discuss this and discussed this and discuss this uh while it's listed as second reading this is really third reading in this so uh I'm ready to vote I'd like to discuss it no I'm good okay so yeah I just want to do um this morning we heard very clearly part of the issue which is that there's a master plan from 2008 that was adopted at mission that residents want they like it it talks about green and passive space it talks about wide boardwalks they saw a gym installed in an area that they did not want it because there was a warrant available they were able to appeal to PAB PAB heard the issue they were supported by a 7 to1 vote it came to commission it want it commission by 32 it was a ballot measure that was introduced now what they didn't realize with the ballot measure is that there's a state law that says a referendum cannot supered municipal code and because there was a lawsuit in between that did not move forward and the gym equipment wasn't able to be open the answer in pz7 is incredibly flawed because it's asking us to eliminate all the warrants for the parks with a few exceptions museums cultural centers some other things but that would mean that anyone in the city of Miami the residents of the city of Miami actually loses those rights to appeal if somebody's putting a pickle ball court if somebody's putting uh a skateboard ramp uh something that the residents are just not in favor of so the solution in pz7 is incredibly flawed because it impacts all of the residents of the city of Miami and in fact people leaving here today would leave with less rights than they did coming here this morning that's not what we want to do as a commission I listened to the public comments and I spoke to our City attorney about that losing of Rights uh Mr City attorney could you respond to that please yes Madam chair and um I'll probably need assistance from the planning director but um some of the the discourse today talked about um losing one's civil rights for a park and I just wanted to sort of calm that down a little bit all you basically you just have to look at the legislation what does the legislation do um the legislation removes the requirement for recreational facilities to have a warrant so what that means is it's a change that if you're building a park in the city of Miami and you want to put a swing set in you will no longer need a warrant um and whatever recreational facility is defined in Mii 21 that's what it applies to now the other change is community facility previously that required a warrant um now a warrant would not be required for a community facility imagine a building that is built where you know people gather to play dominoes or something like that um you wouldn't need a warrant for that however if you wanted to turn that building into a library or into a museum then you would still need need to get a warrant um and that's it that's all it does um and so um the public will still have say there are potentially other opportunities for permits approvals variances Etc that depending on what type of Park one is building they would have to go to the planning department and and and get that information but this does not divest the public of any and all say regarding parks and and quite honestly this is not really just about the gym equipment in museum Park this is a more broader issue in relation to the ability of the administration to build parks and improve parks in a timely manner yeah and Madam chair if I may um you know oh one one last thing I wanted to mention the there was also a comment where somebody indicated that this would eliminate Parks turn Parks over into commercial property and remember this commission was very very keen on preserving parks by adopting the non net loss which basically says if you take away Park property you'll have to replace it with more Park property so if you convert something from a park into a commercial use then you would have to do create find another park space equal to that that property right um in the the warrant process today is simply a it's a conditional use permit right it's a conditional use permit it's not a mechanism for outreach uh or does it require Outreach to be done um the warrant does have an appeal process so that in the event that uh someone wants that you know doesn't feel uh that the equipment or whatever is necessary they can appeal it and go through this process but the warrant today does not have an Outreach quote unquote Outreach process in place it's simply there for a conditional use permit uh Mr City attorney both of you actually this case kind of proves the need to keep the warrants because you have a park which does not fall into city parks so the regular standard Outreach feedback loop that the city might have established didn't apply you had people who felt disenfranchised and they had a mechanism they were able to present for the mechanism they were able to file an appeal they came before us as Commission PAB sided with them unanimously the commission voted in their favor the process worked to to preserve that fail safe for the residents now City may be having very good feedback today but that may change tomorrow and what do the residents do if that feedback loop changes or they have a grievance with a gym or a tennis court or a pickle ball court where do they go it's by right they have no say so while they may have used the wrong language in saying civil rights or something what they meant was their right as a resident as a public resident taxpayer for public space to speak up and be heard also there there was mention of a master plan in 2008 I wasn't here in 2008 so I did not know about a master plan I was advised by staff that there was a Parks master plan in place for from 2023 is there a difference in these Master plans like I I don't know that we are holding on to a master plan from more than 10 years ago when you have one that was in 2023 but I do know that and we don't have Barbie um the city's Parks master plan is created with citizen input correct I because it troubles me that the public comments were saying that we were taking away our residents voice that's troubling to me I meet with my constituents regularly about what's happening in our Parks I in my district we don't make decisions in a vacuum on what is best for our parks and gym equipment which has been my position all along gym equipment is contemplated in the park master plan now can you explain to me if there is a difference between the master plan that was mentioned today in 2008 versus the master plan that was done in 2023 and also after our commission meeting I spoke to a couple of the residents that got up and spoke I had the City attorney speak to them and once we went through this their position changed because they realized that we are not taking away anyone's right to be heard that I would never be in favor of taking away someone's right to be heard I just wouldn't so can you somebody come up and discuss 20 2008 versus 2023 because I I don't want I want the facts I don't want there to be misinformation and again I didn't know about a 20 2008 master plan I wasn't elected then can I respectfully request that before the parks director does that and I think it's important that he does that because I didn't know about the 23 uh until now and the 2008 that they kept talking and talking it was just finally today that I was going to able to get something that's not quite uh what they've been saying and I have been asking for if there was anything in 2008 for some time certainly Bon Park Trust doesn't have a copy of it and let me let me begin because this is important that you hear exactly what's in 2008 not what a very minute minority wants to say and then you could compare it to whatever is in 23 first and foremost uh the corporation out of New York I don't know what we're doing getting a New York firm uh to come to Miami uh since we have very different climates in needs from New York to Miami to come here but the New York firm that was chosen um it was done in February 24 2005 the amounts that were told to us today were quite low what this city paid um the one that wanted this was mayor Diaz at the time and from and correct me I'm wrong Tau but from what you gave me it's a million 58 $3,000 back in 20056 uh $7 which today you're probably looking at somewhere in the neighborhood of maybe $3 million if not more which I don't know where they had their minds at paying this kind of money uh for anything in particularly what I see that we've gotten now let me go back in what was approved you're the record coding of the city of Miami and everything that's approved by the commission here as is given to the commission you keep from then after correct city clerk am I correct that the only thing that you have from the attachments and the exhibits on back in 2008 beginning of 2008 when the city commission um dealt with this item in principle it didn't vote for it per se he said in principle and I'm going to get into what in principle means uh here in a minute but am I correct that the only thing that you had on the record was this one dark picture that's what the commission apparently saw that is what's in the city clerk's repository that is the exhibit um associated with the resolution uh regarding Museum Park this is the custodian of our records the city clerk of the city of Miami and this is the only thing if you could make out you know whatever is here that he hasn't file from the record back in early 2008 and let me see what data it was that this is approved in theory was beginning 08 um bear with me so I could get the uh the next one here this is the minutes of that meeting where it said that the city commission was adopting this resolution approving in principle the master plan March 13th 2008 but this was from back in ' 05 we're looking at something that's about 20 years old the handful of people that were here I doubt if any of them even lived uh in the city of Miami then I'm sure they were in New York or somewhere else uh I know the person that own all the land across the street every last inch of all that land where those big buildings are at today his name is Hank soer he's the one that introduced me to the gentleman that's going to make America great again beginning January 20th a fellon new Yer and he never talked to me about any of these ideas that are coming up now but let me go back to what the Coopers and Robert Robertson partners that did this uh plan whatever it is stated in some of the papers that I think came from planning is that correct that you gave me that you found there the there was a PowerPoint presentation um from I believe 20 7 provided please listen to this because I think this is going to explain a lot they say the design was programmed to accommodate both active and passive they've been telling you up to now that the only thing that was done was for a passive Park a passive Park says here the design was programmed to accommodate both active and passive Recreation with play Fields playgrounds and Native Planting Fields with Ming Pathways I just got this today to look at this is not what we have been told as the Bible Madam chair now no sir I'm speaking now what does in theory means well it means without necessarily committing to all the specifics or details of implementing something now it gets better this gym area is around 3,000 square ft and a Park land that's got taking the museums out of the equation approximately give or take 900,000 Square ft of land however the clerk found these renderings that are not what you're supposed to get for a mil5 83,000 $3 million or more today's dollars and what does this showed me surprise surprise they got a big restaurant in here this is your so-call master plan big restaurant it's got a another big building here what is what do they call it uh will a pavilion a big Pavilion between the land footprint of the big restaurant by the water in the slip and the Pavilion it's around the size of the Paris Museum but maybe this is what we got to do build the restaurant build a pavilion and forget about the 3,000 ft uh gy in there that Tiny Little Gym it gets even better the slip they got all kinds of islands running around and connected in the slip and a small little Highway going from the Miami arena side or the heat side to Fay Park which means we're going to do away with that Waterway then what I find in here that chairwoman I I I'll show this to you because the only thing that this gives me the impression of what it is since there's nothing here that says what it is you know those waves that you find in uh different uh party places in Florida like uh up in Tampa Bush Gardens those waves that come like that and you jump in there or up in Palm Beach uh one of those way places it's what it looks like look at that I don't know maybe it's something else but seems like you got people inside there you got uh other people uh standing like on the side like a beach so I cannot for the life of me to this day believe or understand how individuals have made into a crusade worse than the islamics over there in uh the Middle East and the way they're coming at me and others because of this because we want to put a tiny outdoor gym like some 40 plus parks in the city of Miami and have and what they're trying to avoid and not bring up in any way is that 80% of the people of Miami agreed that they wanted the gym there but of course the question was misleading what we put down was not true and as you said it very elegantly chairwoman at the last meeting what is misleading by the question it was straightforward I should have frankly G out and campaigned for it I didn't not until the night before the election that I was invited to a a TV station that I spoke on it but I should have because they used Mr parter used me to try to get votes against it make it in into a referendum against me like to reply no sir well you can reply when I'm done okay you're not in Rodriguez to he's radio station right now and by the way he's up the air uh by January 6th oh yeah like you don't care that's where you bashed Mr Gava your chairwoman and myself like you don't know bottom line is that they want to talk if they want to talk about Master plant let's talk about whatever was given to the city for a m583 th000 by this New York firm that wanted a big restaurant in the park wanted a huge Pavilion to sell I don't know what wanted what appear was one of those wave things with water with a beach at the end wanted to undo the big slip with all kinds of isol and connections what have you and more stuff that you can't tell what's in there now I think it' be good to find out what 23 said but going back 