weekend for our Veterans Day and Founders Day celebration I was um really excited to see how many veterans we have who live in our town and so for tonight I would like to have a moment of silence and yeah we're gonna have the community conversation well it it's it has a us to do that first and then have the community conversation so what what would you like me to do community conversation first or do the additions and Del first it's conversation you want to do the community okay so we will have the community conversation is there anybody who would like to speak valer Miss sui comment or Jenny's yours okay um Cassie sui I just wanted to bring up something you guys can think about because I guess I never sleep at night and um go through all kinds of things um I had an idea coming up that might be a way um that could help us with getting like some information to you guys maybe to help with efficiency transparency some of the things that we don't have time maybe that committees don't have time to do it wouldn't cost staff um I came up with an idea maybe possibly to do an ad hoc volunteer committee for you could name anything you want like uh a committee on government efficiency and financial transparency and you could do maybe one or two people they could get together would not be bound by Sunshine it would be just strictly people like Treasure Coast get together work on a project um I don't know we'll say the efficiency of Public Works they look on the public works department and and they'd go through that and maybe look at things like Advan positives negatives efficiency cost analysis and then just give you a report and then do the next thing and it would be a way that you could get some extra information it wouldn't cost us any money to have a committee have staff here have lights it wouldn't be bound by Sunshine it would have no decision making it would be strictly like a Treasure Coast with just preparing a report and I just wanted you guys to think about it might be something if you did it as an ad hoc then we could have other people from other committees cuz we have some brilliant people in this town that might uh they would probably volunteer to to work on that thank you for your comment Cassie you can go into the next one you're already there have something excuse me one second before you begin Laura has something to how can you give me an example of something that Treasure Coast worked on well I know like in the past you've used them to get like analysis on things like when we were doing um the okachobee overlay you wanted to do like traffic studies and some other things I don't know if they charged us because I'm not wasn't privy to any of that but uh something like that that might be an advisory that could give you extra information maybe you guys want to know um I I don't know um the efficiency of how uh I don't know um materials are spent or something just how are the Departments efficient uh how they uh the positives the negatives maybe a cost benefit analysis type thing it's just to throw it out there some way to do you could call it anything you want it would be volunteer and then they would prepare a report you could give them like three months to do uh something and task them with doing something just I was just trying to think of a way to get additional information to you tap into some some of the Brilliance that we have as residents in this town cuz we have some brilliant people and some people that are willing to help also to curb some of the cost that it would be to have meetings two-hour meetings paying for staff paying for lights things like that and you could still get the information interesting thank you just a thought okay this is a comment from Jenny she couldn't make it Jenny schutzler oh oh Len are we even allowed to create an ad hot committee out of the sunshine no if you if you're gonna have any committee that's going to provide input to the council than it's a sunshine committee yeah I mean if people want to just talk among themselves come and make public as individuals that's one thing but anytime anytime two or more people get together to make recommendations or suggestions to yes counil right right so you're appointing you're appointing people well that's not exactly true cuz I did some research through the state on some of the rulings for example what is a decision-making ability would be a Sunshine Law and you can correct me if I'm wrong uh I don't know if it was El latcha County or whatever the school district for example this was a case that went out they wanted to review like a hundred books and they said okay we're going to have a book committee and they're going to review the books so the book committee met they did not have Sunshine they didn't have a meeting they reviewed the books and then they gave the the school district like 36 books that they picked and then the school district reviewed those that was a violation Sunshine had they reviewed all 100 books wrote all their recommendations and then the school district reviewed all the hundred books again in the light of sunshine it would have just been an advisory committee with no decision- making if I'm correct in that I I can give you the case though I don't know if it was the first or second district um there was another one where they were going to hire somebody and if they make an actual decision then they were considered Sunshine so you could correct me if I'm wrong but that's how I came up with this idea let me Le explain any any advisory committee that's going to give advice to the council is part of the decision-making process and so the Sunshine Law is very strictly construed and about if if you're involved in something that is going to be giving them input where they're going to make a decision based on that input and you're appointing that committee is a sunshine committee maybe you can think maybe there's another way to do it where they can give advice or do reports to the staff I don't know I don't know maybe there's a way to do it but I know when I was reading it there was two distinct differences between Sunshine committees and committees that do advice only or just give reports no decision- making of anything so maybe you can look into that for them because it would help and I'll send you everything that I found and you can review that it was just a thought that came up I'm just trying to make things more efficient and I just want to say excuse me before you go to your next comment I think two things for the record Treasure Coast Regional planning council is another governmental agency it is not a group of volunteers they're all paid experts and what they do is very focused work they don't take on work that they're not expert in additionally one of the things that works in other communities to get the engagement you're talking about is advertising for open committee positions and maybe before there's specific ad hoc committees maybe we do an advertisement and get a group of Volunteers in a pool that the council can then look at you know and and pick those people because that's how people connect with the public in other cities they they do a call for committee members I do think that you're making great points to get people involved I think everybody wants to do that just thought that I would put those two points out there and oh Mr T cvia did look at this when you brought the issue up earlier so I think that you know we could probably revisit it again throwing it out there no no reason not to look at it again okay this me this is a comment from Jenny schutzler she couldn't make the meeting she had a couple questions she wanted to ask you um number one she said Marcela Boulevard was paved many years ago and paid for by the residents on the street with the new Paving program is Marcella Boulevard on any list to get repaved or at a minimum repaved at the f Road inter section that was question number one you want to answer that or you want to she had two questions yeah oh Richard she's listening by the way so I'm sure at this time Marcel Boulevard is not up for repaving unless there's any damaged like areas then we would obviously fix those areas but so if there is some kind of a damage or increase where here at that intersection that you're speaking of then she should call Public Works and let Mr Galant know that so that they can address it yeah they can any Resident can go on the town's website we have a um a link there under the I think it's under Public Works that they can any Resident can enter any complaint or issue that they have in the town and it'll be sent to Francine myself the superintendent and it'll be created a work order and then addressed phis had something she also wanted to say um to my knowledge the residents have never paid for that road Mr maot gave the town a grant for that road from Palm Beach County and then it got resurfaced Again by the town so to my knowledge they have been getting serviced and the to my knowledge then the neighbors have not had to pay Raymond did Raymond did Marcela did not I believe phis is correct yes for their back okay question her question number two about Marcel Boulevard again so I assume she lives on Marcella they have a covert Canal on the North side the South properties flood terribly in the rain is there a future plan for South properties to connect to the Culvert for flood relief so the original design of Marcela was to for the water to flow from the south side of the road to the north side of the road and then travel through the CT system that is on the on the north side of the road to the culs under falam and under f Road um the easements on that road the Perpetual maintenance obligation is that of the residents unfortunately a number of the residents have not been maintaining the swes over there public works has gone over there after the recent storms that we had in September and we did um on the town's dime clear a number of those swailes so that the flow of water is better there's still a lot of work to do over there there's a lot of um trees that have grown in the swales and everything else and they all have to be removed moved and that's actually one of the items I believe we're going to be discussing at some point with the water the water control plan and the unit of development stuff so Richard on that so the water supposed to flow across the road into the north ditch yes there if you go down Marcel there uh strategically placed there's two or three uh drainage pipes that actually go under Marcel and go from the south side to the north side and then the SW is actually on the North side not exactly the best design in the world and actually there is plans in the future don't ask me how long in the future but there are plans in the future um to address that that's all contingent obviously on budget all those roads are like there right Compton Marcel Ryan is not Ryan has ditches on both sides um I would have I don't remember if comptent but most of them yeah most of them that's how they pretty much designed them all so unfortunately what happens is whoever lives if the north side is full the South Side floods so there is some East West flow on the South Side supposedly to those few colberts that were right well they cross somewhere yeah yeah they cross Marcel is what they do they go from the south side to the north side and then the the actual drainage ditch is on the North side it flows East West to eff and fulson um so since we're talking about ditches and drainage on that side of town and have you acquired the proper tool or hired the proper vendor to start blowing out our covert pipes so the water will flow better we have inspected the culverts themselves and the CTS are pretty much Clear it's the all the debris in the sale itself that's causing the backups yeah mine comment was the same as hers I wondered if it was the cross pipe that was plugged up now we went out there after uh when we had the torrential down we had the like the nine inches of rain in 24 hours um we went out there um and clear once we started clearing the actual debris that was in the residence swes the water began to flow a lot better um I mean and unfortunately most of the residents are Marcella take care of their swes uh sadly there are three or four of the residents who do not have let the let them just go and so there's pine trees palm trees all kinds of other trees that are just occupying the Swale and they'll have to be removed because they're basically acting as dams so we have one Elder resident that lives on Marcela that I do know her ditch is probably full of vegetation I do not believe she's financially able to pay somebody to clean it out and we were talking about assisting some of our elders in this town so I'd like to bring that back up in the future and for you to consider that I consider anything I mean we try to do our best with what we have um you know like I said we went out to Marcel the first few properties on the west on the fulam side we cleared theirs back but you know once we got to like think the second or third property there were so many trees in there literally require start digging up all trees and removing all the you know because when it gets Beyond you know Brazilian peppers and just some overgrowth grass and stuff in there that needs to be cut it starts getting into like heavy you know pine trees and palm trees and stuff that need to actually be cut down that's when we need to bring in a vendor to actually remove those trees we don't have the resources to cut down 30 foot tall trees in the swes I think once it's trimmed back then she can maintain it but I think it's out of control right now send me the address we'll take a look at Miss sish Virginia sish North Road one I want to take thank the town staff that was literally on the road as that tornado was hitting and called everyone into action don't know how they survived seeing that as they were going down but uh the town did a great job on dealing with everything um the biggest issue I noticed as far as the utilities it's the same time same thing we have happened every time the fpin linemen that are signed here don't know the area so anybody who can go out anytime we have a serious problem like this and help them ask them what address are you looking for what road because it it's not easy to find anything out here we were able to get uh neighbors gates open show them where to go um that was the biggest stumbling block I could see for the utility companies but again public works Town staff did a great job um I and I do want to ask that if the sheriff and PBSO the sheriff PBSO fire department anyone um that is here that has a report if you could move them up to the beginning of the Town meetings I've noticed they come here and their reports sometimes we don't get to hear them so I don't know how often you get them but rather than having them weigh down it might it would be helpful you know it's on the taxpayer dollar and it it's kind of irks us to see them sitting in the room they could come and give a report and leave um the other question I have you guys can't get involved in Code Enforcement but once cases are closed I think it behooves all of you to know how things are resolved I for one would like to know how excessive pores of asphalt are resv somebody comes in they pour a lot of asphalt goes before the judge the magistrate and then we hear oh it's resolved I'd like to ask Town staff how does it actually get resolved what happens every case is different it's a situational matter Paving is not disallowed Paving is not prohibited Paving is supposed to be done within um standards and you also have to have a permit so if something would be resolved in some cases it might be what I'm sorry no no the podium no the podium mov that I'm trying to keep it from somebody's gonna fall down leing on that Podium yeah so that's it your Public Works gu anyway but more specific more specifically if a flood plane a flood plane is supposed a permit is supposed to be done when there's a non- permal surface put down so some pours a huge asphalt area without doing a flood plane permit how does that get resolved lots of different ways and it's with compensating storage so each one is resolved differently however an FDA permit is not issued without engineering sign off and in previous workshops and discussions we went over the different mechanics of those different equations you can solve it multiple ways so that's why you can't always have the same answer okay so somebody makes a poor they had no flood plane just a general concept they had no flood plane permit they have a huge pour they've done what would be an example of how it could be resolved okay I'll give you one on Southern Boulevard we had um a a property owner that was chomping at the bid to get moving quickly we told them that until they had their flood planes signed off including the south Florida Water Management sign off because anything over 10 acres is going to need their sign off as well and they said well we can move some dirt around can't we I said no they said we can put our um Foundation down can't we I said no and additionally they disregarded me and put and moved the dirt around took out trees they shouldn't have taken out and they also put in the foundation so they got code enforced because I saw it and um they ended up having to spend I'm going to say on the order of several hundred, doing underground storage in addition they didn't have enough money to put up their bond so they ended up having to to delay their actual construction as opposed to accelerate so that's a real example people that happens to individuals as well um that's why what we decided to do and we brought it through several different workshops with the council to have a more expeditious process so that um if somebody was just going to be doing let's say 500 square feet of um impervious surface area whatever it is yes we heard that part I was just concern about the larger when somebody does a large por it's just because and the reason and I bring this up and it's again the same comment that you've all heard over and over everybody can do what they want in this town they just get their hands tapped lightly and move on next so get their hands tapped lightly by us that's the reason that's why I'm bringing it up for an example that's why it takes sometimes as much as 7 to 12 months for somebody to get through an FDA process that they've disregarded a regular FDA process is really not that big of a deal but um you know if you're coming in after the fact it turns into quite a big deal particularly if you haven't gotten a rightaway permit particularly if you know the location of where you're wanting to put your Culver Bridge you know is where there was some kind of other easement or you didn't have an easement there are a whole number of reasons why we need to look at those before you do the calculations including whether you're irrigating you know from our wanted to established there there is something that happens after if you think you can come in and just do it without a a permit all right thank you no no no Mr mcneel hat off to this town I was away for the tornado fearing for my property as it hit B- Road and Absol Ely flipping out I got back two days later and I I cannot believe I can't believe how effectively you guys jumped on this it was amazing I've been in emergency situations in California hats off everybody especially this guy here um that said I just have a tree question because I have 10 acres that for 21 years I have carefully tried to maintain the canopy to take care of the Southern yellow Pines to not let steel track Machinery go around the root ball and kill them look at the poor little church on okachobee that lost all their pine trees that being said this event took all the dying canopies of my Southern yellow Pines shook them out because there is a beetle boore problem right now with these Southern yellow Pines and they die from the top down leaving enormous piles of debris my question is as a 10 acre homeowner am I allotted the same curbside volume as a 20 acre owner or as a five acre owner this may be old history that I'm not you're allowed to bring as much as you want need out that's all still considered a result of the storm and we have but it'll be between 60 and 90 days of the storm event that we will be having collections bring it out to the so I could pick away at it for a little bit I think I think we've told everyone I'm sorry for interrupting by December 1st if it's at all possible if it is not possible then we can make arrangements with you okay um but um by December 1st and the reason for that is because all the debris has to be grinded and um that we believe December 1st allows us enough time to get that done before the January deadline but the answer to your question is you're not limited to six yards you just bring it out and once we get past this bubble the question I guess I had is I generate a phenomenal amount of debris just by virtue of the fact that I've tried to keep the canopy um making my horse trails go around trees but at six yards on 10 acres of a high canopy there's no way that I can keep up the volume without having more assistance and do you Pro rate does is the six the same uniform for regardless of acreage the six cubic yards in a way that's not fair in my opinion it's I'm just expressing that because I don't know how to manage that except little by little by little by little I have tried doing legal Burns I get a permit I talk to the fire department they come in everybody's in line except my neighbors they don't like it so I just want to try to balance this all and not create a problem but I'd love it if there was a gold star for 10 acres a green star for five acres a blue star for two acres and you prated that volume fairly based on the fact that we all pay different amounts of taxes but beyond that I'm super pleased with what everybody did one last question I missed a couple of meetings did we ever grab that property on C road to use a dumping place for we we we did that that's how we got rid of it so quickly that's brilliant whoever came up with that idea we didn't grab it we we used it right right so that's where it's going gra it didn't mean we we took possession of it no we utilized it we utilized it fantastic smart move on somebody don't move oh don't move I have a question um pardon I have a question um if his neighbor was not using their vegetation in front and he had a good relationship with his neighbor could he ask his neighbor if they weren't putting anything out if he could put out in front of them I have to answer that question in terms of our contract he would have to do a community pile Arrangement and if he did a community pile Arrangement the larger pickup could take place on Wednesdays or Fridays that's what I can say in the you call Town and get details on a community pile that may be the way to go well I think I know a real estate agent who's marketing that five acres next door to me so thank you I think I'll have a little conversation thank you did you have something um of health insurance renewal you can go ahead and come to the podium thank you someone left their glasses hello good evening I am Melissa Morley from the Garing group gr been here a couple years now um it's a risk strategies company as we are so we're here to present your 2025 employee benefits so we're very excited we're going to start with the recommendations page you'll see in your packets all of the supplemental information so I'm just going to review the recommendations of what we want to do for this year for an effective date of January 1st 2025 we would like to stay with Florida Blue they've been great for you we're going to renew with alternate one that you see on the list um it is a change in plan design it is going to save the town money so that's why we are picking it um and then also as an initial roll out we would like to create a health reimbursement account for employees since we're saving money on changing the plan design for the first year as an initial rollout each employee would receive $500 which is the difference of the new deductible that will happen on the plan uh to help them if they were to have a deductible expense because the the current deductibles ,500 for a single and it would be moving to$ 2,000 so that's where the $500 comes into play do you mind if I interrupt you moment sure before we go through the details I do think that it's important to say that we budgeted 125% and what's before you is with a 5% increase we have a $30,000 savings and the $500 is not a giveaway it's a wellness benefit that requires each of the employees to go through a wellness program so I think that you know when we talk about it being the difference in the deductible it's to add a level of Wellness isn't it yes for next year so I'll get to