you guys tell us what you're trying to do with the property uh we're trying to build a uh prefab shed um in the corner lot um it's a 12x 24 shed um that's the I don't know what I'm looking at somewhere around there but um it's 12 x 24 shed we're trying to put it in the rear corner of the lot um behind the fence for the chair yes okay um so the applicant um submitted a site submitted a plan it's actually titled pool grading plan so it was an that was an ASB built survey that was completed in 2018 just want to ask you has anything changed on the site since 2018 the the pool and and Patio was uh built right and that that's on that survey plan right okay so nothing's changed since then so uh the the property is located in the R5 Zone um which you know obviously the site is less than 5 Acres correct correct it doesn't say on the survey but do you know how you know how large your your property is it's one acre it's one acre so it's a one acre lot in a 5 acre zone right in the I'm sorry in the R5 Zone um for that zone it requires accessory structures to be located 100 ft from the rear yard property line 75 ft from a uh side property this property is a corner lot so it has Frontage along Hawken road which is to the right of the plan and Bane Lane which is to the bottom of the plan so you know the the the setbacks for this Zone uh would preclude them from being able to build just about anything and locating it just about anywhere on the property so that that's you know I believe that's the hardship uh they're they're proposing a 12x 24 structure it appears to be no higher than 15 ft in height um it is it will be used for vehicle parking no no that's just a picture from from the Costco site it's just been used to store Lawn Equipment does it have a garage door on it though it doesn't have open en Clos it has um oh regular man doors oh okay so this would actually be a considered a shed and not a detached garage so the setbacks are a little smaller for that requirements in that zone but regardless there would still be nowhere on the property to me the setback requirements and it's just going to be used for storage yeah excuse me any questions for the applicant correct yes no no and for the record it's my understanding that that existing six foot high fence was um approved as part of the subdivision approval for this so there's no further variances that would be required for the existing fence any addition any additional questions for the applicant is there any plans for water or electric in the shed possibly in the future no maybe a light bulb in the future Mr Martins were you going to ask something U yeah I think it's more for the professional it says it was denied because they want to put it in the front yard so so how do how do I think about so it's a corner looking at it it looks like it's the backyard no it's a corner lot because there's there to the right is hawen road to the front to the bottom is Bane so because of Haw and Road Haw and road is considered front roadway Frontage therefore anything between the roadway Frontage and the and the and the dwelling is considered front yard area right okay thank you yeah for all intents and purposes you can assume that a corner lot always has two frontages any additional questions for the applicant okay being that there's no additional questions I would normally open it to the public but there's no one else here so we won't be opening it to the public this evening I will oh I'm sorry I'm going to open it to the public seeing no one come forward oh it's all my stuff your lawn mow is going in there this is going there that going in there seeing no one come forward we're going to close public session so board it's up to us for discussion and a potential motion we've heard EV clearly defin obviously what the hardship is it's a corner lot so it's considered two front yards um and because of the standards it's a 1acre lot in the R5 Zone I personally don't have any problem with approving it given the hardship here and obviously when they bought it it was in this condition so it was no doing of their own so I would have no problem through the chair I'll make a
