Smith pres vice mayor smuckler pres mayor Evan Piper here quum has been established thank you thank you all right and U for the invitation this evening I'd like call upon Rabbi Mario Rajan from Beth Tor Benny Rock campus welcome it would work here we go thank you for the honor Mr Mayor vice mayor Commissioners especially as being one of the residents of North Miami for more than 20 years it's a privilege to be here you know you mentioned the word invocation is true you know in Judaism we use less the invocation we speak more about H prayer we speak more about Torah study so what I will do with your permission I will take 30 seconds to teach something for the talm which is the second most important book in our tradition I think can help us think a little bit about what we envision for our wonderful City H one of the rabbis in the talmud asked the following question when will the Messiah come and one of the rabbis answer says go and ask him what do we ask him yeah you can go and ask him so where is he he's in the gates of the city and I will I recognize him it's very easy you will see a person who is taking care care of the wounds of other people and this is the Messiah so when I see this amazing group of people who are determines policies for our city and touching the life of so many people maybe a right invocation will be to us that we'll never forget that we are here to take care of the wounds of people and we're talking in a time when there is so many wounds in different places not only in the world but residents of our town are being wounded to different family members who are being wounded in different places in this world ER so allow me to include a prayer and a blessing for you and for us our gu and God of our ancestor we ask your blessing for our city for the Commissioners the mayor vice mayor leaders advisor and for all who exercise just and rightful Authority teach them Insight of your Torah that they may administer all Affairs of this city fairly with peace security happiness Prosperity Justice Freedom May forever abide in our midst creator of All Flesh bless all the citizens of this this amazing city of North Miami Beach with your be uh by commissioner Daniela Jean there's also going to be another um added on item here um for Paralyzed Veterans of America's Florida chap and that's being proposed by commissioner shernoff also by commissioner sherov item 15.6 under appointment discussion item entitled The recision repeal of resolution R 2020 2-33 that will be withdrawn from the agenda per the um request of commissioner Smith item 9.3 will be can you hear me there's something wrong because I couldn't hear the previous speaker either so well mayor and commission have you did you were you able to hear do you want me to start all over again yes but there is an issue with the uh speakers it seems like one of the I don't know if the other speaker mic is okay or not but that one was a little muffled with uh certain tones but um we we also have the hand mics available too if if worse comes worse so okay okay so I'll continue forther request of commissioner Smith item 9.3 um entitled to approve the continuing Services agreement task order from Chen more in Associates that will be pulled from the consent agenda to be heard um right before legislation and additional documents have been placed in your respective areas regarding 11.7 for your information and we have an added last item on um an applicant to the economic commission um board that should be on the appointments and I believe that appoint that was placed also in your areas that's for Alan Mackin those are the only um changes that we have to this agenda I see a raised hand from commissioner flon thank you so much Madam clerk uh I'd like to move um up uh the manager's discussion or or report I should say and the attorney's report uh if that's okay with my colleagues move it so where do you want to move it I have no objection to the um we can move it either to the beginning of the uh meeting or after um consent agenda um okay let's uh let's so let's do let's do the presentations and public comment and then we'll do consent agenda we'll do it right after consent agenda thank you so much okay all right Mr Mayor yes under the city attorney's report to ask the two items be added 17.3 um engagement of uh the law firm neighbors Giblin Nickerson to provide um um Services uh to the city um Vivian she was stand in yesterday so we need to get her formally engaged so she can get paid uh and so we' request and she's I presume would continue to do some additional work uh in conjunction with the the city manager and ultimately negotiating the contract with the uh New City attorney uh and then uh 17.4 is I've distributed to you all is the uh resignation letter and a new engagement letter um that uh we've put for you uh so um that we ask for those two items to be added to the agenda under city attorney's report okay got it Madam clerk you got that as well they got the two items on 173 and four yeah okay perfect okay good all right so if we're all set with that then um let's move on with presentations I guess let's do Theiss John commissioner John's gonna commissioner John the presentation for women's month you want to do that up front here or you want to do it from here or what um we can do it from here um or up front whichever matters the most but what I what I wanted to do is honor my colleagues I asked our city clerk to give me a history of all of our women who have led with the city of North Miami Beach and as many of you know leading as a woman leader sometimes have has its unique challenges or opportunities um but as we celebrate women's history month we acknowledge that commissioner Smith is one of the longest serving has the most tenured in the history of the city as a woman as a female commissioner so I think she should be honored and also commissioner um vice mayor smuckler is the only um uh leader of Hispanic descent to ever have led as in our commission as a female commissioner so I think also we're making history as we speak so I wanted to honor them today and acknowledge them for their years of service and also for making history from the history of our great city so we have just a special token from the clerk's office um to honor you two ladies for all the great work that you have done and the years of service that you have provided to this great City and I also may I yes um you know we women we have to encourage each other and commissioner Daniela Jean called with this great idea and I saw only fit for her to also receive of course um recognition for this so one second thank you so much should we like go and get it or huh should we like go up FR yeah maybe when maybe I think we're going to we have one other presentation so if you want we can go up picture a really nice and it matches my address very nice yeah I think you knew I knew I think we should go up front after we do this other presentation and take a picture with all that too so I I think it's funny to have an honor if your mother and father was Hispanic you win an honor and if you live long enough you win an hon you just have to live long enough and of course Danielle is Jean well deserving of what all she does well for the city as well as our clerk I might add okay okay and then I have we have another presentation that we put in as well is there a proclamation or what do we have for that okay so why don't we all go let's all go to in front of the day for this for this presentation and then take those so we can also take pictures with that test test when I'm here 25 years I want another one next you know the guys together a little bit more I don't know if I should be angry want first that time perod to come back come okay okay now we're going to recognize the par Paralyzed Veterans of America month with Veronica Amador executive director of Paralyzed Veterans of America Florida Chapter please come up Veronica you don't want to come up that's not you is she representative of PB so come on up and your [Applause] name no she she was here oh well we're honored to have you please sh and what is your name Maria Maria Maria whereas residing within the boundaries of the great city of North Miami Beach Florida many of our neighbors has served as members of the Armed Forces and in doing so honored our community with exemplary dedication and whereas it is important that we recognize the sacrifices made by our community's veterans who are paralyzed and and whereas PV was chartered by the Circuit Court of the 11th judicial circuit in Miami day County Florida on September 13th 1956 we achieved status as a nonprofit corporation under the authorized statutes of the State of Florida and excuse me whereas Paralyzed Veterans of America Florida Chapter mission is to improve the lives of veterans with a spinal cord injury or dysfunctional scid and other persons with disabilities to achieve maximum health productivity and self-esteem in their daily lives and whereas whereas approximately 750,000 American men women and children have spinal cord impairments and most cases until a cure is found these Americans will spend the rest of their lives using a wheelchair for mobility and battling the obstacles of everyday life it does not matter how the impairment occur occurred only that it was drastically it will drastically change a person's life and lifestyle right in front of you okay it's a long one now therefore we the mayoring commission of the city of North Miami Beach hereby proclaim the month of April 2022 as paraly Veterans of America awareness month we encourage the citizens of North Beach to honor our Paralyzed Veterans because they personify the highest ideals of service to this country sacrifice of self and perseverance and overcoming adversity their stories of hardship and Triumph provide life affirming lessons for all of us I also encourage the people of North May beach to observe and participate in the activities associated with Paralyzed Veterans of America awareness month and reflect upon the sacrifices endured by our community's veterans who are paralyzed there are many local Comm community service organizations particularly those serving our youth that seek involvement in worthy projects and Paralyzed Veterans of America Awareness Month meets and surpasses that standard thank you for your [Applause] service thank you thank you so very much it is an honor to be here and we work of course with our veterans but we also work with a community and I am so glad and honored to be here with you guys thank you thank you thank you very much okay picture time [Music] Spong huh okay and we celebrate all the the women in here and in honor of international women's month it the plaque reads honors commissioner Phyllis s Smith for empowering women everywhere empowered women empowered the world light lighting the path for progress and equality in in the International Community and Beyond March [Applause] 2024 she didn't need to read my name but she did need to read the plaque because where every woman can Empower someone every woman can empower the Next Generation every woman can be the root of the best world we could ever have that's right she said [Applause] it okay let me get let you get in okay so the um next presentation is 5.1 um better bus Network um Mr manager thank you mayor at this time I'd like to call up um our public works department as well as Miami dat County who would be giving the presentation on the better bus Network thank you mayor Commission [Music] T good evening mayor good evening Commissioners um it's a pleasure to roduce the better bus Network Miss Linda Harris good evening mayor good evening Commissioners my name is Linda Morris I'm the chief of service planning uh for the Department of Transportation and public works for Miami day County and I've been managing the the better bus Network um also known as just our new bus Network for the county uh so I'm really here today to give you kind of a brief overview of what's happened in the last few months since we've uh done the implement M ation and uh tell you a little bit more about how we've been working very closely with your staff uh to come up with some recommendations to move forward with for both our service to make things better and also your trolley service which is an integral part of the whole bus Network system so um just to briefly uh go over we did launch the new network last year on November 13th the whole point of the network is to make things better um it was the BS networks we actually had five um High frequent routes to begin with prior to the network um and what that is is a bus that comes by every 15 minutes or less so we had five of those routes before the new network today we have 19 routes across the entire County um so it's a huge increase for accessibility and not just accessibility accessibility to opportunity that's what Mobility gives you um and so with the new network we've actually more than doubled the number of residents across the county um that are near frequent weekday service um we they added a lot of service on Saturdays and we've seen that really result in um a lot more ridership on on our Saturday Service as well um but also that just means that there's more jobs accessible uh within a 45 minute um travel time so about 10,000 more uh jobs on Saturdays and we know that a lot of our shift workers coming out of the pandemic people do work on the weekends uh so this is a really key Improvement there um and then finally just uh about 20,000 more households without cars are nearer frequent service today than they were before so that's just a general overview of why we're trying to do this work it's really about accessibility um across the county in terms of improvements specific to North Miami Beach um what we did there was a route three we improved the service um to essentially a 15-minute all day service on on biscan um we improve the service on route nine U by having again a high frequent service there with uh 10 minute in the Peaks and 15 minute all day um we extended Route 17 into the mall into the 163rd Street mall and again uh increased the frequency there of to every 15 minutes um we also extended uh Route 183 uh to Oobi station to connect to our rail system um and providing a better frequency there of every 20 minutes um those were just kind of highlights of what we uh improved uh for the new network uh but we know that we didn't get everything right uh we absolutely acknowledge that uh and we had some serious concerns within North Mii Beach that uh we actually came out to the community back in uh November uh last year and following up in uh January this year to really hear uh from the community understand what what was going wrong um and just to give you an idea if you haven't heard already um people want to reinstate Route 16 we heard that loudly and clearly um we heard a lot of overcrowding on the route 9 and unreliable schedules um and we heard that people wanted the service restored on Northeast 171st Street so what are we doing about those issues um so immediately after the launch we we acknowledged that there were some areas um that we didn't get right and so Route 16 was was one of those areas that we heard very clearly and we instituted an Uber voucher program so um we allow a subsidy of up to $25 uh for passengers can essentially go to any stop along the old route and get a uber uh subsidize up to $25 anywhere along those routes uh so that's still in effect today we also expanded our Metro connect Zone this is our on demand service so again uh which covers the majority of North May Beach uh so again within that zone you're able to get um hail um a vehicle uh it's not exactly like an Uber it is a shared ride um but the idea is that within 20 minutes of you hailing that vehicle you'll be able to get a ride anywhere within the Zone which again covers um the majority of North M Beach um we also um are looking to or we are making service changes uh in on April 29th this year so it does take us about five months for us to be able to change our fixed drought service um there's various ways of of various processes involved um which ultimately ends up in uh we have a unionized um uh operations so we have to kind of go through a whole long process in order to do the analysis do the scheduling and then work with our um our Union operators to make sure that they bid the work that's changing so that all takes five months so if you kind of go back we had to confirm what was going to be changing in April um back in December last year so these changes are moving ahead and I'm I'm pleased to um let you know that we are going to be rerouting um the route 9A to cover that section on 171st Street which we've heard a lot of concerns about so I know that's going to cover a lot of the the issues we've heard from some folks um and we're also going to be doing a lot of uh schedule improvements uh for routes 3975 135 and 183 uh which should really help with some of the overcrowding we've heard and just provide better reliability for those Services we're also in June looking to launch um a different type of uh again details will be forthcoming but really to hone in on the issues that we've heard about Route 16 so we're looking to launch uh a different sort of service along that section of uh the discontinued route to provide that Mobility for folks who had concerns about that um we are also working very closely with your uh Public Works uh staff who have been a joy to work with um to look at the local trolley service so again I mentioned it really is a network of mobility and key to that is figuring out where the local service can complement the more regional service that the county provides and so we have been working very hard uh with Sam and his team to realign some of the uh routes to um pick up some of some areas where uh we have kind of uh gone away from in terms of the regional network but again really servicing the local needs uh for the local residents so um we're hoping uh to work uh to see that in uh implemented shortly um and I believe that is all I had to discuss but I'm happy to to take any more question any questions Mr Mayor yes thank you thank you so much uh for your presentation um I know that this this tour that you're that you're doing is a painstaking one because you know there's a lot of uh you know feedback from the community um because at the end of the day they're the ones that ride the us they're the ones that get up every morning and have to take the system and sometimes you know uh there is a gap between what we may see from the perspective of uh your your job or an elected official's job and what actually takes place on a day-to-day basis uh although this route does not come through our city but a lot of our residents use it um I've heard a lot of feedback on Route G which if I'm not mistaken either was completely eliminated or at least eliminated in the city of North Miami um so I don't know if that's something that's on your radar uh I know that route 10 was eliminated and that's something that comes through our city has been coming through our city for decades um and so while Bus 9 goes through 12th Avenue um I think um and you have a better handle on this but perhaps a lot of that capacity from 6th Avenue in you know between perhaps um Miami Shores and going into 6th Avenue North Miami all of that is probably now being dumped onto 12av so the people who are used to riding bus 10 on 12av and have a lighter capacity on that bus are now being joined with people who normally ride Bus 9 uh as well and so now you have those buses that are just over capacity which is probably what you're hearing about Bus 9 um I did hear I did watch uh your um uh your response on uh the media recently um one of our residents said that she had to leave her home I think three 3 hours ahead of time in order to make it to work um you know so that's an additional perhaps four hours a day that she's spending um you know because she wants to get to work on time so um there's a lot that needs to be done and I'm glad you're addressing those concerns and hopefully we can uh become that best but the best bus Network cuz I know you said you're we're not the best but we're working on getting there and our trolley you mentioned our trolley can you go a little bit deeper into what you're doing with our Trolley system because last meeting I I I think it was the meeting that we had um last month I stressed the importance of our Trolley system to supplement what's going on with Miami day County Transit as far as that last mile um uh of travel so can you elaborate on that and tell us what you're doing currently and what you would like to do with our uh Charley system thank you sure absolutely thank you um and and maybe I can just also just add on to that that um this is still a work in progress and you know everything that I outlined doesn't stop there um we continue to make improvements we continue to receive feedback um and we have three opportunities each year to make these adjustments to our schedules to our routes and so at every opportunity we're making those adjustments so the next one's going to be July and then November so I just want to make that clear um but as it pertains to your rout so we've been working um to look at um the efficiency of your routes in terms of the ridership um and to make sure that um we can um get the best possible routing um using our kind of talented um Transit planners and some data analysis tools so we've kind of taken some of your data um and uh some of our planners have have essentially proposed some Alternatives which will help improve the efficiency and reliability of a routes uh and so I think it's all four of the routes but um we had five routes um and each one of them had um a proposal to make improvements uh to again help better serve the area um and include um maybe more areas of ridership that you could capture as well um but I want to be clear as well so it really the local trolley service is not mass transit right so the regional network is the mass transit we have large buses that's supposed to carry a lot of people that's our purpose and where the local service comes in is supposed to complement that Ma mass transit to provide that more local service to the residents that need it and so it's never going to be a high ridership service I want to make that clear um it's really providing service for people who um who can't get around who have special requirements um or for for kids who need to get to the local school um but it's not something that the the county provides in terms of that local connectivity that really is something that the local municipality should be providing for residents and and can provide it better in the more appropriate sized vehicle as well thank you okay thank you so much and good to see you again Miss Morris I know the last time I saw you at the Oak Grove um meeting and I think mayor Piper was also there it was a pretty heated um meeting because of the service gaps that you guys have left in North Miami Beach and that are still there um I had the opportunity to meet a resident that lives across from the Spanish Monastery Mr blin who has to cross over the railroad tracks and get to bis Gan because the route was cut um and he has we know we met out there we were out there for hours but his story is like many others because there is a service Gap and so when people have to walk 30 minutes 40 minutes to a bus stop and we're saying that it's going to take us 5 to 6 months to get it right you know you heard from Seniors who said hey I used to get groceries I used to be able to ride the the bus and now those routes are gone and so when we say it's going to take 6 months for us to rectify it you know um I appreciate your calm demeanor but for me it's it's an area of deep concern um you mentioned the the the subsidy as it relates to Uber can you can you speak to that a little bit or lift or sure no it's a specific program with Uber um and so uh there you can go to the website or if you have the app um you can actually call a number as well and I can Sam has the details um and you essentially uh put in your request as long as it's within um where one of the old routes were so again Route 16 in this instance uh anywhere along that route um you would be able to go on the app or call the number and say I'm at this stop I want to go 10 stops further down the line and it will do that um up to a subsidy of $25 and this is repeatedly is there a limit is there is I think you can have 10 rides a day 10 rides a day so usually if you catch a uber the average Uber is $20 sometimes depending on the routes um and I'm assuming that's both ways if someone's going one way and then has to come another way you know they might max out that 10 you know 10 credits within a very short amount of time well 10 10 trips so each trip is subsidized up to $25 each trip okay um what other question did I have if I can just answer as well um so I know Mr blumine very well he's he's spoken to a lot of uh my staff and myself um and the one change that I mentioned um rerouting to 171st Street on 9A route that's happening April 29th uh that is going to solve his issue so he right and in the meantime we spoke about how he has to cross over the railroad track I ended up taking him to work that day at to the mall I felt so bad to just get in my car I'll take you to work because for someone to have to cross thisis Gan and then wherever they're going and potentially get hit by a car you know that's concerning um I think the H was also eliminated was the H route um it was uh change to a different number right so I think you know the full list I sit on the national league of City Advisory board for transportation so that's why I'm so passionate about this but you you haven't really given us a full list of all the routes that have been cut um in North Miami Beach cuz it's kind of undermining what has what the reality is for our residents and individuals in this community that actually use the surface you guys also cut your service to Golden Glades can you speak to that the adjustments to Golden Glades um I'm trying to remember as it pertains to because we we still serve Golden Glades um and you know you do have the uh your local service to Golden Glade so it's the route e uh you also have a route e which does exactly the same as our old Route e did up to to the mall um so maybe that's what you're referring to right but to your point about the supplement so for example in the case of the the route e that we have if you look at our agenda that's that's something that we're actually going be voting on tonight to either keep or or reduce Services um through our trolley so I don't know if you can further emphasize the need for the supplement um because we also have a decision later on tonight that may impact our writers ship as well as it relates to sustainability of this particular service so I would love to hear from you because you didn't mention the um golden glaze in your initial presentation so I kind of want to hear more about uh if you can highlight a little bit more about the the importance of the supplement and I'm Sorry by supplement you mean the local service right you know it's it's it's a key part of the system so as I mentioned before the county really provides the regional Bus Network for mass transit and the local service that the municipalities provide that's funded through you know in part through the county um you know there there is an agreement there's both a financial and an administrative agreement with the county um the financial is through the CIT the administrative is through myself and my team and that's why we work together to make sure that the local network complements the regional Network we want to make sure that we're using uh tax funds you know efficiently um and so it really needs to provide that local service to connect people to where they need to get to so that's why I've been working really hard with with Sam and his team to make sure that the the service is as best as it can be and and you know we are committed to moving forward working together in that way as well the last point I'll make I think commissioner furmon mentioned it um because of the The Cutting of the routes in North Miami Beach there's a lot of overcrowded so sometimes three buses are coming at the same time you mentioned the discrepancy in scheduling can you speak to any updates that you've guys been able to do based on that overcrowding absolutely so I mentioned that there's going to be changes coming April 29th um and so those are going to be schedule changes that will help with a reliability so you won't see those bunching buses back to back um and so you're seeing the overcrowding because of the schedule isn't quite where it needs to be right so you've got three buses in a row for example the first two buses might be really packed but then the last bus is empty so ensuring better scheduling make sure that you're not going to have that overcrowding that you see the last thing I'll say um you know sometimes we dehumanize the transit um experience because all of us mostly if you live in South Florida you have a car and I I want to speak to the advocacy for those residents who don't and while the county is trying to get it right people are you know getting to work late or whatever the the case may be and as you mentioned our responsibility to ensure that these services are running efficiently so I commend you for your work and I want to really ask you to continue to allow North Miami Beach to be where