that correct sorry I just thought it was important to say because we're not basically giving employees $500 so with that being said yep the result is a 5% increase just so everyone understands on the medical plan or $8,500 so with that starting December 1st the wellness program would be tied to um earning money for the following Year's renewal for 1126 also so in doing so the wellness program is also attached there employees would have to do some activities to earn that $1,000 for their health reimbursement account in the future so that is where the earning comes into play and it also helps um culture here and then of course we have a flexible spending account that we always have every year and that's an employee paid benefit so no cost to the town our d plan actually is having a savings this year for employees because it is an employee paid benefit so that's going to save employees about 5% on their payroll deductions and then vision is also an employee paid benefit so we suggest renewing as is because there's no increase and then basic life STD and LTD are with a carrier called The Hartford we've been with them for years that is an employer page benefit or a town benefit and there was no increase uh to those rates and they are guaranteed for another two years so the only increase we had really was the medical increase uh for that $88,500 at 5% for this year and then our supplemental information is also attached and you'll see what those activities are for the wellness program that we'd like to implement starting December 1st through next November they have 12 months to earn the money for the following year I I I have a question sure um one of my past lives I was the um treasurer of the water Control District and we had a similar reimbursement program there and um I was alarmed to find when I took over as treasure that um we were reimbursing an employees husband's medical expenses um and I just want to make sure that we have stop yeah I'm I'm like all okay with the wellness thing into giving them the $500 as long as it's to to reimburse the employees expenses not their family or or whatever we can make that stipulation if you would like that stipulation y so no dependence can be given the health reimbursement account yep we'll we'll write that in the um SPD nobody else has any agree just curious if a spouse or a dependent is being paid for by the plan are you allowed to not allow reimbursement um if there I mean if you can't answer that's okay but I'm just I'm thinking let's say I'm paying for my husband and you know right but he's not receiving the employee Ben this is an extra benefit that the town's giving to the employee okay it doesn't it doesn't apply to his portion of the healthare even though he's being covered under my premium he's being covered not under your premium he's been covered by you privately because we don't cover spouses we don't if if Richard's wife is on his policy I'm sorry Richard to single you out I just know you have a wife um if Richard I met her this weekend she's Lovely by the way she if Richard's wife is on his policy he pays that portion that's for her okay we don't cover that okay so my point is the reimbursement should only go for what we cover as the town that makes sense okay got it in my opinion I got a question on your $2,000 deductible because that's why you did it it went from 1500 to 2,000 is that an individual deductible yes so that's the dependent has a $22,000 deductible as well as the employee no okay no you said yes um well the dependent yes there's a $4,000 uh deductible for anyone with dependence okay so it is an embedded deductible so yes it it maxes out at 2,000 if it was just an employee spouse then the employee would have 2,000 and then the other 2,000 would have to be met by the spouse okay I just your premise was it was 15500 last year and this $500 is to help bridge that Gap but also promote a wellness program which y for employees only because the town pays for employees y thank you and children would not be added children can be added if they no I mean as an extra 2000 the whole family would meet the 4,000 so if a full family's on the plan $2,000 for an individual and the rest of the family can meet the other $2,000 whether it's five children or just a spouse thank you so much for being here and what you want from us is a uh motion to renew right that would be terrific you don't need to don't need a motion no because this will come back on the consent agenda on December 3rd but we wanted to make sure you had an opportunity to make comments on you so much okay presentation thank you so much hurricane Milton Post storm update giv us this Richard I just want to say thank you to everybody because nobody could have expected those tornadoes and it was not untrue what um Brian said our staff was actually out on the road following that tornado um cleaning up until 10:00 that night and um Richard himself was leading that charge so um I think that a combination of Richard and also um anyone else in the audience that you want to ask questions to will do this item I do think it's important to say thank you very much to Chief fomo when we had reports that we had perhaps fatalities she was climbing over fences herself to get into houses and PBSO oh my God he went to town on rumor control for me um CU we didn't have any end of those I also think it's important to know that Jack took two different teams out to do that damage assessment um first they did the rapid assessment and then they did um the better estimate and Amber is the person that this all comes through because she's going to get us the money now of course the good news was Jeff was out of town so he was insane mind to hear all of us complain and come up with what we thought some of the debriefing items are it I would be remiss not to say that the town takes care of itself because it does everybody sprung into action and at the next meeting we're going to do some recognitions for that but in the meantime I really couldn't imagine any staff anywhere doing what this staff did then and since then so thank you thank you all very very much um and Richard it's your show all right wey mayor vice mayor councel president um as many of you know in October we had hurricane Milton come through and prior to landfall of hurricane Milton in the greater Tampa area an ef3 tornado which originated in the lockah hatchey wild life Refuge uh proceeded North Northeast through Wellington across Southern Boulevard and ripped through our town um entering between sea Road and the Culver and exiting uh eoad by the uh Royal by the eoad by the um Natural Area and then proceeded North uh many of you I'm sure watched the news where they talked about how it went through the acreage destroyed the publics and the tornado actually went all the way behind Palm Beach Country States and right down Jupiter Farms Road um um it was an unprecedented tornado it's something they haven't seen in recorded history in Palm Beach County traveled 21 miles and it was over 300 yards wide um as Francine said um the day of the actual event we it was right around 5:00 we were all getting ready to leave we had a limited number of staff on the ground just doing some finalized stuff because Town Hall was actually closed that day due to the storm and we were supposed to be closed on Thursday as well um I personally was driving down Southern Boulevard noticed the Culver sign was missing the the frame didn't even think of it saw a pomy County Sheriff's stuty go flying into the Publix with his lights on I'm like huh I wonder what's going on in Publix so I'm looking over here not paying attention to anything over here um approached Southern Boulevard or sem Pratt Whitney Road um and noticed two state troopers there at the same time my wife called and says where the heck are you there's a tornado going through lock AI Groves I'm like no there's not I just drove through there so I told her I'm on my way home don't worry I'll be fine I make the rightand turn and my superintendent calls me he goes youe you're not going to believe this um he goes look to your right because he knew which route I was taking I look to the right and I see this monstrous storm tearing through the town so I immediately took action went up to okachobee Boulevard assisted the palmach county sheriff's office in blocking okobe Boulevard so nobody proceeded East on okachobee and then once the storm once the tornado jumped okachobee Boulevard took off down okobe met fire rescue on okachobee WE cleared okachobee Boulevard and then I took off down d Road and they went down C Road um I drove the North End of the town and directed staff to go to C Road and check out the south end of town met them over there if any of you have seen the town crier uh the current edition there's a picture on the cover I took that picture um that was taken on SE Road between Gruber and collecting Canal of the guy standing in the middle of the Carnage of all the the seven power poles of three-face power poles that were laying in the in the water and he's just standing there um we were yelling at him dude get out of there whatever um our staff stayed um another one of my guys was actually getting ready to leave himself and they they all stayed went over to se road we cleared West sea we helped a number of residents be able to get to their houses because they weren't able to get to their houses um cleared the road so people could get through and we assisted residents where we could and as Francine said we didn't leave until 10:00 that night um over the proceeding month and actually we're still doing some limited damage um removal or debris removal because we cannot remove any debris if AT&T or comcast cables are wrapped up in trees uh so we're still waiting on AT&T M Comcast to remove their uh infrastructure from the debris so we can remove the debris but since that day we've been uh clearing debris clearing streets um assisting residents wherever possible um as you go through this I this is actually a day-by-day synopsis of what actions we took before during and after um I'm not going to read the 14 pages um I'll let you do that on your own um on page 22 is the uh synopsis of the damage assessment conducted by our building official Jack thomasi where we had two destroyed structures two structures with major damage 17 minor damage structures and one person that was seriously affected with a total damage of almost $2 million of individual property damage um and that number is low because of the method that we are required to use by the state by FMA to assess initial property Dam individual property damage most of this would be paid for by Property Owners property insurance um or their commercial insurance depending on what what was impacted um but a a specific methodology we're required to use um which is based off the property appraisers assessment of the buildings that are on the property as many of our properties are a exempt those building numbers are very low um for example for example Alman Farms which has over 100 acres of property that was completely devastated had $122,000 worth of damage because according to the Property Appraiser's office he only had $25,000 worth of structures on that property even though there were canopy structures that were completely destroyed their office trailer was completely destroyed um but because of the methodology we're required to use that's why that number is what it is below that is all public assistance this is what we will get reimbursed by FEMA these are estimates we based on our rapid assessment um so we estimated $300,000 in debris removal $60,000 in emergency protective measures which is that is you know lowering the canals picking up all the other you know stuff that's around the town doing all kinds of stuff like that damages to Road and bridges water control facilities and public equipment is also with a total Public Assistance initially assessed $430,000 um FPL came out on the 11th replac the polls on or started they replace the polls on C they finish it the next day um we also had a few people that had some concerns about um residents not having the ability to get access drinking water so initially we had called um to have a tanker truck brought out here we uh instituted a mission with the p County Emergency Operations Center Parks brought out two 18800 gallon water uh water tankers but without having specific addresses of where they were going to go and they couldn't just leave the trucks here uh we had to turn them away but then I came up with the idea contacted a friend of mine who's the the director utility director of palom County water utilities asked him to do it me a favor and we put in a water meter at Station 21 with hose was on there so if any residents needed water they could just go there and and access the Water behind the fire station um the fire the firemen there were very cordial they helped us a lot Amanda actually did a great job helping arrange that um with fire rescue making sure everybody it was all the shifts were aware of what was going on so if somebody was back there that wasn't for drinking water that was to water animals no you could drink it too if you wanted to okay it is pable it was pable water you could drink it just checking um yeah know you could she said I wouldn't drink it well okay as some as as somebody who worked for a water utility for 19 years I the water in the fire hydrant come say water comes out of your tab okay um drink that either but anyway so um so that you we and then we we used our Civic ready program we used our website social media everything else to announce about the um you know the water being available any resources that were available FEMA where their stuff was going to be the neighbors helping neighbors all the other stuff that we um did um continuing on you know you see in here we have the various charts and tables uh We've hauled out at this as of today we're somewhere in the neighborhood of 13,000 cubic yards of storm debris that's been hauled out of the Town um page 31 I think it is yeah 31 actually has a diagram showing the path uh the rough path of the storm uh where the tornado went through um we went door to we we had our staff go door Todo FEMA had uh people go door Todo to to assess the needs of the residents and try to help them out as best as we possibly could we identified about a 100 properties give or take that could have possibly been affected by the storm or by the tornado we reached out to those as best as we could uh to assess their needs and then on the um page 36 is our initial debrief there's a number of things that that were concerning uh issues that came up as you go through here um some of the items was for example there's a generator of Public Works which we all assumed would operate Public Works it only operates the lights in the Public Works building that's it so we could not control the dgates when the power went out from d Road past to seminal Pratt Whitney Road we could not control the a Gates we could not control the dgates um because we didn't have power to the ska system we couldn't control any of the gates remotely we'd have to physically drive out to the gates um to open them and close them and all that stuff and to verify their operation um so that's something we have to look at because the like the and even the dgates without even if the generator the generator wouldn't run the gates because the gates are three-phase and the generator single phase so like you we need a whole another different generator to operate the dgates uh one of the recommendations which we're actually starting to move forward with is to operate the A and fome Gates we just need small 2,000 watt generators is all you need to operate those Gates because while the gate is 12 volts the mechanism to operate the gate is 120 volts so you need power to turn the H the HOA switch to on to actually open the gate um and it's been that way since they put those gates in this is not something new can I ask a quick question with the about the gates sorry to interrupt but so the 2000 watt generator is this something that you're going to have at Town Hall is this a gas generator or is this something that's going to be because I I see in some towns you could see where they have little generators and they're bolted down and you know but this is something you're gonna physically have to put on the back of the truck and bring out yeah you ever seen those little Honda generators little ones about but how are you gonna secure them they're gonna be they're gonna be public works right but once you put them out oh chain them to the fence or we just bring them out there set them up plug them in do what we need to do with the gates and then unplug them and take them with them yeah never take them off the back of the truck because remember when they close the gate at uh you know at EOD it torched it so I'm not sure yeah know it's not you know they're small enough that you know they literally be carried in like a suitcase you know started plugged into the the operate the equip you know operate this the so actually technically operate both you could just run around from okay and my second question is and also I was hoping to hear from Jack as well it says one person seriously affected is that a resident yeah okay but I think more than one was seriously I know there were I know of two houses that were demolished well you have to ask Jack specifically he could give you the more detail on how they come up with that number because I know on Flamingo I believe that house was demolished and then uh the old snaf bit was demolished regardless no one was in the house it was still get details general report this is what we call a rapid assessment so but I'm wondering if this is going to affect the money we get from FEMA so that's why I'm asking because I think it's important yeah they won't it won't affect anything we get from FEMA the rapid assessment has to be done by every city in the county for the county to determine what level of effort they need to put out for the cleanup the rapid assessment and the later assessment are two different things the public assessment and the private assessment are two different things when we initially were putting in some of our numbers including some of the Agricultural loss we actually provided numbers that were accurate but they were higher than what's on the tax role so for us when we look at the definitions and the dollars it's totally different because we're living in the real life but unfortunately we have to me measure against the definitions which Jack can describe to you because they are very weird but they are what they are thank you so I think this might be a little Miss might be an error might person effect be building there's four categories that we go through you turn your mic on okay I I will excellent yes yeah what so is um so this is page number 22 so there's four categories that we that we fit there is actually fifth one that we didn't use some of them um properties are uh not accessible uh but we use one category is destroyed major damage minor damage and affected so it's not going to be person it's a building that was affected that's how it was and in the categories that we use based on the guidelines from FEMA those are the four categories that we go there and we we determine how building is damaged so uh destroyed building is the building that is basically shifted of foundation like one of the the uh the u p on Flamingo uh something that is completely unrepairable has to be demolished you know and then and you have uh major damage structures so Al those are structures that are repairable uh but they receive major damage they can have a part of the roof missing uh part of the roof trusses you know part of the wall that would be a major damage anything of the minimum uh of the minor damage those are missing shingles missing roof tiles U and basically missing uh maybe SCM porch damage out of the house those will be the minor and affected if if it's even less so that's how we determine that so sometimes people I I know we talk to Residents and you know my entire screen porch is gone I have a major damage no your screen porch your main structure your primary structure is standing and is occupiable it's safe just because your screen enclosure was damaged that that would be considered minor damage that's how that's how the the damage assessment is assessed and sometimes for Homeowner this is hard to understand but but unfortunately that's that's the guidelines that we use to do that so my my my other question is now in our agenda it's saying to destroyed two major damage 17 now what if FEMA is this your final report because my concern is what if residents go to FEMA and they go whoa whoa the town didn't you know more residents show up for more damage which is legitimate um because I I imagine did you go out and inspect everything that well we we in respect everything um based on the path of the hurricane and the tornado so so we did the best we could we covered everything then uh lot of it was was by the whatever was reported to us so as the reports were coming we would be driving there and going there and this is assessment from the road a lot of times we got out of the trucks we walk the properties we talk to people and we we discover more but the assessment that you that you make here uh it's it's assessment basically from the road uh okay so if anybody had damage they need to come to town hall and let you know they they would come to town and they happened quite a bit that people would come in here or call in through Francine and code enforcement and building department and then we would we would and all of those were were were included in the report right because that's my concern if we see where our damage seems to be lighter than when the residents go fill out all their application comes in heav you know I I I that was my concern that maybe some people won't the female won't take them seriously or or get them paid and Council I I assure you that everything that was brought up to our attention was put on the list I was personally involved in that because we can't possibly and specifically to me this was a new new experience in in this set set of town I did 15 20 damage assessments across the street where it's a lot easier to see everything from the street because of the size of the properties so here I so we specifically paid attention to everything everyone that would reported for us because that's the only way we could see it and then and then Richard will mention also probably that we had we had uh drawn footage and and we were able to discover a lot more from that and we would go back and also assess that whatever was visible from the Drone because you could see a lot more from it h one thing that is worth adding is also so we didn't include it um RVs you know turnover RVs or any of those structures are not part of the assessment and the governor told everybody to evacuate mo mobile homes and their residents if they had RVs on their property whether they were renting or not they're responsible to make sure the people they're collecting money from had safe were safe that they should have evacuated or giving them sha safe shelter with them which I don't know who had safe shelter but being in a CBS house probably would have been a little bit better than in a RV absolutely absolutely those are not not structures or RVs are not the place to be I'm sure everybody learned that through this through this event yeah I actually had I had a resident tell me that they were actually sitting in their RV when the tornado came through they felt the RV shake they were sitting at their dinette eating dinner and ALS sudden they felt something at their leg and it was a tree branch went right through the side of the RV right behind their legs if it would been another 4 Ines more forward it would have hit it would have broken their legs right off there was an RV in Wellington that it was in um uh off a flying Cal road that when the tornado went through it actually picked the RV up and threw it and there were eight people inside the RV something like if I remember the report right it was like two of them had to be trauma hawked out and the other ones all had to be taken to the hospital so there were people in I mean there was one house in Gruber two or three RVs flipped over I've got a picture of the truck Horse Trail everything else flipped over there was a property on snail Trail they had a horse trail in their yard and nobody knew who it belonged to it didn't belong to anybody I went I personally went to the three houses to the south of there all the way to Gruber and asked are you missing a horse trailer everybody's like no so we don't know where it came from well I had a tag on it right okay yeah I mean eventually I figured it out