commission comments about current agenda items are to be made during the comment period of the specific agenda item and uh please address all comments to the chair do we have any uh commentary from let's try this again that uh hopefully that's large enough for everyone so that looks pretty good okay uh and the pretty diagram to go along with it uh so this is the and you you can all see that correct yes diagram yes okay the yellow outline is roughly the uh Main Beach area we plan to add 25 to 30 um cubic yards of of sand uh to the existing Beach area there and the area is proximately 120 by 80 ft I know my drawing is not quite the size I probably should have labeled it as such uh but that's the area there there's picnic tables the little um Brown squares um a couple trees and the other area um we already do have a lake um uh Lake PL Lake management plan on file with you guys which is for erosion control there is along the um a little bit of a peninsula uh outcropping and there's already existing um Stones there um but as you know it rains every 24 hours now and it's been eroded behind that uh so we just want to add some more Stones behind there which is actually covered you know erosion control is actually covered under the Lake management plan but I just wanted to call it out in case knowing you guys would be down there one way or another and I know Bob P uses the area all the time so just to coverall basis is there uh that's the int of it is just to restore the main Beach area uh adding approximately an inch to two inches of sand to that area um and that's that's about it h oh and I suppose uh 10 we we'll keep 10 feet off of the high water mark they just put the last set of boards in today so wherever that winds up I'm sure that'll be filled in like less than a week but we'll keep it out out as best we can away from uh the waterline itself uh that's that's about the gist of it okay very good uh Doug I think um I think actually in the submitted documentation you pointed out that uh you already rake uh rake the sand out of the uh Lake as an ongoing maintenance um effort we do yes every year we do have uh Lake View comes in um and we uh M uh mud rake without going into to you know the bottom obviously just whatever Falls that year you get a little bit of sand with it as well so we do you know it's not like it's shallow over there um so we try and maintain that uh as well so we do rake it out every year so that there's not a whole lot of sand blown in there okay thank you and uh when uh Jenny and I had had the U opportunity to meet with you and walk the site this weekend we were walking with you I think you said the existing vegetation that's there along the beach area you were not planning to cover that up but just put the uh sand in the kind of existing sand area uh as as it were yes um basically like cow grass has grown over one side of it less used area we're just going to leave it there uh seems to hold it pretty well we always look for new ways instead of just throwing sand there because as you know sand blows around um but it is the best you know for bare feet and stuff like that uh we have over the course of time looked at other things maybe mulch maybe small stones or something but um we'll see whatever works better with the whole Hickory Hills board and stuff like that over the long course of time but currently at Sand okay very good um Sophie um have you completed a s sidewalk and did you have any recommendations for the commission um yes I I did a site walk uh last week and took some photos and uploaded those to Google Drive um I don't really have any uh concerns for the the project as it's proposed um I know that you uh the commission likes to know what kind of trees are around but I mean half the commission probably knows um what trees were there but if you wanted that information I could provide it couple Birches couple Oaks couple p a lot of Pines yeah I think that yeah sums it up and I think Doug you also confirmed that this um project you're not um planning to take down any trees or smother any roots or anything like that no okay okay thank you for that um I will uh do we have any questions or comments from members of the commission Madam chair yes Rich uh as I believe my brother does work for the beach area here I'm going to recuse myself from this uh RDA does Thank deck within the buffer zone of a wetland at 189 Hemlock Drive do we have uh Mr catris uh or his uh representative here on the call I do see Mr catris David is here thank you so do you just want to catch us up on uh where where we are with your uh project sure um as you requested I got uh a formal tree guy to come over to take a look at the trees um I sent you or I should say I sent Sophia the documents um two letters and an updated diagram um and the tree guy basically said uh all of them should come down for his reasons of um where is the I just had it now it's gone that they're all either dead dying or going to be a uh potential Hazard for the house or for people um so his his recommendations is to take them all down um and then I talked to Lake View and we came up with a plan for um um replanting trees and Shrubbery to uh mitigate erosion and get the uh cover back up over the uh over the water again with some bigger trees do you have that plan uh that you could uh share or uh perhaps I can get one of my Commissioners to share that plan uh can Sophia possibly do it I do not have the uh ability Chris you said that uh you might be able to oh Sophia has it okay that's the first letter from Elite tree okay thank you okay that's uh that's pretty clear I think I was more um for me anyway kind of wanted to see the uh replanting plan one more there it is so the if you read um I believe it's Matt or Mark sorry if you read Mark's letter and stuff it explains why um we can't get as many trees in there as much as we as we want to um I was able to figure out one two three four five six seven within the 30 um because of all the stumps you want to keep in the ground you can't you have to have the new trees so far away from the other stumps and there's already some other stumps that have been uh cut down before whether it's from uh beavers or they fell down during storms and stuff so this was the best we could come up with uh within the 30 um the scribble marks around the open deck that's all the blueberry and Shrubbery that he was talking about to try to get those um yep all in there um yeah and I believe Mark uh he Mark has a red red oak and red APLE for truee replacement and then uh Mount Laurel High Bush and low Bush blueberries winterberries um and he unless there's something else you'd prefer instead we can we can U substitute it out and I assume that uh that's spelled out in the letter yes yeah yeah on the other side of that Freight logic I know it's not shown but there are a bunch of other trees already over there along the um the that near the between the road and the water and there's also trees along the um the Waterway already and everything okay and the X's are the trees to be removed that's correct if you see the double X's right next to each other it's basically one giant um stump with two trees coming out of it okay okay so uh 16 and the 30 foot uh I don't understand that it says times 16 in the 30 foot and then um time 10 over 30 does that mean outside of the 30 foot correct correct yes okay and outside of the 30 but presumably within the 50 the yes I believe the 5050 Mark is probably right around where that one little black dot is on the you know the hemlock Terrace wording that's probably about the 50 right there oh okay so almost all of the lot is oh that side you you actually have a culde saac in front and then him loock Terrace going beside the property right yeah okay okay I think I think I'm clear on that plan um do we have questions from other members of the commission Madam chair yes rich is this applicant's working with my brother at L your Landscaping I'm going to recuse myself from the sard thank you rich and uh Sophie while the uh Commissioners Gathering their thoughts uh what were your recommendations on on this property um well my original thoughts have changed um based on what the the professional has um brought to to light [Music] um I I do hesitate um on some of the removal um but I I would put Faith in the professional for that so I would U probably move forward with uh a positive uh determination and maybe the commission has some something that they would like to see um that could kind of counteract all the disease trade removal have some Healthy Growth okay so to be I think you're what you're saying is that you um you recommend a positive determination and so that we Channel this through the noi process um I'm not I'm not entirely sure I'm kind of 5050 um okay thank you Mike um I'll call on you you have your hand raised thank you yes Madam chair um I'm just curious of uh why Sophia has concerns or reservations uh if she can elaborate that would be great and also the person who's recommending all these trees to be cut is is this person an arborist or is he just the owner of a company that Cuts trees good questions Mike um Sophie well I guess we could probably get some