uh the application this evening and we have one application on the agenda tonight it is pb1 12623 Costco Wholesale Corporation it's a it's a application for both a preliminary and a uh Council here good evening everyone am I loud enough no fine um good evening everybody uh my name is Jennifer maway I'm a partner with the law firm of K&L Gates located in Newark New Jersey and we're here this evening on behalf of Co Costco Wholesale Corporation um the site in question is Loc loated at 10 Costco drive also known as block 79 lot 20.1 it is in the L1 light industrial district where wholesale distribution facilities are permitted on the property currently there are two existing Warehouse buildings um a larger building that includes dry storage and cross stck and then a smaller cold storage building um we're here this evening to request an approximate 2,240 ft addition to the cold storage building um and the purpose of the uh um of the application is to in add a mechanical room expansion that will um allow for a sustainability initiative by Costco um this addition if approved will house three new chillers which are environmentally um which are an environmental upgrade from the chillers that are there today and once installed the existing CH will be decommissioned um in in um in preparing for this evening's hearing um we note that we have one variance that we are requesting of the board it is a parking variance um currently on the site there are 859 parking spaces uh the ordinance would require 1,618 parking spaces we're requesting to maintain the current condition 859 parking spaces uh in addition there are two existing uh non-conforming conditions that are at the site that are not being impacted by the addition but they are there so uh our engineer will testify to that um with regard to public notice of tonight's hearing notice of our hearing was published in the January 12th 2024 edition of the home News Tribune and was mailed on January 11th 2024 to all persons entitled to notice uh our proof of publication and service has been shared with the board secretary in advance of this evening's hearing um you'll hear from three Witnesses this evening on behalf of Costco we have um Eric bran who's Costco's director of real estate development um and he'll talk a little bit more about the reason why we're requesting the um uh the approval this evening um and answer any of course answer any questions the board may have our licensed professional engineer is Ed wils with we Malcolm and he'll talk about the current conditions at the property as well as detail the uh proposed addition for the board and finally our architect claudo Breo also with we Malcolm and he'll go over the mat materials and get into a little bit more of the architecture for the uh relatively small Edition that we're requesting this evening um and if with that if the board's prepared I would like to call my first witness please do okay we'd like to call Eric bran truth whole truth spell your full name spell your last name full name is Eric J B ready okay great thank you um Eric could you tell the board your position at Costco I'm director of real estate development uh for the Eastern Division Costco uh which goes the entire East Coast in the united your closer sorry so is that better okay director of real estate development for the Eastern Division of Costco uh we are here tonight uh requesting a small addition to our cold unit uh on the existing Depot here uh in order to remove an R22 refrigerant system that we currently have and replace it with a glycol system that is part of our uh initiative in order to make everything a little Greener and a little safer for the employees the reason we need the addition is we have to add the new units and have them completely ready to go before we can can turn off the old Jans and that that's what the addition will serve and this is going on piece of property that is already paved there will be no increase in any impervious area uh so should be a pretty simple pretty simple task and Eric as a um with this addition will Costco have any additional employees any uh will this result in any additional employees no this is a a non occupiable space that is completely contained by the chillers there will be no new employees and no new deliveries nothing of that nature so operations won't change as a result of this operations will remain exactly the same okay great thank you um I have no other questions for for Mr Brandon thank you um Nathan do you have any questions or comments uh not at this time Mr rool no any questions from I have one question we're not losing any parking spaces right you had 859 before and stays the same correct and you're not taking on any additional employees that is correct your theory being that it's not going to affect the parking and anyway it will not affect the parking in anyway thank you if I I was going to bring this up later and during the engineering report uh Mark you had uh on page five of your report uh you said that the total number of parking spaces are 1,18 in your report that came with this sorry I believe that's CME report that's the CME report yeah okay um well they're talking about 859 there's since there's a discrepancy of like uh 250 I was yes I was gonna wait for the uh okay wasn't sure to um yes so that that was something I was going to bring up during the uh Engineers testimony um just to clarify that uh there are two points in the site plans that have two different statements there's the cover sheet that has 859 which I believe is the correct number and then there's a place later on the aerial image of the site that has the 1,18 so what we were going to ask the uh engineer to clarify was which one of those is correct we believe it's the 859 but we just want to clarify with the engineers that's correct and that that will be corrected on the the plan okay thank you thank you and if if if it helps Mr Rockman um Eric did we previously appear before the board to request um a parking allocation of 859 spaces for cars at this and that was in 2020 is that correct sometime between 2019 and 2021 it's all a little it started in 2019 and it finished in 2021 that's thank you any other questions to this no fine okay thank you m thank you welcome we'll we'll call Ed wils our professional engineer next I do move the and for the record can you spell