motion to approve meting minutes moved second okay all in favor I okay we are moving on to new business we have n ph-1 comprehensive plan Amendment 24-22 Hope Sound train station Flume um request to consider an application for proposed amendment to assign a future land use designation to the recently abandon 5,465 ft13 Acres right away of the corner of Southeast bucan Avenue and Southeast artha Street and hop sound Sierra a and at this point we'll go ahead and turn it over to staff for their report good evening my name is Clyde Dulan with the com comprehensive planning division uh I'll be presenting uh the plan Amendment and the next item the uh ldr change uh as you said this is a proposed uh land use map Amendment the uh 5,000 odd square feet of property is all for L right of way uh the board of County Commissioners voted to abandon this right of way and um it was then deed one half to the east which is owned by the board of County Commissioners and one half of the RightWay was deeded to the property owner on the west and then that property owner deed over his half to the county so the entire 5,000 odd square feet of RightWay is now owned by the county and is contig to this triangular piece of property here to the East and um so it needs a land use designation if it's going to be used for something uh because right of way does not have a future land use designation so in our staff analysis we considered um what potential future land use designations could go on this property as you can see CRA Center is to the uh East to the South and uh also to the to the north here along the the service road the Dixie Highway Service Road and CRA Center is farther to the east on the east side of the railroad tracks CRA neighborhood is here to the West um in the Zeus Park Subdivision that was originally planted in the early 1900s and uh the so staff is recommending approval of the CRA Center so it would have the same color as this uh triangular property here to the east uh it would allow a variety of commercial and residential uses in so doing we considered past land use changes in the area uh there's no potential for Wetlands on the site um we consider the four criteria that staff must consider any future land use map uh past changes in land use designations there have been largely the changes to assign the CRA Center and CRA neighborhood future land uses to the entire uh Hound C growth in the area uh there's been numerous uh houses developed in the Olympia plat and um uh since the 1990s and de development of vacant land in the area uh and the fourth criteria uh would fulfill a public interest um because this is land is owned by maren County it will be used by Martin County for public purposes and uh for the benefit of the public we consider Urban sprawl criteria and found that it met all of the criteria for for um not causing urban sprawl uh it's deep within the CRA deep within the primary urban service District uh close to the east coast compatibility uh we considered uh the neighborhood to the uh West and uh looked at the land use designations that are already there I looked at the permitted uses we'll get into that more in the next public hearing uh but you have residential uses that are permitted in both the CRA neighborhood and the CRA Center and you have commercial uses that are permitted in both and so you really don't have a a really big big difference uh the CRA uh zoning regulations limit some of that commercial and some of that residential intensity in the CRA uh Center future L use designation so the existing land use is nothing uh and the proposed land use would be CRA Center and that's shown in this graphic right here so that it would match the Triangular portion to the east um it's consistent with the comprehensive growth management plan the uh CRA Center future lus designation is intended for this type of an area in the in the community redevelopment area of hob sound um I could go into more of the staff report but I think I've covered the high spots and I'll end the the staff presentation there with staff recommends approval of the proposed future Lage designation C Center and I'll be happy to take any questions little piece just to the north C what's that um I'm sorry where where are you pointing where your thing is where it's blank there's no color there's no color that's right of way so that's right away as well that's right away as well everything that you see where the the picture the underlying picture is showing through where there's no color on it that's right of away so who owns that right away to the north to the north there Venus come come come down oh this part right here to to the West above the proposed property little bit yeah right joining the proposed property that's all right away uh it's controlled and um managed by Martin County border County Commissioners but to the left of it it's the neighbor why do it on all of it at one time uh they don't need all of the right away for this uh also this SE section of Vulcan where my cursor is is providing access to property owners who front Vulcan right here and it will continue to provide access to them that makes sense any questions what are terrific okay he says terrific Mr Camp I have no questions but moving public comment I'll Mo motion to recommend approval to the County Commission okay uh obviously you are the applicant so we have nobody