it'll be your turn to speak you'll get to cross-examine any witnesses that the town has called present any witnesses that you have any documentation that you have and at the end of that dialogue I'll uh for Section 87- 030 um it was found in violation on June was fing violation on June 19 it was mailed out on June 21st and it was hand delivered on July 2 and the representative for the the company's here uh give us an update on U the parametes for the um tree mitigation so before I before you begin ma'am let me just ask you a few questions so you sent the mail how did you send that certified mail certified mail on the 21st okay and you hand delivered you said yes did you do that I did that in the I gave it to Jose uh the manager of the branch okay and is there an Affidavit of hand delivery in there yes sure okay thank you okay and Mr machos what's the status of compliance the property remains out of compliance the perment hasn't been approved yet okay and you're looking for the respondent to give an update before you give my your recommendation to me in terms of Remedy is that right yes your okay all right your name ma'am Shannon Lee okay so Mr Matos is telling me that the permit has not yet been issued what's your uh what's your side the application along with the landscape plan has been submitted with the help of Mr Flashman um we did find a little glitch that we weren't um expecting in the C's application process where um when the fees get paid the Consultants don't get notified so it caused us a little bit of a delay um but I think we've we've gotten by that now um but I don't know exactly we haven't received any comments back from the town when when did you submit and when were you fully paid two weeks ago but I don't have the exact date yeah okay does the town have a response or is any other witnesses to call on this case do you have any knowledge of the application Jan any of that Jim fleshman uh town planning consultant the uh uh uh this is a has been a complicated uh tree removal issue because when the trees were taken um some of the trees uh were were located on the subject property some of the trees were located in the County's RightWay of okobi so then I spent um spent considerable amount of time trying to figure out how to do the permit when the two jurisdictions were uh were involved in this my um my my initial thought was was to get Palm Beach County to agree with the town to uh to issue one uh Town permit that was signed off on by both jurisdictions and I wasn't wasn't able to get that and the way it appears now is um looking at the tree survey that uh that that was done by uh the the applicants arborist the that uh uh great majority of of well number one uh there weren't that many native trees taken anyway I think it was like six or eight and uh it appears that most of those were on the subject property so uh the approach that I'm going to try to take right right now is is that we just issued one permit by by the town and uh notify the county and and see see how they how they react because i' I've I've talked to several County departments and nobody seems to be able to come up with uh an alternative to that and they didn't really like the one permit with the two sign offs so so that's that's been uh certainly a part of the of the reason for the slow proc progress on this one um so that's that's how I propose that we proceed is that we issue a town permit send it to the county and and see how they react so I I hear all that I guess let's maybe for the purposes of this hearing let's simplify that because I think that's all behind the scenes stuff between you and you and between the town and the county what's your response relative to her saying that she has a permit in as of two weeks ago are you have you seen the permit are you're aware of the permit uh yes yes okay what's the turnaround or expected turnaround time um have you started reviewing yet or not no no I really haven't I mean I've I've I've looked at it briefly and I've looked at the survey that that was done by the arborist and it's it's not going to be uh an extensive uh mitigation and they they are going to be performing and getting approved the landscape plan which will very likely uh account for the entire mitigation amount so that's that's the long-term term game plan figure out the mitigation um take take a look at the value of the trees planted on the M or on the landscape plan if if the landscape plan is uh uh value is exceeds um or equals the amount of the of the mitigation then there should be no more mitigation is the landscape plan going through a formal public hearing process well that that would be part of the there's a requirement for for a site plan approval now also um that uh and the landscape plan would be part of that site plan and that holds up your issuance of the permit well or doesn't uh no not necessarily because because now we' put a put a uh we would look at the landscape plan get get a value of it uh include that as a condition um uh in the uh vegetation removal permit saying that um uh when we do the final inspection of of the landscape plan if that modifies the vegetation removal permit will do it at that time kind of complicated that's the way that we've been handling these okay so hearing that Mr Matos or anyone from the town what's the remedy that you're requesting today I'm inclined your honor to extend the compliance date to um October 1st and and have them set for October 16 um for hearing if compliance hasn't been achieved Miss Lee how's that sound I was definitely inclined to give you additional time it sounds like you're getting there um I'm happy to hear that you have a permit fully in and and that it's it's in the town's court if you will um October 1st that seems reasonable to me certainly I'll give you more time if you come back to me at the next hearing and there's the