Hans winr David Latt and Don gurny uh the way that hearing will go as Lisa will read the application and any other submitted Communications the applicant will have the opportunity for comments on the and we are replacing the front Farmers porch the porch already is non-conforming and we are looking to add length the proposed action has not begun the basis for this application is found in the following section of the lunenberg zoning bylaw section 250- 5.21 the street address is 386 Sunset Lane in lunenberg assesses map 135 Cal 5 the name and address of each holder of legal tile to the land which is the subject of this case is Matt s and Nicole matano of 120 Benjamin Road in Shirley Mass the deed is recorded in won Northern District registry of deeds 16 10668 page 314 and recorded 119 2023 it they have no prior knowledge of a prior appeal application or petition concerning the land or building involved in this case the special permit questions and answers are as follows will the proposed action be injurious or dangerous to the public health or unduly hazardous because of traffic congestion danger of fire or explosion or other reasons the reply is no B will this action have a material adverse effect on the land on the value of land and buildings in the neighborhood or on the amenities of the neighborhood the response is no c will the proposed action be operated with reasonable regard for order and cylin if in open use and the answer is yes s and D will the proposed action produce noise vibration dust odor heat or glare observable at the lot lines and amounts clearly detrimental to the normal use of adjacent property and the response is no and that is signed on March 13 2024 by Matt Metrano of 120 Benjamin Road in Shirley Mass and there's a copy of the building plans there's a copy of the site plan and there's a copy of the building permit application and a list of abutters that were all notified two weeks prior to tonight and that's all Mr chairman pretty straightforward we are remodeling the house as a whole um and we want to replace the Farmers porch That's there it actually sticks out about a foot further than the one that we're putting on there it sticks out it's about 7 ft wide instead of six but the one that we want to put on is the length of the house so that's where the encroachment is okay on Sunset Lane okay so you're adding a foot uh no we're subtracting oh you're subtracting yep so the existing one I don't know if you can see in the building plan there but the existing one it sticks out 7 ft that's 7t and then the new one is actually only 6 ft wide but it's longer it goes the full length of the main house okay and that the way it goes towards the road that tape is down as you go down correct it goes from 20 21.1 ft down to if you put the new addition 13.7 uh according to your plan okay that's just how the the road and are sh right exactly the road curves at that spot okay I'm going to open it right up to the board okay Mr chair I I we had a chance to look at the uh larger plans thank you very much for us folks who were past the age of 21 that was much necessary um for my my understanding is the existing porch is actually a raised porch which on doing is basically uh ground level no oh okay so the existing porch is also ground level the way that they have that driveway or we have the driveway it's yes my house now uh it comes in and it it dips down so the porch is actually a little bit below the driveway grade in some in some spots and then it's slightly above the grade at another spot okay okay but not raised either but as far as the front yard it's it's so it is raised up a little bit but as far as the front yard it look looked like the pictures it was the same level as the front yard that's what I was the same level as the driveway pretty much y any other questions from the board I didn't have any mrman I don't none okay so um yeah actually the only section that would be I'm going to say a little adding more Conformity the the length yes but is that one section to if I was looking at it from the house to the right you're going to go from what's there existing 15.4 to uh 13.7 so that's the only small area that's really adding a little non-conformity I know the length does as well but um like you say it's because of the way the road actually curves and if it helps at all um we went in front of conservation last week and they were fine with it okay all right okay then if there are no other questions I will ask for a motion anybody on zo oh uh nobody's on zo Mr I'll make a sure I I do have to read something first uh the special permit is grent with the contingency that the petition applies with all licenses regulations statutes ordinances of any and all applicable local state federal boards agency with jurisdiction over the premises a special permit is subject to parotic review by the permit granting Authority or enforcement officer to ensure compliance with conditions non-compliance conditions may result in revocation a copy of the board's decision shall be filed with the town clerk within 14 days any party agreed by the board's decision May appeal to Superior Court 20 days after the decisions filed with the town cour clerk after certification by the town clerk that 20 days have elapsed since the decision was filed you should have it recorded in the registry of deeds no special permit shall take effect until it has been recorded and the special permit shall elapse within two years unless substantial use of construction has commenced with that
