could we talk for a second about um get and I know that I I I have hounded you actually on on confirming a date but is anyone else feeling that it would be nice to get that date on the calendar cuz I got I got issues I got plans got to be places okay and June is very you know right right there I I don't have my calendar but I I would be interested in coming up with a date maybe we could talk about it Thursday night yeah that's I was going to say let him come back with some dates on Thursday and let's try to pin it down all right no more any any other questions for Ryan we're from Isa marada um on your agenda this evening under mayor uh Communications which you do not have general public or you do not have normally have public comment you have a an item concerning uh a sister city of talking about a c sister city I just wanted to lay a little history on you is that I do remember and I think I remember the name of the city when I was was on Council we did do a sister city we brought them to ISA marada and and we sent representatives to their town and if I remember right it was Ocean City Mississippi but it was a few years ago so I'd have to look that up to verify that but we did do a sister city program and I think it was in relationship to Hurricane assistance thank you Deb who's next Marty next up is Mike Goldberg Marne he's going to need five minutes for speaking on than you you want three Mike or four yeah just three three okay all right assum I don't run on my name is Mike Goldberg I am the co-founder of iare we're part of the group that's working hard every day to restore the coral reefs here locally and I wanted to bring to everyone's attention a fabulous event that's happening uh May 2nd through 5th it's our second annual trash Derby some of you may recall last year's Derby we had about 200 participants um pulled out about 12,700 lbs of debris uh we had a fabulous Festival I think I saw Maria here earlier um fabulous Festival here at Founders Park and went off really well this year same kind of format uh we have three divisions we have uh a shoreline division we have a private boat Division and we also have the dive operator division this year it's arguably the largest dive event in the history of the keys uh it might be the biggest cleanup event ever in the keys as well so I decided to rope in Key West to Key Largo I chartered 15 dive boats um raised enough money so that all of the folks that come here for that weekend May second through 5th can dive for free um there was 694 spots to fill on the boats and as of this morning about 670 of them were filled it's going to be a massive event um I'm sure I'm hoping to beat 12,700 lb or maybe I'm not depending on how you look at it um but it's going to be quite an Endeavor so the 3rd May 3rd May 4th fourth they are the cleanup days sun up to sun down if you want to register you want to go clean up in your neighborhood you want to get together a team iare trash derby.com if you want to take your own boat out and run out to a mangrove Island I care trash derby.com you can register your team the winning teams in those areas uh get $1,000 cash award so it's I don't think that's the reason why people are doing this but what the heck it's $1,000 why not um and then the the dive shops that are participating um again 15 different dive operators throughout the keys and of course it's centered here in our wonderful Village um they're buying for a whole host of prizes from dive Regulators to some wonderful paintings trips all sorts of really neat things that uh they are uh we are auctioning off to help raise money to rebuild our reefs all right um I do want to uh mention some of our sponsors I think it's important that they get get their do um of course the tourist Development Council we couldn't have done this without them uh they've they came up with a total of $65,000 ad spend that we had for this event so uh obviously that helps it's an amazing amount of money I might pass my three minutes already yes sir we're going to give you two more I tend to ramble too much um the national Marine Sanctuary Foundation of course Patty um Florida Keys Brewery we thank thank you Florida Keys Brewery and of course the Atlantic trash and transfer without them last year and this year this event doesn't happen because they donated all the rollway uh dumpsters and without them of course we couldn't pull this off so um thank you for the time please come out on May 5th s go de Mayo that's one of the festivals we have great music um uh Leah suder if if you everyone know who she is her voice is so magical and um Atlantic no Atlantic um Southern Stampede is the the rock band that's going to be performing they're a fantastic band so come out on May just me thank you all thank you Michael my pleasure Marney who's next next up is Kylie Smith good evening everyone um my name is Kylie Smith and I'm the other co-founder of iare alongside Mike um and as Mike said we are the only Coral restoration organization focusing our efforts here in Isa marada um over the past 3 years we have transplanted over 15,000 corals to our reefs and we've educated more than 32 sorry 3,200 people through our program we are funded primarily by grants and donations and we're really excited to be able to announce um over the next I believe two weeks we're going to be able to announce that we are receiving a significant donation that is going to allow us to expand our work by including the first ever known sponge restoration program on the reef side um it's also going to allow us to propagate our own corals and have our own stock that we can outplant and breed as well as educating local high school students of Monroe County to become certified divers and get involved in our activities so we do this work primarily with dive shops actually only by dive shops they allow us to run trips on their boats they help us get customers and donate percentages of their revenues to help us make this work possible our biggest supporter in terms of dive shops um both and helping us to run these trips and financially is key Dives and key Dives if you guys don't know is also owned by Mike Goldberg who just spoke and this man is fighting to make this community a better place as you just saw he is the effort behind the trash Derby it was his dream and this is what it is doing for this community Mike gives his time money and all of his crew to help us rebuild our reefs yet he runs away from any recognition but he needs our help uh key Dives is losing their building in August and he needs our help to help him find a new home so that we can continue the partnership that we have with key Dives um so if anybody knows of a space or somebody who may know of a space if you can please get into contact with us we would be incredibly appreciative if key Dives does not find a home in Isa marada that funding goes with us to another shop and right now the only other shops interested in getting involved are up in kilargo we want to stay here this is our home this is where we started it's a part of our name the I and I care stands for Isa marada um we want this funding and the work to stay here so if you know of anything we would be grateful for any heads up um and we're excited to continue to rebuild our community thanks thank you very much and I can't wait we right thanks Marne who's uh anybody next yep van kenad good evening ladies and gentlemen I'm van Caden head from is marada uh I'm encouraged to hear that the uh new manager is working to uh G get a list together for gray Robinson to go after some of the money that we've been leaving on the table up there for all these years and uh that is definitely a falling down of the uh responsibility of the councils and not just you all but the ones that preceded you uh we should have had this program uh in full force uh years ago and uh I'm incredulous that you have to go up to Keys day in Tallahassee to educate the legislators in Tallahassee about the keys because the keys has been a a critical concern area for since the 70s and and we've had so much uh uh building going on since the 70s uh almost unbridled and and I'm looking at at the uh the um agenda for the last session in in uh Tallahasse and it seems like they're still trying to make things easier for the building Community to build out every square foot of vam marada in Monroe County and uh we were going to have a discussion T out in beef pass and rogo and um to to my way of thinking that that should even be a a concept much less uh uh asking for 3,000 they were asking for 8,000 new building permits and raising the time of the evacuation from from here um it's it's ridiculous it's like they're insane they're being intentionally ignorant about what's going on here the the the caring capacity study which was paid for by the people of Monroe County years ago said that we were uh overbuilt and and within the next couple of years there would be a problem well we've got a problem now we've got a problem with traffic we've got a problem with water we got a problem with not communicating amongst ourselves and a united front against these people in that Tallahassee who are very well-coordinated and they're very greedy and they're very wanting very much to get every nickel they can out of their little Colony down here in Monroe County and the more that we put uh construction ahead of the people that live in Monroe County the worse I think uh America is going to be because I don't think that the people of the kids are not being served by either the the DCA the the Department of Community Affairs which morphed into the Department of Economic Opportunity which morphed into the Florida commerce none of those entities have defended the keys or the people that live in the keys they have defended the commercialization of the keys please okay I'm I'm all right you know you can tell by my tone wise I could stay here for another hour but I'm not going to but I I I hope you hear what I'm saying and when you have your discussion on bass and rogo I have it's I hope it's indepth and we're not and you don't limit the people that are trying to talk to it to three minutes thank you very much Marney anybody else yes Su Miller is next Sue Miller lower matacumbe it's great to have a new manager and I'm very optimistic that Mr Cole will make a significant difference in Alam Mara when I study the village council meeting agendas I often am left totally mystified there are so many critical issues in our community and when are we going to establish those priorities we have just one two-day meeting each month when I I see the agenda I wonder when are we going to get to the fills our 5-year lease expires September 10th what about spending we continually watch a spending seems so out of control we continually wave competitive bidding sure some people are very wealthy in this town and it doesn't matter to them the rest are leaving one moving van at a time and perhaps one member of the workforce at a time the village seems intent on helping those who want to make more money but there are others that need a lot of help bass virtually ended last summer times have certainly changed we've talked about the necessity of a total review of our outdated comp plan and ldrs to fix what is fixable instead we're using the planning department and a $250 per hour Law Firm to spend precious time defending defining the word Frontage and recommending zoning so Property Owners can convert single family homes to Vacation Rentals where does the noise ordinance update fit in where's the Strategic plan blueprint Kimberly Matthews was to create before she left when do we actually discuss the baseball interlocal agreement publicly when will we discuss the impact of traffic in Alam marada and acknowledge there are things we can do to help will we ever get back to genuinely involving the community in the governing process as councilman Rosenthal always said when will we all be able to sit down at the kitchen table together and work out our differences I am so grateful that we now have a manager who is in charge we are all expecting great things from Mr Cole I hope each of you will stay away from Village Hall for a while and let him do his work the public doesn't have free access to staff and neither should members of council help Mr Cole establish the priorities for the council agendas not just your pet projects but the projects that you hear about from the entire Community the projects that will affect and benefit ala marada we have long been considered Paradise we need to work diligently to remain the best place in the world to live the job you have Mr Cole will be a challenge and we all sincerely want you to succeed I wish you the best of luck I know you can handle this thank you Marne anybody else yes next up is joish meer we have anybody after him or is that it there are two more [Music] speakers Joe wishme plation key Mr Mayor and Council I would like to talk about public comment or lack thereof in some of these public meetings by grouping important items under Communications or consent agenda is not fair to the people who voted for you to represent us the public this is not the first time that this has come up by others and myself we listen to you talk all night the least you can do is listen to us for a few minutes additionally taking public comment on an item before Council even discusses it is also not fair to the public we would like to hear your opinions and positions on an item before speaking so that we can speak more speak better the last meeting had 20 tab items and there were only allowed five uh items that we were allowed to speak on this does not seem very Democratic by having two meetings in a week the first described as Village council meeting and the second one described as land use council meeting seems like a good idea the Tuesday meeting should be to discuss Village issues like Master plans Park plans Village projects strategic plans fills Etc the Thursday meeting should be about land use and lengthy quasi judicial hearings apparently this is not the case because again tonight there are four quasi judicial hearings on land issues on tonight's agenda when they would be more appropriate on Thursday's agenda this is there is no mention of long-standing issues that I mentioned earlier on tonight's agenda I don't know who is responding responsible for making and approving the agenda but now that our new man our new Village manager has had time to adjust I hope that he can address these issues regarding the upcoming opening of crooked Palms Cabana Distillery that this Council burden the residents of Plantation Key Colony with we hope that you will follow through with your commitment to make sure they comply with code compliance including licenses parking and the 19 conditions of approval that were signed over on number nine states that violations of these conditions including noise could result in the council revoking the major conditional use and terminate the operation of the business restaurant Distillery besides the parking traffic and noise concerns the safety of our children riding their bicycles down gardinia street to 7-Eleven for Slurpees gardinia Street has no bike path or street light so after dark is Pitch Black and dangerous us please help us keep our residential Community safe and peaceful if you need a copy of those 19 conditions that were agreed to I will be more than happy to supply them to you thank you thank you Marne who's next please Harold Dalton good evening Dr Harold Dalton I'm the president of the homeowners association for madira Bay uh I would like uh to take this opportunity to thank the board and and particularly vice mayor Mahoney I stood up here two months ago with some significant concerns that my community had uh with Island disposal uh quite frankly thanks to uh in part mayor Mahoney May or vice May Mahoney maybe some others that reached out uh that uh situation has been remedied and and they've done an absolutely phenomenal job ever since so I want to thank you guys for helping our community with that um on a a a totally different note uh in talking about using lobbyists and we had a report from the lobbyist tonight I've LED organizations that have used lobbyists in in Tallahassee and and also uh National lobbyists but they need direction but I would strongly encourage you when you're setting your date in June for that meeting to have the lobbyist on board for that to help guide you through the Labyrinth that is Tallassee also when the uh legislature is in session you know the the joke is is that no one is safe when the Florida legislator is in session you need to have a weekly meeting with your lobbyist so you can make those changes in how you want them to move it can't be just hey I meet in June and go it's got to be much more Hands-On in dealing with that thank you thank you very much and Don Harton is our last speaker Don Horton bringing up the rear uh 47 Schooner Bay Road Plantation key so mayor and councel I'm normally not very critical but I got to tell you tonight I originally came here to comment on Tab four to ask you to please approve Tab four in the guidelines of reservation of Rights but as what often happens you uh Kick the Can down the road again I'll remind you that roughly 15 months ago I was in front of this very Council asking for a reservation of right of eight affordable housing units for the Coral Bay Marina that application had put in that application had gone through we were working working out the final details before the permit was ready to be issued your then planning director recommended that you postpone my request um I don't believe you were properly informed by him uh that director in fact had told you that the village had never done that before when the village in fact had done that themselves on their own property for their own units anyway uh that director was told to come up with a policy and here we are what 15 months later from when I addressed you that director was focused on many other code changes that most of them have been already dismissed or tabled and he was too busy making his shock and awe presentations to you we finally have a planning director that's bringing you a policy I think a good guideline and again we're kicking the can down the road now I'm going to let you know that moments ago I had sitting next to me my client that owns Coral Bay Marina his dad dad owned it he was raised there he owns it now after his dad passed away he wanted to build eight affordable housing Workforce housing units off his own property out of his own pocket when this can got kicked down the road he walked out and says I quit so I have likely tomorrow will have to come in to the building department and the planning department and revise that application for a one-story building with no Workforce housing I think that's sad so I'm glad that uh hopefully one day we will have a council that will be able to make some decisions some hard decisions and have those discussions and not k kick things down the road and I plan to be one of those on one other item there was a comment made about unchecked growth that's another one of those that Dan had preached to you guys but I will tell you since since 1992 June 10th of 1992 we have been under a mandate in Alam marada