clarification on that as well um while the applicant's here because I do see um landscape professional but I'm not sure what their background is um so that's kind of why I have the reservation of yes they're professional but um what to what extent uh have they hired this person um and what their background is and what their knowledge is for the the health of trees so I I'm not sure what they're what the extent of their knowledge is so their letter had doesn't uh claim um licensed arborus or anything of that [Music] sort I can share it again it's right here I can just share it boy or you could just tell us oops that's Lake View um and is Lake View uh who did the uh tree assessment it was Elite tree Madam chair I had both Elite tree and Lake View um come over do the walkth through um they both without knowing one from the other they both said the exact same thing that um you know most of them are visibly dead or dying and that the amount of that I'm going to be taken out for the dead and dying ones the ones that are going to be left over are going to probably um be a danger or a hazard with the um the lack of the surrounding um trees to to to to protect each other if you will they're both of them um separately said that they should all come down on the safe side replant and then like like he said um let's get some better stronger uh trees up there then and stuff that are in the way a lot of them are dead dying uh or like like I call them house Killers or the the sh killer if you will being right in front of it um if it's a couple more trees I can probably put a couple more up in the uh beyond the 30 maybe along uh along the side closer to the road maybe to help over there maybe that's the only I can think of for for placement without um yeah without getting all those other um trunk uh um Trunks and stuff stumps and stuff in the way I can probably do a few more over there maybe okay I'm so I did see that Mark bur uh joined um I don't know if he's walked the property if it's somebody else from his company that's walked the property Mark did you have any commentary about the health of the trees in question can can you hear me I can yes okay yeah I walked the property I agreed with the assessment from the tree company uh there were a few larger trees some struck by lightning uh all um all uh en cringing on the the house itself um it's tight over there it it's very tight um I the only thing with the plan is I might spread the low the under under story plants out a little bit more uh while the canopy uh reestablishes itself for the trees that we were putting in okay thank you Mark thanks for confirming that yep uh Jenny you had your hand up but it looks like your hand is down um I think my question got answered okay great Jeff I'll call on you next I was just wondering if any Commissioners had a chance to do a sidewalk I did uh with uh Mike and Jenny so I'd love to hear your opinion it's there are a lot of trees there um and the house is basically shoehorned into the trees and uh there was a lot that uh honestly with all that with all those crowded trees um I'm not surprised that there is some you know health issues um there there are a lot a lot and I I saw visible damage I didn't actually go through and count the ones with uh visible damage but there were a lot with visible damage um and you know they're very tall trees so almost all of them hover over a structure of some kind um Mike uh Jenny uh would you want to add anything Madam chair uh did we take some pictures to kind of share with everyone uh to give the sense of congestion of trees do have photos um I know I have photos mine are actually on my phone though so I don't have a convenient way of sharing do we have any photos in the uh in the share uh SharePoint Drive thank you Sophie for doing this yeah so that shows the beaver damage and and the um the one that Sophie has there that had caught the corner of the house is pretty representative of the crowding that is around you can see how dense the um trees are around the house Madam chair this is Corey da catris I just want to make one other comment um we've had roof damage because of Limbs falling from these trees as well um and I know we shared those photos with Sophie previously I don't know if she has pictures of that as well yeah I'm not surprised with the number of uh branches and trees that overhang the property do we have um do we have other questions from members of the commission Bob I can hear you but you're a little pingy but I can make out what you're saying that's that's because I'm driving in the car um I don't have any questions uh I don't see why we would do a positive um termination here uh I don't see that it's going to have an impact on the resource area and I'm not sure what uh jumping through additional what additional information we would get you know by making the applicant reapply you know with a different set of legal ads a different set of fees and a different um uh you know public hearing you know a buth or two from the back so u i I am uh definitely not in favor of a positive determination thank you thank you for that Bob and I'm uh I'm aligned with where you're at on that as well um yeah I think this is a matter of Tree Management um Chris you have your hand up yeah I just I the fact that two um two companies came with the came to the same conclusion um kind of weighs a little heavy heavy with me I I I I'm willing to I'm leaning to going forward with the recommendations and you protect the property um so thank you for that Chris uh Sophie um I just I just want to kind of retract my my previous statement um mostly based upon our our continued conversation about this and I I changed it to a recommendation of uh a negative RDA uh with the you know the removal with um the addition of plantings okay thank you for that Sophie um so uh is any do any of my Commissioners have a concern about uh a negative determination with condition of the replacement of trees and if so raise your hand make some gesture or I'm going to assume that you don't so then uh in my mind uh the next logical question is the uh quantity um that's being replaced and right now it's proposed uh seven within the 30 uh 24 under story as shown but spread out a little bit more per marks um articulation and I didn't actually capture in my notes how many were uh proposed for outside of the 30 and within the 50 um I think it was 10 uh if somebody could just reference that for me quickly yeah 10 over the 30 okay and that uh within the 30 doesn't seem to match our um our guidelines for within the 30 but again I would give precedence to the uh you know the health of the trees and not wanting the new trees to be grown in an overcrowded um area right so I want them to grow into uh healthy situation so I'm I'm also okay with that does anybody have a concern there or want to advocate in a different direction Mike you're off of mute did you have something to say yes I wanted did did we have the kind of trees that are being replaced in the plan we were told Red Oak and red maple um and the uh I understand that that's in the plan but uh for those of you that are actually able to look don't have to navigate facilitate hosting would you just check on that um it says I would recommend Red Oak or red maple for tree replacement for the underst story Mountain Laurel High Bush or low Bush blueberry and Winterberry okay so that's in the that's in the submitted uh documentation Mike so do we have an amount of trees viav uh bushes that are being put in 24 of the bushes and how many trains seven within the 30 10 between the 30 and the 50 um I might have been mistaken on the I was reading the removal it says I recommend insulation of approximately six trees as defined on the plan re-reviewed approximately an inch and a half caliper with the addition of 24 2 to three gallon understory native plant material um hey Chris why don't you share what you're seeing because I wrote down what was on the top of the diagram and that seems to be a little bit different I think we want to be really clear what we are um I'm reading off of this um of landscaping and irrigation Inc this is Dave's recommendation here so I think that is that what we're talking about Mark yeah Mark's recommendation yeah does that comply to our regulation in the amount of trees that are being removed and the amount of trees that are being planted I think uh Mike we we don't want to um cause the same crowding so I think there's going to be less replacement than we're removing because of the overcrowding that's the way I'm interpreting it and also you know uh we don't want to have the house have the same issue 10 years later with trees hovering over it so I think that I think it's a less I don't think think it's a I don't think it's a typical replacement due to the situation of the way the house is in a very tight lot there are trees Chris that uh can fit uh under canopies and that can do well in shaded spaces and I'm just wondering if the applicant has considered that or without overcrowding and endangering the property things like native dogwoods and whatnot that are underst story uh free correct we're open for oh we we went by um what lake View's uh idea