presenting correct correct um do we have any public comment at this time okay so we have a motion on the table I'll second it okay all in favor I I okay it is passed all right moving on to our next item my favorite word np-2 Land Development regulations 24-4 article 12 hop sound train station subdistrict um do we have any interveners not for this public caring okay expar gentlemen none I have no expar I do not as well okay and we will go on to any well swearing everybody in at this time who will be testifying on the behalf of the project yes Clyde Paul please stand do youwe or affirm that the evidence we about to give will be the truth the whole truth and nothing but the truth I do I do all right without further Ado we'll go ahead and let staff make the presentation the uh future lanus designation that you just discussed and considered at at the last public hearing uh is implemented by uh a number of could be implemented by a choice of different sub districts that are found in the hob sound c u Land Development regulations and uh so and depicted on this graphic in the CRA Land Development regulations are the subd districts for the entire hob sound CRA um I'll zoom in on another loc another site here so this again is the abandoned RightWay that we talked about here's the land use that you just talked about and here is a zoomed in uh graphic showing the subdistricts um that are that could be uh considered the core c the general subdistrict both Implement uh could be used to implement the proposed future land use designation CRA Center uh the core has a little bit more latitude and a little more uh intensity the general is a little more restrictive um but it's they're both allowing uh residential you development and Commercial development basically a mixture of uses um and the uh staff recommendation is for the core subdistrict to be assigned to this um right away and it would look like this the what I was just describing for you is that you have the future land use designation CRA Center neighborhood Waterfront and Industrial and then you have subdistricts that can Implement that either of these uh future land use designations that were just considered as you can see the general subdistrict can be in both the core can only be for the CRA Center and then below it in this in this uh staff report are permitted uses that show the core and the general and we'll I'll just lightly touch on some of the permitted uses that are permitted in both of those subdistricts uh one that's proposed for the property and the one that's to the um to the West they both permit accessory dwelling units um bed and breakfast Business and Professional offices Construction Services Limited hotels motels as you can see the core and is going to permit I'm sorry the general is going to permit some things that the core does not like marinas but medical offices are in both restaurants are in both uh institutional uses limited impact are in both so there is really a very good comparability there's really not going to be a drastic difference in the permitted use uses that could be located on the properties to the west or on the subject site or on the properties or on the property to the uh East so uh then the development standards for the subdistricts um you can see the minimum lot width minimum maximum Building height you can have a little bit higher building on the core as opposed to the general I am speaking correctly yes and uh your density is 10 on both your hotel motel density is the same on both your maximum building coverage is a bit more on the core than it is on the general so those are to give you an idea of the the uh differences in the subdistricts that are applicable to this area staff is recommending approval of the core subdistrict to implement the future L use designation you just considered in the last public hearing um I'll close the staff presentation and be happy to answer any questions gentlemen no again pen pending public comment I'll move that we accept staff's recommendation and recommend that to the commission all right since staff and applicant are one of the same do we have any public comment okay excuse me um I just want to confirm that the notice has been turn the affidavit and notice to surrounding Property Owners has been turned in for this public hearing yes okay you were sworn in huh no of sworn also there's at the in your agenda package are the notice that was um published in the newspaper for these uh hearings intergovernmental coordination a proposed text amendment to chapter 3 enter governmental coordination element of the comprehensive growth management plan Martin County Code based on the 2024 evaluation and appraisal report um so staff you ready to present yes again my name is Clyde douan The comprehensive planning administrator uh with me is Stephanie she is a planner with the Treasure Coast Regional planning Council and she did the work on this chapter uh We've uh contracted with the regional planning Council to assist us with a number of the chapters um in these ear-based plan amendments uh every seven years the uh the county is required to review its comprehensive plan and make amendments to Chapters uh in order to be consistent with State Statute and also to identify local issues or just housekeeping items that need to be taken care of uh this element has uh no major changes no major policy changes necessary