uh mention that several of us attended the unveiling of the honorary sign for um our former councilwoman Margaret McQueen and it was a really great event Saturday morning and uh very well attended and uh want to thank everyone was involved in organizing that also great job by our parks and wck department on the Easter egg hunt and it it everybody had a great time and I don't know but that looked like it was the biggest turnout I've ever seen um also want to let everyone know that there is going to be a meeting on Wednesday April 3rd this Wednesday at 700 p.m. at the beaches Branch Library uh the presentation is going to be the good and the bad of the 2024 legislative session and Mike stopulos our city manager and I will be uh doing a dog and pony show uh about the bills that passed and failed that will impact our beaches communities the other two city managers from Neptune Beach and Atlantic Beach will be there as well to provide updates related to um legislative issues that that impact impacted their communities and just wanted to let everyone know that that uh the the vacation rental bills Senate Bill 280 that I've been talking about since the beginning of the year has not made it to the governor's desk yet so there's still time to email the governor and urge him to veto the bill um because it is not helping municipalities with the issues that we are having with the problem vacation rentals um want to let everyone know that I did send out an action alert to 45 municipalities throughout Florida that have registration ordinances like ours that would be impacted by this bill ultimately the state would wipe out our registration ordinance with Senate Bill 280 um taking away our ability to to regulate anything with vacation rentals so if you're so inclined um I would urge you to contact the governor and my fellow council members do the same um please share I sent out a newsletter today and several people have responded that they are they've contacted the governor so um if we can keep the keep the uh Communications flowing the the more the better thank you thank you Miss golden Mr s uh just a quick shout out to uh councilman Mesa uh for his recognition last week as a uh Latin leadership award uh in our community there and I had the opportunity to attend and uh was a great event and um he was presented with the award I think by the mayor or Governor or something of Waka for former former govern yeah so yeah it was pretty impressive he was here as a guest and uh congratulations and yeah second um councilwoman golding's comments on the Margaret McQueen recognition it gave me actually the opportunity to um meet up with an old classmate from 1981 at clutcher um Miss Miss McQueen's daughter so I didn't expect that and it was a nice surprise so thank you Mr horn I wanted to say thank you to the public works department for their efforts um week ago Friday and over the weekend we had a an issue with some um uh issues with the installation of IQ fiber that uh happened to strik and city um and the wonderful folks in Dennis Bon and his group um they came out they did a great job the citizens in my area were very happy not only with the work that was done but the speed and efficiency at which it was done and again it's very often that City departments get people complaining about what they do but you know I just want to make sure that they know that the citizens in my neighborhood were very happy with what they got last week so thank you thank you Mr Mo Mr Mesa yeah another shout out to uh parks and R for the Easter egg hun heard it was a big turnout uh I've said this tomorrow before if you guys get a brand new Easter Bunny outfit I would do it every year no questions asked cuz that it was fun when I did it seeing all the kids laughing but then a couple of the kids that were crying that that was even funnier but either way um it was it's fun I will be the Easter Bunny outfit if you guys get a brand new one so I just want to put it on the record uh thank you to council member Greg and Chris for being there Friday uh it was a special moment um especially for my parents I know they're in California but they're very proud um and anything I can do to help the community and those in need I will do that in the harv thank you so ditto to everyone else um I also want to kind of promote upcoming this week we have seawalk sessions on Wednesday and I forgot to write the name of the artist down but these are new events and uh designed to activate the lake and Plaza area on weekdays um and I think they're also designed to forecast rain every time seemingly so um the forecast isn't looking great now but it's Florida it's 2 days away anything can change and we'll have a food truck out there as well and then this is a big weekend for us we have springing the blues um Friday through Sunday it's always a great time the weather for that is looking spectacular coincidentally this the museum is hosting springing the blooms that morning Saturday morning so come on by if you want to learn about dabble Peppers or monar butterflies or anything like that before you hit the uh seawalk Pavilion I'd also like to welcome our new City attorney seated next to me you might have noticed a new face up here David migot he is on his second week week two so he came back for week two this is his first council meeting hopefully he'll be back