on right are we close to ready all right six o'clock everybody Welcome to the February 6 2024 Town Council regular meeting from 6:00 to 6:30 we have what's called Community conversation and anyone can come to the podium and talk about anything that's not on the agenda it runs from 6:00 to 6:30 and this is an opportunity where you can have dialogue and interface with councel and staff Miss Valerie who do we have okay we received a public comment via email this afternoon from Fran Holden the email reads as follows please read this at the meeting tonight February 6 2024 she didn't specify for okay oh so that gets held for the regular public comment okay okay uh Miss Deborah do we have many cards we have three okay so right now everybody can have maybe 10 minutes each unless other people come in and they're you know wanting to speak all right good deal thank you hello one one it's on okay it's um hi there I'm deor Marshall I live on 161st Terrace North and um 161st is actually the issue I want to discuss um first I want to name the sources that I've been in contact with that have advised me on on um is some of the issues not just on 161st but that I want actually wanted to bring up months ago and then on course life intervened um so I've been in a lot of contact with Dave arber's office the state attorney um they were the first to send me the green book which dictates the standards for our road and transportation standards then um uh I'm very close with the retired what was roads and bridges in Dade County um because he helped me with course relief effort after Hurricane Andrew um then a retired litigation lawyer for the auto insurance claims and accidents for Bing insurance and retired litigation lawyers for real estate law ver in eminent domain easements and Roads um as the retired lawyers directors they're allowed to give me legal and experiential advice if they were still practicing they would not be able to do that there's actually three components I want to address but probably not all of them tonight um so it is uh time for 161st to work duy paid um this year um but a lot of the residents are very very upset angry and Confused um about the plan land of Public Works program um constitu we are scheduled so a lot of residents R opposed to it some are are passion for it the issue I think is a little bit historical and it becomes the rights of the residents themselves to sort of have a say in if and and how the road is paved and designed so historically 16 first has always been a privately owned Road um so it was not by the town but it was owned by the residents so this was true in all the site maps of water Control District when C Sonia was in charge of the department and was also designated as a privately owned Road when Steve Yohi was in charge so 161st was quite unique in his designation was only privately owned Road um because water Control District of course had own the other ones um so it was never part of water Control District and in fact the grading was called a courtesy grade since according to director Yoki because the road was privately owned residents actually had to give permission for grading so when water control distri roads were turned over to the town this road according to director Yi was not included and remained a privately owned road so when I moved in I was gold in tax on private land ownership that extended to the center of that road and and tax accordingly so historically um this is a dead end dirt road um it's been a 12 foot road with 25 foot distance for privately own land priv there um so somewhere somehow without the knowledge of the residents this private ownership has changed so now of course that of town there's like 40 foot right away Andress and Ingress and lots of things residents don't understand they're very confused about and they um so the has also been included as a gas SE which has never really been expain to us as residents as to how that happened was documented so part of the issue I think here um one of the things thats at is that also historically I think we've had so many issues with public works and now of course we have new people in public works so um a lot of that history then is something that that's kind of resting on the but we know that and we've experienced that L been 20 years that public work has routin a long way and compromis private so we know that the LA the maintenance maps that were being used um I always call it um that those those maintenance Maps were both erroneous and invalid but a lot of times we've seen those maintenance Maps still used so that's in so we also know that there was numerous and invalid surveys that had been conducted one one year was not valid and then maybe the next year was but if you look back 10 years that one was valid so all things again that as residents we're not as as prone to knowing as as those of you that have been involved in this um we know that there were not real proper surve do before the alphabet Road took p with the exception of South B road we know that the res on bad and to suit the town successfully reestablish their rights because proper use and surveys ENT domain appropriate payment for their private land has not been done eminent domain um is an issue that um both Dave arber's office discuss maybe more for another day so part of the issue here is we don't know as residents what the plans for 161st and everybody this that R and um and again we had a lot of issues you know here dealing with the town so um basically what there is told is you know the town can cut down our over trees fill in our tisues change our ptor property brage pattern move our mail boxes and may have no C for to bad so sad kind um so we're looking into hiring lawyers and again a lot of this is historical stuff from a way that resents they hisory not necessarily how they being treated Miss Marshall there are other people who have come we're kind of almost at a 10minute window so if there's is there anything that you want staff to address here and now right you've got about two minutes one of the that addressed is with roads and bridges was North CNP road because they're now sort of illegal and and they they've created force non-compliance and traffic safety standards so we don't know as residents what the plans are for 161st um and we don't know how we've lost our rights one of the issues has been communication three out of my four close neighbors don't even own a computer and don't know how to operate one so trying to tap into online stuff with the town um a lot of people when I ask them why they don't come to the meetings the number one number one thing they said was here and I thought was sad um another life that you know they they haers or they have home or you know like me I was you know treating H around literally around um so so these are all things so we' like a little bit more communication we like to know we like the original plats for 164 so we can take them and know Private Road how that was established and again how now we are not a private road but we didn't know that we weren't a private road because we it was never you know it was never discussed with the residents and we weren't told how it happened so we'd like a lot would say they also somebody Su yest and I thought it's a good idea put a little more Forum on on you know anything that's going to happen there residents have a little bit more clarity all right thank you know that the council got a memo about me now being an incident and occas office about okay then Mr Austin 746 hide farar Road actually this question is more about for francena our town attorney um I just don't know how in Royal Palm Wellington how would they deal with uh uninspected apartment buildings being built and occupied in their towns I mean I don't think they would get rid of it but we have one operating Loach grov it's an apartment building that's has about six or seven people living in it and Town's known about it for years they watched them build it and now it's occupied how does that happen in our town well it should not happen in our town if it's if you tell me the address outside reported it's in your uh code it's 1057 D we're working on that right now no it's on Hyde Park it's the same one was a trailer park that one is already subject to a code violation and we've had the health department out there um we have recently been out to that site I think twice recently including with our Public Works folks and our building official I just don't understand how they could just sit there and build it with the town watching them build it because you guys were on them about their illegal trailer park and they were watching that being built the whole time and they finished it and now there's occupied and we have triple the traffic on our little street that we've ever had before because the people living down there and their families and friends and everybody else going there we have had a number of complaints about that property we actually have been watching that property like I said we sent code the building official and the Public Works director out to the property at this point in time without larger help we can only do um repeat violation and we are looking at um what power we have through the building official I excuse me do you mind larger health definition please uh Health Department okay so I the health department with will help with any sing single family that is no longer a single family because there the town is aware of more than these properties and um also they're getting past the title companies because the code complaints where did they go so do what else can can we assist with we met Department we met yesterday with fire rescue they too have the same issue we cannot get them onto the property unless there's an emergency call if they can get on to the property with an emergency call they can get a picture and a picture is enough for us to act on we actually have videos from 10:32 and we have many pictures of 10:32 um and again we have a new building official and a new fire chief and we're trying to put something together with regard to all of the multifamily living arrangements that are unpermitted that we are aware of in town I would love to see that list because I could probably add to it well please do send whatever because I think I've already sent you guys you know issues yeah and we would like to address them so send the list no you you send me the list please and I'll put the look at your list if you don't want I do because I don't have a list I only have what has been reported through code so let's just get right to the point and send me your list nothing I wanted to thank you for Paving collecting Canal it's beautiful day today we wouldn't be able to enjoy because for years we had to keep our Southside windows closed because we were eating dust constantly it and everybody could see it that the last meeting during the comments it was shot down the streaming of it was shot down because of money so um I don't mean to put you on the spot but can anybody in here tell me how much that would cost because we did offer to pay for the time so I'm just curious how much it would cost for click click and record on YouTube which I believe is free for hour and a half tops maybe can I respond sure yeah I I brought that up a discussion it's not about money it's about the Precedence it's about the precedent set when somebody uses this facility they use the chairs and the bathrooms they don't use our infrastructure they don't use our streaming they don't use our software if you use our software and it goes to YouTube and something happens all of a sudden show of hands who voted it down please because I wasn't here okay so we have an incumbent did you vote Yes I okay we had two incumbents voting on something about an election right Paul you're Miss you're missing the point Paul not missing the point I'm getting to a you are so I just don't understand how elected officials who preach transparency okay would could sit here and want to stifle the Democratic process because that's what you're doing it's making it easy for older individuals who can't make it here for other individuals who can't make it here to just pluck it up on their YouTube and watch it on YouTube this is very simple it's not a town sponsored event Paul it's an individual group no different than pine tree when they come here and use our facility we don't broadcast their meetings on our YouTube channel other people use this facility and we don't broadcast their information that's what it's about it's about setting using it it's not a Town function Paul it's an organization in the town so it's not a town function okay but but but we WE Post Town schedules on on the website great and and we try to we're trying to have a community involvement thing where everybody's working together sir so I don't understand the difficulty because you're worried somebody might say you put the kibos on it no because it broke down it's about anybody that uses Town Hall being treated the same it's not picking it's not picking on you Paul this is any organization Paul you you belong to an organization not just anybody gentl of the town the voters of the town thank you land owners enough both of you no because all we're doing is yelling at each other and I'm sorry I just don't want mayor I don't understand I I I really don't because it's Community people trying to be involved in the community and just educate the voter I don't understand the conflict here I mean maybe put it to the attorney and ask her if there's a conflict I don't see a conflict all I see is stifling stifling stifling stifling all the dang time how could we be stifling if we're allowing the use of the facility because not everybody can see it unless I bring in equipment and I and I project it out we didn't find this out to the last meeting so don't worry it's going to be out there it's going to be on YouTube it's going to be on the Facebook okay on our Facebook page and that's you know but the problem is is there's a very very big I see a conflict here and it's not with us using the facility and using the technology because we offer to pay for the for the facility we offer to pay I stood up here and said give me a number okay we offered the conflict is is I got you know you know and two two incumbents other side so they cancel whatever but I got elected officials stifling Democratic process that's a conflict and that's a problem thank you Mr Coleman who's next have two more comments uh Miss sish five it yeah absolutely all right thank you thanks don't take that out of my time thanks Virginia don't run go ahead a new face go ahead Virginia thank you Virginia Standish um I would like clarification H how long it should take to get a request from the building department on a simple request of information on January 23rd I sent in an email to the building official who was forward to a different person my question was simple I I am competent in reading munic code but I am aware that things can change that may not be in the electronic record so my question was what is the minimum or maximum size that can be built for a mother-in-law's quarters unattached or a caretaker's Quarters on a regular residential property five acres I have not seen receiv received a response as of today uh according to our mun code my understanding is in section 20 that you can build up to 15 I believe it's 15% of structures non- Bonafide okay five acres non- Bonafide munic code says you can build up to 15 structures can be up to 15% of the total square footage of the property so I was just trying to get a qu you know answer on confirmation that nothing has changed so my question is how long is the process to get a response so right now you're somewhere close to two weeks without a response yeah business days okay do you have Jack's number Andor email I have of course I have emailed called I called a second person their voicemail was full I called by email Jack again I called town hall and told him he I was told he had forward the email so I would just please like to know when I can get an answer to a very simple question Franc and could we please get an answer I have the answer I'm looking right at it because it looks to me like it was answered last Wednesday and um I have not could you tell s to yeah it was actually Jim if you let me finish Mr fleshman was asked to respond directly to you because our building official is new but without even looking at this I can tell tell you that the minimum size for any dwelling per our code is 400 square ft that that is the minimum size dwelling unit that does that is not the Standard Building Code dwelling unit size because a standard building unit dwelling a standard building code dwelling unit would have in it a kitchen and a bathroom so that would make it larger but our code if you're asking for what our code says it's 400 square ft for the dwelling which is why the building official moved this over to Mr fleshman to answer for you so I believe that he thought it was answered and I can follow up on that I will and that's that's why we have these Community workshops get this answer I've have not seen that um let me ask you this then that where would I would I find that in munic code that 400 square feet you you can and I believe that our planner is looking for it right now because I believe um Caitlyn Forbes so it is in section 20 I believe doing this homework so we can all know um we're saying a dwelling this dwelling unit of 400 square feet is the minimum for it could be for a mother-in-law unit with a bathroom and a kitchen I may have misunderstood what I'm saying is a minimum dwelling unit per R code in section 20 is going to be 400 square feet and um our Public Works director has it pulled up so he can tell you the actual code sighting however that does not necessarily um include a kitchen or bathroom and it would not have to per code however the Florida building code would require of a dwelling unit to have a kitchen and a bathroom so that's where the code that's where the two are different so that's the minimum now my other side of the question was what is the maximum the maximum is also in section 20 and I'm going to let um either Mr Galant or Miss Forbes read it to you because they appear to have it right in front of them and I do not okay and if you could the complete section would be helpful let me just clarify that 400 is an accessory dwelling yes just what a mother Florida building code for a residential dwelling that has the bathroom the kitchen exactly they don't allow 400 because you can't fit it all in that but the accessory correct may not have need the kitro access may not for for my understanding what was just said a 400 foot unit because I I have one elsewhere that has a bathroom in a kitchen so a minimum 400 square F feet can have combining the two codes could have a bathroom and a kitchen but I'm just trying to find the maximum in section 20-10 A2 A2 the maximum floor area for an accessory dwelling unit shall contain no greater than 12200 square feet of livable floor space okay livable space and that applies so in that that would apply to both a mother unattached mother-in-law unit and a caraker quarters I am not as familiar with those regulations I need to look up the definition in the distinction between the two I'm not sure if anyone else jemail I will I will read you this which is from Jim that says ulc section 10-15 requires a freestanding dwelling unit to consist of no less than 400 square ft this statement is not a zoning confirmation for any particular parcel of land so therefore it depends on what you're building on what would be acceptable but the generic statements are contained in sections 10 and 20 of the code so then these properties so the maximum is 12 00 sare F feet you were reading from 20- 010- le2 um and you can have more than one accessory building on a property you may and that's something that the ear process has led us to knowing we need to clarify because you may have a mother-in-law unit that's unattached you may have caretakers quarters that are unattached and you may have Grooms quarters that may be attached attached depending on the number of stalls that you have in your barn now I will let you know the reason this came about that I was trying to find these specific answers is I had someone say after reading the that the maximum structures cannot exceed 15% of the total square footage of the property someone