to build 28 permits a year and we've done that we've done what our comprehensive plan has told us to do except for affordable housing and except for transportation and we failed it both of those and other councils have kicked that can down the road and given affordable housing to the market so I'm sorry I'm out of time thank you thank you Don Rob did you have something yes sir mayor I know typically we don't respond respond during public comment but I felt it important to note that U Mr Horton with apologies it was my fault that this got pushed to Thursday because we as staff failed to print out some last minute uh information that was provided to council by email so I accept responsibility for that as opposed to councel um you know I'll I'll learn moving forward and we'll make sure that doesn't happen again that was one sentence that was changed it doesn't matter it's okay okay all right KCK the can down I'm sorry okay yeah all right all right so Marne any other public comment no sir okay so now public comment is now closed we're going to move on to mayor council Communications and uh John um be before we talk about this would this be or would it be better for me to wait for the under the village attorney Village manager Communications to ask you to uh speak on something um I'm happy to do it now there were there if I if I know what you're talking about there were um um I might as well just talk about now there were there were two news articles that had come out and there was a request both from you and from uh from staff for me to provide some uh factual um uh background where there might have been some clarification necessary as that would just so the public knows I have waved my confidentiality so you're okay yeah you you had asked me to to and and I'll address both of them now um uh one of them related to an article um uh uh discussing allegations of a um ethics complaint that had been filed against you um uh I was not aware of all the uh intricacies because it was it was confidential at the time as I understand and as you have shown me uh you have waved those confidentiality so um obviously as the village attorney anytime uh there's a complaint made against our village officials I want to be apprised of it so um I I did take a look at that um and I think what what you had asked is in terms of the status of of where that stands um there was a uh recommendation that was made by the um you know let me get the I printed it out because I didn't want to use the wrong title um there was a recommendation made by the advocate for the Florida Commission on ethics um and she had um uh gone through the allegations um and uh she said that there was not sufficient evidence to find any wrongful intent with regard to I'm just reading it from here from misuse of public position uh misuse of public position and there's she recommended uh a finding of no probable cause for a violation of section 112. 313 sub6 of Florida Statutes as well as Article 2 Section 8 H2 of the Florida Constitution uh so uh looking into that that was the recommendation that was made by the advocate for the commission on ethics uh it's my understanding that that will be um presented to the full commission on April 19th um for uh for their consideration uh the other item that um staff had asked me to address for clarification related to an article about a um uh potential FBI investigation um uh and there was some mention in there about a a approval for certain commercial bass um uh approval that went to uh don't want to get the I think it was SD Marine was the name of the applicant at the at the time um and that there was a statement in there that um talked about that there was a there was an a requirement for a certain amount of commercial uh bass allocation uh then SD Marine made a has filed an U uh I don't I don't want to say objection is not the right term but but um submitted a additional information um as to why it believed that those calculations were incorrect um at that point um it was turned over to legal with and that legal was asked to look into the the code um I worked obviously with um the planning director um and I guess part of the the clarification was it seemed to infer that we had a prior planning director that was one determination then the new planning director came in and there was a new determination um so staff had asked me to to clarify uh legal had come in and become aware of this issue in the intervening weeks or months um we looked at the uh the code the uh The Villages code gave our opinion as to how it should be uh calculated uh which frankly was honestly somewhere in between it wasn't uh we didn't we didn't necessarily side with the origal interpretation of the planning director and also didn't side with the um uh the interpretation that was being advocated for by SD marinees so I was asked to uh provide that clarification just wanted to make sure that was clear that um uh there was more to it I guess in that story than um uh than what was was originally reported can I just as a point of order I'm I'm unclear why we're having this conversation um this wasn't on the agenda and um and and I'm unclear about why we're why we're having this conversation if there's just if I could just finish this sentence go ahead but you didn't even ask you want ahead and take I was going to give you permission to do it but you decided you're just going to you're going to ask yes okay so thank you I I am um I'm I'm unclear about why we're having this conversation about what may or may not be a a legal um uh situation that this Village is encountering um I I'm I'm I'm I'm surprised that this is here and normally if we have an emergency addition it's it's addressed at the front of the meeting and I know we're trying as a council to um adhere to protocol and and actually we look to our staff to help us do that and and I would like to continue um to manage our meetings in in a orderly way okay so so I I I didn't know that John was going to talk about this thing with with this thing with SD Marine at staff but but obvious ly staff had asked him to comment about it okay all right and so just so the public understands there there was an article ran last week that's why I asked Mr Quick as well as staff because it involved me I waved my confidentiality because my ethics thing was confidential but obviously uh it was leaked to several people and a reporter actually called me and so I went ahead and released I I got it taken care of with an attorney last week and got it I waved my confidentiality so everything's public so every everybody can see uh you know and it's it's a whole different story what came out in the Key West citizen last week compared to what I had sitting with me but I was told I couldn't talk about it because it was confidential okay so that's why I asked John to read that and I think as well as some staff but okay so we can move on then to Oh Henry sorry go ahead I'm kind of taken back by the problem that was created by somebody here um I addressed it I didn't include you or the staff or or any conversation that we just went through and due respect to Buddy which I'm not participating in either way but I'm kind of taking back back why the staff and you and everybody else got involved with his situation which in part is similar to mine now what I did and what he do what he does is two different two different things but I I certainly didn't call on you I certainly didn't call for you to to enter the staff as for the legality of my complaint but yeah and and I'm not commenting on the legality at all I I'm not Mr Mayor Pender has his own attorney that's handling his ethics I'm not involved in that at all advising at all um I guess my question is why are we even talking about this your case is totally public it's on the ethics mine wasn't okay so that's why I went ahead and waved my confidentiality so it can be public whever I really don't want to discuss it but I'm kind of taken back that we are discussing and quite frankly with members members you know what there was members of this community uh that went ahead and released everything so they did an article totally different from what I have from the ethics so anyways I I really don't care to discuss it I'm just taking back by the fact that that we're having a discussion and involving staff and council at the same time that's it I'm done but I have to say what I have to say thank you thank you Henry okay so uh John we can we talk about sister cities yeah do you want me to um discuss that okay so um tab two is a discussion about uh possible sister city Partnerships um I know this was something that the uh uh mayor had expressed interest in um and uh so we uh he put it on the agenda uh to get a uh consensus or an attempt to get a consensus from the council to potentially proceed uh he'd asked me to uh if I would uh present this for you all um honestly in terms of sister cities this is the this if the council would be interested in exploring this idea this is really the first step there's really multiple steps there's a planning process um which is really what this would be there's a research phase then you obviously would communicate with any potential sister city and there would be an agreement with that sister city um uh some of the things that I would recommend that the council look for if this is something the council is interested in doing again this would not be for tonight this is obviously would be part of the research phase but um I think you you all should be aware of it to make a determination if this is something you're interested in you would look for some cities that are of similar population size similar Geographic qualities um similar Industries um academic institutions cultural institutions there might be some pre-existing relationships with cities that you all have or there might be some historical or ancestral connections um with cities um that's usually how a lot of these come about um uh some of the potential benefits that I've I've seen with some of our other cities if this is an Avenue that the village decides it would like to go um it obviously would open up Avenues of communication uh between our government and whatever other sister city government there might be to uh collaborate to address emerging issues um learn from each other on policy areas both the council and staff I mean you're talking about things like uh water issues natural resources Health Transportation sustainability tourism you know similar things that that we experience here Economic Development um uh those types of things it also has the potential to open up um youth education opportunities where where you might be able to facilitate you know education exchanges um or even Sports tournaments depending on uh what you're talking about and and also sometimes it opens up business opportunities where if you have um you know your governments from your sister cities may come here get some ideas and you know our businesses our local businesses have the expertise sometimes it opens up those ideas so um I think what the mayor is looking for is uh um uh and I don't want to speak for you Mr Mayor but I think he's looking for uh consensus from uh from the council if this is something that the council would be interested in um because obviously before uh you know part before uh staff were to engage in anything along these lines we would make sure that there's a consensus on Council uh for something like this okay so what what I was thinking is like Mr Kates did Craig Kates the mayor former mayor of uh Key West and last year mayor of Monroe County was to the the Bahamas and I'm thinking of Andros and I've checked into it and they don't have a sister city and it's the biggest farm community fishing a lot like the keys Alam marada was you know a lot of the people that came here came from the Bahamas so anyways John told me he recommended this is what I do and that's what I was thinking that we do if we get a consensus that we move forward with it so I talked to one of the scientists this morning with with bamy in Andros where they have their facility and um you know I went over there last year for the queen conch for to save the queen with Harbor branch and uh FAU for Atlantic University um so anyways I want to bring it here for discussion I think it's a great thing I'm interested sounds very interesting I don't know a whole lot about it but I'm interested in further discussion more information uh I didn't know Andros had a city Andreas is an island it is I know the island I've been there myself but I didn't know there was got there's many cities there little cities yeah there's send something or another I just thought it was a creek and yeah Navy has a base there like a subbed sub based yeah um so they're they're what Hy you have any input okay Henry I need more information okay all right Elizabeth uh yeah I like the idea but I I would like to ask for us to you know put it um to we I think we've got a lot on our plate right now and being in transition with a new manager I just wonder whether we have the bandwidth right now to address it um to the level that we want to address it um so maybe we could um put this at a you know push this down the road a couple months when um we've got aail more availability and uh staff is is um our manager a little bit more comfortable in his position um okay well I mean what would be the next step that's my question think John can tell me better him and Allison have done this before yeah I mean the next step is is it sounds like there's at least three four depending on the timing uh of when this would be is is is this now would allow staff to uh proceed to to work I think we probably work with uh with the mayor as well as any other council members to bring back additional information um because I agree with council member Rosenthal there is more information that you all need to make a decision but we didn't want to expend staff resources and time um doing that if the council wasn't on board so the next steps would be for for us I think um uh you know if if if the mayor or any council members have any um uh potential uh sister cities in mind I think it would be good to identify those um if there's any relationships to reach out to see if there is a um reciprocal interest uh from there um and then you know we can work through the manager's office um to to do that obviously in the uh hierarchy of of importance um in terms of of things but we would you know we would work with Rob and uh and work with uh with Council to to do that and then ultimately if there is something that is viable um we would bring it back to to council to make sure that that is still something it wishes to do um and then then at the end of the day you would create a a sister city agreement to uh to you know just to sh share I mean it it's it's some Agreements are very Broad and very formal others are you know just kind of loose loose agreements that you have the sister city that you can you know you can rely on them or if you know if you have if we have a hurricane here you know they may be able to like um uh Miss Gillis had said you know there's a hurricane you know you have a sister city who can come in and help out especially if you have a city that has you know similar resources or or faces these types of things um you know faces hurricane so it would be you know you would just kind of have like kind of a you know bring an agreement back and we would have to see how how broad and how in-depth it would be or whether it would be more of a loose ceremonial type of agreement uh but something would obviously be brought back to council before for its formal approval I'd like to say something that um I think the first thing we need to do is get a a priority we tend to go off willy-nilly on so many things and I think I like the thought of it but I don't think it should jump ahead of the the fills freebie the so many other things that just seem to be pushed to the side so if we could consider it but not spend like time was spent this past month doing things I asked not to have done but we're done and so I think we need to first develop a list of priorities and make it so it's fair to everybody and and I think your manager will uh create that priorities and then we will you know obviously whatever if there's any legal assistance that's needed we will we will assist um you know whatever is prioritized by uh by Council and and by the manager's office okay okay thank you thank you guys all right so we can move on to uh Village attorney Village manager we have anything since we moved tab three and four there's um want and nine yeah there's there's two things one was uh just the executive session statement that I'm going to read it'll take me 30 seconds and then there is still um the discussion on relocating Public Works materials and Machinery from Founders Park which after I read that I'll turn it over to Rob and and uh he can lead uh so pursuant to Florida statute 28601 sub 8A governing public meetings I as the attorney for the for Isam Marta Village of Island wish to advise The Village during this public meeting that I desire advice concerning the litigation of marel barley at all versus ISA marata Village of islands and I asked that subject to council availability uh we hold an executive session on May 7th at 4M um assuming that we have it that day and and obviously it'll need to be noticed uh attending the session would be the mayor and council members Village manager myself John quick um and then special counsel Eric stetton and possibly special counsel uh Brian sadik um would be handling it's now been uh covered by the insurance carrier um so they have been assigned that litigation by the insurance carrier that's who those people are okay all right uh Jennifer do you have anything you want to say or is that something we're bringing back on Thursday I I guess it it's uh Tab four we're bringing back three and four correct yeah yes okay so what about uh we're down the sea okay Jennifer about uh discussion relocating Public Work material and Machinery from found part it's me mayor okay all right all right thank you sir um I'll go ahead and get started uh when I was touring the community with Village staff as part of The Village's effort to recruit its next Village manager I learned that our public works department lacks a permanent location from which to base its operations Park vehicles and store materials because space has not been dedicated for this purpose our Public Works Personnel have found various Park l locations to meet their needs including Founders Park Green Turtle hammock and others such activity is not compatible with the intended use of our Park system contributes to environmental degradation and is not operationally efficient for our Public Works operations while there's been a longstanding interest in identifying a public works site and transitioning equipment materials and operations to a more SU suitable location or locations uh there hasn't really been movement in that regard over time so with the Founders Park master plan to be completed in the coming months and the RFP is out on the streets now for that now seems to be an opportune time to consider other site Alternatives including either renting or acquiring