your last name yes w i l k e s should I should I give him do you mind you gonna sit or You Gonna Stand I'll Stand suggest we put it on the other side so members of the audience could also see it the member of the audience nice and close s I'll qualify Mr wils first Ed can you share with the board uh your professional background please sure I uh graduated from uh TCNJ uh with Bachelor of Science and civil engineering I've been a professional engineer in the state of New Jersey since 2011 practiced civil engineering up and down the East Coast for about 17 years these plans are prepared under my direct supervision um and my license is current and have you been have have you uh testified before as an expert witness before planning boards in New Jersey I have thank you thank you credentials accepted thank you thank you okay Ed can you talk a little bit about the current conditions at the property yeah sure so before me I have an exhibit on Market A1 A1 um that is an existing uh aerial of the current conditions of the site I believe the aial is from January of of like a couple weeks ago because as I'll get to in a couple minutes we had a little discrepancy on how many spaces were out there because of what aial imager we had and some recent improvements from the prior application um that's dat today so as as was already discussed uh this this site itself is uh located in the northwest corner of the township uh in the light industrial district uh but to familiarize yourselves with the with the surroundings here to the north and uh to the east on the plan there uh that's the burough of Jamesburg and residential uh a residential area uh to the South there is uh the Conrail RightWay and then to the West are industrial other industrial facilities um so it exists on the on the on the site today uh there's actually three structures two large warehouses and uh a a guardhouse uh that total square footage of of building is approximately 1,291 52 Square ft um and then in terms of the car parking and trailer storage uh trailer spaces 859 car spaces and 1,22 trailer spaces um all trucks access from a a right right from Costco Drive uh that's the main entrance where they they go through the guardhouse before ultimately um Distributing around either Warehouse depending on where they're going and employee parking and you know General car parking there's two separate uh driveways from uh posum Hollow Road that they can enter from so there are any questions about the existing conditions before I kind of continue I think go ahead okay so what's what's hard to see on that plan there there is a um kind of a a black dash line that represents where the uh Improvement is occurring if you look on the the southern building there that's the cold storage Warehouse in the North West Corner that's where the expansion is is happening um with that I'll I'll open the next exhibit and uh we can we'll mark this A2 A2 it's got today's date on it what that is is a uh colored rendering of the proposed site plan so it's essentially um the exact same as the site plan that was in the in the uh package or the submission package uh with the exception it's got some color to it so again we are on the northwest corner of the um total storage warehouse and we're proposing to construct a a 2, uh 240 Square ft uh expansion as you heard from Mr Ron that's for mechanical equipment um for the the new Chillers um that area again is going to be full of equipment only um the space that the the old equipment is being being decommissioned from will still have other there so to make a long story short that area that's being decommissioned isn't going to be able to be used for storage isn't going to be able to used um for other operations so there's no ultimately no increase in the amount in the employees or the uh additional warehouse space uh the improvements themselves are about 5,000 square ft a little more than 5,000 square ft and the reason it's it's that large is because ironically that expansion happened to be right over a gas service line and uh a couple drainage lines from the from the roof so naturally we're relocating those around the building um to the north of the of the addition um so that's plan right there are proposed metal stairs that actually go to the roof of the structure um those metal stairs are proposed for maintenance purposes so that the equipment that's on the roof can easily be accessed and then the other item to note that's that's kind of hard to see uh we are proposing two light fixtures um 16 ft High LED uh downward facing dark sky compliant um ultimately we can talk about it a little bit more in detail but there one of the comments in the review letter was to provide some more information to confirm that that meets the township ordinance and the specifications for lighting we're happy to do so um but that those two lighting fixtures are really to provide just lighting around the new expansion area from a bulk uh standards perspective uh um there's not really much changing on the bulk standards however there are uh two existing non-conformances uh the first is that your ordinance has a requirement for a landscape buffer of 100 ft from public rways the existing property and it's been there for a very very long time is is only 50 ft between bom uh Hollow Road and one of the parking areas so that existing area is going to be is going to remain um and the second non-conformance is related to impervious coverage um the the ordinance allows up to 60% the site actually has 65% of uh impervious coverage now our improvements are not in an area near the the landscape buffer and obviously I think it we said earlier it's in an area that's currently completely paved so we're not adding any impervious coverage um the one item that is changing from a numerical standpoint is the building coverage obviously we're adding um square footage however the number 16.2% isn't actually changing it's still going to be 16.2% and that's because 2,240 ft is negligible when you're talking about almost 1.3 million square F feet um and then the last item I guess I wanted to touch on was the variant request and that is for um for for parking as was discussed a little bit earlier we had previously received the variance uh to allow 859 spaces on the on on the property whereas the ordinance required um 1,618 that's based off of one