under God indivisible with liy and justice for all minutes um oh just July 24 yeah just has the attachment on the back from the letter that we received that referenced Mr chairman I'd make a motion if you're ready ready to approve the minutes of July 10th 2024 all right next thing we have is uh excuse me review Town's proposed water supply Zone bylaw where we at in the process that's what I'm trying to yeah quite figure out there's one more plan meeting on it and goes well okay nothing new since our last meeting but I put it back on the agenda again because I thought maybe we could put a draft back to them if there was specific things that you wanted to change so this is the draft that Richard the interim plan coordinator after your meeting that you guys all went to yeah he highlighted you can see where he crossed out highlighted that so is there anything in here are you guys good to go for me to send something back to say yep Bo's good or are there things on here which um a couple of things I kind of highlighted yep because you guys kind of seem to make up your mind about the special permit thing but it wasn't really decided so am I leaving it should I take it out do you even want to send them a draft back it sounded like they wanted a final draft for the meeting for their next meeting on the 26th but they haven't anything more so are they looking more for comments from us on what is is this like their I think they just want to know do you agree with this do you agree with this draft no okay so what do you want to change for me to send back to them to say these are the things that the water Commissioners are requesting obviously they I think they can say yes or no as is but are there things that you guys I'm definitely I'd like to see them take out the um special permit required for us to do anything in in for you know it's just it's site plan review is adequate enough uh I I don't know of any other water district anywhere that has to go for a special permit for anything that they're doing so I I just think this is like brand new never seen anywhere else before doesn't need to go to that level and I'm I just really feel that it's unnecessary that so you're referring to Zone one zone one and Z special permit required so that's page yeah and then we talked about treatment in zone one and zone two and that's distri that was just highlighted for what they were changing but basically page eight is uses and activities requiring a special permit so page 8 one is all of Zone one yeah um h 2 d c f and g pertains to zone two so are those the two sections that you want removed completely Zone one and zone two I don't think a special permit it's it's nothing that I've seen I I've I've tried to find it somewhere else for another water district as a requirement and I I just think it's you know we're covered under site plan review I agree I I don't want I I just feel that that's you know we talked about the differences at the last at the last planning board meeting they they were so slight and I don't you know there's there's specific verbiage I think or specific meaning when they call for a special permit and this this does hasn't fall into any of that and I I think it's just excessive yeah it's just something else we have to do if we if we're going to need to do something well you you got to jump through the hoop you don't have to jump through it twice that's right I think uh I've been on the fense about this whole thing really kind of looked at it I don't see I just don't see how a special permit is applicable in this situation right just don't think it fits what a special permit is really you know required for um I understand why they're out there but if you look at things that require special permits it's just it's add a treatment plan it's just not one of them so I would like to see that take okay so remove remove and then it was just one other on page five permitted uses G oh no I'm sorry page six H H6 h was still under the permitted uses uh shall not include so we need to remove that because we're not doing okay yeah so really I mean and then FR you had talked about just adding in the D word d wording for the permitted which is on the single piece of paper right here activi conducted by Lum which are necessary in the construction installation operation maintenance inspection repair replacement protection of the well and infrastructure necessary and for the use of the well is a public water supply consistent with the requirements of mass drinking water regulation 310 CMR 22 yeah so that's a requirement that right and that's why we had that very restrictive easement corre allows us to do that okay so I will add this section in and I will highlight those few sections that you guys want to takeen up and then they automatically send this to the attorney general for review I don't know the steps with that I don't know I mean I I would I all I know is that they were talking about wanting to have a final draft for their next meeting on the 26th I don't know if that means they then will have the final draft and then send it to the attorney general so after the next meeting isn't that when it goes to the public hearing stage well I thought the next meeting was yet just another uh regular regular public hearing uh they'll talk about that so I do think it's important that we you know yeah subm this to them being like this is what the lunberg water district has is in favor of Cu it sounds like after the last meeting they're you know not in session or they're not talking about this until at no he said they would it was a Monday yeah he said they weren't until 26 that there was no other discussions yeah so that's why I just thought to be proactive I can make some changes and we can send them a draft back and