a site for this purpose staff have undertaken preliminary site analysis and wish to receive Council direction to engage in negotiations for either rent or purchase of an appropriate site should Council agree that now is the time to move forward in this regard staff will work with legal counsel to open negotiations for one or more suitable sites and return to council perhaps at a special call if needed to consider a recommended purchase or rental lease should a proposed land acquisition be Advanced as the preferred or recommended solution uh the staff recommendation will include consideration of purchase or financing Alternatives so we're clear what this means for Isa Mara on a moving forward basis financially um so what we're seeking ESS essentially is uh consensus from Council that this is a good idea right now and yes we should continue to work this path um on a uh on a diligent basis and return to council with the recommendation and appropriate steps depending on the outcome of that investigation and effort to uh potentially even go down the path of of acquiring a property and getting pricing set Council any questions I don't have any questions but I would say thank you for bringing this forward um this has been a a source of frustration at this park for from the very beginning uh more than 20 years um I know that AJ depends on that area back there and he's done it fantastic job of of uh doing uh multiple acres worth of responsibility in a very narrow sliver while dodging uh soccer moms and baseball flying baseballs and uh whatever else happens in that back road back there so the time in my view with redesigning the park or re whatever that's going to be this is the time and then I I am aware of at least one site I'm not sure if I should mention anything but everyone can see the sign from the road uh there is a narrow window of opportunity to inquire about uh obtaining that uh property under a lease um it is highly desirable um it I expect that that will go to someone very quickly so um this is not something I think I think this is an urgent matter that we should authorize the manager to pursue to so that we don't miss an opportunity we don't have to go with it if we don't like it but if we wait and think about this and take the normal long period of time to make a decision that we always do we're going to probably miss so I would be one I don't know if we need to do a motion but I would certainly uh like to give authorization to the manager to do exactly what he said to explore that in conjunction with the needs for AJ's Department to see if we can relieve the congestion that's behind here this is a park this is not an industrial workshop and they have the same problem at Green Turtle hammock and you know we are a linear Community that's 18 Mi long AJ has special needs because of that if he has a breakdown on lower manakum and has to get a machine or a part and the traffic that we've had Lacy that employees time is shot for the day that machine is not going to work that day so there needs to be something improved and redesigned for his department so they can become efficient we owe that to the taxpayers yeah well and can I say one thing real quick no go ahead go ahead okay hey what I want to say is where are all where are those sheds back there going to be if we get a bad hurricane man or or the container that's back there and stuff I mean AJ doesn't have any room and I agree you know we talked about it today in my Bri briefing and uh you know I agree Robert we need to we need to start identifying some properties that we could put a building on and you know we can protect ourself in a storm uh with with all our how much money we're talking out there there's a lot of money sitting out there and equipment so okay Henry uh I likewise have learned of a property might be the same one don't know but time is of the essence I I will have that principal contact you and it's all yours okay yes sir thank you um Council if you authorize The Village manager to expend budgeted funds authorizing The Village manager to execute the work authorization and providing for an effective date okay Peter you gonna give us a little sure good evening Council so this would be approval of a work authorization with Avalon Gardens for plant Project Avalon Gardens is one of three Landscaping firms in The Village's Landscaping Library so this project specifically would be for planting in the right of way across the street here from Founders about mile 87 is and then also on the perimeter of Founders Park where some large uh day poms were removed recently that were interfering with the power Lin so we're going to fill in the kind of the voids out there now so you want any more detail I'd be Happ answer any questions okay Henry anything you want to talk to him about yes I just my basic observation is there an overall plan for the landscaping and the funds where are we we've discussed these things since 2018 as a fact matter of fact where are we now for the future what are the plans for land landscaping and the funds Landscaping funds primarily sure so we do have a pretty healthy uh landscape mitigation fund right now and we have been identifying projects to use those funds for in Village open spaces Greenways and R of ways and when such items come up we had one come up recently where uh we had some residents in a homeowners association on Lower MBI that were interested in a planning project so as instances like that come up we will prioritize uh in Rel to the the list that I have going now so so Henry I do have a list of identified areas where we're looking to to plan using these uh landscape mitigation funds okay thank you okay any other questions for Peter all right Peter uh okay so Marne do we have any public comment for six yes S Miller all right Su Miller lower matacumbe I have a quick comment uh lower matacumbe requested funds for landscaping in the right of way on Lower mumbi in 2018 it's been in the budget for five years I think it was removed this past year but um it was continually put off and put off and put off and I wondered if we couldn't create a you know someone drive through town and look at the places that need Landscaping because there are some that I think are really important to landscape and others not so important and I just wondered how how the priority got established and and if lower maumi can ever expect to have any uh Landscaping done on their Island thank you thank you sue um okay council is that something that we could maybe ask Rob and Peter to look into it seems reasonable to have a a survey of of areas where we might want to consider and then prioritize them so I can talk with Pete offline and and see about getting something like that prepared all right thank you AJ I can uh mention a little bit about the lower mat uh portion of the landscape project uh so that's a portion of dot project that we've been working with them on that project was a little delayed because of Irma uh it includes the Phils area and all of that but um that project goes out to bid in May of 202 and we'll begin uh construction at that time okay thank you AJ all right Marne any other public comment on Tab six no sir okay okay I I guess I will what go ahead project is going out forbid in May of 25 I think you and I are talking about the same thing I hope yes so the the the reasoning that it's going out in uh 25 is because it does include that Phils area um and the Landscaping they don't want to put Landscaping in in the middle while FKA and fdot has a small little Bridge rehab rehabilitation project going on um while they're making those uh tie-ins and everything so they they don't want overlapping projects and they've delayed it a little bit but that's the reasoning for I think it was like a six Monon away talking about the he sat on the County commission for a number of years who was heading up the project for that development what the hell is his name Keith Douglas Keith Douglas we're not talking about that no that's in the works somewhere I hope I think it is I I'll let you go okay I'll let I'm not aware of that project okay I'm just fing Peter we talked about it I believe Keith Douglas yes sure yeah and that's in the works yes that's the right answer that's it sit down all right what what are you talking about what what they're having like this private conversation what what are we talking about because that settlement wants to redo their entrance to that settlement and there was a question with the togate togate project authorize a village manager and Village attorney to negotiate an agreement for the project authorize a village manager to execute the agreement authoriz manag to expend budgeted funds and providing for an effective date AJ all right uh good evening uh this is uh a Wastewater project uh with an an expansion of our vacuum main located on the south end of gardinia and Lake Drive Right There by PKS uh this is one of those larger projects we talked about we don't use our continuing service agreements for we put these larger projects out to bid um the project was put out to bid with an RFP uh we received one uh bid and that's what we're asking for you guys to approve tonight um the bid itself was sorry um the proposed project bid was uh 363,462 Council any other questions for AJ Rob AJ uh to your understanding what would be the reason why or at least some of the contributing causes for why we would only get one bid because I think that would be helpful for the public to be aware of and understand as well sure um I don't specifically know why but uh my my gut is uh it is a larger project uh the engineers estimate was right around uh 600,000 uh was the mid uper range of the uh for the project itself um for the the work that's being provided um it's one of those that it's bigger that some of the smaller companies won't do but not quite big enough that you're going to draw in large uh contractors to do this uh some of the local contractors that are here or in the area doing work um specifically uh some of the ones that are working with FKA they're doing um I I forget what the project cost of that is but it's it's up there in what the $20 million range uh plus uh they've they just been awarded Ed an extension uh for the windley key portion of that it's you know comparative on the cost you're not going to get as much um companies coming up from the Lower Keys to do to do work or and the same thing from Miami Dade to come down and do that that type of work go ahead Henry I kind of question the fact that we only had one bid and the popular conception is that Paige is going to get it no matter what I'm serious and the other people that would have normally bid just say the hell was it it's going to go that in that direction I don't know how to encourage people to bid but I certainly don't want to endorse endorse the comments I hear from other people that don't want to bid anymore I guess I'm just going to close my statement with say at some time when are we going to talk seriously with FKA or even kilargo and I'm not done with the waste system yet and I'm not going to mention any names because I have not got their approval to do that but I have talked to some people and I think there's room for discussion and every time I bring this up and I brought it up for sometime it just gets shot down there's no interest in it well I I'm going to create some interest to satisfy my own curiosity and I have interest so that's all I can say I have not gotten the approval to mention anybody's names in relation to keygo and the Wastewater but once I do I'll tell tell you where I am so that's these are com comments that are forwarded to me by the public and uh 99% of the time when I bring up an issue somebody brought it up to me so that's that's where I am I'm not opposed to you personally you have to understand that but I was elected to do a job and if I were in the private sector I'd be doing it completely different quite frankly the worst thing about government is government I've said it forever and ever and I'll say it again so but I have to now live within rules that I never lived with with before and I understand some of the rules but some of the rules just they carry on they carry on and committees and whatever and uh when I make a statement the public is confused as well so that's it that's all I want to say well I I talked to AJ today in my briefing with Mr Cole and the rest of the staff that was in there and I understand because I've called the Lower Keys and some of these people to come and and bid on these jobs but they're not going to come here for a a $360,000 job they don't they're not interested in it they have enough work where they are AJ just mentioned these guys the one guy has a $24 million bid he could do the work but they're not they're not going to pull off a $20 million job to come over here so you know uh you know Mark is right here um you know he gave a good bid what what are we going to do got to get the work done so I you know I I don't know what we can do people don't want to come from Miami I agree with you but I have to make the comment I know I I understand Henry but you know not everybody in their brother does Wastewater work a lot of people don't want to mess I mean personally I never messed with live waste because I put brand new stuff in I did it for the aqueduct but when you're talking raw sewage you know it's a whole different ball game so I don't know Council you have something Elizabeth I I wanted to say something you know this every time we have a bid proposal or something and Page excavation is on there especially when it's the only one that responds you know it just seems to to draw negative comments and I think that is entirely misplaced um Paige Excavating and Mark paage have been here many years they've developed a specialty of working on the village system they know it better than anyone else and one reason that many of the contractors don't want to do this kind of work aside from the fact that it's nasty work is the fact that have you seen the houses that they're building around here lately they can make so much money more money building pretty big giant houses uh I heard one bid for a house that was $23 million to build that house in this community that's just the construction cost so so Mark and and paig Excavating has dedicated their professional career to doing work in the village they have other opportunities they could pursue but they focus on us when we had our sewer pipe main that runs up to kilargo burst at about where the radio station is in tavanir uh Mark page was the only one that was able to go out and stand in waste deep RAW live sewage in the middle of the night and make that repair and I think he did it twice so no one talks about that stuff when we have these conversations and I think that's terrible and what we should be doing is thanking him for bidding on this thanking him for coming back when no one else would want to do the job because if he didn't bid we would have to overpay someone from out of town to come down and do it that doesn't know us and probably doesn't care and might not do a very good job so I'm ready to approve this and and I'm going to make a motion that we approve it Elizabeth yeah I I I wanted to just make kind of reiterate what you were saying that every I mean we're kind of in a spiral about Wastewater and Paige and AJ so every time he asks for something then there's just this shade cast over this system and I I want to move on with that and so if if part of that moving on is is that because you a lot of people have brought up let's look at an alternative situation if that's going to help us move on then let's give that direction and we put that on the after action report and um and so that we can just I mean we've had this conversation multiple times we need to we need to either stop or give some direction to our staff to to make um a an exploration and that is on a staff level not an individual level because I mean uh me going to talk to whoever is is not helping it's it's an administrative issue so well I'm happy to move on tonight I think there's a bigger question here that that's really important well I mean AJ told me today what the we the pipe crew has busted our sewer main twice already right who we got the fix of besides Mark so yeah in the last 5 days uh we've had our Force main bus three times um five days yes twice by the aqueduct uh one of them was a faulty part um on a connection that was the both of them happened at the same time uh they made both repairs on the same day uh no questions asked um that was yesterday okay all right okay so did um yeah and there was a couple that that caused a couple backups even didn't it yeah there there were two homes in lower mat that had a backup um that or why we don't competitively bid why we wave competitive bidding and um and I'm here again to say the same thing I'm questioning whether we are large enough as a community to try to maintain the system on our own perhaps we need the equipment and the expertise of a larger group and I don't know why we don't at least talk about that it just seems to me that that you know we we're we're not but um is he the manager Peter Peter's the manager right was he there yeah Peter was there y Kevin's the assistant manager for the county or Now Kevin now he's the administrator yes yes yeah so I just think we need to get some things worked out ke Aro and we can I mean yeah there's been talk either kilargo or the or the aquad do so are we asking to put it on our report and ask the staff to address of violence Florida amending chapter 2 Administration article 24 finance division 242 purchasing amending section 2- 236 authority of Village manager to update the signing authority of checks amending section 2-37 guidelines to provide for increased amounts in purchasing Authority providing for severability providing for inclusion in the code and providing for an effective date um I'll be brief I don't know if if you all recall this from last month um this is a an item there was an a a bunch discussion o over a number of months about potentially increasing the purchasing authority of the village manager this item would accomplish that it would increase it from $25,000 to $50,000 um and it also allows for under the Florida Statutes there is a um a section that allows for faximile signatures on checks in Le of manual signatures it would also invoke um that provision in the statute I mean obviously we'd still have to comply with the with the provisions um and the requirements for that but then would would allow for fact simile signatures should that be necessary Council nothing to say but move for approval when public comment's over public comment we're going to do public comment right now uh Marne we have any takers for public comment yes van Cen head okay evening Council I'm going to reiterate what I said the last time $25,000 is a lot of money and uh it's it's easy to link together a bunch of $50,000 uh truncated million doll project under the offices of the village manager I think $50,000 is uh not necessary it's $25,000 is proven to be sufficient for 25 years and I would like to hear from Mr Cole uh he could convince me if he thinks he needs that $50,000 in lie of $225,000 I would like to