20 years ago we don't have nearly the population of 20 years ago today in downtown Miami the population exploded in downtown Miami uh the population of Miami exploded 20 years ago Miami was a little over 300,000 we're getting close to half a million people today you cannot tell me that any master plan that is made for whatever is made has to be written in stone forever no matter what change has come to a community or a city the answer to why they didn't want the gym we have a gym in our [Music] building well the two precincts right across the street that cover all the buildings in front of Maurice Ray Park one voted 80% for the gym to stay the other voted around 60% for the gym to stay and thus with a full campaign where Mr parter was asking for contributions uh to the to the a pack that he created to do a campaign and that's with him having recruited the six people that filed the lawsuit and he told them not to worry that he would open up the pack which he did and they would pay the attorney which is how the attorney that's sitting out there for them is getting paid through the pack that Mr Paro has raised the money for so let's stop the hypocrisy here you know the residents of Miami Express themselves we should respect those res a minority a tiny minority this is not Russia this is not China this is not Iran a tiny minority does not dictate to the majority not in our democracy Mr I had asked no I mean he invoked my name I think I should be able to respond right now before we lose track of everything that he's right okay I just want thank you no but I I I get it but I but I before I lose track because otherwise it's not fair you're putting me in a disant no go right ahead go right ahead first of all I would never bash my colleagues I realize that for some people the truth hurts the truth in this case is that residents have been trying to reach you they have been trying to communicate all these things that are coming through our office to you if you had heard them a little bit you would have known about the 20 8 master plan you would have known that Savino Miller did an update to that plan comprehensive that they have read and researched they're not just picking little people in beaches and they didn't just find this now they have diligently done their homework they're not a handful of people they're a community I have you know a petition with 760 people on it they go to the forums they speak out even today it is humiliating denigrating and wrong to treat people this way they don't deserve to be treated this way and that's what they keep coming to us to say and I think we need to listen to them about uh the ballot election yes there was an election uh there when I looked at it uh Precinct 980 ballot lost there were a few where they were tied there were 27,000 people that voted 27 in favor 7,000 against out of two and a half million people so take that for whatever it's worth but the residents deserve to be heard they've been trying for a very long time and I think if commissioner Coro would open his door and listen a little bit and bring people in we wouldn't even be here CH if I could have a quick minute rebutt just a quick rebuttal I've listened to I've listened to every we just have the parks director answer me on the 2008 master plan and the 2023 master plan can I just get an answer for that right um good afternoon Chris Evans Parks and Recreation director um the 2023 master plan um is what we what I have the information on as far as the community engagement we did for the master plan it's more of a global master plan for our entire park system for 154 different Parks uh we got uh public input from about 36,000 uh residents which made it sta statistically valid um uh for what we're trying to accomplish it does mention in different sections of the master plan what different amenities Go in different Parkland it doesn't go par by part we work with all the district offices to to schedule meetings uh to specific Parks commissioner gabella what did you say Chris which part I don't know you want so quick trying to get out of the uh the the light here um um it was statistically valid 36,000 residents uh completed our our master plan from rout the city um it doesn't go into directly into one in one he was just kidding svey statistically valid survey yes uh for the entire city so um it didn't go into to Direction on each individual part we work with the commission offices to discuss those what was the Ser B about or what amenities they would want in each par um what yeah what uh ranked a high priority low priority which different amenities different program is that we need broke it down Citywide and by districts in uh in the master plan thank you pres gentl then I just had a question for him Chris uh yes does your Park master plan the 2023 include Maurice fet Park no no and there was no Outreach ever done to those communities in downtown from the list that I saw all communities throughout the city and you included downtown communities yes sir and where did outdoor gym rank in your high priorities um ex outdoor exercise equipment was for that kind of Park for that kind of Park um outdoor exercise equipment is in uh as a preferred amenity in all of our different types of not in that kind not in the master plan I saw it wasn't listed in the higher priorities at all a mid-level priority was an indoor gym I'm going to page here 139 and then um outdoor Fitness uh medium uh medium priority outdoor Fitness yes okay like yoga classes outside um and because you had an indoor gym there was no outdoor gym that didn't show anywhere and to know that Maurice Frey Park is not even included in the plan significantly changes it and this is what the downtown residents are complaining about that they have not been included in this process the kind of Outreach that you're doing for the parks like morning side Margaret Pace everything those are not being done for B from Park trust and that's what they keep time and time again stressing hold on hold on hold on a second that they were not included and that's not true and we have shown proof that they were included Chris said that the district 2 residents were included included in the contemplation of the master plan you just said that correctly I did and the the only thing I added is the Outdoor Fitness just by national standards includes different types of programming different types of equipment it didn't go um to that level as far as exercise question you include the names of every Park in the city yes sir commissioner Cabella okay so we beaten this horse to death okay uh a lot of us you know I'm I'm tired for for once you know um not of doing my job cuz this is what I signed up for but I'm tired of hearing the same thing over again let's simplify it the way this started out is we had the warn thing okay he out withed you guys like I said before we went to to to to the to the voter he went to the voter and the problem is for me for somebody like me is that you're saying one thing but then there's the the other on the other side you got 80% of the people that said yes we want this this is the main problem for me as at can I address yeah go ahead when you said he outwitted he didn't outwit well he well let me just make the clarification there's a state law that says a referendum can't supersede municipal code and that's why we're here because otherwise the gym equipment would have been open but here's the other thing that here's the other thing that that you guys and people keep saying that they're not being heard to you know you know the way it was expressed to me the warrant system works to people that are around the area the most the ones that are going to be mostly affected right but everybody outside of that 90% of the other people are not going to get a SE those are the only guys that are going to get a se you know that to me you know is is not fair also you know I understand but I don't understand because when you say you know these people are coming and they demand and they well what about the other you know the other the layer outside of that which is 90% of the people that make up you know that layer you know I mean if you eliminate warrants nobody will get to say but here's the thing here's the thing cuz I asked and I got a little bit educated on this the warrant that he's talking about okay we're not going to take you know all warrants away and there are multiple uses that warrants will remain the way it was explained to me is that not right why song that we had this discussion yesterday that there there are there in the in the tens of of uh probably hundreds of that warrants will remain in effect the only thing that will change is that from now on the exercise equipment and the the use of a uh commun Community facility facility Community are the only ones that are not going to be required warrants everything else is still going to require warrants period and the story that that's what I was told is that is that correct that is correct that is correct so this is specific to the warrant for recreation facilities in CS and Community facilities in CS right but that means if it's a tennis court or a pickle ball court it's not just gym it's not just gym equipment it's that's what I'm trying to explain it's not just skateboard ramp it's it's anything in any park in the entire city of Miami right so I there's another piece of this that hasn't really been talked about but there are specific development requirements for our CS so only 25% of that CS space can be built on all right so the rest of the space is reserved for the open space let me let me ask legitimate question let me ask you a legitimate question commissioner depart okay are we talking here that the problem M here because this is what I've even considered why don't we just grandfather the gym over here and then not not do anything in the Warr why we why can't we do it the other way around is there another way you know if if if if legitimately you want to protect the warrants and and he you know I think he had a vote and he got 80% I still remain with that I the problem for me is I I look I was with you in the beginning man you know but but I I'm not going to go against 80% of the people that voted I'm not going to do that whichever way it happened whichever way it happened whether the sky was blue that day or it was you know whatever it ain't going to happen with me I respect the voter that's why when I came to the you know I listen and and when I got to back up my you know my my car I back up my car it happened with me with with with the uh with the uh the retirement thing you know I realized I didn't want that to make noise I had other important stuff to get done from from my district and I backed up my car and I withdrew right okay you guys are locked in Horn okay you're locked you know we've been having this for I don't know how long to the end of time and I think it's today we should draw this to Wi for me I want to get his Ste equipment open and I want to protect take your warrants do it the right way and um we've been in litigation and um while the court has I'm sorry while 80% of the population the voting population has said that the gym equipment should stay the appropriate way to open it is by adopting um pz7 and there's no way to do it without eliminating warrants for the whole city well and mind you that's that sounds terrible there's the only way to open up the gym equipment is by eliminating warrants we're only talking about about two warrants that really are one and a half warrants really because it's the one relating to Recreational Equipment and half of the warrant relating to the community um facilities and the and the other side I'm sorry to interrupt you but real quick the other side is that you are afraid that it gets open and then they go to court right is this correct well that's why spend all kind of money yes oh what let me ask you a question if we if we guaranteed that the that that the warrants were not going to be removed and his equipment is going to be installed would you guys remove the lawsuit and that's it everybody's happy we don't spend any more money we save the money we save the city money because this is costing us money also right on our side to to counter this situation but but commissioner here what the City attorney said all the other warrant process are going to stay with the exception no no I heard that word I got that word and you know what bothers me is they want it both ways how many times until I brought this up today that I just found it today were they saying that there was this master plan we have to follow the master plan but damn it let's follow the master plan right here let's put the restaurant let's put the big huge house that they want in there the Pavilion let's put you know the waving Waters in there let's fill the slip up with islands and walkways and driveways let me you know all of a sudden they stopped talking about that when I brought this up I believe that we have oh the city manager wants to weigh in please I'm sorry I can we just apply for a new warrant M Madam chair and I'll I'll be brief so the pc7 which is the item that we're hearing specifically right now right addresses the issue of whether we remove warrants specifically for those two specific uses philosophically from a staff perspective we think it's warranted not not no pun intendent um but but I think that from a standpoint of public input the problem is you don't govern based on the issue of the gym equipment in Maurice Fay park or not because that's the anomaly right that's not the regular set of circumstances every time we build a park or we rebuild a park we have a considerable amount of public input right we have Community meetings and Community meetings we get a lot of input from the community as it relates to how a particular Park is programmed each and every one of you have experienced that right and so pc7 is about good public policy right of which I think it is I think the concern is we bled Maurice furry park into that discussion and I think that's part of the issue I I I think you know we I certainly stand behind and support a pz7 because it's in a as a general rule it's good public policy I I think the warrant process is cumbersome as it relates to those particular uses and public input is garnered in every Park we build so I I just wanted to kind of point that out because I think sometimes I I don't we get caught in this idea we we've been so focused on the gym equipment the gym equipment the gym equipment which is obviously a significant issue but that's an issue for 89 it's not it's not really an issue of good public policy I I know it's