additional review um again my my job here in this chair is not to be punitive but it's to encourage you to comply as quickly as you can so just as you've done here today and come to me and said you submitted a permit two weeks ago bring that same evidence to me at a next hearing it should that be necessary come with what you've done between today and that time period so that I know okay that you've been moving in good faith uh towards compliance we also do have site plan and Landscape plans in um as well so okay and my hope is like Mr plement said that that doesn't hold up his issuance of the permit because I know that's a much more complicated process and that takes uh much more time but my hope is the permit issue can get resolved uh without without the rest of that so Mr machos you said October 1st and October 16 and what's the status of compliance on this case uh the permit was submitted um I believe over a month uh ago the uh fees were paid and there was a issue with communication uh to our system and so there was a delay on on processing the the perit is now on the [Music] review I I believe that for that permit they will need uh another 60 days to allow comments to be sent and then addressed so I would like to set this one uh for October 16 uh for find F assessment SL status okay so all the all the required permits have been submitted is that your testimony yes sh okay all right you have not changed you are still Miss Lee correct yes all right so you've heard what Mr Mao said um anything else you'd like to add on that one no he's correct we did resubmit yesterday so we had received minor comments um we're still waiting on some communication back from the county on whether they're going to require a rideway permit which likely they will um and some other things I'm hoping that takes care of the other we talking about so okay and just keep record especially on this case too I know that the FDA permits and and these are a little bit more in terms of process but keep keep records and should you have to come back to me at that October hearing and and if you still don't have the permits in hand just have a chronology of what you did between this hearing and then so I understand that um again like I think you've heard me here maybe not at this hearing but at a prior hearing you know if you submit the things and you're doing things the day before the hearing I'm less inclined to give you more time if you do things the day after we leave this hearing and you're working the entire period of time that you're given to comply I'm certainly willing to give you more time because yeah this this was submitted a month ago so we just resubmitted yesterday so so hopefully that'll hopefully this will get issued and this will be a nonissue yes U let me ask you Mr Matos to show her this case File thank you so when that permit gets approved hopefully soon do I just send a copy to or do you get the copy from how does this work exactly that way we're it's it's always safe for you to get those two by the end of the week for signature on the record at the next hearing date assuming all parties are of course on board with that and I've asked Mr German if he can stay around or uh speak offline as as soon as I get out of this hearing with you since all the necessary parties from the town are here should I need uh their assistance in order to finaly the numers okay all right so situation for the mitigation would be so he can leave us um on time well let me I guess let me just ask procedurally what what is the agenda item that's on the agenda today is it is this at the request of the respondent or the request of the town it's at the request of the respondent and we reset we we created a form um of the notice um that she signed um showing that this not shows that there was an order previously um made by you and uh shows a violation and she signed it as being notified that we were going to move her here for today it's it's an unusual it's an unusual um first time we have done this but um we found out that was a so let me just ask and let me ask the town attorney is my understanding I I always copied on I think one or two emails um but my understanding is that this is on the agenda as a motion for re-hearing is that correct that that would be accurate as to both cases and this would be um the respondents motion and the respondents UN need to explain why rehearing would be appropriate as to each separate case Okay understanding that I'm going to ask that uh Mr fleshman not provide any testimony uh this is a respondents motion so I don't believe brief but be be direct about why you're here um not about the merits of the violation um my understanding is that you're requesting rehearing um due to noticing so okay I'm Gonna Let You continue I'm G to try not to stop you but go ahead and just give me the the cliff notes version of of what your request is okay um I uh I don't know where to start on this about the serving I have had problems with a neighbor neighbor of mine no oh I I thought he was motioning to me sorry I've had problems with a neighbor of mine Barbara Briggs that lives down the street I've had her go through my mailbox I have a incident report in May um with the sheriff's department I had an inant report when right after I moved in there I guess she got my phone number either we exchanged it because I was wanting to get estimates on fence oh on fencing or um she got it off Facebook I don't know but she was sending me nasty texts and I called the sheriff's department one of the concepion they have four deputies last name concepion he came there he I showed him to him he read them he said blocker which I I'm not real techsavvy and so I did that and he went down to talk to her she wasn't there she's asked me the whole time I've been there anyway um I already had the property um before this tree violation um before I