open public meeting act being chapter 231 Public Law 1975 laws of the state of New Jersey the planning board secretary has prepared a schedule of the meetings of the planning board of the burrow of kennworth for the year 2024 and has posted a true copy of the schedule on the bulletin board located at the front entrance of burrow Hall and has mailed true copies of this schedule to the local source and the Star Ledger as and is maintaining a copy of this schedule in burrow Hall accordingly the notice of requirements of the open public meeting act have been satisfied in regards to this meeting roll call please Mr berera here Mr David here Mr kenti here Mr Mao here Mr L here Mr scary here um Mr dun here and Mr P here I got everybody okay okay so hey Frank what's up this is our thanks for coming you no just um this is our workshop and uh we have a few things to discuss in our Workshop right so I think we have to put everything on the record later on so I don't know how much of this you want to discuss now if any gentlemen special meeting or not yeah we can talk about the special meeting now right you might want to talk about what's leading up to the special okay so something special why don't we do this hey Hey Kevin why don't you just take the the lead here tonight and talk about that in the workshop so it'll become an easier task come 7 o' do the short version that okay good evening everybody we uh none of us expected to be here tonight at least of all me that's why had surgery yesterday so I apologize for my lack of professional attire this even I could barely see myself dress thank God my wife took care of ladies Mr pantina so we met last month and we were presented with a resolution from the burough Council that said conduct a study in order to find out whether or not the mer former Merc property was eligible to be declared are nobody from Council communicated us nor the mayor nor the administration so we took the uh resolution from the council face Val and uh work through officers professionals met prior to that meeting and we laid everything out according to the law did took the same steps that we took when we last did a Redevelopment which back was back in 2020 2021 uh we made sure through our Council that everything was done in accordance with the Lawan law Redevelopment La so that's why last month you authorized me as your planner to conduct that study after we had that meeting uh we met with the mayor council president and people that they had hired to guide them through Redevelopment a week and a half later week later excuse me and we sat that and said please tell us what's going on and uh they told us that the council basically jumped the gun by hiring a Redevelopment planner to conduct both the study which is the first step and that says yes this area qualifies as well as the Second Step you remember that 10 step program I gave out last month they basically hired the guy for the fifth inning instead of the start um so it turned out after we met with mayor and counsil and that they ad fired that they did not bless you bless they did not realize that the middle step and that second and third anual planning board authorizing the study and hiring people to do it was necessary they had been told otherwise so we showed them the statutes we showed them the things that we were working with and everybody came to the agreement that we had done the right thing and we should proceed and as we plan to do because that was fully in accordance with the statute after that meeting we had another meeting and St with the mayor and the council and said please give us all the background tell us what happened so they said that they had hired these folks um the study had already been done uh we saw an initial draft of it uh two weeks ago and realized that they're already working on step two which is the fourth and fifth things and after we learned all the background of why they had not talked to us why they had proceeded uh and we found out all the above and they said look we made a mistakes we didn't know what you guys do because we weren't told so now everybody knows the board has made its point is supreme in this matter because statute is behind it it tells us what to do uh after that meeting we met again with the officers of the board and I said you know this study is has been completed I consider it a draft because it needs revisions things have to be redone in it but why PID me and my colleagues who I was going to work with to do the same thing as these guys have already done unfortunately we didn't know it at the time uh and it made no sense to me personally I worked for this buau for a very long time and I hate to see waste and I hate to see things done the wrong way uh while supporting the board of course as fully as I possibly have so after Consulting uh with the chair and the vice chair I said look let's not withdraw the resolution for me to do the study because what I will do is I will revise the study with those guys and they will present it and I will present the summary to the board from my perspective trying to lay out as I always do what your job is and what you're here to do uh the chair the vice chair agreed that we could save at least 6 weeks of time if we moved up if we accepted their study had a special meeting at the end of the month to adopt their study uh and if we do that on April 29th I believe is the date is that right that is correct thank you very much let the record show mras here if we do that on April 29th on May the 1st the council meets and they can Pro they can approve our resolution and get these guys going to the fourth and fifth day fourth and fifth