hard for everybody to sort of untangle that a little bit but not for me no I know but but I think sometimes it's difficult I I if we could if we could that's what I'm I'm trying to implore you to do if if we can't get there we can't get there but but I wish we would focus on pz7 on the got an idea take a vot on p7 let's do s and we talk about n let's do that can we just apply for a new warrant hold on hold on hold on and I want to make this point for what the manager just said over in District 5 Legion Park we have tennis courts we have a robust tennis program there were some folks that wanted to put a pickle ball court well my neighbors said no and we didn't put a pickle ball court because you do have as it should be because the ground is not level there's no drainage and that's something that hopefully soon uh we will get uh fixed but even though your master plan says that that's what we should do uh I'll tell you now I I'm not going to go for pickle book courts commissioner Paro Madam chair just to clarify the active is behind the arena and I think he's just working off of Old plans does never this is coming we we the agreement before you today gives us until July of 2026 to figure out where it's coming from the concept is that the amount would be split uh three ways between the city and the two c um but this gives us a year and a half to work out the details of that so this gives us another vote before it's final uh this would no this would be no it's just to find the money and the southeast Overtown now now you got a splitter four-way Al the southeast Overtown Park West CR has committed the Omni C has committed so there isn't that the delta isn't that great cuz we've already committed from the two c okay so the 10.8 is coming from the cras and the city and the city a third a third and a third third third and a third third and third 333 from you 333 from yours probably a little bit more from in there okay no I vote against it I I vote against it on principle until the alipa omnis is established now January February we don't even have a resolution I mean I haven't been built in our area and Camilo's house is not taking people you know why they're not taking people because they can't settle on money it's about money right now so when my officers pick up a homeless they don't have anywhere to take them they don't have anywhere to take him I I spoke to Rodriguez 3 days ago we're just shuffling them around so no you know what lose the $60 million cuz you know what I'm losing a lot more than that my constituents are losing a lot more than that they call me I got a big problem you guys have known it for five or 6 months and we keep delaying and delaying so that's I'm not here to make trouble but I'm here to get things done for my district and things will be done for my district like it is for him like it is for you and like it is for you sir with all due of what you're asking I can do this we can do that no nothing never did you guys ask me once hey I'm curious gabella what is your plan well my my plan was actually half the land mass less than 40% of the landmass originally you do know we cannot speak to you about this without being on you know we can't talk to you we literally cannot talk to you about this unless we're at the commiss at sunshine meetings I'm talking about ma'am I called for Sunshine meetings 4 months ago and nobody wanted to come to my sunshine meeting the sunshine meeting that everybody participated because I did it three times and we put it on the record and we put on email is this true Larry or is this not true I mean that that I asked for sun no no but no no they're asking is it true or is it not true it is it is true it's true okay so I've been trying to resolve this issue but nobody came to the sunshine meeting because it wasn't important maybe to you guys but it was important to me I listen to you guys when it's I agreed to go to it but it was canel it was canel we couldn't do me me and you couldn't do it because we didn't have a quarum but but I have been at this for four or five months okay four or five months I've been at this you know give me a stay certain that we're going to have this done please and I will I will be happy I'm happy to support you and do anything possible anything so through staff when Larry yeah Larry don't give him a date I'm not just to give him a DAT you know you cannot give him a date I'm if you if you guys do the chair if you allow me please commissioner on the record you know I've been meting with you and I've been engaging with you weekly with regards to this situation all the consultant from business player has been hired we you and I have actually exchanged or your staff has exchanged emails about your public meetings I have the Gant chart on the actual date we'll have everything finished all the steps and into the to the s to the County Commission so because it's not just us I I can't pull it up on my phone because of the type of file it is but I will make sure you have it and we have we've already started pulling the internal data you know the police calls all that stuff so we are absolutely in the middle of working it is being done and I think I've given you my personal professional word on this that here's what I'm going to say to you that I'm scared of uh people are sending people over not going to mention names okay and they they continue for three months they've been at this four months continue to ask me what I'm going to do how I'm going to do it you know L and that like like if they're going to like if you're going to get a give a little kid of candy and then you're asking how you're going to chew it when he's going to throw it away and I and I've said to the other and I and I get the feeling but they never go where they should go because Larry you can't make the choice for him right okay I can't make the choice for her he's got to make the choice he's got to get on the negotiating table here like I have and i' I've come forward and said give me this here what about that can you do this can you do that that's called negotiating okay the other side has not come to the table yet and you know this and I I continue to be to to for people to be sent to my office trying to brainwash me trying to tell me oh do this this way but they never show up like I said the last time to the lady I said you know every time you come here you're asking me this that but you never come with anything else you just come to tell me and you've been at it for 24 years I told you you guys have been doing this for 25 years and let me tell you I've had a lot of I've heard a lot of negative okay uh comments and stuff come from these cras for years and years and years okay but they've been at it for 24 years all of a sudden what am I supposed to do here draw a pie from the sky and tell you guys I want to do this this and that without even knowing what kind of money I have this these are the questions that they sent over to talk to me so I feel like on their part it's not serious man okay I'm serious but from their part I feel like they're playing a game here to see that you know the less they can they can do that's that's the way I feel you'll excuse me commissioner that's the way you know that's what's going on do the chair and I and we're going to be transparent I've asked you professionally to stop listening to that noise because all it's serving to do is impede the process that your professional team is working on I have literally worked on every single CRA in the city of Miami and North Miami I've done this six times I know what I'm doing we just have to get through the process I know it doesn't help that you do have people from the outside constantly coming to you and you and I have had this conversation we you know if I could put a shelter around you with regards to this and assure you we're get getting it done but we are getting it done you know what's happened that when they tell me this I I get excited that I think they're going to offer something new and we're told you how we going to f the seed money so guys don't send me guys don't send me anybody else over there to brainwash me to try to get me to think on all the way because it ain't going to happen you know until you guys show up to the negotiating table it ain't going to happen so so you know what Larry I'm going to take your word I promise so so guys you you so you you guys know so when you when you guys make an appointment with pranka tanela or my secretary uh please don't be annoyed when they tell you we don't want to talk to you guys we're not being rude and we're not you know being like that but chair commissioner par so these are absolutely false claims I gave $165,000 to my campaign I don't think it is becoming of a commissioner to question anyone without proof in the public a little bit embarrassing to have a journalist kind of call out a sitting commissioner uh in that way I believe calling other sitting Commissioners lab dogs or that they have been installed by people involved in his lawsuit or by saying that we're here to destroy the city or that we're here to destroy employees is conduct becoming of a commissioner and the worst part in my mind is that he has weaponizing government by introducing this fr1 this is only there as he just used it in the media as just one more way a political narrative against an opponent that he may not agree with and and and I think that's I guess we haven't learned from the $10 million that we're paying but you can't weaponize government in that way we signed an oath which states to my colleagues and to all of those I represent and serve I pledge fairness integrity and civility in all actions taken and all Communications made by me as a public servant I'm not sure Madam chair if this is the right moment or if after but I would like to call for a censure of commissioner caryo in this matter want to say you know this but then you're willing to do bottom line I was never in Spain on vacation I don't know why you're such a fan of sausage in Madrid has nothing to do with me um and it's this idea that by bullying you can just always get your way and get through every department or every single thing you need I'm not afraid of you I'm embarrassed by you and there's a big difference with that you you know you can take a couple of facts and you can spin a delusion a paranoid delusion and start talking about it and making it a reality I have no interest in doing that I'm not attacking I'm not pulling your items from the agenda like you're doing to me not this meeting not the last meeting I'm not going to a building with graffiti in in your district and trying to blow it up to make you look bad I'm not talking about the gang of eight and plumbers giving money to packs and all these other things I'm not trying to defund Omni I'm not trying to hurt any of the staff in your office none of that none of that makes sense to me because at the end of the day we're not serving our residents we're playing political games that serve no one absolutely no one and and I think it's based in very false information so I would like the City attorney and we've talked about this I would like the city clerk I would like Madame chair to come up with guard rails so that we can these things impact our bond rating as a city they impact our image globally they impact whether people even want to work here with us so let's take ownership of this and if we have to stop each other maybe or politely put each other you know uh in in these guard rails I think it's good because otherwise people like me who are trying to abide by a certain code of conduct are handcuffed we put at a disadvantage we can't you know uh give our information the same way so that that would be my my ask and if there are claims against me these claims about pxs and money go report it go to the state attorney go to the commission on ethics go wherever you need to go that's what I would do I wouldn't just sit here and keep making false claims and taking time and making putting residents and and everybody else in a bad shape Madame uh chairman so we could end this he had uh plenty of time so now it's my time and let's close his meeting for today um Mr partu is clearly concerned of things that he's run done but he knows her Ron so he comes with us today pretending that he he's a hurt and offended party that he's such a good guy he's just Mr wonderful and he cuts uh pieces from where he wants to cut them stops goes and whatever he wants to show um with help from a few people that did this for him so that he could pretend that gee you know I'm a victim well comes January uh I want to talk about the gar rails that he's talking about because I stand by what I stated I'm fed up with the hypocrisy he's in a mission uh nonstop against B part trust and to goe me personally it's done stuff the first uh uh video that he had here um we both know who gave it to him that he sent uh to the trust meeting to film that that day uh unfortunately we didn't have the cameras in the trust that we do now who had filmed the other way to see what they were saying and how they were trying to instigate me and the board uh to how they were behaving but uh he is uh no little loss Mary uh is what uh we say in Cuban SL the little cat Maria R throws the Rock and hides the hand so you won't see that he threw the Rock and you have uh all this time to uh think about your guard rails I'm going to bring my guard rails and show everything uh since uh I've been here that you've been trying to do that's underhanded and have crossed the line sir cross the line completely and every meeting that we have here you bring in your campaign group um so that we have to spend another 45 minutes another hour in meetings that we would have to spend otherwise uh that depending on what's Happening Here they could attack any one of us but the no doubt about it every meeting the attacks uh are mainly aimed at me and I hear it I take it um you know whatever little your buddy Little Billy uh says ain't going to Rous me up uh or any of the people that you called up and there is proof that you're doing this and every meeting and this is the kind of weaponizing and warfare that you bring up you can't do it yourself so you got to go behind the scenes to get people to come to get your campaign group and you really think that you're going to get a guy like me to think that because you could bring in 15 20 even 30 people here uh that's go going to make me think that you have everybody that's behind you it's ridiculous we saw this in the 8020 vote you lost by 80% and you still haven't gotten over that and you can't get over the fact that you haven't been able to