invocation followed by a moment of silence and in the Pledge of Allegiance dear God we ask for wisdom understanding and foresight in the decision-making process tonight amen let's have a moment of silence you joint me a pledge may we have a roll call please mayor KY here vice mayor Delaney here councelor for councelor May here councelor sunstrom Town manager Kito Town attorney be here okay um we begin tonight with citizen comments this is the portion of the meeting intended for all non-agenda items it's items uh not on the meeting agenda uh and uh anyone wishing to speak uh is given three minutes uh ask you to try to hold it to that uh and when you begin uh speaking please state your name and address for the record and do we have any citizen comments yes we have two first Joseph hacket and then Don thenen gar let the mic please good evening uh ladies and gentlemen thank you so much for giving me the opportunity to speak to you uh this evening this is regarding the proposed uh change of uh the U uh the plan the master plan in Abacoa and I'd just like to give you my feelings on that I've been a homeowner in Abacoa uh since October of 2000 I've always thought it been it's been a wonderful place to live very very happy here when I purchased my home I was aware that there was a master plan that and I was very pleased with that and I looked forward to the future of Abacoa and my community uh that Master Plan made sense and it guaranteed to us residents what to expect into the future now after all of these years this proposed change comes about and not of course what we originally agreed to when we moved here I went to the meeting at the golf club a few weeks ago and uh I heard a lot of misleading faction figures by Mr herd who represented the developer I'm here to State unequivocally that I'm absolutely opposed to this change it provides nothing for the benefit of the current residents and it only benefits the developer this proposed change of the original plan will undeniably cause a great deal more traffic uh less parking and a bigger burden to our schools and likely a degradation of our beautiful adjoining communities I implore you to reject the proposal this proposal in the interest of all of us who love Abacoa and our neighborhoods thank you so very much Don zengara good evening and thank you for the opportunity to speak to you on the same subject matter about the proposed development for Abacoa Town Center I too have been a resident of Abacoa for for over 15 years and I really my heartfelt requests to reject this proposed amendment to our Master site plan for Abacoa Town Center as you know Abacoa has parksite and Greenway which has turned into a thoroughfare for those from the Alton development cutting through Abacoa to get it in getting into Indian Creek Parkway and I think this proposed development will continue to overcrowd abro E streets with traffic create more traffic and safety concerns around our schools in Abacoa negatively impact parking and pedestrian safety in our downtown area and surrounding streets and potentially decrease the value of homes in the surrounding neighborhoods as well as impacting our environment such as sanitation and air quality and put a strain on General Road surfaces and other infrastructures in epoa I am sure there are additional ISS issues that may result should this proposed development be approved the developer held a meeting as mentioned earlier at the Abacoa golf club and there were really no comments by residents of Abacoa in support of this proposed development the site plans for areas of aboa exist for a lot of reasons this is a planned Community the master site plans outline restrictions on the number location of residential and workplace sites building Heights neighborhood bylaw the preservation of our community infrastructures and green spaces as well as the overall aesthetic Integrity of Abacoa and its neighborhoods the Abacoa Town Center subd District as you know has only 104 dwelling units remaining to be built based on his master site plan it's my understanding this developer is seeking approval for an additional 253 units for a total of 300 157 units within the Abacoa Town Center please reject approval of the additional 253 units and let's just stick with the master site plan please do this for Abaco residents as well as its homeowners to maintain the Integrity of our beautiful community and just as a side note I'm sure you know the Barcelona Jupiter complex on Military Trail has 352 units so this unit uh complex will be larger than that and I cannot imagine what kind of traffic impact it's going to have in our beautiful neighborhood so please reject the proposal for aboa town center and support the owners that also want to see our Master site plan maintained thank you for your time um then we have Debbie mcdono and Fran Buckley [Music] Debbie and then after Debbie is going to be Fran Buckley like the two previous speakers I request you reject the proposal to change from 104 units keep the master plan as it is so I won't repeat all the details you've heard them twice already traffic would be a nightmare thank you ran Buckley I attended a meeting on January 16th of this year at the Abacoa golf club in attendance with residents homeowners from all the different dasta Abacoa communities we will given a presentation by Donaldson hearing hopefully I have his name correct presenting the workforce housing project as if it had already been approved he said it was needing that we are very excited about this project he added he lives in this community as well that said he does not he lives on the water not even close he went on to say that the halls of these buildings would be carpeted and there would be air conditioning in the elevators but the most exciting part was we the current homeowners that in Abacoa could come over and relax in the courtyards what just want to express how insulting he was this is our community and we are not excited about carpeted hallways and air conditioned and elevators that we would be allowed to sit in their Courtyards now to get more serious first of all traffic traffic with 1.5 spaces per unit that would be a major problem some of these units are two and three bedrooms having the real potential of three or more cars per family the other night we walked