said to me that well if you build a mother-in-law unit um it can be any size but the residence must be at least twice the size size of the Mother-in-law unit that's and so that's why I was trying to get clarification on where to start what sections in specific so has anyone heard that said Virginia are you open to having a specific one-on-one discussion with either Caitlyn or Richard or both because this s want to occup I just thought the email would handle it and I don't want I know they're super busy that's why I was trying to do it through email and this may handle it but I I would pursue that if I needed to and thank you for pointing out that there I was I was not expecting one from Jim so he kind of went Above and Beyond on that thank you so much yeah you're even though everybody is super busy it's part the proper procedure for us to get a hold of Public Works our code guy or we have a question for the planner or um I mean I contacted Town Hall just want to make sure or is there another Avenue that we need to do to go through somebody else or whatever we've changed our website to be very clear so that when you go to make any kind of application or you have any particular question you can get trying to do is be very accessible to everybody you can ask anybody here for a public record but they need to be logged and we need to make sure that they're fil no no I understand but I'm I'm taking it next level if you want a record you can ask anybody here for that record and we like it to go through the clerk's office so we know that we filled it but anybody here can answer any question directly it does not have to come through the front desk or me and I had one other thing that was brought to my attention about a year and two months ago I stood up here at the podium and I mentioned about two people putting in a covered Arena getting a building permit and the discussion came up that they were being forced to give an easement as part of that building permit it was written on the building from I don't know if you guys remember was about a year and two months ago in December December meeting or so and you guys asked the questions through the conversation we found out that that was happening and it was taken off um I have found out now that site plan permits are having the same type of wording requiring the people to to give up an easement for their site plan appr approval that doesn't have anything to do with giving up a road easement or a drainage easement um so I don't know if you're aware of that I've had a couple people call me and I just wanted to see if you guys are aware of that I'm trying to get a copy of the permits right now um to see but I just wanted to bring it out there and throw it out there that it was it has come up so I'd like to say this item is on the agenda tonight for the easma policy to be Revisited again and the easement policy allows for the public works director to discuss obtaining an easement with anyone that they talk to and when someone is in here for a permit or looking at an FDA we always try to raise the issue if we don't already have an easement that we have not predicated any permit on somebody giving us an easement except for when it's a rightaway permit and we're going to put in a covert for someone um but generally speaking our policy which we'll look at on the agenda tonight States in there and this is what I said in December as well States in there that the Public Works director can and should have that conversation with anyone who comes in but no permit is predicated on you must give us an easement unless it's a matter of private property um and they've asked asked for us to do something such as put a covert in Cassie did that did that answer your question because it doesn't sound like they weren't asking so it wasn't asking for an easement it was actually printed on the site plan that had nothing to do with the easement site plans concern that it's following the same I just want to make sure it's not following the same Avenue as the building permits and things are being run okay A a building permit a building permit is never conditioned on an easement and obtaining an easement is often included in the list of conditions on a site plan because a lot of the work on a site plan might Encompass drainage if you're giving us an ement and we put in drainage for you in that easement it can oftentimes change the work you do on site I'm not an engineer so I'm not going to speak to that but we do put it in um as a checklist item as we go through there's nothing that says they have to give it we just don't have to do the drainage in the area where they would have given us an Eastman okay have that was not my question I know it's not predicated but it's happen it happened back in a year and two months ago and it's been brought to my attention and I'll get a copy of that easily and you have that person or persons come into town hall and have some kind of established meeting I'll try for this y I just want to make sure it's not being printed on there because we didn't know it was being done to the building permits until we brought it up and then during the discussion it came out I remember we were like wow I can't believe that's happening it shouldn't be part of it well it didn't happen on building permits it without here's it WR it's written on a site plan yes it would be it would be written on a site plan okay I just want to make sure it's being asked separately of the site plans or the building permits because it is a separate issue and make sure that we're keeping them separate I understand okay Robert has his light on do you want to talk to Kath if they're discussing it during the site plan they agree to an easement it's going to be on the site plan that is something agreed to it's part of the site plan period yeah all right moving on Mr Scott close to the mic sir you can pull it towards you 14970 grber okay um I I just want to know the status of the paving or Paving or remaining unpaved of grber specifically okay Mr Gant Mr Gant is our director of Public Works he would be the person to answer that it's on the agenda you want to cover then or [Music] uh Council since this is this gentleman's first time here can we make an exception I I want to know why the folks that come at 6 can't talk about what's on the agenda and get answers I I I don't know when that happened if you go to the town website it's out to bid right now go to the town website right on the homepage Paving bid click on it you go down there'll be a a picture of Gruber and we're supposed to bid hopefully in April it's coming to the council meeting but all the details are on the website in that invitation to bid thank you uh I will take a look um I also want to put it out there my my concern is just um a lot of people a lot of people use it to ride horses so um you know people walk with dogs there and I think people well I understand the council needs votes from all of the residents from what I've heard um so um a couple of there one neighbor is against uh two neighbors are against Paving that I know of and another neighbor is four um but uh I think it's an advantage to the boarding businesses along Gruber um for guber to remain unpaved but um I understand that you know we might get out voted um and it would be nice if at least if grber Lane does become paved if there could be maybe a horse trail alongside if that could be be a possibility that they're not they're not laughing at you it's something that we've been trying for decades um Mr Gant is can give you a more thorough answer go ahead Richard so specifically to Gruber um my superintendent and I have discussed it we have some work to do on Gruber we are actually going to shift the road and then extend the Swale on the South Side the intend is extend it on the South Side about five six feet um and then re because we have to reshape that Swale anyways and when we do we're actually that our intent is to make a um a horse path through there to connect the two roads so you can actually cut through there with a horse and be on the side of the road out of the the the travel lines that'd be great um you know Best of Both Worlds I think the people who who don't want dust coming into their house would be you know would be served right with the paved Road and then so with the horse that'd be nice um thank you're welcome thank you for your input he I my lights on oh I'm sorry I didn't see your light go ahead thank you um I have a question Francine yes sir you did not have a vote to pave your Road Council did you didn't have a vote just letting you know your vote is when you elect people um Francine I've had several people come forward on on Gruber that do not want the road Pi more than half the folks on Gruber so how do we address that for another council person that asked me that question I didn't ask that I know I am you are not the only person who has asked and I have shared what sta plans are which is one an outreach program to let everyone know that the road paving plan is out to bid right now and what was approved on the road paving plan and we will also hold at least a 2hour at least one 2hour openhouse for people to come in and talk about what their concerns are on the March 6th council meeting we will put discussion of the capital plan in specific any additions or deletions to the capital plan including the road paving plan if we decide that we don't want to pave a road let's say everyone on grber says we don't want paved we reallocate those Monies to another road and we would bring forward a final Paving plan as well as a ward of the ITB um for the April meeting so question um if the year is going out to several other entities to be critiqued and sent back to us why are we revising it in March wouldn't we wait to get it back no to revise it no we would not because we had a 5050 program so if you got more than 51% of the votes to PVE the road the road got paid well that's a different program than I understand it's different I'm I'm just saying how do these folks they've never had a voice they they they don't want if they don't want the road paved do can they can they speak up so we are going to have an outreach program which invites people to let us know any issues and concerns we will have an open house where we can answer any issues and concerns and we will bring to you what we have heard from talking to the public at the March 6 meeting and hopefully at the March 6 meeting interested parties will be there and this this is the essence of council policy what roads get paved and what roads don't get paved my other concern is the Horse Trail now we're putting in a road and we're putting a horse trail on one side of the road and a Swale so how much property will you be looking for the residents to give us for a Swale and a horse tr on that and a road okay so very specific questions cannot be answered in a very general um Arena that we're in right now but what I will say to you it is my appreciation that most of the properties on Gruber have easement Deeds that provide in some cases up to I think 30 30 feet 30 feet on each side so if there would need to be some moving of the road to accommodate the swell Andor a horse trail that could certainly be something we could consider if that is the solution that we take we also did the ITB with unit prices and segments um and if we did need to do some type of addendum it is possible that we would have the information to be able to do that before the award for those folks that don't know what an ITB is please invitation to bid okay thank you you're welcome Robert I'm just going to say this is on the agenda so can we stop the conversation hopefully yes thank the microphone up to not damage it we've been trying about last time you know who you are I had a pleas Pleasant meeting with our new Public Works director Richard Galant responded to an email or to a cell phone request within two hours he was on my property shortly thereafter welcome Mr Galant was working with me on some of the issues that are coming up later tonight but this is a specific concern the poor guy has no idea about what happened verbally between myself public works department in some cases members of Staff regarding the width allowed in front of my property based on an agreement that I had with lar that had to do with putting in Ballers that agreement which I brought up at the meeting because I don't know if Larry recorded it was 19 feet 6 Ines from the center of the burn not the toe you cannot change horses in mid burn it won't work with me a deal was a deal however Mr Galant has no clue no historical documentation other than the Rosetta Stone of Mr Stevens time here the book no Peters not Stevens sorry L Peters the the book the book was out when I met with him the book was out when we had our meeting with the staff regarding this I am not trying to be difficult but I'm trying to not hinder this gentleman who's trying to do a very good job question to everyone here whose property is the book it just and and and not to be but the um the book you're referring to the book in which Larry kept notes just okay all right then just just checking okay the book I'm saying that not for me I've already stated sort of through legal process through the meetings with staff however this gentleman is coming into this blind and I'm just hoping that we can possibly get a copy of it made reference back there and maybe we can keep moving forward smoothly I do thank you for your response can the attorney please speak on theuk theuk any um public employees notes that they take in a book on a scratch piece of paper or you know whatnot are their personal notes if they share them with somebody else they can become a public record but otherwise they are personal notes used for their own use and recollection thank you okay Brian not to belabor the point here what is the difference in measurement from the center of the burm to the ballards versus the toe to the ballards that can VAR depending on grading good discussion about grading okay sh again I'm a licensed dirt you can move dirt from one side to the other you can build up a burn you can strengthen it you can push it a little bit farther into the canal or you can shift it the other way but the concern that I've had as you all know is that when there was the taking the properties much property was taken we're up to 23 and a half feet now from the toe into my property and it keep growing Mr Galant is aware of that he came down and saw the markings that I made at 196 he instructed the grading driver to honor that and then he will also put in some Turf if possible the point I'm getting at is there's no documentation of that other than my verbal discussion and my discussion at the meeting that I had with Town manager our lawyer staff Larry you were there but I don't want to have to approach the road grader or the paving contractor or the paving contractor's Town representative and get into a Taffy pull over this so I'm just saying officially I think that that is a document that should be shared because it has a wealth of information in it that will avoid a lot of confusion but if we can't pry it from his rigid grip in retirement have too we have a problem there's a lot of information in there and he's a paid Town employee he sat in at that meeting that I was at with all these people here that to me is an official document of proceeding and a specification thank you mayor thank you yes our attorney needs to speak to this item yes ma'am so um Mr mcneel recently granted the town an easement for some additional roadway at the front of his property so that the greater would grade to that edge and no further um we have we have as Mr mcneel has stated been talk in talks for a long time over additional roadway indoor drainage easements you know in the future he has talked many times I've been in several meetings with him where we talked about that 19 and a half ft from the uh top of the burm uh but that would be have to be documented in an easement of some kind which we have not you know put to finality and recorded So that is all discussion at this point and we will continue having the discussion as many times as it takes until we're ready to put something in writing and get it recorded we are working on a draft U of an easement right now but it does not include additional roadway so okay thank you all right no lights Valerie are we done yes ma'am all right thank you all passes 5 all right section five is something new and Francine I will let you handle this what we're trying to do is capture the conversation at the 6 PM portion of the meeting and also at the public comment at the front end of the meeting and any consensus or direction or open questions and Council comments um and try to report back on where we were where we are at for each of these items so tonight you'll hear from PBSO and I believe that there's actually a specific slide to talk about additional traffic control and traffic control that we have done with regard to traffic control um and traffic calming up to and including traffic lights stop signs roundabouts markings so on and so so forth we're in active conversation with Palm Beach County um those conversations actually extend even beyond that relative to rights of way and Canal clearing and so on and so forth um and we are drafting a follow-up letter from Public Works to them um we are looking at all of the lane markings and by the way I noticed that the minutes need to be revised advised relative to the Lane marking conversation the primary issue with Lane markings bless you is at B and Southern not um the roads mentioned in the minutes um good point to bring up Road standards um we do need to consider Road standards because the green book bless you that is promulgated by um Traffic Engineers and fdot and D um is the only Road standard that anyone can quote from unless the town adopts its own Road standard and we are halfway there we have identified Road classifications and we have identified Scopes less than fdot standards in our invitations to bid and now we need to memorialize those in our code um so we are working on those and they will incorporate best fit for the rural nature of the town they will not be one siiz fits all um as a lot of discussions in the past have been and we are including looking at differences between uh roads most traveled roads least traveled um where we need more churning radi radi I guess so on and so forth so that is uh a little bit more detailed than um the the brief discussions have been the ITB which was mentioned earlier um is on our website and I know people have been looking at it it also gets published in the newspaper this week and it is also on a bidding service that's free called demand star and it goes out to all vendors in specific Industries um with regard to Palm Beach County and better Communications our public Works director has talked to Palm Beach County water utilities um to have a more open discourse on when work is being done here and also for those who wish to have um pable water and and Sewer rather than septic you know to make better arrangements for that you might have noticed that um the mowing has been uh fairly caught up um we are looking at getting um more maintenance easements where we do not have them um in the meantime we are about to get the new equipment that was approved by Council that will certainly help us get at some of the hard to- reach places um what the Public Works group has been doing is getting ready and catching up on disrepair in town relative to unmaintained drainage swells and ditches um a lot of that work is in anticipation of the approved Paving PL um and we're only doing it where we believe that we have easements either by direct conveyance or through warranty deeds that show those easements um we have implemented uh a sign plan if you will and later on this evening we can hear in the roads and drainage report the details of the sign plan we have about uh $15,000 of an order on new signs for stop signs um Trail signs and various other signs and disrepair we've been told by the county that we may not get the county to do the signs on okobe we will have to do the signs and straping on okobi because our speed limit being at 30 is below their required speed limit of 45 and with that we will have to take care of the striping and the signage so that's the latest and you know it's the opening of a discussion we can keep carrying on with