run me over like you wanted to I have voted in many things uh for your district for you I haven't held anything back uh from your District that I could certainly recall in voting for you but you have gone out of your way to hurt whoever you have to to see how you could come and hurt me so chairwoman he wanted to bring it up he brought his little video up trying to play victim again when we we come back at the next uh commission meeting you will see that he's nowhere near the victim that he tries to play again Madam chair what we do in our office and I'm actually very proud of it is we do a very hard job with engagement we do open forums we do agenda uh reviews before and after I believe in that I'm an activist I've been doing that for 35 years it would go against me not to try to do that we try to engage people Every Which Way whenever we speak to people we tell them please come please speak I know it doesn't feel good I know it doesn't feel like we listen like I'm sure the downtowners felt today uh at no time do we try to manipulate anything or carve anything like that quite the opposite we just think we're doing a very good job with engagement in our forums we can get a few hundred people we're happy and proud that we can do that this is not personal I personally have nothing against you commissioner Cory if you if if if the folks from Bayfront are in my district and they come to be represented we give them a platform that's all we do for them and we want to do that so I'm just you know I'm trying to be very clear on that because I don't want this spun in a way that's like I we all have very little time to be invested trying to do this stuff right so I'm not here trying to figure out how to Target anybody quite the opposite I'm just trying to get as much done in our district and in our city as possible and that's been clear from day one bottom line is that when you say the downtowners you're talking about your campaign downtowners because the majority of downtowners voted in Mass against what you were calling vote against Coro and the g 8020 and that's the bottom line so I respectfully say to you sir put hiding and saying that the downtown residents that the residents because what you have is a very small local minority and you're trying to control a huge majority just like in communist countries um by using a very small vocal minor minority I'll just I'll just leave it at this um I don't think a big majority is 27,000 people out of two and a half but what I wanted to leave it on is more often than not I am not going to jump into the mud fight because I realize when you jump into that mud fight it's all of us and it's our city and so if people see me quietly here never think that I'm agreeing with what's being said what I'm thinking is do I really want to engage in this moment or present my case in an organized way at another time and that's what I've tried to do here today then why do you throw the muder why do you have others throw the mud and me and others here I don't I don't of course you they you know you do on the you've earned it from them so I think we've heard do you would you and I I I think that we can all do better I think we can all do better I think we can all be a bit more civilized to each other and there are times when we are very passionate about serving and protecting our districts um you rarely see me raise my voice and I rais my voice at commissioner gabella and I'm sorry you always raise your voice though sir may proceed um let me finish so the point I'm trying to make is that I do not think that it would be um a waste of time for all of of us to reflect on our conduct and come back next year with a renewed Spirit of service and Congeniality for our colleagues because you are all of you are my colleagues and I respect all of you I love all of you and um these are great times we have been given a tremendous responsibility service is the highest honor it is the highest honor and the only way that we will do our communities well is if we can get along with each other so I would ask that that we make an effort to continue to get along with each other I believe commissioner gabella would like to weigh in yeah so uh got a couple of things I'll be brief you know the the reason I think we get into trouble here number one we don't have time limits I for one when we started out K and I are differences uh you know I I try to be cordial um I I don't like name calling you know you know I don't think I do a not lot of name calling here I might not agree with you but I'm not going to call you you know a name I'm not into that you know I hear what you're saying on the other hand I I hear what he's saying also and I hear what we're all saying in response to that sometimes I over uh you madam chair I don't mean any disrespect but if if if I I think if I'm a gentleman here and sometimes I've listen to you go on for 20 minutes and 25 minutes everybody knows this and some and and and Mr par today you spoke at at length sometimes for 10 minutes you you're right you're a commissioner just like you know people elected you people elected commissioner G and people elected uh you madam chair as they did me and and and so when when you uh interrupted me that I can't talk because you want to set a time limit on me but not on him that's not fair and I'm not going to stand for it and so but but but but I understand what you're hearing and believe me I have tried to be cordial here under the circumstances and I think I have succeeded to to some extent I'm not perfect I have many flaws I apologize for them however to you sir U if I have to jump in the mud or the River or the ocean for my district let it be known that I will to respectfully to with you guys and and and and what you heard me say was and why I got frustrated is because we've been playing a lot of games I think you know for four or five months with this alap SI business okay and just like you were frustrated correctly so Comm with the Jim equipment and and you because you know you're what you believe in and everybody believes in what they believe believe in I'm not going to try to change you you're not going to you know but but the point of the of the matter is we must negotiate you know and my frustration is that nobody has been forthcoming from your team to to to to me only giving me the the the the same story I think it's important I think we should set some guard rails of maybe say hey you know what each of us are going to get 10 minutes okay let's call it that if you're you know and then uh somebody uh when you're done with that and the other person answers you back then maybe we get 5 minutes to for rebuttal and then maybe we can end it that I I'll do whatever you ladies and gentlemen want me to do okay but but please don't call me unil because you know today I'm trying to because I'm I'm I'm upset and I got to take the the opportunity of of telling what's going on in my district I was elected I'm a people I'm on the people's voice in in my district and I was elected to to make my district better okay and this is one of the components and I need done this thing with the communal house I'm not making this up okay we don't have people we don't have beds we can't take them anywhere we're just shuffling around we're wasting police resources okay we're not getting anything done and I'm suffering the consequences my my constituents are in district one okay and and like you commissioner B that you have to hear about it and you commissioner and you ma'am you know I I have to hear about it and I have to do something about it I can't just sit here you know on my knees on my hands and not do anything about it but but but pertaining to the subject that we're at hand I think maybe we should vote on setting ourselves time limits of maybe 10 minutes 12 minutes okay and then I'll rebuttal for five or seven whatever you guys ladies and gentlemen AG agree on and then start from start from from there but but I will try to better myself uh in January I can promise you that that I will come back you know I've done it for some time where commissioner gyo and Mano commissioner Rees got into a TI you know a while back I had nothing to do with with that today you guys got in had nothing to do with that you know what I mean you know I got because it's because he didn't want to find the Clips in you only a me and then cut him at the right time I think you guys should resolve your your issues but but look I believe we have some I'm sorry I'm about to do it again I didn't mean to because of the logistics of the holidays and the deadlines required also because of some events that are occurring that day um I'd like to see if there's any openness to consideration of combining the two January meetings the 9th and the 23rd to the 23rd um for purposes of just efficiency if if you'll entertain that at all that's fine all good so I've got a I can sort of read a resolution real quick to that effect Okay resolution of the Miami city commission combining the January 9 2025 and the January 23 2025 City commission meetings into one meeting to be held on Thursday January 23rd 2025 starting at 9:00 a.m. and moving all items previously set on the January 9 2025 meeting to the January 23 2025 meeting directing the city manager and the city clerk to take any and all actions necessary to ensure that the public is properly noticed of the change in date thank you and at this time I'm going to open the meeting for public comment on that item moving the meeting combining the Godmother of GSA that is the nickname that we have for her but it's been 25 years of dedication 25 years of hard work 25 years of never skipping a beat and actually being the example for all the newbies that come in and with the transitions that happen so you have been a blessing to our constituency and I know that to me you have been more than a blessing so thank you for all that you've and Innovation they host the longest running monthly short film series in Florida created to celebrate local culture diversity and Regional creativity they've demonstrated a strong commitment to education and engagement they have a strong partnership with the frost center with frost Museum and um and they actually do a ton of workshops seminars networking events and they have a youth filmmaker summer boot camp they've contributed very significantly to the city's cultural and economic growth and for that reason we would like to recognize dilana Alexander and filmgate on behalf of the mayor all of our colleagues and I want to make sure you have the you want to say a few words um I really appreciate you commissioner Paro and the City of Miami for supporting film art and Technology we know it's the soul of the city and we're future proofing our youth um so that's really really important um thank you so much for your honor sure I had the I served as a juror on one of their festivals so it was it was really a lot of fun thank [Applause] you next I'd like next I'd like to recognize Marco Ma and First Take youth film program come on [Applause] up just to say a few words after I get my glasses [Laughter] on Marco Maul founded the first take youth film program providing a safe and supportive environment in which youth can learn the fundamentals of Film Production while fostering collaboration discipline self-con confidence and form working relationships with industry professionals they have taught 500 students over 10 years and they reside in Overtown in the dorsy Memorial Library which is was a renovation by omnicc they plan to expand to Liberty City Little Haiti and other parts of South Florida Miami day and Broward they've created opportunities for underrepresented youth hands-on experience with state-of-the-art to technology and they provide young people from diverse backgrounds the tools and mentorship needed to succeed they've made a profound and lasting impact on the lives of young adults in Miami and they are a vital part of Miami's cultural landscape with that Marco I will say I will say these students are as good as any professional they've done work for us they continue to do work for us so I highly recommend this program and and this group I mean they do amazing work thank you thank you thank you thank you we appreciate thank you to chairwoman you know Paro and all the other delegates that help us and the mayor and a lot of people have helped us you know create this program um Kean Hardman you know he helped a lot from the very beginning and you know I think it is a very important program we have helped a lot of kids and I and I thank the community you know for continuing to support us and then help the students because some students you know they just need a little guidance and we're just doing our little part you know what I'm saying me and my partner blah just trying to you know do our little part to make it little you know a little better you know thank you this Marco Maul and the omnic and the southeast Overtown Park westc this is a perfect example of us working together because he serves the children in Overtown and there's no divide in the service he serves the children of Overtown I was was at a groundbreaking yesterday in the Omni C area where commissioner Paro he couldn't make it cuz he had another um obligation but I spoke on his behalf and it it's so refreshing to be able to serve together and so it warms my heart that not only the southeast Overtown Park West CRA is funding Marco Maul's program but also the Omni that's fantastic so congratulations sir thank you thank you chairwoman so on behalf of the mayor and the entire commission we wanted to present the proclamation and want to welcome this morning Spencer Crawley um he is the commissioner for the Florida Inland navigation District um we work very closely with them and they support us financially and with a lot of different technical support in improving the waterways for the city of Miami um they give us money and funding to make sure that all the residents have access to the water um and all the rivers and everything so with that thank you uh Lillian good morning Madam chair uh Commissioners uh all of our staff and City attorneys good morning everyone uh happy holidays it's great to be here right before uh we have a a wonderful time of year and can celebrate um I'm here today as the uh chairman of and the Miami day county commissioner to the Florida Inland navigation District um our district is a independent District of the State of Florida and we manage the intra Coastal Waterway from Jacksonville down to Miami what that means is uh we make sure that this channel this Inland Waterway is navigable so that boats can come down to