it's largely housekeeping and with that I will turn it over to Stephanie hi Stephanie he Deputy executive director of the Treasure Coast Regional planning Council as C said we were doing some of these um items so I'm going to get to to see you guys a few more times which is good um the the changes we did as Clyde said were very housekeeping in nature not nothing major um things like the coordinating agencies like um we had to add in the village of Indiantown because there were a lot of things that just that didn't have them included in there um also some of the coordinating mechanisms because um since the last update of the plan um the m has uh uh created a the Treasure Coast Transportation Council that's a council that coordinates with um St Lucy County and Indian River County on uh you know more Regional issues um and then also the membership of the no board is also changed so those are some of the strike through and underline you'll see and those strike through and underline are should be in your agenda packet um also uh there were references to County agreement with Waste Management uh related to Solid Waste disposals so that was a there was a first contract was in 2004 2019 there was then another contract 2019 to 2027 which is the current contract so we've referenced that in the materials and then also um just to let you know that 2027 there is an extension of seven years that they can um like a renewal term that can be done uh uh we also renaming departments such engineering department is now Public Works um coordinating utility services so we had to change the name of the Indian Town utility company which has changed since the last update and the expiration date um for the agreement uh the interlocal agreement with the town of Jupiter Island um also with the school board um there's some text uh changes that we're suggesting to be more current with State statutes and then there's also um you'll also see that um we did the school element too so you'll see that as well and we've made references to languages that school district and the county does coordinate things such as population projections which are required and then site planning so that's really it for this chapter if V governmental I'm available for questions okay you're heard chatty bunch tonight staff recommends approval of the proposed changes to the chapter the advertisements uh for this are text Amendment are in the uh package amendment to chapter 7 Recreation element of the comprehensive growth management plan Martin County Code based on 2024 evaluation and appraisal report um you're back I'm back okay can you staff you're welcome to present thank you uh Clyde Duan for the record chapter 7 uh has very very few changes uh all of them were most all of them were proposed by the parks and rec staff uh we we provided the chapter to them they went through it and made some uh changes that that are largely their recommendations um so the there's very little in the way here of of changes in in terms of uh I mean we updates it somewhat so that Parks wreck the parks and wreck master plan um is uh changed to be conducted every 10 years instead of five uh they really can't get that much done in a five-year period so they uh they wanted to make that minor change um developments of regional impact are no longer a requirement in Florida statute so there's no reason really to have that in the chapter um it's um it's just an example of dated language um as you can see listed here are the the highlights of the proposed changes um you know the there 2003 feasibility study is long since done um it the village of indan town is Rec is recognized in along with the city of Stewart and the school board for joint use of uh Recreation facilities instead of um just Rec Rec recognizing the unincorporated area of Indian town that used to be um the changes are minor we'll be happy to go over the chapter in more detail and discuss it with you if you have any questions staff recommends approval of the uh changes shown in the attached staff report okay I know you have a question [Laughter] gotta speak in your mic I don't hear you back there C can hear me reference to Future pu public gun range and off-road vehicle parks that means I what does that tell me that that you took all those requirements out there was a reference to planning for and potentially having a future public gun range and a future off-road vehicle park and Aquatic Center the Aquatic Center has been constructed um we're all very proud of Sailfish Splash um and please you have your time oh was a big word the um the parks department does not see it I I think in their future planning for an off-road vehicle park um or a gun range Mar for there's more than one jokester up here not me I'm going to let that go I don't know light keeping it light gentlemen the I mean there was talk of an off-road vehicle park but there's a high school there now instead I'm thinking the the future public gun ranges that I mean that can still come up later on right I mean there's nothing to stop the the county the board of County Commissioners and their their Parks Master planning from including something like that in the future okay yep I'm good so Madam chair pending public comment I make a motion that we recommend to uh the County commission for staff's recommendation okay um applicant and staff are one and the same do we have
