evening but from a procedural standpoint we have to pass a resolution appointing her in such a role before she can restor so if council's okay I'd like to move down to resolution 2526 of appointing please feel free to go the rest of this is not as exciting as it like on television so thank okay okay next item on the agenda is the public portion of the meeting anyone from the public wishes to come forward and speak on any topic please come forward state your name and address for the record is two uh is that just like three is we can retract this after year things go so let's visit this number one yes number two it's pretty much the same to get stoned as it is to get drunk i' agree with that except that triaa does not approve of mization because it impairment meur so really what I'd like to talk about tonight is safety the most important issue you should be considering tonight V the question is are you detracting from making the street less safe by adding consumption L to Center Street coun and your residents have discuss Center Street and on safe Street they've said that people speed down it they've said that it's difficult to cross because people won't stop they you know that the crossing is a major Crossing for strollers for bikers for skateboarders for runners and it's very difficult to see you can make some changes to that uh Crossing because of it also Center Street is primary cartway your kids walk into school and a lot of those kids have to go right across that driveway we're caning this so I think what you really need to consider is the safety issue because with a resounding yes the addition of consumption Lounge street marille is making the street more unsafe for your resid so you should and put the benefit of our residents [Music] first of public come forward state your name address record and I just want to back up with Miss meter said I think it's a safety concern I know cols would with their legalized cannabis they usually put out on 130 which is no main drag away from the presidents I just want to re what miss m said I think you should vote no against this proposal thank you all right heing seeing nobody will'll close the public portion of the meeting uh and we'll move into Old business uh item on the agenda is the discussion regarding jining uh and the C consumption Lounge which they have requested uh for Council support uh for submission of their application to the state or canis Regulatory Commission for the same um so U you know we've talked about this at a couple different meetings uh what I guess uh I would like to do um unless Council would like to debate back and forth but I I'm just going to start go to Every council member if you'd like to say one thing or another support no support whatever whatever you want to say if you don't want to discuss anything you think it's already been discussed I'm perfectly fine with that as well but to give everybody an opportunity to sort of say their peace if that's okay everybody all right you okay Mr starting this discussion sure I know I spoke a little bit at length at the last meeting why I'm choosing to support it um I will continue to chooses to support it I know Mr mentioned the fact that it's a safety issue fortunately it's the same driveway that houses a bar that people drive in and out of my daughter happens to work at that bar my kids have friends that live up and down there they presented more than enough I think to feel confident in the fact that they're going to be looking out more than the bars will for people coming and going after consuming cannabis on site there without delaying it or drawing it out more it has my support um the reason I feel that way is that it's a controlled environment um and there's it's monitored by the state if I understand correctly and there's a trial period it one year Fair it's a fair chance to show how it can work um but the fact that is a controlled site and it's monitored thank you uh so I do agree with Miss men I think that we do need to make serious considerations of Public Safety um and I think that that our the presentation that we received from J sing a couple meetings ago they outline their plan to ensure that they're doing everything on their end to make sure that people aren't leaving intoxicated I do have concerns that our the technology isn't there yet we're not able to test in the same way we offer alcohol was classting through balzers I think that the technology will eventually get there but right now we're going to have to rely on not only the the safety protocols that Jensen's putting in place I think we also are going to and I personally going to request that our police officers through the chief police uh that they're monitoring the facility to make sure that people aren't leaving the facility intoxicated uh I I feel comforted in the sense that we have the ability to have this as a one-year trial period if things don't go as planned and we can backtrack and and and uh withdraw our support of this type of facility and I think if there's any serious public safety issues that arise I would be inclined to act even more swiftly uh but I I do feel that Jing has been a positive presence in our community since they they've open uh I believe not just for their support of our community that they're going to do the thing that's right uh but their license and business is also on the line if they don't do what they need to do to ensure that this is a safe facility um so so with that said I I do have my hesitations as far as as Public Safety but I think we need to do our due diligence as the burrow to make sure that this business which is requesting something that is legalized in the state of New Jersey uh that has been regulated by the