Florida from up North and spend a lot of money and the people that use the inter Coastal Waterway also spend a lot of money on boating and boating activities which uh helps people who work in our communities and build boats and service boats uh it's a huge economic engine and we're really proud to play an important role in maintaining that um in addition to our work on the intra Coastal however and what's most important I think for City of Miami is we have a grant program where we provide uh grant funding to Waterfront uh Improvement projects like boat ramps and bayw walks and public marinas and all all kinds of uh public Waterfront activities um today and and we do pretty significant grant funding I mean 6 7 8 million do a year to the to the city in Miami County um today we have two grants that although they're small in value uh $20,000 uh each they're very important grants and uh the reason they're important is because these grants are dedicated specifically to the spoil Islands in bis game and they're being used to help fund the trash cleanup of those islands uh all of a lot of you may remember uh back earlier this summer there was uh an initiative unfortunately by the city where the the islands had to be closed uh to Public Access and that's not something that any of us want to see uh certainly our district um we Tred to use our funds uh to increase public access to the waterways so we don't ever want to see uh public property or public uh assets closed uh to the public um we have a annual grant program called the smallscale spoil Island restoration Grant the city can spend $2,000 they can use their own staff time to do it and then we match that with $20,000 so it's a 10 to one uh match it's it's an amazing uh uh Grant opportunity and uh we have three of those every year actually our grant cycle is open so Lillian please please come come back for uh a couple more this year and I've also told uh the city uh Chris and and and City staff if you guys believe that you need more funding to manage the spil islands uh adequately every year so we don't have to close Public Access please let us know we can change our rules and increase the availability of these funds we can do more than three maybe we can do a little more money um so I just want to want to leave you all with that and and and thank the City for for applying these two specific grants are for uh Willis Island which is um at the mouth of the Marine Stadium Basin and then um uh the morning side uh Pace picnic Island so um I'll present these resolution of the Miami city commission with attachments authorizing the city manager to accept a Perpetual sidewalk easement in substantially the attached form from ocpc number 12 900 biscane Boulevard LLC a Delaware limited liability company for the purposes of public pedestrian access to portions of sidewalk constructed on Northeast Second Street Miami Florida that concludes the pocket to everybody Happy New Year I want to speak on on personal experience the the importance of equity and inclusion from a personal experience that that I've had many times living in low-income marginalized Community when we lease Parks or we weaken ordinances we make them weaker it's more of a disadvantage to lowincome community that can afford High attorneys and and a lot of legal fees and you got to keep keep in mind that the people that lease Parks they're usually for the upper income level be very careful when you lease it I want to speak for a personal experience in haia right now our former mayor Robina is trying to lease a park slate park because he owns a charter company called uh Academia the way they word it low-income Community can't match the the attorneys and another example of how important ordinance I know you're trying to weaken the ordinance of the trees that has a disproportion effect on low-income Community because they don't have attorneys to to fight themselves like when you weaken the ordinance on the trees it's not going to affect that much coconut gol or edgear other parts of Miami you're going to afford you're going to affect low-income communities I'm going to give you an example you have on on your board a developer arene who's developing factory town in in haia the only resource we have is a strong orance that the county has for noise the noise is so loud that it's being heard in Miami Springs and and in Brownsville because the county has an ordinance low-income communities like us could defend themselves so if you're thinking about weakening the the the tree the ordinance I know Mr gabella that's your neighborhood and you come from a you're representing a lot of low-income residents that won't be able to defend themselves against these developers you should be the main one that should be against weakening any ordinance because an ordinance gives a little bit of power to those that can't afford High powerered attorneys and like we're bounding right now factory town and the whole developers they have so much money is so hard and if we didn't have the ordinance for the noise the county ordinances we won't be able right now those parties are going down till 6:00 in the morning hopefully they'll be able to shut down at midnight or at 2: a.m. but ordinances help low-income communities keep that in mind thank and F fr5 which I understand was just deferred agree it needs to be withdrawn both of these will have a profoundly negative impact on our quality of life and our environment first giving solid waste the power to eliminate Recycling and Bulky Trash pickup shortsighted and harmful we're already grappling with pollution flooding Rising temperatures these problems require ire action to strengthen our environmental policies not dismantle them decisions that weaken or eliminate recycling send the wrong message about our City's priorities and undermine efforts to reduce waste and protect our natural resources scaling back Bulky Trash pickup leads to problems like illegal dumping littering and further strain on our already very fragile ecosystem we need to see these issues fixed for our Collective benefit not eliminated and I understand that this measure was just deferred but weakening requirements around tree removal deeply concerning I'll move on we're at a Crossroads we need to prioritize fight climate crisis here in South Florida we've been we specialize in green infrastructure for the last 15 years um I was originally here to talk about trees but I learned about the flood mitigation issues and I just wanted to propose some solutions um green infrastructure are practical Solutions and I also want to say that I'm from Little Havana that's where I grew up and I was very pleased to learn of the meora master plan that commissioner coroo signed off on I just want to bring to attention that nature was one of the four pillars that focused on that and little Havana right now um there's about a 30% area that's prone to flood issues and so some of the designs of green infrastructure involve tree canopies involve open spaces biooils and so I'm just here because I've been doing this work since 2014 started as a volunteer we need to be creative we need to think about these hybrid Solutions and look at green infrastructures and amazing things like commissioner Coro has signed off on and commissioner gabella thank you for hosting the town hall on Friday about trees we should not be removing trees we should be working with nature thank you thank you good morning good morning uh you know as I shared with our residents what this ordinance does they were shocked at first when I had this conversation with a group of people they thought I was joking that this can't be right you know why would the Commissioners want to take away the people's voice and do whatever they want with our city parks and the keyword being our as you know PAB denied this unanimously and peap members tend to you know be experts in planning and and I know you take their recommendations seriously they heard this item in its entirety read every line of the ordinance it is simply not a good ordinance to pass as you can see by the overwhelming vote against it I mean the item also states that existing facilities such as museums could be expanded by right no warrant required the people would have zero say look I understand the need for streamlining the process but we need to have checks and balances for our city there needs to be accountability and everybody talks about green space but what is really being done about it you should not be passing this ordinance you're elected to empower the citizens not take away their power thank you thank you good morning hi good morning uh thank you for the time my name is Dave doer I live at 8000 West Drive in North Bay Village um I focus on Marine debris and very specifically most recently uh our waste crisis in Miami Dade County um it is ABS I'm here to speak on fr1 uh and I am concerned about the elimination of recycling programs and the reduction of bulky waste pickups it is Absol absolutely true that Miami city of Miami and Miami day County have a was a waste crisis or incinerator burned down last year and now we're putting our trash on trains to send it to Central Florida and and uh Georgia and this is going to continue to increase costs um Street litter is clogging our storm water systems clogging causing flooding it's happening a lot in your District sir uh as well as in your District chairwoman um litter is entering biscane Bay creating huge uh problems which uh our friend Spencer Crowley is giving the city $220,000 to help mitigate uh our per capita uh Miami residents create 8 pounds of trash and debris which is twice as much as the national average and over four times the worldwide average um and we are talking about where to place an incinerator uh in Dural our friends over there are fighting that they want we don't know where to put a new incinerator right because we're creating too much trash so if we want to solve our waste crisis we really need to focus on reduction and diversion and even with its flaws recycling plays an important role in the solution to reducing the amount of trash and waste that we send to landfills so in order to solve this problem we must focus on zero Waste Solutions how do we reduce how do we divert we need to invest in our infrastructure uh we need to increase Le fees for landfill we haven't increased our Solid Waste fees even though the costs have president of BNA and a resident of uh Edgewater I was reading the ordinance and I I noticed that it was uh voted on October 15th 24th and November 21 um there's a pop saying the that was on the a sener here arguing about the bisc park and the decision was the school to be built there with this ordinance you can change sell the the the the the the lot or do a development which was not what halia which don't really have a whole lot of shade they're not very pleasant to hang out hang out in until dusk comes and we're talking about Recycling and waste pickup which obviously affects high as well there's a lot of trash on the streets at the end of the day these are quality of life issues and we all know and I I don't mean to sound arrogant but let's be honest all of us here in Miami we love the Grove we love Coconut Grove why do we love the Grove when you look to buy a home in the Grove you don't really look that closely at the house you're trying to buy into the neighborhood right you're trying to buy into the trees into the canopy every time we have a hurricane we're spared from massive flooding halia no trees they are not when we have our faithful waste pickup every Friday where they come and pick up the leaves and they regularly pick up the recycling we don't have streets that are littered with trash as we do in halia when you talk about public parks and just kind of greenlighting anything that five people choose to do at any given moment which may not be the people in front of us here today you're pretty much guaranteeing that we won't have the stress and the expense and the hassle of cleaning up under big leafy trees and that serves no one instead of trying to make areas like Coke and a grve and Coral Gables by the way the highest property values in the city look less appealing to buyers why don't we try to make make the rest of the city of Miami look more like the parts of the city of Miami that everyone wants to be in thank you for your time thank Fritz 111 East Flagler Street and executive director of the Flagler District bid I'm here to speak on fr7 special events in 2017 the commercial property owners worked very hard to create chapter 4 section 4.5 Flagler specialty District which we celebrated when the city commission approved it unanimously since then the Flagler business improvement district has championed and celebrated our unique and historic district and despite the pandemic and a challenging streetcape project we've seen an amazing increase in the number and quality of our restaurants and entertainment offerings I hope you've had an opportunity to visit East Flagler Street in recent weeks first the Sunday Flagler market then the DD a holiday Lighting Event and the ongoing Holiday Market at Julian Henry's have transformed Flagler into a familyfriendly day and night destination for the holidays we had an amazing Miami art week last week and the market continues through January 1st so we hope you'll join us uh before New Year's on behalf of the board of the Flagler District bid we wholeheartedly support fr7 and commend you on undertaking to simplify the process for permitting special events however the proposed legislation appears to create an annual Gap or annual cap of four events per location and a reduction of event duration the Flagler Market on the 200 block of East Flagler could use up that allocation in one month where's a commission to consider how these proposed changes might unintentionally affect some of our most vibrant districts in the city of Miami and we request that I live at 218 Southeast 14th Street in Bickle I'm also the CEO of a high technology company that migrated here to Miami in 2018 with the expectation that Miami was a well-run city that had took into consideration not just the economic drives of developers but also the Aesthetics of the city the living arrangements and the people of the city we are currently considering moving because of an incredible decision by uh the county to rezone the rtz rezoning that took place in February and the subsequent a to build a massive building with no setbacks against the zoning of the city of Miami such that uh the Aesthetics the living arrangements the life of residents in brickl and even the safety because structurally as you all