over to the game sold out Yankee game it was the bottom of the second inning stadium was empty why people trying to park their cars that's not a complaint I'm happy that that they're there is not our responsibility to provide Workhorse housing within blocks of our homes we all know what this is really all about the current density is far more than most of us thought it would be when we purchased here allore most of us knew nothing about it until they started clearing the land thank God it turned into a nice project plenty of inexpensive land out west to build plenty of Workforce housing we were told by someone who works for work uh Workforce in Palm West Palm Beach has this board considered Land close to Adam Cove think not even was available he compared this project to the commercial building at Parkland University again insulting to compare an office building to hundreds of residential units that can house anywhere from two to six people in a unit as a realtor I can tell you renters in downtown Abacoa are bringing in two or three roommates to help out with rents that is something you cannot control the taxpayers in Abacoa have the right to say no to a project that will affect their lives and the lives of their children each and every day for or board member to make a decision on this on behalf that does not affect their home their family or their children is wrong again we all know what is is really what is really going on here but I won't say any more thank you for the time that was it thank you um okay uh Council before we have before us the minutes of the March 5th uh Town council meeting um I don't see any changes on the Das uh if there's no revisions needed I'd look for a motion in a second so moved second motion and second on the minutes uh all in favor signify by saying I I I motion carries unanimously moving on to the consent agenda this is items uh 2 through 10 um do we have any member of the public want to pull a consent providing for an effective date ordinance 624 an ordinance of the Town Council of the town of Jupiter Florida amending section 27-1 regarding the definitions of gross floor area and story providing for amendments to section 272304 pertaining to the purpose of of the the division providing for amendments to section 27235 pertaining to development standards for exceptions to the measurement of building Heights providing for severability providing for the repeal of laws in Conflict providing for codification and providing for an effective date ordinance 824 an ordinance of the Town Council town of Jupiter Florida amending chapter 27 article 11 Division 44 section 27 3191 to increased commercial and Industrial Development linkage fees providing for severability providing for the repeal the regular agenda item 11 resolution 40-2 24 um does staff have a presentation good evening uh Thomas Hernandez director of engineering of Public Works I have a formal presentation however I'll just give a brief uh synopsis of what we're going to be covering and then uh turn over if you have any questions about it uh so tonight uh Town count or excuse me the uh Town staff has prepared at Town council's Direction resolution 40-24 uh which is being provided for consideration of the Town Council for uh essentially Town staff to uh submit the notice of establishment uh to the federal rail Administration for quiet Zone establishment uh if this resolution were passed it would direct staff to establish and uh submit the paperwork for the uh 24-hour quiet Zone along the 4.72 mile FEC Corridor uh within the town of Jupiter um would essentially direct staff to move forward with submitting the paperwork to the various Regulatory Agencies who review and make comments on the overall package which we would be submitting with that if you uh have any further questions about uh the quiet Zone package that was presented as a part of the overall um agenda item Can field any questions that you any questions um not right now not right now I don't have any questions but I have some comments but I think maybe we should first hear from the public uh first we have Bruce Balsam after Bruce is going to be Kurt Dempsey there are two podiums um if you want to speak to whichever one's closest to you is fine good evening and when you begin uh I'd ask everybody if you could move the mic because we uh yeah I would just like to say I totally missed that presentation because the audio was so very low um so I just wanted to comment that since the bright lines come through we now have many many many more trains coming through the crossings and it's uh it's loud and it's disturbing and uh it's a little bit lower quality of life and I just wanted to come to express my support for quiet zones on all the crossings and um having said that complaint I just want to say how beautiful it is to live here in beautiful uh Jupiter including all the public services and um thank you very much for your time and attention Kurt Dempsey after Kurt it's Raymond Richards hi my name's Kurt and I'm two here for the quiet Zone I came here about 1982 from St Louis been in Jupiter all this time I run and manage a business it's been in Jupiter for since 1963 they live on a canal not far from the tracks on the west side of the tracks it is unbearable of the noise the train inconveniences 10 times over the people that ride it it should have been out west I know it's probably too late for that but the noise is ridiculous I understand that there was supposed to be a fence put up there was post started then it ended I understand that the council wanted the town or the railroad to pay for that that's never going to happen and besides that Rivier Beach gets a quiet Zone Lake Worth gets a quiet Zone West pal Beach gets a quiet Zone and we're in Jupiter and we have to listen to that I think it's ridiculous that's my point of it thanks Raymond Richards in regards to the quiet Zone my name is Raymond Richards uh nine months ago I lived in West Palm Beach everybody told me to move to jty because it was a beautiful place and a very quiet place to live I moved here I haven't slept since then one night through I'm probably I don't know a quarter mile from the track on the uh west east side of it and I don't understand why Rivera Beach and all these other places could get a quiet zone why we