you get it right sooner than later thank you okay anyone else yes thank you so I appreciate so much that you came to the senior meeting last month and spoke to our board and it was very eye Awakening because I will tell you not only did they depend on the bus but they also are at a stage where that's their only Transportation their their licenses are are no longer going to be of use so I really appreciate that and I believe you're coming to speak in front of the luncheon or somebody from your office is coming one one of the months to speak in front of the senior luncheon as well my question is when you reroute three times a year how do you notify the public that the routes have been changed because that's where it was very discour Discerning to a lot of people that they went and there was no bus they had no idea so how are they notified every three uh three times a year when you do change the routes and are do you ever continue to have the input of the public like you did when you went to Oak Grove so that you can adjust it to their needs absolutely thank you for the question so it it was very clear um that one of the areas that we didn't do so great on was Outreach and engagement um and so we definitely learned from that and we're trying to stand up a kind of a new engagement arm of our department uh that's going to be actively going out to the community and um so we're we're standing that kind of piece up but we are continuously taking feedback um from the public um as to how we put out the information um again we're going to be getting um um some ambassadors uh on an ongoing basis to be going out and and talking to people at the bus stops uh we obviously put things on the bus themselves signs on the bus um we're going to be making announcements on the bus as well that changes are coming um obviously there's the social media um aspect of it we do General Media Radio TV um but I think it was clear from that meeting as well that I attended that we need to do more that Grassroots really one-on-one effort um which is very resource intense but clearly just vital to get those messages out there so i' would be happy to come to the senior luncheon unfortunately I won't be able to make it this Friday but another mon I'd be happy to come because I think a large part of it is something we call Travel training right just telling people how to get from A to B on their Journey um because every journey is unique and so you really need to have that one-on-one conversation to to let them know oh you've got this option you've now got a a Metro connect um you can this is how you use it or you can use this bus at this time so it's really important to have those conversations for those specific communities that really need that attention you know one of the things that Danielle John had mentioned about Crossing missc Boulevard one of the women she had to take the one bus to the trolley to take the trolley to get to the city bus to get to aventur mall which is around the corner I mean it was three different transportations and sitting in the Heat or sitting in the rain or the buses are delayed so I think um people call me all the time complaining about what it costs for City to spend money for transportation but I don't think today you could be a municipality without having public transportation and I sat on Dade County Board of Transportation so the importance of this is time consuming but to get it right but it is very important and vital to a community thank you for being here thank you any other um questions commission I have an additional question just just for clarity um thank you Mr Mayor the voucher that you are referencing the credits are they on specific routes or is that any route up to 10 stops it it's specific routes that were discontinued um and so I can forward you the the list I don't have it to mind but I I'll forward you that information okay because none of these routes are in North Miami well well you have here discontinued section old Route 16 79th Street to 163rd um no I'm saying well 79 to 163rd so that includes some parts of North Miami Beach um and then you have Northwest 84 to 63rd but the majority of the routes that are on this are not coming through our city so how how are you expanding that particular option or what do you plan on expanding that option for the Uber credits so that that was very much a stop Gap um you know we implemented that pretty much as soon as we launched the program knowing that there there were those gaps because we we are rolling out some more permanent improvements right so I mentioned that with Route 16 we're looking to stand up a different type of kind of fixed route service so once we do that the Uber voucher program will go away there because there's the service so you know as as we're able to bring online the more kind of permanent Solutions some of these different um you know ways of moving around will fade out as we kind of become more right sized to the level of service needed in those areas okay and and I would be remissed if I didn't mention you know all of Miami data is a Melting Pot but our residents here speak various languages um Haitian Creole Spanish um you know uh primarily you know U Russian right Mandarin HEB okay so we speak a lot of different languages uh and so what you know our hope is that the efforts are really targeting the people who are affected the most um by these changes and when I say affected the most someone may have a handle on Uber and be able to download the app and request that ride but a vast majority of residents who may have to call their child to come change the channel or to figure out a smart TV may have an issue with that kind of a solution because it's it's beyond the days where you used to open up that piece of paper and see all of the different times when your bus was arriving and I'm talking about what I used to do when I was going to going to school is open up that paper and look at all the times and I know when I got to be at that bus stop for my particular bus so we're a long ways away away from that and Technology a lot of people still are catching up with this ever evolving technology so the Haitian Community the Hispanic Community you know people who speak different languages need a different kind of um way to be informed of these changes so that they can be fully integrated into this this change so um I don't know what that looks like or what you guys are already doing but um you know that's a suggestion all I appreciate that and and yeah we are very conscious um we we do have a particular Gap um in reaching out to the to the Haitian speaking Community um and very specific needs there as a lot of it isn't uh written um so there's a lot of kind of more verbal Outreach that needs to happen um that we're working with some uh community- based organizations to help um reach those communities as well um and again acknowledging that we haven't done as good a job of it as we have before um and also putting some announcements on our buses um in Haitian Creole as well which is something we're working on doing as well um one thing that Sam reminded me um just to reiterate I mentioned before there is the Metro connect uh service which is an on demand Service uh which does cover um the majority of North Miami Beach and that's something that I think um City staff are interested in trying to expand potentially um it really is a great service to provide that accessibility across the entire city where where maybe you know a a a large bus isn't warranted right it provides that that better kind of more tailored service for for individuals in areas where there's just not as much demand so um just again something to consider moving forward but it's something that we're committed to as a county to continue providing that service uh where it is currently okay great all right well thank you so much very informative and great information and we appreciate you coming um all good okay all right thank you um all right so next um 5.2 is uh live local act and I guess um we've got Joe cordino from the cordino group here mayor unfortunately uh mayor cordino could not join us um as he had a a um meeting down in Pine Crest that he was not able to reschedule um we tried to see if we can get him to um to present virtually um but with some of the delays that we've had today um that also isn't possible so Ed um who's also well vered um will be taking over for mayor cordino okay on behalf of Mayor Corino he profusely apologized that we had some technical difficulties early this evening um I would try my best uh uh uh uh to compensate that I'm actually one of the few planners in the state who have presented on this Statewide to other professionals so uh hopefully uh we can bring this up um as you are aware uh um last year we had to deal with live local act and last month um the update SB 328 was pass so uh to cover this uh with you all today uh um um we have uh an overview of what live local act actually entail what was the goal why why would it pass in the first place and what did it do including specifically the significant changes in the new bill how it impact our city north Miami beat in particular and what we can do about it the community um this is a very complex issue it's it's also Complicated by the fact that uh in addition to our own legislation and the state legislation we also have the county legislation layered on top of that when it comes to North Miami Beach being on the uh the Northeast Corridor for the uh Smart Plan um it's really good to uh for us to take a step back and look at this from a legal perspective from a loning uh perspective and from a political perspective as well uh regarding the we need to make the most of this um you know where we are is we can't reject this and not participate uh it is the preemptive items on this date and we really need to figure it out at the community how it fits uh at part of community how it fits in our communities and doing nothing is not an option one of the reasons why this came about um I'm on the State Board uh for APA Florida uh it is the Professional Organization and that organization does Lobby um and so every month I take a look at uh we we Mo our lobbyist and look at the politics behind it one the reason why legislation like this happened is not only because of the wider trend of preemption that I'm sure the Commissioners are all aware of happening in this state but also because they saw this pervasive issue of housing affordability uh uh in the state and a lot of nism from our peer communities and so they got sick of communities not really taking action and did is how these laws become what they are with the preemptive this kind of gives us an idea of how to proceed in North may be forward as well um as we go physically closer together we Face a lot of uh difficult problem including Transportation economic environmental and did all feedback and affordable housing uh and uh really our household income and our ability to you know have a good quality of life um these issues are Regional or Statewide um they can't be soled by one city or county but this law essentially forces each City to tackle it on themselves by their own solution take critical mass um and part of it I mention that the state is aggressively trying to solve these problem not that the live local hat has near support in the legislature and what was passed last month was just a fix to the original bill it's really Undisputed that we have an affordable housing crisis uh in the county and a lot of people moving here from other places with higher cost of living are squeezing out every other demographic of homeowner renter you also have the recent uh changes in the uh the the rate that provided for the FED which actually does slow down housing construction over time therefore also ex activating the problem and we're expected here to continue to grow by as many as the million people in the next planed Horizon within the county and something needs to be done or um essentially the area will become unlivable um and again that's why the state the state understands why been so aggressive and trying to tackle this in coordination with some of the nonprofits uh uh in the state as well um so in looking at live local act let's cover what this law does what it mean to Norm Beach and what we can do about it the law Implement a multifaced approach to addressing Statewide demand for affordable housing development in Florida it does four main things here it had preemption to the approval project and Don consideration to affordable housing development foring to also approve these things administratively it requires local government to compile and publ the L of all government home properties with fality that being be suitable for affordable housing it provide new property tax exemption to incentified Property Owners to explore affordable housing options and I'll go back a little bit more in depth in a little bit and it appropriate over $700 million in state funding to the Florida Housing Finance Corporation the land you preemption here really looked at U affordable housing commercial commercial industrial mixed youth zones a local government can't regulate the youth density for air ratio or height of affordable housing development if the project is multif family or mixed use in any area known for commercial industrial or mixed use and at least 40% of the unit are dedicated to affordable housing for up to 125 Ami with its area median income for at least 30 years and if the project is mixed use at least 65% of the uh they get residential we really can't do much in making them do a lot of variances either though that mentioned or youth density floor area and height are the major preemptions here with the use it had to deal with um mentioning uh those particular Dr and you can't force them to do a roning or Land Development uh uh change uh um now we can still maintain based on what was passed last month on conditional use but um that's the correction correct with density is the highest current density allowed in any land in city or county where residential development allowed what does it mean for North Miami Beach our highest density is 125 gr un per acre and that's what's listed what implied by our back at right can be higher depending on how you look at it so kind of put that in a little bit of a bind right there um at to floor area ratio um it doesn't allow for more uh less than 150% the highest currently allow floor a ratio and for the height it provides for the highest current allow height of any residential land in the city within one mile to Pro uh s where lival act being applied um what the most recent change of the law last month did provide for is we look look back and say hey if you're next to a single family area where it's like one story we can look at it a little bit differently and what that means here is that it's instead it's restricted the heights of either 150% of the hall adjacent building the to currently allowed height on the property or three stories whichever applies to most if it sounds confusing because it can be so pre option also look at bonuses uh Live loal app did not preclude a project from receiving local uh development bonus for density height or F and provide the project Pro bonus must be approved administratively without uh further action what does that mean it doesn't actually come before you at the quad judicial hearing it's administratively done through the Community Development Department offices um that's what the state law really means on that one um and that to uh I guess for them is speed up the proct based on the lobbying effort of the uh that we provided um the retion there there are tax exemption the property appra must include the proportion share of the res res common area in the land um what does it mean if it qualifies for affordable housing there the proportional aspect of that where you don't really uh it affects your avaloran taxes and these tactic exemptions also apply retroactively to January uh 1st um so any pending exemptions uh will follow in that as well um last month the commission also asked um about parking whether parking is uh would be reduced at the time I said no because this uh this update hadn't passed at that time now that it has uh that what the law actually said now uh it uh eliminated parking requirements for Mi residential live local act within a Transit oriented Development Area Tod and where everywhere else the parking requirements are reduced by 20% for live local act project within 1 half mile of a major Transportation Hub um which also has a pable parking within 600 ft um that's uh you know that uh major Transportation Hub meet any transit station Hub Light Rail bus where disted by public transit which is a great deal of the city actually despite the change it in a better bus Network our changes from last year units are also now allowed for sale they before just rental um not permitting Airport flight paths um it clarified buil administrative approval procedures uh uh and um look to conforming and grandfathering specifically uh if a project is approved after the 30-year Covenant is over with it grandfathered in it had to be legally deem legally conforming even after that time so this had a really long range effect uh as well on on development within the city um provided for extra funding as well under the hometown HERO program funding $100 million more importantly for us as we discussed this evening is where is it impacting us if I could direct you to the purple and pink areas we know that at the mix youth International Boulevard uh um District that's 125 Dron units per acre now expand to the North and South three miles that is the extent of the range that this law impact um and then you look to the mixed use districts and you expand dream out from that so mutc m e and if you do a calculation of that that's about 75 to 80% of the city um that's the range of effect of this law right now um at in provision all the state and local laws applied and mention it must be moved administratively actually within 10 days that's how my office had a a time to actually review the project in its entirety 10 days um if not it if we do not um um complete that review on time it's considered administratively approved V comment it's really hard to um with affordable holding really hard to dispute that that affordable holding credited there a lot of confusion and definitely uh you know it get confused a lot of what this program whether it's uh you know thinking about low-income housing or really folk uh uh to fall to a very charge term that we hear about like Section 8 and there's definitely a difference between what's called Workforce housing affordable housing and so forth as basic form housing is Affordable any income level with uh no more than a third of our annual income the fing affordability we look at it as if you spend more than 30% of your household income uh uh on your housing your uh housing is not considered affordable uh and you spend more than 50 you're severely uh impacted uh 50% and we do have folks within our community who do spend more than 50% on uh of their household income on uh uh housing um at the Ami uh we um we talked about Ami right with 100% for the law but what does it actually mean well the Ami Miami day county is 74,700 $ so 120% of that is what they considered affordable under this law so you look at it that's close to 90,000 um does it really fit our community um that's you know 89,000 a year considered high income um midlevel master degree professional uh or well at higher level police and firefighters and um so you know we have to look at what the alternatives are when it comes to the middle class Gap so um what did the bill do and how we pack the city um the bill really uh does remove a lot of our autonomy at the city unfortunately um it's well-meaning but has an compounding impact because of it preemptive quality that we have a city uh need to look at take a closer look to address and then because um it's a Statewide bill it kind of tried to uh put a square peg into a round hole because the issues that we see in Miami da and places um may not be the same way Target as you see in P County or other parts of the state but here the state is seeing as a Statewide problem and therefore it's providing something on a very Statewide basis um there's um also a lot of issues that you know on uh administratively about Staffing turnaround times I mentioned the 10day turnaround time how we monitor these it create questions about losing your tax base um because if you're project qualified in Li vocal act you lose part of that avalor and income um it creates uncertainty about how to correct Community character and quality of life like right now there are certain aspect of our uh commercial Zone properties where if live local act to come in with the project we have regulations that c with facade and things that you would normally deal with from a commercial standpoint they don't apply from a residential standpoint so how do we uh ensure at the community that was coming in even though it's mixed use ex actually built in a way that is a quality development that is suitable for residences um how do we know that folks are not going to cut Corners just to create a uh affordable housing uh but of electric quality to make it affordable um how do we in Das then consider how we protect neighbor character in places particularly since we have a transit station coming in um and what needed here U moving forward is also um taking all that at and understanding that and then clarifying the city's position as we continue to see investment from developers um you know there's and in the long term that's also a need to think about how we administrative apply the item and think about how we track the affordable how 30 years of a long time and you know uh let's see what was I okay sorry it wasn't changing um the law gives again the density FL areas and height as long as they conform to other uh rules in the uh the ldr uh but we still it's important to remember have control over concurrency requirement this law doesn't doesn't preempt certain concurrency requirement doesn't just uh preempt other aspect of development and uh the the solution to this then is to look at how we as Community can use design based approaches to guide the development take a closer look to everything from setbacks to concurrency block sided and so forth as part of the overall solution what that means that we need to Revis our Zing code um looking at how we can construct Our Land Development regulation deal differently uh especially at live local act item come in to ensure that the uh new developments are livable we should explore consider exploring a bonus structure because this law doesn't prevent you from doing something in between right it gives you hey 40% it's all you have to give uh but you qualify that but that's still a high number so can we construct something that intermediate that's opted by a developer that serve the affordable housing need of our community um that's something to that can be explo exp a little further as well and the thought of bonus structure is a way to kind of think about how to counteract them the more uh what some folks will argue to negative consideration this law um you know affordable housing is also Nuance in that you have to consider what type of affordable housing you want and to understand the differences affordable housing is very diverse it can be 120% Ami work for housing and then there's uh Z to 60 6 to 80 and so forth uh through the intermediate aspects um you can uh really adjust your uh technique by looking at everything from doning to minim un stes um it's all part of a consideration for how the doning can be redone um how do we work to preserve neighborhood character well most people tell you the height density is height should be a corner mile from the transit station this law allows it really far from the station right so with position loing you have separate uses new inform based codes uh uh are however designed to have aesthetic priority so moving towards a more Thorn based code is what you see your peer communities like for L have had uh begun to do um and ultimately um again um you know that looking at the Land Development regulation you have to think about how uh how you can Implement um or the poliy that VI better Clarity um clear statement on which D District are eligible um and that sense that you know you have certain rule for the envelope of the building design of the building uh pre-application reviewed are something that your peer cities have begun to implement uh in response to this um clear statement on which multif family regulations apply to receive administrative approval on compliance monitoring retirement so forth these are all techniques being used by uh other that they think about how we tackle this law um um let's see and landage restriction agreement as well uh uh uh um again it's an important part of this through the years uh uh but you know in terms of how that complies again um you know uh um looking afford terms uh looking at a little bit differently to see how we can uh have um PR for monitoring between income certification and I know it's a long presentation I apologize uh this the last one uh slide uh in conclusion uh what we found is that this bill with real meaning it was really buil to try to uh solve an extremely uh difficult and disruptive problem in the state but however it is as mentioned earlier a Statewide attempt to solve something that should have a little bit more local whole basis and how we uh adapt to um uh um our actual needs as a city and it's like I said earlier blooding a round peg into a square hole or a square peg into a round hole um it's later on top of different uh efforts like the rapid transit zone so it kind of muddies the water a bit and as you refer the city part of the process to un muddy the water to actually create distinction that's the most important part here that important part solution that required for the city you have to create Clarity within the process now that the wat have been muddied a bit um that's exactly we have to do and ultimately when we do that we have to look at affordable housing and ldr and form code for zoning diversity or form of building and combine that all together and something that makes sense again mayor and vice mayor commission um to to kind of summarize it's it's a very detailed presentation um with very profound impacts on on the city um a live local development project essentially bypasses a lot of the regulations that the city has uh by right and not only that but the city could potentially lose um any ADV valorum revenue from the development so it's longlasting in in its impact apart from just the building right so what can we do um one is we have a open door policy in which we try to meet not only with residents but also developers or anybody who's interested um from the Community Development um Department as well as the building department to have pre application meetings explain what's going on be able to walk someone through because what we're trying to do is foster a partnership with anybody who's looking to to build or do business with the city we do that purposely so that we don't get stuck in this type of um situation where for the most part people are going to throw up their hands and say you know what I'm just going to do this because at the end of the day to qualify for affordable housing in Miami day County you're essentially talking about $90,000 in salary that's that's not a fast food worker you know as we indicated that that is a professional um that is someone with a degree that is our police officers those are firefighters uh those are teachers um it's it's a it's a large scope but we have to recognize there isn't a a housing crisis going on not only throughout the state but in Miami Dade County and so what we need to do is be able to prepare and have opportunities to work with interested parties so that they see the city as a partner on top of that staff is looking at various different aspects um to make our code more in Conformity with modern standards and and state regulations we're looking at update doing an update to our comprehensive plan uh we're looking at various other code changes looking at our um tot districts um we're looking at creating a uh mixed use District over by bis Gan Boulevard all of these things to ensure that we have the right type of partner that comes in to do any type of um proper development we're also looking apart from just the zoning side we're also looking to move and finalize the second study phase for affordable housing and implementation um we had commissioner um basan here through District 2 she's allocated funds to help us fund that study okay and so we're looking and we're working we've been contacted my office has been contacted um several times to see what properties do the city have available um because people are interested in doing some type of affordable housing development and so we're we're what we're trying to do is um as part of the law we we've created a list that we need to do but part of our strategic planning um um once we get started with with Fi and our in our economic study which we're getting to the point of signing the the contract they'll some back and forth but we're signing those contracts and starting that up we'll be able to start recognizing other areas throughout the city that now we can really help move affordable housing within within our our city and reimagine some of these properties