but anyway hey does anybody Council have any more questions for Richard or for I'm not done yet Jack oh I'm sorry um so as we digressed got lost as uh Jack had mentioned we did we did a contract with two contractors and the Sheriff's Office to fly drones over the town um looking for additional damage or anything because you know with the larger Lots it's hard to see in the backs of these lots to see if there's any additional damage or anything else we should be aware of um in the town um you know one of the things you know for future you know we're going to increase continue on increase our training um of Staff especially in the key roles um part of the instant command system so you know we get better trained better training for the employees and you know just go through um all of our stuff I have one more question go ahead so regarding the RV ordinance it turns out that this tornado um uncovered several properties that were Harding hiding annual RV residents in this town so um does with that said what is our recourse with code enforcement to be able to like C road I'll use C Road for an example not as but there was a 10 acre property that people came out of the woodwork stunned they didn't know what to do they had obviously been in RVs and got hit by this tornado so what is our recourse and what is our uh to prevent the town from being liable um for people that end up uh in this kind of uh natural disaster um do we have like a home hold harmless that the owners of these properties need to make sure that you know they are responsible for the people they rent to the town should not be responsible and not the town at all right I mean it's not a Town's responsibility you do something that's not lawful you can't expect the town to be responsible for you committing something that you shouldn't be doing and now that we know about our visa on properties that are say don't have RVs because they're not coming forward with the permits how how do you try to get on that property and enforce that so we s this was late recently pass ordinance uh we are in the middle of the question Seasons as well so we are working on advising people about the new ordinance uh we are we have a code officer that that uh the drives and addresses and informs them uh we identify properties that are that have more than four or more and if they are uh if there are situation that they are repeat violators they will get not as of uh violation and not as of hearing uh there's some of them that might not be aware of it we we we we trying to advise everyone uh because this is a since this is a new ordinance we we don't feel that we we're going to be able to you know write everybody up and and put through code enforcement special hearings and and and finds so we work talk about the people that are renting annually that have no intention of doing the permit and so I I was hoping that maybe we could get an update on how many permits are given out when we come back in December so so far because now they're coming in it's November so everybody with trailers that are renting for season should have their people in place or at least talking to them well I can tell you that they not rapidly coming in to get permit yet we uh we have uh I think if we have 10 right now uh then that that's that would be probably good number to to throw out there you know um it should be a lot more that's why we we are reaching out uh enforcement of the RV ordinance is in addition to what we do uh so so it's not like we can dedicate two officers and sweep down uh we don't have the stuff available but we are addressing it and I think um through through this year we're going to do good job educating and I think you know and I think a lot of people will learn that they will get a permit to today or this year and they'll be good for five years and we'll have to do this every year and so I think a lot of lot of goods going to come out of educating uh because again everyone that comes in here is asking for ordinance we did good job sending flyers and delivering flyers and they shorten the ordinance to the point where it could be better understandable for average person uh so I think we're doing a good job on that but I I don't think that we're going to get everybody permitted this this season this is work in progress and and yeah hopefully by by next season we're going to have all the permits in place or at least majority and discovering um RVs is not challenge because as I learned myself you can't see anything from the street uh so um you know this is this is something that we're going to be working on and addressing maybe the biggest violators first repeat violators first uh you know having a you know four or more RVs I think those are the most concerns and and obviously following your direction as well so I just wanted to add one more thing on that because Jack was um being modest he's working with a list of 100 let's call it 5,200 locations of where there have been RVs before as well as what you can visually see from the road and anybody who is a past violator is going straight as he said to noov the property on C Road um was exposed but we already it's already a third time fourth time violator on no you're not that get the same one well no there's another one there too but um since you mentioned that one they're immediate the ones that are repeat violators are not getting the courtesy they're getting the noov because they already knew and it's four times the fine right it's four times the permit it's four times the permit so it's a lot cheaper to just come and get it is cheaper to come in and do it right question yeah um is there any possibility that a sign could be made uh to make awareness of the six month rule so that maybe the owners of these um RVs they may not even know that you know they are creating a violation in our town because the owner of the property is not going to say we got to leave in six months well that's a good point Marge and also actually they're not the one making the problem the owners are and those folks probably don't know but they also don't know that they may have to pack up and move in the middle of the season if they end up in Code Enforcement if the owner ends up in Code Enforcement well that's why I'm saying maybe a the signs on our major in andout roads would be worthwhile are you all willing to pay for a variable message sign those seem to work a little bit better than our sandwich switchboards I'm happy to put the signs up the electronic one are they no I'm not saying to buy one I mean to rent one maybe we know a friend in so no no no send out okay we've already sent out flyers yeah we've already done a lot of that we you hand deliver Flyers to the properties and we continuing to do that so so we are making people aware of it um now bringing them here to get a permit that's that's another subject which is one of the reasons Jack is here tonight anyway I'm at the point where I've gathered all my data and I'm I'm I'm sto by the site plan thing because I'm scared to draw a picture does that have to actually be on a site plan of my house or is it just me drawing a rough sketch just rough sketch just it doesn't have to be on a survey no it's just I mean it survey survey is easier for us to read but I'm sure you're going to do good enough drawing for us to okay all right well you could see mine from the r okay I'll do it I was I was little little daunted by that part of it this is to help us also inspect uh and then we discovered that inspections will also take time because uh those are different type of inspections it's not a new construction inspections where inspector goes out and everybody is waiting for him we have to arrange the time and make appointments with homeowners make sure they home uh so um and also drawing will help us find just in case the homeowner is not there and we allow to go on the property the drawing will help us locate them you can see it from the red in your case yes but there's there's plenty that you can't so I understand okay thank you thank you very much for your time okay um you're done right yeah okay we were supposed to just have a present a file and receive the quarterly reports but seeing as your both here um would you like to just come up for a minute and give us a brief summary of yours he doesn't have to we can read I mean it's here left their glasses I don't know if it was the insurance lady oh I'll take them thank you very much yeah I also wanted to compliment the town on their response during the storm and after the storm um it was very it was very nice to see Neighbors helping neighbors and um everybody just pulling together the way that they did and um just a couple of numbers um from that hour and a half after the storm uh we fielded over 12911 calls and at one time we had 58 units on on the ground responding to emergencies um as a direct result of those storms so um we were in great communication um the Tom manager and I and and Richard um and it's just a really nice partnership that um I'm grateful for thank you we're very grateful I have one question so is something um we don't normally have those kind of tornadoes right so now is that changing your training at all is you know it's it's diff changing everything now it is it does change everything but we are already trained in that emergency response or setting up um divisions and you know um utilizing the chain of command and the incident command structure um that Richard was talking about getting some of your staff better trained in the um instant command system structure um we are already trained on that this was unprecedented um I feel like we did a really good job though it was Controlled Chaos if you will you know um and there was a lot of moving parts and a lot going on um but all in all uh we didn't have uh we had a total of seven patients um in total for palach County as a result of the tornado we did have the unfortunate horse fatality um none of our Personnel were injured everybody went home safely um and it was wild we had crews out there responding and we had an engine there was one tornado in front of them and they're going to reverse and there was one behind them so um thankfully nobody was injured and everybody did get to go home safely so um but it was really great the way that everybody pulled together and and did their part so it was uh hopefully I don't ever see that again in my career um so but um you know we handled it and and you guys did too so kudos to you all it's tough when you don't have basements yes it is we're well yeah and the RV is not the place to go and hide out so yeah we saw complete structures completely leveled um let alone RV is tossed and turned and whatever so um I have some exciting news with fiscal year 2025 um October 19th we had I got three additional Battalion Chiefs to the complement for um Battalion 2 and Battalion 2 has been split because I have nine stations out here so everybody north of Southern Boulevard is two north and south of Southern Boulevard is two South so we split it up five and four um and the three Battalion Chiefs that I got are housed at the West Lake Station and they also will cover 21 Zone which is predominantly in uh your area latche Grove so that should in improve response time as well with Command Staff and then three additional EMS captains will go into service January 177 for the compliment of Battalion 2 so that's a a additional level of service to the community that we're very excited about and one more question um have you used traumahawk on the uh Dolphins uh saw Farm yet you did ask me that last time and I did look it up but that was several quarterly reports ago so I will have to I will have to look up to see if we have used that so I get notified on a lot of the big calls and you know not that a trauma alert or flying someone out is not a big call but I don't get notified on a lot of the routine medical calls so it's something I would have to go looking for so but I will remember to get that information and I will let you know trama Hawks saved my life oh I'm glad to hear it question for me are are you going to be uh drawing from the the local uh kids that are being trained like at the State College and the other Center uh in order to fill the jobs in the western communities so we don't give preference points to the kids that come out of those programs but we are one of the largest employers um of fire rescue agencies um we hire about 90 a year but we do get anywhere between 600 and a th000 applicants and we do take applications every 12 months right around June is July is um of every year um but yes increasing the pool of you know local good candidates um but we have not been able to give preference points from anybody body that comes out of um either the Wellington High School fire academy or um Palm Beach State College um and Palm Beach Lakes High School now also has a fire academy as well for high school students so I would think that it would be an advantage to have kids that were raised in this area absolutely and and know you know the dos and don'ts and wise and what fors yes I agree with you I do um I'll just stop there I agree with you I was in recruitment and human resource development for six years um prior to transitioning back out to the field I became an EMS captain and then um a battalion chief and now a district Chief so um I do agree with you and I would love to see some of those homegrown kids get a couple of preference points or uh maybe a letter of a recommendation from a local fire chief or something like that um but we're just not there we don't they we don't do that HR does not offer that unfortunately thank you so much for your support and for your service and and for your partnership for this this episode we really do appreciate it it's my pleasure thank thank you okay Captain Turner you did you want the call volume or no well I we all read it anybody feel like they need to hear it right out you're good okay yeah thank you Captain Turner thank you very much have something you wanted to briefly say I'll come up and answer any questions but well I I know that I I had one question sure if there was any I know that I was alarmed when I went to the I meeting there was a briefing of in I I don't think I saw you there um and one of the things they were bringing up was the Looting that was occurring over there in the that's that was that was not accurate at all it was not I I actually went because I was like oh my I went to the next meeting the following week the follow-up meeting and I showed them the stats not one looting call was called into the Sheriff's Office not one thank you the entire time thank you for cck um we we had deputies we had doubled our staffing throughout the entire west region for a 3-week period from the day the tornadoes hit until we deemed it was safe enough to bring the Staffing levels back down so everywhere we had at least double the Staffing um we had a listing of every damaged property that we found and I I know I talked to Francine about the damag properties here and that was a that was a revolving um door of deputies just coming through and checking on those damaged properties to make sure there weren't people in there walking around the properties doing what they were supposed to be doing uh they we got one call of a possible looter that was at a house they were outside across from coconut park picking up stuff off the ground and it ended up being the homeowners um so no that was that was not accurate we we super glad to hear that I was like I just can't believe anybody would kick somebody while they're down well that was something that was mentioned and it was never mentioned overall in the meeting it was mentioned in the back of the room to Brian Mast um but it was never brought up in the meeting so I had sergeants that were there that meeting that could have defended that but it was just never brought up and to the public side of the house and so he said he'll take care of it and and he called and we discussed it um but like I said we showed the stats the following meeting I came and I showed them look here's all the calls that happened in this two we 3we period um I showed them the list of all the houses that we were checking and it's same thing it was a list in it was broken down the same way yours are these houses were destroyed these houses were uh damaged where there's access to the house and these houses had just minimal damage and that's how we decide on which houses we would spend as much time with as we could going by and checking on them um so we we were um and that like I said that was that was uh that rumor was squashed this whole thing go down wow that rumor was squashed and U believe me it's uh good so if anybody else had questions I answered them at that the following meeting up an ENT trails Great thank you Marge yeah um I know the acreage has had tornadoes in the past but can't remember in all the years I've lived in L Grove since that's the first F3 that I think they've ever recorded here I had ever one land on my roof in 95 um it was not an F3 right I I'd never seen and to be honest and I always thought you watch the tornado movies and you're like yeah that's a little bit overboard but to see in air a huge West uh what is um Waste Management dumpster sitting on a house I was dumbfounded because because I got to tell you even from what I'm hearing and some of the things they put out there that that if you had tornadoes at all touch down here and that happened during a named storm that's one of the big issues they had is people had a lot of tornado damage and they were trying to use their coverage under their tornado coverage but they weren't allowing him to because it was during a name storm so they had to use their everything that they had in place for hurricanes so that was a big issue that we we all learned about this past year too um because I had some damage and Wellington took a pretty good hit um with with the houses over there too but um yeah that's that's one of the major things that we saw uh that happen with but it's never I think they said that 107 tornadoes touch down between Broward County and Martin County or up St Lucy County or something in that area that was it was ridiculous a lount of tornadoes seem like the storm and the uh the speed of it and uh where it was south of uh the lake I mean you don't get as many situations like this uh south of the lake they're usually north of the lake well like you said I've never seen that here i' I've only been here 25 years but I've never seen something like that I was at Hurricane Andrew and I saw a mass Devastation down there but just the the individual houses that got hit by the tornadoes it was worse than a lot of the damage District ordinance that's adopted by the town in our code has to be recommended by the district to follow our attorney's advice so this is not doing anything except recommending that the town vote on this okay we have any public comment on this I'm confused because we pulled so much stuff so we're on 15 it's not a pulled item sorry about that the actual item please hand your card the yeah except I've got it filled out wrong right now so I want I just want to point out Miss Corning and for the council that the actual item that will be discussed by the council is item number 18 that's where ordinance 20246 the first reading of chapter 46 which are revisions to the special district ordinance will be discussed okay 2834 EO Nina Corning um in a way you're trying to get this through but all of what it's going to be in 18 is in this already so if you're approving this you're also kind of approving 18 so that's not entirely Fair since this is before the other um actually this is the water Control District recommending that the town consider it yeah I understand that be approved by both bodies so no it's not I get it but what I'm trying to get at is this is just for approval here is is a little you know just push it through isn't quite right I don't think um so this says this is fair and reasonable it do not it says it's due process and this protected due process it is not it says it protecting private rights it does not it says it's a reasonable regulation it is not okay it just isn't you've put all of the related costs for all kinds of things onto a program where you have you have a 10-day notice that you get some notice you're supposed to go and be home within those 10 days and pass a notice into the magistrate you don't get a proper hearing you've got culverts that are in violation um just by having existed because your new regulations weren't there once upon a time in most of the town just about almost everyone would be in violation if you pass this through the way it is we all are not via those standards of today and that alone says you're in violation and then the clock starts ticking and the money starts running I don't know how you expect anyone in this town to be able to afford what you're passing through here it's it's it's amazing you've got um the magistrate hearing as the final say uh there you know the district just decides that something is wrong um you can always pull out of it the poor property owner is stuck with massive bills from both the town and and the water Control District and everybody else in between then you're suggesting financing to go and do this you're you're adding administrative fees to this you're adding it's I'm I'm going to run out of time and this I don't even know where to start telling you this is all wrong and we're supposed to be government light and this looks like you're just going after you know the bad guys the violators you're going after pretty much the entire town with this thank you Miss sui nassie sui so I guess we're going to discuss this again under 18 because I have very I've picked it apart completely um thank you for taking out some of the vague wording from a month ago at the last meeting um but I do had some issues um and I'll pick apart by pages but I'll get more under 18 there's a lot of issues with this vaguely some of your definitions um some definitions left out um I see no wording for protection for residents or devices that have been built under previous standards of 10 years ago that might still be functioning based on the wording that's in this document they will now be hand to held up to the standards of 2024 so um I don't think that's correct there needs to be some type protection or grandfathering for devices culverts Bridges whatever that may have been built um in previous standards from 2005 2000 and might still be functioning properly uh I had a question with um the appeals process there's one uh you only give a 10-day notice there's reasons that for whatever reason somebody might not get the notice and you're giving them 10 days to respond and if they don't that's considered well they don't care and it goes right away what if they're on vacation what if they're in the hospital what if they don't get the mail yet yet so I think 10 days is very insufficient to have people respond um you have a abatement costs you basically throw everything in there in abatement costs um you might as well throw milk eggs and dog food in there because everything else is included uh to financially burden the residents um there's a section and I'll get more in depth on 18 uh you talk about the contractor they're going to have to choose from a qualified list of contractors chosen by the government well the town what makes them any better than another qualified I think that's right for abuse uh requiring them because we know anything contracted through a government is a lot more expensive than contract it individually um you talk about assessments additional 10% assessments um for extra costs like uh title searches and surveys well if the bridge costs 150,000 what is that 15,000 what if the cost comes in at only 5,000 does the reimbursement go back to the people or does the town get to keep 15,000 just because so I think there's a lot of stuff in here I have a lot more stuff and I have it more specific when we get to it but I don't think any of this needs to get approved right now and I think it needs to go back and some of the stuff needs to be worked on um we are government light and what I see is a repeat of the FDA which was approved in 2017 or 2018 we thought it was great and and then when we started to look at it boy was it not exactly what it was for the resident so I think we need to be proceed with caution and look through some of this and I'll bring it up in in depth thank you for your comment Robert you have your light on yeah thank you madam chair yeah what I'm reading in this and the other ordinance you know we merg The District in the town to be under the umbrella of the town and now this is separating it back out and giving power back to the district and if we think this is critical infrastructure