can't do it here is there a problem I'm not aware of do you know anybody so why aren't we're moving forward I guess is a question this is yesterday's newspaper for Rivera Beach saying they got approve for The Quiet Zone and they're putting up the signs for it are we against it or something or I don't quite understand what's happening nobody knows we're going to be discussing that right now we're just taking public comments okay so we'll we'll find out later where we stand with it okay I hope it's to the positive thank you very much not mention you could you give your name and address for the record again H Dempsey not to mention the noise that weal that I talked about earlier living on the west side of the track the train trestle is constantly down we pay high taxes to live on the water and so now it inhibits us getting our boats out the train it's down too much yet Stuart gets awarded 125 million from the government to raise their Bridge so that boat you know an average sized boat can go under it you're stuck at that bridge all the time you can't get out you figure if you do the math 30 trains at least 20 minutes per train the bridges down times that time start dir you don't get your boat out thanks last we have Barb TTY Barb talty 208 Damon way I live right over by Center Street so during the day we hear three sometimes four intersections if you do the math at 3:32 bright line a day and I don't even know how many times the freight train we're listening to 480 minimum whistle blows that is I mean you can't even sit out in your backyard and have a nice glass of wine and Converse with people because of stupid train going by blowing the whistle and Jupiter doesn't get a whole lot of benefit from the train going through and it's just annoying to the citizens they went through did all the constructions at all the intersections shut everything down so people can go across the intersections this was supposed to be so we could be quiet Zone status now I reach out to the town and the town says oh we've got to put up a fence now okay a chain link fence what is that actually going to do it's not going to increase the noise or decrease the noise level is it going to keep people off the tracks maybe but frankly if someone wants to get over that fence they're going to climb over the fence and get through the track anyway so why are we wasting our dollars it's not it's going to be on bright line they're not going to do it so I'm asking this town to give us the quiet Zone that we deserve so we can live live in this beautiful piece of paradise that is not Paradise right now thank you that was the last public comment okay um like to just emphasize or make sure the public understands that number one when uh right line was extended North to the South had been done long time ago and that's why to the South they have quiet zones established to the south of the prior Terminus uh down in Magonia Park the maximum speed was 79 mph federal government saw fit to approve speeds of up to 110 mph through portions of our town going north um there's not one of us on the Town Council uh that would have approved this if we had a right to reject it so I just want to make that very clear um railroads have inherent rights you would not believe that date back more than a century they think it's they're being kind and giving us the privilege have a road crossing and we pay for that so uh we're going to act tonight on quiet zones there are some issues I want to raise to bring up um and uh you know we only have three of five here tonight so two or three will make the decision but uh we understand and regret um what everybody is going through and staff has brought this to us take action uh but I do want to share some things in the way of uh some background so um when um the likelihood of bright line getting approved and by the way there were Federal rail Engineers that recommended like going 109 mph through areas where there was you know a high population that was accustom to crossing the track between Road Crossings not a good idea nobody listened to them but they did raise that as an issue um so when it then came to us the council went ahead and um and I work with staff and you know we're a team on the council and we divvy up who handles what this was one item that I've handled um and uh we asked staff to uh give a recommendation on where fencing would be appropriate um I took that to the council was unanimously agreed upon I work with brightline brightline agreed to fund portion of it and then they applied for a Federal grant um for the balance that Grant was with a whole host of Public Safety upgrades beyond the just the uh Road Crossings um from and a whole host of things from basically here all the up to Orlando that got approved I'm going to ask I'm kind of speaking rather than put staff on the spot to you know comment um so you can sit back down but then you can get up and if anything I said is incorrect uh you can uh give your opinion for the record uh but um so I got so bright line is committed uh to put fencing in and and even the federal government has supported by Grant there's not many uh areas that got fencing but some did and were part of them it was in a very limited area I'm going to have I'm going to just go through a quick deck so people understand where we wanted to put fencing in so the fencing was going in by bright line and then FC halted told them the halt cease putting the fence in FEC is the owner of the property um and um so they put it to a halt uh because before work was done in their Corridor you know even though you know bright line was doing it they wanted to make sure certain things were addressed the status I have from Bright line is that two things are happening number one um FEC FEC is working with bright line to go through the issues needed um to uh commence uh the fence installation and then secondly uh work is happening now uh with you know representatives of the federal government F Etc on the scoping and and approval of what will happen with the Federal grant dollars um so with that um I'm going to ask staff to just put up this the uh the deck that I uh number one the first uh the deck that shows the fencing locations please forgive me sorry they were telling me to speak a little louder into the microphone this time if you