was and such uh again we're open to substitutions and if you want a few more um over the 30 um we can I we we I work with lake view on that and we can put maybe another uh a couple more Red Oaks or Maples in or uh maybe some smaller like flowering trees type of thing um where maybe they won't get so big next near the house would that satisfy your concern it would satisfy it would satisfy me okay um and Mark um what are your thoughts on that um I mean Dave if it's okay with you since we have your expert here on the call maybe let's take advantage please so Madam chair I was looking primarily inside the 30 um I was upsizing some of that stock because your requirement for replacement uh the numbers are higher and I was trying to reduce the amount of impact to the soils in that area in general um I didn't really look outside the 30 um but again it's a the density it's the density of what is there is is very thick um uh I did review with uh with uh David about uh the possibility you might require some stuff outside the 30 um again uh if you're looking at the numbers I I I wouldn't go tree for tree uh he's planning on leaving the you know the majority of the stumps so it again it doesn't give for area to put much stock in so um off the cuff um I don't know David if you had any plans outside the 30 with the stumps where you were moving those or leaving them or grinding them or all the all the are gonna stay all the STS are gonna stay um I was thinking maybe closer to the um the axis Road of ter HL Terrace maybe couple over that way yeah um I think we can probably get probably throw a couple in over there I'm thinking yeah I mean we could definitely add um you know we didn't plan on any installation outside the 30 um actually let's um Chris if you could scroll down to the diagram that was provided we may have misunderstood uh what that had so at the top of that it has okay the majority of what I propose are most of the circles within the 30 foot buffer and I put two I have a Z2 over 30 feet um that was I was thinking ahead of myself but yeah basically if you scroll just a little bit more those two trees right near it says Hemlock there's two x's near Hemlock I was thinking right in between there I might be able to get two two more smaller trees in and maybe some more um some more of the um bushes maybe to go in between or something of that nature I obviously I'd have to defer to link view for their expertise I'm not a but M Madam chair uh Bob is that you it is me okay I I don't know how to raise my hand on a phone in my while driving in the cars talk Talking is is uh is just fine um I appreciate you uh being with even though you're commuting um I think it makes no sense to uh strictly follow our tree replacement regulations here I mean we have a situation where there were too many trees they are overcrowded uh creating unhealthy tree growth um you know I don't think we're uh doing uh the environment any favors by planting try to figure out where we could cramp some more trees in here uh to uh you know satisfy some numerical uh requirement you know that when it was crafted I believe you know was assuming that we we were replacing uh healthy tree grow um so uh I don't think we in my opinion as one member of the commission we should not be asking the applicant to figure out where we could cram in more trees here thank you madam chair thank you Bob thanks for that uh commentary um Jeff yeah thanks Madam chair I'm looking at near Maps here and from what everybody's saying it's real tight and there's a lot of trees crammed in there so I'm I'm I'm with Bob and Chris on this one I'm pretty happy with the re with the repl planings that they lunenberg was requesting third-party uh review uh on this um project is that consistent with your own understanding so uh it was my understanding that we were going to request thirdparty review for the Wetland delineation of the parcel there were some questions because you know wetland Flags had been changed a little bit and so we agreed to the third party review of the Wetland delineation only and after receipt of Gard engineering's uh proposal there seemed to be a lot of scope added to their their proposal and um not something we're exactly willing to agree to at this point and I just wondering we could what was added that you take an exception to well it was just it was an added cost and um it was a lot more than you know the applicant was expecting to to have I apologize I'm uh pulling it up now uh you know at the last meeting I think it was two meetings ago we were supposed to have the quotes from uh the third party review We just received it today and the total was you know $8,500 and you know within their quote it included Wetland delineation review Riverfront boundary determination Riverfront Wetland impacts and alternative analysis review replication area design review and compliance with Wetlands bylaws attendance to the hearing site walk with the commission so at this time you know we we're really only comfortable or we we only pre previously agreed to having that task one so um that's kind of our position and I'm I'm willing to talk more about it but that's uh that was our understanding we're a little you know caught off guard with their proposal Madam chair yes Bob um I'm sorry I'm driving down the uh driveway of the Woodland so I'll be on my computer probably in five or 10 minutes sure um uh here here's what happened uh we took and I sent uh the request for proposals uh to the three uh Engineers uh for Sophie because Sophie uh didn't have time to get to it um one engineer responded immediately that they weren't going to respond they were too busy or one Wetland scientist I should say Wetland scientist another Wetland scientist came back I think with Scott CER uh came back and said well what about all this other stuff oh would you like me to review this other stuff and I said can you please uh uh and I consulted with you at the time and uh we said sure why not and so I asked uh so I asked the two remaining uh Wetland scientists uh to quote uh you know the full list of stuff I said but please provide a separate court with just the wet's delineation because this other stuff has not been requested by the commission and uh you know has not been agreed to you know uh you know by the applicant and so now we have we actually have two quotes one from LEC and one from uh Scott gard and um uh Scott Goddard uh one um the Scott gard one uh he's sent a separate quote he sent what he sent a separate quote for 2, uh $500 just for the wetlands delineation and the other one just for the Wetland delineation it was 1,500 and uh I can share both of those with uh the commission uh when I'm on my computer in a little bit okay thank you Bob yeah thank you Bob I had not seen that um the secondary proposal Bob and mentioned I I apologize I'm kind of filling in here uh I I wasn't on the email chain earlier today so I just kind of forwarded it last minute and that wasn't included as part of the attachments that would provide to me but if if that's the case and there's a proposal that's solely for the Wetland delineation that would be acceptable it and one of the reasons I we we went for it is because uh when this application first came up there was no discussion of the Alternatives analysis and the Alternatives analysis must must have changed because uh from what the original uh because I haven't seen a New Alternatives analys because the original thing uh said there was a very little encroacher of the driveway onto the wetlands and since then you know the wetlands boundaries have changed significantly uh so that now you know replication is required and all that other stuff so um that's why we went for the further stuff yeah and I my own personal concern about that U particular parcel is was um the riverfront um the lineation uh because it appeared to me when I walked out there that uh and I didn't have the opportunity to go with uh the Wetland scientist from the applicant uh because that walk happened during the week um but uh yeah it appears that to me that there was actually current flowing across the dam up uh adjacent to the parcel which is not shown in the riverfront delineation and the original plan is submitted so when Scott uh brought those additional recommendations up they seemed relevant to the uh to the application okay um I'm not I I acknowledge that comment but it's um this is that's kind of new information to us at this time and uh you know we've had our Wetland scientists go back out there and to verify and she she's confident with her her uh delineation of the the riverfront so we don't see that as an issue in our mind um could I could we propose maybe that we agree to the portion of or the separate proposal that only [Music] delineates for the delineation of the Wetland only there you so that that would be our preferred route if we approve if we approve that and then um I guess we could coordinate another walk we just don't want to commit to to having another third party review on this right at this time for the the riverfront I'm not certain that the uh quote would be relevant uh I mean you we' probably have to go out for a second quote right to