are aware of what happened with Surf Side building such a massive structure uh on what is no more than a sidewalk there's this tiny sliver of land in front of our building is dangerous in my view certainly disruptive certainly incredibly ugly and by the way I think Bickle could use some more Parks so if you are thinking of a use of that land I think thinking about a children's park or something uh would be appropriate given the amount of tax money that Northwest F Street in Little Havana um I'm here for many various reasons but one of the the items was the tree ordinance but I'm here to also just generally speaking on a lot of the items here especially trash and litter and waste pickup it live in a neighborhood that's multif family um and different densities I live in a single family home but next to me I have buildings so their pickup is very different as a co-founder of healthy Little Havana we presented to our commissioner and to our Solid Waste Department many years ago we did a policy scan that gave recommendations for City departments um for trash and illegal drump dumping issues supposedly 25 cameras were bought by the city of Miami to crack down on illegal dumping in the neighborhood and as you all know that is the fight for my life there the trash in this neighborhood and in this city is a problem and we have to address it not by cutting back by educating by finding bold actions and different solutions to our our issue right um tree canopy is a problem all over the city I have a better idea of for that park space or or Children's Park let's make a forest let's make a forest in the city right we have great ideas and we need to support we did a $400 million bond to navigate climate parks and that money is going to go back and be wasted no we cannot continue to ask the city taxpayers and the residents of this city to invest in something and then you guys go back on it let's go bold let's go big Miami has it they have the money let's do this please thank you good morning good morning my name is I have to hold this down because I'm very short um my name is Dar Jeff I'm representing my community in Edgewater very pleased and uh honored to be here today um and I'm reminded as I stand in this August chamber before all of you that we don't live in a Banana Republic last I looked and that there is a democratic Pro process and that you all serve at the will of the people um and that not five people will decide to do whatever they want when they want I don't think that's the American way not last I looked and I would certainly urge you to reject the uh pz7 proposition which is undemocratic and outrageous I only heard about it recently and I couldn't even believe it it just didn't even seem possible in Miami and in the US that such a thing would even be considered and are we to believe that if you were to had that such power that you would really do wonderful things for the people that you would make the parks better bigger more of them I don't think so so I would urge you to reject that concept also if it's money that we're after for Miami one of the reasons people move to Miami is because how beautiful it is Parks make it beautiful I don't have to tell you what a park is everybody knows what a park is and what it's for but think about what it looks like when there aren't any think about what that looks like that's important to remember just have that picture in your mind as City with no parts and also um it's very important to remember that there is already a glut in um inventory of co-ops and buildings I don't think we need to give developers even more opportunity to build even more that will eventually be empty let's remember the how important the parks are to the quality of life in Miami thank you very much thank you good morning good morning thank you chairwoman thank you board members um um my name is Edward martos I'm here on behalf of was connections my offices are at 2800 ponon Boulevard Waste Connections is the largest or second largest Solid Waste franchisee for the city and we're here to ask that you defer and and have a workshop with regard to FR fr2 now you all have worked very hard to clean up the streets to make your downtown your commercial corridors vibrant to make sure sidewalks are clear and pleasant and now fr2 is an ordinance that includes this provision Bulky Trash may be placed on the public right of way as is done for non-commercial properties now I don't understand how cleaning the streets can be facilitated by encouraging property own commercial property owners to leave Bulky Trash on the streets this is counterintuitive and I have to say that even if this one provision was stricken from the law the law would not not be workable it won't be workable because the definitions are off you cannot treat commercial Bulky Trash the same as residential and that's what this ordinance does a commercial facility has furniture that they change out imagine a uh a furniture store they've got broken merchandise you are now authorizing them to put their merchandise outside or even an office swapping out their printers now they can put all their printers outside there's also implementation issues uh different trucks are needed for this sort of waste and your current waste franchises don't have those kind of trucks your facilities the commercial facilities may not have containers if your aspiration is that the containers will be used well the facilities don't have those containers now and there's no plan in place to get those new containers they don't have a location not every commercial property has a trash room so they don't have a location to put a container if you wanted it to be containerized commercial properties are picked up okay thank you thank you very much Commissioners just my request is defer it and let us Workshop it the industry has worked with you very closely and we're happy to do that again thank you good morning good morning chairwoman King and thank you to the Board of Commissioners to allow the public to speak on these important issues facing the city I would like to speak on pz7 uh I found about found out about this fairly recently I think it's fairly unconscionable to have uh Parks be open for development Miami does not have a Central Park Miami does not have a Rock Creek we have little bits of uh uncontinuous Parkland of green spaces we do not have enough green spaces as it is we are one of the cities with the highest levels of development of any city in the country even the world I think that there's tons of space for development there's tons of development that's happening now we do not need to open our green spaces and our parks in order to have development in the city we have enough as it is I think these Parks need to be open for the public they need to be spaces that allow uh Beauty to be seen in Miami to to have these pictures of Miami that the world can see of green parks of beautiful spaces that will not happen if it's all great cityscape we should maintain our Parks we should keep them we do not have uh massive Park areas we do not have green spaces as it is and opening it will be a travesty I request that you listen to the public you listen to the citizens of Miami and keep those parks open and do not uh open them to development thank you very much I yield remainder of my time CH may have plan he's talking about but if he's trying to insinuate of a master plan there's never been a master plan you to stick to a master plan that was designed with great detail and the importance of adhering to the master plan those highly paid Consultants previously hired to develop the master plan right here in the Magic City this master plan with this Hills beautiful Hills gorgeous my name is Lori Ferell I live at 1425 Brickle Avenue um here today to address Planning and Zoning 2 and three I served as president of the board of the Perez Art Museum the Miami Art Museum and was involved as far back as Center for Fine Arts I was appointed by the city of Miami mayor at the time manise Diaz to the city of Miami task force for the master planning election for Bicentennial Park I went to Mayor coroo The Honorable mayor coroo at the time we evaluated 19 sites to get this multi-generational site I went met with um mayor Suarez's father heavier Suarez was mayor so I've been through a lot of Mayors mayor Diaz mayor coroo be Suarez and I stand here today to stress the importance of keeping the Robertson plan not changing it I commend the man who spoke earlier this was a CommunityWide here we go again my name is Ruben Sanchez a resident of downtown 234 Northeast Third Street and I want to use my two minutes for the video thank you thousands of citizens in the city of Miami a joint effort between the county and city government to plan the museum footprint to enable 16 Acres of green space on the part on the site Cooper Robertson is a world-renowned master of planner it was a process through the city of Miami task force it would be a great betrayal to the citizens of Miami who came to these charettes thousands of people came to share a multi-generational desire to have the L A Beautiful Park we looked at Central Park Millennium Park and Chicago Museums anchor parks that was basically the bullet points of this site selection which took seven years in7 and 2008 at Great expense to the city taxpayers in award-winning master plan for a future Park was created led by the the design firm of Cooper Robertson in New York this commission approved that master plan on March 13th of 2008 the Park closed for construction in 10 reopened in 13 and 14 while budget cup acts meant that the full master plan was not implemented at the time the park reopened a slim down version of that design was delivered based on the idea that the master plan vision would be finished in the future when funding was available that Master Plan approved in 2008 is still the legally guiding principle that governs development in MAF Park final documents show an area designed for Passive Recreation and unstructured play and that's a key point this is a passive park it it has been since it reopened um nothing in the master plan suggests that an outdoor gym would fit the character of this area there's a rendering of the alternative design there has never been uh any master plan got the master plan for the park right here by the way I know you mentioned earlier Park management completely disregarded the master plan there have been dock Parks buil planted trees wherever the park management felt like it now the gym and who knows what comes next ma' all of this is not in the master plan I got two more minutes for you goad I am May estreno I'm at 9440 Fountain Blue Boulevard I want to give my um this is about pz7 plan that I trusted in when I bought my apartment so this Master Plan cost a lot of money to the city of Miami and now it's just going to waste why even spending money on plans if they're completely disregarded outside city council also stated that there is a 2020 comprehensive neighborhood plan that is not the master plan for this park that is a comprehensive neighborhood plan created by Parks and Recreation Fay Park is not governed by Parks and Recreation it's governed by the Bayfront Park management trust without any regard to the approv parks Master he refuses to use the park specific master plan that was created by professional Park planners that are tax dollars paid for the professional Park planners who actually have the expertise to know what they're doing did not put a gym in Fay Park in their pl we have asked so many times that the master plan by professional Park planners be utilized for Fay Park we have been ignored over and over again a master plan that is in fact already in existence with full construction documents that has already been paid for by the taxpayers the 2008 master plan the 20203 plan which does not specifically address Maurice Fay Park IT addresses most Parks but not Maurice Fay Park because marce spray park is a special use Park under the 2023 plan the only plan that addresses Maurice spray park is a 2008 plan that does not include outdoor gym equipment Mr U Bardo talked about a plan in 2008 well I don't know what plan he's talking about but if he's trying to insinuate of a master plan there's never been a master plan that has been approved by any past commissions of the city uh on foray Park that one thank you I do have Nicole desiderio 900 bis g bay I'll finish it off here the citation for the 2008 City approved the master plan with a $46 million budget and by 2010 the park was ready for construction there no master and I would like to finish there no master and I would like to finish a plan in 20 all right so as you can see there's a big discrepancy here on whether or not there is a master plan for Fay park there is indeed a master plan for that park it was approved by City Commission in 2008 here are the meeting minutes from that meeting re2 a resolution of the Miami city commission accepting and approving in principle the museum Park master plan as prepared by Cooper Robertson four votes for yes commissioner Gonzalez sarov Sanchez and regalato one was absent it is frustrating watching Joe Coro sit here and lie over and over and over again saying that there's no master plan for this park you know there's a master plan for this park yet your ego won't let you admit it because you think you know better than the world-renowned professional Park planners you're not a park planner the approved master plan for Fay Park in fact does not have a gym in it because they wanted to keep it as a passive Park City taxpayers paid a million dollar for this master plan and you refused to use it commissioner King I'm sorry but you tactfully continue to ask the city staff if there's a a gym in the Parks master plan you don't specify for Ray Park and the city staff and the outside Council give the same rehearsed response over and over again the 2023 comprehensive neighborhood plan contemplates a gym one it contemplates two the mcnp is not a master plan for Fay Park it's a generalized guideline created by Parks and Recreations fet Park is not even governed by Parks and Recreation thank you thank you madam chair can please go ahead tell me when I could respond after public comment after this this is every meeting this is organized by commissioner party he know I made that video myself people um absolutely not people that are coming you're lying sir after after public absolutely after public comment please thank you good morning good morning Commissioners um my name is z alus um I live on Northeast Second Avenue and I'm here on behalf of my organization um we count um and on behalf of our