wouldn't mind if you could repeat the question put up the presentation on the fence locations this is just try to be information for the public this is a dated presentation from 2022 but uh but we've used it in previous meetings so if you again this few slides just quickly to go through where we thought fencing is needed to protect dupid residents and save lives next slide so we have in one area particularly um we call this the Pine Garden South neighborhood which is between Tona and Indiantown Road um there's been a beaten pathway where residents for decades have traveled from their neighborhood to the public shopping center you know an alternate A1A and uh you know those residents are accustomed to crossing the A1A and the FEC Carter while avoiding cars and freight trains that travel about 45 mph bright lines passenger rail service will reach speeds of up to 110 mph through portions on the south end of Jupiter and about 100 now at this location so you know this was one of the key locations where I felt government has to be more responsible can't just allow and the IDE FEC for decades there solution is to just put up no trespassing signs there's a lot of kids that live in this neighborhood and whatever um so again we proceeded bright line agreed to put fencing in uh but then um we we're held up go to the next slide so just what we're talking about in this section this is that Pine Garden South at the bottom is Tona pen on the slide and the top is Indian toown Road um and effectively we felt was be responsible to put up fencing um you know for the entirety of the Carter just that section of the Carter um on the west side only uh to discourage and change the beh behaviors of those that have walked this way for for years and um this was going to be funded partially by bright line and partially by the grant by the uh Federal grant next slide so the next slide was uh you know north of Indian Town Road uh we had 1,800 ft again we had a staff recommendation we B it to council and we all felt anonymously this this would be being responsible to you know to do a a uh rail expansion this way particularly one that's going so much faster um so it is about 11 ,400 or 1,800 ft there um and again U it is being funded by bright line and and this Federal uh Grant and then the last segment last slide um is uh basically along alter and A1A uh you know the North End of the town uh staff came up with that um and we we uh pursued it and agreed and again it's covered in the grant so when the fencing happens which we expect it to happen um there's a commitment both from Bright line and this this Federal grant that that fencing will be installed we think we're we're very responsible there's a lot of length of track that this low risk of residents coming particularly like in the South End and um so we limited to this Sera just on one side we already have had two incidents on the first segment I think that both were there where we had um people that uh were uh on the verge of committing suicide Laying across the track and got pulled off by our police um I do believe that a fence would have discouraged that yes people can climb over it uh but um I do think that the fence will when it's up will uh help to uh change people's behavior and with the fence then we can more en Force you know go around um but you know it's a it's a big distance to the um you know to the intersections where they should be Crossing so there a temptation to just follow the beaten path as they have for decades um so with that um and then just I had the other um slide if you could put up or you have a variation of it so um as I as I just walk through this and explain it realized that my colleagues are hearing this for the first time because in Florida we have Sunshine laws and we can't talk about this kind of stuff you can't hear okay um so I'm just saying my colleagues are hearing this at the same time you're hearing it so I'm kind of presenting it so they can see uh what I'm going to be asking for consideration so um the bright Line train you can see there's uh the intersections of the crossing locations where they do you don't currently uh blow the horns at at Donald Cross Road the speed is Max Speed is 110 mph at federick small it's 110 at Tona pen it's 109 at Indian town it's 93 Center Street Lux Hatchy River Bridge and Riverside is 60 then it speeds back up when it goes into at the Questa has to do that crossing the bridge that's by regulation both the curvature of the bridge Etc um so as as it's slowing down there's less safety risk um what I just penciled in there was um the yellow signifying line signifying where we had safety fencing were desired by the council um and but I felt is appropriate um and again it'll it'll be up to the decision of the three of us tonight but uh what I felt was appropriate was that and if you just travel both let's just travel it Northbound and then southbound um on where I'm comfortable with pursuing a quiet Zone as phase one pending the fencing so Donald Ross northbound no horn quiet Zone Frederick small no horn quiet Zone the next two Crossings would be phase two when the fencing would in um at Center Street Lock satche River Riverside to be no horn northbound flip if you're heading southbound kind of going in reverse so that's the direction of the horn as well so it's the direction of the train direction of the horn Riverside we get a quiet Zone lock River we get a quiet Zone at Center Street it's a phase two because between there and um Indian Town Road you know uh I'm suggesting that um it um be uh pending The Pedestrian fence and then likewise Indian Town Road heading to Tona Penna when you get to Tona Penna then southbound it's quiet zone so and I'm sorry we're up here discussing this we're explaining and my colleagues will make that decision I just wanted to kind of explain a lot of people have in had have heard that gee the mayor was the one pushing for this fencing yeah I've been pushing for a number of years um um understand we're we're having dialogue and we're presenting here so you all understand what I'm sorry we understand that I'm sorry no it's not a money thing and what I'm proposing is to proceed with a quiet Zone at 5 of the uh seven Crossings it's going to be up to the it's slower speeds I'm sorry we're having conversation