get them out on site again so um no if that's what you're saying that you want right to go down a peac mill path I I would say that for what Bob said a separate proposal was issued for the Wetland delineation only I haven't seen that one but task one of godard's whole proposal for his entire scope of services is the Wetland delineation so at this time I guess we would recommend or request that we could just agreed to task one of the proposal just the Wetland delineation y there you go and then we could regroup from there just because this is kind of this was thrown out as kind of last minute and we haven't had a chance to really discuss this with the applicant okay thank you for that uh commentary uh Chris I'll call on you oh we can't hear you you're still on mute that was my my understanding was just the initial um Wetlands delineation so I'm confused why um we are we're adding other things I mean last time I was part of this discussion that's what we're waiting on I mean I know Godard went and did a bunch of other things but I think that was outside of what we were expect what we had ask the applicant so um I want to know if any other um Commissioners um agree or disagree with that so I actually thought when we um when we agreed to this I've not been through many of these applications where we asked for a thirdparty review I thought that um a wetland and a river were inclusive and so I thought that the river delineation would be included with the Wetland delineation which may be my error right so when Scott came back and said well hey here are here are three other things that you know seem to be applicable but you're not asking for it I went oh well I thought we were asking for that so yes please do them uh so that's where my head was at uh for right or for wrong yeah if I may I just want to chime in you know but that's just that's not what we agreed to previously so we agreed to the the Wetland delineation and you know that's what we're willing to to commit [Music] to thank you John uh Sophie you have your hand up um I I wanted to say that it does sound like there might have been a miscommunication um in some way shape or form but I also do have the other um peer review uh letter if you would still like me to share I know Bob was going to but I do have it available oh yeah that would be uh helpful Rich while Sophie's uh calling that up I'll call on you yeah Madam chair I I do agree with Chris as far as um our intent was for the Wetland delineation the um the delineation of the River Front is pretty straightforward inad helping me yeah why I I think somebody might want to go on mute okay uh Rich back to you the Wetland delineation pretty straightforward from the bank in 100 feet and 200 feet for the two different reparan zones uh and honestly a movement a little either way is not going to affect uh the project in my opinion at this point because the majority of it is either right along or just inside the outer aaran or 200 foot zone so I I personally don't see a big need to have the riverfront itself red delineated uh my biggest concern was the Wetland delineation because their um expert went out once and did it and we called them on it of course they thought the first time they did it they did it correctly so then they went back and did it again and said oh here we go now it's right so that was my biggest reason for asking for the delineation from a third-party reviewer uh where they definitely got it got it wrong big time the first time so I didn't feel comfortable with them performing it again and taking their word for it so I'm in favor of the Wetland delineation but I don't think we need to proceed at this point with the riverfront again that's just my opinion but thank you rich thank you Mar Mary yeah Bob uh after listening to what Rich's uh comments I'm comfortable with just proceeding with the Wetland delineation uh when s when Sophie calls up the other quote you're going to see that the other quote I think was 1500 for just the Wetland delation and Scott card's uh executive assistant set a follow-up email saying that for just the Wetland delineation uh their price would be 2,500 it's not in the original quote but they did set a separate email uh which I printed to a PDF but I'm not able to share that right now okay thank you I'm going to mute now okay thank you okay then um I think uh I think we've heard from the applicant that they're willing to accept the uh Wetland uh delineation review um do we have any other comment around around that questions or comments around that vote on uh on accepting one of these quotes and a specific quote or what would we take as next steps uh you certainly can the um I believe the applicant has a say in which one make sure or at least that uh that they're not in uh a conflict with either one of the two uh Wetland Specialists that are going to provide the quote or the service thank you Rich uh and just just speaking on behalf of the applicant we're fine working with either consultant I just to be clear as long as it's for the Wetland delineation only that's the only thing we we're we're agreeing to perfect good okay thank you know why we would ask I don't know that there's any both both of these firms are highly respected firms and I don't know why we would ask uh the applicant to pay $1,000 more for one firm over the uh two weeks ago and there were a couple of uh plan changes that were requested by the commission um at the end of last week I submitted a revised site plan with a cover letter describing those changes um there were three plan changes the first of which was relative to the proposed spiral staircase in an effort to increase a setback between the lake and the staircase we've shifted it so it's going to be installed on the side of the existing deck we weren't able to get it completely outside of the 50 Foot but we were able to increase it um from its previous location in the front here to the side the second item which was a new item I had brought up at the last meeting was that the existing concrete patio underneath the deck the owner intends to replace that with peral pavers um so we that's an improvement over the condition there um however we did want to formalize that on the plan as requested by the commission so I added that to the revised site plan and lastly we reduced the footprint of the reconstructed walkway this will again be constructed with the same permeable pavers um the techco blocks that the owner intends to use the smallest percentage of open area in the prvious pavers is 4 and a half% so that's the proposed increase in in size and footprint of that walkway that we proposing and I did submit a catalog of those um permeable papers as well for your review those were the only changes since last meeting if there's any questions on any of that I'd be happy to take them I don't have any questions Ryan thank you I'll open floor to Conservation would I would want to approve that uh certificate of compliance um however if the commission feels that vegetation should be present then perhaps they would want to hold off on that how big were those bear spots um I didn't take a measurement but uh just eyeballing it probably two of me so 17 by maybe either 12 to to 15 fet okay sizable yeah and it didn't appear that it was a lot of um good soil material for seeding um a lot of it was nutrient lacking soil with mixed mulch as well okay um sounds a little concerning um and I thought we had a member of the public with their hand raised but I actually don't see them now um it's like they dropped uh did we have questions or comments from Commissioners yeah can we can you clarify are we talking about erosion between the house and the the water I mean I'm not I'm not I'm not clear what we're talking about honestly um well there were there's just one one bare spot that somehow the grass got taken up on the if you're looking at the house it's the left side and it's um okay possibly closer to the water than it is to the road all right um I don't see any current erosion it's just not not established with vegetation and and what when when did you see this how recently um I did a site visit last either wed last Wednesday or Thursday so fairly recently oh yeah that yard's tiny is the yard much bigger than 12 by 15 feet um a little bit if I were to give a percentage of of that side of the house with that yard the plot that is not established might be I don't know maybe 10 actually not 10 um maybe 35% un not established Jenny you had your hand up so this is we went on a site walk for this one this is the one where they were redoing their driveway and putting a little wall up it's a very very small yard on that left hand and it is sloped toward the water so if it's around 17 feet it's probably I would say like maybe twoth thirds of the yard what do you think Sophie uh so the other portion that I just remembered is uh a little bit uh in between that area of um bare soil and the water's edge there's a rock in that odd Gap I don't know if anyone recalls there's um that Gap where it's the concrete of it's right in that area so there's there's an impervious barrier between the water and that bare spot and that bare concrete area takes up