inning and that puts the burrow six weeks ahead of where we would have been so I'm losing money oh well so let me jump in I'm trying to do what's best for the board the board is responsible for this so I'm recommending that we hire these folks they revise the study presented to you on April 2 okay so um you pretty much hit the nail on the head but there's a couple other things that are going on okay so we found it NE so first of all we're doing this in the workshop so we don't have to reiterate all of this again later on at 7 o'cl we already know what's going on if there's discussion we could have it now we could have it again later but what's done is done this is what we're trying to do I just want to bring you up to speed on something when we got the resolution uh from the governing body we acted the way we were supposed to we took that resolution we read it we did everything we was supposed to do according to uh resolution okay at that point there was murmur that there was a study in progress or done and we didn't really want to hear about that because we didn't know what was done and may not be done so that's why we took the action of creating our own team to make sure that everything was done when we when we did have that meeting we recognized that a study was already in play um and when we finished that meeting um when I left there was a a continuation of that meeting with Mr David and and Kevin and and uh the mayor and and and Mr Zimmerman and they discussed why the uh the whole read development was to take place so we now have the knowledge not secondhand but firsthand why the governing body or the council is saying this is what we want to do this is how they went about it they may not necessarily have followed the proper marching orders but we're here to make sure that it's clean and tidy and that's pretty much what Kevin has done in the past couple of weeks with that being said I get a phone call from Kevin while I'm in Niagara Falls having a martini and he tells me this portion of the story which I really and I and I know uh I talked to Mr David about this too I have to commend him as you all should that he could have stretched this puppy out and picked up an extra 20K and just laughed all the way to the bank in instead I think we have the right guy on the job because he actually took a step back reviewed it tweaked it and said this isn't the right way to go for the burrow so we were right every step of the way by picking him by asking him to do the study he looked at and said the study's done um I think it was best that we did what we did so it it really it really makes me feel good that we're going in this direction although he was strong and fast saying no we're doing it we're doing it we're doing it what done is done and yes so I want to commend k for doing that's a really honorable thing to do and the way to go but my concern about having this I forgot what the name of the place is but just seems like very strange that we have a legal attorney up up at Council right we have a legal attorney on the board we have experienced board members and they make such a mistake I mean to me I don't want to say anything's bishy but it just doesn't seem right that that Collective body would make such a mess and get someone there that blindsided us and get that study done I agree and and I can I just make one more do we need I mean I don't want to say we need an overseer do we need Kevin to make sure everything is going right like whose job is that so that Kevin to do extra work to kind of be the overseer on that projects Were Us just an idea I yes I I agree with Mr Lut um on Kevin's performances and that he fell on the sword for this but what I was also thinking about during the week or you know over last month since we we talked about this is that um you know the statement that Kevin made about the governing body not knowing well he's not here I think that's how can the how can the Gover you're run good how can how how can the governing how can the governing body how can the governing body who's supposed to be prudent in anybody we part they're supposed to be prudent in saving money how can we have a professional on payroll and then you'll hire another professional and does the same thing why would you do that unless you just you know because we can I can explain it if Council Council but but but on that but on that before you say counsel didn't know how do they not know we have lawyers in your profession everybody knows a little bit about ml about the land use law right how can they not know that the planning board has to do the the has to do the study first how can they not know that I think Mr bottom line is okay everybody's right everybody's wrong we can all point fingers at everybody all day and you guys could be absolutely 100% somebody dropped the ball but I think should be for this board go forward doing the right things getting the right people we need to make sure listen I like to look myself in the mirror the next day and like what I see so as long as this board continues on its present PA doing the right things regardless of how effed up you think somebody's dropping the bll or something we're going to continue on our path which is I believe is we're doing the right thing we're following what's best for the burrow uh and and if we continue to do what we're doing whatever mishaps happen at the council level at least we can say we did the right thing no I agree with that know I agree with that I agree I agree with everything everybody's saying and that's why we took the action we did but I did take the opportunity on behalf of the board to ask the question with