of how they look how are we using it and what might be a good way to address um that that aspect um all that said again it is to create a relationship within our city that's going to foster a true partnership people who want to work with the city as opposed to forcing something essentially down our throat um in which then we don't see any benefit of ADV valorum um revenue or anything and and I point that not because ADV valorum is end all say all but in city government in order to provide services we're still going to have to provide services to that um development right we're going to need more police because we have higher density we're going to have to provide more services whether it's Public Works whether it's Park whether it's libraries whe um storm a slew of different Services yet more often than not it's when cities don't want to work with these partners that they say okay well I'm going to take this aggressive stance or or path that's available to me to to develop then the only one that gets hurt is the community so it's finding a way to to to keep that um in in a way that we can work with with those who who come and and and talk to us um I think that kind of helped cover everything we'll be bringing back um over the next several months different items for you all to be considering um and I think once we start some of these down the line we may need individual um either a special meeting or a workshop um to go really into depth with some of these um but we did have um several months ago um commissioner Jean wanted us to explore this and come back with a date certain of a presentation of how this impacted North Miami Beach and what we're doing to move um the needle on Workforce and affordable housing so we wanted to bring this report to you and kind of really show you cuz there's been a lot of talk but not a a lot of talk of the ACT ual impact to North Miami Beach right so we wanted to bring this to you but we will be bringing back other actionable items for you all to consider and I think those would uh need to have either special meeting or or workshops available to kind of get into the the weeds of the of the matter okay thank you commissioner John thanks for initiating that process and I think it was um informative I think it's complicated something that we need to start digesting little by little but but something that's obviously going to be relevant to us um in a lot of ways yes thank you Mr Mayor I just have one quick point I know you you you mentioned the mixed use but have you looked into how you could update our R2 residential areas and to because we have certain Lots in some West some some East as well as Sky Lake these are Big Lots and uh see what possibly allowing these um in-law types um developments on those properties so you w to have to move I mean they've been doing it in place like Direct Mor because of the the the housing issues there um but I I just want to give you give give that out for food for thought because I know we talk about mix but also to also consider um R2 um zoning as well thank you commissioner Joseph that's an excellent point um in today's in today's world more often than not um especially the younger generation it's becoming harder and harder for them to purchase property um and so you're seeing more families multigenerational families living in in the same home whether it's where they grew up or they all come together to buy a a single property so we'll definitely be looking at that especially during our um comp plan updates um live local is more specific to those commercial um type of zoning areas and mixed use areas because it talks about increasing the density where at one point there was a rumor in the legislation that they would allow that type of development to start leaking into residential areas and everybody kind of started freaking out and then it was like they CL they clarified they're like no no no this isn't what we're talking about and like oo okay because last thing you would want is for a developer to come in um in any of our neighborhoods buy up a block and then build you know 20 30 stories up and it's was like so there was some misinformation that got out there during the legislative um session luckily that's not the case um it's more specific to just mix use um and and high density areas or commercial areas um where where we've seen a lot of this type of development throughout the county um has mainly been um in areas that have longstanding um like Warehouse districts um uh I I can thinking my hometown of haia um right next to the railroad tracks there's a lot of warehouses that have a lot of Auto Part repairs and things like that developers have been buying up those warehouses and are now looking to to do um higher density type of development right so that's really kind of the focus where we've seen this I think the first live local project um which has been publicly said um I I don't know if there's you know been any changes has been ball Harbor um and and where the mall is in ball Harbor uh they're you know the the mall owner has wanted to do um luxury residential area and the city has basically said we don't want that kind of density for a long time and I think the the developer just recently said well I'm doing live local and you can't stop me and so again creating Partnerships as opposed to constantly creating adversarial relationships is is the goal here it could be used there's also one in Sunny Isles that Sunny Isles is going to buy the property to usurp it there's a lot of rumors out there thank you for bringing this presentation there's a lot of rumors um thank you Mr Mayor yes uh one more uh point you spoke about uh the city taking a look at uh properties uh that they own or that we own um and I remember that not this particular you know body with everyone that's on board here but a few of us was on the previous commission that actually voted right to um take a look at one of the parks that we have on West Dixie Highway that's been if I'm not mistaken just vacant and utilize right now to um it was utilized for Mi day I think when they were doing some uh still is right okay so um that was an actual vote that took place and so we we need to go back to that and take a look at that vote and what steps can be taken towards affordable and Workforce housing because it's right next to what resia is supposed to be doing which is targeting Workforce housing as well um and whether or not that needs to be something that's placed on the ballot or how we move about getting that done because that vote actually took place so that's on that's on the record that that was that was the int of we'll we'll go back into into the history book there and um I'll I'll do a little bit of research come back to you and and come back to the commission with what our available options are um with regards to um to that property the law live local requires the city to put a list of all the properties that we own and made available to anybody to kind of review um recently we had a developer call us and like oh I'm interested in possibly buying um was it Allen Park or something like that and then we're like yeah it's not not for because they wanted to do a development we're like no that's our that's our park we use it we're not they're like okay never mind then so you know people are starting to look at these things and just making cold calls and and to see what may or may not be available um you know people who tend to develop affordable housing type of units are in it for the long game um you know if their developers are in it for the long game they're thinking 10 20 years out um as opposed to a quick flip of selling um units as quickly as possible although now with the law changed you're now introducing a new mind frame because they can sell these units um as soon as they're built instead of renting them right so we're we're trying to adjust to all that see what those new impacts are are going to be and we'll be bringing several of these type of items but I'll definitely look into that property and bring that back to the commission for for discussion and consideration thank you so much absolutely okay if we're all good let's uh move on to 5.3 um smart C NMB mayor um we have the presentation available and this is another item in which we were asked to bring back um although it was date certain um for because it's already 8:00 p.m. um what I would like to request from the commission if it's okay um and the bill sponsor or the resolution sponsor um commissioner Jean if it's okay with you um I would like to just bring this presentation back to you in April um so that we can move over because I think we have some pretty good discussion items that are very crucial for for the community um and and and I'd like to just kind of move so if it's okay with commissioner Jean and the commission um I'd offer to bring that next month Smart City we're moving it Forward yeah okay so we're going to defer that now to a future meeting is that okay with you ability towards each other at all times and our first speaker is Roland Vu you good good evening Roland good evening everybody name an address name me an address for the record by the way my my name it's okay it's working you just have to move it closer yeah move the microphone closer all right okay perfect okay my name is R I live at 13730 Highland Drive not Miami beach but I was supposed to talk about a subject but now since you're talking about construction I'm going to bring it up next door to me they built a eight story building and when they build a big Den some of you were there to give them the permit to build that kind of uh building over there then the mayor V told them one time had a meeting like this he said I know I've been bending backward to give you a chance but there is not enough parking place for the amount of the the apartment they're going to have there the problem is those people there now they were parking across the street by the church now started park the car all the time the grass died the roofs were coming out when it was raining it was mud but the church decided to put some trees in there now they don't pack there no more but next door to it is me I got 100 ft across the the road over there then when they found out they could not park by the church they all came in my place back over there one time I got up and I had seven car park I had one pack on the on the on the back of my car because I I went to the store to buy some Grocery and Par and one of them was park in front on the back and one of them was park on the other side on the right hand side on the left hand side I had a tree on the right hand side I had the gate where the heck do you want me to go in my car then called the police department I said there's something wrong in there then an officer came over by the name of Ky and the KY he went to a me one time we had a meeting with the c manager Highland Village and I asked the C manager if he does medical then he said not really but he said the thing is you see if you got a complaint you have to come up with something good about it that's the thing about it if I complain about something bad how can I get with something good then finally we let it go and uh to come back to the parking over there then I called the this the the police apartment and I had a gentleman very nice talk to me and he said we're going to send you an officer right away good no problem with about five six minutes the Mr C came over he said I remember you talking about me he said where he said that meeting you had in the island you was a c manager if you make miracle I said yeah you did listen to me then then what happened there and I said do you make Miracles because I was stuck I could not move he said let me see what I can do then got the phone there called towing truck he he got three of them to away then I was free to move my car but now what I did I put a your time's up by the way actually went over a little bit somebody else want to give me three [Laughter] minut gee I need three three hours okay anyway you've got there's a whole bunch of police officers in the back there you can continue the conversation with them in the back of the room well they already know I talked to them already because you see I just want to say that the police department did a very very good job when I call and I want to thank them for city planners and public Ser servants like yourself were very wise in in in the careful choosing of the location of our library the Pew Research Institute states that successful communities have a library within 2 miles of their home this is the new Target for the Miami day Public Library System at North Miami Beach we have already reached that goal having a walkable City the trolley and the central location of the North Miami Beach Library is part of our environmentally conscious successful and useful City last year the North Miami Beach Library received 261,000 with an average of 796 daily visitors a number that is rising the number of community members that are served by our library professionals and power professionals is the number of community members that are satisfied with their community services and therefore your service to the community in the upcoming budget season we hope to see resounding support for our library an increase in staff in order to maintain the level community commissioner smokler congratulation on your award from the league of City even though I wasn't at the biking event um I was able to was a n i was here in spirit so vice mayor thank you I mean Mr shanov thank you for the great job you done um but what I wanted to communicate about was the better bus Network um I think commissioner Flor kind of touch the topic and kind of touch the topic a little bit but he looped around it like in term of technology for the people who are not so technology slavy so this is more of a question than more of a statement I wanted to know what would you do for those people who don't sorry I wanted to know um is it Linda right is she still here no okay but um I think she might be watching the commission meeting so I wanted to know what would you do what solution do you have for those who are not technology saavy when it comes down to the Uber incentive cuz not many people know not many people know how to use um the app I could have test to that cuz I know a couple of people I think like I said before like I brought up earlier commissioner flma touched the topic on top uh he kind of touch the topic a little bit but he straight around it but I wanted to know what would you what would you be able to do for those people who don't know how to use the app how would they be able to get the incentive for the Uber and um also I I don't take public transportation but I wanted to know um the 246 the overnight BS like does it still operate I want to know and the three as well thank you for your time okay um would one of the Commissioners be able to get back to me with that like um what in like what solution would they have for um for those who don't know how to use the app who don't have anybody to help them how would we be able to go around that so I I actually spoke a little bit to the manager about that this morning and there's a 800 number to call so there's a phone number you can call if you don't have the capability of using or the knowhow of using the app I want so how would they be able to get that in I wanted to add to that I think that's part of the the smart city is our initiative to also help residents learn how to operate their uh elect electronic devices and also learn so that's hopefully part of the ask that I had of the manager for us to start those classes and help people learn how to use an app learn the basics and hopefully that will eventually translate into them being able to be self-sufficient in that way thank you thank you so much appreciate it my time is over thank you um good evening before I get started I just want commissioner um Michael um to your AR to R You2 uh sir please state your name for the record uh Bruce lamberto I was hoping to just get in before we start my time just as I was going to comment on that R2 issue that has been signed into law by mayor Cava for the county that mother-in-law's quar it's up 8 to 800 square foot countywide is allowed not in not in the municipalities but in the county yeah yeah okay my name is Bruce lamberto uh 3420 Northeast 165th we heard tonight the the presentation by Metro dat bus transit that they're going to be doing an optimization of their system in integrating with our trolley and and that's about to start shortly and for that very reason I think you need to delay this proposed um Consulting agreement that you're going to be that's on the agenda for tonight until such time as that optimization is done and maybe at that time you would uh see the results of that and maybe at that time you would do your uh this this Consulting agreement because if you if you implement this now and they make changes during the course of that consultation that Consulting it may invalidate the actual results of the of that contract um the other thing I wanted to mention to you is that uh what are what some of the proposals were and you've seen this I've communicated with all of you either by phone or or email or both that um The Proposal would be to eliminate four of the six trolleys that they have very little low ridership the ones that have the heaviest ridership the ones that go to Washington Park Highland Village those would remain uh and then we would come up with alternatives for the people outside of those routes that that are our residents of North Miami Beach that we could actually address we can we can do the Uber we uh the mayor had suggested in my conversation with him that maybe we can use the 1012 passenger wreck van that we have and have a dedicated driver just to catch those people in the uh that get missed by the the former trolleys but I've ridden the trolleys and and there's very little low ridership and we can make better use of that money the just the Consulting agreement that you're going to sign is $117,000 that would buy three police cars that would buy three pickup trucks for Public Works uh you know and that 107,000 once it's done it's gone it's gone you don't have nothing to show for it so let's try to be wise on uh how we spend our money on these Consulting contracts just in the past month and a half we've given out almost 100 almost $400,000 in Consulting contracts the one for the water study one for the garbage study now we're doing a trolley study it's getting close to half a million dollars here and these this is all unbudgeted this is all coming out of our reserves 15 seconds we haven't even had a hurricane yet so please consider this what you're voting on tonight that maybe we should defer this um and just go month-to month on the trolley until we kind of get a handle on it and then please don't prove this contract what what about a $20,000 Consulting agreement instead of 107,000 can we look at different options here thank you thank you sir diego7 good evening everyone s Diego North Miami Beach resident I want to say that I'm just loving the environment in here where everyone is getting along and been so nice and personal and loving toward each other I'm so glad that our city is in this nice good space next I would like to thank all the city officials and staff that took the initiative to come out to meet me at my home so that they were able to see and witness the things that I have been explaining over the years time since I've been coming to the commission meeting starting in November of 2022 I'm very grateful and I'm beginning to see some of the teams here for the city from the city taking initiative to try to make things better so I'm grateful for that I'm also grateful for the affordable housing conversation I'm so glad that I made it here tonight and was able to hear that because that's speaks to people such as myself and my demographic also socioeconomical status and things of that nature people who are in this community that are Income challenged who are not making $90,000 or things of of that nature so I'm aware that several years ago Republican Governor Ronda Sanz did pass a bill to take away or limit the power and ability of the local municipalities to be able to do more with having these developers provide more affordable housing you know that's a that that happened so this new bill I wasn't even aware of it I have so many things going on in my life I try to keep up on what's Happening so I'm glad that I've been able to hear that too and so also commissioner smuckler thank you for taking the time to speak with me vice mayor excuse me got to keep up with the titles you know so thank you for that um it was a pleasure to be able to be specifically asked to attend the city manager meeting I'm glad for that I want to thank you too Mario and David our city managers I want to thank every one again who has personally taken the time and mayor you know you and I I appreciate you we had a great conversation on the phone uh I thank you for that special invit invitation too for talking tacos I will be present that'll give me opportunity to be much more proactive in the community and sought after better known so I'm grateful and um did I everything wanted to make sure I got everything cuz I'm cold and I'm hungry I going to go home and I want my glass of wine so I'm just glad good evening everyone my name is Maan um I want to talk a little bit about yes yesterday the speaker previously talked about how many how much half a million dollars alone we spent on the experts and you guys hired experts to vet the law firm or the lawyer that is going to come and represent us the City attorney and that study was literally cast aside you did your own thing the number one rank vendor you cast to the back and the number third vendor you brought up forward and you selected that why are we paying for all of these studies and you don't even care about it and you do your own thing that is why the city keep crashing the the number one rank vendor was um the vendor that um Mr John represents that was the number one vendor he had like 282 points and the last rank vendor had 202 points and you all jumped for that I'll move on the CRA I think the CRA is miserably a failure in this city I heard a CRA guy tonight I do not know what position he holds but he wants to buy the singer building from us that singer building is over $2.1 million he's going to buy it from us so that he can get more office space and he's going to rent the downstairs what happened to all the the the actual monies that the CRA actually was to do was to help the businesses around to Spruce them up to make them look more sprightly you go down 125th in in North Miami you'd see how the CR is working there our CRA is not working for the last 20 year it's a failure and what you do you take this money and you give it to the new owner developer who's going to put up some highrises and you give him hundreds of thousands of dollars whil the mom and pop businesses that has been in the city for the last 20 years have been donating to the CRA you give they give nothing I look at some derc um um bu bu business um buildings down the corridor 163rd 167 and the money is not utilized and here again this director now wants to buy a building from the city so that he can get an extra office space what sort of nonsense am I hearing you guys I know you're good you've got to bring it out you've got to say no thank you very much for having me thank you um Mr Mayor if I may have a point a personal privilege um Kazan we did not pay the evaluation committee evaluation committees do not get paid thank you know what you mean for the attorney's office the the the the committee that vetted the attorney's office the the three finalists we didn't pay them thank you okay but we didn't pay them so there exps were more EXP I certainly I certainly hope that they were more experts than me okay next speaker linu Reef Club condominium and um mayor Commissioners and uh staff directors of the city of North Miami Beach thank you for your service I uh what sir Diego said just now I said if I'm really close friends with him should I call him Diego or sir Diego still but um sir sir right yeah there you go so so um so that really resonated with me I think like it's so nice and peaceful to see the the de very working cooperating together now um my comment is about yesterday and I hate bringing up the past but it's important because I think that um the fact that we have three biders coming in right uh that shows a lot that means there's a lot of other law firms and lawyers and attorneys who don't want to work with us or don't care to put their bid in and so it's very important that you choose or vote for the right one and that the that the City attorney uh probably Bargains for a good deal for us and um a nice easy exit if should things not work because I think that um to have a City attorney that is going to be I'm pretty sure I haven't seen him lose an election so I'm pretty sure he will win the Schoolboard seat and to have him run that uh two other cities including um our city as well I think our city needs some TLC right now if we can get some good TLC good some good structure whether it be uh attorney Heron or um or gray and Rob gray Robinson that would be fantastic I'm not saying that he's not great I'm saying that I'm worried when he gets elected and he's not going to have enough time for us I want our city to have um full attention of the attorney that is going to be here to set everything up and CLE CLE everything out I believe there's a lot of ordinances that are outdated they are um repeats of each other they are redundant uh those things need to be cleared out and I think it's time for our city to pack it tight and run as fast as we can because every city around us has already gone like a decade ahead of us thank you so much thank you any other to be our professional advisers uh and you all didn't even ask enough questions on the person who ended up getting the approval to be our City attorney um how that happened how you go from the third Rank and make them the first Rank and it was interesting because so many of you asked questions about the ability of the person who seems to be the one that's going to take the lead with greenspoon martyr now Green Spoon Marty is a fantastic Law Firm I'm sure um and I don't have my doubts about the attorney that is going to represent us he's the one that actually came to the meeting without a team barely a presentation compared to the other ones and again he's running for school board he's I think interim attorney in Durell he's an attorney in El pel he's attorney in Bay Harbor and you think he's going to be here four days a week commissioner Smith I mean it's and and that was really important to you so maybe that's what's going to happen or maybe there's going to be another attorney that's going to take over but I think that's the person that needs to be here that you all speak to and make sure that they do have their ducks in a row and they do have an staff that can handle what this city needs um I was really disappointed watching that last night there was one presentation that look we don't know what they would have charged us it could have been something that you wouldn't have been able we wouldn't have been able to afford and you know having a request for proposal would have been great in the mix of requests for qualifications but um to watch that presentation to watch all these outstanding young vivacious you know interesting attorneys come here and and speak about their background to me was so impressive and they didn't even get a shot so hopefully um this is all going to work out and and if uh you know the lead attorney for greenspoon martyr that's supposed to watch over us um thinks they're going to have the time to do everything we don't want to broke the roof and that's my question I come in especially today because somebody told me oh the meeting is public you can go and you can ask him it's really really it's very necessary sometime we want to work and I'm the woman I have three kids I want to work sometime I cannot go to work the office or something like that I lost cooking and the people say my food is good I don't have the money for I start with the a big business uh the restaurant ohot I want one day I want but right now I can so that's one one um it's something more easy for me to take a small food truck and a star maybe one day I can have my big restaurant and give it a more people um I don't know I can't explain in English I'm sorry um that's the reason I stay here I live in for more than 10 years here in nor Miami I moving but I come back from nor Miami because this is my city too and I love it so that's my my point today thank you may um we'll have staff reach out to [Music] you okay what I explained is that our ordinance is essentially aligning with the rules that the state has and that our staff will will speak to and kind of guide her through that process um so that she can have her searching uh support for our businesses and youth services in addition there will be some employers present so if anyone is looking for employment or an opportunity to uh gain better Workforce assistance uh you can stop by the Career Source event at you in addition to that we have the n&b team program Town Hall that'll be held tomorrow um 6:30 p.m. at the McDonald Center uh we also have a youth College Tour series that's going to begin on Friday March 22nd 10:00 a.m. students