state of New Jersey and there are F in place um that that we give them our approval to continue to operate their business and uh we need to support them to ensure that they Thrive and are benefit to our community so with that I support Mr f um I'm not I apologize but I just I can't bring myself to authorize the use of CH on pris in the bar technolog is not quite there yet as you identified I think it's getting closer but it's not there yet um the Baseline they're going m is the Baseline that is an assumption yet no one has consumed or done anything before they arrive and We Know by bars and other things that people do sometimes consume before they arrive and they might you know Jump Around locations so I think we're operating on a baseline that may not be present again I just don't think the technolog is there yet U my kids do play in that area we have a number number of things between ice cream shop and store and the bike path that comes through there that I just don't feel comfortable and as much as I would like to think the police will pick up enforcement the reality is enforcement's down now particularly when it comes to speing and things like that and you don't see them around as much as you have seen in the past and so I I don't have confidence necessarily that they're going step up and for in this particular area or take a look at it and uh and I I also just as crazy they I just I don't want to be the first one I don't want to be the the the gamble on my kid's life um or someone in my family's life that may be the first one uh in the state to authorize consumption on site the wall allows for it but no other community has authorized and I'm not willing to necessarily be the first to do that so and the final thing is that when we authorized this the first time around I was very clear that my vote was contingent upon that this was more of a liquor store than it was a bar and that's how got my the first time to authorize the ordinance and I hand consistent that application that um you know again I'm still very much in favor of this it's a liquor store version versus the bar operation I'm not ready for Bar operation and I just it Mr so I think you all know my record on the the only person of council that voted against having the retail here in the first place I will say again I think you are good neighbors fire I said if I was in the market for a drug dealer um get through with all this I think it's time I think it's just the December meeting me of the Canabis committee they said okay we're going to do this we came and do the applications and so I don't it's been 60 days yet and we're looking to Russia and we talked about the Blue Mountain okay that establishment okay when did alcohol prohibition in 1933 it took us about 60 years before we put St my point is we took our time to make sure that we were doing it right okay and I think it's really important that we do this right and I think Society changes when it comes to these things and perhaps alcohol point maybe there'll be more restrictions see what Generations doing how they don't do as much you know there could be more constraints in the blue mon in future okay think about the attitudes towards cigarette smoking we around this table 60 years we all be smoking cigarettes okay things change things change when it comes to Public Health okay and so I'm concerned about this public health haard in our community okay there are people that get addicted to it I know it's not everyone I know it's not alcohol but there's people just like gam get addicted to it and I think this makes it easier for this people I think it brings a problem in this t this new setting it's new for everyone it is absolutely a safety on the main order okay I don't want to be the G I don't want to be the the failure of this experiment is someone getting seriously hurts let some other community uh do that and take that challenge okay so I I don't like the whole thing about doing it one year I think when the gen's out of the bottle this it's been out of so my recommendation to this Council first of all I don't see a resolution here tonight resolution we depending on probably resolution again I would say the fact there not a resolution on the agenda published hopeing we're not taking action tonight and public should not what that resolution would look like okay and the majority is going to uh go through this and not listen to your hesitations that you have with safety by all means can you please put some time constraints on it I think one of the points that we made about it being open 10:00 in the morning and closing down you know the school hour that's a terrible thing okay I don't want people moving I would like during the school year that this is not available or open until the evening hours okay so I would like to see some type of restrictions especially for the schools in my bek said I think you really covered some of the this I mean going back to the safety issue I don't want on 130 I think that's scarier um we are walkable downtown we have a bik path we have we have shown that a lot of people walk businesses I think that Highway going back to Russia this Denver's had it Colorado's had it Cali had it they just expanded this year to include more establishments there is a Formula that's been working it has been safe I like that I did that the year we could try this see how it works um the rules have been out for many months now to Cate the rules since last summer um they been available publicly I'm willing to try it I think some of the arguments being made were the same arguments being made for why we should even entered into this initially um and they Haven been proven true so um I don't think we're the first I don't