about maybe 8% 10% of the the rest of the yard too so but it is a very small yard um Matt grael you have your hand raised yeah how you doing I'm the owner of the house um so yeah yes there is there is a little bare spot that we playing just to put more top soil and more uh dirt and possibly even saw it um OBU just haven't had the uh time or the resources after doing all the other work and everything else let to get that done but uh uh again I don't think it's I would to call a 17 ft it's probably 12 by 10 Max and the yard is tiered um so there's definitely no erosion that goes towards the uh lake at all thank you Matt uh Sophie I did all all this talking I do have images to show that oh that' be great yes yeah because it's such a so hard to explain that [Music] area so this is a patch house is on the right side you can see the water's edge here this is that odd barrier between the the water's edge and then the lawn area here that also doesn't look like it's established vegetation is that am I understanding that photo right it it's not um I can't can't remember if it was vegetated at one point from my recollection I don't believe it was is this the area we're talking about this one this is the size of the issue it's not the previous picture correct uh this is the main picture I was talking about that there's there is seed but there's the soil is uh nutrient poor and half of it or at least portions of it seemed like it was Mulch and not not soil itself this was just last week and then the picture here is referencing just over this edge here okay thank you do we usually approve these when there's um we don't have established vegetation uh within the limit abort would seem unusual to me but I'm I'm looking for guidance okay Rich what are your thoughts uh we're right in a growing season um I would feel more comfortable if we held off on five blueberry bushes and I believe a maple tree so over in that specific Corner uh Jack from Dillis and Roy said there really isn't that much room over there to plant the five blueberry bushes so I was going to try to spread them out okay so I guess what I'm on here for is instead of two maple trees that I was going to I would do one maple tree and five blueberry bushes so over where the proposed blueberry bushes are that's I kind of went a little a different direction my oil tank used to be on the other side of the house and now I went with propane so they kind of need access to get to it which is where those blueberry bushes would be so I was going to take the blueberry bushes and put them over near the um were the other two maple trees over on that side okay and were the out the tickets um you know if she can't handle them they can be mailed and U and uh because I thought you know there was the possibility there was the potential that we could be issuing fines tonight for U uh some VI of a uh non-compliance uh with an noi Down On Fire Road 12 and that it would be good you know uh if uh you know we got some some advice on that uh you know for our new conservation administrator uh before we started such a process thank you for trying to get that coordinated Bob I appreciate it okay um if there's no uh nothing more in that discussion let's move along to the uh enforcement actions uh 141 uh Hemlock Drive uh I think we've already got a continuation on that one um has there been any uh progress or movement on 10 massav no I haven't heard anything from them I actually reached out to to ask if they needed help um and I haven't gotten anything when when you and I visited there which is over a month ago the applicant uh the applicant um I say with air quotes um the uh uh o occupant of that commercial um site said that they had done a submission have you seen a submission yet no uh I got well the submission wasn't to our department again it was to D so our department never got one so the last meeting that they were uh present for was discussed that they need to file uh connect with me and file uh correctly uh within 30 days I believe um and they they haven't reached out since okay so their 30 days that that was at the beginning of April their 30 days uh is almost up then yeah I'm recalling correctly so we'll we'll discuss that further at the next uh meeting 20 uh moving along 205 Sunset Lane you have any updates for us there um so this one was kind of complicated and and tricky I I had to go through all my files to kind of backtrack um and I was in communication with the the applicant they they were stating that um they had submitted an noi and the commission had um uh approved a order of conditions or and there hasn't been an order of conditions issued so they were waiting on that to in order to do any work um however I couldn't find an noi or an order of conditions I did only find the uh negative determination that was issued a couple years ago I believe um and that determination was um negative determination with uh contingent upon not having any permanent structures built uh stairs down um leading into the lake um so I was hoping that maybe the commission could clear things up for uh people that have been part of the commission prior to me with the 205 sunet Lane yeah they had a uh uh Mike you have your hand raised yes didn't theas um weren't they represented by Dillis and Roy at the last yes and that was in the fall which means they must have a copy of the plan that was submitted and that we looked at so I would think they would be a good resource to kind of catch Sophie up on what the latest was I'm sure they would be glad to share I'm looking at the plan right now okay you want to share that uh with us that an noi that we uh deliberated all on in the fall I think it was probably September October kind of uh time frame uh when we uh came to a decision on the noi yeah this was um this was a fall this file was was timestamped in the fall um was that uh how did you find the the plan I went to Google Drive and I searched for 205 Sunset and I found I found uh this folder oh and you just have to blindly click around yeah and open things that's why nothing came yeah was labeled saw noi under this this folder was 205 Sunset and so I said September 28th and I saw noi so yeah I clicked on you know and I just got lucky I guess so and uh Sophie in the uh in the uh uh DocuSign uh archive there's not um there's not an OC issued for this no I well now I I question my searching skills but um I didn't see I did not see one it sounded like you were doing research on the neighboring lot because we wouldn't allow them to put stairs down we just allowed them to do a dock so that's the property that's just adjacent to it just south so I maybe it had the wrong address possibly but I think that gentleman lived in Shirley and didn't have a house in lunenberg and there was some issues with the building department and um yeah this there's also two names here there's a sunset beers and a sunset Welton for the same address so that's maybe that's yeah that's that's the gentleman that was that's the neighbor to this property uh so essentially this one they built that larger deck area that over that went over the lake that you saw in your document mhm and they were supposed to reduce the size and have it done during the draw down by March 15th okay I was down there a couple days ago and I hasn't been touched so no the uh applicant actually uh sent a couple of um rebuttal after the meeting to me and then also to the the uh chair of the select board about the decision as well uh ma Madam chair yes Bob uh in my mind was supposed to be done by March 15 at this point we should uh issue a notice of non non-compliance I think that's a uh excellent uh is that a motion Bob turn it into one yep I'll second it okay a motion by Bob uh to issue a notice of uh non-compliance and a second by is that Mike yes it was and Sophie you have your hand up yeah sorry to interrupt um I I couldn't find the orders of conditions issued for that um they said they never received the issued orders of conditions well that that's entirely possible given the amount of uh you know staff vacancies and everything we've had and the amount of turnover that a tragedy but that's entirely possible I think we should research that before we send him a notice of non-compliance yes that's that's why I wanted to to make sure that that was clear okay then um uh Sophie I think uh continue to research that and uh Bob I don't know if you have the Cycles to assist her with that but that would be uh useful I will also research that in my own uh inbox I really thought that had been we had done that by DocuSign I I thought we had too but I could be wrong I'm I'm gonna look in my DocuSign yeah through my doc sign emails and we'll uh we'll look at this again next meeting okay uh uh which one should we go to next uh Sophie um where do we have the next update 1168 Mass AB rear uh no update okay the 4 okay 4 Fire Road 12 they said they wouldn't attend they would not attend yep they were they were told um that there may be um um consequences however they they will attend this meeting so they they're not here and um what is the issue with this um property I believe this was the paving uh they paved on Town property um next to might have been