hear why and uh how much easier his life would be if that were true and the five of you are very Blas about spending other people's money and 20 well you know you vote against it if if you're going to shake your head okay all right I I I'm looking to see uh the continue status quo of $25,000 and I think we're making a mistake by doing it another way because if you had a big project you could divide it up truncate it into four or five different parts all for $50,000 or $49.99 and and all of a sudden you got a quarter million dollar project that that is not uh underneath uh any uh control of the Village Council it's only at the behest of the manager so I like to just hear what Mr Cole has to say about uh how important this is to him and whether he could live without it thank you very much Marne any other public comment uh let me double check on Zoom I don't believe so no that's it okay um rob you got anything you want to say well I I think that you know it was discussed at our last meeting that the last time an adjustment was made in this number was I I think 2008 or so uh so with the logic still holding if you account really just for inflation alone certainly that merits an increase in the manager's Authority I think with a professional manager in place you're looking at someone who believes in uh strong fiscal stewardship and accountability uh so I don't think that someone in my position would abuse that Authority but only use it uh when it's necessary and is in the best interest of both the organization and the Isam Mara Community um so I I'm hearing you know the the concern about that but operationally I think it works and as long as as the person in my position mirrors my commitment to high ethical standards and uh again uh fiscal accountability I think you're going to be fine and and that adjustment over time um may or may not be even north of the number we're looking at and I'm not arguing for more I'm just saying um that can be managed within reason and and help us to be more efficient thank you Council any providing for requisite ballot language providing for notice of the election providing for authorization to Village Clerk and for village campusing board providing for separability providing for inclusion in the the charter Conformity of amendment and providing for an effective date uh this is also an ordinance on second reading um I can go into detail if you all would like if you uh if not um let me know okay uh Council want to discuss this I'm comfortable with the way we did it last time okay anybody else okay I'll move to approve okay so let's uh have public comment then since there's spoken already twice in referendum about having four-year terms they have voted uh overwhelmingly that that is not their preference and yet this seems to keep coming back up because people do not want to take no for an answer and uh I I just think that it's uh not reflective of a democracy to continually ignore the population that votes against some something and keep bringing it back and we have we have proven that the the First Council uh was a was pretty much a four-year disaster in other words we had so many things that went went on in that first four years stin that were that were just outrageous that we're still making up for I mean the the zoning changes that were made uh I'm there's all any number of things the the property next store that was bought by one of the sitting uh the sitting vice mayor with with State money and that that knew was using his seat as a place to to uh uh have Insight information because he knew we were going to buy plantation in not Harbor those are the kinds of things that you can set up if you're there for four years and if you're there for eight years if you can redo that again you can do a lot of damage there was a lot of damage done the people remember that and the fact that you keep re trying to do this shows uh bad faith in my opinion and I really hope that you decide to leave things the way that they are if you can find out a way the the most uh the three most uh vote Getters uh find a way to stagger it other than making it a four-year term uh that's open for your discussion but I urge you do not go for foure terms it's already been quashed twice overwhelmingly by the population of Isam marada and if you do it then woe upon you thank you thank you van Marne any other public comment no sir okay public comment is now visits and lots of people in the community have an opinion on this so I I can't even begin to name everybody but a lot of people have been talking about this soeth um I I spoke with Jocelyn about this probably maybe before it was even before it even she she even started building so briefly Chuck TI uh suer and vice mayor were there any names that you do recall just so we can get that on the record if there's any you do recall um Sue definitely um probably Deb I think maybe at one point or another maybe I was watching the LPA meeting and I can't even just you said I I the doctor and he's the neighbor he's a neighbor yeah I don't know what his name is the orthopedic that's her neighbor so they've come to see me multiple times so and I I wish I knew more of their names next time I'll make uh Jennifer Deo your planing director here this evening with um two two requests one by windley Cove LLC and windley Isles LLC um they are for a future land use map uh Amendment from residential medium flum to mix juuse flum and a zoning map Amendment from R1 zoning to Highway commercial zoning both propert well the addresses of the property are 85327 Overseas Highway and 85331 Overseas Highway they are um neighboring Parcels um immediately adjacent to the property known as Hog Heaven um they are new newly constructed two residential homes um on each on 13,300 Ft of land area and hold on let me I'm using my computer for the first time instead of my book so it's going to take me a minute sorry um okay so the subject property as I said has existing residential medium flum designation the surrounding properties to the South are also designated residential medium flum to the north the adjacent properties are designated M mixed use the properties to the west across Overseas Highway are designated conservation and to the east is the Atlantic Ocean the character of the subject property is single family home with some Mangrove Wetlands to the east of the property and the surrounding area is mixed use with a collection of restaurants Marine uses single family residences and conservation land um the subject properties also have uh currently existing residential single family R1 zoning designations the surrounding properties to the South are also designated residential single family R1 to the North and the adjacent properties are designated Highway commercial the properties to the west across Overseas Highway are designated as conservation and to the east again is the Atlantic Ocean sorry I have to keep going back and forth the proposed F Amendment from the residential medium to the mixed youth in conjunction with the companion application for the zoning Amendment from residential single family. Highway commercial would allow for the applicant to pursue acquiring a vacation resident a vacation rental license on the subject properties the request is also to allow the property be included in the Wiley key mixed use area one we as staff had reviewed that request and we have indicated that we would request that the property be included in the Wiley key mix use area 2 which is Po policy 1-2. one14 point4 um that policy allows limits the commercial density on the property it only allows single family residences to be built which would mean that all that could ever be built there are the houses that are existing there today the areas designated mixed juice on the future land map recognize the prevalent and historical mixed juuse patterns of the development in the village the mixed use designation shall accommodate a mix of commercial and residential uses it may be located in the same building limited public and semi-public lo uses re recreational facilities schools marinas tourist oriented facilities and supportive Community facilities ancillary to permitted uses pursuant to the standards in the comprehensive plan and Land Development regulations the proposed flum amendment would alter the development potential of the subject property by allowing one additional market rate unit and five affordable housing units the new flum would also allow hotel motel density as follows six rooms per six rooms or units per acre or 12 hotel motel rooms per units per acre with tdrs and non-residential intensity of a quarter of a a 0.25 F or 035 f with tdrs or working waterfronts however by adding Again by adding the properties to the windley key miix juice area too it would not alter the development potential other than the single family homes in your packet there are uh several uh policies of the comprehensive plan that um we find the request to be consistent with um I'm not going to go over each individual one unless you would like me to do that um also in your packet outlines how the proposal is compatible with the principles for guiding development in area of State critical concern um and then let me just go to the zoning one so the zoning map and Amendment um the pursuant to section 30- 696 the purpose of the highway commercial zoning district is to accommodate existing businesses along US1 and to provide opportunities for new commercial retail shops and services that are typically are autod dependent and are used by people on less than a weekly basis or to accommodate the building and services trade single family or multif family residential uses and educational uses are an option to commercial use any future development of the subject property would require a site plan application approval this will ensure that the subject property meets the standards of review of the comprehensive plan and the De Land Development regulations including but not limited to requirements for minimum open space habitat preservation concurrency management and level of service standards for transportation infrastructure waste water storm water and other public services off street parking and internal circulation required setbacks Landscaping dedicated conservation easements for existing habitat on-site and off-site improvements and Design amenities required to achieve land use compatibility for surrounding land uses into zoning districts but again by putting it in the Wile key mix juice area to it would not be any future development proposed for this only just for this uh new new change and any application for a vacation rental license would also have to meet all the criteria division six of the village code and then there are also uh in your packet we reviewed the proposed zoning a map amendment pursuant to section 30- 411 d4b of the code of ordinances which says that the Village Council must find that the application is consistent with the comprehensive plan the applicant has complied with all the procedural requirements of the section and that the maintenance of the existing zoning of the property does not accomplish a legitimate public purpose The Village Council shall make the determination on a finding of legitimate public P purpose based on one or more of the following factors the for the proposed zoning District in the village in relation to the amount of land currently zoned and available to accommodate that demand currently the village has 140 lot zoned Highway commercial about 20 of those lots are vacant windley key has four lot zoned Highway commercial and none of those are vacant compatibility with the site's physical geological hydrological and other environmental features with the uses permitted in the proposed zoning designation the lot is already under construction as a single family house data errors including errors in mapping vegetative types and natural features described in the comprehensive plan there is no evidence that there are any errors in The Village's GIS data records or other resources new issues there are no new issues to be addressed recognition of the need for additional detail or comprehensiveness there was no recognition of a need for additional detail and the compatibility of the proposed district with the property surrounding the site of the requested resoning and any applicable neighborhood or Redevelopment plan the proposed zoning would be compatible with the property surrounding the site as the properties to the north are also zoned Highway commercial LPA heard these requests on January 8th 2024 and voted 6 to1 to approve the requested Amendment um and at this time the staff has reviewed both all these requests and are requesting are recommending uh approval of all of the zoning changes the flum change and the addition to the properties in the windley K mix juice area too I'm available to answer any questions that you may have CC any questions for uh Jennifer okay all right thank you so do we need to uh and then participants in opposition are called up after that okay all right um good evening I'm Jocelyn tman 127 Coconut Row um all right I'm a little nervous all right so um I bought these properties 3 years ago um they had allocative billing permits when I bought them um I didn't like the house plan that was on there I redrew them submitted revisions and of course what you see today is what I designed um very proud of what I built um it's taken me two years to get to this point to get them up I've put a lot of hard work in it um I might not be the one that swings a hammer but I am the one there five times a day giving direction and making sure everything is going as smooth as possible um I'm not a big-time contractor my father used to call me a guppy in the world of sharks um I just try to get my piece of the action to support my family and I have four kids and you know just trying to help them out in their future to give them the same hand that my father gave me um as I started building these vacation rental sorry building these properties um you know I brought other contractors over I brought other Realtors over just to give me their opinion um as the proper properties were going up um and as I brought more people over there it was always a comment you know these would make really great vacation rentals um when I originally started this project in no way was in my tent to do vacation rentals I wanted to build two beautiful single family homes um that was my intent from the start but just Gathering feedback and truly thinking it through and honestly listening to some of the noise coming from Hog Heaven which of course I knew what Hog Heaven was at the beginning when I started this um you know my decision started to change that this would be something worth going through and trying to accomplish just because I truly do believe from the bottom my heart that these are excellent vacation rental sites um you know Wiley key as you all do know is the vast majority of commercial related and tourism oriented key um you know you have surrounding including me surrounding commercial properties such as Hog Heaven Island Grill SD Marine you have boat rental companies and new SD Marina right there beside these properties um you know further down the line you have you know Pelican Cove drop anchor postcard uh you have Sunset Cove OV the theater which is all on Wile he um you know so these properties Wiley key is you know the one key here in the village that has the highest commercial density use and the lowest density residential use um there are only six Parcels on all of Wiley key that are zoned R1 um and I own three of those Parcels to of course with my two properties the one to the north side is hog heaven but the vacant land property that has an active building apartment on it right now to the South Side is my property as well which I intend to build my own personal home on um so this is not your traditional key neighborhood and it's really not a good property that's compatible with long-term use um so I think you know just given the location that you know it hopefully have strong consideration to be able to do this vacation rental you know by doing this flum and Zing change with my proposal um underneath the sub area District too these properties will remain 100% residential I am not asking for any commercial uses I'm not asking for any other businesses other than vacation rental use um so there will be no density change there will be no intensity change it is still going to be of one family use at a time I mean I'm a family that has four children you know I know in our last comment at um the LPA they asked it to be an 8% occupancy home which I was completely fine with if that was for a vacation rental use you know I think about my home and that's the reason why I built them these sides is I think houses should have four bedrooms you know that's just how I was raised and what I needed for my own family use as you know I raised my kids um so in essence I know some may not agree with this but to me there is no up zoning when you're still keeping it completely residential with no other accessory use other than the residential of a vacation rental may start keeping it vacation rental with a family in it um out of the 331 vacation rental licenses that are out there 260 of them are currently active I verified that today so there's 71 vacation rentals out there still which are automa not not are eventually going to be used on properties here in the village it only makes a lot of sense to steer those vacation rental licenses where you have the least low impact Des density residential use in such a high commercial area it is very fitting and it matches where a vacation rental should go not to have it where it's going to be disturbing neighbors or children riding bikes or anything like that I mean right there in front of those properties you have the trailer storage you have the boat storage I mean people whiz down that Highway um it's not like it's a regular typical residential neighborhood um you know just 500 ft away down the street you have the Anglers Reef from what I could count on the current property appraisers map there's already 19 vacation rentals right in there um and then you also have peaceful Palms down the street which allows the 7-Day vacation rentals as well um so Wiley key does propose a perfect spot of having these multi- vacation rental licenses um back in the v sorry before the village was incorporated in 97 um these properties were actually zoned Suburban commercial and they were part of those group that got changed um you know to R1 which you know um so you know if we do change these back to Highway commercial um at least you know we'd be staying consistent with the zoning next door making it a nice gradual transition to residential for the few remaining homes that are beside me um you know I wanted to State for the record too you know I do have active Observatory deck permits from the D and Army Corps um you know I do recognize that you know those are not docks that they are not for boats they're not for kayaks and no dockage of any time allowed you know whatever buyer does buy the property you know i' be of course the license would stay active and if they wanted to go to the village and get a um permit