then we should take control of it and plan its replacement if it's not appropriate um to implement this and burden a resident with something that was put in 50 years ago because it doesn't meet today's standards I mean it'd be like the building official walking up your house was built in 1950 and you have to bring it up to 2023 Florida building code it's just not right and these CTS are just like a house it was put in when the house was built where the property was developed I don't support any of this conversion of the Town budgeting process in tax collecting process with ad valum to turn around and give the district the ability to just say yeah your culbert's not satisfactory what's who's the magistrate going to side with staff I don't care you can appeal it all day long and and then the town turning into a financing company that's stop why we're here I mean this is a lot of burden on staff if we think there's critical infrastructure that needs replacement then we need to work with a property owner um we need to find a A Better Way in my opinion and and I'm not saying that you know the b-road debacle where you had a critical Culvert that failed multiple times during rainy season over multiple years then all of a sudden you know it became something else and it did get replaced on hopefully a reimbursable dollar but um I do agree there's issues out there but if the issues are private culverts then I think we need to work with the land owners if we feel that that that is a limiting situation that's not in the best interest of the water flow and if we feel it's critical then uh take possession of it and plan its replacement but just turn around and code somebody on something that a person looks at and says that because I can tell you many many many colberts look bad you know you look at it from the road you look under it and you see the head wall you know was just a bunch of dirt and rocks and you know it's not a fancy RI rack bag and rebar and tied nice you know a lot of them look not not good and I agree 100% but uh you know these small colberts that go under roads they fall into this I mean if that culbert fails and gets blocked up it's going to flood that person's property so you know they would need to pay to to fix it obviously that's their baby that doesn't affect the town more so as a canal culbert I understand Canal culverts in my opinion you know was critical infrastructure and there are some some limits out there we haven't got the resiliency study yet so we don't know the whole impact of of some smaller covers we do know in the past the district said hey we're getting too many covers out here put bridges in or drive down the Canal bank you know Richard found you know that that history of that of that um change in uh philosophy philosophy yeah great word you know at that time recognizing hey we're getting a lot of little pipes in our big open canal and it may not be the greatest thing in the world but I just think there's a better way to look at this um and work with the land owners to to try to find Solutions and and not just go out and say that's bad and you're going to pay to get it fixed and us turn around to be the financer I I I just don't support that I understand there's an issue I completely understand I don't think this is the solution mayor can I okay go ahead the reason why I'm asking to say something is that we have done a great disservice to the community and with the council in our discussions of this for the last six months and the reason why is exactly because of what Mr Shore said and that is that the district became dependent upon the town and we haven't stopped to look at how that relationship works so I have to take a moment and better clarify ify the public record here because this section 46 currently exists in our ordinances it currently exists in our ordinances because on June 25th of 2018 the district adopted a booklet of resolutions and agreements and the exact same book was adopted by the town and the big thing that happened that day is that all of the 298 roles and responsibilities through all the special acts and the original legislation of the district and the many amendments thereafter were Incorporated in the town's section 46 of its code what this proposed ordinance intended to do was to provide two release valves for people who have issues not for the town to come in and lay assessments on people the town has the ability through the district or as the town to do assessments and any assessment we ever do has to go through a public process the assessments that are proposed in here are clarifications of powers that the district already has but because the district is codified in the town's ordinances we are clarifying that relationship this ordinance that the district that is on this agenda for the district to consider recommending to the town to consider with or without changes because again this is for discussion and review not for adoption so any warning changes are certainly welcome the two things that are mostly different in this and that have to be noticed is the ability to do individual voluntary assessments voluntary assessments mean that we have worked together with the property owner and everybody has agreed that they want to do an assessment I will give an example a whole neighborhood wishes to go ahead and take care of their drainage because the ditches have not been properly made maintained the town does not have the money to do that in its current budget whatever year it is the town does not have the money to do that that group of people can come forward to the town and say forget about the 5050 if you would just go ahead and do this work for us we would be happy to pay the additional assessment that means we don't have to go out and find 10 different contractors to meet the same standard and have the town do all the separate permitting and so on and so forth and it still might not work however the volunteer program would work it would be because Town Property Owners came and said they wanted to do it voluntary the other issue the town already has a nuisance abatement ordinance that nuisance abatement ordinance is not specific to drainage issues and I see the wording that we could easily change in here because this is not for the town to go out and inspect CTS and say yours was built in the 1970s and you know today our standards are different this is for where something fails this is not for where something has been maintained or is performing it is not to go apply a current standard to something that already works but if that fails whether or not we have this ordinance in here or not we already have current standards you can't put a 12in pipe under a driveway it has to be 15 or 18 I can't remember the right number but you know my point is you know if something fails even if this isn't on the books we already have other requirements to make you come already section 46 is on the books it's not on the books with the changes that were just not on the books with the two changes that we're proposing that can be excluded if you would like one is a Voluntary Assessment which the town the district has done voluntary assessments before they have done it with created units and they have done it without creating units they have um unit two with just with units or not with units unit two was Voluntary Assessment and a unit was created that unit you can argue that it was created or it didn't need to be created but we had another Voluntary Assessment at bitx that was not done with a town type of an assessment that was done with a district type of an assessment and it was voluntary nuisance abatement assessments we have not done there is a person on Casey who has not repaired they're culverts we have not done a nuisance abatement There Our Town ordinance does not give us the ability to do that in the way that we need to do it with this but we can do an assessment by the town ordinance for nuisance abatement but it belongs in the district because it's for drainage so this just adds a power that we already have as the town in the district where the appropriate accounting is done by the district I know I've shared a lot more information than you wanted to hear but I'm going to Summit by saying on the day the district became dependent all of the district's legislation and special acts became part of the town's code and the district and the town did mirror images of each other section 46 of the town's code was born of that day section 46 is being reviewed today to add two assessment types that would have to have notice one is a voluntary where the community comes in and says we want this can we pay for it you would say well why do we need that if they come in and say we want this we want to pay for it I'd agree with you if you don't want to put it in there don't but our attorney say you need to and the second one is a nuisance ab bment and you would say well if we already have a town nuisance abatement why you doing a district abatement well we have to change the towns abatement to be very specific to the nature of this which is drainage but the standards are the same and we don't go out to look for problems we are Health life safety for code enforcement and complaint driven and where we have a lot of complaints we still haven't done nuisance abatement on the culverts so I just wanted to make sure the public record was clear nothing new just two different tools that could be used after they were voted on an appropriate notice was given 10 days isn't Magic it's what's required by law if you want to make it 14 days or 30 days makes no difference 10 is the minimum required by law phis so the amazing thing is is that this affects half the town maybe not you if you live on eoad or broad or c Road and you have a big big Canal next to you and you don't have a swell but this affects all the people that are screaming about their water doesn't move and we are responsible to fix this and not every single thing in this town is nefarious and unfortunately um it I'm so tired of hearing the complaints that the town isn't doing anything isn't doing anything isn't doing anything okay we're not doing anything about the truck uh repair shop we're not doing anything about the drainage where this is doing something and I didn't hear anything specific I was waiting to turn my page and say okay well they want they don't like that verbit okay Me Turn My Page we have gone through this over and over and over again and per personally this is why this town it it sits stagnant there's people waiting for this to get past maybe it doesn't affect you personally but it affects every half the rest of the town There's Nothing nefarious in this okay anybody else Robert you got your life back on yeah just you know just looking at staff summary the first one section 461 is in general okay then the other highlighted number two is General powers of the district changing the powers clarifying the powers section three enforcement of drainage Works violations I'm just reading the summary from staff I'm not getting into the details of each little sentence and and what could be tweaked and changed I just think the attitude of this document has changed it's the attitude of the document we'll go back and change it I don't think we have a 5050 well we've talked about a 5050 for Paving drainage my point is the town owns everything so if the town wants to do a 5050 for Paving 5050 for drainage 5050 for anything in the town that is um eligible or if anybody wants to come in and make a neighborhood Improvement you don't have to do that through the district the town owns everything that is not accurate but I recommend that since we have such a divide and that staff has definitely not done enough in the last six months that I recommended that we take item 15 and 18 off the agenda and we bring it back at another date with modifications in the wording after we meet in person with Missi and go over her handwritten changes okay and might I suggest that you consider putting in your in some of your changes just as one comment Glenn that there be even though I understand that there's nothing nefarious about this and the intent is not to go on some kind of a Witch Hunt but that you put some kind of a grandfathered clause in there that I mean you put something that that you know this is there is no intent for the district or the town to actively pursue coverts that may not be up to today's standards it's only in regards to failed structures this is only in regards to failed structures some language along that nature that's perfect I think that that's probably something really important to put in there I think that might put a lot of people that might eliminate a lot of the ends and I'm assuming when you're saying failed you also mean failing about to fail I mean I mean failed you want to wait for it to actually I mean we I mean for us to take action we need to wait for it to actually fail if people want to come to us prior to failing and seek out the 5050 or a neighborhood plan or a unit that's fine but to make the Judgment for us to make the Judgment that we need to intercede it has to have failed okay okay on private property only what what why does that make a why does that distinction make a difference because this is basically about going after residents and private property not about going after residents that's the point no I understand that that's not the point I'm trying to make okay well I don't understand your point tell me what your point is I don't understand it regarding private property they're covert even though Richard's gonna say no actually because the problem is also the angles of the covert so the covert might be a perfect legal covert but it wasn't installed properly is that not part of the issue here's what I'm hearing the point is that the staff is making and that you're making that I hear is that people are actually desirous before these coverts fails they they recognize there are groups and they've come in here and spoken to us there are groups of people who recognize that the system that exists in their neighborhood while it isn't technically failed isn't functioning properly and those people are desirous of a solution and so this would not prohibit them from coming in before a failure but then I hear that there's another group of people that are concerned that there's going to be some kind of a of a Witch Hunt and so I'm suggesting to keep the Witch Hunt aspect out of it and to get rid of this culture of that people think that everybody's doing something nefarious that we put some language in that says that that that we eliminate The Angst about the the Public Works director being able to make the call of of of that this Culvert needs to be replaced to that the only way he can make that call the only way that the town can make that call is if it's actually a complete and call it a nuisance as if it's actually a completely failed structure whether it be on private property obviously you can decide to replace a public one yeah you can de to replace a public one before it fails anytime on the budget but whatever so I'm suggesting that that language might eliminate some of these concerns that people have or language sowhat to that effect yes Robert go ahead I want make quick comment on a recent FDA comment when I submitted an FDA that said if your CT is in bad shape it needs to be replaced and you need to pull another permit a separate P permit for that and replace that Culvert so here's the FDA person you know the cover isn't failed but and I have yet to ask how or who makes that determination you know I dump a gallon of water in it that gallon of water goes out the other side so does that mean it's perfect no but but that's my point is these type of comments are coming back you know like hey you know from an FDA point you need another permit replace this Culvert if and and like I said I haven't got to the Second Step where okay who determines the condition of this Culver so who's that your contractor contractor contractor contractor goes out and looks at the cber makes sure it's not rotted that's the problem we're running into in this town is people do improvements on their property and then three months later they're in our office screaming because their yard is flooding and they're blaming the town it's because the C rotted and the question is is why wasn't it caught during the FDA process that's where those comments are stemming from cont it's from Angry residents coming into my office screaming about their CTS are failing and why didn't our engineer catch it so now we ask the contractor if there's an existing cber to go into the go to the cobber and inspect it and make sure that it's not rotted at the water line that it's not you know trash so that way you're protect and this is to protect you it's not to protect the town if your yard floods it's your yard but you know it's it's the staff is the one who's the brunt of when somebody's cobbert fails and when they got an FDA nobody told them they should have inspected it so now we make the comment the generic comment inspect your Calbert and see if it needs to be replaced or not if it doesn't it doesn't if it does then we recommend that you replace it now while you're doing all this work while you have the heavy equipment out there to do this easily so you don't have to mobilize now you obviously do a lot of work yourself but 95% of the residents of this Town don't have the ability the Contracting um knowhow or the equipment to do this stuff themselves so they spend half a million dollars on their property to do improvements we never make the comment hey check that existing culbert because it might fail six months from now it fails and then they're in my office screaming why didn't you tell me this in the first place now I've got to pay a guy $100,000 to come out and replace this culber that you should have told me I should have inspected in the first place and I and I'm just being brutally honest that's what happens okay so we're we're at the request of Staff going to go ahead and pull 15 and 18 for reconsideration and reworking by legal thank you okay thank you does 16 hold hands with 15 and 18 has nothing to do with all right moving on to item number 16 16 is 16 is one of those cleaning up something that should have been done moons ago moons ago so at this meeting you would be recommending that we clean up the interlocal agreement and at the next meeting it will be on consent for the town for 16 correct yes verse 16 all right d question if I may be allowed but this does have the 46 the covert stuff on it yes we need to pull 16 also thank but you would be recommending that it come back in tandem correct okay 15 16 and 18 need to come back as a group okay on December 3D um or whenever okay let's adjourn the and Rec the town council meeting on to item number 17 for the regular agenda the red speed item number 17 was presented to the council at an earlier meeting by redp speed red speed actually offered each council person the opportunity to come meet and show them um what their speed study indicates they did a speed study in the two school zones on okobi Boulevard um there are 787 potential violations just at the Loach Groves Elementary School Alone by putting um this ordinance in place to enforce speed zone sorry enforce school zone speeding it will allow us to go ahead and um in effect provide traffic coming at our eastern and western borders and it will not only be during the early morning and end of day hours where school um starts up and wraps up it will also be in effect in the hours between um those two times school starting and school ending so um anything over 11 miles more than the school zone speed of 20 miles during the pick up and drop off or more than 30 m 30 m an hour which is our speed during the day the town would um Ben benefit from traffic coming because we would have cameras in place east and west in the school zones that are able to by camera issue citations and the citations are $100 um of which by law 39% or $39 can come to the town and the idea of this is to change the behavior of drivers and supposedly in one year's time they generally achieve 90 to 95% reduction in Speeders and by and large most of the speeders in their other studies are generally from out of town it's only three to five PE percent of the Speeders that are in town so this ordinance on first reading would allow us to implement um the state laws that allow us to use the um cameras for a school zone um speeding violations thank you any public comments B no okay bis you have a question I was gonna make a motion any that any questions no okay go ahead B make a motion to approve ordinance n opposed passes five zero okay on to number 20 discussion of civil violations 19 I'm sorry 19 skip right over 19 no we just did no we we just 17 17 18 is we're moving to 19 correct I'm sorry go ahead 19 19 is the first reading of civil citation program this is another tool in the toolkit for code enforcement and also for various other activities in town for which we can give a citation again it's the first reading so um you know we can certainly make changes on anything that you wish to change um basically what this does is it facilitates the process it puts somebody in violation faster than going to the magistrate and the fines are very similar because it is generally speaking 250 for a first violation and 500 for repeat violation um we also have a schedule of violations which is item number which is item number 20 um I think we would like to be able to proceed with the first reading even if we're tweaking something on the list of the fees or types of civil violations because we can keep adding to the Civil violations you know just our first list doesn't have to be the only list a question um thank you for telling us that the first goor round of list of of violations is section 20 and that my first question till I read further and I was like my was I would like to see aedle of the citations and then I read 20 I was like oops there it is we go so I kind of told you them both together because they kind of go together I really feel like they go together I mean it was a missing for me when I just read 19 I really feel like and then when I like I said them when I read 20 I was like okay there it is I really feel they to me for me to be comfortable with it they have to go hand in hand because to me it was you know otherwise you're gonna be accused of oh it's random or it's just me because they don't like me but if we have a a a published list of citations that is part of the document okay I think that would be really really and that's why we put the resolution on normally you don't put the resolution on until the second reading but we had the same conversation that said let's see the whole thing so there's no hidden ball it's all right up front and over right I think it needs to be all up front and so that we know there's uniformity and so that you know people aren't saying oh I got charged 250 I got charged 500 well you know then there's the explanation of why you got 250 and why you got 500 for the second thing is because you're a repeat offender it's not just because they don't like you and they like me better or whatever you know like they like you better no I'm sorry do we have any public comment we do miss sui Cuchi um I just wanted some clarification I was reading through and it's listed throughout the document it says says here uh if the penalty is paid it's deemed to be conclusive proof of the violation for the purpose of establishing a repeat violation if the penalty is not paid it's conclusive proof for the violation for the purpose of establishing a repeat violation I don't know it's if it's important you might want to get legal opinion but I would be more comfortable having a magistrate say okay this by deeming it as conclusive proof that this uh uh basically deeming it that it would be con conclusive proof of the violation for the purpose of establishing a repeat violation because repeat violations have different penalties um I didn't see it in there maybe I overlooked it but I think it would be more comfortable and be a little bit more binding legally if somebody tries to challenge this repeat violation creased fines or whatever so maybe perhaps if it's if it's not in there maybe we can have the magistrate just rule on in say okay the the penalty was paid this is proof that this is and and the next one will be repeat I don't know if it has to be in there but maybe it would make it more legally binding that might be something you asked the attorney hold on yes thank you is there any other public comments no okay do you have a question yeah I want to comment the whole idea about this is not to have the expense of the magistrate this is just a ticket okay you're correct and once you pay the ticket you're