got the notice is I've had trouble with her even when I first bought the property there was a stake down at the West End of the property that had that code enforcement had put there with a notice nailed in it I guess and um she when I went down there to get the phone number of the fencing guy to get an estimate she tells me well I went on your property because there was this stake there and there was a note and so she's she's going on other people's property and taking stuff and examining it you know I mean she I've just had a horrible time with her and so I don't know if I didn't get any certified mail I got none okay until the one I got on the 25th of July that the hearing had been on the 17th and the day be well it was the 25th that I saw it zip tied your ruling okay so I got no notice of the 17th hearing so I I I assume this lady has you know done whatever yeah I've got an instant report on file with the sheriff's department so so here's here's the trouble from my seat you know I I'm I'm sympathetic to to what you're saying and and that puts you in a very difficult spot because you're essentially receiving the notices but somebody is is intervening before you actually get them so but that puts me in a difficult position because as you've heard from the the cases that you've heard me rule on today the first thing I do in each case that I hear um in this jurisdiction and in every other jurisdiction where I serve as a magistrate is I have to find and I have to ensure that the town has legal service before I proceed to hear anything about the case yes Ma so what that means is that the town has to have sent you by certified mail their notice of violation and notice of hearing they also typically post the property as well to make sure that that there's actually a posting done that you actually get the mail because a lot of times they don't get the certified mail back in before they they have to post the property so the signed Green Card doesn't come back to them so they they typically for most cases have what amounts to double service by the time that we get to a hearing the difficulty in your case here is that the town has legal service for you you just are not getting the documents I got either one of them right and and I I'm sympathetic to that but that I can't change my ruling because the town legally had service for me to proceed in hearing both cases that I heard at at whatever that hearing date was I think it was July um that said are you are you in communication with the town and trying to to make progress on on getting into compliance yes I I definitely I tell you y I would I would like to have the resolved today I have so sold this property okay and the closing is scheduled for the 30th and I would like to get whatever fines need to be you know I don't know if you can hear that today but I so the the trouble is the previous orders you're not even required to comply until September right but I I've got to get this done by the 30th to get this closing done I mean I need to move down to Miami I have a place down there I'm TR hopefully I'm going to putting the deposit on it today I'm I'm beginning work down in Miami okay you m go ahead um we have explained to um the property owner miss m Manos and also to the buyer of this property that a permit needs to be obtained and Miss Mano has the the the option to allow our staff to go inspect the property calculate the mitigation and the permit can be expedited uh that's the best route for her to come in compliance and the only route for her to come in compliance um and and you know behind the scenes is there's all this you know options after the fact long term that could benefit both parties but as of right now the only option is obtaining a permit and it's the fastest way for for this to be resolved there's no other way for us to help the property order in this case you're on go ahead I had um they were scheduled to bring the Arbor on Monday between 9 and 12 I was there all day Monday and I stayed there all day yesterday in fact I didn't get a lot of copies made of stuff I wanted to get done because I have no electricity I've I've been living on that property for four years with no electricity or running water and I have to haul water in there for my seven I've got Minis and donkeys and a riding horse and I have no electricity or running water I mean I've I've had it with that property I just need to get this resolved so I can get pay what I've got to pay and I can be done with it so so technically as we sit here today there there isn't a fine running as it relates to these two cases correct the compliance date has not has not even lapsed yet you have another month to comply I know but I want to get it done I have to get it done or the blading won't buy it right but what what I think you're hearing the town say is that getting it done I can't rehear the I can't hear the merits of the case again until September because my my order already gave you 60 days to comply so they didn't show up yesterday or uh well that's where that's where I'm going to ask the town to to get somebody out there as quickly as you can um to to try to get her what she needs and if I may interject I presented three different times permits since I bought this property on 14th of February 2020 um I presented I did Florida Power and Electric in March of 20120 then I in July 2nd I finally came up here and banged and banged on the door and got the den Town Administrator Jamie and I handed him a copy that had not been notorized because I was going to get somebody here to notorized it and I said and I put a sticky with my email and phone number if there's anything needs to be changed before I have it notorized if you'd have them call me I waited five weeks they didn't I had it notorized they he said that I needed to email it I took it to Office Depot CU I have no electricity and