with the two top discussion items the first will be the enforcement order on 10 Ivy followed by enforcement order of um 301 let's go ahead and start uh enforcement order 10 Ivy which is mass D 20498 okay good hello I'm Alec drers the engineer for ten Ivy uh pretty much just I'm assuming we're going have to jump on to next uh the next meeting because right now they're still at a standi we fixed the erosion control concerns that we had I Tim came out and inspected it and uh said that they gave the contract to the green light we're still waiting for the DPW to come out and uh investigate the catch Basin and uh like I said right now we're just on pause because the contractor mobilized offsite to go work on another job and they're planning on getting there for next week and before we start we'll have the dewatering set up and for our last discussion it's only going to be a very very small portion of the project will have dewat because once we get the the bed bottom inspection by Board of Health uh everything else will be above the water table okay thank you for that update um Alex so our next meeting is May 28th but is my understanding that you have permission to go ahead and do the work as permitted correct commission that's right that the only reason I wanted to maintain this as an open enforcement order is to make sure that the catch bent was in a good condition before we uh lifted it yeah and and we did get in contact with Highway uh and they are going to check it they just haven't got to it yet understood okay and Jim graffy is is also on top of it for the Board of Health side of things yeah I did see that correspondence thank you Alec for sending that along or or for Tim for wrangling out of JY in any case I was glad to know that they were up to date Alec I Alec I would encourage you to do follow call to Highway DPW they're obviously very busy but I think some of those things can just fall off the off the list yeah absolutely when did you say the next meeting was uh we meet again on May 28th but I'm hoping you can get your work done by then okay so if we um how I take it all right that works we'll have I'm assuming they'll be done by next week so enforcement order 30 Warren Street it's an unpermitted construction of a walkway within the buffer zone who would like to speak with that this evening we have the homeowner Casey here um if youd like I can give you a rundown of basically everything that kind of occurred in the in the sequence that it did okay do you have any um any photographs that like to share for I don't believe Michael's been out so myself Tim Kyle and Amy have been on site so I don't know yep I can okay just give me a second okay Tim while you're pulling those up I I do want to express appreciation that the site walk logs and the photo logs that you've got loaded up on the website really I wasn't able to get out there to see it but they're well done and and really help me yeah I think it gives you if you weren't there Chase it gives you a pretty good r view of what's going on all right um hold on a second I think I clicked on the wrong one here so while we're doing that Casey um if you'd like to introduce yourself um as your full name and and where you reside and let us know if you've had an opportunity to install any erosion control uh yeah um my name is Casey calenberg I live at 44 Warren Street which is right next door to 30 um after you came out to visit me you instructed me to put either um hay bales or waddle down I didn't know what wadle was at the time but I sure do now and I put waddle down um on the back side of the walkway um to going across the opening of underneath the decking you didn't happen to take a photo of that by chance did you no okay all right Tim we we'll turn it back to you all right you guys can see this right my computer is being a little FY all right Perfect all right so I got I got word that there might be work going on um within the buffer zone and um so I go out later that day to take a look and the only person that was still on site at that time was one of the labor labor um for I think it's male landscaping design um he didn't speak the best English I wasn't sure if he was quite grasping what I was saying uh nonetheless I I I asked him if he could show me what he was doing and and he did um while I was there I noticed additional work towards the back um we'll get into that in a little bit um but the work that the general contractor was doing was this sidewalk or sorry walkway that you could see it's on the uh the right side of the house here we'll get to more pictures um but there was the walkway work um stockpiling over here more stockpiling towards the uh far side of the property um and that was the the scope of the the work that the general contractor was doing so as you can see here by the time I got out they had already started um putting down the pavers and some of the gravel and we had soil all around with no erosion controls around it um and this is I guess a good point to introduce the uh the work that had occurred in the back so there was this uh River Rock Swale um that was placed and um this I'm not even sure what to call this material right here but essentially the BBW from where I could delineate it without doing soil testing and uh um you could see some hydroptic vegetation was trying to push up through this area right here but the bvw that was visible to me um where I knew it definitely was was right around here and also over in this area which I'll have better pictures for once I scroll down to it um but Casey was saying that he put St uh Waddles along this area right here um right Casey yeah correct 100% perfect just a couple more pictures of of there's there's a bunch here but we'll just run through them pretty quick if you guys want me to stop on any for I think it's good to note the um the roof drain though oh yes all right let me see if I can get better so here's the uh where the roof drain uh Outlets down here and um has caused some erosion back here and the Waddles go across that uh right Casey they're they're that green is piping yeah the waddle is on the downhill side of that I gotcha it's just an area this is the stock pile on the far side of the property so the river rock swell goes about I'd say it's about 15 feet from where the the material really changes um okay so um we tried to the labor tried to contact the general contractor while we were out there that day it was about five o'clock towards the end of the day um couldn't contact him he didn't pick up his phone he gave me his phone number I called him when we were back at the office and he he answered I explained to him the situation that this work at the very least should have been gone in front of the Conservation Commission um couldn't really tell where the 50 Foot uh no disturb line was because of I couldn't delineate this without taking soil samples right you could see barely in this picture that there is uh hydropic vegetation trying to to push its way up um but either way it should have been in front of the Conservation Commission um the contractor um kept kept going back to him it's just a walkway it's just a walkway and I tried to inform him of why it should have gone in front of us um and I tried to get Casey's contact information so I can ask him questions and get in contact with him um because this was going to he's going to get involved with this as well uh the contractor was reluctant to give me any sort of of