members who work um in the construction industry here in South Florida I'm here to say a warm thank you to commissioner um chairwoman Christine King for adding the report that we produced on labor conditions in the construction industry as a discussion item today in the meeting um we surveyed over 300 construction workers this past summer as you all know we've experienced year after year the hottest ever recorded temperatures on record here in Miami the construction workers who we rely on to build our beautiful buildings are housing to rebuild after storms what we found in these surveys are dealing with um extremely difficult um and degraded labor standards every 4 days on the job in Florida a construction worker dies um we're also finding that you know through our survey only 20% of construction work had ever received any kind of training on how to protect themselves from extreme heat um or how to even you know uh conduct first aid in the context of of heat stress while we do know you know that there's been preemption legislation um preventing us from mandating protections we're here because we're eager to collaborate with you all um we're eager to collaborate with Physicians climate experts on Common Sense protections um that can ensure that the workers that are so essential to our economy and our community are emerald at Brickle I'm here to speak about the rezoning issue um and just want to say the the previous person who spoke that was a really nice message have the best construction recruitment company in Miami so you know I appreciate that I'm someone from Miami I work very hard here I tried to do good things for the community and I finally bought my dream apartment you know I I made my research and it's imposs it seemed impossible to me that they would build a building in that little splot of land and that's what they told me that it was blocked by this commission around 3 four years ago right before I bought the apartment because have you guys been there if if you go to the apartment building you put your arm out you will literally you should be it's a little bit exaggerated but you will be close to the building that they trying to put in there you know it's a very small plot of land so I went crazy I went ahead and even got some offers to to some my building about everybody this my apartment about everybody in my family agrees with me it's impossible that they would build such a big building in that small plot of land so I hope that you take that into consideration it's crazy from my understanding they put this last second just this specific building the one at the intersection of 14th Street and Brickle Bay Drive in that um in that rtz thing that they do but it's not even going to do anything for that building you it's supposed to help ease homelessness it's supposed to help bring prices down but it's not going to do that you know it's only going to ruin what a lot of hardworking people like myself work so hard for and it's not going to do anything it's just going to make things more expensive in addition you know with my family we've been working so hard we've bought a property we went to the city before we bought it and we told them that we wanted to make sustainable housing they told us that we could do everything you know for for people who cannot afford these high prices and then after we bought it we went back and they told us that you know that we could actually not do what we wanted you know and that they told us that we could do it but that they were going to block it at some point and that just one minute away from there there's all these big developers that are building and they don't follow the rules but us the little people the P price of the dangers of power taking more power for itself and from leaving power unchecked and from uh disenfranchising the people from being able to have a voice in the decisions that our elected officials make if the Commissioners are all given the power to make unilateral sweeping changes to the parks without input from the people we all know what will happen to those parks and we know that it will not be long before the parks are gone at a time when Miami is one of the most desirable places to live and we all want to make Miami one of the best cities if not the best city in America to take away our public parks would be to take this city in the wrong direction we know that Parks make a great City it creates all of the benefits that you all know and it is not American to give a few people the power to unilaterally make changes without the input of the people we need our Parks we know that you also want to do what is best for our city and I know that you know that it is not best to give this power to a few people when we don't know who these people who these elected officials might be in the future I urge you to oppose pz7 and to listen to us here today thank you so much walking around art basil admiring art but you know what else is beautiful trees green spaces and watching a community come together in a park and our children having a place to play our dogs having you know a small area to run in on or off leash um yet the Commissioners are considering granting themselves unchecked Authority uh with this proposal to alter areas like our parks and and uh repurpose them um without our input uh the other thing that I wanted to bring up was proposal F1 uh this threatens to disrupt a Cornerstone of our City's functionality reliable trash and recycling pickup as you know Miami has a lot of visitors probably around thousands or 10,000 of them during Art Basel um not having timely pickup could lead to unhygienic conditions road and Roach infestations you know um and this is going to be detrimental to our environment to our health and to our city um real reliable Waste Management isn't just a convenience it's a necessity um not normally a public speaker this may me nervous but I felt these two issues have to be addressed and uh thank you for your time thank you good morning good morning uh thank you for having me here uh I just wanted to say I am severely opposed to pz7 uh if you visit cities like New York and Chicago and many other great cities around this country you notice that the public parks are really blossoming and showing those cities in the best light possible we really do need more Parks more attention to those parks and I think a lot of that uh comes from the community involvement we know best what serves our community we want to have a voice we want to make sure that the best things are done with that so I'd really urge you to rethink pz7 take it back and really give the power back to all the people so that we can actually contribute to our communities and make it much more livable uh and provide uh green spaces that will really serve everybody in this uh City uh the other one is uh fr7 uh sorry uh fr1 let's make sure that we pick up trash it really does serve the community better it makes it a better livable uh Place uh better hygiene and so on let's not go down that path and and and really let's focus years are going to be eliminated now on fr1 fr2 Bulky Trash we're going to go from weekly which is the standard Norm especially where I live in the Grove which is necessary to now maybe a couple of times a month and eliminate the recycling program pz7 we're going to take away the ability for residents to have any input on what happens in public parks it's hard to feel like there is not a war on residents with this elimination of services just because of concerns about misuse or mismanagement or inefficiency well when the city weaponized code enforcement which cost us tens of millions of dollars are we going to eliminate code enforcement I don't think so when there's mismanagement around tax collection are we going to eliminate the tax collection department of the city I don't think so I think there is a way to do some of these things reform make more efficient without eliminating commissioner gabella also I wish he was here he's to be commended for initiating a process of conversation and dialogue around the tree ordinance question he's concerned about permitting permitting is a mess he's not wrong but a byproduct of Permitting reform through this tree ordinance is to homeowners which are the ones that call me on a Bono basis understand what the regulations are and to match up the County ordinance with the city ordinance to just bring fairness to City of Miami of these rezoning it's a little alarming um the the concern that I have is you know we are at a crossroads right now and I really honestly do not envy any of you because a lot of really serious decisions need to be made that will affect our city forever this is going to be historical we're at a Crossroads of growth that's necessary for Workforce housing and climate change and I can tell you that climate change is going to not win if we keep going down the road that we're on very very concerned I really feel that we need to find nature-based solutions to a lot of these items we need to grow but we need to have Smart growth with infrastructure like all of the major cities of the world if we build it they will come no they won't not if there's like excessive heat that exed six months out of the year not if there's permanent hurricane season and you know crazy rain events and flooding nobody's going to want to be here and you would have in essence killed the city so that's really all I had to say sorry I'm so dramatic one last thing I want to mention that's nothing to do with this but when I called yesterday and I do want to go on record on this somebody told me that I could in the litigation regarding the referendum that occurred over the gym equipment at Fay Park um Madame chairwoman Mr Vice chairman commissioner Paro um and to the two absent Commissioners I I hope they're okay I saw commissioner gabella step away I hope everyone's doing okay and of course commissioner Reay has wishing to come back soon healthy uh a lot of people have stood up in opposition to pz7 um you know I'm here for pz 78 and N people have explained why they think it's bad policy I I agree I'm a lawyer so I focus more on the legal side than the policy side whether it's a good idea or a bad idea is is for the commission and for the citizens to weigh in on my concern with respect to pz7 one that maybe I have not articulated before chapter 163 it's one of the subjects of the litigation which I think we're familiar prohibits referendums in regard to development orders but Section 163 3164 subsections 15 and 16 provide that development permits which are in turn prohibited by that the referendum statute that we have been familiar with prohibits any official action of local government having the effect of Permitting the development of land so for me if pz7 were to pass it actually at least in my opinion would not fix the problem because if I think the commission's been very clear over and over again that the impetus for pz7 is the referendum and if that is the reason why this has passed it would be an official action of government that had the effect of developing land and so for me it's bad policy but also it doesn't solve the legal problem I just wanted members of the deis um my name is Nicole Crooks I reside in historic Overtown and I'm here to speak about pz7 um especially in first and foremost because of this um as I look through the agenda so many things in the agenda are not written in Lay person's terms um and so a lot of times things come up and things are passed without the community even understanding what it means and so that's one of the things that I would like to um Challenge and ask for um the other piece when we talk about the importance of green spaces um we need to understand and in spaces like I live I live in or Overtown and we talk we talk about climate change in Miami being Ground Zero of climate change and and if that is the case um communities like historic Overtown Coconut Grove all of these um spaces um Little Havana are Ground Zero of Ground Zero we need green spaces in historic Overtown we have some of the highest disproportionate rates of respiratory illnesses and diseases not just because the highway and another iteration of the highway has come through and has began to plunder through our community um but first and foremost we need to honor the people we need to come together as community and work through this um elected community members we live together we have to heal together we have to be able to exist in dignity and in a healthy way so thank you thank you good morning good coming out of our prisons and jails and our community if we don't help these particular people groups we we are really doing a disservice to our community there are many women that I see every week that wants to get off the streets that wants to get off drugs that wants to get out of uh crime and stop doing things that they shouldn't do but there's little to no groups that are out there that are actually targeting many and women that are coming out of our prisons and jails there over a thousand people that's coming out of your jails out of uh Miami jails that needs your help there is harly no program that helps them that hel that takes them from the front door to a place of help and security they need your help they can't be here on their own I speak to them every week they uh telling me to continue my fight I have a board I have a organization have a CBO that that's targeting men and women that are coming out of your pris bu and jails that really needs your help that really needs your assistance uh I would love to sat down with any of you to speak of a comprehensive plan how we can help these men and women that are coming out of our prisons and jails thank you God bless thank want to uh study some of the other cities in in the State of Florida that have the same issue the other thing is our incinerators gone we don't have an incinerator so there's all kinds of questions that need to be answered about that before we go out of our way to start just eliminating services and if we do eliminate the services is there going to be a reduction in the tax the taxes that I pay for my garbage pickup because here you're going to take away something so is there going to be a reduction in taxes because of it then the other thing I'm speaking on is pz 13 and 14 which is a project in the Upper East Side also off of Second Avenue and I would like you to support that project it's up for second reading and uh I know because I worked with the commissioner to do the Outreach for that for that and we did a we did a great job doing that so any complaints that are coming up now it's kind of like I don't understand