deemed guilty otherwise you wouldn't be paying the ticket it's like getting a speeding ticket you get a speeding ticket for $100 you pay the ticket you're guilty and the next time you're speeding your ticket's $200 because you've already gotten one that you've paid and to bring it the answer to miss sui's question is by virt that that legally by virtue of paying the first ticket that is the proof that's need and that's what the be unnecessary to get a magistrate ruling on top of it that is the answer correct question Laura what if you think you're not guilty then you plead not guilty and you go in front of the magistrate and you prove that you're not okay but right but if you're if you're guilty you don't usually go to the judge and say you know I'm guilty of that speeding fine and hit me on the head and remind me again I'm guilty of it I already paid okay and what I think was talking about is there is violation it also takes into consideration the circumstance where I don't pay but I don't appeal oh so I just blow it off that means violator next time if you're blow it off okay and then probably be bought in front of the magistrate because you didn't got it all right the the only part where I'm kind of uncomfortable here is hand delivered or certified right on give me an example please of something you would post on a gate that I could easily rip off and say never saw it or my lovely neighbor doesn't like me and they watch the code officer drive away and they run out and they pull it off and that way I never know about it Jack please come to the hard certified them but but you're then sending it certified and you're I mean typical code enforcement is you post a property that's deemed enough notice and and posted and I think we mailing as well so um and then even if someone's not home somebody's feeding the animals or something he goes hey yellow but you're saying somebody actually pulls it off and so you never really had notice of it you really didn't have notice I'll give you an example I have a friend who got subpoena to court recently and the service was done apparently they had a bin in front of their house for like um FedEx boxes and packages and stuff like that and the way that the papers were served was apparently the server went up to the house asked someone who was on the property if they would receive the papers for the other person that person said hell no I won't and so the got person got mad opened the box threw the box in the bin that person who never really sees the other person they're kind of like they're on different shifts didn't say anything while the other person finally said oh I'll check the package box they checked the package box and it was the day after the court date oops that the the thing was B they were not aware that it was in there okay so so I think that that kind of stuff happens and I think we need to you know but this is this again this is the general code enforcement statute it's you know 16212 this is the way the state says this is how you do these things and you know now ask our code officers to do something different than what they're doing and trained to do and the law says they should do so that's the only way they do it is by posting on the gate they they try they try to do hand delivery if you can okay and I'll turn it over to Jack to make sure but yeah they try to hand if they don't then your secondary source is post it in mail right cor right so it gets posted in mail so if somebody comes along and rip it down you should be getting the mail right I can live and back to the ordinance resolution thing I understand the the ordinance is the big picture giving the authority and then the resolution is the list and you can change the list with one reading in the future versus if the list is tied to the ordinance then it takes two readings to change the list in the future um I'm I'm totally on the fence on this I it started out you know PBSO getting them a ticket book so they could write tickets and now you're we haven't read the list yet but giving a a code enforcement guy um enforcing alcohol ordinance I mean it just a lot of this stuff I I I don't think a code enforcement person should be out there writing tickets um the m doesn't save money on magistrate that's not the purpose of it when you're go for the magistrate you pay the fee the $23.80 or whatever it is to see the magic trate and um I I just you know I grow my pasture it gets tall like about hey after it's 12 14 16 inches tall that's a direct violation of our code that says your grass can't be higher than x so some code kid that's got a a uh you know on a mission to go out and clean up the town sees this overgrown field says that's a nuisance and I get a ticket you would the magistrate side with me I would hope so but I I just I I just don't think writing tickets in this manner is is a job for the code enforcement staff I mean if there's a violation do an niov and go through the process the process is already there we spend months to get something declared in violation it's really a very long process and it doesn't bring us to compliance and it doesn't get us fines so we can probably take something to the magistrate multiple times without actually getting a fine and we might never get a fine yet we've spent hundreds and maybe thousands of dollars trying to get the compliance so we're spending a lot more money from staff resources and magistrate resources to get compliance the other thing is is that I'm glad that Captain Turner is still here we talked about this ordinance and I really think the only thing his staff his his deputies are going to be enforcing um is the alcoholic beverages regulation I don't think think they're going to enforce any of the other code stuff he's been very clear PBSO is always very clear they don't do code correct we we don't get involved in Code Enforcement like you said if you're saying your property or something like a homeowners association or a town the way they look at it with the the side of the house doesn't meet compliance being being painted or the grass is too long or people are parked a certain way that you don't want them parked but if it's a code enforcement violation and for certain other violations then yes once that ordinance is approved by the town and it comes over to the Sheriff's Office you run it through our legal people and it's approved by them that the whole purpose of the ticket book was never to have us take over all of the Town ordinances and and enforce them for the town it was to look at the ones that the law enforcement should be going after like if it's an under if you have a under 21 violation for drinking or cigarettes or something like that or like you said uh open containers and other items like that then yes but we don't need the ticket books anymore that because because we could put them directly into our system and go after it it right it basically print off the citation instead of having to take a book but we were never in line to take over a lot of the stuff that code enforcement in most places handle on a regular basis so section our our code for failure to comply with regulations related to alcoholic beverages is already in your your citation that's the code that's been approved by the Sheriff's Office in our system so when we come across somebody like Phyllis and I just talked about um or uh she brought up earlier yes we can go by that location if we have somebody with an open container then we site them right there on the spot or they they charge them and and bring them into the jail if they don't have an ID or other items like that so yes that's something that that's in the system and that we are enforcing so we don't need this ordance for you to do that that's my point this is purely giving code enforcement the ability to go out there and act like the HOA um officer and and start citing people for some of these minor things actually if somebody's got a building without a permit it should be a code violation and go in front of the magistrate you got to resolve that you don't pay a ticket for a building without a permit okay hey here's my $250 you can get I'm off the hook now till next time he comes by I guess I mean you're not you're not off the hook you can get a citation every day the thing with the this is getting ridiculous in my opinion it's the essence of council policy but this is just to facilitate getting things into violation faster and for instance some of the things with the RVs you can keep giving somebody a citation just because I got a citation yesterday for speeding and I'm speeding again today they don't not give me a speeding ticket so we can keep piling on these civil citations it's the same thing with noise ordinances that point for me how ridiculous this is I get a citation for a building without a permit I pay it right what did that just solve how many years nothing did that take and then stop yeah this is the Essence no no and maybe I use the wrong example but I'm talking anybody because there's a process to go through when you get that citation so that process doesn't start immediately when you get design engineering and all that stuff so I'm just trying to understand think the point staff is making is that by getting a civil citation which you have to pay right away if you got one for not having a permit you would then pay the citation and at the same time you're paying the citation say what do I need to do to get the permit with the point being that you would Rectify it right then within you know 24 or 48 Hours of when you got the citation instead of waiting three months or a 30 days before it can be brought up before the magistrate so in other words the writing the citations enhances quicker action quicker response on these things I'm not seeing it I see the town gets some money quicker and creates less cost to the town yeah but that that's what that's what they're suggesting that this would do so for building permits if I may um well not just building permits but also um you know and you're involved in all these um and I'm sorry I'm on the next ordinance looking at the list but um the you know fail to comply with Land Development regulations right that would be you to enforce that right and some of these other you know fa promote immediate Asos conditional uses you know so all that stuff kind of would be you involved in the solution I don't understand how this let's let him answer helps it any better than the goal is compliant obviously we want to we you know the goal is not to find obviously but we have a different tools for different situations uh always is goal to to to solve the case and not go to special magistrate uh and I know the lot most of the residents prefer to be not not not be here standing in front of special magistrate um so the way it works we issue stop recorder for work without a permit uh that gets that gets posted you get a red tag or work with work without a permit and if someone comes in and tells us that I was not aware of that I need a permit for shed then we're going to we're going to work with the homeowner if we post the stop recorder we're going to get ignored for some time this is going to create a code case we will create a code case because this is the only tool right now that we can use to to make someone to obtain a required by theate permit and then person applies for a permit we usually extend the code case because I we know the homeowner is working with us so we give you more time obviously you can get a permit within three days and then takes even longer obviously to get BL development permit for site development so uh case gets uh in a perfect situation case gets satisfied when a permit is issued not when they apply for a permit because a lot a lot of customers comes in applies for a permit and and that's the last thing that they do so we we want to make sure the permit gets reviewed and approved when you get appr proof permit and it's issued your violation is satisfied unless you let that permit expire 6 months after so that's that's how it works this tool will we encourage you and I'm not sure if this is going to be um applied every time on the first day that we find you in violation and you're already paying the fine uh because a lot of customers here comes in talks to us and will uh will tell us I was not aware of it I'm going to get my plans together and I'm going to apply for the permit and we create create a case in our system and we follow up with that now we haven't been following great with following up previously we're trying to change the right now that we actually will follow up with all the cases so we can satisfact satisfy them and close them at some point so they don't hang in a system uh unresolved but that's pretty much what uh so do you want the citations do you see them as a useful tool I think when I think the citation will be encouraging to uh to quicker action on on the on this on the part of the of the violators yes in that scenario you just ran through which I appreciate the process where does the citation fit in right away they go issue a citation you pay your $250 and then you come in and talk to you I don't think we we don't we don't have to apply citation on the first day the we if we if we uh if we provide homeowner with or owner with a currency notice um and he responds to it we don't have to apply the citation right right at the first day uh but but it is as a tool up there I understand that but that's not in here you know and that's not the way it's sprad and it doesn't you like Francine said we get the money right away and I don't think that I hope that's not the intent of it but if there was something in here they talked about warnings and then first offense second offense and there is also situations where we have a different different violators you know we have repeat violators that we obviously want to bring to compliance faster because we have a history of not compliance and there's there's legit people that actually didn't know that that that there was a requirement so you're you're saying Common Sense would have to Prevail as always Glen you had something you wanted to chime in just that on page 241 at section 1416 does say that there will be a warning un unless that's in letter A not letter B unless it's a health safety serious threat to the public health safety welfare or if it's irreparable so a normal a normal civil citation is going to get a warning first they have to but if it's serious then no then you can jump right to getting the citation something I was gonna make a motion okay make a motion to approve ordinance 202 24-17 on first reading second all in favor now we do we want to look at the schedule now or do we want to have them bring the schedule back for the next meeting and consider I mean let's keep them in I'm concerned about the alcoholic beverage thing being on there I'm not why we have I you know yeah we can take it off that's why it's really here to discuss it and take it off next time the alcohol beverage one is one that I see as his job not our job so you know um I'm also concerned about prohibited signs just because and I'm just concerned about it I'm throwing it out there because I know that signs have been used um as tools doing El as political weapons during elections here in lahi gr so it's just something I have a concern for and until our sign code is a little bit more refined and uh perfected which it is not at this time I you it's in review It's seems to have been in review for about the past 10 years so until it gets actually ironed out I don't think that we should have a citation for that because it may put us in a Sticky Wicket if we apply it in some places and don't in others isn't there specific rules in RS dedicated solely and exclusively to election in the uh packet book that you pick up there is but the point is the recent snapo with the election signs caused a survey of the town and we have 50 some odd people in violation of sign code right now so I think we're opening up a enormous can of worms that could affect a large amount of citizens right now and I think I'm just giving my opinion that I think this that citation should be pulled until our sign code is perfective which it is not at this time at this time our sign code is such that half the town is in violation so I think that until we get that cleaned up we shouldn't have a we shouldn't be violating anybody we shouldn't be co- violating anybody until we get it straightened out that's just my personal opinion I'm not I don't it's not it's not a dictatorship I'm just giving my opinion yeah no I don't disagree with that but there's a lot of code stuff that is either influx or doesn't apply correct and I I I also I mean personally I think the excessive noise is going to be a t because one person's definition of excessive noise is different than another and you might be opening up I'm just saying you might be opening up the can worms but whatever leave it in there I'm just giving my opinion of what I think might be a problem at some point but are old guys equipped to even determine that right have the right equipment it's like writing ticket I guess those would be ones that would be very infrequently because generally when something like a noise violation happens it's going to be you know like a 10 o'clock at night and you guys aren't even going to be out here anyhow so there's going to be nobody out here to do a decibal recording and and be able to determine that yeah I mean we I just don't want to put you in a bad situation right where you've got the person that's complaining about their neighbor who has loud parties all the time and saying you've got a you know calling in code complaints and violating them for excessive noise and there's no way to prove or disprove whether there was excessive noise well noise if it's if it's particularly like one you describe we can cooperate with the sheriff's office as well you know if someone says extensive party to late night and this you know Noise We also you know there's tools to to measure noise and we can also those are not expensive that we can also do that but this will be it will be driven complaint driven and and uh and we would you know react to the complaint and if we not there to measure at the moment you know we will not be able to address it okay so how about this how about if I suggest that before now and December 3D that each of us look at this list very closely decide what we like and what we don't like about it and and send that into to Valerie and she'll get that to starting point and as I sit and listen to this and I read it and I listen to comments I see a road paved with good intentions turning bad I thank you for the building guy to say this is reactive not proactive because that was a concern one of the concerns I have is rushing to do a citation then the resident has to go pay $250 to go to a magistrate for them to deem well shouldn't have been written do they get their money back let's just throw out an example because it's off the top of my head a noise complaint somebody is shooting on their property I don't know if they make a noise complaint I'm just using that as an example and then they get a citation written and they have to go to the magistrate to so basically they're guilty till proven innocent or they innocent to proven guilty because I thought it was innocent to proven guilty so do you see where I'm going I'm concerned that we're going to be rushing to do this I know we will have good intentions and I know why we're doing this but as I read it and listen to your comments and listen to the talk I'm concerned that this could be right for abuse and it seems to me more and more like a homeowners association to me those are just my comments my thoughts and I think when you go back and you look through that you have to think about that I took into account what Robert said I'm very against This Tall Grass thing and some of this other thing and I remember when the nuisance abatement came out and it was under Underwood when we did it oh Tall Grass they're going to run out and they're do oh they're not going to run out well there was I could go back and find at least four or five proactive code complaints for Tall Grass two were against Nina's husband on her property on B- Road um you're going to create distrust in the public my phone went haywire with text messages um for Neighbors turning Neighbors in for things and I've sent pictures to people somebody on Los Angeles got a code complaint for a fence there was nothing wrong with the fence and when the code guys were out there they said oh well that fence is on your property so it's leaning on your property we're going to write him a code violation the guy's like no he can't afford that it's nothing wrong with it I don't know if they ever did but you're going to sew distrust within the community in the town government that they're supposed to trust so we need to tread very carefully and perhaps maybe when we're doing these maybe we have to do them after they've been to a magistrate or after something because it's still not going to stop the magistrate they're going to have to go to the magistrate anyway so just keep those thoughts in mind yes if you pay finer you say it's wrong you're going to go to a magistrate right so if I get if I get cited for noise and I don't feel it's appropriate I'm going to go to a magistrate I'm going to take it to magistrate my point being just keep it in mind think about it my concerns and some of the concerns that I was receiving on my text messages thanks Miss sui please please ask your email and text friends to please send them to the town so we can have them and and know what we need to respond to I think that's big void here because we hear things like that without a context so it would be very appreciated and very helpful that your folks would contact us directly so we can incorporate it with regard to the Civil citation this is not intended to go ahead and start money making or to circumvent any existing process what it is trying to do is to declare a violation exists without bureaucracy so if there is an RV on your property and there shouldn't be you get a citation we don't have to go through the magistrate with pictures and stories and come back for two or three or four different times that you're going to remove it and you haven't removed it that's the point of doing something like this with a big nursery on um okobi that we keep hearing that we're not doing anything if we had a citation on it and we were citing them it might move a little bit faster with the trucks that are parked illegally we can do a citation for each truck I don't know if I said this with the RVs we can do it for each RV if they're not moved and I'm not saying that anybody's going to use this as any kind of muscle or any kind of HOA the the thing that constantly gets repeated in here about the four times a contractor from an HOA background went out in our town and did nuisance abatement and Property Standards he was admonished greatly and none of those things were brought forward and I am very sorry that he did that but that is not how we do our business we don't have enough staff to get out to everything that people want us to by having the citation we actually get a chance to get out to people and get the violations recorded not because we want people in violation even if they get a warning letter at least it doesn't have to go through a magistrate process which costs us time and money and when you ask why we don't have stuff resolved it's because we're still waiting for the magistrate to declare violation we've had trees taken down all over the place we've waited in some cas is more than a year that we still don't have a violation we have a conservation preserve that was denuded it still doesn't have a violation we have a back and forth on a stipulation agreement for two years and we still don't have a violation even where there were fines that were stated in the stipulation so this civil the Civil penalty and it's a civil penalty which we're going to change change it because these are code enforcement civil penalties now once we take the alcohol off um the Civil penalty is the item to declare the violation and not go through unnecessary staff time or magistrate time or property owner time and it is totally the essence of council policy whether you wish to do this or not but this is in no way and HOA because in no way would we be doing violations for anything other than the things that are our issues now and I give you the livestock waste we can't get a livestock waste through the violation lets us get a live stock right now public comment the only thing I could add is that I know you're on item 20 you already approved the ordinance of 19 but if you don't pay the fine and appeal you don't have to pay to you don't have to pay to appeal you