the attorney there Mr David there and and and Kevin there and asked why they took this route and they actually said they didn't know any better I you we we could frown we could say what we want but I can only go by what I didn't hear it in at at the deli I heard it from the horse's mouth matter of fact there was two horses there that night so I'm sorry who was the mayor and the council uh council president Zimmerman so I'm not saying he did anything uh disingenuous or deliberately wrong or or whatever like I just think by what they told us that they were uninformed I did say that's the reason you have the board that you handpick because we have hundreds of years of experience myself being in business for over 50 years work with planning boards and and Redevelopment and business Mr David who is our mayor at one point and also deals in finance we have risk management sitting over there deals with lawyers every day we have Mr Mao that deals with construction and what have you and all the other people we have another mayor sit out there in the audience we have a lot of talent and uh it it should have it and if I miss someone someone I'm sorry we also have another councilman and everybody firefighter we are hands we are so I expressed it Nick and I said it what they did was they misstepped if they misstepped and and there was a hiccup we corrected it and that's where we're at now I feel we corrected it I I uh let the record show said D Mondo's here I think at this point we can't look back we need to look forward and I'd like to get this back on track and I am under the impression that Kevin is going to be overseeing and working directly with Brian and uh Fran what's this let I will Fran reer revise the document yeah in preparation for the 29th so we're not going away no we're I just wanted to make sure yeah where they are Mr obrien is absolutely getting a portion of that money that was set aside for the work that he's done and the work that it's continuing to do but absolutely nowhere near the 20,000 that was set aside there's no reason to put any uh burden on the the Ken burrow of kennworth or the developer that's not warranted and that's why I think we all commend him for stepping up and doing what we have to do so that's that yes absolutely you know again I want to commend Kev publicly because you know his actions have been you know excellent and uh he's been with us for for a long time and I think that speaks to um his longevity speaks to why you know he's been here so long because of the way he conducts himself on behalf of the barel on the board so again kudos to you Kevin the last thing I want to make the point is you know it's it be behooves the governing body to take a look and potentially hold accountable the people who steered them in the wrong direction because when you hire professionals you rely on their advice and guidance and in this situation assuming that everything was done accidentally the everybody you know and I take them at the word you know we met with them but I would go back to those professionals and say why didn't you know how this was supposed to play out and make sure that it played out in that fashion and that's what but that's on that yes it marrow's not here so well so Mr Mr David I think if you're remember we did ask why they did it that way and his answer was because the attorney was he took sick coming off 138 thought he was going to have a heart attack or something like that if I remember correctly he was right but the only guy that was there to speak on behalf of DMR was the planner right and he did say that he has done it that way aund times before Mr O'Brien said if you've done it 100 times before that way you probably were doing it wrong and nobody picked up on it so we we we we did figure that out and I don't know if it was jammed down somebody's throat to just try to get it through but I'm glad we picked up on it and did what we had to do I I do know that um I have this 15 minute rule in my body I'm gonna be real pissed off at you for 15 minutes try to iron it out and then we're going for a beer I want to put it behind me if we can put it behind us then we could do good work going forward if we can't put it behind us I'm not saying that we're not watching you know I like to put my sunglasses on and look around the room but we need to make sure that everything is above board and if we could all at least agree to that then we could actually move forward when you met with you and Mr David met with the mayor and the council president did you ask them how they came up with this firm we did no I don't any know any connection anybody resp profession I'm sorry just think no we did and and I will tell you how that happened um did somebody else well I don't know where it's pretty it's pretty serious Nick you know because I I shouldn't have said that because I'm always joking I'm always joking and it is serious that's why I made my comment and I'm not mad I'm just telling you that that's how so I was told to us uh that that there was three uh candidates I think it was whoever it was they put out an RFP they put it out of RFP there was which we didn't know we didn't know about it yeah we we I'm okay with that they went through the right H the firm and it just wasn't all a sudden showed up one day I'm okay with that and I will tell you that they did put out the RFP and there was three candidates and DMR Harbor and one other person I don't know who it was I forget who it was and it was um said it it was a brief conversation but it was said that they felt comfortable they presented well and this and that and I said well that's wonderful however if a guy