the county on that um can we put crosswalks in if we have we have asked well we have asked if we can put the cross walks in and we've got two or three locations we're looking at so um on the horse trails the conversation with Council was essentially right at your own risk I know there's varying opinions on that but until there is a different opinion we're pursuing similar language to what is out there in other unmaintained Trail trails that are accessible to the public um late agendas I think you've seen the change in the agenda production and I'm going to leave leave it at that hopefully we don't slide um policy for accepting gifts we did draft a policy for accepting gifts a while back we have something in our procurement manual that lets us accept gifts up to $5,000 um and we also had a draft gift policy that we can modify and bring forward for the larger gifts we actually did use some of that as we were um getting ready to accept the um sod farm gift and then finally um the easement policy is on tonight's agenda the conversation was to change our current easement policy to allow staff to accept easements without specific Council approval after the fact um that would be for temporary Andor Construction eus in order to accept emus or dedications our code requires us to bring that to council at this point in time so as we do code revisions later on this year we can add more specific language on when and which specific dedications come to council for acceptance so that's a follow up on what we had um trying to keep them brief if we missed anything please let's put in tonight's Council comments and we'll come back with it at the next meeting okay Valerie um I should have asked before I asked Francine to start did we have public comment for section five uh not for Section Five okay um yeah you're right so my fault on that how is this document going to be treated going forward meaning it are the notes that are in tonight's agenda going to appear in March or do these get archived and then what was spoken about tonight is put in the next agenda how would you like them we can make them cumulative I was planning on just doing the answers to the next round of questions yes unless we had continuing items from this one carry over go ahead yeah my comment is I understand giving more detail than we do at the meeting going back thinking about it talking about it but I do not want to see a change in Direction on these comments when Council gives you Direction to go a Direction that's the direction you go until you come back to council and say Hey you know we're going that direction here's some comments you guys want to shift gears but I don't want to see comments that shift direction and change priorities well priorities is everything's a moving Target but uh changing the scope of Direction which I see a comment on here about a on Lane roundabout you know that was never discussed at Council you know that came up that that meeting was talked about now it's almost like a direction hey this is where we're going now I do know we support you know stop signs stop lights it's in our ear we're going to talk about that later roundabout so there is obviously if we approve that support to go in that direction and whatever we can get to calm the traffic I think everybody would take it but I just want to make sure that you know this doesn't change any kind of Direction it might be my bad on the wording because what we are looking at is repeating a previous letter that we sent to the county relative I'm talkinging and it could be up to you know any of these things that they might open the conversation with and we can bring it back thank you m yes Aran um and also instead of making an agenda item since it was public comments i' I'd like to have them I don't know how my um fellow council members feel but i' like to have the comments at your comments at the end of the night if it's something that we're following up and not putting out as an agenda item um however you would like to do and I'm okay with that um the reason I put it or we put it in the front is because the public is here and a lot of these comments are from the public but I will do we will do whatever the direction is I just didn't want to lose track of what we talked about okay um I guess as we meet with you email you talk to you whatever um we can share individual thoughts I love I love the idea that we have some sort of documented note that acknowledges somebody's input you know it's validating it it yeah you're being heard so where we put it in the agenda you know front back manager comments um I hear your point Robert about this not becoming a directive it's more like a yeah an acknowledgement yeah I I like it in the front um because it's it's a continuation of the last session we had as a followup but not as a direct agenda item I guess that's that's what I'm because we have follow-ups from you know when our when our building department and stuff speaks so put it in the beginning I just didn't think it needed to be an agenda item itself all right so just at so at some point I'm I'm hearing from the five of us that yes keep it written yes keep it in the agenda we don't necessarily have to talk about it yeah it unless it's brought up yeah and I'll be careful with the wording um because truly um we're trying to just open the door on communication with the county not get them to do anything particular we have to have a conversation with them before we hear what they'd even be willing to do understood all right thank you for doing that sure okay item six public comment yes ma'am thank you mayor uh we received a public comment via email uh from Miss Fran Holden it reads I live on North B road and travel South B Road a lot the traffic and congestion at the sou Southern Boulevard intersection Publix Aldi Etc is horrible for those of us who want to travel North a huge number of cars semi- trucks and dump trucks traveling on and damaging our small narrow two-lane but paved Road a cut through for the acreage residents something we weren't told wouldn't happen haha the joke was on us developers lie developers lie now we are faced with commercial use encroaching further north up South B the residents will not benefit from this and none will be able to get home before our ice cream melts I could lament all day about the stupid an or corrupt actions of our elected representatives that have caused disastrous mistakes are in conflict with our Charter and caused the slow destruction of our lifestyle excuse me wisdom seeks wise counsel from many sources arrogance thinks they know it all I encourage you to seek legal advice from our attorney general about what the intent of of the legislature not just from someone who depends on you for their job and thinks our Charter is a pipe dream and then miss sui I just had a thought from the conversation that uh happened in the workshop perhaps if there's uh that much Discord on grber we could do something by maybe having a vote of the residence see uh about Paving the road since it to the residents um second item um tomorrow night is the lock sat grov Landers Association um I don't know how many times we've had it candidate Forum um there are two candidates in attendance there will be just general questions asked we have a bunch of questions that made it in by by the deadline um we're going to try and get to all of them there's going to be time to responses so nobody can just pontificate um it will be we welcome everyone to come to town hall it' be awesome if there was standing room here um you know that'd be just great because all we're trying to do is educate the voter no matter who you want to vote for or who you think you want to vote for or which way you think you want to go or whether you like Paving or you don't like Paving or you like roundabouts you don't like roundabouts it's uh it's TR it's truly a community event um and we hope everybody shows up if you cannot make it I believe you can search on YouTube and on Facebook boah Hatchi grow special events and presentations and we have one tonight from District 17 and Captain Turner good even everybody Captain Turner from County Sheriff's Office um I think you're going to be happy with your report today uh when we look at some of the things that happened in 22 and how they translated to what happened in 2023 uh a lot of the things are trending better so we just go to next slide that's your deputies we just had one uh switch with your deputies we had one of the deputies move over to another district and we had a new Deputy that's just been assigned in District 17 so at some point El make sure he meets everybody on the board office uh next slide all right this is a breakdown of everything that happened over the year compared to 2022 what I will be doing is breaking this down individually in the next handful of slides so if you have questions on it I'm sure I'll get to them I'm done with the presentation so if you have any questions after that I'll be to answer them all right next slide calls for service really didn't change much as far as what happened uh approximately 20% of all calls came in from the public the other 80% were calls that were self-initiated by deputies either being a check on a business uh traffic stop or any other proactive activity that the deputy uh decided to do while he was working what you can see though is the amount of calls that happened throughout the year were a lot higher in 2022 you had 8,000 or correction 9900 self-initiated calls where in 2023 you had 11,500 you had 2022 2300 just under 2400 calls that were initiated by the public and that Rose to almost 3,000 of those persons crimes you had uh spike in shootings this year is uh unprecedented the amount of shootings you had in thaty groves uh before I get to that your robberies you have three uh up up by one from the previous year uh those three robberies one of them the victim refused to cooperate when we arrived one of them when we started getting into the story a little further again the victim refused to cooperate and the third one is still being investigated by our rer unit so uh somebody with a handgun went into somebody's house and took cash and a cell phone out of residence well they W yes um the one sexual assault she had this year was a a minor child that happened like 10 or 12 years previously by a family member and they decided to report it at this time if you look the robberies go back to the one the six robberies uh three of the robberies were domestic violence or not I'm sorry the shootings three of the shootings were domestic violence related um two of them resulted in an arrest one of them uh the person was killed uh or the the victim survived but the husband actually killed himself on SE uh two of the robberies were I'm sorry I keep saying robberies two of the shootings were cleared by arrest from road rage incidents and then the last robbery uh was a refusal to prose I robber I can't shootings I'm not used to saying shootings on lock sat grow so was really F me off but we'll do it again two of them were domestic related the third one was a murder suicide uh with a lover uh two of them were road rense which were cleared by arrest and the final one there was the unknown suspect uh a horse trailer was struck by a couple rounds but they we had no idea it wasn't occupied um but we have no idea where the rounds came from when it happened and could it happen and during travel it could have happened they just noticed that a couple rounds uh had penetrated the side of the horse trip and called it into us we have no suspects at this time we have no additional information questions all right property crimes uh one of the things that you can notice in here is you did have a higher residential rate of property crimes but overall you dropped from 21 burgies in 2022 down to 13 in 2023 again they TR in the right direction uh because we have so many shootings sorry that's hey the clearance rate was great I just got to say it's not like they were happen and everyone dispersed and we couldn't do anything above without the deputies and the detectives for this area have been done doing a phenomenal job uh last year a lot of cases and five out of those six uh the map of the burglaries is the next slide you're not going to see it it's still pretty spread out but you do have a a handful of happening just off Southern Boulevard down the South You Don't See Much happen north of boobe Boulevard as far as the burglaries um usually like that is because they have quick access off the Sol Boulevard they could come in off some of the side roads and be out and gone in any direction in a matter of of minutes so usually that would be the preferred method by someone if they they going to come in and try to steal a a golf cart or um whatever they're trying to take out of the Yards homes almost all of these were actually property that was taken out of the yard of a residence I don't know if any that actually they made entrance into a house to make the bur inside of residence it's all property stolen within fenon yards next slide uh stolen vehicles and recoveries uh again stolen vehicles went down by 25% and we seem to recover a lot more in your area that's kind of interesting um we actually found a chop shop located in the town of Loach Groves and on that property we found I believe four vehicles that were recovered that were stolen other areas and recovered here and then two days ago we actually came across another Chop Shop that was in locki Gres and they recovered an additional five vehicles on that property and they're continuing that investigation so the vehicles are being stolen from other places but for some reason um some of the properties here are being used to store the stolen vehicles until they can either take them apart and get rid of them or transfer them to another location but that investigation I said is ongoing on the second one but we did make multiple arrests off that had recovered five additional vehicles uh yesterday well done all right now to the uh map of the deaths and the vandalisms as you can see it's it's still spread out you'll have a handful that come right off the Southern Boulevard but as a majority they they happen throughout the whole district and as you can see the number of vandalism is in dep dramatically from 33 in 2022 down to 7 in 2023 now I know this is your passion um next slide one more all right accidents and traffic stops I know that's uh always seems to be the highest of concerned for the town a lot of the residents here uh the the motor vehicle crashes went down slightly from 2022 to 2023 from 116 to 107 but if you go to the next slide you'll see where they happen of course they happen along Co Chi Boulevard a majority of them and then some of them will happen down by the public spaz and just in some of the businesses on the north side of Southern Boulevard within the uh next slide traffic stops all right as you can see from 2022 to 2023 the traffic stops went up for just over 1300 to over 1700 uh citations issued Rose from 421 up to 795 and warnings Rose from 1226 to 64 um the next slide at at the traffic stops are I I know people keep wanting to see the traffic stops on Oak Boulevard side roads but if you look at the map that's exactly where they're hitting everything they're they're drenching o chobi Boulevard and letter roads and collecting canal with as many traffic stops as we can um I know it's a priority for you and your residents it's a priority for me um I can't stand the way some of these people drive these days and I see it on a regular basis and I'm in my car so I don't really stop L people but who way do I want to um and with that um I still get to see a lot of the stuff that happens as I was sitting in the back of the room tonight I got a call from one of my sergeants saying they just walk in an accident up in aage 11year old kid killed um and a traffic accident um got hit while he was riding at open down a sidewalk and no lights or anything and he ran into the side of a car and dead so I'm about to go see my deputies after this and make sure they're doing okay and and check in on them but it is every time I hear something like that it just it kills you um so it is traffic making sure people try to slow down and pay the traffic laws as near and D to my heart as it is to yours with with as you can see the the uptick and the numbers of traffic stops we're doing uh our Traffic Unit is also put together multiple traffic plans and this past week they hit Southern Boulevard but I wrote back to the captain of the unit saying listen list there's two other places you have to hit one of them being in okobi Boulevard in the town of locket Groves and the other ones along s PR because there's a lot of nasty speed up and down SE Pratt so you will be seeing a detail coming here in the near future that's going to focus primarily on oobe Boulevard um next slide all right arrests there were 12 arrests from persons crimes which I talked about earlier three of them for the shootings domestic assault cious act and five uh assaults property crimes you had a total of 10 arrests next slide other crimes you've had a total of 58 arrests some of those would include the open retainer laws some of them include um drug cases uh misdemeanor arrest for drunk drinking and driving a lot of people having warrants for their arrest that was there 20 of the arrest for people that had warrants whichis is a little higher than that um but that's uh that's a breakdown of all the rest you had that happen in the town next slide Palm Beach State College there were a total of 27 calls there for the entire year so very minimal it breaks down what those calls are next slide is the Public's Plaza you had a total of 305 calls throughout the entire year and that does include again some of the self initiate activity but you still average less than call a day out of that Plaza for the um some of the community service stuff and this doesn't include it all but as you know every time you call up and ask for something I'm I'm more than happy to try to give you whatever help I can um free free of charge no I never try to get the permit pay or anything for it um and that will continue the next year we have a good relationship um I think I do with with all of you and your staff here um so whenever I get a call asking for assistance U more than happy to get it for you some of the things that you did over the last year some of them are Town related some of them I guess were run by residents but uh you know the Fourth of July parade the Veterans Day Parade uh we've done multiple smoothie with the cop with the therapy dogs over at uh your in the Public's Plaza and then lock Groves Elementary Spring Carnival we do we've been doing that the last um I'm sure there's a couple other events on there that I forgot but that I just wanted to show you some of the things that we try to get back to the community and we continue to do so long as I'm district 15 17 so with that being said do you have any questions as always thank you you're more than appreciated and valued and Phyllis and Robert and I have and Marge have questions all right all right Phyllis go um thank you Captain Turner question regarding the chop shops and you check with the town manager and find out if these were uh automotive shops I don't believe are allowed in uh our town ordinances and I would be curious to find out if any of these places were already in Code Enforcement they're not automotive shops it's literally just used in the backyard of a property yeah but some of them are in the radar for the town yeah I'll get so I would be curious to see if maybe those were some properties that the town already has issue with um second um is it possible to get maps of the accidents townwide from 2020 2021 and 2022 to date yeah I um all the previous books that I gave to town they were in all of them I I have copy them all on my computer if it would be possible for you to download them sure I would say from probably 2019 2020 to date I just like to see um the difference in accidents since the roads have been because it seems to be an uptick um it w it was if you looked at Co the the co year they went down a lot of people not driving but once people came out of the Co year 2021 2022 access with the group I can tell you that I guarantee for those to be here higher than I think any numbers before that and probably the numbers that you saw tonight so uh there was it was