up here we we we finished with public comment so uh so anyway with that and you know when we uh adopted the uh resolution 5322 uh adopting uh Vision zero um I'm just going to read from a statement in here section two we Town Council hereby adopts Vision zero as the policy for all Railway and roadway Carters and Traffic Safety in the town and directs near and long-term traffic planning to be based on Vision zero principle so you know I'm obligated not not just an elected official I'm a professional engineer um so Public Safety is is Paramount double double bound Duty bound on that but again um it's before the council what what staff has presented was to proceed with a quiet zone for all of the inter all the crossings and it's going to be up to my colleagues to decide um you know how to proceed and uh I'd ask uh you have anything you'd like to add to what I said you you made a very good uh summary of all the the different steps and where where the the safe safety fencing currently is as far as agreements between bright line as well as the FEC is currently the the status as well as the the raise Grant which you had also mentioned uh the the the bright line is working with the fdot as well as the federal rail Administration to work on those current agreements uh but that is essentially the status of those items um other than that I I believe you covered most of it very well when it comes to the fencing and the locations how they were chosen okay and can can you please just also for the members of the public here you head it in the write up mention that if the council whether the council approves um the entirety of The Quiet zone or excludes some to phase two can you just Define the process so the public knows that as a result of action by the council Toni you know as you the time frame for uh you know when they can expect to get a quiet Zone uh incomplete or partially enacted understood uh so essentially let's say the council chooses tonight to uh enact a quiet Zone at all six locations which is essentially what uh resolution 40-24 is is uh so what we would do after that time is we would take uh we as staff would prepare the the information that's here and we would route it for the mayor's signature um and once that is signed we would send it off to the uh the various Regulatory Agencies whether it's be F fef uh the county uh fdot and the various other regulatory agencies in the area they would review the package there's roughly a 21-day uh waiting period uh during that time Town staff would be working on the uh signage Replacements and and installation which we have to do for the various Crossing locations so installing no no train Horn uh signs and and other uh regulatory signs as a part of the as the quiet Zone um with the actual quiet Zone requirements um essentially after that time um the F and and the other Regulatory Agencies would review the package and then they would enact uh if we were to go all at uh one time if we were to go back and pull out and do separate separate uh only enact a portion we would have to start the process more or less over again you would have to go to enacting a notice of intent to establish a quiet zone for um the sections that we were going to make AC quiet Zone first we would go through the two-month waiting period and then uh once we got our comments back we would have the ability to move forward with whatever section we want to move forward with the Quiet Zone establishment for the just the sections that we going to implement the quiet Zone itself um if it was chosen to hold uh for other sections we would wait until um basically down Council gave us direction to move forward um and then at that time we would do essentially what we're we're currently doing uh tonight uh bring it back to council and go over the notice of establishment um package again for the second phase uh where fencing or or whatever um Town Council desires to be implemented could you just and you touched on it but I again I just know public comments not per se here but just in general about to the South so the signage that's needed for The Quiet Zone couldn't be put up until this process starts and then you put it up and it has to be covered correct correct so I just want the public to understand so like there are certain things a lot of the so can you just emphasize everything that could be done has been done now because you had it in the write up but they haven't heard that okay so after the quiet Zone establishment uh is approved by Council uh Town staff still has to go back and lay out the the signs and do the sign inventory to turn into the uh the federal rail Administration uh so they can review all the signage we've already done the field review with with the actual F inspector uh but we still have to go back and we'll have to implement the signage changes as I mentioned uh placing no train horn there's a few um just other regulatory warning signs we have to install but until such time um that the actual quiet zone is established we have to keep those signs covered so even if we move forward tonight um and the Town Council moves forward tonight and gives staff direction to move forward we still have to uh as Town staff go back make those insulation of signs and then there's still that 21-day waiting period in addition to making sure that all the Regulatory Agencies have made all their comments as a part of that so we would have to keep all of those sign signs covered until we're allowed to actually implement the quiet Zone by the F and other Regulatory Agencies but I um so but the sign work happens while the application's being processed right so nothing's held up by that it was just um and then I don't if you know but I know I talk to Bright line and and uh you know uh I understand that after it's approved the next day they can put it in is what I was told they couldn't once once they're being told it's now a quiet Zone at these Crossings it's effectively put in um next day that what you understand once once we've gone through the waiting period and all the agencies have had able chance to uh review the the actual application and package itself once the bright line is given the ability to move forward and all the signs are in place they are able to to implement the quiet Zone yes that's the way I understand um