comes in in khakis and and in a baseball cap but really knows his business and if I come in in a three-piece suit and tap shoes you're going to hire me you remember that okay now that you repeat yeah so me and Uncle Benjamin I'll get in but anyway we asked every question we possibly could I don't think we had any hiccups there um but it's important that uh as our group that um we we stick together as a as a good board and good professionals and um at no time do I or Mr David as the vice chair want to sway anybody's thinking like ours we want to or mine we want everybody to have their own thoughts because that's how we learn and grow if you don't think this is a good idea say no if you think it's a good idea uh you know let's let's get this thing moving and it will help us I'll be right with you Mr D it will also help us to expedite this for a million tax reasons Mr dun um who puts together the rfps and do rfps typically come through the board or no no they don't come through us we didn't know that they went out so that would have probably been the town attorney or Angela we really don't know who put them out usually who puts out our piece the clerk the clerk agent but we were not we is usual that built or does that come to the well sometimes this doesn't seem added ordinary some right now because rfps go out every year for a lot of things the professionals and and that and all of a sudden we get hit and say oh we got three people for you well we really don't we really don't care what you got for us we'll take care of us and that's why we don't have bickering amongst us if you go Wednesday night you might see something a little different as you have encountered so the council hires its own profession to work for the council the board hires its professionals to work for the board and they each have separate um notices Publications and Hing and and you know what else Mr dun the the most important thing is is that the governing body and the planning board is working in Harmony when we have a Discord nothing will get done in the burrow and okay you take care of the map we take care of the ordinances you do this no we do this we all suffer because we're all part of the the tax role so we're trying to make it work the right way for everybody not for selfish reasons so the reason I asked like um guess opportunity for improvement right we have clerk putting out request for proposals without input on what we're requesting so if you're going to ask for something what you're going to get return is based on we asked for yeah so to me what I'm hearing is one person is deciding what we're asking for and we purchasing well it is it is the person 's job it does come from the purchasing agent clerk it does come from there but when it pertains to the planning board the planning zoning it should come to us hey we're putting out solicitations for attorneys planners Engineers we are putting out a solicitation for um Redevelopment attorneys and so on and so forth if we would have heard that early we could have probably stopped this process we don't need to we don't need to how how could the board this board not have heard I mean again I'm just I don't get it how how how come the two bodies aren't talking to each other or how come how let me rephrase the question how come it seems that they're not talking to us I understood it both ways I know seemed like cheese and crackers are CR my my point here is is that um I you like that right um I I I guess my point here is there was an early meeting about uh the whole Redevelopment and what was going on and we have a few things that are hanging over our heads and the biggest one is the 1.4 tax that everybody's getting bang with here in kennworth that we have to pay and we had that in 202 because of MK and then there's another one in 23 so part of what's going on here is to expedite the process so if everything falls into play I would imagine that the developer and the town is in a better position that maybe the 1.4 for the following year will go away and there would not be a tax burden on the people the tax appeal the tax appeal there tax appeal implications here which is why everything needs to move we're but we weren't we weren't aware of that I mean we were again we weren't we Wen aware of that so I I think generically mr's qu your question was more generically I think not just to the specific situation because with the Redevelopment there's a mishap things didn't go the way they should but at the beginning of every year rfps go out for our attorney for our planner and for our engineer or they're supposed to and I believe that you know that that happens believe right we have we as a board have not really taken much um I don't know if interest is the right word but we haven't been that involved over the past few years or maybe even several years in reviewing those rfps and making sure it's exactly what the Board needs but the buau sends them out on our behalf often only one you know firm or whatever responds to those rfps which is unfortunate because otherwise if we had several the board should really be reviewing those firms and then making a decision on who we want to hire that's how it's supposed to work what you said about the experience here going through a new sidewalk out front I would hope that before you put a request out for a sidewalk we would look at say this is xyc but it sounds like we're not well and we take take into account that the rfps wouldn't change from year to year so the fact that we haven't taken much interest because our requirements are what they are you have to attend every monthly meeting you know there's C certain things