uh who have registered will have the opportunity to visit FIU and St Thomas University excuse me in addition on Friday we have nb's we care to share golf tournament that is held by the NMB water team the event will be held at 11:00 a.m. at the Miami Shores Country Club and it's an opportunity to raise funds for the Weare to share program we also have Wednesday March 27th coffee with a cup at 8:00 a.m. uh that will be held at Cafe Del Alma located at 16275 bisc Boulevard uh and last but not least not an event project how to compost the family Story Time and poster contest and then tree giveaway on Saturday so you're all invited please come out uh we will will announce where the trees will be given away okay Fortuna congratulations on a great heartwalk um it's getting better and better each year um and also you're our hometown hero from the Miami dat league so congratulations from the Florida League Greg Lemont is two or three time tour to France winner unbelievable he rode with us and we had a great we were with mayor Cava and a bunch of other people and a lot of my colleagues up here came thank you very much and we won Municipality of the year for bike 305 thank you and we had a great bike 305 last weekend let me thank you thank you commissioner floron thank you madam clerk um first of all everyone welcome again to our city commission meeting uh I also want to um aside from welcoming everyone uh thank our residents for always participating and bringing attention to issues of relevance to the to the commission you know we we don't know everything we don't see everything so you guys are our eyes and ears and we really appreciate all of your um attention to our great city um I want to take some time to uh just hearken on the issues that are going on not only around our world but more specifically um in the island nation of Haiti um and you know we all have a voice we all have a voice we all have social media uh well most of us do um but we all have a voice that we can use to speak up against what is wrong and to speak up for those who um are less fortunate than we are and when we take a look at what's going on in Haiti and as a Haitian American um you know it it it really pains me to see um to the degree that the country has gotten to and so um today I want to use this platform to not only say that our prayers and our thoughts are with the uh people who are in Haiti uh but also for those who are fleeing oppression um all over the world and more specifically want to send a message to the United States government and anyone who is involved in the transition uh uh um of the government um in Haiti to to really take note to what's happened in the past and really uh do their best to make sure that there's a brighter future for the people of Haiti they want basic things the right to walk the streets freely the right to an education the right to have something to put on their table to eat just the freedoms that we here in America sometimes um don't realize um clearly that we have and um so I I know that all of our commission members would would would would second those thoughts but our prayers are definitely the people of Haiti and we'll continue to do what we can uh here to to assure that brighter future um in addition to that um I just want to say because we have some holidays over the next couple of uh weeks um we have porum uh for our uh Jewish uh uh residents uh so happy porum um and we also have Ramadan which is currently being observed right now for our Muslim residents and for our Christian residents we have Easter that is being observed and and when I think about Easter I automatically think about it from from you know a Haitian perspective when you think about diak and when you think about you know all the beautiful services that take place at the Catholic churches and the Christian churches throughout Haiti and to think that a lot of people will not be able to enjoy this holiday the way that they normally do we ask that while you're enjoying your Easter or your holidays that you pray for those in Haiti um so that they can get back to some formal normaly in that country thank you so much thank you commissioner Jan thank you so much good evening everyone and well said commissioner flormont I Echo your your sentiments um did want to thank our interm City attorney Herring for your service throughout the last um 11 or so months and also wanted to congratulate um vice mayor smuckler on her home rule home rule award um hero she's her hero hero hero heroin heroin hero there you go happy woman's History Month to all the women and all to all the men who support us as well um happy St Patrick's Day for those of you who celebrated and also um I had the honor to be nominated for the tpo's street Safe Streets award didn't win but I was honored to be nominated um I did want to thank you to remind everybody about our career fair this coming Thursday with Career Source also teens tea party happening at the end of the month and I celebrated a birthday this um month so I turned 21 and look much younger right know pass was 16 but I want to thank everyone for the well wishes and also take good care of of your health um um both my mom and I had some some health scares um this past um week so all the women get your mammograms get checked out all the men take care of yourself because health is wealth so take good care of yourself though we um lead and it's very stressful often times um even our manager recently had to take a little pause but all of us please take care of yourself because if you don't take care of yourself the work doesn't mean anything if you're not able to do it in a healthy way so thank you to everyone and have a great meeting thank you said commissioner Joseph thank you madam clerk uh Echo the same sentiments in regards to Haiti um as well as you know I know we have a couple of holidays coming happy porum uh good PES but I know PES we're going to have another meeting PR to PES so just giving a heads up Ramadan Mubarak to our um Mr Mubarak Ramadan Mubarak you it's good that you have your name is a blessing in in of itself so to to my Muslim residents um uh next week is um it's going to be our uh spring break a lot of the kids are going to be going out uh my kids are going to be out and uh all I can say is you know get ready for it uh teach them how to swim it's a good opportunity it's going to you know it's always good to give them that ability and to get it early and soon especially in my demographic it's something that we it's kind of endemic and we're trying to you know something we got to work in our community to try to keep especially in this um in Florida and near water anywhere basically so I wish everyone well stay safe stay blessed thank you commissioner Smith thank you very much um Sunday morning had an amazing section on Haiti and the history of Haiti you can Google it and get it back I will tell you that having gone to Haiti and watching the news and seeing those streets demolished and seeing these wonderful people running just to save their life um the history of Haiti has always been a very fight for freedom and I have to tell you what you said I hope the public listened to I hope they realized three things a they need our help B doesn't matter who you are or where you're from We're All in This Together and the most important thing to remember is how blessed we are right here in the United States I want to mention to Sir Diego how appreciative I am you have pounded what I have begged for for years to clean up this city clean clean up this city and when the CRA today for those that don't watch the CRA wanted to hire somebody to clean sounds good sounds good but our code enforcement has to make sure that when you're responsible to keep your Swale Clean and Clear you have to do it I want to thank Bruce Lombardo who makes my life miserable but the these are people Karen Bruce kassan these are people that only want one thing a better City for all of us that's all they want they're not asking for money they're not asking for a job they're giving up their time and that's the only thing they want I wish that we had 50 60 people for public speaking so that all of us could have more input how we as commissioners can serve you better I definitely want to thank John Haron um don't don't discount Mr Haron being gone he could be back he could be staying we don't know the contracts haven't been negotiated but a a wonderful and good attorney has taken care of us for almost a year and I mean that from the bottom of my heart I I have to tell you um there's so many holidays and happy birthday to my colleague who you know at 21 she looks like she's 17 so so uh happy belated birthday but all these occasions that are coming up are time to make memories with your family so whether you're celebrating the Jewish holiday or you're celebrating the Muslim holiday you're celebrating the Christian holiday or my husband with the Irish that he can't couldn't find his you know his shirt from the bar and with it's green and his hat and you know what you're making memories with your family to pass on so please you know make sure that it's in the spirit it was meant to be so I I do have announcements like tomorrow is the senior's lunch and you have to register but the most important thing is we all recognize how what's going on in this world affects us even if we're not standing on once again also want to thank the library for along with the commissioner status of women for doing a beautiful event for women's International Day thank you adenia Al always want to thank the our Police Department for keeping our families our residents our employees our VIs visitor safe happy porm to all those who celebrate congratulations to our city for winning the bike the what is it the bike bike 305 bike 305 award it was you know they they always say somebody has to be last at that ride and it was me that was wonderful yeah I but but then they left me and that was another story um um thank you for to Mr Herring for your service and congratulations to uh Mr Geller for for being uh our new City attorney you know we our city got very lucky this year we were spared from a a bill in Tallahassee in reference to the service charge and and I really want to thank our manager Mario Diaz because you really put in that effort to make sure that everything our city needed to do was done so that that bill would not pass so thank you [Applause] yeah um want to wish peace to Haiti peace to Israel bring our hostages home and peace to Cuba as well and most importantly happy birthday Saul oh and I forgot I had written down congratulations to commissioner John for your nomination a nomination is always um an honor you know it's it's just the acknowledgements is always an honor and congratulations to you vice mayor than you thank you for your that's a major award thank you mayor Evan Piper all right thank you good evening everybody I think I'll just uh did what vice mayor smuckler said she think she covered every single thing and then some but uh anyway just uh in the spirit of brevity just a couple things real quick um it was an honor to be the mayor to accept the bike 305 award from um from count County mayor Cava so that was uh really really a nice thing to do um I uh also wanted to remind um everybody that you know we do have a vibrant Chamber of Commerce in our city north Ry Beach Chamber of Commerce um sir Diego brought something up that he's going to actually attend one of our events coming up at talking tacos um I think later this week or next week Friday okay I should know really right okay um but if anyone's interested in uh in Chamber of Commerce events um if you're a business owner it's great if you're involved in business it's great and even just to come out and get involved in the community and mingle with the business people in the community it's it's a great thing to do and it's something that's out there and um something you should definitely check out um wanted to thank um John herin for his hard work and dedication to us for the time he was here thank you very much um congratulations to commissioner chernof for your work on the bike 305 um where I got to get the Limelight but you know thank you um and and also commissioner smucker with your hard Health walk and your home rule heroin thing and all that stuff happy birthday commissioner John you and your heroin out now and um and then Happy pum to uh all those that celebrate so hopefully I did that quickly so we can keep moving on and uh thank you all for being here and for being our residents so thank you Mr Mayor can I give one more announcement sure April 8th is going to be the Tour De Forest which is for the fallen officers of the State of Florida and it's it starts out at our city hall on the a and it goes to I think Bon Beach the first day and then goes on for four three more days to Daytona Beach so anybody who wants to participate or donate money to Tor Force please see our any of our police officers thank you okay thank you very much okay so now let's move on to the consent agenda um so we need a motion in a second second okay um and um with the city attorney please read the titles yes sir uh first item is 9.1 City commission conference minutes of February 20th 2024 item 9.2 is regular City commission meetings of February 20th 2024 uh item 9.3 has been pulled so the um other item is 9.4 resolution number r202 2440 and titled the resolution of the mayor and the city Commission of the city of North Miami Beach Florida approving and authorizing a change order of the pigb contract with axon Enterprise Inc for the purchase of 40 taser 7 energy weapons increasing the estimated budget amount by $151,200 entertain a motion in a second to approve the consent move to approve the consent agenda okay you got okay um and all in favor say I I any opposed passes unanimously all right thank you um nothing on quasi judicial and um oh actually before we go on to legislation we're going to do the I think the manager report and the attorney's report I don't know if there's any particular order on that but madam cler um item 9.3 does that go before legislation or before the reports right before legislation okay um mayor vice mayor and Commissioners um the reports um provided in the agenda as back up um are are noted there um however there are some key um facts that I'd like to kind of just highlight um one is we recently started um earlier this week the Allen Park roof repairs um and so we're hoping to be able to to to repair the roof which will then allow us to repair the basketball courts um that the flooring is damaged due to water leaks and so forth which will then allow the um the area to be reused not only for basketball but for indoor pickle ball as well um so that's we're we're happy that that project's moving forward um we are also about 80% complete with the mishon park project and we hope to be complet completed by the end of the month um staff is beginning to um put together a program for a ribbon cutting uh that will include our little leagues um and once we have um dates and and um um events scheduled we'll be making sure to provide that not only to the community but to to you all and we'll be coordinating various states with you all as well to make sure your availability um the police department um is now wrapping up their implementation with it and carbine uh this is an item that earlier um last summer was something that's very important with regards to the safety for our community um we were having calls dropped um when someone would call the non-emergency police department number um so we are now happily moving forward we have some flyers here um that will be again pushing out as well as a video uh that will be pushed out this week um the Flyers are in multiple languages so that's going to be um um um great to to kind of move forward uh the first um um full implementation and and and everything um would be Thursday is when we expect in expect excuse me everything to be um Fully live and operational um next um I just wanted to point out again the weekly recycling um that um the commission has has championed uh starts on April 1st uh we have already um been pushing that message via our digital campaigns and that has been ongoing via video email and social media um on Sunday this past Sunday we also began promoting the information via radio and next week uh all the mailers and door hangers will be going out um to um to all the residential um um properties we'll then once once we begin the the weekly um in the month of April we'll then begin transitioning into more of an educational campaign about how to properly recycle because it's not only about the weekly pickup but it's also making sure that um our residents understand what is allowed and what is not allowed yes sir manager uh um one question uh that I got from a resident was and I they might have a video that Coastal has but what happen once you recycle where does it all go U they they just want to know what the process was I don't know if that could be put online where people a link could go to them because they want to see what the process is yeah sure we can we can put that information online I know there's been a a um I almost want to say seismic but I feel that that's kind of overhyping it the um the facilities that unfortunately burned down in Miami dat County which were located in um in Dural does impact quite a bit um and so um I believe coastal's here and we can get into it but we can definitely just provide that on our on our website and be able to provide that in our educational campaigning as well so that they can see what the process looks like for recycling and where it goes correct yes sir um so that will be um door hangers and mailers would be hitting uh the Residential Properties uh next week um and then two um two other uh quick announcements um that I just wanted to make you all aware of um we have been re-evaluating the um email system um in which we use um I guess it's Constant Contact uh to push communication out we are re-evaluating that we're going to be using a different system and we're making it so that it is better targeted um and more personalized uh for what people want information for right now it's basically you sign up and you get everything but under the new system that we're trying to to implement um people will be able to sign up if they only want programming from the library or if they only want emergency or they can kind of start selecting what type of communication they would be receiving via email from from the city so we're moving forward on on that kind and listening to um to something that many of you were were talking about during the um budget is um bringing on board a opportunity to have text messaging um in which residents can communicate directly with um the city so we are uh trying to um finalize uh an opportunity to bring that kind of Technology onto the city we'll also be creating the workflow as who would be responding because they would be communicating uh via text directly with um um with with the city and having a response it's not just a one-way communication um so we're we're putting that program together and we hope to have that um up and running um sometime in mid to late April um with that I believe that was that everything we said we wanted to did you have an update on City Line City Line the newsletter that we used to have any research that was done on potentially continuing on the cost yeah so um we we had looked in the the last amount that the um that the city had had put was over $25 to $30,000 um we are looking to kind of bring that back but I don't have an exact update for you right now he's going to be thank you 66 okay thank you um all right so now um we'll move on to the city attorney's report and um Mr attorney thank you Mr Mayor members of the commission um I um previously discussed with the city manager item 7 17.1 um and the uh decision whether or not to move forward and ask you all to take or to give authorization is being discussed um partly because that authorization is not going to fall on me that's going to fall on the next City attorney and so I felt uncomfortable uh after the agenda was prepared and in light of what took place last night to seek authorization from the city commission to initiate um action against the property owner uh of the subject property U as as set forth in the agenda but I do know that the manager wants to speak to that there is some backup in the um in in the agenda materials and showing you the condition of the property uh the amount of fines that have accured and our ability to um subject to commission Direction um um nomally or or likely under the U offices of of Mr Geller and his firm uh to move forward in seeking uh injunctive relief or foreclosure on the code enforcement leans that the city has accumulated on these on this property it's not just this property but it's also the property next door uh that the city has a series of outstanding uh leans on and the same ownership uh what ended up happening with the property next door which is vacant is the city actually physically went onto the property uh to clean it and to maintain it so we have a the equivalent what's called an assessment lean that's slightly different uh from a code enforcement lean but at the end of the day as reflected in the photographs that are in the backup materials this property is in significant disres disre hair it's become a nuisance uh it's a place for vagrants for just all kinds of debris to be um left um and ultimately um the city has significant concern after multiple attempts and trying to reach out and and communicating with the property owner that their response has been nothing whatsoever uh there lot of shall I say lip service but no actual action in improving and cleaning up the property and so you know very rarely uh in my experience over the years do we take this type of action and bringing this type of situation to the commission's attention but as staff we felt that it was necessary and to seek some direction from the council from the commission is how you wish for us to proceed the mayor through the mayor yes thank you um first uh thank you um uh City attorney Heron um he has been instrumental in in kind of guiding um myself and and our code and and Ed Our Community Development um director uh through this process and the CRA was even involved at some point as we were trying to talk to the property owner as to trying to get the building demolished I we call it the graffiti building um if you're passing it's just down the street from from us here um and we've had a about three meetings um that I've been on and and the property owner um is yes we're doing this this week we're moving forward I visited the property we're going to do this we're going to do that and at the end of the day it's been about two months and they haven't done a single thing and so um what we would like is to um um tonight to continue to receive your authorization and we'll we'll um move forward with that authorization uh with the city attorney's office um to be able to not only um receive injuction release um with regards to the various leans which is closing in on on a million dollars um but also um looking forward to address the property as a whole whether that's foreclosing the property going to Miami Dade um I think it's called Bora um to um to demolish the property uh we have vagrants who are essentially living there um I see people going in and out of the building all the time uh but there's not really much that we can do um from the outside from where we are allowed to look at the the building um you know we've we've had our building department go out and there's not something that's very glaring that would cause it to say hey we need to rush in and inspect and look at um whether the building's unsafe or not um so we're we're very limited in in our process so I'm asking for for your approval to work with the city attorney's office um in the in the coming months to move forward not only for the collection of the leans but to initiate any type of litigation that we may need to do uh to foreclose on the property and potentially uh demolish it which at this point in my personal opinion um I think a empty lot is better than what we have there I I I might add that one of the the uh current code violations that goes directly to some of the issues that we are are discussing here is that uh required 40-year recertification that the building is safe um or otherwise needs to be repaired and uh of course the property owner has taken no action in providing that uh state required report now uh to the city I have a couple questions okay go ahead thank you um so what happens if you don't file that report with the state uh C code findes would begin to start to crew that's what it is is code findes um I remember that they um got permission to demolish a house in eastern Shores and it was about $30,000 at that time we're going back about six years ago s years ago um so if we would push forward to demolish then that would still have to be a lean or what they owe on the land the value of the land the lean wouldn't go away no well I'm just saying I want to find out a million dollars is the lean I'm sure the property's worth more than that on 163rd Street but those leans have to still we have to make sure the value of the land can cover what the what he whoever the owner is owes the city uh correct and because once you demolish it'll just be the value of the land obviously correct uh commissioner and um however the cost uh which would come back to you as a procurement and and so forth the cost of of that demolition would be a hard lean and a hard cost from the city so it it wouldn't be that wouldn't be something we could erase in other words that's the thing I want to address they would have to we cannot negotiate that okay if if I may uh for clarification there's essentially two routes of to proceed and they're not mutually exclusive at this point uh one is to foreclose uh on the existing code enforcement leans uh assuming there are no other uh encumbrance on the property and so subject to the commission's authorization that would be one of the things that would be performed is a what's called an ownership and encumbrance report to find out whether or not there's you know our lean has priority uh or alternatively is to seek injunctive uh relief uh going to the Circuit Court and saying we have these code enforcement orders they're final they're recuring fines the property owner is in non-compliance with our city code it constitutes a nuisance and we're asking the court to um Grant the city injunctive relief uh to either order the property owner to bring the property in compliance or ultimately if appropriate to um give authority to the city to demolish the structure and again place that hard lean on the property okay okay so um do we need to approve it well I guess the I guess the point is you something say go ahead yeah quick question uh is this property does this property have a site plan approved the city um I believe it does but they're quickly running out of time um and I wouldn't give an extension or recommend an extension on that unless that building's completely gone and they've brought everything up um and at this point like like we said earlier there's a lot of I promise I promise but there's zero action so how how long does that s plan approval still have on it the Ty planine approval in question uh what the Ty planine approved at bidy um it was approved in 2015 with an additional update in 2018 uh due to State tolling due to hurricanes as you know uh it extend the timeline there current validity I believe is through 2025 oh however uh we would note that in terms of hard lean cost uh we note 700,000 on this property the one next door uh by the end of this month it's probably going to be about 130,000 and those two property combined constitute the uh the actor development uh I would note that if they don't have money to maintain their property they're not likely to be able to build in fact one of the reasons why we uh looked at of recommending this to the commission is um not only the continue decline but I personally went out the field uh uh and and and we had to do things like remove razor wire we had to remove razor wire from the perimeter of the site that was only held on by a rock and was flapping into the sidewalk before we had staff go out and get cut up entally removing razor wire that would um due to lack of Maintenance by this particular owner um we both of them pardon same owner on both properties yes we understand that the the uh there may be some dispute behind the scenes one the owners had passed away and the item was registered by under gr did research and found that the the the property might go to auction next month so it for us that was like well we need to know where we stand as a city on this because it is a newon property that has decreased uh uh in quality over time I counted the weeks where every week there was another deric vehicle added to the site over the period of five weeks we went from zero to five and a month and a half of deric vehicles on site on top of the track accumulation and so forth it is a new that isn't being Abed thank you okay so I I guess the question is um what's the what's the options to proceed right now I guess I'm asking both of you what we're asking is approval for the city manager's office to work with the city attorney's office um to pursue um um whether it's to initiate a foreclosure foreclosure um or injunction um