contact information um so when I asked to schedule a site walk for the following morning excuse me um with it it was me Kyle the general contractor and I wanted to to call Casey and see if I can schedule with him as well um the general contractor his name is Evan uh he said that he would contact Casey um about an hour and a half later I call him back and he said that Casey wasn't going to be able to make it um and so me Kyle and the general contractor met on site the next day when we met out there the next day let me let me back up that phone call the previous day I told K I told Evan that a ceas and assist is going to be issued no more work should continue um when we got out there the following day some more work had been done um me and Kyle reiterated to Evan that work should not there should be no more work the only thing that should be done at that point should be uh erosion controls should be installed um he said okay um and the EO was the EO was issued that day um a couple days later I think it was Monday of last week um we got word that work had continued uh further uh I go out there and uh I noticed that it had been complet I can show you pictures if I can get to it real quick so when I went back there out there after I heard that work had continued um this is what it looks like now the we can't see that yet I see anything all right it's still the the first document you had oh and Andrew is here all right give me a second not sure why he keeps doing this keeps saying my screen share is paused I think also to to carry on with the conversation I think um I know when I was on site with Carl and Amy um and Tim we had seen photographs of the original work that had been done um of which things should have stopped but then that disregard for the enforcement order we could see over the course of those days that it had continued so we want to be clear in this process that no means no and stop means stop and so now we are at a pause to try and find some um magic wand that will actually tell us what was there prior um Casey had when we were out happened to be there when we were on site told us that there had been things that were there that had been dis disregarded and so was taking that out um in terms of carpets and old just old material um and so and those things under proper mainstream order of conditions perhaps would have been allowed however the disregard to the wetlands is really where we're at now so Tim I'll let you follow up with your comments so when we went back out there um or when I went back out there uh I think it was the day before we all I think it was Monday of last week or Tuesday I can't remember at this point anyways I went back out there this is what it looked like the work had been finished um so not only did work continue after I initially told Evan to stop working um the first day I went out there between then and when me and Kyle met him on site work more work had been done he was reiterated that work should not be done and we went out there or I went out there a couple days later and more work had been done um Casey mentioned that Evan said that it was never told to him that that work could no longer continue um Kyle I think you could you can uh you recollect the situation he mentioned that he would stop work and put the erosion controls down and send a picture of erosion controls none of that which was done yeah it was kind of two different conversations in one conversation where we kind of explained him what the enforcement order was and what it entailed and that you he should stop work get the erosion controls and and go through this process and you know from his point of view it was our meeting wasn't until two weeks after the time we were out there and he didn't see he couldn't get his head around why he should stop working he thought it was more of a safety issue leaving it the work unfinished and unstabilized which sure I can see you had a whole whole up by the walkway stockpiles of dirt that he said he could just take a day and finish it um so without telling us that he was going to continue work I think it was pretty evident that he was going to finish the work knowing that there was no significant punishment or you know repercussion um as far as the was concerned it was explained to him that if he continued work the possibility of fines was was out there um we made that clear to him um this whole time I don't believe Casey was kind of in the loop of what was happening and I tried to get his information from uh the contractor and he really didn't give me any he only gave me his name that's it email he said that he would he would take care of it yeah and like Tim said he said he was going to put erosion controls on the next day or you know a couple days within within meeting out there um so it sounds like Casey did it himself after work was complete so yeah we're already kind of getting a little bit of a runaround here I think yeah so let's let's go ahead and Casey if you'd like to um just tell the the commission because obviously there are two members here Michael and Andrew that I don't believe have been physically on site but I've certainly looked through the case do you want to tell us kind of what's going on and perhaps knowledge or not knowledge I'm not sure why a contractor would withhold giving the owner's name to the conservation um but so what's done is done and now we have to talk about remediation and kind of going forward when we were on site we discussed with you that you're going to have a need for perhaps a wetland scientist in addition to an engineer do you want to tell us where you've gone since we were on site um yeah okay so since you've been on site where have I gone um Tim sent me a list of contacts and so far I'm still waiting from a call from um I can't recall her name uh right here in Littleton was one of the the names of a contact he gave me so I left a message talked to them actually I talked to the secretary for um administrative person for like 20 minutes and seemed like everything they do is what I need done so I like going local so I'm just waiting for them to call me back they haven't called back yet I've also like we tal spoke about I put the waddle down for erosion control on the back side the downhill side um if I could talk about the contractor um I didn't know he was basically gatekeeping information from you and me as well um for that I I wholeheartedly apologize I know he's working on my behalf he um he told me that he got a visit and he was told to stop work but he he's a kind of a fast talker I don't know if anybody gathered that from him so he had told me that he had convinced whomever he had spoke to at that time that he can complete the work so there wasn't any chance of him getting sued for somebody tripping on it or safety hazard or something along those lines and then he was told to uh incorporate erosion controls so he told me what he had done on the downhill side with the stonework was considered erosion control um I guess on the landing side the landing of the deck um I don't know anything about how that is is not erosion control you talking about this Casey right here most likely yes um so okay um right he told me he was going to have a meeting at 8:30 the next morning that he would take care of it he just had to work out some paperwork he was upset that he was told he needed a work permit um to build a walkway and he's never done such a thing before so he thought uh it was just