think just because it's new to this state doesn't mean it's new to other states and other states I'm have to mod so I'm will to give a shot you know baring that they have no issues that it's administered properly effectively safely um if you see the just SP you can visited I think at any point we can withdraw the ACT application from the CRC even if it is um so I'm in favor okay um do we want to walk on you know as Mr said a resolution this evening it would only be a letter of support for their application to um the C regulatory commissions that would be what the resolution would be uh could be an add to that that um the bur could work with Jens put restrictions on things such as time Etc um before the before the the lounge would open um how do we want to go about that so I and I this a better question direct how soon would this letter be needed the application's open I believe it's April 2nd I'm not sure if it's a a letter that you originate like you did with our annual renewal I think there's a portal that opens up for the for the towns for the towns to uh go to the portal and I don't know if you upload something or just check a box or I'm not really sure how that particular part works but there is some some format where the the ging body goes onto the crc's website and the firms their support I mean some time I would be supportive of waiting till that's to actually that is okay um who is going to then take the charge to have a discussion with regard to some of the restrictions people might be concerned about I'm not necess I mean Mr Point side I don't think the Russian people are going to show up because we put resolution 2528 on the agenda it's no offense to you but if they were that upset about it they been here um or if they were that supportive of it theyve been here we've talked about this for four successive meetings at this point it's been very so I I you know I have discussion I just think one more having resolution on there no I we may not even have it on April 2 but I I guess so we have signal I just need somebody to work with J to put these potential regulations together that's that's all they could be separate we don't need to include that it's not pending the approval res could just be Endor a letter that we're supportive of the license that's what I anticipate that to be but there is right but we should work on that now and not wait um I I also at the same time if we're going to do that and it's pending that discussion i' like to have that place sure you know otherwise there's no point meting to the next meeting to have the resolution that's what the only point of contention the hours of operation that I mean outside of not approving it that's the BG concern again and so again that's the wheel are going like the opportunity to just make sure that everything there I think is a concern from the safy I I think that the only outstanding piece that we need to consider is the that of operation I think that can be done separately and I think that can the next meeting but if the majority of council is supp moving the resolution to adopt a letter tonight um otherwise I believe um you know the measures that jinen said that they were going to take they put on the record at what meeting was would that have been um I'd like so let's let's wait to sort of have I I want those to be part of the resolution um in an itemized fashion Tom if you're okay with that in terms of the things that you said the measures you were going to take internally I think that the approval from the four individuals that have signal that they would approve uh and supported that that was contingent upon those measures that you would said that you were going to take I just want to itemize those in a way um so that they are in the resolution the Gen going to take those actions could you put that into the ordinance instead of the resolution like amend the ordinance that that already authorizes the consumption no no I some of that is is you know requiring that you are in an ordinance requiring that you're taking certain administrative action to utilize a an app and things of that nature would not be necessarily appropriate in ordinance the resolution recite that um so we'll wait till the next meeting to to move forward with the resolution I'd like to put that in place and I'd like to have that resolution in front of council when they vote on it okay um so anything is there any other reason why we would want to move it tonight other than waiting for the next Mee okay move on the 24th uh Tim and Denise can you get together and work on putting that resolution together based on the items that we put in place represented by gening in December uh and then if a council I don't know who wants to take the lead on trying to identify potential hours of operation of the lounge I I'll you can sort of narrow that focus a little bit see what works for them and then we can try and include that resol good okay thank you councel I appreciate your your consideration both sides of this issue okay uh the next the agenda is the new business approval use fail for mer music yes mer Music Fest this year would be on Saturday September 20th it will be in the Downtown triang parking lot 3 to9 set at 9:00 a.m. crd size anticipated approaching a [Music] thousand similar last year uh could be subject to change if there's poti construction devel in the is [Music] [Music] there field side sign off by okay uh so uh we have an application for approval use commercial music fest signed off by all the relev department heads are you making the motion to move that yes sir first second second second is Mr Woods all in favor thank you uh next Council we have resolutions that are set to be read bya I think I want