so you know since the the the safe Crossings were installed so we were we've been right on track to qualify for the quiet Zone correct but the fec's halting of the fences you know was a slowed every you know slowed you know pretty much gave us pause to reflect and look at the safety issues correct so so but if we change it tonight we have to start all over again you go so just for the general public yeah so just to answer a couple of those so the the current the FEC did start uh excuse me let me take that back the bright line did start to implement the fencing and uh as the mayor had mentioned earlier the FEC wanted to make sure that all the legal agreements and all of the various items were worked out between the two organizations uh so at that point the fencing construction did hold uh so to reiterate on the second part that you had emphasized yes if we were to only Implement a portion of a quiet zone now and then Implement a second phase later what we would essentially need to do is come back to council with a notice of intent package to submit for a quiet Zone that is broken up instead of all six you know whether it's 1 2 3 four five um we would need to split that into two pieces do the notice of intent for both and submit that and then when we could Implement at one point and then when the next phase is ready we can Implement at that point at a later time possible but and we still have no exact time frame on when FC is going to okay the construction of the fences correct I do not have a good time frame for that no Ive I've tried to stay and work with the FEC they've been very they've been very receptive they have been very communicative with me um they've been very responsive it's just it's a those are two large organizations they have to work you know they have to work out the the legal side to that but they don't set any speed records right [Music] but sir the way we're in our meetings we don't converse back and forth with the public but we're we're discussing with staff right now but okay just just part of the decorum of the meeting thank you um that's it for now thank you um a if you know we do all this is there are they are we planning on applying for SS M for Center Street and Riverside Drive is that do they have a plan to install those so uh at one point the the town staff had reviewed and given comments about the ssms at uh Center Street and Riverside uh the the ssms the the sental safety measures which you're referencing are the four quad Gates I'm assuming yeah um so those those were comments at uh my understanding is that those were comments from town staff before to uh the bright line and others who are implementing the construction at those various locations however it did not move forward with with the quad Gates it's not to say that we still can't request that those items move forward um in the future um to see if potentially those could be added to the the raise Grant or if we could try to see if that could somehow um be pushed through um through other means uh whether it's bright line or um you know another another mean available to us okay and do we know if there's um The Quiet zones that are south of us and uh currently established in West pal and lak worth are there I know the answer but there are crossings that do not have ssms that are in established quiet zones I'll be honest I'm not I'm not sure about that that question myself I haven't haven't done the research beyond the town of Jupiter to to look at whether or not they have quad Gates um that implemented and and actual quiet zones implemented in locations with without quad Gates okay because it just so happened I was I was in Lake Worth today I was at 10th Avenue and uh one of the crossings is a quet Zone Crossing and it doesn't have the ssms there um so I thought that was interesting that they're established with quiet zones down there they have the then they don't have it whether or not they're going to get it I don't know but they've been doing it for years and it's hasn't really been an issue um so and you know the the max speeds I understand what the max allowable speeds are but I did today as I was driving up alternate A1A North going into taquesta um I was actually driving alongside a bright Line train and I was doing 45 miles hour and I was actually going faster than the train as I approached Center Street so the train was actually doing about 40 m hour as it got to Center Street so they're doing about 40 they're not doing the maximum allow they're actually slowing down a lot more than that um so it does give me a little comfort that they're not doing the full coming south I was going north okay so um you know they slow down for the turn and then and then to go over the bridge as well so uh they were doing about probably about 40 miles an hour and I'm not sure if that's average or you know every train does that maybe some go a little bit faster I guess maybe depending on how they're running along with their schedule and stuff but this particular train today was going about 40 so there's there's a max speed to go over the bascule yeah it's 60 is the max is it 60 but this I'm just saying this train wasn't doing 60 it was only doing about 40 so it just to provide a little bit more comfort you know and when we're looking at this so um I'm not sure if they're doing the max speeds at all of these Crossings you know 93 at Indian Town 110 you know at the other ones I mean maybe we could get the cops out there with radar guns and we can hit it just for our you know our own uh information but um you know it's I think it's you know long overdue we've gotten a lot of comments from the residents via email um and all different uh neighborhoods and stuff like that um the thing that helps me with this is the section here on the front page it says it's important to note that while the establishment of a quiant Zone eliminates the requirement for routine train horns train conductors have the authority to utilize the train horn if necessary um so the good thing about that is if the conductor does happen to see something that you know he thinks he needs to utilize his horn for whether it be a person or a car tracks they can still utilize the horn for it um so you know that brings me a level of comfort to say that they can't use the horn but you know they