he is find finding allowing storage is that supposed to be fine fine that's a typle that in there if we're going to correct that then I will make a motion um I yeah okay um second I'll second can I do that sure motion been made in second to approve minutes any discussion you still looking at no I'm good all in favor say I I opposed carried we have a public hearing text amendment to amend title that 15 land usage chapter 152 zoning section 15233 definitions section 152 090 outside storage and section 15209 screening of the municipal code for the city of Mayor um we'll let John take it from there okay um so we have a request here to amend uh the zoning ordance in relation to storage containers we've discussed this the last couple months uh we had draft text question yeah did you make any changes in the wording from the last meeting yeah there was a couple little minor changes nothing too specific but a couple of items that got brought up so but anyways what we have here is language um regarding storage containers and it was discussed last month in a draft text we have a public hearing tonight um with the exact text for the text Amendment and to start with we have a def definition of storage container which uh was the same as what we talked about last month and then we have section um 15290 outside storage and this is where we discussed a little bit of storage containers um are looked at as outside storage and it needs to meet the the requirements of that section this is under letter a and then under letter F which is where the majority that text was added um regarding storage containers has a whole list of you know what districts we can allow these in and the types so basically storage containers will be allowed um as outside storage in the agricultural District the CI commercial industrial district uh previously it was looked at in possibly the um C1 District but there was discussion to pull that out so that text was changed a little bit so the residential Districts The General uh Commerce Central Business uh um and public institutional District are not allowed uh basically this will be considered an accessory use um and shall not be located on a lot prior of the construction of a principal structure uh the number allowed there were not more than three storage containers located on a lot uh there was some discussion of that last month but three was kind of the number that was generally agreed upon um shall not be uh permitted to rent or lease the storage container out to a third party it needs to be used by the owner or the occupant of the lot uh the dimensions were in there that was adjusted accordingly based on the discussion from last month uh they'll be 40t in length 8 and 1/2 ft in width and 10 ft in height for maximums and they should not be stacked on top of each other uh location this is where a lot of discussion centered last month and it has to meet the uh all accessory building setback requirements and should only be located in the rear yard of the lot or in the side yard of the lot um if the storage container is in the rear 50% of the lot so it doesn't want it right up front by the front of the billing has to be kind of in the back 50% of the sidey yard of that lot so it's kind of towards the rear but yet can be on the side of a structure um and it sh not be located further forward than the front of the building if the building is set back you know an extra 100 feet or something like that on the lot uh the coverage uh this will be count storage containers will count towards the lot coverage in these districts so that would have to be calculated um especially if they have three of them that does take up quite a bit of spots or space I should say uh no signs lettering shall be permitted on the storage containers other than what comes on the storage container as manufactured so if they have the company name or something like that yes oh okay that's right it doesn't have to get painted it because correct so if they have that on there that can be done but no additional signage advertising you know specifics to the business or other things like that uh screening uh they shall meet the screening requirements of section 15291 unless the owner Paints the storage container and Earth Tone color to complement the principal structure in the lot screen shall be required when the storage cleer abuts a residential district or public right away um exterior appearance storage cleer shall be maintain in a good condition um so you'll you know and shall be painted in Earth Tone color to complement the structure um you know so that was kind of discussed last week as well and then then we got the screening section below and basically there was one little change there we made to kind of clarify an item in that first section of that section so that's kind of what we discussed so there was a few minor changes from the text last month and I guess we're here for discussion and a public hearing so nobody's out there any discussion on this side no it's just that uh we did discuss the different zoning areas that would be affected by this ordinance and uh we just kind of dropped that didn't we as far as what C1 was well you mean under number uh they were talking about you they were talking about resoning different areas because of C1 well the rezoning would be a separate item than the text Amendment if we were to rezone something so right now it was in discussion last time that's correct so that was we don't have to be concerned about that here not the resoning no but we did pull the C1 District out with the assumption that those couple properties would potentially be reson to CI commercial industrial because basically all those properties that we discussed fit into that District better yeah yep so it would potentially have to be a rezoning here in the future on those couple few properties yep okay yeah that if that's the case then I mean everything looks pretty good to me I just don't like to rezone something because you know yeah of something else well even if we it wasn't this um text Amendment you got to remember some of those properties are non-conforming right now like the storage structures here North of city hall and by resoning them C1 they become conforming so right now they are non-conforming as they stand but there was a possibility of uh using other properties to reone too and that case which were Residential Properties well existing residential that are zone for um C1 right now but we don't have to rezone those at this point because they're existing residential so they are non-conforming as well as we said as it is written here