that are required and then you request you know are you interested in this and at the price that we're looking for well and take that back because they will tell you what they're looking for and then you know we would review that and say okay based on their qualifications and what they're um looking for who would we want to hire but I already mentioned that it's not uncommon that like one firm responds and you're kind of you know at that point hiring that one firm or then you'd have to delay conducting business until you will back out and request new rfps so um you know that's something that we can look at close to the end of this year and they start the process we can collectively it's in November it's in November so the qpa the qpa sets the standards the qpa the one that us we sent out the request for proposal so they determine what right but the qpa should be talking to us to see what we need before they send out RFP that's my is the point I'm making yet we have not really done that for the last sever years because and I get that because we don't change our requirements that much if and I think that's something we're going to be looking at this yeah I think this coming year we have new members who don't know the process I just want to say one thing why I came up I watched I got name of the company but I put in the assall sidewalk over inar par and they just dug it out for down P down dirt put C on top of dirt I'm not an expert but I know that's how do it and it's going to be garbage now that's the way DeLuca does [Music] it go B that's you put the RFP put the RFP you have you know we can we can talk go ahead go ahead rfps are for services for Professional Services what you're talking about as contractor that's a different thing so so RFP goes out services for planning engineering tax law U you know lawyers whatever attorneys whatever Bing for a project going out to for a contract yeah uh the town Harbor as your as your bur engineer not only your plan board engineer but your barel engineer might put out a contract to replace all the sores in town or replace all the sidewalks in town and then they go out to bed load there and then we have to open up the meeting out uh so I I'll I'll come back to you on on stuff like that that happens but we could talk about that a little bit do the job and they may say okay the engineering firm I could only send them out and and he's here he could attested that I could only send them out five times to inspect and he may say to the contractor listen don't pour that black top unless I'm here to at least inspect the stone that's one time he inspects the stone he inspects the elevation but if they're past the amount of time that he's supposed to go out there there's nobody paying him to do that so maybe the burrow not this burrow all Burrows don't have enough money to have the watchful eye so shady contractors or I am not saying the guy you re referenced as a shady cont contractor by no means but I am saying sometimes they'll do things that are not appropriate question is next time I see plans for something for a sidewalk they at least be in the plans right the right way I'm it is they are it is it's there they are there's details there's construction details that should we start without the videographer she's going to try to see where he is but if she comes back and says she as long as you're recording somebody take minutes you're okay we're recording we're good okay and if he's if he's 5 minutes away officers the chair Vice chair and I we discovered a way to save approximately six weeks of that effort by utilizing a study that had been done by another planner that had been hired by Council um unb noed to us so we corrected that and we suggesting correcting that by hiring them this evening to conduct a study which I will help them revise to make sure that it is correct uh although they will present it I will also present a summary as I always do for the board so that you know my language PL language as to what's going on and where we're going uh so in front of you this evening is a resolution entire gmr uh as the planner to do the study the resolution you passed last month still stands so I still can assist them and work with you on it and to make sure that this happens quickly uh we are suggesting a special meeting on Monday April the 29th at 700 p.m. here in the chambers at which point we will hear EMR present the study and we can adopt it deny it change it whatever the board's pleasure may be at that time and as I say that will shave about 6 weeks off this entire process that the B proceed they have various policy issues they we to deal with today board up to date with since our last meeting and uh this accomplishes the chairman are there any questions um I don't think there's any questions and I'm wondering right now if Mr uh Rego could help us do we take a vote on a special meeting for the 29th uh to get this expedited I believe we should uh I think I I would check my recommendation would be check on who's available who's not available and then just uh we can do a voice vote as to whether we propose to meet on the 29th so we have two two meetings right there's no two what two vot we have two votes authorized to conduct study we we should do that now you be opposed to us continuing the meeting Mr chair I wouldn't I mean we both serve on the finance committee of the board of education so I think it's probably important that we got the budget okay and unfortunately at least you know it's going on the school board we have we have started superintendent search we're negotiating with the teachers and the main codes and the aid and have a budget