tomorrow but we are really excited to have you I know he's jumped in uh with both feet and we're we're very glad to have him here any other announcements okay we'll start with courtesy of the floor uh David kill know the name and address go have 3 minutes to address the council good evening my name is David cohill 2302 s Grass Road uh for those of you who I have not had the opportunity to meet yet I am the President of the lodge 17 Florida paternal Order of Police which represents the men and women of the Jacksonville and neach police departments I also serve as the Secretary of the State labor Council come to you this evening to try and quantify some of the emotions that I heard at the last city council were over a dozen business owners citizens came before you to speak uh those of you that have met me before know that I like numbers and statistics at nauseum so I will try and keep those to as uh unborn as possible so since 2011 to 2021 the population in the city of Jacksonville Beach has grown over 11% during that time period the department has added zero officers to its Patrol and detective division yes we have added to downtown Cape but anybody who served in law enforcement knows specialized units are the first ones to be CT when things when Staffing Falls when people are ill when people resign and that's the current state that we're in now in addition to the 11% increase United States life saving Association which the lifeguards uh self-report the unique number of visitors to the beach increased 21% from 2011 to 2022 to over 5.1 million unique visitors to our beach fromont so what do all this growth without a commiserate growth to the police department lead to burn out and turnover the past 12 years 102 officers have been hired to work at the Jacksonville Beach Police Department it's enough to flip the entire department one and a half times average pension age the department is 11 years it's only gone up 2.6 from 2011 to 2021 during that 12-year period we've only seen 18 people retire one line of duty death and of those retirees less than half served uh their full or over 20 years how much does it take to train those 102 office officers 62,000 person hours to train during the time period in 2017 when we have not added a single officer the taxable real property in the city has gone um from 3 billion to 4.65 billion and the property tax revenue has increased from1 18 million to 26.1 million again during that time period not adding a single officer councelor Wagner last time you said that the council's response to what happened on St Patrick's here will be defining moment and the way that the council responds moving forward will be its defining moment thank you very much for your time this evening thank you that is life Quest organ recovery services is a Jackson Beach resident and requested this Proclamation and unfortunately it fell ill today and is not able to attend but I'm going to go ahead and attempt to read it without my reading glasses since we have it and we will deliver it to her at a later time whereas Florida's organ tissue and eye donor registry is named for I'm fine is named for Joshua abber the recipient of a lung transplant who passed away in 2006 Abit story so move the Florida legislature that in 2009 Florida's Agency for healthcare Administration chose Donate Life Florida to create a Statewide donor registry to increase registry enrollment and educate Floridians about donation and whereas Donate Life Florida is a nonprofit by the 1c3 charitable organization and whereas established in 1997 as Florida Coalition on donation Incorporated Donate Life Florida is dedicated to motivating Floridians to designate themselves as organ tissue and IR doners so lives are saved as and enhanced through donation and trans Plantation and whereas today more than 5,000 patients listed at Florida transplant centers await life-saving organ transplants end whereas many of these individuals may get a second chance of Life due to the generosity of those who designate themselves an organ tissue and ey Doner on Florida's organ and tissue donor registry and whereas more than 100,000 people are waiting for a life-saving transplant another person is added to the waiting list every 10 minutes over 20 people die each day because the organ they need is not donated in time one person can save up to eight lives through organ donations and whereas the Nao Clinic being the city's transplant hospital many Jacksonville Beach residents are transplant recipients Jacksonville's diverse population brings the importance of awareness and need for the life-saving transplant for many in the area and whereas the city encourages all citizens to consider organ eye or tissue donation and engage in healthy habits to decrease the need for transplantation and now therefore be it resolved by vir The Authority invested in me as the mayor of the city of Jacksonville Beach I Christine Hoffman hereby support Donate Life month and Proclaim April 2024 as National Donate Life month thank you moving on to um and if you uh I would encourage you to look into that organization if you'd like more information um also something that's really important if you are an organ donor and you do designate it on your driver's license make sure you talk to your family about it and sence because ultimately they may be making a decision um on