um relief um whether it's um nuisance litigation or going to Bora or any of those uh will work with this City attorney um so that we can just move something forward and then we would bring back what that process is um and and if we need to um hire any outside Council or what that process may look like we will come back to you but we want to be able to start with your approval start moving forward and and I think your your support also sends a very clear message um to the property owners of the city is tired of the derck property tired of the lip service we want our Community protected and maintained and you're you're on call right okay and and we would ask uh some of the information uh that uh was made available um by staff to us didn't is essentially to extend the authorization to include both properties uh because the item on the agenda is 2151 Northeast 63rd Street we would also ask for the same authorization with respect to 2 2101 Northeast 16 16 63rd Street which is the vacant parcel next door which we already have and we've already gone on and and cleaned up that that lot um a while back and there is a hard lead on that as well okay so you need you need a vote in other words for to to initiate the authorization yes sir yes sir okay all right so we'll entertain a motion move okay we got the motion we got the second all in favor say I what which one what do well the motion is to give the city manager the authority to negotiate getting into either foreclosing or whatever other remedies are at his service for both properties it's one or the other so do you want a direction on one or the other or you want the right to do one or the other that's until we get the authorization from this this commission we don't want to incur the time and expense without knowing to then do the title report so we can determine uh which is the best option uh authoriz to start the process correct right okay all right so all in favor say I I any opposed all right pass it unanimously thank you okay thank you uh second item under the city attorney's report is a commission approval to pay attorney's fees and costs to Brodsky don't ask me to n to pronounce the second part of the law firm's name for Legal Services Pro provid on behalf of commissioner Michael Joseph as prevailing part party under thornber versus City of Fort Walton Beach uh Florida the case citation is there the total amount uh that we have identified and have re uh invoices for uh would be 4759 387 okay um and any background discussion questions I would like him to put on the record what the request is For What would is related to the litigation where um um another commissioner initiated against uh commissioner uh Joseph uh seeking his removal uh from the um uh commission for failure to uh attend I think it's 120 days under the charter um that matter has gone through the litigation the Court ruled in favor of commissioner Joseph that order was appealed to the Third District Court of Appeal the Third District Court of Appeal affirm that and as a result a final judgment has been entered uh affirming the Third District Court of Appeals judgment that um commissioner Joseph is entitled to um stay in his seat as commissioner through the end of his term which I believe is um this November uh and so H he is entitled as the prevailing party and that and that litigation uh the reimbursement of his fees we've done the same thing with several other parties in related litigation and uh as I said said last night and treating everyone equally it's now up to you all to determine uh that he is the prevailing party and to authorize that uh that reimbursement well haven't the courts determined that he's a prevailing party no that's not under thornberg uh you all have to make that determination um if not if if you do not make that determination then he has the right and the final order does give him the authority to seek uh Court ruling to that effect um but in the first instance under the court case it is your determination uh and if you so if you make that determination then there's obviously no need for additional litigation right but he's here so he prevailed in the action it's just not the court hasn't actually he has he has prevailed to date in the matter and so the appropriate thing under the case law is to reimbursement for the attorney's fees and costs that he incurred in defending himself because he was defending himself in his position as a City Commissioner is the case over or is the case still ongoing at this point in time subject to payment of the attorney's fees the case will be disposed of and we're done right okay so do you have a um a recommendation from a legal perspective as to how we should proceed yes sir okay my my recommendation very specifically is to recognize commissioner Joseph as the prevailing party and under the case law that's cited in the uh in the backup material um his entitlement to reimbursement uh and the amount of $ 47,5 n3877 motion okay all right um all in favor say I any opposed okay passes unanimously okay okay and let the record reflect that in accordance with guidance provided by the M Commission on ethics uh before the item was taken up and voted on uh commissioner V Joseph um uh absent himself from the uh de the chambers and he will now then have to um get together with the clerk to file the appropriate disclosure uh paperwork or conflict of interest paperwork okay um he can come back if he wishes okay someone wants to is he I guess he hears us on the speaker so yeah okay perfect all right um 173 I guess yes the I'm not sure how it was how we 173 is I doesn't matter is the 173 or the next item is uh authorization to engage the services of neighbors Giblin and Nickerson uh in particular Miss Valerie V vente to uh uh make sure that she can get paid and to continue to assist the manager and moving forward with the uh negotiation and ultimately presentation to the city commission for a contract uh between the city and the putative uh City attorney uh Mr Geller and his from greenp martyr so moved the second okay all in favor I I any opposed passes unanimously okay 174 that's one uh the last thing is uh you have before you I've tendered um and provided to you all my official resignation letter which um will go into effect at the end of this month um neatly wrapped up so we can then submit our invoices from that point forward um there's obviously a need for additional services to bridge the gap so to speak and so I'm proposing a new engagement letter uh for the city to enter into with my firm to serve so we serve as essentially transition Council or I'm calling as transition Council we're proposing um subject to the city commission approval and negotiation with the manager a flat fee of uh $30,000 um to provide those Gap Services through April 16th which is the date of the next city commission meeting and which at that time uh I would hope that the first item on the agenda after uh uh the invocation the Pledge of Allegiance is the engagement of your new City attorney so he can sit here uh otherwise I won't be here uh and then it will be up to him whether or not he wishes to and his firm to recommend to the city commission for uh our firm to continue on in that capacity which we would do at an hourly rate of $350 an hour for as long needed okay so so what I'm what I'm understanding is is that um your the resignation is effective as of the end of this month correct and week notice huh two weeks notice okay great and then um you mentioned something about 30,000 for another month for uh uh two and a half weeks uh to provide Gap Services because there's no one else um to and and and during that time you'd be providing full services that you typically as usual do as usual yes and then obviously um putting together and working with City staff to um transition and and organize all the materials that will then have to be provided to Mr Geller and his firm uh to come when they come on board uh effective presumably the uh 16th of April then um you know we'll file the the appropriate um uh notices with the court uh transfer the files electronically in paper if that's how how they wish so we're an orderly transition and that's the purpose of those services in in the event that we needed more time for some reason I don't know if we would or wouldn't but in the event we needed more time would there be the opportunity um at that point to negotiate another half month or month or something I and as I said in I would defer to um Mr Geller and and his advice to you all whether or not that would be needed and if yet if that is yes we'd be willing to do so right well because right now the the new contract I don't we don't know exactly the date that the new attorney's contract will be effective well I I I would I would assume what they say that would be as soon as possible so again there's an orderly transition so there isn't a gap in Services okay all right so I just have one quick question Mr Heron yes ma'am if um the the contract still has to be negotiated so if there's a hiccup in that then is there a plan B uh I would continue on at that hourly rate um for as long as the city would need my services right well that's my question was in the event that there was a hiccup and we needed another another half month or month or whatever it was would the would the 30k per half month um things still be we can extend it for another for for those additional um um um two two and a half weeks because I think it's a rather long month the month of April uh on the same terms and conditions so okay we point being is that I'm available if it becomes necessary right okay and otherwise the hourly is really more once the new attorney's in place if there's any need for additional work and thereal work okay yes perhaps it could even be worded that the hourly late rate would only start once there was a new attorney sitting there that that's fine um so what I would suggest um is that you um accept the the general terms and conditions of the new engagement uh authorize the manager to work out the details and we will I'll sign it and it'll be part of the record part of the the minutes and part of the approval okay commissioner John what's the balance left on the particular contract does do we know the money balance the time balance the money balance you mentioned at at the end of the contract you'll then be submitting invoices yes we we would submit you know we submit invoices on a monthly basis um and the current system that we have in place is that we for General Legal Services we um submit an A flat fee uh and then for the hourly work that's been carved out we obviously submit invoices for that that's primarily a litigation matter so we would do that through the end of um this month so um that's why we're proposing that uh the interim City attorney uh designation end at the end of this month because it coincides with the billing cycle um and we would bill in the normal course of business um and um the presumbly get paid and then we provide for those transition Council services thank you Mr manager do you have a balance as it relates to What's Left um not not with me I know on a monthly basis um it's roughly 47 flat fee um the litigation part um I'm not quite sure but we can look um at that and I can email the commission what the pending balance is I believe the check uh for any pending balances um should be done this week as well so I can forward that over to everyone via email the reason that ask is because um the new the new attorney contract would it be based on what's left or would it be based on like the fiscal year um 25 or how would you work that so um we would get into a negotiation with with the new uh City Attorney at the meeting yesterday um it was proferred that it would continue whatever the existing um rate is for this fiscal year uh would continue and then for the new budget year um there may be a a different rate um so we are anticipating that it would be the same for for the remainder of this fiscal year thank you okay so Mr Mayor yes uh real quick is that is that contract coming back to us for ratification yes you would have that in your April um agenda okay so for all intended purposes the start date for um Green Spoon martyr would be the day of the April meeting is that what you're saying that is the anticipation unless there is a way and I would need legal advice um um to have an earlier start date with and then have the contract um be retroactive um to say April 1st for example I'm not sure if if we're able to do that um with um but we can definitely into if you all authorize us to do something yeah the reason I'm asking that is because of of this particular resignation and new engagement letter it's saying that uh effective April 1st is that where that 30,000 comes in correct so after that we would then um bill that flat fee for those two and a half weeks until Mr Geller comes on board right um uh so we're not working under the the you know has the flexibility to negotiate that contract and we will end our existing Financial Arrangement as of as of the end of this month right but in but in a perfect world I would prefer that you stay on the last two weeks and Mr Geller start those last two weeks so that you can Shadow you that that is at the will of the city commission right you okay repeat that again there needs to be an overlap in order that they overlap for two weeks so that the new attorney can work with John and see let John on the way well I I think that's that's in essence what he's saying but on an hourly basis right well from what I understand that if we can reach an accommodation on a flat fee and the extension of the flat fee we'll do so in lie of the uh of the uh hourly rate I either way we're flexible um and so that was what my comment was is to um uh accept the resignation and authorize uh the manager to work with me uh on um the finalization of the new engagement letter uh to reflect that overlap no that flat fee the 30,000 flat fee is more than your prior rate or your normal rate right it well my my estimation is that that we would be taking care of everything and so um and transitioning over the litigation so that would be included point being is that I think that's a fair and and Equitable manner in which to um cover that Gap right uh of past the end of this month uh until Mr Geller and his firm are up to speed or the city Staff feel feels that they're up to speed so um you know and and again I I want to um you know defer to Mr Geller as the new City attorney his his comfort level of us continuing on um we're willing to do that but I I think that he at that point in time would potentially have a say in in that well another another question is is that um there's apparently there's some cases that you are in the middle of there's some litigation ongoing that you're doing that's above and beyond the let's say the base contract right there's some other cases that your firm not necessar our fir is is handling um you know city is self-insured so um all the uh tort litigation um that the city um that's filed against the city where the city's as a defendant we're handling those matters we would sit down during this transition period with Mr Geller and his firm and decide what if any of that work we were potentially to keep I don't anticipate that that there would be much but the what we're proposing would give the city the flexibility uh to do that right right right okay I mean it's a possibility that if it was going to be something that was going to be additional or outsourced anyway then you know there'd be no reason not to continue is the rate what is the rate that you're charging for that additional 275 an hour okay so in the event that we were to have you continue the litigations that you're already doing would that still be at that 275 an hour or is that going to flip now to the 350 that would go to the 350 okay um Mr manager you you heard all that right just so you know for your okay okay so Mr manager I'm sorry but there may be negotiation possibilities there too did you say that we're fle that flexible screen spoon mortar will will do the same rate or you're hoping they'll do the same rate um I Mr um he said okay he said it okay I wasn't sure I wasn't question is that would continue this fiscal year at the state rate because we've already budgeted for that and so not to create any kind of chaos within the budget so the question is is it wrong of us to now at this time to accept it yeah can can can we accept it now accept what his Services already in existence like yeah all you doing is well we don't have an agreement certain terms I mean we're we're essentially accepting um the the rate per se but that is only through September right and so we'd have to see what type if any increases would happen um as of October 1st um and if there's any other type of other um Provisions within the agreement terms and conditions that that you would have to so I don't feel comfortable um you all approving an agreement that no one's seen we don't know what the agreement is we can't no I I I don't agree but there's a thought are we still in the cone no well well yes according to Shere you remember right we we went back I just want to know because I don't because I was like wait are we no we're all in violation right that's why that's why we're really that's why we're really trying thank you Mr attorney no no no because that's why we're not talking about the new we're not talking about the new contract we're talking about the old deal no no I understand that but talking about the new cont well you guys started doing that I don't think we no we're losing focus but no one stopped us all right so so you confused me no what commission as your still interim City attorney I it is my recommendation that you refrain from any discussions any interactions with regard to the new contract with Mr Geller and his firm um and until there is a proposed contract before you for your you to consider that's I just wanted to be because I was like whoa something clicked in my mind I'm glad to click just mention when we were doing the additions uh and that is need direction from this commission uh to convey to our outside Council uh consistent with the uh conversation that took place in the shade legislation No 9 huh 9.3 okay it was pulled from consent okay now we're going to we're doing 9.3 again hang on all right so 9 93 came off of the consent and it's going to be just heard his legislation okay all right so 93 is going to be the first one um well I guess we need a motion and second to introduce the item I make the motion second okay and um Mr Mayor it's item um 9.3 on the agenda resolution number r202 24-39 a resolution of the mayor and City Commission of the city of North Miami Beach Florida approving a task order for Engineering Services for the project management of a Charlie route optimization study in an estimated amount of $17,300 under the continuing Services agreement with Tren Mor Associates professional consulting services and authorizing city manager doign need to do all things necessary to effectuate this resolution providing for conflicts providing for scre errors providing for severability and providing for an effective date okay thank you all right so um any uh comment from the commission Mr TR I have a problem with doing a task force to do the trolley right now when we should be doing a workshop with all of us because like me I'm here since November I don't know much about the trolley I'd like to learn a lot more and understand it a lot more um and I don't see us spending $107,000 for a task force okay mayor U before before commission gets into discussion it it may be good for staff to present the item be a very good idea what the request is thank you okay go ahead good evening mayor Commissioners staff I have for you a presentation on our NMB line you thought you did um I have for you a brief history of the of the beline uh if you recall September 2015 uh we provider schedule perfect thank you um we provide a scheduled circulator uh Bus Service Catering the residents uh operating from 8:30 to 448 p.m. the route commenced at the inter Coastal Mall and proceeds uh Westward to Walmart on 163rd Street um on April 9th 2017 the inauguration of the n&b line uh was serviced serviced by previous vendor uh provided a free public transportation service that operated 12 hours a day and 6 days a week um we we um during this time wrers ship had more than tripled from the prated basis from 37,000 rights recorded through the quarter four which was in December 2017 we installed a security additional measures or what they called Panic buttons for additional security and enhancements um April 6 2020 we launched the service of um routes D1 and D2 which is the the last route that we added in that provided two circulators um this was a significant expansion because it launched two extra trolleys and notably it stands out because there's a 30-minute turnaround um despite a temporary decline in ridership attributed to the global covid pandemic um the ridership still continue to 79,81 Riders April 8th 2021 uh prot Transportation or Procol proel was awarded the contract to our operate D&B line Pro car is our current operator October 24 2022 um the city launched the most recent route surfacing Avent T Mall Golden Glades inter change um this uh service this northeast regional service um connects the mamid Transportation Hub as well as the fourth largest shopping mall in the in the Americas route e is consistently maintains monthly rouers ships exceeding uh 2,000 20 I'm sorry yes 2,000 passengers rter ship for fisal year 22 October 1st automatic passengers counter were installed uh the current contract expires April 24th of this month this year the contract with prot transportation is up for Renewal the original contract provided an initial three-year term with two options for oneyear renewal each um I mentioned the the um scorecard here I'm sharing the scorecard for all the regional all the municipali in Miami day County and if you noticed uh North Miami Beach has a toal of um if I scroll here uh we what this rers ship it identifies is that at the time for fiscal year it identifies $12.75 $12.58 I'm sorry uh compared so that is the cost per rider for the system you you're able to compare the the cost the rates for the rest of the municipalities which vary throughout but we're assistant 2023 Mobility scorecard um in the assessment of wrers ship across the municipalities Factor such as the city's geographical area population location careful were careful considered uh notably nor beach has demonstrated a noteworthy achievements by sustaining a ridership level that is double that of comparable cities with a frequency higher than most municipalities um where able to keep track of the trolley live track the trollies are available to track via applications on a bobile device or computers with TSO mobile the application is free everyone for free for everyone to use and provides real time location and estimated time of arrival our website is identified briefly going through our routes route a which provides transportation services to the inter Coastal Mall that I mentioned uh convenient transfer point to the son Al Beach shuttle the route also encompasses key destinations S as the Stratford house apartment the United States Postal Service the North May Beach Public Library Walmart the North May Beach City Hall Victory pool uh notably the route maintains an average turnaround time of 1.5 hours ensuring efficient and reliable transportation for passengers this is a map of Route a route B which compr it's a comprehensive transportation service connecting very significant locations along its route which include Walmart greos Park Elementary School the shops at Sky leak the city hall Victory pool the Spanish Monastery the North May Beach Public Library uh notably the rout maintains a commendable average turnaround time of 1 hour and 15 minutes 1.25 1.15 ensuring Swift and reliable transportation for passengers this is a brief this is a map of Route B which is a more centralized our City route C serves key locations including Walmart 44 elementary Allen Park Florida International University North Campus with transfers available to the north Miami and to North Miami via the Nomi bising Commons Highland Village Washington Park this rout maintains an efficient average turnaround time of 1 hour ensuring timely RAB about transportations this is a map of Route SE which incorporates our Central and the southing and the Easter most portions route D1 and D2 this route is uh the North East Regional route which as I mentioned previously it includes North Miami Beach High School John F Kennedy Middle School Sable Palm Elementary School Allen Park which provide services to full for elementary school and Beth high high school oako Park ulita Park Community Center currently rout d stands as the sole trolley service that accesses the majority of our local schools rout D features an efficient Turnal time of only 30 minutes the this ensures a prompt and secure ation for our younger residents allowing them to reach their na safely and punctually as you can see this is the route to service this is the map that I'm showing of Route D1 and D2 route e which is a comprehensive service includes the Golden Glades interchange Jackson North Jefferson Plaza Walmart City Hall Spanish monaster aventur Mall it connects to Miami day bus services aventur shuttle Sunny Al Beach shuttle this route is designed for a 2our turnaround this is a map of our regional route it extends the furthest west and the furthest Northeast to the mall Crossing 163rd Street and and 171st Street 172nd Street and North to bisc Boulevard um the wrers ship within the year um going back as uh from between October to December we're at 39,380 and the current 32,000 3264 we're at a the residents are able wrers residents and writers are able to identify the round with their bright colored signs identifying the rout the stop information for residents what we have for you today is a route and stop optimization study the city will be conducting a 16we transportation study using one of our continuing service Consultants Chen Mor and Associates their first task is to obtain data gather and research rout Maps Charly cycle data writers ship information provided by the city collected organized and analyze determined Trends and patterns within the data set Consultants will undergo a grassroot effort to conduct interviews with n&b line writers as part of the the data Gathering and research Consultants will visit existing trolley stop locations at various times of day at for each route Peak and off peak times will we observed and gather a deep understanding of popular Origins and destination information cu will also work with the city to review proposed zoning and Redevelopment plans what future buildings will provide rouers ship for the purpose of pre-planning modifications to the trolley task two route and stop oranization alternative development consultant will develop multiple alternatives for the Stop optimization based on the observations made regarding the writers ship data uh these Alternatives may include route reconfiguration adjusting of times when one or more Charlies are running on a given route and potential for individually trolley servicing multiple routes these Alternatives could include the elimination of an existing Trolley Stop should wrers ship data reveal under under or if they're under utilized additional stops and or routes may be considered as well based on projected development within the city thank you Sam you're um commissioner uh mayor vice mayor and commission essentially one of the topics that we've been having um both here and and and individually has been are we optimizing our routes um as best as possible do we have the right amount of stops each one of our routes has about seven different stops do they each need seven maybe some of them need six some might need two this is the study and these are the expertise to be able to identify that information and to be able to say you don't need this route to go into these areas you can eliminate these two stops because this other route picks that up and you that's what the purpose of this task order is for it's to be able to do that this is not something that um the city has staff um whether from capacity or from an expert T side to be able to do in-house um so when we're talking about how do we make the routes more efficient how do we know if we have enough stops or less stops how do we know that we need five routes this is what kind of gets us to that to those recommendations um and that is why staff has brought this forward uh forward to you all uh so that we can do the necessary um um study and bring that uh forward for your consideration okay all right so I guess um back to uh commission anyone has questions Mr Mayor we have a public comment first okay yeah I'm a little out of whack because it was on the consent agenda and now we're bringing it back to a regular item so I'm you know okay problem all right hey we're we're making we're making it happen it's all good not okay now respectfully okay sorry um I was going to kind of wait till you had some discussion here um Bruce lamberto um 3420 Northeast 165 Street I heard the manager uh give us eloquent speech on why we need this we have a full-time trolley coordinator Mr manager is that correct Stephanie she's full-time with the yes sir trolley coordinator we have a full-time staff member her job is to coordinate the trolleys and um I would suggest