do the pay the fine or appeal right so it's not about getting your money back if you appeal you don't pay the fine that's right correct you wouldn't be worried about getting the money back okay go ahead Nina Nina more of an educator rather than just a big hammer and then yes if you need the big hammer that's a different story but don't start out with that don't write don't write don't write laws and don't write resolutions don't write ordinances that are just set up as such and that was my problem earlier so um basically I just came up to go and tell you hey I'm not a repeat offender if something comes purchase order we cut the trees down so we wouldn't have to go through the Hoops like we did last time where there was an agreement with Kyle and there was you know X number of trees around town and some of us drove around and looked at them I mean this is just stuff that this is just for trees that are impeding roadway or drainage yeah essentially what the purpose of this agreement is is um over the last year uh there's been a few instances where we had to remove trees that were in swes or in feeding drainage or or whatever and we the first initial go around where you guys approved the 65,000 and tree removal we contacted actually four different vendors and K was the cheapest then the next time we had to do it because our process is anything over1 th000 do you have to get three quotes so every time we contacted somebody to cut a tree down for something we got three quotes and every single time Keel was always the the lowest price um so just to the point it's getting burdensome to try to cont because eventually the other two contractors are just not going to show up and then we can't do move forward move forward anything so that's all it is it's just we have over the last year we've contacted mult including contractors that are in the town out of the Town under piggybacks of other municipalities everything else uh we review the piggybacks that we reviewed the contracts that other towns have and I don't even know why they have contracts because their contract is call these three vendors and whoever has the lowest price wins so it's the same thing so this is just to expedite what you guys do and it does not apply to personal property correct there you go well if if said tree is on personal property and impeding what you guys need to do does this still apply if if for whatever reason we have to remove it yeah that's where we would use this okay Robert did you have something to yeah this absolutely should not be approved what you're doing is giving this a blank check for 200,000 to this company this needs to be bid we've known about this for a year these kinds of things go out to bid and you come up you do an RFP or RFQ and hour there's no hourly rate here there's nothing this just gives him 200,000 and I'm not saying anything negative about this company I'm just telling you the government has a process to bid these types of things way this is written Richard can give him $15,000 on each purchase order or panine can give him 24,999 this is the type of stuff that goes out to bid he's the only one that wants to work he bids on it he gets it but to turn around and hand somebody this when you've known about this for a year you tried to do piggybacks it didn't work should have went right to the bid process we've got to use that process this is not an emergency $200,000 is for an emergency procurement this is just staff not taking something out to bid and I don't think it's right um it it's it's this is not the way you use a super majority voting thing where you got to have four votes that's for an emergency that's not because we didn't feel like taking out the bid because other contractors aren't interested we've got to go through the bid process on these non-emergency high dollar things and I don't care if it's 500,000 when it's bid but to turn around and say you know four council members approved this $200,000 blank check to um this company and we can give it to $15,000 at a time or $24,999 I don't think is right I think it needs to bid yes so our current our current procurement policies allows Francine to approve $24,999 on a PS if I contact Keel and we get a price for $24,999 and fanen says okay no problem we sign it off because we've approved this contract fine if I want to cut down a palm tree that cost 50 bucks it has to become for this Council because if we spend over $225,000 on a single vendor in one calendar year the second we go over $25,000 it has to come before this Council put it to bid but a lot of these trees a lot of these trees are not something we're not driving this town is the eighth largest municipality in the in Palm Beach County we aren't driving around counting every single tree and a lot of times when we need to remove these trees it's because we have identified that we're trying to restore a Swale someplace because a resident has called and there's an issue now not 6 months from now when um we finally write up the ITB send it out a bid do all this other stuff because we want to cut down two trees at a cost of two grand Contra qu million do we might not even spend you want saying this is not an emergency we shouldn't be super majority bypassing the bid process to approve this contract the the $200,000 was an arbitrary number that was put in by our lawyers when they wrote this wrote The Resolution if you want to reduce it that's fine um it was just it's required in the ordinance it has to have a number and then we just they asked us we said 200,000 we don't I mean I think this year we're planning spending like 50 or 60 Grand actually at the next council meeting we'll be bringing forward the um the first purchase order for which I think is $30,000 we're not like going around cutting down half the town just because like I mean we just have you know this past year has shown that we have had to use Keel Tree Service about six different times each time we contacted three vendors a lot of times when we discover there's a tree that's dead or something is wrong we get a call from a resident it's not be you know we don't have months I mean I guess we do if it falls and hurts somebody then you know but if you know we don't have months to wait and this is why nothing gets done because you know you want to okay you want to put out the bit a single tree to cut down because we might spend $200,000 no misunderstand me did an annual contract nobody's going to give us an annual contract to cut down a theoretical tree that may or may not need to be cut down you get an annual contract on an hourly rate and different equipment is different rates they're not going to do that contract it's bid all the time municipalities this is not an emergency this this is being put in front of us as a $200,000 they need at least four votes emergency purchase orders the way it is it's no different than any other we have the system purchas we have tried to contact vendors we have looked at what other municipalities do and all of them every municipality does it the same way they have the piggybacks they have is you contact three vendors they come out and if the three Whoever has the lowest price wins even if the other two vendors don't show up that's how Gardens does it that's how Jupiter does it the Wellington has a specific contract and it's for specific trees and it's only for tree trimming the specific contract Wellington has is specific trees the trees have been identified and it's to trim those specific trees their their tree removal is the exact same process contact three vendors the vendors come out um and and that's it you know all we're doing is delaying you know when we need to cut down a tree it's because there's usually something wrong with it that we need to cut it down not that we just feel like cutting down it's not I doubt we're even going to spend 100 Grand with them say that about the process the bid proc not the right and like I said tree contractors don't want to come out please just put the purchase order on the next council meeting did you have something to I was going to make a motion make a motion to approve 2024 d77 second I I you're welcome um yes the only thing I wanted to bring up about number eight is that we're taking out 246 some OD trees and on finger in my eye on page 109 somewhere halfway down the page mitigation for replanting in the amount of $227,000 is required to compensate for the removal of specimen trees so again it's been so long since we've talked about this that money goes to the town or that money sits in the kitty until trees are replanted sits in the kitty and please tell me it's not going to be icky old palm trees um it's not going to be icky old palm trees do you want to go ahead and discuss yeah actually that that uh $227,000 is a is a theoretical uh uh value of a replacement amount and they have they have a couple a couple different ways uh where that mitigation can be accomplished they can they can either plant trees uh equal to or greater than the value of that 220,000 or they can make a contribution to to the town's tree mitigation fund which um based upon the way that we calculate that would be substantially more than the 22 7,000 that that the $227,000 that I reference here is is only um a portion of of the tree mitigation for this permit the the permit itself uh includes taking out specimen trees and non-s specimen trees okay we now we have we have to report taking out specimen trees because because the the town code says that we have to okay that that doesn't include all of the trees that are taken out on this site okay um if we have gone through the permit um and worked out a mitigation uh response uh alternative with solar Sports and that um that that mitigation response is essentially uh planting trees in the amount of about $135,000 and a contribution to the town's tree medication fund of slightly over $2 million two million $2 million $2 million okay yeah in addition to 720 that we already yeah that's right they've already on on other permits they have already um planted trees uh to the value of $400,000 and made a $711,000 contribution to the tree mitigation fund which is sitting in our account now yes okay yes phis you had a question um yes I do so um I'm very impressed with what has happened to the east of us Royal Palm put up a brand new Plaza and basically in a couple of years we probably won't even see it so why can't solar Sports start planting some of these trees in the front of the plaza in between Southern and their Plaza because it's very sparse we're looking at something called Wawa we're looking at something called A Car Wash we're look which by the way all the lights on these things are not sure they're within our codes and so why can't they add trees to in front I know it's not part of their site plan but it should have been so can we make them plant trees in between Southern on their property and their B and the businesses well there's there's several Alternatives which which they can they can propose in the uh vegetation removal permit and they can they can plant trees anywhere on the uh 90 acre Groves Fountain Center parser and and get mitigation credits okay what what they're proposing is this this uh vegetation removal permit really encompasses essentially two components uh uh number number one it's uh they're going to be expanding um Tangerine drive all the way through over to C Road as well as as uh one of an additional entrance Road uh that's one of the uh components of of this phase uh there that they're taking out trees to uh to accomplish the other the other component of this is is it uh they have to take out trees for uh for the um surface water management permit that's been issued by by the south Florida W Management District and uh and in total the the entire area that's that's covered by this this permit is resulting in them taking out about 1100 trees okay 246 our our specimen trees that has to be reported to the Town Council the rest of the tree the 246 plus the rest of the trees uh uh are taken into consideration in the vegetation removal permit the the um the the value of those trees taken um they they have several Alternatives they can plant trees to the equivalent of that value or they can plant some trees and and get a credit for the value but by planting those trees and then if there's any money left it's uh it's got to be used to um to to make a contribution to the town fre mitigation fund which is which is what what they're doing there there there isn't anything in our code that says you you can't plant trees anywhere else on the property okay so first of all why does um where they're putting in Tangerine is that like a straight line can they go around like some of the specimen trees like some of the Great Oaks a live oak is an a huge tree it's it's it's a it I mean that's what I'm saying I mean this is a road that's basically been mold over I used to ride on that road okay and then another Resident cut it off so why does it have to be it's two Live Oaks and 22 Laurel Oaks the Laurel Oaks are the smaller Oaks right more like a Shrub Oak yeah yeah let me let me just try to answer your question the the route of of of Tangerine has already been defined in the plat oh well I think which which which was approved by the Town Council well we approved a lot of stuff that probably we're not happy that we did or previous councils approved so I don't understand why that road can't Meander around those two Live Oaks where are those two Live Oaks I'm not sure you know this is again we've got a thing here a a a map but for the second time with uh somebody wanting to take trees down it's not showing us where the trees are thank you yeah well that's in the permit and and it's not in the picture we need pictures sometimes well uh well the picture the picture that you have on the two attachments is is a a very small uh scale of of larger documents that we have that go along with the vegetation removal permit and it's and it's very likely that that those two large Oaks are not in the Tangerine right of way rather they're they're up in other areas that are designated for the Water Management AG tracks and and that's the Water Management tracks have already been approved by the by the Water Management District well we don't know that right because you didn't bring those documents in with you like the bigger pictures so we could see exactly what's happening let me tell you what I heard last night owls okay my neighbors in the name of AG took down all the tall I gu there are slash pines the super tall ones then I didn't hear owls anymore okay last night I heard owls again all right that was in the name of pasture land for cows so the problem is our tree canopy and these are 246 trees and I going tell you what we give residents a harder time amen Okay so so I I don't want to see any Oaks gone I would like first of all I want to know where they're at okay um and then I would like to see some trees bring be brought up front of that shopping plaza because they put teeny weeny stuff in there and um right and replace livos with kusas or something right I mean I want to see a forest so anybody on Southern and this is the other thing noise control Mr fleshman I could hear Southern and I have Woods between me clear as day in the morning in the evening all right so it's also about noise control not only seeing we don't have to see the plaza we all have GPS okay everybody knows what's there so I I'm I'm sorry to say I like to keep things moving but I I want to see them I I I want to know where these trees are so we make the residents come back I'm I'm going to suggest we make you come back and show us exactly where these trees are Mar thank you well I had the same issue uh with these maps that are um circled in yellow I mean they don't tell me a thing about what the subject is which is the trees and the removal of them and and like phy said you know the the next one where which trees are where you know and and the other question is you know um are these um trees located in a NE ofi horse riding area no all right and is any what is the clearing being done for what construction is going there the there's two two projects as I have mentioned the first is is a completion of the Interior Road system of grown Center okay and the second is to clear for the uh surface water management um required by the south Florida Water Management District all right and where is that in the picture is that within those two Wiggly um areas uh to the north on page 111 uh well okay the map T 108 and whatever the map on 111 um was is a little bit an error and I'd like to pass it just shows you where both of the components the one that you have has just this and this is part of the water man so they want another big giant drve retention upon the one that they have there isn't good enough for South Florida that's what South Florida want yes so Francy this is to finish up the requirements of South Florida water M why are we can we talk to South Florida water management and tell them we don't want to take our canopy out and why they they've got I I don't understand why their dry retention Pond wasn't enough I thought it was going to be enough for their project it's not enough this is the original this is where all of the drainage is just a little bit stepping back here about this process it was a site planning process that was done many years ago right and in that site planning process the water storage was pushed up to the Northeast section of the property and 23 Acres there is for their water storage for the whole project I do not know why um so many trees were allowed to be taken down before um this point in time I don't know why the buffer isn't more sign significant than the little you know kind of little Hill that we have um I guess you could say a little burm um but that is how it was approved and I hear you about decisions being made that you would like to maybe enhance today and the good news is that I believe that you're scheduled to meet with the Groves at Town Center next week to go over their proposed plans so the these questions about asking them to add additional buffer or to perhaps not take down the oak would be good questions to propose to them now with regard to South Florida Water Management District we could certainly talk to them but they're not going to change their requirements for storage because we don't want them to take down those oak trees um one of the things that's coming back in front of you is section 87 in section 87 I believe that we propose that um a South Florida Water Management requirement is something that would allow someone to get a waiver in the future because you know if you have to put your storage you have to remove your trees that doesn't mean you don't get to replant them it means you get to do the tree mitigation for having to take those trees out so anyway long and the short of it is why don't we go ahead sounds like my drum beat tonight why don't we go ahead and put this aside until you do your one-on-one meetings and maybe they might want to change what they're doing I'm not guaranteeing that I'm not saying that it's likely that they will but at least that way you'll be able to speak with them about it but yes when it I'm sorry when it comes back I would like to see the same thing that we requ required from the last few residents I want to our Conservation Area yeah that was supposed to be cleaned years ago and there are a ton of Exotics over there when you leave Wawa and that's all you're looking at is occas and I drove down the road in the new Oaks that they planted which you're talking about dead they in the door now before the tornado I know the tornado skirted right over the top of them but I suggest everybody drive through there before you meet with them we can't enforce before we approve anything moving forward that they finish what they were supposed to finish to this point and they haven't done it yet yeah and they also need to clean up that area in between Culver's and whatever that other building is that they're pading up now um it it just looks so stupid to have all this um well it was damaged by the uh tornado but it needs to be removed and I don't know who's responsible for it it doesn't look wide enough for there to be another building there so they should clean it up and make it look like it to this is about time that we hold these developers accountable they follow rules in other towns and they seem to get to us and just forget um I do have a problem and I'm glad to hear this the 246 trees the 14 bald Cyprus and two Live Oaks and then we get a stick in place of that somewhere like in a little line somewhere it looks terrible I don't want to ever commend West Lake but I drive down seminal Pratt and I can't even see the 7-Eleven except for the red and green sign up on top um they sure know what they're doing developers don't seem to have a problem following their rules this is not oh please Mr developer what would you do no this is our rules this is what we want and um that's the way it is I had an opportunity to speak to South Florida Water Management on multiple occasions when I was researching FDA I don't know it it if the he misunderstood the question but when I was talking about you know Retention Ponds and their requirements and exemptions and things like that um maybe the the question needs to be asked if the retention Pond engineered needs to be a 50 by 50 we'll just say a 50 by 5050 because it's a round number does it have to be a 50 by 50 contiguous what if there's a bunch of trees could they not do 25 25 and 25 25 or make a u-shape around the trees do you have to mow over all the tree canopy because they want a perfect box I'm going to guess and the way I understood it I didn't exactly ask that was the answer is going to be no as long as you give them the square footage they are requiring per whatever the land mass is I'm going to assume they don't care if it's teardrop or um another shape I remember a resident came in on b-o and she was making her Pond this unique shape to keep to work around the trees cuz she wanted to save as many trees as possible but FDA was requiring her to have so much square footage for a retention Pond and the engineers were fine and I if I would have to go back she was on B- Road she's selling it right now but uh her Pond looked like really cool and she was saving as many trees why can't we require the developers to do that um other counties Martin County is very um proactive in integrating the commercial into the community instead of the commercial defining the community thank you for your comments I have to say one thing so Cassie I talked to Martin County today they have a 50% F on a 5 acre property I was surprised not a lot of trees she has to announce me first I'm take it away all right Nina quinning 2834 you wrote um so thank of thank you all for your comments because I'm glad to hear you're concerned about this one of the ways that you can have a better view at this is by asking for a tree survey and have something that correlates with what they're trying to do prior to the meeting so you can actually prepare instead of getting Hoodwinked every time you meet with them um the rest of us would love to see that too by the way now they got away with what I call murder because they got away with bulldozing and doing all kinds of things in that buffer way ahead of time as was mentioned there is all kinds of invasive uh invasive plants are still in there the um we could certainly use some trees in there we need to go and see what the height is of any trees that are going to be planted or transplanted and I and my husband have actually transplanted trees before so um there are ways to work the development better um my that to my detriment this property has taken advantage of the fact that it has been as wet granted we probably should have never permitted its development but now that we are here and that is gone we need to at least try to mitigate as many trees as possible we need to get more trees into the buffer we need to get the correct trees in the buffer and we need some sort of guarantee that those trees also survive because if you're constantly doing something to the root system you're constantly flooding it you're constantly putting it in an area where it can't Thrive then you're also going to lose that tree and we are really I think we've been much too easy at any of the developers Dennis lip I think said that was the one that said next door looked like Pig with lipstick that was his quote for next door in the uh uh palm trees that were left there we don't want to make the same mistake here and anything that goes into the tree fund has to be in the tree fund so it's a combination this this development has been allowed much too much and I'm glad to hear that you are in tending to be tougher on them than in the