from them along with the de and Army Corps that is the buyer's responsibility um I know there was a small erir in the MLS that had used the word doc after Observatory deck that was immediately changed whenever I realized I had made an error it was not intentional but I just wanted to state that for the record um and I just want to really say before I do turn it over to public comment that all these decisions to try to get these vacation Ral licenses are of mine and my husbands we are the owners of the properties we developed the properties um I had no outside influence from anyone trying to change Used to Vacation Rental uses other than my own decision of wanting to do them um and I just asked when before again we go to public comment too that you please please respectfully make these comments to me and not to Mark who recused himself in the situation because this is my items and I take it very incredibly personal whenever he gets attacked for my doings and my requests I just wanted to state that um and just closing you know this location for these properties you know it's it's a fun spot you see a lot of activity there when I stand out in the balconies I look out there you see the kite Surfers you see the sandb bar you see people going through Snake Creek you see all the people at Hog Heaven it's a very active spot and it's a great spot for purple people want to visit down here that want the night life they want the boat ritals they want the sea life attractions and it's a really great place for people to come and spend their money here in the village you know time after time staying in a nice house that offers that vacation Al use and I just really hope everyone can really strongly consider that with those remaining licenses that are left where they would best be fitted in our community and I truly believe from bottom of my heart and I hope everyone will give it strong consideration that this is an excellent spot that does not deserve disturb the working people of the village it would be a great spot for people to come down and stay for a week and enjoy and go back and tell their friends how wonderful you know the Village VI marada is so um that's pretty much what I have to say and oh one other little small comment I know you mentioned you talked to the helicopter guy I haven't talked to him since whenever I initially started this whole project and um I know before I even submitt my application I talked to him and he told me from his comments that he was completely fine with me doing it on those two properties but he just didn't want the property besided him do it and again that was maybe a year ago when I started these applications so I don't know if his thought process has changed but whenever I called before I even I called on my neighbors to get their input on how they felt about it I had no negative impact on it at that time so when I spitted my application it was with my thought that he was good with it if he is not I don't know um all right so turn of any questions I guess at this time or does the public comment go any questions Cel for joshlin okay all right thank you joshin all right sorry if I wasn't the best speaker tonight I'm a little nervous thank you okay John should we go to public comment yeah and so it would be anybody giving testimony in support of the application would be C up first okay Marty we have any public comment that are in support I don't have anyone specifically signed up for support but uh we do have Deb Gillis without a position noted okay okay who's in support if they you're signed up you can come speak or anybody on Zoom Marney there no Zoom testimony what I think okay well you'd think I'd know the procedure by now but somehow I managed to forget it uh I'm Deb GIS I live in Isam marada and I do sit on LPA and we did vote uh 6 to one uh in favor of this and we we considered it um not an upscale because of the zoning um help me with the term the um Wiley key District 2 yeah the Wiley key District 2 that only allows for the vacation rental um everything seemed to be above board uh uh to the LPA so um I'll be here if you want any more comments about what we talked about thank you next right Marne any other public comment do is there anybody here that wants to speak in opposition yes we have van Caden head and S Miller what's that no no not not on no it it is public comment is timed at 3 minutes we made that change in the Village Council procedures y can I make a point here starts youly trun Van van we're not we're not going there we we're going to we're letting you talk for three minutes but we're talking about four things I want 12 minutes you talk you work that out with Mr quick because not that's not John what is the situation here you tell us the protocol I would air on the side of caution and then go with the 12 minutes if you that's how I would do it since since there are four separate items yes thank you John I guess I need to talk slowly Sue Miller lower matumbi um I think we all know that there's one thing in Alam marada that we don't need more of and that's vacation rentals we hear the vacation rentals are the bulk of the code enforcement work we hear noise complaints we know that they impact traffic they increase the demand on our Workforce and it's interesting to me that um one of the prerequisites for determining whether or not we should process a zoning changes to determine if there's public purpose I don't see where there's any public purpose in keeping a single family home a single family home but just changing the zoning and um and so so I don't understand why you would do that at all and um the staff report is clearly designed to help a property owner without regard to the concerns of the community as a whole each time a property is Zone rezoned we are ignoring the trends that have been documented regarding vacation rental uses versus long-term usage of dwellings more flushes more cars more trips more extreme cutting of the mangroves out front to improve the water view I think it's just time to say no I think that that we've seen in the past when a property is rezoned or a major conditional use is approved for something that might be objectionable to a neighborhood that we always say well the neighbors bought and knew what they were getting into well these neighbors bought and didn't know what they were getting into because the property was not zoned for vacation rentals and and I think that we need to preserve the right of neighbors to have the quiet enjoyment that we all uh expect in ALA marada thank you very much okay Marney who's next Ben good evening Council um I was here and spoke to this last time and because uh uh in 2019 I was on the LPA and and uh heard how this uh building process came to be I have here a copy that's been filed with uh Kevin Mok in Monroe County uh it uh talks about a u conference that was uh Mark Greg applied for uh an appeal because uh he said that the address was uh on US1 and he wanted it says uh I'm quoting here cons the determination of whether each parcel considers to be fronting on us one for affordable housing all right so the the the basis of of his uh request was for affordable housing this is in 2019 and we still have not uh definitively said that th those two properties are not on us one they are not Froning us one and uh Mr Mr Greg uh said that uh in the last meeting that uh my memory is faulty maybe I was getting a little old and I didn't uh wasn't able to recall exactly what happened I sat in the room and I know exactly what happened I watched it happen and my memor is good so far and it says Uh Uh u Mr Greg profer to withdraw his appeal except for the portion seeking a determination of whether each parcel is considered to be fronting on US1 so essentially that was that was the whole basis of the appeal so he didn't he didn't uh back up at all and still wanted it to be called fronting on us one now the the director presented the written recommendation to the staff I'm quoting here of dated November 21th 2019 and uh it it says the director's interpretation of the code is not supported by the facts presented now that's incredibly stupid because the it's the the the facts are there by the side of the road it's not on US1 it should never have been granted for affordable housing that's how the original problem got started right there and uh it says that the D as uh I'm quoting again the the uh the council supported its decision by competent substantial evidence of record and and administrative repeal submitted by Mark rig is hereby granted so he was granted this Appeal on on ridiculous circumstances because anyone who goes to that piece of property can see that it's not on us one and and uh the people who voted for this were mayor Deb Gillis vice mayor Mike Forester councilman Ted Davis Ken Davis uh Cheryl me's councilwoman and Jim Moody who's they call him a councilwoman here but he's a council man but they voted 5 to give him uh this this uh dispensation this is wrong this should never have been done this was this is a uh to me it it shows that somewhere along the line uh someone did something wrong because you can go to the property today and look at it and it does not front on us one and the fact that she wants to uh Joselyn is a lovely woman her mother is a lovely woman and Mark used to be my friend but what happened here was false pretenses this this whole operation is a house built on sand it was it was it was faulty back in 2019 and they okayed it and let it roll up until this point here and then Mark sold the property to his daughter and and his daughter has nothing to do with this you know his daughter has nothing to do with the the the laying of the foundation of this deal and and uh I told Mark I says I'm not I'm not done with this Mark he says well you can continue at your Peril now at my Peril that sounds like he didn't didn't like especially what I was trying to say and I was just trying to tell the truth which is what I'm trying to do to you tonight because I was there I can say without a shadow of a doubt that that this was was uh uh gotten in a disingenuous fashion and the the director of of uh planning said that it was not uh the address was not not uh fronting on US1 and the council went against the planning director's uh decision and awarded him the thing anyway so um I think you you you should listen to to uh the the intensity and density are certainly going to increase if you were to if if uh Mrs Tedman was allowed to sell each one of those homes as a single family home ru1 and then end of story somebody is going to live there permanently and she can get the price for two of those be beautiful homes I mean they both have indoor swimming pools I mean they're they're plush their Ford bedroom is beautiful but but by the same token um if you put in a vacation rental uh who's to say that that uh 12 college kids are not going to chip in and and do it and you know rent it for a month who's going to say you know 2500 $1 a night you're going to have a certain level of clientele but you're also going to open it up to a lot of people that want to break up the the Tariff you know and split up the cost and there you go because then then you got more boats parked out on the on the highway you got more more jet skis and cars and traffic and all that going on in front of that vacation rental uh little mini Resort there and it's it's doesn't line up with the quiet enjoyment of life it doesn't line up with what should be going on there it's going to definitely increase the pop the the intensity and density of the activity on that property and it's going to make it so that instead of the profit that that the Tans are going to be able to make from selling two beautiful homes to two people they're going to be able to have a cash cow thanks to you that goes on forever and ever 2500 $ a night with different tenants every seven days or 30 days or however they decide to do it so I would say let this be uh ru1 if if uh it was it was originally designed as as the r it got the project got started by applying for affordable housing and it was in the they used the the uh us one fronting as the way to get affordable housing well that's just not right that's just not true and it wasn't true at the time that the council uh I think corruptly allowed him to go ahead with with his appeal and they granted him the appeal he should never have won that appeal the planning director made the determination and the whole Council voted against the planning director now somebody somewhere has got to be able to have the common sense to see that those two properties are not fronting on us one and should not be vacation rentals they should be two beautiful dwellings that uh are on the market with the open houses to sell them to people that want to pay that price thank you very much all right Marne any other uh public comment no sir okay all right public comments closed Council any any further discussion or and and just a reminder um final arguments are available to uh the applicant and staff if they if they so choose okay joshin you have anything any rebuttal you want to yeah just want to clarify from the statements uh you know when Mark decided to sell these properties they were actively listed for five months on the open market in the MLS you know entertaining any offers that came through there was not a single offer on those properties in 5 months you know then yes we did make a deal to sell and I purchased him um whether or not the address is us one not us one has in my eyes absolutely no relevance in the world what we are trying to discuss tonight and is so far off topic and I don't like it being clouded because I feel like this is a serious matter and that has absolutely nothing to do with it um and if he should try to get affordable housing everyone should be applauding him I'm trying to get affordable housing for the community his decision not to be able to build those affordably with the you know cost of construction getting so high over these years was probably a great decision because in order of course to sell something affordably I mean you need to have a working crew that you own to be able to make those so affordably where you actually can make any type of profit on them so it was a great decision for him to sell them and and I bought them I strongly considered affordable housing as an option as we had talked about it and my numbers just did not work to be able to make a profit on that and I'm very happy at that decision because expensive they were now to build I would have not have succeeded I would have failed um so again I just I'm very upset that that clouds this topic of what should be focused on tonight and to make a statement too there is no indoor swimming pool so um but just wanted to CL clarify that um all right so please feel free to talk I am here to answer any questions you may have but again yes I know vacation rentals are looked down upon but you have to be realistic for the location of these properties everyone knows what Hog Heaven is everyone has seen what Wiley key is in the tourism and all the commercial uses there these very realistically would make great locations for people visiting our community I don't see how that can be overlooked and I respect any decision you make but I just really hope that you can consider that hard and just really look at the overall picture of it so here to answer any questions thank you thank you joshin any questions no I don't have any questions I mean I could make a are we discussing are we having discussion is that where is that the point where we're at now just can I just clarify one other piece of information I'm sorry um I just wanted to point out that um there was never uh if there was an insinuation that there was affordable housing allocations awarded to those two pieces of property um there were not I have two resolutions here resolution number 20- 0 4-27 and resolution 20- 0647 both of which were which were market rate allocations awarded to each individual property in 2020 andri you have anything you want to say no no vice mayor go ahead Elizabeth well you know let's get on with this um so um yeah I have some comments on this um I don't think that to to to be fair to this applicant it it's clear we're not having conversation about these other issues that continue to to to come into this conversation this is not about whether the address is right or wrong or what the address is nor does it have anything to do with affordable housing and so we're putting that aside um uh the um I I would point out that this this woman um at Great expense and risk um went into a building project and it is pretty amazing and and I appreciate that you acknowledged building um entering into this building um with the intention of building single family homes and then Midway decided to move in this direction and so thank you for acknowledging that um because um that would be a reason that that um some of these difficult issues are around making this zoning change um easier I mean you could have addressed those earlier right what what is what is challenging to me here in in and it speaks to some of the bigger issues that we have with planning our community as we move forward is that that these conversations are not black and white there is Nuance here and what what what I see when I look at this request um I think well the problems I see in looking at this request I think could be handled with some nuanced um restrictions which we've done with other properties so for example um you know it doesn't this this report um and this recommendation doesn't address the very real fact that density will increase so if I were renting a four-bedroom home I would bring my four my my four couples and we'd all come in our four cars with our equipment and and is there ample parking is there boating I mean where am I going to park my boat my jet ski that's going to come on the other side of the road I mean that's sort of that is what I think and there are two beautiful I mean beautiful homes right next to each other so now when I think of worst case scenario it's okay now we have eight cars and four jet skis I mean that is a that is a mess right and that is a space where everyone runs on the old road to get onto the US one I mean that just complicates um the uh it's it's just like I'd say absolutely not however as she's saying this is next to Hog Heaven I mean you know I'm trying not to I'm trying to I mean it's it's that's a mess right there too like that if I mean there there's no denying we're not in a nice neighbor I mean it's a nice neighborhood but it is a um it is what it is right it's a party scene right there um so I I guess my request is why can't we um where where is the Nuance in this recommendation where is the Restriction we've done this for example with crooked palom there are 19 recommendations that that we are going to enforce we can't the only reason that mess of a oh sorry that that I I I really want to retract that word I just used the only reason that crooked pal for example was approved was that we had inent we had we had argument in the neighborhood pro and con people were mad about it and our planner said here in 19 um re 19 restrictions that we're going to place on this development and if they're not