again we try to start doing some stuff here inous you know we have she's very qualified very eloquent and maybe she can determine whether we need two stops or five stops or why don't we try that first why do we always go to these consultants and pay this exorb amount of money that for for stuff that gets maybe used maybe not used I mean again look at what 107,000 would buy for our city three police cars three pickup trucks for Public Works new playground for Eastern Shores that the people have been wanting for years you know this is where where we can allocate our funds can do things here a little differently and again I'm not so sure what this optimization that's going to go on with Metro day transit you heard the lady here talking about it tonight it's about ready to start do you want to do a a Consulting study right now during this transition period which may change the routes that they're going to be doing so we may be doing a a a study on a route that's may disappear because the the Metro Dade route may take it over so I would at the very least table this for tonight this this study see how it goes and then even on your your trolley that's another I guess we'll speak on that later on the trolley extension but that's another thing that should maybe go month to month based on what happens with this uh interface with Metro day transit but the biggest item here is is that you received that report from Metro uh Miami Miami Transit Authority and it talked about and he quoted all this except he left out page 17 which tells you if your ridership is over $10 an hour you might as well do away with it because it's too expensive and you're not getting the ridership that you should have so uh for some reason that that page was not given to you guys which is the analysis and conclusion of the report which is kind of misleading that should you should have gotten that um and just again this is taxpayer money you know let's do something for our residents instead of our Consultants all the time you know let's um let's focus our money where where it needs to be spent thank you very much okay thank you any other speakers good evening Kelly Gonzalez procal Mobility um well um you know I'm Kelly the CEO of procal mobility and owner uh our team was here for an interview earlier today and luckily they were able to come this is Mitch fer and Ed Eduardo Carion our coo and our vice president of operations um you know just to the north Miami beach trolley is the heart and soul of our company and also of the operation if you look at that Charlie that study that was done by the trans Transit Alliance our just how the city stated our operations and the amount of passengers we pick up is in line with all of the cities that are our size for example we pick up 10,000 more passengers than um the city of Miami Gardens um you know our we our passenger the cost per person is about $12 as you heard earlier today when they was talking about the average trip for Uber was $20 um you know I and a Charley for 12 for for you could pick somebody up for $12 uh per person and you can multiply that by to 26 people at a time so the Charlie surf the Charlie service is very efficient you know as you saw in the numbers um it's it's multiplying it's increasing and that Transit Alliance the only thing that was um the only thing that was read when they did the study was the GPS tractor the city worked hard they got the GPS tractors fixed one of the things that the commission um ad wanted when we first started the service we were using clickers there's automatic passenger counters in the vehicle that our firm installed at no cost to the city when somebody goes in goes out it collects the data the service is so good here that when we first started this trolley contract we only had three we only had two contracts in our company in the past three years year was we're in 13 cities also doing the sfrta that covers all 75 miles cter from Miami all the way to West Palm Beach supplying the trial Hollywood Airport Services in um Oella County duva County um Palm Beach County and recently um Broward County so just to you know I I I hear a lot of you know comments about the the trolley service and we always invited we get together with the city to try to improve the service very proud to do the work here very proud to work with the city we're here for all suggestions I think this is a great idea to get the experts cuz we you know even though we do have a planning side getting somebody that could plan for it and we operate it so I just wanted to come up and just you know thank you for the um opportunity for allowing us to do the service and just wanted to introduce our team that's here today and we're here to answer any questions you might have okay thank you any other speakers okay let the record reflect notes come forward and the uh public comment is closed and now it's time to go to Commissioners commissioner Smith thank you being as I pulled this nothing else from you at the moment right U just to clarify um mayor Commissioners um there was a a lot of misstatements incorrect statements that were said previously but um what I if if it is able to help me share my screen the 2023 Mobility scorecard that the municipalities in Dade County uh show what you see here even though it's smaller uh writing but you have in your package is 26 municipalities out of those 26 municipalities 16 of them are over $10 per Rider it's a fact is a black and white is the actual cost every municipality shares or or or information with the county my date uh Public Public Work Transportation um Citizens Independent Transportation trust so what the agency does is they monitor the funds that we spend all the data that we provide to them is actual accurate um so that's 61.5% of the municipalities or over the $10 we're only $12.58 you have municipalities that are $27 per writer you have municipalities that are $78 per writer so just to to make sure that you understand that where the that come froms and how is it validated and who is all reporting agency which is the County Citizens Independent Transportation trust thank you Sam and and to further clarify um the recommendation um that was mentioned um in the report is that if a um a trolley service essentially is over $10 per writer um that it should not serve as the exclusive local service um and it's not the exclusive local Service uh we have on demand Service as well and we recently received the DT Grant uh which should be funded in this upcoming State um year to double the size of on demand service okay okay so I want to before I start I want to ask when the trolley started how would the routes at that time established how did we establish the routes then um I don't have that information with with me uh tonight commissioner but I'll be able to provide that for you on give me one second yeah good evening Commissioners uh I can answer that because I what the consultant who created the uh trolley route in the first place um we had established to what we call a comprehensive operational analysis back starting in 2015 as a study uh the same type of study that you see being asked permission to uh to for for a work order tonight it's important that these type of studies exist because you need to uh look at your origin and destinations and how you are actually going to be able to move people from day getting their health to their Walmart and to align their root and appropriate manner what this type of study does and how we established that was um we did a study with look at where your anchors are where your captal are and look at the spread to say hey this is how we're going to be able to connect people but that's the story of the trolley right um what uh you see before you evening is very very standard uh is no different than any comprehensive operation analysis I would note that at at the industry standard you should be conducting these approximately every four to 5 years we're in about year seven uh so we're a little behind the ball on that one all right well thank you very much Mr n um there's a few things that I found to be a skew um watching the Monitor and watching the presentation for instance uh in eastern Shores and the condo side there's two streets at the trolley rides down on the north of 165th I don't know why it doesn't ride down all the streets especially is the last street is the one that has has the most activity on it 171st um but uh and you know in the presentation we go to FIU which I understand takes our residents there we go to Walmart which I understand takes our residence there we go to Sky Lake Mall which I understand takes our residence there I saw them stop at Fresh Market on biscane Boulevard which and go to aventur mall all these places are outside of North Miami Beach so I understand how they take the the trolley takes people from our city to there but when you're picking people up at the bus terminal in the county and the bus terminal people come from downtown and they go from there to aventur mall they're not our people I've had this discussion with the manager I've had the discussion too many times but specifically in reference to this which I am voting against it 110% um if you actually look at what their scope is if anybody read what their scope is they're going to check proposed redevelopments well that changes constantly if you're going to do a study every five years there could be seven new developments there could be 20 new developments I like the plan very much that they have in place but the project does not include any final Design Services so that's interesting they're going to do the study but they're not going to give you a final design um they're going to check the street lighting analysis uh time changes uh they're not going to check this tree it's not included in the proposal but there's time changes and that might be something that should be included so the study to me needs to be revamped number one number two it's a it's a amazing they're going to put somebody at the bus stops they're going to charge us $2,400 to do that that's so interesting how are they going to do an analysis without putting somebody at the bus stops but but besides all that it's a 16- week study and we're asking for one-ear extension so if the study finds things that need to be changed we have a one it doesn't even coordinate date wise it doesn't even coordinate what we're doing on the scale and I too am getting very Leery and I understand it I understand the manager's thoughts that he needs backing and teeth if somebody comes up against we're doing but I think we have to be afraid stop being afraid of people backing coming after us and stop spending so much money on Consultants we have more employees than we've ever had in the 15 years I've been here we don't I mean you could hire elderly people first that would could use the money or students that could use the money and let them start to ride the bus I walk in eastern Shores and I've been diligent about my walk I've taken pictures of the bus today I saw one person again one the most I've ever seen is once I saw three so maybe that route needs to be every three hours every four hours and it needs to be moved not to say that they don't need a ride from wind Dixie with their groceries back to their condo but we don't need to have it on a constant basis I I just I am I I looked at what their scope was I looked at the amount of money it is and I looked at the trolley with the ridership that we have are there other avenues if we're taking students did anybody contact the school to see what's the distance that the schools required to deliver and pick up children because maybe the school should be picking children up from Highland Village or from Washington Park maybe the school board um no I I'm I'm afraid for this particular uh resolution that you brought before me I have to be a no vote and I hope my colleagues will really pay attention uh commissioner chernoff I didn't think of having a workshop on this but I totally Concur and I thank you for bringing that up I think we should before we spend more money on a trolley that may be in some areas is is not enough and in other areas it's too much we should really sit down as a as a board and say what are we looking for because maybe this $107 should be for two more freebies so that a freebie could be on a Saturday afternoon or Saturday morning they don't start till 1 or freebie could be on a Sunday so I think that we need to every municipality needs transportation that goes without saying public transportation on the responsibility of us as municipality is a definite yes but we need to do it with prudence and with the best advantage to our residents without spending our tax dollars for somebody that lives in another city I love that our residents can go to aventur mall but I think aventur Mall should participate so the study itself is what we're talking about and I find the scope of the study needs to be tweaked and I find that we should try a few other avenues before we spend $107,000 thank you very much thank you vice mayor smuckler okay okay thank you um commissioner Smith so Highland Village is too close to the school so they don't get a bus I do thank you okay so um to the manager one of the heavy Travelers by the way that we we might need to expand right so to the manager so if we were to let's say vote against this um study but we were to vote for the trolley what happens service continues um as it is uh we continue to work with Miami Dade um Transit um this would kind of be in line with their their study and we would continue to coordinate but if the study doesn't move forward um and and you do move the extension forward then the routes continue as they are we're we're seeing about almost 11 and a half 12,000 Riders per month um on our trolley service right um different times of day we we operate um um throughout most of the day so different times are and different routes will have more at one point than than others but you know the the least used route um is is D2 and that has over, 1500 um so you know I I guess it just kind of depends on on what the commission deems is successful you're never going to reach the numbers that South uh Beach or or Miami Beach or the city of Miami has they have over 10 million uh tourists a year um it's it's unrealistic to compare us to them they also have double the size of residents that we have in a in a much denser area um so it just kind of depends on on what the expectation of this commission is if we're looking um for for the study to identify um alternative routes and stops um through throughout the routes which is what task two gives us within this um task um um order um then this is the right way to do it this is the standard practice um and and the best practice of what we do and why we do um these are you know we don't have the expertise in housee even though we do have um um an amazing coordinator uh we don't have the expertise in housee to do a planning study um on the routes all right thank thank you all right thank you so um I don't know where to begin I don't know where to begin but um I guess I'll start with um making some comparisons for example um I mean I have I have different degrees in different um disciplines right um a paralal cannot do what the attorney is doing our attorney is doing um don't paralal but what I'm saying is there's always a degree of expertise that comes with our Prof our different professions so if you want to do a workshop then we would need all of the routes all of the stops from what what's the operating hours of the trolley 7:30 to 7:30 okay that's a nurse's shift so 7:30 to 7:30 you know we can all split come into in our summer gear for the next 16 weeks you know plot out the the 20 or so stops and have our little clipboards or our Excel sheets and do the work ourselves right and so I think when we talk about engineers or the minds that come up with these different patterns I'm not saying that we need to spend 100,000 um but like Mr Nick said um we're about two years behind right as it relates to the the last study so Mr Herring I don't mean to pick on you but I'm I am so for the level of his expertise and his firm's expertise he's asking for 30,000 for 2 weeks and for the amount of work that he he and his team does um we're going to honor that so when you think about 16 weeks and 100,000 um we can come here and plot the the map for 16 however much weeks what I'm saying is I'm not saying I'm for or against it what I am saying is this is something that's more technical than might than we may seem to understand that it is so um is Chen Moore here Chen Moore is not okay but thank you for um commissioner thank you for mentioning one thing very important state law prohibits Engineers from performing practices outside of their expertise a structure engineer cannot perform an electrical engineer's job a a civil engineer cannot perform a transportation engineer's job um our professions is is is closely monitored by the state and protected um we have great staff they're great staff we do not have professionals engineers in our staff we do not have Transit engineers in our staff we're going to have analysts that will be able to perform these type of studies these are the we are Regional Transit provider our writers depend on our level of service right we writers depend on our service if we're the county just made some drastic changes to their service which affects our residents our system what we through your through your leadership we hope to accentuate and to modify to better service of residents um if um for some reason it you do not approve the study now then our our our routes will not change drastically because we don't have the expertise to do so in- house um we will continue to meet with the county better was Network we will continue meet to meet with or uh Jason municipalities but the professional tasks the professional jobs that that's required are from a consultant's Engineers point of view and thank you for that and the last point I wanted to make is for example Eastern Shores um commissioner Smith mentioned that the current route might not go to the end of where a heavier population is right so in essence um we all have our input so you know that would Merit a Workshop but at the same time if we're really going to Workshop it we would need Maps we would need time we would need so many different things to really make a fair analysis because we're not technically in the field you know I'm not for or against the the study itself but we can still continue to do an Antiquated routes and then pay for a service that seemingly people feel like it's not NE it's not needed in our city but I think whether we approve the trolley's extension or not it's something that we need for the sake of the residents of the city thank you okay yes commission Joseph well for for me I know that um Comm Smith brought up the fact of how do we know um the the if our residents are really utilizing the transportation services that we have you know unless we are you know iding we don't do that with freebie we don't do that with or with the TRU probably so if you if you if you're in the vicinity in um North May beach and you and you have the Freebie app you don't necessarily have to be a resident to use it you don't you don't have to be a resident to use you don't have to be a resident to use freebie in North Miami Beach no it it it no it would be no you don't have to it you just have to be you just have to have oh yeah you have to take it in the city yeah I my brain didn't calculate you know you have to take it in the city and they're working in a way that you could do like transfers like certain spots like it'll take you to a certain line where aventur connects and then you would have to then switch over um yeah that's that's being worked on yeah and then you could transfer over the the other the other issue like and I look um you know I was one of the proponents at freebie like just like and I know we got we you know the commission voted for it and what have you and it you know the service qu you know the services that we offer all kind of complement each other and they have to be seen as a whole ISC canot just as a surgical solution to solving our traffic situation um and our transportation services so um one big part like I see it as a as a working vascular system heartwise I know I'm an attorney but you have to see like certain things do certain do certain things like mass transit or or in regards from a trol can pick so many people up it's the most basic type of Transportation when it comes to that last mile or doorstep you have the freebie option so it's like you know to make another comparison like an army you have your aircraft carrier you have your jets you have your your your amphibious vehicles these they all play a part to actually doing the the the the most effective job and if you take one from one part or whatever it makes you less effective in really providing the services to the community that they're expecting also we have a digital divide and that's why you can't really rely on just the trolley doing it and and or or just freebie doing it because at the end9 can have have the access to a phone or to just be able to monitor uh um um what the current conditions of freebi and from my understanding freebie has a wait time in almost like 35 45 50 minutes one hour right now 1 hour because and I'm it shows that there's a great need for it and i' and I see it a lot in the city it makes me very happy like I said you know I really push for it I'm glad at it's being worked and we're the first city then you had North Miami following suit or whatever we're supposed to be ahead of Aventura but it got delayed but eventually like it's it's really flourish in our city um but uh to to my U for me to end at on this point is that you know we have to see it as as a collective approach a holistic approach of really providing quality transportation service in our city makes us more Mo it makes us more uh create Mobility for our residents uh it makes us more attractive to people that want actually you know you know um I guess interact with our community our businesses and but you don't necessar have to be a resident to actually use it and um we just have to keep that in mind um you know it would be nice we can card everybody but I don't think it'll be conducive to really uh um you know being as connected as we could be thank you okay on thank you so much Mr Mayor you know when um when I think about that half penny tax um if we were to if if the county were to say we're going going to you know give you a particular amount based on you know what we you know assume or or maybe if I'm if correct me if I'm wrong but this half penny tax how is it delivered to our city how is it delivered specifically to our city how does the county determine the amount that we receive it's based on uh population and then we're required to use um 20 minimum 20% % towards transit services um and then um the remaining 80% we can use towards transport Transportation um type of projects however the goal for CIT is not to have just a minimum 20% Transit they'd actually prefer to see 100% goes towards uh transit services we are over the 20% uh because we do offer both the trolley and the um and the freebie um services is that percentage Sam do you know what percentage we're at uh for usage uh give me one second I have it here percent of writers ships or percent of of funding for CIT how much are we using towards transit services versus um yes so we we have um approximately for uh the first quarter report of fiscal year 2324 we have the projected Short tax distribution of $2.8 million and the percent of and Transit give me one second MAA apologize for that you should walk around with the Tex instruments there should be a column on there that that tells you what your percentage yes give me one second didn't print out completely but it's a very it's it's a small amount in comparison to the total amount that we receive um I think we're over the 20% um our our over 26 26% 26% okay so 75% are used on non-transportation related things but transit services it's still um we use it for infrastructure type projects that are related to transport correct correct but as far as trolley or those types of things 26 the 26% goes to that and I appreciate that information um so so the point is the point of asking the question is that you know the county gives us a certain amount of money right and they tell us do your part for the aggregate concern of Transportation in the county right and the aggregate that word is really what we need to focus on because our role is not only for the residents of north Miami beach but it's to help in the connectivity of the entire County of the entire County that's why the count is remitting These funds to the cities so that they can participate in the overall aggregate solution of Transportation issues in the county so whether the person is from North Miami Beach or whether they're from North Miami or whether they're from Miami Gardens if they come through our city they need to have a good experience with the transit system while they're in North Miami Beach and part of of that is The Trolley system part of that is The Trolley system and I've written the trolley now you know whenever I get on the trolley it's always full right um now it may it may be that you know I'm writing in the area of city hall or I'm riding by the schools um but the amount of activity that I see on these trolleys and also you have to you have to know that there's different times when there's Peaks right there es and flows as it relates to the ridership so if you're not waking up at 7:30 in the morning to or 6:30 in the morning um so that you can be at that stop by 7:30 right because you're going to school uh and the bell rings at 8 right or you're going to work and you got to be there at 9:00 so you need to be on that 7:30 trolley chances are you're not going to see that high ridership that happens around that time if you get on at 12: in the afternoon then chances are you're not going to see that high ridership in even the areas that experience the most Riders right because it happens at particular times when school lets out I'm sure that there's no place to put uh Riders on these uh trolley because that's when the increases happen so I heard from the uh representative from Miami day County about the better bus Network um the based on what she said while they are working with municipalities the responsibility of the trolley service and the optimization of the trolley service is the responsibility of the city so we can't wait on them to figure out what we're going to do here our goal is to make sure that while people are in our city while they're visiting our city while they're driving through through our city whether it's you know using a um vehicle to go through our city or whether it's using a trolley to go through our city or whether it's a resident that's going from their home to a location within our city and back everyone needs to have a good experience and a timely experience um and so when it comes to the trolley there's no doubt in my mind that this is an important service there's no doubt in my mind that this is an important service I see it every single day children rely on it parents rely on it with the influx of of people moving into our city um you know from the the southernmost parts of the county or the central part of the county that's more expensive and people are coming into our municipality to try to save money right as hard as that is to believe people come here to North Miami Beach to try to find more affordable rents right um and so what I'm starting to see are a lot more people using the electric bikes a lot more people using the um the uh scooters right and a lot more people using the trolleys and a lot more people biking right because those are some of the most affordable ways to get around those are the most affordable ways to get around okay oh so commissioner Jean is saying to reel it in um I'm very passionate about this I know you're a transportation one that was going to offici finish the meeting early remember your I said I did say I was going to finish the meeting early oh you're right wow okay so you remember that okay that was a couple hours ago when I said that but you remember anyways the importance of the trolley we can't we can't negotiate it we can't negotiate it because at the end of the day we saw what happened to better bus Network right they did it from you know their offices and looking at data and different things that they thought would work right and they removed routes and when they removed routes the people suffered right so for the trolley I think the solution is that we need to continue with the trolley service we need to optimize it by providing people more options okay and more ability to be able to find the service of the trolley where and when they need it and I think the best way for us to do that is through this um this agreement because everything I'm hearing up here is how do we better uh uh provide a service and we're not the experts and you're saying that you're not the expert we need the experts to tell us what to do and so I support it as well as expanding that contract thank you so much okay thank you Mr trff yeah um I would like to propose that we table it and move it to later when we had just had the county here telling us that they're changing their routes to coincide with what we were complaining about and if they do that then it's going to change