a huge jump and there was a huge jump in educating drivers in in public um after covid finally let down people started travel back um yes I it just looks like there's more accidents on our on our you know Le roads and side roads um then okobi and usually everything was on okobi and Southern now it seems to be spread out y not a problem thank you Robert yeah on the um calls for service like Publix 305 75 of those were 911 Hang-Ups and what what happens there can you well if it's a 911 hang-up a lot of they actually contrary to property believe somebody calls in and hangs up on a 911 call if it's a personal cell phone they can't track that to who actually called so if they have the area that it got called in from you can have a a coordinate basically they'll say hey it came from this area in this Plaza by this area in the plaza and they'll come in and they'll actually drive around the plaza to find out that's not necessarily from one of the shops and most of the time it isn't from one of the shops it's from a passer by in a car or somebody that's you know in the parking lot so they they will go and they'll look for Hey is anything going on here look out of the ordinary they'll do a drive-thru a couple times if they don't see anything they don't nothing stands out to them they go back to the service they go to whatever next call is all right I just wanted to clarify that you do take action on those just to make sure it's not somebody in distress that you know it does sometimes it takes more time maybe in one of those than a a call where there is something that you can anything to go by then absolutely we'll do whatever we can to catch up them but if there's nothing to go by a lot of the times they'll just get the coordinates they'll go and they'll drive through and see if somebody tries to flag them down or anything stands out and there's nothing there yeah s right thank you thank you for another great year protecting our town all right Marge then Maryann yeah um who who is the officer off with you this evening who is the officer with me this evening that was uh Deputy Campbell that was here earlier yeah he's still behind you okay okay I I was just surprised to see two of you here this evening every once in a while I'll make the deputy come sit with me and hang out to see what happens in these in in the uh interesting meetings it give them a different perspective of what to look for when they're you know driving around at least they to get an understanding what you know some of the residents uh think is a priority and it helps them focus more on what needs to be focused so and will um one of you be at the candidates Forum tomorrow night since there's a potential for a large crowd I already have another deputy that's issues around and it doesn't necessarily take a hurricane I know some of the the um you know stop lights now have generators and stuff on them to keep them going but on occasion 441 and um okobe and 441 and Southern it's a mad house when those lights go out and even coming up okay Kobe through Royal Palm so before hurricane season hits and our storms get into way is that something that can be possibly broadcast so people can yeah I can pass that on to the EOC the EOC is usually the something that would handle that and they could do it through the county site do the sheriff's office site um multiple sites so great thank you if you want the correct answer though it's treat us stop sign everyone's supposed to stop nobody knows that or nobody cares that's why I brought it look at that as the main thorough far of traffic keeps going and the other people stop but it's it's honestly it's supposed to be a fourway stop time everything for everybody thank you um two of my questions were covered so that's a good thing and if you can't answer the following that's fine too so regarding okobe and accidents and traffic and people driving out of their mind what would be in your opinion the effect of having a car at the intersection of let's say FN oobe Andor B and oobe at the afternoon commute time would that be a waste of resources would everybody or actually have a oh God if I could have my cake and eat it to a deputy nobody would get home because you'd be writing tickets it's all night um it it's not it's not a one-time fix it problem you know nor do I do what you do but would that have an effect would it just be a um a waste putting a decoy car out in different spots throughout the day will make people slow down a little bit it'll make them slow down the first time they pass it um probably not the second so yes it'll have a shortterm effect on slowing traffic down but doing that and then replacing that with a person that's actually in a car actually stop people and then confuse them uh over the long term I think will have a better effect so yes um to answer your question yes and no the decoy car by itself long terms I think loses it effect loses its effect but having a deputy that will sit in that car and do it once in a while and change of when it's happening and everything else and then doing the car without a deput once in a while that'll be a greater effect over time so it's difficult to to commit a deputy to sit there from the town of lock gr throughout the ship or for an hour time whatever because he gets call the city the town he has to go to B Town um but not being said yes I have no issues um we just have to make sure people are aware of this kind of in the town because that's the complaints well he's just sitting on the road there for an hour he's not doing anything you can't make everybody happy all the time but if that's the direction the town wants to go and use the resource in that way absolutely we'll use the resource way I the the entire rule but the portion that is relevant to the question on making motions is that official actions may be taken under comments in the case of an emergency or for other situations necessitating immediate action as may be determined by a majority of the council so that's how your rules um read as to making motions during council member comments so does that fall in with and I'm going to stumble through the words here so I apologize so a council meeting is noticed it's published there's a date time there's an agenda and assuming those steps were done properly it's okay if other topics come up and Council votes on them even though they weren't listed on the agenda is that what you're saying there so from aery from a statutory sunshine you know public meeting rules there is no issue as long as your meeting is publicly noticed um and you're taking the minutes and all of those things to comply with the statute you do not have to publish an agenda you do not have to follow the strict agenda and not talk about anything that's not on the agenda you're allowed to take discuss and make motions on things that are not on an agenda okay so man but you have you all have adopted rules that you have and you've talked about this before these were last adopted in 2019 so you all as a board have not amended that um since you were collectively in office and um the rules currently state that under council member comments you would make motions if it's an emergency or there's some immediate need for an action otherwise you would give staff direction to bring it back at a future meeting during your comments okay I got it my was on okay go ahead so um for you those of you that are a little confused I had been trying to communicate with uh Town lobbyists for well over a month to find out what the schedule was for Tallahassee um I have always attended Tallahassee until we have a new lobbyist that it uh seems that I have uh for some reason poor communication with them and so does um our clerk that sits at the front desk so I had every intention to go to Tallahassee the vote was to leave me out of Tallahassee that was taken after I left finished the public comments thank you you're welcome Robert so the key is if there's an action that's going to occur before our next meeting in other words Tallahassee was coming up we weren't having another meeting before Tallahassee so we took action on an issue and the action was that one person would um go with the lobbyist to meet with the Senators and the Reps because that's how we were successful the year before and that was already and everybody was welcome to come to Tallahassee because it was League of cities so but I'll talk about that more later so that's my understanding if it's something that's going to occur before the next meeting we take action on it but if it's going to be after the next meeting then we rather than aot motion do we do a consent my question is okay something comes up and we're going to have a meeting before it occurs so we motion or I'm talking so your rule on council member comments says the purpose of council member comments is to promote the public discussion of matters relating to town business and to encourage the dissemination of information any council member May submit reports and information on items relating to town business when possible the other council members the town manager and the town attorney should receive such materials in advance council members may also request the preparation of proclamations resolutions ordinances reports and other actions of the council during this portion of the agenda subject to a majority consensus all such requests shall be referred to the manager or the attorney as appropriate official actions which would be your motions may be taken under comments in the case of an emergency or for other situations necessitating immediate action as may be determined by a majority of the council okay that would be immediate action is like you were saying if there's not another meeting before the action would need to be taken that would and so the rest of the items are um consent like you know I next meeting I want to see an ordinance on walking and chewing gum at the same time you would get a consens consent and kind of action items by consent only motions um on something that there's not going to be another meeting between now and then or an emergency um how do we make sure consents end up in the agenda because I I I guess I've been abusing the word motion on purpose to make sure it shows up in I'm sorry the attorney I was reading someone else that says Senate Bill 250 does not apply to us so we're allowed to make things more restrictive in our comp plan Madam attorney is that the way you read this email that is and I I did bring make copies of the page that makes that change if you all want to have those um so our advice to you before was that Senate Bill 250 had adopted language that um included all lands with or areas within 100 miles of landfall of hurricane Nicole and or Ian and it put restrictions on whether or not you could adopt amendments to your Land Development regulations or comprehensive plan that were more restrictive or burdensome than what were currently in place the legislature did amend that um legislation to change the locations where it applies and it was it is now very specific as to several counties and Palm Beach county is not one of them yeah I used to say within a 100 miles of either hurricane now County so that being said I'd like everybody look at page 152 and this special policy 1.5.7 that we removed at the beginning of this endeavor a year ago or whenever we started it and and I would like to strike that special policy that same em email that we sent to you we do recommend that you continue moving forward with the language as proposed to be amended instead of striking it we think that puts the town in the best position moving forward well I just remember our attorney in the case coming to us and saying okay you won the case but the judge said if you're not going to let people do it don't have it in writing get it out of there make a motion I'm making a motion to strike 1.5.7 second okay did that cover your questions because I think some of us had other questions as well okay um would you like to get a consensus on that change I think this is big enough we can vote on it or do you want to have and then vote all the changes at the end or how do you want to um well my question is specific to this future land use map or any change to the zoning designation for any parcel within the town shall require the affirmative vote of no fewer than four members of Town Council your ear including this special policy does not amend the future land use map or a zoning designation for any person okay does that answer the question I I assume it does okay did you have any other questions um not on this particular one I I just okay want vote all right I have specific question on this Maryann are you on yeah I'm okay okay so I understand that I understand the effect of sb250 in discussing this regarding leaving the special policy in and Elizabeth tell me if I'm wrong and I'm going to go thought by thought here if we leave it in it does not mean we have to approve an applicant who comes forward yes or no correct any application would be judged on the basis of that application in accordance with your Land Development regulations and and your comprehensive plan collectively okay confusion in there well there it it gets a little deeper okay um there's a line that was added at the bottom by Tanya from Tanya and Glenn and you from tvia donlin and your town manager and your plan we all worked on that okay Collective and the line says the intent of this policy is to exempt the subject properties from policies and there are four listed and that had to do with the court case that we went through and the judge saying you guys don't really always apply your stuff consistently so the way I understand the discussion is to leave this special policy in protects us it's prudent it's not the grage of granted my God it's not the granting of yes to an applicant they still have to meet the other criterias except 115 115a and listed it still has to go through pnz it still has to be reviewed by planning it still has to be reviewed by Council so to leave the special policy in until October it's a protection am am I interpreting that right so help me yes so what what we did was we in looking at the Court's ruling went back and looked at um you know these three properties that are subject to this special policy were granted the ability under this special policy to apply for a land use change to mlu CL clo institution institutional or conservation so we went back as part of that court case the court said okay so you gave them the right to apply for it for example if they're applying for commercial you can't deny them commercial because they don't front on Southern you knew they didn't front on Southern when you said they could apply for commercial even though your comprehensive plan requires all commercial front on Southern so obviously you didn't intend for them to have to meet that requirement because they never fronted on Southern so what we have done in the proposed languages said that you have to meet all of the ele all of the um requirements of the comprehensive plan except for those few four things that we knew you could never comply with with one of them is Runing on Southern if you're commercial one of them is if you are going for mixed land use you don't have to meet the 50 acre minimum uh lot size requirement because they're not 50 acres um then there's um one that's limiting commercial development to areas south of East Citrus Drive and one requiring a minimum of th000 Ft on an of Frontage on an interial roadway those are the four that we said they never met those when they were given this special policy saying they could apply for things that would require those so those are the four things that we never intended them to have to meet under this special policy but everything else in your comprehensive plan everything in your ulc would have to be met as appropriate so if a different applicant than the former came in and said I want to do X based on on your special policy they have to meet every single criteria any applicant okay who owns one of these three properties comes in and says I would like to do X and it complies with this policy where they're applying for one of those things they would have to meet all the other provisions of your comprehensive plan but there's no argument as there was previously under the uh case that there was some wiggle room on what may or may not apply to them we're being very clear okay we know these things don't apply because they never could have but everything else you have to comply with we're being very specific and clear what the special policies intent was okay that makes sense so it again just to simplify it it is a safeguard for the town regarding potential future litigation to leave this in correct particularly because you do have an application that has already been submitted for one of these properties okay and again whomever applies has to go through the gauntlet of you know other comp you know other comprehensive plan items other ulc you know subsections that go through planning then through pnz then through US yes okay thank you all right Robert then Marge I don't know light was on first go ahead Marge all right um the fact is that uh the council all agreed to remove this early on in the process LPA and pnz voted to remove it as well okay we spent large amounts of money on uh lawyers now um so we should remove it from the comp plan your choice um staff interpreted the statutes and and put the previous language back in and provided the less restrict restrictive language we didn't direct you to do that so I don't see why we're even talking about this should not have been in there so if we're not going to um abide by all of these get rid of it get rid of it rules then let's get an attorney general opinion on whether we have clearly uh followed the uh the U the rules as stated you know that the per that we have not um proposed or adopted more restrictive language so let's get rid of it we don't need it thank you okay I don't phis or Robert who is for Robert so this is the reason you do comp plans every 10 years you look at what's happened in the last 10 years you look at the traffic on B Road you look at those issues and you say and don't get me wrong I don't know when this went into effect six eight years ago a different Council a different time things weren't built out yet you know we didn't have any money so it was a different scenario and they looked at hey in the future this might be a good idea well here we are it's the future and I don't think it's a good idea so this is why you review this comp plan every 10 years is to look at situations and analyze them and you don't make decisions fearing a lawsuit you make decisions in the best interest of the Town big picture right okay bis I agree with you Laura proceed with caution and I agree with you Mars an attorney general opinion and I agree with you Robert let's pull it but but I think if we consider pulling it we need to get the Attorney General opinion because personally I think we've spent way too much money on attorneys and fighting residents and land owners in this town so let's kick this can down the road another month let's get an attorney general opinion and then Laura we would be clear if we we would know to leave it in or for the insurance trust did I say Insurance trust first I'm sorry Investment Trust and insurance trust vice mayor sure volunteered for the Investment Trust so what we were hopeful to do this evening is to present um Vice May sh's volunteering um and get a nomination for him to serve on the Florida Le of cities Investment Trust we also have separate from this that will be on your March council meeting so hopefully someone will volunteer for the insurance trust so all the insurance words get replaced with investment yes correct on 10B this is on on 10B all Insurance should be changed to investment and on your next month's agenda you will see an item for insurance trust if someone volunteers and I do hope somebody does two 7 Mar Elizabeth are we allowed to change words like that okay moving on to oh Valerie I'm assuming no public comments on 10 anywhere no thank you okay agenda item 10 C revisions of easement multi-use Trail SRO drainage and utility protocols this policy was discussed by Council on June 1st 2021 and on June 7th 2022 and at our last council meeting we talked about making one change to this policy and that is in item seven on page 276 and the underlined