a misunderstanding um but Casey is he is he used to working in another state or is he not used to working in the Commonwealth under like Wetlands because sometimes we have contractors that come in from New Hampshire or other other states yeah so actually he went to eisenberg's School of Business and he's from conquered yeah I don't want to step on your toes case but that's where I was going he told us that he does a lot of work in conquered and was familiar with the well can KN at a minimum that you know was aware that it existed but yeah he didn't think I don't think it's clear he didn't totally understand the purpose of or that any work happening within a buffer needed to be and I and I wouldn't [Music] um I believe him and I did believe him because to be honest with you my house has a walkway that he built for me maybe three years ago that seems to be about the same distance from the brook as this walkway it's on the front side of my house um so I wouldn't have thought any different of why I didn't need a permit then and I did now I I didn't put two and two together um when it came to um a buffer zone I was clearly under the impression personally that the bank of the brook was the Wetland knowing how the neighbor to the other side of me uh the yellow house Jean she had kind of a brook pool pond thing going on so um I would I was thinking that was probably most likely where the the wetlands started um all that other work he had nothing to do with that was all my doing so he is not the culprit for the backyard that's um all my fault there so okay so let's go ahead I I think we have enough history now so let's um have the commission open up to um some con to some um thoughts here um I still waver whether we're actually in the wetlands based on the vegetation versus actually in the buffer I think it's wet vegetation obviously it's very disturbed so and that's why we had requested a wetland scientist who can go in and do that um I do feel like Casey that you have to understand the ramifications of this work that there'll there'll be some remediation of this and working with Amy and Tim you'll have to basically fill out paperwork for the work that has been done to even see if the work can remain based on where the wetlands are if it's within the first 50 feet there would be a waiver if you meet the waiver you'd be able to maybe keep some of that but um I think the commission members um can now offer some comments on this alteration which is significant okay yeah Amy can I or Sor can I ask you a question on I guess what what are we disc are we discussing the entire property at this point the enforcement is the enforcement orders for the entire property correct right so what we're going to do is we're going to ratify during this discussion right now we're going to ratify the enforcement order which I'll ask for a vote for that in a few minutes and then we're going to outline the expectations of that enforcement order which basically are the things that were in that paperwork as well Amy correct me if that's correct in terms of order of go yep no that sounds right ried I just wanted to make sure we were that you weren't focused on just the sidewalk work that was done initially and then we'll focus on the whole looking at holistically the whole site because Casey just the conversation that we had with a contractor was that if well this would have ended up in enforcement order anyway because of the other work but the sidewalk itself if he would have come in front of the Conservation Commission in the first place could have been a simple Administration Amy might have been able to give him the green light to do the work he just need to be aware that it was happening within a potential buffer zone with but with that Kyle I I don't want to speak out of term but without actually knowing where the wetlands line is that could have been within the first 50 so sidewalk yeah me yeah but right but that's my I guess that's my point just the conversation needed to be had up front and then he could have gone from there to either help delineate that or you know yeah Point him in the right direction can I ask a few since I haven't been able to be out there can I ask a few clarifying questions of the the property owner um I I'd like to separate this into two different issues so we'll we'll talk about the walkway ISS issue and then we'll talk about the let's call it the backyard um Casey can you talk to me about what was being replaced or what was new construction with respect to that walkway I see the deck coming down was there already a walkway there that you were replacing or is this a new walkway like what what are we looking at here in terms of what was it before any of what's photographed here appeared so it was just a p it just a a beaten down pathway okay um from the driveway to the deck and there's no Landing um and one reason I I the only reason I bought the house is my my dad and stepmom are very alien and they're we're moving them here in June and I couldn't imagine them trying to come out of the house off that deck and just roll down the hill so there was no Landing there um it was just that grass that's all it was gr beaten down grass from walking from the front to the back um some old old bricks Cobblestone but nothing no Landing no real safe pathway so that's why I wanted that there okay Casey just I don't know that um Chase knows that is the septic system that's that was G to be my next question yeah it I I think this is probably our side of our purview but I I think I read somewhere in the file they want to have Jim gy or the Board of Health just consider the retaining wall there and the implications for the I send Jim that picture just to let him know so it's he he knows about he's aware okay and the contractor told me I was 15 ft outside of any problem areas and above it so but I I I'm going to suggest for the for the rest of this conversation we might just take your contractor's opinion with a grain of salt and sort of look forward rather than backwards um thank you I appreciate that yes sir um okay I think I've I understand what I need to understand with respect to the walkway Tim could you bring up a photo of the backyard so Casey i' I've heard reference to taking a bunch of garbage and debris and things out of there can you describe for me the condition of the backyard prior to just we're going to go through the same series of discussions the condition of that prior to the work that was done okay so um the up until the Swale and just the other side of it was all grass um I didn't see um as referred to um aquatic plants I know they're pushing up now absolutely but down to the sale and to the other side it was all grass and it was mold you can mow it um years ago I even helped the neighbor their moh her backyard so um when I bought it that was all just grass okay where the Swale is is where I started started noting that there was it was just full of trash um full of batteries diapers Plastics um brick kind of mushed up brick and on to the left of where the picture is um that was all carpeted it was rugs the whole thing is basically a rug um with like a quarter inch of sediment on top of it okay and that is that why there's no vegetation there at all at this point because you pulled that up yeah I just pulled it off gathered it up put it in bags threw it away um also um there was a pathway so where that picture is right to the edge of the very far right was pallets