space per 5,000 square feet um ultimately since we are adding square footage we have to we per code should be adding another half of parking space give or take um because what was alluded to earlier from Mr Bron is we're not adding employees we're not changing the operation at all we're not adding the parking space um and then just some cleanup items just so we're all on this we're on the same page here there's no changes proposed on any signage there's no changes to any of the utility service connections to the site there's no changes to the storm Water Management Systems there's no changes to traffic require you expected traffic or circulation um and no changes to landscaping and no new signage as a as for this correct correct no new signage I think that covers it thank you Nathan do you have any questions yes just uh just a couple uh just want to clarify so the number of vehicle parking spaces is 859 and the number of trailer parking spaces tractor trailer parking spaces is 1,22 correct right okay I just wanted to clarify that and then oh and then the existing conditions that you mentioned as far as the impervious coverage and the buffer requirement uh those were previously approved or were those so the impervious coverage was approved as part of the last resolution in 2020 um the landscape buffer did not come up as a requested relief um we can go back in history and look at how long that that's been in oper like that location has been 50 ft from the public RightWay but we had asked the board for obviously or asked the township for any past resolutions to try and confirm that but we weren't able to find anything okay and I yeah I'll I'll just add that when when we requested we got the we have we received the 2017 resolution and the 2020 resolution in neither of those applications was the 50 Foot buffer it wasn't part of the application it also then wasn't mentioned in the resolution so we did not receive the orig wasn't part of what was provided to us with the original approval right which is where we presume that that 50 foot buffer was permitted right and it has clearly been there historically okay thank you uh so I think the two more things just really quickly um so we did note that a second variance uh was needed for the number of tractor trailer spaces you know obviously it's 1022 which is already over the uh uh the number required uh or the maximum committed uh and so because it's a changing condition we did note that as a variance that would need to be approved uh you know just because the gross floor area isn't is increasing by 2240 that that's correct um then uh we would just ask that that variance be added to the to the list so thank you that we would then formally would request that the board um uh approve that variance in addition to the parking variance that I mentioned in my opening statement and then thank you and then just the last question about the lighting um so the lighting will conform with Section 108 1213 of the ordinance okay all right thank you thanks Mr chairman get into my review letter um my review letter is dated January 15 2024 there's a few cleanup items in it do you agree to meet all those comments in the review letter including the outside agencies we do regarding the outside agencies I think there's a like for example a drcc we outside of the drcc Zone I mean as long as there's obviously not ability to not have to go get letters that are non interest you know that was the only and my letter indicates it's as applicable okay okay um environmental what um your letter did request an environmental impact statement um we did not provide one in advance of the hearing um I think we would request a waiver of that requirement uh based on the DI Minimus uh um Improvement or addition and the fact that it the addition is in fact going to be um environmental the reason to do that is for environmental sustainability rather than to actually do something that um would impact negatively the environment well we would request a waiver of that from your from your letter chairman I I don't have any objection to the waiver subject to the environmental commission is listed as the Outside Agency and I you would need to appear before the environmental commission understood um just to reiterate there's um there's no increase in the impervious coverage for the S is that correct this is all on an area of parking lot that was already impervious that's correct thank you no additional traffic due to this addition that's correct thank you and I would just say the the prior variances and waivers if they can all be listed on the plans and shown on the on the final set do that have nothing okay um any questions yes um I think I missed it but where the uh new extension is what is that going to be built on top of it's currently a paved area just uh so there's nothing hidden underneath there like so yes so I'm sorry so there's there's a service there's a gas service line and a uh a roof leader coming from you know conveying storm water we're relocating that around the uh proposed Edition okay I missed that I'm sorry okay thank you any other questions okay great do you have any other witness one more witness we'd like to call claudo sorry claudo breida ex truth your full name and spell your last name Claudio Brea b r da sorry last stand again no b r e d thank you claudo can you give the board the benefit of your professional background sure uh of uh bachelor's degree in architecture for Pratt Institute in New York I've been in the field of architecture for over 21 years now uh licens and register architect here in New Jersey as well as uh several other states here in the East and have you testified before boards before as an expert I have yes thank you thank you credentials accepted thank you and and claudo were you involved in the creation of the architectural plans for this um addition yes I was and can you share with the board um the some the materials and the architectural um I'm just going to walk over few don't this is actually part of the submission that was so this was part of our submission so um if the board wishes us to to mark it we certainly can but okay so we'll mark this as 8 A3 well Markus say A3 okay just to give away the land here on the the the floor plan this is the proposed addition here which is 40 by 56 and again this Edition as noted earlier will