your behalf um so you want to make sure that they know your wishes thank you for your attention to that we will move on to ordinance number ordinance letter A Madam cler will you read the ordinance by title Please in ordinance of the city of Jacksonville Beach Florida relating to restrictions on use of public property imposing a temporary moratorium on the issue issuance of permits for special events or festivals as provided in section effective date thank you madam clerk um before we open the public hearing we'll have a report from city manager stop thank you mayor and councel uh the purpose of this ordinance is to address Council discussion following the shootings that occurred on Sunday March 17th and the events leading up to them at the city council meeting on March 18th Council discussed the possibility of enacting a moratorium on special events until it could be determined what changes may be required to the city's special events policy to reduce the potential for future similar events it is noted within the accompanying memo that staff has identified issues associated with the implementation of a moratorium specifically a moratorium coupled with the time requirements for permit submission in advance of an event could impact special events in excess of 6 months staff has placed an item on the April 8th Council briefing to discuss downtown public safety and special events the adoption of this ordinance if approved tonight on first reading will still require a second reading at a future date which would likely be scheduled for April 15th Council has a range of options available this evening from the Spectrum ends of approving this on first reading to disapproving it in its entirety or deferring the item till a date certain City attorney migot police chief Smith and Parkson director faes are all here if you have any questions through this discussion thank you Mr stopus this ordinance is before the council for a public hearing and consideration on its first reading I will now open the public hearing on ordinance number 2024-25 we have two speaker cards we'll start with Rhonda and McDonald if you want to come to the podium give us your name and address you will have three minutes yes I'd like to just retract that right now I don't need to okay thank you um Bradley Lewis you'd like to come to Podium give us your name and address you'll have 3 minutes to address the councel my name is Bradley Lewis I live at 18 hwon Road um this ordinance correct me if I'm wrong the incident that happened was it based on a special event we're just using it as a catalyst to address our special event policy how about we step back a little bit and just look at the policy of making the citizen safe in Jacksonville Beach all of you on the council are responsible for providing that police chief with enough money to fund this department we understand it's hard to hire policemen have you given him enough money to to attract more policemen to us have you given an incentive um Chief Smith I have to ask of you what did you do to prepare for spring break I saw a lot in the news about Miami and everything they did to slow down the Spring Breakers to kind of put a check on it they did it for reason but jacksonv beach has had issues before this we have a reason we know that on the weekends the amount of people in the city goes up Dr ically are we prepared for that on just any other weekend a beautiful weather weekend it seems as though we could look at this policy and go let's add some more security to it it won't make it safer if there's not a special event it won't apply to anything that's not a special event the citizens are asking you to make Jack Beach safe I applaud you for running an efficient budget it's so efficient that people are nervous to go out they're not happy they don't feel safe I don't want to say the downtown isn't safe but I would say that a lot of the people that were involved were not Jack Beach citizens we could look at Small Things how about we raise the price to park on the weekends that will affect no Jack Beach citizens as we get to park for free how about we set up things that might deter people that are coming down here none of what I've mentioned is related to special events I think this is something you do when you put toward the public so they they really think you're doing something to address safety when really all you're doing is putting something in front of the news camera so you could say you're taking a little bit of action this will not make Jack spee safer when we do do not have special events thank you thank you Mr Lewis would anyone else like to speak on this issue for or against see none as fellow Comm Clos can I have a motion I move that we approve ordinance number 2024 8212 on the first reading relating to restrictions on use of public property imposing a temporary moratorium on the issuance of permits for special events or festivals as provided in section 19. 