that took you to the shed I don't know if we ever saw a picture there's two sheds back there but it was all pallets that had been pallets on top of pallets on top of pallets I don't know how many were there um that I pulled out of the ground um so um I got rid of all that and it created a huge divot there and then and then you had heavy equipment or I maybe you did it manually just me in a shovel Rak it out red it out filled it in leveled it I wanted no grasp back there what really wanted was pollinator flowers over cover something that wasn't grass I have to mow but was something native um so that that LOM that big pile LOM or Loom up in the front yard I wanted to put that back there that was my plan okay tell you the truth um also another thing I pulled out of there the house must have had the windows replaced 15 20 years ago and all those windows the entire framing so like 9 in thick 3 ft by 4T 10 windows were back there as well laying down on the ground um so I did my best to get I got it all up to include all the paint Flakes and everything I think that's good I I just wanted to understand the condition it was and so to the right of this photo there's a shed or sheda it sounds like Abed two abutted sheds yes were those there prior to you taking ownership oh yes yes they're in very tough condition Chase okay they've been there a long time yeah okay okay sorry previous house owner the one who lives at the yellow house um she grew up there so I believe those sheds were there when she lived there and and she even said she could they mowed past the shed is how she described it when I talked to her okay last question I have with respect to the back is it it looked like there was either a discharge from some pump or something like that I think Sarah you had called that out what's the history of yeah the drain maybe it's a roof dra is it a roof drain and that is definitely something I need advice on or help with but yes um that's not really the picture there but there's a green pipe that he was just trying to show The Sheds I think we go back okay there actually a motorcycle in one of them and just a bunch of stuff roof tar paper there's a green but we have a roof drain coming down yes the roof drains underneath the deck there right here yes into a green piping that you can see just the edge of it that's been there I don't know who knows knows how long that's not my doing are those my pictures Tim because there's a picture of those yeah picture oh there we go that's it um that and here's here's a dilemma I have one of the things I was doing I've hired aloe um gutters to replace the gutters on the house because one of the reasons I even did anything back there the the first thing I did the first thing I did to help out the house was trying to prevent water from getting in there in January late January there's about two inches of water in the basement and um I I don't know how to get it out there's no something there so um I fig one of the problems was the gutter system that was pretty Antiquated there were I think some of the pictures that Tim took have the picture of the gutters but those have since been ripped off a new facial board put on the hip roof and then I have an appointment on Friday that I had scheduled in Jan uh March actually sorry that Alo is supposed to come out put 360 degree gutters so I don't know where that water's supposed to go now and I don't know if I should call Alo and have them delay or cancel putting in the gutters I don't know what to do I gota be honest with you and when we were on site we talked about what the engineer can design or some dry Wells U for some of those those down spouts by dissipating on the other Corners um we have to be respectful of the time we've got other hearings that are waiting so what I'd like to do first is to ratify this um enforcement order for 301 if I could have a motion to do so I'm move to ratify the enforcement commission on this but I think you have to light a fire under some Engineers or something um in hopes that this week you can at least give a message to Amy and Tim that someone has been out on site that they're working on it um we meet again on May 28th and our hope would be that for that meeting you would have really all the plans through that that engineer that we would know where the wetlands are and how we can kind of mediate this are thoughts from the commission yeah I I guess I'm trying to figure out what we're trying to gain by knowing exactly where the Wetland line is here and I'm not necessarily opposed to it but the way I I see it in two two different lenses if if we think about the walkway if the walkway is outside of the 50 or let's say outside of the 50 with a a big sort of safety factor it's a non-issue but I'm going to tell you even from a if it's within the 50 given that it was work replacement and there's a significant safety element of that I I think it's something that I think we need to go through the process but I can see a credible argument for granting a waiver in that case so I in my mind we don't need to know necessarily exactly where the Wetland line is to get comfortable with approving this in terms of the restoration element and what was done down below I'm actually of the same opinion that that frankly if we had looked at this project ahead of time my understanding from the homeowner is there was a lot of restoration work that already happened and so to the extent that we're just moving that forward again I'm not sure that we have to know exactly where the line is to make a reasonable determination that is protect effective of the resource so I I'd like to put it on the table to consider whether or not we have to know that and if the resources spent defining that line wouldn't be better spent on restoring the area yeah I'm glad you I was gonna ask you have the river rock that's that's in there the question is does it stay does it get removed you need to know what else is under what is that soil that was put there that's underneath where potentially the carpets came up and I think that's where an engineer can do those soil samples and let us know also you want to know what those soils are in order to have vibrant regrowth Kyle sorry did I cut you off no you didn't no I mean I was in the same V I was going to ask the same question on what was the path of what why were we initiating him to bring in engineers um if it doesn't sound like it is is necessary and we can jump into the restoration but I mean if the board there so so I I would agree that it would make a lot of sense for the homeowner to I I guess what I'm saying is I if if we're g to ask the homeowner to do something I would rather ask the homeowner to do something that has a net overall benefit for the resource area and I would rather ask the homeowner owner as part of the the resolution of this enforcement order to develop a let's say a replanting plan back there that is consistent with the soil types and the existing vegetation I I think that's a much better use of time and resources that ultimately improves the Wetland it and it also gets to some of your concerns Sarah about are are we gonna spec the right things so I think this is maybe a less conservative approach I think an engineer also is the one that will have to do the dry Wells so I think that's that's really important to place those well I don't know that I would have permitted but not knowing where the wetlands line is the retaining wall in