they have time to review it before they meeting on the 26 and then uh and then I guess you can do you guys want will you all be there do you want me to um post it as a meeting on the6 I don't I don't know that's a you post it and then if we're not all there sure but even yeah so if if she didn't post you still both can go there you know you're not going to be voting on right we're not we're not changing anything you know we're we're making recommendations on the changes and then then from there I just want to make sure eventually we get whoever needs to weigh in on it I'm I'd like to make sure that you know D is well that's I'm thinking if we send this back to them then they come up with whatever they want and then on that Monday you know when you come up with yours when you send it attorney general can you send us a copy and then yeah we just want to make sure we're we're we're covering everything from our regulatory Authority point of view yeah I think where the DP looks is the Zone one y because that's what they're they require us to detect yep I want to make sure we're not we're not doing anything that they would not approve right that's all um I know we have some members of the public here that may want to speak on this and I allow them to do that at that time it's pertaining to this it is okay uh for the record Bill handy with hand engering um so if I'm understanding correctly the the language in sections G1 and two you're okay with except for you'd like to say the issuance of site plan site plan approval versus special permit you said us is p yeah yeah so so both on in zone one and zone two you're asking that that would be you're asking the pl Bo to consider having that at under under cycling approval instead of a special permit which it would be going to yeah no matter what we do we have to go for site plan review and meet with the plan um depending upon the size of the building and stuff like that but I mean I think I think I I think it would be helpful if you just instead of taking it out instead of taking it out you just say we section eight we would just say use is requiring second review yep I could do that yeah because I think that's what you're trying that's trying and they're going to either agree or not agree correct at least but at least the language within it is acceptable yes if required for a uh site plan review they'd have to change a little bit The Zone one following uses activities are permitted uh only upon issuance of a special permit it would be only after a site plan right the top the top would say site wherever it says special permit in here it would Sayan review be would it be cite plan review if required I know certain things required certain I mean I'm assuming that pretty much anything anything want that right so yes okay okay and um and then and then they can decide at that point if they decide they want to keep a special permit then then it is what it is corre all right and then um be the first one in the state it's always good to be number one nope not that the the the and the other part is so is it is it just that or is it that plus FR language he's talking about in permitted permitted us uses yeah because I know I here it's do you want right I'm familiar with the language and I think but I think that that's already covered under under the state regulations as it as it as it sits I don't think that and I I don't think that they're going to have a problem with adding it but I'm just saying if they don't add it I think that that's covered under under 310 CMR 22 anyways uh which it this references right right right so I mean already covered under the regulations on the state level and there's nothing in in here that prohibits you from doing what's required by the state I you know what I understand better safe than sorry putting it in I can absolutely understand what you're saying in in we know that this is is the law the the CMR law you know um it whether it made it in there or not doesn't negate the fact that that is a law however I think since this is getting up for or whatever I I Would S I would recommend that it gets put in yeah and that's a simple recommendation I think that's a good language to have in there so people understand it um but if it's not in there it's still in there you know you know what I'm saying but I just think it's a good idea to put it puts people on notice that that other reg there's another regulation outside of what you know lunberg decides that governs this as well as well so I think it's and as far as the process goes um this is still under the planning board um development of the cor bylaw from here my understanding is the planning board will you know vote to issue whatever version of this that they're going to issue that then would go to town the town warrant and go through that process then there's another public hearing process that opens up to review it at a public hearing under the under the zoning changes by town meeting to get it on the town meeting once it goes to town meeting it gets voted um hopefully it gets approved once it gets approved that's when it goes to the AG okay there's no I don't know of the mechanism that Fran's referring to where D has to review this okay so and I believe that the only place that it gets reviewed or would get reviewed is when it goes past town meeting for the AG to then step in and say wait a minute dp's coming up with comments and here you go so just asking a question here if you don't mind no uh let's just say uh some sort of bylaw got approved in lunberg but did not meet a Mass General law in this case that the AG sits in says no you can't say this is doesn't mean anything you know it just I I we're thinking forwardly that let's have the AG or whoever this governing Bing is