5 city code for 120 days and schedule a second reading for April 15th 2024 second we have a motion and a second Mr s we're having discussion now yes so I just wanted to say um I think a couple of weeks ago when I um first mentioned the you know instituting or coming up with an ordinance um it really was with relation to um events that did not have permits uh non-permitted events which certainly um if this was an event it was non permitted the Gathering of the uh folks where then the the um violence broke out so I certainly appreciate the work that Mr Shephard did in the last two weeks and pulling this together but I'm not so sure that um you know putting a moratorium just on special events really um addresses the issue more likely I think us um meeting next week starting next Monday night at our Council briefing will'll begin to sort of explore and look at some ideas uh that we can update that special event policy on there there are some issues in there that staff has identified that need to be updated uh as it is U regardless of the last what happened two weeks ago um so we can certainly incorporate that and I think the um large Gatherings can be addressed in that special event policy um you know we have a couple of different categories in there and definitions around areas around events or special events that are um sort of specific to the downtown area right here actually specific to lean Plaza and and the Pavilion uh and then we have um things called you know special Gatherings or something to that effect I can't exactly remember the category but which I guess would apply to things other than this immediate area right here so we may want to look at that apply similar type language or or decide anyway what direction we want to go but um as this has been put in front of us right now I'm not in support of just um um putting a moratorium on special events I don't think that gets to the Crux of the of the issue sorry I didn't see who was first com going to like um Mr ragner um thank you for your comments uh councilman Seton um very consistent with the way I'm kind of internalizing this as well you know I think it's really important that we focus on the problems that we're trying to solve and then what are the causes of those problems and address those and I do think an appropriate first step in that is the briefing that set up for next week and so before we start to implement actions without having kind of that level of an ex level of conversation I I do struggle with that myself and and really don't see um as the point was made earlier uh a delaying or the moratorium on uh special events being one that actually contributes or helps us solve the opportunities that are that we have in front of us um we need to take this very seriously we need to be very thoughtful on how we handle those and we need to make sure that the results of anything we do or Implement makes our wonderful community a safer happier better place to be Mr Janson yes so I I go with the the comments of my colleagues and um we can I think we can collectively say that uh the Bad actors that showed up on that weekend did not have a permit they didn't have a sanction they were trying to have a sanction event of fights which is not allowed by law and so put the moratorium out there and it's almost like punishing the good guys the guys that follow the law the guys that are following the permitting process I don't see the value in that um although there needs to be much more discussion about how the permitting works and how we deal with crowds on the beach um from a law enforcement perspective serving 28 years in the Jacksonville Sheriff's Office the one thing I want to say I don't know that we can measure Champions on dasas as to who supports police more than anyone else but in my four almost four years in tenure as a city councilman there hasn't been a time that the police chief has come in front of me and asked for something and was denied that so if there's something that he needs I'm all for it let's give him what he needs to get the job done our our the public safety comes first it's our first responsibility I don't think the chief would disagree with the comments I just made um he can speak for himself but whatever is needed and to keep keep our city safe if we could afford to double the size of the department tomorrow I'd do it if we could afford it I don't think we can afford it but we certainly got to look at how we're dealing with our staffing issues if we have attrition that's high which it seems to be right now then maybe we should fatten up the department so that when that attrition comes back to a level even power we have extra officers and I guarantee you there's there's a lot of um things that we can do with extra officers where there's a lot of task force ideas traffic ideas there's there's tremendous amount we can do with extra officers so I'm not in favor of this particular ordinance I am in favor of having a lengthy discussion I'd like to see the police chief and partson right in that briefing so we can have some hard conversations and how we move forward and being prepared for any events that happen such as these just to piggy back on yours really quick and we just did a bonus for new and exist ing officers and in across the board pay raise that was outside of our normally scheduled contract negotiation so I think this Council um has proven that it's supportive again I I'm with you we haven't said no to the chief um ever in my 12 years even so um I if if more money more officers was the only solution then this conversation would be easy but I don't think it's the only solution um Mr Mar um yeah one of the things um I'll reiterate what I said to Mike recently about the permitting process is that I think that in