they don't have to use the horn so um you know if they see something I'm sure they're going to be you know utilizing it as necessary um so it makes me comfortable with that um you know the fencing it's very frustrating that we were trying to get this done and you know they're just you know whatever you know games they're playing with that I I don't understand but you know it's it's a fence it's it's not we're not building a rocket you know just I I think that you know they're going to do what they're going to do and uh you know it the fence will eventually go up I'm sure but I don't think we need to be waiting on a fence to go up to establish quiet zones for The Crossings so cu the trains aren't blowing the horns the trains aren't blowing the horns between the crossings they blowing them as they approach them so um you know I I I understand the the fencing and stuff and I was I too advocated for a fence to assist with the safety there um but I don't want to you know have to go through this process all over again and delay any longer um trying to get this done for our residents so yeah I agree I mean we were all on board with the fencing but I didn't um the the open-ended wa time for FEC um we felt with them before you just have no idea whether it's going to go or when I I'm I with bright line myself directly I I speak with them probably monthly yeah so no other than it's starting to move I couldn't I couldn't really get a date um so I just you know um you know one of the residents said we get right line comes through and we get no benefit from it which is you know it's true you know um but you know there's unlimited uh Power with that you see and it's their track and you know the you know we actually rent or the county rents you know pays to use the crossings for the for road traffic and we tried to stop it other local you know uh groups tried to stop it in court and it failed so um you know I live about three miles from the tracks and sometimes I hear them inside my house and I have hurricane windows and I live in a concrete home so they're allowed they in my yard when you're on the boat in the weekends it's it's almost like you're in a train yard I agree the bass Fels down far too often but I know you know trains are going to go through um it's just um it's really you know we pride ourselves on this town for our small town fi and it's become sounds like an urban environment and I'm very concerned about the safety um if someone's crossing the tracks and they just oh there's a they see the the light of the train I can beat it you're you're you're dep perception has no it can't judge the speed of that train train and it's on you so quickly that's why people a lot of people accidentally get killed other than the suicides but um you know it's just you know I hear so many stories about people can't sleep you know it's just changing the whole vibe of the town and I'm just not willing to wait for this fenses so I think we we should approve this tonight and um be diligent with the construction of the fences and if FC if if right line can't pull it off then we could maybe do something on our own down the road and find out access to you know borderline of the property of FC and do them ourselves or just figure it out but tonight I think we need to pass this [Applause] resolution that's I I'll uh entertain a motion in a second for comment motion to approve approve second Motion in a second um I'd ask that um with the U it really all ties in including the notice of establishment letter um which has to be signed by somebody attesting that I also concur that this quired Zone should be established with the full support of the town I can't do that as a professional engineer so I'd ask that be done by the vice mayor um you know I'm not going to you know I believe I and I I respect and was expecting that was going to be the outcome I came here proposing I understand I live even further it is incredible the noise I'd asked staff to go and measure the noise to see if we also had the opportunity to also reduce noise uh but nonetheless you need to take action I was supportive of that uh but just uh except for uh two zone so majority decides here I just I'm an elected official do bound on public safety and I'm a professional engineer uh and I don't feel I'm I'm I couldn't U rationalize accepting loss of Liv so okay Motion in second all in favor signify by mics speakers aren't red light do you hear me there you go thank you all right so uh just a couple of things to report mayor um we're still tracking the um final report on the legislative agenda um for the funding for West Indian toown Road in the community webcam as far as I know they're still on the governor's desk waiting for signatures I want to acknowledge the work of the uh utilities department we received word that the town's uh utilities uh receiv received notice this week that they were selected as a recipient of the Florida Department of Environmental Protection FD 2023 drinking water plant operations Excellence award a recognition of outstanding treatment plant operations maintenance and compliance that's that's a pretty big uh accomplishment so kudos to all those folks out there um also as you know we had a busy week last week we had uh two sessions for um Community input one was a CRA um public input meeting which we held here in the council chambers it was really well attended got very positive feedback on that and we're working to the consultant with the Consultants to um to gather that information and move it forward same thing happened as you know on the following night for the input on the um the Parks and Recreation facilities master plan again really well attended and got some great feedback and now we're in the process of taking that information and uh synthesizing it so we can move forward with a report for Council um the police department's taken on a new nighttime Traffic Safety campaign uh to maintain the safety of motorist on our roadways a lot of this has to come with the um citizen comments on lighting and those types of things so they're launching a new nighttime Traffic Safety awareness campaign they Prov be providing awareness and educational messages on various safety driving topics to include overall Traffic Safety the dangers of distracted driving consequences