language is what has been added and it says all easements must be approved by the Town Council prior to recording with the exception of temporary Andor construction easements the council May also approve in advance a single or list of multiple locations for which staff should seek to obtain and record easements and those would be generally like we did for the paving plan okay so is this a policy or a resolution it is both say resolution adopting a policy okay Council questions anything okay yes thank you I know you got 2021 and 2022 in here as discussion but this recently came up with a temporary easement and so thank you for acting quickly on this and getting it to us basically within a month of recognizing an issue that was uh slowing down our public works department from uh doing what we wanted them to do um so thank you for the rapid response to this no other comments and make a motion to approve my resolution 20 24-8 okay motion by Robert second by me all those in favor I all those opposed okay hearing none motion passes 50 well speaking of Public Works that's the next data 10 10 D yeah staff will present updates regarding roadway and drainage to Town Council good evening good evening Peter here all right I just want to give you an update on some of the things we have going on in public works um so some questions have come up in the last month regarding the work that we have been doing around the town including the mowing trimming trees back such and such um the intent of our staff in trimming trees and all the work we have been doing is to improve drainage in the town and reduce the safety concerns of residents uh with getting the car struck by trees are not being able to see around corners because of overgrowth um the Mowing and the cutbacks are all access to existing drainage uh we have a lot of areas that have not been maintained very well um 161st is a good example of that where um a lot of that drainage ditch has been filled in over time by debris um by neglect by residents planting things in the swes that shouldn't be there and so currently our staff is cutting those areas back we are limiting the amount any trees to be removed and redirecting the swes accordingly as we can to allow better drainage for the prep for the residents properties do not flood that is our intent um the paving um bid has been put on the street as it was mentioned by vice mayor Shore um it is set up the way it is set up it is set up to include or exclude any segments listed there are 13 segments listed on the intent to bid and our invitation to bid and the way that it's worded is a notice to proceed will be given once the successful bidder is awarded the invit the notice to proceed will be based on the segments that we wish to be paved at that time so if for example if we decide if we go through the entire process award the bid and then you guys decide that we don't want to pave Gruber we can say Do not pave and just take that right off right out of that that segment um also it is worded in such a way to where our mobilization costs are based on the notice to proceed so we will pay a notice a mobilization cost so if we decide to pay segments one two three four and nine and the rest of them we decide to do later for some reason whatever reasoning um we'll pay one mobilization cost to do those segments in the quote that we got previously that contractor actually put mobilization costs in for every single segment which had $11,300 you know there was nine segments on there that's a lot of money so we could actually pave an entire another road by just removing all the additional mobilization costs that don't need to be in there um some of the other things I wanted to highlight is um easement requests um at this time and to my knowledge I nor anybody who currently works for Public Works has demanded an easement from anybody we have requested easements uh we have negotiated easements I have a couple of residents that basically told us where to go when we asked for an easement and then when we discuss the benefit of granting a road easement and a drainage easement um as far as like for example if that we do have an easement and we have a road that's paved and we don't have a way to drain the water all the water from the road will go on that resident's property and we cannot control it but if we have an easement for drainage we can install CS we can install structures we we can um cut the Swale in to where the water does not enter the resident's property therefore preventing their property from flooding caused by the roads um and many of the people I've talked to have embraced that when we explain it that way they're like oh okay because you know we explain to them we're not trying to take your property we're not trying to do anything nefarious we are here for the purpose of improving the lives of the residents of the town and its and its guests who come through the town um another issue uh because of an issue that came up recently our staff has been directed to limit contact with the public while in the field and they have all been provided business cards by my of mine and Craigs that if they have any questions or have any concerns that they contact us and do not stop our um employees on equipment or try not to interact with them in work zones because many of our staff obviously like you know we're doing this Canal bank restoration moving rocks or moving stuff we don't need residents getting hurt um by our equipment approaching our equipment while it's running or operating or approaching our staff while they're working um currently we're also in the process of better securing our equipment and our facilities uh currently you know there's no real access control on the public works so anybody while we're there even if we're in the building can walk out of the property go through any of the equipment or do anything because there's really no security when it unless we physically close and lock the gates and so we're trying to um alleviate that we're also directing we're going to get signs to direct people if residents want to interact with Public Works that they come down here um and then we would meet them down here because there's also a liability if somebody does drive on onto our property in their personal vehicle and they hit something or one of our staff is moving something and accidentally hit somebody's car the town will be liable for any damages um also if anybody trips and falls on anything that's on the property the town would could be held liable so we're directing everybody to come down here um to interact with ourselves or anybody staff for that for that matter um obviously ensuring the the welfare and safety of our staff and the residents is our top priority in everything we do in the town and like I said is our intent to improve the experience of the residents and the guest of the Town Richard may I ask just a couple questions for you to bring out um the information you and Craig have been giving your cell phones out correct correct it's on my cell phone number and my office number are on my business cards okay and um some of the security message that you're using are to get a keypad for the gate yes we're gonna have to change the gate put a rolling gate in there with the so it'll open and close and put car with a dialer also looking at new cameras for security yes we're looking at getting GPS for all the vehicles and also get um cameras for the vehicles as well so that way any any interactions that are encountered or anything that happens we will have video of it and it's not it's not expensive it's all within even your signing Authority yes okay um the other thing I wanted to mention is Richard's style and talking to people on the easement is a little bit different um I want to go back in history because I think in history is where we kind of found that fork in the road and that we can't seem to reconcile 95 Florida statute 95361 relies on the four or the seven years of Maintenance depending on whether we built it or whether we received it and maintained it um in that case the town May um say because of the maintenance for that period of time after a certain period of time it becomes the town's right of way and we may record it as the town's property discussion was made of this at the last council meeting it is indeed true that our code lets the property remain at five acres for meeting are one for five however that property owner may go and get a reduction in their taxes from the property appraiser because it would be smaller however one of the conversations that we've been having with people to help them understand the difference between an easement and someone taking the road is that um there were originally easements put into Deeds so that the roads and the canals could function over time generally speaking there are 20 or 30 feet in the Deeds warranty deeds and we have to look each one of them up oddly enough nobody has done that before um we're looking up every single one of those for the 24 Paving plan I think at this time we have about 25 or 30 that require additional research beyond that which we did um we can I want to briefly let you know we're looking at options to get it done including asking our attorney to go to the fund and have a title search done on those properties to see if there is a deed at the end of the day it would probably be more efficient than us digging through conversely we can go and ask those residents for the easement when we ask for the easement the conversation is not about taking their property when we have an easement it's not ours when we have an easement it's the property owners all it lets us do is maintain either the road or the drainage better meaning that we go on and we clear the drainage ditches um you know we make sure that we put the dirt back on the road you know the things that people expect us to be doing but right now where we don't have an easeman or we can't find one in the official record books we have to ask for so I think Richard and Craig's style and manner of this explanation has been more thorough um that's my appreciation of it I know Elizabeth and I have had those conversations and the bottom line is if somebody gives you something you can't take it from them so when it does come time if it ever comes time that we record maintenance Maps again anybody who's given us an eastment will not be recorded as part of that maintenance except for as the easement they gave us it means it's still their property so I just want to get that all in the public record because it's sounds like when you say give me an easement that we're taking something no you're granting us the ability to maintain your road and drainage better than it's been maintained that's really all we're asking and I think Richard and Craig are doing a better job of explaining that that doesn't mean everybody wants their drainage and Roads done but that's a different story thank you for inging me on that okay who had their light on go ahead Robert all right um on that bid striping I saw it in the scope but I didn't see it in any of the individual segment details and I know in the past 18 to 20 feet we striped anything less than 18 feet we didn't stripe that was based on Simmons and White's detail that they provided us so that's something to to to clarify um thank you on the mobilization that's good my question is the burm how do we avoid somebody going too far into the burm this time so like we did with the current project that we just finished um we will be either myself or Craig will be on site with the contractor when they do layout I mean we will have you know we I show an actual notice to proceed we'll have a pre-construction meeting with the with the successful bidder and then we will be on site the day they do their layout because you know they're supposed to Mark both sides of where they plan on Paving and so we will go out there and be out there with them when they do that layout so we will to make sure that what happened on collecting Canal does not happen again okay and uh I saw on the bid where town project manager has to approve prior to them taking the next step but it's just when their grader goes through that's that's the key um the slope I expressed a concern with the slope on these previous roads and some them are holding water on the canal side so that that slope they've they've got to and I think this past contractor used to go and make it and develop everything's nice and smooth and sweet you know out here we really need that slope it's critical to you know get that water going the right way cuz I know there's some places out there where there's a puddle in the asphalt next to the BM so the slope isn't there yeah I actually have a slope level for that purpose that's my personal six foot level ballards talking about swes in the past my understanding is the ballards that we put were on the dirt roads whenever somebody gave us a sale to keep our grater from continuously going to the East and vehicles from driving you know to the East and the road getting wider um since we're Paving now is what is the the deal with the Ballers are they going to come out I thought we said before take them out we don't need them now because I know some people maintain their own property they have to take time to weed eat around them some just mow and they don't weed eat around them some of them are knocked down they're just laying there do we have kind of like a plan like with these you know pavement baller Swale situations so it is our intent and actually I want point I didn't bring up um it is our intent we had to the problem is we got to figure out which ones we put up and which ones were put up by residents um that was kind of a void that was in the commun within the communication between Larry um Mario and the two of us um so right now we're trying to figure out what those are but if we once we figure out the ones that we installed we are going to remove them we are also going to remove any other road hazards that have been installed um for example telephone poles laying on the side of the road um there's been Railroad ties laid on the side of the road and I understand what the intent of those are but those are considered road hazards and being located in easeman it could open Town up for liability because if somebody hits them and flips into a canal and then the home property owner can be held liable as well as the town because the town recognized it and did not do anything about it and when you're clearing for the ditches the the swes the drainage are you paying attention to remove the invasive trees and absolutely okay because I know those accases grow so fast and you think nobody's touched it in 20 years but it's actually probably only maybe three four year old tree and we are not only cutting them we are removing the smaller ones we are removing uh even they Australians because the issue with the Australians not only are they growing into these swales we have one road particular right now we're having a major drainage issue because there's a three- foot diameter Australian pine that took over the entire soale um so that's going to be removed and that that one will be physically removed but all the smaller stuff we actually removing them roots and all so they don't come back because that's one of the issues they've been cut back and then they left and then they just grow right back so we're actually going out there and physically removing them fixing the swes residing them and so they function properly last question for you before I ask Francine one side or the edge of the pavment are we going to S it we putting Bea down how are we going to avoid these drop off situations that you know some places we've rolled S farm side like on D road because it's not a good situation what are we doing moving forward we're either gonna a lot of it's going to depend on the road traffic but we're either going to S it or put millings down on the on the first foot and then sod Beyond it Bea or something like that a lot of it's going to depend on how long you know if a lot of people run over because that's the issue like You' mentioned on d uh we laid sad in front of the animal hospital hospital to try to to eliminate the drop offs and people keep driving over for whatever reason like there's no reason to drive over the road is wide enough but for whatever reason people people driving over it and so now all of it's dead so we're going to have to find another solution more than likely there' be some type of of Milling probably be the best thing so that way it's not a permanent Road surface but it's stable enough to prevent the drop off from return but that's not in this bid for any Edge treatment okay no we will be doing that in house all right um Francine we talked about earlier when we're talking about Paving and I asked to you know let's pick it up here CIP when we talked about adding those roads um from the side BR Road North uh North Road from B to C KC we said if the bids come in and we can afford it we would do them all my question to you is why wouldn't you bring the you said you want to bring the capital plan next meeting we won't have the numbers no know what we can afford to do this year so okay and that's a very good point but we also have the question about whether um residents want the roads paved we don't have it on the agenda for discussion tonight but I think we kind of want to have a little bit more knowledge of that before we get to awarding a bid the award of the bid is on April 6th we don't have to discuss it until April 6th if you don't want to but I just think that's T make the decision so we can adjust the capital plan I thought that was the intent we get the numbers we sit down we look at what can we afford to do you know and then we adjust the capital plan accordingly what we can afford to do okay with me to do it all in one night I just didn't want to have to deal with um the two-part question we have enough money and we have residents in here that we've talked to and we know they don't want to do it so I thought maybe kind of try to break it up in two conversations but one do we have them I'm gonna break up this party a little bit you amendments amendments to your CIP are done by ordinance so that's that's two readings and you cannot award a contract for capital projects that are not in your CIP because they're not funded so consider that your award should be at the second reading of your ordinance well there you go so we can okay let's get that Capital ordinance to the next meeting okay or I got nothing wrong with having another meeting having a second meeting to have the public come in you when we get the numbers talk to the public and because we just need meetings so however you would like yeah that was it CIP Francine like to proceed yeah Phyllis needs a new battery go ahead Phyllis this the last item you have M oh no that's all right Francine can you help me um it seems like you guys are figuring out swailes right and easements but one thing we need to know I think is who is going to maintain the swes a great question well I think we need to FR that up yes we do we do it's the property owner's property I don't mind mowing all the way to the canal for myself so so with regard to the easement if we already have a drainage ditch and we've had problems with the drainage like the overgrowth but there's a difference between a ditch and a Swip correct there is and I'm telling you right now we're doing as discussed previously about the prep work for the roads we're clearing up um um what would you say um ignored or deferred maintenance if you will for um existing drainage ditches and existing swells that have obstructions in the selles that we have easements by way of deed okay because okay when we have easements by way of deed we can do that obstructions in the swes are are not all on the resident okay I I agreed yeah I think it needs to be somewhat of a mutual effort and we do too we need to get the swes moving we need to get the trees out of them but have you guys purchased an equipment to blow out the gold s that's that was going to be in my comments later that a long time ago with Larry and I don't think currently we're working with a contractor to clean out colberts we're going to start on the one we're going to start on the ones on collecting canal and the lettered roads basically start South and work our way north um since all the water comes this direction anyways um