to remove 25 23 and 25 24 uh for separate consideration um can we move 2525 and 2527 as a consent so second Mr wood with the first Mr with the second that's to move resolution 2525 authorization to purchase 2023 Dodge police vehicle and resolution 2527 authorization to apply for recreation Mr Benjamin yes Mr Fitzgerald Mr MCL yes Mr perno yes Mr yes yes yes should have been noted I'm sorryi to a replacement vehicle for another police vehicle was in a motor vehicle accident we not just buying cars vehicle squs and trees are fine so there [Music] noic okay um I have uh two other resolutions I'll read them each individually resolution 2523 uh this is the council for affordable housing present need resolution by motion [Music] first or [Music] second sharance these are the resolutions that we put together that are to reduce our Co requirement from what was uh set forth in dca's round four from 15 to 4 which is more and more consistent with our partner this is a resolution adopting a different formula that yes that's different than what round four undercover was which of course so right now under our settlement agreement uh our need was somewhere in range of 3 five right under po 4 which is you know the most recent uh calculations um it moved to 15 units uh and this is a separate independent calculation number of communities throughout the state ad methodology from the uh from the local government attorneys that put it that put our number so this is as essentially but we don't get any credit for units that are currently exportable to the town or is perspective this is this is current moving forward not anything that we've done that takes into account four takes into account what we have this is the additional need right how how do they identify what we have now that was question based upon whatever that they usedly [Music] like like 606 has 20 that was my point it has to be formally dedicated yes so we have people in town who are utilizing HUD vouchers and things like that for the apartment units but we're not credited with that because those units are dedicated affordable they're not considered de restricted right so they aren't counting so our senior housing counts because it's de restricted six or some I'm not BR set every single unit and everything six or six is the same way those go towards our requirement under our last settlement agreement our biggest need was large family very low income so you're talking like a three bedroom unit which is not easy to come by in this and all of the alcohol rehab and all of those do not count towards well they count [Music] they and not on your street I'm not sure they been qualified people yeah but I don't know you know I mean when they did this [Music] an okay but my point being that we we might have satisfied some of's obligation because and and that's I think an approv ultimately um and and I don't I mean you know I'm going by our prior interactions with fair share housing on this set of stuff they'll come in talk to us say this is what we wanted to be this is what they're saying it is we'll say this is what's available did you count these things we we've hired an individual to go through and provide a certification the reason why I hesitate on this because I am generally in favor of the affordable housing rules requirements you know I do think it's actually important that every fair share I do think we've done a good job of actually meeting that application and not running away from so that's why I'm trying to understand like where are we at buil out and we're fully buil out it's not like it's not like we're adding anything it's really hard point everyone else to fix the problem yeah but then also knable but also knowing we're built out right I don't think I think we're an outli in this situation by look at it you look at every market right now Philadelphia has the hottest housing market in you know interest rates are high and we know there is what millions of short short homes in this country right now I have a hard time I understand the greater policy need but I in the situation unlike most other in the state me part of this is there's some properties there's a specific property across from six or six real problem and I know that they're putting 4 but the unit the whole project is not de no it's not yeah this almost my mind myself like this probably creates imp for us to do something to actually create that property well I mean look our agreement with fair share housing that required us to identify I think somewhere between three and five additional units was that that was the idea was was the Imp this that we haven't really been able to act on because since that time we've had you know there's really no development in town we haven't really been able to identify a funding source to purchase properties we looked at some properties and without naming specific property there's areas in town that we've identified buildings that we might be able to acquire at a cheaper number right now it's just I mean it would it would be trying to do something like that we would rather work with a partner like S car rehab deep restrict and move um and so that might be something given that relationship we have with them and I'm not sure that that's sort of their normal sort ofo to De restrict something like that it is they can they can they can they can and 607 remains under a Redevelopment area and with with the ability to detain that's what I was thinking I'm thinking almost like yeah I mean I just want to understand what we doing I'm not to sh our responsibility also make we're getting credit for what has happened in town so I think sometimes we don't get credit for lot and and look with I I agree with you 100% I do