the future we should look at making sure that anything that is permitted brings a benefit to the beach is familyfriendly or is something that will help us now obviously this last event was unpermitted um as we look at the concept of initially the discussion came up about us put a moratory feelings were very raw at the last council meeting by everybody in the committee was very very hurt and you know and everybody on this days and in the crowd and and even at home um looking at these numbers though yeah with 120 days and the 90-day application period That's concerning um I reviewed the um uh the current and pending applications um I guess in the back my mind I would ask Chief Smith and chief do you think if we were to if we were able to magically pass this tonight and say Yes off we go would this help you Jean Paul Smith chief of police um it'll help down the road but it's not going to help right now or tomorrow or the day after um and there's a lot of systemic issues that we've been warning about in the police department for 30 years and it just kind of moves on after we're done we we pass an ordinance and it's we move on so if you want to get systemic issues I suggest to talk about next week hearing and hearing that and that's kind of what I figured we would probably here and I ask Parks and Recreation director fatias if we were to pass this tonight if we could if this were the second reading we passed it tonight do you think this would benefit the ocean rescue Department would this benefit your department parks recreation uh Jason fa's U Parks and Recreation that's a difficult question to answer directly I I don't think that it would have um it would have immediate help or an adverse effect so kind of neutral okay okay thank you um again with the numbers that I'm seeing that the duration the total duration that's a little concerning um I think a majority of our Reg um events are in process um I think we should discuss this more next week I would be in favor of tabling this for now um again I will reiterate to the city manager and I'll say it again next week at the briefing is that I think that our goal in the future should be that any permitted events have a proven benefit for our community and not only for Jacksonville Beach but for the beaches and for Jacksonville in general um something that people want to go to um thank you Mr s yeah just to sort of summarize my comments from earlier effectively um you know I think this penalizes the folks that are that are you know getting the insurance that they have to get getting the in the um security that they have to bring to the table for these events Mr bradock sitting over there you know there there's other folks that bust their butt to have to do this um throughout the year having special events and um to put a moratorium on that and risk losing some of those events I guess specifically um in the second half of the year is probably more where we would begin losing them maybe later in the summer and second half of the year but um to do that these are typically not the issues that we have or from folks that are that are having special events it's it's a different group or different groups and um so I I think Chief Smith has um um done a good job the last couple of weeks but we haven't really had any issues um you know we were helped by weather I think last week it was cool and windy and then yesterday was Easter and so we didn't really have any events but you know this is sort of a wakeup call and um occasionally we get those and Bad actors do bad things and um any any ordinance Again by itself or any changes to the special event policy in themselves are not going to prevent um completely prevent things like this from happening but I think a number of things combined can do nothing but help overall including um you know showing a presence and showing force with Force down there um on the weekends or when when we have uh we have special events or other um hight traffic um things going on in the city so thank you Chief you just say something I just want to make one comment um first of all we did have a group on that group out there last week we had 18 calls only calls for service on St Patrick's Day between noon and 8:00 p.m. till one the shootings occurred 18 calls is nothing total in the city and we had a group watching them because we had our Intel analyst without our computer find the fryer which FHP JSO and FDLE did not find when they scrubed there any I'm also um I am seven officers short I have seven off officers hurt or on modified duty I have three in training I have one leaving in a month I am 20 officers down as of today out of 67 so showing force is fine but I have to have some help I I can't do this with 40 people and um I'm sorry I had to say that that not come out yet but that's the way it is we want to have hard discussions what's going to get worse next Monday so thank yeah and I think we we briefly talked about that last week when we talked about um if we have to go outside uh the city of Jacksonville Beach as far as additional resources whether that be city of Jacksonville or wherever the case again uh most agencies are having issues with Staffing so we'll have to have to find them where we can get them but certainly I think um our approval of the chief's ability to do that is important so um thanks Mr Mesa [Music] um