as far as procuring equipment to do it in house uh we would need staff to operate that equipment no I'm all for outsourcing that cool I think additionally real quick I want to add to that I think we're doing a sample area because as I've mentioned to a few of you talked to me uh we don't know what we're going to find when we start clearing out the covers alligators yeah well besides that oh you're gonna find a bunch of that too right and so before we go full scale through the town we want to do in areas where we can perhaps control it okay um still the baller at the horse bridge is still crooked we have a lot of equestrians enjoying that trail so if you could straighten it out somebody will get hurt there get hooked on that um okay um um are you Outsourcing the tree removal I guess that's some of it so anything large anything larger than a foot in diameter yes um foot this way yes foot 18 inches well we can do the we can do we can do anything less than a foot in a house because anything that's about a foot is usually no more than 20 30 foot tall then we can do that in house but some of these Australians are no you have to Outsource them I have three guys that don't even do Australians they they call somebody else so I'm just saying I have no issue with Outsourcing that you guys stay safe and have a crew come in that does it for a living I don't care um North e roo I've been in the golf park cruising around quite a bit and I'm seeing like no burm at North EO has a huge burm like at least a foot and then it has no burn on certain parts of it we'll go look at it okay and so what are we doing to improve those BMS and uh I know you putting RI wrap down to secure the banks and how is that working out so basically we put the large rip wrap at the bottom and we build it up to stabilize the base at the water line and then we bring up dirt which will increase the the width of the BM and you're having success that the BM is staying on the road now yes unless somebody flips a car over it and then and how many employee do we have at Public Works including you guys just question uh it's in my report I want to say 12 13 including your staff your clerical staff as well you have with staff yes I going to do count my head we have a director of Public Works a superintendent of Public Works we have three public service worker 3es three Service public worker twos a public service worker one three general maintenance workers a public works coordinator a public works staff assistant and we have two temporary Public Works Consultants whose terms are ending tomorrow 16 thank including the people that their term is ending tomorrow 14 yeah so it was 16 less than two is 14 correct and one of them is um temporary also be leaving soon and um the cameras at the Public Works facility are you able to get them up and running they work and I'm glad you're meeting to Town residents at Town Hall I completely agree I think that was an accident waiting to happen they don't really need to be in that facility I think that's good and um how many employ I I'll I'll ask for that that's not your department thank you you guys are doing a great job thank you seeing improvements every day Mariam Richard when you go out you're out out in the field and you're working and um you are talking to a resident land owner um about whatever you're discussing and you bring up easements um do you jot down if if you have their approval do you jot down their name and then send start sending them paperwork to facilitate them um giving us an easement it depends on what the like if we go out specifically to talk to somebody about easements my intent is to bring it with me with my other witness and uh notary so that way it can be done on site and at you know at the time of the discussions um if it's somebody like I say I'm just out there somebody brings it up um depending on what who it is like if I'm just talking to a random resident I'm hey talking to you can you give me an easement um but you know if they if it comes up into discussion typically what we do is if I don't have the document with me we have them come here or I mean I can bring it I can bring it to them it doesn't matter and then we will you know we draft it and we yeah of course I write everything down you know who they are where they live and what they want because some some folks have no problems giving us just a blanket roadway drainage easement uh we've had a couple of residents who were concerned that we're going to widen the roads into the drainage easements which is not our intent because we still have to maintain a drainage system you know we can't widen the roads like you know four-lane highways or something because there's not enough real estate we have to maintain drainage above everything we have to maintain drainage right so but some people have had their concerns and so what we do is you know we we've actually established we have roadway easements we have drainage easements and there are two separate documents that are signed and recorded uh we have a couple of residents who have gone that route um but yeah I mean if it comes up and if I don't have the document in hand we do direct them to come here if possible or bring it to them whatever more can me the reason I brought it up is because uh I believe I asked for this a while ago or mentioned it a while ago that I wanted to try or I thought it would be a good idea to try and get ahead of the curve since we knew with the capital plan what projects we had coming up whether they were going to come up up in one month or whether they were going to come up in six months to get a hold of the residents on those roads and there's nothing saying that a resident that doesn't live on that road can't come here and voice their opinion but too many times we hear that residents are upset from somebody else and they're not talking to staff and they're not talking to us they're seemingly talking to other residents whether that conversation goes one way or another we have no idea of knowing until they come up here and say they've talked to uh one two or 10 people that are on that road that are having a problem with it um so we don't have any teeth to say whether that is a factual statement or not and I'm not saying it is and I'm not saying it isn't what I'm saying is it holds up the process when we're starting to go on things and then it holds it up to say oh my God God now we have an issue we have our crews that were ready to go now they can't it causes us mobilization issues okay so if we get ahead of the curve by saying okay within the next two weeks or three weeks we're going to be on road X send a notification a small concise easy to understand verbiage uh no offense Elizabeth but not legal terminology you know that's going to Boggle their mind this is what we're going to do this is what we would like to have from you this is what we need are you in agreement with that yes no come talk to us because this is the plan we're going to be on your road just like fpnl did when they were doing the roads and they said we are going to be in your area you know and they send letters out certain time frame so I think that'll speed up the process a little it'll take some of the confusion out the residents on those roads will know what's going on and if they say no they say no and if they say no then why you know um I can't fathom that somebody wouldn't want Paving on a road that they're not going to pay for that maybe they helped pay for another road um for a lack of understanding of really what is to take place on that road so you know you mentioned it before and I'll say it again that giving an easement is still the property owner's property that's it um so the what's going to come now or what's going to come later or what about this and what happens if this happens all those answers can be done and clarified by the owners or the properties that are that are directly affected that live off that road I I don't know how Council feels about consensus is sending a letter out to say hey this is what we're going to do um but I think it's a good idea to contact the people that need to be contacted so we are going to do that we are and and I think we have to separate it into people that we already know the warranty deed has an easement in it hey you guys don't know if you know this but warranty deed has an Eastman in it we're cleaning up your swell your ditch your whatever and oh by the way we've got a bid out for road paving um and we can do something like you said you good with that you're not good with that if not come on and see us if so send this back in with a check mark people usually don't respond back so we'll have that open house and Richard tells me he's going to take Craig and Lexi in the car and go visit people with the forms so that they can explain it and get them notorized right there like I said we're down to 25 properties that we have not gone back deep enough in the O um to find the or we have not found those warranty deeds at this point in time but we've done the full 24 Paving routes um and found all but like 25 properties at this point so we totally agree and we'll see how we do okay March yeah um what is the standard that you're using for the culverts on 161st some of them are back bags and some of them are rocks I mean is there a pattern that you're following for any specific job so the town has a detail for colberts which include the ri wrap bags right um for the in walls and then we use the ri wrap Rock on the actual Canal Banks because that stabilizes the material as it flows north and south because there there was some concern that some of the pipes are being um surrounded with rock instead of cement bags you're saying not any of the ones that you have done lately the three that we have done and the one we're going to be doing after on 11th um will'll have the ri rack bags which are basically cement bags is what they are right and then where is the Rock placed the Rock is in the canal Channel itself right so basically in the channel so the the the rip rap bags are on a semi circle almost like a V so the the culbert pipe is in the middle and then it kind of acts like a like a c or a v almost and then the the rock the larger rock is placed at the bottom just below the water line or the average water line and then up about two feet and then we put smaller rock above that and then infill the top of that with dirt and how is that going to be maintained because there's so much vegetation around there seeds drop seeds grow you know are you going to be 10 years out and have the same mess that you're dealing with now a consistent mowing schedule will eliminate all the problems that we have had even with all those rocks in the base of the well eventually grass will grow through the well the berry but that's why we put dirt about three feet from the waterline up everything above it is dirt ins okay and that's what it be mowed everything below it has morfi cloth which will theoretically prevent uh vegetation growth through the Rocks So in theory nothing should grow through the rocks and if it does we just trim it like we do like that's what if you look at D between the gates and the canal it's hard to tell but those are there that whole that whole Canal bank is all rocks but it's hard to tell because of the growth through it because they didn't put anything underneath the Rocks when they did it but we are able to to mow and keep it tame okay uh grber and 161st seem to have very vocal uh residents regarding to pave or not to pave and um I'm wondering uh is there plan to have meetings I did hear something about having um if there you know uh was a need but are you going to create a need and make the invitation uh by sending out a letter inviting um stating whatever you can in the letter to clear up any concerns that they may have our plan is by the end of next week we'll have a letter mailed out to the residents in the affected areas and we'll figure out a date obviously before we send the letter out as when we're going to have like an open house um it'll probably be somewhere in March that we'll have the open house and you know anybody who wishes to ask any questions or anything um the bid is online they're if they go through the bid documents there is a scope of work the scope of work includes a map that shows the area that's going to be paved also has a scope of the projected width this will be in the letter that you'll direct them to that okay all right um what are you doing about dead trees that are on the road Edge for instance South a road just before the corner on collecting there is a dead tree tree that I am holding my breath every time we have a strong wind that it is not blocking the road and the canal we got to check and see if we have an easement to be able to do work in that area because I think that's one of the areas we have questions about okay and and there is a pine tree that is definitely in the road and there's a black and yellow uh caution Thing by it that's overgrown by uh by bushes and the tree is um periodically debarked okay so your answer is you're evaluating dead trees in the area we're evaluating all the trees and all the areas um obviously our goal is to not remove Natives and we're removing the Exotics um as we can um a lot of it has to do with just the amount of Staffing Revenue you know because every time we cut a tree down it costs money to be able to to cut cut the tree down um so we have to evaluate the whole town as a whole because we've got I mean there's there are roads where there we have there are roads that we have Australian pines that are currently leaning over the road and Craig and I were out on a road last month I think it was last month where the garbage truck had to stop almost stop and creep down the road because the Australian pine was leaning so far over the road that the he was worried he was going to hit the roof of his truck on or the garbage truck on the tree right so those are the ones you know the ones that are leaning over roads leaning over houses power lines um are our first priority obviously the dead trees we're looking at the ones like the dead ones are out front here that are about to fall on F road if a good wind comes by and the wires the wires the one at East the Australian at East Citrus and F Road that's you know a lot of them there's a lot of them I mean there are a lot of them along that Canal on okobe also and there are some that are really really leaning way over by the Presbyterian Church I am also is going to come down yeah I'm also in discussions with the county um over the last few weeks I have talked to Road and Bridge traffic the signal people I probably talked to more County departments in the last two weeks and I did the 13 years I worked at the county and um trying to figure out who owns what who's responsible for what and um try to to to establish who who does what like one of my questions was exactly what you just said the county mows their drainage ditch on the south side of okobe Boulevard and they only do the north side of it they don't do the south side of their drainage ditch and I asked that specific question is you have Exotics including including in front of their own fire department they have Exotics that are growing Australian pines that are towering 40 50 feet and one good wind will shut down okovi Boulevard because when those trees fall you know that's where they're going to Falls over ooia Boulevard it's going to trap our residents and so I'm trying to address that and get them removed okay because I know when um when I was in charge of the adopter road on uh okachobee Boulevard uh we worked with the engineering department and uh you know that man has retired and um you know he used to get on it right away and the mowing down to the canal was always done I mean now it's like a three foot if that that they're Mowing and they're leaving a lot of tall grass growing and you might have a lot of Critters crawling in there and uh invading that walkway that's there why God's name would we maintain a count yeah according according to the quot to quote the director of the guy who takes care of the signs Florida State statute uh stat said unless you have an interlocal agreement with the county the the municipality in which the state in which the county road resides is responsible for its maintenance and that was from the guy who does all the signs and the striping all that other stuff and his exact words to me were is the county will not enter into a local interlocal agreement unless we unless the town puts the speed limit back to this to the speed in which the Florida Department transportation had rated for that road which is 45 miles an hour and we know that's never going to happen so um you know I've talked to the town manager that writing yes ex excellent yeah I asked him to send me I asked him to send me an email with that information specifically on it because right okay so um let's see uh the corner of the southwest corner of B Road there is a pothole that if my Prius ever fell in that you wouldn't know where it went it is so deep it's it's at least a foot deep you wrote In what B Road Southwest corner on collecting Canal oh collecting Canal okay that has to do with the lack of drainage and deterioration of the Canal bank um oh yeah we saw that this morning yeah and I think there's regardless it is a hazard it is a hazard for uh Vehicles going around and getting in it and I mean they can rip their axles and their wheels and everything to part yeah it's on the list yeah okay well it needs Road Rock and uh asphalt asphalt yeah to hold it in place um yeah we're currently working on all of the we've got most of of the edge breaks and potholes on the south of side of okoi but there's more obviously south of okobi than there was north of okobe well I was surprised you did some of the problems uh south of that pothole and that was the worst one yeah okay uh and you mentioned the clean up of the south side of the okachobee canal already so that's all all right good deal now I don't have any comments for myself for later um you wanted to know how many sites that had ballards that were installed by the previous contractor 21 and what do we pay to lease the greater any idea I would have to get back with you I have no I it I have no idea okay I haven't gotten that far in the budget I and and the reason I ask is if if Gruber is a public road if 161st is a public road if we've ticked all the boxes for the seven years of Maintenance why would we allow residents to come in and say I want to keep it dirt and what I'm driving at is if you pave it it reduces our maintenance we get to get rid of the grer we don't have to buy rock we don't have a exactly a flood problem a sore spot um something that takes away staff time resources fuel energy to get The Grater fired up go out and do a FP FP on grber and then put it back beyond that it also by Paving the roads it decreases the response time of fire rescue it decreases the response time of P of the Sheriff's Office yes and you know like uh Captain Turner had mentioned there were six shootings in this town one of them was domestic Reliance related and I'm sure sure if somebody was uh being a victim of domestic violence a minute is a world of difference in response time and if they've got to do 20 miles an hour down 161st a mile and a half in to try to get to somebody's house to save their life that two minutes could mean the difference between life and death absolutely so in whatever Outreach we're going to do for these residents you know and this is just me speaking for me in no way shape or form should they get option to say I don't want my road graded it hinders the mass it hinders everything that you guys are trying to do it hinders every bit of forward progress we have been trying to make assess them the cost ding ding ding Marge ABS freaking lutely so I love the idea of having to figure out okay Swale on one side Horse Trail on another you know drainage is going to slope this way swail Rec recreational trail other side fabulous um and and that's just me being me I just can't even imagine we're not here to make people we're not here to make friends with people because you don't want your road paved it's a public road period um and I have a couple yes no questions for you and these are yes no questions yes or no did a resident jump on a piece of town equipment and a c the driver yes was The Driver injured no was the resident