a septic system if that is in a jurisdictional area I agree with the walkway and such but the wall was not there originally understood I guess I see the the wall as a board of health issue more than a I see it as a requirement to improve the safety so I mean that's what is it a foot tall a foot and a half tall but it it was necessary to like you said to to pass away over my eyes to create the safety Factor there okay so what are the action items here we've got to get going I'd like to see a replanting plan I do think that's a really important piece I would like to see a Whitland [Music] line I mean I I would expect whoever is out there could to to develop the replanting plan could do that I question whether or not we need to plot it all up that's a lot of resources I I wonder if we could have it flagged out there and the Wetland line you know have Amy or Tim confirm it I I'm just trying to create a mess here rather somewhere else y I'm fine with that yeah I don't seeing it on paper isn't going to change seeing it in the field right I don't think the 100 feet from wherever okay so no survey but probably pin Flags about where the Wetland was P Flags yeah exactly right so that they have a working range of so they know the distances yeah okay so and the only thing I would suggest is if that was places you were talking to I assume Sue Carter if yeah that's right Sue Carter was the name I think they are very busy um so I would suggest you you talk to Chuck Karen who's the first on the list he's not local but he does work here all the time all right he's not an engineer but but he can get you really far in the process super okay y so the goal probably cheaper yep the goal I believe should be that you've made positive communication with someone and had them out on site this week and they can also and then I would ask am or Tim to go out on site to verify that the erosion control is in the right area and properly installed so this will be continued to May 28th and at that time we would hope that this would that you'd really have all your ducks in a row in terms of having your replanting okay okay fair enough great anybody else have any other questions one last comment Sarah I Casey I I don't think we would want to see you spray like fertilizers back there right now we usually have very very particular iquito spray in my yard I don't do any of that stuff I'm fair fair enough just Steve breit Meer is also on Steve is the uh Steve is the owner and applicant uh for this project um um I I'll jump right in um the site is um at the end of spectacle Hill Road well I guess it does continue on beyond that but it's on spectacle Hill Road uh which is a gravel uh gravel way um it's a former former Gravel Pit site it's pretty obvious when you get out there those that that were out there last Wednesday saw um there's a burm around the perimeter of the site um there's boring vegetative Wetland that wraps around uh three sides and also exists across the street to the to the West which is the left in this figure um during the site walk um the the commission requested a couple changes to the delineation I've circled back here that's flag um AA 32r we revised that flag location and then Amy and I had talked about the mean Angel high water boundary over on the left side here within this Circle um where you can let me oops sorry I'm trying to enlarge that um you can see we had R6 R5 R4 was what we had delineated that mean anual high water boundary has been revised this is that area that comes up uh within that flat area Amy that we had talked about um the the buffer zone and River front area lines were uh adjusted accordingly so uh this obviously I I should should have been explicit this is a revised plan um that was just put together you do not have this yet I will of course get it to you um but I thought it was worth sharing the the revised plan to show that um another um another request of the commission when we were out um is along the existing Gravel Road here this is this is the driveway to the left off off the plan is the driveway to the Stoneworks um and it was clear you know it was clear that that there had been uh plowing had resulted in some material that came over over this banking here um so the plan's been revised to uh to show boulders to be placed at the top and that BM to be cut down to to match the grade of the road as we discussed I will also the plan does talk about uh top soil and Native seed mix um I'll provide some more detail about what's proposed there um but I just wanted to to uh acknowledge that um the other thing um significant change on this this revised plan um is that there was some there was some work um proposed the original version of the plan had a driveway coming in on the right side of the building and there was a little bit of grading inside the 50ft buffer which is this orange line here um so that driveway has been shifted the building shifted a little bit and the driveway shifted over to the to the left side of the building um and um showing a little bit of a boulder retaining wall here at the corner of the building so that uh all the work will be uh out of the 50 so um that's uh that's a that's a change um for those oh can we pause there for one second when when you say all of the work will be out of the 50 do you mean we want I guess we want to distinguish Paul between all of the work and all of the finished product and I guess I'm I'm a little wary of a retaining wall that's within fractions of an inch of the 50 and one thing we may ask you to do is actually show us the limits of work not just the the finished product does that I can I can I can have him I can have him specify uh specify that it's not uh there's not a lot of grades to make up there um so it's it is it is I'm confident that it is doable um but but I can have um just making a note um to be uh explicit regarding the limit of work and and I would worry the same thing frankly about the construction of the building within just a handful of fee yeah that's a that's a tight envelope to construct in without doing work within the 50 yep um sorry I'm just just want to make sure I make get my notes here no worry sorry to Sidetrack your your dis that's fine that's fine I'm just uh like I said I have I have to write it down or I lose it um so in in terms of in terms of the going back to the the project that's proposed um it's proposed this this uh building on a slab um very you know not a lot of grading the the you can see the existing Contours in here um there's not a lot of proposed grade in there again it's it's the remnants of a former Gravel Pit these Mounds that you see here are are stockpiles Steve has been using this area for a number of years um as a soil uh soil management and handling and storage area uh you know he brings in unscreened top soil for example screens it and then sells the the screen the screen top soil um and then there's other uh there's other soils uh in there that that he he manages in similar fashion um but basically uh this is proposed as as a uh building on a on a slab uh driveway coming in pave driveway coming in uh pave parking lot around the back basically a square um there's a uh uh septic system proposed here um this out here is the infiltration Galley uh there was storm water uh storm Water Analysis calculations provided for that um but basically um catch Basin uh collect the runoff from the driveway everything's graded to that one Basin uh proposed to go