think we the burough is unique in the way that we are built out and um in our housing stock and and in the demographics of our community which I think are definitely uh more varied than most communities in South Jersey and certainly in can County and that I think that's what makes us unique and special and I think it's also um I think it also justifies in my mind this resolution saying hey well we we recognize this is a need but this is what our need is here this is what we would adopt this rather for than 15 because I think 15 is an unreasonable expectation for us to be able to identify 15 de units in this community at this point 15 additional yes it also not and in terms of size in terms of type so it's I think that that is a burden that's that's too much for our community that's the that's why I was support moving this um are we under time constraints to move this we are right end what's going to happen after you know the numbers that they they came down with was perspective 15 okay so what's going to happen when we go back with they're probably going to send us toi this res process fav that's mediation process kind of be careful how we write it I am more concerns about the changing the language resolution for that second resolution right the support the amendment of [Music] yeah and I was leing towards [Music] resolution ask Poss hold the resolution to change the well the new fair share housing it's 4 15 is is it when would that need to go into would it would it be within the years 25 that's not trigger if there like instruction okay and that's where Builder remedy can come in and you have all types of issues if you do a plan place don't Place build what they want as long as they're moving towards the obligation but you we not going to here's where they one of our old bigger houses car five six years and and and for Our obligation they can probably that so it would be but I I mean I think this case it has to be a realistic number for what our community can actually sustain above again this is in addition to what it is and so um and that's important to point out it's not we're not just saying hey only need four total affordable housing units in this entire Community it's four additional in the next 10 years that dat is available under Fair Share housing round for rules it'll tell you what they think it is and then this the New Jersey um you know attorneys league league of Municipal attorneys they also have a formula which says or and here's what your units are and here's and basically how it comes down from my recollection I guess the last years have been involed with this year is that certain you know the formula to will only count senior housing is one half of one unit per Bank per need and this will say well it should count for 75 units and and that's where um so I would tend to that 15 is a lot and then without any real major I don't think we built in town the last 15 years I mean coun I can think of one house was three station [Music] [Music] oh yeah houses 056 I mean so 15 just 10 years we 15 and three of those three of those five were built at one time and and back in like 06 oh9 yeah was like so well there was one there anyway we digress how [Music] we wait are we moving both at the same time [Music] 25 just a resolution of support for the methodology that the local government attorneys used okay so but 2523 is is basically going to push us towards mediation yes I have the first and I have a second who made the first Sean and Dan [Music] Dan yes Mr Fitz hi Mr mlo yes Mr perno yes Mr spazza yes Mr wood yes for those of you who are here and watching at home this is a subject of 45 years litigation so the fact that it looks like we don't know what we're talking about here nobody in the state of New Jersey knows what they've been talking about this for the last for my entire life I think this is the third yes yeah absolutely so it's it's difficult you know it it doesn't move that quickly but every time it happens it ends up with just just a lot of litigation a lot of questions suring the methodologies that the second is the supporting the amendment uh of the act as proposed by the government atts local governments that's 254 were you saying your concern with the language of that I just don't support I think [Music] respons the the purpose of that purpose of that ordinance was the methodology that they should was used by was predicated upon the building perm and dividing that by what the need should have been their number of building permits was way off and it came into like 80% so the numbers artificially inflated they used the actual number of the building permits that had been issued against what the number was and they that's where they came in with us having four instead of 15 we also have sh the responsibility for buring me I'm not suggesting we're only taking care of ourselves I think other times because we only have this number compared thousands they div zoning by transfer look I got you I D I do agree with you at the same time I want to sort of preserve our interests here in the bur that's why I would ask for Council to move this resolution we don't need that we don't need this second resolution to go to arbitration no no we do not but it's consistent with position taking the Arbitrage we [Music] have honestly whether we do it or not at this stage and there's also litigation out there there's there's all kinds of things happening in that you know the [Music] world that's correct we don't need to pass it's just this is a resolution that's going pass go to the governor and go to our basically saying we want you to adop this methodology mey Us by to what weit uh next on the agenda is introd intruction of ordinance ordinance 251 C