followed we're not going to we're not going to allow this to move forward and and we discussed it earlier tonight I mean we can't deny that we that our zoning is um is unique it's messy um you know would would any of us I mean and and and and here and even in this conversation you know I am torn with how to move forward but we're not giv I not this is no offense to to you Jennifer at all um because we didn't ask for a nuanced approach to how to make this happen I mean you know the single family that's going to live in this home um um is uh you know to and that single family flushing their toilets a reasonable number of times with their two cars in the garage would any of us deny that no I mean it's single family great buy the house move in live your single family life I mean um but but what we're doing by saying sure make it a vacation rental bring all the people all the toys that's a different single family it's no longer a single family experience so I I I guess the the the discussion here might be where is the Nuance in our planning considering the reality of that location and our really messy um zoning scenario that we have in Isa marada I mean we've got single family next to next to Hob Kevin I mean you know that is that's pretty messy so I'm not sure if I've provided a solution but um or really much of anything here but but perhaps it's a it's a it's a starting point to a conversation but I think joshon already said they built next to Hog Heaven she built knowingly Heaven's right there I mean that's what did she you know so so not I mean just just as a point you know I don't care what you do in your home as long as you don't I don't care like how many times you flush your toilet as long as you're you don't have your cars on the right away and your noise I mean you know that and I don't think that's what we're arguing here I think we're saying single family home home um implies that you have a certain amount of use a certain number of cars a certain number of overflow in and and um inconvenience to your neighbors and and when we think vacation and and vacation rentals we think overflow noise drunk people you know like it's a mess so you know so period anybody else you John by uh by Council no it's not uh yeah I would like to make some observations but I'd like to do it at the end to address if there's more than Elizabeth speaking so I don't want to waste a lot of time Henry you have anything you want to say I think we're at the end Mike U Henry can you lean up to your I think we're at the end you're on Jaron you want anything say anything this this is really a crummy situation to be in um the neighbors do have a problem with it uh especially the wives so I don't know if you talk to the husband or you talk to the wife they're not happy about it okay she's not happy about it and whether here nor there um I'm sorry the old road thing does rear its ugly head because now we've set up precedence which I can't stand that term to be honest and uh it is the old road it's not on us one and that is a part of the decision it just is you are increasing the density big time you're uh um the thought of a family coming in and giving each kid a bedroom let's be realistic that's very very slim when you know it's going to be couples or kids or multiple kids coming in um they are beautiful homes but you did build them knowing you're next to Hog Heaven and whether the rumors have been true how this whole project got started they are around and that's part of the decision where were they ever meant to be affordables were they single family you know were they meant to be vacation rentals all along I don't know I'm just looking at the fact that that area is so congested to start with I can't imagine what it'd be like to live next to two four bedroom homes with 20 kids coming down here and that's who's going to want to rent there let's be honest they're going to want to go to Hog Heaven they're not you're not going to get Mom and Pop who go to church on Sunday with their kids in those vacation rentals I mean you have to address the facts that are right in front of your face and that is I know you want to talk and I appreciate it but I'm just saying that I know the type people that are going to be attracted to these vacation rentals and it's just going to be one problem after next and I appreciate Elizabeth trying to find restrictions but let's be honest about that we can't even keep up with what we've got and I wish our code enforcement was better and I do and there are problems which we can we talk I'm sure down the road and right now um somebody who sent me an email which we all got and it's a little off topic but somebody in their neighborhood was allowed to do something under certain restrictions and those restrictions were never done and yet nobody's ever checked on that and that'll be coming up but it's the point is is that to put more restrictions on somebody you just have to question how are they're going to get enforced who's going to do the enforcing and I just think you're in a dream world when you think that everything is going to be magically enforced I I just have a real problem with this just because of where those houses are so go ahead [Music] Henry John yeah I mean that they made the closing again if if Council has questions of of the applicant or staff or anybody they they can ask them but I think my comments are much broader you're going down to the n Equity so to speak I'm very much in favor of controlling the growth maintain the environment all those good things that many councils before us should have paid attention to and not try to appease everybody I voted against my friends twice I don't think anybody else has the years I've been here but that was the right vote and I'll continue to do that I've represented a lot of people in my day in court [Music] and sometimes I'm not proud of what I did but I had to represent the guy that was paying me but I got a whole group of people that are paying me to do the right thing so when I vote Yes or No it's not that necessarily what you're going to like and making considerations I don't make any considerations if I can help it it's either to me it's a yes or no that's what I'm getting paid for so I'm not going to disclose right now which way I'm going but when I go I'm representing hopefully the people that voted me to do the right thing that's all I have to say I I I uh personally right now it's a very hard decision but I I don't have any comment I think you guys have spoke it I mean I think Mark I know I I have got some phone calls about this this Front Road footage thing which I know that has nothing to do with joshin I've had a lot of K feedback come to me and saying you know that this isn't right you know it wasn't but yet somebody just read whoever maybe van read it that the five the council voted at 5 I mean Cheryl M was one of them too that voted for it all right and I know this what joshin just said because the sign when I went and looked at it when I ran in 2020 it said eight affordables or two Market rates and Jennifer just clarified that the the the affordables were never applied for and then then joshlin Mark you told me that joshin had bought it and was going to you know do her thing there which you didn't and the houses are beautiful joshin they are you did an extremely your daddy would be very very proud of you so um you know I I don't know Mark you go ahead I I I really don't have any more to say say well I I don't really I'm not really trying to make an argument in favor or against anything I'm not connected with this except that it's a member of my family but I've heard some statements tonight that I don't think are either either they're not accurate or they're not complete and my interest would be in having you make a decision based on the facts being accurate and the truth so uh I'm going to try to do this in an orderly fashion and I made some notes so Elizabeth I would I would start with you and I think I also heard this I believe um the vice mayor there is a concern about density uh the increased density of the property um technically density is the number of units per acre I think what you might have meant to say was occupancy of the house you know the number of people in the house that's I'm just reading into it all but um the property is currently zoned for single family and the proposed change would limit that to single family so there would be zero change of density if that's a worry there is no change there it is going to if if it's approved it does go from residential to commercial but because it's in the special district the site specific special district and it does have the limitations or the um this the nuanced approach that's as close as we can get to that um if you look at the I don't know how many there are 12 20 different uses that are allowed in the commercial zoning that she's asking for only one of them will be allowed if you were to approve this because the other ones have been eliminated through the site specific restriction that she's talking about and that use is a single family home the only reason that she wants to do that is for the option to do a vacation rental vacation rentals are not allowed in the R1 so District she could have asked for something else maybe like neighborhood commercial or one of the other four or five different commercial designations that are there but I think her intention was to be consistent with the property that's next door the Hog Heaven property which by the way that lot next to her was zon single family and Howard came in with Don Horton and they had that zoning changed five years ago eight years ago so many years ago but within recent times they did they were approved to do exactly what she's asking to except that there was no site specific limitation they can do anything that they want there that's that's in the zoning District so this is as Joselyn said this is a nice little step down it's going from full-blown commercial to site specific commercial to her house where she's going to build for her family single family so she did go to the other owners and ask about what do you think about this and um I don't know the I'll call them the helicopter doctor that's uh further down but if I'm not mistaken he's the last one in the series that the six lots that are zoned for single family and on the other side of him is anger's reef and there are 19 single uh vacation rental uses in the Anglers Reef next door to him if I was him I would be upset about them too but Jocelyn's project is a couple hundred feet away from that so I I don't know that that means any matters that much but I can understand why someone would be concerned about that um so if if you're if you're looking to control the occupancy of the property uh that's done through the vacation licensing process if you're worried about um illegal uses and so forth there that's what will happen when someone doesn't have a license and they do whatever they want and you have to play catch me if I can with those people so I think that there's an opportunity if you want to do it and if you don't I get it I I get that i' I've railed on against vacation rynolds and my statements up here about them but they're primary I had one across the street from me for several years that was illegal and we finally persuaded the owner the outof town owner of that property to stop doing that they were parking on my property they docked their jet skis and boats behind my house without asking me they had all all kinds of other things eight or 10 cars well four or five cars in the driveway that was built for two so I understand that this property has a wall around it it's a compound I don't think they're looking to get outside of that so it's a little bit different and and windley key is not a residential Community it's it's a it's a party place or whoever said that it's party time there so this is if you're going to have to allow these things and we allow 331 of them uh this is probably the one of the most ideal places there I I remember van coming to the podium many times and um promoting the the the allowance of vacation rentals especially at budget time for the medallions I remember he's the one person that uses the phrase you got to let those medallions out we get a thousand and or $100 a year whatever that so I'm not so sure uh what that means but I've heard van say this two different ways about vacation rentals so um I think the occupancy versus the density thing is is something you you know you should consider if you're worried about that if you think people are going to if the house is designed for uh legally designed for eight people two people per room I think that's the legal limit and you're worried about more people being in there that's something that could be addressed in the licensing I know that enforcement is an issue but enforcement is an issue in every single family home in the Village People put as many people as they want in there in the lower priced homes where people can't afford to live here there's I've seen five people in a bedroom on bunk beds that work as waiters and waitresses and dishwashers in places and that has nothing at all to do with vacation rentals so I I think we're we're we're we're predicting the future with fact that don't exist and you can't assume something's going to happen when I was a kid I had a red U Road Runner and my dad told me not to get a red one because I was going to get a ticket and I said how do you know you haven't you know it's just sitting in the driveway well he was right because he it attracted a lot of attention he told me about that so I got in a lot of trouble with that car so but but just because of a fact it it you think something's going to happen does it mean that it's going to happen so your dad was prophetic well he knew me too well um I still to this day don't understand why everybody is so interested about whether this property is on the Old Highway or on us one it fascinates me but the reality is the segment of asphalt that's in front of these two properties is not owned by The Village it wasn't purchased from the county as part of the Old Highway and the property next door to it has a designation of Overseas Highway on its address so does this one that that was changed by Sheila who is our building official who did that because of 911 um requirements when when you go to build on a vacant property that doesn't have an address you have to have an assigned address so that all the emergency services and all the people in the world that want to find you can look it up under the same address that's what that's all about it doesn't mean anything it's just a place where they can find you if you have a problem so it's it's laughable but if that's what you want to talk about it's fine so I don't see that there's any growth here the practical reality of what you can do on that property before and after you might approve this zoning change is one thing vacation rentals there's no commercial uses allowed if both houses are blown away in a hurricane and she somebody wants to go back and rebuild something the only thing that can go there is a single family home so I hope that that might have clarified some things I think that's um I think that's about the end of my remarks I just uh this is an amazing thing to sit on the sidelines and watch so I can't wait to see the outcome thank you is anybody else want to say anything more say anything else well I don't know if un if we have further discussion and I I appreciate your your comments um excuse me um and um so so uh the question is you know so Jennifer can you speak to the vacation rental ordinance and and how that works with when when you have a and and you know what is what what are the stipulations of our vacation rental or ordinance yeah let me just pull it up one second because I'm not another person in my department handles those and I'm not intimately familiar with them do you have like specific questions about which parts of it or just all of it in general well we're asking for this to be turned into a vacation rental so I'm she has to apply it's not okay it's not automatic but that's the only reason she's asking for it so um for the zoning change so what does that mean you have a four bedroom home so eight people can stay or it's two it's two occupants per bedroom yeah I mean I I I get that that that in theory should control it except that we know it doesn't so how do we fix that because I mean how do like how do we fix it that that eight cars aren't there how do you fix it in any house I mean that's that whether it's a vacation rental or not you don't know no they're here to party they're not here or have a vacation they're not here as you reference the waiters and the dishwashers five of them sleeping they're probably sleeping I mean you're you're trying to I know you're trying to justify things trust me I've been sitting here a while now watching you do this year this last year and a half and I understand you have valid points and they're all good but you got to look at what this really is and it's not going to be the nice family coming in to uh have a barbecue in the backyard how do you know that because it's common sense I mean come on I mean for once admit it's common sense I I refuse to admit something that's not a fact okay well so we're going to have an argument about it but you know these These are really nice homes I don't think that you're going to get the budget renters in there that are going to destroy the thing and that's something that's controlled by the owner say that I didn't say they were coming in there to destroy they're going to come in there to parte and that's simple as that you don't know who's going to rent that know they're not so I don't that's also true so I think it's unfair to make an assumption about something that we don't know that would apply to a lot of things okay so sorry so um so considering this location I mean I'm not seeing solutions for any kind of additional restriction on this on this on this um on these two properties considering what one might predict to happen at this super busy location where it's already a big a big mess of cars and so like help me out here how can we make this happen that's what I'm looking for I don't see it really looking for the road yeah I I mean I am I am I'm because I you know if this were in a different location totally different conversation if this were in my backyard I'd be like oh my God this is spot zoning this is just stupid this is Absolut we should never do this this is not that case and so we're ending that it is and um and and and you know what I'm not a planner so like as it is where one could could predict that that there are going to be Boat Trailers up and down the side of that road how do we fix that I I I don't know I so and I'm not and I'm not I'm not the planner so you know I agree and and if there's any kind of agreement well then let's fix that and then let's have another conversation there's a Marine next door so there's boats available there but I just wanted to ask well I I I I get you just said something minute ago you said about windley key man about all the boat trailers and all the stuff down there they're all over the highway I know but but that does I mean