past thank you yeah I have a question um I would like to know when I do meet with them I think on Monday I'm meeting with them um how many trees were affected by the tornado as well and were any of those trees in this sight line well uh the tornado went through that property well well if there was a tree that was lost by by the tornado it's it's definitely included in this inventory because the inventory itself was done after the tornado no no no no before the tornado right long before the well I'm just taking him out but I'm talking about like Robert mentioned the dead Oaks you know when a tree dies it has to be replaced if it's in the site plan is that correct if if a tree is dead at the T at the time of of the inventory it does not have to be mitigated for per our code no I meant yes but if we the mitigation credit for trees and those trees that they mitigated with have died they have a responsibility to replace those that's were the first year we have that yeah 12 months 12 months so and since we haven't called them out they just get away with it they're not going to get away with it every buny has a 12 month time period that the trees have to live up until recently I don't believe the town went out and check the trees we have started checking the trees sorry for interrupting me and is it possible to get a tree survey by Monday yeah yeah I have that it's it's at a very very large scale which was not uh something that I could put put in the agenda can you make sure solar Sports has it when they meet with us yeah they have it they have it I mean and do you have it in PDF yes I do have it in PDF um but but still there's so many trees that you can't you can't really tell uh which numbers are associated with each of those little dots I I'm going to have to take their 24 by 36s and and and make the tornado because there there are trees in this uh Corner near where the bridge um comes across from sea Road uh that are are leaning over in there and they're not on the trail they're they're in identified trees that that have to come out as a as of that time and we have a mitigation amount for that now that tree may have died uh during the hurricane but it's still being counted as is having to be mitigated for because that's when they did the survey I mean I I mean if you want if you want them to go back and identify the dead trees that's going to lower the mitigation amount Robert is that your light on it's very hard for me to tell what the no okay all right I'm sorry I agree with Robert I say get rid of the Brazilian peppers and then see what you got to work with and maybe they won't have to take out all of those trees but I agree the Brazilian Peppers need to go especially talking in our conservation I mean on the whole property well they're going to do that regardless but but there a lot of occas and invas in our conservation was been still and the trees I'm talking small OES that they planted so they can't be much more than a year old if they're a year old and if they getting choked out by the invasives they're not going to grow as well also are are they responsible that's the are they responsible for the SE Road Trail and keeping it open the SE Road Trail the sea Road Trail is not pass I've had several complaints from equestrians in the last week and two weeks that there's Fallen trees and everything all throughout that trail so that needs to be cleared yeah okay well they they do have a u a a maintenance agreement as as part of the conservation eement that that says that X number of times a year they have to go through there and and clean it out maybe they're behind schedule on that I I don't know but they just had a tornado maybe they need to go check because keeping that trail open is a responsibility of theirs so you just had a tornado go through your property you have a responsibility to keep the trails open and it's dangerous for horses should try to pass in there right now okay so that needs to be taken care of yeah I'll make sure that they know about that but so will I but it is their responsibility and uh and they do have a a contract a contractor to do it they've got to notify him to do it though perhaps right after a tornado goes over your property is a good time to notify the contractor that it's time to clean up dead trees correct okay so I would say I would say Eight's going away um all right let's look at nine foreclosure lawsuits will be filed only upon the approval of the Town Council why is that our job why does that land in our lap well if you want us to commence litigation I mean if you want someone else to make that you can uhhuh okay but it's really you're the ones that are going to be saying go file a lawsuit and we generally don't file a lawsuit unless you approve it but if person or property X has done two or three egregious egregious things why do we have to say woohoo especially when you have three conditions on which you're able to do it yeah right if you want to say that's the manager's authority to authorize us to do it that's fine well you've given three criteria why should we have to vote on it if there are three criteria that we voted on that are the criteria I don't understand why I mean that's just holding it up for it to come to us once a month to take a vote if the three criteria are met do it okay because there are there are economic considerations one of the things that um you would have to make a determination on is whether it would be worth it you're going to be expending monies you could be expending consider monies on litigation um and what if there is uh the property is is worth $2 million um but there is $1.6 million mortgage on the property those are the kind of business decisions that you have to to make or should be making Mak did that answer your question it does but I don't like it neither do I NE do I B go ahead does make sense yeah I have number three stricken yeah that's the conditions on the property pose a substantial risk uh to the life safety or general welfare um and I don't remember why I've struck I struck that uh and I was sitting with you when we discussed it yes when we were discussing it the the idea was whether or not that really should be a a criteria because at this point in time you're dealing with somebody who is not responding to your code enforcement process um and there's a lot of just pure business except risk one or four of them so you don't have to prove all three of them and why not leave it in there because then if there is a life safety one like say you know an amusement park that's running with containers stacked on top with each other you can do it right away with them that is a life safety issue why would you why would you I couldn't remember possibility if it said you have to meet all of the criteria I would get your point but I don't get get your point when it says you just have to meet one or more of them I I don't see why not leave it because it just gives us another Avenue good point if about the million dollars you know you have $100,000 lean in a property is worth 200,000 and it's got a 250,000 mortgage that's the business decision so those but there may be a case problem with what constitut um life health and safety there have been some things that have been passed on health and safety in the past not doing your time it's been some time back that in most people's eyes are not health and safety so this is it's important that something like this gets taken seriously and somebody's not being for closed on for just about nothing and if you you you pulled some of the the agenda items tonight that would potentially put people into foreclosure as well because they could have lanes for some of the items that got pulled I think you know which one ones I which case I might exceed the spending limit by getting the appropriate chemicals that are necessary to take care of that fire um if we had an active shooter you can't know that somebody's coming in um and with the storm we're not really taking any undue risk because all we're doing is following the course of events once the state and the county declare we declare and all it really is then is Administrative so the other ones are for the unanticipated um variety and the other is for the Simplicity of administrative functioning all right because my little brain did not go to car accident chemical fire active shooter so yeah all right I was just stuck on storm thank you correct me if I'm wrong I believe during this storm one of the things that we learned was that there what there were some buyers let's see glitches in the chain of command regarding declaring an emergency because one of the things was activating C and because they didn't feel like they were activated that they had to be civil so this would help to clarify that correct sure it will and I will always go ahead and activate them from here on out but just for the record because you know that's important to me I do c does not require activation by the town per well we are going to have to change things in their manual and in their agreements because they can self-activate at any time right so that's just one like I said we handle everything beautifully I'm not being critical in any way I'm just saying we learn things that you know they're sitting around waiting to be activated you're feeling like they should receive during that time should be related to that particular emergency not be a blanket statement and then also um there are in two places you said which may be extended as necessary for Town manager's discretion in the whereas and then on section two you've got the which may be extended as necessary in in seven calend increments but at the Town manager's discretion so again it if the emergency is still active then it should be in reference to that emergency and it should be only the things that you really can't convene on in that time frame to take care of the emergency um you know you might like Francine you might like the next manager you might like the the manager 10 years from now but this is not something that that should be written in a blanket way um you don't know who's going to be sitting in that that chair and and and you have to be careful with those Powers it's not directed at Francine at all thank you can we change this at any time thank you any other Council within a few days I mean I've seen Council meet in a couple days so it's not against any one person it's exactly what she said it's extending um the oversight away from our elected officials um we did not become a town to be like other municipalities so we shouldn't make our rules to accommodate or be like other municipalities so I would suggest that we don't have the extent attention at her discretion and it it it has oversight with you guys which is our elected officials I I think the seven days goes back to the original other stuff if it is a name storm that state of emergency may turn into declared disaster and we are going to be following whatever the county and the state do so administratively this keeps us in compliance with regard to another one of those mercies um I think the reason why it's 7even days is because you might have some lingering things that have to be done it really again as every single item that comes in front of you it is the essence of council policy how you wish to do but for efficiency and you know for high performance the way that we got some props for earlier this evening I think that we're recommending this because it's the way to go anybody terms of the fact that he's a resident in town that and that he's Homestead yes but in terms of his background um I would think that members uh council member sh could announce what that is okay Mr sh why is he qualified to sit on the ulc I think that's what Mar is asking okay what what are the qualifications for ulc you're a resident and you care about the town um specifically he's lived here quite a quite a long time um I think there's I think what she's getting at is that there are some things like in the CH that where the well what are they well I didn't know if you were asking about his background yeah yeah because I don't I don't I don't a resume on him so I can't speak to his background but his POA sheet is attached so you can see his address um I think the issue is that maybe Marg is getting at is there are some committees like I know on the fact that within the charter there are qualifications Beyond being a resident Beyond those things there are qualifications yeah there are ones and I believe the question she's asking is are there further qualifications than that for you ulc no there are not any further qualifications for ulc it's just whoever the council person wants to to appoint if there's not within the charter further qualifications than that they live here and they have not a professional background requirement or anything like that okay that that these forms I don't see any anything addressing that um and the other issue was if it's not in a flood plane why are they required to fill out the form if they're doing something that's Bonafide egg so that was the question I had under the first reading and the same thing on the first reading was the confidential records do they just fill out a name and leave everything else blank so is that going to be addressed I'm going to answer those questions we do not have anyone registered with the town requesting confidential records we did provide the form to two people who talk about it in the ones tonight um the only question that I had was on the notification for minor Phill activity um you have a a a things that says minor fill duration this notification is valid for 24 months and cannot be resubmitted until after that time period passed I don't believe that's reasonable because like I'll give you an example I just brought in one load of fill because with me moving it in a wheel B by hand because my skider is out of order right now um one load is pretty much all I can handle for a while okay however that doesn't mean that six months from now once I finally get that one load dispersed that I'm not going to want another load and the way I read this and is that with my five acres I'm allowed to have four truck loads right but this is saying that because I just got that one truck load I now have to wait two years to get my other three truckloads that I'm entitled to so I like that part yeah we'll fix that that needs to be Rewritten in a way where you know you understand what I'm saying okay all right well on the form it says requested Phil volume if you want four truckloads you write how many cubic yards that is it request truckloads I only requested one truck load and I called the town because this was in order and notified the town manager that I was bringing in one truckload I don't know whether it's going to take me six months or six years to get that one truck load filled out okay right now it's looking like years okay but I'm hoping for six months but I'm not GNA request four truckloads when I don't when I don't know that I'm going to use four truckloads but I am hopeful that in six months I'm going to be able to bring in another truckload and address some other problem areas I have right now I'm just doing chicken gops but I still have stalls to do and I still haven't even addressed as Robert says what do you call them your burrow holes for your for my horses in front of my Gates I haven't even like that's that's that's like not even but that's something that I do know I have to do as soon as I can get that dirt moved by hand or get my skiner back in running okay if I get my skider running maybe I'll bring in four truckloads on what you're saying so person X buys a proper property and it's an eight stall barn and due to Elevation four of the Stalls are not in the flood plane but the other four are or are in lower level of roof well again my understanding of this permit okay is not that this is a re requires a review or anything else this is like an honor System thing where I'm saying I'm bringing in a Lo of Phil or I'm being for Lo Phil and these are the purposes that I'm going to use them for why am I doing that why am I notifying the town not because we're in HOA not because we're trying to be Nazis so that if Phyllis who hates me says neita Kane just brought in a load of fill and calls that in as a code complaint instead of a code officer having to come out and see that I'm filling my chicken tens with sand she the the code officer can look on this form that I filled out and said yep Nita Kane brought in a load to fill and she told us she was doing it and it's perfectly fine she's using it for her chicken pens thank you for your comment phas you know find some other way to hate your neighbor that's what this that's what this is about is to try to get rid of you know some of that just like you're ripping your notifications off the side and did I explain that right is that okay that is my understand it's purely voluntary but it's to cost the town less money and cost us each as individuals less money if you don't want to do it don't do it and then get the code complaint and then have to deal with all that process no no no so um my understanding also is that we have to keep records for femas so FEMA thinks we're doing our oversight and because if they think we're not doing our job then FEMA we're GNA have a huge problem with trying to collect our money from FEMA so also I would like to say regarding the 24 months every horse farm that I've ever leased has to replenish every year every year they have to bring in fill and replenish so I think asking people to skip a year you're they can't do it I don't think anybody's asking to skip a year the sand ring is a pass and then the fill is separate from the sand ring just take a 24 months out and 500s yeah we'll take it out I think it's 12 months at least annually Lo every 12 months I think the intent of the time and the like so it says requested fill volume you could put 20 20,000 oh not 20,000 but whatever the 80 cubic yards which is the maximum if you get one truckload you get one truckload it doesn't there's nothing on here say you have to take everything that you say you're going to put on here it's a maximum and then the time is the maximum time so if you plan on using that 80 cubic yards over 22 months then we know for the next 22 months you're going to be bringing 0 possibly bringing up to 80 cubic yards into your yard to do whatever with um I yeah we could CH we could take that off well there's got to be a maximum at some point you can't put it on there for like the next 10 years no per yearn perod calendar year from when you bring the first you can't when you if you get the bring the first L on January 6 you can't bring any more than three additional loads before the next January January 6 okay right yeah because you you can put on here you know indicate duration of time yeah this table needs to say maximum fill amount in a 12 month period thank you I think that I think that um is the intent and yeah so then just everybody will be compelled to have to come in every year yeah because I think the I think the intent of this was if you wanted to bring 80 cubic yards over the next two years and maybe use 40 cubic yards per year and then you don't have to do this once every two years we change this to 12 months and you're gonna have to do this every year I think that's what people do okay that's fine as long as I just want to make sure you guys that you can't expect I mean how could code manage it for two years that's just silly do it do do it annually annually do it annually and then people will follow the honor System and and say yeah maximum fill amount in 12 month period so it's a rotating rotating 12 months get rid of the 24 months on both Point all right we updates that would be you Francine no it's going to be Jeff you Jeff okay your name's on here I guess this is a special project yes there it is all right um try to be brief with this you the water control district is a 298 District um every five years you are supposed to review your water control plan the water control plan is the operating plan for the district um the last time the water control plan was reviewed was in 2018 prior to the merger um so it is time to review the water control plan one of the things that happened because of the water because of the merger is that the boundaries of the district um changed uh they no longer include the area in the Southeast um the the district still Services those areas but those are actually not within the jurisdictional boundaries of the district so obviously there's going to have to be an amendment to um the plan to reflect that change we have also noted that uh duck pudle the duck puddle property is different than most of the other property all the other properties in the um in the district um so as a part of the review of the water control plan um we'll present those differences talk about them and see whether not they should be treated differently just because they are different doesn't mean that they should be treated differently but we need to have that discussion and and have Direction on that um the other thing that we have talked about um and Richard has talked about and is uh the conveyance issues that we have had um there's what is it it's over a hundred roads that are not um part of the grid uh pattern that we have those those uh roadways almost all of them have drainage issues of one sort or another um we've mentioned the the 5050 plan we've discussed some things um that haven't been fully adopted yet as to how we can address some of this but those are issues that um we need to talk about in the water our control plan um and see how uh how we're going to handle those um so the there are a number of issues that um have to be reviewed the uh process ends up um being a process in which if you do make an amendment to the water control plan there are at least two public hearings um the whole world gets noticed or at least the whole District actually does get individual noticed um there are a number of timing issues that you have to um deal with in terms of advertising and you also have to give um South Florida Water Management District 60 days notice um before you can finally adopt um the reason we're bringing this forward at this point in time is to let you know that uh we plan on moving this forward uh the formal the um formal notices have not started um but we will we will bring that uh to you in the next couple of months and this will be a regular update as to where we are on it just wanted to let you know that we're initiating this process um and ultimately you all will make the decision as to whether not to amend the water control plan and how they're amend the water control plan okay public comment Nina Nina calling 2834 e Road I want to get some attention to the second second third page of item 20 um two uh number six and number seven um so and then the comment made today regarding roads that might not be on the plan or we have an assessment that is per acre per acre that does not discriminate between a residential whether you're on a uh one of the letter roads or not so we're all paying into this and I think sticking with some of that is a lesser evil than trying to start taxing by Basin or making up basins that we haven't really looked at yet uh properly and figured out yet um I mean I'm I'm a bit concerned about the potential of that changing um I think we are all comfortable and we're not ruffling any feathers with the per acre assessment um and you know we're taxing our folks quite a bit um we're going to stay all alive if we stay closer to what we have than trying to change this and get in certain areas text higher um I understand that these small areas are probably paying less taxes than some of us who are large track owners I I get that but I'm still more comfortable with that than rather saying here's this Bas and you pay this much and here's this Bas and you pay that much so that's a bit of a concern that's coming up with this thank you so I don't remember um got a little nervous when I heard you say duck puddle and how different it is how is it different does it not have dirt is there something under there that we I get that think big thing is the way it drains and that it doesn't it doesn't put water back into the system it does the on the side it pulls out of our canals and dumps out okay so that is what needs to be re-evaluated well alt mins they are they don't flow out they have alman's Nursery one of the like one besides duck puddle our second biggest land owner in town so their Nursery I believe has a ditch all the way around it and they have to retain their own water as all nurseries I believe are supposed to retain their own water but they're ornamental the difference is duck puddle is I believe an organic farm so duck puddle or not duck puddle every other Farm in