a pond if you were facing the dead end it was the left side it's next to stump car Shirley yeah I just wanted to for the record be clear on what it was we were deliberating on and my understanding is they paved uh without uh permission on property that wasn't theirs and within um the 30f foot um and maybe some portion of the pavement is also within the 30 and the 50 Foot I haven't actually taken a measurement um device down there myself but I have there is that the issue at hand that's correct and in addition they did it appears as though they' been doing dumping uh within the 30 and they might have even done some filling within the 30 in into the resource area and um but but in my opinion what we should be doing here is issuing a notice not once once we find the uh email where um where we're sure that the where where the uh you know order of conditions was issued that um we should issue a notice of non-compliance because I mean if they they've gone this far it could easily be you know this going to end up in the litigation and we should be on a pretty Solid Ground yes um further to what I understand and uh and and and prior to my time is that they uh had filed an noi to remove the pavement and they had an order of conditions issued that that's what I oh we could research this by looking in in the in the database and there was an order of conditions I remember doing this now there is an order of conditions yes issued on this because I looked it up in the uh in the um noi database yeah so right now they're in uh non-compliance with their order of conditions true that and uh this is something that would also have ex uh expired uh even with the uh default covid extension well it's not that it's expired but I mean they haven't done what they said they would do um you know in the noi which what is remove the pavement don't we have to if they issue an noi um and we don't specify any other timeline don't they have until the expiration of the noi to execute uh on it I don't know that's a good question yeah if we didn't specify a be done by date than they have the life of the noi or the three years to do it that's unfortunate when when did when was it issued I'm I'm looking now when did you say the hearing was uh this is no that was the previous one at 205 Sunset Lane uh we're talking about uh 40 uh Fire Road 12 now fire Ro 12 yeah and I don't know when that one was done I thought when you uh mentioned it the other day Bob that it you said it was something like 2018 or 2019 or something like that here here let let me uh let me look at my their application was 59 2018 so normal expiration would have been uh 2021 uh no that was for a dock oh sorry maybe I missed some of this but so we're talking about the west side of their property towards the stump Cove Side areas but not but not their property across the road from their property so do they own that property no no oh so then so they paved it would noi even matter if it's not their property that's yeah what I what I understand Jeff and I'll I'll let people correct me if I'm wrong uh which I'm I'm happy for them to do is that uh they had encroached on Town property um they uh that by Paving um the town property there adjacent to stump Cove and across from their property and that uh once that uh came to light uh and it you know in addition there was a violation um on top of it because it was within the 30 and the 50 uh they then issued the uh or requested an noi to remedy the situation um and that's the noi that I think is not been uh executed on gotcha okay Sophie uh you have your hand up uh and you're still on mute thank you um not to backtrack too much but we're still on the enforcement area for 205 Sunset Lane I'm in the uh data portal and is not entered in the uh D data portal so it was not we know as far as it was not submitted that way the orders of conditions okay I think that's because it might have been an RDA if we're talking about if it was if it was an RDA only nois go through the portal I know that it was originally approved under an RDA and then they filed an noi and we might have said no to the noi and that you have to redo it so what was specified on the RDA uh no actually we approved the noi uh but constrained them to the the deadline square footage that they had uh asked for in the noi and then required receding of uh some areas uh that was supposed to happen in November and then uh required that they pull the um dock out of the resource area before the uh uh before April 1st first um and yeah those are kind of burned into my memory because those those specifically um those time limits were uh a concern to the applicant um they didn't understand why they had to do those things early when an noi is supposed to last for three years uh Madam chair if we could go back for a minute to Fire Road 12 yes I'll read an email that I sent to um uh uh you and Heather on uh March 7th that says hi Heather according to the D noi database Scott Benjamin and Thomas wolf filed an noi to remove the pavement in the buffer zone on Town lunenberg owner unknown land on June 8th 2021 the D number is 208-1233 the order of conditions was issued on July 26 2021 um the commission has pictures of the violations a plan Prayed by Dillis roid in the noi application form I have no evidence that the order of conditions was filed with the registry of deeds I'm unaware what follow-up occurred upon the issuance of the order of conditions so um and thank you for digging that out Bob I I thought you had done a complete uh review of it but I um was struggling to remember how you communicated that to me and um that's back in the bad old days when the commission had no access uh to the orders of conditions after they were issued so I mean I have no idea you know where in the world uh the order of conditions exists you know unless maybe the D has uh has it on file somewhere because um uh that's always been a defect that uh in in my mind in our our systems that you know we don't have anywhere a database uh that shows all of the uh orders of conditions and forms that you know that have been issued by the you know in the name of the commission so even without seeing those though just by that date did you say it was June 26 said it was issued or July 26 I said it was uh issued on July 26 2021 then that um would unless there was something else specified that those that order of condition is not expired until July 26 of 2024 this year right yeah and it could be that there's even tolling uh from covid uh that might extend it further although I I'm not sure of that but there's a there's someplace on the D website where you can go and look it up or on somewhere on the State website you can look it up okay so unless I'm mistaken right now we don't have any grounds to um to hold an enforcement action um over them unless I'm misunderstanding something yeah I think I think we should do a little more research um before we do something rash here that could result in litigation I I agree um I agree uh Mike you had a comment I was just wondering if uh in lie of their uh last uh notification could we send a reminder letter or would that violate uh saying we understand that you know the July 26 is coming up [Music] and I think that's a great idea just a reminder I think that's a great idea okay um uh maybe let's uh verify if they have uh a covid extension on that as well should we I believe the extension ended June 15 2021 oh okay good we're in the clear yeah then we're in the clear yeah then let's just I think the reminder is a good idea uh so Sophie I think that's an action for you and it could be that we might want to ask the town attorney to send that oh that's a good idea rather than ask Sophie to send that um carries a little bit more weight carries more weight and uh they're the property owner or represent the property owner they are the property owner um and um uh I'd be happy to draft such an email uh Adam right now we cop or to Heather requesting that uh she take in uh that's a great idea because I can just piggy back on my prior email to uh to to the to to Heather yeah that's a great idea thank you Bob um anybody uh concerned about that or want to advocate in a different direction Madam chair it might be worth just adding in there that uh they filed the order of they filed the notice of intent uh in um response to a violation that they are still responsible for and that if it's not taken care of at the ex at the expiration of the notice order of conditions that uh fines will begin to crew that's a great idea Rich certain Bob will include that in the U Notes I'm certain he's uh rapid as so long as I complete the email in the next three minutes which I'm working on yeah when I was down there um a couple of months ago they're still actively using that there's um boats parked there wood stored there and there does appear to be um a lot of uh trash and debris not like little bitty paper but uh jump cans big pieces of plastic and uh dumping of uh of grass clippings uh into the resource area along that bank and that bank has now been reduced to a few feet in some areas so it doesn't look like there is an intent to uh stop using that area or to be U mindful of the Wetland