to a storm sceptor treatment unit here um and then to um subsurface infiltration system there are details we can show that um but there are details and calculations for that um and it and uh there's a well uh well proposed out in the uh in the back uh basically to get clearance off the septic system obviously um uh but again all of this um all of this work is proposed within uh within the existing uh within the existing Gravel Pit confines so um as I said there uh I will provide some more Det detail about this this was something that was noticed and discussed on the site walk last Wednesday so I I just haven't haven't had a chance to specify you know seed mix top soil uh erosion control blankets on that slope it's a fairly steep slope uh that goes down um I guess technically um we should seek a waiver for this work it is it is very close to the uh to the Wetland um but but that's something that the commission had asked uh as to be included it's it's actually not Mr bright bright Meers doing um but it is on his property so uh he's he's certainly certainly willing to to take that on and and and include the boulders to hopefully prevent any uh any further plowing from his neighbor right Paul appreciate you taking that on in that area have you noted the two telephone polls we had when we were out on site that was kind of our our line of work um I just didn't see those on the plan if the two there's a PLL here you see oh excuse me S ohw is whoops overhead BL so that's the right okay that's that's I believe in regards to the waiver that would meet the safety requirement so it's definitely going down that bank so I feel confident in that Paul you you made reference and showed us where the well there was some discussion about the well and the liability with its proximity to um the transfer station did Border House say that you can in fact put that well in because the we know the adjacent property they did they were not permitted to do so yeah Seth Dono from Dillis and Roy was was planning to talk to the Board of Health um I thought he would I thought he was going to be on tonight um that was um that was on his task list so I I I can't answer that I know I know we had had wanted to answer it okay I would suggest Sarah that that let me step back um I'd really like to see a peer review on this to the extent that the planning board is not going to do a peer review I think we would want one and I would suggest we add that to sort of the list of items for the peerreview to consider as well the the appropriateness of the location of that well what do you okay what are some of the items that you'd like on that review uh in particular the storm water um I think that storm water here is not a triviality and we want to I i' I'd like someone burst in it to to run through it so it's an interesting kind of conundrum out there because it is not a gravel base it's kind of a sloppy mix on that road so when it runs water then a lot of it attributes and goes off onto Mr brigh Myers's property there um the entrance I think will be drier pulling in but Stoney yard's just sheer traffic degrades that road immensely so I don't I'm okay with a peer review but I don't know what would be in the purview of Mr breit Meer to do anything on that road we're already trying to make some concessions I just I'm I'm curious it's it's a it's a challenge out there for sure and and I'd be happy to sort of view it through that lens um particularly if the peer review comes back and says hey there's some things here that aren't perfect this wouldn't be the first time where we've said are not perfect and good enough are maybe different things and Paul they might be able to help you set the the location or the elev of those rocks as well basically just running a line on that road yeah Seth has on the plan um he has a note um uh lower grade to match Center Line of gravel access Drive is that that's what that's what he's proposed here yep and I think that's a that's a good good shot to to try that for sure I just I'm I'm weary how much stoneyard degrades that Center Line at times the the left side looks much better than the right side yeah I mean I know I know Steve's on but I I know I can speak for him and and and say that you know he's he'll um he'll he'll do you know he'll put it at whatever elevation you think is serves the purpose best okay Chase anything else that you'd like them to look at no not if you guys are happy with the Wayland lines okay can I ask uh Sarah if it's worth um Paul running through the riverfront numbers just to confirm that there's no issues there sure yeah that's great um I mean based yeah I I rerun them I'm sorry the um I mean basically we're we're we're proposing uh we're proposing this under the 10585 uh degraded Riverfront Provisions um so um we we didn't um we have let me um let me find the whoops sorry this is our notice of intent uh filing and I think if I think we have the numbers in here give me a second apologize um you have a summary table on your plan total River Front is 105,000 square feet uh of which the degraded is call it 72,000 square feet um which is certainly greater than than 10% of of the total um so the um you know approximately you know 58,000 Square ft um will remain in its current current condition and about 13,000 square feet I don't know if this is the number you looking for 13,000 square feet plus or minus uh is the proposed uh building and driveway building and paved paved area but again it's it's it's not it's not a typical it's not a typical Riverfront area analysis in that we are working under 10585 um for excuse me for the Redevelopment because clearly we have um you know we have we have degraded Riverfront one of the one of the definitions of that is absence of top soil um which we clearly have so I'm not sure if that answers your question yep nobody's want to get it run through thanks and just to be clear what we're talking about Riverfront area Paul the this project what impact will this project have on Riverfront area that is not already degraded um none it's a good answer I I that's what I said to be happening I just want to confirm anyone else have any other questions so we meet again Paul on the 28th um and you can kind of connect with with Amy and Tim in regards to a peer review but would hope that we have at least the you know the Board of Health um verification for that at that time any representing 19 Porter Road LLC for a notice of intent for replacement of a septic system at 19 Porter Road okay we look forward to your shared screen how's that perfect good okay so essentially what we have here is a notice of intent for work at 19 Porter Road 19 Porter Road is currently owned by real estate entity known as 19 Porter Road LLC Wendy Solano being the principal on this particular entity um they are in the midst of rehabilitating the existing home there is no expansion of the structures or any of that um seeking to be approved um merely the replacement of the septic system the house is going to remain in its current configuration no driveway expansions nothing like that the only change that would propose to be made is where I am waving my cursor around um is the existing Le field you have the bordering vegetated Wetland that I flagged here in the actual that's actually the front yard of the house um you have a septic system that currently abuts the Wetland system here and you have an old style tank here this is going to be proposed to be abandoned