the ridership so why don't we wait till the county does I'll what they're doing I'll second that resp can I respond to them and and I just wanted to say one thing um I am definitely for the trolley we need the trolley don't misinterpret my conversation we need the trolley but we may need three rout three trolleys on one route and a trolley every 4 hours instead of every hour and 15 minutes on a different route because under be known to you I do walk at 7:30 in the morning and I do walk at 3:30 in the afternoon when the bus comes home and there are no kids riding the trolley and nor and where that section I'm not saying that that that that trolley that is imperative that's a major part of our transport for our residents and our businesses no question about it but I'm just saying to regulate it in the right way and if we're going to hire outside Council let's get the the let's get the agreement to an agreement that in the end we have all at least as many answers as we can have this agreement that I looked at was lacking but I concur that and I know you want to speak about it I definitely concur that if we table it maybe we could get some more answers all right one one uh one other question is is that um Mr manager with this study um did what was the procurement process for coming up with $117,000 number we have a poll of um and I can have our our director uh speak if if need be but we have a poll of um Professional Services for engineering uh services and so we went through um and and reached out to to the vendors that would be able to qualify for this type of work and uh negotiated the contract okay so um I guess the question is is at how many when should you put it out for bid how many no we have a pool um so the way the Pool Works is you already have um a a procurement that's in place and then you qualify X number of um Consultants so as the work comes up that is needed then instead of going out to an individual procurement every single time you go to that group of um vendors and you negotiate that that work order for them and you have to do it in a certain way so that the work is distributed among the entire not just oh we're just going to give it to one vendor so how many so so how do we know that there's not someone out there that's the same qualification that could do it for 50 Grand do we know that I don't know if theur manager needs to talk about that or I just want I don't understand the process I'm just trying to get a handle on on that we have a a pool mayor I yeah we approved that poll did we not we approved the pools for all of the categories um good evening um the CCNA uh the con the Consultants negotiation act um that is a pool where um several Consultants come and they're uh qualified based on their level of their um industry of expertise so he earlier he mentioned about different engineers and different uh disciplines that's how they're qualified so for instance for this one he may have gone out to that list that we actually added new uh Consultants to last year um and asked for someone to do a transportation study so he would look on that list for the one that had the transportation disciplines and then go out to them um those rates those hourly rates are um industry Market rates that pretty much are the same along this across the board um often times they may be um you know 20 bucks off you know give or take but their industry um professionals with Market rates and the proc is spelled out by State Statute of of how those pools are created y so there wouldn't be anybody out there to do it for half the price so if I may the the the selection of the Consultants uh that create this pool is through a process under state law it's called the Consultants competitive negotiation act you are you are specifically prohibited under state law from looking at Price uh in the selection of the uh firms that ultimately get continuing Services contracts you're prohibited so what as the manager indicated what happens is that you you get you seek as many as possible uh of the qualified of for each area of expertise uh and so we may have four engineering firms that do um uh um engineering studies we may have three who do um traffic uh we may have six that do uh Structural Engineering a and so you then go to those in that category and you say you know and you look at their qualifications you determine who you believe is to be the best uh within that those those categories and then you enter in negotiations for that specific task order at that point you're able to consider in theory price but only for those who you've already selected you can't go outside the pool um and seek other bids or other proposals outside of the formal process established for every County every municipality that has to follow the CCNA Mr attorney can't be bid against each other yes how many do we have in this category um I would have to pull that list to find out but we have um several consultant firms over 40 I believe so I would I would have to look at that but like they can't be bid against each other so you know and we select them the department select them based on either past experience or you know their portfolio similar work so you have to go to one vendor one consultant tell them what you want to do you know talk to them they give you a price based on their hourly or what that work entails if you're not you can negotiate that if you're not happy with them then you would have to move to another but they cannot be bit against each other that is prohibited okay so we have um uh a motion in a second to we have mtion can I call the questioned right to table was that the yeah the motion was to table so motion the second cler you got that I just called the question tce right EXC Beyond any additional discussion this point in time you have to vote on the motion that's on the table okay all right so I'm all in favor of tbling this say I hi okay so who said I okay and um who's opposed any post 3 question well what I would like is once the county study comes out then we find out out what Roots they're either giving us back or what they're doing cuz they're they indicate that they're doing something for us if I understood what they said today I I I just think we need do I think we need to get a little more clarification I think we need to also find out how the changes in the in the metro day bus route might affect it also so that we don't do a study and then it get skewed by whatever they change their routes with because a lot of what they were saying was intera with their routes yes sir uh mayor just to clarify the what the better bu network does is they perform op the optimize their service every three months is what Miss Miss Linda uh explained to us so they year every correct three times a year quarterly so so what what the department does is they look at the the the the writers ship to perform this changes very often we don't have that money I would not come to you or make through the manager of course make that recommendation for us to perform that same level of of service what we what you already tabled was a one time every seven years study yeah but we're here for your for your service we're yeah roughly a month that's all I'm asking for well work with Miami we'll work with Miami day transit and and bring it back thank you right and so since we're talking about the trolley can we just go to the trolley ordinance or yeah I agree with that you want do you want to take the Trever it is okay all right so with that being said um Madam clerk is there any issue with um taking the item out of order no shouldn't be just check just I want to find out afterwards it's a problem what is the item number on that uh oh sorry it's the um 11.7 117 hang on okay on second move to introduce second second okay and then can you read the title Please Mr Mayor members the commission this is uh uh item 11.1 on the agenda ordinance number 2023 s seven oh I'm points uh resolution number R uh 202 24-44 entitled resolution of the mayor and City Commission of the city of North Miami Beach Florida approving and authorizing a one-year contract renewal to the previously approved contract with prot Transportation Inc DBA pral Mobility for the provision of trolley operations maintenance services an estimated annual budget amount of1 1,925 688 and authorizing city manager design need to do all things necessary to effectuate this resolution providing for conflicts providing for scrier errors providing for cability and providing for an effective date so you need a motion to approve or no we need to uh call the presenter thank you mayor Commissioners um currently or agreement with or after cir or operator expires um this month in April and what we propose to you is to extend for a one-year exercise that one-year extension agreement um for a total of 1,925 688 thank you okay and we already went through the same presentation uh to for the lack of time we won't do that again thank Perfect all right could I just ask him a question before he Lees sure uh we were just brought which I haven't had an opportunity to read additional information in reference to this what is this additional information could you tell me what it is good evening again the uh additional information that you have is the uh renewal or extension of the first year of the original agreement um the agreement that was advertised and awarded back in 2021 is a three-year term with two oneyear options to renew and so what we're doing is renewing that one year we've co- turn Med uh a few months ago when we came to extend that route e for 6 months we co- termed all six routes and so now um we're going to extend or we're requesting to extend using utilizing that pre-approved first year of the renewal okay in that original contract excuse me Mr Mayor let me just finish this thought um in that original contract does it is it subject to not the pricing and not the contract being um terminated prior to a year but is it subject to to perhaps changes in the routes during that year can we do it of in I just got it I no no no and I understand I read it twice sometimes most solicitations um have where we can make changes to the uh frequencies routes um some of the service levels I'm contended upon the being in the same scope okay so therefore it's just the renewal and the price that it's going to cost us yes it's a renewal of now six of the routes as opposed to five and one we've co- termed them um the date is through April 30th and I added an extra week there simply you know just for kind of continuity if we continue to do another year if we um go back out to Market if we purchase trolleys whatever we doing this next year um it'll be easier uh financially and and with the billing to do it at the beginning of the month so um originally it was through uh the first one was through April 8th and then the route e was through April 24th so when we co- termed them I moved it to the end of the month and um during this year we're going to do extensive market research regarding the um whole life cycle of the the cars that we're using which are outdated um uh the route optimization you know if it passes or however we do over the next year will be utilized to further um assess our next moves for either the final OTR option to renew or if we're going to go back out to Market and during that years you your study will also show you that if you go out to bid and maybe they have their own trolleys or a whole different setup we'll do that study so we can make a educated our department is going to go out extensively to find out um about all of that kind order no problem okay um Madam clerk we need public comment good evening again Bruce lamberto um what what's amazing to me is on the size of this contract 1.9 million again there's no no explanation of any any of the costs any any of the the the capital expenditures fuel there's no no no PowerPoint no handouts no no no information other than a price that we're that we're agreeing to too um it is an optional renewal so I understand that part so we are doing that but again we got this interface that's going to be taking place with Miami Dade they may come back and eliminate a route they might say hey you know what this route over the Eastern Shores we're not going to support that we're not going to do anything with it I think you want that option to be able to do make that change if we have the study like uh commissioner Smith mentioned you know that we if we did have that study it takes 16 weeks but you're extending this for 52 so what do you do when if they say well we can eliminate the uh the Eastern Shores route where our uh determination is that there's no Riders then you're still stuck with this contract can't we go month to month at this point I think uh because of these impending changes there's no reason to do another one-ear extension to this um it's puts us in a in a in a bad light it takes the flexibility out of decisions here what this board can decide to do um you know it's again this is continuing maybe some of these routes as commissioner Jean had said and and florman their routes are full all the time keep those two we got we have those routes those those routes will stay probably forever but I can tell you if you want to come over and join the one on Eastern Shores it'll be just you and me on the trolley I mean that's that's pretty much what happens there and it's just just we could repurpose that money for any kind of traffic improvements throughout the city that money could be used for any Transit improvements that the the 80% of the money only 20% has to be used for actual trolley the other 80% can put speed uh bumps in your on your street traffic circles on your street uh you know traffic calming repave streets that are need repaving and that Transit tax money will pay that um so don't limit Yourself by signing this one-ear extension and then takes all the flexibility out of what what this board can decide later on in the year six months from now five months from now when whenever the study comes back from Mii Dade thank you okay thank you anyone else here to speak okay let the record reflect no one came forward and the public comments closed mayor if I may clarify something cuz I I want to make sure that we all are are speaking the same language here Miami Dade is not going to evaluate the trolley service or the routes so they're not going to evaluate whether Eastern Shores gets another route or or not or anything like that they're going to look at their existing route um to my knowledge Miami day transit does not go into Eastern Shores and I may be wrong um staff can can take a look but um they do for for one for one or two stops um and so they're not going to be looking at what what routes and so to determine if a trolley needs three on one route or one or none you would need a study right so you know we're it almost feels like we're talking the chicken and the egg at the exact same time and saying we need the result of the study to to to change something but we don't want to do the study because there might be change later you know I think we need we need to have a a a realistic expectation of of what we're doing um and what this service is is meant to to provide um from from what I've seen um we have regular users of the trolley at all times um the users that go to Eastern Shores which apparently is is where we we want to be talking about that route sees about 1,800 Riders per month um those who originate and end at Eastern Shores mainly go to the inter Coastal mall and then go back home um so you know we could start picking apart different routes because we don't feel that it's overly utilized or not but then we're just throwing a dart onto the wall and seeing maybe that's going to stick because in order to really determine is this an effective use of the route or a stop you would do a study so you know I I would just ask that I think the when we're looking at the service for for the trolley um as as our procurement Department director um mentioned we consolidated uh cuz we had two different contracts cuz we added an additional route we Consolidated that earlier um in this fiscal year I think it was October if I'm not mistaken or or maybe around September time frame um and so now they're all in in the same that's where we saw the increase the hourly rate for the driver um which is essentially 75 um and and our procurement director um or or our Public Works director can speak to it um includes and the bus it includes the the maintenance of of the trolley it includes the fuel it includes everything associated with the operation of the troll you said the driver but you mean the the the whole package the whole package is $75 hour it is our trolley it's everything that goes but the maintenance we don't know all the trolleys well they're lending us one from what I we own out of the six we own five right okay we are leasing one we have now been in communication with the with the town of Miami Lakes and they are going to donate two mini buses those two mini buses um will um we're going through to make sure that they're they're properly maintained and all that kind of stuff um and that will allow us to eliminate the least um trolley that we have oh okay um when do that take effect once we finish the inspections and we're able to take take over the um the the vehicles um I don't have an exact date uh but we're working through that with um with um the town of Miami Lakes and we also have to make sure that they have the proper Surplus um to get rid of the vehicles and US accepting so there's there's a little bit of of the paperwork on there um but overall um I think the service that we're providing for the residents there we got to remember those who use transit services you you have two different classifications you have what is called a choice writer a choice writer is someone who for the most part will probably be calling either Uber or Lyft or freebie or decide to take their own vehicle those who are constantly committed to mass transit such as the bus and such as our regional trolley Network for the most part often times don't really have a choice right and so we we need to be able to identify the differences in there and again it comes back into what I mentioned earlier what is the expectation for the services that we're providing and and that's something that you all need to kind of make that decision on um and then we can Implement what it is that you all want whether it's keeping whether it's removing whether it's um adding six more routes whether it's only adding one route or you know only keeping one route whatever commission wants we can definitely move forward with but what I would ask is that you have an honest look at what the expectation is because if again the comparison is Miami Beach and Miami you're never going to get there no matter how much money you throw into it you don't have the resident capacity or the tourist attraction that both those cities are to supplement the numbers that they see within North Miami Beach okay so I I I think that um what I'm hearing and and let the other Commissioners CHP in on that but I think what I'm sort of hearing is is that what we don't want to find out is that we go ahead and we spend 107,000 on a study and then we come to find out that the next day week or during the study they put a second bus going through Eastern Shores and that changes everything so we want to just make sure that that we're using some degree of well that's not a good example exle CU they're not going to add another that's my example it doesn't matter it doesn't matter if it's a good example for you or not I'm just telling you what my example but mayor during this during that study during those 16 weeks we would be talking to Miami day transit who is also telling us that they're going to get into that and we would be coordinating that and we would be sharing that information with them and when Miami day transit does that they hire companies like um Chen Moore um and um Kimberly horn and so forth to do those type of studies for them as well so it's not like they work in a vacuum let's let's hear what the what the other Commissioners have to say about what their concern was with the uh with the study also but talk abouty now we're talking about the stud the he brought up the study he's talking about the study so he talking about the study he's talking about the study I understand that but I want it I want he's asking for some Direction so he knows where to proceed from here he's asking while we're convened then we can all talk together mayor and and let me clarify I appr no sir no sir what what I'm saying is that the extension okay when we're talking about the extension of The Trolley system um comments have been made either from the public or or anyone else um with regards to maybe we don't need this route or we need three on this route and one and and what I'm going is we're having that chicken and egg type of conversation which comes first right and so I'm trying to help clarify of the timing what each of them does our recommendation from staff is to continue with the services for the next year um to to continue and in that year we look at whether we need to go back out or whether we're getting the best price right now or what that would look like uh but our recommendation is to renew that contract for a year okay Mr Joseph me thank you Mr Mayor um well I have a couple of questions I know when when they working on a um and we're talking about the Charlie and extending the the contract uh when they were working with the better bus program whatever they call it they did a lot of community engagement reaching out to the community to see how it would they would be impacted um going month-to month and uncertainty behind all that it to me it's kind of counterproductive and not really being uh as as scientific as we could be because we're taking a cursory look and saying well I don't see many people on at the end of this line so must must not be a lot of people using it um and I'm trying to I'm trying to I'm trying to understand that perception because I know that it's you know a couple of my colleagues on here see that and and what have you I'm thinking that is it because that's the end of the line or or what have you and and I'm just trying to understand your perspective because you're saying that at in when it it's at the end of the day when it's in eastern shorty you don't see that many people coming off is that is that basically what you guys are seeing I I I know that the I know that the manager rode the route and I have never been on that route so I can't tell you for with any certainty of what happens in no but I I I've he I've heard different people from at least one particular C there's certainly a resident that St that says that you know they they they they don't see that many people coming off from their cursory standpoint right and um there must not a lot of people and that that means at least from his assessment there must not be that many people utilizing it but we also have data and GPS and everything else that I mean I mean are we going to believe the numbers or the the the data or we going to believe I guess the the standpoint of I mean uh yes a vocal a vocal resonant but you know a single perspective at least from this at this instance saying this is what I see so I don't I'm just trying to understand I'm just trying to to Gras that cuz I don't want to dis um be disingenuous to his perception but I also but I also want understand like are we trusting data are we trusting numbers uh and if not are we cons are we then saying that the data is fraudulent or it's not correct because I mean I understand that um proel put it at their own expense this particular this particular technology to track it but it's still there and if it's not what it is supposed well at least what it's telling us I mean I would like to have that type of answer I mean I I can't have a resident saying hey I don't see these people here and we have dat saying something completely different it just seems very strange to me and if he sees it this way I don't know how many other res might see because they're seeing it from like the end as from the end end of the line and and and that can promate and that rumor can continue on and it can expand I I don't know that that's the issue right now but but we'll find out as we as we let them speak I well I'm saying this because like this is not the first time this is brought up at least towards I know I don't think anyone's doubted the data that from what I heard but no I mean we had a resident saying the data Maybe we have a resident that's doubting the data but this is us commissioner Smith just testified as to the ridership is that how I mean I I've ridden the trolley the trolley when I rode the trolley nobody was on there I had pictures on my phone of the trolley I understand there there's the trolley is definitely so important in North Mii Beach I understand what the mayor saying and the manager saying in his frustration 120 % Phyllis what are you doing you're saying you need the trolley but we don't know where to do it and you don't want to do the study well well I I we haven't determined the for so the thing is is that if the if the trolley is going to be continued then I think that in the near future definitely we have to do a study absolutely no question and again it's the Chicken and the Egg thing and and maybe we voted on one before the other you know maybe you know so maybe we should have done the whole thing in the reverse order and maybe there also I want to say one other thing I think there in my case I think that there's a little bit of consultant burnout number one cons everything's a consultant everything's been a consultant the last few months there's no other way there's no other way I understand there is other ways but I understand the necessity of it number one number two the $117,000 is like the mayor said it is a a shock number that that that when you read what the study's giving you for that 107 it's not adequate that's why I wanted to table it let's get what we need so we don't have to have a study on top of the study for another 65,000 so it would it be a possibility of us I guess um I get extending the the contract but making it like um able to be amended depending on what the what the study yeah we she just said it could be that was my question yeah wait wait wait everybody can I give a point if you read the the document either party can get terminated within s days Andi in Time Yeah by giving each other seven days that's the contract that we haven't voted on yet that's why that's the contract that you're caining about being a year if anybody either they want to get out they can terminate us if we want to get out we can terminate them yeah Mr Mayor yes do we have a motion do we have a motion to approve this yet no we don't have a motion to just one second um is Mr attorney is that a fact about the 7-Day um Escape yes it it's it it uh see where's the item the termination for convenience in there we draft into and so um on page 59 of the document uh subsection uh D um upon completion of this agement or in the event of termination by these uh public records I'm sorry um no that I'm sorry um that's the public records law provision but there is a a termination that's a termination by either no it's not are you saying here D this is termination by either party no no no add that um commissioner Smith mentioned the design portion of the of the contract how does that work work in the overall suggestion of what of what the study will show so she mentioned that the design is not included in the 107 what would the design be in essence would it be the suggestions of the changes or the implementation of the change um thank you commissioner what the study provides is the proposed changes proposed routes propose modifications that their transportation and analyst and data provides that is what they provide that is their their documents there is no design plans that they have to sign and seal that is the purpose of the route optimization and bus stop study so they'll look at both do we need to change add decreased routes do we need to change the way the traffic flows do we need to add more stops remove stops that is what we're paying for 107,000 implementation would be on our side like no they also include uh um meetings with the public the so that that's includes everything it's a turnkey operation oh okay and and as far as the stud's concerned then um I guess we could just bring it back next month yeah once we go through and make sure everybody beats it up and does whatever they want make sure that you know we're only gonna be a month behind no no to to to your to u to your point Mr like I said she I think the design portion at least that question is important to me as well at least to get some type of clarity and you know a month U delay or whatever whatever the need might may call for something that's fair given that given the commissioner's concern and the fact is so much money and and how people and and I think in the overall scope of things I don't think it's a amount of time that's going to be detrimental so um you know unless someone on staff feels otherwise but uh okay so then we're good with that Mr manager um I just want to call your attention to the time um and what I'd like to do as these items have been taking a little time I would like to know if there's anything that is of significant importance that you might want to um take in a certain order can we consider 11.8 and N the two water issues uh 