house three trailers uh essentially we're mimicking and matching what's directly behind it which is the existing engine room which houses the current chillers that are supporting the entire uh cold storage facility which is directly east of here uh just above is the existing electrical room as well as an enclosed uh fenc in Courtyard fuel that has all the Transformers so essentially this area is really the heartbeat of this cold storage facility um from an architectural perspective this addition is literally going to be mimicking what this part of the building is already um there's two louvers here on the existing uh engine room as well as an overhead door so essentially we're just matching the same exact thing here on the new edition the materials are going to be the same consistent with the existing and our goal is really just to plant in and match the existing colors and textures of the the building um just for context this part of the building here is all uh constructed as of um CMU or concrete masonry unit if you will as noted earlier we also have a new exterior St to go up to the roof um right above the existing engine room there are three large cooling towers that are tied to the the chillers the cooling towers will remain but as requested by Costco they want uh a nicer stair to put it mildly for personnel to access the cooling towers for service so that's the floral plan this is the elevations which were also part of the previous submission uh we'll mark those as A4 here on the west elevation you can see here the addition as I noted earlier essentially we're mimicking the same things it's going to be concrete block just like the existing building behind it we're going to have the same two louvers in the overhead door um to bring in the the actual chillers and Equipment um as I noted there's also the stair here going up to the roof and the the purpose is really to access these three cooling towers are there here you see both on the south and the north elevations of the addition here which is the lower part of the building here we add a little bit more Coles so it pops so everyone can see what the addition is but as I noted the existing building is CMU and we're going to be matching the color this is a a gray tone uh at the base and then a beige tone uh above it and a goal is really just to match the texture and color of the the materials and last but not least also have just the renderings just so you get a better idea what the addition is we'll mark that as A5 so you can see here the propos Edition you can see the existing engine room right behind it which are houses the current chillers and you can see the cooling towers right above it I have no further questions thank you Nathan do you have in yeah just just one at this time um the doors um what is what is the purpose of the doors on the side or the uh the one Overhead Door uh just curious what the purpose of that you talking about the the regular Menor or yeah so I mean if there's multiple could just go over like the talking about this door no I think he's talking about the that door the roll up door the oh the door roll is literally to bring in the trailers okay yeah these these these trailers are massive supporting context they weigh 30,000 pounds so so they're literally going to roll them in yeah all right uh and so that door is most of the time just going to be shut it's not going to be correct used for anyless anything they need to bring a forklift to do any maintenance on them or hoist them for any reason all right understood thank you sure any questions to the board can um sound silly but can you put up A1 and point to where it's going to be uh built addition yeah can you are you able to do that um claudo I'm sorry what was the question where exactly could you show on this where it be built sure it's right there it's tiny compared to the rest of the bill oh okay I could this is the this is the entire cold storage facility and that's the proposed addition for the chillers yeah yeah it it's minuscule compared to the rest of the building having trouble locating needle and a hyack anyone else any further witnesses that concludes our presentation okay I'm going to open up the public if anyone wants to speak and be heard please come forward I do sure my name is Adam Bushman I live at 280 gatzmer Avenue in Jamesburg New Jersey I've lived in the area in Jamesburg for 35 years I moved into there in 1988 I previously lived in Monroe Township for 10 years on 30 Lorry Street off of Spotswood English toown Road I grew up in this area I went to high school here I've always considered myself a a good neighbor during snowstorms I go out and clear the sidewalks for my neighbors their driveways do stuff like that um since 2000 when I served on on the Jamesburg burough Council that's when Costco was first built um we were afraid that there could be flooding problems down in Jamesburg because of the storm water I think the engineer can possibly confirm that approximately 1.3 million square feet of impervious surface could equate after an inch of rain the probably 600,000 gallons of water um it's a large sum of water if you really look at it if you have a chance take a look at the Google Earth and take look at the Retention Ponds that are actually evidenced on there some of them Retention Ponds some of them are um actually just to slow the infiltration of the water but since the Costco warehouse has been built there since 2000 we've been flooded a number of times once in 2005 2011 and again in 2021 which was a little disconcerting because I heard that there was a variance issued in 2020 to allow the increase of Improv surface with without any additional work on the storm water management it seemed to have been said um this was an existing problem it's been known it's been in the paper I've been on news12 in fact I've spoken to the township Council in Jamesburg I've spoken to the council members here in Monroe Township and many times I've been assured that they would contact other Engineers um storm water management in Middle sex County to do a better evaluation of how the waters being handled it's been approximately 24 years now I haven't really seen any major improvements to anything um just a little concerned that nothing's actually being done and I'm not faulting Costco for w to utilize their land I you know I I