yeah I have to agree with my colleagues on this orance um it's unfortunate that if this was to even get pass that the good actors will get punish punished um and even if this was to get pass I don't think those actors that were here a couple weeks ago will even abide by the rules um coming from that type of neighborhoods usually these individuals they want to make a quick um out of a free space and if they can do it they'll do it um it'll matter for them they'll collect their money firstand and take off um and I think this issue is it's it's a bigger issue that we think besides here in Jacksonville Beach because it's a Jacksonville problem but it's also a society problem and we are trying to address an issue but it's going to take more than just us to address bigger issues that are occurring in town and around the city and around the state um I have a question Mr vas um the the life guards I know we briefly talked about this about the the lifeguards in uh in La like Bay Watch they have some Authority what Authority does the lifegard have here at the beach and if they don't have any are we able to give them some sort of authority as to the minor the minor like the people that take the girls out to the uh to the beach and want to grow I would just ask that we keep this discussion to the ordinance I'm trying to get to my other question on the special event the uh Beach do you have an answer prepare for that or if you would like to defer you're welcome too we you if you can answer next Monday that would be great well if I understand the question what Authority we have in terms I'm not sure what you're asking there Mr Mera but you know we always defer to the police department when it comes to legal matters now the other question I have well that was going to lead to with the Gatherings since we're this is what we're talking about the big gatherings at the beach is the lifeguards obviously the respons for Life saves but on the Gatherings what if they were to see something illegal are they able to in constant contact with the police that's the first call that they would make okay um yeah M or I I'm just I don't feel comfortable yet I'd rather discuss it on the briefing next week as far as for the comments that Dan Janson had made Mr Bill and chief I think uh the bigger need right now is to see how we could try to recruit more officers and appeal more recruitment um yeah so I I I'll have more comments later okay um we have Miss Golding and a revisit by um Mr Wagner go ahead gold thank you mayor um I just want to say that I concur with all of my colleagues um my biggest concern and looking at the list of the events that are in process though is um how much we're asking our police department and our Public Safety people to deal with um there you know we've got a lot of really great and I hope easy events like the runs and that sort of thing but when we start getting into some of the bigger events um that's where I get concerned and that's something we'll talk about um next week um but I was going to ask what would be the appropriate motion would it be a deferral um Mr Mot or would it be a table or is it tabling go ahead either of those are are viable uh table would would end it it could come back up in the future uh defer is essentially taking the same action so either of those are fine and it could come back in the future if one of those motions were to pass it could also get denied today and come back at a different iteration in the future the deferral would it would that require a date do we need to specify a date certain if we deferred it so we don't today but to just sub points on that if we don't set a date um we'd have to read vertise it which would be cost it' be a very minimal cost which just a cost and then we'd have to get the public notice back out just the best practice of not just putting it on the agenda but letting the public know ahead of time when that new date would be if that's the action the council takes and tabling would require another public notice as well yes okay I'll I'll defer to whoever else wants to speak but I'll be willing to make a motion whenever everyone's had a chance to speak thank you Mr we do have a motion in front of us right we have a motion on the original ordinance but you can make a motion on top of it to table to postpone definitely which would have a date attached to it or postpone indefinitely which would not have a date attached to it or we could just vote on it and it sounds like it down Mr ragner um So based on the conversation we just had I'll keep my comments very brief I just wanted to summarize that in all of the the the preon in the pre-c conversations that we had sorry in light of the conversation we just had I'll keep it short it's the new guy problem I always forget the buttons um so I'll keep this short but what in summ of what I heard from everybody was there's kind of four areas of focus we need to think about on Monday right there first is law enforcement and it's Staffing and it's do we have the right kind of HR construct around them and the right you know right right uh support systems for for our for our legal team and so that's that's clearly number one two it's special events and the associated processes making sure that things are clear there's good process good definitions and then third there's events outside of that policy