that's something that ownership can control but I just wanted to say kind of rhetorically why are we treating the proposed vacation rental use on this property differently than any other ones that we license in the village why is this one being single out and and I could use a strong word like discriminated because of whatever uh it it just doesn't seem right to me either they're allowed or they're not the code says that that there there's a surplus of those medallions that b referred to available because in other vacation rental scenarios you don't have to get a you don't have to spot Zone to make them happen so we're spot zoning what or there's okay I probably it's probably the legal term is not right there's another little term we are CH we are changing a Zone in an in an area in order to accommodate this this this um vacation rental scenario in another in but we don't have to do that when you go and apply for your vacation rental it's in in your Zone that's already correct so that's why it's a little bit tricky and and and what but I don't think anyone is we're not we're not we're all we're saying very similar things in this area it's a very messy location like you're sitting next to Haw heaven so okay it's not it's not like in my backyard where I don't want 900 people coming in with their vacation rent I get it and again there's some Nuance to this conversation that that and I don't think anyone's being adversarial I don't think anyone's being punitive there is no reason that this woman shouldn't enjoy the same opportunity financially for herself and her family no one is saying that but where how do we how do we fix this so that what we can we can imagine happening when eight couple or four couples with four cars and four jet skis come down like there's not enough room there for that how do we fix that and that is a I I don't know I how do you know that someone's not going to open a meth lab in every house in the village I mean you can take this what do we do if this happens argument out to an extreme so I I'm not I don't want to say if there's no middle I mean if there's no solution no I'm there is enough cuz just the way the the hearing happens you can't comment um but um the if there is no middle ground here then I don't want to set I don't I would say no if there's no there and again I'm not the planner so I I don't know like come back somebody fix I'm waiting for a break I'm just waiting for a break in the I'm just waiting for a break I don't want to interrupt so well I am asking a question how do you fix this General well so I don't know that there's any specific fix the the example you used with crooked Palm Cabana that was a development review permit that we can issue conditions on this is a flum and Zoning Amendment and uh I'll refer I'll defer to legal councel to confirm but in my experience you can't condition zoning and flum changes however it may be of comfort it may not be of comfort our vacation rental um restrictions do limit the number of Motor Vehicles and vessel trailers to um only that can be parked on the existing driveways in other areas designated on the property it can't extend into the right of way or the sidewalk um and no recreational vehicle sport utility or ar Motor Vehicles or vessel parked or mored at the vacation rental property may be used for sleeping liver board overnight accommodations they are also required I mean there's a whole list of regulations they're also required to have all these regulations posted code you know if code gets a complaint they're allowed to go on the property um it's written right in here that code can access at any time you know they do get inspections by the fire department and we we are trying to correct a lot of these things through um the inspections and anytime we get a complaint we are doing our best to keep up with that we have two people in our Code Department right now I understand the vice mayor's concerned that you know we we we aren't doing a great job but it's it's a hard thing with two people in the size of the village so we're trying to do the best that we can but anytime we get a complaint we address it so if people see that you're parking trailers on the side of the road and you know it's coming from the vacation rental give us a call we'll address it that's I mean I know that's not the answer you want but that's what I can offer you fine I'm I'm sorry that that the vacation I guess I could have done the research to like pull the vacation rental ordinance um prior to this conversation I didn't do that and I would like to takes time to review that but but Jennifer it it's just like Mark just said and Josh said there's 19 in Angler's re Angler's reef is terrible with all you how many boat trailers are on that right away right there and and do we can't how can we go en force all that I mean windley key has been okay um so I mean I know for a fact in 2020 when I ran for the election and I put a Jeep and I was told I had to get it out of the RightWay so I called an attorney and he told me go to Coral Shores take pictures go to Wiley key and take pictures and tell them to then see about moving your Jeep and you know I I went all over alamada and there's stuff everywhere so are you suggesting that we should fix that problem well if we're going to if if we're we're going going to have code enforcement we need to we need to enforce this stuff if they're if they are a vacation rental and the and the owner is not enforcing it theirself just as Mark just said to Josh lwood and you know if she's going to build a house next door obviously I think she's going to take she she's got a beautiful product but a lot of these owners don't enforce it in Angler's Reef I don't think there's anybody to so are we are you suggesting that we do a trial period of 3 months to see if our own village can enforce their own policies and if that works then great let's approve this otherwise you know what no is that what you're saying no that's not what I'm I'm just making a point of that that we don't we we can't control our our we can't control our code we our own laws is that that's what you're saying that's what I'm saying I'm just saying that but but I do agree that winley key is Wiley key is a very highly commercial area with Coconut Cove with with uh what's it drop an all of it it's a big mess yeah it's a big mess it is yeah and do we need and do and the question here is are we changing a zoning and do we need eight more cars and eight more jet skis I I don't know Rob did you want to I I know that Deputy Mayor Mahoney had mentioned the need to focus on code at a later point in time but in this particular conversation I think you know if the decision and I'm not saying it does but if the decision hinges on whether the village can enforce codes in the public right of way uh I would offer to the council that we can enforce codes in the right of way um and we may come back with a request for additional Staffing to do that on a more routine basis and on a proactive basis as opposed to a complaint basis which is probably part of what we're doing now with code enforcement um but I would hope that uh The Village's ability to enforce its own codes is not a a a reason why Council would feel uh the application as the only reason uh why the application would would not receive uh favorable treatment because uh our failure to do what we should be doing U is is our problem and and we can solve that uh and and I'm prepared to do that if that's council's desire and wish to to be more aggressive and and and come up with a plan that allows those votes all to be moved now people won't be happy with that mind you uh but uh our code requires it and to the extent that we have Council support to to clean up those issues and maintain that on a moving forward basis I can deliver a plan that would do that and that removes at least that part from the conversation let me just say that number one I wasn't insulting our coding no I'm not insulting Paul or the new guy but the point is is that this didn't happen last week this stuff all over Wiley key and vacation rentals doing whatever they want and having as many people this has been going on since 20 years 25 years of the village so for you to say and I think it's great you're going to put on your Superman cape and get on out there fix it it might not be as easy of a fix as you think it is but but that but part of that but I know and I appreciate it because this because no one has ever asked for that or or given the support because that that you're right that's really hard and this Council will be reviled because of it we'll be hated because but but I think everybody complains about it so what you know so so I mean again how do we how do we get to yes with this so okay table this do 3 months of codee enforcement on windley key see if it works I mean and if it does and then we're not adding to what is a just a disaster of a place I mean it's the worst place to sit there and try to navigate that whole entire road yeah but I mean I don't think we can table it I mean she's looking for a decision here if if it's if it's no or hey let's see if we I mean wouldn't it be amazing if you as a mayor like I mean someone LED this charge to like clean up that I mean that is a mess and and we I mean who who no one no one can fix that but this group to say you know what we're going to make a priority here let's clean up this road like what would that look like I mean otherwise just I don't think Joselyn if she can get to yes is mine's tabling it I mean she might sell them in the meantime I don't know I mean we could ask her okay hry go ahead the more you talk the more you convinced yourself of a position you you have to listen to yourselves what's the problem vacation rentals that's the problem you want to fix it or do away with it whatever but that's the problem what they were designed for way back when was to assist a property owner to pay their taxes running out a room basically and that's grown that usage is no no longer the the intent any longer and we have created a problem and to go out and try to fix the problem it's not fixable it's already there it's a detriment to this community it's it's just that simple I mean there is no fix you do away with it it's a problem and you do away with it you don't contribute to it to make it better what's better limit the number of people that can use a house and two people in a bedroom versus six people in the [Music] bedroom where where are you going with this it's a problem don't contribute to it cold a day I run the Monro County advertising commission before the TDC I think I ran it for like three four years that was designed for tourism build tourism the TDC right now runs on a half a million dollar budget or better but they still contribute you go to an airport around the country or in Europe you'll see an ad that we pay for with the TDC I've been there okay this is do we want you can't get rid of vacation I I'd like to make three short statements and then I'm going to quit can I just Councilman Greg you mind if I chime in one thing just on the vacation rentals just as a reminder to the council the the state has preempted um uh regulation of vacation rentals there is a carve out for that covers our town as well as others in the keys um but it's only for our existing regulations so just I mean I I don't want to get into too much detail because we're in a quasa Judicial item but I did want to remind the council that that is a is an item that has been preempted from the state but it doesn't mean you can't control the vacation rentals you can't you can't enforce the vacation rental ordinance you have on correct book correct and we and we're not doing that which is part of well we aren't doing it well and nothing again not this is not personal because it's just that we aren't no we all know this we are not doing it well and so that is why we're having this difficulty with this with this um application and it's like what a gift to have this application because what if that means that we could actually enforce our code so that people could have a better quality of life in this town rather than just hate vacation rentals and and yes you are correct we are entitled we have that's the beauty of our carve out um we do have the ability to to regulate because of that um and we do have the code and we have the ability to to operate under that absolutely yes all right so do I hear a motion or do I do are we going to what are we going to do here are we going to extend it or are we going to what are we going to do Mr Mayor I'd like to make three statements please just three short Things based on what our discussion is first of all it's easier to control a licensed vacation Ral than it is an unlicensed one and when we talk about problems in the village with vacation rentals the ones I hear about are the illegal ones I don't hear Too Much about the regulated ones a vacation rental license is renewable annually if there's a Code problem it doesn't get renewed with regard to the parking situation I think that's on us um as we learned on the fills if you put a No Parking sign out there that's something that we can enforce and write a ticket for that there are no signs in the area that you're talking about from Hog Heaven down to probably Coconut Cove and I think that the it's it's we may need to talk to the folks that live along there because they have a problem the folks that live in that little trailer condominium that's south of um anger's Reef that's their only go-to place they they incorporate or they condominium ISE that without understanding what that meant I believe because they don't have any place to park anything so they they just default to the median so maybe there's a way we can work with them to make that more orderly or just eliminate It Whatever the council's wish is but that's on us to control that we we've neglected that I don't think that should become part of your decision on deciding that application okay do so I just ask I mean I want to know where we're going to go do I I have a question for the applicant you have a question for the applicant for the okay go ahead yes so so Jocelyn are you willing to table this until we see if we can control our vacation rental problem on Wiley key yes I am if that's your guys decision my one comment on parking if I'm ever so allowed I have almost from my privacy wall to underneath my carport I would say it's about 90 ft of 18t wide parking on each one of these houses so any vehicles that need to be parked there should be more than enough room on this property to park these vehicles I mean and there's going to be Double Gates installed at the front of these properties I mean it's unfortunate that we don't I mean I don't think those pictures are in here and and and I and I hear you I I mean I can't quite Envision that and I haven't really looked at FT from the wall to the house and then underneath the house there's an entire length of the carport for the whole length of the house that's 18t wide from wall to back of the house so there's tons of parking under this house so so Elizabeth you you I will go along if you guys want to take that route I will go through the trial there there's no harm in it and it might help the community as you said thank you joshlin okay because I heard Henry just say call for a motion and it there it's got to be all of us unanimously Elizabeth that not on Jud no no no it's got to be no what I'm saying is you you just ask her that question but we got to make sure that the vice mayor and myself and Henry are are on board with whatever I mean I just asked it for information I I have only one person favor of calling the question okay well one question make a motion Henry I'm I'm confused you confused me he's going to he wants to make a motion and and just a reminder if there's a motion to continue under our code uh the council motion would be to continue it to a fixed uh date time and place um so it would just be whatever how many months we could figure out the council meeting date if that was the case I have a question a procedural question um a motion to continue is not a decision on the merits of the application uh that's correct it's a procedural motion so the conflict rules do not uh prohibit me from making that kind of a motion do they correct you could you could make that motion and vote on that since it's a procedural motion not a it's there's no Financial benefit that is is inuring to the applicant or which who is your uh stepdaughter so if I did make such a motion it would need to have a date and time certain in the future yes it would be a motion to continue this item to x x date and time which we would just pick the count I assume you all would pick the council meeting um and we would specify the location which is where we hold them question yes is is there a possibility we could just I don't I don't know how the V vacation rentals uh if somebody came in and wanted to apply we take their applications all the time is that how it works yes so people why don't we do the same thing with that we're doing with building what we did for the six months why don't we stop doing vacation rentals until we address the problems see if we can fix them and not just let keep giving out vacation rentals when they let's be honest they're continuously a problem and so if we don't fix a problem it's never going to get better and no one just wait a second you're always right there just just no one's picking on you no one's picking on your family but it is a problem and if we just keep continually pushing it down the road or giving out more vacation rentals the problem is a problems that I'm sure if we had a workshop with the community oh I guarantee you a lot of those that are that are a problem are legal and they're not just all illegal so if we could do something where we address what people's dislike for these vacation rentals are and try to fix it or at least modify it in some ways it would be better for everyone and not I you know I love your mother and your dad and I went to high school and uh it's not against you it's just that everything just seems to keep snowballing that we deal with and these are problems that this Council isn't really responsible for but yet we're adding to the problem by not stopping and addressing it I wanted to do what you want to do four years ago but our law is grandfathered in and there's very little that we can do to change our vacation rental law without risking losing it and being subject to the unrestricted law that is much worse than it in some ways because I've been looking into changing it more for like charge by the room and not by the property well maybe this is a topic for looking into yeah but it but the point is we need to find out a what we can do B what we can't do and find where this works for everybody in this community not just the Chosen Few and that's but additionally the the enforcement component I mean I I would say that that is 90% of the issues that we have I mean I mean the the trailers the it's it's out of control and and um and again I mean what an odd opportunity we have to address what is everyone complains about through this unfortunately this application I mean it it's coincides she'd rather have a let's try to