look at this first before we put something all the way through the wickets that can't fly no I I think I think that makes sense but you you I don't think the AG will rule on will will give you any comment back until it goes past town meeting okay I think that it may not be a bad idea once the final version has been created by the planing board if you guys as a board forward that off to DDP to help correct I guess that's yes we're we're trying to if we send it along and PPS gives it their blessing that's that's that's one more thing that's in a positive direction of this bylaw passing right right you know you don't want to p i and I don't know why You' want to pass a bylaw and then have somebody look at D not commented on either they may not hopefully everything's good and it's it's fine but if something is you know blatantly wrong with it that violates another Mass General law or a d law we're just trying to mate pick it pick it up before you that's all we're looking to but I think I think that that in general that kind of lays out how the the structure of how it would go through the process right I thought that the AG would look at it after pass because they only look at they only look at whether it conflicts with mass law in some or constitutional law in some other regard they don't look at the find they don't look at the fine-tuning of the language they look at in other to say okay we're going to put this bylaw through and everybody has to wear a yellow shirt on Wednesdays okay that's the bylaw you can't do that but if you put the bylaw through and it passes a town meeting and everybody has to wear a yellow shirt on Wednesdays then it goes to the AG's office and then they say you can't he can I'm assuming they do this just for the amount of traffic they must get if every little town wanted it's part it's part of the process for law creation within within the the con that's just how it is and it's not just Massachusetts every every state has a similar process sure you know I mean we'll do our due diligence as a board to present to them a uh acceptable factual document and then what the planning board does with it is what the planing board does with it so I'm in favor of what we've annotated here and we'll push on I'll make the changes and get it any other public questions on that I I just want to bring up I don't know number four paragraph or line number four on the yeah what yeah wanted to bring passive Recreation what happen What do we do with that what do we decide on that that's going to go we were going to leave that you're going to leave that that's the definition that's yeah I know what is but I'm just saying walking hiking cross country skiing and bicycling yep that's a definition of pass of recreation nothing with a motor right going to have some fun cross country skiing down there this the Lancaster it also said I could hunt down there I don't think you hunt down well this is this is all for Zone I know it's all own all his own ones I know I was just you know it just seems like who would hike down I mean you walk 50 ft you walk I think this is it is very very specific um okay moving on um commissioner superintendent clerk treasure audition uh all I got is uh is massav extra one on there but Mass moving ahead uh temporary lines are all completed uh tough time we we flushed them chlorinated them but doing bacteria samples they it failed the last two so we reated again today uh so there's two two sides one side north side of uh Mass South Side you say uh so the the south side just tested uh yesterday uh today so we're going to see tomorrow we'll know if that side passes uh the other side we we've already tested twice and make de we reated the line and uh hopefully once that goes then then stuff's going to start happening nothing going to start tying the houses on and the original plan was to tie each house on onto the temporary line and I think what they're going to do is uh tie dig up their service tie them on to the service because one of the things is the the pressure reducing valves in the houses you know where do we put them do we put one on the house do we connect it outside faucet what if something happens in the house now because backwards so they're thinking I think a majority of them they just going to tie this the curb stop like there some of the houses long distance off the road for them to run a hose all the way to the house take much more time than take off the shut off now they're going to tie all those in once the temporary line then act then then the temporary Line's going to be feeding them and then they're going to throw the whole Main in and then finish the Taps on the on when the Main's done in the main uh everybody does that different some some people just just do the main test corate get it past and then do the tabs and Tios in uh some contractors will actually do the tabs as they go and test that so some people scared about doing the tabs passing the test I'm not they don't they don't so if you don't they don't so do you know how they're planning to to do I I haven't asked that's specific you know I just yeah most I'm trying to kick them in the butt get the S going so looks like they're prepping pretty good they're doing a nice job it seems clean and pretty they s the whole job up I mean if you went down and looked at the stream you'll see you'll see where the valves are going so the whole job laid out they make all the materials in hand or in in rout the only went uh unsure of is the directional drill which is from towns AA Road pass uh actually two Game proce Y so uh G's request was that we go a little further past this driveway sure and uh so I spoke to the engineer about it he said you look at a 1010 to $5,000 increase and to go that extra distance but