could appreciate that I myself have a piece of property that I like to utilize to its fullest extent I would just hope that in the sense of being a good neighbor maybe some of the engineers Costco has a fairly substantial Revenue I think I checked for 2022 they made almost $200 billion which is probably greater than what New Jersey even takes in on their budget and taxes if maybe their Engineers or someone could finally just take a cursory look I'm not asking him to pay for anything just take a cursory look and see what possible improvements could be made to the manage of the storm water coming off of there and as a kid growing up in this area I went fishing back in ponds all through Homa all through Monroe all through Jamesburg and probably in the past 100 years in fact along man alop and Brook and a lot of the other waterways I doubt very much other than maybe a few stream cleanups where bottles were picked up and a few erand pieces of trash there has been any concerted effort to actually clean and make sure those waterways are functioning appropriately I myself and my wife can testify to the fact that over this past summer every single day as we're all well aware of there's been aerial flood alerts in this area and I have not slept and always dreading that I'm going to be pumping three or four feet of water out of my basement and again I'm not um faulting the people you know here representing Costco asking to make this addition because it is not increasing the impervious service in any way but I really would like to ask Costco or somebody for once to actually have an engineer look into the problem and is there in 2024 in this day and age are there possible solutions to help mitigate that and on a closing note once before and I don't believe you were representing them they applied for a um variance to increase Warehouse square footage and I remember part of the variance or part of the concession they were going to build a burm to help stop that water however they would through the application it seemed at a later date they resubmitted it and got it through without having to do that burm so again and this wasn't the current people that are presenting here so I can't hold them hold that against them but there's been a little bit of history of some games being played not by particularly these people so just want to go on record saying that and I thank you all for your time thank you anybody that wants to question or respond to that oh fine Council anything you want to add I I would only only say and and Mr Bushman obviously mentioned it we're not increasing imper is part of this application um certainly I I I can do my part try to take Mr bushman's information get it to Folks at Costco and try to make an introduction and I'd be happy to do that thanks so then after the hearing why don't you exchange your I just one more thing please come up I'm sorry again I don't want to cause anybody more work Le trust me no please um but as part of the application I believe they had to or they were supposed to go to certain agencies to get approvals and stuff I'm not saying that you should force them to but it would be nice to maybe address you know middlex storm water management to see again maybe they haven't been doing their due diligence and really looking into these problems either and maybe with a little pressure from both Costco and the planning board that pressure might you know get something too okay thank you Mr bman Council offered to to give you her contact after afterwards so thank you chairman just with regard to Middle sex County they are an outside agency U the applicant is required to go to them to the to the County planning board and that the storm order will be reviewed as part of their review as well thank you anybody else have any questions or comments council do you want to sum up actually I'm going to move um if I may uh and what I had heard so far was actually a positive change with what you're adding however uh you did mention that it had to go before the environmental Commission in our toown and there may be other commission uh County meion would it be more appropriate at this point to just go for preliminary not go for final so that gives them time to be reviewed by our environmental commission but that makes sense to you uh Mr Pres lowest Mr chairman that that's certainly up to the board this however is um you know preliminary and Final on an existing site the site is built out typically we would split it up or this board has has uh uh pulled out and only voted on preliminary on a site that is uh is being developed um or maybe a wooded site um but but in something like this where it's existing it's all built it's a small addition to the site this board you know historic Al has granted preliminary and Final in the same night I guess my only with I'm sorry with the outside agencies being a condition of that approval the outside agent being condition so both would be conditions so they would have to get both our environmental commission and the Outside Agency correct that's correct okay draw my concerns and and I'm going to move to close the uh public portion is there second on that second council do you want to sum up thank you thank you chair um in in in summary uh we believe the the um the application before the board is actually a positive for this site in that we'll be bringing in more environmentally friendly uh chillers taking out those that are um found to be not as safe not as in not as good for the environment there is no increase to operations uh no incre increase to impervious cover no increase um to traffic or employees waste um and so all in all we believe that this is actually a positive for this site um because there are no changes to the operations we believe we've met the we will meet the proofs for H variant for the car parking um and as this board recently permitted the number of tractor trailer spaces that are on the space on the on the site today we also believe we would meet the proof for that variance as well to the extent that uh your planner has indicated we need one so with that I would ask the board to vote favorably we recognized there will be conditions on the uh approval and that will include um approvals from any outside agencies as applicable so your request would be for a preliminary final with the conditions that we've