regulations okay uh where should we go to uh next uh Sophie uh where do we have the next update I have 950 uh50 Chase Road uh have we had any updates there I speak with a fire chief and it's not something that they're interested in burning down uh okay that's that's part of the encroachment dialogue but I think um this is actually on the U the the last meeting where you weren't there uh Jeff volunteered that he has a drone excellent so then Jeff do I just need to get you permission from on a butter to uh launch from their property or is that already in hand we you could do it I think from the public way out in front there's you know like a uh um there's some businesses and stuff across the street you could stop yeah that's what I was thinking there's a business across the way that I think I don't know maybe real estate or something um that has a big empty uh parcel uh the and the empty parcel is there parking lots in Lunenburg the business actually is you know in uh towns I mean I can fly at about four or 500 yards keeping reception so um it takes really clear pictures yeah I think that's uh well within that um yeah that's that's well within that area it doesn't um you don't have to go that far back I don't think you'd be stretching it at all okay I'll uh I'll talk to you off line about that uh about the permission piece of it okay excellent okay um 607 Reservoir Road there sorry this is a typo someone summarize the enforcement process um so long story short um uh it's my neighbor next to me 609 611 he owns both properties I'm just just a general highlevel like what are the steps can somebody just tell me what the steps are uh yeah I'll I'll uh I'm like the uh newest chair around the block um so I'll I'll Bob do you want to summarize those steps um for Ashley uh well uh you know our administrator will take and send them a uh um you know an enforcement letter uh telling them them that they uh um you know have to apply uh for you know to put the dock in um and that uh they have to file probably an RDA if it's a removable doc if it's not a removable if it's gonna sit on the if it's not a removal doc they have to file an noi um and that you know know if they don't do it then um you know we could be issuing them fines and so forth and um and then we uh take it from there and hopefully you know they comply come in you know apply to put the dock in uh and then you know it would be advertised in the paper we'd have a public hearing um and it would go from there okay so he would just you would send him a letter basically asking him to follow the same rules that I did on my property that's correct okay um and currently standing if his dock is in the water um he can apply for the RDA and the noi with it currently in even though he wasn't approved for it well I mean I I that would be up to the commission whether you wanted them to tell them you have to take the dock out to you know you know because there's no permission to put it in but you know typically we wouldn't do that um you know typically we would say um let's put it this way we've never done that before we've never done that totally fair uh we're just trying to feel it out because obviously uh the commission was kind enough to hear our case last week um and approve our RDA uh currently even with that approved RDA I can't put my dock in the water because where his is currently he also um doesn't really follow um the conservation rules and I've brought up a couple of those um potential violations to Sophia as well um like last fall for example he installed two fences within the 30 foot no touch um but again like I I've mentioned and and Todd's mentioned and it's been pointed out I just um I care about the lake and the water and the surrounding areas and being respectful of people's property and being a good neighbor um and I don't want I know the board does not want to get involved in any sort of civil dispute so I totally agree with that um I I just don't want people to just steamroll um through things and not do what they're supposed to do um so I appreciate your clarification and I'm rambling because it's late and we've all been on this meeting for a while so thank you madam chair thank you thank you Ashley uh thank you Bob uh Amanda you have your hand up as well yes hi um this is Amanda Lor and my husband is also here PJ Lor we are the homeowners of 950 Chase Road ah okay yeah um we just wanted to come on here because these issues that the town is kind of presenting to us we were already existing when we bought the house so the clearing the conservation land that land was already it was cleared and maintained by the previous homeowners and and the snowmobile committee the snowmobilers would use that land and ride throughout the conservation we've actually put a stop to that and so we don't let the snowmobilers on our property or on the conservation through our property any longer so the vegetation has actually grown in since we've owned the home and the shed the encroachment issue is not an encroachment issue because the shed has been there since probably 2001 is as far back as I could see and it's fully on Town property it's not even on our property it's fully on Town property it's not encroaching at all I can share my screen if that's helpful well we were just talking about violations and I think the concern with the 950 Chase Road was uh clearing that is uh on Town property that's at the Townson side uh right the northern Townson side and that's not a snowmobile path that's actually uh from satellite view looked like it was maybe 50 by 75 foot clearing no there's no clearing on the towns inside just on the Lunenburg side from the yeah it was towards I'm sorry I misunderstood it was towards the towns inside but on in the lunenberg larget toown forest so it wasn't the snowmobile path wasn't the issue it was the clearing and the removal of vegetation on that Northern side the images that I have I'm actually looking at from ma.gov um satellite aerial images and you can see all of that has been cleared even further back has been cleared for many years and why don't you share your page your uh screen are you able we can see your screen yes okay um so this right here are you able to see the the map yes okay so this is the property line and this is all conservation that has been cleared okay this is from 2019 so we had just moved into the home yeah and that's a uh it looks like that's a fall um or early spring type of uh the deciduous trees don't seem to be have their vegetation um so so there's no ve this goes further back so there's no vegetation in this area that's more recent no vegetation in this area and this is and so uh you guys have lived there through the summer seasons and whatnot right when did you purchase the property 2018 the very end of 2018 2018 okay and uh and you're saying that there's no vegetation growing there now and you're not just talking about trees I think it's starting to grow in and it's it's really not trees it's just vegetation it's starting to grow in but in that top corner you can see where the path is on that far corner right where the um the Town Line is that's where the snowmobiles would meet and go through the woods so there would be you know 10 15 snowmobiles in that section of land right there so that's growing in now but it's taking a lot longer than the rest of it okay and you're saying there were snowmobilers there when there wasn't snow no I'm just saying that's why it's a clearing there's nothing there okay thank you um any other questions for deep under the water surrounded by fence so that the Beavers don't sense any flow and they don't take and react to it by building a dam around it so they think they've uh cre built a dam but they haven't because it's still going through the pipe very good it it and it's a win it's a win because we don't want to hurt the Beavers but we don't want them flooding the road right I hear you thank you Bob I would go further and say these these guys at at uh Beaver uh management are really wonderful Beaver Advocates I I was out there with them um and they are really understand beavers and their uh habitat and their uh their uh you know I want to say culture but that's not it because they're not people but they were great and I know they're very active also with a lot of the uh uh State uh rescue um wildlife rescue um uh and rehabilitators too and whenever they find a problem with one of their uh one of their uh Beaver deceivers they actually uh react to that and redesign it to make it safer for beavers um they've been I've been really impressed with them anyway uh for what that's worth so we got an eye from Jeff and Mike we got an eye from you Bob you were gonna add something uh I was just gonna say it was embarrassing to realize that we never paid them their $175 for consultation back in 2023 uh because uh the authorization came just on Heather Manley's last day and um they sent us the W9 and uh the the the payment never went through so we also have to pay that but that's been previously authorized okay back in 2023 cool so Mike that was an i for you that was an i for me Jenny hi Chris I rich I Bob I and I for myself um Bob you sent me a couple of other