because we had so many public meetings about that um so I just wanted to thank you very much for that and those my only two issues the only thing I have to say to the city manager is that I still want to do those shetes in the Upper East Side because we have so many projects coming online we have Sable Palm we have curly being redone we have Magic City that's still we don't know what's going on there we have the well we don't they haven't done anything so and they're and they've been at this for seven years we also have I'm just saying we also have 79th Street and the the old uh ins build ins building and then of course we also have 82nd Street in that hole that's all owned by one owner so we have a lot of things that are coming online for redevelopment and I really think that we need to uh have the public including your District involved in all um that's the second year that she goes to that school she's a first grader and it's really embarrassing for me to walk my child from the car to a school every day through piles of garbage it's literally piles of garbage I'm in contact with the um city waste management and they send time to time to pick up bulk trash or cards but for a year and almost a half nobody ever swept the street there is broken glass there is um plastic cups you name it there is p uh path holes on a road I just measured it yesterday 2 ft by 6 ft nobody ever patched it I mean it's not that difficult it's basic we discussing here million dollar projects but we don't do Basics and it's it's embarrassing to walk a child that going to speak on in the school about safe our planet project and she walks through the of garbage and I'm ready to work with the city if they need my help in that I actually clean up myself a couple of times basic stuff but I cannot do it on myself I'm asking the city for a help and it should be a bigger program than that because there is couple of more schools in herea the same problem it's not most expensive neighborhood I understand that but basic cleaning could be done couple um businesses um I think we need more than that and sometimes businesses have used our our city services and they use our city Serv Services they always try a wait how to do it so everything that has to do with that with them um assuming more responsibility will be always qu if fight uh the tree trust we need to improve a lot of that and the reason is as a as a as a oh is refer yes sorry but if fr7 um the special permit Street in the sidewalk I just want everybody to remembers about Ultra the same way with fr8 um to do the waiver for the special noises just keep in mind that residents has to James Tores president of the downtown neighbors Alliance on behalf of the DNA I'm here to support and address F an important change to the city code to reaffirm the city's public policy around the noise ordinance we want to thank commissioner Paro for introducing this item as it directly responds to the concerns of last month's issue in which administrative order was done on an event at Watson Island We Believe wholeheartedly that that administrative waiver granted last month was an abuse of the process in which it happened and it occurred because there is nothing in the city code today that clearly identifies an administrative option the proposed ordinance cemented what addresses is section 36.5 in the city code ordinance has an exemption to the city's sponsored events what we're looking for is to close the loophole on that item because it does affect the quality of life throughout the city of Miami on any of the city uh sponsored events that may occur again we support the the ordinance but want to make clear that there should be no loopholes in this Administration should not be given a CA Blanc to create an issue that occurred on Watson Island also we want to address fr7 we understand that the commissioner intent here is to wanting to streamline the ordinance for special events permitting unfortunately there's a few Provisions that should be looked at before this gets approved chairwoman I have a question for you I need to make sure pz7 by warrant not by right did the attorney exclude the billboard scenario out of that can I get a verbal there are no signs there's there's no sign language in that has been removed 100% remov yes it was removed after the last action and the uh agenda reflects it okay so we all know where pz7 I'm just going to go extra times pz7 just want to commend uh also gabella for hosting the town hall this last week thank you commissioner for doing that it's voted very well um I comment came to comment on a couple of things fr1 uh and two on bulk waste I mean you know I I read into the details of this uh I'm going to start sending an invoice for for for all the homework that I'm doing but um operations really is a big issue uh maintenance is a big issue it's coming we're seeing it all across the board we need to have some type of operational maintenance conversation I don't know where we're managing our assets where we have the records and the logs for these things but you know I think that we can't let an operational maintenance issue train wreck the rest of our city so let's try to get on top of that um consider a digital twin model to know where everything lies and and its condition pz7 um involve Community input as much as you can re11 the 67 million for flood mitigation um I remind brings up an opportunity to remind us that uh there's a lot of research that has been done already and and and this is a perfect example to highlight how a a flood mitigation um could be resolved for with natural nature-based solutions and Walter Meyer did a study uh for City of Miami stormwater master plan and sorry I'm going a little over on structural soils and tree plantings and key areas that could equally uh equal to 20 20% of the built environment that could SW us a lot of money in storm water mitigation so uh I want to bring that back up as an example to look at and lastly bc5 and we need one more appointment to violence um we're here today to uh talk about briefly uh an initiative that is a county initiative that's been on the books for a while and uh when the co came in everything kind of went sour but we're here now because we know that there's a lot of shooting and killing going on in our cities so we doing a countywide initiative uh in bringing the operation called operational team curfew and uh we've been meeting with all the municipalities throughout day County and we also have met with the chief of of Mr M uh chief chief of City of Miami Chief we met with him and and his staff as well and we just trying to make this initiative a powerful initiative it's not something to just run kids down anything but it's something to help develop accountability in the household we just trying to stop it from growing if we can get catch it where it starts from we can kind of like it kind of be controlled a little bit so we uh doing a countywide initiative where we want uh the city to be a part of this initiative because we met with other cities and they got the thumbs up on and we just going to have a groundbreaking on it uh probably in February or sometime in February but we need to be able to uh have the city and that give it more power we don't want no City to have a gap because we if everybody is doing it it give it more power throughout the whole day County parents need to be reliable for the kids anyway so this is just a demand we got to shake some things up in order to save life this is what we this is what we're about uh we did initially gave uh I think I initially uh gave a booket to everyone but I do have one another one so uh I'll give it to each one of you guys and and so you can uh re done to the to the honorable chairwoman to the vice chairman and I need to get this out I think the vice chairman will be pleased to hear this and The Honorable Commissioners I owe my past political life to Vice chairman Joe coroo and the coroo family that's trueth the late George dep pontis I got to get that out that's the truth so I owe that to you sir I wanted to also and I'll get right to the point I know the clock is ticking I'm just thrilled that one of our residents or one of our persons in the chamber is a Nobel Peace Prize nominee in the personage of Ron book over the homeless trust I think that is just amazing I told him he's walking with Dr King now so that's good stuff now let me get to the point when I served about 14 years ago as a city of Miami District 5 commission there was a plethora of crimes being perpetrated against the youth because they were hanging out late they were caught out at we wee hours of the night and so we implemented the teen curfew for District 5 um that in fact the records will will reflect that it reduced the crime that was being perpetrated against the young people uh it was so effective that the rest of the city adopted the team curfew this this team curfew has been ACLU tested and tried and tested and proven where there were no legal there were no illegal uh rules and regulations when we implemented it so it's soundproof uh it is not designed as you could imagine to perpetrate tra uh criminal records against uh children particularly brown and black children which comprise a great deal of District 5 but we want the city to you to consider implementing or reimplementing this uh City team curfew which will be tied together with the Cy uh uh unveiling of this we believe it's effective and I believe of in the old model is better to have it and not need it than to need it and not have it but we actually have it it's on your books uh in the fall of 2010 and you can do the research and it will show that it was a deterrent and it did cause a decrease in the crimes being perpetrated against our young people so I would plead for your consideration honorable chair lady and Commissioners thank you so much thank you and at this time do we have any of the consent agenda items that you is a mitigation of a property located at 2923 Northeast 2 Avenue respondent is 2930 Northeast Second LLC the violation in question is CE 2021 0231 123 the violations are for non-compliance with temporary vent permit permits non-compliance with temporary occupancy permit and temporary use permit failure to have BTR failure to comply with food truck requirements construction work without permits and failure to register vacant lot is that all yes sir for this case the uh noov was issued on November 5th 2021 adjudicated on March 3rd 2022 violation ran for 614 days complied on November 8th 202 three acre a total of $377,000 respondent according to my uh information the offer is of 15,350 which makes it a 5% offer good morning Ethan werman with Greenberg Char here on behalf of the property owner the property owner is not the original violator this was a food truck tenant uh in 2122 after the tenant was evicted or ejected from the property our client took possession and immediately proceeded to cure the violation um this was removing tents removing pavers we needed an after Thea demo permit so from the time my client took possession it was about three or four months working through the city after the fact permit process we were able to come into compliance and that violator is not on our property commissioner parto I believe this is your District yeah we had several conversations about it and you said you're comfortable with that range yes sir so I'm good with it what's the range it's it's 5% of the total acur amount 15,350 and and uh for the benefit of the uh commission one of the things we have to take the nature of the violation and also the history and this property does not have a long history of cour violation does not as a matter of fact thank you you're welcome why are we going 5% when traditionally we have gone no less than 10 that's up to the commission r on behalf of uh the city attorney's office I don't think it's um we the city going 5% I think that's the offer that's come from them um the code director didn't have an objection I believe in this particular case under those facts they could not comply it until they removed the tenant once that tenant was removed they did P pull all the permits and spend all of that time time to get it um back into um compliance so that was the reason why it took as long as it did but again it's purely up to this commission as to uh what you wish to um offer I should see that there's a tremendous amount of violations and somebody was making money the landlord was making money on the tenant the tenant was making money on the business and the city was getting the short end of the stick and even at 10% which is the lowest we go at it's really a a very low amount uh of the overall um leans that the city's collecting back again I would just State again for the record that my client was not the Violator the tenant actually stopped paying rent for about a year that's when the eviction proceedings began um and as soon as we came into possession we we came into compliance so we were a good faith actor we we did what we needed to do to come into compliance uh we were not the tenant we did not operate the food truck illegally the tenant did and we took action to get them off and it took you a whole year to get him out the property yes yes it took a while I understand there was a little bit of diff I wasn't the litigator but I was told it it wasn't easy to evict people at that time um and when we did get them out again it was about 3 four month two months to get the property cleared and then we had to get after the fact permitting have you verified that what he's saying what I did prepare uh in research in preparation is that the violation ran for us many days uh they had to take the tenants out and number two how many days do you have that he ran 614 more than a year close to two years yes sir little under now what when I did run the property itself there were only three other complaints so I say that as a point of reference right because I come before you and I often tell you this property has had 22 complaints and here are the violations right so in this one I want to provide you kind of a comprehensive picture yes all these violations took place yes it took nearly two years relative to that um that the property did not have lots of complaints had any complaints uh since then no sir commissioner Paro I'm comfortable with staff recommendation at 5% have a motion motion second for for the record staff did not recommend staff said this is what this is what they're offering I also had ready just in case there was questions you know for the record we had a lot of conversation and they're good with it I'm good with it I have a motion in a