so how do we handle those those folks that have an event or choose to have an event when they shouldn't um outside that policy and we need to really kind of think that through as the third bucket and then the fourth bucket would be any supporting tactics that would support any of those others whether it's parking or some of those other ideas that have been thrown out so as just kind of sharing that with the with all the councils we kind of think about a construct to talk to have that discussion next Monday that might be a nice way for us to kind of work through that um and I would I just want to are you going to make a motion okay if I could just speak really quickly um I agree I think that this is um throwing the the good out with the bad um when you look at the list of events that are pending it is I we have hundreds of events in this community that are Rel relatively Problem free our benefit to our citizens to our area nonprofit events um popup events deck the chairs things that we could all agree are um low impact on our resources um but positive impact on the community and I think that that this is a a pretty dramatic reaction and again I agree that the problems that we're having are largely in that gray area of groups that are more than just a family or group of friends gathering on the beach for a Sunday Funday um but not quite at the event level um but they're operating in an area that they know that they can get away with because we don't have any way to restrict the amount of people in a group on the beach but they are clearly marketing events somebody is probably making money on the events and that's I think that that helps all of your areas if we can find a way to really um hone in on on that gray area type of event that is really getting away with it um I think marketing is also a component of that and I a lot of people have referenced uh Miami breaking up with spring break everyone I think everyone up here and and most of the people who are paying attention realized that this wasn't a group of Out of Towners that came into Jacksonville Beach for spring break this is people that live in the area in the county um probably not at the beach from what we can tell um so I do think there is a marketing and communication component to this um as well to solving this problem that may be a really big part of it um so I'm interested in the conversation on Monday I would ask that our staff come come with some examples of what other communities have done um to Target and hold the event promoters accountable for what um may arise that is caused by them provoking um the scouring and I think that's something that we really um you know we are not the only Community having these issues um and so there's no reason to reinvent the wheel if other communities are are doing it right in terms of making sure that their um beaches communi uh stay safe um for all to enjoy um so looking forward to conversation on Monday um council do you want to um make a motion to to table or or do we want to go ahead and vote on it vote it down Mr s um so just one more time if we if we were to table this is that a whole lot different Mr mot than um just um denying this tonight and then bring if we need to bring it back up again we can bring it back up again a later date explain to me the difference so I I think these are are technicalities that can that can be overcome uh Technically when something fails under our rules It could only be brought back by a motion to rec consider the same meeting or the next meeting however that's if it's the if it's the exact same issue this this proposed moratorium if it if it did come back if it was voted down could be slightly different I don't see any anything that would prevent that from coming back slightly different as soon as it was the will of the council to BR back so I think any of the Motions would accomplish the way I think I hear that the council's looking to perceive this matter so it could be voted down if you want it and that wouldn't Prejudice it coming back anytime soon thank you no lights on the board Mr Mesa um Mr M um it says special events or festivals um are we able to throw in Gatherings special Gatherings is is that a legal thing or we have to keep it simple as special EV you all could do whatever you want the way this moratorium was drafted by uh Mr she Shepard based on the last meeting was restricting it to the special events as they listed in section uh chapter 19.5 of the code so but you all are not restricted to just that topic you could expand it in in future uh debate or action on this matter so this could come back in es especially after the the discussion next Monday I I could foresee that coming back perhaps more encompassing perhaps less encompassing but you all could change it as you deem prudent going forward you're not you're not really restricted by anything that's happened up to this point time but this this is specifically the wording says moratorium moratorium on the issuance of special events permits for special events so that specifically is just for yeah I mean even if we added Gatherings that's not defined uh it are we yes so you know other lights on the board my next step is to call for a vote which would vote up or down a moratorium on um special event permits for 120 days no interest in tbling or postponing Madam clerk roll call to