topics that came up in the last uh 24 hours uh that were uh Beyond just the title um if you could because because I out on Table Rock uh putting in uh some of the trails that we approved last year the connecting Trails uh you know uh so that you know Trails don't dead end at the property line um and they've also been using their own fonts to put in Little Foot Bridges you know really boardwalks across you know boggy you know wet areas and um you know I had offered I said you know if you want to build a more substantial uh Boardwalk you know if you give me uh a location and you know a materials list you know I I I'll go to the commission and ask them for prior permission you know to take and use our existing uh Macky purchase order uh thing to take and you know buy the materials and so this is a request to buy them I think it's 26t 4x4s eight uh 8 foot 2X sixs and a box of uh sheet metal uh not sheet metal deck screws for them to construct the bridge across a uh uh a a stream uh at the Eastern uh edge of uh The Table Rock So Bob uh Eastern edge with in this area I'm sorry I'm not let let me uh hang on I was just trying to share and I uh fat fat thumbed it o o over towards over towards um very close to the Christmas tree farm uh yeah okay so the Christmas tree Farm is in here yeah it's up at it's it's up in the in the uh kind of like the northeast corner there uh to the right of where it's got that little circle around the AT&T right away that needs uh you know Improvement yeah yeah yeah this purple um yeah yeah there right right about where we have the cursor right now there's a fairly substantial stream that runs through there yeah I'm familiar with it and um and there's some muddy spots through there and these guys have been really good about building little um boardwalks um you know to bridge these places where you end up you know with a lot lot of Tire erosion and stuff like that so yeah okay uh excellent and so like I don't know if we need a motion or anything but just you know if I'm looking for a sense of the committee you know is it all right you know to buy buy uh or maybe we need a motion be simpler um to authorize me to you know buy these guys some materials for this bridge they want to uh construct and I sent everybody pictures of the stream of the some of the prior Bridges they built out of their own pocket or I don't I call them Bridges but they're really foot boardwalks and picture of the stream that they want to take and build this bridgeboard walk across yeah I don't have any problem with it because we we routinely as far as I'm aware fund um projects like that for other volunteer groups and what to I'd like to um motion to approve the two properties that would give us access to the rear Lots over on off of paage Street you know behind Matt Allison behind Connie Allison's Farm yes um and um uh saying you know like that they had been talking they've been talking about perhaps putting detention bases on Prop Town property and you're there and that I S said you know if you're thinking of putting detention bases on property that belongs to the conservation land I suggest you first check with the town attorney about you know can you put a detention Basin on land uh that's uh under the car and control of the Conservation Commission uh for Passive Recreation and conservation purposes before you go any further so uh I'm expecting that'll come all come out in the wash uh the next time they get around uh to discuss in flath Hill Road or the selectman's meeting and Bob I also thought you wanted to discuss and you know if you want to table it for another meeting that's fine um we had previously approved funding the title searches for properties out of the um Kelly um fund oh and you wanted to get that shifted over to temper rights thank thank you uh Mary for having my back there um yeah we initially uh uh did a $1,000 purchase order from The Kelly Fund to do searches and you know I I've been thinking about it I really think we should pres at some point in the future we should have a draft policy on what Kelly funds are being used for I really think we should try to do our best to preserve uh The Kelly Fund for major Acquisitions and not Fritter it away with you know uh Little Nickel and Dy and stuff and I'm advocating uh that um we uh and nothing's been charged to that purchase order yet uh that we take and we open a new PO for the title searches uh from the to from the timber rights fund and um uh not use the Kelly money for the timber rights fund for for for the title searches I would agree with that strategy it's aligned with my own thought so I I would make a motion uh for the sake of brevity uh that we um uh uh shift the title search funds uh title search expenditures over to the timber rights fund um and uh open and open a purchase order uh initial purchase order of a amount of $1,000 uh from the title rights fund to uh uh meet Talman and Costa or whatever their name is to the town attorney uh for the purpose of title searches and not use the Kelly and close out the the uh need to socialize no no updates from storm water for this meeting okay and then with the uh Hollis Road uh residents uh like anything that you wanted to socialize yes we do have a lot actually I wanted to just remind everyone that back in January when we replaced the water tank at 123 Hollis Road um we was replaced and we got a 12year warranty on the tank and six-year warranty on the parts and I went ahead and got a lifetime warranty on the tank uh along with the six-year warranty on the parts and that's attached to the new hot water heater so in case someone else is in charge of the commission they can always refer to the warranty that's on the water tank uh at the building uh the next thing I wanted to talk um just real quickly do we have a soft copy of that anywhere that's uh like searchable or like Chris has a copy of it or anything like that photo of it Chris Ruth has a copy of it and he the uh a soft copy to the actual hot water heater okay excellent right uh the next thing I want to bring up it's uh a year past uh where we did the trim work on that particular building and which was approved and now we're at the following year where we have the um request or the proposal to paint the remainder of the building um and the con the painter is willing to start uh it comes with a $6,400 um price tag and I wasn't sure if we had approved both of those because last year we approved the $4,800 for all the tour work that occurred and um now well why don't we just vote again and make it uh really clear okay sounds good so I I propose that we re paint the remainder of the Hollis Road building which includes priming as well as two coats and installing any shingles that may have that may be needed uh for this project and looks like he's willing to carve out May the next thing is we also have gotten the uh facilities Department to agree to put our pollinator habitat sign that fell over the winter back into the ground for us andell um they hope to do that in the next you know they they're just getting their staff back so they're said you know it will happen in the next few days um I did get a request from Linda Hilton Hilson excuse me from the pollinator habitat uh they're still uh working on trying to eradicate their jumping worms I think I may have mentioned that last season and they're looking to see if they can uh have us purchase some dry mustard um which is a culinary spice but uh they need $80. 32 worth of dry mustard and I'm hoping does the town have an Amazon account do you know Mary I have no idea okay um if not there hopefully we can get it somewhere else where we do have an account but I'd like to uh approve the purchase of some dry mustard for the eradication of the jumping worms um so the pollinator habitat can um get rid of Sophie you had your hand raised um yeah so recently I was told that we didn't have an Amazon account um and then even more recently there was an email sent by Annie um that there is an account existing um but I can I can share that whole email um on you know how to go about doing that through the Amazon account because it would be a first for for our department I think um so I'll share the email that has all the details in it if that would be helpful that would be helpful yeah it would be helpful thank you does the uh facilities Department have that access to that Amazon account um I would assume so um okay because I know they have a bunch of accounts um so I believe so but I I'm not sure I did that's just a matter of an email to verify okay all right great so um Mike uh what how are these things that the um pollinator habitat generally funded out of what account we usually uh we usually go through the Haw account the Haw account okay okay I I just wanted to make certain that well as we're voting we're clear because that's something that the office has kind of brought up before that we're clear on what we're approving the funding to be um you know the budget where the budget support should come from um I think the gas for the lawn mowing through that hos account last last year and uh this is more of the same uh okay okay so I think I'm looking for a motion Mike um for $80