then you you're not paying for the water M for them to put it in so that that's $11,000 right there it's not a huge cost to to go that little extra and U he just paav that with Grant curving he did so you know I really would like it like we'll see what we can do so it's not a huge expense to you make him happy so it's an expense for us it would be so that's our on mass out uh next thing that came up is uh the 2way radios that we we're using right now I don't know if we get struck by lightning or what uh we couldn't we can't barely could talk to each other a static even on mobile radios which typically you can talk 20 miles away even standing right next to the tank every was static so the radio guy uh came out today and uh stuck in a backup repeater for us to use so I'm not sure what's if it can be fixed or what what happened to it uh I didn't get to speak to he before I got here but uh something to think about that the fire and police are upgrading their radio system and uh we're all in the same spots we're our inent is our there as our and uh I don't know if this was something that maybe you guys would consider that we We join with them so we do a you know joint system because they when when you have multiple antennas on like say a water tank uh they're all fighting with each other so when this one's transmitting everybody else is dead no reing is going to come in so if we combine the system together it's actually called a combiner but where the antenna is a set with filth is specific to each individual individual department so that no one's interfering with each other so I think in the long run if we did say yes let's let's jump in and do something with them then uh I think it could be a benefit thought you could hear each other each other's conversations no we're all still going to be in our own frequencies but all going to be filtered so they're not interfering with each other so like right now if I ke up at the perfect time like the police start transmit and I ke up it would uh you would hear us pass through the police Gil I've heard it a few times or or if they're talking in a week spot and I transmit they're all done so any and you're talking with the same contractor that is dealing with the town stuff yes yes so the I spoke to the fire chief he he's having a tough time getting it through town to get this process started it's something to do with the the the radio guy is on the state bid so you don't need to bid that yeah you can just go buy the equipment and you can go buy the equipment but when it comes to the part of putting it in now you're exceeding the the prevailing the law the bidding laws so uh that's kind of where it's getting into a touchy spot so this is where the radio guy he says if if we jump in with them we would actually help in satisfying the state laws because now it's split not just big chunk of money them now it's split to dispers three three departments instead of two any we'll see how it goes I me just giving you guys AED that in the radios that we have 14 15 years old I mean it's not that's yep so they're not working now stuck in a temporary repeater but we we had three sites now now we just run off one so that one was working better but it is nice and it's important because when the guys are down there doing stuff Lisa and I can hear what's going on where are they what are they doing so if somebody calls we're aware of everything it's not a phone or a text or like that I'm very very firm on no use of cells everything's by two because if two guys talking my cell phone I don't know what they're doing she doesn't know hey we shut the water off and they said by cell phone then someone call he I have no water we have no idea so if they say it by by 2A we all know it everybody knows even fire police a communication to in case cell phones don't work etc you like yeah that's very that that happened in the ice yeah yeah because we were B on the 2A radio the uh DPW was on the next house yeah and next out was up at Chase Water and I was up there checking the cuz everybody was on back of power so I went read the propane tank and they were at like 72% but when I was up there next to was running off a generator it was on diesel and when I was there it ran out fuel so uh I got up we had a big emergency meeting at the fire department and uh DPW is like we can't talk anymore what's going on yeah battery just I mean gener so yeah so two areas are huge yeah that's all I got Townsen oh Townsen uh superintendent Townson called me yesterday uh their treatment plant is going to be completed and online in the middle of September and he offered us to go and visit the site love love to see it and uh we'll have to post it because that be a full board I want to bring all the guys everybody yeah uh and also he's still pushing the selling lunberg W so really yeah if you do the math ma yeah do the math we can do the math but they they're putting a new storage tank in uh on lunber road which is new new W road to house MH so they're going to put a water tank up on the hill up there so uh that's how his way was thinking that they have the ability to right but we'd have to put whatever miles been yeah and the downside been own by Kevin how so be well every they want to know all the different things we can do so let's find out the different things we can do but typically when we've done that in the past it's been it would cost us more to buy water from an outside entity than it than we sell it for uh correct so most of the time when you've done that it's it's costs more uh true so when when we did keying uh the board I don't if you on the board the board was dead against putting a well in the keys four miles of water man building building a pump station so the whole thing was uh Fitchburg