and left in place tank as well um this section of pavement around the tanks here is going to be removed to to facilitate the installation of the new tanks along with the sewer main you have a sewer main going under the existing pavement here coming out um and the actual leech field has been reloc was going to be re relocated out of the buffer zone with just the edge of the field just touching the 100 foot buffer zone here um this area right here is supposed not to be paved over again the area starting from the edge of the tank out to what is currently pavement is going to be re basically loomed and seated um and reestablished as open space to um augment the abing open space here a waiver from your 50 foot is sought for the work here within the 50 Foot which would be the filling in the or the crushing of the tank here and the reestablishment of the lawn um other than that that's basically it um everything else is pretty much everything else is staying the same nothing else is changing anyone have any questions when is the work proposed Matt as soon as the appeal period is done good I I'm comfortable with this so a couple conditions I would add that like uh maybe the applicant needs to identify any soil stockpile areas and protect those but I think those could be conditions rather than requiring them to go back and draw it on the plan here um you know soil stockpile areas to be approved by the agent okay Matt where's your groundwater you don't anticipate having to do any dewater do you no um I always put something in the narrative just in case we have to dewater it would be done everything will be moved outside of the buffer zone um and would be put in a line sump hole if that were necessary but we're not anticipating it on this site now okay thank you for anticipating putting that in okay is that a I have a couple questions here is that a tree line that I'm seeing where leing field goes are we are we clearing stuff out here what's the I guess what's behind the build what's what's where your proposed leeching field is as far as vegetation goes well if you can give me a second I'll throw up an aerial so we can look at it a little bit better if that's okay um we don't really have much say in that anyway now that I'm thinking about that but for my own well no I mean so the septic system would be going up behind here so there would be some trees removed over here um to accommodate the system uh up here is very thinly wooded um there's really no anticipated work up here just the area of the system and that would be it there's no other trees at the edge of the driveway or anything like that that would be removed everything else is an existing open area what's on the current leeching field that's there that's that's buffer right what there's nothing there right now but it actually looked like it might have been a garden okay okay any other questions or the assistant director of parks and wreck um this is our I believe second or third time that we've come before the board uh and then I just wanted to give you an update on where we were I believe we're starting with the docs um I will share my screen for everyone um so to begin with uh with the doc um we were given our uh notice of intent and we were issued our DB file numbers uh for the project um so one of the stipulations with the doc that uh was requested by the D is that they Sorry that was erosion controls that's our next one um so one of the things that we were asked to do was to understand um what the impacts of the footings and how they should be Quantified in our original filing we had provided pictures of the docs uh specifically where they were going to be and where the doc um pilings were going to be uh on there uh in response to this uh I responded back with the photos that we had originally provided with the docs uh with an Excel document for each doc just quantifying how many pilings there were actually going to be uh so in total there are going to be um 22 uh different pilings uh which are um defined it's 4 inch um round galvanized uh poles that go in that are covered by the um uh the PVC covers as far as the impact on the setting of the lake um they are uh directly uh into the B into the flooring of the lake uh there are no footings um I have yet to hear back in a response um from the d uh on if that was an acceptable uh format but um it just seemed like they wanted the quantity of actual pilings that were going to be there uh the other piece of this that was requested was that they asked how the docks were going to be stored um so I provided this photo uh this is the current sailing dock uh one of the docks that is being um that is included in the filing uh so I sent them this picture also which is how we currently store the docks and how they've been uh stored even before we had this particular type of dock uh where they were stored each and every year thank you Tim um anyone have any questions I saw a note on the screen about chapter 91 is that being applied I'll pull it back up for you Amy uh can I defer that question to you well Tim's gone through the select board uh for that so the select Board of filing a chapter 91 license so unfortunately unfortunately one of the things Sarah that we don't have um since the early for waiting for get the D number they had a couple comments one was about the riverfront area um so I I mean the whole point is to do it in the riverfront area right yes thank you but sorry so there's about uh 500,000 square feet of Riverfront on the area um there's no impervious area existing or proposed within the 200t riverfront area and the existing Boardwalk is built structure um and just adding some to that and give the nature of the work as a connector from the parking lot there's no alternatives to put it any place else other than in the riverfront um they asked about the bvw impact um and in the past they had only asked for mitigation for the actual footing piece of it the the four or six in um and I think they have a new which would have been 10 square feet um and they said they thought it should be 64 and that's just as easy to build as it probably easier maybe than the 10 square feet so I just upped it to a mitigation of 64 square feet um it'll probably be really 10 by1 so it'll be a little overbuilt just to make sure we we end up with what we need um and that would be the replication it's going to be in the same place as the original Boardwalk area there was an an old uh BM that have been placed out there so we're slowly removing that fill um down to the original wetlands and the seed bank has been fantastic and also throw a wetland seed mix on top of it so you might say we're replicating it roughly a 2:1 ratio it depends yes it it depends how you want to crank your numbers but I don't want to mess with it and argue it so it easy just to increase the mitigation right maybe a 10 to one ratio okay so we need a motion on this move to close the public hearing issue an order of conditions and issue a waiver from mdp file number 20410 Z for the years and it's it's doing great it's still a little further to go um but as also mentioned in that permit application um I like to start doing some more of the uh a little bit more terrestrial invasive species management specifically the the burning bush and barber that's right up against the Wetland Edge there um we've done a lot with the weed Warrior um but we're starting to run into the larger burning bush that they can't tackle