11.8 11.9 um the other ordinances are second reading um and and also 11.6 which is changing the qualifying date and runoff election based on um the clerk's convers with um uh with Miami date elections of America authorizing the use of the city's logo and other marketing tools to advertise to the city's residents warranty plans for repairs of external water lines external sewer lines and inhome Plumbing on residential property and authorizing the city manager doign need to do all things necessary to effectuate this resolution providing for conflicts providing for scribers errors providing for severability and providing for effective date okay um would uh presenter speak yes good evening Andrea Suarez aasa NMB water director we actually have Ashley shaori she will be doing a presentation from the national leag of cities to explain a littleit bit of what this program is and the benefits to the city I was wondering who that was I promise to keep it short for you all um thank you um I know I have had the opportunity to talk with two of you in the past at different National League of cities events but um my name is Ashley shaori and I do represent the national league of cities service line program our program it is the only one that's endorsed by the national league of cities but the company I do work for is called hom serve and we admit minister of the program um we've been endorsed by the national league of cities since 2010 and been operating here in the US um for the last 20 years providing services to municipalities all across the country um but what our program really is just designed to do is to help address um aging public infrastructure we know your city is doing your best to either upgrade or maintain your public water infrastructure but the homeowners portion of these lines were kind of being forgotten about not on purpose but we know there's only so much that you can do on that private side so that is why the national league of cities went out and did research they wanted to make a program like this readily and easily available to cities all across the country they went out did the research and we were the company they chose to provide the program so what we actually do here is we partner with the city to make our completely optional program available to your homeowners there and we provide your homeowners with optional protection on their external water lines external sewer lines and their inhome Plumbing we always provide these services with a complete TurnKey approach for the city um we know the group here has more than enough going on um so we handle all the aspects of the program we do the marketing the billing the claims management and customer service and there is no cost to the city if you choose to participate and the city does receive a revenue for their participation what I though always think is the best benefit of this program is that it really does help to raise awareness pretty much every city that I speak with I hear that same thing that if a resident does have some type of issue on one of these lines a lot of times their first call is to someone here um and then your staff is left to use your city's time and dollars to send someone out only to determine that the issue is on a resident side of that line and be the unfortunate bear of bad news explaining to your homeowners at the worst time possible that these lines are not covered by the city or typically their homeowners insurance so that is kind of why I think of this program as a free public awareness campaign because all of your homeowners do receive a letter in the mail from us and the beginning of that letter is educational so that way even if a homeowner doesn't enroll in the protection at least in the future you know they're well aware of exactly what their responsibility is and just that your city did try to take that proactive Approach at helping to educate them of that is the cost very low so yes the cost is very affordable for your residents we offer um three completely separate and voluntary protections an external water line external sewer line and an inhome Plumbing the external water line coverage is $5.75 a month if a homeowner chooses to enroll the external sewer line coverage is $775 per month and our inhome plumbing is N9 $9.99 per month they are all separate all optional our external protections the homeowner receives up to $8,500 towards each and every incident um with no service fees or deductibles we always use local area plumbers when doing the repairs keeping the money here in your local economy making sure they follow local codes um and again up to $88,500 per incident um our inhome plumbing it is up to $3,000 per incident and really by partnering with us you're just giving the residents these options that they otherwise would not have but it is up to them if they choose to enroll um and then the big thing everyone wants to know is what's the city's involvement is so we typically um Market this program by direct mail um we send a letter out to your residents two to three times a year no more than three times but that is the city's involvement is we customize that information specifically for you we work with the group here you know your residents better than we can um to customize that specifically for your homeowners work with you on edits and changes and we never send anything out unless we have the city's approval prior um the information that we do mail out does include the city's logo or letter head so your residents know this is a program that you're making available to them that's endorsed by the national league of cities um but it has all of our information on that letter our phone number is on there so they call us with questions or to enroll same thing with our website they can get a lot of great information or sign up through our website or they return the letter to us um as I mentioned we know you have more than enough going on so we do handle all the aspects of the program the marketing the billing the CL s and the customer service and as I did mention the city does receive a revenue for their participation um you actually receive 10% of all of the premiums collected annually back in the form of a revenue in addition to that um you do receive $30,000 um for spread over three years um and I know I tried to keep it quick but um really by partnering with us the city's just making this option available to your homeowners that otherwise would not be but we handle all the aspects of the program um and I don't know if the group has any um questions for me this evening um at the moment I think we're okay we might come back to you in a minute yeah um and Madam clerk public comment huh oh we need a quum here does anyone the league conferences and uh she does she is persistent I'll give you that much I sent it to the manager I sent it to Andrea um this is an excellent program it's a it's a no-brainer I mean it's very simple for us to offer it it's a great program for a resident who you know that has plumbing problems um there's no predeter anything let them sign up and boom they got a plumber for $9 a month or whatever the the cost is it's it's a no-brainer for us $23.49 is the cost a month of all of them well sewer a lot of our houses don't have sewer okay okay I have a question yes go ahead okay there's a few questions number one on number nine where it says modification because this is very similar to in real estate years ago we used to offer uh Appliance uh contracts to homeowners modifications or amendments entire agreement it's really got a conflict as far as I'm reading it I might be reading it wrong but it says except for the list of available products under the agreement which may be amended from time to time by the parties in writing and without signature any and all of the representation and obligations of the parties are contained here in and no modifications waivers or Amendments of this agreement ment or any of its conditions or Provisions so it's either no modifications or you can modify it that's sure so typically we only make the products available to your residents here that are specifically outlined in the agreement so that's the external water line external sewer line and our inhome plumbing from time to time we do have partners that have started with maybe um inhome Plumbing is a newer product I don't I've been here 10 years it's been a product we've been offering for 5 years so a lot of our older partners are adding that now through an amendment um we also offer like Heating and coaling um that people may add on at a later date um that is through an amendment to add additional products to the agreement or if say we create a new product in the future that might be at an interest to a city they can add that at a future date okay now the next thing I wanted to know is that um it says initially the company anticip Ates offering the interior plumbing and drainage plan um through weapon phone via inbound phone or web only sure um initially for how long so typically um just to give you an idea of how we Market the products um we typically start with the external water and sewer line protections because those are the most interest to cities um because um homeowners are calling you um because that's connected to the public portion the inbound Channel means we typically don't Market the inhome plumbing through direct mail until a homeowner enrolls in the external products but that doesn't mean it's not available they can call us at any time and say what products you have available we'll tell them all three or when they go to our website they'll see all three I see so so you're not pushing the inbound correct because that probably had many more calls it does have very high claims but also um the uptick through Direct Mail is lower just cuz it's a higher price point product so this is the question I want to Broach to my board do we want to collect 10% from our residents that we have a service I understand that we collect a lot of things we collect on the signs on the lighted signs Etc utilities but this is a resident charge and these people going to utilize it that really is an extreme expenditure so if we would to elect not to take the 10% would you would they get a lesser fee they do if you do not re um if you do not collect the 10% we actually decrease it by 50 cents per product per month 50 cents one should be 57 cents one should be 77 cents and one should be a dollar and and and the the billing um you guys build the resident directly that is correct we don't collect through our billing no we handle all of that we do know a lot of times people use the revenue to go back to the community that's not a it's not a requirement of the program I'd say about 70% of our partners receive a revenue 30% don't um but a lot of our partners use it to help residents that maybe are having trouble paying a utility bill for month to month um or maybe didn't enroll in our program and have an issue with their line um they kind of will use it for those type of things but it's completely up to you so what's the tax it's $23.49 if they take all three but what what's the tax so it that's the cost um that's the current cost there's not tax on it in Florida that's just um it says any monthly fee plus applicable it's the same agreement in all in all states um certain states require taxes there's nothing additional here right Florida does not and this is completely up to the resident to decide if they want it or not so I understand you know so no one's holding a gun to their head if they don't want it they don't you know they don't have to have it something that they see value in they can get so it sort of seems like a win-win across the board so anybody any other comments on that no I had a comment I think we can always find creative ways if we don't want to quote unquote pocket the The Profit to invert it to some kind of benefit to the resident um my question is about Outreach and good to see you again um the Outreach as it relates to how will residents know that we not provide this service sure so we typically our Main Avenue is through direct mail um but I know when we discuss this um maybe in Atlanta too um that we had the opportunity we get we can get the word out a lot of ways so we can do it in press releases newspapers websites social media um none of that's a requirement of the program but we do know a lot of um cities want to do additional Outreach and we will provide all those tools we can create unique things for you um you know we've done press releases even just I was um in pompo a couple weeks ago um we they wanted information for their billing office like flyers and signs things like that so really whatever um is the way that you currently get the word out to your constituents we can kind of customize something specifically for do you also customize language so T we can mail in Spanish and English um we have a um we have a language line that speaks any language um but we can also customize um we don't have a full customization currently of Creo but we can do just a line in the letter like that says call this number to get someone speaking of your language so okay and and one more question that I what do you have a troubleshooter that if people see our logo and think we're the one supporting it and they call the city do you have a troubleshooter number that we automatically just tell them we do we will do a training call with your staff internally most of that call is just so everyone has our phone number but we do find if there's information on your website or social that helps to direct them to us with questions as opposed to the city um as well as um you all will have an account manager and me as a a point of contact at all times and their contracts have your number on it not the city's number right correct only our our number and our website right and and I had walked away so um I apologize if you already said this is this going to be only for North Miami Beach or it's for all our customers the entire service area yes okay and the Weare program is just for North Miami Beach right the so the Weare is for the entire service area as well what we are doing right now is because we have arpa funds those arpa funds are going to n&b customers what we're getting through donations and other things those are going to the other like Miami Gardens uh unincorporated Miami date where we still get so the golf tournament as an example last year got us $33,000 we're doing the golf tournament again this week we're about at $60,000 that we're collecting those are for others okay because I thought maybe we can put the money back into we care but then um my question is can we even though we're having other customers can that 10% only go to North Mii Beach or does it have to go to well if if they're paying because it would be customers across and you know I would say that if we get that 10% we also do it across the service area okay okay we could worry about that when we when we see what's involved yes well no because I I might not vote depending on what's involved so okay don't roll your eyes at me I would never do that cuz you I I live dangerously man I live dangerously be careful CU I hit dangerously I wouldn't do that I mean um I have a question and and and it's regarding the Weare the share program um that and because it was brought up during disc like in you know the process of the discussion and uh you know we have I've you know I've reached out and talked to uh Marlene in regard uh we had a resident that was trying to get some type of um benefit from the we care Share program but I was trying to is there a policy guide do you have a detailed policy we do and um it because I when I reached out or when I when I was inquiring about this resident like they they couldn't find something online where it shows specifically um what the what the protocol is for applying and is it is it readily available online or if you can go we do have the brochure that shows what the application what you need to apply and and it is online it is it is online so if if you don't have it we can send it to you and we can share what we're going to do is probably do another campaign but I know with some of the city services they're also pushing through the city Side as to where some of the city services are and the we car is one of them yeah well I know we have our Prof funds that are tied to that and and uh and I know a lot of residents would would love to Avail themselves but I also like can you just for for my own edification and people that that are probably up can you explain the We Care uh Weare we care to share program and the I guess a threshold to to to I guess Avail yourselves of that yeah so there is a a lowincome household that you have to apply for the arpa funds and for n&b we changed it a little bit because we had those funds so for those n&b residents we are giving now $1,000 and we raise the household so so that way more people could apply so what's the income level I would have to check because there's uh different levels based on how many people live in the household how many people are working how many people live there so those are the different levels and we have that already in a brochure that shows and the reason I'm asking this is because I know because of inflation certain things I would assume that the threshold would have to be raised up a little bit higher because and we did and when was the last time that was updated we updated it probably last year okay okay and they have that information downstairs and L yeah I I just didn't know I don't know if it was when we first got the ARP two years ago or three or however year however long ago it was or has it been continuously been updated based on CPI in that regard that's that's what I'm saying so so that's what we're looking right now we're analyzing because we're coming to the end of the arpa funds they have to be spent by 2025 so we're looking and and seeing if we're probably going to have to update a little bit of how much we're paying if we're paying $11,000 right now maybe we're going to go up to 2,000 to be able to spend some of those funds and be able to assist some of the residents not all the residents apply actually the majority of the people that we have are from Miami Gardens and unincorporated Miami date and how the how much money do you think is currently um in the account that's dedicated to this that we care for We Care to share program currently so I know for phase one we had $250,000 and I understand for phase two they gave us again 250 and how much so how much has that how much has been utilized up to this point maybe 100,000 or less I don't want to interrupt you but we're running out of time and it's not really that we want to try to keep it to this item because we got a few more things to get done so I I'm not trying to cut you short I'm sure that the director would be happy to take your phone call anytime abely and we can share the brochure with you and we can provide the numbers of how many people have applied what we want to make sure is that we're being fair and and that everybody gets a chance to apply but if most of your people are from Mommy Gardens and unincorporated before you raise how much they get see what else we can use it for for North IR Beach residence so the arpa funds are only for n&b residents they don't apply to outside residents so we've heard this is any any else can we call the question just one add-on all right do it I make motion the only add-on that I have is if if and when this is approved that we do an in-house informational session that allows people to get the firsthand um knowledge of what's going on and if they have any questions and if they want to sign up on the spot that we make that contention on approval perfect and what happens if the if the public just is very upset about it how how do you terminate it if you don't want to use it they don't pay for it they just don't buy it well but still we want to stop the advertising of the program so I can just in our agreement we don't send anything out unless we have your approval prior so the next mailing wouldn't go out unless then it got amended to 10 years this new one we decided to that the terms had to be change because we no longer do wholesale with Miami dat County we actually have our water treatment plan that supplies our entire service area but what we do is we do have emergency interconnects and we also are doing the sewer billing for uh Miami date because they do have sewer in our area and Sewer is built based on water so that's what the contract in front of you is is just to update the terms and conditions okay so we have more income left let's just let's just um so they pay us$ 12255 for each uh sewer bill I have a question sorry all right let's just do public comment real quick first yeah any anyone here from Madam clerk I'll let you do it just for the record anyone wishes to speak on more money or we're paying less money or is there an increase in the in the water finances over this so the the increase goes based on the CPI because we do charge them for billing for the sewer service so each sewer bill that we send for them we charge them 12255 so now we're doing sewer and obviously collection of that so it it'll go up because the CPI is going up so last year we were charging $112 this year we're charging 1255 and it'll keep going up but we also use their water no we don't so the only time we would use their water or they will use our water if if there's an emergency I see so we have emergency interconnects with different cities around so we have bal Harbor Hollandale North Miami that if there is an emergency we'll sell water but we have the option of purchasing as well okay thank you very much you're welcome mtion I had a question um for currently with the existing accounts that we have right can cities opt out of using n&b water no that would have to be an agreement so right now there are there is Ser service agreements so obviously there would have to be a discussion and right now the the pipelines or anything that is right now it's owned by uh n&b by us correct so if anybody wanted to opt out they kind they would have to buy out so if they wanted to go to the county as an example they would have to go and they would have to agree to purchase our pipelines to purchase our pipelines yes we'd have to agree to sell it to corre if I may just the law says currently that if a water line is within X number feet of any property you must hook up to it so whoever is the owner of that water line is the beneficiary of that mandatory hookup requirement the only way that we would not be the one is if we sold our our system correct okay if and I have the letter um that for us to revise our qualifying time because um they need the information back from us no later than August 23rd currently that's just one portion of this item currently our um qualifying time is from um August they will get it so to August 31st which it would make us not make um our candidates would not be on the ballot so because this is an ordinance it has to go through this um meeting as well as the next meeting so and they need it so it has to go to two meetings so if you push it over to the next meeting which is April they have to get it again but this is a time I understand that but from just because this is dealing with a charter issue and but it's a first reading we're going to have a second reading and we're not the only and I'm not an attorney I'm not trying to um be one but we're not the only city here that was that had to do the same thing too and they all went through the same process not the say to follow the leader but and attorney Haron here was with us and I I'll make this very clear this is your ordinance you can do with it whatever you wish you can vote it up you can vote it down or you can continue it okay so so basically I agree with Mr Joseph uh commissioner Joseph but I had asked that question and the clerk checked into it because it is a charter issue and doesn't the public have to vote on I asked that question as well but I believe like the clerk looked into it and said that the attorney could change it because the county is saying they can't perform their duties if we follow the charter as it's written I just for for some type of legal prudence and the fact that I know we're in transition position I'm asking if we could table it um I I would like to like just like how you had some concerns regarding 107,000 or what have you I think that ju it is first reading so but I'm still asking for the table and we can discuss in the next meeting okay so the only thing that I just want to make sure of is that it's not going to put us into a bad situation down down down the road that's what I want to ask the that's what I'm asking to T I've never asked for this because this no no no I get it I get it but what I'm asking I'm asking the clerk and the attorney cuz I don't want come find out that we table it and then for some reason we can't have an election no we're going to we're going to this our election has is set this is a change to it this doesn't this doesn't undo what we currently have no but if they can't put it on the ballot it is if if we're not on the ballot then we don't have an election no I reading in May and that passing in May would that delay you to getting whatever information to the elections department so that you can move the qualify qualifying date up I will confirm with them just just confirm and I I want to say something as well the manager's office does a great job of creating memos whenever things like this happen or anything that is per into the commission and I would have hoped that the clerk's office would have had the same professional courtesy to provide adequate information to the commission um so the fact that you have didn't do that speaks volumes but I will essentially what occurred here is um there's a group when the drop um benefits were introduced um years ago um a certain category of of um officers um that were hired after a certain date have a different timeline of when they can enter to the the drop and so this is just uh correcting that that error and putting everybody on the same timeline okay I have a question I have a question about the job I think something I me asked the city manager about can in can officers come back uh online after they've met the job deadline who makes that decision as it relates to can they be afforded the opportunity to come back um many officers um once their they're they retire from from NMB they come back as Reserve officers which allows them to to work no she can come back period and and so um they're they're used many of them used in that capacity um often times we do um end up rehiring officers um typically on a part-time basis but um deputy chief kamacho do we H or has the city ever rehired a sorn officer who completed drop into a full-time sworn officer position no sir grieving everybody no not at all just part-time are we allowed um or or does the drop program prevent a certain amount of time before they can be considered for fulltime they become contract employees is what they do you want contract okay this is your moment to shine you've been here all this time you know what I mean yeah um so regarding the drop once an employee enters drop in complete they are no longer able to become a paid employee they have to work 20 hours or less no they can't even do that they they have to be a Reserve officer so period no yes that's why they go somewhere else well that's why they retire and they people that come at night when the roing and those are they're reserved they're reserved all right are we um ready for roll call go ahead and um enlighten me please The Reserve officer and an off duty officer what would be the difference in uh with those two the difference between an off duty is a regular off an off duty is hasn't entered the drop yeah okay so a Reserve officer the the way it happens is they're allowed to come and work a couple of the details here but off duty is usually paid by the businesses that's what that means okay but an off duty has to be a full-time officer that's working off duty or a part-time officer working off duty it can be both it can't be a Reserve officer that's Can it can be yes okay so I just wanted to make that clear a Reserve officer can work off duty detail correct thank you no there's no different rate the off duty rate is the same typically they still have a typically officers wait wait wa wait wait but HR just said they can't work they're they're not employed by the city they're they're paid directly by the um whoever's doing the bus and typically these what's typically the businesses that currently I guess participate with this particular program are what like um adult entertainment well I don't know sure Mr Mayor it could be special events it could be restaurants it could no I was thinking about Publix I I didn't I was thinking about that but hey but I just wanted to it be any business that is looking uh to to hire an off duty officer pretty much and uh the city the city through the off-duty uh detail um does the city receive a portion of that um rate that that hourly rate right yes there's and what do the portion of that what is the portion is there a percentage or is it worked out no it's it's a it's actual amount major nichels is it8 there you go okay the city gets $8 per hour work off duty and where are we with the quota of officers I know we have like 3 minutes left but where are we with the how many officers do we currently have and compareed to what we actually have our