fix a problem than a no because I guarantee you the no is is what it seems like it's Leena I hear I hear it in the background but I think your discussion would be uh appr propo to roll into uh learning about the uh new vacation rental law that if the governor signs it goes into effect that they mentioned at the during the lobbyist discussion today I would argue that in that in that it's it's it's that we have we already have a law on the books that isn't that's that if we could if we could enforce it I think people would be fine with it because it doesn't just bleed all into into your neighborhoods so I mean you know I think it's the Enforcement issue and again do you want to sell those houses I mean would you if somebody came up to sell them well then I'd leave them well then leave them for sale and let's give us some time to see if we can't solve a bigger problem which is enforcement uh enfor enforcement and so one question go ahead who benefits by vacation rentals the the people who own the property yes of course they do does the city benefit in any way well why do second who benefits from my business me who benefits from the Green Turtle when you owned it you did so that's sort of not really a fair thing to say the community doesn't benefit from me my business well they do but but but but we can't get rid of vacation RS the state has preempted it right I mean and we can't we can't hold it against someone if that is there if that is a source of income no like great you you you took that risk and you're moving forward you know where I'm going to call the question get it over with and well get out of here let's go ahead and decide do we want to the majority want to vote right now does the majority want to see if there's a solution for the problem that middle of the road that I like so much I think it's a great I would make a motion to table this item until the um land use hearing for August whatever sure go ahead he's been trying to trying U well I just want to draw attention to the fact that uh Jennifer team is short on Code Enforcement so to do this effectively uh one I want to make sure we're clear on on what code enforcement we want to focus on I'm hearing the the uh rental housing and particularly unauthorized parking in public right of way and to facilitate that she and I will discuss offline of strategy for making that happen um and it may include and just to give the council a heads up a contracted code enforcement support to come in and and actually do the field work that's necessary to see it happen on a on a consistent basis for a period of time and and see what kind of results we're able they generate I'd like to also if I may ask to have um because if nothing changes I will never vote for another vacation rent over again and um if I'd like to see a what the new law is that Mark was talking about B what we we what we have now and maybe take a look at all the people who have them and start from there if they're up to compliance is that doable if we have a set of rules that we're operating under yes we should have a mechanism to take the ones that are currently operating verify that they're in compliance with those standards and as well as take a look at again conflicts between authorized parking and unauthorized parking it will require uh bringing in contracted code enforcement support um but we're we're relatively clear on on what we're doing there's also going to have to be a Communications piece because um it's extensive so we would leave that to your ministra staff to to bring so you understand what we're getting into is is the only background I'm trying to provide so can we extend for 10 minutes because we're already we we only got one more minute yeah great great okay all right Elizabeth go ahead right I just wanted to um this is the after action report and I have just a couple quick things that I want to I want to just hit on um one of the items is is strategic plan and um you know we've been talking about it for a very long time and we had authorized um Kimberly to work on a road map in her last weeks and whether or not I know she I don't think she's wrapped that up but no matter what whether that piece is completed or not I would like to ask if we could give some very clear direction to our new manager to put out an RFP to move forward on um on this strategic plan that we've dis been discussing for about a year now um and and and we we've also which which hasn't actually managed to get on here is this potential for a combination of addressing the comp plan a rewrite of the comp plan in conjunction with the Strategic plan so can we just kind of like give direction on this so there's no like we just move on because so many of the items that come before us have to do with the our lack of planning what what suggestion would you have in mind put an RFP out and and we're going to bring someone in like like people do in all governments to create an actual plan and I don't know whether you want to speak to that I think you have some expertise there that might be less polarizing if you speak to it well when when this conversation has been brought up to me in in terms of both the Strategic plan and the age of our comp plan I have to validate as to Jennifer that you know yeah the comp plan is quite aged at this point and it does need to be updated since we also have a strategic plan that requires updating and both of those are pretty involved public processes there could be an opportunity to dovetail the two together such that you do uh a new comprehensive plan but it require as part of that an implementation component that mirrors many of the dimensions of a strategic plan and forms really the basis for the first year of a strategic plan and once that comp plan is completed with an implementation element that has uh specific goals and perhaps some OB objectives embedded for the upcoming year to three years then you can dive into a regular strategic planning routine until the comp plan comes back up for Renewal again usually about 10 years so get the comp plan done have a strategic element to it that satisfies the requirement the immediate need for a strategic plan and then dive into strategic planning on either a biannual tri-annual basis whatever the the council is most comfortable with until again you hit maturity on the comp plan um that's a very intensive public process requires a lot of Staff time and public engagement uh so we should know going into it that that's what we're looking at by issuing that RFP and the other thing is we'd want to consider if there's any seasonality to it that is are there groups of people in the community that uh leave and go do other things and wouldn't be available to us uh and if so you know what does that mean for the timing of the RFP and launching that process but I think that that kills two birds with one stone um respects people's time because it would be important for all members of the ID Mara Community to try and participate in that process and by dovetailing I think again it it it achieves multiple objectives yeah okay was that a yes you'd like that to move forward okay I mean we've had this conversation multiple times and I think that what has to happen now is that we direct our new manager to do that if not now when thank you yeah can we can we uh re can we bring this back a little bit and try to pick a date on Thursday no no no no no we're giving him permission to go ahead yes it is putting out an RFB okay so what I'd like to say R right now since we're on this he he mentioned Kimberly I I would like to talk about Kimberly Thursday night about that okay she she was here I've already talked to John quick about this she sent me an email that even though she wasn't asked to to at the last week but our County contract was through the 5ifth and if we were supposed to give help me if I'm wrong John we were supposed to give 10 days notice if we weren't going to keep her even a week uh and I talked to John about it and he said we're obligated to the to the even though she emailed me and said she didn't let's tell me no no I want to talk about this Thursday night it's alls I'm saying okay I'm sorry I don't think we finished my my my I think Rob's got something to say and I think it'll be pertinent to this and I think you will like it so uh we've been seeing this coming for a little while and and Again Jennifer Jennifer and I have talked about timing elements all the rest that I just spoke of and in fact we already have uh Mary working on development of the RFP so that is already in the works and we're getting close to the point where we think it should be ready in in a reasonable amount of time although I don't have the date right now but it is certainly uh something we've already thought about I've heard General ideas that yeah this would be a good idea and we've already tasked our staff with developing that RFP so it's it's not starting from scratch right now okay so when's it going to go when's it going to go out that that's all you know hey Rob when you get the you or Jennifer get the information can you guys can please keep us updated yeah we will um Mary uh just started it uh last couple days and then she's going to focus on some grants and I have to the RF for comp plan update is very intensive um you know scope of work and things like that so she's asked me to take a look at that and I'm going to I'll share it with Rob as well and have some of my other staff members look at it as well and so we're hoping to finish that piece of it over the next couple weeks and then um when she even plug in all the like the details for like when it's due in the village all the village details um hopefully can get it out sometime in May on the street all right anybody else have anything yes I do what no I mean go ahead if anyone else has anything so bear with me Henry um additionally on the after action report we had um the item is a purchase of the Island community church building um you know there that was a discussion that we brought up it it sort of vaporized and um and I'd like to further I mean Sharon brought it up where where are we where are we with that okay but you brought it up you were talking about the county maybe coming in with us no we deci because well because they're trying to get their zoning changed and they're trying to they want to move forward and even if even if we don't uh go with the county and make it a library I think we should look at buying the property to be able to uh control if we resell it who gets it I don't want to see a high dollar apartment complex going in there that's why we bought Island silver and spice for that exact reason I know that's why that's where I got it from strategic planning that'll help solve so I'm just saying maybe we should think about buying the the church and uh I'm interested and seeing the possibilities now I asked to do that and I see on Elizabeth's after action that nothing was done so the point is that the time is of the essence here and so we you know what are we doing with that sure we've had some conversations with the church about the possibility of delaying their application while we continue and as uh vice mayor Mahoney highlighted they're not wanting to do that so the next step was to report back to council that uh look that's that's not playing out so far uh there's some complexity involved in terms of it becoming a library and we needed to really get council's feedback on whether we wanted to move forward and buy it for you know for some other reason perhaps and then if the rest of it works out for a very great but if there was interest and ability in in negotiating a sales price for any other purpose besides a library that's really what we needed to hear and I'm hearing now um and and please confirm I've got a a majority Council in agreement that you do want us to reach back out and negotiate a price and we're willing to purchase it irrespective of whether that library is realized or not we could always make immediate contact with them to begin that discussion and see if we can move it forward okay great um briefly um we have on our report the Phils and the Founders Park baseball field Improvement project and I wonder if I could we could request a brief note um from our manager in an email form as an update to get an update on what's going on with those too just can you please update us on and you know I don't I don't need to talk about it now it's just really kind of a yes or no could we could we ask for that update of course super okay the next one is um would you mind doing that that's what I was going to pause for I was writing and I didn't hear exactly which two you were calling out so I actually just wanted to confirm which ones were referring to thanks because we're under a time limit for here we've got two minutes it's the Phil oh thank you thank you we've got the Phils and Founders Park just a brief email update um and I think I think the community would be interested in that as well actually I don't Henry already asked me about an update he wants an update on the fills he mentioned it to me great um the final one is noise ordinance it notice on our report that it says that we did our workshop and then it and then it suggests that that's done it's going to be removed from the report but what the point of that noise ordinance was that then we would go back and work on an ordinance so I would like to ask you if we could ask for the item of noise ordinance to be um put on a timeline to hear back from our planning Department about how that data was collected and and what that next step would be and let's and I personally would like to know I'd like to see how many codes on noise violations that we've had I I want to see statistics of codes that have been violated with the noise ordinance because it already went to the LPA and it got it went when when Dave Webb was on council with us okay and Pete it went before the LPA and they you know about CH uh a battery change saws battery blowers and all this so we had just spent operation yeah so as you recall we we had Tas Jennifer very recently I think that was two months ago to use her time and staff to have a community meeting so we had quite a big participation and it was kind of exciting in a kind of weird way um and and then the expectation was that she would take that data and come back with with um some the the uh come back with a report but this suggests that we had the workshop great it's over but that's that's that's a waste of time and and we had had the conversation that we wanted to address a noise ordinance and I know something things happened when ever David Webb was here I don't know whatever that was five years ago things have changed it's getting noisier we we've had this conversation so that's why we have this beautiful report so we can sort of it wasn't five years ago Elizabeth CU I had even been whatever 3 years ago it's still getting noisier so the question is are was that a oneandone workshop we over or was it should we follow through on the request please have a community meeting and then bring us the data tell us tell us more what if Jennifer made some recommendations to us for possible changes based on the data collected at the workshop hey I super great great Jennifer does that sound like fun but but is there not scary do we have a senses here Henry what is your opinion I did not attend the workshop it was well-run um I heard all good things about it and all of a sudden it stopped okay and I'm with you as where where we should have gone immediately from that Workshop I don't know who's responsible I could pick somebody but I'm not not about to but I'm in favor of moving on because otherwise that action can we let Jennifer talk she's got her I'm not yeah I'm not looking that way I'm looking at you so yeah thank you for helping me realize that someone is raising their hand over here thank you first I'd like to apologize if the um appearance of the removal of the workshop item was that um it was dropped and that there was going to be no additional information I would like to apologize that was not the intent at all um it was removed from the after action Because the actual uh request from the council was to hold a workshop and the direction we've been given is once those items are completed they get to the completed section my intention always has been to finish looking at that data collection and come back to the council with some recommendations maybe to make some changes not make some changes do something with the noise ordinance um it has not you know fallen into a priority at the moment but hearing the conversation I can certainly bump it back up to a priority again I apologize if the appearance was something that it did not mean to be great thank you thank you for I I am done now thank you with the RFP where's where are we with the RFP for the Strategic plan and comp plan Rob's on it Rob Rob said he was going to move forward with that we've already started the RFP uh councilman Rosenthal and uh we anticipated should be ready in in May to to hit the streets and when will that be ready May uh May we're in April you know 9 at this point so about 30 days more or less meeting maybe um yes close I can't guarantee the next meeting but it will be sometime in May well that's the next meeting I I understand that but I I don't want I can't it involves other people that aren't here tonight so I can't give you an exact date without speaking to them and knowing what their work plan and their workflow is so I'm committing to you the month of May I can't commit to you the next meeting all right and and I'll just add real quick we've got the comp plan RFP we have the master plan RFP we're going to be working on a plan to address code enforcement uh we're working on multiple property Acquisitions so let's also temper our expectations in terms of you know the the fastest possible timeline on individual items because we do have a bandwidth issue that we should be cognizant of and I'll I'll one thing well Jennifer is down to two Code Enforcement Officers one of them is actually out so she has one so that's why I was referring to the need for contractual support so there's a lot of mechanics to doing these things that uh have been perhaps neglected for some time and it's are contributing to a sense of urgency uh but let's not put so much on that we don't do what we want to do well and uh I can assure you staff will'll move these balls forward as fast as we can and we'll report back on things where we think that we need a little more more time so work with us and let's be partners and and we'll get the jobs done we're hearing the voice loud and clear he do I I have a basic question we're having one meeting a month right that's in May it's the same thing you you say you you can't commit to May or you can't commit to the meeting but might to try their best so so councilman Rosen and maybe you're you're not we're committing to the RFP hasn't been written yet we're in the process of writing it and then we have to put it out for bid and so that's what's going to happen in May and then when all that comes and then that will come back to the council it's not ready to come back to the council yet no I I know that oh okay I was I wasn't clear when you're going to