injured not that I'm aware of was the was any public property damaged not that I'm aware of okay was the equipment damaged no did we file a police report yes thank you that's all I need to hear that is unacceptable and I am truly deeply sorry that you all are out there doing your best working for people and you have to be accosted like that um and I hope it is dealt with to the fullest all right wrapping up that section moving on nope you had your comments yep done done all right I'll just do it in Council come see which is where we are now reports by Town Administration section 11 Town manager okay um one I just want to say you made all of my dreams cont true it's 9:15 we're going to transmit the first reading of the ear you have to thank yourself for working on that since May of 2022 we do it right because we take forever so a new motto it wasn't it wasn't it wasn't easy there were a lot of tough discussions um but it was all very thoughtful and um necessary conversation and it's the first time that it's happened you know since the last time the comp plan was done which was at the very beginning of the town's you know incorporation so it was really a big deal and you know we're kind of ho hum about sending it but it's really a big milestone for us um speaking of Milestones um the trip to Tallahassee last week was a Florida Liga City sponsored trip to Tallahassee and it was open to everyone who wanted to go um and the league puts out the itinerary for that um I did work with our lobbyists and did discuss with them trying to get meetings scheduled and those meetings had to be on the Fly because this year in Tallahassee is extremely busy I sent the fourth week of briefings out to you today there's a lot going on uh and some of it will affect us adversely like increasing it'll be great for our residents but could be terrible for us in that Homestead exemptions have two chances of going up um couple of other things sovereign immunity um may go from 200 to 400 and additionally in some cases imun municipality May settle for more than the $400,000 limit so um risk is there and revenue um opportunities are getting less and less rental which we have a lot of rental uh we do not have anything on the books for that it is supposed to now be what's being proposed is regulated by the state that leaves us you know with not a whole lot to do um I'm not going to go through all of it but I encourage you to take a look at um you know what um is coming out from the league they send something out once a week There's a phone call in 9 o'l I think it is every Monday morning even you know if you're busy you could still leave it on your phone and listen um and um I'll keep sending you the weekly reports that we get for us uh um we asked for 750 we're still hopeful for 750 of an appropriation for drainage that will have to happen during the budget reconciliation process um the Senate did not have us in their budget but they made a budget amendment um because we were able to have you know some um representation um to get us that so the budget amendment has Us in at 350 and the goal is that our lobbyists continue to work their magic and get it back up to the 750 um wanted to go over that because that's where our future funding has to be coming from that and grants that we apply for um you know for a lot of it and saving money on maintenance that being said three things um related to that council did give us me in particular the ability to exceed $25,000 on signing off on POS for maintenance to move things forward more quickly um Richard didn't mention he is talking to companies about tree removal I don't know how many there are that is likely to be over 25,000 um additionally we have a dump truck analysis going on is it cheaper for us to keep renting it or is it cheaper for us to buy one um that analysis has to come forward it's my appreciation that we've spent um Richard you can you can answer this better than I can but we've spent almost as much as buying a a new dump truck on the amount we've paid for rentals um and that dump truck is necessary for a bank stabilization program and that would be coming to a an agenda near you I will not be signing off on that even though it would be over 25 and less than 100 just sharing with you the stuff I would sign off on versus not um because I only have a couple more weeks to do this and we've been very frustrated not being able to get pricing back as quickly as we wanted the rock um for the bank stabilization we need 12 to 24 Rock for the canal stabilization what we can get from Aggregates and other providers is 9 to 12 in and that's not enough we used 9 to 12 in last year um we found another provider but they are like in ovido or something in the center of the state I will be signing off on $75,000 for that and bringing it back to you um because we don't want to slow the bank stabilization program down I have already signed 25,000 for Murray Logan and I did that based on three local quotes and somebody's recent um contract um and the third thing is on the covert clearing we are looking at a piggyback using a company um used by Palm Beach Gardens um again we're going to be doing that on oh and Wellington okay um it's a piggyback and we're looking at doing um limited areas on it again it's going to be over 25,000 when if I sign any of these they are still going to come back to the council for ratification because the council you know only gave us that so we could try to speed things up um it's not going as fast as we wanted so I just want to get that on the public record the other thing is wbi starts next week week um and we were able to get that under the $200,000 um and you'll be getting status reports on that I also believe since we're going to be lowering the canals we're going to be trying to assess culverts on collecting Canal is the first ones we try to blow out if you will and I think also we're going to try to be doing some dredging where we can since the canal levels will be lower and we will need to tell the residents about that sorry for this detail here I just you know Richard probably didn't want to go into more of this stuff um couple of other quick things good news and bad news good news we trained people well bad news Andrew got a job in Royal Palm Beach so I feel you know that he did an amazing job for us um we could not give him the kind of money that he wanted and I think he will have a very good career in Royal Palm Beach and we've told him when he realizes how much he liked us better he should look and come back um in the meantime again for some of you who talked to me about Andrew leaving um I said we would use part-time people until we can get someone to come we have two part- timers um one is going to work on the weekends um and look at unpermitted activities that occur on the weekends so we might actually amp up our weekend coverage um so we'll see how that goes now what we put into investments in Andrew I mean how do we regain that oh well um I think Andrew set up an excellent code process he totally redid the field reporting he gave us files that we never had um we had a very goodess process as he built our process as well as us giving him training I feel comfortable with that yeah okay he did um we also standardized a lot of things with using Andrew um and we also most important thing of all I think EST establish some um credibility in the community with our code you know not everybody's going to like it but I think people um appreciated that we were Earnest um AGR tourism um we had the first meeting the group wants to do best management practices um we need to figure out how we will legislate something with regard to best management practices um we had two appointees that we have not heard from and that did not come to um initial meeting I don't know if Council would like to reappoint um or talk to their appointees and see if you know they will be coming um we're having a little difficulty getting a quorum for February because if we only have the three people we need all three of them what's the date um the date that we can get um Stephen Hall from Dax is February 21st and we can only get two of our three members that came to the first meeting on that date additionally I don't think Chief vomero is here but we were gonna have her come and join the group as well because PM Beach County fire rescue has come up with some um best practices based off State statutes for um for instance if you have a food truck on your property the town can't do anything anything but if they bring the food truck to fire rescue or fire rescue can come out to the site they can give them you know the um necessary um Health Department approval or whatever can I interject real quick yeah so we have two people that aren't showing up you can't get a hold of them right we appoint by resolution yes can we have a special meeting before the 21st and appoint two new people let us reach out to the to that's why I'm bringing it up yeah I mean if Town Hall can't get a hold of them that's there's a problem there I think our attorney did have the only conversation I think I spoke with one of them and it was very brief conversation where we agreed to reschedule a call for the next early the next week and I did not hear from them I would say let whomever the council person is deal with it yeah yeah I know they had a very large um AG tourism event last Sunday that they were preparing for at the time you scheduled the uh the appointment so we've been calling around for February 21st okay hav't a to hear back if you could yeah confirm attendance that'd be great because we're having a hard time getting an alternate date that works um so so if they don't if they're not going to come they're not going to participate which this is crazy because there two people from the same family right which blows me away in the first place um then you can call American call special meeting within what 48 hours notice and we just do a resolution how how soon could that happen Madam attorney if it's by resolution and these people say no and we find two new people we want to appoint them is this this committee sunsets so extended I'm talking to the attorney your resolutions uh you I mean the resolutions drafted it's a matter of you know tweaking a few things um and resolutions are effective immediately so I mean it's not not a really big deal on food for thought if if I don't have a problem calling they tried to connect with zoom at the the date of the first meeting and couldn't make there's proof that they tried it okay so okay okay were you done with your or do you have more one more what time was that meeting it's at six o'clock six on the 21st six we did not we were not aware of them trying to connect with zoom um I don't believe that we had a zoom link for agrotourism so okay what else okay okay um we have another committee that doesn't have a quorum for its February meeting at this time and that's fact it shows on your calendar which um you know we're trying to put in there for each meeting on the 12th we don't have quarum for that night's meeting so um looking for some alternate dates at this point in time and at your next council meeting um you will have the quarter Le financial report that was not in your reports this time we did not get them um actually until I think it was Friday or today no yesterday I got them midday end of the day yesterday um and you will see what we have to carry forward at that point in time so I'm going to end with that um and um again thanks for making my dreams come true and by the way we have nine employees here and a temporary because I know that was a question asked and before we added the three people for the Canal bank stabilization I think in total we down the order here Marge what you got yeah um Fring I thought that we got the 750,000 last year uh Grant it wasn't awarded it was just tell me what we did I'm happy to do it we got a $750,000 appropriation and we got a $350,000 Grant the one 350 is to go ahead and identify the changes that we need to make in our drainage system and will help us Reb balance the flood um basins so that we're not dependent on every single properly property to to manage so we'll be able to do fdas differently the um $750,000 appropriation was intended to be year one of a three-year ask because we need to do CTS and C we need to finish what we started if you will which is the CTS catch basins and other control structures so last year we put in um how many 30 40 something like that culverts now this year we're going to use the 750 for culverts and catch Basin for the culverts and swes um next year's ask is also for 750 right now we're in that budget for 350 we already have agreements for this year for the 350 and the 750 and next year is still going through committees and we'll go through the budget reconciliation process um if they reconcile and both parties agree on the 750 generally speaking it doesn't get vetoed but who knows um um the budget seems pretty strong well the mayor the governor apparently told um all the Committees and his budget staff that they needed to cut from 1 point something billion to 1.1 billion I think they have to cut like three billion something on that range of magnitude and if I'm incorrect I apologize but they have to cut but the way they cut is through budget reconciliation and if you don't get both the Senate and the house to agree on budget reconciliation and it's like a a 7-Day period of back and forth um that's usually where they cut where there's a lack of agreement okay and when will Mr book be giving us the update on the status uh he will give us the update on the status all the way through he gives us little updates like for instance what I told you tonight is based on an update that I got from his office and I know how they do the budget reconciliation because we were getting blowby blow last year during the budget reconciliation in terms of coming to the council meeting after the legislative session I was thinking about that today we probably need to try to get him booked no pun intended to see if he can come to I would say May meeting okay and the governor has to sign by what June or July um budget it has to be signed in June yeah okay and um Robert and uh Laura you were up there um with book I did not go because I broke my foot I'll give a report with my Council comments yeah okay thank you that's you're you're welcome they are also continuing to work on somehow protecting the rural lands next to us um and also if there is any possible way who is that that you're talking to them book book any possible way at the state level to uh prevent I guess encroaching development encroaching North from all engineer to move that forward because it will require some planning and maybe engineering some work from those skill sets that I don't have okay so is that something we need to put on the agenda to have a meeting to move forward with because it it's been a long time now it has been a long time and I I know that you all gave the direction and I I know Francine has stepped out but I'll follow up with her and and make sure that it has been assigned to somebody I thought that had been done but we'll I'll work with her to make sure it is okay um I don't know I guess I got to wait for Francine to come back in uh because I guess my questions are for her um but I will I will give you one Richard um 43rd Road North that got blocked off of 140th going out that way um I drove back there a while ago and um I have a minivan and you're not going to get an emergency vehicle back there so can you please take a look at going all the way back through there how it winds and comes out on 43rd from um starting on North Road and then going I forgot what the road is and past um 147 145th you cut it back well okay we cut it back but one of the bigger issues is good luck on a firet truck trying to make a U-turn that's yeah because thanks to Indian Trails um if a firet truck gets back there they're going to need a crane to get it out because it ain't backing down and and I know we had asked at a meeting for them not to do what they did which was to put the guard rails in there but to put a gate so that way they somebody can get in an emergency vehicle can stay right there and they just no no so um but it is a dangerous situation and I hope nobody ever has to need um something to get in there because they get in they're not going to get out um I gota wait for Francine so can [Music] I is done I will hold okay I'll go Richard um using the 1224 Rock we're putting down mesh or what kind of material are we putting down it's called morfi cloth it's a thick webbed cloth about yay thick all right it's like hanging over the edge on C Road when you see where the tractor hit it because that's worked awesome there you know that's all rock that bank and and it's so critical having that cloth because just rocks the fish will get between the rocks and the dirt will erode but having that cloth there that prevents the fish and turtles because that's a lot of what causes the slides is the animals under there Bing digging and next thing you know the Canal bank slide so they that cloth CU some Reon I don't think that was done at the previous uh restoration project projects yeah I never saw it it was speed liit signs on okobi have we looked at those talked about them are we goingon to put some up there well now that we have out that we're pretty much on the hook for it unless somebody gives me direction to try to pursue this other methods like by our attorney um we're going to wind up being responsible for them U like one of the points I brought up to the guy when I talked to him is that you go through the entire town you get to f Road and there's a sign that says reduce speed ahead and the speed limit sign 30 mes hour so um we are addressing that right now uh we've ordered the posts and stop signs um Craig and I actually yesterday we drove up and down uh okoi Boulevard counting signs figure out how many speed limit signs we're going to need don't we have a bunch of 30s left because we reduced our town from 30 to 25 did we oh I'm sure we do we just got to figure out how many we have go do go through our inventory figure out how many we have in on hand and then we need the posts it's the big thing which we're waiting on to come in and then I found out we're also responsible for that flashing light in front of the fire station yeah I remember when that goty ran over it was like eight grand and they they told us to do it we said no thanks and we have to test it and see if it actually works well there was one on both sides okobi yeah there still and the one on the North side got run over did they put it back up there there's one there I don't know who put it there but it's it's definitely I don't think they ever put it back up the one on the North side I swore I saw it but anyhow and then mowing now that we're lowering the water levels for inspection stuff can we mow that bottom couple feet that we couldn't hit because it was too close to the water yes that's cool doing a great job thank you mower comes in um all right go ahead yeah I've got more later Francine do you have it's got to be easy I mean you should know do we have an update on the Wawa when it will be um people have been asking when it's going to open everyone's asking and we're trying to find out when you know that's still going through the county okay and um Southern lawn and equipment what is is there any new news they're working with their building official they were in here earlier this week I have reminded everyone that um their development approval included a bond and that we would be willing to work with them on whatever type of facility they wanted to give us whether it was a letter of credit a letter from their Bank whatever if they cannot afford the bond um but we have not received that yet so I am patiently and graciously waiting okay thank you you're welcome so it's the letter for the uh for the bond that's all it's holding them up that's pretty much that's what's holding them up from moving forward at this point yeah okay bis do you want to go yes pressure on [Music] um are you sending the equipment that really the rust buckets to auction I thought we talked about that you need a dump truck let's get rid of the garbage get a d the auctions at the end of the month oh perfect so do you foresee maybe getting a decent price out of what you're sending there that it might um be able to be uh