uh so we looked at Fitchburg and we start looking at purchasing water from fitur how much it's going to cost you a year right it cost to buy water from fburg for this just this little chunk chunk of water was more money than the loan payment to to go to go so Dave Rogers was the big one da Dave Rog don't no D he's by the penny everything's by the penny you got you got to be perfect specific detail and so we started running the num started looking and I I don't remember the number we were looking at two or 300,000 y a day so it wasn't like anything huge and uh it was it was exceeding what the cost was to buy the water and then the positive side was ke could do .4 million g a day so if you looked at that number it it blew the number away from first so so but if you run the numbers and it's not very difficult to do no and you run the numbers you're you're and let's say it is cheaper to do that it's audio control just like the Su they can raise the rate like like look at lemons and fish they have their rate and then they charge more a different rate so and if town did that then it's what do you do then there then there's infastructure to get to where you can get the water transport the C of doing that there's a lot to consider I mean it's definitely you know but like I as we go through all the stuff I look at it in a 20-year block this is that's I'm trying to Envision any investment make to uh you know what's what's this going to do for us in a 20e Time Everything Changes yeah uh I got are you good I'm done I have uh one the yep no the um investment that we did the cedar is coming due in a couple weeks the one that we did last year for the 1.5 million y u comes due on the 22nd so we need to decide if we would like to invest again I talked to Fran and that money was allocated for the tank and it doesn't look like for painting the tank the maintenance of the tank what's the what's the term on reinvesting so he gave me two he gave me a 6 month and a 12 month so the 6 month is 4.75 and the 12 month is 4.5 okay see when the next time we look at the tank uh they they said two two years we definitely have more than one year and me from what I'm hearing with the interest rates dropping I would Pi one year that y I would yep all right reest message him tomorrow no sure motion that we uh roll over or reinvest the the what called the Sedar Cedar for 12 months was hi hi I don't why do we have to second something when we all have to vote on it at the end it's just uh all right I'll reach out the old way the process the old way it's the u rules rules Robert Robert came up with that if you made you made a a motion and no one second it it's dead right so someone has to second that means they're on your side so I mean you could come up with a crazy thing and but if we all vote on all vot in favor anyway actually I think a three rules are a little different I did read some of Robert's Rules but I think if you had board 7 for example and if someone said it's yellow shirt Wednesday I knew that was you guys all good I'm done any public comment I have a comment Andy starasi he went to Green Court um I I came here I was trying to get an update has the district uh submitted anything to the state for the clean water srf for this year no no um I was hoping you give me a status on what's going on with the King well uh pilot test is still in progress the only part of the testing that's been completed is the hardness test and the hardness test ran for I think it was only for three hour well it ran for many two weeks but in three hours it was already zero so Prov working very effec I believe the last time we met with our engineer we were waiting to get all the testing done before we submitted any srf yeah correct because the public wanted to have all the information so we're waiting to get all the information before we submit for SRS that was going to be my next question cuz last time you submitted before the pilot so it's the pilot study that's holding up putting keyd it's the it's the request from the public for to get all of the information as accurate as possible so waiting for the testing that's we've had numerous meetings where people have suggested to wait for the testing so we know exactly what all the costs are going to be so that's what we're we're waiting on is is the goal to submit maybe next year as soon as we have all the information I would think the goal would be to subit as soon as possible of all the wells and the past treatment is keing the priority there is nothing planned at this time right because we're still Gathering all the information I thought you you wanted to pursue all of them again yeah we're want to look at every option and give every option V pick which of how that's the way I wanted to do it yeah give them yep but until we get all the information we can't yeah also the srf cycle is passed yes you know so we can't uh there's no at this point what do we have it was uh we're hoping to have all our ducks in a row information gathered put out to the public take public input and then apply for Sr srf funding on the next available cite um so has there been more past testing at keing and Lancaster app that would um I don't think we I think they they only have us testing twice a year so I'm not sure if there's because there's been some qu I asked CU there was questions about the Lancaster a past levels and statistically where did it fall so do we have any new data since what you presented in the I think I don't uh yeah I'm not sure when the date was I know Wells one and five both failed the P pass Wells two and four passed uh I don't know the dates on when that was is that data is that something the public can look at yeah I can I can do that' be great thanks hello that's it anybody else accept