I had it scanned their server was down so I came back up here and I submitted it they sub deposited my check that was in there and never notified me never notified me anything about the permit that I put in for I hear what you're saying let me see your case File please and electricity so those have nothing to do with the viation yeah that's what I I want to be clear so the two cases that are that are here is one is the tree removal which we're talking about now we'll get to the other one next but as it relates to this case the the fastest method to compliance is to to get the required permit so I'm G to ask Mr fman I'm G to ask the town um to work with the property owner hearing her timeline get out to the property as soon as is is feasible for the town um My Hope Is that you can get it resolved and and sell the property or do whatever it is that you're trying to do I paid for that per in 2020 I understand my my difficulty this morning is I've given you a time to comply and that time has not lapsed so I can't do anything else about that order um what's before me strictly today is your motion for rehearing um which because I'm not going to get into the merits I'm I'm going to deny your motion because I think you have time to comply and there's a better path for you to get to where you're trying to go which is my request to the town to go out to the property and work with you to try to get this permit expedited to the extent that that helps you so that you can move on to the next chapter of your life wherever that is I'm you know I I work I was supposed to start this week I work explosive detection dogs dogs that find guns and stuff like that in school so I was supposed to start this week okay which I had been able to do and I got to get this property sold and then like I said they didn't show up Monday and I waited all day well I'm asking them here today I'm asking them here to to get with you as as quickly as they can okay yes ma'am so in in that case 240 6006 um because there's no path forward just so you understand what my denial of your motion for rehearing is you don't have a permit in your hand today so there's there's no benefit to me doing anything other than deny right but it's not been issued by the town yet um anything else you'd like me to hear on the residential vehicle case which is the next one 2465 your request to me is the same right the notice no I could pay for that permit I I just didn't know and you know I had a meeting here with them in February after the treat when they did the stop work order on me and twice I told them I was living in a camper and they didn't tell me I needed a permit if ID known then I would have bought a permit I just didn't know and I know negligence is you know not knowing is no excuse but I just did not know let me see that case we're gonna we actually going to request to vacate that order to vacate that order yes you're on and we're gonna also request um we're going to restart that uh there was a clinical error on that um notice of violation uh even though the dates calculated were the same as the other case on the paragraph at the bottom for the day of the hearing actually shows today's date and we didn't notice that until we reviewed the the case again so we want to V vate that order because it was our errror this is appropr is going to move the RV soon as the cell happens we'll monitor if is necessary to come back in front of your M all right so the so since we're here again on a motion for rehearing the town doesn't object to granting the motion to rehear and then the town's request is to vacate the prior order is that correct based on Mr mat's uh statement that that would be accurate um and and it sounds to me special magistrate like this this part of the case may not come back if it complies out if it complies okay but you're going to set that through sep you're gonna reset the matter altoe is what you have to do correct okay so miss monos does that make sense to you what the town is telling me is that they're not objecting to to me granting your motion to rehear this case and relook at the service and what the town is actually asking me to do is vacate my prior order so they're asking me to get rid of the prior order that found you in violation uh of section 20-50 A1 okay um so I think that's beneficial to you I don't presume you have any objection to that is that correct thank you okay thank everybody yeah and it will it be re submitted so what what they'll have to do because they're asking me to vacate the order is that case essentially goes away in simple terms so you the the prior order that I found you in violation will go away um if they choose to reset you and Reen notice you and bring you to a subsequent code enforcement case they can certainly do that but they will give you the same notice of violation notice of hearing all of those documents um they'll have to legally serve you the same way they've been serving you um to to bring a new case against you Is What It ultimately will be okay does that make sense yes ma'am okay anything further you'd like me to hear no ma'am all right case 2465 I will grant the respondent's motion for rehearing and upon review of the evidentiary case File and based on the statements of the town I will issue a subsequent order vacating my prior order finding violation which was dated July 17th 2024 that date again ma'am it's just a date of my previous order with July 17 Sor yeah so what you'll get on this one is you'll get two um you'll get two orders you'll get the first order that says I've granted your your motion for rehearing I've relooked at the case File and then I'll issue a a separate clean order that vacates my prior order thank you specifically in this case okay yes ma'am thank you so I I I encourage you to get with the town I My Hope Is that they're going to work with you on that prior case