towards the dump truck to complet to be completely honest probably not because what equipment is going so right now we have some miscellaneous stuff that came with the skid steer we're looking at the dump truck well first we were examining whether we wanted to try to get the dump truck fixed or if it's beyond it's I don't think think has ever worked to be honest um same thing with the water truck we're looking at that it needs a new pump we got a quote from the manufacturer for the part alone that we believe it needs is almost $4,000 just for the part and that doesn't include because the solenoids are air actuated so we don't know if that system is working to rent a water truck when we needed it because I haven't seen that sucker out in a long time right would probably well it's whether we even really need it or not and the grade all that's also been sitting as well correct these are all things we bought used so the issue with the long stick excavator and the gr all both is when you use those pieces of equipment you have to put the items that they dig up into something and we don't have the into something to put them in hence the reason why we need the dump truck so it's a it's a circular issue so the theory is as I've contacted there's a state purchasing agreement for um that has a state price agreement for dump trucks there's a 10 yard brand new 2024 dump truck that's listed on there for they want to say it's like 96,000 I'm trying to contact uh Tampa truck which is the uh the or the group that does the state purchase um we have spent $80,000 in the last two years renting and that's not even like solid every month of the year rental we're talking three months here three months there over the last two years in rentals so obviously it'd be very advantageous for us just to buy one and if we buy one brand new it'll probably just like the long stick excavator that we are still using today that is bought was bought new and is 23 years old um the dump truck is the same way providing that it gets maintained and that's one of the things I'm also working on is a better maintenance program for all of our in looking at a um don't they make the dump trucks being that you're talking about the rip rat in the canal that you could open it on the side or is that not gonna happen the rental does that the one the but that's also very small the regular dump truck regular 10 yard dump truck similar to what we have now just not as big we don't need that's a 12 yard dump truck and frankly we don't need something that big in Austin Tak so you don't think you need one that opens on the side like you're renting CU I watched that little tiny thing go back and forth 42 times just to drop a few rocks and I mean it took them forever to do that job so I don't think not here yeah I don't think they make a 10 yard dump truck that tilts sideways okay the only ones they make are the small ones like that little was was that three yards I think we're always gonna have Canal issues that's why I'm ask [Music] um so we had other options um besides Paving um back in 2019 when we started this project and um we had a uh we had a lot of push back um the council the 2019 council did we were trying to become become more green and unfortunately we had a public works director that just wanted to put down petol based product so this is what we got um that's it all right um update on Tallahasse I went to Tallahassee um when I got there we weren't in the budget the House of Representatives was not amending their budget they were one and done but we had an option if we could convince the Senate to add us as an addendum so addendum or Amendment amendment I guess um met with Rick Roth our representative met with Gail Harold our Senator Rick said he talked to Gail you know they worked together and um Wednesday night we got in a senate Amendment into the budget as a $350,000 line item and the way it works is the way it's working this year I think so far I've been up there four years I guess Co we didn't go and every year it's been different you know there's been a different spin on why you do or don't get money so this year the governor is pretty much uh said he doesn't want to be the bad guy in veto so he has told the House and Senate last year 117 billion was our state budget he said this year you get4 billion that's where the three came from so he's already told them you be the bad guys you bring me 114 billion and it's approved so our next step is like Francine said the Senate and the house get together now and that $350,000 is just a placeholder if your ask is more than 500,000 you do a $350,000 placeholder if it's less you do I think as low as a dollar or something it used to just be a dollar everybody did a dollar placeholder then they all meet and see how much the real number was so our 350 is the minimum placeholder for projects over 500,000 so if you looked at the budget you'd see tons of $350,000 and then uh they all get together and figure out okay you know is is latche Grove 700 50,000 within that 113 or 114 billion so that's where we are there's nothing else we can do you know our lobbyist talks to these people all the time um last year we did ask in a three-phase program I met with 11 Senators I had 14 meetings I met with the governor's budget staff um that's a really good meeting because that's where you know tell them how we use this 750,000 how we're using it now and it's critical loow hanging fruit that we're picking off now you know we aren't even getting in to the yeah we should replace that we're getting you know we're doing that that should have been replaced 20 years ago stuff so a really great conversations always leave them uh you know remembering our town so that was good U first time I ever been up there for the league of cities I've always been during Palm Beach County days so here's the schedule of the meeting meetings from the league of cities they put together all the meetings you go as a team from Palm Beach County and you go boom boom boom every 15 minutes or every half hour depending some of them are double booked so half you go to one person half to the other and you're there with this card that things that Francine talked about um bills that are affecting the cities they are taking away their power um you know there there's a lot of them she touched on them you know sovereign immunity right now the Mac is 200,000 300,000 that somebody could get out of a city 200,000 per person 300,000 per per incident well they want to change out to 400,000 600,000 which isn't the crazy part the crazy part is or whatever you settle for so they could hit these cities for a million bucks you know that I mean it's kind of just like right now it's a hard number 200 300 and now it's going to be it it looks like this stuff's moving it's going to be 400 600 or whatever you know which is which is the scariest part the the or whatever because it's almost setting a precedence hey this city just gave me a million for this now your city did the same thing to me I want a million so that that sovereign immunity is is scary um Homestead did Disney start that because of their s immunity no it hasn't been changed in 20 years it's been 200 300 for 20 years because Disney won there Chase yeah that was that was the thing okay yeah you got to raise it some you know it's 20 years old but uh you know don't hit us with triple and um you know the the or double and then whatever uh the expedited perming process doesn't affect our town 30,000 residents or more but there's going to be if it passes I think you got two weeks two weeks from the time somebody applies to get them a permit or get them comments and and it's it's scary because it's gon to make people Rush it's gonna make plan reviewers Rush they're going to miss stuff life safety you know or they're just going to reject it to get it out the door in that two weeks then when you resubmit it's down to a week I think so I don't know what's driving that but uh I mean some of these things when you read them you're like who makes up this stuff there's no way it's going to pass and you see it's in committee and and it's passing almost everything going the committee is passing um One Bad Apple up in Gainesville they were charging a huge s tax for people outside their utility area and now they've got a bill that any utility which doesn't apply to our town but applies just about everybody else around us that has a water plant sewer plant they because they want to extend the infrastructure to to rural areas and try to get them on sewer especially you know maybe you're not water but you know there's a septic to sewer program and so they do charge extra because they got to extend the lines extend the pumping power they charge a sear charge and people outside their Municipal limits they're taking that away saying no you can't charge them anymore it's like okay where's the incentive to you know extend the lines and help out you know those that want to help so lot of really really interesting stuff you know from being with the league of cities and you know jumping on their team and uh so a really different different uh stick than than Palm Beach County days so anybody gets a chance next year uh should go to both of them really should go to Palm Beach County days and this but I was upset when I got there and they said you're not in the budget they're not making an amendment and I was like what do you mean you know cuz we didn't go to Palm Beach County days so it was like H but the so that 350 like I say is a placeholder then they'll sit down hopefully it stays in there hopefully it gets up to 750 um I now sit on a construction industry licensing board I had my training couple weeks ago first meeting I was in Tallahassee so I missed the first meeting but uh really serious about unlicensed contractor so it's a it's it's a good board I'm excited sit on that and uh help that Water Resource task force I sit on that we didn't have a meeting this month I park we didn't have a meeting I sit on the streetlight subcommittee and uh we had a meeting reviewing the County's policy on street lights because uh you the issue is the county puts in street lights then they hit the municipal limit and they stop putting them in which doesn't hurt my feelings in our city and I don't think it hurts people in our City's feelings but some of the other cities are like hey you know want you to light up our road they're like no so they're making them permit it pay do everything is from scratch they're like let us use your drawings you're permitting you've already gone through the process and you know let's let's team up and get continuity through the city so I sit on that I volunteered to sit on that because everybody I talked we don't want street lights in our town so that's why I'm there to understand it and understand the angles we're going and I speak up at the meetings as they talk about all things they say hey we don't want them in our town um so if uh if anybody feels different speak up I mean if there's a consensus and tell me quit saying that but I've not heard a single person in this town complain that you we don't have street lights I've heard the contrary we have lighting ordinances that says keep your light on your own property the um 350,000 I was looking forward to the budget this meeting because I know we are burning through some money and I want to see that burn rate and and all this stuff we're getting done cost money and I appreciate it all being done but I know uh we're going to have to start backing down some the $350,000 for the canal crew is that right now like labor and material and fuel kind of break even at that that's set up or have truck money in there maybe or we don't have the third employee so we could always translate that third employee to something else I'd like to be I'd like to do that but see what our Public Works folks say I mean for now right now if it's not geared up Full Speed Ahead I mean when we talked about that in the budget was like okay this is a this a 10 20 year plan right this crew is going to start here and just crawl their way through the town and 20 years well all the canal banks will be perfect so that is it for me so definitely please have that budget information for the next meeting the sooner you can send it to us oh yeah I'd like to see it sooner than later if you've got anything you can send to us to start yeah sure uhhuh um Francine I know it's with the the best intention and the the purest most transparent of documented thoughts um we had agreed for the $100,000 blessing to be what 60 days or 90 days it was 60 days and we did it at the December 18th um council meeting okay um and so I was going to go ahead and try to get it all done before the March 6th council meeting so that would technically be a little bit more than 60 days but I'll call it as 60 days but we don't have the contracts back in that I mentioned that we've been working on I mean it you know if if if we need number 24 Rock and number 24 Rock isn't going to be available until X time I understand and the only reason I bring this up is you are completely transparent about what you said you're going to do what the money was going to be for you know why we're doing it this way yeah and I just want to you know soothe any thoughts out in the public that Town Council has given card launch to the town manager to spend wildly and recklessly without our review you know it's it's detrimental fake news like that that just puts everything in a bad light so that's the only reason I bring it up keep doing what you're doing because if you guys need it to do what you need to do you know and we cut off our nose to spite our face and say February 17th you're done yeah we can't we can't do that we just can't uh item four Phyllis tell me true or false the you were trying to refer to what the dirt glue for any any green items we they brought dirt glue and they brought the dust list product okay for folks that didn't necessarily want their roads PID then you know looking for just another option besides the patroling yeah uh we tried the dirt glue on the corner of F and collecting and um it worked dustless yes it worked great for a short time but because of the amount of traffic it it just dissipated and it was unfortunate and it's so expensive and it wasn't put down properly so I not even G to comment on that because that's just going to start a fight anyway um let's see this one that one oh uh Robert thank you for all you did at Tallahassee and covering for me while I couldn't go very much appreciated for all that you did and Phyllis did you go with your no I did not go okay just asking um last Friday and this what why would I go if there was no communication with the lobbyists I'm not going to go up there with somebody that's hostile to me and then do what so no I didn't go I chose not to spend the town's money because I felt it was a hostile environment and I didn't get the information I needed from the lobbyist was it hostile because you called him one day and cussed him out I did not call or cuss anybody out Laura just repeating what I heard I mean it's a shame that you didn't go what I heard you had the opportunity to go I want to see the ethics violations that I wrote up it's public record now want to see it c236 Phyllis manilia anyway item five last Friday I went to Palm Springs Middle School and represented us at a Junior Achievement program and that's where the sixth seventh and eighth graders come in and they get to talk to people who have different careers so that was a ton of fun and then this Friday I go again to Emerald Cove so if there's anybody who wants to volunteer their time talent and services to you know reach out to the young minds give me a call and I'll put you in touch with the program directors um it's a little noisy it's really busy and it's a lot a lot a lot of fun and where oh Francine tell me how the first development meeting went um actually I thought it went pretty well and I'm glad that Caitlyn stayed because I think she can um add perspective to it it was very civil um it was very orderly each applicant had there were a list of questions from each of our different disciplines that were asked of each applicant each applicant made a presentation about their project and asked their questions um and and um I think it was very helpful um anything you want to add we were done very quickly we didn't go over um and we did have a zoom link for anybody who wanted to watch it while it was going on and we did have a few people in the audience okay and those are open to anyone to attend right open to anyone to attend and the zoom link is available because we post the agenda online with the link and when's the next one it's on the fourth Thursday of every month so what is February pending applications I would not expect that we have resubmissions that are ready for the next DRC meeting they'll probably trickle back in so while we had three on the first one I would not anticipate that they stay on a concurrent cycle moving forward and probably um go back to maybe one maybe two applications unless we start to get a few more in that require public hearing it really well um each municipality does it a little bit differently um when you start to get into these types of review meetings um we do them with a lot of different towns and cities and I think um this first one it went really well um and we'll keep adjusting to make sure that it serves the town and the applicants best but I think it to Fine's Point gave everyone a lot of good uh conversation we were able to iron out some really high level questions and concerns that staff had and had really good conversation and I think everyone uh on both sides was appreciative of the process it it felt efficient very can ask a question I about the process sure why not like how much money does somebody invest how far are they along to get to that meeting so this was everyone's first submission review cycle so it was everyone's first time um having their plans reviewed so however much it costs to put together their individual plan sets and applications that varies um you know based on that yes they do cost recovery account we have two types of fees that come in for what we were reviewing we have all the different application fees which range from like let's say 1,000 to 5,000 depending on what they were putting through some of them had multiple application fees that they had to pay and then we would have cost recovery for the time that we were in the meeting so they're pretty serious when they get to that meeting they are this isn't somebody just out fishing no it's not a pre-application meeting they've formally submitted all of their fees they've opened escro accounts for cost recovery they've formally submitted all of their um plans for review and this will be the process that all public hearing items go through moving forward but they've put in a good amount of money into getting engineering plans and site plans ready for sure this saves several weeks in the review time and it kind of again it's really for better service and better efficiency in terms of moving things through the process abolutely without it being exp parte communication I guess that's kind of dumb to say that because it's a public meeting can you name the projects that were brought forth or were they still just in like a discussion stage oh no absolutely um so we had three different um applicants one was the Town Center um project that is coming forth as a uh four story Hotel um that one would be in pod m g it they flip-flopped yeah g and the the former Town um Center site and so I think you all have had a presentation on that before um that predates us so you're probably somewhat familiar with that one the other one was PK Sports um they came in with a handful of applications to take care of of um what I understand to be very long-standing issues with the site um so they're trying to rectify their issues um that have been identified by the town and the last one was the 444 and 556b Road um what has been referred to as the Brier property um their land use plan amendment was the last application gotcha and I just want to be clear no site plan no stated uses of and no detail of anything just requesting you know um the land use on the third application at this point the only use has been referenced was medical office yeah okay so commercial on Commercial low at this time okay good deal thank you thank you all right