of driving while impaired and other important tips so they're they are doing the uh public campaign and also obviously with their traffic enforcement as well so uh and that directly feeds back to the comments that we receive from our citizens and then finally as I I like to do um we just got another uh member of Club 20 that's those employees in the town that have 20 20 years or more of service and I'd like to congratulate Jenny Bryant from the parks and rec section for achieving a 20-year Milestone um with the town I believe we have over 90 people in club 20 right now that's my report mayor councelor hey um just real quick I I was talking to a resident out front before we came to the meeting about the uh intersection at Riverside Drive and Alternate AA um there's been significant amount of increase in traffic accidents and stuff there and I know we looked at um I had asked staff to look into speaking with Palm Beach County about uh changing the light timing there and you know things like that left turn only versus you know being able to go straight across and whatnot I just wanted to see if we can revisit that just now with season and a lot more traffic it seems we be having a lot more accidents and stuff there and so just for the safety especially the residents in Jupiter Cove that are coming out of Riverside to turn onto alternate a heard that too from a few people yeah so you're heading you're heading west from Cove yeah want to take a left exactly there's no left hand there's no there's no left hand only you got traffic coming across and they're coming up and over the railroad tracks you can't see them until they're almost up on you because they're on a downhill right so when they come up and over the intersection they're already on you needs to be one there I was going to wait a little bit because of the bridge in when that was winding down yeah when they refigure all the light cycles maybe put a bug in there now about getting a left hand yeah I know I think I had staff look at it and at the time they kind of shot it down but I think they need to look at it again because I think I heard something about there's been 47 accidents like we'll follow up on that yeah it's it's a tough turn I make it fairly frequently and some see why there's accents there so yeah um but that's all I got for tonight um ice mayor yeah I heard there was an app available able for I I if it's put out by FEC or bright line probably FEC about uh uh rasule openings and I heard there was one up north is available up North but is there one available for Jupiter has anybody heard could be request one or anybody ever hear about that I have not but I'll look into that as well have you councelor may I I've I've heard of the app where you can look at what the bridge schedule is I guess or what the intended it's supposed to let you know what time ited openings are that's all those that timing is pretty specific yeah I'm sure it may be very here and there but it's yeah it could be five minutes here or there either way but just to give people an idea on the boats that it goes down bright line flies through it might wait 15 minutes freight train goes through might wait 10 minutes and a bright line comes the other way so it's like sometimes like 40 minutes yeah and you can there is that little notch further south on the on the on the the bridge part yeah that if it's low tide some Cent can get under but it's you know otherwise the boat stack up and it's a safety issue with the current and and some people don't know how to navigate that well so yeah I was able to get my boat under that at low tide but I've got under it some like an inch to spare I mean it was close so let's staff look into that is my understanding that bright line may be the one that has to populate or NFC has to actually populate it with the information so to some degree I think their lead on it but uh but yeah we had heard about it uh in the past being done further nor so we ought to make that ask yeah it' be very helpful that's it um just um for the residents from Abacoa that stood here um maybe this first time you've come to meeting we we generally uh don't discuss items with the public uh comments um that doesn't mean we don't care and we don't act on but it's not an agenda item I just want to explain for the record that on behalf of the council that um you know it's interesting when development uh projects are being discussed in the public and presented still hasn't come to us to act on and it could largely change before it ever gets here um so we may individually kind of give comment but we never know how it it could could in fact be changed if you will um but I will say that we had we had a presentation on it and um you know we had three of five that allowed it to just continue to move in the process not necessarily supporting the project so um the next time it would come back to the council certainly um you know developers ought to be meeting with the public and yet there there been a long track record of that to get a consensus before they ever come back to us so we don't know whether or not they got the message or what uh but the first step in the process would be it would take two meetings about that for the council it would first have to go Planning and Zoning commission you know before it comes to the council and then if it came to made it that far the first step I just want to put on everybody's understanding would be code change to allow uh an increase in the number of units in that District before the um site plan would ever be considered that' be the second meeting the first step is to pass that they could get an entitlement to additional um dwelling units residential units above and beyond what's in the code now so I'm just trying to explain the process to you and leave it at that I'll be glad to talk to you afterward woods but just um you know when we hear there's nothing we can do about it being in the process so I just wanted to make sure that's understood property owners are entitled we only get to speak when it's before us and then give comment but we did back in I think it was November we had heard about that and there had been reservations expressed you might want to look at the minutes for that with that um the time is now uh 8:04 and we'll adjourn the meeting for