with the the weed wrenches um so what I like to do is just continue with the um the herbicides they have been used for the frag mes um and still get the volunteers to help cut that stuff down and then get a license applicator in there to to do a cut and dob um and also hopefully make that a weed Warrior training session for anybody who wants to actually see that in action so they can take the information home with them and that's um that order conditions is good through 2025 I think something like that so I'm not asking for extension just for a minor mod and Amy do you need a formal vote on the minor mod or is this uh informing us I do need a minor mod please that's what I thought or Y vote um I'm I move that the Littleton Conservation you scroll back up to the to the first one to show where it is in the uh the buffer zone so it's it's relatively far outside the 50 Foot um what they're looking to do is um Amy ke on to that middle photo perfect uh he's looking to do some work here he's looking to pull that wall all that corner on the right side he's looking to move it more to the left kind of where to the uh the to Encompass where that rocking chair is um I think he's looking to move I think he's looking I think the door's staying in the same spot anyways what's really going to change in terms of like the footprint what he wants to do is he wants to add another um like a step toward at the bottom of where those steps are I think he just wants to add some like a concrete step where that grass is I'm sure if you guys wanted to see a filing for this or if that's something that could be done administratively and this is on the opposite side of the house that has the wetlands correct I would say modification yeah let's keep our powder dry for other things yeah right yeah and and he he was going back and forth on his design and it was a little confusing and said well let's just get a little formal take it to you guys because that's exactly what I was thinking so as long as as long as he keeps it within the envelope of what's there within reason you know adding a step as a landing yeah right yep okay perfect um town meeting update Webster CPC and oakill stabilization [Music] fund uh so yeah congrats to anybody who uh who went there I was actually watching on my phone while I was watching TV and then just before the orchard vote my phone crapped out on me so um but uh so Webster passed um so the next steps besides the purchase will also be deciding or talking to LCT and then maybe SVT about the holding the conservation restriction um and whether or not the Websters are willing to wait uh while we go chase a grant um which would not be known if we get it until November and wouldn't be able to get the money until probably the first of the year so it's it would be potentially a long wait uh which I don't from what I've heard they're not thrilled about but we're still trying to figure something out um that would me mean that we have to take the second appraisal and elevate it to the EA to the state standards um for the grant uh which the appraiser said they can do um and this was as of a week or probably two weeks ago now that they could do it in time for the grant and but they didn't tell me how much so I'm going to circle back with them and get a little better idea of that and I'm not sure if it's going to work or not and the grant is due early July July 11th I think is the date that stuck on my head so potentially I mean you've only written this grant three times I've only written it once and you know we got to get S SVT actually their piece of it hasn't been finished they they're going to do the U community outreach reach stuff that the grant requires um which is all a done deal at this point but they're much better at writing that than I am um uh CPC all got approved thank you Andrew so uh what the heck was it that that was funding for the fried mes control at Cloverdale for the the rest of it um as well as was it 30,000 Andrew or 20,000 for land acquisition support so that if if there is uh a sudden need to do something like an appraisal or a survey um and we really can't wait for town meeting there will be some money there that that we could use to advance that might use it might not use it but it's could be pretty invaluable to have sitting there great I thought that that forethought was really Whoever thought of that was that was spot on I've been meaning to do it for years and just haven't done it so but now that team is picking up all the slack I can do I can do the really annoying things like write grants um and the oakill stabilization funds uh the language of that was just clarified that that money and there's about $100,000 in there right now um can be used for conservation land maintenance uh that used to be the cell fund Tower money so no more money is going into it um but the budget asked for 20,000 uh for this year so you know we could run through it in five or 10 years depending on what we needed or it could be sitting there or it could be kicked loose to go towards a purchase or something but but at least we can get at it now okay or again anybody have any questions on on those and shout out to chase for all the work on the Webster property and Andrew for Jim dougo was especially appreciative of how little time you took at town meeting yeah chase you did an incredible job as always speaking for us at town meeting be able put those skills to use for more land yeah exactly all right let's jump into subur Valley trustees presentation on land protection prioritization May 20th 7M right so uh Kyle I think you said you might make that g try to I got to double check the calendar again but yeah and and if if anybody else is interested and I can haul you over there to make sure that we have a showing um SVT is is actually pushing this pretty hard uh that they can provide this service for us um and they've they've already done a map based on the rating scale that they used um and a spreadsheet that's got all the information I asked them to take the names property owner names off of that uh at least for Monday night um and I'm sort of hoping that that this might help Kickstart um what steveen nudy calls the the checklist checking all the boxes um okay so at some point um if you think you're go he just kind of RSVP to me um and then we can decide figure out out after that what is the best way to go forward with coming up with boxes to check and evaluating a property Amia assuming that'll be recorded for later viewing it will not SVT actually asked it it not be oh is there a zoom link or you have to be in the room you have to be in the room top secret materials I'll show you okay next approving tree removals like crazy and now that right now there is no agent over there all of a sudden we've got I think close to 30 trees in front of us to be removed I said we need a policy all right Amy now we're coming into your land use permit oakill yeah so the uh was it the Association of Massachusetts Wetland scientist um Wanted would like to do a uh a walk at Oak Hill on Saturday June 1st at one o'clock um basically to interpret the landscape and ID plants they figure maybe a dozen people or so um think it's great I I figure be pretty straightforward I just wanted to run it by you and get a vote to make it all official if you're so willing what day did you say that was June 2nd Saturday June 1st June 1st I make a motion that we issue a land use permit uh on June 1st 2024 for