then uh I guess I I should be favorable so if we haven't we will close the public hearing and review and discuss which we're doing right now um I I apologize I wasn't here for the last discussion I did read through the meeting minutes so I got a couple of my questions answered um because right now we don't have a problem this is just to we notice that people are using could be using this and then just having some ordinance around it is that kind of where this came up correct there there's a couple properties out there and we looked on the aerial photo and found you know we could see them on the gis site for the county um where there's a you know a few different storage containers out there technically storage containers I've always classified as outside storage so they have to be screened like a a pile of pallets of you know something in these industrial districts um you say screen like a fence fence you know or a combination of BM trees you know fence or just so it's 100% screen is what it's supposed to be okay um now there are some instances where they're not fully screen right now so what what the discussion was is in some of these properties like out in shim cor if it's sitting in the rear of the property and you can happen to see it back there as we're driving by is that something we should be regulating and it was kind of thought yeah maybe we should be able to allow these on some of those properties where if you're driving by and see it back there you know as long as it's painted a good color and that's where this you know Earth Tone color thing came up and it's in the rear of the property that not such a big issue especially in these commercial/industrial areas so so we're putting r tion in place that will allow that without being like a hard fast 100% screened so and we're also limiting the districts that can go and so can't go in a lot of different districts only two that'll be allowed in okay I was just curious because um we own a business and we actually use storage containers to uh store a lot of our inventory because they're really uh kind of a cost-effective way and and sturdy yeah um and we do stack them as well oh you do so I'm glad that we don't have our business in mayor okay yeah so yeah we probably have go I haven't been up there for a little while eight stacked on each other but it's I mean it's nicely what four is it 16 I mean well no at 16 be eight so four on the bottom and four on top just as storage and a forklift property just curious commercial well yeah it'd be commercial it's a dealership oh okay all right so we store a lot of of our uh our product in the storage containers because it's a very cost effective way for us and that I mean it's been there for we inherit well we didn't we purchased business that was already there so we wasn't like we put them there as storage but I just get a little nervous by like really limiting a lot of these things but I don't think we have an issue and actually this will limit you know the number and stacking um but it does actually open open it up to allow more from a screening know previously it's only in the rear yard now they can come you know halfway forward on the side yard you don't necessarily have to fully screen it as long as it's painted a decent color and you know it doesn't look terrible that type of thing is that was kind of the intent so also as we mentioned last at the last meeting at that when these storage units are utilized that way uh we don't really get any revenue from them as regards to a building so so in a way the CI is kind of get losing Revenue because of it too yeah and that was part of the discussion last month was if you have a storage container you don't want to just allow them everywhere versus an accessory building because accessory building will be tax storage containers or not so you want to kind of limit them to some extent but yet allow them to help business but then do you want businesses to be here because if you start taxing them on every little thing you have but structures are taxed whether they're but I'm just saying like we for us we just use it for storage it's not like people are going in and shopping in these you know like it's literally used for storage and I don't know who made the decision to bring those in when we you know prior to purchasing this business but as a business owner you know you are already contributing a lot of not just to the city but sales you know I know it's a pass through but there's just a lot of things and if you want successful businesses to be brought into your community you need to take that into account as well I have no problem with this because it's not we don't I don't I think it's it's a good way to make sure we don't have 15 or 20 of them and they're all just scattered around a property and that was kind of the thought process is what's stopping somebody instead of building a a big storage Warehouse which would be a taxable building than putting 50 of them out there right really that's where the three came up now if we end up someday adding a full-blown industrial district which has been discussed for like the VM property maybe that one allows more than three that districts it's true industrial whereas the C1 you know allows a cases or allows potentially retail business in there as well so yeah I I'm I'm fine um with with it is I'm just throwing out some other thoughts since I wasn't at the other meetings so just we have a business and we utilize storage containers and they just keeps everything out of the when also it's more secure CU for theft where well there is a bu there is a up in the industrial park there what was there there was how many containers that were already up there and they're organized in a way where you don't even really yeah that was notice them so six of them and you to be told that they were there yeah we had we had an aerial shot of the of the the area and that's that that's why we discovered that but then again there's another person that has a couple two three of them and he's got them sitting here and there yeah I and and area people fly over too they don't just see me on from 25 or whatever they see a no I think having it well the second one you said see it by driving by yeah so the first one that we talked about you don't know form an organization or else you have things scattered all over the place and they'll be wind up like Washington Avenue years ago and and clearly with the amount of people that came to the public hearing all right we have a motion on the course of action yeah make motion we accept the ordinance written and that's it all right