the town I mean literally every other Farm in the town um the water returns to the ground whether it be through percolation or direct going into a Swale system or something like that duck puddle if you drive down Southern to where the aate is and go look in the the discharge side there is a pipe that comes from Duck puddle and goes after the gates so they suck probably a million gallons or more per year probably more than that per year or whatever amount and then irrigate their farm and then dump it all into the c-51 and then we turn pumps on and we pump it back into the canals so they can pump it back into their farm so they can dump it back into the C so why don't they just pull it out of the c-51 because their property isn't near the c51 all right so how they dumping into the c-51 because they have a if you drive by next said go by there and look you'll see that there's from their Farm they have a Swale that runs between their driveway and and the a canal burm that runs all the way to Southern Boulevard and has a cold oh and they're dumping that way right they're dumping directly into C into the well basically they're dumping into the c51 directly and do they how did they how did that happen did they get a permit for that they have a they have their own they have a dependent South Florida Water Management District permit okay and paying for the water they pull out of our canals just through their assessments they're paying so they have a dependent permit that's dependent on our permit so their permits dependent on our permit all right and are you in conversation with South Florida Water Management to try to correct this it's been like that since they gave them the permit I mean we you try to correct it because what's happening is when we're in a drought water is not getting to the north end of our town because one land owner is sucking up all our water more than so that's what I'm saying are you in conversation that that's that's one of the reasons that we will'll be looking at the water control plan and potentially making some adjustments um to deal with that situation so have to have a plan to potentially input uh or Implement something um along L of you put it up and put the water back in and you ship it if you have more than 20 acres you have to get blessing from South Florida management for an FDA okay so why are you not already talking to them the conversation with this particularly mentioned property was started long before I got on the district and in 2015 uh Mr yoy and I took a walk and met with the owners and it was suggested to them instead of taking the water out of the canal and flushing it right you know past our system that they drill their own well and they basically looked at us and said no okay so I have a question we could not use um we didn't have enough maintenance easement to be able to have for a trail because the horses were going to poop and contaminate their Peppers so how do they know that the water coming out of the canal which by the way probably alman's leeches into our water so I would imagine that our water is probably not very pure there and possibly could be contaminating so shouldn't they be concerned about that if you can't have a horse riding on the thing but yet they're going to suck water out of our canals oh by the way after we spray them and everything I think that this is one of the reasons why we're going to go ahead and do a little bit more review additionally we did have South Florida out here on site this year to look at that particular issue so we are going to address the water quality as well as as the issue that causes us to be short on water and also exceed our permit because since they do not put water back we have to pump more so we can't exceed our permit that's really the issue the water quality exceeding the permit and circumventing um our system so sorry yeah um when's the resiliency going to finalize so you have information to use for this because you're trying to get this by March correct way before March well we're trying we're actually we actually have um a call with them um I think sometime later this week to get another update I think that they have to um still finalize a great bit of work is that true Richard well per the schedule I didn't think they were going to be done till last March yeah it's GNA be like March next year but they have to do the now they've done the ass the initial assessment and identified where all the CTS are now they're going to do the individual culbert assessments um and then basically put it all together yeah they're also looking at Basin and we've been going back and forth with them talking about um you know how to actually look at them that's critical information updating this absolutely we agree we agree whatever you're about to say could you please make a motion to extend before you say it motion to extend second are you done um Richard tell me if I heard you right or wrong um when you were uh summarizing you said the boundaries of our formerly independent District changed they did not that's sorry it's late um sorry sorry Jeff yeah um because that's part of the relationship pickle that we're in with one of our neighbors okay so that our boundaries have not changed but they need to they no our boundaries did change by virtue of the special act your jurisdictional boundaries did um and with respect to the properties that are uh in unincorporated Palm Beach County you have an operating agreement with them County okay but one of them did not change when we became dependent it's just that the the the area within the that is actually within what is theah hatche Groves water Control District did change um and it and it excluded those areas is on the on the south east now we still service those areas and with respect to those areas that are in unincorporated Palm Beach County we have um an agreement with Palm Beach County that allows and provides for the service and collection of Assessments in that area um with r Palm Beach uh there have been discussions about an agreement but we don't have an agreement at this point in time okay thank you okay on to item number 23 that you too Jenna I don't think so that's rich that's the other J saying is that you Jeff so this is the discussion on road and drainage um it is obviously very short because we've been rather busy the last month doing anything but Road and drainage um but you know currently we're working on female reimbursements um drainage retrofits um and all the other items on here that I'm sure you don't want me to read one anything you feel compelled to point out to us or are we good any I I have one item that I feel compelled to point out we we actually identified that we had Canal bank damage on e um you had what we had we sustained Canal bank damage on E the tornado hit our banks actually CD any yeah you know you're right the list yeah we have it on the list and um we are not sure about the mid whether that whether they're opening up Palm Beach County to mitigation funding or not but we're going to try our best to get that damage restored the tornadoes were yeah spawned from the freaking hurricane okay any questions on this item everybody's good with that okay future agenda items anything you wanted to bring up or um I wanted to bring up that December could be very long having moved a number of these items to December so I'm gonna go back with Valerie and sit down and revisit no no but a lot of the items that are in December are follow-ups to the item it we started tonight right right right that's what I'm saying we might have a very short meeting in December good news um so we'll see about that since I'm on my my tab let me just go ahead and give you a couple of quick comments so that we can move on to adjournment nice and swiftly how about that okay um much to my chrin I wasn't able to um get Kodak Black to come to Town um but uh I spent my whole weekend on it and so did um so did Richard and Craig um and Sammy um all trying to make sure that we explained what our requirements are and why we can't have that kind of event um without a great amount of advanced notice I think the important thing I'd like to point out is the event was originally proposed with a 48h hour turnaround time for almost double our population 5,000 people on a 10 acre property off of one of our lettered roads um it sounds big sounds big um we were also told that the property often accommodates up to a thousand people um I think that one the things that this made us realize is that we are probably going to have to ask that agrotourism committee to talk about setting some actual metrics because when you think about it if we only have you know 3500 people here a thousand people yeah I mean it's like how can you do that the other thing we talked a lot about off-site parking and a lot of stuff with regard to make making sure you have fire rescue and PBSO couple things I want to point out with the president having announced that this is essentially the second White House um here in South Florida um there isn't a lot of PBSO coverage we couldn't get but a handful of PBSO um to be you know on our parade which you know in the past we've gotten quite a lot um um they're busy they're all working OT just wanted to mention those couple things because it's like several issues that kind of come inside um Council had talked about um stepping back the questions with regard to development or good ones um I don't know how early development was approached I don't really know um I do see your point on a lot of the things that you talk about um for that very same reason since we have a lot of people interested in coming on Southern Boulevard what we have done is we've called Treasure Coast Regional planning Council to see if there is any way that they have um any kind of grant funding Andor capacity to kind of Corral the development happening on um Southern Boulevard and given council's direction to evaluate a business improvement district we are trying to get a proposal from them to see how we would be able to look at all of that before the development overtakes um Southern Boulevard what do I mean by that um let's just take properties that say they already have enough traffic counts to do what they say they want to do well traffic counts are great but if we have tremendous you know um gridlock because of what's happening on other parts of let's say your lettered Road and Southern then that's not going to help unless the traffic traffic circulation is looked at and since we have a lot of people coming in off BNC with proposed developments happening on BNC then the question becomes do we need to have have another traffic light what do we need to do to realign some of the already approved development circulation that isn't currently working Publix Wawa rest of groves at Town Center so on and so forth so that's why we're kind of trying to step back and look at it from the bigger picture point of view I guess what we're thinking is that um to some extent the bigger picture look is part of the development process so I'm trying to get a proposal that we can put back on the agenda and talk to you about um it's very difficult to approve these individually without looking at them in the hole um on the agenda thank you for approving the um support for the transportation master plan for the county I think that that is um the County's process towards evaluating whether they're going to do um a transportation tax as opposed to the infrastructure sir tax um we will be um represented I mean I felt like you know it was good to be able to be part of the discussion um making some points with regard to the unique characteristics of our community and that not all communities are going to fit in the same you know slot or hole so there should be a number of community meetings and they're supposed to include up to three unique Community meetings separately I don't know how that'll roll out um we Richard did mention it so I'll mention it now he sent you guys a note this morning about the 162nd guard rail put up by itid um we have annually sent the interjurisdictional letter telling them that you know they can't telling the property owners that have access to 1602 that they may not access 162nd and that their access needs to be through 161st or a depending where they are um right now we do have a number of property owners that um are going to have an issue um Richard and Craig are talking to them we didn't get any advanced notice that we would see the guardrail up but we didn't know it was happening we just didn't know when or how soon there are a very small few um residents that actually had and kept their permits seven okay so they are not going to be blocked they are not going to be blocked seven property owners that were part of a lawsuit that had annual permits associated with it are not going to be blocked but all of the rest that were not part of that lawsuit do have the guard rail and are blocked so um they have to work with us to try to reestablish their um Eastern access um one two the council people brought in goodie bag goodie packages of their memorabilia and very ious historical type stuff um they have value value for multiple reasons not just to put together um some great base for our you know historical preservation but also some of the stuff when you look at it has interesting information and I mentioned to somebody earlier I have Richard on a challenge to find some stuff since he always seems to be able to do that so if anybody has stuff that would be great particularly if you have stuff on Trails um we are planning to try to apply for another Trail Grant in February um so whatever you have on that would be great to have and anything you have on previous Canal projects that would also be terrific but of course anything you have would be fabulous and um you know I um just wanted to say thank you again to the staff I thought thought the weekend was a beautiful event I think that doing that while still recovering from the storm and starting the new year pretty amazing stuff so thank you to everyone too bad they're not all here and thank you Council hey Glen you're up I have a really long report have a good night Richard you already reported so as freen Stein said on 162nd we were uh we found out at 9 o'clock last night when Facebook blew up because uh everybody's like what are they doing with the guard rails and started blaming I members who didn't even know about it either so apparently their own staff didn't tell their own board uh that they were doing this so till I called one of them last night and she's like oh um yeah there's three res or three properties um that are on 161st 162nd that area there that did not have established driveways uh one of them I had to informed them they did have an established driveway it just hasn't been used in a few years so they just got to mow the grass and they should be able to use it um all of them have come in and you know to to get a driveway Culvert you know the driveway Culvert hermit they need to access 160 first and we're working to expedite working with those specific residents to make sure that they have access to to their properties we're not going to you know be like Indian Trails and just slap up a guard rail um the uh other stuff that we're doing you know like I said our staff did a really good job after the tornado um you know I've told them numerous times um the the work that they did during uh before during and after the storm and they continue to do every day I'm very proud of our staff uh in public works and especially Craig and all the work he's done all all of our staff members and just constantly trying to improve this town um other than that I don't have much else thank you Richard okay Valerie okay for once I actually have a few things to say um but I'll make it as quick as possible so today um started our qualifying period at noon uh for seats 2 and 4 uh qualifying ends next Tuesday the 19th at noon um I implore you that if you are interested in qualifying please make an appointment and see me as soon as possible um because there is a process and there are things that need to be done off site and back to me um by a certain time um again if I'm hoping that you're thinking it's better I'm I'm thinking the content is better but you know I I mean I'm I I love advertising and marketing our name needs to be big and our logo needs to be do that because our residents are missing our turtle that got you on that I'm sorry sorry Carlos didn't like the turtle but he doesn't put that big turtle back um and I also had a resident mention that the election information was not on the um on the website we added a whole page and updated a bunch of information on there today no not today it's been up there okay well I don't know why they didn't see it well we'll make it a banner up on the top that's it for me Laura if you can't say it enough you just keep saying it again thank you Richard and your crew for everything that you did keeping us safe and getting us up and running and still what you're doing Francine and the office crew you know that's a big part of it too so thank you um I think a lot of people don't realize how much actually happens behind the scenes you know I mean a lot of us were're we're scrambling so you know again it's it wasn't unnoticed Valerie Fab job on Saturday really really well done lot of fun um I'm looking forward to next year and then I have one question what what are we doing with um are we changing from AT&T to Verizon what's the what just explain to me what are we doing that's it so currently we have AT&T for our um town-owned cellular devices as well as the iPads um one thing we since I've started here is that these AT&T phones don't work in the majority of the town so I have my personal phone is a Verizon phone and I find myself using my personal phone for Town business more than I use my town phone for Town business because this thing is nothing more than a glorified paper weight so um I we contacted Verizon T-Mobile and AT&T which are the three big ones uh AT&T we already decided because of the issues we already have you know it's a problem uh T-Mobile wasn't very responsive we contacted Verizon so they're actually coming tomorrow morning um and basically what they're doing is they're giving us a $200 bill credit for for porting our numbers over so we'll get $200 credit for SE for the seven devices sell your devices we have um they're going to replace our devices for free right now we have iPhone 12s are going to give us iPhone 15s for free and there's no contract they're just giving us the devices um then they're going to transfer all the iPads to Verizon the um then we're purchasing two additional iPads that were we actually had in the budget this year um were part of our in our budget um and then what else oh and then we're also going to be part of the the uh Verizon Frontline program so all of our devices will be preemptive which means that during an emergency or anything else our devices will work before the general Public's devices uh similar to the way law enforcement fire everything else Works um so that'll obviously help us out a lot during an emergency uh with communication um and like I said they're coming tomorrow to uh Port all the iPads and start on the cell phones do I have to back up my data on my iPad and I apologize for forgetting to bring it theoretically no because uh what we need is the um when the guy comes what he does is he just has to like change the SIM card basically to from AT&T to Verizon in an iPad the yeah so theor it's digital theoretically the data on the iPad stays the same and as long as your Apple account is backed up everything should be backed up to your Apple account you don't have to worry about it because yours is still clean yeah okay thank you Robert all right thank you um I had a property got hit by the tornado and my neighbors and uh they've been doing a great job picking up the debris coordinating where to put it and uh they've uh we put out some big stuff and they've been taking it away thank God because a lot of big stuff went down um Paving great job e Citrus grber saw on the report Casey's next how close is that this week oh this week all right awesome good job uh yeah parade went great thanks Public Works the guy set up the cones and we had one sheriff with us and uh thank you to Groves Community Foundation for purchasing the medals we gave out 46 medals so that's basically how many participants we had um so awesome [Music] um you as for it you got it RV and now FDA permits you know user friendly for the people so you know you don't have to go through that big process when you're just you know filling in holes and and doing small um project so I think that that's that was a a great thing people need to use it now and uh not end up uh with a $250 ticket so uh that's it election coming up make sure you qualify you got to go open an account at a bank and that's usually the thing that takes the longest so get out there and get that started because it takes a couple days to get that ball rolling that's it thank you thank you robt okay um has any anyone address the U confusion uh of the postal uh name associated with 33 [Music] 33470 when I have packages that are um coming to me I I get a um error message because when you enter that zip code it lists three different places and what I'm assuming is that because W like has has a higher population they're just sending everything there and a lot of our stuff is getting lost in the in the shuffle and I'm wondering what can be done to get our identity back I mean it was our post office since what 1917 you know and I feel like we're being run over and being forgotten so I don't know what what can be done to to help us out so in in reality um as long as the street address and the zip code is right you could write anything for the city and I actually proved that to somebody once um that the city they don't look at the city thing they look at the street address and they look at the ZIP code that's it those are the only two items they look at sometimes they look at the state so when you get a message on your phone stating that you have a package and they can't deliver it because of a zip code error and you know the zip codee was correct so is it fraud is it what is it that is probably a fishing that's probably a fishing email that's exactly a fishing email yeah uh there's the they're do I get them all the time for I love the ones I get for Wells Fargo says my Wells Fargo account's going to be closed like I have never had will never have and don't have Wells Fargo um yeah if you ever get an email a text or anything that says oh we can't deliver your your mail click this link yeah or your Amazon package already don't click it because it's a fishing email okay I'd like to say Val it was a pleasure working with you and and the staff and uh you know uh I enjoyed Gathering all of my Chacha from the years that uh I've been involved with um the incorporation and and the land owners you know and um there's there's still no more to come so be ready and uh it was a great weekend and I enjoyed the founders showing up and sharing time and enjoying the changes you know and talking about uh everything that uh well everything that uh we talked about in the incorporation committees and you know just it was just great well all I have to say is it's been quite a month from hurricanes to [Music] tornadoes Founders Day and Veterans Day to Kodak Black and let's not forget doing your regular jobs um in between all that um I really appreciate uh the partnership I know that um I was out a lot during the storm and that um you know trying to help people with everybody else identify those who were in need and uh and uh the speed with which our community worked together and the professionalism that our staff showed in taking care of our town was extraordinary and it's been commented on to me by a number of other elected officials and other communities that it's really extraordinary accomplished here as quickly as we could we were like the first ones back on our feet and it's it's pretty amazing for small town like us so um I'm pretty proud of us um to be able to pull off these other major events really not just pull them off my mom cried my mom cried at the bedroom station like you made me cry you all made me cry it was so ming so she was really touched by um by everything that happened so um really well done guys and um I also feel a little bit like you know this group is starting to really work together in sync I mean we don't always all agree on everything but there's a little less contentiousness and a whole lot more um give and take and I really appreciate that and working with everyone so thank you all fellow council members and with that I'd like a motion to ajour motion to ajour Second gets run from the de
